consistently throughout the text - Full Text of Regulation 26429 Amendment to the Regulations to the Forestry Law No. 26429-MINAE THE PRESIDENT OF THE REPUBLIC AND THE MINISTER OF ENVIRONMENT AND ENERGY, Exercising the powers conferred upon them by article 140, subsections 3) and 18) of the Political Constitution and in accordance with the provisions of Forestry Law No. 7575, published in Supplement No. 21 to "La Gaceta" No. 72 of Tuesday, April 16, 1996.
1.-That since the entry into force of executive decree No. 25721-MINAE, published in "La Gaceta" No. 16 of Thursday, January 23, 1997, technical differences of opinion have arisen in its application, which hinder the applicability of the Regulations.
2.-That there are definitions established in the regulations to Forestry Law No. 7575 that have caused inadequate interpretations, which represents a high risk for the sustainability of forested areas.
3.-That to facilitate the functioning of the Board of Directors of the National Fund for Forestry Financing (Fondo Nacional de Financiamiento Forestal, FONAFIFO), the appointment of alternates is necessary, who in eventual situations may substitute for the regular members in order to guarantee the participation of the represented sectors and the operation of the Board of Directors.
4.-That by mutual agreement between the private forestry sector and the Ministries of Finance and Environment and Energy, the amounts for the payment of environmental services (pago de servicios ambientales) to owners of forests and forest plantations were defined, for the benefits these areas provide to society.
5.-That for reasons of legal certainty, the State must invest economic resources from the national budget in those acts where there is certainty that they are well-founded.
6.-That executive decree No. 26141-H-MINAE establishes the maximum amounts payable for the environmental services provided by forested areas, and that said amounts differ from those indicated in executive decree No. 25828-MINAE, therefore its repeal is necessary.
7.-That article 104 of the regulations to Forestry Law No. 7575 establishes that FONAFIFO must record, in the Public Property Registry, an encumbrance on the properties that have been incentivized with the payment of environmental services, by means of the Forestry Payment Certificate (Certificado de Abono Forestal), a situation that limits the participation of persons with other types of tenure (tenencia) or possession (posesión).
8.-That the objective of the State Forestry Administration (Administración Forestal del Estado, AFE) is to establish with precision the guidelines most appropriate to the intended purpose, which is the protection and sustainable use of Natural Resources. Therefore, THEY DECREE:

7575 is amended in relation to the definitions "Combination of Forest Species" and "Forest Tree," so that it shall henceforth read as follows:
-Combination of Forest Species (Combinación de Especies Forestales): Combination in time and space of trees with annual crops, permanent crops, forage species, fruit trees, or others. Socolados forests, or heavily intervened forests where a space is opened that allows the establishment of forage or agronomic species, are not included within this definition. Among others, agroforestry systems are considered, such as windbreaks, pastures with planted trees or trees from natural regeneration provided that the latter were established after the crop, shade trees for permanent crops, and trees in fences.
- Forest Tree (Árbol Forestal): Perennial plant (one that lives more than two years), with a woody and elevated trunk (referring to the different heights trees reach depending on the species and the site), which branches at a greater or lesser height from the ground, which is a source of raw material for the different types of forest industry such as sawmills, factories of boards, veneers, matches, cellulose, essential oils, resins, and tannin.

7575 is amended so that it shall henceforth read as follows:
- The National Fund for Forestry Financing (FONAFIFO) is a body of maximum deconcentration within the organizational structure of the AFE. Said Fund shall have a Board of Directors, whose president shall have the powers of a general attorney-in-fact without limit of sum to issue and commit the fund in all types of lawful legal business necessary for the fulfillment of the established objectives.
The Board of Directors shall issue the credit regulations, the conditions for regulating interest rates, maximum terms, requirements, and any others necessary to fulfill its functions in promoting forestry activity as empowered by law.
Within the heart of the Board of Directors and for periods of two years, a President, Secretary, Treasurer, and two directors shall be appointed. The Presidency for the first period shall correspond to the representative of MINAE. In successive periods, it shall be determined by the members of the Board of Directors. Likewise, each one of the members of the Board of Directors may have an alternate who shall be appointed by the respective competent body; the alternate may not participate in sessions when the regular member is present.

To demonstrate ownership title (titularidad de la propiedad), it will be necessary to present a registry or notarial certification, establishing the description of the property, liens, and annotations.

4Que de común acuerdo entre el sector forestal privado y los Ministerios de Hacienda y Ambiente y Energía se definieron los montos para el pago de servicios ambientales, a los propietarios de bosques y plantaciones forestales por los beneficios que estas áreas brindan a la sociedad.
5Que por razones de seguridad jurídica el Estado debe invertir los recursos económicos provenientes del presupuesto nacional en aquellos actos en donde se tenga la certeza de que los mismos están bien fundamentados.
6Que el decreto ejecutivo No 26141-H-MINAE, establece los montos máximos a pagar para los servicios ambientales que brindan las áreas boscosas, y que dichos montos son diferentes a los indicados en el decreto ejecutivo N° 25828-,MINAE, por lo que es necesaria su derogación.
7Que el artículo 104 del reglamento a la Ley Forestal No 7575, establece que el FONAFIFO debe realizar en el Registro Público de la Propiedad, una afectación a los inmuebles que ha sido incentivados con el pago de los servicios ambientales, mediante el Certificado de Abono Forestal, situación que limita la participación de las personas con otros tipos de tenencia o posesión.
8Que el objeto de la Administración Forestal del Estado, consiste en establecer con precisión, los lineamientos más adecuados al fin propuesto, cual es la protección y el aprovechamiento sostenible de los Recursos Naturales. Por tanto,

DECRETAN:

-Combinación de Especies Forestales: Combinación en tiempo y espacio de árboles con cultivos anuales, cultivos permanentes, especies forrajeras, frutales u otras. No se incluyen dentro de esta definición los bosques socolados, o fuertemente intervenidos donde se abre un espacio que permite el establecimiento de especies forrajeras o agronómicas. Entre otros se consideran sistemas agroforestales, los rompevientos, los potreros con árboles plantados o de regeneración natural siempre que estos últimos se hayan establecido después del cultivo, los árboles de sombra de cultivos permanentes y los árboles en cerca.
- Árbol Forestal: Planta perenne (aquella que vive más de dos años), de tronco leñoso y elevado (referido a las diferentes alturas que alcanzan los árboles dependiendo de la especie y el sitio), que se ramifica a mayor o menor altura del suelo, que es fuente de materia prima para los diferentes tipos de industria forestal como aserraderos, fábricas de tableros, de chapas, de fósforos, de celulosa, de aceites esenciales, de resinas y tanino.

- El Fondo Nacional de Financiamiento Forestal es un órgano de desconcentración máxima dentro de la estructura organizativa de la AFE. Dicho Fondo tendrá una Junta Directiva, cuyo presidente tendrá facultades de apoderado generalísimo sin límite de suma para emitir y comprometer al fondo en todo tipo de negocios jurídicos lícitos necesarios para el cumplimiento de los objetivos establecidos.
La Junta Directiva emitirá los reglamentos de crédito, las condiciones para la regulación de las tasas de interés, los plazos máximos, los requisitos y cualquier otros necesarios para cumplir con sus funciones en el fomento de la actividad forestal según lo faculta la ley.
Dentro del seno de la Junta Directiva y por periodos de dos años se nombrarán Presidente, Secretario, Tesorero y dos vocales. La Presidencia por el primer periodo corresponderá al representante del MINAE. En los periodos sucesivos será determinado por los miembros de la Junta Directiva. Asimismo, cada uno de los miembros de la Junta Directiva podrá tener un suplente que será nombrado por el órgano competente respectivo, el mismo no podrá participar en las sesiones cuando esté presente el titular.

Para demostrar la titularidad de la propiedad será necesario presentar certificación registral o notarial, donde se establezca la descripción del inmueble, gravámenes y anotaciones.
Para demostrar la titularidad de la posesión, se deberá presentar certificación judicial de la existencia de sentencia firme en el trámite de información posesoria correspondiente.
En fincas inscritas podrá autorizarse el aprovechamiento cuando existan contratos de arrendamiento, o cualquier otra modalidad contractual, en estos casos deberá presentarse certificación registral o notarial de la inscripción del arrendamiento al Registro Público, donde se indique expresamente la posibilidad otorgada al arrendatario de disponer del recurso forestal; en las modalidades contractuales no sujetas a inscripción, se deberá presentar certificación registral o notarial de la propiedad y documento público que demuestre la existencia del contrato y sus alcances.
