across the entirety of the text - Complete Text of Regulation 29112 Declares La Marta Private Wildlife Refuge, the properties belonging to the Fundación Universidad Latinoamericana de Ciencia y Tecnología Complete Text record: 3B1EE N° 29112-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY In exercise of the powers conferred by Article 140, subsections 3) and 18) of the Political Constitution and based on the provisions of Articles 82 and 87 of the Wildlife Conservation Law N° 7317 of December 7, 1992, and Articles 6, 11, and 27 of the General Public Administration Law. Considering: 1°-That it is in the government's interest to strengthen administrative structures in the field of natural resources, in order to have defined policies that guarantee the rational use of such resources. 2°-That in the area of Pejibaye, province of Cartago, fourth canton (Jiménez), third district (Pejibaye), are located the properties belonging to the Fundación Universidad Latinoamericana de Ciencia y Tecnología, with legal identification number N° 3-006-114772-18, registered under the Folio Real registration numbers 3-044625-000 and 3-035154-000. 3°-That the area described above constitutes a very important nucleus for wildlife conservation (conservación de la vida silvestre) within the management category of refuge, clearly located in the zone where the properties are situated, due to the inherent characteristics of the environment. That because forests and wildlife species continue to disappear from our environment and therefore from our planet, under this management category, they can be conserved and managed within a framework of sustainable development, serving at the same time as an environmental regulator. 4°-That the primary objectives of this refuge are to conserve and protect the natural primary and secondary forest in order to sustain and incentivize the protection of water and soil, as well as the perpetuation and protection of endangered species of flora and fauna of the Pejibaye zone in Jiménez and in the area near the La Amistad Biosphere Reserve, which has been defined as unstable and prone to landslides. 5°-That due to the current state of the natural resources of the region, the national openness towards the protection of wilderness areas, biodiversity, and also because it is a zone with high rainfall precipitation, it turns out to be a very fragile area, making its preservation necessary. 6°-That the integrated rational management of natural resources contributes to meeting regional needs for research, recreation, environmental education, scenic beauty, carbon dioxide fixation, as well as the use of renewable natural resources, exploited rationally. 7°-That Article 22 of the Biodiversity Law, Law N° 7788, created the National System of Conservation Areas, transferring to it all the powers of the "Ley Forestal," the "Ley de Parques Nacionales," and the "Ley de Conservación de la Vida Silvestre." 8°-That the Administration of Wildlife and the recommendation of measures to ensure the perpetuity of species is a function of the National System of Conservation Areas of the Ministry of Environment and Energy. 9°-That the owner of said properties voluntarily agrees to be incorporated into this wildlife protection regime. 10.-Based on the foregoing, the farms meet the necessary requirements to continue as a private wildlife refuge. Considerando: 1°-Que es interés del gobierno fortalecer las estructuras administrativas en el campo de los recursos naturales, a fin de contar con políticas definidas que garanticen el uso racional de dichos recursos. 2°-Que en el rea de Pejibaye, provincia de Cartago, cantón cuarto (Jim‚nez), distrito tercero (Pejibaye), se encuentran los inmuebles pertenecientes a la Fundación Universidad Latinoamericana de Ciencia y Tecnología, con cédula jurídica N° 3-006-114772-18, inscritos bajo las matrículas de Folio Real Nos. 3-044625-000 y 3-035154-000. 3°-Que el rea antes descrita constituye un núcleo muy importante para la conservación de la vida silvestre dentro de la categor¡a de manejo de refugio, localizada claramente en la zona donde se ubican los inmuebles, por las características propias del medio ambiente. Que por continuar desapareciendo de nuestro medio y por ende de nuestro planeta, los bosques y las especies de vida silvestre, bajo esta categoría de manejo, permite conservarlas y manejarlas dentro de un desarrollo sostenible sirviendo a la vez como regulador ambiental. 4°-Que son objetivos primordiales de este refugio, conservar y proteger el bosque natural primario y secundario con el fin de sostener e incentivar la protección de aguas, de suelo y así como la perpetuación y protección de especies en vías de extinción de flora y fauna de la zona de Pejibaye en Jiménez y en el rea cercana con la Reserva de la Biosfera de la Amistad que ha sido definida como inestable y propensa a deslizamientos. 5°-Que debido al estado actual de los recursos naturales de la región, a la apertura nacional hacia la protección de las áreas silvestres, a la biodiversidad y también a que es una zona con una alta precipitación lluviosa, resulta ser un rea muy frágil, por lo que es necesaria la preservación de la misma. 6°-Que el manejo racional integrado de los recursos naturales, contribuye a satisfacer las necesidades regionales para la investigación, recreación, educación ambiental, belleza escénica, fijación de bióxido de carbono, así como el aprovechamiento de los recursos naturales renovables, explotados racionalmente 7°-Que el artículo 22 de la Ley de Biodiversidad, Ley N° 7788 creó el Sistema Nacional de áreas de Conservación, traslad ndole todas las competencias de la Ley Forestal, Ley de Parques Nacionales y Ley de Conservación de la Vida Silvestre. 8°-Que la Administración de la Vida Silvestre y la recomendación de medidas que aseguren la perpetuidad de las especies es función del Sistema Nacional de áreas de Conservación del Ministerio del Ambiente y Energía. 9°-Que el propietario de dichos inmuebles accede voluntariamente a incorporarse a este régimen de protección de la vida silvestre. 10.-Con base en lo anterior, las fincas cumplen con los requisitos necesarios para continuar como refugio privado de vida silvestre. Por tanto, Decretan: Artículo 1°-Declárese refugio de vida silvestre de propiedad privada La Marta, los inmuebles pertenecientes a la Fundación Universidad Latinoamericana de Ciencia y Tecnología, inscritos bajo el sistema de Folio Real Mecanizado según matrículas Nos.: 3-044625-000 y 3-035154- 000, situados en el cantón cuarto (Jiménez), distrito tercero (Pejibaye) de la provincia de Cartago, según consta en el plano catastrado N° C-30788-59, con un rea de 1498.7 hectáreas.
