Voto N° 031-2012 Voto N° 031-2012 ADMINISTRATIVE LITIGATION COURT, FOURTH SECTION, San José, at eleven thirty on veintidós de marzo de dos mil doce.- Ordinary proceeding (proceso de conocimiento) brought by Nombre53625., legal entity identification number […], represented by Mr. Nombre3640, single, merchant, resident of […], against MUNICIPALIDAD DE ATENAS, represented by Mayor Querima Bermúdez Villegas, divorced, identification card CED87210 - - . BACKGROUND:
Judge Madrigal Jiménez drafts the judgment, with contributions from Judge Muñoz concerning facts VI and VII; and,
CONSIDERING:
The plaintiff asserts that she owns a property registered in the Province of Alajuela under Real Property Folio number [...], and that the property has frontage on a public street and access to all public utilities. For that reason, in the course of her business activities, she decided to subdivide it into forty-eight lots, twenty-eight of which received municipal approval (visado). Compliance with the legal requirements was verified by Municipal Engineer Marcelo López León in official letter MAT-OCV-089-2008 of veinticinco de abril de dos mil ocho. Notwithstanding the foregoing, on siete de octubre de dos mil ocho, the Secretary of the Municipal Council of Atenas de Alajuela ordered her principal to submit a complete preliminary project design (anteproyecto) for review by the collegial body, which she did on quince de ese mes y año. After several efforts to ascertain the position of the head of the institution, she was informed of the decision to ask the Engineering Department to conduct a complete analysis of the project, which yielded findings favorable to her interests.
In the absence of a response to her application, on trece de febrero de dos mil nueve, she requested application of affirmative administrative silence (silencio positivo) with respect to acceptance of the project—which included acceptance of the common works and the obligation to approve twenty additional plans—and the legal office issued a favorable opinion on diecisiete de ese mes, with the same being ordered on that date through official letter MAT-WA-14-09 by Mr. Nombre20665 Municipal. On veintitrés de febrero de dos mil nueve, she submitted an application for approval of the twenty outstanding plans, while releasing the municipality from the obligation to supply water because she had authorization from the Ministerio de Ambiente y Energía to drill and extract water, in order to complete the project. On dieciséis de marzo de dos mil nueve, the Municipal Council resolved to deny the request for affirmative administrative silence for the subdivision project (proyecto de fraccionamiento), treatment plant, and other public-road works; it likewise declined to endorse the aforementioned Mayor’s Office letter MAT-WA-14-09.
On veintitrés de marzo de dos mil nueve, the municipal engineer forwarded to the Council the application submitted by her principal for the construction of two homes on an equal number of lots, noting that all legal requirements had been satisfied. On treinta y uno de marzo de ese año, she filed an appeal (recurso de apelación) against the aforementioned municipal resolution, which led to another resolution on trece de abril admitting the appeal and clarifying that the affirmative administrative silence granted by the Mayor’s Office had not been annulled or revoked because the legally prescribed procedures had not been followed. Subsequently, on dieciséis de junio, it was clarified that any interim measure (medida cautelar) imposed by the collegial body on the project had ceased to have effect because of the affirmative administrative silence ordered by the Mayor’s Office, which would entail that both the subdivision approvals and the building permits for two lots remained in force.
Despite this, on nueve de julio de dos mil diez, she was notified of an order issued by Nombre20665 Municipal suspending the aforementioned building permits, for which reason she filed an appeal against that act, which was referred to the Council for consideration. On veintitrés de julio de dos mil nueve, pursuant to Article forty of the Ley de Planificación Urbana, she requested that the respective Nombre20665 accept the project, which the municipal surveyor recommended approving. Meanwhile, the appeal filed with the Municipal Council was returned to Nombre20665 with a legal and technical opinion favorable to her interests, so that it could issue a decision. Subsequently, on siete de septiembre de dos mil nueve, the municipal engineer issued a complete report on the permits granted for the project, including the building permits, because the legal requirements had been satisfied. It was not until quince de enero de dos mil diez that the Mayor’s Office reviewed the suspension ordered on its own initiative and lifted it.
On diecisiete de junio de dos mil diez, the Third Section of the Administrative Litigation Court upheld the appealed resolution and declared the administrative remedies exhausted (agotada la vía administrativa) with respect to the act originally adopted by the Municipal Council, which was adverse to the Plaintiff. She asserts that the omissions and physical acts (actuaciones materiales) of the cantonal administration seek to annul declaratory acts (actos declarativos) issued in favor of her principal and bases the claimed liability on those actions, which she contends violate the principle that an administration’s own acts are inviolable (intangibilidad de los actos propios) and the principle of legitimate expectations (principio de confianza legítima). She also requests revalidation of all acts favorable to her interests, since she maintains that they satisfy all legal requirements for a simple subdivision (fraccionamiento simple), which in her view is what was carried out.
The municipal representatives dispute some of the facts but assert that the precautionary principle (principio precautorio) provides the basis for their actions and contend that there is no liability whatsoever to be declared against the municipality. This is particularly so because the Municipal Council considers the existing project not to be a simple subdivision but rather a residential development (urbanización).
Of importance for rendering this judgment, the following relevant facts have been established, with the caveat that the administrative record contains several mutually inconsistent numbering systems, all of which are difficult to read; accordingly, the numbering appearing in the upper-right corner of the documents has been used:
That decision did not endorse the administrative silence that the Municipal Mayor’s Office had granted through official letter MAT-WA-14-09 of 17 February 2009; it ordered that a report on the project and compliance with all requirements be requested from the municipal engineer, that the INVU Urban Planning Directorate intervene, and that the Administration be urged not to grant approval (visado) to any cadastral plan until the required reports had been obtained, reviewed, and ruled upon by the Municipal Council. It further requests that the decision adopted in Article VI of Ordinary Session No. 185 of 290 September 2008, which was never served upon it, be annulled. The ruling affirmed the appealed decision and declared the administrative remedies (vía administrativa) exhausted. In its reasoning, the nonhierarchical superior held: “..... Through the claimant’s application of positive administrative silence and, above all, through Resolution MAT-WA-14-09 of 17 February 2009, issued by Nombre20665 Wilbert Aguilar Gatgens, as well as building permit No. 30-3009 of 24 February 2009 (folios 494, 495, and 501), a legal error occurred that purported to produce an extremely significant legal effect, because from that point onward the company mistakenly considered its right to carry out the authorized construction to have become vested, thereby reinforcing the purported existence of a subjective right (derecho subjetivo) in its favor.
Accordingly, serious defects are evident in both administrative acts (actos administrativos), which are legally improper on the grounds stated, wholly contrary to the legal system and, therefore, must be deemed nonexistent. // VI.- Regarding simple subdivision (fraccionamiento simple) and an urban development project (proyecto urbanístico). The Ley de Planificación Urbana identifies the distinction between subdivision and an urban development project, a distinction that is indispensable because of the legal implications entailed by these processes. It is therefore necessary to determine the difference between the two concepts, which follows from Article 1 of the Ley de Planificación Urbana. Thus, // ‘Subdivision is the division of a parcel for the purpose of placing it into private commerce, which presupposes—as each local government must verify when granting the corresponding approval—that, in terms of size and characteristics, it conforms to the urban-planning provisions in force, particularly the local land-use regulatory plan (Plan Regulador), if any, as well as implementing regulations and other special public-order statutes.
A subdivision that the law describes as “simple” does not include a process of urban servicing (habilitación urbana) for the use and enjoyment of the lots resulting from that subdivision. This is because the legislature assumes that, in such cases, the properties already have access and green areas resulting from prior urban development. For this reason, Article 40 of the Ley de Planificación Urbana provides: // “(…) Simple subdivisions of parcels in previously urbanized areas are likewise exempt from the obligation to dedicate areas for parks and community facilities…” (emphasis not in the original). // When a particular area has previously been urbanized, the purchasers of the subdivided parcels have access to the properties, parks, and community facilities; it must not be overlooked that this forms part of their right to enjoy a healthy and ecologically balanced environment (Article 50 of the Constitution).
For this reason—it bears repeating—the legislature has not deemed it necessary, in the case of a “simple” subdivision in an urbanized area, to require larger dedications of land on grounds of social interest. Because of its limited significance, approval for simple subdivisions is usually entrusted to an official (e.g., the Municipal Engineer) other than the body entrusted with “complex” approvals (e.g., the Municipal Council, urban-planning commissions, etc.); the former lacks jurisdiction (competencia) to authorize any other type of approval, where urban-planning regulations draw such a distinction. However, a subdivision that forms part of the urbanization process and entails servicing the properties for urban purposes for the first time must be provided with streets, green areas, and parks, as well as the services necessary for their use and enjoyment. In this second situation, we are dealing with a complex subdivision and urbanization process that imposes urban-planning restrictions on private property (Article 22 of the Ley de Planificación Urbana), which the Constitutional Court has held to be fully consistent with Constitutional Law (voto N° 5097-93 de las 10:24 hrs del 15 de octubre de 1993).
The residential or subdivision project that we shall call “complex” is contemplated in Article 40 of the Ley de Planificación Urbana, which, insofar as relevant, provides: // “Every person subdividing land (…) and every developer shall dedicate free of charge for public use both the areas intended for roads and those intended for parks and community facilities; the amount required for the latter two purposes shall be determined in the applicable regulations by establishing percentages of the total area to be subdivided or urbanized, which may range from five percent to twenty percent, depending on the average size of the lots, the intended use of the land, and the applicable standards. Notwithstanding the foregoing, the total amount of land that must be dedicated for public roads, parks, and community facilities shall not exceed forty-five percent of the total area of the land to be subdivided or urbanized.
(…) // The developer’s obligation to provide the subdivided parcels with access, green areas, parks, and public roads requires compliance with urban-planning provisions establishing minimum standards for space, quality, quantity, and all other requirements imposed by law and implementing regulations for such areas. The local government must exercise its police power (poder de policía) in a timely manner, guaranteeing the residents of the canton that the works will be carried out as required by urban-planning regulations and under the conditions they prescribe. The mere fact that the parceling of land (parcelamiento) requires works to provide access and various services to any of those properties is sufficient to establish that it is not a “simple subdivision,” but rather a residential project that must consequently comply with all the stated requirements. Urban residential projects may provide access to properties only by means of public roads that must meet the dimensions and requirements of the Ley General de Caminos Públicos and, in the absence—in the latter case—of specific provisions in local regulations, the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones.
(Decisions of this same Section, numbers 175-2009, issued at fifteen hours and forty minutes, and 176-2009, issued at fifteen hours and fifty minutes, both on the thirtieth of January of two thousand nine, cited above.) // Accordingly, when approving building permits for housing developments (urbanizaciones), the Local Government must verify full compliance with the corresponding provision of public roads, green areas, and community areas and, especially—as relevant to the resolution of this matter—with the developer’s provision and implementation of public utilities such as electricity, telephone service, drinking water, aqueducts, and sewer systems, the latter where the necessary infrastructure exists. Consequently, the failure of urban development projects to conform to the requirements established by the urban-planning legal framework requires, per se, the denial of the applications filed, pursuant to the principle of legality (principio de legalidad). // VII.- Regarding the nature of the Villas de Jesús de Atenas Project.
In this proceeding, the legal nature of the Villas de Jesús Project must be clarified, because both the Municipal Engineer and the company Nombre53625 have classified it as a “simple subdivision” under the Reglamento para el Control Nacional del Fraccionamientos y Urbanizaciones. As shown by the documents submitted to the Municipality, and in accordance with the conclusions of Engineer Bayardo Noguera Paz included in the document entitled “Technical Analysis of Documents for Permits,” although the project has been called a simple subdivision, it is in fact a complete urban development project intended to provide housing through 48 lots on land lacking all services. The various actions undertaken show that the company Nombre53625 has been applying, one by one, for all the permits necessary to construct a housing development and provide it with basic services. Both the company and the Municipal Engineer justified treating it as a simple subdivision solely because the property is surrounded by public roads and all lots would front on a public road.
In this regard, it must be noted that although the property is surrounded by public roads, the permit granted by the Mayor itself demonstrates that the property subject to partition (segregación) lacks essential services, and what was authorized was the construction of a wastewater treatment plant (planta de tratamiento de aguas residuales), improvements to the public road, concrete surfacing (encascotado), curbs and gutters (cordón y caño), sidewalks, stormwater drainage (evacuación de pluviales), and drinking water infrastructure, which is far from being a simple subdivision under the terms stated above. It follows that the developer’s actions are outside the law, because it intends to construct a housing development without fully complying with all requirements necessary for that purpose, including, among others, submission of the preliminary design (anteproyecto) and compliance with all statutory requirements, as was disclosed in Engineer Bayardo Noguera’s technical report, which identified serious deficiencies that must be addressed by the developer and that were transcribed in Proven Fact 26 of this resolution.
The foregoing means that the challenged Municipal Council decision, having considered the existing technical reports, correctly applied the body of applicable law (bloque de legalidad), insofar as it adhered to the unequivocal rules of science and technology (Article 16 of the Ley General de la Administración Pública), which require the Administration to ensure that its actions do not contradict the theoretical knowledge derived from the various scientific and technical methodologies and disciplines, such that any ruling by the Municipality concerning a building permit must conform to the results of the technical studies required in the particular case. It must be noted that there are not even any studies showing the actual capacity of the existing well to supply forty-eight houses; the well was authorized by MINAET exclusively for domestic use. Nor are there studies concerning the treatment plant’s operating system, among other serious deficiencies.
It follows from the foregoing that none of the claims of error raised by the company to the contrary can be sustained. // VIII.- On the powers of the Municipal Council in urban-planning matters. Lastly, it is appropriate to examine the Municipal Council’s participation in the actions under review, since it ruled contrary to what had been communicated by the Mayor. The process of strengthening territorial decentralization through greater political and financial autonomy gives a leading role to Nombre20665—a democratically elected official in each locality—who introduces within the municipality an administrative system that must efficiently and economically combine human, material, and financial resources in order to achieve the proposed objectives. Accordingly, the administrative task undertaken by Nombre20665 may be summarized as the basic functions of planning, organization, integration, direction, and oversight, so as to secure the commitment and identification of the other members in order to carry out the proposals initially presented by him to the community, all with a view to the locality’s socioeconomic development.
The principal duties assigned to him by Article 17 of the Municipal Code include: // a) Exercise the general administration of the municipality. // ... // e) Submit to the Municipal Council a government program based on an assessment of the canton’s circumstances... // However, his administration is carried out concurrently with the powers of the Municipal Council, which is the municipality’s deliberative body and is composed of council members who are also popularly elected. Article 13 of the Municipal Code sets forth the Council’s powers, including: // “a) Establish the municipality’s development policy and priorities in accordance with the government program registered by the municipal Nombre20665 for the term for which he was elected. // ... // o) Adopt urban-planning measures.” // As is clear from the transcribed text, the Municipal Council is obligated to respect the government program submitted by the Mayor, to which any project or service provided by the local entity must be subordinate.
As the body having jurisdiction over urban-planning matters, the Municipal Council was responsible for approving everything relating to this project, given that it is not a simple subdivision (fraccionamiento simple) under the cited provision, in strict application of Articles 11 of the Political Constitution and 11 and 13 of the General Law of Public Administration. This leads to the conclusion that the claims of error raised by the appellant company cannot be sustained and that the decision appealed from was correctly resolved. // IX.- In view of all the foregoing, because the claims of error asserted in the appeal cannot be sustained, the appropriate course is to affirm the challenged decision and declare the administrative remedies exhausted.” (see folios 843 through 867 of volume 3 of the administrative case file). 62) By official letters MAT-IC-62-2010 dated dieciséis de agosto de dos mil diez, MAT-IC-69-2010 of dos de septiembre de dos mil diez, and MAT-INGM-74-2010 of diecisiete de septiembre de dos mil diez, signed by the municipal engineer, he informed Nombre20665 and the Municipal Council that the project complied with each and every requirement that had been requested (an uncontested fact, as shown at folios 277 and 365 of the judicial case file). 63) The project complies with all legal requirements if it constitutes a simple subdivision (see the testimony of Messrs.
López León and Méndez Marín given at the oral and public trial). 65) The plaintiff company suffered acts of vandalism affecting the well on its property during one of the periods when the project was halted (see the testimony of witnesses Nombre41092 and V).
The following are deemed to be such:
Municipalities are local entities that enjoy relative autonomy in the exercise of their functions, based on territorial decentralization (descentralización territorial), as may be inferred from Article one hundred sixty-eight of the Constitución Política. This level of independence is granted by Article one hundred sixty-nine of the Carta Magna, within the framework of their territorial jurisdiction (competencia territorial), comprising the physical area designated for the canton they represent, insofar as it provides that each municipal government is responsible for the: “administration of local interests and services …”; thus, the fundamental charter confers a series of functions or powers upon those governments by reason of “local matters,” that is, to administer the services and interests of the area to which they are confined, namely, the canton. Accordingly, it is clear that there are interests whose protection falls to the Municipalities and, alongside them, there are other interests whose constitutional or legal protection is assigned to other public entities, with the understanding that jurisdiction is not exclusive, particularly where local interests are also regional or even national, such that interests from the local to the national level converge, without prejudice to the fact that, in some cases, their impact may be limited to the smallest level.
The municipality’s territorial sphere constitutes an original jurisdiction (competencia originaria) of municipal governments and may be displaced only through a nationalization statute, provided that such legislative action does not impair the aforementioned autonomy or effectively deprive the municipal regime of its constitutional substance. For its part, Article four of the Código Municipal, Ley no. 7794 del treinta de abril de mil novecientos noventa y ocho, sets forth the types of autonomy that the ordinary legislature deemed these corporations to possess, stating that they enjoy political, administrative, and financial autonomy (see Sala Constitucional, votos 5204-2004 y 8928-2004). Within this dynamic interplay of interests lies the matter of urban planning (urbanismo), where the interest is essentially local but has significance beyond the cantonal level, extending to matters of national concern.
Thus, the Ley de Planificación Urbana establishes a coordination mechanism under which each Municipality is responsible for approving its respective regulatory plan (Plan Regulador), subject to approval by the Instituto Nacional de Vivienda y Urbanismo with a view to implementing a national development policy that integrates all the technical, economic, and social variables that converge in this activity. The reverse applies to environmental matters (insofar as the various ecosystems and biological corridors extend throughout the territory), where the interest is national, but its specific application directly affects the territorial sphere of each municipality. In resolución no. 5445-99, the Sala Constitucional, in addition to developing the foundations of municipal autonomy, defined the interaction among these interests and established the mandatory coordination of local, regional, and national authorities in order to satisfy the various interacting public interests.
Notwithstanding such autonomy, the principle of legality (principio de legalidad), constitutionally grounded in Article eleven, requires constitutional and statutory powers to be exercised under the legal rules that define, delimit, and specify their operation; it is, in effect, a guarantee to municipal residents and civil society generally that public acts issued by those local entities are consistent with that principle. As a general rule, this entails the proper application of legal rules, not only as to their substance but also with respect for their hierarchical rank, from which it follows that the application of subordinate regulatory measures that conflict with or contravene the law is impermissible. Municipal autonomy, established by the Carta Magna, confers upon local corporations special jurisdiction over the administration of the interests and services within their territorial jurisdiction (Articles 169 and 170), which prevails over that of other institutions within the local context.
Article fifteen of the Ley de Planificación Urbana, no. 4240 del quince de noviembre de mil novecientos sesenta y ocho, grants local entities the fundamental authority to regulate and oversee all matters concerning urban planning and development within the limits of their territorial jurisdiction, which is merely the implementation of the aforementioned Article one hundred sixty-nine of the fundamental charter. Consequently, each territorial corporate entity must take the appropriate measures to implement a regulatory plan and the related urban-development regulations in the areas where they are to apply, without prejudice to extending all or some of their effects to other sectors where compelling grounds exist for establishing a particular oversight regime (régimen contralor). The assigned jurisdiction is not limited merely to planning, but also includes powers to control urban development, which entails substantive oversight both of work in progress and of completed work.
Consistent with the foregoing, Article one of the Ley de Construcciones, Decreto Ley no. 833 del cuatro de noviembre de mil novecientos cuarenta y nueve, clearly establishes these powers, as reiterated in Article thirteen, subsection o), of the Código Municipal, under which the Concejo is responsible for issuing rules and measures concerning urban planning. Thus, the performance of any work or construction requires a municipal permit (licencia municipal), and the local entity is also responsible for overseeing such work (Articles 74 and 87 of that statute). The Municipality’s predominant role in these matters is therefore evident, as it is responsible for adopting specific measures concerning urban development and planning, as well as granting construction “permits” and monitoring those activities in accordance with the rules governing that field (see, in this regard, Sala Constitucional, votos 2153-93 y 4205-96).
It should be noted that the scope and effects of urban development and planning generally entail coordination with the rest of the public administration, which justifies the involvement of the Instituto de Vivienda y Urbanismo, the Instituto Costarricense de Electricidad, or the Ministerio de Ambiente, Energía y Telecomunicaciones, always within the scope of their respective jurisdictions. It must not be forgotten that an urban-development project involves various considerations that extend beyond the purely urban sphere. In matters of an urban-planning nature, particularly the construction of subdivisions or residential developments, the Ley de Construcciones and the Ley de Planificación Urbana, in their Articles fifteen and thirty-two, respectively, refer the specification of the matters that developers must address to regulations, namely, the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones (3991 del 13 de diciembre de 1982), while construction matters are governed by the Reglamento de Construcciones (del 22 de marzo de 1983).
Pursuant to Articles fifteen and seventy-four of the Ley de Construcciones, every subdivision (fraccionamiento) and urban development (urbanización), as well as every construction-related project, must have an authorization (acto autorizatorio) issued by the corresponding Municipality. Matters of safety, sanitation, and appearance are also regulated in the Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, which is applicable for this purpose insofar as it is a predominantly technical legal instrument containing various regulations governing urban developments in such areas as access, roadways, lot division, green and public areas, drainage, water-supply systems, sewers, infrastructure, and finishes, among others. Oversight naturally falls to local governments, with this rule uniformly reinforcing municipal powers. From this perspective, municipalities act in two capacities: preventive and supervisory.
In the preventive context, the “permit” is granted if all requirements are met, and that function is carried out through such qualitative and quantitative review. In its supervisory capacity, the municipality verifies that what is actually carried out conforms to what was authorized; these functions are manifestations of public authority derived from powers conferred by the constitutional and statutory framework in this field, which justify the Administration’s exercise of authority. Likewise, oversight applies because a specific project, even when carried out strictly within the limits of what was approved, may produce impacts that were not considered, such as archaeological, ecological, or environmental impacts, among others; these would require suspension of the work and its redesign to adapt it to the newly identified circumstances. The municipalities may therefore exercise a series of inherent powers that are necessary for sound administration.
These powers even authorize them to suspend a particular project when it fails to meet the required conditions or, in the exercise of their preventive and precautionary role, to deny a construction application when the legal and technical requirements imposed by the applicable provisions have not been satisfied. These are specific manifestations of public authority that protect legal principles, including safety, environmental protection, and health. This therefore constitutes an inspection function concerning the construction-related aspects of structures erected within the municipality’s territory, for the purpose of determining whether they comply with the requirements established by that legislation and with other regulations associated with the activity. In accordance with their purpose, these powers and authorities serve public or collective interests, which ultimately provide the justification for municipal involvement in controlling and overseeing urban-development activities.
Because these powers are established by the legal system (Ordenamiento)—as a direct consequence of the constitutional powers entrusted to the local entity—and are associated with the protection of public interests, the local entity’s actions must encompass not merely a superficial, formal review of applications for construction permits, but also a comprehensive and thorough assessment of compliance with the legal and technical requirements imposed by the legal system.
Unlike administrative concessions (concesiones administrativas), through which the Administration transfers certain public powers to a private party, whether a natural or legal person, through authorizations (autorizaciones) the Administration “removes barriers” to the exercise of a right that is already held but has not yet been administratively declared in favor of the applicant who complies with the requirements imposed by the legal system as a whole. Hence, following Manrique Jiménez (JUSTICIA CONSTITUCIONAL Y ADMINISTRATIVA, 1º edición, San José, Imprenta y Litografía Mundo Gráfico, 1997), the authorizing Administration neither delegates powers nor creates rights; it merely declares them, because the rights already exist before the respective declaration, by virtue of compliance with the legal system as confirmed by the party who, as a matter of law, applies for the authorization itself.
The authorizing Administration therefore issues a declaration of intent in favor of the public or private person who has complied with each and every prescribed requirement, with the Administration limiting itself to assessing the legality of the application within the sphere of the public interest that the Administration itself must safeguard. In the best sense of the term, it is a declaratory act (acto constatativo) issued once a series of legal requirements has been verified. It is maintained, in principle, that when the exercise of a subjective right (derecho subjetivo) requires an enabling act (acto de habilitación) from the Administration, there is no room for administrative discretion (discrecionalidad administrativa), since the authorizing Administration is legally obligated to issue it when the applicant has previously complied with the regulatory requirements. Thus, an authorization involves two dimensions of regulated acts (actos reglados): those relating to the content of the authorization and the act declaring it, which must be consistent with the grounds and purposes justifying it.
Nevertheless, once the authorizing act has been issued, the Administration does not thereby lose its supervisory and oversight powers over the use and enjoyment of the permit, license, or authorization. Its original prerogative as the Administration responsible for serving and safeguarding the public interest does not disappear merely because the authorization has been expressly or implicitly declared. In essence, therefore, the Administration retains its power to revoke or annul licenses or approvals in the case of conditional licenses or unlawfully granted licenses; provided, of course, that the legal procedure has been followed, guaranteeing the interested party’s full participation and, in particular, the right of defense (derecho de defensa) and due process (debido proceso) generally. Indeed, the applicant’s subjective right to authorization arises upon full compliance with the legal system, and the Administration may neither contest nor disregard its declaration; but neither may the applicant validly seek the individual application of a declaration of that right when the applicant has not complied with the requirements prescribed for everyone.
Among the various forms of administrative authorization, licenses (licencias) are one of the classic examples, including the incorrectly named “construction permits” (permisos de construcción), which municipalities must issue within their territories in accordance with the Ley de Construcciones. Article 1º of that statute provides: “The Municipalities of the Republic are responsible for ensuring that cities and other population centers meet the necessary conditions of safety, sanitation, convenience, and beauty in their public thoroughfares and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law in these matters to other administrative bodies.” Article 2º adds: “Scope of this Law. This law applies throughout the Republic. In the future, no building, structure, or component thereof may be constructed, adapted, or repaired except in accordance with the conditions established by the respective Regulations.
Nor may demolitions or excavations be performed on private property, public thoroughfares be occupied, or works be carried out thereon without complying with the provisions of those Regulations.” Article 74 of the Ley de Construcciones, in turn, provides: “Licenses. Any construction-related work performed in the population centers of the Republic, whether permanent or temporary, must be carried out under a license issued by the corresponding Municipality.” Article 78 establishes the tax on construction by providing: “License Fees. All licenses shall give rise to fees, which shall be set in accordance with the rates in force, taking into account the quantity of work to be performed or the extent of occupation of a public thoroughfare, as well as its duration.” Of fundamental importance to the matter before us, Article 79, also of the Ley de Construcciones, provides: “Payment. For a license to take effect, the corresponding fees must have been paid.” Regarding penalties, that Law provides: “Powers.
The Municipality may impose penalties for violations of the rules of this body of law. The penalties shall be those specified in this Law and its Regulations (fines, closures, evacuation, destruction of the work, etc.) and those established in this Chapter.” Finally, it is appropriate to reproduce the provisions of Article 90 of the Ley de Construcciones: “Fines. Under no circumstances shall the amount of the fine exceed the economic harm suffered by the Municipality as a result of its failure to collect the license fee corresponding to the violated requirement.” It bears reiterating that the granting of any construction permit is conditional upon the project in question conforming to the applicable urban-planning regulations (ordenación urbanística); this entails prior enabling review or a “permit,” accompanied by oversight of the performance of the authorized activity to ensure that it is carried out in accordance with the license or permit granted and the regulations governing the activity.
Although thus far we have used these concepts as though they were analogous, certain distinctions should be drawn. An authorization is understood to be an act of “enablement or permission,” meaning the “administrative act (acto administrativo) whereby the public administration grants the administered party (administrado) the power to exercise preexisting rights following a discretionary assessment of the timeliness and usefulness of such exercise with respect to the general interest. In such a case, authorization is issued in response to an express application by the administered party, but it is generally discretionary as to its grounds and content. The distinction between this type of authorization and a license, in the strict sense, lies in the fact that the latter has an effect similar to authorization but is governed by rules; that is, its content is regulated.” (JINESTA LOBO, Ernesto.
Tratado de Derecho Administrativo, Tomo I. Biblioteca Jurídica Diké. pág. 449) A permit (permiso), for its part, is understood as an “act authorizing a person—the administered party—to exercise a right that is, in principle, prohibited by the legal system itself. It is a special exemption from a general prohibition for the benefit of the applicant. A permit tolerates or allows something very specific and defined to be done. Its nature consists of removing a legal obstacle to the exercise of a preexisting power; it is said to be a concession of limited scope because it grants rights of lesser intensity and greater precariousness,” and also “always grants a new, weakened right that constitutes an exception to a public-order prohibition” (JINESTA LOBO, Op Cit, págs. 456 y 457). In general terms, the two words are often confused, but both share the requirement that a preexisting right must exist. Now, the Ley de Planificación Urbana (Ley 4240), in its first article, defines subdivision (Fraccionamiento) as follows:
“Subdivision is the division of any parcel of land for the purpose of separately selling, transferring, negotiating, distributing, exploiting, or using the resulting lots; it includes partitions resulting from judicial or extrajudicial awards, the demarcation of undivided rights, and simple segregations remaining under the same owner’s title, as well as those located in developments or new constructions that are relevant to the regulation of the formation and urban use of real property.” Subdivision is the division of a parcel of land for the purpose of introducing it into private commerce, which presupposes—as each local government must verify when granting the corresponding approval (visado)—that its size and characteristics comply with the urban-planning provisions in force, particularly the local land-use regulatory plan (Plan Regulador), if one exists, as well as development regulations and other special public-order laws. Based on that concept, which is reiterated in various provisions, two concepts may be identified that, although they interact with one another, are not identical: simple subdivision (fraccionamiento simple), on the one hand, and a complex project or urban development (urbanización), on the other. The same provision defines urban development (Urbanizar) as follows:
“Urban development is the subdivision and preparation of land for urban purposes through the opening of streets and the provision of services.” This entails that a simple subdivision (fraccionamiento simple) consists of the division of a parcel of land, regardless of the motivations or interests pursued, when it fronts a public street and is provided with all the public services customary in an urban area. It bears repeating that the full availability of basic public services (water, lighting, garbage collection, and electricity, at a minimum) is vital in this case; therefore, they must be sufficient to meet the needs of the new construction. The subdivision that the law refers to as “simple” does not include an urban-servicing process (habilitación urbana) for the use and enjoyment of the lots resulting from that subdivision, because the legislature assumes that, in such cases, the properties have access roads and green areas resulting from prior urban development.
The logic is straightforward: the subdivision does not in itself entail any greater efforts by the public corporation or other government agencies; the service network already exists Nombre53625 and the only activity required is connection to that network. With regard to subdivision approval (visado), it is merely a permit in the strictest sense of the term, since it entails only verification of formal and technical requirements; the subsequent building permit is a logical and necessary consequence, provided that what is created does not constitute an urban development (urbanización). An urban development, by contrast, is a more complex project in which, although the developer has a legitimate interest in carrying out that economic activity, the provision or extension of public services requires a series of precautions that must be taken into account, and the review of requirements becomes more thorough, without prejudice to the fact that it is a complex act in which several public agencies external to the public corporation ordinarily participate.
This leads to the necessary conclusion that what is involved is an authorization for the entire project and that, once it has been granted, the acts implementing it are merely permits. It constitutes urban servicing, which is why Article forty of the Ley de Planificación Urbana establishes the obligation to transfer land for parks and urban facilities. When a particular area has already been developed, the purchasers of the subdivided lots have access to the properties, parks, and community facilities; it must not be overlooked that this forms part of their right to enjoy a healthy and ecologically balanced environment (Article 50 of the Constitution). For this reason—it bears repeating—the legislature has not deemed it necessary, in the case of a “simple” subdivision in an already developed area, to require additional land contributions on grounds of social interest. Because of its limited significance, approval for simple subdivisions is usually entrusted to an official (e.g., the Municipal Engineer) other than the official or body entrusted with “complex” approvals (e.g., the Municipal Council, urban-planning commissions, etc.), with the former lacking jurisdiction to authorize a different type of approval; this is so where urban-planning regulations make such a distinction.
The foregoing makes sense on the understanding that, in the first case, the vast majority of requirements are prescribed by regulation and the margin of discretion is minimal. A subdivision that forms part of the urban-development process and entails servicing the properties for urban purposes for the first time must be provided with streets, green areas, and parks, as well as the services necessary for their use and enjoyment. A complex or urban-development subdivision involves an act that properly falls within the authority of the institutional head, except where authority has been delegated. In this second scenario, we are dealing with a complex process of subdivision and urban development that imposes urban-planning restrictions on private property (Article 22 of the Ley de Planificación Urbana), which the Tribunal Constitucional has held to be fully consistent with the Law of the Constitution (voto N° 5097-93 de las 10:24 hrs del 15 de octubre de 1993).
Accordingly, when approving building permits for urban developments, the Local Government must verify full compliance with the corresponding provision of public roads, green areas, and community areas and, of particular relevance to the resolution of this matter, with the servicing and implementation, at the developer’s expense, of public services such as lighting, telephone service, drinking water, water-supply systems, and sewerage, the latter where the necessary infrastructure exists. Consequently, the failure of urban-development projects to comply with the requirements established by the urban-planning legal framework necessarily entails, per se, the rejection of the applications filed, pursuant to the principle of legality. As the definition itself indicates, an urban development always entails some margin of discretion, particularly because, even where the developer Nombre41092 provides the corresponding services and streets, without prejudice to other obligations (such as that established by Article 40 of the law under consideration), the territorial public entity is called upon to assess its capacity to meet the new demands.
Furthermore, the list of requirements, which is partially regulated by various provisions, must be tailored to each specific case, an exceedingly complex undertaking. For this reason, we reiterate that the enabling act (acto habilitante) departs from the concept of a permit and instead constitutes an authorization, as explained above. Given its close relationship to the matter before us, it is appropriate to clarify several points concerning positive administrative silence (silencio positivo).
It is clear that every administrative authority is called upon to respond as promptly as possible to the various applications submitted to it, not only pursuant to a constitutional mandate (Articles 20, 30, and 41 of the Constitution), but also as an expression of the democratic nature of the State and to avoid creating uncertainty for users. Article one hundred thirty-nine of the Ley General de la Administración Pública (hereinafter LGAP) establishes a principle of administrative law according to which: “The silence of the Administration may not express its intent unless a law provides otherwise.” This means that administrative inaction does not express the intent of the Administration; in other words, the Administration’s silence produces no legal effect unless a law assigns a different meaning to that silence. The exception to that principle therefore consists of assigning a legal effect to the inaction of the Public Administration when certain conditions are met.
Such exceptions are known as positive administrative silence and negative administrative silence (silencio negativo). This possibility is, above all, a legal fiction, since it is not an implied act but rather a procedural remedy for administrative inertia. The general rule in this area is that silence has a negative effect, allowing the affected party to proceed with the matter before the next level or, if the party so wishes, to pursue judicial proceedings. It would be contrary to every principle of law to leave the interested party indefinitely awaiting a response that never arrives, even though the legal system establishes an obligation to respond to that party’s application. As relevant here, positive administrative silence is a procedural mechanism under which the legal system deems authorizations, licenses, or permits to have been granted upon the Administration’s silence once the period for it to issue a decision has expired, provided that the interested party has submitted an application and fully complied with the requirements for its approval.
Authorizations or approvals that must be granted in the exercise of oversight and supervisory functions relate to inter-administrative relationships—in which private parties do not participate—whereas permits, licenses, and authorizations relate to dealings with private parties. It should be noted that positive administrative silence does not constitute a true administrative act (acto administrativo), but rather an effect that the legal system assigns to the absence of a response in the face of administrative inaction. The limited and exhaustive nature of the circumstances in which it applies is not in itself arbitrary, because, as explained above, these are situations in which an administrative barrier stands in the way of a preexisting right, the exercise of which is contingent upon legal verification that all applicable requirements have been met. Thus, if no ground for rejecting the application can be identified within the allotted time, logic requires that it be approved and its exercise permitted.
It should be recalled that these are acts with a very limited margin of discretion, involving a substantial number of regulated elements and only very narrow areas of discretion. In our positive law, it is specifically section three hundred thirty of the Ley General de la Administración Pública that regulates the institution of positive administrative silence in general terms. As has been indicated, these permits, authorizations, or licenses constitute obstacles or barriers that a private party must remove or overcome in order to engage in a particular activity or carry out a specific project. What is at stake is the exercise of a public freedom, although, as consistently stated, an enabling act by the Public Administration is required for its exercise. Positive administrative silence occurs when the period within which the Administration must issue a decision has elapsed and it fails to do so.
In addition, for the act to be deemed granted by virtue of positive administrative silence, the private party must have fully complied with the proper submission of all requirements demanded for the issuance of the authorization, license, or permit. Article three hundred thirty-one of the aforementioned Law establishes that the period required for positive administrative silence to arise is one month from the date of the application for the permit, authorization, or license, accompanied by submission of the legal requirements. Special laws may, however, establish different periods. The last-cited article further provides that, once positive administrative silence has occurred, the Administration may not issue a decision denying the application or extinguish the act except in the cases and in the manner provided by the law itself. This means that, where an authorization, license, or permit has been granted by virtue of positive administrative silence, the Administration may not subsequently issue a contrary decision expressly denying the application, in accordance with the principle that an authority’s own acts are binding upon it (principio de intangibilidad de los actos propios), and must instead resort to the procedures and mechanisms provided by the legal system itself. Our case law has stated the following regarding this doctrine:
“V.- Because positive administrative silence (silencio positivo) constitutes an administrative act (acto administrativo) equivalent to the requested authorization, license, or permit, article 331, subsection 1, cited above, provides that the application submitted must contain the legally required elements. That is, for positive administrative silence to operate, the private party must have complied, in the application, with each and every requirement imposed by the rule, since otherwise the essential prerequisites for the existence of the act would be absent, and silence cannot operate when any one of them is omitted, even if the responsible body or official does not issue the corresponding notice to cure the deficiency (prevención). To hold otherwise would mean accepting the existence of an administrative act that does not meet the essential prerequisites for its validity, and in the specific case the defect could not be cured.
On this subject, and in a similar case, the Corte Interina, in an extraordinary session held at 10,00 hours on 7 de febrero de 1985, when hearing the amparo proceeding (recurso de amparo) filed by Nombre36751. against the Gobernador de San José, found that ‘the truly decisive issue is to determine the specific content of the approval or authorization obtained through positive administrative silence in those cases in which the claim asserted by the private party or public entity initiating the proceeding is not consistent with the law. In principle, there are three possible solutions: the first and most radical consists of deeming the submitted project authorized or approved on its own terms; the second solution advocates limiting the authorizing or approving effects of positive administrative silence to what may, under the Law, be authorized or approved; the third calls for adjusting the effects of positive administrative silence according to the type of defects in the underlying project.
The truth, however, is that after analyzing these three possible solutions in legal doctrine, it must be concluded that under each and every one of them, powers contrary to statutory provisions cannot be deemed acquired through positive administrative silence, because positive administrative silence cannot be allowed to prevail when what is thereby granted cannot be authorized under the law. In short, positive administrative silence substitutes for an express act, but only within the limits authorized by law.’ The absence of formal or substantive requirements in the application submitted by the regulated party (administrado), even when the Administration did not identify them in a timely manner, prevents positive administrative silence from operating. It should further be noted that the contrary could permit collusion between the regulated party and the Administration, allowing acts contrary to legislation or even morality to be issued through silence.” (Sala Primera de la Corte Suprema de Justicia, judgment 88-94 of fifteen hours and five minutes on diecinueve de octubre de mil novecientos noventa y cuatro) Up to this point, we have considered the entirety of construction activity as a conceptual unit within the framework of permits, insofar as the owner of real property, personally and in the exercise of the right of ownership, has the power to use it in whatever manner the owner deems best.
This means that a building permit (licencia constructiva) is nothing more than the removal of an administrative barrier to allow the specific exercise of that right presented in the case. However, in the matter sub judice, it is essential to draw an important distinction between simple subdivision (fraccionamiento simple) and land-development permission (permiso urbanístico), and to analyze them in relation to positive administrative silence. A first point to note is that, under constitutional article fifty, positive administrative silence cannot apply where an impact on the environment is involved (Sala Constitucional votes 2001-05737 and 2003-03656, Sala Primera de la Corte Suprema de Justicia vote 000507-F-04 and Decreto Ejecutivo N. 32565-MEIC). This would implicitly entail either that all the submitted requirements were not present from the outset or that the interested party provided false information to create the appearance to the contrary.
That assertion consequently means that positive administrative silence cannot apply to any urban development project (proyecto de urbanización), because, given the scale of the activity, it will always have some impact in this area. This does not mean, however, that certain subdivision and construction projects are not also subject to that principle (consider, for example, a shopping center or an industrial workshop, among others), although they would at least be the exception rather than the rule. With respect to subdivision activity, and specifically as regards the issue before us, it may be maintained that positive administrative silence applies to simple subdivision, subject to the exception for the environmental matters already indicated. However, complex or urban subdivision (fraccionamiento complejo o urbanístico), because of its impacts, cannot be regarded as a mere authorization and affects the application of positive administrative silence; it must therefore be understood that it is not covered by that doctrine, but rather the contrary.
This is especially so because, as noted, an urban development (urbanización) always retains some discretionary element in the act, which would prevent the doctrine of positive administrative silence from being applied without further consideration. This Court understands that silence in its positive form originated in municipal authorizations and permits and that the doctrine is used indiscriminately within that system. However, the cross-cutting nature of certain matters of national interest means that this position can no longer be maintained today; accordingly, as a matter of sound logic, it is a misapplication of the law to seek a positive effect when it should be negative.
The principle of the immutability of the Administration’s own acts (principio de intangibilidad de los actos propios), which this Sala Constitucional has accorded constitutional status because it derives from constitutional article thirty-four (See votes 2753-93, 4596-93, 585-94, 2186-94, 2187-94 and 899-95), is based on the rule that the respective Administración Pública may not annul an act that is in some way favorable to the regulated party, the exceptions being annulment or ex officio review (revisión de oficio) and revocation (revocación). To that end, as a general principle, the public administration must resort, in the first instance—as well as in cases of evident and manifest nullity (nulidad evidente y manifiesta) under the terms of article one hundred seventy-three of the Ley General de la Administración Pública—to the administrative procedure established for that purpose, governed by articles one hundred fifty-four, one hundred fifty-five, and one hundred seventy-three of the Ley General de la Administración Pública; and, in the second instance, acting as plaintiff and following a declaration that the act is injurious to public, economic, or other interests (declaratoria de lesividad), to judicial proceedings for injuriousness (proceso de lesividad), which have traditionally been understood as a safeguard for regulated parties.
This is an application of the constitutional principle of the non-retroactivity of law (irretroactividad de la ley), and all the more so of acts—especially acts declaring rights—which are unalterable by the Administration unless it uses the avenues established by the legal system. On this matter, this Tribunal Constitucional stated the following in Voto No. 897-98 of 11 de febrero de 1998:
“... the Administration is barred from extinguishing, through its own action, those acts that it has issued ..... Thus, rights ... constitute a limit on the powers to revoke (or modify) administrative acts, so that greater procedural safeguards may be required. When the Administration issues an act and subsequently issues another act contrary to the first, to the detriment of subjective rights (derechos subjetivos), it disregards those rights, which it had granted through the first act, whether by mistake or for any other reason. This means that the sole means available to the State to remove one of its own acts from the legal system is judicial proceedings for injuriousness, since such proceedings are designed as a procedural safeguard for the regulated party. Alternatively, our legal system permits the Administration to act contrary to its own acts through administrative channels in cases of absolute, evident, and manifest nullity (nulidades absolutas, evidentes y manifiestas), following an opinion from the Contraloría General de la República and the Procuraduría General de la República—as a further safeguard for the regulated party—and in accordance with article 173 of the Ley General de la Administración Pública.
Consequently, if the Administration has failed to observe the rules governing these procedures, or has omitted them entirely or in part... the principle of the Administration’s own acts dictates that the effect of this irregularity is the invalidity of the act.” Legal scholarship generally analyzes this institution on the basis of acts declaring rights (actos declarativos de derechos), but there are other acts that are also favorable to the person subject to the Administration (administrado) and create legal situations (situaciones jurídicas) that must likewise be duly respected and that, in this Chamber’s view, are equally supported by the principle at issue. It must be noted that, although permits and authorizations are not, in technical terms, acts declaring rights—because they do not declare any right, since, as stated, the right already exists (the right to build on and make use of real property in accordance with the claimant’s interests), and the administrative act (acto administrativo) merely removes administrative barriers—they do, in the Chamber’s view, confer a benefit on the interested party that allows that party to pursue the intended purpose.
Thus, abruptly and unjustifiably giving the measure retroactive effect causes an unlawful injury contrary to the legal system; it is clear that the administrative proceeding (procedimiento administrativo) is not an end in itself but rather the means by which the administrative will is formed through its various elements. Consequently, as a general rule, only material defects (vicios sustanciales)—those that cause a denial of the right of defense (indefensión) or alter the content of the act—result in the nullity of the administrative act (under the maxim that there is no nullity for nullity’s own sake). The absence of any proceeding, however, is itself evidence of an arbitrary act that inevitably renders the specific action null, insofar as the elements of the act were produced by unlawful means. Returning to the available avenues for revocation (revocatoria) or nullity (nulidad), with respect to the former, it is clear from Article one hundred fifty-six that it may be ordered by the head of the agency (jerarca), following a duly conducted administrative proceeding and an opinion from the Contraloría General de la República.
The provision further establishes the mandatory obligation to compensate for the loss and damage caused. As is well known, revocation presupposes a change in the factual or legal circumstances that renders the originally issued act no longer appropriate, without calling into question its original grounds and circumstances, which are presumed to have been lawful. In other words, the Administration’s action was originally issued in accordance with the law and is revoked because the current circumstances have changed, rather than because of defects in the administrative determination. Regarding nullity, Article one hundred seventy-three of the Ley General de la Administración Pública provides that a public entity or body may annul through administrative proceedings an act declaring rights in favor of the person subject to the Administration when that act is harmful to the public or property interests of the former, without having to institute contentious-administrative proceedings for a declaration of injuriousness to the public interest (proceso contencioso administrativo de lesividad), provided that the act is vitiated by evident and manifest absolute nullity (nulidad absoluta evidente y manifiesta).
Evident and manifest absolute nullity must first receive a favorable opinion from the Procuraduría General de la República or the Contraloría General de la República—a preparatory act (acto preparatorio) for the final annulment decision. The Contraloría General de la República shall be responsible when the nullity concerns administrative acts directly related to the budgetary process or government procurement (contratación administrativa) (Hacienda Pública). This opinion is binding—meaning that the consulting body or entity may not depart from it—because Article 2 of the Ley Orgánica de la Procuraduría General de la República provides that compliance with it is mandatory. Through this opinion, a form of prior or preventive legality review (control previo o preventivo de legalidad) is exercised, since it must precede the final act in the ordinary proceeding (procedimiento ordinario) instituted to order annulment ex officio (anulación oficiosa), given the seriousness of the facts under consideration and the opinion’s technical-legal nature.
In cases in which the opinion must be issued by the Contraloría General de la República, it is likewise binding pursuant to the applicable law. Not every degree of invalidity or nullity authorizes a public entity or body to order ex officio the annulment of an administrative act declaring rights in favor of a person subject to the Administration, because the administrative legal system requires the existence of certain specific and aggravated characteristics or attributes qualifying the nullity as “evident and manifest.” That which is evident and manifest is patent, notorious, conspicuous, palpable, clear, and certain, leaving no room for doubt and requiring no dialectical or logical process or effort of verification to uncover it, precisely because of its gross and serious nature. In that regard, it is sufficient to compare the administrative act with the statutory or regulatory provision supporting it in order to reach that conclusion, without the need for any interpretation or exegesis.
Before declaring nullity, the respective public administration—the author of the act sought to be annulled or reviewed—must institute an ordinary administrative proceeding in which the principles and guarantees of due process (debido proceso) and the right of defense (defensa) must be observed (Article 173, paragraph 3, of the Ley General de la Administración Pública). The requirement to follow that proceeding is justified because the final act may extinguish a subjective right (derecho subjetivo) held by the person subject to the Administration (Article 308 ibídem). At the conclusion of the ordinary proceeding, it is essential to obtain the opinion of the Procuraduría General de la República or the Contraloría General de la República, which constitutes an interlocutory procedural act (acto de trámite) within that proceeding. When the opinion of the Procuraduría General de la República or the Contraloría General de la República is unfavorable, the respective public administration is legally barred from annulling the act through administrative proceedings and must necessarily resort to ordinary contentious-administrative proceedings for a declaration of injuriousness to the public interest.
I X .- REGARDING THE VILLAS DE JESÚS DE ATENAS PROJECT: Before considering the claims asserted, it is essential to analyze the legal nature of the Villas de Jesús project developed by the plaintiff, namely, whether it constitutes a “simple subdivision (fraccionamiento simple)” or whether, on the contrary, it is a “residential development (urbanización).” From the evidence received, specifically from the municipal engineer and the surveyor, as corroborated by the Instituto de Vivienda y Urbanismo in some of the documentary evidence, it is clear that they consider it to be the former, on the understanding that the project is being developed along a public road and in an area where the corresponding public utilities are available. In principle, the Chamber might share that view if the matter involved only a few plan approvals (visados), or even building permits, held in the plaintiff’s own name; but that is not the situation.
On the contrary, it can be established that the existing utilities were insufficient for the project being developed, which led the interested party to provide them consistently, not jointly but separately, one by one. The best example is the treatment plant: the established facts do not show that it was required by the public-law corporation; rather, the interested party, aware of the relevant limitation, promoted it on her own initiative. A similar situation arose with the water supply, where it can be seen that what was submitted was intended for domestic use, which would be insufficient to meet the actual needs of the economic activity as a whole. Clear evidence of this is that, when requesting approval of the remaining plans, the plaintiff herself acknowledged that she had released the municipality from its obligation to supply water based on an authorization to construct a new well that was supposedly intended to meet the project’s needs.
There is no evidence that this latter well has been constructed to date, demonstrating the lack of certainty regarding the solution to the project’s water problem. The same applies to the improvements to the public road, the curb, the gutter, and stormwater drainage. It is not that public utilities do not literally exist, but rather that the preexisting utilities are insufficient for the specific circumstances presented; moreover, they were requirements for the project to be successfully completed. As if those circumstances were not sufficient, it cannot be forgotten that forty-eight new families in an urban area not only require many services but also create environmental impacts (afectaciones de orden ambiental) that must be assessed, considered, and minimized. Under those circumstances, we find it indisputable that this is a residential development. In addition to the foregoing, a jurisdictional issue (competencia) concerning acceptance of the works was raised at the appropriate time.
The fact remains that it was not demonstrated that any body other than the Concejo Municipal had authority over the matter, which would suggest that any act adopted by Nombre20665 or any of its subordinates in this area would be defective as to that formal element—jurisdiction—unless the project had first been accepted by the higher-ranking authority, the Concejo Municipal. We must emphatically reiterate that the mere existence of a public road is not sufficient to establish the existence of a simple subdivision, because the matter must be considered as an integrated whole. Thus, the existence of a public road creates a presumption that basic public utilities are present, but there is not necessarily a cause-and-effect relationship. This case is a clear example of that situation: although the existence of basic utilities is beyond doubt, the volume of lots comprising the project renders them insufficient, making it essential to provide and improve them.
Even with respect to the end users, the developer is aware of these limitations, since she has consistently sought to provide the missing utilities; however, possibly because the public entity at some point classified the project as a simple subdivision, she followed that procedure because it was less burdensome. As already indicated, the concept of a simple subdivision is that the interested party need only connect its needs to a preexisting network with sufficient capacity to accommodate it, which is not the case here, we reiterate, because of the number of lots provided. This basic and central consideration gives this collegiate body full conviction regarding the specific nature of the project. That said, we consider that there are a number of specific impacts that affect the dispute under review. According to established fact fourteen, the municipality approved twenty-eight plans for segregating lots from the property at issue; it likewise authorized two building permits (established fact number 41) and, by application of affirmative administrative silence (silencio positivo), declared the project and the wastewater treatment plant accepted.
As has been stated, although each of these acts cannot be regarded as creating vested rights (declarativo de derechos) in the technical sense of the term, because they are authorizations and permits, they do create a situation favorable to the plaintiff, which, as such, could not be nullified or disregarded without complying with the applicable legal and constitutional procedures. To accept otherwise would create a state of legal uncertainty incompatible with the democratic, liberal state governed by the rule of law that this nation professes to be. Nor can those acts be treated as nonexistent because they may contain some defect, because that would once again create legal uncertainty that is untenable in the Costa Rican State. This is not a form of validation (convalidación) of an act that, based on what was learned at the oral and public trial and from the evidence presented, has serious deficiencies; rather, it concerns the impossibility of disregarding an act issued by a public agency when no contrary action has been taken regarding it.
In short, there has been no administrative proceeding to deny it the legal effects it has as of this date. It is debatable whether, from a substantive standpoint, certain legal requirements that were not met at the time remain unsatisfied today, since it can be established that an environmental impact study (estudio de impacto ambiental) is now available and that works have been carried out to provide the missing utilities. Nevertheless, the record lacks sufficient evidence to determine whether all needs have currently been met. The most notable example concerns water, regarding which there is no evidence at all, without prejudice to the jurisdictional issue concerning the body authorized to accept the project, under the terms already stated. Within that framework, any substantive or formal action taken contrary to the legal system becomes unlawful or abnormal, as applicable, and gives rise to liability, which necessarily entails that the acts favorable to the interested party cannot be disregarded.
While the Chamber understands that the effects of approving a plan are embodied in the document itself and that, consequently, any acts that may have been issued or actions taken internally within the municipal system do not affect the permit insofar as its purpose is to allow it to be submitted or attested to before the Registro Nacional when executing the deed of segregation, this does not prevent an attempt to deny the existence of the favorable act from constituting unlawful conduct. A similar situation applies to building permits once the work has been constructed, at which point the act is no longer of practical relevance; in any event, a more exhaustive analysis should be conducted, but specifically in relation to the claim at issue.
Before addressing the specific claim, the Court must note that the relief sought is not presented with complete clarity, insofar as recognition of rights and declaratory judgments are consistently intermingled; nevertheless, the Court will endeavor to analyze it as comprehensibly as possible, always guided by the principle of effective judicial protection (tutela judicial efectiva). A) Setting aside the first principal claim, consisting of a declaration that the action be sustained, since it is not a claim in itself but rather one encompassing the others, the plaintiff company’s first request (numbered as two) seeks revalidation of the twenty-eight plans previously approved by the municipality, on the grounds that they relate to a mere subdivision (fraccionamiento). The Court understands the term “revalidation” to refer to a situation in which an administrative act (acto administrativo) is issued, subsequently annulled, and its legal effectiveness is then requested to be restored.
As relevant to this case, the plans shown in proven fact number fourteen have never been annulled and consequently cannot be revalidated. Nevertheless, pursuant to article one hundred twenty-two of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo), the Chamber understands the relief sought to be the annulment of any formal or material act that impairs the favorable administrative action under consideration. It is also appropriate to clarify that the plaintiff implicitly asserts that those certifying acts should remain in effect because they concern simple subdivisions, which, as has been stated, is incorrect, since they form part of a residential development (urbanización). Thus, it cannot be affirmed, in the terms requested by the plaintiff company, that the project is a mere subdivision, when the account of proven facts clearly established the limitations in public utilities, which were undertaken by the developer as necessary requirements for its project; accordingly, the existence of public streets and limited public utilities is insufficient to grant the requested relief.
In any event, we are inclined to construe the claim in the terms indicated, not because these are mere subdivisions, but because any impairment of an act favorable to the governed party (administrado) violates the principle that an authority may not derogate from its own acts (principio de intangibilidad de los actos propios). Consequently, the legal effectiveness of such acts may be extinguished only through legally established administrative procedures, and there is no evidence that any such procedure occurred in this particular case. Upon comparing all the actions taken with those acts, the only instance that could be characterized as an attempt to deprive them of effect appears in proven fact sixty-one, involving the nonhierarchical superior authority (jerarca impropio), which stated that those acts should be deemed nonexistent. The first point that must be noted is that the act under review in the appeal was the minutes of session two hundred twenty, of dieciséis de marzo de dos mil nueve, of the corresponding Municipal Council, concerning the refusal to endorse the positive administrative silence (silencio positivo) granted by the municipality.
This adjudicative body therefore understands that statement to constitute obiter dictum, that is, a tangential analysis undertaken by the Third Section of the Administrative Litigation Court that was not central to its analysis, since that was not the subject of the appeal. This Section of the Court thus understands that the act favorable to the governed party had already been granted previously, as shown in the list of proven facts under number thirty-eight, corresponding to official letter MAT-WA-14-09 of diecisiete de febrero de dos mil nueve. Accordingly, once the act in question had been granted, it was irrelevant whether or not it was endorsed by the Municipal Council, or even whether the nonhierarchical superior authority agreed or disagreed with that position, insofar as the act had already come into existence. It should be noted in this regard that there is no evidence from which bad faith on the part of the plaintiff company could be inferred, particularly since the municipal officials were convinced that this was a mere subdivision, a position even shared by officials of the Instituto de Vivienda y Urbanismo.
Although the administrative officials’ assessment is respectable, this Court does not share it, insofar as they failed to understand that the rule merely contemplated connection to a preexisting public-utility network, which was not the case here. Despite the error in applying the rules, the fact remains that an act favorable to the interests of the governed party exists and cannot be disregarded. Therefore, the position taken by the nonhierarchical superior authority pursuant to section one hundred seventy-three of the Constitution (Constitución Política), in addition to not being a strictly jurisdictional act giving rise to res judicata (cosa juzgada) with respect to this judicial body, was not central to its reasoning. This is without prejudice to the fact that the Municipal Council itself subsequently clarified its resolution, explaining that it should not be construed as an act adverse to the interests of the plaintiff company in this proceeding, but merely as the position of the collegial body.
A clear demonstration of this is that, following this second resolution, the suspension imposed on the project was lifted. Thus, when the nonhierarchical superior authority heard the administrative appeal, there was a manifest lack of interest, because the administrative superior authority, exercising the principle of administrative self-review (principio de autotutela), had reversed its own acts. This again leads us to conclude that no acts exist that seek to deprive the approvals granted to the plans of legal effect. It is important to recall in this regard that the approvals (visados), as such, are acts whose effects are recorded on the plan itself, authorizing the interested party to subdivide the land by means of the corresponding public deed whenever it sees fit, as stated above. Any interference with them would therefore have to take the form of communications with the Registro Nacional, the entity before which the act would produce effects, and no such communications have occurred in this case.
The plaintiff thus speculates about possible future adverse effects, which have not occurred and cannot be adjudicated because it is impossible to know what new actions or positions the public entity may adopt in this particular case. The other actions taken by the municipality (interference with the progress of the work or refusal to accept the project) are merely material actions and do not challenge the approval granted to the twenty-eight plans. Consequently, there is no actual and specific impairment relating to this claim upon which a declaration could be based, and a lack of present interest must therefore be found. This is without prejudice to the fact that declaring those acts valid would entail accepting their conformity with the legal system, although, as previously stated, they do not possess that attribute because they should have been considered within the framework of a development project (proyecto urbanístico), rather than as a simple subdivision.
Neither the parties’ arguments at the oral trial nor the list of proven facts reveals any administrative action currently preventing those works from being carried out, although such action may have occurred previously. While the Chamber understands that the prior actions may give rise to concern on the plaintiff’s part that other situations could arise, where the works have already been completed or are subject to no current restriction, such concerns amount to mere speculation without legal support. It bears reiterating that the decentralized public entity has a duty to supervise and monitor development activities within a canton, but those functions must be performed in accordance with the law. This means that orders halting or suspending work must be based on noncompliance with the permit granted or on adverse impacts arising during the development of the project that were not originally contemplated.
They may never consist of sudden or unfounded actions or actions motivated by unlawful considerations. Returning to the specific case, the Court again finds a lack of interest because these are building permits whose effects were exhausted when the work was completed. Accordingly, there is no relevance in analyzing their validity and effectiveness, particularly when neither is being challenged. Once again, a lack of legal entitlement must also be declared, since, as stated, those acts should have been considered within the framework of a development project and not as a mere segregation (segregación), which precludes a declaration that they were lawfully issued.
The Court therefore cannot impede the exercise of administrative powers and can only state that, if such powers are exercised, they must be exercised within the bounds of the law, with full guarantees of due process (debido proceso) and the right of defense (derecho de defensa), at which time the present plaintiff may exercise the rights guaranteed to it by the legal system itself. Moreover, as to the validity and effectiveness of the foregoing acts, the plaintiff lacks legal entitlement, as stated, and this must also be declared. The Court understands from the evidence received and the interpretation of the applicable rules that it cannot be maintained that all legal requirements were satisfied, insofar as the acts were processed as a mere subdivision rather than as a residential development, under the conditions already explained.
However, as has been reasoned, we are dealing with an act favorable to the claimant’s interests that has not been revoked or annulled and is therefore protected by the principle that one’s own acts may not be impaired (principio de intangibilidad de los actos propios). Thus, regarding acts obstructing the project, as already indicated, oversight of construction projects, insofar as they conform to what has been permitted by an administrative act, is an obligation inherent in the municipal system, because the enabling act (acto habilitatorio) does not authorize just any activity, but rather a specific one. Even when the activity remains within what has been permitted, it may cause impacts that were not considered—environmental impacts, for example—which would make it lawful to halt construction activity. What is unlawful is to halt work that conforms to what was permitted and does not cause unconsidered impacts, particularly environmental ones, which all indications suggest is what occurred in this case.
In any event, we will return to this issue when considering the requested findings of liability. In the case at bar (sub júdice), it can be verified that there are no acts seeking to annul the acceptance of the Villa Jesús de Atenas project, but rather informal actions consisting of the suspension of the project at the time and the failure to carry out the activities required for acceptance of the project; the former no longer presents a current legal interest, while the latter concerns an omission to carry out those activities. Everything appears to indicate that this latter situation is based on the municipality’s lack of clarity regarding the specific impacts that might arise, prompted by pressure from the residents. Acceptance of the project has three direct effects: first, acceptance of the communal areas under Article forty of the Ley de Urbanísmo (including the treatment tank); second, acceptance of the improvements to public infrastructure and services; and third, endorsement (visado) of the project plans that have yet to be endorsed.
We are faced with a conflict of laws (antinomia de las normas), in the sense that accepting the project under the current circumstances would constitute an unlawful act, while at the same time denying effect to an act without complying with the legal requirements would likewise be unlawful. Accordingly, pursuant to Article one hundred twenty-two of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo), the Chamber grants the defendant Municipalidad a period of three calendar months from the date this decision becomes final to implement the ordered act or, failing that, to initiate the applicable revocation or annulment proceedings in accordance with the legally established procedures. This is with the understanding that the legal uncertainty created by the defendant must definitively cease, in one direction or the other, given the contradictory conduct of the public corporate entity, which on the one hand authorizes or permits and on the other denies implementation of the ordered acts.
In this regard, the extensive list of proven facts demonstrates a chain of submissions, some repetitive and others isolated, without any specific decision having been issued on the matter, particularly in the case of the Concejo Municipal, which wholly failed to comply with its obligations. It must be made clear that it is one thing for an act to contain discretionary elements and quite another for the government-administered party (administrado) to be left indefinitely without a decision on its submissions. It can also be verified that the highest collegiate body makes statements disapproving the project but adopts no specific act in that regard, which plainly creates an untenable state of legal uncertainty. By granting that period, the Chamber resolves this claim, as well as claim 5.1, concerning the defendant’s acceptance of the land and works; claim 5.2, concerning endorsement of the outstanding plans; and the matter relating to the annulment of acts contrary to the act that was favorable to the government-administered party. Regarding the latter, we must also note the lack of legal interest, given the absence of any currently effective act having an actual adverse effect on the project under consideration.
As the final point among the principal claims, the plaintiff seeks compensation for damages and lost profits (daños y perjuicios), which, due to their complexity, require detailed examination. Initially, it calculates as property damage (daño patrimonial) the amounts corresponding to construction permits 030-2009 (road improvements and treatment plant), 110-2009 (single-family dwelling), and 11-2009 (single-family dwelling), justifying the damage on the basis that the work was halted without justification. The grounds for the claim state that, through decision MAT-DA-WA-0150 of nueve de julio de dos mil nueve, Mr. Nombre20665 Municipal halted the work, which was not resumed until quince de enero de dos mil nueve, through official letter MAT-WA-07-109. This was indeed an abrupt suspension, with no evidence in the case file (expediente) of any justified reason, undertaken without any procedure and likewise incapable of being justified as a precautionary measure (medida cautelar).
As previously explained, inspection and oversight activities regarding the work are inherent in the municipal system, which entails the possibility of halting it whenever the work performed departs from what was authorized, as well as where there are real and actual effects on circumstances not originally considered; however, neither situation has been established. The sole explanation points to the parties’ allegations that the suspension resulted from pressure by the neighbors—a fact that was likewise not proven—which, although relevant, does not constitute a lawful basis for the administrative act (acto administrativo) under consideration. Consequently, the conduct was procedurally improper and unlawful and, as such, gives rise to liability that may be declared in these proceedings. For the Court, the unlawfulness of the conduct, the existence of the damage, and the causal link (nexo causal) between them are unquestionable, given that halting construction work affects purchased materials, hired personnel, and even potential business transactions that might have arisen from the work; what remains to be established is the amount of that damage.
However, when calculating that damage, the plaintiff fixes it at noventa y nueve millones cincuenta y nueve mil trescientos treinta y un colones con sesenta céntimos, consisting of the purchase price of the land, construction of the treatment plant, improvements to the public road, and infrastructure. The existence of the stated items as activities inherent in the construction project is indisputable, but they manifestly lack a causal link to the unlawful conduct already identified. Thus, neither the purchase of the land nor the work performed resulted from the suspension. The plaintiff cannot seek to recover the project’s entire investment merely because of a suspension, regardless of how unlawful that suspension may have been. It should be noted that the land remains the property of the plaintiff company, as do the works it undertook at its own risk, since every business venture—as the negation of idleness—implicitly entails a series of risks that cannot be imposed upon the Administration and that are assumed by the interested party within the profit-making activity it undertook.
A clear example is that, as of today, the two single-family dwellings could still be sold, as could the remaining works. To disregard the risks of the enterprise and allow it to retain both the completed works and their value would amount to unjust enrichment (enriquecimiento injusto), which under no circumstances can be sanctioned by this Chamber. That calculation must therefore be rejected, and the matter referred to enforcement of judgment proceedings (ejecución de sentencia) so that the plaintiff may calculate and prove the damages actually sustained, subject to the foregoing. It should be clarified that the public oral trial showed that some materials had been washed away because the suspension occurred in the middle of the rainy season, in addition to the ordinary deterioration caused merely by the passage of time, which would not have occurred had the work continued normally. Those damages are directly related to the unlawful administrative conduct; regrettably, however, they were not calculated when the proceedings were filed, and in any event their quantum was never established, precluding their declaration at this time.
The oral trial also addressed, and evidence was submitted—both documentary and testimonial—concerning damage sustained by the plaintiff’s water well while the suspension remained in effect, to the point that a new well had to be constructed. In this regard, the absence of a causal link between the administrative conduct and the claimed damage is evident, because the Administration halted the work but did not prevent the plaintiff from employing security personnel and taking the appropriate and necessary measures to safeguard its property; these are entirely different circumstances. Furthermore, the damage was not proven and, as stated above, was caused not by the Administration but by a third party having no connection whatsoever with the administrative organization or activity. The situation is regrettable and under no circumstances can it be condoned by this jurisdiction, but compensation for those effects cannot be claimed from the municipality.
It should also be noted that, in our view, this case does not fall within the circumstances contemplated by article ciento noventa y cinco of the General Law of Public Administration (Ley General de la Administración Pública), which prohibits compensation where an unlawful interest is involved, because the party cannot be found to have acted fraudulently to deceive the Administration. On the contrary, the public officials who participated in the process appear to have been fully aware of what occurred; thus, the incorrect interpretation of the rules was not induced by the private party but was determined by the Administration. The second claimed item concerns harm to the company’s reputation under the doctrine of objective moral damage (daño moral objetivo), based on the assertion that reports that the project failed to satisfy technical and legal requirements reached the community and the mass media.
Its amount is fixed at quinientos millones de colones. Regarding this calculated item, there is a manifest lack of evidence, in violation of article trescientos diecisiete of the Code of Civil Procedure (Código Procesal Civil), in conjunction with article doscientos veinte of the Code of Administrative Litigation Procedure (Código Procesal Contencioso Administrativo). There is no evidence that the matter in dispute gained public attention within the community or, more importantly, that the company’s assets were harmed. It must be recalled that objective moral damage, unlike subjective moral damage (daño moral subjetivo), is not presumed but must be proven. It cannot be established that any sales were lost as a result of the relevant events, that revenue declined on that basis, or, generally, that any specific harm occurred satisfying the requirements of article ciento noventa y seis of the General Law of Public Administration; accordingly, this item must be rejected.
The third group claimed consists of lost profits (perjuicios), allegedly arising from the failure to complete the project, specifically the inability to sell the lots and thereby obtain the expected profit. This harm is estimated at cuatrocientos dieciséis millones cuatrocientos diecisiete mil quinientos cincuenta colones. It should be noted that, in calculating this item, the claimant proceeds from the premise that it had been dispossessed of the property, even though, as stated, the property remains part of its assets. Logically, this means that its calculation should have included only the profit, rather than the full value of an asset over which it may still exercise control. Once again, there is insufficient evidence. There are veintiocho lots with duly endorsed plans (planos visados) that the interested party may use, and no evidence that it attempted to sell them but was unable to do so because of the defendant’s actions; that circumstance was never established.
Nor has it been shown that any real property was returned on that same basis. All of this suggests that the plaintiff is calculating an amount it expected to receive under uncertain circumstances, since ultimately nothing guarantees that the sales would have occurred on the terms anticipated. This is indeed speculation and must be rejected on the same grounds. In summary, with respect to the damages sought, except for the item recognized in the abstract, the claims lack a legal basis, which must be so declared.
The plaintiff submits a subsidiary claim (pretensión subsidiaria) based on the possibility that the endorsements and construction permits issued cannot be ratified, which requires a corresponding ruling. It initially requests compensation based on the veintiocho endorsements of plans for parcel segregation (segregación) granted by the municipality. As stated, although those acts were issued on the basis of a segregation project when they should have been processed as a residential development (urbanización), the fact remains that those acts have not been annulled and continue to exist within the legal system as of today, precluding the possibility of awarding any compensation. Consequently, because those acts remain in force to date—regardless of whether they are valid—there is no legal injury eligible for compensation on the terms sought; the plaintiff could therefore proceed at any time to segregate those lots and dispose of them as it sees fit.
Note the discussion in the third preceding recital (considerando), explaining that the claim seeking revalidation of the plans manifestly lacked a current interest, since no act had been issued preventing the endorsed documents from being presented to the notary selected by the plaintiff so that the permitted segregations could be executed by public deed. As stated, that possibility remains available to date. Accordingly, any compensation in that regard would be contrary to the legal system. It should be noted in this particular respect that the calculation seeks the items identified under the sixth point of the principal claim, which were analyzed and resolved in the preceding recital and concerning which no further reasoning can be added.
The plaintiff requested payment of statutory interest (intereses legales), which should indeed be awarded as civil interest (réditos civiles) on specific amounts that it was required to pay as a result of unlawful conduct by the Administration, but only once the decision establishes the specific damages sustained. This is an obligation of value (obligación de valor), the quantum of which has not yet been established; it is therefore impossible for the defendant to pay any specific amount. Although the plaintiff seeks payment from the time the harm occurred, it cannot be granted on those terms while the obligation is not yet monetary and must instead be limited as stated. Naturally, such interest must be calculated on the basis of article mil ciento sesenta y tres of the Civil Code (Código Civil). Likewise, pursuant to article ciento veintitrés of the Code of Administrative Litigation Procedure, indexation (indexación) must be awarded, calculated in the same manner from the final enforcement judgment establishing a specific amount payable until actual payment.
X IV.- REGARDING THE DEFENSES: As a defense invoked by the defendant, the expression sine actine agit was asserted, which requires revisiting the reasoning set forth by different Sections of the Court, based on the position stated by the Sala Primera de la Corte Suprema de Justicia in its well-known decision No. 2008-000317 of nine ten a.m. on May second, two thousand eight. Accordingly, a distinction is drawn between the procedural doctrine of an “affirmative defense (excepción de fondo)” and substantive prerequisites (presupuestos materiales). For a complaint to proceed, the judicial body must review, on its own motion, the procedural prerequisites (presupuestos procesales) (procedural capacity, jurisdiction of the court, and compliance with the requirements of the complaint). Later, chronologically and logically thereafter, when judgment is rendered, for the claim to be granted, the court must also review, on its own motion, whether the substantive prerequisites are met.
These are: the right, standing (legitimación), and a present interest (interés actual). If any—or all—of these are absent, the complaint cannot receive a favorable response. Technically speaking, an “affirmative defense” exists when, despite the existence of a right, standing, and an interest in the plaintiff’s claim, the claim cannot be granted because there are also other, distinct but legally relevant grounds supporting the defendant’s opposition. Clear examples of an affirmative defense would be the statute of limitations (prescripción) or expiration (caducidad). Our procedural legal system (both civil procedure and administrative litigation procedure) provides that affirmative defenses must be raised by the defendant when answering the complaint, without enumerating what those defenses are, for obvious reasons. It has been customary in litigation to call the absence of a right, lack of standing (both passive and active), and lack of interest “defenses.” It is even common for litigating attorneys representing defendants to raise the “sine actione agit defense.” These three deficiencies (absence of a right, standing, and a present interest), as indicated, are actually substantive prerequisites, not affirmative defenses in the strict sense.
The “sine actione agit” defense arose from a misinterpretation of the case law issued by the former Sala de Casación, and was understood to encompass “absence of a right, lack of standing, and lack of interest.” Not only does this “defense” no longer exist, but it is redundant if asserted together with those noted above. It applied during the second period of Roman formulary law (Derecho formulario romano), when the plaintiff could bring the defendant to trial only if Nombre24595 granted him the formula-action (fórmula-acción). Otherwise, he lacked that authority, and therefore the phrase “claims without an action” had legal meaning. Today, it is not necessary to obtain the right to institute proceedings before filing a complaint; for this reason, the aforementioned defense lacks both legal meaning and a legal basis. It must be understood that if the complaint is granted and the corresponding grounds are provided, this automatically entails rejection of the “defenses” of absence of a right, lack of standing, and lack of interest.
In other words, separate reasoning is not required. It bears reiterating that even if the defendant does not raise those particular “defenses,” where no right, standing, and/or present interest exists, the claim must be rejected on the court’s own motion (see, in this regard, decision 2008-000523 of the Sala Segunda de la Corte Suprema de Justicia). All of this requires rejecting the expression sine actione agit on the grounds asserted. Nevertheless, as previously indicated, it is appropriate to declare the absence of an interest and right with respect to all the principal claims for declaratory relief (pretensiones principales declarativas) sought by the plaintiff, the absence of a right with respect to the ancillary claims (pretensiones accesorias), and, in part, the absence of a right with respect to those claims that have not been recognized, all on the basis of the preceding recitals (considerandos).
X Nombre53625.- REGARDING COSTS. As to costs (costas), because there is no reason to exempt the losing party, they shall be borne by that party, pursuant to article one hundred ninety-three of the Código Procesal Contencioso Administrativo.
THEREFORE (POR TANTO):
The expression sine actione agit is rejected, and the court, on its own motion, declares the absence of an interest and right with respect to all principal claims for declaratory relief not expressly granted. The complaint is declared partially meritorious, and, pursuant to article one hundred twenty-two of the Código Procesal Contencioso Administrativo, the defendant is granted a period of three months from the date the judgment becomes final to carry out the formal acceptance act (acto de recepción) or, failing that, to initiate proceedings to revoke or annul the Villa Jesús de Atenas project. The court also declares, on its own motion, the absence of a right with respect to the principal claims for damages (pretensiones principales indemnizatorias) insofar as they have not been expressly granted, and the Municipalidad de Atenas is ordered to pay the plaintiff damages corresponding to the suspension of the construction work that it had authorized, which shall be assessed during enforcement of the judgment (ejecución de sentencia).
The absence of a right with respect to the alternative claims (pretensiones subsidiarias) is declared. With respect to the financial award recognized, the right to indexation (indexación) and civil interest (intereses civiles) is recognized from the date on which the enforcement ruling that ultimately determines those amounts becomes final. Costs shall be borne by the defendant Municipalidad.
Ricardo A. Madrigal Jiménez Carlos Espinoza Salas Francisco Muñoz Chacón DISSENTING OPINION OF JUDGE ESPINOZA SALAS I concur with my fellow judges in the decision; nevertheless, I depart from their interpretation regarding the point from which indexation and interest on the amounts awarded in the judgment begin to accrue, which, under the majority’s respected position, is the date on which the judgment specifically determining them becomes final. However, in the undersigned’s view, in the case of value obligations (obligaciones de valor), indexation and interest must accrue from the date on which the judgment awarding them becomes final, without the need to defer that date until a specific amount has been determined, and, in the case of monetary obligations (obligaciones dinerarias), from the time the expenditure was incurred. Thus, in order to establish comprehensive and full compensation (indemnización integral y plena), and to avoid causing harm to the litigant, indexation and interest must be granted from the time the obligation is established, ordered, and recognized.
With respect to indexation, given the nature of this doctrine, which seeks to bring preexisting monetary obligations to present value or to update, as of the time judgment is rendered, value obligations recognized in the judgment, its application, in the case of obligations declared in the abstract, should not be deferred until the enforcement judgment determining their amount becomes final, because the right has already been declared and established. Likewise, if the amount of compensation has already been determined in the judgment, there is even less reason to postpone until later stages, to the detriment of the prevailing party, the court’s obligation to index such items on its own motion. Although section 123 of the Código Procesal Contencioso Administrativo clearly provides that a monetary obligation recognized in a judgment shall be updated from the date it becomes enforceable, section 124, subsections one and two, states with respect to value obligations that, once converted into actual money, the enforcement judge (juez ejecutor) shall update them, but it does not indicate from what date.
Therefore, the logical interpretation, based on the principle of comprehensive and full reparation (principio de reparación integral y plena), is that, because the date of determination during enforcement and subsequent payment is deferred, the adjustment should run from the date on which the obligation was declared in the judgment until actual payment. Therefore, in the case of value obligations whose amount is determined in the judgment awarding them, there is even less reason to defer indexation to later stages. Although the statutory provision establishes that once a value obligation has been converted into a monetary obligation it shall be updated, this is because, logically, the indexation calculation cannot be applied to an unquantified item; however, this does not mean that the adjustment should begin to run only when the enforcement judge determines its amount.

Figura como coadyuvante la Nombre529, cédula de persona jurídica […], representada últimamente por el señor Nombre2882, cédula de identidad numero […], de demás calidades desconocidas. Figura como apoderado especial judicial de la actora el Lic. RESULTANDO:
Redacta el Juez Madrigal Jiménez , con aportes del juez Muñoz en los hechos VI y VII ; y,
CONSIDERANDO:
Sostiene la actora que es propietaria de una finca del partido de Alajuela, con número de Folio Real [...], que dicho inmueble presenta calle colidante y todos los servicios públicos. Motivo por el cual en su giro comercial definió segregar cuarenta y ocho lotes, siendo visados veintiocho de ellos. Que el cumplimiento de los requisitos legales fue constatado por el Ing. Municipal Marcelo López León en oficio MAT-OCV-089-2008 del veinticinco de abril de dos mil ocho. Pese a lo dicho , el siete de octubre de dos mil ocho, la Secretaria del Consejo Municipal de Atenas de Alajuela, dispuso que su representada debía presentar un anteproyecto completo del proyecto para conocimiento del órgano colegiado, lo que fue cumplido el quince de ese mes y año. Después de varias gestiones para conocer la posición del jerarca institucional, le fue comunicada la decisión de solicitarle al Departamento de Ingeniería un análisis completo del proyecto, lo que fue verificado afín a sus intereses.
Ante la ausencia de respuesta a su gestión , el trece de febrero de dos mil nueve, solicitó la aplicación del silencio positivo en cuanto la recepción del proyecto (lo que incluye la aceptación de las obras comunes y la obligación del visado de veinte planos adicionales) , lo que fue dictaminado de manera positiva por la oficina legal el diecisiete de ese mes y dispuesto en esa misma fecha por oficio MAT-WA-14-09 por parte del Señor Nombre20665 Municipal. El veintitrés de febrero de dos mil nueve, presentó solicitud de visado por los veinte planos faltantes y eximiendo al ayuntamiento del suministro de agua, al contar con autorización del Ministerio de Ambiente y Energía para la perforación y extracción de agua, a fin de concluir el proyecto. El dieciséis de marzo de dos mil nueve el Concejo Municipal acordó declarar sin lugar la solicitud de silencio positivo para el proyecto de fraccionamiento, la planta de tratamiento y otras obras de vía pública, de la misma forma no aval ó el oficio de la Alcaldía MAT-WA-14-09 ya señalado.
El veintitrés de marzo de dos mil nueve el ingeniero municipal adjuntó al Consejo la gestión presentada por su representada para la construcción de dos viviendas en igual número de lotes, advirtiendo que se cumplían todos los requisitos legales. El treinta y uno de marzo de ese año interpuso recurso de apelación contra el acuerdo municipal ya señalado, lo que generó otro acuerdo el trece de abril donde acordó admitir el recurso y aclaró que el silencio positivo otorgado por la alcaldía no había sido anulado o revocado, al no haberse seguido los procedimientos legales al efecto, posteriormente el dieciséis de junio se dispuso aclarar que cualquier medida cautelar interpuesta por el órgano colegiado sobre el proyecto quedó sin efecto, por el dictado del silencio positivo dispuesto por la Alcaldía, lo que llevaría aparejado que tanto los visados de fraccionamiento, como los permisos de construcción de dos lotes estarían vigentes.
Pese a esto, el nueve de julio de dos mil diez le fue comunicado una orden de suspensión de las licencias de construcción antes indicadas adoptadas por el Nombre20665 Municipal, motivo por el cual presentó recurso de apelación ante dicho acto, que fuera remitido al Concejo para su conocimiento. El veintitrés de julio de dos mil nueve solicitó al amparo del artículo cuarenta de la Ley de Planificación Urbana , al Nombre20665 respectivo, la recepción del proyecto, lo que fuera recomendado positivamente por el topógrafo municipal. Mientras tanto, el recurso de apelación presentado ante el Concejo municipal fue devuelto con el criterio técnico legal positivo a sus intereses ante e l Nombre20665 para que lo resolviera. Posteriormente, el siete de septiembre de dos mil nueve, el ingeniero municipal emite un informe completo de los permisos otorgados al proyecto, incluyendo los de construcción, al haberse cumplido los requisitos legales.
No es sino hasta el quince de enero de dos mil diez que la Alcaldía procedió a evaluar la suspensión ordenada de manera oficiosa levantando el acto. El diecisiete de junio de dos mil diez, la Sección Tercera del Tribunal Contencioso Administrativo confirmó el acuerdo apelado y dió por agotada la vía administrativa, frente al acto originalmente adoptado por el Concejo Municipal y adverso a la Actora. Sostiene que las conductas omisivas y las actuaciones materiales de la administración cantonal pretenden anular actos declarativos a favor de su representada, siendo que sobre estas fundamenta la responsabilidad reclamada, lo que resulta contrario a la intangibilidad de los actos propios y el principio de confianza legítima. Solicita también la revalidación de todos los actos favorables a sus intereses, en cuando sostiene cumplen con todos los requisitos legales para un fraccionamiento simple que es a su juicio lo realizado.
La representación municipal discrepa de algunos hechos, pero sostiene que el principio precautorio fundamenta sus actos, considerando que no existe responsabilidad alguna que declarar en su contra. Máxime cuando el Concejo Municipal considera que lo existente no es un proyecto de fraccionamiento simple sino una urbanización.
De importancia para el dictado de esta sentencia, se tienen los siguientes hechos de relevancia, advirtiendo que en el caso del expediente administrativo presenta varias numeraciones no coincidentes entre sí, todas con mala visibilidad, de suerte que se ha tomado aquella que presenta en la parte superior derecha de los documentos:
Se tienen como tales, los siguientes:
Las municipalidades son entidades locales que gozan de autonomía relativa en el ejercicio de sus funciones, a partir de una descentralización territorial, según se colige del numeral ciento sesenta y ocho de la Constitución Política. Este nivel de independencia lo otorga el precepto ciento sesenta y nueve de la Carta Magna, en el marco de su competencia territorial, integrada por el espacio físico dispuesto para el cantón al cual representa, en tanto señala que corresponde a cada ayuntamiento la: "administración de los intereses y servicios locales …"; así la carta fundamental le confiere una serie de funciones o atribuciones en favor de esos gobiernos en razón de "lo local", esto es, para administrar los servicios e intereses del ámbito a la que está circunscrita, sea, el cantón. De este modo, es claro que existen intereses cuya salvaguardia corresponde a las Municipalidades y junto a ellos, coexisten otros cuya protección constitucional o legal es atribuida a otros entes públicos, en el entendido que la competencia no es excluyente, máxime cuando existen intereses locales que a la vez son regionales o incluso nacionales, de suerte que los intereses desde el plano local al nacional confluyen, sin perjuicio que en algunos de los casos su afectación se limite al plano más pequeño.
La esfera territorial del municipio constituye una competencia originaria de los ayuntamientos y solo mediante ley de nacionalización puede serles desplazada, siempre que esa manifestación legislativa no suponga un quebranto a la autonomía referida o implique vaciar el contenido constitucional del régimen municipal. Por su parte, el artículo cuatro del Código Municipal, Ley no. 7794 del treinta de abril de mil novecientos noventa y ocho , desarrolla los tipos de autonomía que el legislador ordinario estimó ostentaban estas corporaciones, indicando que poseen la política, administrativa y financiera (ver Sala Constitucional, votos 5204-2004 y 8928-2004). Dentro de este dinamismo de los intereses, se ubica el tema urbanístico, donde el interés en esencia es local, pero con trascendencia más allá de la cantonal, llegando a temas nacionales. Así la Ley de Planificación Urbana, establece una coordinación, donde corresponde a cada Municipalidad el aprobar el respectivo Plan Regulador, con una aprobación a cargo del Instituto Nacional de Vivienda y Urbanismo de cara a la implementación de una política nacional de desarrollo que integre todas las variables técnicas, económicas y sociales que convergen en esta actividad.
Situación inversa es con respecto a la materia ambiental (en la medida que los diferentes ecosistemas y los corredores biológicos corren por todo el territorio) donde su interés es nacional, pero su aplicación en concreta incide de forma directa no en la esfera territorial de cada municipio. La Sala Constitucional en la resolución no. 5445-99 además de desarrollar las bases de la autonomía municipal, fijó la interacción de los intereses y determinó la obligatoria coordinación de lo local, regional y nacional, para satisfacer los diferentes intereses públicos que interactúan. Pese a la autonomía, el principio de legalidad de raigambre constitucional en el canon once, determina que las competencias constitucionales y legales deben ser ejercidas al amparo de las normas jurídicas que las definen, delimitan y precisan su funcionamiento; se trata en efecto de una garantía para el munícipe y sociedad civil en general, de que los actos públicos que emanen de esas entidades locales, son contestes con aquél.
Ello incluye por regla de principio, una aplicación debida de las normas, no solamente en su contenido, sino además en el respeto de su nivel jerárquico, de lo que se infiere que son inviables las aplicaciones de medidas infra legales que sean opuestas o contrarias a la ley. La autonomía municipal, impuesta por la Carta Magna, confiere a las corporaciones locales una competencia especial para la administración de los intereses y servicios de su competencia territorial (artículos 169 y 170), competencia prevalente sobre la de otras instituciones, en el contexto de la localidad. El numeral quince de la Ley de Planificación Urbana, no. 4240 del quince de noviembre de mil novecientos sesenta y ocho confiere a los entes locales la competencia base para regular y vigilar todo lo concerniente a la planificación y desarrollo urbano dentro de los límites de su competencia territorial, lo que no es más que el desarrollo del ya señalado artículo ciento sesenta y nueve de la carta fundamental.
Consecuentemente, cada uno de los entes corporativos territoriales debe disponer lo que proceda para implantar un plan regulador, y los reglamentos de desarrollo urbano conexos, en las áreas donde deba regir, sin perjuicio de extender todos o algunos de sus efectos a otros sectores, en que priven razones calificadas para establecer un determinando régimen contralor. La competencia asignada no se limita a un aspecto de mera planificación, sino que además, incluye las potestades de control del desarrollo urbanístico, lo que supone un grado de vigilancia sustantiva tanto de las obras en ejecución, como de las ya ejecutadas. En concordancia con lo señalado, el artículo primero de la Ley de Construcciones, Decreto Ley no. 833 del cuatro de noviembre de mil novecientos cuarenta y nueve, establece con claridad evidente estas potestades, lo que es retomado por el artículo trece inciso o) del Código Municipal, corresponde al Concejo dictar las normas y medidas atinentes al ordenamiento urbano.
Así la realización de toda obra o edificación requiere de una licencia municipal, a la vez que corresponde al ente local la vigilancia sobre aquellas (mandatos 74 y 87 de ese cuerpo legal). Por ende, resulta evidente el papel prevalente que en estos menesteres ostenta la Municipalidad, siendo que le incumbe disponer las medidas concretas sobre el desarrollo y planeamiento urbano, así como el otorgamiento de las "licencias" de construcción y el control de esas actividades acorde a las normas que regulan ese campo (ver al respecto Sala Constitucional, en votos 2153-93 y 4205-96). Advirtiendo que los alcances y efectos del desarrollo y planificación urbana implica, en la gran mayoría de las ocasiones, la existencia de relaciones de coordinación con el demás aparato público, lo que justifica la intervención del Instituto de Vivienda y Urbanismo, del Instituto Costarricense de Electricidad o del Ministerio de Ambiente, Energía y Telecomunicaciones, siempre en el ámbito de sus competencias.
No se puede olvidar que un proyecto urbanístico convergen diferentes aspectos que trascienden el mero aspecto urbano. En cuestiones de naturaleza urbanística, en particular, la de construcción de urbanizaciones o residenciales, la Ley de Construcciones y la Ley de Planificación Urbana, en sus artículos quince y treinta y dos respectivamente, remiten la concreción de los aspectos que deben ser cubiertos por los urbanizadores, a un reglamento, a saber el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones (3991 del 13 de diciembre de 1982) y en materia constructiva, se encuentra el denominado Reglamento de Construcciones (del 22 de marzo de 1983). De conformidad con lo estatu í do por los cánones quince y setenta y cuatro de la Ley de Construcciones, todo fraccionamiento y urbanización, así como toda obra relacionada con la construcción deberá contar con un acto autorizatorio emitido por la Municipalidad correspondiente.
Los aspectos de seguridad, salubridad y ornato, se encuentran también regulados en el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones, norma que sería aplicable al efecto, en cuanto se trata de un instrumento jurídico de naturaleza preeminentemente técnica, que contiene en aspecto de urbanizaciones, regulaciones variadas en aspectos tales como accesos, vialidad, lotificación, áreas verdes y públicas, drenajes, acueductos, cloacas, infraestructura y acabados, entre otros. Naturalmente, la fiscalización recae en los gobiernos locales, norma que potencia de manera uniforme las competencias municipales. Desde este plano, el papel de los municipios se da en dos instancias, sea, preventiva y fiscalizadora. En el marco preventivo, la "licencia" se otorga si cumple con todas las exigencias y en ese cotejo (cualitativo y cuantitativo) se concreta tal ejercicio. En la fiscalización, verifica que lo que se realiza en la realidad, sea conteste con lo autorizado, y no son más que manifestaciones de un poder público derivado de competencias otorgadas por el orden constitucional y legal en este campo, que justifica el apoderamiento de la Administración.
Igualmente, la fiscalización se presenta en la medida que resulta posible que dentro de un proyecto concreto aún siendo cumplido en los estrictos márgenes de lo aprobado, se presentan afectaciones no consideradas; como podría ser el tema arqueológico, ecológico o ambiental, entre otros; que determinarían la paralización de la obra y el replanteamiento de la misma para ajustarla a la nueva realidad no considerada. Le permiten por tanto el despliegue de una serie de atribuciones inherentes y necesarias para el ejercicio de una sana administración. Estas le facultan incluso suspender una determinada obra cuando no cumpla con las condiciones debidas, o bien, dentro de su arista preventiva y previsora, rechazar el pedimento de edificación cuando no se hayan satisfecho los requerimientos jurídicos y técnicos que las disposiciones aplicables imponen. Se trata de manifestaciones concretas del poder público que permiten la tutela de principios jurídicos, entre otros, el de seguridad , medio ambiente y de salud.
Constituye por ende una labor de inspección sobre los aspectos constructivos de las estructuras que se erijan en el espacio territorial del municipio, a efectos de determinar que cumplan con las exigencias que dispone esa legislación, así como demás regulaciones asociadas a la actividad. Estas facultades y potestades, dentro de su orientación teleológica, se ponen al servicio de los intereses públicos o colectivos, que a fin de cuentas, son el objeto que legitima su incursión en el control y fiscalización de la actividad urbanística. Al ser competencias fijadas por el Ordenamiento (como derivación directa de sus competencias constitucionales que le fueron confiadas) y que se asocian con la tutela de intereses públicos, la acción del ente local debe ponderar no solamente una labor de revisión superficial (formal) de las solicitudes de permiso de construcción, sino, una valoración integral y a fondo del acatamiento de las exigencias jurídicas y técnicas que impone el Ordenamiento.
Contrario de lo que sucede en las concesiones administrativas, en las cuales la Administración transfiere ciertas potestades públicas en un particular, sea persona física o jurídica, en las autorizaciones, la Administración, hace un "levantamiento de barreras" para el ejercicio de un derecho que ya se tiene, pero que aún administrativamente no se declara a favor del solicitante y cumplidor con los requisitos que impone el ordenamiento jurídico como un todo. De allí que, siguiendo a Manrique Jiménez (JUSTICIA CONSTITUCIONAL Y ADMINISTRATIVA, 1º edición, San José, Imprenta y Litografía Mundo Gráfico, 1997), la Administración que autoriza no delega potestades ni constituye derechos, simplemente los declara, pues los derechos ya existen antes de la respectiva declaración, en razón del cumplimiento del ordenamiento jurídico confirmado por quien solicita, en buen derecho, la autorización misma.
Hay entonces, de parte de la Administración autorizante, una declaración de voluntad a favor de aquella persona pública o privada que haya cumplido con todos y cada uno de los requisitos normados, limitándose la Administración a ponderar la legalidad de lo solicitado en el ámbito del interés público que la misma Administración debe tutelar. Se trata en el mejor sentido de la palabra, de un acto constatativo una vez verificados una serie de requerimientos legales. Se sostiene, en principio, que frente al ejercicio de un derecho subjetivo, urgido para su realización de un acto de habilitación de la Administración, no cabe la discrecionalidad administrativa, toda vez que la Administración autorizante está jurídicamente obligada a dictarla, cuando el solicitante haya previamente cumplido con los requisitos normativos, por lo que, encontramos en la autorización, dos dimensiones de actos reglados: los relacionados con el contenido de la autorización y el acto de su declaración que debe ser congruente con los motivos y fines que la justifiquen.
Sin embargo, la Administración no pierde por ello, una vez dictado el acto autorizante, las potestades de tutela y control en el uso y disfrute del permiso, de la licencia o autorización. Su prerrogativa originaria como Administración que debe satisfacer y velar por los intereses públicos no desaparece con la simple declaratoria, expresa o implícita de la autorización. En esencia, entonces, no desaparece de la Administración su potestad de revocar o anular licencias o aprobaciones, ante licencias sujetas a condición o licencias ilegalmente otorgadas; claro está, siempre que con ello se haya cumplido el procedimiento legal, que garantice la plena participación del interesado y en especial el derecho de defensa y el debido proceso en general. En efecto, el derecho subjetivo del solicitante de la autorización nace con el cumplimiento cabal del ordenamiento jurídico, sin que la Administración pueda rebatir o desconocer su declaratoria; pero tampoco es válido del solicitante pretender la aplicación individual de una declaratoria de su derecho cuando no haya cumplido con los requisitos normados para la generalidad.
De las diversas manifestaciones de autorizaciones administrativas, encontramos en las licencias, una de sus ejemplos clásicos, y dentro de ellas, los mal denominados "permisos de construcción", que debe extender las municipalidades dentro de su territorio, de acuerdo con la Ley de Construcciones. Dispone el artículo 1º de dicho cuerpo normativo: "Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad, y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de las mismas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos." Añade el artículo 2º: "Alcance de esta Ley. Esta ley rige en toda la República. Ningún edificio, estructura o elemento de los mismos será construido, adaptado o reparado, en lo futuro si no es con las condiciones que los Reglamentos respectivos señalen.
Tampoco deberán hacerse demoliciones o excavaciones en propiedad particular, ni ocupar la vía pública, ni hacer obras en ellas, sin sujetarse a las prevenciones de dichos Reglamentos." A su vez, dispone el artículo 74 de la Ley de Construcciones: "Licencias. Toda obra relacionada con la construcción, que se ejecute en las poblaciones de la República, sea de carácter permanente o provisional, deberá ejecutarse con licencia de la Municipalidad correspondiente." El artículo 78 establece el impuesto sobre las construcciones al disponer que: "Derechos de Licencia. Todas las licencias causarán derechos, que serán fijados de acuerdo con las tarifas en vigor, las que tomarán en cuenta la cantidad de obras por ejecutar o de ocupación de vía pública, así como su duración." De fundamental importancia para el asunto que nos ocupa, establece el artículo 79, siempre de la Ley de Construcciones: "Pago.
Para que una licencia surta sus efectos, es indispensable que haya sido pagado el importe de los derechos correspondientes." En materia de sanciones, la Ley de comentario dispone: "Facultades. La Municipalidad puede imponer sanciones por las infracciones a las reglas de este Ordenamiento. Las sanciones serán las que se han especificado en el cuerpo de esta Ley y su Reglamento (multas, clausuras, desocupación, destrucción de la obra, etc.) y los que señala este Capítulo." Finalmente conviene reproducir lo establecido en el artículo 90 de la Ley de Construcciones: "Multas. El importe de la multa en ningún caso será superior a la lesión económica que implique para la Municipalidad la falta de percepción del derecho de la licencia correspondiente al concepto violado." Si conviene reiterar que el otorgamiento de cualquier permiso de construcción está condicionado a que el proyecto en cuestión resulte conforme con la ordenación urbanística aplicable; lo cual supone un control previo de habilitación o "permiso" , acompañado de la actividad de fiscalización en la ejecución de la actividad autorizada, a fin de que se realice conforme a la licencia o permiso concedido y a las regulaciones que rigen la actividad.
Si bien hasta aquí hemos utilizado los conceptos a manera de símiles, conviene realizar algunas distinciones. Por autorización se tiene como un acto de "habilitación o permisión", entendiéndose como el "acto administrativo por el cual la administración pública le concede al administrado la potestad de ejercer derechos preexistentes después, de una apreciación discrecional de su oportunidad y utilidad respecto del interés general, La autorización, en tal supuesto, obedece a una petición expresa del administrado pero que, generalmente, es discrecional en cuanto a motivo y contenido. La diferencia entre este tipo de autorización y licencia, en sentido estricto, radica en que la última tiene un efecto similar a la autorización pero normado, esto es, su contenido es reglado." (JINESTA LOBO, Ernesto. Tratado de Derecho Administrativo, Tomo I. Biblioteca Jurídica Diké. pág. 449) Por su parte, el permiso se entiende con aquel "acto que autoriza a una persona -administrado- para el ejercicio de un derecho, en principio, prohibido por el propio ordenamiento jurídico.
Es una exención especial respecto de una prohibición general en beneficio de quien lo solicita. Con el permiso se tolera o permite realizar algo muy específico y determinado. Su naturaleza consiste en remover un obstáculo legal para el ejercicio de un poder preexistente, se dice que es una concesión de alcance restringido, puesto que, otorga derechos de menor intensidad y de mayor precariedad" y que además "siempre se otorga un derecho debilitado nuevo que supone una excepción a una prohibición de orden público" (JINESTA LOBO, Op Cit, págs. 456 y 457). En términos generales ambos vocablos suelen confundirse, mas lo s dos coinciden en que debe mediar un derecho preexistente. Ahora bien, la Ley de Planificación Urbana (Ley 4240) en su artículo primero define el Fraccionamiento como:
"Fraccionamiento, es la división de cualquier predio con el fin de vender, traspasar, negociar, repartir, explotar o utilizar en forma separada, las parcelas resultantes; incluye tanto particiones de adjudicación judicial o extrajudicial, localizaciones de derechos indivisos y meras segregaciones en cabeza del mismo dueño, como las situadas en urbanizaciones o construcciones nuevas que interesen al control de la formación y uso urbano de los bienes inmuebles." El fraccionamiento, es la división de un predio con la finalidad de introducirlo al comercio de los hombres, lo que supone, tal y como lo debe constatar cada gobierno local al otorgar el visado correspondiente, que el mismo se ajuste, en cuanto a tamaño y características, a las disposiciones urbanísticas vigentes, en especial, al Plan Regulador del suelo local –si lo hubiere- así como a la normativa de desarrollo y demás leyes especiales de orden público. A partir de dicho concepto, reiterado en diversas normas, es posible ubicar dos conceptos que si bien se interactúan entre sí, no son idénticos, a saber el fraccionamiento simple y por otro lado, el proyecto complejo o la urbanización. La misma norma definir Urbanizar de la siguiente forma:
"Urbanización, es el fraccionamiento y habilitación de un terreno para fines urbanos, mediante apertura de calles y provisión de servicios." Lo que lleva aparejado que el fraccionamiento simple, corresponde a la división de un terreno, al margen de las motivaciones o intereses que se persigan, cuando linda frente a calle pública y está provisto de la totalidad de los servicios públicos propios del área urbana. Cabe reiterar que la integralidad de los servicios públicos básicos (agua, luz, recolección de basura y electricidad cuando menos) es vital en este caso; de suerte que estos tienen que suficientes para suplir la necesidad de la nueva construcción. El fraccionamiento que la ley denomina como “simple”, no incluye un proceso de habilitación urbana para el uso y disfrute de las parcelas resultantes de ese fraccionamiento y ello es así porque el legislador parte de que en estos, los fundos cuentan con accesos y áreas verdes producto de un desarrollo urbanístico anterior.
La lógica es sencilla, el fraccionamiento no representa por sí mayores esfuerzos para la corporación pública o demás dependencias gubernamentales, la red de servicios existe de pre Nombre53625 io y la única actividad que debe desarrollarse es la conexión a la misma. Se trata de un mero permiso en los términos más propios del concepto lo referente al visado, pues es una simple constatación de requisitos formales y técnicos; posteriormente el permiso de construcción es una consecuencia lógica y necesaria, en tanto lo generado no constituya a una urbanización . En el caso de la urbanización se trata de un proyecto más complejo, donde si bien el desarrollador tiene el legitimo interés del ejercicio de esa actividad económica, la dotación o extensión de los servicios públicos, determina una serie de previsiones que deben considerarse, así como la revisión de requisitos se torna más minuciosa, sin perjuicio de corresponder a un acto complejo donde ordinariamente interactúan varias dependencias públicas extrañas a la corporación pública; lo que lleva a la necesaria conclusión que estamos en presencia de una autorización de todo el proyecto, siendo que una vez otorgada esta los actos de ejecución de la misma son meros permisos.
Se trata de una habilitación urbana, es por este motivo que el artículo cuarenta de la Ley de Planificación Urbana dispone la obligación de ceder terreno para parques, y facilidades urbanas. Cuando una determinada área se encuentra previamente urbanizada, los adquirentes de las parcelas fraccionadas cuentan con acceso a los fundos, parques y facilidades comunales y es que no debe perderse de vista que ello hace parte de su derecho a disfrutar de un ambiente sano y ecológicamente equilibrado (artículo 50 constitucional). Por este motivo –se reitera- el legislador no ha estimado necesario exigir en el caso del fraccionamiento “simple” con desarrollo urbanístico, mayores dotaciones de tierra por motivos de interés social. El visado para fraccionamientos simples, por su poca trascendencia, suele otorgarse a un funcionario (v.gr. Ingeniero Municipal) diverso de aquél al que se encomiendan los visados “complejos” (v. gr.
Concejo Municipal, comisiones de urbanismo, etc.), careciendo el primero de competencia para autorizar un visado diverso; ello en el caso de que las normas urbanísticas hagan tal distinción; lo anterior tiene sentido en el entendido que en el primero de los casos los requisitos se encuentran en su gran mayoría reglados y el margen de discrecionalidad es mínimo. Ahora bien, al fraccionamiento que hace parte del proceso urbanizador y que implica una habilitación de los fundos, por vez primera, para fines urbanos, debe proveérsele de calles, áreas verdes y parques, así como de los servicios necesarios para su uso y disfrute; el fraccionamiento complejo o urbanístico, engloba un acto propio del jerarca institucional, salvo los casos donde exista alguna delegación. En este segundo supuesto, estamos ante un proceso complejo de fraccionamiento y urbanización que introduce limitaciones a la propiedad privada por razón de urbanismo (artículo 22 de la Ley de Planificación Urbana), las que el Tribunal Constitucional ha señalado son totalmente conformes con el Derecho de la Constitución (voto N° 5097-93 de las 10:24 hrs del 15 de octubre de 1993 ).
Así las cosas, en los casos de aprobación de permisos de construcción de urbanizaciones, el Gobierno Local debe corroborar que cumple a cabalidad con la respectiva dotación de vías públicas, áreas verdes y comunales, y en especial -de relevancia para resolución de este asunto- de la habilitación e implementación, a cargo del urbanizador, de los servicios públicos, tales como el de la luz, telefonía, agua potable y acueductos y alcantarillados, éste último, en caso de que exista la infraestructura para ello. Con lo cual, la no adecuación de los proyectos urbanísticos a los requerimientos establecidos en el ordenamiento urbano, obligan -per se-, al rechazo de las gestiones incoadas, en aplicación del principio de legalidad. Así como l a misma definición lo señala, en la urbanización, siempre subyace algún margen de discrecionalidad, máxime que aún cuando el desarrollado Nombre41092 habilite los servicios y las calles correspondientes, sin perjuicio de otras obligaciones (como la del artículo 40 de la ley en estudio), el ente público territorial se encuentra llamado a medir sus capacidades para las nuevas exigencias; sin perjuicio que la lista de requerimientos regulada parcialmente en diferentes normas, debe ser ajustada a cada caso en concreto, estudio por demás complejo.
Es por esto que reiteramos que el acto habilitante se a l e j a de la figura del permiso para constituirse en una autorización, en los términos dichos. Por tener estrecha relación con el tema que nos ocupa, conviene que precisemos algunas notas relacionadas con el silencio positivo.
E s claro que toda administración se encuentra llamada a contestar las diferentes gestiones que se le presenten con la mayor celeridad posible, no solo por imperativo constitucional (artículos 20, 30 y 41 constitucional), sino como manifestación del carácter democrático del Estado y para evitar generar inseguridad en los usuarios. Por su parte, e l artículo ciento treinta y nueve de la Ley General de la Administración Pública (en adelante LGAP), establece un principio del derecho administrativo, según el cual: "El silencio de la Administración no podrá expresar su voluntad salvo ley que disponga lo contrario." Significa ello, que la inactividad administrativa, no expresa la voluntad de la Administración, lo que equivale a decir, que el silencio de la Administración no produce efecto jurídico alguno, salvo ley que otorgue un sentido diverso a dicho silencio. La excepción a tal principio es, en consecuencia, otorgar un efecto jurídico ante la inactividad de la Administración Pública, cuando se cumplan determinados supuestos, tales excepciones son los denominados; silencio positivo y el silencio negativo.
Esta posibilidad es ante todo una ficción jurídica, pues no se trata de un acto presunto, sino un remedio procedimental ante la inercia de la administración; siendo que la regla en la materia es el carácter negativo, permitiendo al afectado proseguir con el trámite en la instancia ulterior o si es su interés concurrir a la vía jurisdiccional. Resultaría contrario a todo derecho, el dejar de manera indefinida atado al interesado a un a respuesta que no llega, pese a que el ordenamiento estatuye la obligación de responder a la gestión del interesado. En lo que nos incumbe, el silencio positivo, constituye una técnica procedimental por la cual se tiene por otorgado, por parte del ordenamiento jurídico ante el silencio de la Administración, las autorizaciones, licencias o permisos, una vez vencido el plazo para que aquella se pronuncie, previa solicitud del interesado, habiendo cumplido plenariamente los requisitos exigidos para su otorgamiento.
Las autorizaciones, o aprobaciones que deban acordarse en el ejercicio de funciones de fiscalización y tutela refieren a relaciones inter-administrativas -en donde no hay participación de los administrados-, mientras que los permisos, licencias y autorizaciones se refieren a relaciones con los administrados. Es de advertir que, el silencio positivo no constituye un verdadero acto administrativo, sino un efecto ante la ausencia de respuesta, que el ordenamiento otorga frente a la inactividad administrativa. Véase que lo limitado de los supuestos y lo taxativo no es por si arbitrario, pues como se viene razonando se trata de s ituaciones donde existe una barrera administrativa ante un derecho preexistente y cuya ejecución se encuentra supeditada a la verificación legal del total de los requisitos establecidos al efecto, de suerte que si dentro del tiempo otorgado no es posible ubicar un motivo de rechazo de la solicitud la lógica obliga a admitirla y permitir el ejercicio.
Recuérdese que estamos en presencia de actos con margen de discrecionalidad muy limitados, con buena cantidad de aspectos reglados y la discrecionalidad bajo espacios muy reducidos. En nuestro derecho positivo, es precisamente el canon trescientos treinta de la Ley General de la Administración Pública, donde regula en forma genérica la institución del silencio positivo. Como se ha venido indicando estos permisos, autorizaciones o licencias, se constituyen en obstáculos o barreras que el particular debe eliminar o levantar para ejercer una actividad determinada o realizar una obra concreta. Hay de por medio, el ejercicio de una libertad pública, pero que requiere de un acto habilitante de la Administración Pública para ejercitarla como se ha indicado consistentemente. Se produce el silencio positivo cuando ha transcurrido el plazo en que debe pronunciarse la Administración y est a no lo hace, además para que se tenga por otorgado el acto en virtud de silencio positivo, el particular debe de haber cumplido plenamente con la presentación en regla de todos los requisitos que se exigen para el otorgamiento de la autorización, licencia o permiso.
El artículo trescientos treinta y uno de la Ley de referencia, establece que el plazo para que surja el silencio positivo es de un mes a partir de la solicitud del permiso, autorización o licencia acompañados de la presentación de los requisitos legales. Sin embargo, leyes especiales pueden establecer plazos distintos. Continúa manifestando el artículo último citado, que una vez acaecido el silencio positivo, no podrá la Administración dictar un acto denegatorio de la instancia, ni extinguir el acto, sino en aquellos casos y en la forma prevista por la propia ley. Lo que significa, que ante la autorización, la licencia o el permiso otorgado en virtud de silencio positivo, no podría la Administración posteriormente dictar un acto contrario, denegando en forma expresa la solicitud, ante la aplicación del principio de intangibilidad de los actos propios, debiendo concurrir a los procedimientos y mecanismos que el mismo ordenamiento otorga. Nuestra jurisprudencia ha manifestado respecto a esta figura:
"V.- Por constituir el silencio positivo un acto administrativo equivalente a la autorización, licencia o permiso solicitado, dispone el artículo 331, inciso 1, citado, que la solicitud que se presente debe contener los requisitos de ley. Es decir, para que opere el silencio positivo, debe el particular haber cumplido en su gestión con todos y cada uno de los requisitos exigidos por la norma, pues lo contrario implicaría la ausencia de presupuestos esenciales para la existencia del acto, no pudiendo operar el silencio cuando se omita alguno de ellos, aunque el órgano o funcionario encargado no realice la respectiva prevención. Lo contrario implicaría aceptar la existencia de un acto administrativo que no reúne los presupuestos esenciales para su validez, no pudiendo en el caso concreto subsanarse el vicio. Sobre este tópico, y en un caso similar, la Corte Interina, en sesión extraordinaria de las 10,00 horas del 7 de febrero de 1985, conociendo del recurso de amparo interpuesto por Nombre36751. contra el Gobernador de San José, consideró que "el problema realmente decisivo es el de precisar el contenido concreto de la aprobación o autorización obtenida por silencio positivo en aquellos supuestos en que la pretensión ejercitada por el particular o ente público que promueve el procedimiento no es conforme a Derecho.
Tres son las soluciones posibles en principio: la primera y más radical consiste en considerar autorizado o aprobado en sus propios términos el proyecto presentado; la segunda solución, postula en favor de limitar los efectos autorizatorios o aprobatorios del silencio positivo a lo que, según la Ley, es posible autorizar a aprobar; la tercera remite a una modulación de los efectos del silencio positivo en función de la clase de defectos del proyecto base. Pero la verdad es que después de analizar en doctrina esas tres posibles soluciones, cabe considerar que en todas y cada una de ellas no es posible entender adquiridas por silencio positivo facultades en contra de las prescripciones de la ley, porque no puede admitirse que el silencio positivo prospere cuando lo que resulta concedido no puede autorizarse con arreglo a la ley. En resumen, el silencio positivo suple al acto expreso, pero sólo dentro de los límites autorizados por la ley".
La falta de requisitos formales o de fondo en la solicitud presentada por el administrado, aún y cuando los mismos no hayan sido advertidos oportunamente por la Administración, impide que opere el silencio positivo. Cabe señalar, a mayor abundamiento, que lo contrario podría llevar a permitir una colusión entre el administrado y la Administración, autorizando vía silencio la emisión de actos contrarios a la legislación o incluso a la moral." (Sala Primera de la Corte Suprema de Justicia, sentencia 88-94 de las quince horas cinco minutos del diecinueve de octubre de mil novecientos noventa y cuatro) Hasta este momento hemos considerado el total de la actividad constructiva como una unidad conceptual dentro de la figura de los permisos, en tanto el propietario de un bien inmueble por sí y en ejercicio de su derecho de propiedad presenta l a facultad de utilizarlo de la mejor manera que tenga a bien, lo que determina que la licencia constructiva no es más que eso, un levantamiento de una barrera administrativa para permitir el ejercicio concreto que se presenta frente al caso, pero y frente a la sub júdice se hace imperativo realizar una diferencia importante, con respecto al fraccionamiento simple y e l permiso urbanístico y analizarlo frente a la figura del silencio positivo.
Un primer aspecto a señalar es que al amparo del artículo cincuenta constitucional no resulta posible la aplicación de un silencio positivo cuando se está en presencia de una afectación al medio ambiente (Sala Constitucional votos 2001-05737 y 2003-03656, Sala Primera de la Corte Suprema de Justicia voto 000507-F-04 y el Decreto Ejecutivo N. 32565-MEIC), lo que llevaría aparejado de manera implícita que el total de los requisitos presentados no se encontraban presentes desde el inicio o que la información ha sido falsedad, por el interesado para aparentar lo contrario. Esa aseveración lleva como consecuencia que en ningún proyecto de urbanización sea posible aplicar el silencio positivo; pues por la magnitud de la actividad siempre tendrá alguna afectacción en esta materia; pero tampoco quiere decir que algunos proyectos de fraccionamiento y de construcción no se encuentren afectos a esa máxima (considérese a manera de ejemplo un centro comercial, un taller industrial, entre otros), pero al menos sería la excepción y no la regla.
Frente a la actividad de fraccionamiento, y en concreto en lo que al tema que nos ocupa corresponde, es posible sostener que en lo tocante al fraccionamiento simple resulta de aplicación el silencio positivo, con la salvedad de los temas ambientales ya indicados, pero en lo correspondiente al fraccionamiento complejo o urbanístico, por sus afectaciones no puede considerarse como una mera autorización y afecta al silencio positivo, debiendo entenderse que no se encuentra cubierta por ese instituto sino por el contrario. Máxime cuando como se ha señalado, en el caso de la urbanización subsiste siempre algún elemento discrecional en el acto, que impediría aplicar sin mayores consideraciones la figura del silencio positivo. Comprende este Tribunal que la figura del silencio en su modalidad positiva presenta su origen en las autorizaciones y permisos municipales y que dentro del régimen se utiliza la figura de manera indiscriminada; pero la transversalidad de ciertos temas de interés nacional determinan que hoy no sea posible mantener esa posición; por lo que en buena lógica es una mala aplicación del derecho pretender un efecto positivo cuando debería ser negativo.
VII I .- SOBRE LA INTANGIBILIDAD DE LOS ACTOS PROPIOS: El principio de intangibilidad de los actos propios, al que esta Sala Constitucional le ha conferido rango constitucional por derivar del ordinal treinta y cuatro constitucional (Ver votos 2753-93, 4596-93, 585-94, 2186-94, 2187-94 y 899-95), parte de la regla que la A dministración P ública respectiva no puede anular un acto que de alguna forma resulte favorable para el administrado, siendo las excepciones la anulación o revisión de oficio y la revocación. Para ese efecto, la administración pública, como principio general, debe acudir, en el primer caso (así como en los supuestos de nulidad evidente y manifiesta en los términos del artículo ciento setenta y tres de la Ley General de la Administración Pública) al procedimiento administrativo establecido al efecto, reguladas en los artículos ciento cincuenta y cuatro, ciento cincuenta y cinco y ciento setenta y tres de la Ley General de la Administración Pública; y en el segundo supuesto en calidad de parte actora y previa declaratoria de lesividad del acto a los intereses públicos, económicos o de otra índole, al proceso de lesividad, el cual se ha entendido, tradicionalmente, como una garantía para los administrados.
Se trata de una aplicación del principio constitucional de irretroactividad de la ley y con mayor razón de los actos (en especial los declarativos de derechos) en inmodificable para la Administración, salvo que utilice las vías previstas por el ordenamiento jurídico le establece. Sobre este particular, este Tribunal Constitucional en el Voto No. 897-98 del 11 de febrero de 1998 señaló lo siguiente:
“... a la Administración le está vedado suprimir por su propia acción aquellos actos que haya emitido ..... Así, los derechos ... constituyen un límite respecto de las potestades de revocación (o modificación) de los actos administrativos, con el fin de poder exigir mayores garantías procedimentales. La Administración, al emitir un acto y con posterioridad al emanar otro contrario al primero, en menoscabo de derechos subjetivos, está desconociendo estos derechos, que a través del primer acto había concedido, sea por error o por cualquier otro motivo. Ello implica que la única vía que el Estado tiene para eliminar un acto suyo del ordenamiento es el proceso de jurisdiccional de lesividad, pues este proceso está concebido como una garantía procesal a favor del administrado, o bien, en nuestro ordenamiento existe la posibilidad de ir contra los actos propios en la vía administrativa, en la hipótesis de nulidades absolutas, evidentes y manifiestas, previo dictamen de la Contraloría General de la República y de la Procuraduría General de la República (como una garantía más a favor del administrado) y de conformidad con el artículo 173 de la Ley General de la Administración Pública.
En consecuencia, si la Administración ha inobservado las reglas de estos procedimientos, o bien, las ha omitido del todo o en parte... el principio de los actos propios determina como efecto de dicha irregularidad la invalidez del acto.” La doctrina normalmente, analiza el instituto a partir de los actos declarativos de derechos, pero existen otros actos, también favorables para el administrado que la constituyen , situaciones jurídicas sobre los cuales debe guardarse el correspondiente respeto, los que a criterio de esta Cámara presentan igual respaldo en el principio que nos ocupa. No puede dejar de señalarse que si bien los permisos y autorizaciones en términos técnicos no son actos declarativos de derechos, en cuanto no declaran derecho alguno pues como se indicó el derecho es preexistente (a construir y aprovechar un bien inmueble según los intereses del actor), por lo que el acto administrativo se limita a levantar barreras administrativas, si a criterio de la Cámara generan un beneficio para el interesado, que le permite proseguir con su interés.
De manera que el retrotraer el efecto de forma intempestiva e injustificada genera una lesión antijurídica contrario al ordenamiento; es claro que el procedimiento administrativo no es un fin en si mismo sino el medio mediante el cual la voluntad administrativa se conforma en sus diferentes elementos, lo que lleva aparejado que solo los vicios sustanciales (aquellos que generan indefensión o cambien el contenido del acto) procuden como regla de principio la nulidad del acto administrativo (bajo el aforismo de la inexistencia de la nulidad por la nulidad misma), más la ausencia de procedimiento es por sí una manifestación de un acto arbitrario que produce irremediablemente la nulidad de la actuación en concreto, en la medida que los elementos del acto se generaron por medio ilícito. Retomando las vías para la revocatoria o la nulidad, e n cuanto al primer supuesto, resulta de manifiesto a partir del artículo ciento cincuenta y seis, que lo faculta adoptado por el jerarca, previo procedimiento administrativo levantado y con dictamen de la Contraloría General de la República.
Agrega la norma la necesaria obligación de indemnizar los daños y perjuicios causados. Como es conocido la figura de la revocación presupone un cambio en las condiciones fácticas o jurídicas, que determinan la improcedencia del acto originalmente dictado; sin cuestionarse los motivos y condiciones de este , que se presumen dictadas conforme a derecho . Es decir la actuación de la administración se dictó conforme a derecho originalmente y se revoca por variación de la situación actual, por vicios en la determinación administrativa. En lo que refiere a la nulidad, el numeral ciento setenta y tres de la Ley General de la Administración Pública, prevé que un ente u órgano público bien puede anular en vía administrativa un acto declaratorio de derechos para el administrado pero lesivo para los intereses públicos o patrimoniales de la primera, sin necesidad de recurrir al proceso contencioso administrativo de lesividad cuando el mismo est é viciado de una nulidad absoluta evidente y manifiesta.
La nulidad absoluta evidente y manifiesta debe ser dictaminada, previa y favorablemente, por la Procuraduría o la Contraloría Generales de la República —acto preparatorio del acto anulatorio final—. Le corresponderá a la Contraloría cuando la nulidad verse sobre actos administrativos relacionados directamente con el proceso presupuestario o la contratación administrativa (Hacienda Pública). Se trata de un dictamen de carácter vinculante —del que no puede apartarse el órgano o ente consultante—, puesto que, el ordinal 2° de la Ley Orgánica de la Procuraduría General de la República establece que es de acatamiento obligatorio, a través del cual se ejerce una suerte de control previo o preventivo de legalidad, en cuanto debe anteceder el acto final del procedimiento ordinario incoado para decretar la anulación oficiosa, ante la gravedad de los hechos en consideración y el carácter técnico jurídico del mismo.
En los supuestos en que el dictamen debe ser vertido por la Contraloría General de la República, también, tiene naturaleza vinculante en virtud de lo dispuesto en la ley de la materia. No cualquier grado de invalidez o nulidad autoriza a un ente u órgano público para decretar la anulación oficiosa de un acto administrativo declaratorio de derechos para un administrado, dado que, el ordenamiento jurídico administrativo exige que concurran ciertas características o connotaciones específicas y agravadas que la califiquen, a saber “evidente y manifiesta”. Lo evidente y manifiesto es lo que resulta patente, notorio, ostensible, palpable, claro, cierto y que no ofrece ningún margen de duda o que no requiere de un proceso o esfuerzo dialéctico o lógico de verificación para descubrirlo, precisamente, por su índole grosera y grave. En tal sentido, basta confrontar el acto administrativo con la norma legal o reglamentaria que le dan cobertura para arribar a tal conclusión, sin necesidad de hermenéutica o exégesis ninguna.
La administración pública respectiva —autora del acto que se pretende anular o revisar—, de previo a la declaratoria de nulidad, debe abrir un procedimiento administrativo ordinario en el que se deben observar los principios y las garantías del debido proceso y de la defensa (artículo 173, párrafo 3°, de la Ley General de la Administración Pública), la justificación de observar ese procedimiento está en que el acto final puede suprimir un derecho subjetivo del administrado (artículo 308 ibídem). A final del procedimiento ordinario, resulta indispensable recabar el dictamen de la Procuraduría o de la Contraloría siendo un acto de trámite del mismo. Cuando el dictamen de la Procuraduría o de la Contraloría Generales de la República es desfavorable, la respectiva administración pública se verá impedida, legalmente, para anular el acto en vía administrativa y tendrá que acudir, irremisiblemente, al proceso ordinario contencioso administrativo de lesividad.
I X .- SOBRE EL PROYECTO DE VILLAS DE JESÚS DE ATENAS : Previo a considerar las pretensiones deducidas, se hace imperativo entrar a analizar cual es la naturaleza jurídica del proyecto Villas de Jesús desarrollado por la actora, a saber si corresponde a un "fraccionamiento simple" o si por el contrario estamos en presencia de una "urbanización". De la prueba recibida, específicamente el ingeniero municipal y el topógrafo, lo que es ratificado por el Instituto de Vivienda y Urbanismo en alguna de la prueba documental, es claro que para ellos se trata del primero de los supuestos, en el entendido que el proyecto se desarrolla frente a calle pública y una zona donde existen los servicios públicos correspondientes, criterio que en principio podría compartir la Cámara si se tratara de algunos pocos visados (e incluso permisos de construcción) en cabeza propia; pero esa no es la situación. Por el contrario es posible constatar como los servicios existentes eran insuficientes para el proyecto desarrollado, lo que motivó que la interesada fuera de manera consistente dotando de estos, no de manera conjunta sino disgregada (uno por uno).
El mejor ejemplo es la planta de tratamiento, donde no consta dentro del elenco de hechos probados que fuera prevenida por la corporación de derecho público sino que la interesada quien conocedora de la limitación al respecto la promueve por su propia iniciativa, situación semejante ocurre con el suministro de agua, en donde es posible ver como lo presentado es para uso doméstico, lo que resultaría insuficiente para cubrir las necesidades reales de la actividad económica como un todo; muestra clara de ello es posible constatar como para requerir los visados de los planos faltantes la misma actora reconoce haber eximido al ayuntamiento del suministro de agua a partir de una autorización para construir un nuevo pozo que supuestamente vendría a cubrir las necesidades del proyecto, sobre este último pozo no existe prueba de haberse realizado a la fecha, lo que evidencia la ausencia de seguridad en cuanto a la solución del problema de agua en el proyecto.
Por el mismo sentido es posible ubicar lo referente a las mejoras en la vía pública, el cordón, el caño y la evacuación de aguas pluviales. No es que no existan los servicio públicos en su literalidad, sino que lo preexistente es insuficiente para la realidad en concreto que se presenta; y eran requisitos para poder llevar el proyecto a feliz término. Por si esas situciones no fueran suficientes, no puede olvidarse que cuarenta y ocho nuevas familias en una zona urbana no solo demandan muchos servicios, sino también presentan afectacciones de orden ambiental que deben valorarse, considerarse y minimizarse. En esas condiciones nos resulta incuestionable que se trata de una urbanización. Suma a lo antes dicho que se hizo ver en su oportunidad un problema de competencia para aceptar las obras, lo cierto es que no se demostró que existiera un órgano diferente del Concejo Municipal para conocer del tema, lo que haría pensar que cualquier acto adoptado por el Nombre20665 o alguno de sus subordinados en la materia presentarían un vicio en dicho elemento formal (competencia), si antes el proyecto no ha sido aceptado por el órgano jerárquico de grado superior (el Concejo Municipal).
Si debemos reiterar de manera enfática que no basta la existencia de calle pública para considerar la existencia de un mero fraccionamiento, al deberse ver el tema como una integridad, así la existencia de la vía pública hace presumir la presencia de los servicios públicos básicos, pero no necesariamente existe una relación de causa efecto. Este caso es un claro ejemplo de esta situación, donde es indudable la existencia de los servicios básicos, pero por el volumen de lotes que componen el proyecto los mismos se tornan insuficientes, resultando imperativo dotar y mejorar estos. Incluso, frente a los usuarios finales, el desarrollador es conciente de las limitaciones, pues de manera consistente ha procurado dotar de los servicios faltantes, pero posiblemente en virtud de que el ente público lo calificó en algún momento como mero fraccionamiento se ha acogido a dicho procedimiento por resultarle menor engorroso.
Como ya se indicó la idea del fraccionamiento simple es que el interesado solo tiene que conectar su necesidad a una red preexistente que tiene capacidad para incluirlo, lo que en este caso no se da, reiteramos por la cantidad de lotes suministrados. Este aspecto básico y medular genera pleno nivel de convicción en este órgano colegiado sobre la naturaleza del proyecto en concreto. Ahora bien, consideramos que existen una serie de afectaciones específicas que repercuten en el conflicto que se analiza. Conforme con el hecho probado catorce el ayuntamiento visó veintiocho planos para segregar lotes a partir de la finca que nos ocupa, así mismo autorizó dos permisos de construcción (hecho probado número 41) y en aplicación de un silencio positivo declaró la aceptación del proyecto y de la planta de tratamiento de aguas residuales. Como se ha venido señalando si bien no es posible considerar cada uno de estos actos como declarativo de derechos en el sentido técnico del término (por tratarse de autorizaciones y permisos), si generan una situación favorable a la actora, que como tal no podría destruirse o desconocerse sin cumplir para tal efecto los procedimientos legales y constitucionales al efecto.
Aceptar lo contrario sería generar un estado de inseguridad jurídica que no resulta propia en un Estado democrático, liberal y de derecho que se profesa. Tampoco es posible tenerlos como inexistentes por presentar algún posible vicio, pues nuevamente estaríamos ante una inseguridad jurídica insostenible en el Estado costarricense. No se trata de una especie de convalidación de un acto que presenta serias deficiencias de lo que se conoció en el juicio oral y público y de la prueba vertida, sino de la imposibilidad de desconocer un acto emanado por una dependencia pública y sobre el cual no se han emitido actuación en contrario; en pocas palabras no existe procedimiento administrativo para negarle los efectos jurídicos que presenta a la fecha. Es discutible si desde el plano material algunos requisitos legales que en su momento no se presentaban al día de hoy no esten satisfechos, pues es posible constatar como actualmente se cuenta con el estudio de impacto ambiental y como se han realizado obras para suplir los servicios faltantes, pero faltan elementos de convicción para saber si la totalidad de las necesidades están satisfechas al momento, el ejemplo más notorio es lo referente al tema del agua, donde la prueba es inexistente; todo sin perjuicio del tema de la competencia sobre el órgano facultado para recibir el proyecto, en los términos ya apuntados.
En dicho marco, toda actuación material o formal adoptada en contra del ordenamiento jurídico se torna ilegal o anormal según corresponda y es generadora de responsabilidad, lo que lleva aparejado la imposibilidad de no reconocer los actos favorables a la interesada. Si bien es cierto, comprende la Cámara que en un visado de un plano sus efectos se materializan en el mismo documento, y consecuentemente, los actos que se puedan haber dictado o las actuaciones adoptadas a nivel interno del régimen municipal, no afectan el permiso en la medida que su utilidad es poderlo presentar o dar fe de él frente al Registro Nacional al momento de la escritura de segregación, ello no impide que sea una actuación ilícita el pretender no reconocer la existencia del acto favorable. Situación semejante ocurre con los permisos de construcción, una vez construída la obra, donde el acto carece de interés; en todo caso, conviene realizar el análisis más exhaustivo pero frente a la pretensión en concreto.
X .- SOBRE LAS PRETENSIONES PRINCIPALES DECLARATIVAS : Previo a entrar en la pretensión en concreto, debe advertir el Tribunal que la articulación pretendida no presenta un formato con plena claridad en cuanto se mezclan consistentemente reconocimiento y juicios declarativos de derecho; empero se procurará su análisis de la manera más comprensible posible, siempre teniendo como norte el principio de tutela judicial efectiva. A) Dejando de lado la primera pretensión principal, consistente en la declaratoria con lugar del proceso, en cuanto no es una pretensión en sí misma, sino una comprensible de las demás, la primera solicitud (numerada como dos) de la sociedad actora requiere que se revaliden los veintiocho planos visados en su oportunidad por el ayuntamiento, en virtud de corresponder a un mero fraccionamiento. El término revalidar es entiendo por el Tribunal como aquel supuesto donde se emite un acto administrativo, posteriormente es anulado, y consecuentemente se solicita el otorgamiento de la eficacia jurídica nuevamente.
En lo que al caso corresponde, los planos que resultan ser visibles a hecho probado número catorce nunca han sido anulados y consecuentemente no pueden ser revalidados, pese a esto, al amparo del artículo ciento veintidós del Código Procesal Contencioso Administrativo entiende la Cámara que lo pretendido es la nulidad de cualquier acto formal o material que lesione la actuación administrativa favorable en consideración. También es pertinente aclarar que la parte actora sostiene de manera implícita la manutención de dichos actos constatativos en virtud de corresponder a fraccionamientos simples, lo que como se viene indicando es incorrecto, pues son parte de una urbanización. Así no es posible asegurar en los términos que la sociedad actora requiere de que el proyecto es un mero fraccionamiento, cuando de la relación de hechos probados quedó claramente indicado las limitaciones en servicios públicos los cuales fueron asumidos por el urbanizador como requisitos necesarios para su proyecto, de suerte que la existencia de calles públicas y servicios públicos limitados no resultan ser suficientes para otorgar lo pedido.
En todo caso, nos inclinamos a encontrar sentido a la pretensión en los términos indicados, no por ser meros fraccionamientos, sino por que cualquier lesión a un acto favorable al administrado es una vulneración al principio de intangibilidad de los actos propios, de suerte que solo mediante los procedimientos administrativos legalmente establecidos es posible destruir la eficacia jurídica de esos actos, procedimientos que frente al caso en concreto no existe prueba alguna de haberse dado. Cotejado la totalidad de las actuaciones frente a esos actos, el único momento donde es posible ubicar un intento para restarle efecto a esos actos se ubica en el hecho probado sesenta y uno por parte del jerarca impropio, donde llega a señalar que dichos actos deben tenerse por inexistentes. Un primer aspecto que debe señalarse es que el acto frente al cual se conocía el recurso de apelación era el acta de la sesión doscientos veinte, del dieciséis de marzo de dos mil nueve del Concejo Municipal correspondiente, referente a la negativa del aval al silencio positivo otorgado por el ayuntamiento, motivo por el cual este órgano jurisdiccional entiende que corresponde a un Obiter dictum, es decir un análisis tangencial realizado por la Sección Tercera del Tribunal Contencioso Administrativo sin que fuera la parte medular de su análisis pues no era ese el motivo del recurso.
Entiende así esta Sección del Tribunal como el acto favorable al administrado ya estaba otorgado con anterioridad según es posible ubicar en el elenco de hechos probados bajo el número treinta y ocho, correspondiente al oficio MAT-WA-14-09 del diecisiete de febrero de dos mil nueve. De suerte que una vez otorgado el acto en consideración, resulta irrelevante si es o no avalado por el Concejo Municipal e incluso si esta posición es compartida o discrepada por el jerarca impropio, en la medida en la cual el acto ya estaba generado. Cabe advertir sobre el particular la inexistencia de elementos de convicción sobre los cuales pudiera pensarse una mala fe de la sociedad actora, máxime cuando los funcionarios municipales estaban en la convicción de tratarse de un mero fraccionamiento, posición incluso compartida por los funcionarios del Instituto de Vivienda y Urbanismo. Valoración de los funcionarios administrativos aún cuando respetable no compartida por este Tribunal en cuanto no lograron comprender que lo buscado con la norma era la mera unión a una red de servicios públicos preexistentes, lo que en el caso no era así.
Pese al error en la aplicación de las normas lo cierto es la existencia del acto favorable a los intereses del administrado, de imposible desconocimiento. De manera que lo sostenido por el jerarca impropio al amparo del numeral ciento setenta y tres de la Constitución Política, además de no ser un acto jurisdiccional propiamente dicho que genere cosa juzgada frente a esta órgano judicial, tampoco es la base central de su razonamiento. Todo sin perjuicio que de manera posterior, es el mismo Concejo Municipal quien aclara su acuerdo, haciendo alusión que no debía entenderse un acto contrario a los intereses de la sociedad actora en este proceso, sino una mera posición del órgano colegiado; muestra claro de lo dicho es que a partir de este segundo acuerdo se levanta la suspensión del proyecto que se había generado. Así al momento que el jerarca impropio conoció del recurso de apelación administrativo había una manifiesta falta de interés, al haber revertido el jerarca administrativo en aplicación del principio de auto tutela sus mismos actos.
Lo que nuevamente nos lleva a la conclusión de la inexistencia de actos que pretendan restarle efectos jurídicos a los visados otorgados. Es preciso recordar sobre el particular que los visados como tal son actos cuyos efectos quedan plasmados en el mismo plano, facultando al interesado a poder segregar el terrreno mediante la correspondiente escritura pública en el momento que lo tenga a bien según lo dicho, así su perturbación debería ir encaminada hacia comunicaciones con el Registro Nacional, dependencia donde surtiría efectos el acto, los que en el caso no se han dado. La parte accionante especula así sobre la existencia de afectaciones futuras, las cuales no se han dado y que no podrían conocerse en cuanto no es posible saber que nuevas actividades o posiciones va a adoptar el ente público frente al caso en concreto. Las otras generadas por el ayuntamiento (afectacciones al avance de la obra ó no recepción del proyecto) son meras actuaciones materiales y no atacan el visado otorgado a los veintiocho planos.
De manera que no se estaría presentando una afectación real y concreta sobre dicha pretensión que permita ser declarada, disponiéndose la falta de interés actual. Todo sin perjuicio que declarar la validez de dichos actos es aceptar su conformidad con el ordenamiento, como cuando ya se indicó no presentan tales atributos en cuanto debieron ser consideradas dentro de un proyecto urbanístico y no como fraccionamiento simple. B) La siguiente pretensión se orienta a la declaración de validez y eficacia en cuanto a tres permisos de construcción otorgados a la actora, correspondientes a los números 030-2009 para una planta de tratamiento de aguas residuales, mejoras en vía pública, encascotado, cordón y caño, aceras, evacuación de pluviales y agua potable; 110-2009 para una vivienda unifamiliar y permiso de construcción 111-2009 para la edificación de una vivienda unifamiliar. El primero de los permisos de construcción fue otorgado por el Señor Nombre20665 según se narra en hecho probado treinta y ocho, mientras que la base de los permisos de construcción fueron otorgados según se establece ha hecho probado cuarenta y seis.
Si bien, dichas obras en su momento fueron paralizadas, posteriormente se permitió su construcción. Muestra de lo dicho es como a hecho probado numero cuarenta y ocho, el Concejo Municipal de Atenas el seis de abril de dos mil nueve, aclara sus actuaciones, para indicar que no se están anulando o revocando el primero. Dentro de las argumentaciones de las partes realizadas en el juicio oral, así como del elenco de hechos probados no es posible detectar actuación administrativa alguna que impida la realización de estas obras en este momento, las que en su momento si pudieran haberse dado; sí bien comprende la Cámara que ante la existencia de actuaciones anteriores es posible la existencia de un temor en la actora que puedan presentarse otras situaciones, ante obras ya concluídas o sin restricción vigente, se trata de meras especulaciones que no presentan abrigo jurídico. Conviene retomar lo señalado en cuanto la obligación del control y vigilancia de las actividades urbanísticas en un cantón a cargo del ente público descentralizado, pero dichas funciones deben ser desarrolladas al amparo de la legalidad, lo que incluye que las paralizaciones o suspensiones de obras deben darse en supuestos de incumplimiento del permiso otorgado o sobre afectacciones generadas a la hora de desarrollar el proyecto no contempladas originalmente.
Nunca podrían corresponder a acciones intempestivas, infundadas, o con motivaciones ilícitas. Volviendo al caso en concreto, de nuevo ubica el Tribunal una carencia de interés en cuanto estamos frente a permisos de construcción que agotaron sus efectos en el momento que la obra se encuentra concluída, careciendo de toda relevancia analizar su validez y eficacia, máxime cuanto esta no esta siendo cuestionada. Nuevamente hay que declarar también la falta de derecho, en la medida que como se ha indicado debieron ser conocidos dichos actos dentro de un proyecto urbanístico y no como mera segregación, lo que impediría declarar que fueron emitidos con sustento legal. C) La cuarta pretensión requiere se ordene a la Municipalidad de Atenas el reconocimiento del derecho subjetivo que asiste a la actora con respecto a los puntos anteriormente reconocidos, en cuanto a su validez y eficacia, de manera que no es posible revocar o anular dichos actos.
Sobre dicho requerimiento deben realizarse varias aclaraciones, inicialmente y como se ha venido señalando no se trata de derechos subjetivos sino de permisos, de suerte que lo realizado fue levantar barreras administrativas que permiten su ejercicio, no siendo posible declarar lo pretendido por la interesada en la medida que no son derechos subjetivos como lo indica; por otro lado se trata de actos carentes de una perturbación real (en el supuesto de los permisos) o cuyos efectos se agotaron (en lo referente a los visados), debiendo declararse la falta de interés manifiesta que se presenta en el caso. Lo anterior sin perjuicio de la imposibilidad de los órganos jurisdiccionales de pretender restringir las facultades administrativas de revocar o anular dichos actos, siempre concurriendo al procedimiento legalmente establecido. De manera que el Tribunal no podría impedir las facultades administrativas, limitando su señalamiento que en el supuesto de que fueran ejercidas estas deberán desarrollarse dentro del marco de la legalidad, con plena garantia del debido proceso y del derecho de defensa, momento en el cual la hoy actora podrá ejercer los derechos que el mismo ordenamiento le garantiza.
Por otro lado, en cuanto a la validez y eficacia de los actos anteriores, como se indicó carece de derecho, lo que también debe declararse, en el entendido para el Tribunal que de la prueba evacuada y de la interpretación de las normas aplicables, no es posible sostener que se han cumplido todos los requisitos legales en cuanto fueron tramitados como un mero fraccionamiento y no como urbanización, en las condiciones ya explicadas. D) La quinta pretensión versa sobre la ratificación de la aprobación del proyecto Villa Jesús de atenas, requiriendo se declare el cumplimiento de la totalidad de los requisitos legales. Visto como ratificación, como se había indicado presupone la existencia de un acto previo el cual es anulado o revocado lo que en la especie no se consolida, empero la Cámara entiende la solicitud como de anulación de todos los actos que resultan contrarios a aquellos dispuestos con actuación favorable a los intereses de la sociedad actora.
En los términos dichos, inicialmente existe una carencia manifiesta de derecho en cuanto a dicha pretensión, en la medida que resulta imposible reconocer el cumplimiento de todos los requisitos del proyecto en consideración cuando no es posible constatar esa situación en el caso de una urbanización, como es el caso que nos ocupa, que como es conocida presenta requerimientos más complejos en razón de la obra a realizar, donde actuán diversas dependencias estatales; de manera que no resulta posible acceder a la pretensión deducida. Más como se ha venido razonando estamos en presencia de un acto favorable a los intereses de la accionante el cual no sino revocado o anulado, protegido en consecuencia por el principio de intangibilidad de los actos propios, de manera que en cuanto a los actos de obstrucción del proyecto, como ya se indicó, las labores de fiscalización de los proyectos constructivos, en cuanto se ajusten a aquello permitido por acto administrativo es una obligación connatural al régimen municipal; en la medida que el acto habilitatorio no es para cualquier actividad sino para una en concreto.
Incluso, aún supeditándose a lo permitido, resulta posible la generación de afectaciones no consideradas (en temas ambientales a manera de ejemplo) que harían lícito la paralización de una actividad construtiva. Lo que sí resulta ilegal es la paralización de una obra ajustada a lo permitido y sin generarse afectaciones (especialmente ambientales) no consideradas, que todo indica fue lo ocurrido en lo que a la especie corresponde. En todo caso, retomaremos este tema a la hora de considerar las responsabilidades solicitadas. En la sub júdice es posible verificar como no existen actos tendientes a anular la aceptación del proyecto Villa Jesús de Atenas, sino actuaciones no formales, consistentes en la paralización del proyecto en su oportunidad y en la ausencia de ejecución de las actividades propias a la recepción del proyecto; la primera carente de interés a este momento y la segunda, en la cual se omite su ejecución.
Todo parece indicar que esta última situación tiene sustento en la falta de claridad del ayuntamiento sobre las afectaciones concretas que podrían presentarse, promovidas por la presión de los vecinos. La aceptación del proyecto presenta tres efectos directos, el primero de ellos en cuanto a la aceptación de las áreas comunales al amparo del artículo cuarenta de la Ley de Urbanísmo (lo que incluye el tanque de tratamiento), en segundo lugar lo correspondiente a la aceptación de las mejoras en infraestructura pública y servicios y lo correspondiente al visado de los planos faltantes de visar dentro del proyecto. Estamos frente a una antinomia de las normas, en el entendido que aceptar el proyecto en los términos actuales resultaría un acto antijurídico, pero al mismo tiempo negar eficacia a un acto sin el cumplimiento de los requisitos legales, también lo es. De manera que la Cámara opta al amparo del artículo ciento veintidós del Código Procesal Contencioso Administrativo por otorgar a la Municipalidad demandada un plazo de tres meses calendario a partir de la firmeza de la presente resolución para que la demandada ejecute el acto dispuesto o en su defecto inicie los procedimientos de revocación o anulación, según corresponda a partir de los procedimientos legalmente establecidos.
En el entendido que la inseguridad jurídica presentada por la demandada cese de manera definitiva en uno u otro sentido, ante conductas contrapuestas del ente público corporativo donde por un lado autoriza o permite y por el otro niega la ejecución de los actos dispuestos. Al respecto el copioso listado de hechos probados demuestra una cadena de gestiones, algunas reiterativas y otras aisladas, sin establecer una resolución en concreta frente al tema; en especial en el caso del Concejo Municipal, incumpliendo plenamente sus obligaciones. Debe queda claro que una cosa es que el acto presente elementos discrecionales y otra muy diferente que pueda mantenerse al administrado sin resolver sus gestiones de manear indefinida. Es también posible constatar como el órgano colegiado supremo hace manifestaciones desaprobando el proyecto, pero no adopta ningún acto concreto al respecto, lo que manifiestamente genera un estado de inseguridad jurídica insostenible.
Al otorar dicho plazo, se resuelve dicha pretensión, así como la numerada como 5.1 que corresponde a la recepción de terrenos y obras por la demandada, la señalada como 5.2 que refiere al visado de los planos faltantes y lo atinente a la anulación de actos contrarios a aquel que fuera favorable a la administrada. Sobre esta última si debemos indicar la carencia también de interés en cuanto la inexistencia de algún acto vigente con afectación real sobre el proyecto en consideración.
XI .- SOBRE LAS PRETENSIONES PRINCIPALES INDEMNIZATORIAS : Como último punto de las pretensiones principales, la actora realiza una solicitud indemnizatoria de daños y perjuicios, los que por su complejidad resulta necesario su estudio detallado. Inicialmente se liquida como daño patrimonial lo correspondiente a los permisos de construcción 030-2009 (mejoras en la vía y planta de tratamiento), 110-2009 (vivienda unifamiliar) y 11-2009 (vivienda unifamiliar); justificando el daño en la paralización de las obras de manera injustificadas. Se razona en la fundamentación como por intermedio de la resolución MAT-DA-WA-0150 del nueve de julio de dos mil nueve el Señor Nombre20665 Municipal paralizó las obras, las que fueron reanudadas hasta el quince de enero de dos mil nueve, por intermedio del oficio MAT-WA-07-109. Se trata en efecto de una paralización intempestiva y sin la evidencia dentro del expediente de un motivo justificado, carente de todo procedimiento y tampoco justificable como medida cautelar.
Así como se razonó en su oportunidad las labores de control de fiscalización en cuanto a la obra son inherentes al régimen municipal, lo que lleva aparejado la posibilidad de paralización en el momento que lo realizado se separe de lo autorizado, así como afectaciones reales y efectivas a situaciones no consideradas originalmente, pero ni uno ni otro supuesto se encuentra acreditado. La única motivación se orienta a los alegatos de las partes en el sentido que fue efecto de la presión de los vecinos (hecho que tampoco fue probado), aspecto aún cuando relevante no presenta ser un motivo lícito para el acto administrativo en consideración, generando como consecuencia la existencia de una conducta formal e ilegal, y como tal generadora de responsabilidad declarable en esta sede. A los efectos del Tribunal es incuestionable la ilegalidad de la conducta, la existencia del daño y el nexo causal entre uno u otro, en el entendido que la paralización de una obra de construcción presenta afectacciones sobre el material comprado, el personal contratado y hasta posibles negocios que pudieron gestarse a partir de estas; queda por establecer la cuantificación del mismo.
Ahora bien, al momento de liquidar dicho daño la actora la fija en la suma de noventa y nueve millones cincuenta y nueve mil trescientos treinta y un colones con sesenta céntimos, consiste en el precio de compra del terreno, construcción de la planta de tratamiento, obras de mejoramiento de la vía pública e infraestructura. Los rubros indicados resultan incontrovertibles en su existencia como actividades propias del proyecto constructivo, pero carecen de manera manifiesta nexo de causalidad con la conducta ilegal ya señalada. Así la compra del terreno no es consecuencia de la paralización, como tampoco lo son las obras realizadas. No es posible pretender cobrar el total de la inversión del proyecto a partir de una paralización por más ilícita que esta pudiera ser. Véase como el terreno todavía es propiedad de la sociedad accionante, al igual que las obras desarrollas por su cuenta y riesgo, pues todo negocio en cuanto negación del ocio lleva implícito una serie de riesgos que no es posible cargar a la administración y que son desarrollados por el interesado, dentro de una actividad lucrativa por él emprendida.
Muestra clara es como al día de hoy las dos viviendas unifamiliares bien podrían ser vendidas, al igual que las restantes obras. Pretender negar los riesgos de la empresa y permitirle quedarse con obras realizadas y al mismo tiempo con el valor de éstas, no es más que un enriquecimiento injusto que bajo ningún motivo puede tener abrigo por parte de la Cámara. Debiendo rechazarse dicha liquidación y remitir a la ejecución de sentencia a que la parte actora liquide efectivamente los daños sufridos y los acredite, supeditado a lo antes dicho. Si debe aclararse como en el juicio oral y público se evidenció como algunos materiales se habían lavado por generarse la paralización en pleno invierno y así como el deterioro normal por el mero tiempo que no se habría generado si la obra hubiera continuado por su curso normal, daños que si presentan realización directa con la conducta administrativa ilegal, más lamentablemente estos no se liquidaron a la hora de presentar el proceso; y en todo caso nunca se llegó a establecer su quantum, lo que impediría declararlos en este momento.
También se hizo ver en el juicio oral y se aportó prueba (tanto documental como testimonial) referente a los daños producidos al pozo de agua de la actora en el tiempo que se generó la paralización, al extremo de ser necesario generar uno nuevo. Sobre dicho particular es evidente la ausencia de nexo causal entre la conducta administrativa y el daño reclamado, en el entendido que la administración paralizó obras, pero no impidió a la actora que contara con el personal de seguridad y las medidas útiles y necesarias para mantener sus bienes en resguardo, lo que corresponde a situaciones diametralmente diferentes. Además el daño, no fue acreditado antes dicho no fue realizado por la administración sino por un tercero sin nexo alguno con la organización o actividad administrativa. La situación es lamentable y bajo ningún motivo puede ser aceptada por esta jurisdicción, pero no es posible reclamar al ayuntamiento dichas afectaciones.
No es de menos indicar que a nuestro criterio no corresponde el caso al supuesto del artículo ciento noventa y cinco de la Ley General de la Administración Pública que prohibe indeminización frente a interés ilegítimo en el entendido que no es posible ubicar el dolo de la parte por engañar a la Administración, más por el contrario los funcionarios públicos que actuaron en el proceso resultan estar claros sobre lo ocurrido, así la incorrecta interpretación de las normas no fue inducida por el administrado sino dispuesta por la administración. El segundo daño reclamado se residencia en la afectación a la imagen de la empresa, bajo la figura del daño moral objetivo; entendido como que trascendió a la comunidad y a los medios de comunicación colectiva como el proyecto no cumplía requisitos técnicos y legales, estableciendo su importe en la suma de quinientos millones de colones. En cuanto a dicho rubro liquidado tenemos una manifiesta carencia de elementos probatorios, vulnerándose el artículo trescientos diecisiete del Código Procesal Civil, con relación al doscientos veinte del Código Procesal Contencioso Administrativo.
Así no existe prueba en cuanto a la trascendencia pública de la situación objeto de litigio hacia la comunidad, pero más importante aún que se haya producido una lesión al patrimonio de la empresa. Recuérdese que el año moral objetivo no se presume como el subjetivo, sino que debe acreditarse. No es posible constatar que hayan existido ventas caídas a partir de los hechos de interés, reducción en los ingresos sobre dicha base o en general una afectación concreta que satisfaga los requisitos del artículo ciento noventa y seis de la Ley General de la Administración Pública, imponiéndose el rechazo del rubro. El tercer grupo reclamado corresponde a los perjuicios los que motivan en la ausencia de consolidación del proyecto, específicamente en la ausencia de venta de los lotes y con esto recibir una utilidad esperada. Estimándose dicha afectación en la suma de cuatrocientos dieciséis millones cuatrocientos diecisiete mil quinientos cincuenta colones.
Cabe advertir que a la hora de liquidar dicho rubro la parte promovente parte de la premisa como si existiera un desapoderamiento del inmueble, cuando como se ha indicado sigue formando parte de su patrimonio, lo que llevaría a la lógica pensar que a razón de liquidarlo debió considerar únicamente la utilidad y no la totalidad del valor de un bien que todavía puede disponer de él. Nuevamente aquí tenemos problemas de insuficiencia probatoria, véase como existen veintiocho lotes debidamente visados que pueden ser utilizados por la interesada, sin la existencia de que estos se hayan procurado vender y a partir de la acción de la demandada no se ha logrado, dicho aspecto nunca se acreditó. Tampoco se ha logrado demostrar, que algún bien inmueble fuera devuelto por la misma base. Todo lo cual hace pensar que la actora viene a liquidar el rubro que esperaba recibir en una situación incierta, pues a final de cuentas nada asegura la existencia de las ventas en los términos pensados.
Se trata en efecto de una especulación, que debe ser rechazados sobre las mismas bases. A manera de sintésis en cuanto a los daños pedidos, a excepción del rubro reconocido en abstracto, estamos en presencia de una falta de derecho, que debe ser declarada.
XII .- SOBRE LAS PRETENSIONES SUBSIDIARIAS : La actora realiza una pretensión subsidiaria a partir del supuesto de que no resultara posible la ratificación de los visados y permisos de construcción entregados, que requiere su correspondiente pronunciamiento. Solicita inicialmente se le indemnice a partir de los veintiocho visados de planos para segregación otorgados por el ayuntamiento. Como se indicó si bien dichos actos fueron otorgados a partir de un proyecto de segregación cuando debieron ser tramitados en una urbanización, lo cierto es que dichos actos no se han anulado, todavía al día de hoy subsisten en el ordenamiento jurídico lo que impediría la posibilidad de reconocimiento alguno. De manera que subsistiendo a la fecha dichos actos (al margen de ser o no válidos) no se ubica una lesión jurídica susceptible de ser indeminizada en los términos pretendidos; de manera que la actora podría en cualquier momento proceder a segregar esos lotes y disponer de ellos como a bien los tuviere.
Tómese nota como lo señalado en el considerando tras anterior, en el entendido que frente a la pretensión de revalidación de los planos existía una carencia manifiesta de interés actual, en la medida que no se había dispuesto acto alguno que impidiera presentar esos documentos visados ante el notario de interés de la actora para poder generar por escritura pública las segregaciones allí permitidas. Posibilidad vigente a la fecha, conforme se ha sostenido. De suerte que resultaría contrario al ordenamiento alguna indemnización al respecto. Cabe advertir en este particular como a la hora de liquidar se solicita los rubros señalados bajo el punto sexto de la pretensión principal que son aquellos analizados y resueltos en el considerando anterior, sobre los cuales no es posible agregar mayores elementos de razonamiento para su análisis.
XII .- SOBRE LA PRETENSIÓN DE INTERESES Y LO CORRESPONDIENTE A INDEXACIÓN: La actora solicitó el pago de intereses legales, los que en efecto corresponde reconocer en cuanto réditos civiles a partir rubros en concreto que tuvo que cancelar sobre la base de una conducta ilícita desplegada por la administración, pero a partir de la resolución que llegaré a establecer los daños en concreto producidos. Véase como estamos en presencia de una obligación de valor, la cual a la fecha no ha llegado a establecer su quantum, de manera que resulta imposible para la accionada proceder a cancelar rubro alguno en concreto. Es de precisar que si bien la actora pretendería el pago desde el momento de la afectacción, no es posible concederlo en dichos términos cuando todavía la obligación no es dineraria, debiendo limitarse en los términos dichos. Naturalmente dicho interés deberá calcularse sobre la base del artículo mil ciento sesenta y tres del Código Civil. Igualmente de conformidad con el artículo ciento veintitrés del Código Procesal Contencioso Administrativo procede el reconocimiento de indexación, tomando de la misma manera como base a partir de la sentencia de ejecución firme que llegare a establecer un monto concreto a cancelar y hasta su efectivo pago.
X IV .- SOBRE LAS EXCEPCIONES : Como excepción invocada por la demandada se señaló la expresión sine actine agit, lo que obliga a retomar el razonamiento vertido por diferentes Secciones del Tribunal que tienen por sustento lo señalado por la Sala Primera de la Corte Suprema de Justicia en su conocido voto No. 2008-000317 de las nueve horas diez minutos del dos de mayo de dos mil ocho. De manera que se señala una diferencia entre el instituto procesal “excepción de fondo” y los presupuestos materiales. Para que una demanda pueda ser cursada, el órgano jurisdiccional debe revisar oficiosamente los presupuestos procesales (capacidad procesal, competencia del tribunal y cumplimiento de los requisitos de la demanda). Más adelante, cronológica y lógicamente después, al dictarse la sentencia, para que la pretensión pueda ser acogida, también debe revisarse oficiosamente si se reúnen los presupuestos materiales.
Estos son: el derecho, la legitimación y el interés actual. Si alguno de estos -o todos- no existen, la demanda no podrá encontrar respuesta positiva. Una “excepción de fondo”, técnicamente hablando, es cuando, existiendo derecho, legitimación e interés en la pretensión del actor, ésta no es susceptible de ser acogida porque también existen otros motivos diversos pero jurídicamente relevantes, que dan razón a la oposición que presenta el demandado. Ejemplos claros de lo que es una excepción de fondo sería la prescripción o caducidad. Nuestro ordenamiento procesal (tanto procesal civil como contencioso administrativo) señala que las excepciones de fondo deben ser opuestas por el demandado al contestar la demanda, sin que se haga, por razones obvias, una enunciación de cuáles son éstas. Ha existido la costumbre de que en los litigios se denominen “excepciones” a la falta de derecho, a la falta de legitimación (pasiva y activa) y a la falta de interés.
Incluso es usual que los abogados litigantes que patrocinan a los demandados opongan la “excepción sine actione agit”. Estas tres carencias (de derecho, legitimación e interés actual), como se ha indicado, en realidad son presupuestos materiales, no excepciones de fondo en sentido estricto. La de “sine actione agit” se derivó de una mala interpretación de la jurisprudencia emanada de la antigua Sala de Casación, entendiéndola como comprensiva de las de “falta de derecho, falta de legitimación y falta de interés.” Esta “excepción” no solamente no existe actualmente, sino que resulta redundante si se alega junto con las antes señaladas. Ella procedía en el segundo período del Derecho formulario romano, cuando el actor sólo podía llevar a juicio al demandado si el Nombre24595 le otorgaba la fórmula-acción. En caso contrario, carecía de esa facultad, y por tanto, tuvo sentido jurídico la frase “demandas sin acción”.
En la actualidad no es necesario obtener previamente el derecho de promover el juicio para presentar una demanda, y por este motivo, la mencionada excepción carece de sentido jurídico y de base legal. Ha de entenderse, que si la demanda se acoge y se brindan los fundamentos correspondientes, ello implica automáticamente el rechazo de las “excepciones” de falta de derecho, falta de legitimación y falta de interés. En otras palabras, no se requiere una fundamentación independiente. Valga reiterar que aún en caso de que la parte demandada no oponga esas particulares “excepciones”, si no existe derecho, legitimación y/o interés actual, la pretensión deberá ser rechazada oficiosamente (Ver al respecto el voto 2008-000523, de la Sala Segunda de la Corte Suprema de Justicia). Todo lo cual obliga a rechazar la expresión sine actione agit en los términos invocados. Pese a eso, y como se indicó oportunamente si procede declarar la falta de interés y derecho en cuanto a todas las pretensiones principales declarativas solicitadas por la actora, la falta de derecho en cuanto a las pretensiones accesorias y parcialmente la falta de derecho sobre las que no hayan sido reconocidas, todo con fundamento en los considerandos anteriores.
X Nombre53625 .- SOBRE LAS COSTAS. En lo que refiere a las costas, no existiendo motivo para eximir al vencido, corren las mismas a cargo de este, de conformidad con el artículo ciento noventa y tres del Código Procesal Contencioso Administrativo.
POR TANTO:
Se rechaza la expresión sine actione agit, se declara de oficio la falta de interés y derecho sobre todas las pretensiones principales de declarativas no expresamente concedidas. Se declara parcialmente con lugar la demanda, disponiéndose al amparo del artículo ciento veintidós del Código Procesal Contencioso Administrativo el plazo de tres meses a partir de la firmeza de la sentencia para que la demandada ejecute el acto de recepción o en su defecto inicie los trámites de revocación o anulación del proyecto Villa Jesús de Atenas. Se declara también de oficio la falta de derecho sobre las pretensiones principales indemnizatorias en todo aquello no expresamente concedido, se condena a la Municipalidad de Atenas a cancelar a la actora los daños correspondientes a la paralización de de las obras de construcción que había autorizado, los que se deberán liquidar en ejecución de sentencia. Se declara la falta de derecho sobre las pretensiones subsidiarias. Sobre el rubro económico reconocido se reconoce el derecho a indexación e intereses civiles a partir de la firmeza de la resolución de ejecución que los llegare a fijar. Corren las costas a cargo de la Municipalidad demandada.

Madrigal Jiménez Carlos Espinoza Salas Francisco Muñoz Chacón VOTO SALVADO DEL JUEZ ESPINOZA SALAS Concurro con mis compañeros en el voto, no obstante me separo en cuanto a la interpretación realizada respecto al momento a partir del cual corre la indexación y los intereses de las sumas otorgadas en sentencia, que acorde a la respetable posición de mayoría lo es desde la firmeza de la sentencia que las establezca en concreto. Sin embargo, para el suscrito, la indexación y los intereses tratándose de obligaciones de valor, debe correr a partir de la firmeza de la sentencia que las otorgue, sin que sea necesario trasladar tal data hasta que exista un monto concreto y en caso de obligaciones dinerarias desde que se incurrió en la erogación. De este modo, lo correcto para establecer una indemnización integral y plena, y para no causarle perjuicio al justiciable, es que se deba indexar y conceder intereses desde que se establece, dicta y reconoce la obligación.
Respeto a la indexación por la naturaleza de este instituto, el cual pretende actualizar al valor presente las obligaciones dinerarias preexistentes o actualizar al momento del dictado las obligaciones de valor reconocidas en sentencia, no debe quedar sujeta su aplicación, tratándose de obligaciones declaradas en abstracto, hasta el momento de la firmeza de la sentencia de ejecución que defina su monto, por cuanto el derecho ya se declaró y estableció. De igual modo, si el monto indemnizatorio ya se definió en sentencia, con mucho menos motivo debe postergarse a etapas posteriores en perjuicio de la victoriosa el deber oficioso de indexar tales rubros. Si bien, el ordinal 123 del Código Procesal Contencioso Administrativo es claro en que la obligación dineraria reconocida en sentencia se actualizará desde la fecha de su exigibilidad, el numeral 124 inciso primero y segundo, en cuanto a las obligaciones de valor, expresa que una vez convertida en dinero efectivo el juez ejecutor la actualizará, pero no indica a partir de cuando.
En razón de ello, la interpretación lógica, con base en el principio de reparación integral y plena, es la de que al diferirse en el tiempo la fecha de su fijación en ejecución y posterior pago, es lo razonable que la actualización se produzca desde que se declaró en sentencia y hasta su efectivo pago. Ergo, en el caso de obligaciones de valor en las cuales se fija su monto en la sentencia que las otorga, con mucha menos razón debe diferirse su indexación a etapas posteriores. Si bien el precepto legal dispone que una vez convertida en dineraria la obligación de valor se actualizará, ello obedece a que por razón lógica no puede aplicarse la operación de indexación a un rubro no cuantificado, pero ello no implica que tal actualización deba correr hasta que el juez de ejecución establezca su monto.
