Judge Maricel Zamora Arias of the Agrarian Court of the Second Judicial Circuit of the Southern Zone, in Judgment Nº 174-2012 at thirteen hours and fifty-three minutes on October twenty-third, two thousand twelve, ruled:* "THEREFORE: The possessory title proceedings are APPROVED. Subject to the encumbrances referred to in Article 17 of the Ley de informaciones Posesorias and without prejudice to third parties having superior rights, the Registrar of the Property Registry is ordered to record, for the first time, in the name of LA ISLA Y LA LUNA S.A. (sic), corporate identification nº (CED6, represented by its President, [Nombre5] , who holds the powers of a general attorney-in-fact without limitation as to amount, residence identification card CED1 , of legal age, single, businessperson, resident of Escaleras de Dominical de Osa, the property described in the survey plan recorded in the Catastro Nacional under number P1232702-2007, which is described as follows: Scrubland. [Nombre2] currently bounded to the North by: Solamar de Hermosa S.A. (sic); to the South by: [Nombre3]; to the East by: Rancho Costa Verde Estates S.A. and [Nombre4] ; and to the West by: Solamar de Hermosa S.A. The real property that is the subject of this proceeding is valued at doce millones de colones. RESTRICTIONS AND LIMITATIONS: 1- In addition to those contained in Article 19 of the Ley de Informaciones Posesorias, the property to be titled shall be subject to the reservations concerning the rights-of-way (derechos de vía) of public roads established by Articles 4 of the Ley General de Caminos Públicos and 19, subsection a, of the Ley de Informaciones Posesorias. 2) The area adjacent to watercourses is a protected area (área de protección) pursuant to Article 33, subsection b), of Ley Forestal nº 7575, and the cutting or removal of trees is prohibited, which shall be stated in the judgment for purposes of recording in the Registry. (Article 34 ibid.). The channel and waters of that watercourse are in the public domain (dominio público) (Ley de Aguas, Articles 1, subsection IV, and 3, subsection III). 3) The surface water and groundwater existing on the property are in the State public domain and do not form part of the property.
A certified copy of this judgment shall serve to record the aforementioned property in the Property Registry" (folios 100 to 101). * 4. Lic. Lydiana* Rodríguez Paniagua, in her capacity as deputy attorney, filed an appeal (recurso de apelación), expressly stating the grounds on which it was based to refute the trial court’s position (folios 107 to 126). * 5. The statutory requirements were not observed in the conduct of the proceeding, and the decision contains errors or omissions capable of rendering it null and void. * Judge Díaz Bolaños authors the decision; and, * WHEREAS: *
I.In view of the manner in which this matter is resolved, no ruling is issued regarding the list of proven facts contained in the decision. *
II.The appeal was filed against the judgment rendered at 13 hours 53 minutes on October 23, 2012, approving the possessory title proceeding. Deputy Attorney Lydiana Rodríguez Paniagua appeals on the following grounds:* She asserts that the land-use study (estudio de uso de suelo), the survey plan underlying the proceedings, the judicial inspection (reconocimiento judicial), the testimony given, the statements made by the party in the initial pleading, the copy of the certified deed, and even the findings established in the judgment show that the nature of the land for which title is sought is forested mountain land (montaña); therefore, because it is located within national reserves, it is subject to the public-domain regime as State Natural Heritage (Patrimonio Natural del Estado), pursuant to Ley Forestal number 4465 of 1969, Article 33, as amended by Ley Forestal 7174 of 1990 (Articles 32 and 33), and retains its character as public-domain property (carácter demanial) under Ley 7575 (Articles 13 and 14).
She argues that the law permits title to real property outside protected wilderness areas (áreas silvestres protegidas) if the claimant proves legitimate rights arising from ten years of possession, together with the other applicable requirements, proves that it protected the resource, and shows that the property is duly demarcated. This leads her to conclude that title may be granted if acquisitive prescription (usucapión) was completed before the property entered the State Natural Heritage by operation of law, because, in her view, the witnesses’ testimony does not establish the possession required to obtain title to the property. She cites decision number 4587-97 of the Constitutional Chamber of the Supreme Court of Justice and further contends that forestlands are immediately designated by law as public-domain property. She argues as error that the statements of those who testified do not demonstrate the ten-year possession suitable for acquiring ownership by prescription on the claimant’s part. She then cites judicial precedents and opinions issued by the Procuraduría General de la República, specifying the following:
III. * * Section 26 of the Ley de Jurisdicción Agraria provides that courts may, on their own initiative, declare proceedings null and void and order procedural steps to be repeated in order to correct irregularities that could affect the validity of the proceeding. Furthermore, with respect to appeals, and as an additional ground, Section 60 of the aforementioned statute provides that the proceeding shall be governed, as applicable, by the provisions of the Código de Trabajo. Article 502 of that code states that, upon receipt of the case record by the Court, it shall first review the proceedings;* and if it finds that a formality capable of causing actual denial of the right to be heard has been omitted, it shall declare the appropriate procedural acts or rulings null and void to the extent necessary to restore the case to its ordinary course. The provision in question stipulates that this Court must precisely identify the omissions to be remedied and the corresponding disciplinary measure.
This Court has likewise emphasized the principle of preservation of procedural acts (principio de la conservación de los actos procesales) in order to avoid unnecessary delays, except where the omission or defect affects fundamental rights, including due process or the right of defense. In the case under review, the proceedings are examined before the grounds for appeal presented by the State’s representative are reviewed. *
IV.The base cadastral survey plan (plano catastrado) in these proceedings, visible at folio 1, shows that the Playa Hermosa stream runs along the northwestern side of the property (fundo), specifically between [Dirección3]. Furthermore, the declarant [Nombre6] stated the following:* “...The property is rugged and covered with secondary scrub (tacotal); it has * a stream...” (page 68). That statement is consistent with what is depicted in the cadastral survey plan cited above. However, the record does not contain the study by the Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados indicating whether the waters flowing through the property at issue must be reserved or are intended to supply water to any population. This Chamber also considers it important to establish the state of conservation of the protective zone (zona protectora), which was not recorded during the judicial inspection (reconocimiento judicial), the minutes of which appear at folio 71; this is an essential aspect that must be duly assessed.
In addition, the adjudicator must consider what was agreed upon at the XVI Cumbre Judicial Iberoamericana, held in Buenos Aires, Argentina, on April 25, 26, and 27, 2012, where the Declaración de Buenos Aires 2012 was signed. The section concerning information, transparency, and public participation in environmental matters declared the following: “INFORMATION AND TRANSPARENCY IN ENVIRONMENTAL MATTERS. It is important that judges and the parties have access to truthful, effective, accurate, and suitable environmental information so that effective judgments may be issued in environmental matters. It is important that judges ensure that the public and society have access to the environmental information they need or request, including information held by judicial bodies. It is important that judges take into account how significant their contribution, as public officials, can be to environmental education and to raising public awareness regarding environmental protection.
It is important that judicial bodies use suitable and efficient means to convey relevant environmental information to everyone, inform society about their actions in environmental matters, and clarify for the public environmental issues decided in judicial proceedings. It is important that judges have broad access to all environmental information held by the parties, third parties, and public bodies, in accordance with each legal system and Principle 10 of the Declaración de Río. PUBLIC PARTICIPATION IN ENVIRONMENTAL MATTERS. It is important that, whenever possible, judicial bodies adopt environmental-management policies and encourage measures for the rational and sustainable use of their resources. It is important that judicial bodies consider their socio-environmental responsibilities in their * strategic planning, including: (a) adopting such environmental-protection measures as may be possible or necessary; (b) requiring judges and officials to exercise environmental responsibility in the performance of their duties; and (c) favoring practices that combat the waste of natural resources, promote sustainability, and prevent environmental harm.
It is important that each country’s procedural mechanisms ensure broad participation by the public and society in judicial actions relating to the environment. It is important that the judge hearing the case or the competent court, whenever deemed necessary or advisable, hold public hearings to clarify issues relevant to the adjudication of environmental actions, hear society’s views, and obtain technical statements from specialists on matters relevant to rendering judgment. It is important that, while respecting impartiality and independence, judges share the experience accumulated through their daily handling of environmental proceedings and problems, maintaining institutional contacts and cooperating with public bodies, social stakeholders, economic or professional associations, nongovernmental organizations, and the scientific and academic community, in order to improve the administration of justice, promote the effective application of environmental legislation, and publicize environmental-education and environmental-protection initiatives. ..” From the foregoing, this Court considers that the person responsible for deciding matters in judicial proceedings and the parties must have access to truthful, effective, accurate, and suitable environmental information so that effective judgments may be rendered in environmental matters.
In proceedings to establish possessory title (informaciones posesorias), it is evident from Articles 45 and 50 of the Constitución Política that adjudicators are required to ensure that the title eligible for registration (título inscribible) in the Registro Público provides information aimed at generating the greatest well-being for all inhabitants of the country, promoting agricultural and agro-environmental production; encouraging the conservation and preservation of a healthy and ecologically balanced environment; and preventing harm that could affect future generations. Furthermore, the cited declaration establishes the importance of judges ensuring that the public and society have access to the environmental information they need or request, including information held by judicial bodies. When possessory-title proceedings are processed, the decision to be entered in the corresponding registry must provide the public at large with accurate and transparent information.
Accordingly, it is important that all matters concerning water resources, and potentially sources of drinking-water supply for communities, be clear and accurate. Access to drinking water is a right that all men and women must enjoy. This issue has been addressed by the Sala Constitucional de la Corte Suprema de Justicia as follows: ³«III.- Fundamental right to drinking water. In its case law, this Court has recognized that the rights to health and life are fundamental human rights that depend—to a great extent—on access to drinking water, and that the competent bodies have the inescapable responsibility to ensure that society as a whole is not deprived of them...” (decision* number 18633, issued at 10:50 a.m. on December 21, 2007). It is therefore imperative to determine whether the water resource must be reserved for human consumption and, during the judicial inspection, to verify the condition of the protective zone of the stream that runs through the property. For this reason, the judgment was issued prematurely, as the statutory requirements had not been fully satisfied. *
V.In view of the foregoing, pursuant to Articles 45 and 50 of the Constitución Política, * Article 11 of the Ley de Informaciones Posesorias, Articles 6, 26, 54, and 79 of the Ley de Jurisdicción Agraria, Article 34 subsection e) of the* Reglamento de la Ley de Catastro Nacional, and Article 7 of the Ley de Tierras y* Colonización, before judgment is rendered, a report must be requested from the Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados indicating whether those waters need to be reserved for human consumption; the * judicial inspection must also be supplemented to record the condition of the protective zone of the Playa Hermosa stream that runs through the property for which title is sought. Consequently, the judgment must be declared null and void because it was issued prematurely. *

La jueza Maricel Zamora Arias del Juzgado Agrario del Segundo Circuito Judicial de la Zona Sur en la sentencia Nº 174-2012 a las trece horas cincuenta y tres minutos del veintitrés de octubre del año dos mil doce, resolvió:* "POR TANTO: SE APRUEBAN las diligencias de información posesoria. Con las afectaciones a que se refiere el artículo 17 de la Ley de informaciones Posesorias y sin perjuicio de terceros de mejor derecho, se ordena al Señor Registrador del Registro de la Propiedad inscribir, por primera vez, a nombre de LA ISLA Y LA LUNA S.A. (sic) cédula jurídica nº (CED6 representada por su Presidente con facultades de apoderado generalísimo [Nombre5] , cédula de residente CED1 , quien es mayor, soltero, empresario, vecino de Escaleras de Dominical de Osa, la finca descrita en el plano inscrito en el Catastro Nacional bajo el número P1232702-2007, que se describe así: Terreno de tacotal. [Nombre2] actualmente al Norte: Solamar de Hermosa S.A.(sic), Sur: [Nombre3] , Este: Rancho Costa Verde Estates S.A. y [Nombre4] , Oeste: Solamar de Hermosa S.A. (sic) situada en Playa Hermosa del [Dirección2] , Provincia de Puntarenas, posee una extensión de ciento setenta y dos metros con cuarenta y cuatro decímetros cuadrados.
El inmueble objeto de este proceso se estima en la suma de doce millones de colones. RESTRICCIONES Y LIMITACIONES: 1- Además de las contenidas en el artículo 19 de la Ley de Informaciones Posesorias, que el inmueble a titular queda afecto a las reservas en cuanto a derechos de vía de las calles públicas que disponen los artículos 4 de la Ley General de Caminos Públicos y 19, inciso a, de la Ley de Informaciones Posesorias. 2) Que el área contigua a las corrientes es área de protección según el artículo 33, inciso b) de la Ley Forestal nº 7575 y que queda prohibida la corta o eliminación de árboles debiéndose consignar en sentencia para efectos de inscripción en el Registro. (artículo 34 ibídem). El cauce y las aguas de esa corriente son de dominio público (Ley de Aguas, artículos 1, inciso IV, y 3, inciso III). 3) Las Aguas Superficiales y subterráneas existentes en el inmueble, son de dominio público estatal y no forman parte de la finca.
Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca relacionada " (folios 100 a 101). * 4. La licenciada Lydiana* Rodríguez Paniagua en su condición de procuradora adjunta , interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (folios 107 a 126). * 5. En la substanciación del proceso no se han observado las prescripciones legales, y se notan la existencia de errores u omisiones en el fallo capaces de producir su nulidad. * Redacta la jueza Díaz Bolaños; y, * CONSIDERANDO: *
II.La apelación es interpuesta contra la sentencia de las 13 horas 53 minutos del 23 de octubre de 2012, donde se aprobó la información posesoria. Recurre la procuradora adjunta Lydiana Rodríguez Paniagua por los siguientes motivos:* Afirma en el estudio de uso de suelo, plano base de las diligencias, reconocimiento judicial, testimonial rendida, manifestaciones de la parte en memorial inicial, copia de testimonio de escritura y hasta lo acreditado en la sentencia, se desprende que la naturaleza del terreno pretendido titular es montaña, por lo que, al ubicarse en reservas nacionales está afectado a régimen de dominio público, Patrimonio Natural del Estado, desde la Ley Forestal número 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990 (artículos 32 y 33) y de carácter demanial que mantiene la Ley 7575, (artículos 13 y 14). Argumenta, la ley permite titular inmuebles fuera de las áreas silvestres protegidas si la promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado.
Lo anterior la lleva a concluir, es posible titular si la usucapión se ha consolidado antes de ingresar por ley a Patrimonio Natural del Estado, pues en su criterio la declaración de las personas testigas* no acredita la posesión requerida para poder titular el bien. Cita el voto de la Sala Constitucional de la Corte Suprema de Justicia número 4587-97, además esgrime los terrenos de bosques tienen una afectación inmediata por ley a dominio público. Agravia, las manifestaciones de quienes declararon no demuestran la posesión decenal apta para usucapir en cabeza de la promovente. Procede a citar precedentes jurisprudenciales y pronunciamientos emitidos por la Procuraduría General de la República, especificando los siguientes:
III. * * El ordinal 26 de la Ley de Jurisdicción Agraria establece, los tribunales por iniciativa propia podrán declarar nulidades y disponer la reposición de trámites, con la finalidad de corregir irregularidades que pudieran afectar la validez del proceso. En otro orden, en materia recursiva, y a mayor abundamiento de razones, el numeral 60 del cuerpo legal en cita, señala el trámite se regirá en lo pertinente por las disposiciones del Código de Trabajo. El artículo 502 del código citado, expone, recibidos los autos en el Tribunal, éste revisará en primer término los procedimientos;* y si encontrare que se ha omitido alguna formalidad capaz de causar efectiva indefensión, decretará la nulidad de actuaciones o de resoluciones que proceda y hasta donde sea necesario para orientar el curso normal del juicios. Estipula la norma en mención, esta Sede deberá hacer indicación precisa de las omisiones que deban subsanarse y de la corrección disciplinaria que corresponda. Igualmente esta Sede ha insistido en el principio de la conservación de los actos procesales, con la finalidad de evitar retrasos innecesarios, salvo en aquellos casos que la omisión o defecto afecte derechos fundamentales, entre otros, como el debido proceso o el de defensa. En el caso bajo examen, previo a la revisión de los agravios expuestos por la Representación Estatal se analizan los procedimientos. *
IV.En el plano catastrado base del presente proceso, visible a foja 1 se denota que el fundo por el rumbo noroeste discurre la quebrada Playa Hermosa, específicamente entre los [Dirección3] . Por otra parte, la declarante [Nombre6] , expresó lo siguiente:* "...La propiedad es quebrada y de tacotal, tiene * una quebrada..." (página 68). Tal afirmación coincide con lo graficado en el plano catastrado arriba citado. Sin embargo, no existe en autos el estudio del Departamento de Cuencas Hidrográficas de Acueductos y Alcantarillados donde indique si las aguas que discurren en el fundo en litis están destinadas o deben ser reservadas para surtir de agua a alguna población. Esta Cámara considera, también la importancia de constar el estado de conservación de la zona protectora, lo cual no se hizo constar en el reconocimiento judicial, cuya acta consta en folio 71, aspecto que es esencial para valorar oportunamente.
Abonado a lo anterior, debe considerar la persona juzgadora, lo acordado en la XVI Cumbre Judicial Iberoamericana, realizada en Buenos Aires, Argentina, los días 25, 26 y 27 de abril de 2012, donde se suscribió la Declaración de Buenos Aires 2012. En el segmento relativo a la información y transparencia, y la participación pública en materia de medio ambiente, se declaró lo siguiente: "INFORMACIÓN Y TRANSPARENCIA EN MATERIA DE MEDIO AMBIENTE. Es importante que el juez y las partes tengan acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias y efectivas en materia ambiental. Es importante que los jueces velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales. Es importante que los jueces tengan en cuenta cuán significativa puede ser su contribución, como agentes públicos, a la educación ambiental y a la sensibilización de la opinión pública en materia de protección del medio ambiente.
Es importante que los órganos jurisdiccionales utilicen medios idóneos y eficientes para transmitir a todos la información ambiental relevante, para informar a la sociedad sobre su actuación en materia de medio ambiente y para esclarecer al público cuestiones ambientales decididas en el ámbito judicial. Es importante que los jueces tengan un amplio acceso a toda la información ambiental que obre en poder de las partes, de terceros y de órganos públicos, de acuerdo con lo establecido en cada ordenamiento jurídico y el Principio 10 de la Declaración de Río. PARTICIPACIÓN PÚBLICA EN MATERIA DE MEDIO AMBIENTE. Es importante que, siempre que sea posible, los órganos jurisdiccionales adopten políticas de gestión ambiental e incentiven medidas para un uso racional y sostenible de sus recursos. Es importante que los órganos jurisdiccionales consideren sus responsabilidades socioambientales en sus planificaciones * estratégicas, incluyendo: (a) la adopción de las medidas de protección del medio ambiente que sean posibles o necesarias; (b) la exigencia de una responsabilidad ambiental a los jueces y funcionarios en el desempeño de sus obligaciones; y (c) la preferencia de prácticas que combatan el desperdicio de recursos naturales, incentiven la sostenibilidad y eviten daños al medio ambiente.
Es importante que los mecanismos procesales de cada país aseguren una amplia participación de la ciudadanía y de la sociedad en acciones judiciales que guarden relación con el medio ambiente. Es importante que el juez de la causa o tribunal competente, siempre que lo estime necesario o conveniente, realice audiencias públicas para esclarecer cuestiones relevantes para el juicio de acciones ambientales, en las que conozca la opinión de la sociedad y recabe declaraciones técnicas de especialistas sobre aspectos relevantes a la hora de dictar sentencia. Es importante que, respetando su imparcialidad e independencia, el juez comparta la experiencia acumulada en el trato cotidiano con procesos y problemas ambientales, manteniendo contactos institucionales y cooperando con órganos públicos, agentes sociales, asociaciones económicas o profesionales, organizaciones no gubernamentales y la comunidad científica y académica, en beneficio de la mejora de la prestación jurisdiccional, de la aplicación eficiente de la legislación ambiental y de la divulgación de iniciativas de educación ambiental y de protección del medio ambiente. ..".
De lo anterior estima este Tribunal, la persona encargada de resolver los asuntos en sede judicial y las partes, deben tener acceso a una información ambiental verdadera, eficaz, real e idónea para que se dicten sentencias efectivas en materia ambiental. En el caso de las informaciones posesorias, es evidente, a partir de los numerales 45 y 50 de la Constitución Política, se impone a quien juzga velar porque el título inscribible en el Registro Público, suministre información tendiente a generar el mayor bienestar a todos los habitantes del país, estimulando la producción agraria y agroambiental; incentivando que se conserve y preserve un ambiente sano y ecológicamente equilibrado; evitando daños que puedan afectar a las futuras generaciones. Además, la declaración en cita, establece la importancia que los jueces y las juezas velen para que la ciudadanía y la sociedad tengan acceso a la información ambiental que precisen o soliciten, incluyendo la información en poder de los órganos jurisdiccionales.
Cuando se tramitan las diligencias de información posesoria, la decisión que se inscribirá en el registro correspondiente, deberá suministrar a la ciudadanía en general información precisa y transparente. Por lo anterior, es relevante que todo lo que concierne al recurso hídrico, y eventualmente a fuentes de abastecimiento de agua potable para las comunidades, sea diáfana y precisa. El suministro de agua potable es un derecho al que todos los hombres y mujeres deben tener acceso. Este tema ha sido abordado por la Sala Constitucional de la Corte Suprema de Justicia de la siguiente manera: ³«III.- Derecho fundamental al agua potable. Este Tribunal ha reconocido en su jurisprudencia que el derecho a la salud y a la vida son derechos fundamentales del ser humano que dependen -en gran parte- del acceso al agua potable, y que los órganos competentes tienen la responsabilidad, ineludible, de velar para que la sociedad como un todo no los vea mermados..." (voto* número 18633 de las 10 horas 50 minutos del 21 de diciembre de 2007).
Resulta entonces imperante que se establezca si el recurso hídrico debe ser reservado para consumo humano, y verificar en el reconocimiento judicial el estado de la zona protectora de la quebrada que discurre por el fundo. Por tal razón, la sentencia resulta anticipada al no cumplir a cabalidad con los requisitos exigidos por la legislación. *
V.Por lo expuesto, con fundamento en los artículos 45 y 50 de la Constitución Política, * numeral 11 de la Ley de Informaciones Posesorias, 6, 26, 54 y 79 de la Ley de Jurisdicción Agraria, 34 inciso e) del* Reglamento de la Ley de Catastro Nacional, 7 de la Ley de Tierras y* Colonización, deberá solicitarse, en forma previa a dictar sentencia, un informe emitido por el Departamento de Cuencas Hidrográficas del Instituto Costarricense de Acueductos y Alcantarillados, donde de cuenta de la necesidad o no de reservar tales aguas para consumo humano; así como adicionar el * reconocimiento judicial para hacer constar el estado de la zona protectora de la quebrada Playa Hermosa que discurre por el fundo objeto de titulación. Por ende, deberá declararse la nulidad de la sentencia al haber sido emitida en forma anticipada. *
* * POR TANTO: * Se anula la sentencia .
