In the ordinary proceeding (proceso ordinario) brought by MISAEL JARA ALVAREZ against JOSÉ HERIBERTO LAZO HERNÁNDEZ, ESTADO, and JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE VERTIENTE ATLÁNTICA (JAPDEVA), the defendant ESTADO raised the defense of lack of subject-matter jurisdiction (incompetencia en razón de la materia); the Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica ordered that the proceeding be referred, with suspensive effect (efecto suspensivo), to the Tribunal Agrario, which rejected the objection for lack of jurisdiction (excepción de falta de competencia). The defendant disagreed, and the matter was therefore submitted to this Chamber for consultation.

CONSIDERING

I.The plaintiff brought this proceeding, seeking damages (daños y perjuicios) and requesting a declaration that: “I- I am the lawful owner and possessor of the property described, which is unregistered land used for agriculture, livestock farming, and forestland, located in Caño Gaspar de Puerto Viejo de Sarapiquí de Heredia, currently measuring approximately three hundred hectares. II.- I have possessed said property for more than sixty years quietly, publicly, peacefully, continuously, and under a claim of ownership, and have therefore acquired it by adverse possession (usucapión), making me its lawful owner; accordingly, the creation of any property, reserve, or refuge by the ESTADO does not affect me. III- Acquisitive prescription (prescripción positiva) shall be declared in my favor with respect to the aforementioned property, and the undersigned shall enjoy all the rights and powers of a true owner, to the exclusion of any third party, including ESTADO, JAPDEVA, and LAZO, who may believe they have any right over my estate.

IV- In the future, defendant Lazo shall refrain from committing any act of interference against my person, my property, or my possession, subject to the applicable legal consequences in the event of noncompliance. V- Mr. Lazo Hernández has no land whatsoever in Caño Gaspar de Puerto Viejo de Sarapiquí de Heredia, since he sold his possessory interest to Mr. Antonio Huertas Araya. VI- The defendant shall be evicted from any portion of land that he is claiming and that forms part of the property belonging to me, because the undersigned plaintiff has the superior right of possession. VII- The defendant shall pay both categories of costs (ambas costas) of this action” (F. 22, 28 y 29). The Juzgado Agrario del Segundo Circuito Judicial de la Zona ordered that the proceeding be referred, with suspensive effect, to the Tribunal Agrario, which, through resolution 279-F-2016 issued at 11 hours 43 minutes on 18 de marzo de 2016, rejected the objection for lack of jurisdiction, stating that nothing prevents this proceeding from being adjudicated in the agrarian jurisdiction (jurisdicción agraria).

It further stated that within protected areas, except for biological reserves and national parks, given the purpose and absolute conservation objectives of those management categories, public and private properties may coexist in the other categories, and their owners may be public entities or private persons. Counsel for ESTADO expressed disagreement with the decision, stating that the land at issue in this proceeding lies within the natural heritage of the State (Patrimonio Natural del Estado) and that, under recent rulings of the SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA, jurisdiction lies with the Tribunales Contencioso Administrativos; consequently, the matter was submitted to this Chamber.

II.Article 13 of Ley Forestal N° 7575 provides: “The natural heritage of the State shall consist of the forests and forestlands of national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other agencies of the Administración Pública, except for real property securing credit transactions with the Sistema Bancario Nacional that becomes part of its assets. The Ministerio de Ambiente y Energía shall administer this heritage. When appropriate, acting through the Procuraduría General de la República, it shall register the land in the Registro Público de la Propiedad as individually identified properties owned by the ESTADO. Nongovernmental organizations that acquire real property containing forest or suitable for forestry, using funds from donations or the public treasury obtained in the name of the ESTADO, shall transfer such property into its name.” In turn, Article 14 of that same Law states: “The forestlands and forests constituting the natural heritage of the State, as detailed in the preceding article, shall be immune from attachment and inalienable; possession thereof by private parties shall not create any right in their favor, and the State’s action to recover ownership (acción reivindicatoria) of such land shall not be subject to limitation.

Consequently, such land may not be registered in the Registro Público through possessory information proceedings (información posesoria), and both its invasion and occupation shall be penalized as provided in this Law.” Article 108 of the Ley de Biodiversidad, in turn, establishes that, until specialized environmental courts exist, the Jurisdicción Agraria shall have jurisdiction over all matters involving private parties, while reserving for the Jurisdicción Contenciosa Administrativa those matters in which the ESTADO is involved. Specifically, it provides: “In matters concerning biodiversity, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the jurisdicción contenciosa administrativa. As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal jurisdiction; likewise, disputes arising between private parties that do not involve an administrative act (acto administrativo) or public-domain property (dominio público) shall fall within the jurisdiction of the jurisdicción agraria.” It follows from the foregoing that, because the specialized environmental jurisdiction has not yet been established, disputes that arise fall, as a general rule, within the jurisdiction of the jurisdicción contenciosa administrativa and cannot be deemed to fall within the jurisdicción agraria as an exception, because the property at issue forms part of the public domain.

Accordingly, this Chamber concurs with the opinion of the Procuraduría General de la República that subject-matter jurisdiction over this proceeding lies with the jurisdicción contenciosa administrativa, which is consistent with the subject-matter jurisdiction established in Articles 1 and 2 of the Código Procesal Contencioso Administrativo. Both laws, the Ley de Biodiversidad and the Código Procesal Contencioso Administrativo, postdate the Ley de Jurisdicción Agraria, Articles 1 and 2 of which establish the subject-matter jurisdiction of the agrarian courts in relation to Article 22.

III.In the case under consideration, the plaintiff seeks a judgment declaring him the owner of the land. In the seventh allegation of fact, he states that in 1994 he had part of the property surveyed, resulting in cadastral plan (plano catastrado) H-1899-1994; subsequently, in evidentiary section 22, he offers plan H-189955-94, and at folio 417 of the evidence submitted by ESTADO appears plan H189955-94 in the name of Misael Jara Álvarez. According to the plaintiff, said plan corresponds to part of the property he claims; and according to study SINAC-ACTo-ASP-PNE-198, issued by the Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía and appearing at folio 56 of the judicial record, it states: “…based on the location set forth in cadastral plan number H-189955-94, in the name of Misael Jara Álvarez, bearer of identity card number 5-146-012, with an area of 75 hectares 9014,00 square meters, it has been determined that said plan describes a property whose entire area is located WITHIN REFUGIO NACIONAL DE VIDA SILVESTRE BARRA DEL COLORADO, created by Decreto Ejecutivo N° 16358-MAG, dated 26 de julio de 1985, and its Amendment to the Declaration of Refugio Barra del Colorado, Decreto Ejecutivo N°31804-MINAE.” Under these circumstances, part of the real property at issue in this matter constitutes a public-domain area; therefore, it is the jurisdicción Contenciosa Administrativa (art. 108 Ley de Biodiversidad), extending to any matter in which the ESTADO has a direct interest, that has jurisdiction over the plaintiff’s claims.

IV.Consequently, the appropriate course is to declare that jurisdiction over this proceeding lies with the Tribunal Procesal de lo Contencioso Administrativo y Civil de Hacienda.

It is declared that jurisdiction over this proceeding lies with the Tribunal Procesal de lo Contencioso Administrativo y Civil de Hacienda. En el ordinario interpuesto por MISAEL JARA ALVAREZ contra JOSÉ HERIBERTO LAZO HERNÁNDEZ, ESTADO y JUNTA DE ADMINISTRACIÓN PORTUARIA Y DE DESARROLLO ECONÓMICO DE VERTIENTE ATLÁNTICA (JAPDEVA) , la parte demandada Estado interpuso la defensa de incompetencia en razón de la materia, el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica ordenó remitir el proceso en efecto suspensivo al Tribunal Agrario, el cual rechazo la excepción de falta de competencia, de lo que disintió la parte demandada, por lo que se envió en consulta ante esta Sala.

CONSIDERANDO

I.El actor planteó el presente proceso, solicita daños y perjuicios y solicita se declare “ I- Que soy legítimo dueño y poseedor de la finca descrita, que es terreno sin inscribir dedicado a la agricultura, ganadería y montaña, ubicado en Caño Gaspar de Puerto Viejo de Sarapiquí de Heredia, que mide actualmente aproximadamente trescientas hectáreas. II.- Que he poseído dicha finca desde hace más de sesenta año en forma quieta, pública, pacífica, continua, a título de dueño, por lo cual he usucapido la misma, siendo su legítimo propietario, por lo cual la creación de cualquier finca, reserva o refugio creados por el Estado no me afectan. III- Que se declare la prescripción positiva en mi favor en relación con la indicada propiedad, gozando el suscrito de todos los atributos de un verdadero propietario, con exclusión de cualquier tercero, incluido dentro de ellos al ESTADO, JAPDEVA y LAZO, que crean tener algún derecho sobre mi heredad.

IV- Que el demandado Lazo en el futuro deberá de abstenerse de realizar cualquier acto perturbatorio contra mi persona, mi propiedad y mi posesión, bajo apercibimientos legales en caso de omisión. V- Que el señor Lazo Hernández no tiene terreno alguno en Caño Gaspar de Puerto Viejo de Sarapiquí de Heredia, desde que vendió su posesión a don Antonio Huertas Araya. VI- Que el demandado deberá ser desalojado de cualquier porción de terreno que este reclamando y que forme parte de la finca que me pertenece, por tener el suscrito, demandante, mejor derecho para poseer. VII- Que el demandado deberá pagar ambas costas de esta acción” (F. 22, 28 y 29). El Juzgado Agrario del Segundo Circuito Judicial de la Zona ordenó remitir el proceso en efecto suspensivo al Tribunal Agrario, el cual mediante la resolución 279-F-2016 de las 11 horas 43 minutos del 18 de marzo de 2016 rechazo la excepción de falta de competencia, indicando que nada obsta para que en la jurisdicción agraria pueda dilucidar este proceso, además de que dentro de las áreas protegidas a excepción de reservas biológicas y parque nacionales dadas su finalidad y objetivos de conservación absoluta de esa categorías de manejo, en los demás si pueden coexistir fincas públicas y privadas cuyos propietarios pueden ser entes públicos o personas privadas.

El apoderado estatal manifestó su inconformidad con lo resuelto indicando que en este juicio el terreno objeto del proceso se encuentra dentro del Patrimonio Natural del Estado y de acuerdo con resoluciones recientes de la Sala Primera de la Corte Suprema de Justicia su conocimiento corresponde a los Tribunales Contencioso Administrativos, por lo que se envió ante esta Sala.

II.El artículo 13 de la Ley Forestal N° 7575 dispone: “ El patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. El Ministerio de Ambiente y Energía administrará el patrimonio. Cuando proceda, por medio de la Procuraduría General de la República, inscribirá los terrenos en el Registro Público de la Propiedad como fincas individualizadas de propiedad del Estado. Las organizaciones no gubernamentales que adquieran bienes inmuebles con bosque o de aptitud forestal, con fondos provenientes de donaciones o del erario, que se hayan obtenido a nombre del Estado, deberán traspasarlos a nombre de éste”.

Por su parte, el numeral 14 de esa misma Ley señala: “ Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley.” Por su parte, el artículo 108 de la Ley de Biodiversidad establece que, mientras no existan tribunales ambientales especializados, corresponderá a la Jurisdicción Agraria todos los asuntos vinculados con particulares, reservando a la Jurisdicción Contenciosa Administrativa, aquellos en los cuales esté involucrado el Estado. Concretamente, dispone: “En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contenciosa administrativa.

Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria.” De lo anterior se deduce, como no se ha creado aún la jurisdicción ambiental especializada, las controversias que se susciten, por regla general, son competencia de la jurisdicción contenciosa administrativa, sin que se pueda estimar que es propia de la jurisdicción agraria a manera de excepción, debido a que se está en presencia de bienes que forman parte del dominio público. Por ende, comparte esta Sala el criterio de la Procuraduría General de la República acerca de que la competencia material de este proceso corresponde a la jurisdicción contenciosa administrativa, lo cual es acorde con la competencia material establecida en los artículos 1 y 2 del Código Procesal Contencioso Administrativo.

Ambas leyes, la de Biodiversidad y el Código Procesal Contencioso Administrativo, son posteriores a la Ley de Jurisdicción Agraria que en sus artículos 1 y 2 establecen la competencia material de los tribunales agrarios, en relación con numeral 22.

III.El caso de estudio, la parte actora pretende se declare en sentencia como propietaria del terreno el cual indica en el hecho séptimo, que en el año 1994 procedió a medir parte de la finca resultando el plano catastrado H-1899-1994, posteriormente en el apartado de prueba 22. ofrece el plano H-189955-94 y a folio 417 de la prueba aportada por el Estado se observa el plano H189955-94 a nombre de Misael Jara Álvarez. Dicho plano que según el actor corresponde a parte de la propiedad que solicita, y según se indica en el estudio SINAC-ACTo-ASP-PNE-198 emitido por el Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, que corre a folio 56 del expediente judicial, señala; “…se ha determinado con base en la ubicación consignada en el plano Catastrado número H-189955-94; a nombre de Misael Jara Álvarez; portador de la cédula de identidad número 5-146-012; con un área de 75 hectáreas 9014,00 metros cuadrados; que le mismo describe un inmueble que se ubica en la totalidad de su área DENTRO DEL REFUGIO NACIONAL DE VIDA SILVESTRE BARRA DEL COLORADO, creado mediante Decreto Ejecutivo N° 16358-MAG, del 26 de julio de 1985 y su Reforma a la Declaración del Refugio Barra del Colorado Decreto Ejecutivo N°31804-MINAE ”.

Ante esta coyuntura, parte del inmueble objeto de este asunto corresponden a un área de dominio público, por lo que es la jurisdicción Contenciosa Administrativa (art. 108 Ley de Biodiversidad), extensiva a cualquier asunto en los que el Estado tenga interés directo, a la que corresponde conocer de las pretensiones de la parte actora.

IV.Consecuentemente, lo procedente es declarar que el conocimiento del presente proceso corresponde al Tribunal Procesal de lo Contencioso Administrativo y Civil de Hacienda.

POR TANTO

Se declara que el conocimiento del presente proceso le corresponde al Tribunal Procesal de lo Contencioso Administrativo y Civil de Hacienda.
