Ordinary proceedings (proceso de conocimiento) brought by LUIS FERNANDO ORTIZ LÓPEZ, of legal age, married, forestry engineer, identity card 1-0853-0842, resident of Río Claro, Golfito, represented by attorney Roberto Matamoros Ramírez, identity card number 1-0956- 0882, Colegio de Abogados membership card 17291, against COLEGIO DE INGENIEROS AGRÓNOMOS (hereinafter CIAgro or Colegio), represented by its president Oscar Fonseca Rojas, of legal age, married, agricultural engineer, identity card No 1-0369-0968, and resident of San José.

I.As can be gathered from the complaint, the response, and the evidence contained in the record, the plaintiff Luis Fernando Ortiz López, in his capacity as a forestry engineer and forestry technical supervisor (regente forestal), entered into a forestry technical-supervision agreement (contrato de regencia forestal) (formulario 010980) with Aaron Michael Dyer on September 4, 2011, for the timber harvesting (aprovechamiento forestal) of property 6-19709-000, located in Escaleras de Playa Ballena, Osa, Puntarenas. Due to inspections conducted by officials of the Sistema de Áreas de Conservación (SINAC), during which irregularities were found, on November 10, 2011, the Head of the Departamento de Fomento de la Dirección de Recursos Forestales y Vida Silvestre of the Área de Conservación de Osa, by resolution ACOSA-DRFVS-DF-988-2011, ordered the suspension of the harvesting activities authorized by certificate of origin (certificado de origen) CFO-17/11, issued by Mr.
Ortiz López, on property 6-19709-000. At the same time, he ordered that the corresponding complaint be filed for infringement of the Ley Forestal, since the property did not have the characteristics required to be considered an agroforestry area (área agroforestal), as it contained trees more than twenty years old, recent crops, and a water outflow—a spring (naciente)—at the site. By official letter T.H. 08-2012 of November 13, 2012, the plaintiff was notified that the proceeding had been initiated, was given access to the administrative record (expediente administrativo), and was summoned to an oral, closed hearing (audiencia oral y privada). After the proceeding had been conducted, the Tribunal de Honor del CIAgro, at session no. 148 of August 26, 2013, recommended imposing a three-month suspension on engineer Ortiz López. That recommendation was adopted by the Junta Directiva del Colegio at session no. 25-2013 of October 28, 2013, and communicated on October 30, 2013, by official letter JD. 202-2013.
The plaintiff filed a motion for reconsideration (recurso de reposición) against the final administrative act (acto final del procedimiento); it was denied by the Junta Directiva del CIAgro on February 24, 2014, at session 04-2014, and communicated on February 25, by official letter JD. 023-2014. In view of the foregoing, Engineer Ortíz Lopez sued CIAgro and requested that the judgment declare: “1. That this ordinary action be granted. 2. That agreement number 4 from session number 25-2013, held on October 28, 2013, set forth in administrative resolution J.D. 202-201.3, dated October 30, 2013, as well as resolution JD 023-2014, dated February 25, 2014, which exhausted administrative remedies (agotó la vía administrativa), and all related, ancillary, or derivative acts leading to their issuance, which ordered the disciplinary sanction of suspension from professional practice for a period of 3 months, be declared null and void. 3.
That a public apology be made to Eng. Luis Fernando Ortiz López, to be published on the website of the Colegio de Ingenieros Agrónomos de Costa Rica for the same period for which I was suspended, 3 months. 4. That the Colegio de Ingenieros Agrónomos de Costa Rica be ordered to pay compensation for the subjective non-pecuniary harm (daño moral subjetivo) caused, the amount of which shall be determined during enforcement of the judgment (ejecución de sentencia). 5. That the Colegio de Ingenieros Agrónomos de Costa Rica be ordered to pay the attorney’s fees and litigation costs (costas personales y procesales) of these proceedings.” Counsel for the Colegio opposed the complaint and raised the defenses that the act was not subject to challenge and that there was a lack of legal right, interest, cause of action, standing to sue and be sued, as well as sine actione agit. The Tribunal, composed of Sergio Mena García, Marianella Álvarez Molina, and Rodrigo Alberto Campos Hidalgo, stated the following in the operative portion (parte dispositiva) of its judgment: “The defenses of lack of interest and lack of standing to sue and be sued are denied.
The defense of lack of legal right is granted. The ‘sine Actione agit’ argument is denied. Consequently, the complaint is dismissed in its entirety. The plaintiff is ordered to pay both categories of costs in favor of the Colegio de Ingenieros Agrónomos.” Dissatisfied with the ruling, the plaintiff filed an appeal on points of law (recurso de casación), which is admissible.
II.First: The appellant raises a claim of indirect violation of the law (violación indirecta de ley) concerning the assessment of the evidence. Although presented as a single ground, the arguments may be divided into three parts: A) He states that, among facts 3, 4, and 5, the judgment omits mention that on December 6, 2011, he submitted a letter to the Fiscalía Forestal del Colegio resigning from his technical-supervision engagement and requesting that it be halted until the observations made by MINAET were clarified. This evidence appears on folio 7 of the administrative record. By assigning no weight to that request, he contends, the judgment fails to identify and properly assess his professional obligations and creates the impression that the technical-supervision engagement continued, when in fact it was stopped immediately because of MINAET’s concerns, thereby preventing even a single tree from being cut.
He argues that the judgment neither established nor stated that no environmental damage (daño ambiental) occurred. That is critically important to the proper assessment and review of his actions as forestry technical supervisor. Because of that omission, he was deemed to have acted with absolute negligence or willful misconduct in issuing that permit. B) He challenges proven fact number 30, stating that the MINAET official who originally processed the complaint, Ginnette Gabriela Jiménez Soto, indicated that she had marked the trees 30 meters from the drainage ditch (acequia) (at minute 3:05:00), which does not establish an environmental violation because, for such a violation to occur, the trees would have had to be marked outside the 15-meter “protected area” (zona de protección). He alleges that the 3-month sanction was imposed because he had marked trees during his technical-supervision engagement “within the protected area.” That witness, however, stated the opposite, and therefore, he emphasizes, he should at a minimum have been acquitted on the basis of doubt.
He adds that a forestry engineer cannot determine whether an overflow of water is a drainage ditch, so he took precautions and marked the trees outside the prohibited area. He argues that the testimony on this point is vague and confusing and, for that reason, insists that it must be construed in his favor. Regarding the report she issued on November 21, 2011, he notes that it stated that rubber trees (Castilla Elástica) had been cut. These were not charged or cited against him because the trees that had been marked and formed the basis of the complaint were Spanish cedar trees (cedro amargo), were outside the protected area, and moreover had not been felled, as stated by the MINAET official at minute 3:19:47. Even so, he explains, he was sanctioned. Nor, he states, was it established that the plaintiff had been seen cutting trees, clearing forest undergrowth (socola del bosque), or planting agroforestry species (especies agroforestales) (testimony at minutes 2:57:35 and 3:23:02).
Despite that, he says, he was charged with that conduct. The witness clearly stated that she never saw anyone engaged in those activities. He also alleges that the witness established that the site contained markings made by other professionals that could not be attributed to the plaintiff; nevertheless, no distinction among those markings was made in either the disciplinary proceeding (procedimiento disciplinario) or the administrative litigation (proceso contencioso administrativo). He adds that there was no environmental-damage report because no such damage existed. Furthermore, he explains, the judges considered the “age of the trees” and their thickness as criteria for attributing liability, although this was not part of the analysis by the Tribunal de Honor del Colegio. The judges’ assessment of the evidence was therefore incorrect. He concludes that the proven fact on which virtually all of the plaintiff’s liability rests must be annulled because it is inconsistent with the evidence.
If annulled, there would be no basis for any charge against him. Therefore, no violation of Article 3 and 28 of the Ley Forestal is established. C) He challenges fact number 3, which was deemed unproven. He contends that the judges considered the plaintiff’s testimonial evidence accommodating and inconsistent with that of the MINAET official. In that regard, he states, the judges did not explain why the witnesses were accommodating or in what respect their testimony was contradictory. The judgment provides no reasoning on this issue and is unclear in that regard, thereby violating the right of defense and the proper assessment of the evidence in these proceedings. Finally, he states that the area was deemed not to have been shown suitable for an agroforestry system (sistema agroforestal), even though the testimony of two professionals establishes that it was. The rules of reasoned judgment (reglas de la sana crítica) were applied subjectively.
III.Regarding the omission to assess the request submitted by the plaintiff seeking suspension of his forestry supervision (regencia), it must be noted that it was found as proven that no agroforestry system (sistema agroforestal) existed on the property where the harvesting plan (plan de aprovechamiento) was to be carried out. This leads to the conclusion that the certificate of origin (certificación de origen) issued by the plaintiff was irregular. The fact that he submitted that request relinquishing his supervisory role does not eliminate his responsibility for issuing that document, in which he certified, exercising the public certification authority (fe pública) vested in him as supervisor, that an agroforestry system existed that could be harvested, in this case by felling trees. In addition, it was found as proven that the harvesting activity authorized by the plaintiff was suspended by the Área de Conservación de Osa on 10 de noviembre de 2011.
By contrast, the request in which the plaintiff relinquished his supervisory role was dated 6 de diciembre 2011, that is, after SINAC had acted. Accordingly, the fact that no trees were felled and, therefore, that no environmental damage occurred was not due to actions taken by the plaintiff, but rather to the timely suspension of the permit by the Área de Conservación de Osa. With respect to the assessment of the testimony of the official Guinette Jimenez Soto, the appellant insists that her testimony establishes that the plaintiff did not mark any tree within the protection zone (zona de protección), and thus that the environmental violation was not proven. In response to the specific questions put to the witness, she stated that there were trees around the stream, at different distances, some at 30 meters and others at different distances. She did not say that all of them were at least 30 meters away, as the appellant attempts to suggest. In addition, it is important to recall that the Tribunal de Honor found as proven that the plaintiff committed three violations:
IV.Second: Violation of the principles of proportionality and reasonableness. He asserts that a very severe sanction was imposed on him even though it was not possible to prove his responsibility for the area where the undergrowth was cleared, for marking trees in a protection zone, for implementing the supervisory permit (permiso regencial), for planting or simulating an agroforestry system, or for the cutting of the bitter cedar trees; consequently, he concludes, it was not shown that his actions caused environmental damage. None of that occurred; nevertheless, he argues, he was suspended as a forestry engineer and not as a supervisor. He adds that the charges were brought against him in his capacity as a forestry supervisor (regente forestal), not as a forestry engineer, which are entirely different capacities. Yet he was sanctioned with a 3-month suspension in his capacity as a forestry engineer when the actions were performed as a supervisor.
V.Considerando III clarified the facts for which responsibility was attributed to the plaintiff. That said, to determine the possible sanctions for those acts and whether they are proportional to the violations, it is necessary to review the regulations applied. In the final administrative act, the Junta Directiva concluded that Mr. Ortiz López had violated the following provisions: 3, 31, 33, 34, and 55 of the Ley Forestal; 2 and 30 of the Reglamento of that Law; and 5, 8 subsection g), 23, and 24 subsection e) of the Código de Ética Profesional del Colegio de Ingenieros Agrónomos. Pursuant to provision 58 of the Ley Orgánica del Colegio de Ingenieros Agrónomos (Ley Orgánica CIAgro) and numeral 11 subsection b) of the regulations to that law, decreto no. 22688, those violations may be sanctioned by a written reprimand, temporary suspension for up to two years, or expulsion from membership in the Colegio for up to 5 years.
Considering that it was found as proven that the plaintiff marked 22 trees under the forestry-system modality even though that condition did not exist, that he marked 8 trees in a protection zone surrounding a spring even though trees may not be felled within a radius of 100 meters from the spring, and that he certified the existence of an agroforestry system where none existed, this Chamber finds that the sanction imposed is commensurate with the proven violations. Had any tree been felled, thereby causing environmental damage, a more severe sanction could properly have been imposed on him, including expulsion from membership in the Colegio for up to 5 years. It is important to emphasize that a forestry engineer—and all the more so a supervisor—has the fundamental duty to safeguard the conservation and protection of forest resources, as well as their sustainable production and harvesting, in accordance with the principle of the proper and sustainable use of renewable natural resources.
As a supervisor, he also assumes responsibility for implementing the management plan (plan de manejo) or other forestry activities by supervising, controlling, and monitoring the operations performed by the supervised company or person. These professionals bear considerable responsibility for protecting forest and water resources and the environment in general. The conduct proven against the plaintiff was therefore properly sanctioned and, in the judgment of this Court of Cassation, the sanction is proportional to the violations attributed to him. Finally, the appellant challenges his sanction as a forestry engineer because, according to him, he acted as a supervisor. Regarding that argument, it must be noted that, from the outset, in the notice of charges (traslado de cargos), the charges attributed to the plaintiff concerned violations of provisions 13 subsections a and c of the Ley Orgánica CIAgro; 16 subsections b and ch of the Reglamento a la Ley Orgánica CIAgro; 3, 5, 6, 8 subsections f, g, h, i, 9 subsections a and b, 21, 23, and 24 subsections a and b of the Código de Ética Profesional del Colegio de Ingenieros Agrónomos; 3 subsection h), 28, 33, and 34 of the Ley Forestal; 2 of the Reglamento de la Ley Forestal; 30, 90, and 91 of the Combinación de Especies Forestales; and 5 and 10 of Decreto 26870.
Those provisions were binding on him as a forestry engineer affiliated with the Colegio, and his failure to comply with them was therefore attributed to him in that capacity, as is evident from the final administrative act in the proceeding. Furthermore, the sanction was issued by the Junta Directiva, the body with authority to discipline members, as established by article 58 of the Ley Orgánica CIAgro, which reads verbatim: “ARTICLE 58.- Matters submitted for consideration by the Tribunal de Honor which, in its judgment, warrant imposing a sanction on any member of the Colegio shall be referred to the Junta Directiva, which shall impose one of the following penalties: a) Written reprimand. b) Temporary suspension of membership in this Colegio. c) Expulsion. The decision shall be published when expressly ordered by the Tribunal.” By contrast, had the investigation and sanction concerned his conduct as a supervisor, the Fiscalía would have had jurisdiction to sanction him, as established by canon 52 subsection h) of the Ley Orgánica CIAgro, which provides: “ARTICLE 52.- The duties of the Fiscalía are: h) To suspend supervisors from their duties in the event of noncompliance with the legal provisions governing the subject matter.” Accordingly, and considering that serving as a supervisor requires membership in CIAgro and certification through the forestry-supervision training course offered by the Colegio, as established by numerals 21 of the Ley Forestal and 10 and 11 of the Reglamento de Regencias Forestales, suspension as a forestry engineer entails suspension as a supervisor.
Had the Colegio intended to sanction him solely as a supervisor, the proceeding would have followed provision 52 subsection h) of the Ley Orgánica CIAgro, which did not occur; the objection is therefore rejected.
VI.Third: He states that the nature of contentious-administrative proceedings allows any person subject to administrative authority who believes that his constitutional, property, personal, and legal rights have been infringed to resort to the contentious-administrative jurisdiction for a review of legality, in accordance with Articles 39, 41, and 49 of the Political Constitution. Regarding costs, in section IX of the judgment, he infers that the Court does not state the reasons establishing “Bad Faith” in litigating the proceeding in which a broad review of the legality of the actions of the Tribunal of Honor was requested, thereby imposing a double penalty. Thus, he argues, with a terse explanation supporting the finding of bad faith, the judges order him to pay costs. On the contrary, he states, the litigation was pursued in good faith; no surprise evidence was submitted; the claims were never frivolous; rather, he says, they were accepted at the preliminary hearing by all parties and by the Court, without any observation that they did not conform to the legal system; every stage of the full-cognizance proceeding was completed with absolute respect; and the allegations in the present case were defended with facts, rules, and evidence. He concludes that there is no reason to order him to pay costs on the basis of alleged bad faith in litigating the present proceeding.
VII.As may be seen, the appellant challenges the award of costs because, in her opinion, she litigated in good faith. In ruling on this issue, the Court stated: “Article 193 of the Contentious-Administrative Procedure Code provides that procedural costs and attorneys’ fees shall be imposed upon the losing party solely by virtue of having lost, a ruling that must be made even sua sponte pursuant to section 119.2 thereof, except in cases in which the litigation is deemed to have been pursued in good faith. In this particular case, the Court finds no grounds to exempt the plaintiff from paying costs; accordingly, he must pay them to the defendant non-state public entity.” To begin with, the Court is not stating that the plaintiff acted in bad faith, but rather exercised the authority conferred by section 193 of the Contentious-Administrative Procedure Code. That provision establishes the general principle that costs are imposed upon the losing party by the mere fact of having lost and that a waiver is possible only by way of exception, in the cases expressly provided for by the legislature.
Consequently, the award is generally imposed upon the losing party by the mere fact of having lost, as the Court did in the case under review. It should be noted that the cited provision grants the adjudicator the authority to exempt the losing party from that payment if, in the adjudicator’s judgment, sufficient grounds for litigating existed. Thus, the issue in dispute is whether Mr. Ortiz López did in fact have sufficient grounds to bring an action against CIAgri and, accordingly, whether there are grounds to grant him an exemption from paying costs. Regarding the concept of sufficient grounds for litigating, the First Chamber has held: “…it does not consist of the losing party’s mere conviction regarding its position, but requires that such conviction be based on objective information from the proceeding…” (See, among many others, First Chamber judgment no. 2012-1692 of 13 de diciembre de 2012).
To conclude that a litigant had sufficient grounds to resort to judicial proceedings, it must be determined that the party acted on the basis of a reasonable conviction concerning the right defended in the litigation. But that conviction, as has been stated, cannot be limited to the claimant’s subjective belief; rather, objective elements must exist that reinforce and support the decision to bring an action seeking recognition of a right. In other words, anyone who resorts to the courts must have reasonable grounds in fact and law for litigating. In this regard, this Court of Cassation observes that, in the case under review, Eng. Ortiz Lopez was fully aware that his conduct was not in accordance with the law because he certified that an agroforestry system existed on the property where he performed forestry-regency duties, when no such system existed, and authorized a harvesting plan consisting of the felling of 25 trees, 22 of which had been marked by him and were not located in an agroforestry area, while 8 of them were situated within a water-resource protection zone.
This Chamber finds no sufficient grounds for resorting to the courts to defend conduct that is manifestly contrary to law and the public interest and that violates the right to the protection of forest and water resources and the environment in general. It is therefore clear that he cannot be exempted from paying costs; consequently, this objection, like the others, must be dismissed.
VIII.Consequently, in accordance with the foregoing, the appeal must be denied. Pursuant to section 150(3) of the CPCA, the person who filed the appeal shall bear its costs.
POR TANTO
The appeal is denied, with costs to be borne by the appellant.

Proceso de conocimiento establecido por LUIS FERNANDO ORTIZ LÓPEZ, mayor, casado, ingeniero forestal, cédula de identidad 1-0853-0842, vecino de Río Claro, Golfito, representado por el licenciado Roberto Matamoros Ramírez, cédula de identidad número 1-0956- 0882, carné del Colegio de Abogados 17291 contra COLEGIO DE INGENIEROS AGRÓNOMOS (en adelante CIAgro o Colegio), representado por su presidente Oscar Fonseca Rojas, mayor, casado, ingeniero agrónomo, cédula de identidad No 1-0369-0968 y vecino de San José.

CONSIDERANDO
I.Tal y como se extrae de la demanda, la contestación y de las pruebas constantes en autos, el actor Luis Fernando Ortiz López en su condición de ingeniero y regente forestal, suscribió el 4 de setiembre del 2011, contrato de regencia forestal (formulario 010980) con Aaron Michael Dyer para el aprovechamiento forestal de la propiedad 6-19709-000, ubicada en Escaleras de Playa Ballena, Osa, Puntarenas. Debido a inspecciones realizadas por funcionarios del Sistema de Áreas de Conservación (SINAC) donde se encontraron anomalías, el 10 de noviembre del 2011, el Jefe del Departamento de Fomento de la Dirección de Recursos Forestales y Vida Silvestre, del Área de Conservación de Osa, mediante la resolución ACOSA-DRFVS-DF-988-2011, ordenó suspender las labores de aprovechamiento autorizadas mediante certificado de origen CFO-17/11, emitido por el señor Ortiz López, en la finca 6-19709-000. A la vez, ordenó presentar la denuncia correspondiente por infracción a la Ley Forestal, habida cuenta de que la heredad no tenía las aptitudes para ser considerada un área agroforestal, por tener árboles con más de veinte años de antigüedad, cultivos recientes y existía en el sitio un brote de agua (naciente).
Mediante el oficio T.H. 08-2012 del 13 de noviembre de 2012, se le comunicó al actor la apertura del procedimiento, donde se le puso en conocimiento del expediente administrativo y se le convocó a audiencia oral y privada. Luego de seguido el procedimiento, el Tribunal de Honor del CIAgro en sesión no. 148 del 26 de agosto del 2013, recomendó imponerle al ingeniero Ortiz López, una sanción de tres meses de suspensión. Dicha recomendación fue acogida por la Junta Directiva del Colegio, en la sesión no. 25-2013 del 28 de octubre del 2013, comunicada el 30 de octubre del 2013, mediante el oficio JD. 202-2013. Contra el acto final del procedimiento, el acto presentó recurso de reposición, rechazado por la Junta Directiva del CIAgro el 24 de febrero del 2014, en la sesión 04-2014 y comunicado el 25 de febrero siguiente, mediante oficio el JD. 023-2014. Debido a lo expuesto, el Ingeniero Ortíz Lopez, demandó al CIAgro y pretendió que en sentencia se declare: "1.
Con lugar la presente demanda ordinaria de conocimiento. 2. Que se declare la nulidad del acuerdo número 4 de la sesión número 25-2013, celebrada el 28 de octubre del 2013, consignado en la resolución administrativa J.D. 202-201.3, de fecha 30 de octubre del año 2013, así como la resolución JD 023-2014, de fecha 25 de febrero del año 2014, que agotó la vía administrativa, así como sus actos conexos, anexos, o derivados que se produjeron para su conformación, mismos que ordenaron la sanción disciplinaria de suspensión como profesional por un período de 3 meses. 3. solicitar una disculpa pública al ing. Luis Fernando Ortiz López, que deberá publicarse en la página web del Colegio de Ingenieros Agrónomos de Costa Rica por el mismo plazo que fui suspendido, 3 meses. 4. Que se condene al Colegio de Ingenieros Agrónomos de Costa Rica al pago del daño moral subjetivo causado, el cual será liquidado en ejecución de sentencia. 5.
Que se condene al Colegio de Ingenieros Agrónomos de Costa Rica al pago de las costas personales y procesales de éste proceso.". La representación del Colegio se opuso a la demanda e interpuso las defensas de acto no susceptible de impugnación, falta de: derecho, interés, causa, legitimación activa y pasiva, así como sine actione agit. El Tribunal integrado por Sergio Mena García, Marianella Álvarez Molina y Rodrigo Alberto Campos Hidalgo, consignó en la parte dispositiva de su fallo siguiente: “Se rechazan las defensas de falta de interés, falta de legitimación activa y pasiva. Se acoge la defensa de falta de derecho. Se rechaza el alegato de "sine Actione agit". En consecuencia, se declara sin lugar la demanda en todos sus extremos. Se condena al actor al pago de ambas costas a favor del Colegio de Ingenieros Agrónomos.” Inconforme con lo resuelto presenta recurso de casación la parte actora, el cual resulta admisible.
II.Primero: La parte recurrente plantea un reparo por violación indirecta de ley en relación con la valoración probatoria. Pese que lo hace en un solo cargo, se pueden dividir en tres sus alegatos: A) Expresa, entre los hechos 3, 4 y 5, se omite indicar que el 6 de diciembre del 2011, presentó una nota ante la Fiscalía Forestal del Colegio, renunciando a la regencia y solicitando que se detuviera hasta que se aclaren las observaciones hechas por el MINAET. Prueba que se encuentra en el folio 7 del expediente administrativo. Al no darle ningún valor a dicha solicitud, indica, se omite señalar y valorar correctamente las obligaciones profesionales, y se hace creer que la regencia continuó, cuando lo cierto es que se detuvo de inmediato por los cuestionamientos del MINAET, evitándose así la corta de un solo árbol. Arguye, no se acreditó ni se señaló en la sentencia, que no hubo daño ambiental.
Eso es de vital importancia para la correcta valoración y el examen de las actuaciones como regente forestal. Debido a esa omisión se tiene por operada la negligencia absoluta o dolo en el otorgamiento de dicho permiso. B) Combate el hecho probado número 30 diciendo, la funcionaria del MINAET, quien originalmente tramitó la denuncia, Ginnette Gabriela Jiménez Soto, señaló que había marcado los árboles a 30 metros de la acequia (al minuto 3:05:00), con lo cual no se acredita la infracción ambiental, por cuanto para que esto ocurra, deben haberse marcado fuera de los 15 metros de la “zona de protección”. Alega, la sanción de 3 meses, fue por haber marcado árboles en su regencia “dentro de la zona de protección”. Sin embargo, dicha testigo refiere lo contrario, con lo cual, resalta, debió como mínimo absolvérsele por duda. Agrega, un ingeniero forestal no puede acreditar si un rebalse de agua es una acequia, por lo que tomó las previsiones y marcó los árboles fuera de la zona de prohibida.
Arguye, la declaración en este punto es vaga y confusa y por eso, insiste, se le debe favorecer. Sobre el informe por ella rendido el 21 de noviembre de 2011, menciona, en este se incluyó que se habían cortado árboles de hule (Castilla Elástica). Estos no fueron imputados o reprochados ya que los árboles que fueron marcados y que fueron base de la denuncia son de cedro amargo, y estaban fuera de la zona de protección y además de ello no fueron talados, declaración de la funcionaria del MINAET al minuto 3:19:47. Aun así, expone, se le sancionó. Tampoco, refiere, se logró acreditar que el actor fuera visto cortando árboles, o haciendo socola del bosque o sembrando especies agroforestales (declaración al minuto 2:57:35 y 3:23:02). A pesar de eso, dice, se le imputó esa actuación. La testigo manifestó claramente que nunca vio a nadie trabajando en estas actividades. También, alega, acreditó la declarante, que en el lugar había marcas de otros profesionales, que no podían ser reprochados al actor, aun así, no se hace diferencia alguna de dichas marcas, ni en el procedimiento disciplinario ni en el proceso contencioso administrativo.
Agrega, no hubo informe de daño ambiental porque no existió. Además de esto, explica, los jueces valoraron la “vejez de los árboles” y el grosor, como un parámetro para inculpar responsabilidad, sin embargo, esto no fue parte del análisis del Tribunal de Honor del Colegio. Por ello la valoración de la prueba por parte de los jueces fue incorrecta. De esta forma, concluye, el hecho probado sobre el que gravita prácticamente toda la responsabilidad del actor debe ser anulada porque no coincide con la prueba. De ser así, no existe reproche en su contra. Por tanto, no se acredita la violación del artículo 3 y 28 de la Ley Forestal. C) Combate el hecho tenido como no probado número 3. Acusa, para los jueces la prueba testimonial de la parte actora fue complaciente y se contradice con la de la funcionaria del MINAET. Respecto de eso, dice, los juzgadores no motivan porque los testigos son complacientes, ni en qué sentido hay contradicciones.
No hay motivación en el fallo y este es oscuro al respecto, vulnerándose el derecho de defensa y la correcta valoración de las pruebas en este proceso. Finaliza, se tiene por indemostrado que la zona era apta para el sistema agroforestal, a pesar de que la prueba testimonial de dos profesionales así lo acredita. Hay subjetividad en la aplicación de las reglas de la sana crítica.
III.Respecto de la omisión de valorar la nota de solicitud de suspensión de la regencia emitida por el actor, es menester indicar que se tuvo por acreditado que no existía un sistema agroforestal, en la propiedad donde se llevaría a cabo el plan de aprovechamiento. Lo que hace concluir que la certificación de origen extendida por el actor fue irregular. El hecho de que haya presentado esa nota renunciando a la regencia, no elimina la responsabilidad de la emisión de dicho documento, donde certificó, haciendo uso de la fe pública que lo cobija como regente, que existía un sistema agroforestal que podía ser aprovechado, en este caso con la tala de árboles. Aunado a lo anterior, se tuvo por acreditado que la labor de aprovechamiento autorizada por el actor fue suspendida por el Área de Conservación de Osa el 10 de noviembre de 2011. Mientras que la nota donde el actor renuncia a la regencia lo fue de fecha 6 de diciembre 2011, es decir en forma posterior a la actuación del SINAC.
De ahí que, el hecho de que no se haya producido tala de árboles y por tanto el daño ambiental, no obedece a actuaciones propias del accionante sino, por la suspensión a tiempo del permiso por parte del Área de Conservación de Osa. Referido a la valoración del testimonio de la funcionaria Guinette Jimenez Soto, insiste el recurrente que de la declaración se extrae que el actor no marcó ningún árbol dentro de la zona de protección, con lo cual no se acredita la infracción ambiental. A las preguntas específicas realizadas a la testigo, esta contestó que habían árboles alrededor de la quebrada, a diferentes distancias, algunos a 30 metros y a otras distancias. No dice que todos estaban a mínimo 30 metros como lo intenta hacer ver el recurrente. Aunado a lo anterior, es importante recordar que el Tribunal de Honor tuvo por acreditado la comisión de tres faltas por parte del accionante:
IV.Segundo: Violación de los principios de la proporcionalidad y la razonabilidad. Estima, se le impuso una sanción muy alta, a pesar de que no se pudo demostrar su responsabilidad respecto del área socolada, ni de haber marcado árboles en zona de protección, o de haber ejecutado el permiso regencial, ni haber sembrado o simulado un sistema agroforestal, o que se hayan cortado los árboles de cedro amargo, por ende, concluye, no se demostró que ocasionara con su actuar daño ambiental. Nada de eso sucedió, sin embargo, acusa, se le suspendió como ingeniero forestal, y no como regente. Agrega, las imputaciones hechas lo fueron en la calidad de regente forestal y no como ingeniero forestal, que son condiciones completamente distintas. Pero se le sanciona a 3 meses de suspensión en calidad de ingeniero forestal cuando las actuaciones fueron como regente.
V.En el considerando III se esclareció los hechos por los que se atribuyó responsabilidad al actor. Ahora bien, para tener claridad respecto de las posibles sanciones a dichos actos y si estas son proporcionales a las faltas, precisa revisar la normativa utilizada. Concluyó la Junta Directiva en el acto final, que el señor Ortiz López incurrió en violación de las siguientes normas: 3, 31, 33, 34 y 55 de la Ley Forestal, 2 y 30 del Reglamento de esa Ley, así como 5, 8 inciso g), 23 y 24 inciso e) del Código de Ética Profesional del Colegio de Ingenieros Agrónomos. Dichas faltas pueden ser sancionadas con amonestación por escrito, suspensión temporal hasta por dos años o expulsión como miembro del Colegio hasta por 5 años, de conformidad con lo establecido en el precepto 58 de la Ley Orgánica del Colegio de Ingenieros Agrónomos (Ley Orgánica CIAgro) y el numeral 11 inciso b), del reglamento de dicha ley, decreto no. 22688.
Ahora bien, considerando que se tuvo por acreditado que el actor realizó la marca de 22 árboles bajo la modalidad de sistema forestal, cuando no existió esa condición, que marcó 8 árboles en zona de protección por naciente, cuando no se pueden talar árboles en un radio de 100 metros de la naciente y por certificar la existencia de un sistema agroforestal donde no existía, en criterio de esta Cámara, la sanción impuesta se ajusta a las faltas demostradas. De haberse ejecutado la tala de algún árbol, y por consiguiente ocasionado un daño ambiental, bien pudo imponérsele una sanción mayor, de hasta 5 años de expulsión como miembro del Colegio. Es importante resaltar que un ingeniero forestal y con mucha más razón un regente, tiene el deber fundamental de velar por la conservación y la protección de los recursos forestales, así como por la producción y aprovechamiento sostenible de estos, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables.
Como regente, además, asume la responsabilidad de la ejecución del plan de manejo o de otras actividades forestales, mediante la supervisión, control y seguimiento de las operaciones que realiza la empresa o persona regentada. Es mucha la responsabilidad que cargan estos profesionales en aras de la protección del recurso forestal, hídrico y medio ambiente en general, por lo que la actuación acreditada contra el actor se encuentra correctamente sancionada y en criterio de este Órgano Casacional es proporcional a las faltas irrogadas. Para concluir, el recurrente cuestiona la sanción como ingeniero forestal, cuando según dice, su actuación fue como regente. Sobre dicho argumento, es preciso indicar que desde el inicio en el traslado de cargos, las imputaciones que se le atribuyeron al actor, lo fueron por violación de normas 13 incisos a y c de la Ley Orgánica CIAgro, 16 incisos b y ch del Reglamento a la Ley Orgánica CIAgro, 3, 5, 6, 8 incisos f, g, h, i, 9 incisos a y b, 21, 23 y 24 inciso a y b del Código de Ética Profesional del Colegio de Ingenieros Agrónomos, 3 inciso h), 28, 33, 34 de la Ley Forestal, 2 del Reglamento de la Ley Forestal, 30, 90 y 91 de la Combinación de Especies Forestales, así como 5 y 10 del Decreto 26870.
Articulaciones que debían ser acatadas como Ingeniero Forestal del Colegio, por lo que el irrespeto de esas normas le es achacado en esa condición, lo que se extrae del acto final del procedimiento. Además la sanción proviene de la Junta Directiva, órgano competente para reprender las conductas de los agremiados tal y como lo establece el artículo 58 de la Ley Orgánica CIAgro que a la letra reza: “ARTICULO 58.- Los asuntos sometidos a la consideración del Tribunal de Honor, que en su concepto tengan mérito para establecer una sanción a algunos de los miembros del Colegio, serán remitidos a la Junta Directiva para que sea ésta la que imponga alguna de las siguientes penas: a) Amonestación por escrito. b) Suspensión temporal de la condición de miembro de este Colegio. c) Expulsión. El fallo se publicará, cuando expresamente lo ordene el Tribunal.”. Por el contrario, si la investigación y sanción lo hubiera sido por su actuación como regente, el competente para sancionarlo era la Fiscalía, tal y como lo decante el canon 52 inciso h) de la Ley Orgánica CIAgro el cual indica: “ARTICULO 52.- Son deberes de la Fiscalía: h) Suspender de sus funciones a los regentes, en caso de incumplimiento de las disposiciones legales que rigen la materia.”.
De conformidad con lo anterior, y considerando que para ser regente se requiere ser miembro colegiado del CIAgro, y haberse certificado en el curso de capacitación de regencia forestal impartido por el Colegio, tal y como lo decantan los numerales 21 de la Ley Forestal, 10 y 11 del Reglamento de Regencias Forestales, la suspensión como ingeniero forestal conlleva la suspensión como regente. Si la intención del Colegio hubiese sido sancionarlo solo como regente la actuación se hubiera ajustado a lo establecido en el precepto 52 inciso h) de la Ley Orgánica CIAgro, lo cual no ocurrió, de ahí el rechazo del reparo.
VI.Tercero: Expresa, la naturaleza del proceso contencioso administrativo permite que de conformidad con los artículos 39, 41 y 49 de la Constitución Política todo administrado que sienta lesionado sus derechos constitucionales, patrimoniales, personales, y legales pueda acudir a la vía contenciosa para que se realice un test de legalidad. En el punto IX del fallo, sobre las costas, infiere, el tribunal no señala las razones por las cuáles se prueba la “Mala Fe” para litigar en el proceso donde se solicitó un amplio examen de legalidad de las actuaciones del Tribunal de Honor, con lo cual se impone una doble sanción. De esta forma, arguye, con una fundamentación lacónica para motivar la mala fe, los jueces lo condenan al pago de las costas. Al contrario, expone, se ha litigado de buena fe, no se presentó prueba sorpresiva, las pretensiones nunca fueron temerarias, más bien, dice, fueron aceptadas en audiencia preliminar por todas las partes y por el Tribunal sin que se hiciera ninguna observación de que no se ajustaban al ordenamiento, se han cumplido todas las etapas del proceso de cognición plena bajo un absoluto respeto y se han defendido con hechos, normas y pruebas lo alegado en la presente causa. Finaliza, no hay motivo para que se condene en costas por una señalada mala fe al litigar en el presente proceso.
VII.Según puede verse, la impugnante acusa la condena en costas, ya que, en su opinión, litigó de buena fe. El Tribunal al resolver este tema indicó: “El artículo 193 del Código Procesal Contencioso Administrativo establece que las costas procesales y personales se imponen al vencido por el solo hecho de serlo, pronunciamiento que debe hacerse incluso de oficio, al tenor del numeral 119.2 ibídem. Salvo casos en los que se considere que el litigio es de buena fe. En el caso concreto el Tribunal no encuentra motivos para exonerar al actor del pago de costas, por tal motivo deberá sufragarlas en favor del ente público no estatal demandado.” Para empezar el Tribunal no está afirmando que el actor actuó de mala fe, sino que ejerció la potestad conferida en el canon 193 del Código Procesal Contencioso Administrativo. En dicha norma, se establece el principio general, según el cual, las costas se le imponen al vencido por el hecho de serlo y sólo, por vía de excepción, en los casos previstos expresamente por el legislador, es posible su dispensa.
Por consiguiente, la condenatoria en principio se impone al perdidoso por el hecho de serlo, según procedió el Tribunal en el sub-examine. Debe hacerse notar que la norma indicada, le provee a la persona juzgadora de la facultad de eximir al vencido de esa erogación, si a su juicio existió suficiente motivo para litigar. Así, el punto en discusión está en determinar si en efecto, el señor Ortiz López tenía suficientes motivos para entablar una demanda contra el CIAgri y con ello establecer si existe mérito para otorgarle la exoneración al pago de costas. Respecto del concepto suficiente motivo para litigar, la Sala Primera ha considerado: “…no consiste en la simple convicción de la parte vencida sobre su tesis, sino que requiere que el convencimiento se funde en datos objetivos del proceso…” (Véase entre muchos otros, el fallo de Sala Primera no. 2012-1692 del 13 de diciembre de 2012). Para arribar a la conclusión de que un litigante ha tenido los suficientes motivos para acudir a un proceso judicial, debe determinarse que la parte actuó sobre la base de una convicción razonable del derecho defendido en el pleito.
Pero ese convencimiento, tal y como se ha dicho, no puede restringirse a una creencia subjetiva de quien demanda, sino que deben existir elementos objetivos que refuercen y sustenten esa decisión de accionar en busca del reconocimiento de un derecho. En otras palabras, quien acude a estrados judiciales debe tener razones de hecho y derecho atendibles para litigar. Al respecto, observa este Tribunal de Casación, que en el caso de estudio, el Ing. Ortiz Lopez tenía pleno conocimiento de que su conducta no era ajustada a derecho, pues certificó que en la finca donde realizó la regencia forestal había un sistema agroforestal, el cual resultó inexistente y autorizó un plan de aprovechamiento, consistente en la tala de 25 árboles, de los cuales habían marcados por su persona 22 que no se encontraban en zona agroforestal y 8 de ellos estaban situados dentro de una zona de protección hídrica. No encuentra esta Cámara, motivo suficiente para acudir a los estrados a defender una actuación que es evidentemente contraria a derecho, al interés público y violatorio del derecho a la protección del recurso forestal, hídrico y medio ambiente en general. Así resulta claro, no es posible eximírsele del pago de las costas; razón por la cual corresponde desestimar este reparo al igual que el resto.
VIII.En consecuencia, conforme a lo expuesto corresponde declarar sin lugar el recurso. Sufragar las costas del recurso quien lo interpuso, a tenor de lo que señala el numeral 150 inciso 3) del CPCA.
POR TANTO
Se declara sin lugar el recurso, son las costas a cargo de la parte recurrente.
