For the correct understanding of what is regulated in this regulation, the following definitions are established:
1. Storage: Action of temporarily retaining waste while it is delivered to the collection service, processed for its use or change of its characteristics, or disposed of.
2. Companion animal (animal de compañía): Animal that lives with human beings. For the purposes of this regulation, companion animal shall be understood as dogs and cats, exclusively.
3. Sanitary authorization for temporary events of massive concentration of people: Administrative resolution issued by the Ministry of Health authorizing a natural or legal person, public or private, to execute a temporary event that involves the massive concentration of people in a specific space.
4. Canton: For the purposes of this regulation, whenever the canton is indicated, it must be understood as the canton of Sarchí.
5. Storm drain or gutter (Caño o Cuneta): Channel through which rainwater flows.
6. Category: Classification of a taxpayer (contribuyente) according to the estimation of waste they generate per month. For this purpose, the studies of generation, composition, and categorization of waste produced in the canton of Sarchí or those that are more favorable to satisfying the public interest shall be used as a basis.
7. Recovery centers for recoverable waste (Centros de recuperación de residuos valorizables): It is a permanent site for the temporary storage of waste for its recovery (valorización) where recoverable materials are weighed, classified, and separated according to their nature: plastic, cardboard, paper, glass, and metals, for their subsequent sale.
8. Composting (Compostaje): Technique that allows the aerobic decomposition of organic matter in a controlled manner to achieve a product usable as a soil improver.
9. Concessionaire (Concesionario): Natural or legal person to whom, through an administrative legal act, the right is temporarily granted to take charge of the cleaning, collection, transport, treatment, recycling, and/or final disposal service of ordinary waste in the canton.
10. Container (Contenedor): Receptacle intended for the temporary storage of solid waste.
11. Service contract (Contrato de servicios): Contract whose purpose is the contracting of technical or professional services, by natural or legal persons; for this purpose, the Municipality must follow the administrative contracting procedures.
12. Taxpayer (Contribuyente): Natural or legal person who receives municipal services and who has the obligation to pay the respective rates. They are the taxable person (sujeto pasivo) and can be the registered owner, the possessor (poseedor) of a property without registration, or the usufructuary (usufructuario) of a real estate property, as applicable.
13. Effective cost (Costo efectivo): The effective cost of the service is the sum of the cost of materials, labor, equipment use, as well as its depreciation, contingencies, administrative and financial expenses, cost of collection, disposal, and treatment of solid waste if required, as well as other direct and indirect costs related to the work, plus ten percent (10%) utility for development. In the case of external contracting, the amount determined by the invoice of the cost paid by the Municipality to the company or person who performed the work shall be taken, with application to the above. All of the above, in accordance with Article 83 of the Municipal Code.
14. Water bodies (Cuerpos de Agua): Those spaces constituted by rivers, streams, springs (nacientes), lakes, lagoons, reservoirs, wetlands, whether permanent or intermittent.
15. Final disposal (Disposición final): Last stage of the solid waste management process in which they are disposed of definitively and sanitarily.
16. Governing body (Ente rector): Refers to the Ministry of Health (hereinafter MINSA).
17. Transfer Station (Estación de Transferencia): Facility that, with the necessary equipment, allows the change of the means of transport for non-hazardous solid waste, from collection units to higher-capacity vehicles for transport to a treatment facility or final disposal.
18. Temporary event of massive concentration of people (Evento temporal de concentración masiva de personas): Any temporary event that extraordinarily gathers a number of people under overcrowding conditions in open or closed physical spaces that, due to their site, structural, and non-structural characteristics, suppose or suggest a risk or threat scenario that obliges preventive measures for controlling the use of space and human behavior.
19. Weighting factor (Factor de ponderación): Factor that seeks equivalence between categories when multiplied by the base rate to obtain an equitable distribution of service costs.
20. Generation source (Fuente de generación): Place where ordinary solid waste is generated.
21. Generator (Generador): Natural or legal person, public or private, that generates solid waste through the development of production, service, commercialization, or consumption processes.
22. Comprehensive Solid Waste Management (Gestión Integral de Residuos Sólidos, hereinafter GIRS): Articulated and interrelated set of regulatory, operational, financial, administrative, educational, planning, monitoring, and evaluation actions for the management of solid waste, from its generation to final disposal.
23. Authorized manager (Gestor autorizado): Natural or legal person, public, private, or mixed economy, registered and authorized by MINSA for the comprehensive management, totally or partially, of waste in accordance with Article 27 of Law No. 8839 and Chapter X of the General Regulation to the Law for Comprehensive Waste Management, Executive Decree No. 37567-S-MINAET-H.
24. Incentives (Incentivos): Refers to the benefit granted to Generators who contribute to correct management, demonstrating minimization and the application of the hierarchy in comprehensive waste management established in Law No. 8839.
25. Commercial license (Licencia comercial): Municipal license to carry out commercial activities.
26. Waste management (Manejo de residuos): Set of technical and operational activities of waste management that includes: storage, collection, transport, recovery (valorización), treatment, and final disposal.
27. Municipality: For the purposes of this regulation, whenever the Municipality is indicated, it must be understood as the Municipality of Sarchí.
28. License holder (Patentado): Natural or legal person who has a commercial license to carry out commercial activities in the canton.
29. Municipal Patent (Patente Municipal): Tax obligation that arises as a consequence of carrying out lucrative activities that were previously authorized by the Municipality upon granting the commercial license.
30. Municipal Plan for Comprehensive Solid Waste Management (Plan Municipal de Gestión Integral de Residuos Sólidos, hereinafter PMGIRS): Instrument that defines the cantonal policy on the matter and will guide municipal and/or cantonal actions on the topic within its area of competence.
31. Single-use plastic (Plástico de un solo uso): Plastic products designed to be discarded after their first use; examples of these products are straws, coffee stirrers, and plastic containers.
32. Owner (Propietario): Natural or legal person with a property title registered in the National Public Registry.
33. Possessor (Poseedor): Natural or legal person who exercises dominion over a property without having a title registered in the National Public Registry.
34. Recycling (Reciclaje): Transformation of solid waste through different recovery (valorización) processes that allow restoring its economic and energy value, thus avoiding its final disposal, provided that this restoration implies a saving of energy and raw materials without prejudice to health and the environment.
35. Collection (Recolección): Action of collecting solid waste under municipal jurisdiction at the generation sources or containers, in accordance with the provisions of this regulation, to be transferred to transfer stations, treatment facilities, or final disposal.
36. Sanitary Landfill (Relleno Sanitario): Engineering method for the final disposal of solid waste generated in the canton in accordance with the Regulation on Sanitary Landfills, Executive Decree No. 38928-S.
37. Waste (Residuo): Solid, semi-solid, liquid, or gas material, from which its Generator or possessor must or needs to dispose, and which can or must be recovered (valorizado) or treated responsibly or, failing that, be managed by adequate final disposal systems.
38. Solid waste (Residuo sólido): Post-consumer solid or semi-solid material, from which its Generator or possessor must or needs to dispose.
39. Organic waste (Residuo orgánico): Solid or semi-solid waste, of animal or vegetable origin, which can be decomposed into the chemical elements that compose it, due to the action of biological agents, such as plants, microorganisms, and fungi, and used through composting (compostaje) and other technologies.
40. Construction and demolition waste (Residuo de construcción y demolición): Those solid wastes generated in tasks such as the construction, reconstruction, repair, alteration, expansion, and demolition of buildings, and urbanization works of any nature, whether urban or rural.
41. Electronic waste (Residuo electrónico): Those wastes derived from electronic devices for both domestic and commercial use as described in Annex I of the Regulation for the Comprehensive Management of Electronic Waste, Executive Decree No. 35933-S. The components, subassemblies, and consumables that are part of the product are considered part of this waste.
42. Garden waste (Residuo de jardín): Garden waste is that obtained from the maintenance tasks of gardens and green areas, such as: grass, leaves, flowers, logs, among others.
43. Waste requiring special handling (Residuo de manejo especial): Those declared as such by MINSA, and which, due to their composition, transport needs, storage conditions, forms of use or recovery value, or due to a combination of these, imply significant risks to health and systematic degradation of the ecosystem quality, for which they need to leave the normal stream of ordinary solid waste.
44. Non-recoverable solid waste (Residuo sólido no valorizable): Waste that has no use or recovery value at the moment in the country.
45. Ordinary waste (Residuo ordinario): Waste of a domestic nature generated in homes and in any other generation source, which present compositions similar to those from homes. Waste requiring special handling and hazardous waste are excluded.
46. Hazardous waste (Residuo peligroso): All waste that, due to its chemical reactivity and its toxic, explosive, corrosive, radioactive, biological, infectious-contagious, and flammable characteristics, or that, due to its exposure time, may cause damage to health and/or the environment.
47. Sharps waste (Residuo punzocortante): Any object with the capacity to penetrate and/or cut tissues, among them, surgical medical instruments, laboratory articles, dental instruments, as well as general-use articles like light bulbs (all types), fluorescent tubes, all types of staples, metal and plastic bands.
48. Recoverable waste (Residuo valorizable): Waste that due to its potential reuse value can be recovered for its recovery (valorización), such as aluminum, glass, paper, plastic, metal, cardboard, poly-laminates (tetrapak), electronics, white goods, and any other that has reuse potential.
49. Non-traditional or bulky waste (Residuos no tradicionales o voluminoso): Those objects disposed of by their owners sporadically, having reached the end of their useful life, which due to their size, weight, or characteristics are not suitable for ordinary collection.
50. Waste separation (Separación de residuos): Procedure by which solid waste is prevented from being mixed from the generation source, which allows them to be disposed of separately, for collection purposes.
51. Collective storage system (Sistema de almacenamiento colectivo): It is a defined and closed area, intended for the temporary collective storage of solid waste, awaiting the collection service.
52. Taxable person (Sujeto pasivo): Any natural or legal person obliged to comply with tax obligations, as a taxpayer (contribuyente), either as the owner or possessor of a land to which the service is provided.
53. Public service rate (Tasa del servicio público): Tax whose obligation has as its generating event the effective or potential provision of a public service, individualized to the taxpayer, and whose proceeds must not have a destination unrelated to the service, which is the reason for the obligation.
54. Tariff (Tarifa): Name given to the mathematical expression that represents the cost that the taxpayer must pay for the effective or potential provision of the public service in proportion to the quantity generated monthly per unit of weight.
55. Treatment (Tratamiento): Transformation of waste or specific parts thereof into new products or the change of characteristics, such as recycling (reciclaje), composting (compostaje), mechanical-biological treatment, thermal treatment, among others.
56. Served unit (Unidad servida): Residence, institution, commerce, and industry to which the service is provided.
57. Usufructuary (Usufructuario): Natural or legal person who holds a real right of use and enjoyment of a real estate property belonging to another person.
58. Recovery (Valorización): Set of associated actions whose objective is to give added value to waste for production processes, through the recovery of materials and/or energy utilization and the rational use of resources, with present or future technology.
59. Dump (Vertedero): Site without prior preparation, where waste is deposited, without technique or through very rudimentary techniques and where adequate control is not exercised.
60. Public road (Vía pública): It is all land of public domain and common use, which by provision of the administrative authority is destined for free transit in accordance with the legal system regarding urban planning.
