Goicoechea, at eight hours on nueve de mayo del dos mil once.- ORDINARY PROCEEDING, brought by [Nombre1], of legal age, widowed, a resident of Paquera, Puntarenas, holder of identity card number CED1 - -, a farmer by occupation.   1. 1The petitioner brings a possessory information proceeding (proceso de información posesoria) seeking registration in his name, in the Public Property Registry, of the property described as follows: “Nature: Pastureland and scrubland (tacotal). Location: San Rafael [Dirección1] in province six, Paquera, Puntarenas; boundaries: North: [Dirección2], South: [Nombre2], East: [Nombre3] and [Nombre4], West: [Nombre5] and [Nombre6]; area: tres hectáreas cuatro mil cuatrocientos cuarenta y tres metros con cuarenta y dos decímetros cuadrados. Survey plan P-cuatro ocho tres cuatro cinco cero-noventa y ocho...” (folio 10).-

THEREFORE: Based on the foregoing and the cited statutory provisions, the legal requirements set forth in Ley de Informaciones Posesorias Nº 139 de 14 de julio de 1941, as amended and supplemented, having been satisfied, the Public Property Registry is ordered to register the property that is the subject of this proceeding, free of encumbrances, real-property charges, and co-owners, without prejudice to third parties having superior rights, in the name of [Nombre1], whose personal particulars and domicile have already been stated. The unregistered land, located in San Rafael de Paquera, [Dirección3], [Dirección4] in the Province of Puntarenas, consists of land with irregular topography, level toward the front and steeply sloped toward the rear, planted with plantains and fruit trees and containing timber trees; its structures consist of a dwelling and a storage building; all its boundaries are fenced with Indian palm, Jinocuabe trees, and living Pochote posts; there are no springs (nacientes), and it neither borders nor is crossed by any river or stream.It is bounded on the North by a public road, with sixty-two linear meters and ten centimeters of frontage thereon; on the South by Amazonas Kidneywood Corporation Sociedad Anónima, represented by [Nombre7]; on the East by [Nombre3] and [Nombre4]; and on the West by [Nombre5] and [Nombre6]. The rights of possession (derechos de posesión) over the stated property were obtained from the transferor, [Nombre8], who is his son, of legal age, unmarried, holder of identity card Nº 06-0216-0444, a resident of San Rafael de Paquera, Puntarenas, [Dirección5] Pulpería Fabio Villalobos, by means of public deed number doscientos ochenta y nueve-seis, executed at diez horas del tres de junio de dos mil cinco, possession having been exercised quietly, publicly, and peacefully (Artículo 860 del Código Civil).The petitioner is advised that, in light of artículo número 27 de la Ley Forestal Nº 7575, the corresponding permit must be obtained to remove or cut trees, and good practices must be implemented to promote an optimal balance of natural resources and sustainable use of the forest. As to the public road bordering the property to be registered on the North, with frontage of veintiún metros treinta y tres centímetros lineales, in light of artículo número 19 inciso 1) de la Ley de Informaciones Posesorias, the property is subject to the statutory reservation likewise established by artículo 4 de la Ley General de Caminos Públicos. The notice related to this proceeding was duly published in judicial bulletin número 115 del 15 de junio del año 2007, and no third-party objections were raised. During the proceeding, testimony was received from [Nombre9], [Nombre10], and [Nombre11] to substantiate the possession exercised over the property.The adjoining landowners were notified of the existence of the proceeding, and none raised any objection or opposition. Once this judgment becomes final, issue the writ of enforcement for its registration with the Public Property Registry...” (folios 140 to 146).-
  4. 4Attorney Lydiana Rodríguez Paniagua filed an appeal expressly stating the reasons for challenging the trial court’s position. Folio 152.
  5. 5The statutory requirements have been observed in the conduct of the proceeding, and the judgment contains no apparent errors or omissions capable of rendering it null and void.-

Judge Vargas Vásquez drafts the opinion; and,

CONSIDERING:

I.The facts deemed proven in the appealed judgment are adopted, except for those identified as the third, eighth, and twelfth facts, because they constitute information properly belonging in the Background section of the judgment rather than facts relevant to approving this possessory information proceeding. The first fact is supplemented to state that a forested area exists on the property for which title is sought, and the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria at folio 49 is added as evidence supporting that fact).-

II.Attorney Lydiana Rodríguez Paniagua, Deputy Attorney General of the Procuraduría General de la República, filed an appeal against the judgment in a brief transmitted by fax on 13 DE OCTUBRE DE 2010 (folio 152). Her principal argument is that the property for which title is sought is forestland, as shown by the land-use certificate (certificado de uso de suelos), meaning that the property forms part of the national reserves subject to the public domain and, therefore, of the Patrimonio Natural del Estado, at least since Ley Forestal 4465 de 1969, artículo 33, as amended by Ley Forestal 7174 de 1990, artículos 32 y 33, a public-domain status (carácter demanial) maintained in Ley Forestal 7575, artículos 13 y 14. She adds that, although forestry legislation permits title to properties outside protected wilderness areas if the petitioner proves legitimate rights arising from ten years of possession, together with the other required conditions—having protected the resource and having the property duly demarcated—the aforementioned declaration placing forests within the public domain must be taken into account.

In her view, a harmonious interpretation of those provisions logically leads to the conclusion that title to forestland may be obtained only if acquisitive prescription (usucapión) had vested before the land entered the Patrimonio Natural del Estado by operation of law. As support for the foregoing, she cites the decisions issued by the Sala Constitucional in judgments 4587-97 and 16975-2008. Finally, she states that the witnesses’ testimony does not establish that the petitioner exercised the ten years of possession required for acquisitive prescription and therefore requests reversal of the appealed decision.-

III.The appellant disagrees with the judgment, arguing that the property for which title is sought forms part of the State Natural Heritage (Patrimonio Natural del Estado), and therefore belongs to the public domain (demanio público) and cannot be titled in the name of private parties. Pursuant to article 13 of Ley Forestal 7575, the State Natural Heritage consists of the forests and forestlands (terrenos forestales) of national reserves, areas declared inalienable, properties registered in its name, and properties belonging to municipalities, autonomous institutions, and other agencies of the Public Administration, except for real property securing credit transactions with the National Banking System that becomes part of their assets. Pursuant to sections 1 and 18 of that same legislation, research, training, and ecotourism activities may be carried out or authorized on property comprising the State Natural Heritage once approved by the Minister of Environment and Energy.

To determine whether the property for which title is sought forms part of the State Natural Heritage, it is necessary to establish whether the land is forested and whether the petitioner has acquired the property by adverse possession (usucapir) in compliance with the requirements established by the Ley de Informaciones Posesorias. Survey plan P-483450-98 states that the land consists of scrubland (tacotales) and pastureland (repastos) (folio 2), the same characterization indicated in the transfer document through which [Nombre8] sold to [Nombre1] the possessory rights (derechos posesorios) exercised over that property (folio 9), and in the initial filing submitted by the petitioner, which has the status of an affidavit (declaración jurada) (folio 10). Testimony was received from [Nombre9] , [Nombre10] and [Nombre11] , who stated that the property is used for agriculture and contains scrubland, fruit trees consisting of mango, orange, avocado, soursop, and lemon, and timber trees consisting of teak, laurel, pochote, and melina (folios 69 to 71).

The Court conducted a judicial inspection (reconocimiento judicial) of the property on 4 de febrero de 2010, recording the existence of agricultural crops, including fifty plantain plants, mango and guaba fruit trees, as well as guachipelín, laurel, and teak timber trees (folio 103). The foregoing evidence does not establish the existence of a forest; however, the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria stated that one portion of the property consists of “forest,” and the recommendations even included: “... In the steeply sloped area, preserve the existing natural forest.” (folio 49). In light of the foregoing, and because the latter constitutes technical evidence, this Court agrees with the appellant’s assertion regarding the forested nature of part of the property in dispute. Moreover, the record shows that the property in question is located outside any protected wildlife area (área silvestre protegida), regardless of its management category (categoría de manejo), administered by the Ministerio de Ambiente y Energía, now the Ministerio de Ambiente, Energía y Telecomunicaciones (folio 3).

Under these circumstances, the second paragraph of article 7 of the Ley de Informaciones Posesorias applies, pursuant to which properties containing forest and located outside protected areas may be titled, provided that the petitioner proves the exercise of possession for ten years, the protection of the forest resource (recurso forestal), and the proper demarcation of the property. The Court finds that this provision removed the properties in question from the public domain (desafectó), such that, if compliance with the foregoing requirements and those ordinarily required by the Ley de Informaciones Posesorias is established, such property may be titled in the names of private persons, contrary to the position of the State’s representative. It is important to note that the constitutionality of the cited article 7 was challenged before the Sala Constitucional, which, in voto 4587-97, rejected the constitutional challenge (Acción de Inconstitucionalidad), declaring unconstitutional only the interpretation followed by this Court at that time, under which titling required direct and personal possession of the property and excluded transferred possession.

Having clarified the foregoing, it is first necessary to determine whether the forest resource existing on the property has been protected. The most important evidence for determining this is the certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, which expressly stated: “this agency certifies that the property HAS BEEN USED in conformity with the land’s capacity for the activity carried out, in accordance with the approved methodology.” (folio 49). The capitalization appears in the original. The following recommendations were then added: “maintain adequate vegetation cover beneath the avocado crop and fertilize this plantation. In the steeply sloped area, preserve the existing natural forest.” (folio 49). It follows that if the recommendation is to maintain the existing natural forest, this means that it has been maintained, with no evidence that it was previously affected in any way.

In this regard, witness [Nombre9] stated: “I remember seeing it overgrown with brush in the past; it currently has teak timber trees, as well as mango, orange, and other fruit trees. It also has an area used as pastureland.” (folio 69). Petitioner [Nombre10] added: “The property was used for agriculture in the past; currently, most of it is scrubland, with a small patch of grass, and it also has planted timber trees such as pochote and laurel.” (folio 70). And [Nombre11] stated: “In the past, the property was used for livestock and agriculture, but it currently has a small area with pochote and melina timber trees, another area with fruit trees such as mango, avocado, soursop, and lemon, and another area consisting of brushland (charral), which is sometimes used for shelling beans.” (folio 71). These statements show that some of the areas formerly used as pasture and farmland are now maintained as brushland or used for pochote, laurel, and teak plantations.

This demonstrates a conservation-oriented approach, since brushland can readily develop into secondary forest; moreover, the recommendations issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria establish that the forested portion has been protected, thereby satisfying the forest-resource protection requirement referred to in article 7 of the Ley de Informaciones Posesorias. The demarcation requirement has likewise been met, since [Nombre9] stated: “The property is completely fenced with a living fence made of quick-stick posts and wire ...” (folio 69); [Nombre10] added: “The property is completely enclosed by a wire fence ...” (folio 70); and [Nombre11] added: “The property is completely enclosed by a fence made of wire and quick-stick wood ...” (folio 71). Finally, the Court finds that the remaining requirement—proof of the exercise of possession for ten years—has been met.

The possessory-information proceedings (diligencias de Información Posesoria) were filed with the Court on 24 de abril de 2006 (folio 10), meaning that the possession to be established dates from 24 de abril de 1996. As proof thereof, the document transferring possessory rights from [Nombre8] to [Nombre1] on 3 de junio de 2005 (folio 9) was submitted; it stated that the former transferred to the latter possession exercised publicly, peacefully, continuously, and under a claim of ownership for more than twenty years. Witness [Nombre9] stated that she had known the land for more than 15 years, that is, since octubre de 1993, when it belonged to [Nombre11] , who transferred it to [Nombre8] , who in turn transferred it to [Nombre1] , consistent with the information contained in the transfer document. Witness [Nombre10] stated that he had known the property for 20 years, that is, since octubre de 1978, and indicated that the first owner he knew was [Nombre12] , who sold it to [Nombre11] , who sold it to [Nombre8] , and finally [Nombre8] transferred it to his son, the petitioner (folio 70).

Finally, [Nombre11] stated that he had known the property for 40 years, that is, since octubre de 1968, and listed the property’s previous owners, in order, as [Nombre5] , [Nombre13] , [Nombre12] , himself, [Nombre8] , and finally the title applicant (titulante) (folio 71). All these statements are consistent with the information contained in the transfer document, thereby establishing that the petitioner and his predecessors in possession exercised public, peaceful, continuous possession under a claim of ownership. It therefore follows that the requirements established by article 7 of the Ley de Informaciones Posesorias and the other requirements prescribed therein have been met in this case.-

IV.For the foregoing reasons, pursuant to articles 7 and 11 of the Ley de Informaciones Posesorias, and 6, 26, 54 and 79 of the Ley de Informaciones Posesorias, the appealed ruling must be affirmed as to the matters challenged on appeal, with the understanding that the property to be titled consists in part of forest.-

THEREFORE

The judgment is affirmed as to the matters challenged on appeal, with the understanding that part of the property consists of forest.- [Nombre14] [Nombre15] ALEXANDRA ALVARADO PANIAGUA NOTE BY JUDGE [Nombre16] This note is issued to state that the case under review does not involve public-domain property, as the appellant claims, merely because part of the property is mountainous woodland. It should be noted that the property measures three hectares, one thousand four thousand four hundred forty-three square meters and forty-two square decimeters, consists of scrubland, and is not located within any protected area. Most of it is scrubland in nature; consequently, it is not a primary forest important for aquifer recharge to supply any population and therefore lacks the significant characteristic necessary to be considered public-domain property. Rather, it is a property regarding which the title applicant has demonstrated the exercise of acts of possession (actos posesorios).

The property is predominantly scrubland and therefore is not considered public-domain property; accordingly, I do not agree with the appellant’s arguments or with the reasoning set forth in the majority opinion regarding the use of article 7 of the Ley de Información Posesoria as the basis for calculating the ten-year period in this matter, since the property is predominantly agricultural in nature, with secondary forest. The ten-year possession period must therefore be calculated under the doctrine of ordinary agricultural possession (posesión agraria simple), without any need to assess the legislation governing forestland, for which possession and calculation of the ten-year period would be different if applied to the case under review.- [Nombre16] Nº EXPN1 Possessory Information Proceeding Petitioner: [Nombre1] li.++

POR TANTO: Con base en lo expuesto y artículos de ley citados, estando cumplidos los requisitos legales señalados en la Ley de Informaciones Posesorias Nº 139 de 14 de julio de 1941, sus reformas y adiciones, se ordena al Registro Público de la Propiedad proceder a la inscripción de la finca motivo de ésta diligencia, libre de gravámenes, cargas reales y condueños y sin perjuicio de terceros de mejor derecho, a nombre de [Nombre1] , de calidades y domicilio ya dichas, el terreno sin inscribir, situado en San Rafael de Paquera, [Dirección3] , [Dirección4] de la Provincia de Puntarenas, se trata de un terreno de topografía irregular, plano hacia el frente, con una fuerte inclinación hacia el fondo, cultivado de plátano y frutales, árboles maderables, tiene como construcción una vivienda y una bodega, se encuentra cercado en todas sus colindancias con palma india, árboles de Jinocuabe y postes vivos de Pochote entre, no existen nacientes, y no colinda con río ni quebrada, tampoco lo atraviesan, linda al Norte, con calle pública, con un frente a éste de sesenta y dos metros diez centímetros lineales; al Sur, con Amazonas Kidneywood Corporation Sociedad Anónima representada por [Nombre7] , al Este con [Nombre3] y [Nombre4] , y al Oeste, con [Nombre5] y [Nombre6] mide TRES HECTAREAS CUATRO MIL CUATROCIENTOS CUARENTA Y TRES METROS CON CUARENTA Y DOS DECIMETROS CUADRADOS según plano catastrado Nº P-483450-1998, los derechos de posesión sobre la finca indicada, los obtuvo del transmitente [Nombre8] quien es su hijo, es mayor, soltero, cédula de identidad Nº 06-0216-0444, vecino de San Rafael de Paquera, Puntarenas, [Dirección5] Pulpería Fabio Villalobos, mediante escritura pública número doscientos ochenta y nueve- seis de las diez horas del tres de junio de dos mil cinco, siendo el ejercicio de la posesión realizado en forma quieta, pública y pacífica (Artículo 860 del Código Civil).De advierte al promovente, que a la luz de lo dispuesto en el artículo número 27 de la Ley Forestal Nº 7575, para la eliminación de árboles o corta de éstos, deberá contar con el respectivo permiso, y deberá establecer buenas prácticas encaminadas a favorecer el equilibrio óptimo de los recursos naturales y el aprovechamiento sostenible del bosque, en cuanto a la vía pública con la cual colinda la finca objeto de inscripción por el rumbo Norte con un frente de veintiún metros treinta y tres centímetros lineales, a la luz de lo que señala el artículo número 19 inciso 1) de la Ley de Informaciones Posesorias, queda afecta a la reserva legal que de igual forma señala el artículo 4 de la Ley General de Caminos Públicos. El Edicto relacionado con esta diligencia fue debidamente publicado en el boletín judicial número 115 del 15 de junio del año 2007, no hubo objeción de terceros, en el trámite se recibieron los testimonios de [Nombre9] , [Nombre10] y [Nombre11] para justificar la posesión realizada sobre la finca.Los colindantes del inmueble fueron notificados de la existencia de la diligencia, ninguno de éstos formuló objeción u oposición. Expídase una vez firme la ejecutoria de esta sentencia para su inscripción ante el Registro Público de la Propiedad..." (folio140 a 146).-
  4. 4La Licenciada Lydiana Rodríguez Paniagua formuló recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del juzgado de instancia. folio 152.
  5. 5En la substanciación del proceso se han observado las prescripciones legales, y no se notan la existencia de errores u omisiones en el fallo capaces de producir nulidad.-

Redacta la jueza Vargas Vásquez; y,

CONSIDERANDO:

I.Se comparten los hechos tenidos por probados en la sentencia apelada, salvo los identificados como tercero, octavo y décimo segundo, al tratarse de información que es propia de los resultandos de la sentencia y no propiamente de hechos relevantes para la aprobación de esta Información Posesoria. Se adiciona al hecho primero que en el inmueble pretendido titular existe un sector de bosque y se adiciona como prueba a dicho hecho la certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria de folio 49).-

II.La licenciada Lydiana Rodríguez Paniagua, Procuradora Adjunta de la Procuraduría General de la República, interpuso recurso de apelación contra la sentencia, en memorial remitido por fax el 13 DE OCTUBRE DE 2010 (folio 152). En lo medular, alega, la naturaleza del inmueble a titular es de bosque, según se desprende del certificado de uso de suelos, lo cual significa que dicho bien es parte de las reservas nacionales afectas al dominio público y por ende del Patrimonio Natural del Estado, al menos desde la Ley Forestal 4465 de 1969, artículo 33, reformada por la Ley Forestal 7174 de 1990, artículos 32 y 33, carácter demanial que se mantuvo en la Ley Forestal 7575, artículos 13 y 14. Agrega, aún cuando la legislación forestal permite titular inmuebles fuera de áreas silvestres protegidas si el promovente demuestra sus legítimos derechos de posesión decenal, con las demás condiciones exigidas al efecto, haber protegido el recurso y tener el inmueble debidamente deslindado, ha de tenerse en cuenta la declaratoria de dominio público forestal antes dicha.

En su criterio, la interpretación armónica de dichas disposiciones lleva a concluir, en forma lógica, que los terrenos de bosque sólo podrán titularse si la usucapión se había consolidado antes de ingresar, por ley, al Patrimonio Natural del Estado. Cita como fundamento de los anterior, las resoluciones emitidas por la Sala Constitucional en votos 4587-97 y 16975-2008. Finalmente señala, las declaraciones de los testigos no demuestran la posesión decenal apta para usucapir de parte del promovente, por lo que pide se revoque la resolución apelada.-

III.La recurrente se muestra inconforme con la sentencia al estimar que el inmueble objeto de titulación forma parte del Patrimonio Natural del Estado, por lo que pertenece al demanio público y no se puede titular a nombre de particulares. De acuerdo al artículo 13 de la Ley Forestal 7575, el Patrimonio Natural del Estado está constituido por los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a municipalidades, instituciones autónomas y demás organismos de la Administración Pública, excepto inmuebles que garanticen operaciones crediticias con el Sistema Bancario Nacional e ingresen a formar parte de su patrimonio. Conforme a los numerales 1 y 18 de esa misma normativa, en los bienes que conforman el Patrimonio Natural del Estado se pueden realizar o autorizar labores de investigación, capacitación y ecoturismo, una vez aprobadas por el Ministro del Ambiente y Energía.

Para poder determinar si el inmueble pretendido titular forma parte del Patrimonio Natural del Estado, es necesario precisar si naturaleza del fundo es boscosa y si el promovente ha logrado usucapir dicho bien cumpliendo con los requerimientos establecidos por la Ley de Informaciones Posesorias. En el plano P-483450-98 se señala que el fundo es de tacotales y repastos (folio 2), misma naturaleza que se indica en el documento de traspaso mediante el cual [Nombre8] vendió los derechos posesorios ejercidos sobre dicho inmueble a [Nombre1] (folio 9) y en el escrito inicial presentado por el promovente, el cual tiene el carácter de declaración jurada (folio 10). Se recibió la declaración testimonial de [Nombre9] , [Nombre10] y [Nombre11] , quienes informaron que la finca está destinada a la agricultura, tacotales, árboles frutales de mango, naranja, aguacate, guanábana, limones, y árboles maderables de teca, laurel, pochote y melina (folios 69 a 71).

El Juzgado practicó un reconocimiento judicial del inmueble el 4 de febrero de 2010, en el que hizo constar la existencia de cultivos agrícolas, entre ellos cincuenta cepas de plátano, árboles frutales de mango, guabas, así como árboles maderables de guachipelín, laurel y teca (folio 103). De las probanzas anteriores no se deduce la existencia de bosque; no obstante, en la certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria se indicó, un sector del fundo está constituido por "bosque", e inclusive, entre las recomendaciones se agregó: "... En la zona de relieve escarpado conservar el bosque natural existente." (folio 49). Conforme a lo anterior, y siendo esta última una prueba técnica, comparte este Tribunal lo alegado por la recurrente acerca de la naturaleza boscosa de parte del inmueble en litis. Aunado a ello, consta en autos que el bien en referencia se localiza fuera de cualquier área silvestre protegida, sea cual sea su categoría de manejo, administrada por el Ministerio de Ambiente y Energía, actual Ministerio de Ambiente, Energía y Telecomunicaciones (folio 3).

Ante tal situación, resulta aplicable el párrafo segundo del artículo 7 de la Ley de Informaciones Posesorias, conforme al cual, es posible titular inmuebles con bosque ubicados fuera de áreas protegidas, siempre que la persona promovente acredite el ejercicio de la posesión durante diez años, haber protegido el recurso forestal y mantener debidamente delimitado el fundo. Estima el Tribunal que dicha norma desafectó los inmuebles en referencia, de forma tal que si se acredita el cumplimiento de los requisitos aludidos, más los exigidos ordinariamente por la Ley de Informaciones Posesorias, es posible titular tales bienes a nombre de personas particulares, contrario a lo señalado por la representante estatal. Es importante señalar la constitucionalidad del artículo 7 citado, fue cuestionada ante la Sala Constitucional, la cual en voto 4587-97 rechazó la Acción de Inconstitucionalidad planteada, declarando inconstitucional únicamente el criterio seguido por este Tribunal a ese momento, conforme al cual, para poder titular se exigía el ejercicio de la posesión directa y personal del fundo, excluyendo la posesión transmitida.

Aclarado lo anterior, es preciso determinar en primer orden si el recurso forestal existente en el fundo ha sido protegido. La prueba más importante para determinar lo anterior, la constituye la certificación emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, en la cual se indicó expresamente: "esta instancia certifica que en la finca SE HA EJERCIDO el uso conforme del suelo para la actividad que realiza de acuerdo con la metodología aprobada." (folio 49). Lo anotado con mayúscula es del original. Luego se agregaron las siguientes recomendaciones: "mantener una cobertura vegetal adecuada bajo el cultivo de aguacate y fertilizar esta plantación. En la zona de relieve escarpado conservar el bosque natural existente." (folio 49). De lo anterior se deduce que si la recomendación es mantener el bosque natural existente, eso significa que éste se ha mantenido, sin que conste que el mismo se haya afectado de alguna forma con anterioridad.

Al respecto, la testigo [Nombre9] señaló: "en el pasado recuerdo haberla visto encharralada, actualmente se tiene árboles maderables de teca, también frutales de mango, naranja y otros. También tiene una área destinada a repastos." (folio 69). El promovente [Nombre10] agregó: "La finca ha estado dedicada a la agricultura en el pasado, actualmente es en su mayor parte de tacotal y tiene un pedacito de pasto y además tiene madera sembrada como pochote y laurel." (folio 70). Y, [Nombre11] señaló: "La finca estuvo dedicada en el pasado a la ganadería y también a la agricultura, pero en la actualidad tiene una pequeña área de maderables de pochote y melina, otra área de frutales como mango, aguacate, guanábana y limones, otra área es de charral y que en ocasiones se usa para destapar frijoles." (folio 71). De tales declaraciones se desprende que parte de las áreas que anteriormente se destinaban a pastizales y agricultura, actualmente se mantienen como charrales o se destina a plantaciones de pochote, laurel y teca.

Lo anterior, evidencia una actitud conservacionista, puesto que el charral perfectamente puede convertirse en bosque secundario; además, de las recomendaciones dadas por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria se deduce, el sector de bosque ha sido protegido, cumpliéndose así con el requisito de protección del recurso forestal al que hace alusión el artículo 7 de la Ley de Informaciones Posesorias. Igualmente, se ha cumplido con la delimitación del fundo, pues [Nombre9] señaló: "La finca se encuentra totalmente cercada con cerca viva de postes de pega y con alambre ..." (folio 69), [Nombre10] agregó: "La finca se encuentra totalmente cercada con alambre ..." (folio 70); y, [Nombre11] agregó: "La finca se encuentra totalmente cercada con alambre y madera de pega ..." (folio 71). Finalmente, estima el Tribunal se ha cumplido con el restante requisito consistente en la acreditación del ejercicio de la posesión decenal.

Las diligencias de Información Posesoria se presentaron a estrados el 24 de abril de 2006 (folio 10), lo cual significa que la posesión a acreditar data del 24 de abril de 1996. Como prueba de ésta se presentó el documento de traspaso de derechos posesorios de [Nombre8] a [Nombre1] el 3 de junio de 2005 (folio 9), en el cual se indicó que el primero transmitía al segundo la posesión ejercida en forma pública, pacífica, ininterrumpida y a título de dueño por más de veinte años. La testigo [Nombre9] dijo conocer el terreno desde hace más de 15 años, es decir, desde octubre de 1993, fecha para la cual pertenecía a [Nombre11] , quien se la traspasó a [Nombre8] y éste a [Nombre1] , lo cual es coincidente con la información citada en el documento de traspaso. El testigo [Nombre10] dijo conocer el fundo desde hacía 20 años, es decir, desde octubre de 1978, e indicó, el primer dueño que conoció fue a [Nombre12] , quien le vendió a [Nombre11] , éste le vendió a [Nombre8] y finalmente, [Nombre8] se la traspasó a su hijo, el promovente (folio 70).

Finalmente, [Nombre11] dijo conocer la propiedad desde hace 40 años, sea desde octubre de 1968, citando como dueños anteriores del fundo, por su orden, a [Nombre5] , [Nombre13] , [Nombre12] , él mismo, [Nombre8] y finalmente, el titulante (folio 71). Todas esas declaraciones coinciden con la información citada en el documento de traspaso, verificándose así el ejercicio de la posesión pública, pacífica, ininterrumpida y a título de dueños, por parte del promovente y las personas que le antecedieron en la posesión del fundo. De ahí se concluya, se ha cumplido en este caso con los requerimientos dispuestos por el artículo 7 de la Ley de Informaciones Posesorias y demás requisitos dispuestos por ésta.-

IV.Por lo expuesto, con fundamento en los artículos 7 y 11 de la Ley de Informaciones Posesorias, 6, 26, 54 y 79 de la Ley de Informaciones Posesorias, deberá confirmarse la resolución recurrida en lo que ha sido objeto de apelación, en el entendido de que el inmueble a titular está constituido en parte por bosque.-

POR TANTO

Se confirma la sentencia en lo que ha sido objeto de apelación, en el entendido de que parte del inmueble está constituido por bosque.- [Nombre14] [Nombre15] ALEXANDRA ALVARADO PANIAGUA NOTA EXPUESTA POR LA JUEZA [Nombre16] Esta nota se expone en en el sentido de indicar el caso bajo examen no es de naturaleza demanial como lo afirma la apelante por el solo hecho de que el inmueble cuenta con una parte de montaña. Nótese, el inmueble tiene una medida de tres hectáreas mil cuatro mil cuatrocientos cuarenta y tres metros con cuarenta y dos decímetros cuadrados, es terreno de tacotales y no está dentro de alguna zona protegida. La mayor parte del mismo es de naturaleza tacotal, de allí implica no es se trata de un bosque primario de importancia de recarga acuífera para abastecer a alguna población de allí no tenga esa relevante característica para que sea considerado un bien demanial. Si no que se trata de un inmueble del cual se ha demostrado el ejercicio de actos posesorios por parte del titulante.

La naturaleza del inmueble es predominantemente tacotal, de allí no se considere sea un bien demanial, por lo que no se comparte los argumentos de la apelante, y tampoco los expuestos en el voto de mayoría con relación a tomar como referencia el artículo 7 de la Ley de Información Posesoria para hacer el conteo del plazo decenal este tema, pues la naturaleza del inmueble es predominantemente agrícola con bosque secundario, por lo que el conteo de la posesión decenal lo es bajo la tesitura de la posesión agraria simple, sin ser necesario entrar a valorar normativa que regula terrenos boscosos, cuya posesión y conteo decenal sería diferente al aplicar al caso bajo examen.- [Nombre16] Nº EXPN1 Información Posesoria Promovente: [Nombre1] li.++
