Plenary proceeding (proceso de conocimiento) heard by the Administrative Litigation Court, brought by Nombre230210 SOCIEDAD ANÓNIMA, represented by its president, vested with powers of a general attorney-in-fact with unlimited authority (apoderado generalísimo sin límite de suma), Nombre160319, businessman, resident of Puntarenas; against the STATE, represented by its attorney B, Ana Cecilia Arguedas Apuy, resident of Heredia; the INSTITUTO DE DESARROLLO AGRARIO, represented by its general judicial attorney-in-fact (apoderado general judicial), Nombre34867, resident of San Ramón de Alajuela; Nombre230211, registrar of the Registro Nacional, whose domicile was not stated; and the JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL, represented by its president, vested with powers of a general attorney-in-fact with unlimited authority, Dabogerto Sobaja Morales. Also appearing as special judicial attorneys-in-fact (apoderados judiciales especiales) are Lic. Gerardo Moya Paniagua, whose domicile is unknown, for the plaintiff company; Licda. Marjorie Mora Ramírez for the co-defendant Institute; and licenciadas Guadalupe Ortiz Mora and Ericka Patricia Fallas Garro, both remarried, and licenciados Luis Enrique Castro Fonseca, resident of San Ramón de Alajuela, and Adrián Castro Montealegre, single, for the Junta Administrativa del Registro Nacional. The natural persons are of legal age and, subject to the exceptions noted, married, attorneys, and residents of San José.

BACKGROUND 1. Based on the facts it alleged and the legal provisions it cited, the plaintiff company instituted plenary proceedings seeking a judgment declaring: “1- That the defendants REGISTRO, DEPARTAMENTO DEL REGISTRO PUBLICO (sic) DE LA PROPIEDAD INMUEBLE, and Mr. Nombre230211 (), defendants in these proceedings, be ordered to pay both categories of legal costs (ambas costas). 2- That the Registro Nacional Departamento de Registro Público de la Propiedad Inmueble and Mr. Nombre230211 () be ordered to pay the damages and losses (daños y perjuicios) they have caused my client. 3- That the registration recorded in the Registro Público de la Propiedad Inmueble in favor of the Instituto De (sic) Desarrollo Agrícola (sic) I.D.A., which was erroneously registered in its favor pursuant to a judicial directive (exhorto) recorded under tomo 2009, Asiento número doscientos veintisiete mil cuatrocientos treinta y nueve, be annulled, and that the property described herein and forming the subject matter of this dispute be registered again in favor of my client, Nombre230210 S.A.” 2.

The defendant Junta answered at folios 161 a 185 and raised the defenses (excepciones) of lack of a right of action (falta de derecho) and passive lis pendens (litis pendencia pasiva). Co-defendant Nombre230211 answered as set forth at folios 225 a 232, raising the defense of compulsory joinder of necessary defendants (litis consorcio pasivo necesario). The State, in turn, denied the claim and raised the defenses of lack of passive standing on the merits (falta de legitimación ad causan pasiva) and lack of a right of action. The co-defendant Institute answered as shown at folios 285 al 302, raising the defense of lack of a right of action. Likewise, at folio 300, it waived the conciliation process (proceso conciliatorio).

3. The preliminary hearing (audiencia preliminar) was held at 8 horas 55 minutos on 13 de abril de 2011, at which time all parties addressed the Court.

4. The Administrative Litigation Court, Eighth Section, composed of Judges Rosa Cortés Morales, Sady Jiménez Quesada, and Ricardo Madrigal Jiménez, ruled in judgment n.° 178-2011 of 15 horas 30 minutos on 13 de setiembre de 2011: “The defense of lack of passive standing on the merits raised by the State is denied. The defense of lack of a right of action raised by the co-defendants is sustained. The complaint is dismissed in all respects, and the plaintiff is ordered to pay both categories of legal costs in these proceedings.” 5. The claimant files an appeal on points of law (recurso de casación), expressly stating the grounds on which it relies to challenge the Court’s position.

6. The proceedings before this Chamber have complied with the requirements of law.

CONSIDERING

I.In the complaint giving rise to these proceedings, filed against the Registro Nacional, registrar Nombre230211, the Instituto de Desarrollo Agrario (hereinafter IDA), and the State, the representative of Nombre230210 S.A. (hereinafter Molaretto) stated that, by deed no. 250 executed before notary Gerardo Moya Paniagua at 15 horas on 30 de julio de 2009, his client acquired two properties in the Alajuela Registry District, registration numbers (matrículas) no. Placa43322 and Placa43323. He asserted that it acquired those properties in reliance on the Registry, free of encumbrances and annotations (gravámenes y anotaciones), from Nombre29235 and Nombre230212, both Nombre230212, and that they were registered on 12 de agosto de 2009. He explained that, on 31 de agosto de ese año, its property 231998-000 appeared registered in the name of the Instituto de Desarrollo Agrario. He asserted that this transfer was carried out by registrar Nombre230211, who acknowledged that he had made an error when registering an IDA judicial directive.

He noted that, in this case, it was easy to ascertain that the person named in the judicial directive was not the same person identified in the Registry and, therefore, that document should not have been registered. He consequently stated that he filed an administrative claim (reclamo administrativo) with the Registry Directorate so that the property would be registered again in his client’s name. In response, the Registry issued the decision at 11 horas 14 minutos on 1° de octubre de 2009, in which it entered an administrative warning (advertencia administrativa) concerning the property in question. He continued that, by decision at 12 horas 12 minutos on 18 de diciembre de 2009, the property was ordered frozen (inmovilización) so that the parties could assert their rights in judicial proceedings. In the judgment, he requests: a) that the registration of property 231998-000 in favor of IDA be annulled and that it be ordered registered in his client’s name; b) that the Registro Nacional and co-defendant Nombre230211 be ordered to pay diez millones de colones for non-pecuniary harm (daño moral), damages and losses, and both categories of legal costs.

The co-defendants denied the allegations. They raised the defenses of lack of a right of action and compulsory joinder of necessary defendants. The Court joined IDA and the State as parties to the dispute (litis). Those co-defendants also denied the allegations. They raised the defenses of lack of a right of action and lack of passive standing on the merits. The Court rejected the lack-of-standing defense and sustained the defense of lack of a right of action. It dismissed the complaint, ordering the plaintiff to pay both categories of legal costs; dissatisfied, the plaintiff brings this appeal on points of law.

Appeal on Procedural Grounds

II.Although the appeal intermingles an indiscriminate series of grievances (agravios), an analysis of the challenge presented shows that there are actually two complaints of this nature. In the first, the appellant alleges a violation of the right-of-defense principle (principio de defensa). It asserts that the Court allowed it only 15 minutos for closing arguments (conclusiones), refusing to extend that period even though the opposing party was represented by nine attorneys. Consequently, it states, it was unable to read certain paragraphs of the admitted evidence, such as the statement of the Director of the Registro Público, which closely examines the reasons why an error occurred in registering the judicial directive, as well as the IDA documents demonstrating that the directive was invalid. In the second complaint, it faults the challenged decision for failing to analyze all the facts.

It argues that, although the Court deemed them proven, it did not explain whether the judicial directive was valid in the form in which it was submitted to the Registry. It states that the Court did not analyze compliance with capítulo 29, inciso 9 of the guía de calificación registral, under which such judicial directives are issued only when the restrictions in numeral 67 of the Ley del ITCO have been violated. It adds that the Court also failed to analyze the Ley de Inscripción de Documentos del Registro Público no. 3883 or the registration regulations, and omitted any reference to public notice through the Registry (publicidad registral) and the principle of priority (principio de prioridad).

III.Although provision 109 of the Código Procesal Contencioso Administrativo (hereinafter CPCA) establishes the obligation to allow the litigants to present closing arguments, it also grants the adjudicator a degree of discretion in determining how much time they will have to do so. Thus, the provision states verbatim: “Once the evidence has been received, the parties shall present closing arguments within the time set by the Court.” Review of the oral-trial record (acta del juicio oral) establishes that counsel for the plaintiff presented closing arguments for 20 minutos, not 15 as stated in the appeal. This Chamber likewise notes that counsel for the other parties spoke for shorter periods than the plaintiff: seis minutos; 10 minutos in the case of the Registro Nacional; siete minutos for IDA’s attorney; and ocho minutos for the representative of Mr. Nombre230211. The co-defendants’ representatives were able to set out their closing arguments within a maximum of 10 minutos, using a total of 31 minutos to present their arguments.

Additionally, as shown in the hearing video (10 horas 03 minutos 03 segundos), the Court allowed him 15 minutos, to which the plaintiff’s representative merely responded with the phrase “15 minutos,” without objecting. Likewise, when the allotted period expired (10 horas 18 minutos 34 segundos, according to the hearing video), and the Court informed him that the allotted time had elapsed, he was granted cinco minutos more, to which the litigant responded, “perhaps 15 minutos more.” The presiding judge granted him cinco minutos more to conclude, without the party objecting either then or upon completing his presentation. Accordingly, the appellant does not specify how the alleged denial of a defense (indefensión) occurred, but merely gives examples of matters it was unable to present. Consequently, the Court is not found to have committed the alleged defect, not only because it granted the parties a reasonable period in which to present their closing arguments, but also because the time allotted to the plaintiff was not timely challenged. Nor does it appear that one of the parties was excessively favored, as the appellant contends. The complaint must therefore be rejected.

IV.With regard to the second objection, the Tribunal indicated that, upon accepting the resignation, the IDA Board of Directors ordered that title to the property revert to it. For that purpose, the adjudicators state, it issued the writ (exhorto) dated 4 de mayo de 2009. They further state that the nature of the writ is defined in subsection e) of article 7 of Ley 6735, which provides: “e) Final decisions issued by the Institute in matters within its jurisdiction shall be deemed enforceable orders (ejecutorias), provided that there is no final judicial decision to the contrary; except as expressly provided by this law and without prejudice to any civil liability that the Institute may incur for harm caused to private parties.” They add that the enforceability conferred by this provision upon IDA decisions is fully compatible with that generally afforded to administrative acts (actos administrativos), pursuant to subsections 1) and 2) of provision 146 of the General Law on Public Administration (Ley General de la Administración Pública) (hereinafter LGAP), which establish: “1.

The Administration shall have the authority to enforce on its own, without resorting to the Tribunals, effective, valid, or voidable administrative acts, even against the will or resistance of the obligated party, subject to any resulting liability. 2. The use of administrative enforcement measures shall be without prejudice to any other liability incurred by the regulated party due to noncompliance.” Likewise, they state, those provisions must be read together with provision 450 of the Civil Code, which underpins registry law (materia registral), insofar as it provides: “Only instruments embodied in a public deed (escritura pública), an enforceable order, or another authentic document expressly authorized by law for this purpose may be registered.” Thus, they conclude, the act whose nullity is sought is an act implementing the decision ordering the registration to be canceled and title to the property to revert to the IDA; that act has the force conferred upon administrative acts by administrative law, reinforced by provision 7 of Ley 6735 cited above.

The Registry could therefore have declined to register it only if a judicial order so directing had existed, which is not the case here; consequently, its conduct was in accordance with law. From the foregoing, this adjudicative body considers it clear that the Tribunal did analyze the nature of the writ. The grievance on that point is therefore unfounded, since the adjudicators provided in the challenged judgment the reasons why they deemed registration of that document proper. Now, contrary to the assertion that compliance with chapter 29, subsection 9 of the registry examination guidelines (guía de calificación registral) was not analyzed, this Chamber considers it indisputable from the judges’ statements that their reasoning was based on the registrar’s obligation to register the writ under review. Accordingly, they did justify their position that the cited statutory provisions required the official to register the document under review immediately.

It is therefore undeniable that the judges conducted a substantive analysis of the legality of that conduct, setting forth the legal grounds from which they derived its mandatory nature, regardless of whether they cited the registry-registration guidelines for that purpose. Nor should it be forgotten that this is a procedural claim, which precludes assessing at this juncture whether they correctly examined the provisions potentially applicable to the case. The argument that the adjudicators failed to interpret the text of the Public Registry Document Registration Law (Ley de Inscripción de Documentos del Registro Público) no. 3883, or the registration regulations or guidelines, is therefore unavailing because, as reiterated, with respect to the procedural claim, the adjudicators did provide the legal basis necessary to support the position they advanced.

Appeal on substantive grounds

V.The appellant raises two objections of this nature. Although the first was presented as a procedural grievance based on violation of the rules of sound judicial evaluation (sana crítica), this Chamber considers that it is actually a substantive objection. The appellant in cassation (casacionista) contends that the Tribunal dismissed the complaint on the ground that the registrar acted pursuant to the principle of legality (principio de legalidad), even though that official and the Registry Director himself acknowledged that the registration resulted from an error warranting correction. She states that the judges’ argument—that, under the IDA law, its final decisions are deemed enforceable orders and must therefore be registered exactly as submitted—is illogical because an act contrary to law cannot be upheld. She argues that a registered property cannot change owners “from one day to the next” without prior notice.

She asserts that deeming registration of the writ proper because it was issued while the restrictions remained in effect entails dispossessing a person who acquired the property in good faith. She explains that when the property was acquired by Nombre230210, it was registered in the name of the registered owner. She adds that, because the IDA had taken no action in that regard up to that point, it was reasonable for the titleholder to believe that her relinquishment of the allotment (adjudicación) granted to her was invalid or had become ineffective due to the IDA’s inaction. In the second claim, the appellant states that the Tribunal’s judgment dismissed the complaint on the ground that the writ was issued by the IDA on 4 de mayo de 2009, a date on which the restrictions remained in effect. She maintains that this is immaterial because it was submitted to the Registry on 28 de agosto de 2009, when the restrictions had already expired, in contravention of provision 455 of the Civil Code.

She asserts that the judges also relied on provision 7 of Ley 2825 concerning the Instituto de Desarrollo Agrario, under which decisions issued by that Institute in matters within its jurisdiction are enforceable orders, as well as provision 450 of the Civil Code, which establishes that only instruments embodied in public deeds, enforceable orders, or other authentic documents expressly authorized by law may be registered. She disagrees, arguing that merely because a document is contained in a public deed does not mean that it must be registered “as is”; instead, it must undergo registry examination (calificación) to verify compliance with the requirements, in accordance with Ley de Inscripción de Documentos no. 3883. She adds that, in the case of a writ, it must be determined whether it satisfies all requirements necessary for registration; in this particular case, it could not be registered because, as a relinquishment of the allotment granted, it should have been submitted in a public deed.

She states that the challenged judgment improperly interpreted provision 7 of the IDA Law, mandate 450 of the Civil Code, and failed to apply articles 1, 5, 7 and 8 subsection 1) of Ley de Inscripción de Documentos del Registro Público no. 3883 (hereinafter LIDRP), provisions 34, 35, 54, 55 and 66 of Reglamento del Registro Público no. 26771-J, and provisions 51 and 53 of Reglamento de Organización del Registro Público de la Propiedad Inmueble no. 26883. She concludes that the decision she challenges should have considered and ruled upon the statements made by the registrar and the Registry Director. Finally, she also alleges violations of provisions 41 and 45 of the Constitution, provision 68 of Reglamento Autónomo del IDA, published in La Gaceta no. 168 on 16 de octubre de 2007, and provision 86 of Reglamento del IDA, published in la Gaceta no. 13 on 20 de enero de 2004.

VI.In essence, the first claim seeks to refute the Tribunal’s position that the registrar acted pursuant to the principle of legality. This Chamber observes that the judges’ position in that regard (See recital IV (considerando IV) of this judgment) is based on statutory arguments. The adjudicators reasoned that, under provision 7 of Ley 6735, as well as provisions 146 subsections 1) and 2) of the LGAP and 450 of the Civil Code, the registrar was required to register the writ forwarded by the IDA without further action. Thus, positions based strictly on law, such as that maintained by the Tribunal, cannot validly be countered by mere assessments of the Registry Director’s or the registrar’s own statements regarding the existence of a registration error, because the adjudicators’ position does not concern the evaluation of evidence but is legal in nature. Accordingly, to challenge it, the appellant should have alleged the incorrect application or interpretation of the substantive provisions cited by the Tribunal or, alternatively, the failure to apply or the violation of other regulations, identifying them specifically; the appellant provides none of those elements.

Along those lines, this adjudicative body notes that the appellant in cassation does not allege the violation of any provision. She does not challenge the Tribunal’s arguments or the legal propositions it advances. Nor does she question the validity of applying the mandates cited by the judges. Thus, because the grievance fails to identify the substantive provisions she considers violated, the claim is procedurally deficient and must be rejected.

VII.Before turning to the analysis of the second objection, it is appropriate to clarify the scope of the principle of registry publicity (publicidad registral). In this regard, this Chamber has held: “…the legislature chose to protect the appearance of legal legitimacy created for the legal community through registry publicity, so that the registration of rights would provide—except in exceptional circumstances, such as those established in provision 457 ibídem—legal certainty in transactions involving property, insofar as, as a general rule, unregistered matters are unenforceable against third parties. It must be emphasized, however, that this preference for protecting a good-faith third-party purchaser does not diminish the original titleholder’s right to seek judicial relief, should the titleholder so choose, by asserting the liability of the agent alleged to have caused the dispossession.” (Decision 111-2010 at 14 hours 30 minutes on 21 de enero de 2010)

VIII.The Tribunal indicated that Ms. Nombre230212 had been selected as a beneficiary and awarded (adjudicada), in julio de 1994, parcel 43-B of the Asentamiento Labrador finca de Alajuela, registration no. Placa43323, a document that was submitted to the Registry on 11 de agosto de 1994, subject to the restrictions (limitaciones) established by provision 67 of Ley 2825 for a period of 15 years. The judges noted that, before the expiration of the term of those restrictions, Ms. Nombre230212 relinquished her right to the parcel on 23 de junio de 2007. Consequently, they stated, the entity’s Board of Directors accepted that relinquishment, ordering the existing registration canceled and the property reverted to its name. To that end, they asserted, it issued a writ (exhorto) on 4 de mayo de 2009, the enforceable nature (naturaleza ejecutoria) of which is defined in canon 7 subsection e) of Ley 6735 and subsections 1) and 2) of artículo 146 of the LGAP, which, together with artículo 450 of the Código Civil, permits the registration of instruments of an enforceable nature.

For that reason, they considered that the act whose nullity is sought cannot be analyzed in isolation—that is, solely with respect to its registration—because it constitutes the enforcement of the act ordering the registration canceled and the property reverted to the name of the IDA, and therefore the Registry could not object to its registration. This Chamber observes that the restrictions established by provision 67 of Ley 2825 were imposed on the finca de Alajuela, registration no. Placa43323, for a period of 15 years, expiring on 29 de julio de 2009. Likewise, as demonstrated, through resolution 27 adopted at ordinary session 012-2009, of 13 de abril de 2009, the IDA Board of Directors accepted the relinquishment submitted for that purpose by Ms. Nombre230212 concerning the award of the aforementioned parcel, ordering the registry entry for that property canceled and title returned to the IDA (folios 8 a 14 of the judicial case file).

For that purpose, that Institute issued a writ at 14 horas 30 minutos on 4 de mayo de 2009, which was submitted to the Registry on 28 de agosto de 2009, at which time the property was registered in the name of the plaintiff company. Indeed, by deed executed before Notary Public Gerardo Moya Paniagua at 15 horas on 30 de julio de 2009, Ms. Nombre230212 transferred the property at issue to the company Nombre230210, and the transfer was registered on 12 de agosto de 2009 (folios 12 -14 of the judicial case file). It is therefore beyond dispute that, when the writ was submitted to the Registry’s daybook, Nombre230210 had acquired the property in good faith and in reliance on the Public Registry. It is likewise clear that the transfer made by Ms. Nombre230212 took place on 30 de julio de 2009, when the restrictions imposed on the property under review had expired and were consequently no longer in effect.

Accordingly, it bears repeating that, at the time it was submitted, the writ addressed to the Registry for the purpose of canceling and reversing the registration of right 000 pertaining to the finca de Alajuela, registration no. Placa43324, could not be registered by the Registry. Clearly, that enforceable instrument could not be carried out by the registering authority because it contained an order to cancel the registration of a right recorded in the name of Ms. Nombre230212, who by that date was no longer its holder. Thus, although the request for nullity and reversion had been approved by the IDA within the applicable period, it was submitted late by the co-defendant Institute. It therefore lacked the conditions necessary to be asserted against the instrument of the purchasing company Nombre230210 S.A., which purchased in good faith and in reliance on the Registry, based on the principle of public notice (principio de publicidad) reiterated by this Chamber, which upholds the “… unenforceability against third parties of that which has not been registered.” (Resolución no. 1672-2012 de las 8 horas 40 minutos del 13 de diciembre de 2012) Accordingly, the claim of improper interpretation of numeral 7 of the Ley del IDA and mandate 450 of the Código Civil must be sustained because the enforceable nature of IDA writs, in addition to lacking the elements of a public deed (escritura pública), cannot be asserted against instruments validly registered earlier in reliance on the Registry.

The claim must likewise be sustained for failure to apply provisions 1, 7 and 8 of the LIDRP, insofar as the registrar’s actions violate the principles of public notice and legal certainty (seguridad jurídica) enshrined in those provisions, since rights in the Registry may be created only by the person who has them registered or who acquired them through the instrument establishing them (artículo 7), and documents that conflict with another document previously submitted may not be registered (canon 8 de la LIDRP). The public authority in question is also obligated to examine the registrability of each document submitted to it for that purpose, in accordance with cardinals 34, 35, 54, 66 of Reglamento del Registro Público no. 26771-J, which similarly establish the duty to examine and assess registry documents in advance, in accordance with the principle of registry priority (principio de prioridad registral), without such registration being capable of validating void acts or contracts.

Finally, canons 51 and 53 of Reglamento de Organización del Registro Público de la Propiedad Inmueble no. 26883 are also violated; they subject the registration of documents to the principle of successive title (principio del tracto sucesivo), and therefore a transfer document in which the holder was a person other than the person appearing in the corresponding entry could not be registered.

IX.The defenses of lack of a right of action (falta de derecho) and lack of active standing on the merits (falta de legitimación ad causam activa) raised by the co-defendants are unfounded. According to the defendants, the Registry’s actions are protected by the principle of legality (principio de legalidad), because the registered writ arose from Ms. Nombre230212’s relinquishment of the parcel in question, which, under their theory, created an off-registry situation (situación extraregistral); moreover, in any event, there was a registry obligation by virtue of the enforceability of the act. In this case, pursuant to recitals (considerandos) VII and VIII of this judgment, it has become clear that this is a case of acquisition by a good-faith third party—namely, the plaintiff company—which purchased in reliance on the Registro Nacional. It therefore has the right to bring an action in defense of its interests because, in that capacity, unregistered instruments cannot be asserted against it. It likewise has the standing necessary to proceed in this forum, since it is evident that the plaintiff acquired the property at issue by public deed, which demonstrates the legitimate interest (interés legítimo) under which it acts.

X.The plaintiff sought compensation for non-pecuniary harm (daño moral). She stated that, as representative of the plaintiff company, she had been the victim of that registry error and had personally borne its consequences, since the property is an asset of the company she represents and the shareholders had blamed her for its loss. She assessed that harm at ¢12.000.000,00. She later clarified that she was limiting her claim to the objective harm (daño objetivo) caused to the entity she represented. On this point, the Tribunal indicated that, because the plaintiff originally decided to sue only the registrar and the Registro Público, without directing the claim against the seller, Ms. Nombre230212, it was not possible to fully analyze either the existence of the harm or its origin or causal connection (nexo de causalidad), because the matter involved an off-registry action. The judges therefore denied that claim and likewise rejected the claim for non-pecuniary harm.

In that regard, this Chamber considers that the arguments presented are based on factual premises that provide no further supporting argument. Although the non-pecuniary harm claimed was originally placed within the subjective sphere, as harm caused to the plaintiff’s representative, it was later characterized as objective harm inflicted on the company. This adjudicatory body notes that the appellant’s argument is based, first, on the alleged suffering endured by the representative because he had purportedly been subjected to pressure by the company’s shareholders. The appellant then abandons that theory and contends that the detriment alleged is limited to that objectively caused to the plaintiff company. Nevertheless, those allegations do not appear to have been accompanied by the indispensable evidence that would have permitted this Chamber to assess the alleged impairment. It is therefore clear that the requirements for sustaining the claim made are not met in this case, and it must be rejected.

XI.The plaintiff also sought compensation for consequential loss (perjuicios). She alleged that the property is in the possession of the entity she represents but that it has been unable to dispose of it because of the registry error. She further stated that she retained the services of an attorney who charged her ¢1.500.000,00. She added that she purchased the property to build a house, which she has been unable to do because of the problems that arose, especially because the price of materials has increased. Finally, she stated that carrying out “her project” would cost ¢10.00.000,00 and therefore assessed the total loss at ¢12.000.000,00. In this regard, this Chamber considers that, as stated in recital X, the elements necessary to establish the claimed consequential loss are not present in this case because, although the allegations have established an omission by a public entity, they have not demonstrated that the appellant sustained a loss. Accordingly, because the alleged consequential losses are unsupported by the required evidence, the claim must be rejected.

XII.Given that the co-defendants did not appeal in cassation because they prevailed at first instance, it is necessary to specify the arguments they advanced in their defense in these proceedings. As relevant here, the Registro Nacional alleged that liability should have been asserted against Ms. Nombre230212 because she formalized the sale of the property after relinquishing the award of the parcel. It added that its actions were limited to performing the registry function. For his part, Mr. Nombre230211 did not object to the claim for annulment (pretensión anulatoria). Instead, he stated that he had merely registered the writ. The State alleged that the Registry’s actions were carried out in accordance with the principle of legality because the writ arose from Ms. Nombre230212’s relinquishment of the award. For that reason, it added, there was an off-registry element not attributable to the Registry. Although the IDA did not make a specific claim, it asserted lack of a right of action. In general, all the co-defendants opposed the claims for damages and consequential losses (daños y perjuicios), considering that the elements necessary to establish them were absent because there was a defense precluding liability (eximente de responsabilidad), namely, the act of a third party (hecho de un tercero).

XIII.In this regard, this Chamber finds, in accordance with recitals (considerandos) VII and VIII of this judgment, that it is clear that, when the letter rogatory (exhorto) was submitted to the Registry’s daily filing log, Nombre230210 had acquired the property in good faith and under the protection afforded by the Registry. It was also established that the transfer carried out by Ms. Nombre230212 took place on 30 de julio de 2009, when the restrictions imposed on the property under review had expired. Accordingly, as of 28 de agosto de ese año, the letter rogatory addressed to the Registry for the purpose of canceling and reversing the registration of the existing right over the property registered in Alajuela under matrícula no. 231998 could not be recorded by the registry official. In that regard, the argument advanced by both the State and the National Registry itself—that their actions were limited to exercising the registry function—cannot be accepted, since it is evident that, on the filing date, the letter rogatory could not be recorded.

This position was, in turn, reiterated by Mr. Nombre230211. It is thus evident that neither the actions of the IDA nor those of the Registry complied, as alleged, with the principle of legality (principio de legalidad), because the former delayed the performance of its obligations and the Registry recorded the document unlawfully, in breach of the principles of public notice (publicidad), legal certainty (seguridad), prior examination (calificación previa), and continuity of title (tracto sucesivo).

XIV.In light of the foregoing, the challenged judgment must be partially vacated. In its place, ruling on the merits, the defense of lack of legal entitlement (excepción de falta de derecho) raised by the co-defendants shall be rejected. The complaint shall be partially granted solely insofar as it requests that the Public Property Registry be ordered to cancel the registration of the property registered in Alajuela under matrícula no. Placa43323 in the name of the IDA and to register it in the name of Nombre230210 S.A. Costs shall be borne by Nombre230211 and the National Registry. In all other respects, the judgment is affirmed.

POR TANTO

The appeal is granted. The Tribunal’s judgment is vacated only insofar as it upheld the defense of lack of legal entitlement, dismissed the complaint, and ordered the plaintiff to pay costs. In its place, ruling on the merits, that defense is rejected and the complaint is granted on the following terms, with all relief not expressly granted deemed denied. The registration of the property registered in Alajuela under matrícula no. Placa43323 in the name of the IDA, now INDER, is null and void; the property belongs to Nombre230210 S.A, and the Registry must reflect this accordingly. Costs shall be borne by Nombre230211 and the National Registry.

Proceso de conocimiento tramitado en el Tribunal Contencioso Administrativo por Nombre230210 SOCIEDAD ANÓNIMA, representada por su presidente con facultades de apoderado generalísimo sin límite de suma, Nombre160319 , empresario, vecino de Puntarenas; contra el ESTADO, representado por su procuradora B, Ana Cecilia Arguedas Apuy, vecina de Heredia; el INSTITUTO DE DESARROLLO AGRARIO, representado por su apoderado general judicial, Nombre34867 , vecino de San Ramón de Alajuela; Nombre230211 , registrador del Registro Nacional, de domicilio no indicado; y, la JUNTA ADMINISTRATIVA DEL REGISTRO NACIONAL, representada por su presidente con facultades de apoderado generalísimo sin límite de suma, Dabogerto Sobaja Morales. Figuran además, como apoderados judiciales especiales, de la sociedad actora el Lic. Gerardo Moya Paniagua, de domicilio ignorado; del Instituto codemandado, la Licda. Marjorie Mora Ramírez; y, por la Junta Administrativa del Registro Nacional, los licenciadas Guadalupe Ortiz Mora, Ericka Patricia Fallas Garro, ambas bínubas; y, los licenciados Luis Enrique Castro Fonseca, vecino de San Ramón de Alajuela y Adrián Castro Montealegre, soltero. Las personas físicas son mayores de edad y con las salvedades hechas, casados, abogados y vecinos de San José.

RESULTANDO

1. Con base en los hechos que expuso y disposiciones legales que citó, la sociedad actora estasbleció proceso de conocimiento, a fin de que en sentencia se declare: “1- Que se condene a los demandados REGISTRO, DEPARTAMENTO DEL REGISTRO PUBLICO (sic) DE LA PROPIEDAD INMUEBLE, y al señor Nombre230211 () , demandados en este proceso, al pago de ambas costas. 2- Que se condene al Registro Nacional Departamento de Registro Público de la Propiedad Inmueble, y al señor Nombre230211 () , al pago de los daños y perjuicios que le han ocasionado a mi representada. 3- Que se anule la inscripción que consta en el Registro Público de la Propiedad Inmueble, a favor del Instituto De (sic) Desarrollo Agrícola (sic) I.D.A. inscripción que hizo a favor por error, exhorto que se inscribió bajo el tomo 2009, Asiento número doscientos veintisiete mil cuatrocientos treinta y nueve, y se ordene inscribir nuevamente la finca descrita objeto de esta litis, a favor de mi representada Nombre230210 S.A.” 2.

La Junta demandada contestó a folios 161 a 185 e interpuso las excepciones de falta de derecho y litis pendencia pasiva. El codemandado Nombre230211 contestó conforme a folios 225 a 232, oponiendo la excepción de litis consorcio pasivo necesario. El Estado, por su parte, contestó negativamente y opuso las excepciones de falta de legitimación ad causan pasiva y falta de derecho. El Instituto codemandado contestó acorde a folios visibles del 285 al 302, interponiendo la excepción de falta de derecho. Asimismo, a folio 300 renunció al proceso conciliatorio.

3. La audiencia preliminar se realizó a las 8 horas 55 minutos del 13 de abril de 2011, oportunidad en que todas las partes hicieron uso de la palabra.

4. El Tribunal Contencioso Administrativo, Sección Octava, integrada por los jueces Rosa Cortés Morales, Sady Jiménez Quesada y Ricardo Madrigal Jiménez, en sentencia n.° 178-2011 de las 15 horas 30 minutos del 13 de setiembre de 2011, dispuso: "Se rechaza la excepción de falta de legitimación ad causan pasiva interpuesta por el Estado. Se acoge la excepción de falta de derecho interpuesta por los codemandados. Se declara sin lugar la demanda en todos sus extremos y se condena a la actora al pago de ambas costas de este proceso.” 5. La accionante formula recurso de casación indicado expresamente las razones en las que se apoya para refutar la tesis del Tribunal.

6. En los procedimientos ante esta Sala se han observado las prescripciones de ley.

Redacta la magistrada Escoto Fernández,

CONSIDERANDO

I.En la demanda origen de este proceso, interpuesta contra el Registro Nacional, el registrador Nombre230211 , el Instituto de Desarrollo Agrario (en adelante IDA) y el Estado, el representante de la empresa Nombre230210 S.A. (en adelante Molaretto), señaló, por escritura no. 250 otorgada ante el notario Gerardo Moya Paniagua a las 15 horas del 30 de julio de 2009, su representada adquirió dos propiedades del Partido de Alajuela, matrículas no. Placa43322 y Placa43323. Afirmó, obtuvo esas fincas al amparo del Registro, libres de gravámenes y anotaciones, de las señoras Nombre29235 y Nombre230212, ambas Nombre230212 , quedando inscritas el 12 de agosto de 2009. Explicó, el 31 de agosto de ese año, su inmueble 231998-000, apareció inscrito a nombre del Instituto de Desarrollo Agrario. Aseveró, dicho traspaso fue realizado por el registrador Nombre230211 , quien reconoció un error de su parte al inscribir un exhorto del IDA.

Apuntó, en el presente caso, era fácil darse cuenta de que la persona mencionada en el exhorto, no era la misma que indicaba el Registro, por lo que ese documento no debió registrarse. Por ello, refirió, presentó reclamo administrativo ante la Dirección del Registro, para que se inscribiera nuevamente a nombre de su representada. Ante lo anterior, el Registro emitió la resolución de las 11 horas 14 minutos del 1° de octubre de 2009, en la cual incluyó advertencia administrativa sobre el inmueble en cuestión. Continuó, mediante resolución de las 12 horas 12 minutos del 18 de diciembre de 2009, se ordenó la inmovilización de la finca, a efecto de que las partes acudieran a reclamar sus derechos en sede judicial. Solicita en sentencia: a) se anule la inscripción del inmueble 231998-000 a favor del IDA, ordenándose inscribirlo a nombre de su representada; b) se condene al Registro Nacional y al codemandado Nombre230211 al pago de diez millones de colones en concepto de daño moral, y daños y perjuicios y ambas costas.

Los codemandados contestaron de manera negativa. Opusieron las excepciones de falta de derecho y litis consorcio pasivo necesario. El Tribunal integró a la litis al IDA y al Estado. Dichos codemandados también contestaron en forma negativa. Presentaron las excepciones de falta de derecho y de legitimación ad causam pasiva. El Tribunal rechazó la falta de legitimación, acogió la excepción de falta de derecho. Declaró sin lugar la demanda, con ambas costas a cargo de la actora, quien inconforme acude a casación.

Recurso por razones procesales

II.A pesar de que en el recurso se entremezclan una serie indistinta de agravios, del análisis de la censura planteada, se puede colegir que se trata en realidad de dos reproches de esta naturaleza. En el primero, alega violación al principio de defensa. Afirma, el Tribunal solo le concedió 15 minutos para las conclusiones, negándose a extenderle el plazo, a pesar de que la parte contraria contaba con un patrocinio de nueve abogados. Por ello, indica, no pudo leer algunos párrafos de la prueba aceptada, como es el caso de la declaración del Director del Registro Público, que analiza con detenimiento las razones por las cuales se dio un error al inscribir el exhorto, así como los documentos del IDA que demuestran que ese documento estaba viciado de nulidad. En la segunda censura, endilga, la resolución recurrida no analiza todos los hechos. Aduce, si bien los tuvo por probados, no fundamentó si el exhorto era válido en la forma en que fue presentado al Registro. Expresa, no analizó el cumplimiento del capítulo 29, inciso 9 de la guía de calificación registral, según la cual, esos exhortos solo se dan cuando se han incumplido las limitaciones del numeral 67 de la Ley del ITCO. Agrega, tampoco analizó la Ley de Inscripción de Documentos del Registro Público no. 3883, ni los reglamentos de inscripción, dejando de hacer referencia a la publicidad registral y al principio de prioridad.

III.El precepto 109 del Código Procesal Contencioso Administrativo (en adelante CPCA), si bien establece la obligación de conceder la palabra a los litigantes a efecto de realizar las conclusiones, confiere a su vez un margen de discrecionalidad al juzgador a fin de establecer el tiempo durante el cual serán realizadas. Así, dicha norma, a la letra establece: “Evacuada la prueba, las partes formularán conclusiones por el tiempo fijado por el Tribunal”. Revisada el acta del juicio oral, consta que, la representación de la parte demandante formuló conclusiones por un lapso de 20 minutos y no 15, como se indica en el recurso. Igualmente nota esta Cámara, los abogados de las demás partes hicieron uso de la palabra durante segmentos menores al de la actora, seis minutos, 10 minutos en el caso del Registro Nacional, siete minutos por parte del abogado del IDA y ocho minutos el representante del señor Nombre230211 .

Los representantes de los codemandados alcanzaron a puntualizar sus conclusiones en un tiempo máximo de 10 minutos, abarcando en total 31 minutos para emitir sus alegatos. Adicionalmente, según consta en el video de la audiencia (10 horas 03 minutos 03 segundos), el Tribunal le concedió la palabra por 15 minutos, a lo cual, el representante de la actora, se limitó a expresar la frase “15 minutos”, sin manifestar oposición. Igualmente, al vencimiento del plazo otorgado, (10 horas 18 minutos 34 segundos, de acuerdo al video de la audiencia) al informarle el Tribunal que había transcurrido el plazo otorgado, le fueron conferidos cinco minutos adicionales, a lo que el litigante manifestó “talvez 15 minutos mas”, otorgándole la jueza presidente cinco minutos mas para que concluyera, sin que la parte manifestara oposición, ni en ese momento, ni al concluir su exposición. De tal forma, no concreta la recurrente en qué radica la indefensión que alega, sino que solamente ejemplifica, que no pudo exponer.

Por consiguiente, no se observa que el Tribunal haya incurrido en el vicio que se apunta, no solo por cuanto otorgó a las partes un plazo razonable para efectuar sus conclusiones, sino además por cuanto, el tiempo conferido a la actora no fue combatido en forma oportuna, sin que tampoco se observe, se haya privilegiado excesivamente a una de las partes como en ese sentido esgrime el recurrente, razón por la cual, la censura debe ser rechazada.

IV.En lo referente al segundo reparo, el Tribunal indicó, la Junta Directiva del IDA, al aceptar la renuncia, ordenó revertir la finca a su nombre. Para ello, dicen los juzgadores, expidió el exhorto del 4 de mayo de 2009. Además, expresan la naturaleza del exhorto está definida en el inciso e) del artículo 7 de la Ley 6735, el cual dispone: "e) Las resoluciones definitivas, que el Instituto dicte en asuntos de su competencia, se considerarán ejecutorias, en tanto no exista resolución judicial firme en contrario; salvo lo que expresamente disponga esta ley y sin menoscabo de la responsabilidad civil, en que pudiera incurrir el Instituto por los perjuicios que ocasione a los particulares." Agregan, la ejecutoriedad que otorga este precepto a las resoluciones del IDA, es totalmente compatible con las que tienen la generalidad de los actos administrativos, en aplicación de los incisos 1) y 2) del canon 146 de la Ley General de la Administración Pública (en lo que sigue LGAP, que establecen: "1.

La Administración tendrá potestad de ejecutar por sí, sin recurrir a los Tribunales, los actos administrativos eficaces, válidos o anulables, aún contra la voluntad o resistencia del obligado, sujeta a la responsabilidad que pudiera resultar. 2. El empleo de los medios de ejecución administrativa se hará sin perjuicio de las otras responsabilidades en que incurra el administrado por su rebeldía." De igual forma, mencionan, tales ordinales deben integrarse al precepto 450 del Código Civil, fundamento de la materia registral, en cuanto norma: "Sólo pueden inscribirse los títulos que consten de escritura pública, de ejecutoria o de otro documento auténtico, expresamente autorizado por la ley para este efecto." Así, concluyen, el acto cuya nulidad se solicita, es un acto de ejecución de aquel que ordena anular la inscripción y revertir la propiedad a nombre del IDA, el cual tiene la fuerza que otorga el derecho administrativo a sus actos, reforzada por el numeral 7 de la Ley 6735 recién citada, por lo que el Registro únicamente podría haberse excusado de su inscripción, si hubiera existido una orden judicial que así lo ordenara, lo cual no sucede en la especie, por lo que su conducta se encuentra ajustada a derecho.

De lo expuesto, considera este órgano decisor, es claro, el Tribunal si entró a realizar un análisis de la naturaleza del exhorto, por lo que el agravio en ese punto, carece de fundamento, pues los juzgadores en el fallo cuestionado, brindan las razones por las cuales estiman la procedencia de la inscripción de dicho documento. Ahora bien, contrario a lo afirmado en el sentido de que no se analizó el cumplimiento del capítulo 29, inciso 9 de la guía de calificación registral, estima esta Cámara, de las manifestaciones realizadas por los jueces, resulta inobjetable, que se fundamentaron en la obligatoriedad para el registrador en cuanto a inscribir el exhorto de examen. Así las cosas, si justificaron su posición en el sentido de que los textos legislativos citados, obligaban al funcionario a registrar de inmediato el documento de análisis. Por ello, resulta innegable, los jueces sí realizaron un análisis de fondo sobre la legalidad de esa conducta, exponiendo los elementos jurídicos de los cuales derivaron su obligatoriedad, independientemente de si a ese efecto citan o no la guía de inscripción registral.

No debe olvidarse tampoco que se está ante un cargo de naturaleza procesal, lo cual impide a este punto valorar si examinaron o no correctamente las posibles normas aplicables al caso. De ahí que no sea de recibo el argumento en cuanto que los juzgadores dejaron de interpretar el texto de la Ley de Inscripción de Documentos del Registro Público no. 3883, o el de los reglamentos o guías de inscripción, pues, se reitera, en lo que toca al cargo procesal, los juzgadores si brindan el sustento jurídico necesario como fundamento a la tesis que esbozan.

Recurso por razones sustantivas

V.La recurrente formula dos reproches de esta naturaleza. Si bien el primero fue planteado como un agravio procesal por violación a las reglas de la sana crítica, esta Cámara estima, en realidad se trata de un reparo de naturaleza sustantiva. La casacionista sostiene, el Tribunal declara sin lugar la demanda aludiendo a que el registrador actuó amparado al principio de legalidad, no obstante haber aceptado dicho funcionario y el propio Director del Registro, que la inscripción se debió a un error que ameritaba ser corregido. Dice, el argumento de los jueces, en cuanto a que, conforme a la ley del IDA, sus resoluciones definitivas se consideran ejecutorias y por ello deben inscribirse tal y como sean presentadas, carece de lógica, pues no puede ampararse un acto contrario a la ley. Arguye, no es posible que una finca inscrita cambie de titular “de un día para el otro”, sin previo aviso. Afirma, pensar que la inscripción del exhorto es procedente, por haberse emitido cuando estaban vigentes las limitaciones, implica despojar de su propiedad a quien adquirió de buena fe.

Explica, cuando la finca fue adquirida por Nombre230210, se encontraba inscrita a nombre de la dueña registral. Agrega, como el IDA no había hecho nada al respecto hasta ese punto, era lógico que la titular pensara que su renuncia a la adjudicación conferida era inválida o que por la inactividad del IDA, había quedado sin efecto. En el segundo de los cargos, la recurrente manifiesta, el fallo del Tribunal declaró sin lugar la demanda, con fundamento en que el exhorto fue expedido por el IDA el 4 de mayo de 2009, fecha para la cual aún se encontraban vigentes las limitaciones. Lo anterior, refiere, carece de importancia, toda vez que fue presentado al Registro el 28 de agosto de 2009, cuando las limitaciones ya habían vencido, contrariando el precepto 455 del Código Civil. Asevera, los jueces se fundamentaron además en el canon 7 de la Ley 2825, del Instituto de Desarrollo Agrario, según el cual, las resoluciones que dicte ese Instituto en asuntos de su competencia son ejecutorias, así como en el ordinal 450 del Código Civil, que establece, solo podrán inscribirse los títulos que consten en escritura pública, ejecutorias u otro documento auténtico, expresamente autorizado por ley.

Discrepa, no por el hecho de estar contenido en una escritura pública, el documento debe inscribirse “como vaya”, sino que ha de calificarse a efecto de constatar el cumplimiento de los requisitos, acorde a la Ley de Inscripción de Documentos no. 3883. Añade, en caso de un exhorto, debe comprobarse si éste cumple con todos los requisitos necesarios para su inscripción, que en el caso específico, no se podía inscribir, puesto que, al tratarse de una renuncia a la adjudicación conferida, debió haberse presentado en escritura pública. Menciona, la sentencia impugnada ha interpretado indebidamente el numeral 7 de la Ley del IDA, el mandato 450 del Código Civil y ha dejado de aplicar los artículos 1, 5, 7 y 8 inciso 1) de la Ley de Inscripción de Documentos del Registro Público no. 3883 (en adelante LIDRP), los cardinales 34, 35, 54, 55 y 66 del Reglamento del Registro Público no. 26771-J y los cánones 51 y 53 del Reglamento de Organización del Registro Público de la Propiedad Inmueble no. 26883.

Concluye la resolución que combate, debió haber tenido en cuenta y pronunciarse sobre lo dicho por el registrador y el director del Registro. Finalmente, alega también quebrantados los numerales 41 y 45 de la Constitución Política, el cardinal 68 del Reglamento Autónomo del IDA, publicado en La Gaceta no. 168 del 16 de octubre de 2007, así como la norma 86 del Reglamento del IDA publicado en la Gaceta no. 13 del 20 de enero de 2004.

VI.En lo medular, el primer cargo busca descartar la tesis del Tribunal, respecto a que el registrador actuó amparado al principio de legalidad. Observa esta Sala, la posición de los jueces en ese sentido, (Véase considerando IV de este fallo), se fundamenta en argumentos de base normativa. Los juzgadores han esbozado, conforme al precepto 7 de la Ley 6735, así como a los cardinales 146 incisos 1) y 2) de la LGAP y 450 del Código Civil, que el registrador se encontraba obligado a inscribir sin más el exhorto remitido por el IDA. De tal forma, no es válido oponer a posiciones, cuya base es estrictamente jurídica, como las que sostiene el Tribunal, simples apreciaciones sobre lo manifestado por el Director del Registro o por el propio registrador en cuanto a la existencia de un error de inscripción, pues la tesis de los juzgadores no se centra en la valoración probatoria, sino que es de naturaleza legal.

Así las cosas, a efecto de combatirla debió argüirse la incorrecta aplicación o interpretación de las normas sustantivas citadas por el Tribunal, o en su defecto la desaplicación o quebranto de otras regulaciones, con su cita respectiva, elementos que no aporta la recurrente. En esa línea, nota este órgano decisor, la casacionista no argumenta el quebranto de norma alguna. No ataca los argumentos del Tribunal, ni las tesis de derecho que apunta. Tampoco cuestiona la validez de la aplicación de los mandatos citados por los jueces. De tal forma, al carecer el agravio de la mención de las normas sustantivas que estima quebrantadas, el cargo resulta informal, lo que obliga a su rechazo.

VII.Previo a ingresar al análisis del segundo reproche, conviene precisar los alcances del principio de publicidad registral. Al respecto esta Sala ha establecido: “…el legislador se decantó por tutelar la apariencia jurídica de legitimidad que se crea para la comunidad jurídica a partir de la publicidad registral, con el fin de que la inscripción de los derechos provoque, salvo circunstancias excepcionales, -verbigracia lo establecido en el cardinal 457 ibídem- seguridad jurídica en el tráfico de bienes, en tanto existe -por regla de principio- inoponibilidad de lo no inscrito frente a los terceros. Ahora bien, es menester destacar que esta inclinación hacia la tutela del tercer adquirente de buena fe no mengua, sin embargo, el derecho del titular original de reclamar judicialmente, si a bien lo tuviere, la responsabilidad del agente al que atribuye el despojo.” (Resolución 111-2010 de las 14 horas 30 minutos del 21 de enero de 2010)

VIII.El Tribunal indicó, la señora Nombre230212 había sido beneficiada y adjudicada en julio de 1994, con la parcela 43-B del Asentamiento Labrador finca de Alajuela, matrícula no. Placa43323, documento que fue presentado al Registro el 11 de agosto de 1994, que soportaba las limitaciones dispuestas por el precepto 67 de la Ley 2825, por un período de 15 años. Señalan los jueces, antes del vencimiento del plazo de las limitaciones de referencia, la señora Nombre230212 renunció a su derecho sobre la parcela el 23 de junio de 2007. En consecuencia, apuntan, la Junta Directiva de la entidad aceptó esa renuncia, ordenando anular la inscripción existente y revertir la finca a su nombre. Para ello, aducen, expidió un exhorto el 4 de mayo de 2009, cuya naturaleza ejecutoria, está definida en el canon 7 inciso e) de la Ley 6735 y los incisos 1) y 2) del artículo 146 de la LGAP, que con la integración del artículo 450 del Código Civil, posibilita la inscripción de títulos de naturaleza ejecutoria.

Por esa razón, estiman, el acto cuya nulidad se solicita, no puede ser analizado en forma aislada, esto es, solo en cuanto a la inscripción, ya que se trata de la ejecución del acto que ordenó anular la inscripción y revertir la propiedad a nombre del IDA, razón por la cual, el Registro no podía objetar su inscripción. Observa esta Sala, sobre la finca de Alajuela, matrícula no. Placa43323, fueron impuestas las limitaciones que establece el ordinal 67 de la Ley 2825, por un período de 15 años, con vencimiento al 29 de julio de 2009. Asimismo, según se demostró, mediante el acuerdo 27 de la sesión ordinaria 012-2009, del 13 de abril de 2009, la Junta Directiva del IDA aceptó la renuncia que al efecto presentara la señora Nombre230212 , sobre la adjudicación de la parcela de cita, ordenando anular la inscripción registral de dicha finca, regresando su titularidad al IDA (folios 8 a 14 del expediente judicial).

A ese efecto, ese Instituto emitió un exhorto a las 14 horas 30 minutos del 4 de mayo de 2009, el cual fue presentado al Registro, el 28 de agosto de 2009, momento en el cual, el inmueble se encontraba inscrito a favor de la sociedad actora. En efecto, por escritura otorgada ante el Notario Público Gerardo Moya Paniagua, a las 15 horas del 30 de julio de 2009, la señora Nombre230212 traspasó la finca de interés a la compañía Nombre230210, quedando inscrito el traspaso el día 12 de agosto de 2009 (folios 12 -14 del expediente judicial). De esta manera resulta inobjetable, cuando el exhorto fue presentado al diario del Registro, Nombre230210 había adquirido el bien de buena fe y al amparo del Registro Público. Asimismo es claro, el traspaso realizado por la señora Nombre230212 tuvo lugar el 30 de julio de 2009, momento cuando se encontraban vencidas y en consecuencia sin efecto, las limitaciones impuestas sobre la propiedad de examen.

De tal suerte, se reitera, al momento de su presentación, el exhorto dirigido al Registro a efecto de anular y revertir la inscripción del derecho 000 de la propiedad de Alajuela matrícula no. Placa43324, no podía ser inscrito por parte del Registro. Claramente, dicha ejecutoria no podía ser cumplimentada por el órgano registrador en tanto contenía la orden de anular la inscripción de un derecho inscrito a nombre de la señora Nombre230212 , quien a esa data había dejado de ser su titular. Así, a pesar de que hubiese sido acordada en tiempo por el IDA, la solicitud de nulidad y reversión fue presentada por el Instituto codemandado en forma tardía. Por ello, carecía de las condiciones necesarias para ser opuesta al título de la sociedad adquirente Nombre230210 S.A., la cual compró de buena fe y al amparo registral, con fundamento en el principio de publicidad reiterado por esta Sala, que enarbola la “… inoponibilidad de lo no inscrito frente a los terceros”.

(Resolución no. 1672-2012 de las 8 horas 40 minutos del 13 de diciembre de 2012) De tal suerte, procede acoger el cargo por interpretación indebida del numeral 7 de la Ley del IDA y del mandato 450 del Código Civil, por cuanto, la naturaleza ejecutoria de los exhortos del IDA, además de carecer de los elementos de la escritura pública, no es oponible a los títulos válidamente inscritos con anterioridad al amparo del Registro. Igualmente, por desaplicación de los preceptos 1, 7 y 8 de la LIDRP en tanto la actuación del funcionario registral, atenta contra los principios de publicidad y seguridad jurídica consagrados en dichas disposiciones, toda vez que solo puede constituir derechos en el Registro, quien lo tenga inscrito o lo haya adquirido en el instrumento de su constitución (artículo 7), y no podrán inscribirse documentos que estuvieren en contradicción con otro que haya sido presentado previamente (canon 8 de la LIDRP).

Existe además una obligación del órgano público de referencia, en cuanto a calificar cada documento que con esa finalidad le es presentado, lo anterior con apego a lo dispuesto por los cardinales 34, 35, 54, 66 del Reglamento del Registro Público no. 26771-J, que en esa línea establecen el deber de examinar y calificar previamente los documentos registrales, lo anterior conforme al principio de prioridad registral y sin que tal inscripción pueda convalidar los actos o contratos nulos. Finalmente, también se lesionan los cánones 51 y 53 del Reglamento de Organización del Registro Público de la Propiedad Inmueble no. 26883, los cuales sujetan la inscripción de documentos al principio del tracto sucesivo, razón por la cual, no podía inscribirse un documento de traspaso en el cual aparecía como titular una persona diferente a la que constaba en el asiento correspondiente.

IX.Las excepciones de falta de derecho y de legitimación ad causam activa interpuestas por las codemandados, no son procedentes. Para los coaccionados las actuaciones del Registro se encuentran amparadas en el principio de legalidad, ya que el exhorto inscrito provino de la renuncia que hizo la señora Nombre230212 de la parcela en cuestión, lo que en su tesis genera una situación extraregistral proveniente de esta situación, además que en todo caso se estaba ante una obligación registral en virtud de la ejecutoriedad del acto. En la especie conforme a los considerandos VII y VIII de este fallo, ha quedado claro, se está ante un supuesto de adquisición por parte de un tercero de buena fe, a saber, la empresa actora, quien compró al amparo del Registro Nacional, razón por la cual posee el derecho para accionar en defensa de sus intereses, pues en tal calidad, no le son oponibles títulos no inscritos. De igual manera encuentra la legitimación necesaria para gestionar en ésta vía, pues es evidente, la actora adquirió en escritura pública el bien objeto del debate, lo cual refleja el interés legítimo con el cual actúa.

X.La accionante reclamó el pago de daño moral. Dijo, como representante de la sociedad demandante, ha sido víctima de ese error registral, el cual ha soportado en lo personal, toda vez que el inmueble es patrimonio de la empresa que representa y los socios le han achacado culpa en su pérdida. Estimó dicho daño en la cantidad de ¢12.000.000,00. Aclaró posteriormente, que limitaba su reclamo al daño objetivo causado a su representada. Sobre este punto, el Tribunal indicó, al haber decidido la actora demandar únicamente al registrador y al Registro Público, originalmente, y no haber dirigido la demanda en contra de la vendedora, sea la señora Nombre230212 , no es posible entrar a analizar integralmente ni la existencia del daño, ni su origen o nexo de causalidad, pues en la especie se está ante una actuación extraregistral. Por ello, los jueces declaran sin lugar esa pretensión, rechazando de igual forma el daño moral.

Al respecto, estima esta Sala, los alegatos esbozados se fundamentan en presupuestos fácticos que no aportan mayor argumentación. Si bien el daño moral reclamado se situó originalmente en la esfera subjetiva, como ocasionado al personero de la actora, posteriormente se le caracteriza como un daño objetivo, perpetrado en contra de la compañía. Nota este órgano decisor, el argumento de la casacionista se basa, primero, en el supuesto sufrimiento soportado por el personero, en tanto habría sido objeto de presiones por los socios de la compañía. En un segundo momento prescinde de dicha tesis, para sostener, que el detrimento que endilga, se limita al causado de manera objetiva a la sociedad actora. No obstante, no se observa que tales alegaciones hayan sido acompañadas de las probanzas indispensables, que hubieses permitido valorar en esta sede, el menoscabo que se aduce. Así es claro, en la especie, no se dan los presupuestos a efecto de acoger el reclamo planteado, por lo que debe de rechazarse.

XI.La accionante también reclamó el pago de perjuicios. Alegó, la finca está en posesión de su representada, no obstante, no ha podido disponer de ella en virtud del error registral. Además dice, contrató los servicios de un profesional en derecho que le cobró ¢1.500.000,00. Agrega, compró el bien para construir una casa, lo cual no ha podido hacer en virtud de los problemas presentados, máxime que los materiales han incrementado su precio. Finalmente, señala, realizar “su proyecto” tendría un costo de ¢10.00.000,00 por lo que en conjunto valora ese menoscabo en ¢12.000.000,00. Al respecto, estima esta Sala, en este caso, conforme se indicara en el considerando X, no se dan los elementos necesarios para la configuración del perjuicio reclamado, pues de los alegatos, si bien se ha logrado acreditar la omisión por parte de un ente público, no se ha evidenciado la producción de un perjuicio a la recurrente. De tal suerte, visto que los perjuicios alegados no encuentran sustento en las requeridas probanzas, el cargo debe de rechazarse.

XII.En vista de que las codemandadas no acudieron en casación, por haber resultado victoriosas en primera instancia, es necesario precisar los elementos que en su defensa esgrimieron en el presente proceso. En lo de interés, el Registro Nacional alegó, que la responsabilidad debía ser reclamada a la señora Nombre230212 , por haber formalizado la venta del bien, luego de haber renunciado a la adjudicación de la parcela. Agregó que sus actuaciones se limitaron a ejercer la función registral. Por su parte el señor Nombre230211 no objetó la pretensión anulatoria. Manifestó en su lugar que se había limitado a inscribir el exhorto. El Estado alegó que las actuaciones del Registro fueron realizadas al amparo del principio de legalidad, toda vez que el exhorto provino de la renuncia a la adjudicación formulada por la señora Nombre230212 . Por ese motivo, añadió, existe un elemento extraregistral, no imputable al Registro. El IDA, aunque no formuló una pretensión específica, alegó falta de derecho. En general, todos los codemandados se opusieron a los daños y perjuicios, al estimar, no se dan los elementos necesarios para su configuración, en vista de que existió una eximente de responsabilidad, a saber, el hecho de un tercero.

XIII.Al respecto, estima esta Sala, conforme a los considerandos VII y VIII, de esta sentencia, resulta claro, al presentarse el exhorto al diario del Registro, Nombre230210 había adquirido el bien de buena fe y al amparo registral. Asimismo se acreditó que el traspaso realizado por la señora Nombre230212 tuvo lugar el 30 de julio de 2009, cuando se encontraban vencidas las limitaciones impuestas sobre la propiedad de examen. De tal suerte, al 28 de agosto de ese año, el exhorto dirigido al Registro a efecto de anular y revertir la inscripción del derecho existente sobre la propiedad de Alajuela matrícula no. 231998, no podía ser inscrito por el funcionario registral. En esa línea, no es de recibo la tesis expuesta tanto por el Estado como del propio Registro Nacional, en cuanto a que sus actuaciones se limitaron a ejercer la función registral, pues es evidente, a la fecha de presentación, el exhorto no podía inscribirse. Tal posición fue en su caso reiterada por el señor Nombre230211 . De tal forma, se evidencia que ni las las actuaciones del IDA, ni las del Registro se ajustaron como se alega al principio de legalidad, toda vez el primero se atrasó en sus prestaciones y el Registro inscribió el documento, en forma ilegítima, quebrantando los principios de publicidad, seguridad, calificación previa y tracto sucesivo.

XIV.En mérito de lo expuesto, se deberá anular parcialmente la sentencia impugnada. En su lugar, fallando por el fondo, se rechazará la excepción de falta de derecho opuesta por los coaccionados. Se acogerá parcialmente la demanda, únicamente en cuanto solicita, se ordene al Registro Público de la Propiedad, anular la inscripción de la finca de Alajuela matrícula no. Placa43323 a nombre del IDA e inscribirla a nombre de la sociedad Nombre230210 S.A. Son las costas a cargo de Nombre230211 y el Registro Nacional. En lo demás se confirma el fallo.

POR TANTO

Se declara con lugar el recurso. Se anula la sentencia del Tribunal solo en cuanto acogió la excepción de falta de derecho, declaró sin lugar la demanda y condenó en costas a la actora. En su lugar, fallando por el fondo, se rechaza esa excepción y se acoge la demanda en los siguientes términos, entendiéndose denegada en lo no expresamente concedido. Es nula la inscripción de la finca de Alajuela matrícula no. Placa43323 a nombre del IDA, hoy INDER, la cual pertenece a Nombre230210 S.A y así debe consignarse registralmente. Son las costas a cargo de Nombre230211 y el Registro Nacional.
