7- By ruling issued at two sixteen p.m. on August thirty-first, two thousand twelve, the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, ordered the plaintiff to join [Nombre8] and [Nombre15] as defendants. (fs.325 and 340)

CONSIDERANDO.
I- Motion to nullify service (incidente de nulidad de notificación) of the order entered at 10:10 minutos del 17 de junio del 2015, filed by Bienes Raíces Brisas del Norte S.A. That party filed the motion before this appellate court (expediente digital/escritos/fecha 9 de octubre del 2015), asserting that the referenced order had not been duly served at the facsimile number it had designated and appearing before this appellate court to submit arguments rebutting the grounds for challenging the trial judgment stated in the appeal under consideration here. Upon review of the proceedings, it is determined that, although it is confirmed that the order admitting the appeal before this Chamber with suspensive effect (efecto suspensivo) was served through another means (service list at folio 603), that circumstance does not warrant a declaration of procedural nullity (nulidad procesal), because it did not leave any party without a defense or infringe the right of defense.
This follows from the supplementary application to this matter of sections 199, 194 and 196 of the Code of Civil Procedure. The incorrectly served order is the one admitting, with suspensive effect, the appeal against the trial-court judgment filed by [Nombre2] before this Court. Agrarian proceedings do not contain a procedural stage at which the parties must be afforded a hearing on their arguments opposing appeals filed against a trial-court judgment, although they remain free to submit any arguments they deem necessary to protect their interests (articles 501 and 502 of the Labor Code). Therefore, service of that order at another facsimile number caused no lack of defense, and the motion to nullify service must be denied.
II- Proven Facts. The proven facts stated in the appealed judgment are affirmed because they are supported by evidence in the record.
III- Facts Not Proven. The findings regarding facts not proven in the appealed decision are adopted because no evidence establishing a different factual reality was entered into the record.
IV- Grounds for Appeal. Wilfama S.A., through its special litigation attorney-in-fact (apoderado especial judicial), filed an appeal (folio 599 Tomo II) against trial-court judgment N. 139-S-2015 de las quince horas del 1 de junio del 2015 (folio 575 Tomo II). It states the following grounds for its disagreement:
V- The appellant company’s objection centers on its disagreement with the route selected in the judgment as appropriate to provide the plaintiff’s property, registration [Placa4] of Guanacaste, with adequate access to a public road. It argues that use of the route identified as [Dirección10] will harm the natural forest environment and its elements and that, for this reason, the granting of that access road should have been denied. In its appeal, it states that, consistent with the expert evidence, passage should have been granted via [Dirección8], which is the shortest route, or alternatively via routes three or four, in order to protect the environment. It generally contends that the judgment departs from the body of evidence and contains contradictions. It cites two such contradictions: a) with respect to the width granted along [Dirección10], since the judgment stated that in some sections it was no more than one meter wide, yet granted a width of three meters; b) it grants [Dirección7] as an outlet because it does not harm the environment, yet requires compensation to the plaintiff for any loss or damage that it may entail, with the harm logically referring to the environment, although this was not expressly stated.
It faults the judgment for omitting to specify what type of four-wheel-drive vehicle is authorized for use on the granted road, given that modes of transportation capable of causing additional damage could be used.
VI- It is argued that the declaration of the right of way (derecho de paso) along the so-called [Dirección7] causes environmental damage (daño ambiental) to the elements present in that specific ecosystem, by recognizing a road through a forest described as “virgin.” The pleading under appeal further states that granting another of the routes set forth in the expert report would better serve environmental interests, as it would cause no environmental damage whatsoever. Having analyzed that grievance and the ruling, this Court does not agree with the argument. It should be noted that our legal system contains no definition of environmental damage; nevertheless, based on Article 50 of the Constitution and its closest statutory development, namely the Ley Orgánica del Ambiente, Article 2 establishes that environmental damage constitutes: “an offense of a social nature, because it affects the foundations of society’s existence; economic, because it threatens the materials and resources essential to productive activities; cultural, insofar as it endangers communities’ way of life; and ethical, because it threatens the very existence of present and future generations.” For the protection of the environment, a body of environmental-protection rules (bloque normativo tutelar del medio ambiente) has been enacted, comprising national and international provisions governing human activities that may cause ecosystem imbalances (desequilibrios ecosistémicos) intended to be avoided, reduced, or mitigated.
That is, activities that alter the environmental baseline (línea base del ambiente). Based on the concepts of environmental damage developed in legal scholarship or case law, it may be understood as human acts or omissions that cause deterioration or pollution of the surrounding environment. Such damage affects people both individually and collectively as a society. Article 59 of the Ley Orgánica del Ambiente defines environmental pollution (contaminación del ambiente) as: “any alteration or modification of the environment that may harm human health, threaten natural resources, or affect the Nation’s environment in general. The discharge and emission of pollutants shall mandatorily comply with the technical regulations issued. The State shall adopt the measures necessary to prevent or correct environmental pollution.” For its part, because the matter under appeal concerns the existence of forest, Article 1 of Ley Forestal number 7575 defines the State’s role as: “ensuring the conservation, protection, and administration of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of proper and sustainable use of renewable natural resources.
It shall also ensure job creation and improvement of the rural population’s standard of living through its effective incorporation into forestry activities (actividades silviculturales) ….” For its part, as one of the core principles of Environmental Law (Derecho Ambiental) for protecting the natural environment and its elements, the precautionary principle (principio precautorio) applies to all human activity. The Sala Constitucional de la Corte Suprema de Justicia explained the matter in judgment N°1923-2004: “XV.- PRECAUTIONARY PRINCIPLE OF ENVIRONMENTAL LAW AND PROTECTION OF GROUNDWATER. One of the guiding principles of Environmental Law is the precautionary principle, also known as the principle of prudent avoidance. This principle is embodied in the United Nations Conference on Environment and Development, or Rio Declaration, which states literally: ‘Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities.
Where there is a danger of serious and irreversible damage, lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.’ Within the domestic legal system, Article 11 of the Ley de Biodiversidad (No. 7788 del 30 de abril de 1998) adopts the following principles as interpretive parameters (parámetros hermenéuticos): ‘1.- Preventive approach: It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats to it is vitally important. 2.- Precautionary approach or in dubio pro natura: When there is a danger or threat of serious or imminent harm to the elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures.’ In Voto No. 1250-99 of this Chamber, issued at 11:24 on 19 de febrero de 1999 (reiterated in Votos Nos. 9773-00 at 9:44 on 3 de noviembre del 2000, 1711-01 at 16:32 on 27 de febrero del 2001, and 6322-03 at 14:14 on 3 de julio del 2003), this Court held as follows: ‘(...) Prevention seeks to anticipate negative effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is founded on the need to take and implement all precautionary measures to avoid or contain possible harm to the environment or human health. Thus, if there is a risk of serious or irreversible damage—or any doubt in that regard—a precautionary measure must be adopted, including postponement of the activity concerned. This is because, in environmental matters, ex post facto enforcement is ineffective, since once socially harmful biological consequences have already occurred, punishment may have moral significance but will scarcely compensate for the damage caused to the environment.’ Subsequently, in Voto No. 3480-03 at 14:02 on 2 de mayo del 2003, this Court stated: ‘Properly understood, the precautionary principle refers to adopting measures not because the facts giving rise to a risk are unknown, but because there is no certainty that such facts will in fact cause harmful effects to the environment.’” The foregoing concepts are relevant in light of the appellant’s appeal, in which it claims that granting route one to the plaintiff company results in damage to the forest resource and associated ecosystem existing on its property, where a forest under conservation is present.
Having analyzed the evidence in the record, this Court does not agree with that argument or with the assertion that the decision was made without regard to the evidence submitted in the proceedings. First, it should be noted that the road recognized as the access route leading to the public road has been used for several decades and has existed at least since the year 1975, as stated in the judgment under appeal. It is not a new route that must be opened through a forest, since it already exists and was formerly used by those who owned the property that now belongs to the plaintiff in order to access their land. The appellant raises no objections regarding the judgment’s assessment of the testimonial evidence and therefore accepts the conclusions drawn from each of the testimonies described in the judgment under appeal. This Court agrees with those conclusions following a comprehensive review of those statements.
The witnesses consistently testified that the road identified as [Dirección7] in the expert evidence and the judgment under appeal is the road that has always remained in use and has existed for several decades. Witness [Nombre18], known as [Nombre19] (folio 115 and folio 464), stated, insofar as relevant, in both of his statements that for many years the road was used by landowners without any problem. He stated that he had owned, for 20 or 25 years in the past, the land comprising the property now owned by the plaintiff, and that he knew no problem had arisen regarding the use of that access route until the year 2009. For his part, [Nombre20] (folio 467) stated that he has known the property and the road for 40 years; his father, [Nombre13], had owned the plaintiff’s property, known as “[Nombre21],” and the property he now identifies as belonging to [Nombre2] was used as the access route from the public road, following the existing road.
He stated that his father sold it to [Nombre19] when the witness was 14 years old. Witness [Nombre22] testified that he had worked for [Nombre2] in 1990 and stated that the existing access could be used by neighbors without any impediment. He referred to [Nombre23] and [Nombre13], both surnamed [Nombre13], who were the previous owners of the landlocked property (fundo enclavado). All these witnesses testified consistently that the road already existing as an access route to the plaintiff’s property is the same one that the previous owners had always used to access the property now belonging to the plaintiff company. [Nombre24] testified to the same effect (folio 470), stating that this has always been the access route to the properties farther inside and that [Nombre25] granted permission to pass. These statements clearly establish that route one has existed for several decades as access from the property registered under [Placa4] of Guanacaste to the public road and has been used by its current and previous owners.
The judicial inspections (reconocimientos judiciales) of 23 de julio del 2011 (folio 48 a 49), 11 de febrero del 2011 (folio 104 a 109), and 8 de abril del 2013 (folio 425 y 426) record that this path exists and is surrounded by forest vegetation along its course, as detailed in the various records so stating. This may also be seen in the sketch at folio 548, entitled Plano Cobertura Boscosa sobre Rutas (folio 548), and in the description at folio 555, which states that the route passes through a forest area and consists of: “a road used for transit, work, and recreation (rural tourism), with average widths of 3 to 4 meters along its first 890 meters and an average width of two meters along the final 15 meters of the route. The entire surface is earth. (turned into mud because of the rainy season..., with a winding horizontal and vertical alignment due to the topography in some sections....” Given its longstanding existence and use as an access route, the objection that granting this route causes environmental damage cannot be accepted, because it is not a new element in that environment that would harm the forest vegetation, wildlife, or water resources.
This point is confirmed by the fact that [Nombre17] S.A. itself, which opposes recognition of [Dirección7] on the ground that it causes environmental damage, widened this route and partially modified it in order to remove timber from its land, all, as it stated, with the respective permits from the Ministerio de Ambiente y Energía to remove certain trees from its forested land. Those actions altered the original conditions of [Dirección11], since that record states (folio 425): “... During this section, it can be seen that the road has indeed been widened and modified as necessary to create a logging track (trocha), which the defendant states is used to remove timber; the defendant likewise states that it holds the corresponding permits, granted by [Nombre26], for that width of the road and that its intention is to allow natural regeneration along that section....” Accordingly, the environmental damage alleged in the appeal does not exist on that ground, since this route had already existed for many years.
As may be seen, the forest resource may be harvested by society, and this is permitted through legal regulation and oversight by means of the issuance of the respective permits by the competent entities designated by law. In our legal system, such use of forest resources is governed by Ley Forestal N. 7575 and its regulations.
It is appropriate to cite national environmental legal scholarship concerning the legal framework of forestry legislation, which sets forth the limits and restrictions on the right of ownership of properties with forest cover (cobertura boscosa). In this regard, given the private nature of the registered properties, they fall under the regime of private forest ownership (propiedad forestal privada), as a form of ownership subject to multiple limitations in the public environmental interest, restricting the powers of the owners of those properties. (Cabrera M. Jorge. Manual de Legislación Ambiental Costarricense. 2002. pag 159). That author states: “Ley Forestal No 7575... establishes in Article 1, as an essential and priority function of the State, the duty to ensure the conservation, protection, and management of natural forests, and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the appropriate and sustainable use of renewable natural resources.
It shall also ensure the creation of employment and improvement of the standard of living of the rural population through their effective incorporation into forestry activities.” (Op.cit. pág. 153). In this specific case, as reasoned in the judgment under appeal, the closure by the representatives of the defendant company of the existing road ([Dirección12]) used by the plaintiff to enter her property did not occur because of any abuse in its use or damage to the natural resources surrounding that access. Rather, it arose from the displeasure of the representatives of the Wilfma S.A. property upon learning that a survey plan had been prepared depicting an easement (servidumbre) five meters wide in favor of the plaintiff’s property. This was admitted in the confession evidence, in the response to the tenth question, which was contrary to their interests and reads: “Was it in the year two thousand ten that you closed the passage and denied its use to the plaintiff, leaving that property without access to a public road?” To which the response was: “Yes, I closed it because when they surveyed her property, they indicated on her plan that it was five meters wide, both at the entrance and the (sic) exit.” (folio 462).
It is therefore not apparent that the continued use of an already-existing road, which had for years provided access to the property currently owned by the plaintiff, causes any present or past environmental damage. Such use is not inconsistent with environmental protection, provided that it consists of appropriate passage in absolute respect for the right granted, without abuse in the exercise of the authority and conditions of passage conferred. This route is not granted because it was used in the past, since, pursuant to ordinal 379 of the Código Civil, acquisitive prescription (prescripción positiva) does not apply to discontinuous easements such as the one under consideration. Rather, various factors were weighed in granting it, principally safety. For that purpose, important elements from the topographical expert report (dictámen pericial topográfico) and the observations of the adjudicators were considered.
The plaintiff must pay the defendant the compensation ordered for this road area, to be determined during the judgment-enforcement stage (etapa de ejecución de sentencia). It is logical that all necessary works must comply with the applicable regulatory environmental laws. In this particular case, the corresponding permits must be requested if required by law. This is what the representatives of Wilfama S.A did at the appropriate time, when they were required to seek permits to remove trees from their land, widen the track, and even temporarily alter a stream channel, as described in the record at folio 425 cited, in order to use the extracted timber, all with the respective permits from the Ministerio de Ambiente y Energía. In the view of this Chamber, given the preexisting conditions demonstrating the safety of the route and the many years of use of that road within an area with forest cover, no damage is caused.
It has not been shown that damage has occurred or that a foreseeable risk exists solely because of that circumstance. Indeed, the existence of roads within forested areas is among the activities permitted by artículo 19 of Ley Forestal N. 7575 for the sustainable use of the resource. That provision states that residential houses, offices, stables, corrals, nurseries, roads, bridges, and facilities intended for recreation, ecotourism, and other analogous improvements may be constructed on privately owned land and properties where forests are located. That same provision establishes the need to satisfy statutory technical requirements before the competent entity for the development of those and other activities in forests located on privately owned properties of a forest nature. What is absolutely prohibited is land-use change (cambio de uso de suelo), which is severely punished by law. As to the contention that other routes would not cause any environmental damage, the appellant is incorrect, because route two (which does not exist), proposed by the appellant defendant, is described in the expert report (folio 556) as beginning in a forested area, crossing the channel of a spring (ojo de agua), and commencing a steep, progressive ascent from that point.
Moreover, [Dirección13] (which do not exist) would require the performance of works from the starting point and present significant safety problems for the safe passage of people and animals. It should be noted that, regarding the third and fourth routes, the expert description identifies matters relating to the necessary demarcation and formal construction because no infrastructure currently exists, while also noting that access would be difficult during rainy periods due to the steep slopes and materials present in the area (mud). The judgment under appeal thoroughly analyzes the conditions of each route and weighs the best option, with LENGTH not being a determinative criterion in itself, but merely one factor to be considered against others, such as safety along the route, current conditions, topography, causing the least harm to the servient estate (fundo sirviente), and benefiting the dominant estate (fundo dominante).
(artículo 373 y 377 del Código Civil). Accordingly, the appellant’s argument that the shortest route must be recognized as the means of access cannot be accepted, because the other factors carry equal weight in the decision. The shortest route is [Dirección14], but it has the cited disadvantage of not existing, being located in a forested area at its beginning, and having a spring (naciente) along its course. The expert evidence further states that, on some sections of the route, there is an imminent danger to vehicular traffic due to slopes greater than or equal to 30%, (folio 557). The parties made no observations concerning the expert report when the trial court disclosed it to them, thereby accepting its contents regarding the conditions described for each of the routes considered therein, (resolución a folio 561). For the foregoing reasons, the appellant’s grounds of appeal concerning the alleged generation of environmental damage through recognition of the right-of-way obligation (obligación de paso) over the route identified as [Dirección7], on the terms recognized in the judgment under appeal, are rejected.
Nor does it appear that the conclusions of that decision were reached without proper grounds and explanation as to the factual and legal reasons, or without adherence to the evidentiary-assessment rules (reglas de sistema de valoración probatoria) established in artículo 54 de la Ley de Jurisdicción Agraria.
VII- On the other hand, the judgment is challenged on the ground that there is a contradiction regarding the width of the route recognized as providing access to a public road for the plaintiff’s property, because a width of three meters was authorized although there are sections that do not exceed two meters, as the court below (a quo) noted was observed during the judicial inspections (reconocimientos judiciales) and recorded in the judgments. That argument is rejected; the judgment must be interpreted in accordance with the actual conditions under which it is to be enforced and have effect. In the twentieth recital (considerando vigésimo), when route one is described, the following is stated regarding the width of that road: “The [Dirección15] one, due to the conditions through which it runs, cannot be widened beyond two meters. Therefore, even if the modified route of [Dirección16] were used, it could not be more than five meters wide, and in some sections it would be barely two meters wide (without gravel).” In the twenty-second recital (considerando vigésimo segundo), when analyzing the width to be granted, the court stated, based on Article 398 of the Civil Code, that a minimum of two meters and a maximum of six meters are permitted.
It reasoned that route one has sections that are difficult to traverse and would not allow a width greater than three meters, and that its owner acknowledged that, when passage was permitted, it was three meters wide. This was in addition to the widening carried out for the removal of trees harvested under the respective permits. The judgment subsequently continues explaining in this regard that, because this road is located on forested land, passage may be made on foot or horseback and, if weather conditions permit and the road is made passable without harming the surroundings or the environment, four-wheel-drive vehicles may be used; the width to be granted shall be three meters. That was the width granted for the route in the operative portion (parte dispositiva). It should be noted that the conditions of the route granted are those actually existing on the land, which is located on properties with irregular and winding topography and slopes of varying degrees (on both properties: the dominant estate (fundo dominante) and the servient estate (fundo sirviente)); accordingly, the three-meter width is the width that was granted in view of the findings from the judicial inspections and the expert report (pericia), which also describes it as having that width.
The judgment is therefore not contradictory in granting that width. If any section of the road is less than three meters wide because of the inherent nature of the road and the topography of that particular area, or because of natural changes occurring after the judgment, it would obviously be impossible to force the path to have a width of three meters merely because the judgment so ordered. Moreover, that is a matter pertaining to the actual enforcement of the judgment and resolution of the dispute. This Court finds no contradiction, nor does it find one regarding the type of four-wheel-drive vehicle that may be used by the plaintiff, since it has already been stated that such a vehicle may be used when weather conditions permit, provided that the road is passable and its use does not cause harm to the surroundings or the environment. Turning to another matter, regarding the safety of the various routes, the assessment made in the judgment concerning this characteristic, identified as “Passability and Hazardousness,” stated that all of them run over ungraveled ground and are passable on foot or horseback.
The judgment clarifies, based on the expert evidence (prueba pericial), that they could be traveled by four-wheel-drive vehicles, but this depends on weather and ground conditions, although vehicle travel entails danger. This applies to all routes. The court below found that, of all the routes, the most dangerous was route number two; the least dangerous was route number one; route four would rank second; and route three would rank third in terms of being less dangerous. Having analyzed the expert evidence, this Chamber confirms that route number one would indeed be the least dangerous because it has already been laid out and physically established. All of them present hazardous conditions along their courses depending on weather conditions. The expert evidence likewise describes all four options analyzed as passable throughout the year for persons, animals, or four-wheel-drive vehicles, although travel by the latter means is extremely difficult during the rainy season; there are also sharp curves, road widths of less than four meters, steep slopes, and mud.
For this Court, the fact that the expert evidence establishes the hazardousness of all routes at various times of the year and for the use of four-wheel-drive vehicles along certain sections, together with the fact that route one has already been physically established, has been used, and is already familiar to those who require it, means that it provides greater safety than a nonexistent route requiring works ancillary to the road surface, such as culverts and drainage ditches, which make it very difficult to foresee the final conditions that would result if a route other than [Dirección17] were selected. The judgment’s decision regarding safety is based on the technical expert evidence contained in the record. This ground of appeal is rejected.
VIII- Another contradiction alleged by the appellant is that [Dirección10] was granted and the judgment found that this would not cause environmental damage, yet it awarded damages, which must be understood as environmental damages even though the judgment does not say so. This Court disagrees with that assertion because, as explained, granting passage along the modified [Dirección7] continues the use of a road that has existed for several decades, thereby demonstrating its safety; furthermore, the judgment’s order to pay compensation for the land, including payment to the appellant, is intended to compensate for the right to use that portion of her property to enter the plaintiff’s own property due to its landlocked status (condición de enclave). It is consistent with the ruling that the resulting losses and damages (daños y perjuicios) must also be paid. Such losses and damages may be of various kinds and would have to be proven at the judgment-enforcement stage (etapa de ejecución de sentencia), if they can be established.
IX- For the reasons stated, pursuant to Articles 1 and 2 of the Ley de Jurisdicción Agraria, sections 395 and 398 of the Civil Code, and sections 199 and 195 of the Code of Civil Procedure, applied supplementarily, the motion to annul (incidente de nulidad) service of the order admitting the appeal from the trial-court judgment shall be denied, and as to the matters appealed, the challenged judgment shall be affirmed.
POR TANTO
The motion to annul service of the order admitting the appeal from the trial-court judgment with suspensive effect is denied. As to the matters appealed, the judgment is affirmed.

RESULTANDO:
7- El Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, en resolución de las catorce horas y dieciséis minutos del treinta y uno de agosto del dos mil doce, ordenó a la parte actora integrar la litis consorcio contra [Nombre8] y [Nombre15] . (fs.325 y 340)
Redacta la jueza Castro García; y,
CONSIDERANDO.
I- Incidente de nulidad de notificación del auto de las 10:10 minutos del 17 de junio del 2015 incoado por Bienes Raíces Brisas del Norte S.A. La parte citada interpone la incidencia ante esta instancia (expediente digital/escritos/fecha 9 de octubre del 2015) señalando que el auto referido no le fue debidamente notificado al medio de facsímil que fijó y se apersonaba ante esta instancia a presentar los alegatos que refutan los agravios contra el fallo de instancia expresados en el recurso de apelación que se conoce por esta sede. Analizado lo actuado, se determina que si bien se corrobora que ese auto que admite en efecto suspensivo ante esta Cámara se notifica a otro medio (listado de notificaciones a folio 603), tal situación no conlleva al dictado de una nulidad procesal, al no haberse causado a ninguna de las partes indefensión o transgresión al derecho de defensa. Lo anterior en aplicación del numeral 199, 194 y 196 del Código Procesal Civil aplicado supletoriamente a esta materia.
El auto erróneamente notificado es el que admite la apelación en el efecto suspensivo contra la sentencia de primera instancia emitida, que fue interpuesto por [Nombre2] ante este Tribunal. No existe una etapa procesal en el proceso agrario en el que deba darse audiencia de los alegatos que las partes exponen contra los recursos que se presentan contra la sentencia de primera instancia, aún y cuando se encuentran en la libertad de aportar los argumentos que estimen necesarios a sus intereses.( artículos 501 y 502 del Código de Trabajo). Por lo que la notificación de ese auto en otro medio de facsímil no causa indefensión alguna y debe ser rechazado el incidente de nulidad de notificación reclamado.
II- Hechos Probados. Se avalan los hechos probados de la sentencia apelada, por estas sustentados en elementos probatorios que constan en autos.
III- Hechos no probados. Se comparten los hechos no probados de la resolución recurrida por no haberse aportado prueba a los autos que reflejen otra realidad fáctica.
IV- Agravios. La sociedad Wilfama S.A. mediante su apoderado especial judicial, interpone recurso de apelación (folio 599 Tomo II) contra la sentencia de primera instancia N. 139-S-2015 de las quince horas del 1 de junio del 2015 (folio 575 Tomo II). Como motivos de disconformidad expone los siguientes: 1) el proceso se interpone por Sueños de La Cruz S.A. con la finalidad de que se concediera salida a calle pública a la finca matrícula [Placa1] que esta en condición de enclave. Se logra determinar que existen dos terrenos que pueden brindar esa salida, el inmueble matrícula [Placa2] de su propiedad y la de [Nombre6] San Sebastián S.A. matrícula [Placa3]. Expone, debe de considerarse con mayor importancia la prueba pericial que se brinda a la persona juzgadora la oportunidad de contar con un criterio amplio y resolver conforme a derecho. No comparte la decisión vertida en la sentencia que debe sustentarse en un análisis lógico de toda la prueba.
Señala, del dictamen pericial se concluye la existencia de cuatro rutas posibles como salida a la finca de la sociedad actora: La numerada uno, pasa por la finca de su representada que atraviesa un bosque virgen, la número dos que transcurre en la finca [Nombre6] propiedad de [Nombre6] San Sebastián S.A., y cruza por un potrero, sin que afecte las zonas boscosas. Las propuestas por el perito judicial, corresponden a la [Dirección5] . Pasa por la finca de la apelante Wilfama S.A. y la número cuatro, ubicada por la finca de [Nombre6] San Sebastián S.A. 2). Expone, se decanta la sentencia por otorgar salida afectando el recurso boscoso que ha destinado a la protección del bosque, la fauna y vegetación. En tal bosque existen manantiales que pasan por esa área en forma descendiente, que se afectan con lo resuelto al otorgar la [Dirección6] . Aduce, es deber de la persona juzgadora velar por la protección del medio ambiente.
En la sentencia se cita que por la [Dirección7] pasan varios cauces (secos en febrero del 2011) y una quebrada. Se citó, que el paso en el 2011 era angosto de máximo tres metros y se reduce a un metro en algunos puntos, posibilitando el paso solamente a caballo. Alega, las condiciones vistas en la primera inspección en el verano del 2011, donde el recurso hídrico no estaba es diverso al observado en la segunda inspección. Se visualizó barro en esa zona y los caballos quedaron varados en el zuampo. Ello denota la condición boscosa y virgen de la ruta. Situación a la que no se le brindó importancia en el fallo apelado. Estima, la más mínima posibilidad de dañar los recursos debieron conducir al rechazo de esa ruta como posible salida. Refuta al respecto, en la pieza apelada se señaló que fue el mismo apelante quien había ampliado el camino, como efectivamente sucedió y era para sacar madera con los respectivos permisos. Pero por las condiciones naturales actuales del bosque se encuentra totalmente virgen otra vez.
V- La inconformidad de la sociedad apelante se centra en su desacuerdo respecto a la ruta elegida en sentencia como conveniente para dar salida suficiente a calle pública a la finca de la actora matrícula [Placa4] de Guanacaste. Al esgrimir que el uso de la ruta identificada como [Dirección10] , perjudicará el entorno natural boscoso, sus elementos y que por esa razón debió haberse rechazado el otorgar ese camino de acceso. Señala en su recurso, acorde con lo arrojado en la prueba pericial, debió haberse concedido el paso por la [Dirección8] que es la más corta, o bien tres o cuatro para tutelar el medio ambiente. Invoca en forma general, la sentencia se aparta del acervo probatorio, y entra en contradicciones. De las cuales cita dos: a) en cuanto al ancho concedido en la [Dirección10] , pues señaló que en sectores no tenía más de un metro y concedió tres metros de ancho. b) Concede la [Dirección7] como salida por no dañar el ambiente, pero obliga a indemnizar a la actora de todo daño y perjuicio que conlleve; siendo lógicamente una referencia al ambiente el perjuicio, aunque no se indicó en forma expresa. Achaca de omisa la sentencia al no aclarar que tipo de vehículo de doble tracción que se autoriza a utilizar en ese camino concedido, siendo que sería posible la utilización de medios de este transporte que produzca daños adicionales.
VI- Se combate que con la declaratoria del derecho de paso por la denominada [Dirección7] se produce un daño ambiental a los elementos existentes en ese ecosistema específico, al reconocerse un camino en medio de un bosque que denomina "virgen". Señalándose además en la pieza que apela, resulta más conveniente a los intereses ambientales otorgar otra de las rutas expuestas en el peritaje, al no causarse con ello daño ambiental alguno. Del análisis de ese agravio y lo resuelto, no se comparte el argumento. Cabe acotarse que en nuestro ordenamiento jurídico no existe una definición de daño ambiental, no obstante a partir del artículo 50 constitucional y su más cercano desarrollo legal, sea la Ley Orgánica del Ambiente en su artículo dos establece que el daño ambiental constituye: "un delito de carácter social, al afectarse las bases de la existencia de la sociedad; económico, porque atenta contra las materias y los recursos indispensables para las actividades productivas; cultural, en tanto pone en peligro la forma de vida de las comunidades, y ético, porque atenta contra la existencia misma de las generaciones presentes y futuras".
En protección del ambiente se ha decretado el bloque normativo tutelar del medio ambiente, alimentado por normas nacionales e internacionales, las cuales rigen las actuaciones humanas que pueden provocar los desequilibrios ecosistémicos que pretenden ser evitados, disminuidos o mitigados. Es decir, que alteren la línea base del ambiente. De los conceptos que se han expuesto del término daño ambiental a nivel doctrinal o jurisprudencial, podría entenderse como los actos u omisiones del ser humano que causan deterioro o contaminación del medio ambiente que le rodea. Mismo que le afecta en forma individual y colectiva como sociedad. La Ley Orgánica del Ambiente prescribe en el artículo 59 que contaminación del ambiente se entiende como: " toda alteración o modificación del ambiente que pueda perjudicar la salud humana, atentar contra los recursos naturales o afectar el ambiente en general de la Nación.
La descarga y la emisión de contaminantes, se ajustará, obligatoriamente, a las regulaciones técnicas que se emitan. El Estado adoptará las medidas que sean necesarias para prevenir o corregir la contaminación ambiental”. Por su parte, dado que lo que se apela es tema de existencia de bosque, la Ley Forestal número 7575 determina en su artículo primero como función estatal: “velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. Además, velará por la generación de empleo y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales …”. Por su parte, como uno de los principios medulares del Derecho Ambiental para la tutela del entorno natural y sus elementos, el principio precautorio resulta aplicable a toda actividad humana.
La Sala Constitucional de la Corte Suprema de Justicia en la sentencia N°1923-2004, explicó al respecto: "XV.- PRINCIPIO PRECAUTORIO DEL DERECHO AMBIENTAL Y PROTECCIÓN DE LAS AGUAS SUBTERRÁNEAS. Uno de los principios rectores del Derecho Ambiental lo constituye el precautorio o de evitación prudente. Este principio se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, la cual literalmente indica “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. En el ordenamiento jurídico interno la Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), en su artículo 11 recoge como parámetros hermenéuticos los siguientes principios: “1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección”.
En el Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999 (reiterado en los Votos Nos. 9773-00 de las 9:44 horas del 3 de noviembre del 2000, 1711-01 de las 16:32 horas del 27 de febrero del 2001 y 6322-03 de las 14:14 horas del 3 de julio del 2003) este Tribunal estimó lo siguiente: “(...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”.
Posteriormente, en el Voto No. 3480-03 de las 14:02 horas del 2 de mayo del 2003, este Tribunal indicó que “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente”. Los conceptos anteriormente citados cobran relevancia dada la apelación del recurrente, cuando invoca que el haber concedido la ruta uno a la sociedad actora conduce a la producción de un daño al recurso forestal y ecosistema asociado existente en su finca al existir bosque en conservación. Analizada la prueba en autos, no comparte este Tribunal su argumento ni que la decisión hubiera sido tomada alejada de la prueba aportada al proceso. En primer lugar nótese que el camino reconocido como ruta de acceso de salida a calle pública, ha sido el utilizado desde hacer varias décadas y ha existido al menos desde el año 1975.
Tal y como se afirmó en la sentencia recurrida. No es una ruta nueva que deba abrirse dentro de un bosque, pues existe y ha sido utilizada por quienes han sido los dueños de las finca que actualmente pertenece a la actora, para poder ingresar a su terreno antiguamente. No existen reproches por la apelante sobre la valoración que se hace en la sentencia sobre la prueba testimonial, por lo que se conforma el recurrente con las conclusiones de cada uno de los testimonios expuestos en el fallo apelado. Tales son compartidos por esta Sede, luego de la revisión integral de esas declaraciones. Los testigos declararon en forma coincidente en que el camino identificado como la [Dirección7] en la prueba pericial y en la sentencia apelada, es el que siempre se mantuvo en uso y ha existido desde hace varias décadas. El testigo [Nombre18] conocido como [Nombre19] (folio 115 y folio 464) manifestó en lo que interesa en sus dos declaraciones, por muchos años el camino se utilizó por finqueros sin problema alguno.
Señaló, haber sido dueño por 20 o 25 años en tiempos pasados del terreno de la finca actualmente de la actora y saber nunca medió problema por el uso de esa ruta de acceso hasta el año 2009. Por su parte, [Nombre20] (folio 467), describió que conoce el fundo y el camino desde hace 40 años, su padre [Nombre13] había sido dueño del fundo de la actora que se le conoce como "[Nombre21]" y como ruta de acceso desde calle pública se utilizaba la finca que actualmente identifica como de [Nombre2] por el camino existente. Señaló vendió su papá a [Nombre19] , cuando tenía el testigo 14 años de edad. El testigo [Nombre22] , depuso haber trabajado para [Nombre2] en 1990 y afirmó el acceso que existe podía ser utilizado por los vecinos sin impedimento alguno. Haciendo alusión a [Nombre23] y [Nombre13], ambos de apellido [Nombre13] que eran los dueños anterior del fundo enclavado. Todos estos testigos rinden declaración de forma coincidente esa vía que ya existe como ruta de acceso a la finca de la actora, es la que siempre los anteriores dueños habían utilizado, como ruta de acceso a la finca que pertenece actualmente a la sociedad accionante.
En igual sentido declara [Nombre24] (folio 470), cuando manifiesta esa es la ruta de ingreso de siempre a las fincas que quedan adentro, que [Nombre25] daba permiso de paso. Con tales deposiciones es posible concluir con claridad la ruta uno ha existido como vía de acceso a calle pública de la finca matrícula [Placa4] de Guanacaste por su actual dueña y los anteriores hace ya varias décadas. En los reconocimientos judiciales del 23 de julio del 2011 (folio 48 a 49), 11 de febrero del 2011 (folio 104 a 109) y 8 de abril del 2013 (folio 425 y 426) se deja constancia que esa senda existe y esta rodeada por vegetación boscosa en su recorrido, según se detalla en las diversas actas que así lo refieren. Ello se observa también en el croquis de folio 548 denominado Plano Cobertura Boscosa sobre Rutas (folio 548) y la descripción de folio 555 que indica que la ruta transita en zona de bosque y corresponde a: " un camino de uso de transito, trabajo y recreación ( turismo rural) con anchos promedio de 3 a 4 metros en sus primero 890 metros y los últimos 15 metros del recorrido a un camino de dos metros en promedio.
La totalidad de la superficie de tierra. (convertido en barro debido a la temporada lluviosa.. , de trazo horizontal y vertical sinuoso, debido a su topografía en algunos sectores....". Dada su existencia y uso desde el pasado como ruta de acceso, no resulta de recibo el reproche de que otorgar esta ruta causa un daño al ambiente, pues no es un elemento nuevo en ese entorno que perjudicara la vegetación boscosa, la fauna o el recurso hídrico. Tal punto se confirma en el hecho que la misma [Nombre17] S.A. que se opone al reconocimiento de la [Dirección7] por producir daños ambientales, procedió a ampliar esta ruta y modificarla en parte, para poder extraer madera de su terreno, todo, según lo afirmó, con los respectivos permisos del Ministerio de Ambiente y Energía para extraer algunos árboles de su terreno boscoso. Tales hechos cambiaron las condiciones originales de la [Dirección11] , pues en esa acta se consignó ( folio 425) :" ...
Se aprecia durante este trayecto que efectivamente se ha ampliado y modificado el camino lo necesario para la realización de una trocha, la cual indica la parte demandada es utilizada para sacar madera, igualmente manifiesta dicha accionada que cuenta con los permisos correspondientes , que otorga [Nombre26] para dicha anchura del camino y que su intención es la regeneración natural en dicho trayecto... ". Es así, que los daños al ambiente invocados en la apelación no existen por esa causa. Pues es la ruta existente muchos años antes. Como se observa, el recurso forestal es susceptible de ser aprovechado por la sociedad y ello se permite mediante la regulación y control legal a través de la expedición de los respectivos permisos por los entes competentes definidos por Ley. En nuestro sistema legal, esa actividad del recurso boscoso es regido mediante la Ley Forestal N. 7575 y su reglamento.
Cabe citar la doctrina nacional ambiental nacional respecto al marco jurídico de legislación forestal, que expone los límites y limitaciones al derecho de propiedad de fundos con cobertura boscosa. Se indica al respecto, dado el carácter privado de las fincas inscritas, se entra en el régimen de propiedad forestal privada, como forma de propiedad sujeta a múltiples límites de interés público ambiental, restringiéndose la facultades de las personas dueñas de esos inmuebles. (Cabrera M. Jorge. Manual de Legislación Ambiental Costarricense. 2002. pag 159). Se señala por ese autor : " La Ley Forestal No 7575.. establece en su artículo 1 como función esencial y prioritaria del Estado velar por la conservación, protección y administración de los bosques naturales, y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recurso naturales renovables.
Además velará por por la generación de empleo, y el incremento del nivel de vida de la población rural, mediante su efectiva incorporación a las actividades silviculturales. " (Op.cit. pág. 153). En este caso concreto, tal y como se razona en el fallo apelado, el cierre del camino ([Dirección12] ) existente por parte de los personeros de la sociedad demandada a la actora para el ingreso a su finca, no ocurre por razones de abuso en el uso de tal o daños a los recursos naturales existentes en el entorno de ese acceso. Sino por disgusto de los apoderados de la finca de Wilfma S.A. por haberse enterado de la confección de un plano que dibujaba una servidumbre a favor de la finca de la actora con un ancho de cinco metros. Así fue aceptado en la prueba confesional en la respuesta a la pregunta décima, que fue contraria a sus intereses, que reza: " Que en el año dos mil diez es cuando usted cierra el paso y le impide el mismo a la parte actora, dejando ese fundo incomunicado a calle pública?: a la que respondió: "Si yo lo cerré, porque cuando midieron su finca pusieron en su plano, que tenía cinco metros de ancho, tanto en la entrada como el ( sic) salida."( folio 462).
Por lo que no se vislumbra que la continuación en el uso de un camino ya existente y destinado desde años antes a dar acceso a la finca actualmente propiedad de la actora, sea causa generadora de un daño ambiental actual o anterior. Ese uso no riñe con la protección del ambiente, siempre y cuando sea el de transitar de forma adecuada y en respeto absoluto del derecho conferido, sin poder abusarse en el ejercicio de la facultad y condiciones de paso concedido. No se otorga esa ruta, por haberse ejercido un uso de la misma en el pasado, pues acorde con el ordinal 379 del Código Civil, en servidumbres discontinuas como la que es objeto de estudio, no opera la prescripción positiva. Sino que medió la ponderación de diversos elementos en su concesión, y principalmente el de seguridad. Para ello se consideraron elementos de importancia del dictámen pericial topográfico y lo observado por las personas juzgadoras.
Por esa zona de camino se deberá pagar la indemnización ordenada la actora a favor de la demandada, a ser definida en la etapa de ejecución de sentencia. Resulta lógico que todas las obras que sean necesarias realizar, deben ajustarse a las normas legales ambientales regulatorias aplicables. Debiendo en el caso particular, ser solicitados los permisos correspondientes, si así lo exige la Ley. Tal y como en su oportunidad lo hicieron los apoderados de Wilfama S.A, cuando debieron pedir permisos para extraer árboles de su terreno, ampliar la trocha y aún modificar temporalmente un cauce de quebrada, según se describe en el acta del folio 425 citada para lograr aprovechar la madera extraída, todo con los respectivos permisos del Ministerio de Ambiente y Energía. Para esta Cámara, bajo las condiciones de la preexistencia que demuestran la seguridad de la ruta y uso por muchos años de ese camino dentro de una zona con cobertura forestal, no se causa daño alguno.
Pues no se ha demostrado se haya ocasionado o existe riesgo previsible solo por esa circunstancia. De hecho, la existencia de caminos dentro de zonas cubiertas por bosques, constituyen una de las actividades permitidas por el artículo 19 de la Ley Forestal N. 7575 en aras del uso sostenible del recurso. Tal norma cita, se permite construir casas de habitación, oficinas, establos, corrales, viveros, caminos, puentes e instalaciones destinadas a la recreación, el ecoturismo y otras mejoras análogas en terrenos y fincas de dominio privado donde se localicen los bosques. Esa misma norma señala la necesidad de llenar requisitos legales técnicos ante el ente competente para el desarrollo de esas y otras actividades en bosques ubicados en fincas de particulares de naturaleza forestal. Lo que se prohíbe en forma absoluta es el cambio de uso de suelo, fuertemente sancionado por Ley. Respecto a que otras rutas no producirían daño ambiental alguno, no lleva razón pues la ruta dos (no existente) que es la propuesta por la parte demandada apelante, es descrita en el informe pericial (folio 556) como que iniciaría en zona boscosa y pasaría por un cauce de ojo de agua e inicia a partir de ese punto un ascenso fuerte progresivo.
Por otra parte, la [Dirección13] (inexistentes ) requerirían la ejecución de obras, desde el punto de partida y tienen problemas de seguridad importantes para el tránsito seguro de personas y animales. Nótese que sobre la tercera y cuarta ruta, se presentan en la descripción pericial aspectos referidos a la necesaria demarcación y construcción formal, al no existir infraestructura actual pero que presentaría dificultades de acceso en épocas lluviosas dadas las características de sus fuertes pendientes y materiales presentes en la zona (lodos). En la sentencia apelada se analizan profundamente las condiciones de cada una de las rutas y se pondera la mejor opción, no siendo LA LONGITUD un criterio determinante por sí solo, sino uno más que deben confrontarse con otros como seguridad en el recorrido, condiciones actuales, topografía, el que cauce menores perjuicios al fundo sirviente y beneficie al dominante.
(artículo 373 y 377 del Código Civil). Por ello, no es posible dar razón al recurrente, donde indica que la ruta más corta es la que debe reconocerse como salida, pues los demás factores pesan de igual forma en la decisión. La ruta de menor distancia es la [Dirección14] , pero tiene el inconveniente citado de no existir, ubicarse en zona boscosa al inicio y tener una naciente en su recorrido. Además de señalarse en la prueba pericial que en algunos tramos de la ruta se presenta peligro inminente para el tránsito de vehículos debido a pendientes mayores o iguales al 30%, (folio 557). A la pericia rendida no se le hicieron observaciones por las partes cuando el juzgado de instancia la puso en conocimiento, conformándose con su contenido en cuanto a las condiciones descritas de cada una de las rutas que allí se consideraron, (resolución a folio 561). Por lo anteriormente expuesto, se rechazan los agravios de la recurrente en cuanto el tema de la generación de daño ambiental con el reconocimiento de la obligación de paso por la denominada [Dirección7] en los términos reconocidos en la sentencia apelada.
Tampoco se denota que las conclusiones de esa decisión hayan surgido sin estar debidamente fundado y explicado en cuanto a las razones de hecho y derecho y en apego a las reglas de sistema de valoración probatoria del artículo 54 de la Ley de Jurisdicción Agraria.
VII- Por otra parte, se recurre el fallo citando que hay contradicción en cuanto al ancho de la ruta reconocida como salida a calle pública a la finca de la actora, pues se autorizó un ancho de tres metros y existen tramos que no superan los dos metros, según lo señaló la a quo se observó en los reconocimientos judiciales y se consignó en los fallos. Se rechaza ese argumento, el fallo debe ser interpretado conforme la realidad en la cual se ha de ejecutar y surtir efectos. En el considerando vigésimo, cuando se describe la ruta uno se indica respecto al ancho de ese camino que: " la [Dirección15] uno por las condiciones por las que transcurre, no puede ensancharse más de dos metros.. Por ende , aún cuando se utilizace el trayecto modificado de la [Dirección16] , no podría tener un ancho mayor a los cinco metros, y en algunos sectores apenas de dos metros (sin lastre)." En el considerando vigésimo segundo al analizar el ancho a otorgar, señaló con fundamento en el artículo 398 del Código Civil que se permite un mínimo de dos metros y máximo de seis.
Razonando que la ruta uno tiene sectores de difícil tránsito que no permitirían más de tres metros de ancho y que su titular aceptó que cuando permitió el paso lo era de tres metros. Aunado a la ampliación que hizo para la extracción de los árboles que aprovechó con los permisos respectivos. Más adelante sigue explicando la sentencia al respecto, se toma en consideración que al ubicarse ese camino por un terreno boscoso, el paso puede hacerse a pie y a caballo y en caso de permitirse por condiciones climatológicas y se habilite el camino sin dañar el entorno ni el ambiente, puede utilizarse vehículos de doble tracción , el ancho a conceder será de tres metros. Ese ancho fue el otorgado en la parte dispositiva en la ruta. Cabe señalar, que las condiciones de la ruta concedida son las que existen en la materialidad del terreno, que se ubica en fincas de topografía irregular y sinuosa con pendientes variables de diverso grado (en ambas fincas: dominante y sirviente), por lo que el ancho de tres metros es el que se ha concedido visto lo analizado en los reconocimientos judiciales o lo visto en la pericia que la describe de ese ancho también.
Por lo que no resulta contradictorio el fallo, cuando se concede ese ancho. Si en algún tramo del camino se tiene un ancho menor de tres metros dada la naturaleza propia del camino y la topografía de esa zona particular, o bien por modificaciones de la naturaleza posteriores a la sentencia, resulta obvio que sería imposible forzar la senda a tener el ancho de tres metros, solamente porque la sentencia así lo dispuso. Además ello es un tema propio de la ejecución del fallo en la realidad y la solución del conflicto. No encuentra contradicción esta Sede, como tampoco respecto al tipo de vehículo de doble tracción que se pueda utilizar por la parte actora, pues ya se señaló que es aquel que por condiciones climatológicas permita, si el camino esta habilitado, sin que genere daños al entorno o el ambiente. En otro orden, sobre la seguridad de las diversas rutas, de la ponderación realizada en el fallo sobre esta particularidad denominada " Transitabilidad y Peligrosidad" se señaló que todas transcurren por el suelo sin lastre, y transitables a pie o a caballo.
Aclarándose por la prueba pericial, indica la sentencia, que podrían ser recorridas en vehículos de doble tracción, pero eso depende de las condiciones climáticas y del suelo, aunque existe peligro para que los vehículos transiten. Eso en todas las rutas. La a quo estimó que de todas las rutas, la más peligrosa era la numero dos, la menos peligrosa la numerada uno, la cuatro sería la de segundo lugar y la tercera ocuparía el tercer lugar en menos peligrosidad. Analizada la prueba pericial por esta Cámara, se verifica que efectivamente la menos peligrosa sería la ruta número uno, por estar ya trazada y materializada. Todas tienen condiciones de peligro en su recorrido acorde con las condiciones climatológicas, al igual que describe que son las cuatro opciones analizadas transitables todo el año para personas, animales o vehículos de doble tracción pero con dificultad extrema éste ultimo medio en época lluviosa, además de haber curvas estrechas y anchos de caminos de menos de cuatro metros, bien sean pendientes de gran inclinación y presencia de lodos.
Para este Tribunal, el hecho de que la prueba pericial manifiesta la peligrosidad de todas las rutas en diversas épocas del año y en el uso de vehículos de doble tracción en algunos tramos, y que la ruta uno este ya materializada, haya sido utilizada y sea ya conocida por quienes la requieren, conduce a que la seguridad sea mayor que una ruta no existente, que requiere obras complementarias a la superficie de calle como alcantarrillas y caños, que hacen muy difícil preveer las condiciones finales en que quedaría si se optara por alguna diversa al [Dirección17] . La decisión de la sentencia en cuanto a la seguridad esta fundada en la prueba técnica pericial que consta en autos. Se rechaza el agravio.
VIII- Otra de las contradicciones apuntadas por el recurrente es que se otorgara la [Dirección10] , se estime en el fallo con ello no se causa daños al ambiente, pero se conceden perjuicios que deben ser entendidos como los perjuicios de naturaleza ambiental, aunque la sentencia no lo diga. No se esta de acuerdo en esta Sede con esa afirmación, pues como se expuso, al otorgarse el paso por la [Dirección7] modificada se da una continuación del uso de un camino con varias décadas de existencia que prueba su seguridad y la orden de la sentencia de pagar la indemnización del terreno que incluye ese pago a la recurrente, es por concepto de cancelación del derecho al uso de esa parte de su finca para ingresar a la suya, dada la condición de enclave. Resulta consecuente con lo resuelto que sean cancelados además los daños y perjuicios que eso conlleva. Mismos que pueden ser de diversa naturaleza y que deberían ser probados en la etapa de ejecución de sentencia, si se llegaran a demostrar.
IX- Por los motivos expuestos, con fundamento en los artículos 1 y 2 de la Ley de Jurisdicción Agraria, numerales 395 y 398 del Código Civil, 199 y 195 del Código Procesal Civil aplicado supletoriamente, se rechazará el incidente de nulidad de notificación de auto que admite la apelación de la sentencia de primera instancia y en lo apelado, deberá confirmarse la sentencia recurrida.
POR TANTO
Se rechaza el incidente de nulidad notificación del auto que admite en efecto suspensivo de la sentencia de primera instancia. En lo apelado, se confirma la sentencia.
