in the entirety of the text - Complete Text of Regulation 30056 Imposes Forced Aqueduct Easement on the property of Mr. and Mrs. Josip Stefanovic, of Tilarán, Guanacaste Complete Text of record: FCF08 Nº 30056-G Nº 30056-G THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE, AND PUBLIC SAFETY Based on Article 146 of the Political Constitution, Article 27 of the General Law of Public Administration, Articles 99 and following of the Water Law No. 276 of August 27, 1942, and its reforms, and Articles 383 and following of the Civil Code.
Considering:
R-1034-98 MINAE, at 12:30 hours on October 21, 1998, granted a water use concession for a term of 3 years in favor of Jagus, S. A. In the amount of 0.08 liters per second to be taken from an unnamed spring (naciente), with the catchment being located on the property of Mr. and Mrs. Josip and Bok Hee, both Stefanovic, to be used for domestic use and watering troughs (abrevadero), with the piping being conducted through the property of Mr. and Mrs. Stefanovic to the site of use.
José Alfredo Gutiérrez Zumbado, in his capacity as president of Jagus, S. A., filed a request for the imposition of a forced aqueduct easement (servidumbre forzosa de acueducto) before the Ministry of Governance and Police, in accordance with the Water Law No. 276 of August 27, 1942.
311-2001 DMG at 12:00 hours on February 19, 2001, after prior compliance with due process, resolved to declare the request for the imposition of a forced aqueduct easement as granted and ordered the payment of compensation by the applicant to Mr. and Mrs. Stefanovic, setting it at the sum of ¢150,000.00 based on the appraisal rendered by the expert appointed by the State, which is recorded in the case file, as well as the payment made by means of deposit No. 04506268, for the aforementioned sum into the checking account in the name of Stefanovic Hoe Josip, owner of the affected property, Mr. and Mrs. Josip and Bok Hee, both Stefanovic, at the Banco Nacional de Costa Rica.

The piping to be used for the water intake shall be plastic and with a flow of 0.08 liters per second to the site of use, said piping must be buried at a minimum depth of 30 centimeters, so as not to cause problems for people or for animals that graze the area. The pipeline or pipes must comply with the technical and legal specifications governing the water concession granted by the Ministry of Environment and Energy(*) in favor of the petitioner herein according to the repeatedly cited resolution. The right of way for maintenance and pipe repair purposes shall be maintained 24 hours a day for the term of the concession.

Considerando:
A. En la cantidad de 0.08 litros por segundo que se tomará de una naciente sin nombre, efectuando la captación en la propiedad de los señores Josip y Bok Hee ambos Stefanovic para destinarla al uso doméstico y abrevadero, conduciendo la tubería por la propiedad de los señores Stefanovic hasta el sitio del aprovechamiento.
A., presentó solicitud de imposición de servidumbre forzosa de acueducto ante el Ministerio de Gobernación y Policía, de conformidad con la Ley de Aguas Nº 276 del 27 de agosto de 1942.
Por tanto,

Decretan:
La tubería a utilizar en la toma de agua será de plástico y con un paso de 0.08 litros por segundo hasta el lugar del aprovechamiento, dicha tubería deberá ir enterradas a una profundidad mínima de 30 centímetros, de manera que no cause problema a las personas o bien a los animales que pastorean el área. Los tendidos o tuberías deben estar acorde con la especificaciones técnicas y legales que regulan la concesión de agua otorgada por el Ministerio de Ambiente y Energía(*) a favor del aquí promovente según la resolución de repetida cita. El derecho de paso para efectos de mantenimiento y arreglos de las tuberías, se mantendrá las 24,00 horas del día por el plazo de la concesión.
