in the entirety of the text - Complete Text of Regulation 30883 Declares the Boracayan Private Category Wildlife Refuge Complete Text record: 10ADAF No. 30883-MINAE No. 30883-MINAE (This executive decree was repealed by article 1 of executive decree No. 39479 of November 10, 2015) THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by article 140, subsections 3) and 18) of the Political Constitution and based on the provisions of articles 82 and 87 of the Wildlife Conservation Law No. 7317 of December 7, 1992, and articles 6, 11 and 27 of the General Public Administration Law.

1That it is in the Government's interest to strengthen the administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of said resources.
2That the corporation named Boracayán del Sur, S. For a total measurement of the fourteen real estate properties of three hundred six hectares eight thousand five hundred fourteen square meters and thirty-six square decimeters (306 has 8 514 m² 36 dm²). The representative of the Corporation Boracayán del Sur, S. A., expressly accepted, to voluntarily submit to the Private Wildlife Refuge regime, the said real estate properties for a period of ten years, as established in article 102 subsection f), of the Regulation to the Wildlife Conservation Law, automatically renewable except for prior notice from the owner or the administration expressing otherwise.
3That the area described above constitutes a very important nucleus for the conservation of wildlife within the management category of private wildlife refuge. That because forests and wildlife species continue to disappear from our environment and therefore from our planet, this management category allows their conservation and management within a framework of sustainable development, serving at the same time as an environmental regulator, through the implementation of a Management Plan.
4That in the technical document presented by the interested parties, it is demonstrated that it is a protected wild area for the protection of biodiversity and that it serves to provide opportunities for scientific research, recreation and education; the primary objectives of this refuge being to conserve and protect the primary and secondary natural forest, as well as the perpetuation and protection of species with threatened and reduced populations of flora and fauna, by virtue of the fact that in the area subject to the application there exists a large number of faunal resources (insects, mammals, amphibians, birds and reptiles) as well as floral resources that merit being conserved rationally and sustainably, to guarantee their permanence within the ecosystems in which they currently exist. The real estate properties submitted to the Refuge were dedicated to agricultural activities in the recent past, and by the will of their owner, will be dedicated exclusively to conservation henceforth, and therefore represent an important area for the recovery of natural habitats and for the regeneration of degraded zones that will serve the development of the flora and fauna present in the zone.
5That in accordance with article 87 of the Wildlife Conservation Law, the main environmental effect generated by the declaration of a real estate property under this legal regime is that, for the purposes of the conservation of natural resources, the general administration of the refuge corresponds to the owners of the real estate properties, which will be supervised by the La Amistad Pacífico Conservation Area, Pérez Zeledón Subregional Office and by the Osa Conservation Area, Diquis Subregional Office, as part of the real estate properties are located in both Conservation Areas. Consequently, the subregional offices will be those that approve all those activities that may be desired to be carried out henceforth within the area declared and submitted to the Private category Wildlife Refuge.
6That by means of resolution number ACLA-P-D- 401 at three o'clock in the afternoon of October seven of the year two thousand two, the Directorate of the La Amistad Pacífico Conservation Area accepted the application for voluntary submission made by the President of the corporation Boracayán del Sur, S. A., to voluntarily submit to the Private Category Wildlife Refuge. Therefore,

Likewise, they will provide all necessary collaboration to the officials of this Ministry, for the tasks of control and verification of environmental policies through the La Amistad Pacífico Conservation Area and Osa Conservation Area of the National System of Conservation Areas, as well as to researchers, students and others who sporadically visit said area in the functions proper to their respective positions, study and research. Likewise they commit to complying with the provisions that to that effect stipulate the General Wildlife Law, the Forestry Law, their respective Regulations, as well as the other provisions in force regarding environmental legislation.

In the event of not wanting to maintain said management category, the owners must express their desire to disaffect the farms by means of a writing presented before the La Amistad Conservation Area, six months in advance.

In the same way, all activities that the owner develops within this National Wildlife Refuge must comply with the legal, regulatory and technical norms and provisions that are established by the La Amistad Pacífico Conservation Area and Osa Conservation Area and the corresponding Management Plan.

A., for which the owner must send to the La Amistad Pacífico Conservation Area, and to the Osa Conservation Area, at least one annual report on the different aspects related to development and infrastructure within the real estate properties, achievements obtained, activities of the next period and the state of natural resources on the real estate property. Said report must be approved by The State, provided that the activities conform to the proposed Management Plan and to current legislation.

1Que es interés del Gobierno fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos.
2Que la sociedad denominada Boracayán del Sur, S. Para una medida total de los catorce inmuebles de trescientas seis hectáreas ocho mil quinientos catorce metros cuadrados con treinta y seis decímetros cuadrados (306 has 8 514 m2 36 dm2). El representante de la Sociedad Boracayán del Sur, S. A., aceptó expresamente, someter voluntariamente al régimen de Refugio de Vida Silvestre Privado, los inmuebles dichos por un periodo de diez años, según lo establece el artículo 102 inciso f), del Reglamento a la Ley de Conservación de Vida Silvestre, prorrogables en forma automática salvo su previa manifestación o de la administración que exprese lo contrario.
3Que el área antes descrita constituye un núcleo muy importante para la conservación de la vida silvestre dentro de la categoría de manejo de refugio privado silvestre. Que por continuar desapareciendo de nuestro medio y por ende de nuestro planeta los bosques y las especies de vida silvestre, ésta categoría de manejo permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental, mediante la implementación de un Plan de manejo.
4Que en el documento técnico presentado por los interesados, se demuestra que es un área silvestre protegida para la protección de la biodiversidad y que sirve para brindar oportunidades a la investigación científica, la recreación y la educación; siendo objetivos primordiales de este refugio, conservar y proteger el bosque natural primario y secundario, así como la perpetuación y protección de especies con poblaciones amenazadas y reducidas de flora y fauna, en virtud que en el área objeto de la solicitud existe un gran número de recursos faunísticos (insectos, mamíferos, anfibios, aves y reptiles) así como recursos florísticos que merecen ser conservados racional y sosteniblemente, para garantizar su permanencia dentro de los ecosistemas en que actualmente se encuentran. Los inmuebles sometidos al Refugio, fueron dedicados a actividades agrícolas en un pasado reciente, y por voluntad de su propietario, serán dedicados exclusivamente a la conservación en adelante, por lo que representa una importante área de recuperación de los hábitat naturales y para la regeneración de zonas degradadas que servirán para el desarrollo de la flora y fauna presente en la zona.
5Que de conformidad con el artículo 87 de la Ley de Conservación de la Vida Silvestre, el principal efecto ambiental que genera la declaratoria de un inmueble bajo este régimen jurídico lo es, que para los efectos de la conservación de los recursos naturales la administración general del refugio corresponde a los propietarios de los inmuebles, la cual será supervisada por el Área de Conservación La Amistad Pacífico, Oficina Subregional de Pérez Zeledón y por el Área de Conservación Osa, Oficina Subregional Diquis, por encontrarse parte de los inmuebles en ambas Áreas de Conservación. En consecuencia, las oficinas sobregionales serán quienes aprobarán todas aquellas actividades que deseen realizar en lo sucesivo dentro del área declarada y sometida al Refugio de Vida Silvestre categoría privado.
6Que por medio de la resolución número ACLA-P-D- 401 de las quince horas del siete de octubre del año dos mil dos, la Dirección del Área de Conservación La Amistad Pacífico, aceptó la solicitud de sometimiento voluntario que realizó el Presidente de la sociedad Boracayán del Sur, S. A., para someterse voluntariamente al Refugio de Vida Silvestre Categoría Privado. Por tanto,

Asimismo, brindarán toda la colaboración necesaria a los funcionarios de este Ministerio, para las labores de control y verificación de las políticas ambientales mediante el Área de Conservación La Amistad Pacífico y Área de Conservación Osa del Sistema Nacional de Áreas de Conservación, así como a los investigadores, estudiantes y otros que esporádicamente visiten dicha área en las funciones propias de sus respectivos cargos, estudio e investigaciones. Asimismo se comprometen a cumplir con las disposiciones que al efecto señalan la Ley General de Vida Silvestre, la ley Forestal, sus respectivos Reglamentos, así como las demás disposiciones vigentes en materia de legislación ambiental.

En caso de no querer mantener dicha categoría de manejo, los propietarios deberán de manifestar su deseo de desafectar las fincas mediante escrito presentado ante el Área de Conservación La Amistad, con seis meses de anticipación.

De igual forma todas las actividades que desarrolle la propietaria dentro de este Refugio Nacional de Vida Silvestre, deberán cumplir con las normas y disposiciones legales, reglamentarias y técnicas que establezca el Área de Conservación La Amistad Pacífico y Área de Conservación Osa y el correspondiente Plan de Manejo.

A., para lo cual la propietaria deberá enviar al Área de Conservación La Amistad Pacífico, y al Área de Conservación Osa, al menos un informe anual sobre los diferentes aspectos relacionados con el desarrollo e infraestructura dentro de los inmuebles, logros obtenidos, actividades del próximo periodo y el estado de los recursos naturales en el inmueble. Dicho informe deberá ser aprobado por El Estado, siempre y cuando las actividades se ajusten al Plan de Manejo propuesto y a la legislación vigente.

Declaration of Boracayán Private Wildlife RefugeDeclaratoria del Refugio de Vida Silvestre Privado Boracayán

Artículo 1 — To declare the BORACAYÁN Private Category Wildlife Refuge, which is formed by the entirety of the real estate properties registered in the Public Registry of Real Property that are described below and which are divided into three Blocks, namely:

Artículo 2 — The owners of said real estate properties commit to not developing any activity that compromises the existence of flora and fauna without the respective permit from MINAE.

Artículo 3 — Said real estate properties will be subject to the Private Wildlife Refuge category, for a period of ten years renewable for equal periods, for which the owners must request it three months in advance of the end of said period.

Artículo 6 — The owner of the indicated farm will enjoy the benefits and incentives established in the Wildlife Conservation Law, for which the La Amistad Pacífico Conservation Area and the Osa Conservation Area, and the involved ministerial agencies, will issue the necessary documents.

Artículo 7 — It becomes effective upon its publication.

Artículo 1 — Declarar el Refugio de Vida Silvestre Categoría Privado BORACAYÁN, el cual está formado por la totalidad de los inmuebles inscritos en el Registro Público de la propiedad inmueble que se describen a continuación y los cuales se dividen en tres Bloques a saber:

Artículo 2 — Los propietarios de dichos inmuebles se comprometen a no desarrollar ninguna actividad que comprometa la existencia de la flora y fauna sin el respectivo permiso del MINAE.

Artículo 3 — Dichos inmuebles estarán sometidos a la categoría de Refugio de Vida Silvestre Privado, por un período de diez años prorrogables por períodos iguales, para lo cual los propietarios deberán solicitarlo con tres meses de antelación a la finalización de dicho período.

Artículo 7 — Rige a partir de su publicación.
