CONSIDERING:

I.Proven facts (hechos probados): For purposes of deciding this matter, the following is deemed proven: The plaintiffs’ land is entirely planted with apple and avocado crops, covering approximately five thousand square meters, and they had been using, to irrigate those crops, the water-pipe network that ran from the defendant’s property and drew water from a spring (naciente) located within the defendant’s property.- (See judicial inspection (reconocimiento judicial) in images 48-49 of the case file in PDF format).- 2) At the boundary between the parties’ properties, a severed pipe and a seven-strand wire fence were observed; the latter modifies the previous fence to prevent access to the spring.- (Same citation as above).-

II.The defendant appeals the decision issued at eight hours and thirty minutes on once de octubre del dos mil diecinueve, concurrently seeking annulment (nulidad), on the grounds that the judicial inspection should be declared null because it was conducted before she had been served with the complaint sufficiently in advance, thereby leaving her unable to defend herself and violating due process and the right of defense, as a result of which she was not present when this evidence was taken. Furthermore, that judicial inspection was considered as the sole evidence without taking into account the defense evidence (prueba de descargo), which was not even mentioned, and the arguments made in response to the hearing granted concerning that sole item of evidence were omitted, with all other evidence being entirely disregarded; this constituted a failure to assess the evidence offered, which was not considered as a whole.

The defendant states that she is the registered owner and is exercising ownership rights over her property, which is not subject to any encumbrance; she may therefore exercise her right to defend and enclose it, which is what she did by modifying the fence to prevent a person from passing through, as authorized by Articles 302 and 295 of the Civil Code. This is an absolute right that she exercises over her property, where no person has permission to pass through or to use and exploit the water, much less to claim rights such as an easement (servidumbre) of any kind established for the benefit of the plaintiffs’ property or a right to use and exploit water. Any right the plaintiffs believe they have has been supported solely by their own statements and not by any evidence. She states that, pursuant to Article 4 of Water Law 276, privately owned waters belong to the owner of the land; the defendant is therefore exercising rights legally protected by her title as owner, particularly because she holds a concession to use the water from the spring and stream at issue, granted by the Water Directorate through decision R-10772019 Aguas-Minae at 8 hours 34 minutes on 12 de junio del 2019, which gives her complete exclusivity over that water resource.

She argues that the judicial inspection does not establish with certainty whether it was conducted on the plaintiffs’ property, real-property folio registration CED4, cadastral plan 1-2045363-2018, or on another property; rather, it merely states generically that they were at the place known as Río Blanco, Copey de Dota, as recorded in the judicial inspection, rendering the evidence null. Nor was the total area of the property verified, since they hold several legally unpartitioned interests in that property, which was likewise not recorded in the minutes; they recently acquired the property on 23 de agosto del 2018 as co-owners, making the evidence incomplete and one-sided because it includes only the statement of one co-owner rather than all of them. She further states that the existence of any proceedings before the Water Directorate of the Ministry of the Environment to obtain the required water concession for their property was not proven; the plaintiffs thus improperly and unlawfully induced the Court to impose legally untenable precautionary measures on another person’s property in order to defraud the State.

She states that the plaintiffs’ D2 environmental assessment document was not analyzed, even though it establishes that the project has its own water and has no need whatsoever to obtain water from any neighbor; without a concession, this constitutes unlawful appropriation of publicly owned water, yet none of this was assessed. Because neither urgency (peligro de demora) nor a prima facie showing of entitlement (apariencia de buen derecho) exists, the requested measures must be revoked. She also challenges the failure to join the Office of the Attorney General of the Republic as a party to the proceedings, because it is an interested party given that the water resource being used belongs to the public domain.- (See appeal brief in file dated 16/10/2019 13:42:42).-

III.Regarding the first ground, concerning the annulment of the judicial inspection and the decision because the inspection was not conducted in her presence and because proper notice was not provided sufficiently in advance, the Court rules as follows: First, it should be noted that Article 486, second paragraph, of the Labor Code, which applies supplementarily to agrarian matters pursuant to Article 26 of the Agrarian Jurisdiction Law, permits this evidence to be taken in advance without the party being present; the party shall subsequently be informed of it or shall be deemed served upon entering an appearance in the proceeding, as provided in Article 10 of the Judicial Service of Process Law. Article 26, second paragraph, of the Agrarian Jurisdiction Law provides as follows: “When appropriate, the courts may, on their own initiative, declare proceedings null and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding.

They are likewise authorized, where the law is silent, to apply by analogy the rules of labor legislation or, failing that, the corresponding code of procedure, in order to ensure that the proceeding is conducted with due promptness and effectiveness.” (Emphasis added). It follows from this provision that declarations of annulment and the repetition of procedural steps to cure the proceeding, as well as the supplementary application of procedural rules, are intended to provide promptness and effectiveness to the proceeding. In other words, in view of that purpose, the principle of preservation of procedural acts (principio de conservación de los actos procesales) applies in the interest of procedural economy, provided that the parties’ right of defense is safeguarded and that the adversarial principle (principio del contradictorio) is guaranteed. The appellant exercised that principle by responding at the hearing in which she was informed of the results of the judicial inspection and, at this stage, by presenting her arguments and having the opportunity to offer pertinent rebuttal evidence.

By entering an appearance in the proceeding, she is deemed aware of everything previously done; when she was granted a hearing concerning the judicial inspection, she had the opportunity to exercise the adversarial principle by responding, and no impairment of the right of defense is apparent, contrary to the appellant’s assertion. Her next opportunity arose when challenging the precautionary measure, at which point the evidence and arguments that will be addressed below were presented. The foregoing is also supported by Article 474 of the Labor Code, which applies supplementarily to this matter and provides: “Procedural defects shall be corrected, remedied, or cured, and annulment shall be ordered only when cure is impossible; in such a case, however, every effort shall be made to avoid the unnecessary loss, repetition, or destruction of stages of the proceeding or of completed acts or measures, and all actions that are valid in themselves shall be preserved so that they may be used once the proceeding has been restored to regularity.” In this specific case, it is unnecessary to discard the judicial-inspection evidence reflecting what the judge observed at the site, because the defendant may use the appellate process to assert her views regarding the judicial inspection conducted in her absence.

Upon entering an appearance in the proceeding and receiving notice of the hearing concerning the result of the judicial inspection, she could have requested that it be supplemented on specific points. Procedural balance is thereby achieved without any need to annul the judicial inspection or the challenged decision on that ground. Likewise, the failure to assess the remainder of the evidence submitted by the plaintiffs is not grounds for annulment, because this is not a determination on the merits of the dispute; at this initial stage, it is sufficient to determine the urgency of the measure. The documentary evidence offered will be relevant when the merits of the matter are decided, because it does not affect the principal issue, which is whether the use of the water that was cut off is urgent.- For the foregoing reasons, the request for annulment is denied.-

IV.As to the substantive arguments concerning the procedural requirements for interim relief (medidas cautelares), which the appellant claims have not been met, these are likewise without merit.- It should be noted that the a quo judge observed the existence of a property devoted entirely to growing apples and avocados, which requires the water that has been drawn from the defendant’s property and conveyed to the plaintiff’s property through a pipeline in order to carry out its agricultural activity. (See judicial inspection (reconocimiento judicial) in images 48-49 of the case file in PDF format).- This is contrary to the appellant’s assertion in one of her grounds for appeal that the property was not identified during the judicial inspection, because only its location in the Canton was stated in general terms, without specifying the registration number and survey plan corresponding to the property in question.

The a quo judge verified that this is land planted with apple and avocado crops, which are grown using water piped from the spring (naciente) on the defendant’s land, where the characteristics observed coincide with the existence of a new seven-strand wire fence that is distinguishable from the rest of the existing fence between the two properties, as well as the existence of a severed pipeline; this supports the conclusion that the inspection was conducted at the site in dispute and not elsewhere. The defendant does not refute the presence of those characteristics in situ, so as to suggest that the inspection was conducted on a different property. The appellant herself states, as part of her grounds for appeal, that erecting the fence falls within her right to exclude and defend her property rights. The existence of that fence is therefore the characteristic that supports the conclusion that these are the two properties involved in this case, rather than others unrelated to the dispute.

Nor is the failure to identify the area corresponding to the rights held by the plaintiff as a co-owner (copropietario) grounds for nullity, since Article 270 of the Civil Code provides: “When a thing belongs simultaneously to two or more persons, the owners jointly exercise all the rights of a sole owner in proportion to each person’s share in the common property.” Any co-owner may bring an action on behalf and for the benefit of the remaining co-owners, a principle contained in Article 864 of the Civil Code. In other words, if recognition of a right to use water for the jointly owned property is sought, this benefits both the applicant and the remaining co-owners; therefore, the appellant’s argument that the remaining co-owners must participate, and that the plaintiff’s undivided interests must be located and physically demarcated, is not accepted, because the relief benefits them all and does not prejudice them.

The aforementioned judicial inspection also established that the pipelines convey the water necessary to continue growing apples and avocados, as had reportedly been done for some time, since the apples were already producing a harvest when the a quo judge conducted the inspection; therefore, these were not newly planted crops. The appellant states that the plaintiff’s property has its own water and therefore would have no need to draw water from her spring; however, there is no evidence supporting that assertion, since the judicial inspection revealed no other water source that could supply the irrigation of the crops. There is no reason why that activity should now be altered. The purpose of the interim relief is to preserve the status quo as it had existed, according to the plaintiff’s initial pleading, and the use has not been disputed in the answer to the action, since the answer itself refers to the existence of the fence that allegedly obstructs access and which the appellant claims she is entitled to erect pursuant to Articles 302 and 295 of the Civil Code, arguing that she may act in defense of her property rights and, based on her title as owner of the property, is entitled to prevent others from interfering with her.

Whether or not the defendant was entitled to block access and prevent the use of water located on her property is a substantive legal issue that must be proven during the concluding stage and examined in the judgment; this is not the appropriate procedural stage because the case is at the preliminary stage, where only a prima facie assessment (juicio de verosimilitud) is being made and the evidentiary stage has yet to be completed. The factual circumstances could change during that stage and affect this interim relief, which remains temporary until this matter is finally decided.- The primary evidence for determining whether interim relief is warranted is the judicial inspection; indeed, it may be the only evidence needed to grant interim relief, without any need to assess documents that relate more closely to the substantive determination in the judgment and are not relevant to interim relief, which belongs to the preliminary stage.

The same applies to the argument that the plaintiff should have demonstrated his right to use the water, since whether or not he held a right to use the water in question must be examined in the judgment. Likewise, the judicial inspection did not establish that the plaintiff’s property had water from sources other than the spring for irrigating the crops; this will be resolved in the judgment, since at this procedural stage it is sufficient to make a prima facie assessment regarding the prior use of water between the two properties. That use is acknowledged in the answer to the complaint, which admits that access was blocked with the fence and asserts that the defendant alone may use the water by virtue of the concession granted to her, to the exclusion of the plaintiff, who, as she states in her appeal, holds no water concession.- The appellant contends that another water supply exists for the plaintiff’s property but submits no evidence of it.

Even if she is referring to the public water service in the area, this argument would be without merit, because the potable water supplied as a public service is intended for human consumption, which is its priority use. It is inconceivable that potable water should be used to irrigate crops, because this contributes to shortages in service to the community. Article 27 of the Water Law establishes that water use for human consumption takes priority, followed by all other productive activities. At a time when global warming and shortages of potable water for communities are matters of common and notorious knowledge, ordering the use of potable water supplied as a public service would be unreasonable, since it would impair the community members’ right to water, waste this precious resource, and increase the cost of agricultural production. The existing arrangement must remain in place until the judgment determines whether or not the plaintiff was entitled to it or, if so, under what conditions, as these are substantive matters to be resolved during the concluding stage and need not be determined at this preliminary stage.

The judgment will determine whether the plaintiff was legally entitled to use water from the spring. The same applies to the grounds for appeal concerning who holds the right to use the spring: whether it is the defendant, who states that she already has exclusive use under an administrative concession granted in her favor, or whether the plaintiff has no such right because he has not initiated the necessary proceedings to obtain that concession from the Water Administration, given that he has not proven that a water concession was granted in his favor, or whether such a concession may subsequently arise from pending proceedings. These matters are not to be examined at this preliminary stage, where, in order to issue the interim relief granted by the a quo judge, it was sufficient to establish:

  • 1)the existence of the agricultural activity,
  • 2)that the water had been used through the pipeline whose presence she verified in the field, and
  • 3)that this water is necessary for the continuation of production, since using potable water, whose preferred use is human consumption, is not a viable option if those are the other water sources to which the appellant refers. Once these three matters were established, the requirements of Article 489 of the Labor Code were satisfied. That article provides that interim relief may be granted to preserve the exercise of a future right, together with any other non-standard measure (medida atípica) necessary to provisionally protect and safeguard the subject matter of the proceedings and the effectiveness of the judgment. Accordingly, this interim relief must ensure the continuation of the productive activity through the use of the water that had been supplied via the pipeline in dispute, thereby maintaining the status quo until the judgment determines, based on ample evidence, which of the two parties is correct regarding the rights they assert and whether either litigant acted unlawfully. The alleged unlawfulness on the plaintiff’s part cited by the appellant, arising from the absence of a concession, is a substantive legal issue that must be examined in the judgment, along with whether it affects the establishment of the right claimed by the plaintiff.- Nor is it appropriate in these interim proceedings to examine whether necessary joinder (litis consorcio necesario) exists with respect to the State’s representation, since that issue would be examined in the principal proceedings if raised there as a defense, given the provisional nature of these interim proceedings.- To maintain procedural balance between the parties, the following is ordered sua sponte as counter-security (contracautela): the plaintiff is directed to refrain from altering the current condition of the defendant’s land; that is, access is authorized only when strictly necessary to maintain the existing pipelines, and the plaintiff may neither widen the path nor install new infrastructure on the defendant’s land. The plaintiff must refrain from contaminating the water source in question.- This interim relief is provisional until such time as other evidence may emerge that could change the factual circumstances. For the foregoing reasons, the ruling is affirmed as to the matters challenged on appeal.-

POR TANTO:

The motion for nullity is denied, and the challenged ruling is affirmed as to the matters appealed. Sua sponte, the following is ordered as counter-security: the plaintiff is directed to refrain from altering the current condition of the defendant’s land; that is, access is authorized only when strictly necessary to maintain the existing pipelines, and the plaintiff may neither widen the path nor install new infrastructure on the defendant’s land. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las catorce horas y cincuenta y cinco minutos del veinticuatro de abril de dos mil veinte.- MEDIDA CAUTELAR incoado por [Nombre1] , adulto mayor, agricultor, vecino de Dota, cédula de identidad CED1 - - ; y [Nombre2] , mayor, agricultor, vecino de Dota, cédula de identidad CED2 - - contra [Nombre3] , adulta mayor, divorciada una vez, empresaria, vecina de Dota, cédula de identidad CED3 - - . CONSIDERANDO:

I.Hechos probados: Para la resolución del presente asunto se tiene como hecho probado lo siguiente: La parte actora tiene en su terreno cultivos de manzana y aguacate en su totalidad, siendo sembrado aproximadamente cinco mil metros cuadrados, siendo que venía utilizando para el riego de los mismos la red de cañería que transcurría de la finca de la parte demandada y tomaba el agua de una naciente dentro del inmueble de la demandada.- (Ver reconocimiento judicial en imágenes 48-49 del expediente en formato PDF).- 2) Se observó en la colindancia de ambas partes, un tubo cortado y una cerca con siete hilos de alambre que modifica la cerca anterior para impedir el paso hacia la naciente.- (Misma cita anterior).-

II.La demandada apela con nulidad concomitante la resolución de las ocho horas treinta minutos del once de octubre del dos mil diecinueve, al considerar debe declararse la nulidad del reconocimiento judicial pues éste se realizó antes de que fuera notificada de la demanda con la antelación debida, lo que la coloca en estado de indefensión y viola el debido proceso y derecho de defensa, por lo que no estuvo presente en la realización de esta prueba. Además, al analizarse ese reconocimiento judicial como única prueba sin que se tome en cuenta la prueba de descargo, de la cual ni siquiera se hace mención, siendo que se omite los alegatos efectuados al respecto en la audiencia conferida sobre esta única prueba, con entera prescindencia de todas las demás, siendo una omisión de valoración de prueba ofrecida, la cual no se consideró en su conjunto. Indica la demandada es la propietaria registral y en ejercicio del dominio de su fundo, sobre el cual no pesa gravamen alguno, por lo que puede ejercer su derecho de defensa y cerramiento, que fue lo que hizo al modificar la cerca que impidiera el paso de una persona, siendo amparada por lo dispuesto en el artículo 302 y 295 del Código Civil.

Es un derecho pleno que ejerce sobre su predio y donde no existe permiso de paso, de uso y aprovechamiento de aguas de persona alguna, ni mucho menos alegar derechos como el de servidumbre de cualquier especie constituida a favor del predio de los demandantes o de uso y aprovechamiento de agua. Cualquier derecho que consideren los demandantes no ha sido acreditado más que por sus propios dichos y no por cualquier medio probatorio. Indica, según lo estipulado en el artículo 4 de la Ley de Aguas 276, que las aguas de dominio privado pertenecen al dueño del terreno, por lo que la demandada está en ejercicio de sus derechos legalmente amparados con su dominio a título de propietaria, máxime cuenta con concesión de uso de aguas sobre la naciente y quebrada de marras por parte de la resolución R-10772019 Aguas-Minae de las 8 horas 34 minutos del 12 de junio del 2019 de la Dirección de Aguas, lo que tiene la entera exclusividad sobre ese recurso hídrico.

Aduce en el reconocimiento judicial no hay certeza se haya realizado en la finca de los actores matrícula de folio real CED4 plano catastrado 1-2045363-2018 o en otro, sino tan solo en forma genérica indica se encuentran en el lugar conocido como Río Blanco, Copey de Dota, siendo así consignado en el reconocimiento judicial, por lo que es una prueba nula. Tampoco se constata el área total del inmueble, pues lo que tienen son varios derechos de esa finca no individualizados legalmente, lo que tampoco fue consignado en el acta, fundo el cual adquirieron recientemente el 23 de agosto del 2018 como copropietarios, siendo una prueba incompleta y parcial con solo el dicho de un copropietario y no de la totalidad de ellos. Indica tampoco se probó la existencia de trámites para obtener la debida concesión de aguas sobre su finca ante la Dirección de Aguas del Ministerio del Ambiente, por lo que induce en forma errónea e ilegal al Despacho a instaurar medidas cautelares improponibles sobre un fundo ajeno a fin de defraudar al Estado.

Indica no se analiza el documento de evaluación ambiental D2 de los actores, donde consta el proyecto cuenta con agua propia y no tienen necesidad alguna para abastecerse de vecino alguno, lo cual sin concesión es usurpación de aguas del dominio público y nada de esto fue valorado, siendo que no existe peligro de demora ni apariencia de buen derecho, por lo que deben revocarse las medidas solicitadas. Impugna también el que no se haya integrado la litis con relación a la Procuraduría General de la República pues es parte interesada dado el uso del recurso hídrico siendo de su propiedad como dominio público.- (Ver escrito de apelación en archivo del 16/10/2019 13:42:42).-

III.Respecto al primer motivo referido a la nulidad del reconocimiento judicial y de la resolución por no haberse realizado ante su presencia, y por haberse omitido la debida notificación con la debida antelación, se resuelve: En primer término ha de indicarse que el artículo 486 párrafo segundo del Código de Trabajo de aplicación supletoria a la materia agraria por remisión del artículo 26 de la Ley de Jurisdicción Agraria, otorga la posibilidad de realización anticipada de esta prueba sin la presencia de la parte, a la que se le pondrá en conocimiento posteriormente o se tendrá por notificada con su apersonamiento al proceso según lo establecido en el artículo 10 de la Ley de Notificaciones Judiciales. El artículo 26 párrafo segundo de la Ley de Jurisdicción Agraria dispone lo siguiente: " Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso, e igualmente están autorizados ante el silencio de la ley, para aplicar, por analogía, las normas de la legislación laboral, o en su defecto, el código de procedimientos respectivo, con el objeto de proveer la debida celeridad y eficacia al proceso".

( El subrayado es nuestro). Se desprende de esta norma que la declaratoria de nulidades y reposición de trámites para subsanar el proceso, y la aplicación supletoria de normativa procesal lo es con el objeto de dar celeridad y eficacia al proceso. Es decir, en atención a ese objeto es de aplicación el principio de conservación de los actos procesales por economía procesal, siempre y cuando se resguarde el derecho de defensa de las partes, garantizándose el principio del contradictorio que lo ejerce la apelante al contestar la audiencia donde se le puso en conocimiento el resultado del reconocimiento judicial, y en esta instancia oponiendo sus argumentos teniendo la posibilidad de ofrecer contra prueba pertinente. Al apersonarse al proceso asume el conocimiento de todo lo actuado y al otorgarse la audiencia sobre el reconocimiento judicial, tuvo la oportunidad de ejercer el principio del contradictorio al contestar la misma, sin que se observe haya un menoscabo en el derecho de defensa como lo afirma la apelante.

La siguiente oportunidad es en el momento de impugnación de la medida cautelar donde se observa la prueba y argumentos a los que nos referiremos posteriormente. Lo anterior también encuentra sustento en lo estipulado en el artículo 474 del Código de Trabajo y de aplicación supletoria a esta materia, dispone que: "Los vicios procesales deberán ser corregidos, subsanados o saneados y la nulidad se decretará, únicamente, cuando la subsanación no sea posible; pero en tal caso se procurará siempre evitar la pérdida, repetición o destrucción innecesarias de etapas del proceso, los actos o las diligencias cumplidos y se conservarán todas las actuaciones que en sí mismas sean válidas, de modo que puedan ser aprovechadas, una vez que el proceso se ajuste a la normalidad". En el caso concreto resulta innecesario la destrucción de la prueba de reconocimiento judicial que refleja lo observado en el campo por la persona juzgadora, dado que la parte demandada tiene a través de la materia recursiva hacer valer sus puntos de vista sobre el reconocimiento judicial realizado sin su presencia, pero al apersonarse al proceso y notificarle la audiencia sobre el resultado del reconocimiento judicial, pudo solicitar la ampliación sobre aspectos puntuales, siendo de esta forma que se logra el equilibrio procesal, sin que sea necesario anular el reconocimiento judicial o la resolución impugnada por ese motivo.

Igualmente, tampoco es motivo de nulidad el que no se valorara el resto de la prueba aportado por la parte actora, pues no se está en el pronunciamiento de fondo del conflicto, basta en esta etapa inicial determinar la urgencia de la medida. La prueba documental ofrecida, será de interés para cuando se resuelva por el fondo del asunto, pues no incide en el motivo principal que es determinar la urgencia o no del uso del agua que fue suprimido.- Por lo expuesto se rechaza la nulidad planteada.-

IV.En cuanto a los argumentos de fondo, respecto a los presupuestos procesales de las medidas cautelares, que indica el apelante no se cumplen, tampoco son de recibo.- Nótese la a-quo observó la existencia de una finca dedicada al cultivo de manzanas y aguacate en su totalidad, requiriendo del agua que se viene aprovechando de la finca del demandado hacia la finca del actor y que es canalizada a través de una tubería para desarrollar su actividad agrícola. (ver reconocimiento judicial en imágenes 48-49 del expediente formato PDF).- Lo anterior es contrario a lo afirmado por la recurrente en uno de sus agravios, quien dice no se identifica la finca en el reconocimiento judicial, pues de forma genérica se indicó solo su ubicación en el Cantón, pero no se detalló el número de matrícula y plano correspondiera al inmueble en cuestión. Al constatar la a-quo se trata de un terreno con cultivos de manzana y aguacate y que se desarrollan por el uso de agua que viene entubada desde la naciente del terreno de la parte demandada, donde coinciden las características de la existencia de una cerca nueva a siete hilos de alambre que se distingue del resto de la cerca existente entre ambos fundos, así como la existencia de tubería cortada, permite concluir dicho reconocimiento fue realizado en el sitio en conflicto y no otro.

La parte demandada no desvirtúa tales características presentes in situ, como para pensar el reconocimiento fue realizado en otro inmueble distinto. La misma apelante, indica como parte de sus agravios, que está en su derecho de exclusión y defensa la colocación de la cerca en protección de su derecho de propiedad. Siendo tal característica sobre la existencia de la cerca que permite concluir se trata ambos fundos los involucrados en esta causa y no otro ajeno al conflicto. Así como no es motivo de nulidad el no haberse identificado el área que corresponde a los derechos que tiene como copropietario, pues el artículo 270 del Código Civil establece: “ Cuando una cosa pertenezca simultáneamente a dos o más personas; los dueños ejercen conjuntamente todos los derechos del propietario singular, en proporción a la parte que cada uno tenga en la propiedad común.” Todo copropietario puede accionar en favor del resto de copropietarios, para su beneficio, principio contenido en el artículo 864 del Código Civil.

Es decir, si se pretende el reconocimiento del derecho de uso de aguas a favor del fundo en copropiedad, ello le beneficia tanto a quien lo solicita como al resto de sus copropietarios, de allí no se comparte el agravio de la recurrente al indicar debe contarse con la presencia del resto del copropietarios, así como la localización y materialización de los derechos indivisos de la parte actora, pues es en beneficio de todos y no les perjudica. También se constata del citado reconocimiento judicial, que las tuberías transportan el agua necesaria para la continuidad del cultivo de manzanas y aguacate, como se indica se ha venido haciendo desde hace tiempo, dado las manzanas ya están cosechando al momento del reconocimiento por parte de la a-quo, por lo que no se trata de un cultivo recién sembrado. La apelante indica la finca de la parte actora tiene su propia agua, lo cual no tendría que acudir a tomar agua de su naciente, sin embargo, no existe prueba de su dicho, pues del reconocimiento judicial no se observó otra fuente de agua que sea para el abastecimiento para el riego de sus cultivos.

No tendría porque ahora modificarse esa actividad. Siendo que con la medida cautelar, se pretende el mantenimiento del estado actual de las cosas tal y como se venían dando, según lo afirma el actor en su escrito inicial y que no ha sido controvertido su uso al contestar la acción, ya que en su misma contestación, refiere a la existencia de la cerca que se indica es la que impide el paso, y que aduce la apelante está en su derecho a cerrar con base en los artículos 302 y 295 del Código Civil , que indica puede actuar en defensa de su derecho de propiedad y con base en su título como dueña del inmueble tiene derecho a impedir a quienes le inquieten. Si la demandada tenía o no derecho a cerrar el paso y a impedir el uso del agua ubicado en su propiedad, es un aspecto de derecho de fondo que se debe demostrar en la fase conclusiva y analizarse en la sentencia, y no siendo este momento procesal idóneo dado que se está en un juicio de verosimilitud en la etapa inicial del proceso, donde aún falta por evacuar la etapa probatoria en la que el cuadro fáctico podría cambiar e incidir en esta medida cautelar que es temporal hasta que se resuelva en definitiva este asunto.- La prueba principal para determinar la procedencia de la medida cautelar es el reconocimiento judicial, incluso es factible sea la única prueba suficiente para acoger una medida cautelar, sin que sea necesario acudir a la valoración de documentos que se relacionan más con el pronunciamiento de fondo en sentencia y no siendo de interés para la medida cautelar que es propia de la etapa inicial.

Igual ocurre con el agravio referido a que debió demostrar el derecho sobre el uso del agua, lo cual ha de analizarse en sentencia sobre si el actor tenía o no derecho de uso del agua en cuestión. Igualmente, no se determinó en el reconocimiento judicial que el inmueble de la parte actora tuviera agua de otros medios distintos al que se toma de la naciente, para ser utilizado para el riego de cultivos; ello se dilucidará en sentencia, pues basta a esta altura procesal contar con un juicio de verosimilitud sobre el antecedente del uso del agua entre ambos fundos, sobre lo cual se admite en la contestación de demanda al aceptar cerró el paso con la cerca y afirma ser quien puede aprovecharla el agua debido a la concesión que le fuera otorgada, con exclusión del actor, que no cuenta con alguna concesión de agua como lo afirma en su apelación.- Aduce el apelante, existe para la finca del actor otro abastecimiento de agua, pero no aporta prueba de ello, sin embargo sea que se trate del servicio público de agua en el sector, este argumento no sería de recibo, pues el agua potable que se brinda por el servicio público, es para consumo humano, siendo ese su uso prioritario.

No es concebible se utilice agua potable para el riego de cultivos, porque incide en la escasez del servicio a la comunidad. La Ley de Aguas en su artículo 27, dispone como prioridad el uso del agua para consumo humano y luego de ello el resto de actividades productivas. En tiempos donde es un hecho público y notorio la existencia del calentamiento global y la escasez de agua potable para las comunidades, es insensato ordenar el uso de agua potable que se brinda como servicio público, pues es ir en detrimento del derecho al agua de los miembros de esa comunidad, y un desperdicio del preciado líquido, además de que encarecería los costos de la producción agraria. Deberá mantenerse hasta que en sentencia se determine si la parte actora tenía derecho a ello o no, o de tenerlo cuáles serían las condiciones, siendo tales aspectos de fondo que se determinarán en la fase conclusiva, no siendo relevante determinar en esta etapa inicial.

Será en sentencia donde se determinará si el uso de agua de la naciente le correspondía en derecho. Lo mismo ocurre sobre los agravios referidos a quien le corresponde el derecho de uso de la naciente, si a la parte demandada que indica ya tiene el uso exclusivo a través de la concesión administrativa declarada a su favor, o si el actor no tendría tal derecho dado que no ha iniciado los respectivos trámites para obtener dicha concesión ante el ente Administrativo de Aguas, ya que no prueba concesión de aguas a su favor o si la misma será sobrevenida como consecuencia de algún trámite pendiente. Tales aspectos no son de análisis en esta etapa inicial, donde para el dictado de la medida cautelar que aprobó la a-quo, bastaba con demostrar:

  • 1)la existencia de la actividad agrícola,
  • 2)que había venido utilizando el agua a través de la tubería que logró constatar en el campo, y
  • 3)que de dicha agua es necesario para la continuidad de la producción, no siendo viable la opción de utilizar el agua potable de uso preferente para consumo humano si es que a esas otras opciones de agua son a las que hace referencia la impugnante. Al constarse estos tres aspectos, se cumple con lo dispuesto en el artículo 489 del Código de Trabajo que indica es factible el dictado de la medida cautelar para la preservación del ejercicio de un futuro derecho, así como cualquier otra medida atípica necesaria para proteger y garantizar, provisionalmente, el objeto del proceso y la efectividad de la sentencia. Se debe entonces, a través de esta medida cautelar, garantizar la continuidad de la actividad productiva con el uso del agua que se venía dando a través de la tubería en conflicto, manteniendo con ello el estado actual de las cosas hasta tanto en sentencia se determine con prueba abundante cual de las dos partes lleva razón en el derecho que alegan, y si alguno de los dos contendientes tienen actuación ilegal, pues esa ilegalidad que aduce el apelante que tiene el actor, por falta de la concesión, es parte del derecho de fondo que ha analizarse en sentencia y si esto afecta o no a la constitución del derecho que pretende para sí el accionante.- Tampoco es factible en esta medida entrar a analizar la existencia o no de un litis consorcio necesario respecto a la representación estatal, lo cual sería de análisis para el proceso principal en caso de que allí se excepcione, dada la naturaleza provisional de este proceso cautelar.- Para generar un equilibrio procesal entre las partes, de oficio en carácter de contracautela se dispone: se previene a la parte actora debe abstenerse de modificar la naturaleza actual del terreno de la parte demandada; es decir, el paso sólo se autoriza cuando sea estrictamente necesario para el mantenimiento de las tuberías actuales, sin que pueda ampliar el sendero, ni introducir nueva infraestructura en el terreno de la parte demandada. La actora debe abstenerse de contaminar la fuente de agua en cuestión.- Se indica esta medida cautelar es provisional, hasta tanto no existan otros elementos probatorios que puedan variar la situación fáctica. Por lo expuesto, se confirma lo resuelto en lo que ha sido objeto de apelación.-

POR TANTO:

Se rechaza la nulidad y se confirma la resolución impugnada en lo que ha sido objeto de apelación. De oficio en carácter de contracautela se dispone: se previene a la parte actora debe abstenerse de modificar la naturaleza actual del terreno de la parte demandada; es decir, el paso sólo se autoriza cuando sea estrictamente necesario para el mantenimiento de las tuberías actuales, sin que pueda ampliar el sendero, ni introducir nueva infraestructura en el terreno de la parte demandada.
