(folios 11 to 13 and 431).-* * * * * * * * * * * * * 2.- By an order issued at fifteen hours and thirty minutes on veintidós de junio del dos mil nueve, the assignment of rights made by the executor of the estate of [Nombre1] in favor of Horizontes de Alajuela Sociedad Anónima was deemed effective (folios 131 to 132).- * * * * * * * * * * * * * * * 3.- That company, in turn, assigned its rights in dispute and possessory rights (derechos de posesión) to Ciro del Pacífico Sociedad Anónima, and the assignment was deemed accepted by an order issued at thirteen hours and thirty minutes on veinticuatro de junio del dos mil catorce (front and back of folio 423).-* 4* .- The Procuraduría General de la República entered an appearance in the proceeding under the terms set forth at folios 40 to 46; and the Instituto de Desarrollo Rural did so under the terms set forth at folio 47, without raising any objection.-* * * * * * * * * * * * * 5* .- Judge Marisel Zamora Arias of the Juzgado Agrario del Segundo* Circuito Judicial de la Zona Sur, Corredores, by Judgment number 07-2015 issued at fifteen hours and twenty-eight minutes on veintisiete de enero del dos mil quince , ruled: "THEREFORE: In accordance with the foregoing, the possessory information proceedings brought by CIRO DEL PACIFICO SOCIEDAD ANONIMA are DENIED." (folios 460 to 465).-* 6* .- Oscar Humberto Segnini* Saborío, special judicial attorney-in-fact for the assignee petitioner company, filed an appeal (recurso de apelación), expressly stating the reasons why he disputes the position of the trial court (Juzgado de instancia) (folios 469 to 490).-* 7* .* - The statutory requirements were not observed in the conduct of the proceeding, and the judgment contains errors or omissions capable of rendering it null and void. -* Drafted by Judge Picado Vargas; and,* CONSIDERING:* * * * * * * * * * * * * I. No ruling is made concerning the list of proven facts, given the manner in which this appellate court will decide the matter.-* * * * * * * * * * * * * II.

Oscar Segnini* Saborío, special judicial attorney-in-fact for the petitioner company, appeals the aforementioned decision under the terms set forth at folios 469 to 490.-* * * * * * * * * * * * * III. This Tribunal finds two procedural errors that rendered the judgment premature and caused a denial of the right of defense (estado de indefensión). The registered survey plan by which title to the property is sought violates subsection e) of Article 34 of the Reglamento de Catastro Nacional of 16 de setiembre de 2008, under which the plan must graphically and textually indicate, in full rather than in part, any physical feature, such as rivers, streams, lagoons, among others. Analysis of the Technical Report on the Existence of a Wetland (humedal) on the Property Shown in Plan No. 662100-2000, at folios 280 to 299, specifically its conclusions at folio 290, as well as the Ecological Assessment (Evaluación Ecológica) of a section of [Dirección3] at folios 349 to 378, specifically identifies an area of 137578,71 square meters designated as wetland, which is not depicted on the aforementioned plan.

Even in the appealed judgment, the a quo court deemed it proven that the area comprises ten hectares, which contradicts that report. The existence of the wetland was verified by this Tribunal through the judicial inspection (reconocimiento judicial) conducted at eight hours on 19 de febrero del 2016 (see video on DVD), as well as through the judicial inspection conducted by the a quo court at folio 328. Nevertheless, registered survey plan P-662100-2000 at folio 1 indicates only that the land consists of pastureland, rice fields, and secondary scrub growth (tacotal).* According to the referenced information, because a wetland exists on the property, the registered survey plan should have described it as required by Article 34, subsection e), of the Reglamento de Catastro Nacional. Accordingly, this Tribunal considers the judgment to have been issued prematurely, because it was rendered before all statutory requirements, including the referenced Article 34, had been satisfied.

Given that omission, the appropriate course is to order compliance with that requirement.-* * * * * * * * * * * * * IV.- Regarding the wetland conservation requirement, this Court has held: “Agro-environmental restrictions (limitaciones agroambientales) on property encompass numerous aspects of the conduct of productive activities and the conservation of natural resources, Biodiversity, soil use and conservation, forest and ecosystem protection, the use and control of pesticides and chemically synthesized products, animal and plant phytosanitary and sanitary control, agricultural waste, water conservation, the use and management of wastewater in agriculture, and the restoration of soils and watersheds (cuencas hidrográficas), among others. Within the context of the constitutional principles and values set forth in Articles 45 and 50 of the Political Constitution, numerous agro-environmental laws began to be enacted; these not only marked the consolidation of a sustainable development model, but also imposed a series of agro-environmental restrictions on property and freedom of enterprise, while also seeking to consolidate a new agrarian and environmental or ecological culture. * * * * * 1) The Ley Orgánica del Ambiente (No. 7554 of October 4, 1995) establishes the State’s obligation to foster sustainable economic and environmental development, which necessarily entails imposing environmental limits on the conduct of productive economic activities and the exercise of property rights.

For those limits to be genuinely applied, however, a cultural change is necessary. Traditional agrarian culture, in which only economic considerations mattered, must give way to an environmental or agro-environmental culture for sustainable development (Ley Orgánica del Ambiente, Articles 12, 13, 14, 15 and 16). The most important restrictions imposed on property to ensure its economic, social, and environmental function include the following: A.- The conduct of any agro-environmental activity that may alter or destroy elements of the environment necessarily requires an environmental impact assessment (evaluación de impacto ambiental, EIA), which must be approved before the project begins. An assessment is also required when construction or infrastructure may affect marine and coastal resources or wetlands. B.- Land-use planning (ordenamiento territorial), in order to balance sustainable development, entails the territorial relocation of productive activities, which could impose significant restrictions on property rights, since consideration must be given, among other matters, to natural resources, predominant economic activities, land-use capability (capacidad de uso de los suelos), and zoning by agricultural products and activities, based on ecological and productive considerations.

C- The Executive Branch is empowered to include privately owned properties necessary for fulfillment of the environmental function within protected wildlife areas (áreas silvestres protegidas), or to create statutory easements (servidumbres legales) for ecological protection. In cases where the Law requires compensation, private parties may voluntarily submit to the forestry regime (régimen forestal), in which case an encumbrance on the property is recorded in the Public Registry (Ley Orgánica del Ambiente, Article 37). D.- Activities intended to interrupt the natural cycles of wetland ecosystems and that may cause their deterioration or elimination are prohibited (Ley Orgánica del Ambiente, Article 45). E.- Productive activities must prevent water pollution, treat wastewater, and prevent or minimize the deterioration or pollution of watersheds and soil. F.- Organic agriculture, as a means of conducting sustainable agrarian activities, constitutes a way of fulfilling the economic, social, and environmental function, because environmental certification (certificación ambiental) is required for organic products obtained without applying chemically synthesized inputs or products (Articles 73-75).

G.- Environmental credit (crédito ambiental): it is intended to finance the costs of reducing pollution in production processes. When such processes involve land use, a land-management and land-use plan (plan de manejo y uso de tierras) is required in accordance with land-use capability (Ley Orgánica del Ambiente, Article 113). Undoubtedly, the structure of property and its function are, in this case, conditioned by the environmental element required in the conduct of business activities. 2) The Ley Forestal (No. 7575 of February 5, 1996, amended by Laws No. 7609 of June 11, 1996, 7761 of April 2, 1998 and 7788 of April 30, 1998), guided by the constitutional principles governing the appropriate and sustainable use of renewable natural resources, establishes regulations concerning the conservation, protection, and management of natural forests, and the production, harvesting, processing, and promotion of forest resources, seeking to involve private parties in the sustained conduct of silvicultural activities.

Although MINAE is empowered to create protected wildlife areas on privately owned land, doing so requires compensation unless the owner elects to submit voluntarily to the forestry regime or the land already belongs to the State as part of its National Reserves. The Law establishes two clear restrictions in the interest of protected areas: a: “In the case of forest reserves, protection zones (zonas protectoras), and wildlife refuges, where payment or expropriation has not yet occurred and while it remains pending, the areas shall be subject to an environmental land-use plan (plan de ordenamiento ambiental) that includes an environmental impact assessment and, subsequently, a management, restoration, and resource-replenishment plan.” (Ley Orgánica del Ambiente, Article 37, in relation to Article 2 of the Ley Forestal. That amendment was introduced by the Ley de Biodiversidad, in Article 14).

This constitutes a clear restriction intended to ensure fulfillment of the environmental function of property. B. “When, based on scientific and technical justification in the public interest, it is determined by law that the land is essential for conserving biological diversity or water resources, a restriction on the property shall be established that prevents trees from being cut and the land use from being changed. This restriction shall be registered as an encumbrance (afectación) in the Public Registry.” (Ley Forestal, Article 2, second paragraph). As can be seen, this is not an unreasonable restriction. On the contrary, the owner may conduct activities provided that they are compatible with the environmental function inherently assigned to the property for the conservation of water resources or biological diversity. Title III of the Law, concerning private forest property as a special form of property, establishes a set of rights and obligations for forest owners that condition fulfillment of the environmental function according to the nature of the property:* a) Owners are not permitted to change the land use or establish forest plantations.

Nevertheless, the State Forestry Administration (Administración Forestal del Estado) may grant permission to carry out works ancillary to agroforestry activities, provided that forest cutting is limited, proportionate, and reasonable (Ley Forestal, Article 19. Where necessary, an environmental impact assessment would be required); b) Forest harvesting (aprovechamiento del bosque) may be conducted only if the owner has a management plan (plan de manejo) addressing the potential environmental impact, in accordance with scientific sustainability criteria; c) Payment for environmental services (pago por servicios ambientales) (The Law defines environmental services as:* “Those provided by forests and forest plantations that directly contribute to environmental protection and improvement. They are the following: mitigation of greenhouse-gas emissions (fixation, reduction, sequestration, storage, and absorption); protection of water for urban, rural, or hydroelectric use; protection of biodiversity for its conservation and sustainable, scientific, and pharmaceutical use; research and genetic improvement; and protection of ecosystems, life forms, and natural scenic beauty for tourism and scientific purposes.”), constitutes one of the most modern manifestations of the exercise of the environmental function, since the owner undertakes to conserve the forest for a period of no less than twenty years in order to receive the Forest Conservation Certificate (Certificado de Conservación del Bosque).

It is also received by owners who wish to place their property under forest regeneration (regeneración del bosque), for areas that, because of their degraded condition and environmental needs, must be converted to forestry use. The encumbrances and restrictions, as well as the incentives, are registered in the Public Registry as encumbrances on the property; d) Forest plantations, including agroforestry systems and individually planted trees, require no permit for cutting, transportation, processing, or export, except where there is a management plan arising from a forestry contract with the State; e) Every owner is prohibited from cutting or removing trees in the protection areas (áreas de protección) established by Law for permanent springs (nacientes permanentes), rivers, lakes, and water springs (manantiales) (Ley Forestal, Articles 33 and 34.); f) Burning on forest land or adjacent land without obtaining the corresponding permit from the State Forestry Administration is prohibited; g) As part of the environmental function, properties voluntarily submitted to the forestry regime or devoted to that activity enjoy special protection against intrusions, and their owners may request immediate protection from the police authorities; h) Forestry credit (crédito forestal) is consolidated as a mechanism for financing small and medium-sized producers through loans and other mechanisms promoting forest management, reforestation processes, forest nurseries, agroforestry systems, and the restoration of denuded areas.

Financing also includes payment for the environmental services provided by forests and forest plantations. Forested land and standing trees shall serve as security for those loans and shall be recorded as encumbrances on the property (Ley Forestal, Articles 46, 48 and 49). 3).- The Ley de Uso, Manejo y Conservación de Suelos (No. 7779 of April 30, 1998) is fundamentally important to the fulfillment of the economic, social, and environmental function of property. Its purpose is to achieve the sustainable management, conservation, and restoration of soils, integrated with other natural resources, by securing more active participation from communities and producers and promoting the implementation and oversight of improved practices within land-use systems to prevent erosion and degradation of the resource. Agroecology (agroecología) is proposed as a means of achieving convergence between the objectives of agricultural production and the conservation of soil and water resources.

The Law establishes a set of agro-environmental restrictions to achieve the stated objectives: In critical areas of watersheds or sub-watersheds (where degradation of the soil and its surroundings is severe enough to restrict any activity), whether publicly or privately owned, landowners must mandatorily implement all measures and practices necessary for soil restoration and the preservation of the environment in general. Every allocation of land made by the Instituto de Desarrollo Agrario shall be subject to the restriction that the use of the land may not be contrary to its land-use capability, noncompliance with which shall constitute grounds for revocation.

The obligations established for private individuals include, among others:* Promoting, contributing to, and implementing all practices and activities necessary for soil management, conservation, and restoration (manejo, conservación y recuperación de suelos); monitoring and overseeing compliance with soil legislation is both a right and an obligation; preventing soil degradation that may be caused by water, for which purpose all practices that increase the infiltration capacity of their land or the drainage of excess water into natural watercourses must be implemented; preventing or impeding the contamination of aquifers and groundwater layers; and allowing authorized technical personnel to enter in order to verify that soil-management, conservation, and restoration practices are being maintained. 4) The foregoing are perhaps the most important restrictions established by the Legislature to ensure fulfillment of the environmental function of property (función ambiental de la propiedad).

The regulations implementing the Ley sobre Uso, Manejo y Conservación de Suelos (No 29375-, MAG-MINAE-S-HACIENDA-MOPT) contain, in Title IV, “Punishable Acts,” Chapter III, “Agrarian Jurisdiction,” under which the agrarian judge is granted sufficient authority to request, in any proceeding, a soil-and-water use and management study (estudio de uso y manejo de suelos y aguas), providing that “If noncompliance is demonstrated, regardless of the outcome of the proceeding, the judge shall order the noncompliant parties, within the period granted for that purpose, to bring their activities and practices into conformity with the soil-management plans...” (Article 159); furthermore, “...the judge may order the agricultural operator (empresario agrario) to adopt the measures established for that purpose by the National Plan, the Area Management Plan, or, where applicable, the study specifically addressing the use, management, and conservation of soil, water, and roads for the farm or micro-watershed in question....” (Article 161).

If those directives are not complied with through the implementation of soil-management practices in accordance with the technology approved for that purpose, the application for possessory title proceedings (información posesoria) must be denied.” TRIBUNAL AGRARIO, Voto No. 616-f-2010 de las once horas cincuenta y un minutos del veintinueve de junio de l dos mil diez.-* * * * * * * * * * * * * V.-* In this specific case, the Court observes that the applicant for title (titulante) submitted the Land-Use Certification (Certificación de Uso de Suelo) (folios 117 to 118), which indicates that conforming land use (uso conforme del suelo) has been exercised in sector C of the property, whose current use is “marshland” (ciénaga), and which, according to the aforementioned evidence, was determined to be a wetland (humedal). Nevertheless, the analysis of the Ecological Assessment (Evaluación Ecológica) of a section of [Dirección3], at folios 349 to 378, specifically the recommendations at folio 375, provides a series of recommendations consisting of: “... proper sectorization of the area by an agricultural professional, since it was found that there are sectors unsuitable for cultivating oil palm or for the customary management of that crop, with particular consideration given to the flooded area.

Viable agricultural options that are better adapted to the wetland soil conditions in different sectors of the site should be sought. More environmentally friendly management of agricultural crops adapted to the site conditions must be implemented, because there is a high risk that chemical products and poor agricultural practices will degrade the quality of the site’s waters and the environments associated with them. It is recommended that at least 10 meters of the protection zone (zona de protección) and water bodies (cuerpos de agua) at the site be respected, in order to create a buffer zone against any practice that could affect the water resource (recurso hídrico).” * Despite the foregoing, the court below (a-quo) did not issue any recommendation or warning to the applicant for title regarding compliance with the recommendations and verification thereof through the submission of a new Soil Study (Estudio de Suelos).

In view of the foregoing, as the Court has ruled on other occasions (See Voto No. 87-F-10 de las 15:53 horas del 29 de enero del 2010 and the aforementioned Voto No. 616-F-2010 de las once horas cincuenta y un minutos del veintinueve de junio de l dos mil diez), the appropriate course is to VACATE the appealed judgment because it was issued prematurely, given that the Court cannot perform the role of the trial judge, who must verify compliance with agro-environmental regulations (normativa agroambiental) and order such measures as the judge deems appropriate for that purpose. * * * * * * * * * * * * * VI.- For the reasons stated, pursuant to Article 26 of the Ley de Jurisdicción Agraria and Article 34, subsection e), of the Reglamento de Catastro Nacional, the judgment must be declared void as premature. Before it is issued, the following shall be done: 1.- The petitioner (promovente) shall be granted a reasonable period of two months to submit a new survey plan (plano) of the property to be registered, showing the existence of the wetland on the land. 2.- The court below shall take the necessary measures to verify the technical recommendations set forth in the Ecological Assessment of a section of the Km31 property, at folios 349 to 378.

SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las quince horas y cincuenta y cuatro minutos del veinticuatro de febrero de dos mil dieciséis.-* * * * * * * * * * * * * INFORMACIÓN POSESORIA promovida por SUCESIÓN DE [Nombre1] , cédula de identidad número CED1 - - ; representado por su albacea [Nombre2] , cédula de identidad número CED2 - - , vecina de Golfito, quien cedió los derechos litigiosos a HORIZONTES DE ALAJUELA SOCIEDAD ANÓNIMA, cédula jurídica número CED3 - - , representada por su apoderado generalísimo sin límite de suma [Nombre3] , mayor, casado, empresario, vecino de Alajuela, cédula de identidad número CED4 - - ; quien a su vez cedió sus derechos litigiosos a CIRO DEL PACIFICO SOCIEDAD ANÓNIMA, cédula jurídica número CED5 - - , representada por su apoderado generalísimo sin límite de suma [Nombre4] , mayor, viudo, empresario, vecino de Quepos, cédula de identidad número CED6 - - .

Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por la procuradora adjunta Lydiana Rodríguez Paniagua, de calidades desconocidas en autos; y el INSTITUTO DE DESARROLLO RURAL, cédula jurídica número CED7 - - - , representada por su apoderada general judicial Carmelina Vargas Hidalgo, mayor, divorciada, abogada, vecina de Guachipelín de Escazú, cédula de identidad número CED8 - - , carné número cinco mil trescientos setenta y dos. Actúa como apoderado especial judicial del promovente cesionario el licenciado Oscar Humberto Segnini* Saborío, cédula de identidad número CED9 - - , colegiado número catorce mil trescientos dieciséis. Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur, Corredores.-* RESULTANDO:* * * * * * * * * * * * * * 1.-* La parte promovente interpuso las presentes diligencias de información posesoria para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad el terreno que se describe así: "Terreno para agricultura y siembra de pasto, el cual colinda al Norte con la línea férrea; y la sucesión de [Nombre5] , al Sur con la Sucesión de [Nombre5] , al Este con [Nombre6] y [Nombre7] , Oeste [Nombre8] , situado en [Dirección1] [Dirección2] , , del cantón Sétimo Golfito, de la provincia de Puntarenas, con una medida de ochenta y un hectáreas cinco mil doscientos treinta metros cuadrados con dieciocho centímetros, según el plano catastrado P seis seis* seis dos uno cero cero dos cero cero* cero." (folios 11 al 13 y 431).-* * * * * * * * * * * * * 2.- Mediante resolución de las quince horas con treinta minutos del veintidós de junio del dos mil nueve se tiene por operada la cesión de derechos que hace la albacea de la sucesión de [Nombre1] , en favor de Horizontes de Alajuela Sociedad Anónima, (folios 131 a 132).- * * * * * * * * * * * * * * * 3.- A su vez dicha sociedad cede sus derechos litigiosos y de posesión a Ciro del Pacífico Sociedad Anónima teniéndose por aceptada mediante resolución de las trece horas treinta minutos del veinticuatro de junio del dos mil catorce, (folio 423 frente y vuelto).-* 4* .- La Procuraduría General de la República se apersonó al proceso en los términos que corren en los folios 40 al 46; y e l Instituto de Desarrollo Rural lo hizo en los términos que corren a folio 47 sin oponer objeción alguna.-* * * * * * * * * * * * * 5* .- La jueza Marisel Zamora Arias, del Juzgado Agrario de l Segundo* Circuito Judicial de la Zona Sur, Corredores, mediante sentencia número 07-2015 de las quince horas con veintiocho minutos del veintisiete de enero del dos mil quince , resolvió: "POR TANTO: De conformidad con lo expuesto, se IMPRUEBAN, las diligencias de información posesoria promovidas por la sociedad CIRO DEL PACIFICO SOCIEDAD ANONIMA.", (folios 460 al 465).-* 6* .- El apoderado especial judicial de la sociedad promovente cesionaria Oscar Humberto Segnini* Saborío formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia , (folios 469 a 490).-* 7* .* - En la substanciación del proceso no se han observado las prescripciones legales, y se nota la existencia de errores u omisiones en el fallo capaces de producir su nulidad. -* Redacta el juez Picado Vargas; y,* CONSIDERANDO:* * * * * * * * * * * * * I. Se omite pronunciamiento acerca del elenco de hechos probados, dada la forma en que se resolverá en esta instancia-* * * * * * * * * * * * * II.

El apoderado especial judicial de la sociedad promovente Oscar Segnini* Saborío interpone recurso de apelación contra la citada resolución en los términos expuestos a folios 469 a 490.-* * * * * * * * * * * * * III. Este Tribunal encuentra dos errores en el procedimiento que devienen en que la sentencia sea anticipada y se cause estado de indefensión. El plano catastrado con el que se pretende titular el inmueble es violatorio del inciso e) del artículo 34 del Reglamento de Catastro Nacional de 16 de setiembre de 2008, conforme al cual, en el plano se debe hacer indicación gráfica y literal de cualquier accidente físico, tales como ríos, quebradas, lagunas, entre otros, en forma completa y no parcial. Del análisis del Informe Técnico sobre la Existencia de Humedal en el Inmueble Plano No. 662100-2000 a folios 280 a 299, específicamente en sus conclusiones a folio 290, así como de la Evaluación Ecológica de una sección de la [Dirección3] a folios 349 a 378 se determina concretamente un área de 137578,71 metros cuadrados destinados a humedal, los cuales no están graficados en el mencionado plano.

Incluso en la sentencia apelada, la a quo tiene por demostrado que se trata de un área de diez hectáreas, lo cual contradice dicho informe. La existencia del humedal se verificó de parte de este Tribunal con el reconocimiento judicial practicado a las ocho horas del 19 de febrero del 2016 (ver video en DVD) y del mismo reconocimiento judicial hecho por la a quo a folio 328. No obstante, el plano catastrado P-662100-2000 a folio 1 solo indica que el terreno es de potrero, arrozal y tacotal.* De acuerdo a la información en referencia, al existir en el inmueble un humedal, el plano catastrado debió describirla conforme a lo dispuesto en el artículo 34 inciso e) del Reglamento de Catastro Nacional. De ahí, estime el Tribunal, que la sentencia emitida en anticipada al haberse dictado en forma previa a que se cumpliera con todos los requisitos legales, entre ellos, el artículo 34 en referencia.

Ante tal omisión, lo procedente es prevenir el cumplimiento de ese requisito.-* * * * * * * * * * * * * IV.- Sobre el requisito de conservación de humedales este Tribunal ha estimado: "Las limitaciones agroambientales de la propiedad, alcanzan gran cantidad de aspectos en el ejercicio de actividades productivas y en el ámbito de la conservación de los recursos naturales, la Biodiversidad, el uso y conservación de suelos, la protección del bosque y los ecosistemas, el uso y control de los plaguicidas y productos de síntesis química, el control fitosanitario y sanitario animal y vegetal, los desechos agrícolas, la conservación de las aguas, la utilización y manejo de aguas residuales en agricultura, la recuperación de suelos y cuencas hidrográficas, etcétera. Dentro del contexto de los principios y valores constitucionales contenidos en los artículos 45 y 50 de la Constitución Política, comienza a dictarse gran cantidad de leyes agroambientales, que no solo marcan la consolidación de un modelo de desarrollo sostenible, sino que además, imponen una serie de limitaciones agroambientales a la propiedad y la libertad de empresa, buscando consolidar también una nueva cultura agraria y ambiental o ecológica. * * * * * 1) La Ley Orgánica del Ambiente (No. 7554 del 4 de octubre de 1995) establece la obligación del Estado de propiciar un desarrollo económico y ambiental sostenible, lo que implica, necesariamente imponer límites ambientales al ejercicio de las actividades económicas productivas y al ejercicio del derecho de propiedad.

Pero para que esos límites tengan una verdadera aplicación, es necesario un cambio cultural. De la cultura agraria tradicional, en donde solo importaba lo económico, debe pasarse a una cultura ambiental o agroambiental para el desarrollo sostenible (Ley Orgánica del Ambiente, artículos 12, 13, 14, 15 y 16). Entre los límites más importantes impuestos a la propiedad, para garantizar la función económica, social y ambiental, pueden destacarse los siguientes: A.- El ejercicio de toda actividad agroambiental, que pueda alterar o destruir elementos del ambiente, requiere necesariamente de una evaluación de impacto ambiental, cuya aprobación debe ser previa al proyecto. También se exige la evaluación cuando por obras o infraestructura puedan afectarse recursos marinos, costeros y humedales. B.- El ordenamiento territorial, para equilibrar el desarrollo sostenible, implica la reubicación territorial de las actividades productivas, lo que podría significar límites importantes al derecho de propiedad, pues deben tomarse en consideración, entre otros aspectos, los recursos naturales, las actividades económicas predominantes, la capacidad de uso de los suelos y la zonificación por productos y actividades agropecuarias, en razón de consideraciones ecológicas y productivas.

C- El Poder Ejecutivo está facultado para incluir dentro de las áreas silvestres protegidas las fincas de particulares necesarias para el cumplimiento de la función ambiental, o crear las servidumbres legales para la protección ecológica. En los casos donde la Ley exija indemnización, los particulares pueden someterse voluntariamente al régimen forestal, caso en el cual la propiedad queda afectada en el Registro Público (Ley Orgánica del Ambiente, artículo 37). D.- Están prohibidas las actividades orientadas a interrumpir los ciclos naturales de los ecosistemas de humedales, que puedan provocar su deterioro y la eliminación (Ley orgánica del Ambiente, artículo 45). E.- Las actividades productivas deben evitar la contaminación del agua, dar tratamiento a las aguas residuales, impedir o minimizar el deterioro o contaminación de cuencas hidrográficas, así como del suelo. F.- La agricultura orgánica, como forma de ejercicio de actividades agrarias sostenibles, implica una forma de cumplimiento de la función económica, social y ambiental, pues se exige una certificación ambiental de los productos orgánicos que se hayan obtenido sin aplicar insumos o productos de síntesis química (artículos 73-75).

G.- El crédito ambiental: está destinado a financiar los costos de reducción de la contaminación en procesos productivos. Cuando implican el uso del suelo se requiere un plan de manejo y uso de tierras de conformidad con la capacidad de uso (Ley Orgánica del Ambiente, artículo 113). Indudablemente, la estructura de la propiedad y su función está condicionada, en este caso por el elemento ambiental, requerido en el ejercicio empresarial. 2) La Ley Forestal (No. 7575 de 5 de febrero de 1996, reformada por leyes No. 7609 de 11 de junio de 1996, 7761 de 2 de abril de 1998 y 7788 de 30 de abril de 1998), orientada por los principios constitucionales de uso adecuado y sostenible de los recursos naturales renovables, establece regulaciones en cuanto a la conservación, protección y administración de los bosques naturales, y por la producción, aprovechamiento, industrialización y fomento de los recursos forestales, buscando la incorporación de los particulares al ejercicio sostenido de actividades silviculturales.

Si bien es cierto, el MINAE está facultado para crear áreas silvestres protegidas en terrenos privados, ello requiere indemnización, salvo que el propietario decida someterse voluntariamente al régimen forestal, o sean ya propiedad del Estado, dentro de su patrimonio de Reservas Nacionales. La Ley prevé dos claros límites, en interés de las áreas protegidas: a: “Tratándose de reservas forestales, zonas protectoras y refugios de vida silvestre y en caso de que el pago o la expropiación no se haya efectuado y mientras se efectúa, las áreas quedarán sometidas a un plan de ordenamiento ambiental que incluye la evaluación de impacto ambiental y posteriormente, al plan de manejo, recuperación y reposición de recursos.” (Ley Orgánica del Ambiente, artículo 37, en relación con el artículo 2 de la Ley Forestal. Dicha reforma fue introducida por la Ley de Biodiversidad, en el artículo 14). Lo cual constituye un claro límite para el cumplimiento de la función ambiental de la propiedad.

B.“Cuando, previa justificación científica y técnica de interés público, se determine mediante ley que el terreno es imprescindible para conservar la diversidad biológica o los recursos hídricos, quedará constituida una limitación a la propiedad que impedirá cortar árboles y cambiar el uso del suelo. Esta restricción deberá inscribirse como afectación en el Registro Público.” (Ley Forestal, artículo 2 párrafo segundo). Como se observa, no se trata de un límite irrazonable. Por el contrario el propietario podría ejercer su actividad siempre y cuando sea compatible con la función ambiental que, por naturaleza, viene asignada al inmueble, para conservar recursos hídricos o diversidad biológica. El Título III de la Ley, referido a la propiedad forestal privada, como propiedad especial, establece un conjunto de derechos y obligaciones para los propietarios de bosques que condicionan el cumplimiento de la función ambiental, atendiendo a la naturaleza del bien:* a) No es permitido a los titulares cambiar el uso del suelo, ni establecer plantaciones forestales.

Sin embargo, la Administración Forestal del Estado puede otorgar permiso para realizar obras complementarias a la actividad agroforestal, siempre y cuando la corta del bosque sea limitada, proporcional y razonable (Ley Forestal, artículo 19. Cuando sea necesario, se exigiría evaluación de impacto ambiental); b) El aprovechamiento del bosque solo se puede realizar si el propietario cuenta con un plan de manejo que contenga el impacto que pueda ocasionar al ambiente, según criterios de sostenibilidad científica; c) El pago por servicios ambientales (La Ley define los servicios ambientales como:* “Los que brindan el bosque y las plantaciones forestales y que inciden directamente en la protección y el mejoramiento del medio ambiente. Son los siguientes: mitigación de emisiones de gases efecto invernadero (fijación, reducción, secuestro, almacenamiento y absorción), protección del agua para uso urbano, rural o hidroeléctrico, protección de la biodiversidad para conservarla y uso sostenible, científico y farmacéutico, investigación y mejoramiento genético, protección de ecosistemas, formas de vida y belleza escénica natural para fines turísticos y científicos.), constituye una de las manifestaciones más modernas de ejercicio de la función ambiental, pues el propietario se compromete a conservar el bosque por un período no inferior a los veinte años, para recibir el Certificado de Conservación del Bosque.

También lo recibe los propietarios que deseen someter su inmueble a la regeneración del bosque, para áreas que por su estado deteriorado y necesidades ambientales, deben convertirse al uso forestal. Las afectaciones y limitaciones, así como los incentivos se inscribe en el Registro Público como afectación a la propiedad; d) Las plantaciones forestales, incluidos sistemas agroforestales y árboles plantados individualmente, no requieren permiso de corta, transporte, industrialización ni exportación, salvo cuanto exista plan de manejo derivado de un contrato forestal con el Estado; e) Todo propietario tiene prohibiciones de cortar o eliminar árboles en las áreas de protección establecidas por Ley para las nacientes permanentes, ríos, lagos y manantiales (Ley Forestal, artículo 33 y 34.). f) Está prohibido realizar quemas en terrenos forestales, ni aledaños, sin obtener el permiso respectivo de la Administración Forestal del Estado; g) Como parte de la función ambiental, los inmuebles sometidos voluntariamente al régimen forestal o dedicados a esa actividad, gozan de una protección especial respecto de invasiones, pudiendo solicitar la protección inmediata de las autoridades de policía; h) El crédito forestal, se consolida como instituto para financiar a pequeños y medianos productores, mediante créditos y otros mecanismos de fomento del manejo de bosques, procesos de reforestación, viveros forestales, sistemas agroforestales, recuperación de áreas desnudadas.

El financiamiento comprende, además, el pago de los servicios ambientales que brindan los bosques y plantaciones forestales. La tierra con bosque y los árboles en pie servirán como garantía de dichos créditos, quedando anotadas como afectaciones a la propiedad (Ley Forestal, artículos 46, 48 y 49). 3).- La Ley de Uso, Manejo y Conservación de Suelos (No. 7779 de 30 de abril de 1998), es de fundamental importancia para el cumplimiento de la función económica, social y ambiental de la propiedad. Se pretende lograr el manejo, conservación y recuperación de suelos en forma sostenible, integrada con los demás recursos naturales, logrando una participación más activa de las comunidades y los productores, e impulsando la implementación y control de prácticas mejoradas en los sistemas de uso, para evitar la erosión y degradación del recurso. Se plantea la agroecología, como una forma de lograr la convergencia entre los objetivos de la producción agrícola y la conservación de los recursos suelo y agua.

La Ley plantea un conjunto de limitaciones agroambientales, para lograr cumplir con los objetivos señalados: En áreas críticas de cuencas o subcuencas (con gravedad en degradación del suelo y su entorno, como limitante a cualquier actividad), sean de dominio público o privado, los dueños de terrenos deben aplicar forzosamente todas las medidas y prácticas que conlleven la recuperación del suelo y preservación del ambiente en general. Toda adjudicación de terrenos que realice el Instituto de Desarrollo Agrario, tendrá como limitación que el uso del terreno no puede ir en contra de su capacidad de uso, cuyo incumplimiento se convierte en causal para revocarla. Como obligaciones de los particulares se establecen entre otras:* Fomentar, contribuir y ejecutar todas las prácticas y actividades necesarias para el manejo, conservación y recuperación de suelos; es un derecho obligación vigilar y controlar el cumplimiento de la legislación en materia de suelos; prevenir la degradación de los suelos que pueda ser causada por las aguas, para lo cual deberán aplicarse todas las prácticas que aumenten la capacidad de infiltración en sus terrenos o la evacuación de aguas sobrantes hacia cauces naturales; prevenir o impedir la contaminación de acuíferos y capas de agua subterránea; permitir el ingreso de técnicos autorizados para verificar el mantenimiento de las prácticas de manejo, conservación y recuperación de suelos. 4) Quizás se han mencionado las limitaciones más importantes, establecidas por el Legislador, para el cumplimiento de la función ambiental de la propiedad.

El reglamento a la Ley sobre Uso, Manejo y Conservación de Suelos (No 29375-, MAG-MINAE-S-HACIENDA-MOPT), contiene en el Título IV "De las acciones punibles", el capítulo III "De la Jurisdicción Agraria", en la cual se le otorgan suficientes poderes el juez agrario, para solicitar en cualquier proceso un estudio de uso y manejo de suelos y aguas, disponiéndose que "En caso de que se demostrare incumplimiento, indistintamente del resultado del proceso, deberá ordenar a las partes incumplientes que dentro del plazo que se otorgará al efecto, procedan a adecuar su actividad y prácticas a los planes de manejo del suelo..." (artículo 159) además, "...podrá ordenar que el empresario agrario adopte las medidas que a ese efecto establezca el Plan Nacional, el Plan de Manejo del Área o en su caso el estudio de uso manejo y conservación de suelos, aguas y caminos específico para la finca o la microcuenca que se trate...." (artículo 161), en el caso de que no se cumplan dichas prevenciones, cumpliendo con las prácticas de manejo de suelos de acuerdo con la tecnología aprobada al efecto, debe denegarse el trámite de la información posesoria." TRIBUNAL AGRARIO, Voto No. 616-f-2010 de las once horas cincuenta y un minutos del veintinueve de junio de l dos mil diez.-* * * * * * * * * * * * * V.-* En este caso concreto, observa el Tribunal, que el titulante presentó la Certificación de Uso de Suelo (folios 117 a 118), en la cual se indica que se ha ejercido el uso conforme del suelo en el sector C del inmueble cuyo uso actual es de "ciénaga" y que de acuerdo con la prueba mencionada se determinó es un humedal.

No obstante, del análisis de la Evaluación Ecológica de una sección de la [Dirección3] a folios 349 a 378, específicamente en las recomendaciones de folio 375, se dan una serie de recomendaciones consistentes en: "... una adecuada sectorización del área de parte de un profesional en área agrícola, ya que se consideró que hay sectores que no son aptos para el cultivo de la palma aceitera ni el manejo habitual de dicho cultivo, considerar principalmente el área anegada. Se deberían de buscar opciones agrícolas viables que se adapten mejor a las condiciones de humedal del suelo en diferentes sectores del sitio. Es necesario implementar un manejo más amigable con el ambiente d elos cultivos agrícolas que se adapten a las condiciones del sitio, lo anterior debido a que existe un alto riesgo de que productos químicos y malas prácticas agrícolas deterioren la calidad de las aguas del sitio y los ambientes asociados a estas.

Se recomienda respetar al menos 10 metros de la zona de protección y cuerpos de agua en el sitio, lo anterior para generar una zona de contención de cualquier práctica que pueda afectar el recurso hídrico." * Pese a lo anterior, la a-quo no hace ninguna recomendación o prevención al titulante para el cumplimiento de las recomendaciones y la verificación de su cumplimiento, mediante la aportación de un nuevo Estudio de Suelos. En razón de lo expuesto, como lo ha resuelto el Tribunal en otras oportunidades (Ver Voto No. 87-F-10 de las 15:53 horas del 29 de enero del 2010 y el citado Voto No. 616-F-2010 de las once horas cincuenta y un minutos del veintinueve de junio de l dos mil diez ), lo procedente es ANULAR, la sentencia apelada, por haberse dictado de manera anticipada, dado que el Tribunal no puede suplir la labor del juzgador de instancia, quien debe verificar el cumplimiento de la normativa agroambiental y dictar las medidas que considere oportunas para ello. * * * * * * * * * * * * * VI.- Por lo expuesto, con fundamento en los artículo 26 de la Ley de Jurisdicción Agraria y 34 inciso e) del Reglamento de Catastro Nacional, deberá declararse la nulidad de la sentencia por anticipada.

En forma previa a su emisión, deberá: 1.- Otorgarse a la promovente el plazo prudencial de dos meses para que proceda a presentar un nuevo plano del inmueble a inscribir, que grafique la existencia del humedal en el terreno. 2.- Deberá al a-quo tomar las medidas necesarias para la verificación de las recomendaciones técnicas vertidas en el Evaluación Ecológica de una sección de la finca Km31 a folios 349 a 378. Lo anterior, deberá ordenarlo bajo apercibimiento de que en caso de incumplimiento, se resolverá con la prueba constante en autos.-* POR TANTO:* * * * * * * * * * * * * Se anula la sentencia por anticipada.
