DECISION NO. 0046-F-12 AGRARIAN COURT OF THE SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at fourteen hours and forty-two minutes on veinticuatro de enero del dos mil doce.- POSSESSORY TITLE PROCEEDINGS (DILIGENCIAS DE INFORMACIÓN POSESORIA) instituted by [Nombre1], of legal age, married once, agricultural engineer, identity card number CED1 - -, resident of Guápiles, Pococí, Limón. Appearing as parties are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented by Lydiana Rodríguez Paniagua in her capacity as Deputy Attorney General; and the INSTITUTO DE DESARROLLO AGRARIO, legal entity identification number CED2 - - -, represented by Carmelina Vargas Hidalgo, of legal age, divorced once, attorney, resident of Guachipelín de Escazú, identity card number CED3 - -. Attorney Carlos Mora Calvo, of legal age, married, attorney, resident of Guápiles, identity card number CED4 - -, acts as special judicial attorney-in-fact (apoderado especial judicial) for the petitioner. WHEREAS:

  1. 1The petitioner instituted these proceedings so that the following property may be registered in the Public Property Registry through this procedure: “... land consisting of mountain forest and scrubland, and an area on which a wooden house, a shed, and a large covered structure have been built. Located in Bella Vista de Guápiles, [Dirección1], in the province of Limón, described in cadastral plan number L-1317085-2009, with an area of six hectares four thousand five hundred twenty-seven square meters, bounded to the North by: [Nombre2]; to the South by: [Nombre3]; to the East by: [Dirección2], with frontage measuring one hundred two linear meters and seventy-six centimeters; and to the West by: an unnamed stream (a tributary of Río Blanquito)...” (folio 8)

  3. 3Ronald Rodríguez Cubillo, Judge of First Instance, ruled in a judgment issued at seven hours and twenty-three minutes on treinta y uno de marzo de dos mil once: “THEREFORE: In view of the foregoing, pursuant to the LEY DE INFORMACIONES POSESORIAS N° 139 of 14 de julio de 1941 and its amendments, these POSSESSORY TITLE proceedings instituted by [Nombre1], of legal age, married once, agricultural engineer, identity card number CED5, resident of Guápiles, Pococí, Limón, ARE APPROVED. The REGISTRO PUBLICO DE LA PROPIEDAD, Real Property Section, shall register in his name, without prejudice to third parties having superior rights and subject to the limitations established by the Ley de Caminos Públicos, Ley Forestal, Ley de Aguas, Ley de Conservación de Vida Silvestre, and Ley Orgánica del Ambiente, the property described below: land consisting of mountain forest and scrubland, and an area on which a wooden house, a shed, and a large covered structure have been built.Located in Bella Vista de Guápiles, [Dirección3], [Dirección4],, Pococí, in the province of Limón, described in cadastral plan number L-1317085-2009, with an area of six hectares four thousand five hundred twenty-seven square meters, bounded to the North by: [Nombre2]; to the South by: [Dirección5]; to the East by: [Dirección2], with frontage measuring one hundred two linear meters and seventy-six centimeters; and to the West by: an unnamed stream (a tributary of Río Blanquito). The property was appraised at the sum of ten million colones. A certified copy of this judgment shall serve to register the aforementioned property in the Property Registry. Such registration shall be made with notice to the titleholder that the area adjoining the streams or watercourses that exist or may exist along the boundaries or on the property of Mr. [Nombre4], as specified in Article 33 of Ley Forestal Nº 7575, constitutes a protected area (área de protección), and the cutting or removal of trees is prohibited.It shall likewise be recorded that the channels and waters of those watercourses are in the public domain (dominio público), as established by the Ley de Aguas, Article 1, subsection IV, and Article 3, subsection III. Also applicable are Articles 1, 2, 3, 4, 5, 6, and 7 of the Ley de Informaciones Posesorias and Articles 1, 2, 7, and 25 of the Ley de Jurisdicción Agraria, as well as the Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre, and Ley Orgánica del Ambiente. Once this ruling becomes final, the corresponding certified enforcement copy (ejecutoria) shall be issued and this matter shall be closed and archived,” (emphasis in the original at folio 164 verso to 165).-
  4. 4Lydiana Rodríguez Paniagua, in her capacity as Deputy Attorney General, filed an appeal (recurso de apelación), expressly stating the grounds on which it was based in order to challenge the trial court’s position (folios 168 to 187).-
  5. 5The statutory requirements have been observed in the conduct of the proceeding, and there are no apparent errors or omissions capable of rendering the judgment null and void.-

Drafted by Judge BOLAÑOS CÉSPEDES; and,

CONSIDERING

I.The proven facts of the judgment are adopted because they are consistent with the merits of the case. A proven fact numbered 12 of the same nature is added and shall read as follows: By an order issued at fourteen hours and fifteen minutes on veintisiete de abril dos mil seis, the applicant for title (titulante) was directed to modify plan L- 793355-89 of 21 de abril de 1989, twenty percent of which was located within the Reserva Forestal Cordillera Volcánica Central (certification at folio 4). He did so, registering plan L- 1317085-2009, which, according to the Certification issued by the Area de Conservación Tortuguero, is not located within any protected area (folio 18).-

II.The Procuraduría General de la República, through Lydiana Rodríguez Paniagua, appeals ruling No 35-11 of the Agrarian Court of the Second Judicial Circuit of the Atlantic Zone, issued at seven hours and twenty-three minutes on treinta y uno de marzo del dos mil once, based on the following grounds of appeal (agravios): 1. She states that, according to the evidence, part of the property for which title is sought is forested (mountain forest), and that forestlands and forests within national reserves are subject to the public domain and form part of the State’s natural heritage (patrimonio natural del Estado), at least since Ley Forestal 4465 of 1969, a public-domain status (carácter demanial) maintained by Ley 7575. She considers that, although Ley Forestal permits title to be obtained for properties outside protected wilderness areas (áreas silvestres protegidas), subject to the other conditions required for that purpose, the aforementioned declaration of public ownership must be taken into account, and that the period for acquiring title by adverse possession (usucapir) is consolidated from the time the property enters the State’s natural heritage. 2.

The witnesses’ statements do not establish ten years of possession sufficient for the petitioner personally to acquire title by adverse possession. She cites various legal authorities and case law in support. She concludes that, because title is sought to property belonging to the public domain, namely the State’s natural heritage, she requests that the aforementioned judgment be reversed.

III.Our country has at the apex of its legal system the Political Constitution, whose principles and rules inform the entire legal order. Constitutional Articles 45 and 50 are fundamental to the interpretation of these cases. The first paragraph of Article 45 establishes the right to private property. Constitutional interpretation has clarified that private property encompasses the bundle of rights inherent in that right, such as possession, usufruct, use, or habitation. Under our law, property rights are not absolute; they are subject to limitations in the public and social interest so that property may fulfill its social function. In this respect, Article 45 is harmonized with Article 50, which establishes the right of every inhabitant to a healthy and ecologically balanced environment. It has been said that this formulation of the provision leads us to recognize sustainable development (desarrollo sostenible) as a premise of our legal system because, although the right of all persons to acquire property is recognized, its use must also be balanced for the benefit of the community.

Por tanto, fundamental rights such as private property and the environment must be harmoniously balanced, with the understanding that our law protects access to property through all permitted means while imposing corresponding duties upon that power. Possessory-information proceedings (informaciones posesorias) are judicial proceedings through which authorization is granted to register property that, although already owned by a natural or legal person, does not meet the requirements for registration in the Property Registry and recognition vis-à-vis third parties through that mechanism. It is therefore clear that the person or company has already acquired the property by adverse possession (usucapión), having satisfied the requirements of Articles 853 and 854 of the Civil Code for ordinary adverse possession and Article 92 of the Land and Colonization Law for special agrarian adverse possession.

In the case of forest property (propiedad forestal), because of the particular function of this type of property—which is suitable both for production and for conservation—increasingly stringent limitations have been imposed upon its registration. In particular, forest possessors located within protected areas must also have consolidated their possession ten years before the respective declaration was issued; possessors of land outside such areas must demonstrate that they have protected the natural resource and that the boundaries of their property have been duly demarcated, in what has been termed ecological possession (posesión ecológica). The authorization to obtain title to forested property has prompted debate concerning the determination of the property’s legal nature—that is, whether it forms part of the State Natural Heritage (patrimonio natural del Estado), in which case it could not be transferred into private ownership, or whether title may be granted to it as private property subject to limitations.

The issue must be addressed through the three-dimensional view of law, namely from the axiological and normative perspectives and as fact. In other words, the legal system must be interpreted according to the threefold criterion of fact, value, and rule. The development of land-titling procedures in Costa Rica dates back to the time of independence. During the colonial period, the land belonged to the Spanish Crown, since all “discovered” lands were originally Crown lands (realengos); it was subsequently divided into various types of property. With respect to such lands, confirmation, composition, and public auction were available; within towns, areas were designated for grazing livestock, known as commons (dehesas), while municipal lands and revenues (propios y arbitrios) constituted a form of property belonging to the municipal councils, and allotments (suertes) were lands held and enjoyed individually.

Each house lot within the legally established town site (fundo legal) was individually accompanied by an allotment for cultivation, which could consist of one or two caballerías of farmland. As to forests, or woodlands according to the colonial classification, Law 5 of Title VVII of the Book of the Compilation of the Laws of the Indies provided that: “the use of all pastures, woodlands, and waters in the provinces of the Indies shall be common to all their current and future residents, so that they may freely enjoy them and build their huts beside any dwelling, and bring their livestock there, together or separately, as they wish...” (cited by Camacho, Revista de Ciencias Jurídicas, No 4, 1962). This situation continued during independence, and the legal fiction that lands belonged to the State—formerly the Crown—unless subject to private ownership was incorporated into the Civil Code, which provides: “Article 486: Immovable property not reduced to private ownership belongs to the State.” This provision is important because it has clearly established since 1886 that property belongs to the State if there is no owner who, in accordance with the law, has reduced it to private ownership.

The Civil Code already established the institution of adverse possession as a means of proving that right; subsequently, however, because of the country’s colonization needs and the existence of many landless farmers, particularly beginning in the second half of the nineteenth century, a series of special laws were enacted that allowed those farmers to claim and acquire ownership of the land they possessed upon satisfying a prescribed period of possession and working the land. (The parenthetical text is deleted (As early as 1839, Braulio Carrillo ordered the opening of a road toward the port of Moín and granted families settling in Pacuar, Reventazón and Pascua 25 pesos in cash during the first year so that they would establish themselves, and they could not transfer the lands until 5 years after cultivating them. Similarly, an 1840 law granted the farmers of Matina, Terraba and Sarapiquí ownership of the vacant State land (terreno baldío) that they cultivated within 5 years from that date along the roads of Térraba, matina and Sarapiquí)).

This legislation was later supplemented by other provisions establishing the possibility of filing land claims (denuncios), and a judicial procedure was even created for that purpose. Beginning in the twentieth century, this type of legislation became more robust with the Heads of Household Laws (leyes de Cabezas de Familia), which allowed farmers to acquire ownership of the lands they possessed as a means of encouraging the colonization of the country’s outlying lands. Those provisions shortened or extended the periods of possession independently of the provisions of the Civil Code, while always retaining the requirement of personal labor. All of them are antecedents of the 1941 Possessory Information Law (Ley de Informaciones Posesorias) and its amendments, as well as of so-called precarious possession (posesión en precario), which protects possession of land registered in the names of third parties where personal labor has been performed, thereby dignifying the value of labor.

As already noted, the Possessory Information Law permits the registration of forested land subject to certain regulations. Subsequent laws, such as the 1970 Multiple Land Titling Law (Ley de Titulación Múltiple tierras) and the 1996 National Reserve Land Titling Law (Ley de Titulación en Tierras de Reservas Nacionales) (subsequently declared unconstitutional), continued along this path by creating procedures, some administrative and others judicial, for titling national reserve lands. We have reviewed this history to confirm that legislation governing possession of forested land has been adjusted over time to the country’s needs and development, bringing lands under or removing them from special legal status by legislative will and under the aegis of the Constitution, according to the country’s own needs. At present, we must understand that sustainable development is the governing principle in our Social State under the Rule of Law (Estado Social de Derecho).

Article 1 of Ley Forestal 7575 clearly establishes the function of forest property by identifying as an essential and priority function of the State the duty to ensure the conservation, protection, and administration of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of appropriate and sustainable use of renewable natural resources. This confirms the sustainable-development perspective, in the sense that forests are suitable for conservation and production, provided that the principles of sustainability are respected. As to the ownership of such property, it is evident, because the Political Constitution so requires, that both public and private ownership are permitted. Consequently, the statement by the Office of the Attorney General of the Republic that all forested land within the national reserves has formed part of the State Natural Heritage since 1969 is technically, legally, and socially incorrect, since persons may have acquired vested rights (derechos adquiridos) over the so-called national reserve through various legal mechanisms and pursuant to public policy and legislation.

That concept, introduced in October 1961 by the Land and Colonization Law (Ley de Tierras y Colonización), replaced the concept of national vacant land (baldío nacional) used by the Fiscal Code and other laws from the first half of the twentieth century. The Land and Colonization Institute administered all reserves on behalf of the State for many years. Subsequently, when the concept of State Natural Heritage was expressly incorporated into Article 13 of Ley Forestal 7575, it was provided that all national reserves containing forests or forest land formed part of the State Natural Heritage. Because the Ministry of Environment, Energy and Telecommunications administers that heritage, the reserves must be divided between agricultural reserves, which continue to be administered by IDA, and forested reserves, which are administered by Minaet. However, as to the statement by the Office of the Attorney General of the Republic, the record contains no evidence that the possessed land forms part of the national reserves, and the Agrarian Development Institute does not indicate that this is the case (folios 68, 69).

Furthermore, according to the certification issued by the respective Conservation Area (folios 103-111), the survey plan (plano) that was ultimately the subject of titling (folios 103, 11) likewise does not concern land corresponding to protected wildlife areas (áreas silvestres protegidas). Accordingly, the applicable provision currently in force is Article 7 of the Possessory Information Law, which specifies the legal regime governing this land and supersedes any prior rules. Thus, it would be impossible to obtain title to land within protected wildlife areas where possession began less than ten years before the declaration of the protected area; when land lies outside those areas, title may be obtained upon ten years of possession of forested land or land of a forest nature, provided its boundaries have been duly demarcated and the natural resource has been protected. In this matter, it has been established that the required period of possession is ten years, because the petitioner corrected the survey plan on which the possessory-information proceeding was based, and the new survey plan lies entirely outside any protected wildlife area (proven fact twelve).

The witnesses presented are in agreement that the petitioner has possessed the land for more than ten years (folios 81,82,83). Thus, the witness [Nombre5] states at folio 82 that he has known the property since the year one thousand nine hundred eighty-eight, when he arrived in the area, and indicates that Mr. [Nombre1] has always been responsible for the property. Furthermore, [Nombre6] states that he has known the property for approximately twenty-five years, from when it was possessed by [Nombre7], who sold it to [Nombre1] (folio 83). Finally, the witness [Nombre8] states that he has known the property for twenty years and likewise knows of its sale by [Nombre7] to [Nombre1] (folio 84); there is also evidence that the soil has been put to optimal use, according to the INTA certification at folio 5. For that reason, the judgment on appeal must be affirmed.

POR TANTO

The judgment is affirmed.

VOTO Nº 0046-F-12 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las catorce horas cuarenta y dos minutos del veinticuatro de enero del dos mil doce.- DILIGENCIAS DE INFORMACIÓN POSESORIA establecido por [Nombre1] , mayor, casado una vez, ingeniero agrónomo, cédula de identidad número CED1 - - , vecino de Guápiles, Pococí, Limón. Intervienen como partes la PROCURADURÍA GENERAL DE LA REPÚBLICA representada por Lydiana Rodríguez Paniagua, en su condición de procuradora adjunta; y e l INSTITUTO DE DESARROLLO AGRARIO, cédula jurídica CED2 - - - , representado por Carmelina Vargas Hidalgo, mayor, divorciada una vez, abogada, vecina de Guachipelín de Escazú, cédula de identidad número CED3 - - . Actúa como apoderado especial judicial de la parte promovente el letrado Carlos Mora Calvo, mayor, casado, abogado, vecino de Guápiles, cédula de identidad CED4 - - . Tramitado ante el Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, Pérez Zeledón.

RESULTANDO:

  1. 1La parte promovente ha formulado las presentes diligencias para que por medio de esta vía se proceda a inscribir en el Registro Público de la Propiedad la finca que se describe así: "... terreno de montaña y charral y un área donde se encuentra construida una casa de madera y un galpón y galerón. Ubicado en Bella Vista de Guápiles, [Dirección1] , de la provincia de Limón, que se describe en el plano catastrado número L-1317085-2009, con una extensión de seis hectáreas cuatro mil quinientos veintisiete metros cuadrados, colinda al Norte: con [Nombre2] , al Sur: con [Nombre3] , al Este: con [Dirección2] con un frente de ciento dos metros con setenta y seis centímetros lineales, y al Oeste: con Quebrada sin nombre (afluente del Río Blanquito)..." ( folio 8)
  2. 2La Procuraduría General de la República se apersonó al proceso en los términos visibles a folios 58 a 64; y el Instituto de Desarrollo Agrario se apersonó en los términos visibles a folio 69.-
  3. 3El licenciado Ronald Rodríguez Cubillo, Juez de primera instancia, en sentencia de las siete horas y veintitrés minutos del treinta y uno de marzo de dos mil once, resolvió: "POR TANTO: Por lo expuesto, de conformidad con la LEY DE INFORMACIONES POSESORIAS N° 139 del 14 de julio de 1941 y sus reformas, SE APRUEBAN estas diligencia de INFORMACIÓN POSESORIA promovidas por [Nombre1] , mayor, casado una vez, ingeniero agrónomo, cédula de identidad número CED5 , vecino de Guápiles, Pococí, Limón. Proceda el REGISTRO PUBLICO DE LA PROPIEDAD, Sección Bienes Inmuebles, a inscribir a su nombre sin perjuicio de terceros de mejor derecho y con las limitaciones que establece la ley de Caminos Públicos, Ley Forestal, Ley de Aguas, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. La finca que a continuación se detalla: terreno de montaña y charral y un área donde se encuentra construida una casa de madera y un galpón y galerón.Ubicado en Bella Vista de Guápiles, [Dirección3] , [Dirección4], , Pococí, de la provincia de Limón, que se describe en el plano catastrado número L-1317085-2009, con una extensión de seis hectáreas cuatro mil quinientos veintisiete metros cuadrados, colinda al Norte: con [Nombre2] , al Sur: con [Dirección5] , al Este: con [Dirección2] con un frente de ciento dos metros con setenta y seis centímetros lineales, y al Oeste: con Quebrada sin nombre (afluente del Río Blanquito). Bien que fue estimado en la suma de diez millones de colones. Sirva la certificación de esta sentencia para inscribir en el Registro de la Propiedad la finca citada. Dicha inscripción se hace advirtiendo a su titulante que el área contigua a las quebradas o corrientes de agua que existen o puedan existir en las colindancias o en la propiedad del señor [Nombre4] y que señala el artículo 33 de la Ley Forestal Nº 7575, constituyen áreas de protección y queda prohibida la corta o eliminación de árboles.De igual forma se hace constar que el cauce y las aguas de esas corrientes son de dominio público, tal y como lo establece la Ley de Aguas, artículo 1, inciso IV, y 3, inciso III. Además artículos 1, 2, 3, 4, 5, 6, 7 de la Ley de Informaciones Posesorias y 1, 2, 7 y 25 de la Ley de Jurisdicción Agraria así como la Ley General de Caminos Públicos, Ley de Conservación de Vida Silvestre y Ley Orgánica del Ambiente. Una vez firme esta resolución, expídase la ejecutoria respectiva y archívese el presente asunto ", (lo destacado es del original a folio 164 vuelto a 165).-
  4. 4La licenciada Lydiana Rodríguez Paniagua en su condición de procuradora adjunta, interpuso recurso de apelación con indicación expresa de las razones en que se fundamenta para refutar la tesis del juzgado de instancia, (folios 168 a 187).-
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se nota la existencia de errores u omisiones capaces de producir la nulidad del fallo.-

Redacta el Juez BOLAÑOS CÉSPEDES, y;

CONSIDERANDO

I.Se prohijan los hechos probados de la sentencia por estar ajustados al mérito. Del mismo linaje se agrega un hecho probado 12 que dirá lo siguiente: Mediante resolución de las catorce horas quince minutos del veintisiete de abril dos mil seis se previno al titulante modificar el plano L- 793355-89 de 21 de abril de 1989, el cual se encontraba en un veinte por ciento dentro de la Reserva Forestal Cordillera Volcánica Central ( certificación de folio 4) lo que efectivamente realizó, inscribiendo el plano L- 1317085-2009, el cual conforme a la Certificación del Area de Conservación Tortuguero, no se encuentra dentro de ninguna área protegida ( folio 18).-

II.La Procuraduría General de la República a través de la Licenciada Lydiana Rodríguez Paniagua interpone recurso de apelación contra la resolución del Juzgado Agrario del Segundo Circuito Judicial de la Zona Atlántica, No 35-11 de las siete horas con veintitrés minutos del treinta y uno de marzo del dos mil once, con base en los siguientes agravios : 1. Indica que conforme la prueba, parte de la naturaleza del bien inmueble a titular es boscosa ( montaña) y que los terrenos forestales y bosque de las reservas nacionales están afectos a dominio público, patrimonio natural del Estado al menos desde la Ley Forestal 4465 de 1969 y carácter demanial que mantiene la Ley 7575. Considera que aun cuando la ley forestal permite titular inmuebles fuera de las áreas silvestres protegidas con las demás condiciones exigidas al efecto, ha de tenerse en cuenta la declaratoria de dominio público antes dicha y que el plazo para usucapir se consolida desde que el bien ingresa al patrimonio natural del Estado. 2. Las declaraciones de los testigos no demuestran posesión decenal apta para usucapir "en cabeza" del promovente. Señala diversa doctrina y jurisprudencia en su apoyo. Concluye que por pretenderse la titulación de bienes pertenecientes al dominio público como lo son el patrimonio natural del Estado solicita la revocatoria de la sentencia dicha.

III.Nuestro país, tiene en su vértice superior la Constitución Polìtica cuyos principios y normas informan todo el ordenamiento jurídico. Son fundamentales en la interpretación de estos casos los numerales 45 y 50 constitucionales. El artículo 45 establece en un primer párrafo el derecho a la propiedad privada. La interpretación constitucional ha permitido aclarar que cuando se habla de propiedad privada se incluye el haz de derechos que este derecho contempla, como por ejemplo la posesión, el usufructo, el uso, o la habitación. En nuestro derecho la propiedad no es absoluta, permite limitaciones de interés público e interés social, para cumplir con la función social de la misma. En este sentido se armoniza con el artículo 50, que establece el derecho de todo habitante a tener un ambiente sano y ecológicamente equilibrado.Se ha dicho que esta formulación de la norma, lo que nos conduce es a reconocer el desarrollo sostenible como premisa de nuestro ordenamiento, pues si bien se admite el derecho de todas las personas a acceder a la propiedad, por otra parte obliga a que ese uso, sea equilibrado en beneficio de la comunidad.

Por tanto, derechos fundamentales como la propiedad privada y el ambiente deben estar equilibrados armónicamente entendiendo que nuestro derecho tutela el acceso a la propiedad a través de todos los medios permitidos, pero establece a ese poder deberes correlativos. En el caso de las informaciones posesorias, se trata de diligencias judiciales por medio de las cuales se autoriza la inscripción de un bien, que si bien es ya propiedad de la persona física o jurídica , no tiene los requisitos para contar con inscripción registral y reconocimiento para terceros por medio de esa vía. Esta claro entonces que ya la persona o sociedad usucapión el bien, al cumplir los requisitos del 853 y 854 del Código Civil para la usucapión ordinaria y del 92 de la Ley de Tierras y Colonización para el caso de la usucapión especial agraria. Tratándose de propiedad forestal, por la particular función de este tipo de propiedad, la cual es apta tanto para producción como para conservación, se han impuesto mayores limitaciones progresivamente a su inscripción.

En particular se exige a los poseedores de bosque, si se encuentran en áreas protegidas que deben además haber consolidado su posesión, diez años antes de haberse hecho la declaratoria respectiva y en el evento de poseedores en tierras fuera de esas áreas, deben demostrar haber protegido el recurso natural y tener debidamente deslindado su finca, en lo que lo se ha denominado una posesión ecológica. Al permitirse la titulación de estos bienes con bosque, se ha dado un debate acerca de la determinación de la naturaleza jurídica del bien, es decir si el mismo es parte del patrimonio natural del Estado, en cuyo caso no podría trasladarse a la esfera privada o si se puede titular como bien privado sujeto a limitaciones. La discusión debe abordarse a través de la visión tridimensional del Derecho, a saber desde el punto de vista axiológico, normativo, y como hecho. En otra palabras interpretar, el ordenamiento desde el triple criterio, como hecho, valor y norma.

La evolución de los procesos para la titulación de tierras en Costa Rica datan desde el tiempo de la independencia. La tierra durante la colonia, pertenecía a la Corona Española, , pues todas las tierras " descubiertas" fueron originalmente realengos, luego fue seccionándose en diversos tipos de propiedad. Cabían con respecto a ellos la confirmación la composición, la pública subasta y en los pueblos, se contemplaron áreas para pastar el ganado, las llamadas dehesas, los propios y arbitrios que eran un género de propiedad de los ayuntamientos, las suertes que eran terrenos de propiedad y disfrute individual y en cada solar en el fundo legal correspondía individualmente una suerte para sembradío que podía ser de una o dos caballerías de tierras de labor. En cuanto a los bosques, o montes según la clasificación colonial, la Ley 5 del Título VVII del Libro de la Recopilación de Indias se dispuso que : " el uso de todos los pastos montes y aguas de las provincias de Indias sea común a todos los vecinos de ellas, que ahora son y que después fueren para que lo puedan gozar libremente y hacer junto a cualquier buhío sus cabañas, traer allí sus ganados, juntos o apartados, como quisiera..." (citado por Camacho Revista de Ciencias Jurídicas, No 4, 1962).

Esta situación se mantuvo durante la independencia y la ficción jurídica de que las tierras pertenecían al Estado, antes la Corona, si no estuvieran sujetas a propiedad particular, se incorporó en el Código Civil que establece : " Artículo 486: Los inmuebles no reducidos a propiedad particular pertenecen al Estado." . Esta norma es importante porque establece claramente desde 1886, que la propiedad, es estatal, si no hay dueño o dueña que conforme la ley la reduzca a propiedad particular. Ya el Código Civil establecía el instituto de la usucapión para acreditar ese derecho, pero luego en virtud de las necesidades de colonización del país, y ante la existencia de muchos labradores sin tierra, sobre todo a partir de la segunda mitad del siglo XIX, se promulgaron una serie de leyes especiales, que permitían a esos labradores, denunciar y hacerse dueños de los terrenos que poseían, con el cumplimiento de un tiempo de posesión y el trabajo..

( se elimina lo parentizado ( Ya desde 1839 Braulio Carrillo ordena abrir un camino en dirección al puerto de Moín y dota a las familias que se instalen en Pacuar, Reventazón y Pascua de 25 pesos en dinero el primer año, para que se establezcan y no podía enajenarlas sino 5 años después de cultivarlas. En el mismo sentido una ley de 1840 concede a los agricultores de Matina, Terraba y Sarapiquí la propiedad del terreno baldío que desde esa fecha en 5 años cultivasen sobre los caminos de Térraba, matina y Sarapiquí) . Esta legislación se complementó luego con otras normas que establecían la posibilidad de hacer denuncios y hasta se creó un procedimiento judicial para ello, . A partir del siglo XX ese tipo de legislación se hizo más vigoroso, con las leyes de Cabezas de Familia, que permitían al campesino hacerse dueño de los terrenos que poseía, ello como una forma de estimular la colonización de las tierras periféricas del país; en tales normas se reducían o ampliaban los plazos de posesión, al margen de lo establecido en el Código Civil , y se mantenía siempre la exigencia del trabajo personal.

Todas ellas son antecedentes de la Ley de Informaciones Posesorias de 1941 y sus reformas, aunque también de la llamada posesión en precario, que tutela la posesión en tierras inscritas a nombre de terceros, pero donde se ha dado un trabajo personal, dignificando el valor trabajo. . La ley de Informaciones Posesorias permite como ya vimos la inscripción de terrenos con bosque, bajo ciertas regulaciones. Otras leyes posteriores, como la Ley de Titulación Múltiple tierras de 1970, o la Ley de Titulación en Tierras de Reservas Nacionales de 1996 ( declarada posteriormente inconstitucional, ) continuaron por esta vía de crear procedimientos, algunos administrvos y otros judiciales para la titulación de tierras de reserva nacional. Este recorrido lo hemos hecho para confirmar que en materia de posesión sobre terrenos con bosque ha habido legislación que se ha ido ajustando a la época, y a las necesidades y evolución del país, afectando o desafectando terrenos, por la voluntad del legislador y bajo la égida constitucional, según las propias necesidades del país En la actualidad debemos comprender que en nuestro Estado Social de Derecho lo que que rige es el principio del desarrollo sostenible.

En el artículo 1 de la Ley Forestal 7575 se establece claramente la función de la propiedad forestal cuando se señala: como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. De esa manera se confirma la existencia de la visión de desarrollo sostenible, en el sentido de que los bosques son aptos para la conservación y la producción, a condición de que se respeten los principios de sostenibilidad. En el caso de la propiedad de esos bienes, es evidente por así ordenarlo la Constitución Política, que se admiten tanto la propiedad pública como privada de esos bienes; y por ello señalar, como lo hace la Procuraduría General de la República que todos los terrenos de las reservas nacionales con bosque son parte del patrimonio natural del Estado desde el año 1969, no es correcto ni técnica, ni jurídica ni socialmente, pues es posible que por diversos mecanismos legales, y en aplicación de la política pública y la legislación, las personas hayan adquirido derechos adquiridos sobre la llamada reserva nacional.

Ese concepto que se incorpora en octubre de 1961 con la Ley de Tierras y Colonización, sustituye el de baldío nacional utilizado por el Código Fiscal y otras leyes de la primera mitad del Siglo XX. El Instituto de tierras y Colonización administró a nombre del Estado todas las reservas, durante muchos años, luego, expresamente con el concepto de Patrimonio Natural del Estado que se incorporó en el artículo 13 de la Ley Forestal 7575, se dijo que todas las reservas nacionales con bosque o terrenos forestales era patrimonio natural del Estado. Al ser el Ministerio de Ambiente, Energía y Telecomunicaciones, quien administra ese patrimonio, las reservas deben ser seccionadas, las agrícolas que sigue administrando el IDA y las que tienen bosque por el Minaet. Ahora bien, en cuanto a la manifestación de la Procuraduría no hay prueba en el expediente de que el terreno poseído sea parte de las reservas nacionales, el Instituto de Desarrollo Agrario no indica tal circunstancia ( folios 68, 69). .

Por otra parte, conforme a la certificación del Area de Conservación respectiva, ( folios 103-111), el plano que al final fue objeto de la titulación, ( folios 103, 11) tampoco estamos en presencia de áreas que correspondan a áreas silvestres protegidas . Así las cosas , la norma vigente de aplicación es el artículo 7 de la Ley de Informaciones Posesorias, que indica cual es el régimen jurídico de estos terrenos, modificando cualquier normativa anterior. Así tendríamos que sería imposible titular terrenos en áreas silvestres protegidas con posesión menor a diez años a partir de la declaratoria de área protegida, en caso de estar dentro de esos terrenos, y los diez años de posesión en terrenos con bosque o de naturaleza forestal fuera de esas áreas, debidamente deslindados y en los que se haya protegido el recurso natural. En el presente asunto ha quedado claro que el plazo exigido de posesión es de diez años, pues el promovente corrigió el plano base de la información, y el nuevo plano se encuentra totalmente fuera de cualquier área silvestre protegida.

( hecho probado doce). Los testigos ofrecidos son contestes en que el promovente tiene más de diez años de poseer dichos terrenos ( folios 81,82,83). Así el testigo [Nombre5] a folio 82 indica que conoce la propiedad desde el año mil novecientos ochenta y ocho, porque desde ese año llegó a la zona y señala que don [Nombre1] siempre ha estado a cargo de la propiedad. Por otra parte [Nombre6] , señala que conoce la propiedad hace unos veinticinco años, cuando era poseída por [Nombre7] , quien le vendió a [Nombre1] (folio 83). Finalmente, el testigo [Nombre8] , manifiesta que conoce la propiedad desde hace veinte años e igualmente, sabe de la venta de [Nombre7] a [Nombre1] ( folio 84) y hay prueba de que se ha hecho uso óptimo del suelo, según la certificación del INTA de folio 5. Por tal razón lo procedente será confirmar la sentencia venida en alzada.

POR TANTO
