No. 402-2009-II SECCIÓN SEGUNDA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San José, at nine-oh-five a.m. on October ninth, two thousand nine.
This Tribunal hears, on appeal, acting as the nonhierarchical municipal superior (jerarca impropio municipal), the appeal filed by Nombre71629, identity card CED53250, against the resolution adopted by the Concejo Municipal de Osa in ordinary-session minutes number 51-2003 of 22 de diciembre del 2003, Article IV, which denied the land-use permit (permiso de uso de suelo) in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) requested by the appellant herein.
Judge Víquez Cerdas delivers the opinion; and,
CONSIDERING:
The following facts of relevance to resolving this matter have been duly established: 1) On 4 de diciembre de 2003, Mr. Nombre71629, identity card CED53250, requested that the Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa grant him a land-use permit for a parcel for which a concession (concesión) had been requested, located in Playa Tortuga, District 1, Canton 5, Province of Puntarenas. The application stated that the parcel has a declaration of suitability for tourism (declaratoria de aptitud turística), a concession application, a paid field inspection, and its voluntary fee (canon voluntario) is current (folios 1 to 8); 2) According to the minutes of ordinary session number 50-2003, held by the Concejo Municipal de Osa on 10 de diciembre de 2003, Article IV addressed the ratification of prior minutes. In Article VI, reports number 35-2003 of 6 de noviembre del 2003 and number 36-2003, held on 14 de noviembre de 2003, of the Comisión de Zona Marítimo Terrestre were read; neither report mentions any case related to Nombre71629 (see folios 297 and 298, 300 to 317); 3) At ordinary session 51-2003, held on 17 de diciembre del 2003 and ratified on 7 de enero del 2004, Chapter VI, the Concejo Municipal de Osa considered the report of the Comisión de Zona Marítimo Terrestre, Minutes 38-2003, which states as follows:
“2.- A TRANSCRIPT OF RESOLUTION NUMBER Placa11643 IS RECEIVED FROM THE DEPARTAMENTO DE SECRETARIA MUNICIPAL, WITH A COPY OF OFFICIAL LETTER AAA-877-2003 SENT BY LIC. MAURICIO CASTRO LIZANO, DEPUTY ATTORNEY OF THE PROCURADURÍA GENERAL DE LA REPÚBLICA, IN WHICH HE REPORTS THAT ON OCTOBER 31 LAST HE RECEIVED A SUBMISSION FROM MR. Nombre71630, IDENTITY CARD CED53250, SETTING FORTH A SERIES OF ACTIONS BY THE MAYOR AND MEMBERS OF THIS MUNICIPALITY’S COMISIÓN DE LA ZONA MARITIMO TERRESTRE THAT HE CONSIDERS CONTRARY TO THE COASTAL-STRIP REGIME (RÉGIMEN DE LA FRANJA COSTERA) FOLLOWING PUBLICATION IN LA GACETA NUMBER 45 OF 5 DE MARZO Placa11644 OF THE APPROVAL OF THE PLAN REGULADOR DE PLAYA BOCA CORONADO, WHICH HE DESCRIBES AS IMPRECISE WITH RESPECT TO THE MAP COORDINATES ON THE SHEET AND THE BOUNDARY-MONUMENT PLACEMENT (AMOJONAMIENTO) FOR THAT SECTOR BY I.G.N, PUBLISHED IN LA GACETA 74 OF 20 DE ABRIL DE 1997.
ON THAT BASIS, HE QUESTIONS THE VALIDITY OF THE CONCESSIONS GRANTED PURSUANT TO THAT PLAN REGULADOR AND RAISES 6 QUESTIONS PERTAINING TO THE PARTICULAR CASE. IN VIEW OF THE FOREGOING, HE REQUESTS THAT THE MEMBERS OF THE CONCEJO MUNICIPAL DE OSA, IF THE PRESENT MATTER INVOLVES ADMINISTRATIVE ACTS DECLARING RIGHTS (ACTOS ADMINISTRATIVOS DECLARATORIOS DE DERECHOS) THAT ARE TAINTED BY CLEAR AND MANIFEST NULLITY (NULIDAD EVIDENTE Y MANIFIESTA), FIRST SET THEM ASIDE BY FOLLOWING THE PROCEDURES ESTABLISHED IN ARTICLES 173, 308 AND FOLLOWING OF THE LEY GENERAL DE ADMINISTRACIÓN PÚBLICA AND DETERMINE THE LIABILITY OF THE OFFICIALS INVOLVED.
THE COMISIÓN DE ZONA MARÍTIMO TERRESTRE RECOMMENDS THE FOLLOWING TO THE CONCEJO MUNICIPAL DE OSA: AFTER ANALYZING THE COPY OF OFFICIAL LETTER AAA-877-2003 SENT BY LIC. MAURICIO CASTRO LIZANO, DEPUTY ATTORNEY OF THE PROCURADURÍA GENERAL DE LA REPÚBLICA, AND UPON REVIEW OF SHEET NUMBER 20 OF THE LAND-USE AND ROADWAY PLAN OF THE PLAN REGULADOR DEL SECTOR COSTERO NO TURISTICO DE BOCA CORONADO, DISTRITO PRIMERO CORTES, OSA.- THROUGH A VISUAL REVIEW OF THE PLAN REGULADOR, THE MEMBERS OF THE COMMISSION WERE ABLE TO VERIFY THAT THE COORDINATES IDENTIFYING THE BOUNDARY-MONUMENT PLACEMENT BY THE INSTITUTO GEOGRAFICO NACIONAL IN THE PUBLICATION MADE IN THE OFFICIAL GAZETTE LA GACETA NUMBER 74 OF MONDAY, 20 DE ABRIL DE 1.987, COINCIDE WITH THOSE INDICATED ON THE AFOREMENTIONED SHEET; WE THEREFORE CONSIDER THAT THE FOREGOING SHOULD BE COMMUNICATED TO THE ATTORNEY SO AS TO REBUT THE SUBMISSION FILED BY MR.
Nombre71630 AND, CONSEQUENTLY, THAT IT IS UNNECESSARY TO UNDERTAKE ANY ADMINISTRATIVE ACTION TO DECLARE NULL AND VOID ANY CONCESSION GRANTED PURSUANT TO THAT PLAN REGULADOR” (folio 62 and 62, 318 to 385); 4) The resolution described in the preceding proven fact is the only resolution from that session referring to Mr. Nombre71629 (folios 62 and 63, 318 to 385); 5) In Minutes number 40-2003 of 17 de diciembre del 2003, the Comisión de Zona Marítimo Terrestre de la Municipalidad de Osa considered the land-use application referred to in proven fact one above and resolved:
“2-A A DOCUMENT SUBMITTED BY MR. Nombre71629 IS RECEIVED, IN WHICH HE REQUESTS A LAND-USE PERMIT FOR A PARCEL FOR WHICH A CONCESSION HAS BEEN REQUESTED, LOCATED IN PLAYA TORTUGA, FIRST DISTRICT, CANTON OF OSA, PROVINCE OF PUNTARENAS (…) THE COMMISSION RECOMMENDS THE FOLLOWING TO THE CONCEJO MUNICIPAL DE OSA: MR. Nombre71629 SHALL BE INFORMED THAT, BECAUSE THERE IS NO DULY APPROVED PLAN REGULADOR IN THE AREA OF INTEREST AND SUCH REGULATION IS NECESSARY, THE REQUESTED LAND-USE PERMIT IS DENIED” (folio 363);
II.First, it must be made clear that, because of the disorder of the case file sent to this Tribunal and the errors made by the Secretaría de la Municipalidad de Osa when transcribing the resolution numbers, determining which act was challenged has taken considerable time, as this Court had to make repeated requests for all pertinent documentation to be provided, although it should have been included from the outset in the administrative record (legajo administrativo) that was transmitted. This was because the appeal was admitted against the resolution of the Concejo Municipal de Osa adopted at ordinary session number 50-2003, held on 17 de diciembre de 2003. However, the documentation provided shows that the minutes of ordinary session number 50-2003 held by the Concejo Municipal de Osa are dated 10 de diciembre de 2003, not 17 de diciembre, and, moreover, those minutes contain no resolution referring to Mr.
Nombre71629. The only resolutions mentioning the appellant herein are: a.- the resolution adopted at ordinary session 51-2003, held on 17 de diciembre del 2003 and ratified on 7 de enero del 2004, Chapter VI, which considered the report of the Comisión de Zona Marítimo Terrestre, Minutes 38-2003, concerning official letter AAA-877-2003 sent by Deputy Attorney Mauricio Castro Lizano regarding complaints filed by Mr. Nombre71631 about actions by the Mayor and the Comisión de la Zona Marítimo Terrestre de la Municipalidad de Osa that were considered contrary to the Plan Regulador de Playa Boca Coronado, specifically questioning the approval of concessions granted pursuant thereto. The Attorney asked the council members to set aside, in accordance with the procedure established by law, any acts tainted by absolute nullity (nulidad absoluta). In response, the Concejo Municipal stated that a comparison of sheet number 20 of the land-use and roadway plan of the Plan Regulador Costero no turístico de Boca de Coronado revealed no discrepancy with the coordinates indicated by the boundary-monument placement of the Instituto Geográfico Nacional and that the irregularities alleged by Mr. Nombre71629 did not exist; and b.- the resolution in ordinary-session minutes number 51-2003 of 22 de diciembre del 2003, Article IV, which denied the land-use permit.
III.There are therefore two sets of minutes bearing the same number (51-2003) but different dates, and neither corresponds to the resolution mentioned when the appeal was admitted. The confusion concerning which resolution this Tribunal must review on appeal, acting as the nonhierarchical superior, is therefore evident. To clarify the matter, the Court examined the submission in which Mr. Nombre71629 filed the motions for reconsideration and appeal (folios 108 to 110); he alleged therein that due process (debido proceso) had been violated because the challenged resolution was neither reasoned nor supported by grounds, and stated: “What remains to be seen is the matter of a request I made so that I might be granted a land-use permit while, through other channels, we determine the inconsistencies in the Council’s assessments, since by its actions it decides everything brought before it without analyzing the content thereof and, more seriously, allows itself to receive advice that appears to be prepared in another country, where there is pervasive ignorance regarding the maritime-terrestrial zone (Ley 6043 in Costa Rica), (…) The Sala Constitucional itself and the Procuraduría General de la República have indicated the applicable procedures for a LAND-USE PERMIT and that a PLAN REGULADOR need not exist (opinion C 100-95 and others), but that Municipality, in its Notice Minutes No. 40-0003 held on 17 de diciembre del 2003, provides no reasoning concerning what is known as the Binding Effect of Acts (Vinculancia de los Actos).
The transcript of Minutes No. 40 of 2003 of the Zona Marítimo Terrestre plainly demonstrates the lack of grounds, because the petition showed the Municipality not only the interest in that permit but also included the prevailing case law on the subject, consisting of the ADMINISTRATIVE CASE LAW (JURISPRUDENCIA ADMINISTRATIVA) itself; nevertheless, there is no statement of grounds or coherent explanation of the legal rule from which the decision rendered by the CONCEJO MUNICIPAL derives, particularly since the challenged article itself consists of the transcription and reading of a purported REPORT that was cloned, like all acts of that Commission, for countless persons associated with the undersigned, without any reasoning, a matter that will be argued before the Higher Authority (…)” (folio 109). The resolution admitting the appeal also states that the challenged act is the decision denying the land-use permit application (folio 15). It is therefore concluded that the challenged act is the resolution identified in item b.
IV- In a case similar to the present one, the Third Section of this Court, in Judgment No. 495-2006 issued at 10:40 on 1 de diciembre del 2006, stated: III).-IMPORTANCE OF THE MARITIME-TERRESTRIAL ZONE (ZONA MARÍTIMO TERRESTRE): In accordance with the provisions of section 1 of Ley 6043, the maritime-terrestrial zone is part of the national patrimony, and its protection is the responsibility of all public entities, whether state or non-state entities, and of all inhabitants of the country. The use and exploitation of that zone are possible only in the cases expressly provided for by that statute. In accordance with Article 39 of that law, a concession (concesión) is the appropriate legal mechanism for private exploitation of that public zone (Articles 41 and 39 of the law). The respective municipality is responsible for ensuring that concessions are granted in compliance with the law and its regulations, and a harmonious reading of both bodies of law establishes that, to grant a concession in the maritime-terrestrial zone, the following must exist: a declaration of suitability for tourism or non-tourism purposes by the Instituto Costarricense de Turismo or the Instituto de Desarrollo Agrario, as applicable; placement of boundary markers (amojonamiento) by the Instituto Geográfico Nacional; a regulatory plan (plan regulador); an appraisal by the Dirección General de Tributación Directa; an inspection of the land; publication of the notice; and preliminary construction plans submitted for consultation to the Instituto Nacional de Vivienda y Urbanismo and the Instituto Costarricense de Turismo regarding the construction of buildings and urban developments.
Section 38 of that statute categorically provides that “municipalities may not grant concessions in tourism zones unless the Instituto Costarricense de Turismo and the Instituto Nacional de Vivienda y Urbanismo have approved or prepared the development plans for those zones...” Without question, one of the essential functions of a regulatory plan is to establish the different types of uses in the coastal sector, with a view to protecting and sustainably developing that national asset. The issuance of a regulatory plan presupposes the prior completion of various technical studies, including an environmental impact study (estudio de impacto ambiental) (Article 17 of the Ley Orgánica del Ambiente), which strengthen the protection of that zone. Accordingly, the regulatory plan constitutes an appropriate instrument for ensuring an orderly process of development and exploitation of the maritime-terrestrial zone.
IV.-USE PERMITS AND OCCUPATION OF THE MARITIME-TERRESTRIAL ZONE: This Court must note that use permits (permisos de uso) may be granted in the maritime-terrestrial zone, conferring upon the applicant a precarious right (derecho de contenido precario) that may be revoked by the granting authority for reasons of expediency and advisability (Article 152 of the Ley General de la Administración Pública). Nevertheless, any use permit that may be granted is not equivalent to a right of occupation (derecho de ocupación) under the terms governed by the aforementioned law, and the voluntary payment of a “fee” (canon) confers no right whatsoever upon the appellant with respect to that zone. (…). V).-THE SPECIFIC CASE: In the case before us, the Municipalidad de Osa, in its capacity as administrator of the maritime-terrestrial zone, denied the use permit requested by the appellant, stating as the reason for that denial that the sector in which the parcel of interest to him is located lacks a regulatory plan—that is, an appropriate technical instrument governing land use (uso del suelo) that would strengthen its protection.
As noted above, the appropriate mechanism for the private exploitation of the maritime-terrestrial zone is a concession, which may be granted only after a regulatory plan is in place, and the local government may validly deny the use permit sought by the appellant in the absence of such an important technical instrument for fostering the sustained and orderly development of that national asset. (…) The Court finds that the lack of an adequate land-use planning instrument (instrumento de planificación de uso de suelo) in the sector where the parcel that the appellant seeks to exploit is located constitutes sufficient grounds to deny the requested permit. Consequently, the challenged decision complies with the applicable body of law (bloque de legalidad) and is supported by valid grounds (…)” There is no legal reason to depart from the foregoing standard, which fully applies to the case of Mr.
Nombre71629. The argument that, in connection with the concession application he submitted, the appellant was or was not authorized to place boundary markers on the lot of interest to him is irrelevant, since it does not overcome the obstacle posed by the absence of the regulatory plan cited as the basis for the challenged decision. Moreover, any concession application submitted by Mr. Nombre71629 is independent of the use permit at issue here, and a mere authorization to place boundary markers, if one was granted, confers no right upon him. No concession proceeding initiated by Mr. Nombre71629 and pending before the Municipalidad de Osa is the subject of this appeal; accordingly, this Court has nothing to say regarding its legality or compliance with legal requirements.
V.Nor does the fact that the motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) was not decided by the Council within the time limits established in Article 156 of the Código Municipal render the challenged decision null and void, as the appellant alleges, because, pursuant to the article of the Ley General de la Administración Pública, the Administration always has a legal duty to issue a decision.
VI.For the reasons stated above, the challenged decision is affirmed and, because no further appeal lies from this Court’s ruling, the administrative remedies (vía administrativa) are deemed exhausted.

No. 402-2009-II SECCIÓN SEGUNDA DEL TRIBUNAL CONTENCIOSO ADMINISTRATIVO. Segundo Circuito Judicial de San José, a las nueve horas cinco minutos del nueve de octubre de dos mil nueve.
Conoce este Tribunal en alzada, como jerarca impropio municipal, del recurso de apelación interpuesto por Nombre71629 , cédula CED53250, contra el acuerdo tomado por el Concejo Municipal de Osa, en el acta ordinaria número 51-2003 del 22 de diciembre del 2003, artículo IV, que denegó el permiso de uso de suelo en Zona Marítimo Terrestre, formulado por el aquí recurrente.
Redacta la Jueza Víquez Cerdas; y,
CONSIDERANDO:
De importancia para resolver el presente asunto, se tiene por bien demostrado lo siguiente: 1) Que el 4 de diciembre de 2003, señor Nombre71629 , cédula CED53250, solicitó al Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa, se le otorgara un permiso de uso de suelo, correspondiente a una parcela pedida en concesión, localizada en Playa Tortuga, Distrito 1, Cantón 5, de la Provincia de Puntarenas. Se indicó en la petición, que la parcela cuenta con declaratoria de aptitud turística, solicitud de concesión, inspección de campo cancelada y canon voluntario al día (folios 1 a 8); 2) Que conforme al acta de la sesión ordinaria número 50-2003, celebrada por el Concejo Municipal de Osa, el 10 de diciembre de 2003, en el artículo IV, se conoció de la ratificación de actas anteriores. En el artículo VI, se dio lectura a los informes de la Comisión de Zona Marítimo Terrestre, número 35-2003 de 6 de noviembre del 2003 y número 36-2003, celebrada el 14 de noviembre de 2003, en los cuales no se menciona ningún caso relacionado con Nombre71629 (ver folios 297 y 298, 300 a 317); 3) Que el Concejo Municipal de Osa, en la sesión ordinaria 51-2003, celebrada el 17 de diciembre del 2003, y ratificada el 7 de enero del 2004, capítulo VI, conoció el informe de la Comisión de Zona Marítimo Terrestre, Acta 38-2003, que dice lo siguiente:
“2.- SE RECIBE TRANSCRIPCIÓN DE ACUERDO NÚMERO Placa11643 EL DEPARTAMENTO DE SECRETARIA MUNICIPAL, EN EL QUE SE ADJUNTA COPIA DEL OFICIO AAA-877-2003 REMITIDO POR EL LIC. MAURICIO CASTRO LIZANO PROCURADOR ADJUNTO DE LA PROCURADURÍA GENERAL DE LA REPÚBLICA, EN EL QUE COMUNICA QUE HA RECIBIDO ESCRITO EL 31 DE OCTUBRE ULTIMO POR PARTE DEL SEÑOR Nombre71630 . CEDULA CED53250, EN LA QUE SEÑALA UNA SERIE DE ACTUACIONES POR PARTE DEL ALCALDE Y MIEMBROS DE LA COMISIÓN DE LA ZONA MARITIMO TERRESTRE DE ESTA MUNICIPALIDAD QUE ESTIMA CONTRARIAS AL RÉGIMEN DE LA FRANJA DE LA COSTERA A PARTIR DE LA PUBLICACIÓN EN LA GACETA NÚMRO 45 DEL 5 DE MARZO Placa11644 LA APROBACIÓN DEL PLAN REGULADOR DE PLAYA BOCA CORONADO, EL CUAL CALIFICA DE IMPRECISO CON RESPECTO A LAS COORDENADAS CARTOGRÁFICAS DE LA HOJA Y EL AMOJONAMIENTO PARA ESE SECTOR DEL I.G.N PUBLICADO EN LA GACETA 74 DEL 20 DE ABRIL DE 1997 ANTE ELLO CUESTIONA LA VALIDEZ DE LAS CONCESIONES OTORGADAS CON BASE EN ESE PLAN REGULADOR Y PLANTEA 6 INTERROGANTES ANTINENTES AL CASO PARTICULAR.
EN RAZÓN DE LO ANTERIOR SOLICITA A LOS SEÑORES REGIDORES DE LA MUNICIPALIDAD DE OSA, SI EN EL PRESENTE ASUNTO MEDIAN ACTOS ADMINISTRATIVOS DECLARATORIOS DE DERECHOS, VICIADOS DE NULIDAD EVIDENTE Y MANIFIETA, HABRÁ DE REMOVERLOS DE PREVIO, SIGUIENDO LOS TRAMITES QUE ESTABLECIDOS ARTÍCULOS 173, 308 Y SIGUIENTES DE LA LEY GENERAL DE ADMINISTRACIÓN PÚBLICA Y SENTANDO LAS RESPONSABILIDADES DE LOS FUNCIONARIOS IMPLICADOS.
LA COMISIÓN DE ZONA MARÍTIMO TERRESTRE RECOMIENDA AL CONCEJO MUNICIPAL DE OSA: LUEGO DE ANALIZADO COPIA DEL OFICIO AAA-877-2003 REMITIDO POR EL LIC. MAURICIO CASTRO LIZANO PROCURADOR ADJUNTO, DE LA PROCURADURÍA GENERAL DE LA REPÚBLICA, Y CON VISTA EN LA LÁMINA NÚMERO 20 DE PLAN DE USO DE SUELO Y VIALIDAD DE PLAN REGULADOR DEL SECTOR COSTERO NO TURISTICO DE BOCA CORONADO, DISTRITO PRIMERO CORTES, OSA.- DE LA REVISIÓN VISUAL DEL PLAN REGULADOR SE PUDO CONSTATAR POR LOS MIEMBROS DE LA COMISIÓN QUE LAS COORDENADAS QUE SEÑALAN EL AMOJONAMIENTO DEL INSTITUTO GEOGRAFICO NACIONAL EN LA PUBLICACIÓN REALIZADA EN EL DIARIO OFICIAL LA GACETA NÚMERO 74 DEL LUENS 20 DE ABRIL DE 1.987, COINCIDEN CON LAS QUE SE SEÑALAN EN LA CITADA LAMINA, POR LO CUAL CONSIDERAMOS QUE SE DEBE COMUNIAR LO ANTERIOS (sic) AL SEÑOR PROCURADOR PARA ASI DESVIRTUAR EL ESCRITO PRESENTADO POR EL SEÑOR Nombre71630 Y POR CONSIGUIENTE NO ES NECESARIO PROCEDER A NINGUNA ACTUACIÓN ADMINISTRATIVA PARA DECLARAR LA NULIDAD DE NINGUNA CONCESIÓN OTORGADA CON BASE A DICHO PLAN REGULADOR” (folio 62 y 62, 318 a 385); 4) Que el dicho en el hecho probado anterior, es el único acuerdo de esa sesión, que se refiere al señor Nombre71629 (folios 62 y 63, 318 a 385); 5) Que en el acta número 40-2003 del 17 de diciembre del 2003 de la Comisión de Zona Marítimo Terrestre de la Municipalidad de Osa, conoció de la solicitud de uso de suelo referida en el hecho primero anterior y acordó:
“2-A SE RECIBE DOCUMENTO PRESENTADO POR EL SEÑOR Nombre71629 , EN EL QUE SOLICITA PERMISO DE USO DE SUELO CORRESPONDIENTE A UNA PARCELA SOLICITADA EN CONCESIÓN, LOCALIZADA EN PLAYA TORTUGA, DISTRITO PRIMERO, CANTÓN OSA, PROVINCIA PUNTARENAS (…) LA COMISIÓN RECOMIENDA AL CONCEJO MUNICIPAL DE OSA LO SIGUIENTE: SE COMUNIQUE AL SEÑOR Nombre71629 , QUE POR NO EXISTIR PLAN REGULADOR DEBIDAMENTE APROBADO EN EL AREA DE INTERÉS Y SIENDO NECESARIO DICHA REGULACIÓN, SE DENIEGA EL PERMISO DE USO SOLICITADO” (folio 363);
II.En primer término, debe dejarse patente que ante el desorden del expediente que fue remitido a este Tribunal y los errores al momento de transcribir los números de acuerdo en que incurre la Secretaría de la Municipalidad de Osa, ha tomado mucho tiempo determinar cuál es el acto impugnado, porque este Despacho tuvo que gestionar varias veces para que se completara toda la documentación pertinente y que debió estar desde un inicio en el legajo administrativo remitido. Lo anterior debido a que el recurso de apelación fue admitido contra el acuerdo del Concejo Municipal de Osa, tomado en la sesión ordinaria número 50-2003, celebrada el 17 de diciembre de 2003. Pero de la documentación aportada, se tiene que el acta de la sesión ordinaria número 50-2003, celebrada por el Concejo Municipal de Osa, tiene fecha 10 de diciembre de 2003 y no 17 de diciembre, y además, no existe ningún acuerdo que se refiera al señor Nombre71629 en dicha acta.
Los únicos acuerdos que mencionan al aquí recurrente son: a.- el tomado en la sesión ordinaria 51-2003, celebrada el 17 de diciembre del 2003, y ratificado el 7 de enero del 2004, capítulo VI, que conoció el informe de la Comisión de Zona Marítimo Terrestre, Acta 38-2003, que se pronuncia sobre el oficio AAA-877-2003 remitido por el Procurador Adjunto Mauricio Castro Lizano, referente a denuncias presentadas por el señor Nombre71631 , sobre actuaciones por parte del Alcalde y de la Comisión de la Zona Marítimo Terrestre de la Municipalidad de Osa, que se estiman contrarias al Plan Regulador de Playa Boca Coronado, específicamente se cuestiona la aprobación de concesiones otorgadas a su amparo. El señor Procurador le solicita a los regidores que si existen actos viciados de nulidad absoluta, se procedan a removerlos según el procedimiento establecido por la ley. A lo anterior, el Concejo Municipal, contesta que confrontada la lámina número 20 del plan de uso de suelo y viabilidad del Plan Regulador Costero no turístico de Boca de Coronado, no existe divergencia con las coordenadas que señala el amojonamiento del Instituto Geográfico Nacional, y no existen las irregularidades denunciados por don Nombre71629 ; y b.- el acuerdo del acta ordinaria número 51-2003 del 22 de diciembre del 2003, artículo IV, que denegó el permiso de uso de suelo.
III.Se tienen entonces dos actas con número idéntico (51-2003) pero fecha diferente y no existe coincidencia con la resolución que se menciona al admitirse la alzada. Es entonces patente la confusión que se ha presentado, sobre cuál es el acuerdo que debe conocer este Tribunal en apelación, como jerarca impropio. Para dilucidar el problema, se acudió al memorial en que el señor Nombre71629 formuló los recursos de revocatoria con apelación (folios 108 a 110); ahí se alegó, que existía una violación al debido proceso, porque el acuerdo impugnado no estaba ni razonado ni fundamentado y expresó: “Lo que esta por verse es el hecho de una petición que solicitara a fin de que se me permita un permiso de uso mientras en otras vías determinemos las inconsistencias de las apreciaciones del Concejo por cuanto con sus actos resuelven todo lo que les indican sin analizar el contenido de las mismas y lo que es mas serio permitiéndose un asesoramiento que parece que se realiza en otro país en donde el desconocimiento imperante en la materia de zona marítimo terrestre (Ley 6043 en Costa Rica), (…) La misma Sala Constitucional y la Procuraduría General de la República han indicado los procedimientos imperantes en el PERMISO DE USO DE SUELO y que el mismo no es necesario que exista plan REGULADOR (dictamen C 100-95 y otros) pero dicha Municipalidad en su Acta de Comunicación No. 40-0003 celebrada el día 17 de diciembre del 2003 no razona en lo que se denomina Vinculancia de los Actos.
De la transcripción del Acta No. 40 del año 2003 de la Zona Marítimo Terrestre se ve a todas luces la falta de fundamentación ya que en la petitoria se le demostró a la Municipalidad no solo el interés en dicho permiso sino que se adjuntó la jurisprudencia imperante en la materia que la conforma la misma JURISPRUDENCIA ADMINISTRATIVA, pero sin embargo, no existe la fundamentación y la consistencia de que norma proviene la resolución determinada por el CONCEJO MUNICIPAL máxime de que el mismo artículo impugnado de la transcripción de la lectura de un supuesto INFORME que fue clonado como todos los actos de dicha Comisión a un sinnúmero de personas afines al suscrito sin un razonamiento que será discutido ante el Superior (…)” (folio 109). También en el acuerdo que admitió la alzada, se expresa que lo impugnado es la resolución que rechazó la solicitud de permiso de uso de suelo (folio 15). Por lo anterior, se concluye que lo impugnado es el acuerdo indicado en el punto b.
IV- En un caso similar al presente, la Sección Tercera de este Tribunal, en sentencia No. 495-2006 de las 10:40 horas del 1 de diciembre del 2006, expresó: III).-IMPORTANCIA DE LA ZONA MARÍTIMO TERRESTRE: De conformidad con lo establecido por el numeral 1º de la Ley 6043, la zona marítimo terrestre es patrimonio de la Nación y su protección corresponde a todos los entes públicos, sean estos estatales o no estatales y, a todos los habitantes del país. El uso y aprovechamiento de la referida zona, solo es posible en los casos en que expresamente lo dispone el referido cuerpo normativo. Ahora bien, de conformidad con lo establecido en el artículo 39 de la citada ley, la concesión es la figura idónea para el aprovechamiento particular de la referida zona pública (artículos 41 y 39 de la ley). Corresponde a la municipalidad respectiva velar por que el otorgamiento de concesiones cumpla con lo establecido en la ley y su reglamento y, de la integración armónica de ambos cuerpos normativos se desprende que, para otorgar concesión en la zona marítimo terrestre debe haber: declaratoria de aptitud turística o no turística por parte del Instituto Costarricense de Turismo o el Instituto de Desarrollo Agrario según corresponda, amojonamiento por el Instituto Geográfico Nacional, existencia de plan regulador, avalúo de la Dirección General de Tributación Directa, inspección del terreno, publicación del edicto, anteproyectos de construcción consultados al Instituto Nacional de Vivienda y Urbanismo y, al Instituto Costarricense de Turismo sobre la realización de edificaciones y urbanizaciones.
De manera categórica, el numeral 38 del citado cuerpo normativo señala que "las municipalidades no podrán otorgar concesiones en las zonas turísticas, sin que el Instituto Costarricense de Turismo y el Instituto Nacional de Vivienda y Urbanismo haya aprobado o elaborado los planos de desarrollo de esas zonas.." . Sin duda alguna, una de las funciones esenciales del plan regulador, es la de establecer los diferentes tipos de uso en el sector costero, con miras a la protección y desarrollo sostenible de ese bien de la Nación. La emisión de un plan regulador, supone la realización previa de diferentes estudios técnicos, incluyendo el estudio de impacto ambiental (artículo 17 de la Ley Orgánica del Ambiente), los que potencian la protección de la referida zona. Por ello, el plan regulador se constituye en un instrumento idóneo para que exista un proceso ordenado de desarrollo y aprovechamiento de la zona marítimo terrestre.
IV.-DEL PERMISO DE USO Y LA OCUPACIÓN DE LA ZONA MARÍTIMO TERRESTRE: Este tribunal debe señalar que, es posible otorgar permisos de uso en la zona marítimo terrestre, lo que otorga al administrado un derecho de contenido precario que puede ser revocado por la administración concedente por razones de oportunidad y conveniencia (artículo 152 de la Ley General de la Administración Pública). Ahora bien, el permiso de uso que pueda otorgarse, no equivale a un derecho de ocupación, en los términos que lo regula la ley tantas veces citada y, el pago de un "canon" voluntario, no otorga derecho alguno al recurrente sobre la referida zona. (…). V).-DEL CASO CONCRETO: En el caso que nos ocupa, la Municipalidad de Osa, en su condición de administradora de la zona marítimo terrestre, denegó el permiso de uso solicitado por el recurrente señalando como motivo de tal denegatoria que, el sector en donde se ubica la parcela de su interés, carece de plan regulador, esto es, de un instrumento técnico idóneo sobre el uso del suelo que potencie su protección.
Ya se señaló líneas atrás que, el medio idóneo para el aprovechamiento privado de la zona marítimo terrestre es la concesión, la que solo puede ser otorga previa existencia de plan regulador y, válidamente puede el gobierno local rechazar el permiso de uso que pretende el recurrente, ante la falta de un instrumento técnico tan importante que potencie el crecimiento sostenido y ordenado del citado bien de la Nación. (…) El Tribunal estima que, la carencia de un adecuado instrumento de planificación de uso de suelo, en el sector en que se ubica la parcela que pretende explotar el recurrente, es motivo suficiente para denegar el permiso solicitado, razón por la cual, el acto impugnado se encuentra conforme con el bloque de legalidad vigente y, tiene motivo válido (…)” No existe ninguna razón legal para variar el criterio anterior, que se ajusta plenamente al caso del señor Nombre71629 . El argumento de que al recurrente, dentro de la solicitud de concesión que hay formulado, se le haya autorizado o no para amojonar el lote de su interés, carece de relevancia, puesto que no elimina el escollo de la inexistencia del plan regulador que se invocó como fundamento del acuerdo impugnado.
Por otra parte, cualquier solicitud de concesión que haya formulado el señor Nombre71629 , es independiente del permiso de uso que aquí se conoce, y la simple autorización para amojonar, de haberse dado, no le concede derecho alguno. No es objeto de recurso, ningún trámite de concesión que haya presentado don Nombre71629 y que se esté tramitando ante la Municipalidad de Osa, por lo que nada tiene que decir este Tribunal sobre la legalidad del mismo o el cumplimiento de los requisitos legales.
V.Tampoco produce nulidad del acuerdo impugnado, el hecho de que el recurso de revocatoria con apelación en subsidio interpuesto, no haya sido resuelto por el Concejo en los plazos señalados en el artículo 156 del Código Municipal, como lo alega el recurrente, puesto que conforme al artículo de la Ley General de la Administración Pública, la Administración siempre tiene el deber jurídico de resolver
VI.Por los motivos indicados anteriormente, se confirma el acuerdo impugnado y, al no caber contra lo resuelto por este tribunal ulterior recurso, se da por agotada la vía administrativa.
POR TANTO:
