ADMINISTRATIVE LITIGATION COURT, SIXTH SECTION, SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at ten hours on siete de abril del dos mil catorce.
Proceeding based solely on questions of law brought by Mr. Nombre136693, holder of identity card number CED108335, against the entity known as Argon Transport S.A., legal-entity identification number CED79286, represented by its president, Mr. Nombre103292, identity card number CED108336; Junta Administrativa Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), represented by its special litigation counsel (apoderado especial judicial), Mr. Cristopher Fuentes Ballestero, identity card number CED108337; Sistema Nacional de Áreas de Conservación (SINAC), represented by its Executive Director, Mr. Nombre14488, identity card number Placa25367; and the State, represented in this proceeding by Nombre71802, identity card number CED239.
FINDINGS OF FACT (RESULTANDO):
16- In the proceedings before this Court, no procedural nullities (nulidades) requiring correction have been identified, and the judgment is issued within the fifteen-business-day period established for that purpose by Articles 98.2 of the Administrative Litigation Procedure Code and 82.4 of the Autonomous Regulations on the Organization and Operation of the Administrative Litigation and Civil Treasury Jurisdiction (Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda).

CONSIDERING
I.Regarding the admission of the evidence offered at the preliminary hearing. At the procedural hearing held on 13 de noviembre del 2013, counsel for Nombre415 offered as documentary evidence (prueba documental) a copy of official letter AL-219-2012-SJ dated 12 de octubre del 2012, issued by JAPDEVA’s Legal Department. At that stage, pursuant to Article 50 of the Administrative Litigation Procedure Code, the presiding judge reserved the issue of the admission of this item of evidence for determination in the judgment. The cited Article provides: “1) After the complaint and answer have been filed, no further documents shall be admitted, except: a) Those dated after those pleadings. b) Those that could not previously have been submitted for reasons not attributable to the interested party. c) Those that, while not forming the basis of the complaint, serve to rebut defenses raised by the defendant or constitute supplementary evidence. 2) Documents submitted after the complaint and answer and before the conclusion of the preliminary hearing shall be served on the opposing party, which shall have three business days to respond; their admissibility shall be decided in the judgment.
Documents submitted after that hearing may be assessed by the adjudicative body only if admitted as evidence to facilitate adjudication (prueba para mejor resolver).” Nombre415 answered the complaint on 23 de agosto del 2012, as may be seen beginning at page 159 of the main case file. Because the documentary evidence is dated 12 de octubre del 2012, this Court finds that it falls within the factual circumstances governed by subsection (a) of paragraph one of that provision. Moreover, it concerns an issue related to the ownership of the land on which Argon Transport S.A.’s property is located, a matter relevant to this judicial dispute in light of the parties’ allegations; it is therefore also relevant evidence. Accordingly, this panel finds that the evidence must be admitted. Although the cited Article 50.2 of the CPCA states that admissibility is to be decided in the judgment, this Chamber finds that this does not prevent the parties, once the evidentiary item has been submitted, from using it in presenting their arguments.
Otherwise, if the provision were understood to mean that evidence may not be used until it has been admitted, the principles of adversarial proceedings (principio de contradictorio) and substantive defense (defensa material) would be infringed. Thus, in cases where that provision applies, the evidence must be deemed incorporated into the proceedings and may be used or referenced by the parties as part of the theory of the case they present to the Court. That opportunity was not impaired in these proceedings, because the parties had access to this evidence, as it was disclosed to those present at the hearing, thereby safeguarding adversarial proceedings and due process (debido proceso). The evidence is therefore admitted for the corresponding procedural purposes.
II.Proven facts (hechos probados). The following are relevant to the resolution of these proceedings:
which is currently filled with granular material (lastre), with the area estimated at 7.91 ha; likewise (sic), it was determined that a section of said property measuring 0.15 ha is located within lands classified as Humedal Zona Caribe Central, according to the information recorded in the 2008 Wetlands layer. Using the submitted cadastral plans L-901560-2004 and L-491099-98, the polygons of said properties were digitized in accordance with the boundary descriptions indicated in those cadastral plans, using specific physical control points corresponding to the GPS readings obtained during the previous inspection of the property in question. (...)” In view thereof, it concluded that Nombre3456 was responsible for evaluating the reported acts concerning the alleged offense of damage within a stream protection area (área de protección) and construction on the Yolillo wetland resulting from activities carried out at Argon’s container-storage site.
As a preventive measure, it ordered the preventive suspension and/or stoppage of all activities, works, and actions specifically connected with expansion of the area of the aforementioned site involving fill (relleno) with granular material (lastre), construction, remodeling, and relocation of infrastructure, on a temporary basis until Nombre3456 issues its determination. (Pages 243-247 of the judicial case file, 151-160 of the precautionary-measures file) 14) The report cited in the preceding section includes a quantification of environmental damage (daño ambiental), as detailed below. It concludes that the economic valuation concerns the environmental damage caused on lands classified as wetlands, using the Geographic Information System, which made it possible to determine that 0.15 hectares of Argon’s container-storage site had been filled with granular material within lands classified as Humedal Zona Caribe Central.
The Economic Assessment of Environmental Damage in Costa Rica methodology—developed by Nombre7991 and Nombre136695 (2002)—was used. Regarding compensation for environmental harm (lesión ambiental), the value of lost benefits was set at ¢244.123.20 (two hundred forty-four thousand one hundred twenty-three colones and twenty céntimos); administrative costs were set at ¢535.200.00 (five hundred thirty-five thousand two hundred colones), for a total economic value of ¢779.323.20 (seven hundred seventy-nine thousand three hundred twenty-three colones and twenty céntimos). Likewise, regarding restoration costs (costos de recuperación), it was stated that restoration of the site was necessary because the site had to be prepared for natural regeneration so that it could return to its initial state of conservation. The report explains that, given the site’s characteristics, its restoration must be ensured; this is feasible through natural regeneration if some soil amendment is undertaken, since the organic soil layer was affected.
It deemed a monitoring plan by the Forestry Administration necessary to verify that the area remains unaltered. (Pages 248-259 of the principal case file) 15) Official letter ACLAC-PNE-OT-048-2011 dated 04 de noviembre del 2011, issued by Área de Conservación La Amistad Caribe concerning the geographic location of the property in the province of Limón, real-property folio registration Placa25380, states, insofar as relevant: “It was thus determined that a section of the property described in cadastral plan Placa25378, measuring 3.42 hectares of the total area stated in that plan, is located within land classified as Humedal Zona Caribe Central, according to the information recorded in the 2008 wetlands layer (Atlas Digital 2008)....” (Pages 143-150 of the precautionary-measures record) 13) Inspection notices Nos. 2766 and 2767, dated 26 de mayo del 2011 and 21 de junio del 2011, respectively, ordered the closure of the expansion and improvement works carried out at the container site of Argon Transport S.A. (Pages 234-235 of the precautionary-measures record) 16) By an inspection record prepared at 12:50 p.m. on 11 de noviembre del 2011 by Área de Conservación La Amistad Caribe of SINAC, Argon Transport S.A. was ordered to preventively suspend and/or halt all activities, works, and actions specifically connected with expansion of the ARGON container-storage site involving fill with granular material (lastre), construction, remodeling, and relocation of infrastructure, on a temporary basis until Nombre3456 issues its determination.
(Pages 212-213 of the precautionary-measures file) 17) In a site-closure report dated 11 de octubre del 2011, the Technical and Studies Unit of Municipalidad de Limón states that on that date it closed the Argon Transport S.A. site for the fourth time, using notice No. 0702 from the engineering department, because of the failure to comply with the report dated 30 de mayo del 2011, official letter UT-417-2011, official letter UT-463-2011, and notice No. 2994 dated 05 de septiembre del 2011. The report recommends filing a complaint with the Ministerio Público for disobedience of the law, violation of official seals, and continuation of the works. It further recommends initiating the administrative proceeding established in Articles 93, 94, 96, and 98 of the Ley de Construcciones. (Pages 214-215 of the precautionary-measures file)
The Protection Area facing north (area of influence, 0.86 ha) contains no fill of any kind of material and is suitable for planned recovery and restoration activities with the least impact generated and the shortest recovery time...." (Pages 370-375 of the precautionary-measures case file)
III.Unproven facts. The following are relevant to the resolution of this matter: 1) That the plaintiff filed a formal complaint with SINAC regarding the works and activities carried out on the Argon property, which is the subject of this case, before filing the action. (This fact has not been established.) 2) That, upon learning of what had occurred on the Argon property in Limón, SINAC engaged in administrative inaction or neglected the case. (This cannot be inferred from the record.) 3) That Nombre415 engaged in omissions that resulted in environmental damage to the Argon property. (This fact is not in evidence.)
IV.Subject matter of the proceeding. This action seeks a judgment holding both Nombre415 and SINAC liable for their omissions in failing to take the legal measures necessary to halt the actions of ARGON TRANSPORT S.A. that caused the damages established in the record, in accordance with the environmental damage assessment performed by SINAC itself. The plaintiff seeks a declaration that ARGON TRANSPORT S.A. is liable for the environmental damage caused by the illegal structures it erected on its property. Likewise, the plaintiff seeks an order for the immediate demolition of the works carried out by ARGON TRANSPORT S.A. on the specified land, because it is a wetland (humedal), and an effort to restore the damaged ecosystem, for which SINAC must provide the technical assistance necessary for its rehabilitation. The plaintiff requests payment of ¢779.323.20 (seven hundred seventy-nine thousand three hundred twenty-three colones and twenty céntimos). The Court will now analyze the relief sought and the defenses raised, taking into account the various arguments presented by the parties during the different stages of this judicial proceeding.
V.Ownership (dominio) of the area where the Argon property is located. The first matter to be clarified in this dispute concerns ownership of the tract of land on which the container yard operated by Argon Transport S.A. is physically located. This is because the plaintiff asserts that the property forms part of the lands assigned to that public entity by Ley No. 5337, Ley Orgánica de Japdeva. In the claimant’s view, such ownership means that these are public-domain assets (bienes demaniales), which cannot be subject to any prescription (prescripción), and the demolition of the structures must therefore be ordered. This issue is decisive in determining whether the respondent entity is entitled to exercise acts of possession and, generally, powers of disposition over that property by virtue of its ownership thereof. Nevertheless, it should be clarified that ownership of the real property does not in any way release the owner from compliance with the restrictions imposed by environmental rules, given the environmental—or ecological—function of property established by the Ley Orgánica del Ambiente (No. 7554), which means that the owner must use and dispose of the property in harmony with those provisions.
In this regard, Argon Transport S.A. is the registered owner of the property in the Limón district, real-property folio registration Placa25368, located at Dirección13525 , . That property is located across from Dirección16370 in Limón, Nueve Millas, Limón 2000. Its chain of title derives from the properties bearing real-property folio registrations Placa25369, Placa25370 and Placa25371, and it originated from property Placa8165, first recorded in the Public Registry on 08 de julio de 1982, and property Placa25372, recorded on 11 de mayo de 1987. The property is depicted on cadastral survey plan number L-901560-2004, subsequently amended by plan 7-1122647-2007 (Pages 44-45, 339-345 of the court record). It has also been established that the property in the Limón district, real-property folio registration Placa20219, is registered in the name of Nombre415 pursuant to Ley No. 3091 del 18 de febrero de 1963, reproduced in full by the Ley Orgánica de Nombre415, No. 5337 del 27 de agosto de 1973, and in accordance with cadastral survey plan number L-000001-1977.
As an initial proposition, it bears repeating that property Placa25368 is clearly located within the area of property Placa7705, both in the Limón district. However, as has been established, the registration of the property owned by Argon Transport S.A. preceded the registration of the property owned by Nombre415; consequently, the ownership right held by that private entity over the referenced property must prevail. This is a title that was duly registered at the proper time, and no evidence has been submitted establishing its nullity, nor has a declaration invalidating that registration been requested. It must therefore prevail in order to protect rights acquired in good faith. Indeed, it should be emphasized that the priority of registrations predating the titling of Nombre415’s land was expressly noted in the deed by which the State transferred those lands to that public entity. Specifically, in the deed executed by the State Notary at 10 hours on 08 de junio del 2001, the State, pursuant to paragraph 41(b) of Ley No. 5337, transferred unregistered lands located in Limón, Alajuela and Heredia to Nombre415 free of charge, with an area of 132 ha 7.150 m2 (one hundred thirty-two hectares, seven thousand one hundred fifty square meters).
That deed included the proviso that “...all titles issued prior to this transfer for properties in the same location shall remain legally valid, provided that they complied with statutory requirements.” That instrument was recorded in volume 491, entry 12355, on 28 de junio del 2001. (Pages 260-266 of the court record.) Although it has been established that the two properties overlap, in response to a request from Argon Transport, official letter PE-747-2012 del 17 de octubre del 2012 from the Executive Presidency of Nombre415 informed the requesting entity that its property had been registered in the Public Property Registry before the creation of Nombre415’s property, registered under real-property folio 7-09958-000. In that regard, it stated: “It has previously been indicated that all properties registered before Nombre415’s property came into existence in 2001 must have their prior registrations respected, consistent with the legal principle known as ‘first in time, first in right,’ as the State Notary, Licda. Gladys Herrera Raven, herself stated when she drafted deed No. 132 at ten hours on the eighth day of June of the year 2001.
Therefore, legal title to that property belongs to ARGON TRANSPORT S.A., as is evident from the registration certificates issued by the entity responsible for registering properties in Costa Rica. (...)” (Pages 405-406 of the principal record.) Similarly, official letter AL-219-2012-SJ de fecha 12 de octubre del 2012 from JAPDEVA’s Legal Department, sent to the Executive Presidency of that public entity, provided a legal report analyzing whether Argon Transport S.A.’s property was located within JAPDEVA’s lands. In its conclusions section, the report states: “CONCLUSION: By way of conclusion, we must indicate that the certificates issued by the National Registry have demonstrated that the properties identified above belong to their lawful owner, EMPRESA ARGON TRANSPORT S.A., because they were acquired in the years 1982, 1986 and 1987; that those properties were registered before the lands granted to JAPDEVA were registered; and that those registrations are governed by the well-known legal principle of ‘first in time and first in right,’ as the State Notary at the time, Licenciada Gladys Herrera Raven, recorded when she stipulated that deed No. 132 was executed without prejudice to third parties with superior rights.
(...)” (Pages 503-510 of the principal record.) Accordingly, for purposes of this proceeding, Nombre415 has acknowledged the priority of the co-respondent entity’s duly registered ownership right. That entity must therefore be deemed the lawful owner of the property in the Limón district, real-property folio registration Placa25380, and thus of the container-storage property at issue.
VI.Impact on a wetland zone (zona de humedal). Geographic delimitation. Having determined ownership of the physical area in which the Argón property is located, it is now necessary to establish whether that land forms part of a wetland zone, in order to determine whether human actions have caused environmental harm to that ecosystem. In this case, it has been established that on the property owned by Argon Transport S.A., real-property registration number (matrícula de folio real) Placa25373, that company carried out works consisting of container hookups, as well as walls and fill, without having environmental approval (viabilidad ambiental) or an environmental license (licencia ambiental), or the construction permits required for such purposes. By official letter SINAC-ACLAC-PNE-C-017-2011, issued at 12:00 hours in January 2011 (the exact day is not specified), the Área de Conservación La Amistad Caribe of SINAC issued a certification stating, in relevant part: “...based on the location recorded in Cadastral Survey Plan Number L-901560-2004 (139492.45 m2), real-property record No. 7029736-000, Placa25375 and Placa25376, it has been determined that... it describes a property located OUTSIDE ANY PROTECTED WILDLIFE AREA, REGARDLESS OF ITS MANAGEMENT CATEGORY, ADMINISTERED BY THE SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
HOWEVER, THE PROPERTY DESCRIBED IN THE AFOREMENTIONED PLAN IS LOCATED WITHIN THE BOUNDARIES OF JAPADEVA (sic) PATRIMONIAL LANDS, ACCORDING TO PLAN No. L-01-1977, REAL-PROPERTY REGISTRATION No. Placa25377. The foregoing applies provided that the cartographic location recorded in the plans at issue corresponds to an accurate location on the ground. ...” (Page 320 of the main case file). Thus, as an initial proposition, it was established that the area encompassed by plan L-901560-2004 was not within wetland areas. However, through report ACLAC-PNE-OT-037-2011 dated October 19, 2011, the Área de Conservación La Amistad Caribe of the Sistema Nacional de Áreas de Conservación issued a report on the inspection conducted by that administrative unit at the container-storage property of Argon Transport S.A. and on the economic valuation of the environmental damage (daño ambiental). That report stated, insofar as relevant to these proceedings, that the property is enclosed on its western, eastern, and southern sides by wire mesh and covered with granular material or gravel fill (lastre).
It states that an unfinished wire-mesh installation can be seen in the eastern sector, with no personnel observed working to complete that mesh or carrying out filling activities. The report explains that along the eastern boundary of the ARGON S.A. Container Storage Property, physically marked by the wire mesh under construction, the existence of a protection area (área de protección) associated with a stream or creek was established based on the presence of fish in its channel. In the analysis section, that environmental authority determined: “The procedure made it possible to determine the area encompassed by the perimeter survey (levantamiento perimetral) of the ARGON S.A. Container Storage Property, which is currently filled with granular material (gravel fill), estimated at an area of 7.91 ha; it was likewise determined that a section of that property measuring 0.15 ha is located within lands classified as Humedal Zona Caribe Central according to the information recorded in the 2008 Wetlands layer.
Using the submitted cadastral survey plans (planos catastrados) L-901560-2004 and L-491099-98, the polygons of those properties were digitized in accordance with the metes and bounds (derroteros) shown on the indicated cadastral survey plans, using specific physical control points equivalent to the GPS readings obtained during the inspection previously conducted at the property in question. (...)” In light of this, it concluded that Nombre3456 was responsible for evaluating the reported acts concerning the alleged offense of damage within the creek’s protection area and construction on a yolillo palm wetland (humedal de yolillo) as a result of activities carried out on Argon’s container-storage property. As a preventive measure, it ordered the preventive suspension and/or stoppage of all activities, works, and actions specifically connected with expanding the area of the referenced property and involving filling with granular material (gravel fill), construction, remodeling, and relocation of infrastructure, on a temporary basis until a determination was issued by Nombre3456.
(Pages 243-247 of the court file and 151-160 of the precautionary-measures case file (expediente cautelar)). For purposes of determining whether the property in question was partially located within a wetland zone, the Área de Conservación La Amistad Caribe of SINAC submitted, through official letter ACLAC-GASP-RNVSL-001-2013 dated February 06, 2013, a technical report on the delimitation of the area of influence and the protection area of Humedal Zona Caribe Central. The site identification was conducted in coordination with Nombre136696, the administrator of the Argon property. It was determined that a section of the property described in cadastral survey plan L-901560-2004, measuring 2.52 hectares, is located within lands classified as Humedal Zona Caribe Central and that a 0.15-hectare section thereof has stone or granular material deposited on the surface. The conclusions section stated: “The digitized north-facing Protection Area (area of influence, 0.86 ha) contains no fill of any type of material, which facilitates the implementation of ecosystem restoration and recovery measures through natural regeneration and planned forest enrichment by introducing trees of specific native species, for example.
(...) the following conclusions are set forth: 1. Considering that national legislation establishes mechanisms for remediation of environmental damage through actions intended to foster or accelerate the recovery of altered ecosystems and habitats, recreating, to the extent possible, their original structure and function based on knowledge of prior conditions, which in this case have not been specified. Selecting the south-facing Protection Area, measuring 0.87 ha, for Recovery, involving the mechanized removal of stone material, potentially increases the Environmental Impact (Impacto Ambiental) on the soil and the recovery time. 2. The north-facing Protection Area (area of influence, 0.86 ha) contains no fill of any type of material and is suitable for planned recovery and restoration activities with the least resulting impact and the shortest recovery time....” (Pages 370-375 of the precautionary-measures case file)
VII.Based on the foregoing, this Court finds it proven that, of the property in the Limón registry district, real-property folio registration Placa25380, an area of 2.52 hectares is located within lands classified as the Central Caribbean Zone Wetland and that a section thereof, with an area of 0.15 hectares, has stony or granular material deposited on its surface. This can be seen in the topographic surveys contained at folios 371 to 373 of the main case file. Regarding the protection of wetlands, the Constitutional Chamber has already established, with sufficient force, the duty of the State and its institutions to protect wetland areas, whether or not they have been declared as such by executive decree, as a consequence of the public obligations arising from Article 50 of the Constitution. In that regard, in judgment No. 5255-98 at 18 hours 06 minutes on July 21, 1998, it specifically stated: “II.- On the merits: In its consistent case law, this Chamber has expressed the importance of protecting the environment, particularly following the amendment to Article 50 of the Political Constitution, which now contains a genuine, specific provision guaranteeing the right to a healthy environment and, logically, its protection, in addition to affording effective protection to wetlands, as in the case before us.
Thus, in judgment number 1888-95 at nine hours eighteen minutes on April 7, 1995, it held: ‘III.- The right to a healthy environment is a fundamental right derived from Articles 21, 50, and 89 of the Political Constitution, and environmental protection is essential to human life, since human life develops within an ecosystem that sustains it. The right to a healthy environment therefore complements and proclaims the right of every human being to enjoy an optimal environment for the proper development of human life, as well as the protection and preservation, for future generations, of the country’s natural beauty and other ecological heritage, in accordance with the cultural purposes established in Article 89 of the Political Constitution. On the basis of the foregoing, Nombre21605 has signed international conventions to protect that fundamental right to a healthy environment. The Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere, ratified by Nombre21605 through law 3763 of October 19, 1966, was signed by the Governments of the Americas, among other reasons, to protect and preserve in their natural habitats representatives of all species and genera of their native flora and fauna and to prevent their extinction through any means within human control.
Article 4 of that Convention provides: “The Contracting Governments agree to maintain inviolate the strict wilderness reserves, as far as practicable, except for duly authorized scientific research and government inspection, or for other purposes consistent with the purposes for which the reserve was established.” Nombre21605 also signed the “Convention on Wetlands of International Importance Especially as Waterfowl Habitat,” also known as the “Ramsar Convention” (signed in Ramsar on February 2, 1971). Article 4 thereof provides: Each Contracting Party shall promote the conservation of wetlands and waterfowl by establishing nature reserves in wetlands, whether or not they are included in the “List,” and shall make adequate provision for their management and care....’ It follows that our country has undertaken an international commitment to keep wilderness and wetland reserves inviolate. The cited Convention defines wetlands as: areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water whose depth at low tide does not exceed six meters.’ Wetlands consist of a series of physical, biological, and chemical components corresponding to soils, water, animal and plant species, and nutrients.
The processes occurring among and within these components enable a wetland to perform certain functions beneficial to the area in which it is located, such as flood control and protection against natural phenomena such as storms. It also generates products that benefit people and society in general, such as the maintenance of wildlife, fisheries, and forest resources. The importance of wetlands lies, among other things, in their very nature: for countries that foster their development and conservation, they sustain a large number and variety of habitats, with favorable socioeconomic impacts for certain sectors of the population engaged in their rational use, and create a distinctive landscape readily identifiable by its great beauty and diversity of wildlife, which form part of their cultural heritage and constitute an important resource for tourism in a country or region....” More recently, in judgment No. 14288-09 at 15 hours 19 minutes on September 09, 2009, it stated on this matter: “IV.- On wetlands and their environmental, cultural, and economic importance.
This Chamber has addressed the significance and protection of these ecosystems in judgments 2001-12817 at 10:28 hours on December 14, 2001, and 2007-6246 at 19:30 hours on May 8, 2007, among others, noting that wetlands are considered among the world’s most productive ecosystems. The Ramsar Convention, signed on February 2, 1971, defines a wetland as: ‘Areas of marsh, fen, peatland, or water, whether natural or artificial, permanent or temporary, with water that is static or flowing, fresh, brackish, or salt, including areas of marine water whose depth at low tide does not exceed six meters.’ In Costa Rica, Article 40 of the Ley Orgánica del Ambiente defines them as: ‘Ecosystems dependent on aquatic regimes, whether natural or artificial, permanent or temporary, lentic or lotic, fresh, brackish, or saline, including marine areas up to the outer limit of seagrasses or reefs or, in their absence, to a depth of six meters at low tide.’ The importance of wetlands derives not only from biodiversity and the functions performed on an ecological scale, but also from the fact that they provide support functions and essential products for human communities in both the developing and industrialized worlds.
According to legal scholarship and scientific studies, the term wetlands encompasses a wide variety of ecosystems with markedly different characteristics; they may be classified into seven landscape units: estuaries, open coasts, floodplains, freshwater marshes, lakes, peatlands, and flood forests; or as saltwater, freshwater, or artificial wetlands. Each consists of a series of physical, chemical, and biological components, such as soils, water, animal and plant species, and nutrients. The processes among and within these components enable a wetland to perform functions such as flood control and storm protection; to generate products such as wildlife, fisheries, and forest resources; to purify water; and to stabilize the coastline. Not every characteristic is present in every wetland, and few perform all functions in the same manner. They also possess highly valuable attributes, such as biological diversity and the uniqueness of cultural heritage.
It is the combination of these ecosystem functions, products, and attributes that makes wetlands important to society. By storing precipitation and releasing runoff evenly, wetlands can reduce the destructive force of floods and rivers; thus, conserving natural storage areas may avoid the need to build dams and reservoirs. Their vegetation can stabilize the coastline by reducing the energy of waves, currents, or other erosive forces, while plant roots hold bottom sediments in place, thereby potentially preventing both the erosion of valuable agricultural or inhabited land and damage to property. Wetlands that remove nutrients improve water quality and help prevent eutrophication, which may eliminate the need to construct water-treatment systems. Furthermore, many sustain dense populations of fish, livestock, or wildlife that feed in their nutrient-rich waters or substrate, or graze in their lush grasslands.
Wetlands’ hydrological, nutrient, and material cycles, as well as their energy flows, can stabilize local climatic conditions, particularly precipitation and temperatures, thereby influencing agricultural and natural-resource-based activities, the stability of natural ecosystems, and the wetland itself. They also contribute to recreation, fisheries, agricultural resources, and tourism, as well as to the direct use of the forest resources they generate in the form of a significant number of goods, ranging from firewood, construction timber, and bark among timber products to resins and medicines, which are non-timber ‘secondary’ forest products. They are even important as genetic reserves for certain plant species—such as rice. For this reason, several international instruments address their protection, most notably the Convention on Wetlands, or Ramsar Convention, signed by our country pursuant to Ley No. 7224 on April 9, 1991 and published in the Official Gazette La Gaceta on May 8 of that same year.
The Convention is an intergovernmental treaty that provides a framework for international cooperation in the conservation and wise use of wetlands. The Convention proclaims the duty of States to protect these ecosystems—not only in their own interests, but also in the international interest—and countries are therefore obligated to develop national policies aimed at conserving these environments within their land-use policies; under the Convention, each member country must include at least one site in the List of Wetlands of International Importance. Our national legislation, for its part, implements that commitment in laws such as the Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995, Article 32 of which included Wetlands among the various management categories for protected wilderness areas administered by the Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET)—with the cooperation of the municipalities—and declared both them and their conservation to be in the public interest.
V.- On the ‘Convention on Wetlands of International Importance Especially as Waterfowl Habitat, or Ramsar Convention.’ Costa Rica has signed numerous international instruments that protect our ecological wealth and that, within the domestic legal system, constitute fully applicable legislation—and are directly enforceable in court—.”
The Chamber will carefully analyze the provisions of the Ramsar Convention, as it is an international instrument whose specific purpose is to protect wetlands (humedales), although, as stated by the Procuraduría General de la República, the international rules incorporated into our legal system that protect these ecosystems are extensive. Among the various obligations undertaken by the signatory countries is, as mentioned in the preceding recital (considerando), the designation of at least one wetland of international importance for inclusion in the List of Ramsar sites, the selection of which must be based on its international significance from an ecological, botanical, zoological, limnological, or hydrological standpoint; this is therefore a commitment concerning the protection of specific sites (article 2). They also undertake obligations unrelated to specific sites, such as preparing and implementing their management plans (planes de gestión) in a manner that promotes the wise use (uso racional) of the wetlands within their territory (article 3), and they further undertake to promote the conservation of wetlands and waterfowl by establishing nature reserves (reservas naturales) in wetlands, whether or not they are included in the “List” (article 4).
Lastly, the signatory countries undertake to coordinate their policies and regulations concerning the conservation of wetlands and their flora and fauna (article 5). Thus, the parties establish a system for protecting wetlands, first through a list of wetlands of international importance (Ramsar sites), and second by seeking the wise use of all wetlands within their territory. The Convention does not define “wise use”; however, it establishes a Conference of the Parties empowered to formulate general or specific recommendations concerning the conservation, management, and wise use of wetlands and their flora and fauna, and to adopt other recommendations or resolutions to promote implementation of the Convention (article 6). The 3rd meeting of the Conference of the Contracting Parties defined the wise use of wetlands as “their sustainable utilization for the benefit of humankind in a way compatible with the maintenance of the natural properties of the ecosystem”; sustainable use (uso sostenible) as “the human use of a wetland in such a way that it yields the greatest continuous benefit to present generations while maintaining its potential to meet the needs and aspirations of future generations”; and the natural properties of the ecosystem as “those physical, chemical, and biological components, such as soil, water, plants, animals, and nutrients, and the interactions among them” (Recommendation 3.3 ).
Likewise, the “Guidelines for the Implementation of the Wise Use Concept of the Convention,” adopted through Recommendation 4.10., state that “The wise use provisions apply to all wetlands and the systems supporting them within the territory of a Contracting Party, both those included in the List and all others.” According to the Secretariat of the Ramsar Convention, the National Wetlands Policy (Política Nacional de Humedales) must include the following objective: “To prevent further losses of the wetlands that still exist and encourage the rehabilitation of the country’s wetlands by maintaining their integrity, conserving their genetic diversity, and ensuring that their enjoyment and economic use are sustainable.” It should also “cover all types of wetlands.” It is therefore clear that, under the Ramsar Convention, every ecosystem possessing the characteristics of a wetland must be used wisely and sustainably under the terms defined by the Convention and the Conference of the Parties.
The Costa Rican legislature has understood it in this manner, since articles 40 of the Ley Orgánica del Ambiente, 2 of the Ley de Conservación de Vida Silvestre, and 2 subsection 18) of the Ley de Pesca y Acuacultura establish definitions of wetlands consistent with the Ramsar Convention. Furthermore, every area or ecosystem meeting such conditions is subject to the legal framework (régimen) established in articles 41, 43, 44 and 45 of the Ley Orgánica del Ambiente.” In this regard, see also judgments No. 8492l-2004 at 8:41 hours on 6 de agosto del 2004, and No.12817-01 at 10:28 hours on 14 de diciembre del 2001, issued by that same Sala Constitucional.
VIII.It is therefore undeniable, in light of the foregoing, that the State and its institutions have a duty to protect the environment, including wetlands. Along this line of analysis, the aforementioned report ACLAC-GASP-RNVSL-001-2013 dated 06 de febrero del 2013, issued by Área de Conservación La Amistad Caribe of SINAC, supports a conclusion regarding the delimitation of the area of influence and protection of Humedal Zona Caribe Central, establishing that a section of the property described in registered cadastral plan L-901560-2004, measuring 2.52 hectares, lies within land classified as Humedal Zona Caribe Central, and that a 0.15-hectare section thereof contains stone or granular material deposited on the surface. The aforementioned report establishes the area of the Argón property that, although part of the wetland, was impacted and affected by the depositing and surface spreading of aggregate.
Moreover, that report records that the wetland areas of influence have already been marked and monumented in situ by SINAC. It is clear that such actions have been deemed environmental damage (daño ambiental), which was even assessed and quantified by the MINAET authorities. However, the various inspections ordered by this Court during the ante causam interim-measure phase (medida cautelar ante causam) show that the works being carried out in that wetland area of influence were suspended and halted, with no evidence that they continued. Indeed, official letter ACLAC-PNE-OT-037-2011 dated 19 de octubre del 2011, issued by Área de Conservación La Amistad Caribe of Sistema Nacional de Áreas de Conservación, contains a report on the inspection conducted by that administrative unit at the container storage property of Argon Transport S.A. and an economic assessment of the environmental damage.
With respect to the status of the works, that document states that an unfinished metal fence had been installed in the eastern sector, with no personnel observed working to complete the fence or performing filling activities. Through official letter ACLAC-PNE-OT-032-2012 dated 24 de abril del 2012, Área de Conservación La Amistad Caribe of SINAC issued an inspection report concerning the Argon S.A. container storage property, for the purpose of verifying whether a perimeter fence under construction on that property was located inside or outside the wetland. The inspection was conducted on 30 de marzo del 2012 and concluded that the perimeter fence was not located within land classified as Humedal Zona Caribe Central. The prohibition against continuing activities harmful to the environment was also imposed by interim measure No. 566-2012 at 15 hours 25 minutes on 06 de septiembre del 2012, which established: “The interim measure is partially granted under the following terms: ‘The suspension of any and all work performed by Argón Transport S.A. on the property located across from the RITEVE station, Limón, nine miles, Limón 2000, is hereby ordered.
The suspension order encompasses any construction work, installation of walls, fills, posts, intakes, earthworks (movimientos de tierra), or any activity that alters that area, whether performed directly, through its employees, or through third parties.’” This decision was upheld by the Court of Appeals with respect to the suspension of the works through Decision No. 699-2012 at 10 hours 14 minutes on 05 de diciembre del 2012. Although the activities disturbing the wetland area have now ceased, the fact remains that the existence of environmental damage to Humedal Zona Caribe Central has been established in this case over a total area of 0.15 hectares. In this regard, in official letter ACLAC-PNE-OT-037-2011 dated 19 de octubre del 2011, Área de Conservación La Amistad Caribe of Sistema Nacional de Áreas de Conservación issued a report on the inspection conducted by that administrative unit at the container storage property of Argon Transport S.A. That report sets out the economic assessment of the aforementioned harm, considering an affected area of 0.15 hectares within land classified as Humedal Zona Caribe Central.
For this purpose, it used the Economic Assessment of Environmental Damage in Costa Rica methodology (Evaluación Económica del Daño Ambiental en Costa Rica)—developed by Nombre7991 and Nombre136695 (2002)—. With respect to compensation for the environmental harm, the value of lost benefits was set at ¢244.123.20 (two hundred forty-four thousand one hundred twenty-three colones and twenty céntimos); administrative costs were set at ¢535.200.00 (five hundred thirty-five thousand two hundred colones), for a total economic value of ¢779.323.20 (seven hundred seventy-nine thousand three hundred twenty-three colones and twenty céntimos). Likewise, with respect to the restoration cost (costo de recuperación), it stated that restoration of the site was necessary because the site had to be prepared for natural regeneration so that it could attain its initial conservation status. The report explains that, given the characteristics of the site, restoration must be ensured, which is feasible through natural regeneration if some amendment is made, because the organic layer of the soil was affected.
It deemed a monitoring plan by the Administración Forestal necessary to verify that the area remains unaltered. (Pages 248-259 of the principal case file) This point is reiterated in the previously discussed official letter ACLAC-GASP-RNVSL-001-2013 dated 06 de febrero del 2013. It bears clarifying that the damage consists of the deposit of aggregate material on the part of the property affecting the wetland area, but not the construction of the chain-link fence, which, as noted, is located outside that area of influence, in accordance with the reports cited above. Therefore, the specific damage consists of the impact on the 0.15-hectare area of yolillo wetland caused by the depositing and spreading of granular material. Accordingly, this Court finds that the aforementioned damage and its amount have been established, and it must now analyze the causes that produced it in order to determine whether the co-defendants bear joint and several liability (responsabilidad solidaria) or, conversely, whether liability is directly attributable to only one of the defendants.
IX.Analysis of the liability of the defendant Administrations. In analyzing the liability of the administrative units against which the action was brought, it should be emphasized that, although Article 50 of the Magna Carta establishes the duty of the State and its Institutions to protect the environment, this does not mean that every instance of environmental damage (daño ambiental) entails direct liability on the part of the Public Administrations based on an alleged failure to oversee the activities of private parties. Protecting the environment is a duty incumbent not only upon public institutions but upon every person. It is also worth noting the regulation established by Article 8 of the Ley de Biodiversidad, insofar as it imposes the so-called environmental function of real property (función ambiental de la propiedad inmobiliaria) as part of the economic and social exercise of the ownership right (derecho de dominio) over such property, which entails the duty of owners to ensure that the use of their lands complies with environmental regulations.
An example can be seen in the building restrictions (limitaciones edilicias) imposed by Article 33 of the Ley Forestal with respect to setback zones (zonas de retiro) near water sources (fuentes acuíferas). Thus, Article 50 of the Constitución Política does not establish a form of unlimited liability for public entities. Therefore, in determining whether or not they are liable, it is necessary to distinguish situations in which they have direct oversight duties from those in which the duty of oversight arises from a claim, application, or complaint filed by a person concerning the risk that environmental damage or harm may occur. In the first case, it is clearly possible to impose liability for public-sector indifference in exercising environmental protection powers; in the second scenario, however, liability depends on proof, in each case, of omissions in addressing such proceedings that resulted in harm to ecosystems.
Having analyzed the merits of the various items of evidence and allegations contained in the record, this judicial panel finds that, in this case, the acts and omissions attributed by the claimant to the public bodies against which relief is sought did not constitute a legally adequate and relevant cause of the alleged harm. Indeed, in cases of this kind, the joint and several liability (responsabilidad solidaria) of the co-defendants depends on whether the alleged damage resulted from the inseparable combination of actions or failures attributable—or referable—to the parties. To the extent that one of those actions can be associated with a particular harm, liability will not be shared but will instead fall directly upon the person responsible for that action. It should be clarified that, in situations of this kind, the causes attributable to each party must be analyzed to determine, first, whether the grounds alleged by the claimant have arisen and, second, whether they constitute a contributing cause (con-causa) of the damage such that joint and several liability may be imposed.
In these situations, joint and several liability does not arise from a statute or prior agreement, but from a potential judicial ruling finding that the causes are inseparable, which has come to be known as “non-statutory joint and several liability” (“solidaridad impropia”). Accordingly, with regard to the environmental damage under review, this adjudicative Chamber finds that the legally adequate and relevant cause of that harm was Argon Transport’s storage of granular material (material granular)—gravel fill (lastre)—on its property located in Limón, specifically within the 0.15-hectare area forming part of the Humedal Zona Caribe Central. It should be noted that those works began without municipal permits. By official letter dated 30 de mayo del 2011, the Municipalidad de Limón informed the entity in question of several circumstances observed on the property at issue, stating, among other matters, that: it was processing a construction permit for a perimeter fence covering an area of 600 linear meters, on top of fill material extending beyond 450 square meters; the permit for the fill material used to compact the property’s parking area was missing; no updated cadastral survey plan (plano catastrado) had been provided; construction work had begun without a municipal license and was 40% complete when it was shut down on 26 de mayo del 2011; despite the shutdown, construction continued in disregard of the affixed seals; and the inspection conducted on 30 de mayo del 2011 showed that work on the perimeter fence was continuing.
It further stated that the project lacked environmental viability approval (viabilidad ambiental), water-discharge plans, and plans for filling the land, and that the plans did not show the wall under construction on the northern side of the property. In that regard, notice was given that the corresponding criminal complaint would be filed with the Ministerio Público for breach of seals and disobedience of authority, as well as a complaint before the Tribunal Ambiental for lack of environmental viability approval. (Pages 46-52 of the court record) The foregoing demonstrates that the actions of Argon Transport S.A. ultimately constituted the cause of the environmental harm. The claimant asserts that Nombre415 is liable for its failure to address a parcel of land forming part of its assets. That allegation cannot be sustained, however, because the superior ownership right of Argon Transport S.A. has already been established over the property in the province of Limón, recorded under real-property folio number Placa25380, which was registered before the transfer of the unregistered land that gave rise to property Placa7705 in the same province.
In any event, by official letter CEPOT-022-2011 of 12 de julio del 2011, the Comisión Ejecutora del Programa de Ordenamiento Territorial de JAPDEVA forwarded to the Jefatura del Departamento Legal of that public entity the file concerning the complaint lodged over alleged environmental damage. That official letter represented the first action taken in response to the events on the property in question. It was subsequently on 19 de agosto del 2011 that the claimant filed a formal complaint with the Auditoria Interna de JAPDEVA, requesting the adoption of specific measures to protect the State’s natural heritage (patrimonio natural del Estado) administered by Nombre415 and asserting that the alleged encroachment upon State property would cause irreparable environmental damage. (Pages 57-58 of the main record) In response, through official letter AL-432-2011 of 12 de septiembre del 2011, the Departamento Legal de JAPDEVA submitted a report to the Presidencia Ejecutiva of that entity regarding the status of the property occupied by Argon Transport S.A. The foregoing demonstrates that Nombre415 duly addressed those proceedings.
This Tribunal does not see how the foregoing could be regarded as a fact contributing to the damage, given that, upon receipt of the complaint, the appropriate actions were immediately undertaken to determine ownership of the property and to refer the claim to the competent authorities regarding the environmental aspect or variable. Accordingly, there is no basis for attribution (criterio de imputación) supporting the existence of a causal relationship (relación causal) with the alleged damage; therefore, the claim against Nombre415 must be dismissed.
X.On the liability of the State and SINAC. As regards SINAC, it should be noted that the alleged improprieties are likewise not evident. Indeed, after reviewing the administrative record of Nombre3456, it appears that, through official letter SINAC-ACLAC-PNE-066-2011 of 15 de julio del 2011, the Área de Conservación La Amistad Caribe issued a preliminary report concerning its response to a complaint filed regarding impacts on wetlands at the container yard of Argon Transport S.A. That official letter refers to the complaint submitted by email by the Asociación de Desarrollo para la Ecología on 29 de junio del 2011, addressed to the Comisión Ejecutora del Programa de Ordenamiento Territorial (CEPOT) Nombre415, which warned of expansion works at the aforementioned site, the risk of encroachment upon lands belonging to Nombre415, and possible serious damage to the State’s natural heritage (patrimonio natural del Estado), consisting of construction on a yolillo palm wetland.
The cited official letter states that verbal instructions were issued on 01 de julio del 2011 to ensure that the matter was properly addressed. It further recounts that, on 04 de julio del 2011, ACLAC-MINAET officials conducted inspections at the property in question to verify the environmental damage (daño ambiental) caused by the alleged expansion activities. During the visit, officials observed the installation of an unfinished metal fence and the deposit of a considerable amount of granular material or gravel fill, intended for the expansion. (Folios 73-74 of the SETENA administrative record) In response, through official letter SINAC-ACLAC-PNE-070-2011 of 21 de julio del 2011, Argon Transport S.A. was granted a hearing (audiencia) for 10 business days and was required to provide certain information related to the works (folio 75 of the SETENA administrative record). The requested information was submitted on 09 de agosto del 2011, as recorded at folio 72 of that administrative file.
Ultimately, through official letter ACLAC-PNE-OT-037-2011 of 19 de octubre del 2011, the Área de Conservación La Amistad Caribe of the Sistema Nacional de Áreas de Conservación issued a report on the inspection conducted by that administrative unit at the container storage yard of Argon Transport S.A. and on the economic valuation of the environmental damage. The report concluded that, along the eastern boundary of the ARGON S.A. Container Storage Yard, physically marked by the metal fence under construction, the existence of a protection area (área de protección)—a stream or creek—was established based on the presence of fish in its channel. It concluded that Nombre3456 was responsible for assessing the reported acts concerning the alleged offense of damage within a creek protection area and construction on a yolillo palm wetland as a result of activities carried out at Argon’s container storage yard.
It also ordered the preventive suspension and/or stoppage of all activities, works, and actions specifically associated with expanding the area of the aforementioned yard and involving filling with granular material (gravel fill), construction, remodeling, or relocation of infrastructure, until Nombre3456 issued its determination. (Folios 243-247 of the court record, 151-160 of the precautionary-measures record, 76-96 of the Nombre3456 administrative record) In response, by means of an inspection report drawn up on 11 de noviembre del 2011 at 12 hours 50 minutes, the Área de Conservación La Amistad Caribe of SINAC ordered Argon Transport S.A. to preventively suspend and/or halt all activities, works, and actions specifically associated with expanding the ARGON Container Storage Yard and involving filling with granular material (gravel fill), construction, remodeling, or relocation of infrastructure, until Nombre3456 issued its determination.
(Folios 212-213 of the precautionary-measures record, 108-110 of the Nombre3456 administrative record). Subsequently, given that the report had not considered survey plan 7-1122647-2007, which amended plan L-901560-2004 and depicts the current area of the Argon property, official letter ACLAC-PNE-OT-048-2011 of 04 de noviembre del 2011 from the Área de Conservación La Amistad Caribe, concerning the geographic location of the property in the Limón registry district, real-property folio registration Placa25380, states, insofar as relevant: “It was thus determined that a portion of the property described in registered cadastral plan 7-1122647-2007, measuring 3.42 hectares of the total area recorded in that plan, is located within land classified as Humedal Zona Caribe Central, according to the information recorded in the 2008 wetlands layer (Atlas Digital 2008)...”. (Folios 143-150 of the precautionary-measures file, 106 of the SETENA administrative record).
Lastly, inspection report ACLAC-PNE-OT-032-2012 of 24 de abril del 2012 was issued by the Área de Conservación La Amistad Caribe of SINAC concerning the Argon S.A. container storage yard, for the purpose of determining whether a perimeter fence under construction at that property was located inside or outside the wetland. The report concluded that this civil work was outside the wetland area, as subsequently clarified in official letter ACLAC-PNE-OT-057-2012. As can be seen, the complaint filed by a third party, rather than by the plaintiff, was duly addressed by SINAC, resulting in the suspension of the works and the performance of inspections and preparation of reports concerning the geographic demarcation of the environmental areas requiring protection, as well as the existence and extent of environmental damage arising from the filling of the wetland with gravel fill or granular material.
The indifference alleged by the claimant is not evident; rather, the measures taken by the SINAC authorities are deemed adequate, prompt, and effective in securing the suspension of the environmentally intrusive works and enabling remediation of the damage. There is nothing in the record showing that the complainant filed any complaint with SINAC concerning this matter. Although, under mandate 50 of the Constitución Política and section 105 of the Ley de Biodiversidad, No. 7788, environmental matters are subject to what is known as a citizen action (acción popular), which confers standing upon any person to bring actions to protect the environment, the fact remains that there is no evidence that any complaint was filed at the administrative level. Even so, it bears repeating that SINAC displayed no administrative indifference in addressing the events at the property of Argon Transport S.A. Accordingly, the environmental damage measured by SINAC in its reports cannot be deemed a consequence of those actions.
Furthermore, because no omission has been established, there is no basis for attribution (parámetro de imputación) that would permit that material consequence to be ascribed to that Administration, and therefore no causal nexus (nexo de causalidad) exists that would support holding that public entity liable or jointly liable for the damage in question. The foregoing must also apply to the State, since no reference is made to any omission attributable to it that could be regarded as the cause of the ecological harm. On the contrary, by addressing through SINAC the events that occurred at that property, it fulfilled the duty imposed upon it by canon 50 of the Constitución Política. Consequently, the claim against the State and SINAC must be dismissed.
XI.Liability of Argon Transport S.A. A different situation arises with respect to Argon Transport S.A. Having examined the merits of the principal case file, as well as the various documents comprising the record, this Chamber considers that the actions in question must be deemed the proximate cause of the environmental damage (daño ambiental) produced within the 0.15-hectare area of the Zona de Humedal Caribe Central. It should be noted that, from the outset, by letter dated 30 de mayo del 2011, the Municipalidad de Limón informed Argon Transport S.A. of the construction work and placement of fill material exceeding 450 metros cuadrados, as well as the absence of a permit to place fill material for compacting the parking area on the property. Similarly, the warning regarding the absence of permits was issued by SINAC in letter SINAC-ACLAC-PNE-070-2011 dated 21 de julio del 2011. It was precisely upon determining that the placement of granular fill material posed a risk of damage to the wetland zone (zona de humedal) that Nombre3456 ordered the suspension of that work, a situation that has continued to date pursuant to the interim measure (medida cautelar) ordered in these proceedings.
As stated ut supra, the existence of environmental damage was established in letter ACLAC-PNE-OT-037-2011 dated 19 de octubre del 2011 from the Área de Conservación La Amistad Caribe of the Sistema Nacional de Áreas de Conservación, which assessed compensation for the environmental harm as follows: value of lost benefits of ¢244.123.20 (two hundred forty-four thousand one hundred twenty-three colones and twenty céntimos); administrative cost of ¢535.200.00 (five hundred thirty-five thousand two hundred colones), for a total economic amount of ¢779.323.20 (seven hundred seventy-nine thousand three hundred twenty-three colones and twenty céntimos). From this perspective, the cause of the damage is attributable solely to the company that owns the property, which undertook the placement of ballast and fill within a 0.15-hectare area of the wetland zone. The factual record discloses no other relevant act that contributed to that damage and to which a share of joint liability (co-responsabilidad) could be assigned.
Under an analysis of legally relevant causation, it was those actions by the respondent company, involving work detrimental to the yolillo wetland, which is considered a protected area (área protegida) under section 32 of the Ley Orgánica del Ambiente (No. 7554), that led to the materialization of the environmental harm. Accordingly, that private entity must be declared directly liable for such environmental damage. Regarding the duty to compensate for that damage, Argon Transport S.A. states at folio 439 of the principal case file: “...although the action is brought jointly against Argón Transport S.A., Nombre415, SINAC, and the State, should this request for out-of-court satisfaction (satisfacción extraprocesal) be accepted... Argón Transport S.A. agrees to pay for the damage which, as shown in the record, was assessed by SINAC in the amount of seven hundred ninety-nine thousand three hundred twenty-three colones and twenty céntimos (sic)...” This Court understands that statement as consent to compensate for the damage if the out-of-court satisfaction were granted.
Since that procedural proposal was not accepted, the condition to which the respondent entity made such payment subject was not fulfilled. Nevertheless, because it has been established that the company is responsible for the aforementioned environmental harm, pursuant to article 99 of the Ley Orgánica del Ambiente, the orders set forth below must be entered against Argon Transport S.A. In this regard, given that the technical authority has determined the economic valuation (cuantificación económica) of the environmental damage and has also stated that, for purposes of rehabilitating and regenerating the altered environment, those proposals must be followed in determining the measures to be taken in this case. Specifically, letter ACLAC-GASP-RNVSL-001-2013 dated 06 de febrero del 2013 from the Área de Conservación La Amistad Caribe of SINAC states the following concerning corrective measures for the filling of a 0.15-hectare property in the affected wetland: “The Protection Area (area of influence) digitized with a northern orientation (0.86 ha) contains no fill of any type of material, which facilitates the implementation of ecosystem restoration and recovery measures (medidas de Restauración y Recuperación de ecosistemas) through natural regeneration and planned forest enrichment (enriquecimiento Forestal planificado), by introducing trees of specific native species, for example.
(...) the following conclusions are set forth: 1. Considering that national legislation establishes mechanisms for the remediation of environmental damage (reparación del daño ambiental) through actions intended to promote or accelerate the recovery of altered ecosystems and habitats, recreating, insofar as possible, their original structure and function in accordance with knowledge of their prior conditions, which in this case have not been established. Selecting the south-facing Protection Area, with an area of 0.87 ha, for recovery, involving mechanized removal of the stone material, potentially increases the environmental impact (Impacto Ambiental) on the soil and the recovery period. 2. The north-facing Protection Area (area of influence, 0.86 ha) contains no fill of any type of material and is suitable for planned recovery and restoration activities with the least impact and the shortest recovery period....” (Folios 370-375 of the interim-measures case file) Consequently, because removal of the material would require machinery to be brought into the affected area, thereby increasing damage to the soil resource and the recovery period, in light of that technical opinion it is neither appropriate nor prudent to order the removal of the granular material spread over the area in question, which forms part of the Humedal Zona Caribe Central.
Nevertheless, to establish measures that ensure effective protection of the environment, pursuant to section 50 of the Carta Magna and under the provisions of mandate 99 of the Ley Orgánica del Ambiente, this Court considers it imperative to impose measures in addition to the monetary award, consisting of affirmative obligations (obligaciones de hacer) intended to restore and regenerate the affected ecosystem, as well as orders to refrain from certain conduct. Accordingly, the owner, Argon Transport S.A., must be ordered to refrain from commencing, continuing, or otherwise carrying out any civil works, removal, deposit, or transfer of material of any kind on the property located opposite the RITEVE station, Limón, Dirección16371 , , property registered in the province of Limón under real-property folio matrícula Placa25380, within the area lying inside the area of influence of Humedal Zona Caribe Central established in report ACLAC-GASP-RNVSL-001-2013 dated 06 de febrero del 2013 by the Área de Conservación La Amistad Caribe of SINAC.
Likewise, that entity is ordered, in prior coordination with SINAC and the Área de Conservación La Amistad Caribe, to take the actions necessary for planned forest enrichment through the introduction of native tree species, under the terms of report ACLAC-GASP-RNVSL-001-2013 dated 06 de febrero del 2013. Argon Transport S.A. is ordered to pay monetary compensation for the environmental damage caused in the disputed area, consisting of the amount established in report ACLAC-PNE-OT-037-2011 dated 19 de octubre del 2011 by the Área de Conservación La Amistad Caribe of the Sistema Nacional de Áreas de Conservación, which assesses compensation for the environmental harm as follows: value of lost benefits of ¢244.123.20 (two hundred forty-four thousand one hundred twenty-three colones and twenty céntimos); administrative cost of ¢535.200.00 (five hundred thirty-five thousand two hundred colones), for a total economic amount of ¢779.323.20 (seven hundred seventy-nine thousand three hundred twenty-three colones and twenty céntimos).
Regarding the allocation of that monetary award, a clear distinction must be drawn between the citizen action (acción popular) applicable in environmental matters to bring claims seeking an award for ecological damage (arts. 50 of the Carta Magna and 105 Ley No. 7788), and standing (legitimación) to receive the benefits of that civil remedy. In these cases, because the damage is inflicted upon the environment, the funds awarded on that basis must be regarded as public funds, to be used exclusively for actions or programs to regenerate the affected environment or, if that is impossible, directed toward addressing environmental needs. In this regard, this Court concurs with the position adopted by the Sala Primera in judgment No. 675-2007 dated 21 de septiembre 2007, which stated the following concerning the allocation of such awards: “XIV.- It must be understood that the resulting legal obligation is to repair the environment and, therefore, a private party may not include in its claim a request that those amounts be disbursed to it.
Along the same lines, in accordance with the matters discussed in Considerando XI, and for the purpose of ensuring full and effective enforcement of the judgment in the amparo proceeding (recurso de amparo), it falls to this Sala to determine the public body or entity to which those funds must be directed so that they may be used for projects to restore and repair the río Siquiares. In that regard, this collegiate body considers that, given the specialized nature of the subject matter and the technical and professional resources available to the Ministerio de Ambiente y Energía, that Ministry is the appropriate entity to carry out this task in this specific case, considering its particular circumstances and characteristics. Likewise, while maintaining the effective enforcement of the constitutional judgment as the governing premise, it is necessary to create a budgetary mechanism that benefits and maximizes the principles of efficiency, effectiveness, promptness, and economy.
Therefore, the amount ordered by the Tribunal Contencioso Administrativo, which held the Cooperativa and the State jointly and severally liable (solidariamente), must be deposited in the State’s Caja Única (sections 66 of the Ley de Administración Financiera de la República y Presupuestos Públicos and 83 and 84 of its Reglamento), in a client account created specifically for that purpose, the account holder being the Ministerio de Ambiente y Energía, which must use those funds exclusively to carry out repair and restoration work on projects concerning the río Siquiares. (...)” Applying the methodology established by that precedent, the awarded amount must be deposited in the State’s Caja Única, in a client account created specifically for the regeneration and rehabilitation of Humedal Zona Caribe Central, the account holder being the Ministerio de Ambiente y Energía, which must use those funds exclusively to carry out repair and restoration work in that wetland.
To ensure oversight of the allocation of these funds, this decision must be communicated to the Ministerio de Hacienda, Contraloría General de la República (Área de Servicios Públicos Generales y Ambientales), Procuraduría General de la República (Área de Derecho Agro Ambiental), and Defensoría de los Habitantes, so that they may properly oversee and monitor compliance with this decision.
XII.Corollary. Analysis of the defenses raised. After service of process as required by law, the respondent parties answered as follows: a) Nombre415: Raised the defenses of a defective complaint (demanda defectuosa) and lack of a legal right (falta de derecho). (Pages 159-174 of the court record); b) SINAC: Raised the defense of failure to join a necessary defendant (falta de integración de litisconsorcio pasivo necesaria) in order to bring INDER into the proceedings, and the defense of lack of a legal right. (Pages 190-200 of the court record); c) STATE: Raised the defenses of lack of a legal right and lack of standing (falta de legitimación activa) (pages 236-239 of the court record); d) ARGON TRANSPORT S.A.: raised the defenses of lack of a legal right, lack of active and passive standing (falta de legitimación activa y pasiva), and lack of interest (falta de interés). (Pages 348-359 of the main case file).
By Resolution No. 2198-2012 at 15 hours on 14 de diciembre del 2012, the pretrial judge, ruling on the defense of failure to join a necessary defendant raised by SINAC, dismissed that defense. (Pages 415-417 of the court record). The defense of a defective complaint was withdrawn at the preliminary hearing stage. As to the defense of lack of standing, since the subject matter of this proceeding is a claim for environmental damage (daño ambiental), pursuant to section 105 of the Ley de Biodiversidad in relation to Article 10, subsection one, paragraph d), of the Código Procesal Contencioso Administrativo, that defense is rejected. The defense of lack of passive standing raised by Argon Transport S.A. must be rejected because its connection with causing the damage to the Humedal Caribe Central area has been established. The defense of lack of a legal right must be sustained with respect to JAPDEVA, SINAC, and the State, as to whom the complaint is dismissed in its entirety.
The defense of lack of a legal right raised by Nombre136697 . is sustained with respect to the requested demolition order (orden de derribo). In all other respects, it must be rejected. Accordingly, the complaint filed against Nombre136697 . is partially granted on the following terms:
XI.Costs. Pursuant to section 193 of the Código Procesal Contencioso Administrativo, court costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the losing party by reason of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, as regards the actions brought against SINAC, the State, and JAPDEVA, this panel finds that the claimant litigated in good faith, insofar as the purpose of the proceeding is to remedy environmental damage which, although it ultimately could not be attributed to the respondent government agencies, does not mean that the allegations in the complaint lacked seriousness. Therefore, this issue is resolved without a special award of costs. As regards the action against Argon Transport S.A., because that entity has been found responsible for the environmental damage caused and liability has been imposed upon it in this judgment, both court costs and attorneys’ fees are assessed against it.
XIII.Continuation of the precautionary measures (medidas cautelares). By Resolution No. 566-2012 at 15 hours 25 minutes on 06 de septiembre del 2012, the pretrial judge, ruling on the pre-filing precautionary measure (medida cautelar ante causam), ordered: “The following precautionary measure is partially granted on the terms set forth below: ‘All work performed by Argón Transport S.A. on the property located across from the RITEVE station, Limón, nueve millas, Limón 2000, is hereby suspended. The suspension order covers any construction work, installation of walls, fill, posts, intakes, earthworks (movimientos de tierra), or any activity that alters said area, whether carried out directly, through its workers, or through third parties. Nombre415 and SINAC shall report to this Tribunal Procesal Contencioso Administrativo, within the first five business days of each month, on the actions taken to protect and defend Humedal de Yolillo and the measures implemented for its recovery and protection along the boundary with the company ARGON TRANSPORT S.A. Let notice be served.-’” In accordance with the precautionary and preventive principles (principio precautorio y preventivo), and in order to safeguard the purpose of the precautionary measures, namely, to preserve the subject matter of the proceeding and enable the eventual enforcement of a potentially favorable judgment, that precautionary measure shall remain in effect until this judgment becomes final.
POR TANTO.
Pursuant to Article 50, subsection 2, of the Code of Administrative Judicial Procedure (Código Procesal Contencioso Administrativo), the copy of official letter AL-219-2012-SJ dated 12 de octubre del 2012, offered at the preliminary hearing held on 13 de noviembre del 2013, is admitted. In accordance with Article 105 of the Biodiversity Law (Ley de Biodiversidad), in relation to Article 10, first subsection, item d), of the Code of Administrative Judicial Procedure, the defense of lack of standing to sue (falta de legitimación activa) raised by the State and Argon Transport S.A. is rejected. The defense of lack of standing to be sued (falta de legitimación pasiva) raised by Argon Transport S.A. is rejected. The defense of lack of a legal right (falta de derecho) is upheld with respect to Junta Administrativa Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), the Sistema Nacional de Áreas de Conservación (SINAC), and the State; as to those parties, the complaint is dismissed in all respects, without a special award of costs.
The defense of lack of a legal right raised by Argon Transport S.A. is upheld with respect to the request for demolition of the works. It is rejected with respect to the remaining relief sought. Consequently, the complaint filed against Nombre136697 . is granted in part on the following terms and shall be deemed denied insofar as not expressly stated otherwise:

RESULTANDO:
16- En los procedimientos ante este Tribunal no se han observado nulidades que deban ser subsanadas y la sentencia se dicta dentro del plazo de quince días hábiles establecido al efecto por los numerales 98.2 del Código Procesal Contencioso Administrativo y 82.4 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda.

CONSIDERANDO
I.Sobre la admisión de la prueba ofrecida en audiencia preliminar. En la audiencia de trámite celebrada el 13 de noviembre del 2013, la representación de Nombre415 ofrece como prueba documental, copia del oficio AL-219-2012-SJ del 12 de octubre del 2012, emitido por el Departamento Legal de JAPDEVA. En esa fase, acorde al numeral 50 del Código Procesal Contencioso Administrativo, el juzgador de trámite reservó para sentencia la admisión de esta probanza. Acorde al citado numeral: "1) Después de la demanda y la contestación, no se admitirán más documentos, salvo: a) Los de fecha posterior a dichos escritos. b) Los que no haya sido posible aportar con anterioridad, por causas que no sean imputables a la parte interesada. c) Los que, no siendo fundamento de la demanda, sirvan para combatir excepciones del demandado o constituyan una prueba complementaria. 2) De los documentos presentados después de la demanda y la contestación, y antes de concluida la audiencia preliminar, se dará traslado a la contraparte, por un plazo de tres días hábiles; sobre su admisibilidad se resolverá en sentencia.
Los que se presenten después de dicha audiencia solo podrán ser valorados por el órgano jurisdiccional, en caso de ser admitidos como prueba para mejor resolver." La demanda fue contestada por Nombre415 en fecha 23 de agosto del 2012, según se aprecia a partir del folio 159 del legajo principal, por lo que siendo la prueba documental de fecha 12 de octubre del 2012, es criterio de este Tribunal, encaja dentro del supuesto de hecho regulado en el inciso a del numeral primero de esa norma. Aunado a ello, se refiere a un aspecto relacionado con la titularidad del terreno donde se ubica el predio de la empresa Argon Transport S.A., aspecto que resulta relevante en esta contienda judicial, dadas las alegaciones de las partes, de modo que además, es prueba pertinente. En ese sentido, considera este cuerpo colegiado, dicha probanza debe ser admitida. Ahora bien, pese a que el citado ordinal 50.2 del CPCA señala que sobre la admisbilidad se resuelve en sentencia, considera esta Cámara, ello no es óbice para que presentado el elemento de convicción, las partes puedan utilizarlo en la expresión de sus alegaciones, pues de otro modo, caso de entender que en la medida en que no ha sido admitida la prueba no puede utilizarse, se vulneraría el principio de contradictorio y defensa material.
De esa manera, en los supuestos en que tal norma sea aplicable, la prueba debe tenerse por incorporada al debate, pudiendo ser utilizada o referenciada por las partes dentro de la teoría del caso que presentan al Tribunal. Ese ejercicio no ha sido vulnerado en este proceso, pues las partes han tenido acceso a dicha probanza dado que fue puesta en conocimiento de los presentes en la audiencia, potenciando el contradictorio y el debido proceso, por lo cual, se tiene por admitida dicha prueba para los efectos procesales correspondientes.
II.Hechos probados. De relevancia para la resolución del presente proceso se tienen los siguientes:
III.Hechos no probados. De interés para la resolución del presente asunto se tienen los siguientes: 1) Que el accionante realizara formal denuncia ante el SINAC por las obras y actividades desarrolladas en el predio Argon, objeto de esta causa, antes de la interposición de la demanda. (No se acredita tal aspecto) 2) Que ante el conocimiento que tuvo el SINAC de lo acontecido en el predio Argon en Limón, incurriera en inercia administrativa o desatención del caso. (No se desprende de los autos). 3) Que Nombre415 incurriera en omisiones que llevaran a la configuración de un daño ambiental en el predio Argon. (No consta tal aspecto)
IV.Objeto del proceso. La presente demanda se formula para que se disponga en sentencia la responsabilidad de Nombre415 como el SINAC por las omisiones en que incurrieron, al no haber tomado las medidas legales necesarias para detener las acciones de la sociedad ARGON TRANSPORT S.A. que generaron los daños y perjuicios que constan en autos, de acuerdo a la valoración del daño ambiental determinado por el mismo SINAC. Pretende el accionante que se declare culpable a la empresa ARGON TRANSPORT S.A. por los daños causados al ambiente, con las construcciones ilegales que realizó en el predio de su propiedad. De igual manera, se proceda a ordenar la demolición en forma inmediata de las obras que ha realizado la empresa ARGON TRANSPORT S.A. en el terreno indicado, por tratarse el mismo de un humedal, y tratar de lograr la recuperación del ecosistema dañado, para lo cual deberá el SINAC brindar la ayuda técnica necesaria para su rehabilitación. Pide el pago de ¢779.323.20 (setecientos setenta y nueve mil trescientos veintitrés colones con veinte céntimos). De seguido se ingresa al análisis de los extremos petitorios formulados así como las defensas planteadas, considerando los diversos alegatos expresados por las partes en las diversas fases de esta contienda judicial.
V.Sobre el dominio del área donde se ubica el predio Argon. Un primer aspecto que ha de ser esclarecido en la presente contiende se refiere a la titularidad del espacio de terreno en el que se ubica físicamente el predio de contenedores de la empresa Argon Transport S.A. Lo anterior dado que el accionante señala que tal predio forma parte de las tierras que la Ley No. 5337, Ley Orgánica de Japdeva, asignó a ese ente público. A juicio del reclamante, ese dominio hace que se trate de bienes demaniales, sobre los cuales, no cabe prescripción alguna, por lo que debe disponerse el derribo de obras. Este aspecto es determinante para establecer el derecho o no de la entidad accionada de ejercitar actos posesorios y en general de disposición dentro de ese predio, como derivación de su dominio sobre esa cosa. En este sentido, con todo, cabe aclarar, la titularidad sobre el inmueble no supone ni por asomo una desvinculación con el cumplimiento de las limitaciones que imponen las normas ambientales, dada la función ambiental -o ecológica- de la propiedad que impone la Ley Orgánica del Ambiente (No. 7554), lo que implica que el propietario ha de disponer de su heredad en armonía con aquellas disposiciones.
Sobre el particular, cabe señalar, la empresa Argon Transport S.A. es propietaria registral de la finca del partido de Limón, matrícula de folio real Placa25368, sita en el Dirección13525 , . Dicho predio se ubica frente a la Dirección16370 en Limón, Nueve Millas, Limón 2000. Tal heredad tiene sus antecedentes de dominio de las fincas matrículas de folio real Placa25369, Placa25370 y Placa25371 y se origina de la finca Placa8165, inscrita por primera vez en el Registro Público el 08 de julio de 1982 y la finca Placa25372, inscrita el 11 de mayo de 1987. Dicha finca se encuentra graficada en el plano catastrado número L-901560-2004, luego modificado por el plano 7-1122647-2007 (Folios 44-45, 339-345 del judicial). Luego, se ha acreditado que la finca del partido de Limón, matrícula de folio real Placa20219, se encuentra inscrita a nombre de Nombre415, según mandato de la Ley No. 3091 del 18 de febrero de 1963, reproducida íntegramente por la Ley Orgánica de Nombre415, No. 5337 del 27 de agosto de 1973, y de conformidad con el plano catastrado número L-000001-1977.
En tesis de inicio, se insiste, es claro que el bien Placa25368 se encuentra dentro de la cabida de la finca Placa7705, ambas del partido de Limón, sin embargo, según se ha tenido por acreditado, la inscripción del inmueble propiedad de Argon Transport S.A., se produjo con antelación a la inscripción de la finca titularidad de Nombre415, razón por la cual, ha de prevalecer el derecho de dominio que esa entidad privada ostenta sobre el citado bien. Se trata de un título que fue debidamente inscrito en su momento oportuno, sobre el cual, no se aportado ningún elemento que acredite su nulidad, como tampoco se ha peticionado la declaratoria de invalidez de esa inscripción, por lo que ha de prevalecer en orden a la tutela de derechos adquiridos de buena fe. Incluso, debe destacarse, la prevalencia de inscripciones previas a la titulación del terreno de Nombre415, fue expresamente advertida en la escritura mediante la cual, el Estado cedió a ese ente público esas tierras.
En efecto, en la escritura otorgada por la Notaria del Estado a las 10 horas del 08 de junio del 2001, el Estado, por imperio de lo establecido por el numeral 41 inciso b) de la Ley No. 5337, traspasa en forma gratuita terrenos sin inscribir a favor de Nombre415, sitos en Limón, Alajuela y Heredia, con una cabida de 132 ha 7.150 m2 (ciento treinta y dos hectáreas, siete mil ciento cincuenta metros cuadrados). En esa escritura se expresó la salvedad que "...quedan a derecho todas aquellas titulaciones que se hayan hecho anteriormente a este traspaso, estando en la misma localización, siempre y cuando se hayan ajustado a los requerimientos de ley." Ese acto fue inscrito al tomo 491, asiento 12355, del 28 de junio del 2001. (Folios 260-266 del judicial) Si bien se ha establecido que existe un traslape entre ambas fincas, ante la gestión de la entidad Argon Transport, por oficio PE-747-2012 del 17 de octubre del 2012 de la Presidencia Ejecutiva de Nombre415, se informa a la entidad petente que su propiedad se encuentra inscrita en el Registro Público de la Propiedad previo al nacimiento de la propiedad de Nombre415 inscrita al folio real 7-09958-000.
En ese sentido, expresó: "Anteriormente, se ha indicado que a todas aquellas propiedades que fueron inscritas previo al nacimiento de la propiedad de Nombre415 en el año 2001, se les debe respetar su inscripción anterior, a efectos de ser consecuentes con el denominado principio jurídico que dispone: "primero en tiempo, primero en derecho", ya que así lo señaló la misma Notaria del Estado, Licda. Gladys Herrera Raven, cuando redactó la escritura No. 132, de las diez horas del día ocho de junio del año 2001, por tanto la titularidad de dicha propiedad corresponde legalmente a ARGON TRANSPORT S.A., tal y como se desprende de las certificaciones de inscripción expedidas por el ente encargado de la inscripción de las propiedades en Costa Rica. (...)" (Folios 405-406 del principal) En ese mismo sentido, en el oficio AL-219-2012-SJ de fecha 12 de octubre del 2012 del Departamento Legal de JAPDEVA, remitido a la Presidencia Ejecutiva de ese ente público, se emite informe jurídico sobre análisis de si la propiedad de Argon Transport S.A. está dentro de los terrenos de JAPDEVA.
En el aparte de conclusiones, ese informe indica: "CONCLUSIÓN: A modo de conclusión debemos indicar que ha quedado demostrado por las certificaciones expedidas por el Registro Nacional que las propiedades indicadas líneas arriba pertenecen al legítimo dueño que es la EMPRESA ARGON TRANSPORT S.A., por haber sido adquiridas en los años 1982, 1986 y 1987, que esas propiedades fueron inscritas previo a la inscripción de los terrenos que le fueron dados a JAPDEVA, inscripciones a las que se las aplica el conocido principio jurídico: "principio de primero en tiempo y primero en derecho", tal y como lo hizo constar la notaria del Estado en su momento, Licenciada Gladys Herrera Raven cuando estipuló que la escritura No. 132 se realizaba sin perjuicio de terceros con mejor derecho. (...)". (Folios 503-510 del principal) De esa manera, para los efectos de este proceso, Nombre415 ha reconocido la prevalencia del derecho de dominio debidamente inscrito de la entidad co-accionada, con lo cual, ha de tenerse por legítima propietaria de la finca del partido de Limón, matrícula de folio real Placa25380 y con ello, del predio de almacenamiento de contenedores objeto de controversia.
VI.Afectación a zona de humedal. Delimitación geográfica. Delimitada la titularidad del espacio físico en el que se ubica el predio Argón, corresponde ahora establecer si ese terreno forma parte de zona de humedal, a fin de determinar la existencia o no de acciones humanas que hayan generado una lesión al ambiente en ese ecosistema. En la especie, se ha tenido por acreditado que en el predio propiedad de la entidad Argon Transport S.A., matrícula de folio real Placa25373, la citada empresa ha realizado obras consistentes en tomas para contenedores, además de tapias y rellenos, sin contar con la viabilidad o licencia ambiental, ni los permisos de construcción para tales efectos. Por oficio SINAC-ACLAC-PNE-C-017-2011 emitido a las 12 horas del mes de enero del 2011 (no detalla día exacto), el Área de Conservación La Amistad Caribe del SINAC, emite certificación en la que indica en lo medular: "...se ha determinado con base en la ubicación consignada en el Plano Catastrado Número L-901560-2004 (139492.45 m2), folio real No. 7029736-000, Placa25375 y Placa25376... describe un inmueble que se ubica FUERA DE CUALQUIER ÁREA SILVESTRE PROTEGIDA SEA CUAL SEA SU CATEGORÍA DE MANEJO ADMINISTRADA POR EL SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN.
SIN EMBARGO, EL INMUEBLE DESCRITO POR EL PLANO CITADO SE ENCUENTRA DENTRO DE LOS LÍMITES DE TIERRAS PATRIMONIALES DE JAPADEVA (sic), SEGÚN PLANO No. L-01-1977, MATRÍCULA DE FOLIO REAL No. Placa25377. Lo anterior siempre y cuando la localización cartográfica consignada en los planos de marras corresponda a una ubicación precisa en el terreno. ...". (Folio 320 del principal) De ese modo, en tesis de inicio, se fijó que la zona comprendida en el plano L-901560-2004 no estaba dentro de áreas de humedal. Sin embargo, mediante el informe ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011 del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, se emite informe sobre la inspección realizada por esa unidad administrativa en el predio de almacenamiento de contenedores de la empresa Argon Transport S.A. y valoración económica del daño ambiental. En ese acto, en lo medular para este proceso se señaló que el predio se encuentra cercado en los costados oeste, este y sur por malla metálica, cubierto con material granular o lastre.
Indica que en el sector este se observa la instalación no finalizada de una malla metálica, sin observar personal trabajando en la terminación de esa malla o realizando actividades de relleno. Expone el informe que en la colindancia este del Predio de Almacenamiento de Contenedores ARGON S.A., demarcada físicamente por la malla metálica en construcción, se determinó la existencia de un área de protección (arroyo o quebrada) determinada por la existencia de peces en el cauce de la misma. En el ítem de análisis, esa autoridad ambiental determinó: "El procedimiento permitió determinar el área del levantamiento perimetral del Predio de Almacenamiento de Contenedores ARGON S.A: que se encuentra actualmente rellenada con material granular (lastre), estimando un área de en 7.91 ha, así mismo se determinó que una sección de dicho predio con un área de 0.15 ha se encuentra ubicada dentro de terrenos clasificados como Humedal Zona Caribe Central según la información registrada en la capa de Humedales 2008.
Mediante los planos catastrados L-901560-2004 y L-491099-98 aportados se realizó la digitalización de los polígonos de dichos inmuebles según los derroteros señalados en los planos catastrados indicados, utilizando puntos de amarre físicos específicos equivalentes a las lecturas de GPS obtenidas durante la inspección realizada al predio en cuestión anteriormente. (...)" Ante ello, concluyó que correspondía a Nombre3456 evaluar los actos denunciados por el presunto delito de daño en área de protección de quebrada y construcción sobre un humedal de yolillo por actividades desarrolladas en el predio de almacenamiento de contenedores de la entidad Argon. Como medida preventiva, ordenó la suspensión y/o paralización preventiva de toda actividad, obras y acciones vinculadas específicamente con la ampliación del área del predio referido, que involucren relleno con material granular (lastre), construcción, remodelación y reubicación de infraestructura en forma temporal hasta que se cuente con el pronunciamiento de Nombre3456.
(Folios 243-247 del judicial, 151-160 del expediente cautelar). Para efectos de definir si el predio en cuestión estaba en parte dentro de zona de humedal, por oficio ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013 del Área de Conservación La Amistad Caribe del SINAC, se rinde informe técnico sobre la delimitación del área de influencia y protección del Humedal Zona Caribe Central. La localización se realizó en coordinación con el señor Nombre136696 , administrador del predio Argon. Se determinó que una sección de la propiedad descrita en el plano catastrado L-901560-2004 con un área de 2.52 hectáreas, se ubica dentro de terrenos clasificados como Humedal Zona Caribe Central y que una sección de la misma con un área de 0.15 hectáreas presenta material pétreo o granular depositado superficialmente. En el aparte de conclusiones señaló: "El Área de Protección (área de influencia) digitalizada con orientación Norte (0.86 ha), no presenta rellenos de ninguna clase de material, lo cual propicia la implementación de medidas de Restauración y Recuperación de ecosistemas a través de la regeneración natural y el enriquecimiento Forestal planificado mediante la introducción de árboles de especies nativas específicas por ejemplo.
(...) se detallan las siguiente conclusiones: 1. Considerando que la legislación nacional establece mecanismos de reparación del daño ambiental mediante acciones destinadas a propiciar o acelerar la recuperación de los ecosistemas y hábitats alterados, recreando en la medida de lo posible, la estructura y función originales, de conformidad con el conocimiento de las condiciones previas, las cuales en este caso no se precisan. La selección del Área de Protección con orientación sur con un área de 0.87 ha, para ser Recuperada, involucrando la remoción mecanizada del material pétreo aumenta potencialmente el Impacto Ambiental sobre el suelo y el tiempo de recuperación. 2. El Área de Protección con orientación Norte (área de influencia, 0.86 ha) no presenta relleno de ninguna clase de material, es propicia para las actividades de recuperación y restauración planificada con el mínimo impacto generado y el menor tiempo de recuperación...." (Folios 370-375 del expediente cautelar)
VII.A partir de lo expuesto, este Tribunal tiene como probado que de la finca del partido de Limón, matrícula de folio real Placa25380, un espacio de 2.52 hectáreas, se ubica dentro de terrenos clasificados como Humedal Zona Caribe Central y que una sección de la misma con un área de 0.15 hectáreas presenta material pétreo o granular depositado superficialmente. Tal aspecto puede visualizarse en los levantamientos topográficos que rolan a folios 371 al 373 del legajo principal. Sobre la tutela de los humedales, ya la Sala Constitucional ha establecido con suficiente contundencia el deber del Estado y de sus instituciones de tutelar las zonas de humedal, sea que hayan sido o no declarados como tales mediante decreto ejecutivo, como derivación de las obligaciones públicas que dimanan del artículo 50 de la Carta Magna. En ese sentido, en el fallo No. 5255-98 de las 18 horas 06 minutos del 21 de julio de 1998, sobre el tema en concreto señaló: " II.-Sobre el fondo: Esta Sala, en reiterada jurisprudencia ha manifestado la importancia de proteger el medio ambiente, sobre todo después de la reforma al artículo 50 de la Constitución Política, en que se tiene un verdadera disposición concreta que garantiza el derecho a un ambiente sano y lógicamente a su protección, además de dar una efectiva protección a los humedales, como en el caso que nos ocupa.
Así, en sentencia número 1888-95 de las nueve horas dieciocho minutos del siete de abril de mil novecientos noventa y cinco, dispuso: “III.- El derecho a un ambiente sano es un derecho fundamental derivado de los artículos 21, 50 y 89 de la Constitución Política, y la protección del medio ambiente resulta indispensable para la vida humana, ya que ésta se desarrolla dentro de un ecosistema que la sostiene. Así el derecho a un medio ambiente sano tiene como complemento y proclama el derecho de todo ser humano a disfrutar de un ambiente óptimo para el buen desarrollo de la vida humana, y la protección y conservación para las generaciones futuras de las bellezas naturales y demás patrimonio ecológico del país, de conformidad con los fines de índole cultural establecidos en el artículo 89 de la Constitución Política. Con fundamento en lo anterior, Nombre21605 a nivel internacional, ha firmado convenciones para proteger ese derecho fundamental al ambiente sano.
La Convención para la Protección de la Flora, de la Fauna, y de las bellezas escénicas naturales de los países de América, ratificada por Nombre21605 mediante ley 3763 del 19 de octubre de 1966 fue firmada por los Gobiernos Americanos entre otras razones, para proteger y conservar en su medio ambiente natural, ejemplares de todas las especies y géneros de su flora y fauna, para evitar su extinción por cualquier medio al alcance del hombre. En el artículo 4 de esa convención se establece: "Los Gobiernos contratantes convienen en mantener las reservas de regiones vírgenes inviolables en tanto sea factible, excepto para la investigación científica debidamente autorizada y para inspección gubernamental, o para otros fines que estén de acuerdo con los propósitos para los cuales la reserva ha sido creada" También Nombre21605 suscribió la denominada " Convención Relativa a los Humedales de Importancia Internacional, Especialmente como Habitad de Aves Acuáticas , llamada también "Convención de Ramsar" (firmada en Ramsar el 2 de febrero de 1971).
En el artículo 4 de ésta se establece: Cada parte contratante fomentará la conservación de las zonas húmedas y de las aves acuáticas creando reservas naturales en los humedales, estén o no inscritos en la " Lista ", y atenderá de manera adecuada su manejo y cuidado..." Tenemos entonces que nuestro país se ha comprometido internacionalmente a mantener inviolables las reservas de regiones vírgenes y humedales. La Convención citada define a los humedales como: extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros" Los humedales se encuentran formados por una serie de componentes físicos, biológicos, químicos, que corresponden a suelos, agua, especies animales y vegetales y nutrientes. Los procesos que se producen entre estos componentes y dentro de cada uno de ellos, permite que el humedal realice ciertas funciones, positivas en la zona en que se ubica, tales como el control de inundaciones y la protección contra fenómenos naturales como las tormentas.
Genera también productos en beneficio de las personas y de la sociedad en general, tales como: mantenimientos de la vida silvestre, pesquería y recursos forestales. La importancia de los humedales, entre otros, estriba entonces dada su naturaleza para los países que fomentan su desarrollo y conservación, lo es el sostenimiento de gran cantidad y variedad de habitad, con impactos socio-económicos favorables para ciertos sectores de la población que se dediquen a su explotación racional y la aparición de un singular paisaje identificable plenamente por su gran belleza y diversidad en cuanto a la vida silvestre que forman parte de su patrimonio cultural, fuente importante para el turismo de un país o región...". De manera más reciente, en el voto No. 14288-09 de las 15 horas 19 minutos del 09 de septiembre del 2009, sobre el particular expuso: "IV.- Sobre los humedales y su importancia ambiental, cultural y económica.
Esta Sala se ha referido a la relevancia de estos ecosistemas y su protección, en las sentencias 2001-12817 de las 10:28 horas del 14 de diciembre del 2001 y 2007-6246 de las 19:30 horas del 8 de mayo del 2007, entre otras, señalando que los humedales son considerados de los ecosistemas más productivos del mundo. En la Convención de Ramsar, suscrita el 2 de febrero de 1971, el humedal es definido como: “Extensiones de marismas, pantanos, turberas o aguas de régimen natural o artificial, permanentes o temporales, estancadas o corrientes, dulces, salobres o saladas, incluyendo las extensiones de agua marina cuya profundidad en marea baja no exceda de seis metros”. En Costa Rica, la Ley Orgánica del Ambiente en el artículo 40, los ha definido como: “Ecosistemas con dependencia de regímenes acuáticos, naturales o artificiales, permanentes o temporales, lénticos o lóticos, dulces, salobres o salados, incluyendo extensiones marinas hasta el límite posterior de fanerógamas o arrecifes, o en su ausencia, hasta seis metros de profundidad en marea baja”.
La importancia de los humedales no lo es sólo en función de la biodiversidad y de las que se desarrollan a escala ecológica, sino porque proveen de funciones de apoyo y productos esenciales para las comunidades humanas en el mundo en desarrollo e industrializado. Según la doctrina y estudios científicos, el término humedales comprende una gran variedad de ecosistemas, con características muy distintas, se pueden clasificar en siete unidades paisajísticas: estuarios, costas abiertas, llanuras de inundación, pantanos de agua dulce, lagos, turberas y bosques de inundación; o en humedales de agua salada, de agua dulce o humedales artificiales. Cada uno está formado por una serie de componentes físicos, químicos y biológicos, tales como suelos, agua, especies de animales, vegetales y nutrimentos. Los procesos entre estos componentes y dentro de cada uno de ellos, permiten que el humedal desempeñe funciones, como el control de inundaciones y la protección contra tormentas, y que se generen productos, como la vida silvestre, pesquería y recursos forestales, purifican el agua y estabilizan la línea de la costa.
No todas las características están presentes en cada humedal, pocos desempeñan todas las funciones de la misma manera. Además, presentan atributos muy valiosos como la diversidad biológica y la singularidad del patrimonio cultural. Es la combinación de estas funciones, productos y atributos de los ecosistemas la que hace que los humedales sean importantes para la sociedad. Mediante el almacenamiento de las precipitaciones y la liberación uniforme de la escorrentía, los humedales pueden disminuir la embestida destructiva de las crecidas y los ríos, por lo que la conservación de los depósitos naturales puede evitar la construcción de presas y embalses. Su vegetación puede estabilizar la línea costera mediante la reducción de la energía de las olas, corrientes u otras fuerzas de erosión, al mismo tiempo que con las raíces de las plantas, sostiene los sedimentos del fondo en su lugar, lo que puede prevenir tanto la erosión de valiosas tierras agrícolas o habitadas, como el daño a la propiedad.
Los humedales que remueven nutrientes, mejoran la calidad del agua y ayudan a prevenir la eutrofización, lo que puede evitar la necesidad de construir sistemas de tratamiento del agua. Por otro lado, muchos sostienen la vida de densas poblaciones de peces, ganado o vida silvestre, que se alimentan de sus aguas ricas en nutrientes o de su sustrato, o bien comen en sus exuberantes pastizales. Los ciclos hidrológicos, de nutrientes y de materia, y los flujos de energía de los humedales, pueden estabilizar las condiciones climáticas locales, en particular, las precipitaciones y las temperaturas, lo que influye tanto en las actividades agrícolas como en aquellas basadas en los recursos naturales, como en la estabilidad de los ecosistemas naturales y en el mismo humedal. Coadyuvan además en la recreación, pesquerías, recurso agrícola y el turismo, así como en el aprovechamiento directo de los recursos forestales que generan en un importante número de bienes, que van desde leña, madera para la construcción y corteza, entre los productos maderables, hasta resinas y medicinas, que son productos forestales “secundarios” no maderables.
Son incluso importantes como reserva genética de ciertas especies vegetales –como el arroz-. Es por ello que varios instrumentos internacionales, entre los que destaca la Convención sobre los Humedales o Convención de Ramsar, suscrita por nuestro país según Ley No. 7224 el 9 de abril de 1991 y publicada en el Diario oficial la Gaceta el 8 de mayo del mismo año, se ocupan de su protección. La Convención es un tratado intergubernamental que ofrece un marco de referencia para la cooperación internacional en pro de la conservación y uso racional de los humedales. La Convención proclama el deber de los Estados de proteger –en aras no solamente de sus propios intereses, sino de intereses internacionales- estos ecosistemas, por lo que los países tienen la obligación de desarrollar políticas nacionales que tiendan a la conservación de estos ambientes en sus políticas del uso de la tierra y cada país miembro de acuerdo a la Convención, debe incluir por lo menos un sitio en la Lista de Humedales de Importancia Internacional.
Por su parte, nuestra legislación nacional desarrolla tal compromiso en algunas leyes como la Ley Orgánica del Ambiente, ley Nº 7554 de 28 de setiembre de 1995, la cual en el artículo 32, incluyó a los Humedales en las distintas categorías de manejo de las áreas silvestres protegidas, que están bajo la administración del Ministerio de Ambiente, Energía y Telecomunicaciones (MINAET) -con la colaboración de las municipalidades- y los declara de interés público, así como a su conservación. V.- Sobre la “Convención relativa a los Humedales de Importancia Internacional especialmente como Hábitat de aves acuáticas, o Convención de Ramsar ”. Costa Rica ha suscrito numerosos instrumentos internacionales que protegen nuestra riqueza ecológica y que en el fuero interno, son legislación plenamente aplicable -y de exigibilidad judicial directa-. La Sala analizará detenidamente las disposiciones de la Convención de Ramsar, por tratarse de un instrumento internacional cuyo fin específico es proteger los humedales, aunque tal y como enuncia la Procuraduría General de la República, la normativa internacional que ha sido integrada a nuestro ordenamiento, que protege estos ecosistemas es profusa.
En cuanto a las obligaciones adquiridas por los países signatarios, que son de diversa índole, se encuentra como se mencionó en el considerando precedente, la designación de al menos un humedal de importancia internacional para ser incluido en la Lista de sitios Ramsar, cuya selección deberá basarse en su interés internacional desde el punto de vista ecológico, botánico, zoológico, limnológico o hidrológico, por lo que es un compromiso referido a la protección de sitios específicos (artículo 2). Además se adquieren obligaciones no relacionadas con sitios específicos, como elaborar y aplicar sus planes de gestión de forma que favorezcan el uso racional de los humedales de su territorio (artículo 3) y además se obligan a fomentar la conservación de las zonas húmedas y de las aves acuáticas creando reservas naturales en los humedales, estén o no inscritos en la “Lista” (artículo 4). Por último, los países firmantes se obligan a coordinar sus políticas y regulaciones relativas a la conservación de los humedales, de su flora y de su fauna (artículo 5).
Así, las partes instauran un sistema de protección de las zonas húmedas, en primer lugar a través de una lista de humedales de importancia internacional (sitios Ramsar), y en segundo lugar, procurando el uso racional de todos los humedales en su territorio. La Convención no define “uso racional”, sin embargo, establece una Conferencia de las Partes con competencia para formular recomendaciones generales o específicas, relativas a la conservación, gestión y uso racional de los humedales y de su flora y fauna, y adoptar otras recomendaciones o resoluciones para fomentar la aplicación de la Convención (artículo 6). La 3ª reunión de la Conferencia de las Partes Contratantes definió el uso racional de los humedales como “su uso sostenible para beneficio de la humanidad de manera compatible con el mantenimiento de las propiedades naturales del ecosistema”; el uso sostenible como "el uso de un humedal por los seres humanos de modo tal que produzca el mayor beneficio continuo para las generaciones presentes, manteniendo al mismo tiempo su potencial para satisfacer las necesidades y aspiraciones de las generaciones futuras" y las propiedades naturales del ecosistema como "aquellos componentes físicos, químicos y biológicos, tales como el suelo, el agua, las plantas, los animales y los nutrientes, y las interacciones entre ellos" (Recomendación 3.3 ).
Asimismo, en los “Lineamientos para la Aplicación del Concepto de Uso Racional de la Convención”, adoptados por la Recomendación 4.10. se indica que “Las disposiciones sobre el uso racional se aplican a todos los humedales y a los sistemas que los sustentan dentro del territorio de una Parte Contratante, tanto los incluidos en la Lista, como todos los demás.” Según la Secretaría de la Convención de Ramsar, la Política Nacional de Humedales debe contemplar como objetivo: “Evitar nuevas pérdidas de los humedales que aún existan y alentar la rehabilitación de los humedales del país manteniendo su integridad, conservando su diversidad genética y velando por que su disfrute y aprovechamiento económico sean sostenibles.” Y debería “abarcar todos los tipos de humedales”. Es claro entonces que según la Convención de Ramsar todo ecosistema que reúna las características de humedal, debe ser utilizado de forma racional y sostenible en los términos que la Convención y la Conferencia de las Partes han definido.
El legislador costarricense así lo ha entendido, pues los artículos 40 de la Ley Orgánica del Ambiente, 2 de la Ley de Conservación de Vida Silvestre y 2 inciso 18) de la Ley de Pesca y Acuacultura han establecido definiciones de humedal coincidentes con la Convención de Ramsar. Además, todo espacio o ecosistema que reúna tales condiciones está sujeto al régimen establecido en los artículos 41, 43, 44 y 45 de la Ley Orgánica del Ambiente." En ese sentido pueden verse además las sentencias No. 8492l-2004 de las 8:41 horas del 6 de agosto del 2004, y No.12817-01 de las 10:28 horas del 14 de diciembre del 2001 de esa misma Sala Constitucional.
VIII.Resulta innegable por tanto, a la luz de lo expuesto, el deber de tutela que respecto del ambiente, dentro de este, los humedales, ostenta el Estado y sus instituciones. En esa línea de análisis, el citado informe ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013 del Área de Conservación La Amistad Caribe del SINAC, permite concluir sobre la delimitación del área de influencia y protección del Humedal Zona Caribe Central, estableciendo que una sección de la propiedad descrita en el plano catastrado L-901560-2004 con un área de 2.52 hectáreas, se ubica dentro de terrenos clasificados como Humedal Zona Caribe Central y que una sección de la misma con un área de 0.15 hectáreas presenta material pétreo o granular depositado superficialmente. El citado informe permite establecer el área del predio Argón que siendo parte de humedal fue impactada y afectada por el depósito y esparcimiento superficial de lastre.
Con todo ese informe deja constancia que las áreas de influencia de humedal ya fueron marcadas y mojoneadas in situ por el SINAC. Es claro que tales acciones han sido tenidas como un daño al ambiente, el cual, incluso fue objeto de calificación y cuantificación por parte de las autoridades del MINAET. Sin embargo, las diversas inspecciones que fueron ordenadas por este Tribunal en la fase de medida cautelar ante causam, evidencian que las obras que se levantaban en esa zona de influencia de humedal, fueron suspendidas y paralizadas, sin que se haya acreditado su continuación. En efecto, en el oficio ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011 del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, se emite informe sobre la inspección realizada por esa unidad administrativa en el predio de almacenamiento de contenedores de la empresa Argon Transport S.A. y valoración económica del daño ambiental.
En ese acto, en lo que se refiere al estado de las obras, se expone que en el sector este se observa la instalación no finalizada de una malla metálica, sin observar personal trabajando en la terminación de esa malla o realizando actividades de relleno. Mediante oficio ACLAC-PNE-OT-032-2012 del 24 de abril del 2012 del Área de Conservación La Amistad Caribe del SINAC, se emite informe de inspección del predio de almacenamiento de contenedores Argon S.A., con el propósito de verificar la ubicación dentro o fuera del humedal de una malla perimetral en construcción en ese predio. La inspección fue realizada el 30 de marzo del 2012 y concluye que la malla perimetral no estaba ubicada dentro de los terrenos clasificados como Humedal Zona Caribe Central. La imposibilidad de continuar con acciones lesivas del ambiente incluso fue dispuesta en la medida cautelar No. 566-2012 de las 15 horas 25 minutos del 06 de septiembre del 2012, en la que se estableció: "Se acoge parcialmente y en los términos en que a continuación se indica como medida cautelar: "Ordénase la suspensión de toda o todo trabajo que la empresa Argón Transport S.A. realice en el predio situado frente a la estación de RITEVE, Limón, nueve millas, Limón 2000.
La orden de suspensión, abarca cualquier obra constructiva, de colocación de tapias, rellenos, postes, tomas, movimientos de tierra o actividad alguna que modifique dicha área, ya sea en forma directa, por medio de sus trabajadores o por medio de terceros." Esta decisión fue avalada por el Tribunal de Apelaciones en cuanto a la suspensión de obras por la resolución resolución No. 699-2012 de las 10 horas 14 minutos del 05 de diciembre del 2012. Ahora, si bien han cesado las acciones perturbatorias del área de humedal, lo cierto del caso es que en la especie se ha acreditado la existencia de un daño ambiental a la zona de Humedal Zona Caribe Central en un área total de 0.15 hectáreas. Sobre este aspecto, en el oficio ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011, el Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, emite informe sobre la inspección realizada por esa unidad administrativa en el predio de almacenamiento de contenedores de la empresa Argon Transport S.A. En ese informe se expone la valoración económica de la citada lesión, considerando un área de afectación de 0.15 hectáreas dentro de terrenos clasificados como Humedal Zona Caribe Central.
Para ello se utilizó la metodología de Evaluación Económica del Daño Ambiental en Costa Rica -desarrollada por Nombre7991 y Nombre136695 (2002)-. En cuanto a la compensación por la lesión ambiental se fijó un valor de beneficios perdidos de ¢244.123.20 (doscientos cuarenta y cuatro mil ciento veintitrés colones con veinte céntimos); costo administrativo de ¢535.200.00 (quinientos treinta y cinco mil doscientos colones), para un total económico de ¢779.323.20 (setecientos setenta y nueve mil trescientos veintitrés colones con veinte céntimos). De igual manera, en cuanto al costo de recuperación, se indicó que era necesario la recuperación del sitio, por cuanto era necesario acondicionarlo para la regeneración natural y que pueda alcanzar su estado de conservación inicial. Expone ese informe que por las características del sitio es necesario garantizar la recuperación, lo que es factible mediante la regeneración natural, si se hace alguna enmienda, pues fue afectada la capa orgánica del suelo.
Estimó necesario un plan de monitoreo por parte de la Administración Forestal, para verificar que el espacio se mantiene sin alteraciones. (Folios 248-259 del principal) Tal aspecto se reitera en el oficio ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013 ya comentado. Valga aclarar que el daño consiste en el depósito de material de lastre en la parte del predio que afecta la zona de humedal, no así en lo que se refiere a la construcción de la malla ciclón, la cual, se insiste, a tono con los informes expresados arriba, se encuentra fuera de esa área de influencia. Ergo, el daño concreto se traduce en la afectación al área de 0.15 hectáreas de humedal yolillo afectadas por el depósito y esparcimiento de material granulado. De ese modo, este Tribunal tiene por acreditado el citado daño y su cuantía, por lo que, ser impone ahora el análisis de las causas que lo han generado, a fin de establecer si se trata de una responsabilidad solidaria entre los co-accionados, o si por el contrario, se refiere a una responsabilidad atribuible de manera directa a una sola de las accionadas.
IX.Análisis de responsabilidad de las Administraciones demandadas. De cara al análisis de responsabilidad de las unidades administrativas accionadas, cabe destacar, si bien el numeral 50 de la Carta Magna establece el deber del Estado y sus Instituciones en la tutela del ambiente, ello no supone que todo daño que se produzca al ambiente supone una responsabilidad directa de las Administraciones Públicas, bajo el alegato de una supuesta falta de fiscalización de las actividades de los particulares. La tutela del ambiente constituye un deber atinente no solo a la institucionalidad pública, sino a toda persona. Incluso, cabe destacar la regulación que establece el artículo 8 de la Ley de Biodiversidad, en cuanto impone la denominada función ambiental de la propiedad inmobiliaria, como parte del uso económico y social del derecho de dominio sobre ese tipo de bienes, lo que implica el deber de los titulares de ajustar el uso de sus tierras a las normas ambientales.
Ejemplo de ello se visualiza en las limitaciones edilicias que impone el canon 33 de la Ley Forestal, respecto de las zonas de retiro cerca de fuente acuíferas. De ese modo, el numeral 50 de la Constitución Política no supone una suerte de responsabilidad ilimitada para los entes públicos, por lo que de cara a discriminar la responsabilidad o no de aquellos, es menester discriminar los supuestos en que tienen deberes de fiscalización directa, de los escenarios en los que el deber de fiscalización surja como derivación de un reclamo, gestión o denuncia presentada por alguna persona, respecto de riesgos de ocurrencia de daños o lesiones al ambiente. En el primer caso, es evidente que resulta factible imponer condenas por la indolencia pública en el ejercicio del marco de tutela ambiental, más en la segunda hipótesis, la responsabilidad se supedita a la acreditación en cada caso, de omisiones en la atención de esos trámites, las cuales, hayan desembocado en detrimentos a los ecosistemas.
Ahora bien, luego del análisis de fondo de las diversas probanzas y alegaciones que constan en autos, es criterio de este cuerpo colegiado, las conductas y omisiones que el accionante atribuye a las instancias públicas pretendidas, en la especie, no se han constituido en causa jurídicamente adecuada y relevante de la lesión reclamada. En efecto, en este tipo de casos, la responsabilidad solidaria de los co-demandados depende de que el daño reclamado sea la consecuencia de la suma inseparable de acciones o inercias imputables -referibles- a las partes. En la medida en que una de esas conductas pueda ser asociada a un daño en particular, no existirá responsabilidad compartida, sino directa de la persona autora de esa conducta. Cabe precisar, en este tipo de situaciones, es necesario analizar las causas imputables a cada sujeto para determinar, de inicio, si se ha incurrido en la causal alegada por el reclamante, y segundo, para inferir si constituye con-causa del daño, de suerte que pueda imputarse ese marco solidario de responsabilidad.
En este tipo de situaciones, la responsabilidad solidaria no nace de norma legal o convención previa, sino de una eventual condena judicial que disponga la inseparabilidad de las causas, lo que ha dado en denominarse "solidaridad impropia". Pues bien, atendiendo al daño ambiental objeto de análisis, considera esta Cámara jurisdiccional, la causa (jurídicamente) adecuada y relevante de esa lesión se constituye en las acciones de almacenamiento de material granular -lastre-, realizado por la empresa Argon Transport, en su predio ubicado en Limón, en el espacio específico de 0.15 hectáreas que forma parte del la zona de Humedal Zona Caribe Central. Nótese que el inicio de esas obras se hizo sin las autorizaciones municipales. Mediante oficio de fecha 30 de mayo del 2011, la Municipalidad de Limón señaló a la entidad en cuestión de varias situaciones presentadas en el predio de marras, indicando, entre otros aspectos que: -se encuentra tramitando un permiso de construcción de una malla perimetral de un área de 600 metros lineales, sobre un relleno de material que sobrepasa la medida de 450 metros cuadrados; -falta el permiso de relleno de material para compactación del parqueo del predio; -no se aporta plano catastrado actualizado; -el desarrollo de las obras constructivas arranca sin contar con licencia municipal, en un avance del 40% a la fecha de clausura el 26 de mayo del 2011;-a pesar de la clausura continúa la construcción irrespetando la colocación de sellos; -de la inspección realizada el 30 de mayo del 2011, se denota que continúan los trabajos de colocación de la malla perimetral.
Se indica a su vez que falta la viabilidad ambiental del proyecto, planos de desfogue de agua, planos por el relleno del terreno, no se indica en los planos la tapia en construcción en el costado norte de la propiedad. En ese sentido, se advierte de la formulación de la denuncia respectiva ante el Ministerio Público por la violación de sellos y desobediencia a la autoridad, así como la denuncia ante el Tribunal Ambiental por la falta de viabilidad ambiental. (Folios 46-52 del judicial) Lo anterior muestra que fueron las acciones de Argon Transport S.A. las que llegaron a constituirse como motivo de la lesión ambiental. El accionante indica que Nombre415 resulta responsable por la inercia en la atención de un terreno que forma parte de sus bienes patrimoniales. Sin embargo, tal alegato no resulta atendible siendo que ya se ha establecido la prevalencia del derecho de propiedad a favor de Argon Transport S.A., sobre la finca del partido de Limón, matrícula de folio real Placa25380, inscrito previo al traspaso de terreno sin inscribir que originó la finca Placa7705 de ese mismo partido.
Con todo, mediante el oficio CEPOT-022-2011 del 12 de julio del 2011, la Comisión Ejecutora del Programa de Ordenamiento Territorial de JAPDEVA, dirigido a la Jefatura del Departamento Legal de ese ente público, remite expediente sobre denuncia presentada por supuestos daños ambientales. Ese oficio representa una primer acción de atención a lo acontecido en el predio de referencia. Luego, es hasta el 19 de agosto del 2011, que el actor interpuso formal denuncia ante la Auditoria Interna de JAPDEVA, peticionando adoptar las medidas concretas de protección del patrimonio natural del Estado bajo administración de Nombre415 y estableciendo la presunta invasión del patrimonio estatal, configuraría la comisión de daños al ambiente de imposible reparación. (Folios 57-58 del principal) Ante ello, por oficio AL-432-2011 del 12 de septiembre del 2011, el Departamento Legal de JAPDEVA, dirigido a la Presidencia Ejecutiva de ese ente, rinde informe sobre la situación del predio que ocupa la entidad Argon Transport S.A. Lo anterior pone en evidencia la atención debida que Nombre415 dio a esas gestiones.
No observa este Tribunal como lo anterior pueda tenerse como un hecho co-generador del daño, siendo que ante la denuncia, se emprenden de inmediato las acciones pertinentes para definir la titularidad de los bienes como la remisión del reclamo a las autoridades competentes en lo que atañe al aspecto o variable ambiental. De esa manera, no existe criterio de imputación que permita establecer la existencia de relación causal con el daño alegado, por lo que, respecto de Nombre415, ha de disponerse el rechazo del reclamo.
X.Sobre la responsabilidad del Estado y de SINAC. En lo atinente al SINAC, cabe señalar que tampoco se observan las incorrecciones apuntadas. En efecto, luego del análisis del expediente administrativo de Nombre3456, se tiene que mediante el oficio SINAC-ACLAC-PNE-066-2011 del 15 de julio del 2011, el Área de Conservación La Amistad Caribe rinde informe preliminar sobre atención de denuncia presentada por afectación de humedales en el predio de contenedores de la empresa Argon Transport S.A. En ese oficio se hace referencia a la denuncia presentada vía correo electrónico por la Asociación de Desarrollo para la Ecología, en fecha 29 de junio del 2011, dirigido a la Comisión Ejecutora del Programa de Ordenamiento Territorial (CEPOT) Nombre415, en el que se advierte de obras de ampliación del predio referido ut supra, y el riesgo de invasión de terrenos de Nombre415, además del posible daño grave al patrimonio natural del Estado, consistente en la construcción sobre un humedal de yolillo.
En el citado oficio se indica que en fecha 01 de julio del 2011 se giraron instrucciones verbales para la debida atención del caso. Se relata además que el 04 de julio del 2011, funcionarios de ACLAC-MINAET realizaron inspecciones en el predio de marras, con el fin de verificar el daño ambiental generado por la presunta ejecución de actividades de ampliación. En la visita se observó la instalación de una malla metálica no finalizada y el depósito considerable de material granular o lastre tendientes a realizar la ampliación. (Folios 73-74 del administrativo de SETENA) Ante ello, mediante el oficio SINAC-ACLAC-PNE-070-2011 del 21 de julio del 2011 se confirió audiencia por 10 días hábiles a la empresa Argon Transport S.A., requiriéndole una serie de información relacionada con las obras (folio 75 del administrativo SETENA) La información prevenida fue presentada el 09 de agosto del 2011, según consta a folio 72 de esa carpeta administrativa.
En definitiva, por oficio ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011 del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, se emite informe sobre la inspección realizada por esa unidad administrativa en el predio de almacenamiento de contenedores de la empresa Argon Transport S.A. y valoración económica del daño ambiental. El informe concluye que en la colindancia este del Predio de Almacenamiento de Contenedores ARGON S.A., demarcada físicamente por la malla metálica en construcción, se determinó la existencia de un área de protección (arroyo o quebrada) determinada por la existencia de peces en el cauce de la misma. Concluyó que correspondía a Nombre3456 evaluar los actos denunciados por el presunto delito de daño en área de protección de quebrada y construcción sobre un humedal de yolillo por actividades desarrolladas en el predio de almacenamiento de contenedores de la entidad Argon.
Asimismo, ordenó la suspensión y/o paralización preventiva de toda actividad, obras y acciones vinculadas específicamente con la ampliación del área del predio referido, que involucren relleno con material granular (lastre), construcción, remodelación y reubicación de infraestructura en forma temporal hasta que se cuente con el pronunciamiento de Nombre3456. (Folios 243-247 del judicial, 151-160 del expediente cautelar, 76-96 del administrativo de Nombre3456) Ante ello, mediante acta de inspección levantada el 11 de noviembre del 2011, al ser las 12 horas 50 minutos, por el Área de Conservación La Amistad Caribe del SINAC, se ordena a la entidad Argon Transport S.A. suspender y/o paralizar preventivamente toda actividad, obras y acciones vinculadas específicamente con la ampliación del área del Predio de Almacenamiento de Contenedores ARGON, que involucren relleno con material granular (lastre), construcción, remodelación y reubicación de infraestructura en forma temporal hasta que se cuente con el pronunciamiento de Nombre3456.
(Folios 212-213 del cautelar, 108-110 del administrativo de Nombre3456). Luego, atendiendo que ese informe no había considerado el plano 7-1122647-2007, que modificó el plano L-901560-2004 y que detalla el espacio actual del predio Argon, en oficio ACLAC-PNE-OT-048-2011 del 04 de noviembre del 2011 del Área de Conservación La Amistad Caribe, referido a la ubicación geográfica del bien del partido de Limón, matrícula de folio real Placa25380, se indica en lo relevante: "De esta forma se determinó que una sección del inmueble descrito en el plano catastrado 7-1122647-2007 con una extensión de 3.42 hectáreas del área total que consigna dicho plano se ubica dentro del terreno clasificado como Humedal Zona Caribe Central según la información registrada en la capa de humedales 2008 (Atlas Digital 2008)...". (Folios 143-150 del legajo cautelar, 106 del administrativo SETENA). Por último, se rinde el informe ACLAC-PNE-OT-032-2012 del 24 de abril del 2012 del Área de Conservación La Amistad Caribe del SINAC, se emite informe de inspección del predio de almacenamiento de contenedores Argon S.A., con el propósito de verificar la ubicación dentro o fuera del humedal de una malla perimetral en construcción en ese predio, en el que se concluye que esa obra civil está fuera de la zona de humedal, lo que se aclara posteriormente con el oficio ACLAC-PNE-OT-057-2012.
Como se observa, la denuncia presentada por un tercero, y no por el actor, fue debidamente atendida por el SINAC, llevando a la suspensión de las obras y a la realización de inspecciones e informes sobre la delimitación geográfica de las zonas ambientales a tutelar, así como de la existencia y alcances de un daño ambiental derivado de acciones de relleno del humedal con lastre o material granular. No se observa la indolencia que acusa el accionante, siendo que las atenciones dadas por las autoridades del SINAC se consideran adecuadas, prontas y efectivas para llevar a la suspensión de las obras intrusivas del ambiente y permitir la reparación del daño. No consta en autos que el reclamante haya formulado denuncia alguna ante el SINAC por este caso, y si bien al amparo del mandato 50 de la Constitución Política y ordinal 105 de la Ley de Biodiversidad, No. 7788, en materia ambiental opera la denominada acción popular, que legitima a cualquier persona a formular acciones en tutela del ambiente, lo cierto del caso es que no se acredita haber planteado denuncia alguna en sede administrativa.
Aun ello, se reitera, no se observa indolencia administrativa de parte del SINAC en la atención de lo acaecido en el predio de Argon Transport S.A.. De esa manera, el daño ambiental mesurado por el SINAC en sus informes no puede considerarse una consecuencia de esas acciones, por lo que además, siendo que no se ha tenido por establecida omisión alguna, no existe parámetro de imputación que permita referir esa consecuencia material a dicha Administración, por lo que no existe nexo de causalidad que lleve a tener a esa instancia pública como responsable o co-responsable del daño en cuestión. Lo anterior ha de extenderse para el Estado, pues no se detalla referencia alguna a omisiones que le sean atribuibles que puedan considerarse motivo del detrimento ecológico. Por el contrario, al atender mediante el SINAC lo acaecido en ese predio, cumple con el deber que le impone el canon 50 de la Constitución Política. En consecuencia, debe disponerse el rechazo de la demanda en cuanto al Estado y SINAC.
XI.Responsabilidad de la empresa Argon Transport S.A. Distinto escenario se muestra respecto de la empresa Argon Transport S.A. Analizado por el fondo el expediente principal, así como las diversas piezas que componen los autos, es criterio de esta Cámara, las acciones que ha de considerarse como causa adecuada del daño ambiental producido en el espacio de 0.15 hectáreas en la Zona de Humedal Caribe Central. Nótese que desde un inicio, la Mediante oficio de fecha 30 de mayo del 2011, la Municipalidad de Limón pone en conocimiento de la empresa Argon Transport S.A. sobre la construcción de obras y relleno de material que sobrepasa la medida de 450 metros cuadrados, así como la falta el permiso de relleno de material para compactación del parqueo del predio. De igual manera, la advertencia sobre ausencia de permisos fue expresada por el SINAC en el oficio SINAC-ACLAC-PNE-070-2011 del 21 de julio del 2011.
Precisamente, al determinar que las obras de relleno de material granular generaba un riesgo de daño en la zona de humedal, fue que Nombre3456 ordenó la suspensión de esas obras, situación que se ha mantenido hasta la fecha, dada la medida cautelar dictada en este proceso. La existencia del daño ambiental, según se ha indicado ut supra, fue determinada por el oficio ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011 del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, en el que se estima la compensación por la lesión ambiental de la siguiente manera: valor de beneficios perdidos de ¢244.123.20 (doscientos cuarenta y cuatro mil ciento veintitrés colones con veinte céntimos); costo administrativo de ¢535.200.00 (quinientos treinta y cinco mil doscientos colones), para un total económico de ¢779.323.20 (setecientos setenta y nueve mil trescientos veintitrés colones con veinte céntimos).
De esta arista de examen, la causa daño es solo atribuible a la sociedad titular del predio, quien se encargó de realizar las obras de depósito de lastre y relleno de zona de humedal en un espacio de 0.15 hectáreas. Para la configuración de ese daño, no se desprende del cuadro fáctico ningún otro hecho relevante al cual pueda asociarse una cuota de co-responsabilidad. Dentro de un análisis de causalismo jurídicamente relevante, fueron esas acciones de la empresa accionada, relativas al desarrollo de obras atentatorias contra el humedal de yolillo, considerado como área protegida al amparo del canon 32 de la Ley Orgánica del Ambiente (No. 7554), las que llevaron a la materialización del detrimento ambiental. Por ende, ha de declararse directamente responsable a esa entidad privada por tal daño al ambiente. Sobre el deber de indemnización de ese daño, la empresa Argon Transport S.A. indica a folio 439 del legajo principal: "...a pesar que la demanda es conjuntamente contra Argón Transport S.A., a Nombre415 y al SINAC y el Estado, en caso de ser aceptada esta solicitud de satisfacción extraprocesal...la empresa Argón Transport S.A., está de acuerdo en cancelar el daño que como consta en autos fue estimado por el SINAC en la suma de setecientos noventa y nueve mil trescientos veintitrés colones con veinte céntimos (sic)..." Entiende este Tribunal que tal manifestación debe tenerse como una anuencia a indemnizar el daño en la medida en que se acogiera la satisfacción extraprocesal.
Luego, al no haberse estimado esa propuesta procesal, no se configura la condición a la que el ente accionado sujetó ese pago. Sin embargo, al haberse establecido que es el responsable por las lesiones ambientales aludidas, de conformidad con el artículo 99 de la Ley Orgánica del Ambiente, ha de imponerse a Argon Transport S.A., las condenas que de seguido se indican. En este sentido, habiéndose fijado por la instancia técnica las cuantificación económica del daño ambiental, a la vez que se expresa que para efectos de rehabilitación y regeneración del medio alterado, ha de acudirse a tales propuestas para efectos de la imposición de las conductas a seguir en este caso. En concreto, por oficio ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013 del Área de Conservación La Amistad Caribe del SINAC, en cuanto a las medidas correctivas por el relleno de un terreno de 0.15 hectáreas en el humedal afectado se indica: "El Área de Protección (área de influencia) digitalizada con orientación Norte (0.86 ha), no presenta rellenos de ninguna clase de material, lo cual propicia la implementación de medidas de Restauración y Recuperación de ecosistemas a través de la regeneración natural y el enriquecimiento Forestal planificado mediante la introducción de árboles de especies nativas específicas por ejemplo.
(...) se detallan las siguiente conclusiones: 1. Considerando que la legislación nacional establece mecanismos de reparación del daño ambiental mediante acciones destinadas a propiciar o acelerar la recuperación de los ecosistemas y hábitats alterados, recreando en la medida de lo posible, la estructura y función originales, de conformidad con el conocimiento de las condiciones previas, las cuales en este caso no se precisan. La selección del Área de Protección con orientación sur con un área de 0.87 ha, para ser Recuperada, involucrando la remoción mecanizada del material pétreo aumenta potencialmente el Impacto Ambiental sobre el suelo y el tiempo de recuperación. 2. El Área de Protección con orientación Norte (área de influencia, 0.86 ha) no presenta relleno de ninguna clase de material, es propicia para las actividades de recuperación y restauración planificada con el mínimo impacto generado y el menor tiempo de recuperación...." (Folios 370-375 del expediente cautelar) En consecuencia, siendo que la remoción del material por la necesidad de incorporar a la zona afectada maquinaria, aumenta el daño al recurso del suelo y el tiempo de recuperación, no se considera adecuado ni prudente, dado ese criterio técnico, ordenar el retiro del material granular esparcido en esa área en cuestión que forma parte del Humedal Zona Caribe Central.
Sin embargo, a efectos de disponer medidas que permitan una tutela efectiva del ambiente, en orden a lo establecido por el canon 50 de la Carta Magna, y al socaire de lo preceptuado por el mandato 99 de la Ley Orgánica del Ambiente, es criterio de este Tribunal, resulta imperativo disponer medidas adicionales a la condena dineraria, consistente en obligaciones de hacer con fines de restauración y regeneración del ecosistema afectado, así como órdenes de abstención de conductas. Así, es menester ordenar a la empresa propietaria, sea, Argon Transport S.A., abstenerse iniciar, continuar o de cualquier forma ejecutar cualquier obra civil, remoción, depósito o traslado de material de cualquier tipo, en el predio situado frente a la estación de RITEVE, Limón, Dirección16371 , , finca del partido de Limón, matrícula de folio real Placa25380, dentro del área que se encuentra dentro del área de influencia del Humedal Zona Caribe Central fijado en el informe ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013 del Área de Conservación La Amistad Caribe del SINAC.
De igual manera, se ordena a dicha entidad, previa coordinación con el SINAC, Área de Conservación La Amistad Caribe, adoptar las acciones que permitan el enriquecimiento Forestal planificado mediante la introducción de árboles de especies nativas, en los términos el informe ACLAC-GASP-RNVSL-001-2013 del 06 de febrero del 2013. Se impone a la entidad Argon Transport S.A. el pago de una indemnización monetaria por el daño ambiental ocasionado en la zona objeto de conflicto, consistente en la suma fijada en el informe ACLAC-PNE-OT-037-2011 del 19 de octubre del 2011 del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, en el que se estima la compensación por la lesión ambiental de la siguiente manera: valor de beneficios perdidos de ¢244.123.20 (doscientos cuarenta y cuatro mil ciento veintitrés colones con veinte céntimos); costo administrativo de ¢535.200.00 (quinientos treinta y cinco mil doscientos colones), para un total económico de ¢779.323.20 (setecientos setenta y nueve mil trescientos veintitrés colones con veinte céntimos).
Sobre el destino de esa condena dineraria, es claro que ha de discrinarse entre la acción popular que impera en materia ambiental para formular demandas que buscan el condena por daño ecológico (arts. 50 de la Carta Magna y 105 Ley No. 7788), de la legitimación para obtener las bondades de esa reparación civil. En estos casos, siendo que el daño se produce al ambiente, los recursos condenados por ese concepto han de considerarse fondos públicos, destinables exclusivamente a la adopción de acciones o programas de regeneración del medio afectado, o bien, si ello es imposible, han de direccionarse a la atención de necesidades ambientales. En este sentido, este Tribunal comparte la posición sostenida por la Sala Primera en el fallo No. 675-2007 del 21 de septiembre 2007, en el que, sobre el destino de esas condenas expresó:"XIV.- Se debe entender que la obligación jurídica que surge, es de reparar al ambiente, y por ello, el particular no puede incorporar en su pretensión que le sean girados esos montos.
En ese mismo orden de ideas, de acuerdo a lo desarrollado en el Considerando XI, con la finalidad de darle una plena y efectiva ejecución a la sentencia del recurso de amparo, corresponde a esta Sala determinar a cuál órgano o ente público se deben dirigir, con el fin de destinarlos a proyectos de restauración y reparación del río Siquiares. Al respecto, estima este órgano colegiado que, por la especialidad de la materia, los recursos técnicos y profesionales con que cuenta el Ministerio de Ambiente y Energía, para el caso en concreto, según sus particularidades y características propias, resulta el idóneo para llevar a cabo esa tarea. Del mismo modo, manteniendo como premisa la ejecución efectiva del fallo constitucional, es de rigor crear un mecanismo de naturaleza presupuestario que beneficie y potencie al máximo los principios de eficiencia, eficacia, celeridad y economía, por lo que, la suma dispuesta por el Tribunal Contencioso Administrativo que condenó solidariamente a la Cooperativa y al Estado, se deberá depositar en la Caja Única de este último (numerales 66 de la Ley de Administración Financiera de la República y Presupuestos Públicos, 83 y 84 de su Reglamento), en una cuenta cliente creada específicamente para tal fin, cuyo titular será el Ministerio de Ambiente y Energía, quien deberá destinarlo para ejecutar obras de reparación y restauración, en forma exclusiva, a proyectos sobre el río Siquiares.
(...)" Aplicando la metodología que establece ese precedente, la suma condenada deberá ser depositada en la Caja Única del Estado, en una cuenta cliente creada específicamente para la regeneración y rehabilitación del Humedal Zona Caribe Central, cuyo titular será el Ministerio de Ambiente y Energía, quien deberá destinarlo para ejecutar obras de reparación y restauración, en forma exclusiva en dicho humedal. Para efectos de control del destino de estas partidas, debe comunicarse esta resolución al Ministerio de Hacienda, Contraloría General de la República (Área de Servicios Públicos Generales y Ambientales), Procuraduría General de la República (Área de Derecho Agro Ambiental), y Defensoría de los Habitantes, para que ejerzan el adecuado control y seguimiento de esta resolución.
XII.Corolario. Análisis de defensas opuestas. Conferido el traslado de ley, las partes accionadas contestaron de la siguiente manera: a) Nombre415: Opuso las defensas de demanda defectuosa y falta de derecho. (Folios 159-174 del judicial); b) SINAC: Interpuso la defensa de falta de integración de litisconsorcio pasivo necesaria para traer a la causa al INDER y la defensa de falta de derecho. (Folios 190-200 del judicial); c) ESTADO: Alegó la defensa de falta de derecho y falta de legitimación activa (folios 236-239 del judicial); d) ARGON TRANSPORT S.A.: planteó la defensa de falta de derecho, falta de legitimación activa y pasiva, así como la de falta de interés. (Folios 348-359 del principal). Por resolución No. 2198-2012 de las 15 horas del 14 de diciembre del 2012, el juzgador de trámite, conociendo de la defensa de falta de integración de litisconsorcio pasivo necesario opuesta por el SINAC dispuso declarar sin lugar esa excepción.
(Folios 415-417 del judicial) La defensa de demanda defectuosa fue desistida en fase de audiencia preliminar. En cuanto a la defensa de falta de legitimación activa, siendo el objeto de esta causa un reclamo por daño ambiental, al amparo del ordinal 105 de la Ley de Biodiversidad en relación al artículo 10 inciso primero numeral d) del Código Procesal Contencioso Administrativo, se dispone el rechazo de dicha defensa. Sobre la legitimación pasiva opuesta por Argon Transport S.A., debe ser rechazada al haberse establecido la relación que tiene con la generación del daño ocasionado a la zona de Humedal Caribe Central. La defensa de falta de derecho debe acogerse en lo que se refiere a JAPDEVA, SINAC y el Estado, respecto de quienes, se declara sin lugar la demanda en todos sus extremos. Se acoge la defensa de falta de derecho opuesta por Nombre136697 . en lo referente a la pretensión de orden de derribo. En lo demás debe ser rechazada. En consecuencia, se declara parcialmente con lugar la demanda incoada contra Nombre136697 . en los siguientes términos:
XI.Costas. De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere, a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, en lo que toca a las acciones emprendidas contra el SINAC, Estado y JAPDEVA, estima este colegio, la litigancia ejercitada por el accionante lo ha sido de buena fe, en la medida en que el objeto de la causa es la tutela de un daño ambiental, el que, si bien no llegó a ser referible a las Administraciones accionadas, no implica que la demanda fuese carente de seriedad en sus postulados. Ergo, se resuelve ese particular sin especial condenatoria en costas. En lo atinente a la acción contra la entidad Argon Transport S.A., al haberse establecido que dicha entidad es la responsable del daño ambiental ocasionado y que en este fallo se ha condenado, se imponen ambas costas a su cargo.
XIII.Mantenimiento de las medidas cautelares. Por resolución No. 566-2012 de las 15 horas 25 minutos del 06 de septiembre del 2012, el juzgador de trámite, conociendo de la medida cautelar ante causam dispuso: "Se acoge parcialmente y en los términos en que a continuación se indica como medida cautelar: "Ordénase la suspensión de toda o todo trabajo que la empresa Argón Transport S.A. realice en el predio situado frente a la estación de RITEVE, Limón, nueve millas, Limón 2000. La orden de suspensión, abarca cualquier obra constructiva, de colocación de tapias, rellenos, postes, tomas, movimientos de tierra o actividad alguna que modifique dicha área, ya sea en forma directa, por medio de sus trabajadores o por medio de terceros. Deberá Nombre415 y el SINAC, informar dentro de los primeros cinco días hábiles de cada mes a este Tribunal Procesal Contencioso Administrativo, de las gestiones realizadas en protección y defensa del Humedal de Yolillo y de las acciones implementadas para su recuperación y protección; en la colindancia con la empresa ARGON TRANSPORT S.A. Notifíquese.-" Atendiendo al principio precautorio y preventivo, y a fin de tutelar la finalidad de las medidas cautelares, cual es mantener vigente el objeto del proceso y posibilitar la eventual ejecución de una posible sentencia estimatoria, debe mantenerse vigente dicha medida cautelar hasta tanto el presente fallo adquiera firmeza.
POR TANTO.
Al amparo del artículo 50 inciso 2 del Código Procesal Contencioso Administrativo, se admite la copia del oficio AL-219-2012-SJ del 12 de octubre del 2012, ofrecida en la audiencia preliminar celebrada el 13 de noviembre del 2013. De conformidad con el ordinal 105 de la Ley de Biodiversidad en relación al artículo 10 inciso primero numeral d) del Código Procesal Contencioso Administrativo, se dispone el rechazo de la defensa de falta de legitimación activa opuesta por el Estado y por Argon Transport S.A..Se rechaza la defensa de falta de legitimación pasiva opuesta por Argon Transport S.A. Se acoge la defensa de falta de derecho en lo que se refiere a Junta Administrativa Portuaria y de Desarrollo Económico de la Vertiente Atlántica (JAPDEVA), el Sistema Nacional de Áreas de Conservación (SINAC) y el Estado, respecto de quienes, se declara sin lugar la demanda en todos sus extremos, sin especial condenatoria en costas. Se acoge la defensa de falta de derecho opuesta por la empresa Argon Transport S.A., en lo referente a la petitoria de derribo de obras. Se rechaza en cuanto a los demás extremos petitorios. En consecuencia, se declara parcialmente con lugar la demanda incoada contra Nombre136697 . en los siguientes términos, entendiéndose por denegada en lo que no se indique de manera expresa:
