FINDINGS:
Drafted by Judge Castro García; and, WHEREAS (CONSIDERANDO):
I.The Court adopts proven facts 1, 2, and 3 because they are supported by the evidence in the record. No ruling is made on facts 4, 5, 6, and 7 because they are unrelated to the grounds of the appeals.
II.Unproven fact three is affirmed because there is no evidence establishing a different factual reality. No ruling is made on the remaining facts because they are unrelated to the appeals heard by this Court.
III.Trial-court judgment 06-2017, issued at 11:15 hours on 25 de enero del 2017, partially upheld the action for recovery of ownership brought by [Nombre3] and [Nombre3]. (folio 340), insofar as it ordered the restitution of a missing area of the property in Limón recorded under registration number [Placa2], with plan L-22533-1991, in accordance with the findings of the expert report, which identified an area of 13 hectares 3.124 along the southern boundary, and ordered the removal of defendant [Nombre1] or anyone else remaining in possession. The counterclaim was denied in all respects, as were the claims against joined party [Nombre2]. The company [Nombre3] and [Nombre3] appeals (folios 350 to 353) the decision in the appealed judgment exempting the unsuccessful counterclaimant defendant from attorney’s fees and litigation costs, because the judgment failed to state reasons for that decision, which constitutes an exception to the rule.
It contends that none of the conditions necessary to determine that he should not be ordered to pay those items is satisfied in this case, since he has ultimately refused to vacate the claimed land, and it has been required to incur expenses for attorneys, expert evidence, travel, and documentation; it therefore requests that he be ordered to pay them. It contends that he has litigated in procedural bad faith and requests that the judgment be reversed in that respect.
IV- For his part, counterclaimant defendant [Nombre1] (folio 345) appeals the judgment, claiming nullity because the court failed to rule on his arguments, since the property claimed by the plaintiff overlaps land belonging to [Nombre5] that was registered long before the plaintiff’s property. Thus, because there are two registered owners, [Nombre5] must be joined as a defendant. He contends that it must be determined which of the two has the superior right to seek recovery of ownership. He states that, under these circumstances, an action for recovery of ownership cannot succeed because both have standing to dispose of the land. He asserts that, in the interest of legal certainty, the agrarian judge must consider the existence of duplicate title and should have ordered joinder of the party. He invokes the clarity of the expert report regarding the overlap of plan L-01-1977 of [Dirección2], and states that joinder was not ordered.
As a second ground for nullity, he argues that, during the judicial inspection (reconocimiento judicial), the need to join the State was noted because part of the area sought to be recovered lies within the wetland of the protected area of Laguna Danta, a protected Ramsar site that cannot be privately possessed. At minute 01:22 of video file 20160510114053, the court of first instance recorded the public defender’s statement concerning the overlap between the plaintiff’s land and the yolillo palm swamp or wetland, and this was apparent during the judicial inspection at minute 01:37 of video file 20160510112724, where the claimant acknowledged that the area is part of the State’s natural heritage; this was noted, but no ruling was made on the matter. He includes two diagrams concerning the existence of the wetland. The two reasons stated render the judgment null and void. As substantive grounds for disagreement, he argues: 1) Lack of correspondence between the land described in the expert report and the land allegedly possessed by my client.
He alleges that there is no evidence that the land he possesses is the land claimed by the plaintiff, or that the tract claimed and described by the expert is the tract traversed during the judicial inspection. He refers to the judge’s statement at minute 01:24 of file 20160510120820 regarding the uncertainty as to the extent of the land area. There is no evidence that the defendant exercised possession over any specific area of the property. No witness testimony was received establishing dispossession of the claimed tract or identifying who possesses the land where the judicial inspection was conducted or the land described in the expert report. Nor is there evidence that the tract visited by the expert is the same tract observed during the judicial inspection. 2) He alleges an error in the assessment of the evidence, because the claimant did not establish through witness testimony which area of the property it possesses and which area is occupied by the defendant, thereby failing to prove standing to sue and be sued.
He adds an excerpt from decision no. 169 of the First Chamber of the Supreme Court of Justice concerning the requirements of owning the property and having exercised possessory acts. In addition, he objects that the law was improperly applied by recognizing the plaintiff’s standing to sue and the defendant’s standing to be sued without any evidence whatsoever. He asserts that the defense of lack of legal entitlement should have been upheld because the elements of an action for recovery of ownership were not established. He contends that, because there is no witness testimony, the plaintiff lacks standing to sue, as it is unknown whether the plaintiff holds title to the area visited during the judicial inspection or whether that area is the one traversed by the expert; nor is there any evidence establishing possessory acts. Likewise, it is not known which area the defendant possesses. The identity of the property was also not established, given the observations made concerning the expert report.
Third, he disputes proven fact number 2 because there is no witness testimony establishing that the tract traversed is the same one assessed by the expert, since the judge himself did not know during the judicial inspection how far the tract extended. He contends that facts of this nature cannot be deemed unproven in the judgment under appeal.
V.The first ground for nullity (motivo de nulidad) raised by the defendant/counterclaimant is denied because it instead constitutes grounds of appeal (agravios) against the decision in the judgment under appeal. In this regard, it must be borne in mind that, in agrarian matters, section 502 of the Labor Code, applicable pursuant to Transitory Provision I.3 of Ley 9343, and Articles 26 and 60 of the Agrarian Jurisdiction Law require that, once the case file reaches the Tribunal on appeal, it must first review the proceedings and determine whether any nullity affects the proceeding or the challenged judgment. Accordingly, if it finds that any formality capable of causing an actual denial of the right to a defense has been omitted, it must declare the proceedings or decisions null and void to the extent necessary to restore the case to its ordinary course. Under these provisions, this Tribunal has maintained that a declaration of procedural nullity (nulidad procesal) is appropriate only when absolutely indispensable to prevent a denial of the right to a defense or to restore the ordinary course of the proceeding because essential procedural requirements have been violated (Articles 194 to 198 of the Code of Civil Procedure, applied supplementarily).
In this case, after reviewing the proceeding and the challenged judgment, this Tribunal finds no defect warranting the requested declaration of nullity; consequently, this ground is rejected as unfounded.
VI.In view of the matters raised in the grounds of appeal, it must be borne in mind that section 54 of the Agrarian Jurisdiction Law establishes the free assessment of evidence system (libre valoración probatoria) in evidentiary matters. This requires the Tribunal to examine and select the sources of evidence obtained in order to determine their effectiveness in resolving the dispute submitted for its consideration through perception, representation or reconstruction, and deductive or inductive reasoning. The Tribunal must state the principles of equity or law on which it bases its judgment. “The free assessment of evidence system supersedes both the traditional legally prescribed evidence system (prueba legal) and the sound judicial discretion standard (sana crítica) governing civil proceedings. The manner in which agrarian proceedings have been conceived allows the judge to assess the facts alleged by the parties broadly.
This system is not arbitrary; on the contrary, under the free assessment of evidence, that assessment must be reasoned and critical and must be based on logic, experience, and psychology. In the reasoning of the judgment, the judge must explain the grounds for the conviction that lead the judge to rule as stated. Unlike the statutory evidentiary-weight system (tarifa legal), under which evidence is assessed subject to pre-established legal rules and even the admissibility of evidence must have been previously specified by the Legal System, under the free assessment system the judge is free to admit evidence according to the judge’s judgment” (votos 398 del 6 de junio del 2001 de la Sala Primera. En igual sentido véase votos 206 del 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario y 3657 del 7 de mayo de 2003 de la Sala Constitucional).
Having clarified the foregoing, the ground alleging that the action for recovery of property (demanda de reivindicación) should not have been granted because the plaintiff’s property is partially located within a yolillo palm swamp or wetland (yoliyal o humedal), where possession cannot be exercised, is rejected. The same applies to the alleged need, for that reason, to join the State as a defendant in this proceeding, or because of the existence of overlapping title (doble título) with a JAPDEVA property. First, it should be noted that the topographic expert report (informe pericial topográfico) submitted in this proceeding appears at folio 286. That report makes no reference whatsoever to the indicated ecosystem. The judicial inspection (reconocimiento judicial) (in video format stored on the compact disc attached to this case file) referenced in the appeal shows the existence of a grazing area and a forested area separated by a fence.
In file 20160510112724, the plaintiff explains which area is claimed in the dispute and shows the location of a boundary marker from which the boundary with the yolillo palm swamp (zona de yolillo) is marked, explaining that it is land forming part of the area adjacent to the lagoon and therefore part of the State Natural Heritage (Patrimonio Natural del Estado). The plaintiff stated that small portions of that yolillo palm swamp lie within the boundary-marker line. The boundaries marked by the boundary markers and fences shown physically identify the area claimed by the plaintiff. It is therefore untrue that there was a failure to establish the identity of the property because the judge did not know how far the property—which the judge refers to as “yolillo”—extends within the area claimed by the defendant and forming part of the disputed area. In video 20160510114053, the judge stated that the public defender argued that, because the boundary line was found to extend in some places into the yolillo palm swamp corresponding to a wetland, the need to join the State as a defendant should be considered.
At that proceeding, counsel for the plaintiff (minute 1:55) stated that the property is registered within the existing Refugio de Barra del Colorado and is subject to the limitations inherent to forests and wetlands. Those areas may not be disturbed, and it was instead the defendant that altered the property’s environmental conditions through its actions. It can be verified that, beginning with the video identified by number CED9, the court below (a quo) states that the defendant/counterclaimant withdrew. The proceeding therefore continued with the plaintiff alone. The judicial inspection was conducted for the purpose of visiting the property in dispute, its boundaries, and any acts of possession (actos de posesión) that could be observed. Another noteworthy aspect is that neither party testimony nor witness testimony was taken in this matter. This has not been challenged by either of the disputing parties; accordingly, no defect requiring correction is apparent.
VII- Under these circumstances, it must be stated that the existence of yolillo does not constitute grounds for nullity requiring the State to be joined, given the subject matter of these proceedings and because the property at issue is registered in the name of a private party within an area affected by a refuge management category. It is protected by the right to property and has not been expropriated. It is necessary to outline the legal framework governing the right to property, which is affected at its core by the environmental variable due to its location. In this regard, Article 58 of the Ley de Biodiversidad provides: “Protected wildlife areas (áreas silvestres protegidas) are geographically delimited areas consisting of land, wetlands, and portions of the sea. They have been so designated because of the special significance of their ecosystems, the existence of endangered species, their importance for reproduction and other needs, and their historical and cultural significance.
These areas shall be devoted to conserving and protecting biodiversity, soil, water resources, cultural resources, and ecosystem services in general. The objectives, classification, requirements, and mechanisms for establishing or reducing these areas are set forth in the Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995. The prohibitions affecting natural and legal persons within national parks and biological reserves are established in the Ley de la Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. During the process of satisfying the requirements for establishing state protected wildlife areas, the respective technical reports must include the relevant recommendations and justifications for determining the most appropriate management category (categoría de manejo) to which the proposed area should be subject. In all cases, the establishment of areas and categories shall give due consideration to the preexisting rights acquired by Indigenous or rural communities and other natural or legal persons located within or adjacent to them.” (Boldface not in the original.) Similarly, Article 37 of the Ley Orgánica del Ambiente número 7554 states: “Powers of the Executive Branch.
When establishing protected wildlife areas, irrespective of their management category, the Executive Branch, through the Ministerio del Ambiente y Energía, is empowered to include within their boundaries any privately owned properties or portions thereof necessary to fulfill the objectives set forth in this law and to implement them in accordance with the respective management plan (plan de manejo), or to create legal easements (servidumbres legales) for ecological protection and compliance with this law. In the case of national parks, biological reserves, or state-owned national wildlife refuges, the land shall be acquired by purchase, expropriation, or both procedures, subject to prior compensation. In the case of forest reserves, protective zones, mixed wildlife refuges, and wetlands, the parcels or portions thereof may also be purchased or expropriated unless, at the owner’s request, they are voluntarily placed under the forestry regime (Régimen Forestal).
Such submission shall be recorded in the Registro Público de la Propiedad as an encumbrance (afectación) on the property, which shall remain in effect for the period established in the management plan. Privately owned properties affected pursuant to this article because they are located within national parks, biological reserves, wildlife refuges, forest reserves, or protective zones shall be included within state protected areas only from the time they have been paid for or lawfully expropriated, unless they are voluntarily placed under the Régimen Forestal. In the case of forest reserves, protective zones, and wildlife refuges, if payment or expropriation has not taken place, and while it is pending, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment (evaluación de impacto ambiental), and subsequently to a plan for the management, recovery, and restoration of resources.
(The preceding paragraph was amended by Article 72, subsection c) of the Ley Forestal, N° 7575 del 13 de febrero de 1996, which was itself amended by Article 114 of the Ley de Biodiversidad, N° 7788 de 30 de abril de 1998.) The Executive Branch is empowered, through the Ministerio del Ambiente y Energía, to carry out the expropriations provided for in this article in accordance with the Ley de expropiaciones No. 7495, del 3 de mayo de 1995.” (Boldface and underlining not in the original.) From these quoted provisions, this court understands that the property claimed in this action for recovery of ownership (acción reivindicatoria) is real property whose registered owner is the plaintiff corporation. Its title is valid and effective. If the property forms part of any management category, the owner has a legal obligation to exercise possession and the incidents of the right to property within the full range of restrictions and limitations applicable to that right, as is appropriate for property containing natural resources where ecosystem balance must be safeguarded.
To conclude that privately owned property subject to a right of ownership becomes public-domain property solely because it is included within a protected wildlife area—irrespective of its management category—upon the issuance of a decree or law creating and affecting that area, without any compensation from the State or any declaration by the owner voluntarily submitting to the Régimen Forestal, would deprive the constitutionally guaranteed right to property of its substance. Restricting the exercise of the incidents of the right to property held by the registered owner or lawful possessor constitutes a concealed and unlawful expropriation that violates Article 45 of the Constitución Política. Such action is incompatible with the rule of law established by our legal system. Therefore, given the subject matter of the proceedings, the nature of the land as registered property held in the name of the plaintiff corporation, and the fact that the recovery claim is brought against a possessor who is not the owner, this Court does not find that the State must be joined in these proceedings because there is a yolillo stand in the southern part of the property, nor does it accept the argument that the judgment on appeal is null due to the presence of that ecosystem.
The purpose of the recovery proceedings is to recover the area occupied by the defendant within the property registered under folio [Placa2], with survey plan L-22533-1999, registered in the name of [Nombre3] and [Nombre3], according to the registry report at folio 3. The disputed area was identified by the parties, by the judge during the judicial inspection (reconocimiento judicial), and in the court-ordered expert report (peritaje judicial) contained in the record; therefore, as the appellant argues, it is part of a property registered in the name of [Nombre5], who was summoned to these proceedings but made no statement in that regard. This is an issue unrelated to the defendant’s interest in appealing and does not affect him. If that were the case, it would be for that entity to defend its rights, particularly since it was not part of either the complaint or the answer thereto (the subject matter of the proceedings).
With respect to that issue, this Court finds that the party lacks standing to appeal (interés para apelar) (Article 561 of the Código Procesal Civil, applied supplementally), because although the recovery action against him was granted, he asserts the property rights of [Nombre5] as grounds for his grievance, even though he never introduced that issue into the dispute. The plaintiff is entitled to seek restitution of property shown to be registered in its name, as has been established in this case. The objections concerning the need to join the State as a defendant and the alleged existence of duplicate title to the property involving JAPDEVA are therefore rejected. The rights of that entity may be litigated between those persons, who are separate from the defendant/counterclaimant in this case, and the ruling in these proceedings neither binds the State nor diminishes its rights.
VIII- The allegation that the land described in the expert report does not correspond to the land possessed by the defendant/counterclaimant, and that there is insufficient evidence in this regard, is rejected. He alleges an absence of evidence showing that the land he possesses is the land claimed by the plaintiff or that the property corresponds to the one described in the expert report and observed during the judicial inspection. The record shows that, during the judicial inspection, neither defense counsel nor the defendant/counterclaimant ever stated that the inspection was being conducted on land other than the property at issue in this dispute. As to the expert examination (pericia), and specifically the property inspected, the report appears at folios 286 to 288. In it, the expert concluded that survey plan L-22533-1991 had been located. Along the property’s southern boundary, the configuration on the ground differs from that shown on the plan; the missing area is 13 ha 3124 square meters.
He stated: “the location of the plan is correct according to the coordinates; what is incorrectly identified on the plan is the map sheet: the correct one is Hoja Colorado, not Tortuguero.” In describing his methodology, the professional stated that he had visited the site and measured the vertices of the property depicted in survey plan L-22533-1991 in the northern sector and along the southern boundary, where the fence extends in a [Dirección3] direction toward the lagoon. Furthermore, as already described supra, the video recording of the judicial inspection shows that the route was traversed using the plan as a reference and that the defendant and his defense counsel were present at the outset without alleging that they were at a location other than the property at issue in this dispute. In addition, the expert report was disclosed to the parties by order issued at 07:30 hours on 24 de marzo del 2015 (folio 230).
The defendant/counterclaimant requested supplementation and clarification (adición y aclaración) to state whether the entire property had been traversed; whether fences or cleared boundary lines (carriles) that could serve as guides had been observed; whether the area traversed corresponded to the findings; and why there was no plan mosaic detailing the GPS route and the location of the map coordinates. The clarification was submitted (folio 316), in which the expert stated that the entire tract had been traversed and that the location specified in the report had been determined using survey plan L-22533-1991. He stated: “this mapped location of survey plan L-22533-1991 is the same location where the land was traversed; the missing area is the one specified in the initial report. The missing or disputed area is 13 ha 3124 m2 on the southern side of the property. The route began in the northern portion, specifically at the landing point providing river access to the property, followed the boundary toward [Dirección4], and ended at the same point.
The [Dirección5] boundary adjoins Laguna Danto and therefore has no bearing on the conflict or overlap under examination; it was traversed solely to verify that boundary, which is a natural boundary. Nevertheless, I attach a map showing the requested points.” The supplement to the report was disclosed to the parties (order at folio 319), and notice was served on 10 de diciembre del 2015 (same folio). Neither party made any statement concerning deficiencies in or doubts about the conclusions given. Those same issues are now raised by the defendant/counterclaimant on appeal. The challenge concerns the requirement that the property be identified (identidad del bien) and must be rejected pursuant to Article 320 of the Código Civil. There is no evidence or statement supporting the conclusion that the expert report was prepared based on the physical premises of another property or that the judicial inspection was conducted on property other than the area at issue in this dispute.
IX- The allegation that it was impossible to establish the identity of the property and active and passive standing (legitimación activa y pasiva) because testimonial evidence (prueba testimonial) was not obtained is rejected. The aforementioned judicial inspection (reconocimiento judicial) and expert report (informe pericial) establish the identity of the property and that the disputed area (zona en litis), whose area and location have been defined, is part of property registration [Placa2] of Limón, with survey plan L-22533-1991, registered in the plaintiff’s name (certification at folio 324). That evidence establishes the identity of the property and active standing. As to passive standing, the judgment under appeal deemed it established based on the answer to the complaint, the counterclaim (reconvención), and the judicial inspection. This is the factual basis of the third proven fact, and the fifth recital (considerando) reasons on this issue that the defendant is the possessor of the disputed area, since he stated in the complaint and counterclaim that he was the adjoining landowner along the southern boundary of the plaintiff’s property and that he had acquired it from [Nombre6].
Reference was made to the answer and counterclaim at folios 147 through 153 and to the judicial inspection. The ruling stated that, although it was not determined whether [Nombre6] or the defendant moved the fence between the plaintiff’s property and that of [Nombre1], the missing strip lies within the defendant’s tract (fundo). That reasoning was not challenged in the appeal; rather, the appellant attacks the ruling on the ground that there is no testimonial evidence. This Court finds the judgment correct, because the fourth fact alleged in the reivindicatory action (acción reivindicatoria) states that the property owned by the company, registered under survey plan L-22533-1991, was partially occupied by a third party who had cleared the existing forest, erected fences, and altered the boundaries, depriving it of ownership. The fifth fact stated that the defendant partially occupies the property, knows that the tract does not belong to him, and remains there with the fence moved, carrying out acts of appropriation.
The sixth fact asserts that the entire property can be located and that, upon conducting the boundary resurvey (replanteamiento), it was determined that there is a portion of the property of which they have been dispossessed, because the boundary markers were moved and the neighbor possesses that area. The seventh fact describes how, because of the suspicion that the boundaries had been altered, a surveyor was hired in 2013 to verify them, and it was concluded that, in the southern sector, the adjoining boundaries do not run where the survey plan indicates, because part of its property lies partially within the tract belonging to [Nombre1] (complaint at folios 6 through 16). For his part, the defendant answered (folios 148 through 153), denying the complaint and asserting extinctive prescription (prescripción negativa), based on the plaintiff’s admission in its pleading that it discovered the shortage in the southern area of its land ten years after learning that it had a dispute with him regarding that land.
He denies the encroachment, acknowledges that he is an adjoining landowner, and maintains that the fences have always remained in the same location. In the first fact of the counterclaim, he states that he is the adjoining landowner of the plaintiff’s property and that, by sale on 16 de octubre del 2001, he acquired the possession that [Nombre2] had been exercising, which [Nombre7] had sold to him. In the second fact, he stated that since acquiring the property he has maintained possession of it and that the fences have remained in place for twenty years. He asserted that the plaintiff’s land has a survey-plan problem concerning ties (amarres) and cartographic location that does not physically correspond to reality. He invokes the plaintiff’s extinctive prescription of the claim because the statutory period has elapsed. As relief, he requests a declaration that the company’s right to bring an action against him is time-barred, the annulment of survey plan L-22533-1991, and other ancillary relief.
As can be seen, the plaintiff company brought a reivindicatory action in its capacity as the registered owner of the tract in question, and it was determined that the missing portion of the area represented by the cited survey plan is physically located within the boundaries of the defendant’s property; the defendant alleges that the dividing lines have always remained in that location. Furthermore, the reivindicatory action could be defeated only if the defendant had acquired the land through acquisitive prescription (prescripción positiva) (Article 320 of the Código Civil), which was neither established nor claimed by the counterclaiming defendant, who invoked extinctive prescription in the answer to the complaint and in the counterclaim, on the ground that the ten-year limitation period under Article 868 Ibídem had elapsed. Acquisitive prescription (usucapión) was not at issue; therefore, the reivindicatory action is proper because the three requirements for the action brought were established.
Accordingly, the appellant’s grievances concerning the absence of testimonial evidence regarding the defendant’s possession of the property are unavailing because, according to the expert evidence, the statements made in the answer to the complaint and asserted in the counterclaim, as well as the boundaries observed during the judicial inspection, there is sufficient evidence of passive standing.
X.The challenge to the ruling exempting the counterclaiming defendants from costs (costas) is rejected. A review of the record shows that the placement of the boundary between the parties’ properties, which extends into both the registered and physical area of the plaintiff’s tract, dates back many years. There is no evidence showing that the defendants recently moved the fences or that any claims regarding that situation had previously been made. Accordingly, this Chamber finds that they did not act in procedural bad faith (mala fe procesal) when answering the complaint and filing the counterclaim. They believed they were protected by possession that had been exercised for many years without the situation having caused any disputes before these proceedings. Therefore, pursuant to Article 55 of the Ley de Jurisdicción Agraria, the ruling shall be affirmed insofar as it imposed no special award of costs (especial condenatoria en costas).
XI.In view of the foregoing, pursuant to Articles 1, 2, and 55 of the Ley de Jurisdicción Agraria and Article 320 of the Código Civil, the petition for nullity (nulidad) is rejected and, as to the matters appealed, the judgment shall be affirmed.

RESULTANDO:
Redacta la jueza Castro García, y;
CONSIDERANDO:
I.El Tribunal comparte los hechos probados 1, 2 y 3 por tener sustento en la prueba constante en autos . Se omite pronunciamiento sobre los hechos 4,5,6 y 7 por no estar vinculados con los agravios de los recursos de apelación.
II.Se avalan el hecho no demostrado tres, por no haber prueba que demuestre otra realidad fáctica. Sobre los restantes no se emite pronunciamiento por no estar relacionados con las apelaciones conocidas por esta sede.
I II .- En la sentencia de primera instancia 06-2017 de 11:15 horas del 25 de enero del 2017 se declaró parcialmente con lugar la demanda de reivindicación de [Nombre3] y [Nombre3] . (folio 340 ) en cuanto ordenó la restitución de un área de faltante de la finca de Limón matrícula [Placa2] con plano L-22533-1991 acorde con lo concluido en el peritaje rendido que identificó una zona de 13 hectáreas 3.124 en el lindero sur y ordenó la expulsión del demandado [Nombre1] o cualquiera que se mantenga en posesión. La contrademanda se declaró sin lugar en todos sus extremos, así como las pretensiones contra el litis consorte [Nombre2] . La sociedad [Nombre3] y [Nombre3] apela (folio 350 a 353) en cuanto a exoneración de las costas personales y procesales al demandado reconventor vencido que resolvió el fallo venido en alzada, al omitir fundamentar esa decisión que es una excepción a la regla. Estima, en este caso no se cumple ninguna de las condiciones necesarias para determinar que no debe condenársele al pago de tales extremos, pues en el fondo se ha negado a desocupar el terreno reclamado y ha debido recurrir al pago de abogados, prueba pericial traslados, documentación, por lo que exige su condena. Considera, se ha litigado con mala fe procesal y solicita se revoque la sentencia en ese extremo.
IV- Por su parte, el demandado reconventor [Nombre1] (folio 345) recurre la sentencia invocando la nulidad por omitirse resolver sobre sus alegatos, pues existe un traslape de la finca reclamada por el actor con terreno de [Nombre5] inscrita mucho antes de la propiedad del actor. Ese así, como al existir dos dueños registrales debe ser tenido como demandado. Estima, debe definirse cual de los dos tiene mejor derecho para reclamar la reivindicación. Señala, en estas condiciones no es posible que prospere una acción de reivindicación, al tener ambos legitimación para disponer del terreno. Afirma, en aras de la seguridad jurídica la persona juzgadora agraria debe considerara la existencia de un doble título y se debió haber prevenido la integración de la litis. Invoca la claridad del peritaje, respecto sobre el traslape del plano L-01-1977 de la [Dirección2] y no se ordenó la integración. Como segundo vicio de nulidad aduce, en el reconocimiento judicial se indicó de la necesidad de integrar al Estado, al ser parte del área que se pretende reivindicar del Humedal de la zona de Protección de la laguna Danta, sitio Ramsar protegido que no puede ser objeto de posesión por particulares.
En el minuto 01:22 del archivo de video 20160510114053 el a quo consigna la manifestación del defensor público en cuanto el traslape del terreno del actor con el yolillo o humedal y se evidenció en el reconocimiento judicial a minuto 01:37 del archivo de video 20160510112724, donde se reconoce por el accionante que esa zona es patrimonio natural del Estado, se tomó nota sin que se resolviera al respecto. Incorpora dos gráficas sobre la existencia del humedal. Las dos razones expuestas conllevan a la nulidad de lo fallado. Como agravios de fondo expone como motivos de disconformidad: 1) Falta de correspondencia entre lo descrito en el peritaje y el terreno supuestamente poseído por mi representado. Acusa la falta de prueba de que el terreno que posee es el que reclama el actor, ni que el fundo reclamado y descrito por el perito sea el que se recorrió en el reconocimiento judicial. Hace alusión a lo indicado en el minuto 01:24 del archivo 20160510120820 por el juez sobre la incerteza de hasta donde llega el área del terreno.
No existen elementos probatorios del ejercicio de la posesión del demandado en una zona determinada del inmueble. No se recibió prueba testimonial que acredite el despojo del fundo reclamado o quien posee el terreno en donde se realizó el reconocimiento judicial o descrito en el peritaje. Tampoco que el fundo visitado por el perito sea el mismo del observado en el reconocimiento. 2) Invoca un error en la valoración probatoria, pues no demostró mediante declaraciones testimoniales el accionante cuál área de la finca posee y la ocupada por el demandado. No probando la legitimación activa y pasiva. Agrega un extracto de voto n. 169 de la Sala Primera de la Corte Suprema de Justicia sobre la necesidad de ser propietario del inmueble y haber ejercido actos posesorios. Aunado a lo anterior, reprocha se realizó una indebida aplicación del derecho al reconocer la legitimación activa del actor y pasiva de demandado, sin prueba alguna.
Afirma, debe haberse acogido la excepción de falta de derecho, por no acreditarse los presupuestos de una acción reivindicatoria. Acusa, al no existir prueba testimonial se carece de legitimación activa al desconocerse si el actor es del titular del área visitada en el reconocimiento y que sea la recorrida por el perito, tampoco median elementos que acrediten los actos posesorios. En igual termino no se sabe cual área posee el demandado. Tampoco se demostró la identidad del inmueble dadas las consideraciones realizadas al peritaje. En tercer orden, no se comparte el hecho probado número 2, por no existir prueba testimonial que determine que el fundo recorrido sea el mismo valorado por el perito, pues el mismo juzgador no supo en el reconocimiento judicial hasta donde llegaba el fundo. Acusa, no es posible tener por indemostrados los hechos de esta naturaleza de la sentencia venida en alzada.
V .- El primer motivo de nulidad de la parte demandada reconventora se deniega, por constituir más bien agravios contra lo decidido en la sentencia venida en alzada. Al respecto, debe tenerse presente que en materia agraria e l numeral 502 del Código de Trabajo de aplicación por el Transitorio I.3 de la Ley 9343 , y los artículos 26 y 60 de la Ley de Jurisdicción Agraria, exigen que llegados los autos en apelación, el Tribunal debe revisar, en primer término, los procedimientos, y analizar si existe alguna nulidad que afecte el proceso o la sentencia impugnada. Por ende, si se encontrase que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, debe decretarse la nulidad de las actuaciones o resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, esta sede ha mantenido el criterio de que la declaratoria de nulidad procesal procede cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite (artículos 194 a 198 del Código Procesal Civil, aplicados supletoriamente). En este caso, revisado el proceso y la sentencia impugnada, no encuentra este Tribunal que adolezca de vicio alguno que implique declarar la nulidad invocada, por lo que el motivo se rechaza por infundado.
VI.Dado lo alegado en los agravios, debe tenerse presente que el numeral 54 de la Ley de la Jurisdicción Agraria establece, en materia de prueba, el sistema de la libre valoración probatoria. Ello exige al tribunal estudiar y seleccionar las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. El tribunal debe expresar los principios de equidad o de derecho sobre los cuales basa su criterio. "El sistema de la libre valoración de la prueba supera el clásico sistema de la prueba legal así como el de la sana crítica, que rigen en el proceso civil. La forma como ha sido concebido el proceso agrario le permite al juez valorar ampliamente los hechos alegados por las partes. Dicho sistema no es arbitrario, por el contrario en la libre valoración de la prueba la misma deber ser razonada, crítica, basarse en la lógica, la experiencia y la sicología.
En la motivación del fallo el juez debe exponer los motivos de convicción que lo llevan a resolver en los términos que lo hace. A diferencia del sistema de tarifa legal, en el cual las pruebas se aprecian con sujeción a reglas legales previas, e incluso la admisibilidad de pruebas debe estar previamente señalado por el Ordenamiento Jurídico, en el sistema de libre apreciación el juez tiene libertad para admitir pruebas conforme a su criterio” (votos 398 del 6 de junio del 2001 de la Sala Primera. En igual sentido véase votos 206 del 26 de marzo de 1999, 46 del 26 de abril de 1995; 66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario y 3657 del 7 de mayo de 2003 de la Sala Constitucional ). Aclarado lo anterior, se rechaza el agravio de la improcedencia de acogerse la demanda de reivindicación por estar la finca del actor ubicada parcialmente en un yoliyal o humedal en donde no es posible ejercer posesión alguna.
Así como la necesidad de integrar al Estado a este proceso como parte demandada por esta razón o la existencia de doble título con finca de JAPDEVA. En primer orden, cabe señalar, a folio 286 consta el informe pericial topográfico rendido en este proceso. En tal no se hace señalamiento alguno sobre el ecosistema indicado. En el reconocimiento judicial (modo video resguardado en disco compacto anexo a este expediente) al que hace referencia la apelación, se denota la existencia de una zona de repasto y zona boscosa delimitada por cerca. En archivo 20160510112724 se explica por parte de la actora, cual es la zona reclamada en conflicto y se muestra la ubicación de un mojón a partir del cual se marca la delimitación con la zona de yolillo, que explica es terreno que forma parte del zona aledaña a la laguna y por tanto del Patrimonio Natural del Estado. Citó que unas partes pequeñas de ese yolillo se ubican dentro de la línea del mojón.
Según las delimitaciones de mojones y cercas que se mostraron se identifica materialmente cuál es la zona reclamada por la actora, por lo que no es cierto que exista una omisión de la demostración de la identidad del bien por no saber el juez hasta donde llega la finca que el juez menciona como "yolillo" dentro de lo que reclama el demandado y es parte de la zona en litis. En el video 20160510114053, se citó por el juez que el defensor público alega que al verificarse que la línea limítrofe se introduce en algunos sectores dentro del yolillo que corresponde a un humedal, se valore la necesidad de incorporar al Estado como demandado. En ese acto el abogado del actor (minuto 1:55), manifestó que la finca esta inscrita dentro del Refugio de Barra del Colorado existente y conlleva las limitaciones propias de bosque y humedal. Zonas que no se pueden tocar y fue más bien la parte demandada quien alteró las condiciones ambientales de la finca con sus actos.
Se puede constatar que a partir del video identificado con número CED9 se indica por el aquo que se retiró la parte demandada reconventora. Por lo que la diligencia continuó con la accionante solamente. Se celebró el reconocimiento judicial con la finalidad de visitar la finca en litis, sus delimitaciones y actos de posesión que pudieran haberse visualizado. Otro aspecto notable, es que no se evacuó prueba confesional ni testimonial dentro de este asunto. Lo cual no ha sido objetado por ninguna de las partes en disputa; razón por la cual no se observa vicio alguno que corregir.
VII- Bajo estas circunstancias, ha de indicarse que no es causal de nulidad que debido a la existencia de yolillo se deba llamar al Estado, en virtud del objeto de este proceso y tratarse de un inmueble que corresponde a finca inscrita a nombre de un particular dentro de una zona afectada mediante una categoría de manejo de refugio. Amparada al derecho de propiedad y que no ha sido expropiada. Siendo necesario reseñar el marco legal regulatorio del derecho de propiedad afectado en su nucleo en la variable ambiental dada su ubicación. Al respecto señala la Ley de Biodiversidad en su artículo 58: "Las áreas silvestres protegidas son zonas geográficas delimitadas, constituidas por terrenos, humedales y porciones de mar. Han sido declaradas como tales por representar significado especial por sus ecosistemas, la existencia de especies amenazadas, la repercusión en la reproducción y otras necesidades y por su significado histórico y cultural.
Estas áreas estarán dedicadas a conservación y proteger la biodiversidad, el suelo, el recurso hídrico, los recursos culturales y los servicios de los ecosistemas en general. Los objetivos, la clasificación, los requisitos y mecanismos para establecer o reducir estas áreas se determinan en la Ley Orgánica del Ambiente, No. 7554, de 4 de octubre de 1995. Las prohibiciones que afectan a las personas físicas y jurídicas dentro de los parques nacionales y las reservas biológicas están determinadas, en la Ley de la Creación del Servicio de Parques Nacionales, No. 6084, de 24 de agosto de 1977. Durante el proceso de cumplimiento de requisitos para establecer áreas silvestres protegidas estatales, los informes técnicos respectivos deberán incluir las recomendaciones y justificaciones pertinentes para determinar la categoría de manejo más apropiada a que el área propuesta debe someterse. En todo caso, el establecimiento de áreas y categorías tomará muy en cuenta los derechos previamente adquiridos por las poblaciones indígenas o campesinas y otras personas físicas o jurídicas, subyacentes o adyacentes a ella." (la negrita no corresponde a su original).
En igual sentido, el artículo 37 de la Ley Orgánica del Ambiente número 7554 reza: "Facultades del Poder Ejecutivo. Al establecer áreas silvestres protegidas, cualquiera sea su categoría de manejo, el Poder Ejecutivo, por medio del Ministerio del Ambiente y Energía, queda facultado para incluir, dentro de sus límites, las fincas o partes de fincas particulares necesarias para cumplir con los objetivos señalados en esta ley y para instrumentarlos de acuerdo con el respectivo plan de manejo o crear las servidumbres legales para la protección ecológica y el cumplimiento de la presente ley. Cuando se trate de parques nacionales, reservas biológicas o refugios nacionales de vida silvestre estatales, los terrenos serán adquiridos por compra, expropiación o ambos procedimientos, previa indemnización. En los casos de reservas forestales, zonas protectoras, refugios de vida silvestre mixtos y humedales, los predios o sus partes también podrán comprarse o expropiarse, salvo que, por requerimiento del propietario, se sometan voluntariamente al régimen forestal.
Esa sujeción será inscrita en el Registro Público de la Propiedad, como una afectación al inmueble, que se mantendrá durante el tiempo establecido en el plan de manejo. Las fincas particulares afectadas según lo dispuesto por este artículo, por encontrarse en parques nacionales, reservas biológicas, refugios de vida silvestre, reservas forestales y zonas protectoras, quedarán comprendidas dentro de las áreas protegidas estatales solo a partir del momento en que se hayan pagado o expropiado legalmente, salvo cuando en forma voluntaria se sometan al Régimen Forestal. Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de los recursos.
(Así reformado el párrafo anterior por el artículo 72, inciso c) de la Ley Forestal, N° 7575 del 13 de febrero de 1996, que a su vez fue reformado por el 114 de la Ley de Biodiversidad, N° 7788 de 30 de abril de 1998). Se faculta al Poder Ejecutivo para que, por medio del Ministerio del Ambiente y Energía, realice las expropiaciones, contempladas en este artículo, de conformidad con lo establecido en la Ley de expropiaciones No. 7495, del 3 de mayo de 1995." (la negrita y subrayado no corresponde a su original). De estas normas transcritas, entiende esta instancia la finca reclamada en esta acción reivindicatoria corresponde a un inmueble cuyo titular registral es la sociedad actora. Su título de propiedad es válido y eficaz. Si forma parte ese inmueble de alguna categoría de manejo, tiene la obligación legal de ejercer la posesión y atributos del derecho de propiedad dentro del abanico de los límites y limitaciones de su derecho; propio de una finca que contenga recursos naturales y donde se debe resguardar el equilibrio ecosistémico.
Entender que una finca privada sometida a un derecho de propiedad, pasa a ser bien de dominio público, solamente por quedar contenida dentro de un área silvestre protegida (independientemente de su categoría de manejo) al haberse emitido un decreto o ley que crea esa zona y la afecta, sin que medie indemnización alguna por parte del Estado o manifestación del propietario de someterse voluntariamente al Régimen Forestal, conlleva a vaciar el derecho de propiedad constitucionalmente asegurado. Pues limitarle el ejercicio de los atributos del derecho de propiedad que ostenta el titular registral o poseedor idóneo, es una expropiación velada e ilegal que violenta el artículo 45 de la Constitución Política. Acción no propia del Estado de Derecho que instaura nuestro ordenamiento jurídico. Por esa razón dado el objeto del proceso, la naturaleza de finca inscrita del terreno a nombre de la sociedad actora y que el reclamo de reivindicación lo es contra un poseedor no propietario, no estima este Tribunal que deba integrarse al Estado a este proceso por haber un yolillal en la parte sur de la finca, ni que sea recibido el argumento referido a la nulidad de la sentencia venida en alzada por ese ecosistema.
El objeto del proceso de reivindicación es la recuperación de la zona ocupada por el accionado de la finca inscrita bajo matrícula [Placa2] con plano L-22533-1999 inscrita a nombre del [Nombre3] y [Nombre3] . según informe registral de folio 3. Zona en litis identificada por las partes, el juez en el reconocimiento judicial y el peritaje judicial que consta en autos, por lo que tal y como lo argumenta el recurrente, es parte de una finca inscrita a nombre de [Nombre5], llamado a este proceso sin que hiciera manifestación alguna al respecto, es un tema ajeno al interes para apelar del demandado, que no le afecta. Si eso fuera de esa forma, corresponde a ese ente la defensa de sus derechos, amén de no haber sido parte de la demanda ni contestación, (objeto del proceso). Para este Tribunal en cuanto a ese tema la parte carece de interés para apelar, (artículo 561 del Código Procesal Civil de aplicación supletoria) pues a pesar de haberse acogido la demanda reivindicatoria en su contra, invoca como argumento de su agravio al respecto los derechos de propiedad de [Nombre5], que nunca incorporó ese tema al debate.
La parte actora esta facultada para solicitar la restitución de la finca que demuestre esta inscrita a su favor, y en este caso ha sido así. Por ello se rechazan los reproches sobre la necesidad de incorporar al Estado como parte demandada, así como de la existencia de un doble título de finca con JAPDEVA. Los derechos de ese ente podían ser discutidos entre esas personas ajenas al aquí demandado reconventor y lo que se resuelva en este proceso no alcanza al Estado, ni le resta derechos.
VIII- Sobre el alegato de falta de correspondencia entre lo descrito en el peritaje y el terreno poseído por el demandado reconventor y falta de prueba al respecto, se rechaza. Invoca ausencia probatoria que demuestre el terreno que posee el demandado es el reclamado por el actor y la correspondencia de ese inmueble con el descrito en el peritaje y el observado en el reconocimiento judicial. Consta en autos que en el reconocimiento judicial nunca se manifestó por parte del abogado defensor del demandado reconventor, o éste estuvieran desarrollando la diligencia en un terreno diverso al que es objeto de la litis. Respecto a la pericia, y en específico sobre el inmueble visitado, el informe consta a folio 286 a 288. En el mismo concluye el perito, se ubicó el plano L-22533-1991. En el lindero sur de la finca existe una forma diversas en el campo respecto al plan, el área faltante es de 13 ha 3124 metros cuadrados.
Citó: "la ubicación del plano es correcta, según las coordenadas, lo que esta mal indicado en el plano es la hoja cartográfica, lo correcto es Hoja Colorado y no Tortuguero". En la metodología descrita por el profesional se señaló haber visitado el sitio midiendo los vértices de la propiedad que describe el plano L-22533-1991 en el sector norte y en la colindancia sur, por donde esta ubicada la cerca que se extiende en una dirección [Dirección3], hacia la laguna. Por su parte, como ya se describió supra el reconocimiento judicial, del cual consta video, se observa que se hizo el recorrido tomando como base el plano y estuvieron presentes al inicio el demandado con su abogado defensor sin que alegaran estar en sitio diverso a la finca objeto de esta litis. Aunado a lo anterior, el peritaje se pone en conocimiento, mediante auto de las 07:30 horas del 24 de marzo del 2015 (folio 230). El demandado reconventor solicita adición y aclaración respecto para indicar: se citara si se recorrió toda la finca, haberse observado cercas o carriles que le sirvieran de guía, si la cabida recorrida corresponde a lo encontrado y la ausencia de un mosaico de planos con detalle del recorrido con GPS y ubicación de las coordenadas cartográficas.
Se rinde la aclaración (folio 316), señalando el perito, se recorrió todo el fundo y la ubicación que se da en el informe se determina con el plano L-22533-1991. Menciona: "esta ubicación cartográfica del plano L-22533-1991 es el mismo en que se hace el recorrido en el terreno, el área faltante es la indicada en el primer informe. El área faltante o en controversia es de 13 ha 3124 m2 en el costado sur del terreno.El recorrido se inició en la parte norte específicamente en el punto del desembarcadero, acceso fluvial de la finca, recorriendo el lindero hacia el [Dirección4] y cerrado en el mismo punto. La colindancia [Dirección5] es con la Laguna Danto, por lo que en este caso no tiene que ver con el conflicto o traslape en estudio, se recorrió únicamente para verificar dicha conlindancia, la cual es un límite natural, sin embargo adjunto mapa con los puntos solicitados". Se pone en conocimiento la adición al informe (auto de folio 319) y se notifica el 10 de diciembre del 2015 (mismo folio).
Sin que mediara manifestación alguna de las partes respecto a falencias o dudas de las conclusiones vertidas. Mismas que ahora se exponen por el demandado reconventor en el recurso de apelación. El cuestionamiento se refiere al presupuesto de la identidad del bien y el mismo debe ser rechazado acorde con el artículo 320 del Código Civil. No existe ningún elemento probatorio o manifestación que haga concluir que el informe pericial se realizó sobre la base material de otro inmueble o que el reconocimiento judicial se desarrolló en una finca que no corresponde a la zona en litis.
IX- Respecto al alegato de la imposibilidad de demostrar la identidad del bien, la legitimación activa y pasiva por no haberse recabado prueba testimonial, se rechaza. Con el reconocimiento judicial y el informe pericial ya citados, se demuestra la identidad del bien y que la zona en litis cuya cabida ha sido definida y ubicada es parte de la finca matrícula [Placa2] de Limón con plano L-22533-1991 inscrita a nombre de la actora (certificación a folio 324). Con esas probanzas se acredita la identidad del bien y la legitimación activa. Respecto a la legitimación pasiva, la sentencia apelada la tiene por demostrada dada la contestación a la demanda, la reconvención y el reconocimiento judicial. Base fáctica del hecho probado tercero y se razona en el considerando quinto sobre este tema que se extrae es el poseedor el demandado del área en litis pues indicó en la demanda y reconvención era el colindante del rumbo sur de la finca de la actora y haber adquirido de [Nombre6] .
Haciendo referencia a la contestación y reconvención a folios 147 al 153 y reconocimiento judicial. Se indicó en el fallo, si bien no se indicó que fuera [Nombre6] o el demandado quien corrió la cerca entre la finca de la actora y de [Nombre1] la franja faltante se encuentra incluida dentro del fundo del accionado. Ese razonamiento no fue objetado en el recurso de apelación, sino que ataca el fallo indicando no media prueba testimonial. Para este Tribunal lleva razón la sentencia, pues el hecho cuarto de la acción reivindicatoria indica que la sociedad como titular de la finca inscrita con plano L-22533-1991 se encontraba parcialmente ocupado por un tercero que ha talado el bosque existente, ha levantado cercas, modificó linderos privándola del dominio. En el hecho quinto se señaló que el demandado ocupa parcialmente el inmueble, sabe que fundo no le pertenece y se mantiene con la cerca corrida, realizando actos de apropiación.
El hecho sexto afirma la totalidad de la finca es localizable y al realizar el replanteamiento se determinó que existe una parte de la finca de la que han sido despojados, pues se corrieron las delimitaciones y el vecino tiene en posesión esa zona. En el hecho sétimo se describe que dada la sospecha de haberse alterado los linderos se contrato un topógrafo en el año 2013 para verificación y se logró concluir que en el sector sur las colindancias no discurren por donde indica el plano al encontrarse parcialmente parte de su finca en el fundo de [Nombre1] (demanda a folio 6 a 16). Por su parte el accionado contestó (folio 148 a 153), negativamente la demanda alegando la prescripción negativa al confesar en su escrito la accionante que se percata del faltante de su terreno en la zona sur, diez años después de saber que tenía un conflicto con él con ocasión de ese terreno. Niega la invasión, acepta su condición de colindante y sostienen que las cercas han estado siempre en el mismo sitio.
En la contrademanda indica en le hecho uno es el colindante del terreno de la actora, que adquirió por venta el 16 de octubre del 2001 la posesión que venía ejerciendo [Nombre2] ., a quien le vendió [Nombre7] . En el hecho segundo citó que desde que adquirió la finca la ha mantenido en posesión y las cercas han estado en el sitio desde hace veinte años. Manifestó que el terreno de la accionante presenta en el plano un problema de amarres y ubicación cartográfica que no coincide materialmente con la realidad. Invoca la prescripción negativa de la demandante para el reclamo por haber transcurrido el plazo legal. Como pretensión solicita se declare prescrito el derecho de accionar en su contra de la sociedad y la anulación del plano L-22533-1991 y otras pretensiones accesorias. Como se denota, se interpuso una acción reivindicatoria por la sociedad actora en su condición de titular registral del fundo en cuestión, se determinó que la parte faltante de la cabida que representa el plano citado en la realidad material se ubica dentro de las colindancias de la finca del demandado, que alega siempre estuvieron las divisorias en el sitio.
En otro orden, la acción reivindicatoria solo podría ser enervada si el accionado hubiera adquirido el terreno por prescripción positiva (artículo 320 del Código Civil), lo cual no fue demostrado ni pretendido por el demandado reconventor que invoca en la contestación de la demanda y la reconvención la prescripción negativa. Por estimar que se ha superado el plazo prescriptivo decenal del artículo 868 Ibídem. No fue objeto de debate el tema de la usucapión por lo que, la acción reivindicatoria procede al acreditarse los tres presupuestos de la acción incoada. Por ello, no son de recibo los agravios de la parte apelante sobre la ausencia de prueba testimonial sobre la posesión ejercida por el accionado sobre la finca, pues según la pericial, lo contestado en la demanda y afirmado en la contrademanda, así como los limites visualizados en el reconocimiento judicial, hay suficiencia probatoria de la legitimación pasiva.
X.Con respecto al reproche de la resolución la exoneración de costas de los demandados reconventores, se rechaza. De la lectura de los autos, se denota que la colocación de esa delimitación entre las fincas de las partes que se introduce dentro de la cabida registral y material del fundo de la actora es de vieja data. No consta elemento probatorio alguno que demuestre las personas demandadas movieron las cercas de forma reciente o mediaran reclamos por esa situación. Por ello para esta Cámara no han actuado con mala fe procesal al contestar la demanda y reconvenir. Consideraron estaban amparados a la posesión que se venía ejerciendo desde hace muchos años sin que la situación hubiera generado un conflictos antes de este proceso. Por ello, al amparo del artículo 55 de la Ley de Jurisdicción Agraria, deberá confirmarse lo fallado en cuanto resolvió sin especial condenatoria en costas.
XI.En virtud de lo expuestos, con fundamento en el artículo 1, 2 y 55 de la Ley de Jurisdicción Agraria, artículo 320 del Código Civil se rechaza la nulidad y en lo apelado, se confirmará la sentencia.
POR TANTO
Se rechaza la nulidad. En lo apelado, se confirma la sentencia número cero seis- diecisiete de las once horas quince minutos del veinticinco de enero del dos mil diecisiete.
