APPEAL ON POINTS OF LAW (RECURSO DE CASACIÓN) filed in the present proceedings brought against D, of legal age, […], [Identificacion1], for the offense of Violation of the Ley Forestal, to the detriment of Natural Resources. PROCEDURAL BACKGROUND (RESULTANDO):

  1. 1By judgment number 67-P-11, issued at fourteen hours and fifty-five minutes on the seventh of March, two thousand eleven, the Trial Court of Puntarenas ruled: "POR TANTO: In accordance with the foregoing, the rules of sound judicial reasoning (sana crítica), and Articles 39 and 41 of the Political Constitution; 1, 11, 50, 71, and 103 of the Criminal Code; 1, 6, 9, 320, 341, 343, 360-361, and 366 of the Code of Criminal Procedure; and 1046, 1045, and 1048 of the Civil Code, the Court hereby: ACQUITS defendant D OF ALL PENALTIES AND LIABILITY for the offense of VIOLATION OF THE LEY FORESTAL, committed to the detriment of NATURAL RESOURCES. The civil action for damages (acción civil resarcitoria) is denied, and both parties are exempted from payment of costs. Any interim measure (medida cautelar) imposed against the defendant in these proceedings is hereby lifted. The parties are duly notified herein" (sic).
  2. 2Attorney [Nombre5], Deputy Attorney General, filed an appeal on points of law against the foregoing decision.
  3. 3Following the corresponding deliberation, in accordance with Article 464 bis of the Code of Criminal Procedure, the Court proceeded to hear the appeal.
  4. 4The relevant statutory requirements have been observed in the proceedings.

Judgment Appeals Judge [Nombre6] drafts the opinion; and, CONSIDERING (CONSIDERANDO):

Ú [Nombre7]. – Mr. [Nombre5], Deputy Attorney General (Procurador Adjunto), representing the State in its capacity as Civil Plaintiff (Actor Civil), filed an appeal on points of law (recurso de casación) against judgment No. 67-P-11 of the Tribunal de Juicio de Puntarenas, solely with respect to the dismissal of the civil claim (absolutoria civil). In the first ground, he argues that the State brought a civil claim jointly and severally against both the defendant and […] S. A., the registered owner of the property where, according to the indictment, illegal logging occurred and a forested area was encroached upon for the construction of a hut within a forest ecosystem. Although both documentary and testimonial evidence specifying the damage caused was submitted, the Court completely failed to assess and analyze it, thereby causing prejudice to the Civil Plaintiff; nor did it even consider the possibility of restoring matters to their prior condition, as provided in section 366 of the Código Procesal Penal.

He further adds that there is case law from the Tribunal de Casación Penal holding that, even in cases in which the defendant is acquitted both criminally and civilly, restoration of the impairment of a forest ecosystem has been ordered, even sua sponte, when the damage has been proven. He requests that the dismissal of the civil claim be vacated and that the matter consequently be remanded for new proceedings on the civil issue. In the second ground of the appeal, he alleges a violation of Article 50 of the Constitución Política; Articles 2(d), 19, 20, 58(a), and 61(a) of the Ley Forestal; and Article 52 of the Ley de Uso del Suelo (No. 7779 of April 30, 1998). The Court rejected the civil judgment sought, stating that it was not viable because the State itself had requested the defendant’s acquittal and because the existence of a criminal offense is a fundamental prerequisite for a civil judgment.

That position has been superseded by the case law issued on appeal, in accordance with the interpretation of the cited regulatory framework. According to that case law and the cited provisions, our legal system applies strict civil liability (responsabilidad civil objetiva) in environmental matters; consequently, it is sufficient to establish environmental damage (daño ambiental) arising from the attribution parameters or criteria defined, for example, in the Ley Orgánica del Ambiente, Article 98 of which establishes that environmental damage may be caused by an act or omission and is attributable to all natural or legal persons who cause it. This is supplemented by Article 101 of the same Law, which provides that the owners of the businesses or activities where the damage occurs are jointly and severally liable for the losses and damage caused, whether by act or omission. This is further supplemented by the Ley de Uso y Conservación de Suelos, which establishes civil liability for damage caused to soil resources, regardless of whether negligence or intent exists, requiring payment of the corresponding compensation and repair of the damage caused to the environment.

All the cited provisions were disregarded in the judgment. The environmental damage caused to the forest was not even weighed. Furthermore, the principle of the non-reduction of forests (principio de irreductibilidad del bosque), embodied in the legislative rationale (ratio legis) of the Ley Forestal, was violated. Although one of the stated grounds concerns procedural form and the other the merits, they are resolved jointly because the reasons for rejecting them are the same. The appellant is correct in asserting that a criminal acquittal does not necessarily entail dismissal of a civil action for damages (acción civil resarcitoria); indeed, this is expressly provided in the final paragraph of section 40 of the Código Procesal Penal, which states: “An acquittal shall not prevent the Court from ruling on a validly brought civil action for damages, when appropriate.” Notwithstanding the foregoing, in the present case there could be no ruling granting the civil action for damages because such a ruling would be contradictory and inconsistent with the pleadings.

The civil claims are based on exactly the same facts as the indictment (cf. pages 1 through 6 of the civil-action case file and the indictment at pages 207 through 214 of the main case file). The facts alleged in the indictment and, therefore, in the civil claim were found unproven in the challenged judgment (cf. judgment minutes at page 557). In the appeal on points of law, the appellant raises no ground seeking to challenge the trial court’s factual findings, accepting the acquittal entered in the criminal matter—an acquittal that the appellant himself requested in his closing arguments at trial, supporting his request as follows: “Environmental damage has been proven, but it is not possible to attribute its commission to the defendant. There is no lawful evidence linking D to the commission of that offense. There is no strict liability in criminal matters, as there is in environmental matters.” (cf. recording of the judgment beginning at 10:41:21 hours).

Mr. [Nombre5] bases his request to vacate the judgment insofar as it rejected the civil action for damages on Articles 98 and 101 of the Ley Orgánica del Ambiente and Article 52 of the Ley de Uso, Manejo y Conservación de Suelos. Section 98 of the Ley Orgánica del Ambiente, No. 7554 of October 4, 1995, provides as follows: “ARTICLE 98.—Attribution of environmental damage. Damage to or pollution of the environment may be caused by acts or omissions and shall be attributable to all natural or legal persons who cause it.” Section 101 of the same body of law, in turn, establishes the joint and several civil liability of all participants, whether natural or legal persons and regardless of the form of their participation, for the losses and damage caused by violations of the Ley Orgánica del Ambiente or of laws governing environmental and biological-diversity protection, as well as the liability of the owners of businesses or activities where the damage occurs.

Section 52 of the Ley de Uso, Manejo y Conservación de Suelos, No. 7779 of April 30, 1998, provides that: “Any person who pollutes or degrades soil resources, regardless of the existence of negligence or intent or the degree of participation, shall be liable, in the appropriate judicial proceedings, to pay compensation and to repair the damage caused to the environment and affected third parties” (underlining not in the original). The appellant is correct in asserting that the cited provisions support the existence of strict civil liability for environmental damage, particularly section 52 of the Ley de Uso, Manejo y Conservación de Suelos, which expressly provides that such liability exists regardless of intent or negligence. Thus, the attribution criterion for strict civil liability in environmental matters is solely participation, in any form, by natural or legal persons in an act or omission causing damage, or ownership of a business or activity where the damage occurs.

Considerations as to whether the conduct was intentional or negligent are irrelevant to civil liability in environmental matters. With respect to the elements of strict civil liability and how it differs from fault-based civil liability (responsabilidad civil subjetiva), appellate case law has held as follows: “With regard to liability, two broad categories may be identified: fault-based liability, which requires the existence, and consequent proof, of intent or negligence on the part of the person who caused the damage (e.g., section 1045 of the Código Civil); and strict liability, which is characterized essentially by dispensing with those elements, with attribution of the damage serving as the central basis upon which the duty to provide reparation is founded. (...) It is also important to consider, because of its influence on evidentiary matters, that the elements determining the existence of civil liability, whether fault-based or strict, are: harmful conduct (which may be active or passive, lawful or unlawful), the existence of damage (that is, injury to a legally protected interest), a causal link connecting the two foregoing elements, and, in most cases, verification of an attribution criterion, which will depend on the specific legal regime” (Sala Primera de la Corte Suprema de Justicia, judgment No. 1098-2009 at 2:45 hours on October 22, 2009.

Every form of liability requires the existence of conduct, whether active or passive, the existence of damage, and a causal relationship connecting the conduct to the damage. In this specific case, the State’s representative seeks to have the judgment vacated insofar as it rejected the civil action for damages, so that judgment may be entered against the civil defendants (D and […] Sociedad Anónima) based exclusively on the finding that damage occurred, without any act or omission in which the civil defendants participated in any form, and without application of the attribution criterion that they were the owners of the business or activity that caused the damage. Without conduct, it is likewise impossible to establish the causal relationship required for strict civil liability. Because the facts underlying the civil action for damages were not proven in the challenged judgment and the trial court’s determination was not challenged, the civil action for damages lacks a factual basis to which the effects of the legal provisions allegedly violated through disregard or failure to apply them could attach.

In the absence of an act or omission by the civil defendants that caused environmental damage, determining the existence of such harm serves no purpose because that finding alone is insufficient to establish strict civil liability. Consequently, the appellant’s claim of inadequate reasoning, based on the failure to assess evidence establishing the existence of the damage, caused no prejudice in this particular case. As stated supra, the appellant himself acknowledged in his closing arguments at trial that, although damage had been proven, its commission could not be attributed to the defendant, which was the form of attribution of damage asserted in the civil complaint. In agreement with the State’s representative, the Trial Court found that the allegations in the indictment had not been proven (cf. recording of the judgment beginning at 15:04:25 hours). The civil defendants therefore could not be held liable as the persons who caused environmental damage, because the judgment would be clearly contradictory, having found that the civil defendants committed no act or omission whatsoever.

Nor could the civil plaintiffs be held liable as owners of the business or activity in which the damage occurred, because the judgment would be inconsistent with the pleadings, insofar as no factual basis supporting that form of attribution of environmental damage was alleged. Accordingly, the appeal on points of law before this Court must be rejected.

POR TANTO:

The appeal on points of law filed by Mr. [Nombre5], representing the State, is rejected.

Intervienen en la decisión del recurso, los Jueces [Nombre1] Arturo Camacho Morales, Jorge [Nombre2] [Nombre3] [Nombre4] y David Fallas Redondo. Se apersonan en casación, el licenciado [Nombre5] , Procurador adjunto.

RESULTANDO:

  1. 1Que mediante sentencia número 67-P-11 de las catorce horas con cincuenta y cinco minutos del siete de marzo de dos mil once, el Tribunal de Juicio de Puntarenas, resolvió: "POR TANTO: De conformidad con lo expuesto, reglas de la sana crítica y artículos 39 y 41 de la Constitución Política, 1, 11, 50, 71, 103 del Código Penal; 1, 6, 9, 320, 341, 343, 360-361, 366, Código Procesal Penal, 1046, 1045, 1048 del Código Civil. El Tribunal acuerda: ABSOLVER DE TODA PENA Y RESPONSABILIDAD al encartado D del delito de INFRACCIÓN LEY FORESTAL como cometidos en perjuicio de LOS RECURSOS NATURALES. En cuanto a la acción civil resarcitoria, la misma se declara sin lugar, eximiendose el pago de las costas para ambas partes. Se levanta cualquier medida cautelar que existiera dentro del proceso en contra del encartado. Quedan debidamente notificada las partes en este acto" (sic).
  2. 2Que contra el anterior pronunciamiento,el licenciado [Nombre5] , Procurador adjunto, interpuso recurso de casación.
  3. 3Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 464 bis del Código Procesal Penal, el Tribunal procedió a conocer del recurso.
  4. 4Que en los procedimientos se han observado las prescripciones legales pertinentes.

Redacta el Juez de apelación de sentencia [Nombre6] ; y,

CONSIDERANDO:

Ú [Nombre7]. - El licenciado [Nombre5] , Procurador Adjunto, en representación del Estado que figura como Actor Civil, interpuso recurso de casación contra la sentencia Nº 67-P-11 del Tribunal de Juicio de Puntarenas, únicamente en contra de la absolutoria civil. En el primer motivo aduce que el Estado demandó civil y solidariamente al imputado como a la sociedad […] S. A., propietaria registral del fundo, donde de acuerdo con la acusación, se produjo una tala ilegal y una invasión de un área de bosque para la construcción de un rancho dentro de un ecosistema boscoso. Pese a que se aportó prueba que especifica los daños causados, tanto documental como testimonial, el Tribunal omitió del todo valorarla y analizarla, causándose un agravio al actor civil y ni siquiera se valoró la posibilidad de restituir las cosas al estado anterior al tenor de lo previsto en el numeral 366 del Código Procesal Penal.

Agrega también que sobre este tema existe jurisprudencia del Tribunal de Casación Penal que ha señalado que aún en casos en donde el imputado es absuelto penal e incluso civilmente, ha ordenado restituir, incluso de oficio la afectación de un ecosistema boscoso, cuando su daño ha sido acreditado. Se solicita la anulación de la absolutoria civil y el consecuente reenvío para nueva sustanciación de la cuestión civil. En el segundo motivo del recurso, se reclama violación de los artículos 50 de la Constitución Política, artículos 2 inciso d, 19, 20, 58 inciso a) y 61 inciso a) de la Ley Forestal, artículo 52 de la Ley de Uso del Suelo (Nº 7779 de 30 de abril de 1998). El Tribunal rechazó la condena civil indicando que no era viable por que el mismo Estado había solicitado la absolutoria del imputado y porque el delito es un presupuesto fundamental para la condenatoria civil, criterio que está superado por la jurisprudencia de casación emitida, que de acuerdo con la hermenéutica que con respecto al marco normativo citado.

De acuerdo con dicha jurisprudencia, según la normativa indicada, en nuestro ordenamiento rige la responsabilidad civil objetiva en materia ambiental, por lo que basta acreditar un daño ambiental, derivado de los parámetros o criterios de imputación definidos por ejemplo en la Ley Orgánica del Ambiente, que en su artículo 98 establece que el daño ambiental puede producirse por acción u omisión y este le resulta imputable a todas las personas físicas y jurídicas que lo realicen. Lo anterior complementado con lo prescrito en el artículo 101 de la misma Ley, que dispone que son solidariamente responsables por los daños y perjuicios causados, los titulares de las empresas o las actividades donde se causen los daños, ya sea por acción o por omisión. . Lo anterior se complementa con Ley de Uso y Conservación de Suelos, que establece que habrá responsabilidad civil por el daño causado al recurso suelo; independientemente de que exista culpa o dolo, a indemnizar lo que corresponda y a reparar los daños causados al ambiente.

Toda la normativa citada fue ignorada en la sentencia. El daño ambiental causado al bosque ni siquiera fue objeto de ponderación. Además se causó violación al principio de irreductibilidad del bosque contenido en la ratio legis de la Ley Forestal. Los motivos expuestos, a pesar de ser uno por la forma y el otro por el fondo, se resuelven conjuntamente debido a que las razones para su rechazo son comunes. Lleva razón el recurrente al afirmar que la absolutoria penal no necesariamente conlleva la declaratoria sin lugar de la acción civil resarcitoria, lo que incluso se encuentra previsto expresamente en el párrafo último del numeral 40 del Código Procesal Penal que dispone lo siguiente "La sentencia absolutoria no impedirá al Tribunal pronunciarse sobre la acción civil resarcitoria válidamente ejercida, cuando proceda." No obstante lo anterior, en el presente caso no podría existir un pronunciamiento estimatorio de la acción civil resarcitoria, porque el mismo sería contradictorio e incongruente.

Las pretensiones civiles tienen como sustento fáctico exactamente los mismos hechos de la acusación (cfr. folios 1 a 6 del legajo de acción civil resarcitoria y acusación de folios 207 a 214 del principal). Los hechos de la acusación y por lo tanto, los del reclamo civil, se tuvieron en la sentencia impugnada como indemostrados (cfr. minuta de sentencia de folio 557). En el recurso de casación, el impugnante no esgrime motivo alguno que pretenda atacar la determinación de hechos que realizó el a quo, conformándose con la absolutoria dictada en el aspecto penal, absolutoria que fue solicitada por el recurrente en las conclusiones del debate, fundamentando su solicitud de la siguiente manera: "Se ha probado daño ambiental pero no es posible atribuir autoría al imputado. No existe ninguna prueba legítima que vincule a D con la comisión de dicho ilícito. No existe responsabilidad objetiva en penal como sí existe en material ambiental." (cfr. grabación de la sentencia a partir de las 10:41:21horas).

El licenciado [Nombre5] fundamenta la solicitud de que se anule la sentencia en lo concerniente al rechazo de la acción civil resarcitoria, en la Ley Orgánica del Ambiente, artículos 98 y 101 y en la Ley de uso, Manejo y Conservación de Suelos, artículos 52. El numeral 98 de la Ley Orgánica del Ambiente, Nº 7554 de 4 de octubre de 1995, dispone lo siguiente: "ARTICULO 98.- Imputación por daño al ambiente. El daño o contaminación al ambiente puede producirse por conductas de acción u omisión y les son imputables a todas las personas físicas o jurídicas que la realicen." Por su parte, el numeral 101 del mismo cuerpo de leyes, establece la responsabilidad civil solidaria respecto de los daños y perjuicios causados, de todos los partícipes (personas físicas o jurídicas), en cualquiera de sus formas, causantes de las infracciones a la Ley Orgánica del Ambiente, o las que regulan la protección del ambiente y la diversidad biológica, y también de los titulares de las empresas o las actividades donde se causen los daños.

Por su parte el numeral 52 de la Ley de Uso, Manejo y Conservación de Suelos, Nº 7779 de 30 de abril de 1998 dispone que "Quien contamine o deteriore el recurso suelo, independientemente de la existencia de culpa o dolo o del grado de participación, será responsable de indemnizar, en la vía judicial que corresponda, y de reparar los daños causados al ambiente y a terceros afectados" (el subrayado no pertenece al original). Lleva razón el recurrente cuando afirma que de la normativa citada es posible deducir la existencia de una responsabilidad civil objetiva por daños al medio ambiente, particularmente del numeral 52 de la Ley de Uso, Manejo y Conservación de Suelos, que expresamente dispone que dicha responsabilidad existe independientemente de dolo o culpa, de manera que, el criterio de imputación de la responsabilidad civil objetiva, en materia ambiental, lo es únicamente la participación en cualquiera de sus formas en una acción u omisión por parte de personas físicas o jurídicas, causante de un daño o ser el titular de una empresa o actividad donde se cause el daño.

Consideraciones en torno a si la conducta fue dolosa o culposa, son ajenas a la responsabilidad civil en materia ambiental. En relación con los elementos de la responsabilidad civil objetiva y su diferencia con la responsabilidad civil subjetiva, se ha pronunciado la jurisprudencia de casación de la siguiente manera: "En lo que se refiere a la responsabilidad, se pueden ubicar dos grandes vertientes, una subjetiva, en la cual se requiere la concurrencia, y consecuente demostración, del dolo o culpa por parte del autor del hecho dañoso (v.gr. el cardinal 1045 del Código Civil), y otra objetiva, que se caracteriza, en lo esencial, por prescindir de dichos elementos, siendo la imputación del daño el eje central sobre el cual se erige el deber de reparar. (...) Asimismo, es importante considerar, por su influencia en el tema probatorio, que los elementos determinantes para el surgimiento de la responsabilidad civil, sea esta subjetiva u objetiva, son: una conducta lesiva (la cual puede ser activa o pasiva, legítima o ilegítima), la existencia de un daño (es decir, una lesión a un bien jurídico tutelado), un nexo de causalidad que vincule los dos anteriores, y en la mayoría de los casos la verificación de un criterio de atribución, que dependerá del régimen legal específico" (Sala Primera de la Corte Suprema de Justicia, sentencia Nº 1098-2009 de las 2:45 horas del 22 de octubre de 2009.

En cualquier forma de responsabilidad, es presupuesto de la misma, la existencia de una conducta que puede ser activa o pasiva, la existencia de un daño y de una relación de causalidad que vincule la conducta con el daño. En el caso concreto, el representante estatal pretende que se anule la sentencia en cuanto rechazó la acción civil resarcitoria, para que se condene a los demandados civiles (D y […] Sociedad Anónima) a partir exclusivamente de la constatación de un daño, sin conducta activa u omisiva en la que hubieran participado en cualquiera de sus formas, los demandados civiles, ni en el criterio de imputación de ser los titulares de empresa o actividad causante del daño. Sin conducta tampoco es posible establecer la existencia del presupuesto de la responsabilidad civil objetiva de la relación de causalidad. Al no haberse demostrado en la sentencia impugnada los hechos de la acción civil resarcitoria, ni haberse atacado la determinación realizada por el a quo, la acción civil resarcitoria carece de sustento fáctico respecto del cual se puedan establecer los efectos de las normas jurídicas cuya violación por desconocimiento o no aplicación se reclama.

Sin conducta activa u omisiva realizada por los demandados civiles, causante de un daño al medio ambiente, carece de todo interés determinar la existencia de ese perjuicio, porque ello es insuficiente por sí mismo, para declarar una responsabilidad civil objetiva, de manera que el reclamo que hace el impugnante de falta de fundamentación, por no haber valorado elementos probatorios que determinaban la existencia del daño, en el caso concreto no produjo perjuicio alguno. El mismo recurrente admitió en las conclusiones del debate, como se indicó supra, que si bien se probó un daño, no era posible atribuir autoría al imputado, que es la forma de imputación del daño que se pretendió hacer valer con la demanda civil. El Tribunal de Juicio, coincidiendo con la representación estatal, tuvo por indemostrados los hechos de la acusación (cfr. grabación de la sentencia a partir de las 15:04:25 horas), de manera que no podría condenarse a los demandados civiles como autores de daño ambiental, porque la sentencia resultaría claramente contradictoria, porque tuvo por demostrado que los demandados civiles no realizaron conducta activa u omisiva alguna; por otro lado, no podría condenarse a los actores civiles como titulares de la empresa o actividad en la que se produjo el daño, porque la sentencia sería incongruente, en el tanto no se planteó una base fáctica, que sustente dicha forma de imputación de daños ambientales. Así las cosas, se debe rechazar el recurso de casación que se conoce.

POR TANTO:
