This Court, acting as the non-hierarchical appellate authority (jerarca impropio), hears the appeal (recurso de apelación) filed by Nombre105145, identity card No. CED81752, against the decision issued by the Vice Mayor of Alajuela at 14:15 hours on 18 de setiembre del 2015.

WHEREAS:

I. PROVEN FACTS

The following are deemed proven facts relevant and necessary to decide this case:

  • 1)On 17 de enero del 2013, the Fiscal and Urban Control Department of the Municipalidad de Alajuela served Mrs. Nombre105146 with Completed Construction Without a Permit Report No. 011-2013, concerning the approximately 30 m2 expansion of a medical office using purlin, sheet-metal, and ceramic construction on the property registered under real-property folio Placa18445, lot No. Dirección12440, in Coyol. The work lacked the respective building permits (permisos constructivos), and she was therefore granted a period of 30 days to submit the building permit for the work (folio 16).
  • 2)In the absence of the respective permit, the Municipality ordered the commencement of an ordinary administrative proceeding (procedimiento administrativo ordinario) by decision issued at 15:20 hours on 27 de abril del 2015 (folios 25 to 28).
  • 3)In the Initial Decision Commencing the Proceeding, Mrs. Nombre105146 was summoned to a private oral hearing (audiencia oral y privada) to be held on 01 de julio del 2016 (folios 31 to 35).
  • 4)On 9 de junio del 2015, Mrs. Nombre105146 informed the Presiding Body of the Proceeding (Órgano Director del Procedimiento) that she had applied for the building permit through application No. 0011255-2015 and had fulfilled all applicable requirements; she therefore requested that the summons to the private oral hearing be vacated (folio 36).
  • 5)In a filing dated 24 de junio del 2015, Mrs. Nombre105146 requested a continuance of the scheduled hearing (folio 38).
  • 6)The Presiding Body held the appearance hearing (comparecencia) on 24 de junio del 2015, which Mrs. Nombre105146 did not attend (folios 40 and 41).
  • 7)In a decision dated 9 de julio del 2015, the Presiding Body denied the request for a continuance because the hearing had already taken place and, at the same time, informed her that she should submit whatever was decided regarding the building permit to “the corresponding office, in order to determine the appropriate legal action” (folios 42 and 43).
  • 8)In official letter No. Identificacion159 dated 31 de julio del 2015, the Construction Control Unit of the Municipalidad de Alajuela informed Mrs. Nombre105146 that, before ruling on her building permit, she “MUST BRING THE UNPERMITTED CONSTRUCTION INTO LEGAL COMPLIANCE, BASED ON THE FINES ENTERED INTO THE MUNICIPAL SYSTEM BY THE FISCAL AND URBAN CONTROL DEPARTMENT, WHICH PERTAIN TO PROPERTY 229681-000. A STATEMENT OF THE FINES IS ATTACHED.” SEQUENTIAL NUMBER PERCENTAGE DATE 062 50% NOT INDICATED 765 100% 13-3-2013 (folio 69).
  • 9)In a decision issued at 14:15 hours on 18 de setiembre del 2015, the Office of the Vice Mayor of Alajuela granted the interested party 15 days to demolish the unlawfully constructed work at her own expense and provided that, in the event of noncompliance, the Municipality would proceed immediately with the demolition (folio 57).

II. GROUNDS FOR APPEAL

In her appellate brief, the appellant argues that the Municipality has ignored all her efforts to bring the status of her construction into legal compliance and that the manner in which the matter was decided left her completely without an opportunity to defend herself. She states that the permit was not granted because two outstanding fines appeared in the computer system, as reflected in official letter MA-ACC-07155-2015, which states only that the fines bear sequential numbers 062 and 765 and are for 50% and 100%. She was never notified of those fines and does not know the amount of either one. Although she contacted the Information Technology, Construction Control, and Fiscal Control Departments, none determined the amount of the fines, and they informed her that they could not provide it. Under these circumstances, it is impossible for her to pay those fines, which she considers a failure to protect the citizen. She requests that the fines be annulled because she was never notified of them and is not being allowed to pay them or, alternatively, that an order be issued requiring the fines to be quantified so that she may cure the deficiency and be granted a new plan for obtaining the building permit, as well as a new oral hearing.

III. MERITS

The right to build (ius aedificandi) on real property is one of the attributes of the right of ownership, the exercise of which is subject to public-policy limitations established in Costa Rica’s urban-planning and environmental regulations, pursuant to Article 45 of the Constitution. Those limitations include the duty to obtain a building permit, as regulated by Articles 74 and 79 of the Ley de Construcciones and Article 70 of the Ley de Planificación Urbana. Such permits are granted by municipalities after verifying that the building complies with the applicable urban-planning regulations; this entails prior authorization or a “permit,” accompanied by oversight of the performance of the authorized activity to ensure that it is carried out in accordance with the permit granted. Through the exercise of their police powers (poderes de policía), the Municipalities must and may verify that persons subject to their jurisdiction within their territorial boundaries have obtained all required building permits, in compliance with Article 74 of the Ley de Construcciones.

IV.In the event of noncompliance with the obligation to obtain a building permit beforehand, local-government authorities cannot and must not evade their duty to address the matter promptly and effectively. Beginning with Article 93 of the Ley de Construcciones, a procedure is established under which local governments grant a period of time to persons who erect buildings without the respective permit so that they may cure the violation, which is accomplished by submitting the plans together with the other mandatory requirements and paying the tax along with the applicable fine. The purpose of the provision is to give the person an opportunity to regularize the situation, thereby bringing the property into legal compliance and safeguarding it. The Law provides for up to two formal notices (emplazamientos) to the person from the local government, so that the person may rectify the situation. Only where the irregularity remains unresolved—whether because the person neglects to respond to the local government’s directive or because, despite attempts to correct it, the construction cannot be regularized due to a legal impediment, resulting in the definitive denial of the building permit—may the Municipality issue a demolition order (orden de demolición) for the constructed work.

An administrative act (acto administrativo) of this kind undoubtedly has a major impact because it causes direct harm to the property; it must therefore result from the proper and reasonable exercise of the governmental and police powers granted by law to the local government, since it is the most severe penalty, as the constructed asset ceases to exist. It must never be forgotten that the limitations on the “ius aedificandi” constitute genuine legal impediments that restrict its free exercise and that, in practice, they must be interpreted in favor of the human being (pro homine) and the fundamental right (pro libertatis). In other words, in situations such as the one under review in this case, the legal system must be understood to provide an opportunity for the person to regularize the situation, so that, to the extent the constructed asset can be preserved where legislation allows, it must be preserved.

Accordingly, if the procedure under the Ley de Construcciones culminates in a demolition order, it is because a determination has been made that there is no legal possibility of preserving the work. As stated, that conclusion may be reached only if the person persists in disobeying the duty to regularize the construction or if the erected building was subject to legal restrictions that preclude its existence.

V.The foregoing considerations are necessary because, in the present case, the Municipalidad de Alajuela took steps to have Ms. Nombre105146 regularize the 30m2 expansion of her office, granting her a single hearing—even though the Ley de Construcciones provides for two hearings—and subsequently initiated an ordinary administrative proceeding (procedimiento administrativo ordinario) against her. During the course of that summary proceeding (sumaria), Ms. Nombre105146 made efforts to rectify her situation and duly notified the Adjudicatory Body (Órgano Director). From that moment onward, those responsible for conducting the proceeding were required to wait until the building permit application (gestión de la licencia constructiva) had been decided; however, the attorneys comprising that collegiate body disregarded the information provided by the interested party, did not allow an opportunity for the permit application to be decided, and held the hearing in her absence on 24 de junio del 2015—even though she had been summoned for 1 de julio del 2015.

Subsequently, on 9 de julio del 2015, they denied the request for an extension submitted by Ms. Nombre105146. At the same time, through official letter No. Identificacion160- 2015 dated 31 de julio del 2015, the Actividad de Control Constructivo of the Municipalidad de Alajuela informed Ms. Nombre105146 that, before her building permit (licencia constructiva) could be decided, she had to pay the fines specified therein, without providing further details, amounts, or their basis. It should be noted that the permit had not yet been denied, as it remained subject to a condition that, because of the lack of information, was impossible for the interested party to fulfill—not because of her negligence, but because of a defect attributable to the local authorities, which failed to communicate the details of the two fines. The appellant’s grievance is entirely well-founded, since it was unquestionably the local authorities that left her utterly defenseless.

The final decision of the Vice Mayor’s Office, which is being challenged before this Chamber, ordered the demolition of the works, disregarding the municipality’s internal actions and even though the building permit had not yet been definitively denied. The grievances raised by Ms. Nombre105146 are well-founded because the actions taken violate the purpose of the Law, are arbitrary, and are contrary to the purpose of the rules governing the right to build; accordingly, the appellant must indeed be given an opportunity to complete the processing of her building permit, including payment of her taxes and fines, with detailed information being provided regarding their basis, calculation, and exact amount. A demolition order could potentially be issued only if the permit is definitively denied. Under these circumstances, it is clear that the local government’s actions were premature and are affected by serious defects giving rise to absolute nullity (nulidad absoluta); therefore, they must be annulled.

It is important to reiterate that both processes—namely, the one heard by the Adjudicatory Body and the one handled by the Actividad de Control Constructivo for the issuance of the building permit—form part of a single matter, and the Adjudicatory Body therefore erred in separating one from the other, since doing so departed from the procedure established in the Ley de Construcciones and prevented the interested party from legitimately exercising her right to regularize the works. The interested party must be granted a reasonable, sufficient, and necessary period for this situation to be resolved correctly and orderly, until it is concluded as required by law. Accordingly, the grievances raised are well-founded, since the proceeding contains defects that must be remedied; consequently, all actions taken from the oral and private hearing held on 24 de junio del 2014, including that act, through the Alcaldía’s final decision issued at 14:15 hours on 18 de setiembre del 2015 are affected by defects of nullity, and the proceedings must be remanded to that stage so that the procedure may be rectified in accordance with this decision.

The matter must be returned to the Municipalidad de Alajuela, where Ms. Nombre105146 must be clearly informed of everything concerning the two fines. Depending on what occurs thereafter—whether or not she pays within the period required by the Municipalidad—a determination may then be made as to whether the permit will be granted, after which the aforementioned administrative proceeding must be decided.

VI.The claims submitted to this Chamber seeking the annulment of the fines notified to the appellant through official letter No. Identificacion159 cannot be considered, because they could only have been reviewed through a challenge duly filed against those sanctions within the prescribed time and in the prescribed manner.

POR TANTO

The appeal filed is granted; accordingly, all actions taken from the oral and private hearing held on 24 de junio del 2014, including that act, through the Alcaldía’s final decision issued at 14:15 hours on 18 de setiembre del 2015, within the ordinary administrative proceeding brought against Ms. Nombre105146, are annulled, and the proceedings must be remanded to that stage so that the procedure may be rectified as indicated in this decision.

Apelación en jerarquía impropia municipal Nombre105145 c/ Municipalidad de Alajuela N° 294-2016 TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN TERCERA. II CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las ocho horas veinte minutos del veintitrés de junio del dos mil dieciséis.

Conoce este Tribunal, como jerarca impropio, de recurso de apelación interpuesto por Nombre105145 , cédula de identidad No. CED81752, contra la resolución del Vice Alcalde de Alajuela, de las 14:15 horas del 18 de setiembre del 2015.

Redacta la jueza Solano Ulloa;

CONSIDERANDO:

I. HECHOS PROBADOS

Se tiene como hechos probados, útiles y necesarios para resolver la presente causa, los siguientes:

  • 1)El 17 de enero del 2013, el Proceso de Control Fiscal y Urbano de la Municipalidad de Alajuela notificó a la señora Nombre105146 , el acta de Información de Obra Concluida sin Licencia No. 011-2013, por la ampliación de un consultorio médico con un aproximado de 30 m2, en estructura de perlin, zinc y cerámica, sobre la finca con matrícula de folio real Placa18445, lote No. Dirección12440 , en el Coyol. La obra estaba carente de los respectivos permisos constructivos, por lo que en el acto se le fijó un plazo de 30 días para que presentara el permiso de construcción de las obras (folio 16).
  • 2)Ante la ausencia de la respectiva licencia, la Municipalidad ordenó el inició un procedimiento administrativo ordinario mediante resolución del 15:20 horas del 27 de abril del 2015 (folios 25 a 28).
  • 3)En Resolución Inicial del Procedimiento se convocó a la señora Nombre105146 a una audiencia oral y privada a realizarse el 01 de julio del 2016 (folios 31 a 35).
  • 4)El 9 de junio del 2015, la señora Nombre105146 comunicó al Órgano Director del Procedimiento que había procedido a solicitar el permiso constructivo mediante trámite No. 0011255-2015, cumpliendo con todos los requisitos para tal efecto, por lo que solicitó dejar sin efecto la convocatoria de la audiencia oral y privada (folio 36).
  • 5)En memorial de fecha 24 de junio del 2015, la señora Nombre105146 solicitó una prórroga de la audiencia convocada (folio 38).
  • 6)El Órgano Director realizó la comparencia el 24 de junio del 2015, acto al que no asistió la señora Nombre105146 (folio 40 y 41).
  • 7)En resolución del 9 de julio del 2015, el Órgano Director rechazó la solicitud de prórroga en el tanto la audiencia ya se había realizado, y a la vez le comunicó que lo que se resolviera respecto de la licencia constructiva lo presentara ante "la dependencia correspondiente, a fin de determinar lo que en derecho corresponda" (folios 42 y 43).
  • 8)En oficio No. Identificacion159 del 31 de julio del 2015, la Actividad de Control Constructivo de la Municipalidad de Alajuela le comunicó a la señora Nombre105146 que, previo a resolver su licencia constructiva, "DEBE PONERSE A DERECHO CON LAS CONSTRUCCIONES QUE SE ENCUENTRAN SIN PERMISO, LO ANTERIOR CON BASE EN LAS MULTAS INCLUIDAS POR EL PROCESO DE CONTROL FISCAL Y URBANO DENTRO DEL SISTEMA MUNICIPAL, LOS CUALES CORRESPONDEN A LA FINCA 229681-000. SE ADJUNTA ESTADO DE LAS MULTAS." CONSECUTIVO PORCENTAJE FECHA 062 50% NO INDICA 765 100% 13-3-2013 (folio 69).
  • 9)En resolución de las 14:15 horas del 18 de setiembre del 2015, la Vice Alcaldía Municipal de Alajuela dispuso conferir a la interesada 15 días para que procediera por su cuenta a la demolición de lo construido de manera irregular y, en caso de incumplimiento, la municipalidad procedería al efecto de forma inmediata (folio 57).

II. AGRAVIOS DEL RECURSO

En su escrito de apelación, argumenta la parte recurrente que la Municipalidad ha ignorado todas sus gestiones para poner a derecho a situación de su construcción, y con la manera en que se resolvió se le ha dejado en total indefensión. Indica que la licencia no se le otorgó debido a que en el sistema de cómputo aparecieron dos multas pendientes que aparecen en el oficio MA-ACC-07155-2015, en el que se indica únicamente que las multas tienen los consecutivos 062 y 765, por 50% y 100%, las cuales nunca le fueron notificadas, desconoce el monto de cada una, a pesar de que acudió a los Departamento de Informática, Control Constructivo y Control Fiscal, ninguno le resolvió el monto de la multa y le informan que no pueden dárselo. En estas condiciones le resulta imposible cumplir con el pago de esas multas, lo cual considera es una desprotección al ciudadano. Pide se anulen esas multas en el tanto nunca fue notificada ni permiten su cancelación, o en su lugar, se gire orden para que sean cuantificadas para poder subsanar el requisito y se le otorgue un nuevo plano para la obtención del permiso constructivo, así como una nueva audiencia oral.

III. SOBRE EL FONDO

E l derecho a edificar sobre la propiedad inmobiliaria es uno de los atributos del derecho de propiedad cuyo ejercicio encuentra limitaciones de orden público que se desarrollan en la regulación urbanística y ambiental de nuestro país, conforme lo dispone el artículo 45 constitucional. Dentro de esas limitaciones, se contempla precisamente ese deber de obtención de la licencia constructiva que está regulado en los artículos 74 y 79 de la Ley de Construcciones, y 70 de la Ley de Planificación Urbana, la cual es otorgada por las municipalidades una vez que se verifica que la edificación resulte conforme con la ordenación urbanística aplicable; ello supone un control previo de habilitación o "permiso", acompañado de la fiscalización en la ejecución de la actividad autorizada, a fin de que se realice conforme a la licencia o permiso concedido. Mediante el ejercicio de los poderes de policía, las Municipalidades deben y pueden proceder a verificar el cumplimiento, por parte de los administrados de su circunscripción territorial, de la obtención de todas las licencias constructivas, en acatamiento de lo dispuesto en el artículo 74 de la Ley de Construcciones.

IV.En caso de incumplimiento de la obligación de obtener previamente la licencia constructiva, las autoridades del gobierno local no pueden ni deben evadir su atención oportuna y efectiva. A partir de numeral 93 de la Ley de Construcciones, se prevé un procedimiento a efecto de que las corporaciones locales otorguen plazo a los administrados que levantan sus edificaciones sin la respectiva licencia, tendiente a que se pongan a subsanar el vicio, lo cual se consigue presentando los planos con los demás requisitos de rigor y honrando el impuesto junto con la respectiva multa. La finalidad de la norma es dar oportunidad al administrado para que regularice la situación, con lo cual se pone a derecho y resguarda su propiedad. La Ley prevé hasta dos emplazamientos al administrado por parte del gobierno local, con el objetivo de que enderece su situación. Únicamente ante el supuesto de que no haya solución de la irregularidad, ya sea por desidia del administrado que no atiende el llamado de la corporación local, o bien, porque aún tratando de corregir, no existe posibilidad de regularizar la construcción por impedimento legal -lo cual lleva a denegar definitivamente el permiso constructivo-, es que la municipalidad puede disponer la imposición de la orden de demolición sobre lo construido.

Un acto administrativo en tal sentido, sin duda es de gran impacto pues genera daños directos sobre la propiedad, por lo que debe ser consecuencia del debido y razonable ejercicio de los poderes de imperio y de policía otorgados por la ley al gobierno local, pues es la pena más gravosa al desaparecer el bien construido. Nunca debe perderse la perspectiva que el "ius aedificandi" encuentra en sus limitaciones, verdaderos impedimentos legales que inhiben su libre ejercicio, las cuales, en la vida práctica, se deben interpretar a favor del ser humano (pro homine) y del derecho fundamental (pro libertatis). En otras palabras, en situaciones como la que se revisa en esta causa, debe entenderse que el ordenamiento da chance para que el administrado regularice su situación, de modo que en la medida en que pueda rescatarse el bien construido, si la legislación lo permite, debe hacerse. Así pues, si el procedimiento de la Ley de Construcciones culmina con la orden de demolición, es porque se ha concluido que no existe posibilidad legal de salvar la obra.

Como se indicó, a ello se arriba únicamente si el administrado persiste en su desobediencia en el cumplimiento de su deber de regularizar la construcción, o bien, porque la edificación levantada padecía de restricciones legales que imposibilitan su existencia.

V.Las consideraciones anteriores son necesarias pues en la presente causa, la Municipalidad de Alajuela realizó diligencias a efecto de que la señora Nombre105146 regularizara la ampliación de su consultorio en 30m2 de más, de modo que confirió una única audiencia -a pesar de que la Ley de Construcciones dispone de dos audiencias- y luego inició un procedimiento administrativo ordinario en su contra. Durante el transcurso de esa sumaria, la señora Nombre105146 realizó esfuerzos por enderezar su situación, de lo cual dio el debido aviso al Órgano Director. A partir de ese momento quienes tenían a cargo el curso del procedimiento, tenían la obligación de esperar a que se resolviera la gestión de la licencia; empero, los abogados que integraban dicho cuerpo colegiado hicieron caso omiso de las información suministrada por la administrada, no dieron oportunidad de que se resolviera la solicitud de la licencia y realizaron la comparencia en ausencia de la interesada el 24 de junio del 2015 -a pesar de que había sido convocada para el 1 de julio del 2015- .

Posteriormente, el 9 de julio del 2015 rechazaron la solicitud de prórroga que había planteado la señora Nombre105146. De manera simultánea, en el oficio No. Identificacion160- 2015 del 31 de julio del 2015, la Actividad de Control Constructivo de la Municipalidad de Alajuela le comunicó a la señora Nombre105146 que de previo a resolver la licencia constructiva, debía proceder a pagar las multas que allí se consignaban, sin precisar mayores datos, montos ni su origen. Nótese que aún la licencia no había sido rechazada, pues estaba sujeta a una condición que, por la falta de información, resultaba de imposible cumplimiento por parte de la interesada, no por su negligencia, sino por vicio de las autoridades locales que no tuvieron capacidad de comunicar el detalle de las dos multas. El agravio expresado por la apelante es de total recibo, pues sin duda, fueron las autoridades locales las que la dejaron en absoluta indefensión.

El acto final de la Vice Alcaldía, que es el impugnado ante esta Cámara, dispuso la demolición de las obras, obviando las actuaciones internas del ayuntamiento y sin que aún se hubiera rechazado aún en definitiva la licencia constructiva. Los agravios expresados por la señora Nombre105146 son de recibo, pues lo actuado infringe la finalidad de la Ley, resulta arbitrario y contrario al fin de las normas que regulan el derecho a construir, de modo que ciertamente debe dársele oportunidad a la apelante de terminar el trámite de su licencia constructiva, lo que incluye honrar sus impuestos y multas, brindándole con detalle su origen, especificación del cálculo y monto exacto. Únicamente en el supuesto de que se rechace la licencia de forma definitiva, podría eventualmente recaer la orden de demolición. Ante tales circunstancias, es claro que lo actuado por el gobierno local fue prematuro y tiene serios vicios de nulidad absoluta y, por ende, merece ser anulado.

Es importante reiterar que ambos trámites, entiéndase el que conoció el órgano director y que atendió la Actividad de Control Constructivo para el otorgamiento de la licencia constructiva, son parte de una sola causa, de modo que mal hizo el órgano director al divorciar uno del otro, pues con ello se separó del procedimiento previsto en la Ley de Construcciones e impidió a la administrada el legítimo ejercicio de su derecho a regularizar las obras. Deberá conferirse el plazo razonable, suficiente y necesario a la administrada a fin de que esta situación se resuelva de manera correcta y ordenada, hasta culminar como en derecho corresponda. Por ende, los agravios expresados son de recibo, pues se aprecian vicios en el procedimiento que deberán ser subsanados, de modo que todas las actuaciones ejecutadas a partir de la audiencia oral y privada realizada el 24 de junio del 2014, éste acto inclusive, y hasta la resolución final de la Alcaldía de las 14:15 horas del 18 de setiembre del 2015, tienen vicios de nulidad, debiendo retrotraerse las actuaciones a efecto de enderezar el procedimiento, conforme a lo que aquí se resuelve.

Deberá devolverse el asunto a la Municipalidad de Alajuela, en donde se le debe informar con claridad a la señora Nombre105146, todo lo concerniente a las dos multas. De lo que ocurra con posterioridad, ya sea que ella cancele o no dentro del plazo requerido por la Municipalidad, es que se podrá resolver si la licencia se otorga y luego, se ha de resolver el procedimiento administrativo indicado.

VI.Las pretensiones planteadas ante esta Cámara, a efecto de que se anulen las multas que fueron notificadas a la apelante en el oficio No. Identificacion159 no pueden ser atendidas, debido a que ello solamente pudo conocerse mediante la impugnación debidamente interpuesta en tiempo y forma en contra de dichas sanciones.

POR TANTO

Se declara con lugar el recurso de apelación interpuesto, por lo que se anulan todas las actuaciones ejecutadas a partir de la audiencia oral y privada realizada el 24 de junio del 2014, éste acto inclusive, y hasta la resolución final de la Alcaldía de las 14:15 horas del 18 de setiembre del 2015, dentro del procedimiento administrativo ordinario seguido en contra de la señor Nombre105146 , debiendo retrotraerse las actuaciones a efecto de enderezar el procedimiento, conforme lo indicado en este resolución.
