SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At seventeen hours and thirty-five minutes on the twenty-first day of December, two thousand twelve.- POSSESSORY INFORMATION PROCEEDING (PROCESO DE INFORMACIÓN POSESORIA), brought by SIRIO EDITORIAL SOCIEDAD ANÓNIMA, corporate identification number CED1- - , represented by its general attorney-in-fact with unlimited authority (apoderada generalísima sin límite de suma), [Nombre1], married once, businesswoman, resident of San Ana, identification card CED2- - . BACKGROUND:

1. The petitioner instituted a possessory information proceeding for the purpose of registering in its name with the Registro Público de la Propiedad the property described as follows: “NATURE: Mostly pasture, with forest in the protection area (área de protección) of the stream and one house. LOCATION: La Trinidad, [Dirección1], , Province of San José. AREA: Thirty-five thousand one hundred twenty-seven square meters. BOUNDARIES: Bounded as follows: NORTH: Comercializadora Kalicanto de Alcalá Sociedad Anónima, [Nombre3] and [Dirección2], with frontage measuring one hundred two linear meters and thirty-seven centimeters. SOUTH: [Nombre3] and [Nombre4]. EAST: [Nombre3] and [Dirección3] road, with frontage measuring one hundred sixty-one linear meters and forty-four centimeters. WEST: [Nombre3]. ESTIMATED VALUE: Three million one hundred sixty-one thousand four hundred thirty colones. CADASTRAL PLAN:

2. The Procuraduría General de la República entered an appearance in the proceeding; see virtual desktop, associated documents folder, main case file, images 43, 45, and 46. The Instituto de Desarrollo Agrario likewise entered an appearance in the proceeding; see virtual desktop, associated documents folder, main case file, image 52.

3. Judge Vanessa Fisher González of the Juzgado Agrario del Segundo Circuito Judicial de San José, by decision number 59-2012, issued at eight hours and twenty-five minutes on the twentieth day of July, two thousand twelve, ruled: “POR TANTO: Pursuant to Ley de Informaciones Posesorias No. 139 del 14 de julio de 1941 and its amendments, these possessory information proceedings are approved, with the Procuraduría General de la República and the Instituto de Desarrollo Agrario having participated as parties. The Registro Público de la Propiedad shall register, free of liens, co-owners, and encumbrances in rem (cargas reales), and without prejudice to third parties having superior rights, in the name of SIRIO EDITORIAL SOCIEDAD ANONIMA (sic), domiciled in Santa Ana, [Dirección4] Abastecedor La Guaria, corporate identification number No. CED7, represented by [Nombre1], married once, businesswoman, resident of San Ana, identification card CED8, acting as general attorney-in-fact with unlimited authority, the following property: NATURE: Mostly pasture, with forest in the protection area of the stream and one house.

LOCATION: (sic) La Trinidad, [Dirección5] Copey, Cantón Décimo Sétimo Dota, Province of San José. AREA: Thirty-five thousand one hundred twenty-seven square meters. BOUNDARIES: Bounded as follows: NORTH: Comercializadora Kalicanto de Alcalá Sociedad Anónima, [Nombre5] and [Dirección2], with frontage measuring one hundred two linear meters and thirty-seven centimeters. The property was acquired through a purchase and sale from CALDERON NAVARRO SOCIEDAD ANONIMA, (sic), corporate identification number CED9, by public instrument number ninety-nine-twenty-one, executed before Notary Luis Diego Acuña Delcore. [Nombre6], identification card CED10; [Nombre7], identification card CED11; and [Nombre8], identification card CED12, testified as witnesses.

The notice concerning these proceedings was published in Boletín Judicial number 188 del 2 de octubre del 2006. The property lies within Reserva Forestal Los Santos, created pursuant to Decreto Ejecutivo No. 5389-A del 12 de noviembre de 1975, and the possessory acts (actos posesorios) have been exercised in compliance with the conforming land use (uso conforme del suelo). The land to which title is sought shall be subject to the reservations prescribed by Ley General de Caminos Públicos, insofar as the minimum width of highways is twenty meters and that of local roads is fourteen meters (Artículos 19 de la Ley de Informaciones Posesorias y 4 de la Ley General de Caminos Públicos). The area adjoining the stream running along the western boundary and another stream running through the northern sector of the property from east to west constitutes a protection area under artículo 33, inciso b) de la Ley Forestal No. 7575, and the cutting or removal of trees is prohibited.

It is also placed on record that the channels and waters of those streams are in the public domain pursuant to Ley de Aguas. The title-seeking company is ordered to allow the continued natural regeneration of the stream running through the northern sector of the property from east to west, within a strip fifteen meters wide, measured horizontally on both sides of the bank of that channel if the land is flat, and fifty meters wide if it is rugged” (see decision on virtual desktop, associated documents folder, trial judgment).

4. Attorney Mauricio Castro Lizano, in his capacity as Deputy Government Attorney, filed an appeal (recurso de apelación), expressly stating the reasons for challenging the trial court’s position. (See virtual desktop, associated documents folder, appeal added on 14 de diciembre de 2012.)

5. The statutory requirements have not been observed in the processing of the proceeding, and the judgment contains errors or omissions capable of rendering it null and void.

CONSIDERANDO:

I.Given the manner in which the matter is decided, no ruling is made regarding the list of proven facts contained in the judgment.

II.The appeal was filed against the judgment rendered at 08 hours 25 minutes on 20 de julio de 2012, which approved the possessory

information proceeding. Government attorney Mauricio Castro Lizano appeals on the following grounds: 1. Possession protective of the natural resource (posesión protectora del recurso natural) was not established. He states that property or possessory rights cannot be acquired because the ecosystem was not protected. He recounts the judicial inspection (reconocimiento judicial) of [Dirección7]. He argues that this situation violates the provisions of section 7 de la Ley de Informaciones Posesorias and cites precedents from this Court. He asserts that the land is devoted to pasture and grazing land for livestock farming, and refers to the cadastral plan, the judicial inspection record, the petitioner’s initial pleading, the land-use study (estudio de uso de suelos) at folio 166, and the witness testimony on pages 202 through 207. He considers such pasture and livestock-farming activities contrary to the designated use of land located in protected wilderness areas (áreas silvestres protegidas).

He maintains that this Chamber has held that, even when a land-use study certifies a conforming use, the type of land cover (cobertura) in question does not establish ecological possession (posesión ecológica), and that titleholders have a duty to promote forest cover (cobertura forestal); failure to do so is sufficient reason to deny the proceedings. 2. He adds that the witness evidence is insufficient to prove the exercise of ten-year possession (posesión decenal) before the effective date of decree number 5389-A, which created Reserva Forestal Los Santos, del 12 de noviembre de 1975. He states that witness [Nombre6] was 50 years old when giving testimony in 2009 and thus, according to his calculation, was 6 years old at the relevant time. In his view, this is insufficient because such a young age undermines the witness’s capacity for discernment. Witnesses [Nombre7] and [Nombre9] do not mention Calderón y Navarro Sociedad Anónima or the children of [Nombre10], nor does witness [Nombre6], the initial pleading, or the testimony of instrument number 99-21; he therefore asserts that there is a contradiction regarding the transferors [Nombre11] and [Nombre12], at folios 159 and 161.

He explains that there must be consistency among the witness statements, between those statements and the documentary evidence submitted, and with the assertions made in the initiating pleading, for transferred possession (posesión transmitida) to be credited, in light of substantive truth (verdad real) and credibility before the adjudicator. 3. He asserts that the technical opinion of Acueductos y Alcantarillados was not obtained to determine whether the springs (nacientes) supply water to any community or whether they should be reserved for that purpose, because the judicial inspection and the statements reveal their existence. 4. The area shown on plan SJ-1081998-2006 is included within the properties [Dirección8]; he refers to Catastro Nacional official communication 0700085 and the sheets supporting that technical finding. III. The matter concerning the procedural omission alleged by the State’s representative must be resolved first.

It concerns the failure to request the technical opinion of Acueductos y Alcantarillados to determine whether the springs supply water to any community or whether they should be reserved for that purpose, because the judicial inspection and the statements reveal their existence. The judicial inspection record (virtual desktop, associated documents, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento -oct 18 2012 1:58PM, folio 156) stated as follows: “...Approximately 130 linear mts (sic) from [Dirección9] () there is a stream with very little runoff (escorrentía), covered with blackberry bushes and undergrowth; however, it has no trees protecting it. It should be noted that this stream comes from the adjoining property across the northern boundary. Also visible near this stream, farther inside the property, is a (water well), an area of approximately 20 mts (sic) of standing water, which the husband of the owner of the petitioner company tells us dries up during the summer in that sector....” Witness [Nombre6] (virtual desktop, associated documents, documents, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento - oct 18 2012 1:58 PM, folio 205) stated as follows: “...it has an area with small trees, or shade as we call it, on the side where the stream passes....” Finally, the certificate of conforming land use (certificación de uso conforme del suelo) (virtual desktop, associated documents, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento - oct 18 2012 1:58 PM, folio 166) stated in the observations: “...stream along its boundar [Address10] has an adequate protection zone.

Natural Forest. Recommendations: As of this date, maintain the forest protection zone along the stream...”. The stream described by the deponents and in the other documents indicated is not depicted on the survey plan (plano de agrimensura) on folio 4. This Court understands that a topographic survey (levantamiento topográfico) must conform to reality; therefore, together with the statements of the party, which are made under oath pursuant to Article 3 of the Ley de Informaciones Posesorias, they reflect the actual condition of the property for which title is sought. Section 2 of the aforementioned law establishes that plans must represent exact data and measurements and places responsibility for compliance with its provisions upon the professional responsible for the survey. It also refers to Laws 3454 of November 14, 1964, and the Law Governing the Practice of Topography and Land Surveying, No. 4294 of December 16, 1968.

Section 1 of the Regulations to the National Cadastre Law lists a series of definitions. For purposes of this case, the following concepts are relevant: “Survey Plan: The document through which only one estate, parcel, or tract is represented graphically, mathematically, textually, and legally, in compliance with the standards established by these regulations. Registered Cadastral Plan (Plano Catastrado): A survey plan that has been registered with the National Cadastre.” In light of all the foregoing, and as stated above, the plan represents the property for which title is sought and must accurately reflect it graphically, mathematically, textually, and legally. In this matter, areas that are not properly depicted are included, nor does the survey exclude the corresponding reduction from the area for which title is sought.

IV.Furthermore, the case file does not contain the study by the Watershed Department of Acueductos y Alcantarillados indicating whether the waters flowing through the property at issue (fundo en litis) are intended, or must be reserved, to supply water to any community. In this matter, the Court did not request it, even though the watercourse was not depicted in the topographic survey, a decision with which this Court does not agree. Based on the legislation cited, this Chamber considers it necessary

to describe that physical feature in the registered cadastral plan, as required by Article 34(e) of the Regulations to the National Cadastre Law. In addition, the adjudicating judge must consider what was agreed at the XVI Ibero-American Judicial Summit, held in Buenos Aires, Argentina, on April 25, 26, and 27, 2012, at which the Buenos Aires Declaration 2012 was signed. In the section concerning information and transparency and public participation in environmental matters, the following was declared: “INFORMATION AND TRANSPARENCY IN ENVIRONMENTAL MATTERS. It is important for the judge and the parties to have access to truthful, effective, accurate, and suitable environmental information so that effective judgments may be rendered in environmental matters. It is important for judges to ensure that citizens and society have access to the environmental information they need or request, including information held by judicial bodies.

It is important for judges to recognize how significant their contribution, as public officials, can be to environmental education and to raising public awareness concerning environmental protection. It is important for judicial bodies to use suitable and efficient means to convey relevant environmental information to everyone, to inform society about their activities in environmental matters, and to explain to the public environmental issues decided in judicial proceedings. It is important for judges to have broad access to all environmental information held by the parties, third parties, and public bodies, in accordance with each legal system and Principle 10 of the Rio Declaration. PUBLIC PARTICIPATION IN ENVIRONMENTAL MATTERS. It is important that, whenever possible, judicial bodies adopt environmental-management policies and encourage measures for the rational and sustainable use of their resources.

It is important for judicial bodies to consider their socio-environmental responsibilities in their strategic planning, including: (a) the adoption of any environmental-protection measures that are possible or necessary; (b) requiring judges and officials to exercise environmental responsibility in the performance of their duties; and (c) giving preference to practices that combat the waste of natural resources, promote sustainability, and prevent environmental harm. It is important for each country’s procedural mechanisms to ensure broad participation by citizens and society in judicial actions relating to the environment. It is important that the judge hearing the case or the competent court, whenever deemed necessary or appropriate, hold public hearings to clarify issues relevant to the adjudication of environmental actions, hear society’s views, and obtain technical statements from specialists regarding matters relevant to rendering judgment.

It is important that, while respecting impartiality and independence, judges share the experience accumulated through their daily handling of environmental proceedings and problems, maintain institutional contacts, and cooperate with public bodies, social actors, economic or professional associations, nongovernmental organizations, and the scientific and academic community, in order to improve the administration of justice, efficiently apply environmental legislation, and publicize environmental-education and environmental-protection initiatives....” From the foregoing, this Court finds that the person responsible for adjudicating matters in court and the parties must have access to truthful, effective, accurate, and suitable environmental information so that effective judgments may be rendered in environmental matters. In possessory-information proceedings (informaciones posesorias), it is evident from Sections 45 and 50 of the Political Constitution that the adjudicator must ensure that the title eligible for registration in the Public Registry provides information aimed at generating the greatest well-being for all inhabitants of the country, fostering agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations.

Moreover, the cited declaration establishes the importance of judges ensuring that citizens and society have access to the environmental information they need or request, including information held by judicial bodies. When possessory-information applications are processed, the decision to be entered in the corresponding registry must provide the general public with accurate and transparent information. Accordingly, it is important that all information concerning water resources, and potentially sources supplying drinking water to communities, be clear and accurate. The supply of drinking water is a right to which all men and women must have access. The Constitutional Chamber of the Supreme Court of Justice has addressed this matter as follows: “‘III.—Fundamental right to drinking water. In its case law, this Court has recognized that the rights to health and life are fundamental human rights that depend—to a large extent—on access to drinking water, and that the competent bodies have an unavoidable responsibility to ensure that society as a whole does not see those rights diminished....” (Judgment No. 18633 at 10:50 a.m. on December 21, 2007).

It is therefore imperative that information concerning physical features appear in topographic surveys; in this matter, as stated, the judgment was premature because the statutory requirements had not been fully satisfied.

V.For the foregoing reasons, pursuant to Articles 45 and 50 of the Political Constitution, Section 11 of the Ley de Informaciones Posesorias,

Sections 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria, Article 34(e) of the Regulations to the National Cadastre Law, and Section 7 of the Ley de Tierras y Colonización, the applicant must be granted a reasonable period of two months to submit a new plan describing the physical features existing on the property through which the stream flows, with the corresponding reduction of the area for which title is sought after those exclusions.

Furthermore, before judgment is rendered, a report must be requested from the Watershed Department of Acueductos y Alcantarillados stating whether those waters need to be reserved for human consumption. Therefore, the judgment must be declared null and void because it was rendered prematurely.

THEREFORE:

The judgment is annulled. Before rendering judgment, the Trial Court must request a report from the Watershed Department of Acueductos y Alcantarillados indicating whether the waters flowing through the property at issue are intended, or must be reserved, to supply water to any community, based on the new plan that the applicant shall submit within a reasonable period of two months, which shall describe the physical feature existing on the property through which the stream flows, with the corresponding reduction of the area for which title is sought. The applicant is hereby warned that, in the event of noncompliance, judgment will be rendered on the basis of the topographic survey contained in the case file.

VOTO N° 1597-F-12 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diecisiete horas y treinta y cinco minutos del veintiuno de diciembre de dos mil doce.- PROCESO DE INFORMACIÓN POSESORIA, promovidas por SIRIO EDITORIAL SOCIEDAD ANÓNIMA, cédula jurídica número CED1- - , representada por su apoderada generalísima sin límite de suma [Nombre1] , casada una vez, empresaria, vecina de San Ana, cédula de identidad CED2- - . Intervienen en el proceso, la PROCURADURÍA GENERAL DE LA REPÚBLICA, representada por Mauricio Castro Lizano, mayor, abogado, vecino de Heredia, cédula de identidad CED3 - - , en su condición de procurador adjunt o; INSTITUTO DE DESARROLLO AGRARIO, actualmente INSTITUTO DE DESARROLLO RURAL, cédula jurídica CED4- - - , representado por [Nombre2] , mayor, casado, ingeniero agrónomo, vecino de Limón, cédula de identidad número CED5- - , en calidad de apoderado generalísimo sin limite de suma. Actúa como apoderado especial judicial de la promovente, el letrado Luis Diego Acuña Delcore, mayor, abogado, cédula de identidad número CED6- - . Tramitada ante el Juzgado Agrario del Segundo Circuito Judicial de San José.

RESULTANDO:

1. La promovente interpuso proceso de información posesoria con el fin que se inscriba a su nombre en el Registro Público de la Propiedad la finca que describe así: "NATURALEZA: mayoría de pasto, con bosque en el área de protección de la quebrada y una casa. SITUACIÓN: La Trinidad, [Dirección1] , , de la Provincia de San José. MEDIDA: Treinta y cinco mil ciento veintisiete metros cuadrados. LINDEROS: Linda al: NORTE: Comercializadora Kalicanto de Alcalá Sociedad Anónima, [Nombre3] y [Dirección2] con un frente de ciento dos metros con treinta y siete centímetros lineales. SUR: [Nombre3] y [Nombre4] . ESTE: [Nombre3] y calle [Dirección3] con un frente de ciento sesenta y un metros con cuarenta y cuatro centímetros lineales. OESTE: [Nombre3] . ESTIMACIÓN: Tres millones ciento sesenta y un mil cuatrocientos treinta colones. PLANO CATASTRADO:

SJ-1081998-2006"(ver escritorio virtual, carpeta de documentos asociados, expediente principal, imagen 11 y carpeta de documentos asociados, sentencia primera instancia, imagen 16).

2. La Procuraduría General de la República se apersonó al proceso, ver escritorio virtual, carpeta de documentos asociados, expediente principal, imagen 43, 45 y 46; a su vez el Instituto de Desarrollo Agrario se apersonó el proceso ver escritorio virtual, carpeta de documentos asociados, expediente principal, imagen 52 .

3. La jueza Vanessa Fisher González, del Juzgado Agrario del Segundo Circuito Judicial de San José, mediante resolución número 59-2012, de las ocho horas y veinticinco minutos del veinte de julio de dos mil doce, resolvió:"POR TANTO: De conformidad con la Ley de Informaciones Posesorias No. 139 del 14 de julio de 1941 y sus reformas, se aprueban estas diligencias de Información Posesoria, en la cual han intervenido como partes la Procuraduría General de la República y el Instituto de Desarrollo Agrario. Proceda el Registro Público de la Propiedad a inscribir libre de gravámenes, condueños y cargas reales, y sin perjuicio de terceros de mejor derecho, a nombre de SIRIO EDITORIAL SOCIEDAD ANONIMA (sic), domiciliada en Santa Ana, [Dirección4] Abastecedor La Guaria, cédula jurídica No. CED7, representada por [Nombre1] , casada una vez, empresaria, vecina de San Ana, cédula de identidad CED8 con carácter de Apoderada Generalísima sin límite de suma, la siguiente finca: NATURALEZA: mayoría de pasto, con bosque en el área de protección de la quebrada y una casa.

SITUACION: (sic) La Trinidad, [Dirección5] Copey, del Cantón Décimo Sétimo Dota, de la Provincia de San José. MEDIDA: Treinta y cinco mil ciento veintisiete metros cuadrados. LINDEROS: Linda al: NORTE: Comercializadora Kalicanto de Alcalá Sociedad Anónima, [Nombre5] y [Dirección2] con un frente de ciento dos metros con treinta y siete centímetros lineales. SUR: [Nombre3] y [Nombre4] . ESTE: [Nombre3] y [Dirección6] con un frente de ciento sesenta y un metros con cuarenta y cuatro centímetros lineales. OESTE: [Nombre3] . ESTIMACION: (sic) Tres millones ciento sesenta y un mil cuatrocientos treinta colones. PLANO CATASTRADO: SJ-1081998-2006. La finca la adquirió por compraventa que le hiciera a CALDERON NAVARRO SOCIEDAD ANONIMA,(sic) cédula jurídica CED9, en escritura pública número noventa y nueve-veintiuno, ante el Notario Luis Diego Acuña Delcore. Declararon como testigos [Nombre6] cédula CED10, [Nombre7] cédula CED11 y [Nombre8] cédula CED12.

El edicto relativo a estas diligencias salió publicado en el Boletín Judicial número 188 del 2 de octubre del 2006. El inmueble está dentro de la Reserva Forestal Los San tos creada según Decreto Ejecutivo No. 5389-A del 12 de noviembre de 1975 y se han ejercido los actos posesorios cumpliendo con el uso conforme del suelo. El terrenos a titular quedará afectado por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros (Artículos 19 de la Ley de Informaciones Posesorias y 4 de la Ley General de Caminos Públicos). El área contigua a la Quebrada que pasa por la colindancia oeste y otra que pasa por el sector norte del fundo que corres de este a oeste, constituye área de protección según el artículo 33, inciso b) de la Ley Forestal No. 7575 y queda prohibida la corta o eliminación de árboles, asimismo se hace constar que el cauce y las aguas de esas corrientes son de dominio público conforme a la Ley de Aguas.

Se ordena a la sociedad titulante proceda a permitir la continuación de la regeneración natural de la quebrada que pasa por el sector norte de la finca, que corre de este a oeste, en una una franja de quince metros medidas horizontalmente a ambos lados de la ribera de ese cauce si el terreno es plano y de cincuenta metros si es quebrado" (ver resolución en escritorio virtual, carpeta de documentos asociados, sentencia de primera instancia).

4. El licenciad o Mauricio Castro Lizano, en su condición de Procurador Adjunto, formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del Juzgado de instancia . (ver en escritorio virtual, carpeta de documentos asociados, recurso de apelación incorporado con fecha 14 de diciembre de 2012 ).

5. En la substanciación del proceso no se han observado las prescripciones legales, y se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad.

Redacta la jueza Díaz Bolaños; y,

CONSIDERANDO:

I. Por la forma en que se resuelve se omite pronunciamiento sobre el elenco de hechos probados contenidos en el fallo

II.La apelación es interpuesta contra la sentencia de las 08 horas 25 minutos del 20 de julio de 2012, donde se aprobó la información

posesoria. Recurre el procurador Mauricio Castro Lizano por los siguientes motivos: 1. No se acreditó la posesión protectora del recurso natural. Indica hay imposibilidad de adquirir derechos de propiedad o de posesión por no haber protegido el ecosistema. Reseña el reconocimiento judicial de [Dirección7] . Aduce tal situación vulnera lo dispuesto en el ordinal 7 de la Ley de Informaciones Posesorias y cita precedentes de este Tribunal. Afirma el terreno esta dedicado a pastos y potrero, ejerciendo una actividad ganadera, reseña el plano catastrado, acta de reconocimiento judicial, escrito inicial del promovente, estudio de uso de suelos en folios 166, y declaraciones testimoniales de páginas 202 a 207. Considera ese tipo de labores de pasturas y ganadería son contrarias a la vocación de los terrenos ubicados en áreas silvestres protegidas. Sostiene esta Cámara ha estimado que aunque en el estudio de uso de suelo se certifique un uso conforme, el tipo de cobertura en mención no permite tener por acreditada una posesión ecológica y es deber de los titulares promover la cobertura forestal; y ante la omisión hay razón suficiente para improbarlas. 2.

Agrega la prueba testimonial es insuficiente para probar el ejercicio de la posesión decenal previa a la vigencia del decreto número 5389-A, creador de la Reserva Forestal Los Santos, del 12 de noviembre de 1975. Indica el testigo [Nombre6] tenía 50 años al momento de su declaración, año 2009, por lo que contaba según calcula, con 6 años. Desde su criterio es insuficiente pues demerita la capacidad de discernimiento a tan corta edad. El deponente [Nombre7] y [Nombre9] no mencionan a la sociedad Calderón y Navarro Sociedad Anónima, ni a los hijos de [Nombre10] , no la declarante [Nombre6] , o bien en el escrito inicial, ni el testimonio de escritura número 99-21; por tal razón afirma hay contradicción por los transmitentes [Nombre11] y [Nombre12] , de folios 159 y 161. Explica, debe haber congruencia entre las declaraciones testimoniales, entre éstas y la documental aportada, así como lo expuesto en el libelo iniciado, para poder hacer valer la posesión transmitida, a la luz de la verdad real y la credibilidad para el juzgador. 3.

Afirma no se recabó el criterio técnico de Acueductos y Alcantarillados para determinar si las nacientes surte agua a alguna población o conviene reservarlas para tal fin, porque el reconocimiento judicial y las declaraciones revelan tal existencia. 4. El área del plano SJ-1081998-2006 está incluida en las fincas [Dirección8] ; remite al oficio de Catastro Nacional 0700085 con las láminas que dan respaldo a tal situación técnica. III. Procede en primer orden resolver aquello vinculado con la omisión en los procedimientos que acusa la representación estatal. Se relaciona con la omisión de requerir el criterio técnico de Acueductos y Alcantarillados para determinar si las nacientes surte agua a alguna población o conviene reservarlas para tal fin, porque el reconocimiento judicial y las declaraciones revelan tal existencia. En el acta del reconocimiento judicial (escritorio virtual, documentos asociados, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento -oct 18 2012 1:58PM, folio 156) se indicó lo siguiente: "...Aproximadamente a 130 mts (sic) lineales del [Dirección9] () existe una quebrada con muy poca escorrentía cubierta de matas de mora y monte, sin embargo no cuenta con árboles que la protejan.

Cabe señalar que esta quebrada viene de la finca colindante por el lindero norte. Se nota también cerca de esta quebrada hacia a dentro de la finca un (pozo de agua) un área de aproximadamente 20 mts (sic) de agua estancada que nos manifiesta el esposo de la dueña de sociedad promovente se ese sector se seca en verano...". Por otra parte, el deponente [Nombre6] (escritorio virtual, documentos asociados, asociados, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento - oct 18 2012 1:58 PM, folio 205), expuso lo siguiente: "... tiene una parte de arbolerita o sombra que llamamos por el lado de la quebrada que pasa. ..". Por último en la certificación de uso conforme del suelo, (escritorio virtual, documentos asociados, EXPEDIENTE PRINCIPAL-[ 6 806,05KB ] /Agregar Documento - oct 18 2012 1:58 PM, folio 166) indicó en las observaciones: "...quebrada en su colindania [Dirección10] se tiene adecuada zona de protección.

Bosque Natural. Recomendaciones: Como a la fecha mantener la zona de bosque de protección a la quebrada... ". La quebrada descrita por los deponentes y demás documentos indicados no está graficada en el plano de folio 4. Este Tribunal comprende que un levantamiento topográfico se debe ajustar a la realidad, y de ahí junto con las manifestaciones de la parte, las cuales se hacen bajo la fe de juramento, al tenor de lo indicado en el artículo 3 de la Ley de Informaciones Posesorias, son la realidad del inmueble a titular. El ordinal 2 de la ley en mención, establece que los planos deberán representar datos y medidas exactas, e impone al profesional encargado del levantamiento la responsabilidad por el cumplimiento de lo estatuido. Además remite a las leyes 3454 del 14 de noviembre de 1964 y la Ley para el ejercicio de la Topografía y Agrimensura, N° 4294 del 16 de diciembre de 1968. En el Reglamento a la Ley del Catastro Nacional, en el ordinal 1° se enlistan una serie de definiciones.

Para los fines de este caso, interesa analizar los siguientes conceptos: ³Plano de Agrimensura: Es el documento mediante el cual se representa en forma gráfica, matemática, literal y jurídicamente sólo una finca, parcela o predio, que cumple con las normas que establece el presente reglamento. Plano Catastrado: Es el plano de agrimensura que ha sido inscrito en el Catastro Nacional´. Con todo lo anterior, y como se ha expresado, el plano representa la finca a titular, y debe ser de forma real, tanto en forma gráfica, matemática, literal y jurídicamente. En este asunto se incluye zonas que no están debidamente dibujadas y tampoco se excluye de tal levantamiento reducción del área a titular correspondiente.

IV.Por otra parte, no existe en autos el estudio del Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados donde indique si las aguas que discurren en el fundo en litis están destinadas o deben ser reservadas para surtir de agua a alguna población. En este asunto, el Despacho no lo solicitó, aun cuando no estaba graficado en el levantamiento topográfico, lo cual no comparte este Tribunal. Esta Cámara considera, con sustento en la legislación citada , la necesidad de

describir en el plano catastrado tal accidente físico, tal y como lo exige el artículo 34 inciso e) del Reglamento de la Ley de Catastro Nacional. Abonado a lo anterior, debe considerar la persona juzgadora, lo acordado en la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, donde se suscribió la Declaración de Buenos Aires 2012. En el segmento relativo a la información y transparencia, y la participación pública en materia de medio ambiente, se declaró lo siguiente: "INFORMACIÓN Y TRANSPARENCIA EN MATERIA DE MEDIO AMBIENTE. Es importante que el juez y las partes tengan acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias y efectivas en materia ambiental. Es importante que los jueces velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales.

Es importante que los jueces tengan en cuenta cuán significativa puede ser su contribución, como agentes públicos, a la educación ambiental y a la sensibilización de la opinión pública en materia de protección del medio ambiente. Es importante que los órganos jurisdiccionales utilicen medios idóneos y eficientes para transmitir a todos la información ambiental relevante, para informar a la sociedad sobre su actuación en materia de medio ambiente y para esclarecer al público cuestiones ambientales decididas en el ámbito judicial. Es importante que los jueces tengan un amplio acceso a toda la información ambiental que obre en poder de las partes, de terceros y de órganos públicos, de acuerdo con lo establecido en cada ordenamiento jurídico y el Principio 10 de la Declaración de Río. PARTICIPACIÓN PÚBLICA EN MATERIA DE MEDIO AMBIENTE.Es importante que, siempre que sea posible, los órganos jurisdiccionales adopten políticas de gestión ambiental e incentiven medidas para un uso racional y sostenible de sus recursos.

Es importante que los órganos jurisdiccionales consideren sus responsabilidades socioambientales en sus planificaciones estratégicas, incluyendo: (a) la adopción de las medidas de protección del medio ambiente que sean posibles o necesarias; (b) la exigencia de una responsabilidad ambiental a los jueces y funcionarios en el desempeño de sus obligaciones; y (c) la preferencia de prácticas que combatan el desperdicio de recursos naturales, incentiven la sostenibilidad y eviten daños al medio ambiente. Es importante que los mecanismos procesales de cada país aseguren una amplia participación de la ciudadanía y de la sociedad en acciones judiciales que guarden relación con el medio ambiente. Es importante que el juez de la causa o tribunal competente, siempre que lo estime necesario o conveniente, realice audiencias públicas para esclarecer cuestiones relevantes para el juicio de acciones ambientales, en las que conozca la opinión de la sociedad y recabe declaraciones técnicas de especialistas sobre aspectos relevantes a la hora de dictar sentencia.

Es importante que, respetando su imparcialidad e independencia, el juez comparta la experiencia acumulada en el trato cotidiano con procesos y problemas ambientales, manteniendo contactos institucionales y cooperando con órganos públicos, agentes sociales, asociaciones económicas o profesionales, organizaciones no gubernamentales y la comunidad científica y académica, en beneficio de la mejora de la prestación jurisdiccional, de la aplicación eficiente de la legislación ambiental y de la divulgación de iniciativas de educación ambiental y de protección del medio ambiente...". De lo anterior estima este Tribunal, la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones.

Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ³«III.- Derecho fundamental al agua potable.

Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte- del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (Voto Nº18633 de las 10 horas 50 minutos del 21 de diciembre de 2007). Resulta entonces imperante que la información sobre los accidentes físicos consten en los levantamientos topográficos, y en este asunto como se afirmó, la sentencia resulta anticipada al no cumplir a cabalidad con los requisitos exigidos por la legislación.

V.Por lo expuesto, con fundamento en los artículos 45 y 50 de la Constitución Política, numeral 11 de la Ley de Informaciones Posesorias,

6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, 34 inciso e) del Reglamento de la Ley de Catastro Nacional, 7 de la Ley de Tierras y Colonización, deberá concederse a la promovente dentro del plazo prudencial de dos meses, un nuevo plano que describa los accidentes físicos existentes en el bien por donde discurre la quebrada con la reducción del área a titular correspondiente, luego de tales exclusiones.

Además, deberá solicitarse, en forma previa a dictar sentencia, un informe emitido por el Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados , donde de cuenta de la necesidad o no de reservar tales aguas para consumo humano. Por ende, deberá declararse la nulidad de la sentencia al haber sido emitida en forma anticipada.

POR TANTO:

Se anula la sentencia . Antes de su emisión, debe el Juzgado pedir un informe al Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados donde indique si las aguas que discurren en el fundo en litis están destinadas o deben ser reservadas para surtir de agua a alguna población, con base al nuevo plano que presentará la promovente dentro del plazo prudencial de dos meses, el cual describa el accidente físico existente en el bien por donde discurre la quebrada , con la reducción del área a titular correspondiente. Lo anterior con el apercibimiento en caso de incumplimiento de dictar sentencia con el levantamiento topográfico existente en autos.
