5060 of September 5, 1972, are hereby amended to read as follows:
"Article 32.- No one shall have the right to close, partially or totally, or to narrow, by fencing or building, roads or streets given by law or in fact to the public service or to the service of an owner or neighbors of a locality, unless it proceeds by virtue of a judicial resolution issued in proceedings conducted with the intervention of representatives of the State or of the respective municipality, or by rights acquired according to laws prior to this one or the provisions of this law. The judicial resolution shall be verified by a certification thereof, and the acquisition by the respective title; both must be shown and provided to the authority that demands them.
Whoever contravenes the foregoing shall be judged according to the corresponding criminal laws if, according to the nature of the act, the existence of the crime indicated by article 227 of the Penal Code or the contravention provided for in article 400 of the same Code is determined, all without prejudice to the reopening of the road without any compensation for improvements or constructions.
It is the obligation of road officials to report the referred contravention to whoever corresponds and to initiate the administrative proceedings established by the following article for the reopening of the road.
