CONSIDERING:
II.In the challenged judgment 59-2016 of 30 June 2016, the proceeding was granted and the area of the property registered in the HEREDIA Registry District under property number [Placa1] was ordered amended in accordance with cadastral plan A-1748539-2014, so that [Dirección7] would be recorded as its actual area. The Procuraduría General de la República (PGR) appeals on the following grounds:
III.In view of the arguments raised on appeal, it must be emphasized that our legal system guarantees the right to correct the area of registered land through a possessory-information proceeding (proceso de información posesoria), whether the land is located inside or outside protected wildlife areas, provided that all legal requirements established by the various bodies of law are satisfied. Protected wildlife areas are governed by Articles 32 through 38 of Ley Orgánica del Ambiente 7554 of 4 October 1995 and Article 2 of Ley de Conservación de Vida Silvestre. They form part of the State’s natural heritage (patrimonio natural del Estado), which is governed by Ley Forestal 7575. Anything encompassed therein is immune from attachment (inembargable) and inalienable (inalienable) because it is in the public domain (section 262 of Código Civil). Possession thereof by private persons confers no right upon them, and the State’s action to recover title (acción reivindicatoria) to such land is not subject to any statute of limitations (imprescriptible).
Consequently, such land is not eligible for registration in the Registro Público through possessory information (información posesoria), unless it falls within the exception established in Article 7 of Ley de Informaciones Posesorias, which permits land located within protected wildlife areas to be titled, provided that the property right was perfected (consolidado) at least ten years before the declaration imposing that restriction, because from that time onward such areas form part of the public domain.
IV.Regarding the argument that the testimony of witness [Nombre3] did not establish ten-year possession (posesión decenal) prior to the creation of the cited Reserve (that is, at least ten years before July 1975), and that the testimony of three witnesses concerning that fact must appear in the record before the proceeding may be approved, the appellant is incorrect. In the judgment under appeal, when analyzing the testimonial evidence (prueba testimonial) received on February 24, 2015, the trial judge stated: “... having analyzed the witness statements given, which constitute the appropriate evidence, this judge finds it established that the applicant possessed the land for more than ten years prior to the creation of this Reserve. Witness [Nombre4] stated that he is 68 years old. Approximately 30 years ago, he worked for the applicant. Witness [Nombre4] says that he has known the land since he was 11 years old, that is, since approximately 1957.
He states that the applicant has owned this property for more than 30 years, uses it for dairy farming, and there are buildings where he works with the cows... He also states that there is forest on this property, along the Río San Fernando. He indicates that he knew the previous owners. He has personal knowledge that the land is fenced with wooden posts and barbed wire. He states that the property has remained the same since he first knew it. Similarly, witness [Nombre5] testified that he is 55 years old. He indicates that he has known the land his entire life and was born in the area where the property is located. He states that the property has a dairy operation with its facilities, and that there is forest that protects the Río San Fernando. He states that the livestock is branded. He has personal knowledge that the boundaries are fenced and that, along one section, the river forms the boundary.
He states that the applicant has owned this property for more than thirty years. It has always remained the same property; its boundaries are the same as those he has known. For his part, witness [Nombre6] testified that he is 63 years old and has known the property since he arrived in that location at 6 years of age. Thus, he has known the property for 57 years, that is, since the late 1950s. He states that the applicant has owned this property for more than thirty years. He has personal knowledge that the applicant uses the property for dairy cattle and that there is forested mountain land. At one time, coffee was grown in one section. These witnesses indicate that they have known the property for a sufficiently long period because they are residents of the area where the land is located and have known it since before 1965. Their statements are consistent, and they attest to the applicant’s possession, without disputes involving third parties, and to the manner in which the property has remained unchanged with respect to its boundaries.
They also agree as to the nature of the property. Consequently, the requirement of ten-year possession before the creation of the Reserve, to which the State’s representative refers, has clearly been established. In addition, this case concerns a proceeding to rectify the area (rectificación de medida) of a registered property, the purpose of which is to reconcile its actual area with the records of the Registro Nacional; accordingly, the property is included within the applicant’s registered ownership.”
V.We agree with the trial judge’s analysis of the testimonial evidence. Although it is true that, on the date of the testimony, the challenged witness [Nombre3] stated that he was 55 years old, which confirms that he was born in 1060 and had remembered the property for 40 years (1075), his testimony is useful and must be analyzed comprehensively together with the remaining evidence, rather than viewed in isolation, as the PGR seeks to do in order to diminish its effectiveness and credibility. His testimony is objective and consistent with the statements of the other two witnesses, and there is nothing in the record that casts doubt on the truthfulness of their testimony regarding the fact that the property was fenced, the location of its boundaries and, especially, that those boundaries have not been modified, as well as the use to which the property is devoted. As the court below correctly concluded, the testimonial evidence, together with the applicant’s affidavit (declaración jurada), establishes how the land was acquired and that, in its physical reality, it has remained the same since that person took possession of it; a constitutionally protected real property ownership right (derecho real de dominio) already exists over it.
Therefore, all of the testimonial evidence, including the challenged testimony, is useful in establishing the essential requirement in area-rectification proceedings: that the land possessed is the same land that was registered, without changes to its original boundaries. It is important to emphasize that, in cases such as this one, that fact is essential because the land is already registered and therefore previously passed the screening required by law for the registration of land located within protected areas. Accordingly, what must be established in this proceeding—rather than possession and the date on which it began once again—is that the boundaries have not been modified, in order to prevent an area-rectification proceeding from being used to acquire illegally more land than was actually possessed and lawfully titled, particularly where the land is located within a protected wildlife area (área silvestre protegida).
VI.Regarding the argument that there must be 3 statements that are in complete agreement concerning possession prior to the date on which the protected wildlife area was created, the PGR is likewise incorrect. When assessing evidence in agrarian matters, Article 54 of the Ley de la Jurisdicción Agraria requires that the sources of evidence obtained be examined and selected in order to establish their effectiveness in resolving the dispute submitted for adjudication, through perception, representation or reconstruction, and deductive or inductive reasoning. A court must state the principles of equity or law on which its judgment is based. In this regard, the Sala Constitucional has explained: “..., the assessment of evidence according to conscience (apreciación de la prueba en conciencia) does not entail deciding arbitrarily, because every judge—as a public official—is subject to the principle of legality, which imposes a duty to ensure that public action complies not only with the specific rules governing a particular subject matter, but with the entire body of law; therefore, a judge may not rule in disregard of constitutional principles and rights, since the judge is constrained by the rules of sound judicial discretion (sana crítica) and the principles of reasonableness, which, when properly applied, bring judicial assessment into harmony with the Constitución Política, as this Chamber held in judgment 3484-94, issued at twelve o’clock on July 8, 1994, in which it determined that the authority of judges to assess evidence according to conscience is not contrary to a judge’s obligation to provide reasons for rulings, a constitutional principle forming part of due process...
() the authority granted to an agrarian judge to assess evidence according to conscience and to weigh it without strict adherence to the rules of ordinary law, as provided in the second paragraph of the challenged Article 54, is not unconstitutional, provided that the judge issues a reasoned ruling—that is, analyzes the evidence gathered in the proceeding and states the principles of equity or law on which the judgment is based—thereby respecting the minimum requirements of the right of defense” ( voto 3657 del 7 de mayo de 2003 . See, to the same effect, votos N° 398 del 6 de junio del 2001 de la Sala Primera. Likewise, see votos No. 206 del 26 de marzo de 1999, N°46 del 26 de abril de 1995; Nª66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario). Accordingly, the evidence must be analyzed comprehensively together with the remaining evidentiary material and must be assessed in light of the circumstances of the specific case, particularly in area-rectification proceedings, in which the purpose is not to register land but to reconcile its registered area with its physical reality, as the trial judge emphasized.
In this case, the three witnesses gave consistent testimony and provided information based on their knowledge that is truthful and consistent with the remaining evidence, concerning essential facts about the land and what had to be proven to authorize the rectification of its area. As to the PGR’s reference to judicial precedents, it should be clarified that the Court must require consistency between the evidentiary material and the statements made under oath by the person seeking title; however, this does not require exactness, much less agreement on each and every matter addressed in the testimony.
VII.The second ground of appeal is likewise without merit. The fact that one section of the land is devoted to livestock farming does not preclude rectification of its area. Furthermore, according to the soil study, the environmental asset (bien ambiental) has been used in conformity with its designated use (uso conforme). It is important to emphasize that this matter is not a possessory information proceeding (proceso de información posesoria), but an area-rectification proceeding. The constitutional right of ownership grants the owner powers or attributes of modification and protection, including the right to adjust the registered area to the actual area (Articles 264 and 290 of the Código Civil). It is also important in registry and cadastral matters (materia registral y catastral) that the information in the Registro Público Inmobiliario reflect reality (Article 459 of the Código Civil).
If the activity currently conducted on the land violates environmental regulations because the land lies within a protected wildlife area, mechanisms exist to determine any civil, criminal, or administrative liability that may be borne by the owner. There are also environmental restrictions and limitations (límites y limitaciones de orden ambiental) that the owner must observe and whose violation may be sanctioned through various proceedings. However, that fact neither implies nor permits denial of access to the right protected in proceedings of this kind, because an owner may alter and enjoy the property through any activity not prohibited by the legal system. If livestock farming is wholly incompatible with the type of protected wildlife area, but the land is lawfully registered, the State must apply the appropriate measures to recover it, following expropriation of the land. If that is not the case, the State must verify that the permissible limitations (limitaciones soportables) are duly observed by the owner (Articles 45 and 50 of the Constitución Política).
VIII.The third claim of error is inadmissible because it does not specify what was not duly complied with. In any event, it is clarified that proceedings for rectification of area (rectificación de medida) are not possessory title proceedings (procesos de información posesoria). If a registered parcel (finca inscrita) has an area recorded in the Registry that differs from its actual physical area, the procedure established by the legislature for correcting it is called “Rectification of Area” (“Rectificación de Medida”). This is regulated by the Ley de Informaciones Posesorias 139 of 14 de Julio de 1941 (Articles 12 and 13) and may be conducted through notarial or judicial proceedings, depending on the number of meters that must be rectified. The fact that they are regulated in the same body of law does not mean that they are the same procedure (although they have similarities), nor does it mean that an area of land already forming part of a registered parcel may be registered as an independent parcel through an area correction.
It is important to emphasize that these are distinct proceedings, with different purposes and requirements, even though they share many of those requirements. Thus, the rectification-of-area procedure is a special, non-contentious proceeding regulated by the Ley de Informaciones Posesorias that, upon compliance with a series of requirements, allows the holder of title to a registered property to rectify its area through the following avenues: a) in the original case file itself; b) if that file cannot be located, through an application for rectification accompanied by a certification of the relevant registry entry and, insofar as possible, by reexamining the witnesses who previously testified, if they can be located, or otherwise other witnesses, so that they may testify as to the identity of the parcel; c) depending on the percentage by which the area is sought to be increased, the property owner’s declaration alone in a public deed is sufficient; d) in the event of a decrease, only an express declaration in a public deed and the corresponding registered cadastral survey plan (plano catastrado) are required (Articles 12 through 14 of the cited Law).
By express provision of the aforementioned Article 12, the area of a property that has already been rectified may not be rectified again for any reason, except to correct a survey-plan calculation error arising from the measurement details. In accordance with the foregoing, an essential legal prerequisite for admitting this type of application is that the property to be rectified be registered. In possessory title proceedings, the land may not have been previously registered. Those differences, as well as others, mean that certain requirements differ, such as the type of Registry certifications that must be submitted (content).
VI.Finally, as to the appealed judgment’s failure to state that the area adjoining the spring (naciente) is a protected area (área de protección) where cutting down or removing trees is prohibited (Article 33 of the Ley Forestal and Articles 148, 149, and 151 of the Ley de Aguas), and that groundwater is in the public domain (dominio público) and does not form part of the parcel (Articles 1 and 3 of the Ley de Aguas, Article 4 of the Código de Minería, and Article 50 of the Ley Orgánica del Ambiente), the Office of the Attorney General is indeed correct. However, that omission may be remedied sua sponte or through a motion to expand or supplement the judgment (Article 158 of the Código Procesal Civil, applied subsidiarily). Accordingly, this must be raised in a timely manner through the remedies established for that purpose and not as a claim of error in an appeal. Nevertheless, in the interest of procedural economy and because this matter could even have been corrected sua sponte, this Court orders that the appealed judgment be supplemented as requested by the Office of the Attorney General.
V I I .- In accordance with the foregoing, the appealed judgment must be affirmed with respect to the matters appealed. The Por tanto thereof shall be supplemented to state that the area adjoining the spring is a protected area where cutting down or removing trees is prohibited (Article 33 of the Ley Forestal and Articles 148, 149, and 151 of the Ley de Aguas), and that groundwater is in the public domain and does not form part of the parcel (Articles 1 and 3 of the Ley de Aguas, Article 4 of the Código de Minería, and Article 50 of the Ley Orgánica del Ambiente).

La Procuraduría General de la República (PGR) apela con base en los siguientes agravios:
III.Dada lo que se alega en los agravios, es necesario resaltar que nuestro ordenamiento jurídico garantiza el derecho de rectificar la medida de terrenos inscritos a través del proceso de información posesoria, sea que se ubiquen dentro o fuera de áreas silvestres protegidas, siempre y cuando se cumplan todos los requisitos legales exigidos en los diversos cuerpos normativos. Las áreas silvestres protegidas están reguladas en los artículos 32 a 38 de la Ley Orgánica del Ambiente 7554 de 4 de octubre de 1995 y 2 de la Ley de Conservación de Vida Silvestre. Integran el patrimonio natural del Estado, regulado en la Ley Forestal 7575. Lo que quede comprendido dentro de tal es inembargable e inalienable, por ser dominio público (numeral 262 del Código Civil). Su posesión por las personas privadas no les otorga derecho alguno y la acción reivindicatoria del Estado por esos terrenos es imprescriptible. En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria, salvo que estén en el supuesto de excepción del artículo 7 de la Ley de Informaciones Posesorias, que permite se titulen terrenos comprendidos dentro de áreas silvestres protegidas, siempre y cuando se haya consolidado el derecho de propiedad al menos diez años antes de la declaratoria de esa afectación, pues a partir de ese momento, tales zona forman parte del dominio público.
IV.Con respecto a que con la declaración del testigo [Nombre3] no se demostró la posesión decenal anterior a la creación de la Reserva citada (es decir, mínimo diez años antes de julio de 1975) y que es indispensable que conste la declaración de tres testigos sobre ese dato para aprobarse el proceso, no lleva razón la recurrente. En la sentencia recurrida, al analizar la prueba testimonial recibida el 24 de febrero del 2015, la persona juzgadora de instancia indicó: "... analizadas las declaraciones testimoniales evacuadas, la cual constituye la prueba idónea, esta juzgadora tiene por demostrado que la posesión en el terreno por parte del promovente lo ha sido por más de diez años anteriores a la creación de esta Reserva. El testigo [Nombre4] manifestó que tiene 68 años de edad. Hace como 30 años trabajó para el promovente. Dice el testigo [Nombre4] que conoce el terreno desde que tenía 11 años de edad, es decir desde el año 1957 aproximadamente.
Que el promovente tiene más de 30 años de ser dueño de este fundo, lo tiene dedicado a lechería, hay construcciones donde trabaja con las vacas... También: hay bosque en esta finca, por el Río San Fernando. Indica que conoció a anteriores dueños. Le consta que el terreno está cercado con postes de madera, y alambre de púas. Señala que la propiedad ha sido la misma, desde que la conoce. En igual sentido, el deponente [Nombre5] declaró que cuenta con 55 años de edad. Indica conoce el terreno desde toda la vida, nació en la zona donde se ubica la propiedad. Señala que la propiedad tiene una lechería con sus instalaciones, y hay bosque que es protección al Río San Fernando. Que el ganado cuenta con fierro. Le consta que las colindancias están cercadas, y hay una parte que el límite es ese río. Que el promovente es dueño de esta finca desde hace más de treinta años. Siempre se ha mantenido la misma finca, en cuanto a colindancia, es la misma que ha conocido.
Por su parte, el declarante [Nombre6] declaró que cuenta con 63 años de edad, y conoce la finca desde que llegó a ese lugar a los 6 años de edad. En ese sentido, conoce el fundo desde hace 57 años, sea desde finales de los años 50 del siglo pasado. Que el promovente es dueño de esta finca, desde hace más de treinta años. Le consta que el promovente dedica la finca a ganado de ordeño, hay montaña. En una época había cultivo de café en un sector. Dichos deponentes indican que conocen la finca con suficiente antelación, ya que son vecinos del lugar donde se sitúa el terreno, y lo conocen desde antes del año 1965. Son contestes en sus manifestaciones, y dan fe acerca de la posesión ejercida por el promovente, sin problemas con terceras personas, y como el inmueble se ha mantenido en cuanto a sus colindancias. Además, coinciden en la naturaleza del fundo. Consecuentemente, es clara la acreditación del presupuesto de posesión decenal a la creación de la Reserva que alude la representación estatal.
Aunado a lo expuesto, en este caso se está ante un trámite de rectificación de medida de una finca inscrita, siendo que la finalidad es conciliar la cabida real ante Registro Nacional, de manera que el fundo está integrado a la titularidad registral del promovente".
V.Se comparte el análisis de la prueba testimonial que hizo la juzgadora de instancia. El testimonio objetado de [Nombre3] , si bien es cierto a la fecha de la declaración dijo tener 55 años, lo que confirma que nació en 1060 y recuerda la finca desde hacía 40 años (1075), es un testimonio útil que se debe analizar con la restante prueba, en forma integral, y no verlo aisladamente, como lo pretende la PGR, para restarle eficacia y credibilidad. Su declaración es objetiva y concordante con lo que los otros dos testigos manifestaron, sin que existan elementos en autos que hagan dudar de la veracidad de lo atestiguado por ellos, en cuanto a que la finca estaba cercada, cuáles son sus límites y especialmente que no ha sido modificados, así como a qué se dedica. De la prueba testimonial se deriva, como correctamente concluyo la a quo, así como de la declaración jurada de la parte promovente el cómo se adquirió el terreno y que en su realidad material ha sido el mismo desde que lo posee tal persona, sobre el cual ya existe un derecho real de dominio tutelado constitucionalmente.
Por ende, toda la prueba testimonial, incluido el testimonio objetado, es útil para demostrar el presupuesto esencial requerido en rectificaciones de medida: que se posea el mismo terreno que fue inscrito, sin modificaciones de sus límites originales. Es importante resaltar que en casos como el presente, ese dato es fundamental, porque el terreno ya está inscrito y pasó entonces el filtro que la ley establece previamente para inscribir terrenos que estén incluidos en áreas protegidas. Por ende, lo que se debe demostrar en este proceso, más que de nuevo la posesión y desde cuándo se posee, es que los límites no ha sido modificados, para evitar que a través de un proceso de rectificación se adquiera ilegalmente más tierra que la realmente poseída y ya titulada legalmente, especialmente si el terreno está incluido en un área silvestre protegida.
VI.En cuanto a que deben existir 3 declaraciones conformes en forma absoluta en cuanto al dato de posesión anterior a la fecha de creación del área silvestre protegida, tampoco lleva razón la PGR. En la valoración de la prueba en materia agraria el numeral 54 de la Ley de la Jurisdicción Agraria exige se estudi en y seleccion en las fuentes de prueba obtenidas, a fin de establecer su eficacia para resolver el conflicto sometido a su conocimiento, a través de la percepción, la representación o reconstrucción y el razonamiento deductivo o inductivo. Deben e xpresar se los principios de equidad o de derecho sobre los cuales basa su criterio un tribunal. Al respecto, la Sala Constitucional ha explicado: "..., la apreciación de la prueba en conciencia no implica resolver en forma arbitraria, por cuanto todo juez -como funcionario público que es- se encuentra sujeto al principio de legalidad, el cual constituye un imperativo de adecuación de la acción pública, no sólo de las normas específicas sobre un objeto determinado, sino a todo el bloque de legalidad; por lo que no puede fallar con desprecio de los principios y derechos constitucionales, ya que está limitado por las reglas de la sana crítica y principios de razonabilidad, que debidamente aplicados conducen a la armonía de la apreciación jurisdiccional con la Constitución Política, tal y como lo entendió esta Sala en sentencia 3484-94, de las doce horas del ocho de julio de mil novecientos noventa y cuatro, en que determinó que las facultades de los jueces de apreciar la prueba en conciencia no resultan contrarias a la obligación del juez de fundamentar sus fallos, principio constitucional que integra el debido proceso...
() no resulta inconstitucional el poder otorgado al juez agrario para apreciar en conciencia la prueba y valorarla sin sujeción estricta a las normas del derecho común según lo dispuesto en el párrafo segundo del artículo 54 impugnado, siempre y cuando dicte un fallo fundamentado, es decir analice el resultado de la prueba recogida en el proceso y exprese los principios de equidad o de derecho en que basa su criterio, respetando de tal modo los contenidos mínimos del derecho de defensa" ( voto 3657 del 7 de mayo de 2003 . Ver en igual sentido votos N° 398 del 6 de junio del 2001 de la Sala Primera. En igual sentido veáse votos No. 206 del 26 de marzo de 1999, N°46 del 26 de abril de 1995; Nª66 del 6 de febrero de 2009 y 364 de 28 de mayo del 2009 del Tribunal Agrario). Por ende, la prueba debe ser analizada forma integral con el resto de elementos probatorios y debe valorarse en función de las circunstancias del caso concreto, máxime en procesos de rectificación de medida, donde no se pretende inscribir un terreno, sino hacer concordar su medida registral con la realidad material, como lo resaltó la juzgadora de instancia.
En este caso, los tres testigos declararon en forma coincidente y ofrecen información con base en sus conocimientos, que son veraces y concordantes con las restantes pruebas, referidos a datos fundamentales del terreno y lo que era necesario probar para autorizar la rectificación de la medida. Y dado lo que señala la PGR sobre precedentes jurisdiccionales, se aclara que el Tribunal lo que debe exigir es congruencia entre los elementos probatorios y lo manifestado con carácter de declaración jurada por quien titula, pero ello no implica exactitud ni mucho menos que haya una coincidencia en todos y cada uno de los aspectos referidos en las testimoniales.
VII.El segundo agravio tampoco es de recibo. El que un sector del terreno esté dedicado a ganadería, no es un impedimento para rectificar su medida. Además, de acuerdo con el estudio de suelos, se ha ejercido el uso conforme de ese bien ambiental. Es importante resaltar que el presente asunto no es un proceso de información posesoria, sino uno de rectificación de medida. El derecho constitucional de dominio otorga a la persona propietaria facultades o atributos de modificación y tutela, como lo es ajustar la medida registral a la real (numerales 264 y 290 del Código Civil). Es también un elemento importante en materia registral y catastral, que los datos del Registro Público Inmobiliario sean los reales (numerales 459 del Código Civil). Si por la actividad desarrollada actualmente en el terreno existe una infracción a la normativa ambiental, por estar éste inmerso en un área silvestre protegida, existen mecanismos que permiten determinar la responsabilidad de orden civil, penal o administrativo que podría recaer sobre la persona propietaria.
También existen límites y limitaciones de orden ambiental que deben ser respetados por ella y que pueden ser sancionados en diversas vías. Pero ese dato no implica ni permite que se le pueda negar el acceso al derecho tutelado en este tipo de procesos, pues como propietario puede transformar y usufructar el bien en toda actividad que el ordenamiento jurídico no prohíba. Si la actividad ganadera es imcompatible absolutamente con el tipo de área silvestre protegida, pero el terreno está legalmente inscrito, el Estado debe aplicar las medidas pertinentes para su recuperación, previa expropiación del terreno. Si no es así, debe verificar que las limitaciones soportables se cumplan en la forma debida por la persona propietaria (artículos 45 y 50 de la Constitución Política).
VIII.El tercer agravio resulta improcedente, porque no se especifica qué es lo que no se cumplió debidamente. En todo caso, se aclara que los procesos de rectificación de medida no son procesos de información posesoria. Si una finca inscrita tiene una medida reportada registralmente diferente a la que resulta de su realidad material, el procedimiento que la persona legisladora dispuso para su corrección se llama "Rectificación de Medida". Tal está regulado en la Ley de Informaciones Posesorias 139 de 14 de Julio de 1941 (artículos 12 y 13), y puede ser tramitado en la vía notarial o en la judicial, dependiendo de la cantidad de metros que sea necesario rectificar. El hecho de que estén regulados en el mismo cuerpo legal no implica que se trata de un mismo procedimiento (aunque tengan semejanzas), ni tampoco que se pueda por una corrección de medida lograr inscribir como finca independiente un terreno que ya forma parte de una finca inscrita.
Es importante destacar que son distintos procesos, tienen finalidades diversas y requisitos diferentes, aunque compartan gran cantidad de ellos. El procedimiento de rectificación de medida es así un proceso especial, no contencioso, regulado en la Ley de Informaciones Posesorias, que permite, previo el cumplimiento de una serie de requisitos, al titular del derecho de propiedad de un fundo inscrito rectificar su medida a través de las siguientes vías: a) en el mismo expediente original; b) Si tal no apareciere, mediante una solicitud de rectificación, acompañada de una certificación del asiento respectivo y en la medida de lo posible, examinándose de nuevo a las personas testigas que ya declararon, si pudieran ser habidas, caso contrario otros testigas, a fin de que atestigüen sobre la identidad de la finca; c) Dependiendo del porcentaje que se pide rectificar, para aumentar, basta con la sola declaración de la persona propietaria en escritura pública; d) En caso de tratarse de una disminución, solo es necesaria la manifestación expresa en escritura pública y contar con el plano catastrado respectivo (artículos 12 a 14 de la Ley citada).
Por disposición expresa del numeral 12 citado, la cabida de un inmueble ya rectificado no puede ser rectificada por ningún motivo, salvo que se trate de enmendar un error de cálculo de plano resultante de los detalles de medida. De acuerdo con lo expuesto, un presupuesto legal esencial para que se pueda admitir este tipo de gestión, es que el inmueble a rectificar esté inscrito. En las informaciones posesorias el terreno no puede estar previamente inscrito. Esas diferencias y otras más hacen que algunos requisitos sean diferentes, por ejemplo, el tipo de certificaciones registrales que se deben aportar (contenido).
VI.Finalmente, en cuanto a que la sentencia apelada omite indicar que el área contigua a la naciente es área de protección y queda prohibida la corta o eliminación de árboles (artículos 33 de la Ley Forestal y 148, 149 y 151 de la Ley de Aguas), así como que las aguas subterráneas son de dominio público y no forman parte de la finca (numerales 1 y 3 de la Ley de Aguas, 4 del Código de Minería y 50 de la Ley Orgánica del Ambiente), ciertamente lleva razón la Procuraduría. Sin embargo, dicha omisión puede ser subsanada de oficio o a través de una solicitud de ampliación o adición del fallo (artículos 158 del Código Procesal Civil, aplicado supletoriamente). Por consiguiente, ello debe ser reclamado oportunamente a través de los remedios establecidos al efecto y no como agravio de un recurso de apelación. No obstante, por economía procesal y por ser un aspecto que incluso de oficio se puede haber corregido, esta Instancia procede a ordenar se adicione la sentencia recurrida en el sentido solicitado por la Procuraduría.
V I I .- De conformidad con lo expuesto, procede confirmar la sentencia recurrida en lo que fue objeto de apelación. Adiciónese al por tanto de la misma, que el área contigua a la naciente es área de protección y queda prohibida la corta o eliminación de árboles (artículos 33 de la Ley Forestal y 148, 149 y 151 de la Ley de Aguas), así como que las aguas subterráneas son de dominio público y no forman parte de la finca (numerales 1 y 3 de la Ley de Aguas, 4 del Código de Minería y 50 de la Ley Orgánica del Ambiente).
VOTO SALVADO DE LA JUEZA [Nombre7] No se comparte el voto de mayoría por las siguientes razones:
POR TANTO
En lo que ha sido objeto de apelación , se confirma la sentencia. Adiciónese al por tanto de la misma, que el área contigua a la naciente es área de protección y queda prohibida la corta o eliminación de árboles (artículos 33 de la Ley Forestal y 148, 149 y 151 de la Ley de Aguas), así como que las aguas subterráneas son de dominio público y no forman parte de la finca (numerales 1 y 3 de la Ley de Aguas, 4 del Código de Minería y 50 de la Ley Orgánica del Ambiente). Voto salvado de la Jueza Alvarado Paniagua.
