For the purposes of this law, the following concepts are defined:
(Thus amended the previous paragraph by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of road conservation, No. 10624 of December 12, 2024) National road network: set of national highways determined by the National Roadway Council (Conavi), based on the respective technical studies.
(Thus amended the previous definition by Article 1 of the Law for the intervention of cantonal routes by the National Roadway Council, No. 9953 of March 3, 2021) Traversing streets: set of national public highways that cross the quadrant of an urban area or streets that connect two sections of a national highway in the referred area, in accordance with Article 3 of Law 5060, General Law of Public Roads, of August 22, 1972.
(Thus amended the previous definition by Article 1 of the Law for the intervention of cantonal routes by the National Roadway Council, No. 9953 of March 3, 2021) Road conservation: set of activities intended to preserve, continuously and sustainably, the good condition of roads and bridges, so as to guarantee optimal service to the user. Road conservation comprises everything that does not amount to construction of new works or substantial variation of the standard of existing ones. It also comprises restoration works required due to emergencies, except as provided by this law as an exception. Within road conservation, the following activities can be distinguished: maintenance (routine and periodic), reinforcement, rehabilitation, and specific improvements (mejoramientos puntuales), as well as the installation of non-permanent modular bridges and pedestrian walkways. It also includes the exchange of pavements between rigid and flexible, partially or totally.
(Thus amended the previous definition by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of road conservation, No. 10624 of December 12, 2024) Routine maintenance: Set of tasks for cleaning drainage systems, vegetation control, minor and localized repairs of the pavement, and the restoration of markings, which must be carried out continuously and sustainably over time, to preserve the operational condition, service level, and safety of the roads. It also includes cleaning and minor, localized repairs of bridge structures.
Periodic maintenance: set of programmable activities, every certain period, aimed at renewing the original condition of pavements through the application of additional layers of ballast, gravel, surface treatments, or asphalt overlays or concrete sections, as the case may be. The periodic maintenance of bridges includes cleaning, painting, and repair or replacement of damaged structural or protection elements.
(Thus amended the previous definition by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of the road conservation, No. 10624 of December 12, 2024) Road pairs (Pares viales): set of two roads, separated from each other, with opposite directions of vehicular circulation, which allow the distribution of vehicular flow entering and leaving urban centers, a situation that allows for physical and functional continuity to be given to a specific route of the national road network.
(Thus added the previous definition by Article 1 of the Law for the intervention of cantonal routes by the National Roadway Council, No. 9953 of March 3, 2021) Rehabilitation: selective repair and reinforcement of the pavement or the roadway, after partial or total demolition of the existing structure, with the aim of restoring the original structural solidity and riding quality. Additionally, it may include the construction or reconstruction of the drainage system that does not involve building bridges or major culverts. Before any rehabilitation activity on the riding surface, it must be verified that the drainage system functions properly. The rehabilitation of bridges refers to major repairs, such as the replacement of main structural elements or components, or the replacement of the floor slab.
(Thus amended the previous definition by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of the road conservation, No. 10624 of December 12, 2024) Reconstruction: complete renewal of the structure of the road, after partial or total demolition of the pavement structure or the bridge structures, to improve the original riding quality, adapting it to the current specifications or techniques to meet current and projected demand, incorporating improvements in peripheral structures, as well as new elements.
(Thus amended the previous definition by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of the road conservation, No. 10624 of December 12, 2024) Improvement (Mejoramiento): improvements or modifications of the horizontal or vertical standard of roads, related to width, alignment, curvature, or longitudinal slope, in order to increase the capacity of the road and the speed of circulation. Also included within this category are the widening of the roadway, the elevation of the standard of the surface type ("upgrade") from earth to ballast or from ballast to asphalt, among others, and the construction of structures such as large culverts, bridges, or intersections, as well as the construction of bike lanes.
(Thus amended the previous definition by Article 1 of the Law to increase the maximum amount to invest for specific improvements considered part of the road conservation, No. 10624 of December 12, 2024) Specific improvements (Mejoramientos puntuales): correspond to localized improvements or modifications of the horizontal or vertical standard of roads, related to width, alignment, curvature, or longitudinal slope, in order to increase both road safety and functionality. The definition of which works correspond to specific improvements shall be established via regulation.
