1That it is an essential function of the State to protect plants from damage caused by pests, as well as to regulate the use and handling of chemical, biological, and related substances in order to protect plant health, human health, and the environment.
2That for the national economy and food security, the phytosanitary protection of products of plant origin is fundamental, compelling the State to adopt all necessary prevention, surveillance, and control measures to prevent the entry and dissemination of pests that endanger or could cause harm to people or the national agricultural heritage.
3That the State, based on the framework of the Agreement on the Application of Sanitary and Phytosanitary Measures, must adopt those measures necessary to protect the health and life of people, animals, and plants, basing these measures on an assessment appropriate to the circumstances and the potential risks involved, ensuring that these measures do not constitute obstacles to international trade.
4That the Ministry of Agriculture and Livestock provides a great diversity of services to agricultural producers through the State Phytosanitary Service (Servicio Fitosanitario del Estado, SFE).
5That in order to guarantee a permanent and effective operation of this Institution that provides regulatory phytosanitary services for the protection of plants and the use of agrochemicals, among others, the timely replenishment of inputs such as equipment, reagents, materials, and the hiring of the suitable and necessary human resources for the performance of the services provided becomes necessary, such as inspections of plant and agrochemical products, both for import and export, certification of exported shipments, laboratory analysis of these products, diagnosis and control of quarantine and economically important pests, and other services of the same kind.
6That there is sufficient technical evidence demonstrating that one of the main pathways for pest dissemination is through the transfer of material of plant origin, the means of transport for which are luggage items such as: valijas, maletines, salveques, among others, used by people entering the country via land, air, sea, or river routes, which has led many countries, in order to protect their agricultural heritage, to establish luggage scanning to reduce the risk of introducing new pests.
7That to maintain efficiency and effectiveness in the services provided to producers, it is necessary to make adjustments to the tariffs, in order to compensate for the increases in costs that have been generated over the past year, and therefore it is necessary to re-establish an automatic indexation based on the value of the consumer price index of the previous year, effective as of February 1st of each year.
8That the year 2000 was the last date on which article 2 of the aforementioned Decree N° 27763 was reformed to make a general publication of the tariffs for the services provided by the Ministry of Agriculture and Livestock through the State Phytosanitary Service. Therefore:

"Article 6º-In the case of banana, coffee, cocoa, and sugar cane, the tariffs contemplated in numerals 5 and 8 of article two of this decree shall be charged at 20% (twenty percent) of the established tariff." "Article 8º-The tariffs established for each of the services constitute a minimum cost that will be charged whenever the service requested for its verification or performance does not imply a displacement of more than thirty kilometers by the responsible official, counted from their regular work location. Said amount will be increased by up to thirty percent when the previously established mileage is exceeded.

Those services provided during non-business hours for reasons attributable to the applicant will have a surcharge of fifty percent (50%).

The definition of overtime and holidays is as established in the Labor Code.

For the tariffs established for annual fees and corresponding to the State Phytosanitary Service (SFE), they must be paid at the beginning of the period."

"Article 8º-The services for the registration and record of importers shall be paid annually by the interested party. The cost of the registration service in the registry of importers for the year 2009 shall be ¢ 46,575.00, which must be paid at the beginning of the period. Likewise, this amount shall be updated automatically based on the value of the consumer price index of the previous year and effective as of February 1st of each year."

The scanning services for non-intrusive inspection of goods passing as exports, imports, or national transit through the land borders, ports, and airports of the entire country, will have a cost of $25.00 per container.

Those companies to which phytosanitary services related to import and export are provided on a continuous basis may pay for the services rendered within fifteen calendar days following the effective provision of the same. When the company fails to make the corresponding payment within the described period, the services provided by the State Phytosanitary Service (SFE) will be immediately suspended, and the corresponding administrative or judicial collection process will be initiated.

The foregoing provision shall be regulated by the Directorate, jointly with the Administrative and Financial Department, through a procedure.

1Que es función esencial del Estado proteger los vegetales de los perjuicios causados por las plagas, así como regular el uso y manejo de sustancias químicas, biológicas y afines en aras de proteger la sanidad de los vegetales, de salud humana y del ambiente.
2Que para la economía nacional y la seguridad alimentaria, la protección fitosanitaria de los productos de origen vegetal resulta fundamental, lo que obliga al Estado a adoptar todas las medidas de prevención, vigilancia y control necesarias para evitar el ingreso y diseminación de plagas que pongan en peligro o puedan causar daño a las personas o al patrimonio agrícola nacional.
3Que el Estado con base en el marco del acuerdo para la aplicación de las medidas sanitarias y fitosanitarias, debe adoptar aquellas que resulten necesarias para proteger la salud y la vida de las personas, de los animales y vegetales, basando estas medidas en una evaluación adecuada a las circunstancias y a los riesgos eventuales que ello conlleve, asegurando que estas medidas no constituyan obstáculos para el comercio internacional.
4Que el Ministerio de Agricultura y Ganadería brinda una gran diversidad de servicios a los productores agropecuarios por medio del Servicio Fitosanitario del Estado.
5Que en aras de garantizar un permanente y eficaz funcionamiento de esta Institución que brinda servicios regulatorios fitosanitarios para la protección de los vegetales, y uso de los agroquímicos, entre otros, se hace necesaria la reposición oportuna de los insumos tales como equipos, reactivos, materiales, y contratar el recurso humano idóneo y necesario para la realización de los servicios que se prestan, como inspecciones a productos vegetales y agroquímicos tanto de importación como exportación, certificación de los envíos

plagas cuarentenarias y de importancia económica y demás servicios de igual género.

6Que existe suficiente evidencia técnica que demuestra que una de las principales vías de diseminación de plagas es mediante el traslado de material de origen vegetal cuyo medio de transporte son los equipajes como: valijas, maletines, salveques entre otros, empleados por las personas que ingresan al país utilizando ya sea la vía terrestre, aérea, marítima o pluvial, lo que ha provocado que muchos países, en aras de proteger el patrimonio agrícola hayan establecido el escaneo de equipajes para disminuir el riesgo de introducción de nuevas plagas.
7Que para mantener la eficiencia y eficacia en los servicios que se brindan a los productores, es necesario realizar ajustes en las tarifas, a efecto de compensar los incrementos en los costos que durante el último año se han generado y por lo que se hace necesario reestablecer una indexación automática con base en el valor del índice de precios al consumidor del año anterior y que rija a partir del 1 de febrero de cada año.
8Que en el año 2000 fue la última fecha en que se reformó el artículo 2 del Decreto N° 27763 antes citado, para hacer una publicación general de las tarifas de los servicios que presta el Ministerio de Agricultura y Ganadería a través del Servicio Fitosanitario del Estado. Por tanto:

La definición de tiempo extraordinario y días feriados, es la establecida en el Código de Trabajo.

Para las tarifas establecidas por concepto de anualidades y que corresponden al Servicio Fitosanitario del Estado, deberán ser canceladas al inicio del período."

"Artículo 8º-Los servicios de inscripción y registro de importadores serán cancelados anualmente por el interesado. El costo del servicio de inscripción en el registro de importadores, para el año 2009 será de ¢ 46 575,00 que deberán ser cancelados al inicio del período. Asimismo, este monto se actualizará en forma automática con base en el valor del índice de precios al consumidor del año anterior y que rige a partir del 1° de febrero de cada año."

Dicho cobro se realizará al ingreso o a la salida de las personas, según convenga a la administración.

Los servicios de escaneo para la inspección no intrusiva de las mercancías que pasen como exportaciones, importaciones o tránsito nacional por las fronteras terrestres, puertos y aeropuertos de todo el país, tendrán un costo de $25,00 por contenedor.

Aquellas empresas a las que se les brinde servicios fitosanitarios relacionados con importación y exportación, en forma continua, podrá cancelar los servicios prestados hasta quince días naturales posteriores a la prestación efectiva del mismo. Cuando la empresa incumpla con el pago correspondiente, en el plazo descrito se le suspenderá en forma inmediata los servicios que presta el Servicio Fitosanitario del Estado y se procederá al trámite de cobro administrativo o judicial correspondiente.

La anterior disposición estará regulada por la Dirección, en conjunto con el Departamento Administrativo y Financiero, mediante un procedimiento.

Reform of Phytosanitary Service Tariffs and Importers RegistryReforma de Tarifas del Servicio Fitosanitario del Estado y Registro de Importadores

Artículo 1 — Articles 2°, 6°, and 8° of Executive Decree Nº 27763-MAG of March 10, 1999, published in Supplement Nº 26 to La Gaceta Nº 68 of April 9 of that same year, amended by Decrees Nos.

Artículo 2 — Amend article 8 of Decree Nº 31146-MAG of April 3, 2003, published in La Gaceta Nº 89 of May 12, 2003, to read as follows:

Artículo 3 — The services for X-ray scanning or luggage inspection will have a cost of $2.00 per person. Said charge will be made upon entry or exit of persons, as deemed convenient by the administration.

Artículo 4 — All income received by the State Phytosanitary Service (SFE) must be made in cash, or by other suitable and legally authorized means, upon delivery of the official cash receipt, signed and sealed by the officials authorized for this purpose.

Artículo 5 — Effective as of February 01, 2010.

Artículo 8 — DEL DECRETO N° 31146-MAG, DEL

Artículo 1 — Modifíquense los artículos 2°, 6° y 8° del Decreto Ejecutivo Nº 27763-MAG del 10 de marzo de 1999, publicado en el Alcance Nº 26 a La Gaceta Nº 68 del 9 de abril de ese mismo año, modificado mediante Decretos Nos.

Artículo 2 — Modifíquese el artículo 8 del decreto Nº 31146-MAG del 3 de abril del año 2003, publicado en La Gaceta Nº 89 del 12 de mayo del 2003, para que se lea así:

Artículo 3 — Los servicios de escaneo por rayos X o inspección de equipajes, tendrán un costo de $2,00 por persona.

Artículo 4 — Todo ingreso de dinero al Servicio Fitosanitario del Estado deberá realizarse en dinero efectivo, u otro medio idóneo y legalmente autorizado, mediante entrega del recibo oficial de caja, firmado y sellado por los funcionarios autorizados para tal fin.

Artículo 5 — Rige a partir del 01 de febrero del 2010.
