- a)Three billion five hundred million colones (3,500,000,000.00), as provided in Article 15 of this law.
- b)One billion colones (1,000,000,000.00) to finance the pensions of the Non-Contributory Regime (Régimen no Contributivo) administered by the Caja Costarricense de Seguro Social.
- c)Two hundred million colones (200,000,000.00) for the Fondo de la Niñez y la Adolescencia (Código de la Niñez y la Adolescencia, Article 184), to finance educational reinsertion projects for adolescent mothers in situations of social risk.
(Sinalevi Note: Through Resolution of the Sala Constitucional No. 011172 of June 17, 2020, the omission of the Legislative Assembly in not including the total amount budgeted by the Executive Branch, defined in the preceding paragraph, was declared unconstitutional) d) One hundred million colones (100,000,000.00), for the destination indicated in subsection h) of Article 15 of this law.
(*)e) Two hundred million colones (₡200,000,000.00) of what is collected under this law shall be allocated, ineludibly, to the Ministerio de Educación Pública (MEP) and shall be used in the following manner: one hundred million colones (₡100,000,000.00) to finance sports and recreation for persons with disabilities, according to the following table: thirty percent (30%) of these resources shall be for the Comité Paralímpico Nacional and seventy percent (70%) shall be to finance sports and recreation activity programs of the organizations for persons with disabilities linked and accredited in Costa Rica, by the organization Special Olympics International.
The remaining one hundred million colones (₡100,000,000.00) to fulfill the objectives of Law No. 8283, Ley para el Financiamiento y Desarrollo de Equipos de Apoyo para la Formación de Estudiantes con Discapacidad Matriculados en III y IV Ciclos de la Educación Regular y de los Servicios de III y IV Ciclos de Educación Especial, of May 28, 2002.
The MEP must establish control and oversight (fiscalización) mechanisms aimed at verifying the correct use and destination of all public resources granted to the associations and other beneficiaries of the resources herein provided.
The MEP must establish control mechanisms aimed at verifying the correct use and destination of all public resources allocated in this law.
The MEP must establish the use of the principles of administrative contracting for the contracts executed using these resources, as established in Law No. 7494, Ley de Contratación Administrativa, of May 2, 1995.
To verify the information provided on the use of said resources, the beneficiary organizations must keep separate accounting records and detail the programs in which the resources have been invested.
In addition, they must submit to the MEP and the Contraloría General de la República, for their control and oversight (fiscalización), the annual liquidation of the expenses financed with the delivered resources, in order to facilitate timely control and oversight (fiscalización).
Both the Contraloría General de la República and the MEP shall have access to the documentation and other information that reveals aspects regarding the correct administration and appropriate use of the resources deposited to the organizations, associations, and committees.
Notwithstanding the foregoing, the MEP may suspend the delivery of resources to the beneficiary organizations and request their return, in the event that they incur any of the following faults:
1. Providing altered or false information.
2. Changing the destination of the resources or making improper use of them.
3. Refusing to provide pertinent information that serves the MEP or the Contraloría General de la República to verify the corresponding information regarding the use of the delivered resources.
4. Not providing the services for which the resources have been assigned.
5. Not complying with the principles of administrative contracting established by the MEP.
6. Failing to comply with the guidelines established by the Contraloría General de la República for the use of public resources.
To execute the indicated sanctions, the administrative procedure established in Law No. 6227, Ley General de la Administración Pública, of May 2, 1978, shall be followed.
The Contraloría General de la República, for breaches of the rules established in this subsection and based on its oversight (fiscalización) powers over public funds delivered to private subjects, following due process, may empower the MEP to suspend, according to the seriousness of the violation committed, the delivery of resources to the beneficiary subjects. In this case, at the request of the MEP, it may authorize the redistribution of these suspended resources to the other beneficiaries indicated in this subsection. This distribution shall be proportional with respect to the percentages established in this regulation. The foregoing, without prejudice to the other sanctions that the legal system may establish.
(*) (Thus amended subsection e) above by Article 19 of Law No. 9739 of November 5, 2019, "Reforms for the inclusion of persons with disabilities in sports and recreation") f) One hundred million colones (100,000,000.00) to the school boards (patronatos escolares) of priority attention or urban-marginal schools, for the acquisition of teaching materials, food, improvement, and maintenance of educational infrastructure.
- g)The rest of the resources shall be allocated freely.
The Ministerio de Hacienda shall be obliged to include, in the draft law of the ordinary budget of the Republic, the contributions provided for in subsections a), b), c), d), e), and f) above.
Under-execution of the budget in this matter is prohibited. These resources shall not be subject to the directives issued by the Executive Branch regarding public spending restrictions.
The resources must be transferred in quarterly installments by the competent authorities, and the amounts shall be adjusted annually, in accordance with the consumer price index determined by the Instituto Nacional de Estadística y Censos.
