The Data Registry of Recovered Fishing Gear and Incidents with Marine Species (Registro de Datos de Artes de Pesca Recuperadas e Incidentes con Especies Marinas) is established, which shall be under the charge of the Costa Rican Institute of Fishing and Aquaculture (Incopesca). This registry will compile information from the National Fishing Gear Alert and Registry System and Incidents with Marine Species (Sistema Nacional de Alerta y Registro de Artes de Pesca e Incidentes con Especies Marinas).
To improve the data presented within the Data Registry of Recovered Fishing Gear and Incidents with Marine Species, the Costa Rican Institute of Fishing and Aquaculture may request additional data beyond that offered by the National Fishing Gear Alert and Registry System and Incidents with Marine Species, which shall be defined by means of the regulation of this law. The compiled data must be publicly and freely accessible.
The following shall be responsible for sending the information and additional data through the reports and alerts:
- a)The designated managers of protected marine areas of the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación).
- b)The designated unit of the National Coast Guard Service (Sistema Nacional de Guardacostas) of the Ministry of Public Security.
- c)Coastal municipalities.
- d)Marine operators (operadores marinos).
- e)Fishers, vessel captains, shipowners, or persons responsible for the fishing operation, as applicable.
Any other subject or institution defined by regulation.
The Costa Rican Institute of Fishing and Aquaculture shall provide the information contained in the registry, in accordance with the provisions of Law 8968, Protection of the Person Regarding the Processing of their Personal Data, of July 7, 2011, and, as applicable, Law 10554, Framework Law on Access to Public Information, of October 23, 2024.
