SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At eleven hours and fifty-seven minutes on veintinueve de junio de dos mil veinte.- SUMMARY TREE-REMOVAL PROCEEDING (PROCESO SUMARIO DE DERRIBO) filed by [Nombre1] , an elderly adult, divorced, homemaker, resident of Puntarenas, identification card CED1 - - ; against [Nombre2] , of legal age, married, unemployed, identification card CED2 - - , resident of Puntarenas, and [Nombre3] , of legal age, married, attorney, resident of Heredia, identification card CED3 - - . Attorney Kembly Mora Salas, [Dirección1] , acts as public defender for the plaintiff. Heard before the Agrarian Court of Puntarenas.- Judge Castro García delivers the opinion; and,

WHEREAS:

I.In decision number 2020000137, issued at fourteen hours and forty minutes on dieciséis de junio de dos mil veinte (images 4 through 6, PDF view of the digital case file), the Agrarian Court of Puntarenas declined jurisdiction on subject-matter grounds (se inhibió en razón de la materia) and referred the record to this Court. The order declining jurisdiction (auto inhibitorio) found that the land on which the mango tree that endangers the plaintiff’s dwelling is located corresponds to property possessed by defendant [Nombre2] , namely property registered under folio [Placa1] of Puntarenas, which according to the Registry is titled in the name of INVU under survey plan P-455277-1981. The decision was based on the fact that the initial filing stated that, on that land near [Dirección2] , there is a mango tree approximately 12 meters tall. It stands approximately two meters from the plaintiff’s house and poses a danger because, if the tree or a branch were to fall, it could cause property damage or harm to the life of any person.

She therefore requested safety measures (medidas de seguridad) requiring the defendant in possession, [Nombre2] , to cut the tree’s branches. The court concluded that the matter before it (subjúdice) is not a summary dangerous-condition proceeding (sumario de peligrosidad), but rather an ordinary proceeding concerning neighborly obligations (obligaciones de vecindad) under Articles 403 and 404 of the Civil Code because there is no agrarian production activity, the properties are not agrarian lands, and, according to report SINAC-ACOPAC-OSRE-MRN-115-2020, the tree does not pose a present danger, nor does the report refer to an imminent danger.

II.Agrarian subject-matter jurisdiction (competencia agraria por razón de la materia) is generally determined by Articles 1 and 2 of the Agrarian Jurisdiction Act (Ley de Jurisdicción Agraria). Likewise, Article 113 of the Organic Law of the Judiciary provides that the agrarian courts shall hear matters relating to agrarian law, regardless of the amount in controversy, as well as any other matters assigned to them by law. Furthermore, trees, as natural resources, are governed, among other provisions, by the Biodiversity Act (Ley de Biodiversidad), Article 11(3) of which provides that the environmental public interest (interés público ambiental) is one of the criteria for applying that legislation. Specifically, the provision states: “The use of biodiversity elements must safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvement of citizens’ quality of life.” Such matters must be considered in deciding this proceeding because a natural resource is at issue, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction.

In essence, Article 108 of the Ley de Biodiversidad states: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the contentious-administrative courts. As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or the public domain shall fall within the jurisdiction of the agrarian courts.” Upon reviewing the record and the jurisdictional criteria governing agrarian matters, this Court does not agree with the reasoning of the cited lower-court decision insofar as it finds that this case must be heard in an ordinary proceeding. This is because the relief sought in this specific case and the proceeding selected correspond to the summary tree-removal procedure under Article 108 of the Code of Civil Procedure, which applies on a supplementary basis pursuant to Article 26 of the Ley de Jurisdicción Agraria, Transitory Provision I.2 of Ley 9342, and Transitory Provision II of Ley 9343. There is no legal or technical reason to bar the plaintiff from pursuing the summary proceeding to adjudicate the relief sought and the facts alleged in the complaint.

III-Regarding the court before which the proceeding must be heard, this Court also disagrees with the order declining jurisdiction, which found that the agrarian procedural forum lacks jurisdiction to hear this matter. The property on which the tree stands is for the defendant’s private use and, according to the complaint, is where he resides. That is, it is devoted to private use, is located in an urban area, and removal of a fruit-tree species is requested. This is shown in the complaint, survey plan, Registry certifications, and MINAE technical report (images 65,57 through 59, 52 through 56, 13 through 29). It should be noted that the MINAE technical report states the following conclusions: “4. Conclusions 4.1. The species under study is not among those subject to a prohibition (especies vedadas), as it is an exotic tree that regenerates abundantly in the region. Given the size of the tree and its location, it could pose a future risk to the community and to structures at the site.

The foregoing is stated on the basis of consultations conducted with experts in the field, who indicate that this species grows rapidly and that, within a relatively short period, the tree would reach a very substantial and unmanageable height. 5. Recommendations 5.1. As a precautionary measure (medida precautoria), systematically and uniformly cut the crown and branches using personnel qualified for that purpose; thereafter, felling of the tree is recommended. 5.2. In carrying out the aforementioned activities, all safety standards established by the regulations in force must be observed.” (report SINAC-ACOPAC-OSRE-MRN-115-2020, virtual case file, filing folder dated 27/05/2020). This Court finds that, even though the tree is located in an urban area and is a fruit tree, as shown by the photographs and the MINAE report, the claim concerns a natural resource. It therefore falls within the subject-matter jurisdiction of the agrarian courts under the cited legislation, and the declination of jurisdiction on subject-matter grounds must accordingly be denied. This position was maintained by this panel of the Agrarian Court in decision 1577-C-12, issued at twelve hours and fifteen minutes on veinte de diciembre de dos mil doce.

THEREFORE:

The lower court’s declination of jurisdiction on subject-matter grounds is denied. Once this decision becomes final, the case file shall be returned to the court of origin so that the legal proceedings may continue.

VOTO N° 585-C-2020 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las once horas y cincuenta y siete minutos del veintinueve de junio de dos mil veinte.- PROCESO SUMARIO DE DERRIBO interpuesta por [Nombre1] , adulta mayor, divorciada, ama de casa, vecina de Puntarenas, cédula CED1 - - ; contra [Nombre2] , mayor, casado, desempleado, cédula de identidad CED2 - - , vecino de Puntarenas y [Nombre3] , mayor, casada, abogada, vecina de Heredia, cédula de identidad CED3 - - . Actúa como defensora pública de la parte actora la licenciada Kembly Mora Salas, [Dirección1] . Tramitado ante el Juzgado Agrario de Puntarenas.- Redacta la jueza Castro García; y,

CONSIDERANDO:

I.El Juzgado Agrario de Puntarenas en decisión número 2020000137 de las catorce horas y cuarenta minutos del dieciséis de junio de dos mil veinte (imagen 4 a 6 modo pdf expediente digital) se inhibió en razón de la materia y remite a esta Instancia los autos. En el auto inhibitorio se estimó que el árbol donde se ubica el árbol de mango que pone en peligro la vivienda de la actora corresponde a una propiedad en posesión del demandado [Nombre2] , que es finca matrícula [Placa1] de Puntarenas que registralmente se encuentra a nombre del INVU con plano P-455277-1981. Se justificó en que en el escrito inicial se indicó en ese terreno por el [Dirección2] existe un árbol de mango, de aproximadamente 12 metros de altura. A dos metros aproximadamente de distancia de la casa de la actora que representa peligro de que al caer el mismo o una rama, pueda ocasionar daños materiales o en la vida de cualquier persona.

Por lo que solicitó medidas de seguridad, para que se corte las ramas del árbol a cargo del poseedor accionado [Nombre2] . Se estimó, el subjúdice no corresponde a un sumario de peligrosidad, sino a un proceso ordinario de obligaciones de vecindad según los artículos 403 y 404 del Código Civil, al no existir actividad agraria de producción, no se trata de fundos agrarios y no representa según el informe SINAC-ACOPAC-OSRE-MRN-115-2020 un peligro actual ni refiere a un peligro inminente.

II.La competencia agraria por razón de la materia está determinada en forma genérica por los artículos 1 y 2 de la Ley de Jurisdicción Agraria. Así mismo, el numeral 113 de la Ley Orgánica del Poder Judicial indica, conocerán los juzgados agrarios de lo relativo a la materia agraria, cualquiera que sea la cuantía y de los demás asuntos que les encomienden las leyes. Por otra parte, los árboles como recursos naturales, se encuentran regulados, entre otras normas, por la Ley de Biodiversidad, la cual dispone en el inciso 3 del artículo 11 que uno de los criterios de aplicación de esa normativa lo constituye el interés público ambiental. Concretamente, señala la norma: "El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos".

Tales aspectos deberán ser considerados para la resolución de este proceso, al estar de por medio un recurso natural; y la competencia material para tal determinación está reservada por ley a esta Jurisdicción. Básicamente, el numeral 108 de la Ley de Biodiversidad señala: "En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa. Como excepciones a la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria". Analizados los autos y vistos los criterios de competencia que rige la materia agraria, se estima no se comparte el razonamiento de la decisión citada de instancia, en cuanto considera que este proceso corresponde ser ventilado en la vía ordinaria.

En virtud de que la pretensión del caso concreto y el proceso elegido, corresponde a la vía sumaria de derribo del ordinal 108 del Código Procesal Civil, de aplicación supletoria en virtud del ordinal 26 de la Ley de Jurisdicción Agraria, Transitorio I.2 de Ley 9342 y II de Ley 9343. No existe razón jurídica o técnica para vetar a la actora del ejercicio del proceso sumario a fin de dilucidar la pretensión y hechos de la demanda.

III-Respecto a la sede competencial donde se debe tramitar el proceso, tampoco se comparte la inhibitoria que estimarse no es la vía procesal agraria la competente para tramitar este asunto. Pues la finca en donde se encuentra el árbol, es de uso particular del demandado; en donde habita según la demanda. Es decir, se destina a uso particular, esta en zona urbana y se pide eliminar una especie de árbol frutal. Lo cual, se observa en el escrito de demanda, plano, certificaciones registrales e informe técnico del MINAE (imágenes 65,57 a 59, 52 a 56, 13 a 29). Nótese que que en el informe técnico del MINAE se emiten como conclusiones: "4. Conclusiones 4.1. La especie en estudio no corresponde a las vedadas, siendo que es un árbol con una regeneración abundante en la región siendo la misma exótica. Por el tamaño del árbol y por la posición en que se encuentra, podría constituirse en un riesgo a futuro hacia la colectividad y para las construcciones del lugar.

Lo anterior, se indica con base a consultadas realizadas con expertos en la materia, donde manifiesten que dicha especie presenta crecimiento acelerado, donde en un plazo relativamente corto el árbol tendría una altura muy considerable e inmanejable. 5. Recomendaciones 5.1. Como medida precautoriaìa ejecutar la corta sistemática y unìforme de la copa y ramas con el personal idóneo para tal fin, posteriormente se recomienda ïa la tala del árbol 5.2. Para llevar a cabo la ejecución de las actividades supraindicadas debe cumplirse con todas las normas de seguridad establecidas en la normativa vìgente.." (informe SINAC-ACOPAC-OSRE-MRN-115-2020, expediente virtual, carpeta de escrito con fecha 27/05/2020). Estima esta Sede, aún y cuando ese árbol se sitúe en una zona urbana y sea un árbol frutal, según se observa de las fotografías e informe del MINAE, es un reclamo vinculado con un recurso natural.

Por lo que mismo es parte de la competencia material de los tribunales agrarios conforme a la normativa citada, por tal razón procede denegarse la inhibitoria por razón de la materia. Este criterio ha sido mantenido por esta integración del Tribunal Agrario en voto 1577-C-12 de las doce horas y quince minutos del veinte de diciembre de dos mil doce.

POR TANTO:

Se rechaza la inhibitoria decretada por el juzgado de instancia por razón de la materia. Firme esta resolución, itinérese el expediente al despacho de origen a fin de continuar con los procedimientos legales.
