Approval of the Nagoya Protocol on Fair and Equitable Sharing of the Benefits Arising from their Utilization to the Convention on Biological Diversity and its Annex The Parties to this Protocol, Being Parties to the Convention on Biological Diversity, hereinafter referred to as "the Convention", Recalling that the fair and equitable sharing of benefits arising from the utilization of genetic resources is one of three core objectives of the Convention, and recognizing that this Protocol pursues the implementation of this objective within the Convention, Reaffirming the sovereign rights of States over their natural resources and in accordance with the provisions of the Convention, Recalling further Article 15 of the Convention, Recognizing the important contribution of technology transfer and cooperation to sustainable development, to build research and innovation capacity that adds value to genetic resources in developing countries, in accordance with Articles 16 and 19 of the Convention, Recognizing that public awareness of the economic value of ecosystems and biodiversity and the fair and equitable distribution of this economic value with the custodians of biodiversity are key incentives for the conservation of biodiversity and the sustainable use of its components, Aware of the potential contribution of access and benefit-sharing to the conservation and sustainable use of biodiversity, poverty reduction, and environmental sustainability, thereby contributing to achieving the Millennium Development Goals, Aware of the links between access to genetic resources and the fair and equitable sharing of benefits arising from the utilization of such resources, Recognizing the importance of providing legal certainty regarding access to genetic resources and the fair and equitable sharing of benefits arising from their utilization, Recognizing further the importance of promoting fairness and equity in the negotiation of mutually agreed terms between providers and users of genetic resources, Recognizing also the crucial role played by women in access and benefit-sharing and affirming the need for the full participation of women at all levels of the formulation and implementation of policies for the conservation of biodiversity, Determined to continue supporting the effective implementation of the provisions of the Convention on access and benefit-sharing, Recognizing that an innovative solution is required to address the fair and equitable sharing of benefits arising from the utilization of genetic resources and traditional knowledge associated with genetic resources that occur in transboundary situations or for which it is not possible to grant or obtain prior informed consent, Recognizing the importance of genetic resources for food security, public health, biodiversity conservation, and the mitigation of and adaptation to climate change, Recognizing the special nature of agricultural biodiversity, its distinctive characteristics and problems, which require specific solutions, Recognizing the interdependence of all countries with regard to genetic resources for food and agriculture, as well as their special nature and importance for achieving global food security and for the sustainable development of agriculture in the context of poverty reduction and climate change, and recognizing the fundamental role of the International Treaty on Plant Genetic Resources for Food and Agriculture and the FAO Commission on Genetic Resources for Food and Agriculture in this regard, Taking into account the International Health Regulations (2005) of the World Health Organization and the importance of ensuring access to human pathogens for the purposes of public health preparedness and response, Recognizing the ongoing work in other international forums regarding access and benefit-sharing, Recalling the Multilateral System of Access and Benefit-sharing established under the International Treaty on Plant Genetic Resources for Food and Agriculture developed in harmony with the Convention, Recognizing that international instruments related to access and benefit-sharing should be mutually supportive with a view to achieving the objectives of the Convention, Recalling the importance of Article 8(j) of the Convention as it relates to traditional knowledge associated with genetic resources and the fair and equitable sharing of benefits arising from the utilization of such knowledge, Taking note of the interrelationship between genetic resources and traditional knowledge, their inseparable nature for indigenous communities (*) and local communities, and the importance of traditional knowledge for the conservation of biodiversity and the sustainable use of its components and for the sustainable livelihoods of these communities, (*) (Sinalevi Note: Through Article 2 of Law No. 10372 of November 14, 2023, which approved the Nagoya Protocol on fair and Recognizing the diversity of circumstances in which indigenous(*) and local communities hold or possess traditional knowledge associated with genetic resources, (*) (Sinalevi Note: Through Article 2 of Law No. 10372 of November 14, 2023, which approved the Nagoya Protocol on fair and equitable sharing in the benefits arising from their utilization to the Convention on biological diversity and its annex, the following was established: "The Republic of Costa Rica understands that when this Protocol refers to "indigenous communities" it refers to "indigenous peoples," which corresponds to the internationally agreed term.") Aware that it is the right of indigenous(*) and local communities to identify the rightful holders of their traditional knowledge associated with genetic resources within their communities, (*) (Sinalevi Note: Through Article 2 of Law No. 10372 of November 14, 2023, which approved the Nagoya Protocol on fair and equitable sharing in the benefits arising from their utilization to the Convention on biological diversity and its annex, the following was established: "The Republic of Costa Rica understands that when this Protocol refers to "indigenous communities" it refers to "indigenous peoples," which corresponds to the internationally agreed term.")
