Decreto 29957 — Reform Guaymí Indigenous Reserve of Osa

Said ruling states in part: "The effects are dimensioned in the sense that the declared unconstitutionality does not affect the agricultural practices that are currently carried out under the protection of the challenged executive decree, but they shall have a validity of one year from the moment this ruling is notified; once the given period has expired, said activity must cease in its entirety.") THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF GOVERNANCE AND POLICE AND PUBLIC SECURITY Based on subsections 3) and 18) of article 140 of the Political Constitution and in accordance with Law Nº 5251 of July 11, 1973 and its amendments, Indigenous Law Nº 6172 of November 29, 1977 and Law Nº 7316 of October 12, 1992, of ILO Convention Nº 169, and

1That the Guaymí Indigenous population of the Guaymí de Osa Indigenous Reserve, in an effort to conserve the natural wealth of flora and fauna and the water resources of the northwestern sector of the reserve, has requested the Executive Branch to modify its boundaries in order to be able to opt for land of agricultural suitability (vocación agrícola) and leave that sector, which is of forestry suitability (vocación forestal), under conservation.
2That the Guaymí indigenous community of the Guaymí de Osa Indigenous Reserve, has requested from the National Commission for Indigenous Affairs (Comisión Nacional de Asuntos Indígenas, CONAI) the respective studies for the modification of boundaries of this reserve.
3That the boundary (delimitación) established by article 2 of Executive Decree Nº 22202-G, published in La Gaceta Nº 108 on June 7, 1993, requires a definition of boundaries more in line with the reality experienced by the Guaymí indigenous population of the Osa Reserve.
4That it is advisable to define a buffer zone (zona de amortiguamiento) of greater support for the Guaymí de Osa Indigenous Reserve and Corcovado National Park, with the objective of preserving the natural resources of these administrative units and of the Osa Peninsula in general.
5That in consultation with the indigenous community, as established by ILO Convention 169, in its article 6 subsection a), CONAI carried out the corresponding studies and presented them to the indigenous community, which under consensus endorsed the project.
6That it is fundamental to correct the numbering of the articles of Decree Nº 22202-G, since two articles appear in it under number 2 (two), and to avoid confusion they must be corrected. Therefore,

THEY DECREE:

The Guaymí de Osa Indigenous Reserve is bounded by the following coordinate points:

It starts from the coordinate point N 285 975 E 519 640, point of intersection on the map, of the stream (quebrada), meeting the Rincón River. The boundary of the reserve continues upstream along the Rincón River, until its confluence with the Pavón River at coordinates N 284 380 E 518 440. From this point, it follows upstream along the Pavón River, to its spring (naciente) on the map at coordinates N 284 600 E 510 500. The boundary continues along a spring of the Pavón River, drawn by contour lines on the map, which takes a southwest heading, to the coordinate point N 284 050 E 509 825. From there it follows through the following coordinate points:

This last point intersects the Corcovado River, along which it follows upstream to the coordinate point N 286 710 E 509270.

From there, it continues with a straight line to the coordinate point N 286 925 E 508 710 (Cerro 505) to follow in part along the watershed divide (fila divisoria de aguas) between the Corcovado River and the Vaquedano stream, passing through the coordinate points:

This last point intersects the spring on the map, of the Drake River, continuing the boundary of the reserve along this river downstream, to the coordinate point N 291 000 E 507 650. Point where a stream (defined on the map by contour lines) flows into the Drake River.

The boundary continues with a straight line to the coordinate point N 290 775 E 509 020 (Cerro, 621 m). Point located on part of the watershed divide of the Drake and Riyito rivers.

From that point on, the boundary passes through the coordinate points:

From this point, a straight line to the spring of a small stream drawn on the map by contour lines, at coordinates N 289600 E 510 875.

From there, it follows downstream along this stream, to its mouth on the Riyito River (Nuchi), at coordinates N 290 125 E 512 225. It continues downstream along the Riyito River, to the coordinate point N 288 150 E 517 198. From this last point, the indigenous reserve continues its boundary along the coordinates:

This last point intersects a stream (unnamed on the map) known as Agua Sucia (Nudebrare) stream, on the ground. It follows downstream along this stream to the coordinate point N 287 646 E 518 985. The boundary continues by passing through coordinate points N 287 050 E 519 075, N 286 825 E 519 445. From this point it follows to the coordinate point N 285 975 E 519 640. Initial point of this description;"

However, the System requires consecutive numbering, so it has been created, but without text.

EL PRESIDENTE DE LA REPÚBLICA Y EL MINISTRO DE GOBERNACIÓN Y POLICÍA Y SEGURIDAD PÚBLICA Con fundamento en los incisos 3) y 18) del artículo 140 de la Constitución Política y de conformidad con la Ley Nº 5251 del 11 de julio de 1973 y sus reformas, Ley Indígena Nº 6172 del 29 de noviembre de 1977 y Ley Nº 7316 del 12 de octubre de 1992, del Convenio Nº 169 de la OIT, y

1Que la población Indígena Guaymí de la Reserva Indígena Guaymí de Osa, con el afán de conservar la riqueza natural de flora y fauna y los recursos hídricos del sector noroeste de la reserva, ha solicitado al Poder Ejecutivo la modificación de sus límites para poder optar por tierra de vocación agrícola y dejar en conservación ese sector, que es de vocación forestal.
2Que la comunidad indígena Guaymí de la Reserva Indígena Guaymí de Osa, ha solicitado a la Comisión Nacional de Asuntos Indígenas (CONAI) los estudios respectivos a la modificación de límites de esta reserva.
3Que la delimitación establecida por el artículo 2º del Decreto Ejecutivo Nº 22202-G, publicado en La Gaceta Nº 108 del 7 de junio de 1993, requiere una definición de límites más acorde a la realidad que vive la población indígena Guaymí de la Reserva de Osa.
4Que es recomendable definir una zona de amortiguamiento de mayor soporte para la Reserva Indígena Guaymí de Osa y el Parque Nacional Corcovado, con el objetivo de preservar los recursos naturales de estas unidades administrativas y de la Península de Osa en general.
5Que en consulta a la comunidad indígena, tal y como lo establece el Convenio 169 de la OIT, en su artículo 6º inciso a), la CONAI realizó los estudios correspondientes y los presentó a la comunidad indígena, la que bajo consenso avaló el proyecto.
6Que es fundamental corregir la numeración de los artículos del Decreto Nº 22202-G, ya que en este aparecen dos artículos bajo el número 2 (dos), y para evitar confusión se deben corregir. Por tanto,

Considerando:

DECRETAN:

Parte del punto de coordenadas N 285 975 E 519 640, punto de intersección en el mapa, de la quebrada, dando con el río Rincón. Continúa el límite de la reserva aguas arriba por el río Rincón, hasta su confluencia con el río Pavón en coordenadas N 284 380 E 518 440. De este punto se sigue aguas arriba por el río Pavón, hasta su naciente en el mapa en coordenadas N 284 600 E 510 500. Continúa el lindero por una naciente del río Pavón, dibujada por curvas de nivel en el mapa, que toma rumbo suroeste, hasta el punto de coordenadas N 284 050 E 509 825. De ahí se sigue por los puntos de coordenadas siguientes:

Este último punto interseca el río Corcovado, por el cual se sigue aguas arriba hasta el punto de coordenadas N 286 710 E 509270.

De ahí se continúa con una recta al punto de coordenadas N 286 925 E 508 710 (Cerro 505) para seguir en parte por la fila divisoria de aguas entre el río Corcovado y la quebrada Vaquedano, pasando por los puntos de coordenadas:

Este último punto interseca la naciente en el mapa, del río Drake continuando el lindero de la reserva por este río aguas abajo, hasta el punto de coordenadas N 291 000 E 507 650. Punto donde confluye una quebrada (definida en el mapa por curvas de nivel) sobre el río Drake.

El límite sigue con una recta al punto de coordenadas N 290 775 E 509 020 (Cerro, 621 m). Punto ubicado en parte de la fila divisoria de aguas de los ríos Drake y Riyito.

A partir de ahí, el lindero pasa por los puntos de coordenadas:

De este punto, una recta hasta la naciente de una pequeña quebrada dibujada en el mapa por curva de nivel, en coordenadas N 289600 E 510 875.

De allí, se sigue aguas ab~o por esta quebrada, hasta su desembocadura en el río Riyito (Nuchi), en coordenadas N 290 125 E 512 225. Se continúa aguas abajo por el río Riyito, hasta al punto de coordenadas N 288 150 E 517 198. De este último punto, la reserva indígena continúa en su linero por las coordenadas:

Este último punto interseca una quebrada (§in nombre en el mapa) conocida como quebrada Agua Sucia (Nudebrare), en el terreno. Se sigue aguas abajo por esta quebrada hasta el punto de coordenadas N 287 646 E 518 985. Se continúa con el límite pasando por los puntos de coordenadas N 287 050 E 519 075, N 286 825 E 519 445. De este punto se sigue hasta el punto de coordenadas N 285 975 E 519 640. Punto inicial de la presente descripción;"

No obstante el Sistema exige una numeración consecutiva, por lo que se ha creado el mismo, pero sin texto.

Artículo 1 — Amend article 2 of Executive Decree Nº 22202-G dated April 14, 1993, published in La Gaceta Nº 108 on July 7, 1993, which refers to the boundary of the Guaymí de Osa Indigenous Reserve, so that henceforth it reads as follows:

Artículo 2 — The Guaymí de Osa Indigenous Reserve is located on the topographic sheets of the National Geographic Institute (Instituto Geográfico Nacional, IGN), scale 1:50,000, Llorona 3441 I and Golfo Dulce 3541 IV.

Artículo 2 — Sinalevi Note: In the publication of this executive decree, this article does not appear.

Artículo 3 — Article 2 of Decree Nº 22202-G, published in La Gaceta Nº 108 on June 7, 1993, remains in force and is numbered as article 3, which textually states: "The Guaymí de Osa Indigenous Reserve constitutes a buffer zone for the National Park.".

Artículo 4 — It takes effect upon its publication.

Artículo 1 — Modifíquese el artículo 2º del Decreto Ejecutivo Nº 22202-G de fecha 14 de abril de 1993, publicado en La Gaceta Nº 108 del 7 de julio de 1993, que se refiere a la delimitación de la Reserva Indígena Guaymí de Osa, para que en adelante se lea así:

Artículo 2 — La Reserva Indígena Guaymí de Osa, se localiza en las hojas topográficas del Instituto Geográfico Nacional, escala 1:50.000, Llorona 3441 I Y Golfo Dulce 3541 IV. La Reserva Indígena Guaymí de Osa está delimitada por los puntos de las coordenadas siguientes:

Artículo 2 — Nota de Sinalevi: En la publicación de este decreto ejecutivo, no aparece este artículo.

Artículo 3 — Queda vigente y numérese como artículo 3º, el artículo 2º del Decreto Nº 22202-G, publicado en La Gaceta Nº 108 del 7 de junio de 1993, que textualmente dice: "La Reserva Indígena Guaymí de Osa constituye una zona de amortiguamiento al Parque Nacional.".

Artículo 4 — Rige a partir de su publicación.
