JUDGMENT N° 0240-F-10 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at thirteen hours eighteen minutes on dieciséis de marzo de dos mil diez.- POSSESSORY INFORMATION PROCEEDING (INFORMACIÓN POSESORIA) brought by [Nombre1] , of legal age, married, farmer, resident of Liberia, identity card CED1 - - , who assigned his rights to LOS REMEDIOS DE LA VIEJA SOCIEDAD ANÓNIMA, corporate identification number CED2 - - , represented by [Nombre2] , of legal age, single, mechanical engineer, identity card CED3 - - . Heard before the Juzgado Agrario de Liberia. Participating in the proceeding are the PROCURADURÍA GENERAL DE LA REPÚBLICA, represented in her capacity as Deputy Attorney General by Lydiana Rodríguez Paniagua, whose particulars are not recorded in the case file, and the INSTITUTO DE DESARROLLO AGRARIO, represented by [Nombre3] , of legal age, married once, Agricultural Engineer, identity card CED4 - - , resident of Siquirres Limón, in his capacity as general agent with unlimited authority. Attorney Hugo Zúñiga Clachar, of legal age, married, attorney-at-law, identity card number CED5 - - , acts as special judicial representative of the petitioner.- BACKGROUND:

1. The petitioner instituted these possessory information proceedings, valued at one million colones, seeking an order to record in the Registro Público de la Propiedad the property described as follows: “Land consisting of secondary scrubland (tacotal), with an area of approximately fifty hectares, pastureland (potrero) with an area of approximately sixty hectares, and the remainder consisting of mountain forest, with a house, corral, and passageway located at [Dirección1], ( ), (Liberia), in the province of Guanacaste. Boundaries: NORTH Río Tizate, SOUTH [Nombre4] , Los Remedios de la Vieja S.A., Quebrada Pital and Baldioceda Rojas Hermanos LTDA, EAST: Dry Forest Conservation Fund and Baldioceda Rojas Hermanos Ltda, [Dirección2] Rio Tizate, [Dirección3] , [Nombre5] , [Nombre1] . According to cadastral plan number G-1203365-2008, in the name of [Nombre1] , dated 29 de enero del 2008, it has an area of one hundred thirty-five hectares, two thousand nine hundred eleven square meters and forty square decimeters,” (folios 15, and 163).- 2.

The Procuraduría General de la República and the Instituto de Desarrollo Agrario appeared in the proceeding under the terms set forth at folios 41 and 44, 114, 127, and 137, respectively.- 3. Attorney Luis Andrés Angulo Sequeira, the trial judge, ruled at sixteen hours on siete de diciembre de dos mil nueve: “Pursuant to LEY DE INFORMACIONES POSESORIAS N°139 of 14 de julio de 1941, as amended, this INFORMACIÓN POSESORIA brought by LOS REMEDIOS DE LA VIEJA S.A. IS APPROVED. In view of the condition of the roads running in front of the property registered through this proceeding, the property shall be subject to the reservations established by the Ley General de Caminos Públicos, under which the minimum width of highways is twenty meters and that of local roads is fourteen meters (articles 19 of the Ley de Informaciones Posesorias and 4 of the Ley General de Caminos Públicos). The applicant for title (titulante) must refrain from cutting down or removing trees within the protected area (área de protección) of Rio Tizate and Quebrada Pital, pursuant to articles 33 and 34 of Ley Forestal number 7575 of 13 de febrero de 1996; the riverbed and watercourses of that river are in the public domain (dominio público) by virtue of article 1 of Ley de Aguas number 276 of 27de agosto de 1942, as amended.

The REGISTRO PUBLICO DE LA PROPIEDAD shall record, free of encumbrances (gravámenes) and subject to the real-property burdens (cargas reales) already indicated, without prejudice to third parties having superior rights, in the name of LOS REMEDIOS DE LA VIEJA S.A., the land described as follows: Land consisting of secondary scrubland, with an area of approximately fifty hectares, pastureland with an area of approximately sixty hectares, and the remainder consisting of mountain forest, with a house, corral, and passageway located at [Dirección1], ( ), (Liberia), in the province of Guanacaste. Boundaries: NORTH Río Tizate, SOUTH [Nombre4] , Los Remedios de la Vieja S.A., Quebrada Pital and Baldioceda Rojas Hermanos LTDA, EAST: Dry Forest Conservation Fund and Baldioceda Rojas Hermanos Ltda, [Dirección4] , [Dirección3] , [Nombre5] , [Nombre1] . According to cadastral plan number G-1203365-2008, in the name of [Nombre1] , dated 29 de enero del 2008, it has an area of one hundred thirty-five hectares, two thousand nine hundred eleven square meters and forty square decimeters.

The land is crossed in part by Quebrada Pital. Acts of possession (actos posesorios) have been exercised over the property in compliance with appropriate land use (uso conforme del suelo). It is recommended that the number of paddocks (apartos) and the area of improved pasture be increased. Protection of the aquifers and forest must be maintained,” (folios 164 to 165).

4. The Procuraduría General de la República filed an appeal, expressly stating the reasons for challenging the trial court’s position, under the terms set forth at folios 167 to 190.- 5. The statutory requirements were observed in the conduct of the proceeding, and there are no errors or omissions capable of rendering the judgment void.

Judge Vargas Vásquez writes the opinion; and, WHEREAS:

I.The facts deemed proven in the judgment under appeal are adopted because they are consistent with the evidence contained in the case file. The following findings of that nature are added on appeal: 10° The property is properly demarcated (see record of judicial inspection (reconocimiento judicial) at folio 57 and testimony of [Nombre6] , [Nombre7] and [Nombre8] , at folios 59 and 59). 11° The petitioner, [Nombre9] and [Nombre1] , during the respective periods in which each possessed the property, protected the forest resources existing on it (see record of judicial inspection at folio 57, testimony of [Nombre6] , [Nombre7] and [Nombre8] , at folios 59 and 59, and soil-study certification issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria at folio 55).­

II.Attorney Lydiana Rodríguez Paniagua, Deputy Attorney General of the Procuraduría General de la República, filed an appeal against the judgment in a brief sent by fax on 14 de diciembre de 2009, the original of which was filed on 16 of that same month and year (folios 167 and 179). She argues essentially that the land-use certificate, witness testimony, and judicial inspection show that the property for which title is sought is forestland. She therefore adds that, although forestry legislation permits title to be obtained for properties located outside protected wilderness areas (áreas silvestres protegidas), consideration must be given to the declaration that forests are in the public domain made by Ley Forestal 4465 of 1969, in article 33, as amended by Ley Forestal 7174 of 1990, in article 32, and to the public-domain status (carácter demanial) maintained by Ley Forestal 7575, in sections 13 and 14. She quoted several judicial precedents in support of her position.­

III.Article 7 of the Ley de Informaciones Posesorias permits title to be granted to real property located outside protected areas that contains forests, provided that the petitioner proves the exercise of ten-year possession (posesión decenal) of the property, that the forest resource has been protected, and that the property is duly demarcated by fences and cleared boundary paths (carriles). This proceeding seeks title to property located in El Pital de Cañas Dulces, [Dirección5] , first canton of the province of Guanacaste, measuring 135 hectares 2911,40 square meters, used as pasture and brushland (tacotales), according to cadastral plan [Placa1] (folio 108). Plan G-1052708-2006 was canceled in the Cadastre (folios 1º, 51 and 98). That property is located outside any protected wildlife area (área silvestre protegida), according to a certification issued by the Sistema Nacional de Áreas de Conservación (folios 3 and 102).

The initial filing—submitted to the court on 24 de julio de 2006—stated that the land consists of “brushland, pasture, and forest” and that the possessory acts (actos posesorios) performed thereon consisted of “fencing the property, clearing it, creating firebreaks, caring for it, and maintaining the house” (folio 15). To prove possession, a document was submitted whereby [Nombre9] donated the possessory rights (derechos posesorios) to the property to [Nombre1] , on 27 de febrero de 2004; it recorded that the property was used as “pasture, brushland, and forest” (folio 4). The Court conducted a judicial inspection (reconocimiento judicial) of the property on 13 de marzo de 2007, recording in the corresponding minutes that the property is demarcated and contains jaragua, brachiaria, and guinea grass pastures, brushland, trees of different species such as pochote, cedar, cenízaro, and others, as well as eight head of cattle and two horses (folio 57).

Testimony was also received from [Nombre6] , [Nombre7] and [Nombre8] . The first stated that he had known the property for thirty years; that it had first belonged to [Nombre9] , the petitioner’s father, and had later passed to the petitioner; that both had used it for agricultural crops such as rice, beans, and corn, as well as for livestock farming; and that the property is duly demarcated (folio 58). Mr. [Nombre7] stated that he had known the property “for as long as I can remember” and indicated that he was fifty-six years old. He asserted that the property belonged to [Nombre9] , who used it to grow corn, beans, and sugarcane, as well as for livestock farming; that the petitioner carried out the same activities; and that the property is duly demarcated (folio 59). For his part, [Nombre8] testified that he had known the property for forty years, that it had belonged to [Nombre9] and later passed to the applicant for title (titulante), and that both had kept it duly demarcated (folio 59 verso).

Likewise, the soil study issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria certified that possession had been exercised in compliance with the appropriate land use (uso conforme del suelo) for the activity conducted, in accordance with the approved methodology; it further stated that the aquifers are protected by a forested area and that the property is used for extensive livestock farming and forest protection (folio 55). After this evidence was received, an assignment of rights (cesión de derechos) was submitted by the original petitioner in favor of Los Remedios de la Vieja S.A., which continued the proceeding. It follows from the foregoing that this proceeding has satisfied the requirements established in Article 7 of the Ley de Informaciones Posesorias, among the other requirements established by that legislation, namely, that the property is duly demarcated, that the forest resource has been protected, and that possession was proven both by the person who transferred the possessory rights to the current petitioner, Mr. [Nombre1] , and by his father, the former owner.

This allows this Court to conclude that the appellant’s arguments lack merit. Furthermore, in this Court’s view, Article 7 of the Ley de Informaciones Posesorias permits title to be granted to real property located outside protected areas that contains forest, a provision in relation to which the Sala Constitucional de la Corte Suprema de Justicia has repeatedly dismissed the constitutional challenges filed, a binding position reflected, among others, in judgment [Telf1]. It is important to mention that this proceeding involved discussion concerning the property’s boundary with Parque Nacional; however, when judgment was rendered, the Parque Nacional was not listed as one of the adjoining properties, an issue that was not challenged by the State’s representative when appealing the judgment and therefore does not constitute a ground of appeal. Likewise, it should be noted that although the case file contains inconsistent information regarding the nature of the property for which title is sought—because the initial plan describes it as pasture, brushland, and forest, as do the initial filing and the transfer document, whereas the second plan prepared refers only to pasture and brushland, as also described in the judicial-inspection minutes—the important point is that the technical opinion issued by the Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria refers in its certification to the existence of pastures, brushland, and forest, thus encompassing all the earlier descriptions. -

IV.For the foregoing reasons, the appealed decision must be affirmed as to the matters challenged on appeal, with the understanding that the area of the property is one hundred thirty-five hectares, two thousand nine hundred eleven square meters and forty square decimeters, according to cadastral plan G-uno dos cero tres tres seis cinco- dos mil ocho.-

POR TANTO

As to the matters appealed, the judgment is affirmed, with the understanding that the area of the property is one hundred thirty-five hectares, two thousand nine hundred eleven square meters and forty square decimeters, according to cadastral plan G- uno dos cero tres sies cinco- dos mil ocho.- DAMARIS VARGAS VÁSQUEZ [Nombre10] CARLOS PICADO VARGAS DISSENTING OPINION OF JUDGE [Nombre10]

I.The undersigned departs from the majority opinion of this Court because I consider that the property for which Los Remedios de la Vieja S.A. seeks title through this possessory title proceeding (información posesoria) cannot be privately appropriated, since a large portion of the land subject to titling is forest by nature and therefore forms part of the State’s public domain (dominio público). The property in question is located in the Province of Guanacaste, [Dirección6] , and measures 148 hectares 6871 square meters.

II.It is important to recall the provisions of the Ley de Tierras y Colonización, number 2825 of 14 de octubre de 1961, Article 11 of which provides, insofar as relevant: “…Unless proven otherwise, the following belong to the State as national reserves (reservas nacionales): a) All land within the boundaries of the Republic that is not registered as private property or as property of the Municipalities or Autonomous Institutions; b) Land not protected by ten-year possession;…”. In support of the foregoing, it is necessary to analyze what the first Ley Forestal, number 4465 of 25 de noviembre de 1969, provided regarding forest property (propiedad forestal). Articles 32 and 33 thereof provided as follows: “Article 32.- The State’s forest estate (patrimonio forestal del Estado) consists of all forests and forest lands (terrenos forestales) within national reserves, areas declared inalienable, properties registered in its name, and those belonging to municipalities, autonomous institutions, and other bodies of the Public Administration….” “Article 33.- The forest lands and forests constituting the State’s forest estate, detailed in the preceding article, shall be immune from seizure (inembargables) and inalienable (inalienables); their possession by private parties shall create no right in their favor, and the State’s action for recovery (acción reivindicatoria) of such land shall not be subject to prescription (imprescriptible).

Consequently, they may not be registered in the Public Registry through a possessory title proceeding; their invasion and occupation shall be punished in accordance with this law.” (emphasis added by the author). Based on the foregoing, the first Ley Forestal classified forested areas and land suitable for forestry (terrenos de aptitud forestal) within the National Reserves as public-domain property (bienes demaniales), by designating them immune from seizure, inalienable, and not subject to prescription, and not subject to private appropriation, as far back as nineteen sixty-nine. Subsequently, the next Ley Forestal, number 7032 of 7 de abril de 1986, contained provisions concerning the State’s forest estate and established the same rules as those quoted above in the same numbered articles. That legislation was declared unconstitutional, thereby restoring the effectiveness of Ley 4465, cited above.

In nineteen ninety, a new Ley Forestal, number 7174 of 28 de junio de 1990, was enacted, once again establishing the public-domain status (demanialidad) of forested land and forest land within the National Reserves. That law remained in force until 5 de febrero de 1996, the date on which the current Ley Forestal number 7575 was enacted. This law once again provides for the public-domain status of forested areas and land suitable for forestry within national reserves, stating, insofar as relevant, in Article 13: “…The State’s natural heritage (Patrimonio natural del Estado) shall consist of the forests and forest lands of the national reserves…”. Likewise, Article 14 of that body of law provides: “…The forest lands and forests constituting the State’s natural heritage, detailed in the preceding article, shall be immune from seizure and inalienable; their possession by private parties shall create no right in their favor, and the State’s action for recovery of such land shall not be subject to prescription. Consequently, they may not be registered in the Public Registry through a possessory title proceeding, and both their invasion and their occupation shall be punished in accordance with this law…”.

III.Consistent with the foregoing statutory analysis, it is clear that there is a special regime applicable to forest resources, which is the genesis of forest property, arising upon the law’s entry into force. From the foregoing, there can be no doubt that national reserves are subject by law to this forest-property regime because they belong to the State and, as analyzed above, forested land and land suitable for forestry have never ceased to be designated as public-domain property, since the various forestry laws have remained in force over time through the present day.

IV.The present case concerns land partly covered by forests, which, in the undersigned’s judgment, is sufficient grounds to deny title through possessory information proceedings (información posesoria), because such land constitutes property subject to the public domain (demanio público) as of the year one thousand nine hundred sixty-one, when the Ley de Tierras y Colonización was enacted, and has remained under that public-domain status to the present day. It is important to mention that the Constitutional Chamber has been emphatic that judges must analyze the point in time from which property became subject to the public domain.- In this regard, the Constitutional Chamber, in Judgment No. 4587 issued at 15:45 hours on 5 de agosto de 1997, in which it examined the constitutionality of the aforementioned Article 7, held that, in order to obtain title to land located in the protected areas identified therein, the interested party had to demonstrate possession for ten years prior to the effective date of the respective Decree.

In essence, the Chamber stated on that occasion: “… given the nature of the property to which title is sought (public property), the period of possession sufficient for acquisitive prescription (usucapión) must elapse before the property becomes subject to the public domain. In other words, the declaration of a protected wild area (área silvestre protegida) prevents possession subsequent to that designation from being counted and precludes fulfillment of the requirements for acquisitive prescription if the right had not been acquired by that time, that is, if the ten years of possession sufficient for acquisitive prescription under the conditions established by law had not elapsed… it is important to summarize the basic elements applied to these matters in legal scholarship and case law, which require the judge—in relation to the challenged provision—to determine in each case the specific type of possessory act (acto posesorio) exercised over the property—which becomes part of the protected wild area—to which title is sought.

The foregoing is intended to provide the judge with a broader standard—not limited to the effective date of the law or executive decree defining the boundaries of a particular protected wild area—for determining more precisely when such property became inalienable and not subject to prescription (imprescriptible), for the purpose of determining whether possession for acquisitive prescription (posesión ad usucapionem) was exercised over it for ten years before it acquired that status. This broader perspective promotes the protection of the Nation’s environmental heritage and ensures that, when title is sought—through possessory information proceedings—to land located within a protected wild area, the dispute is not reduced to merely calculating how long the claimant has occupied the property in relation to the date on which the protected wild area was declared, because, on the one hand, in order to establish possession for acquisitive prescription during the period prescribed in Article 7 of the Ley de Informaciones Posesorias, the elements corresponding to each specific type of possession must be considered, and, on the other hand, account must be taken of the possible existence of provisions that declared such land inalienable long ago, even before it was specifically made subject to the public domain….” In this case, after conscientiously assessing the evidence without strict adherence to the rules of ordinary law (Article 54 of the Ley de Jurisdicción Agraria), the undersigned reaches the unavoidable conclusion that this proceeding must be denied because it encompasses property forming part of the State Natural Heritage (Patrimonio Natural del Estado), since the title applicant failed to prove that it had acquired and perfected a property right over that property before the forest areas within the national reserves became subject to the public domain, as explained above.

It is also important to bear in mind that the Ley Forestal governs everything concerning both private and public forest resources (recurso forestal) and is a special law; accordingly, as stated above, forested land became subject to public-domain status upon the entry into force of the first forestry law enacted in the year one thousand nine hundred sixty-nine. The foregoing analysis also leads this adjudicator to conclude that, because the dispute concerns forest or wilderness areas, the principle that special provisions prevail (principio de especialidad de las normas) applies—in this case, the Ley Forestal, which governs forest resources—contrary to the majority opinion concerning the application of Article 7 of the Ley de Informaciones Posesorias, as the latter is a law of general application. Apart from the foregoing, recognition of the right to a healthy and ecologically balanced environment marks a milestone in the country’s ecological history.

It contains guidelines of the highest axiological significance, whose development is not exclusively national. On the contrary, this is a universal movement whose result has been to establish the right to a healthy and ecologically balanced environment as a genuine human right. It is classified among the so-called third-generation rights: a step beyond the classic civil or political human rights (first-generation rights) and economic, social, and cultural rights (second-generation rights). This has provided a basis for formulating a new legal classification: Ecological Law (Derecho Ecológico). Today, its subject matter is clearly defined as natural resources, and its body of sources is characterized by organic unity and completeness. To mention only two fundamental documents promoted by the United Nations in which Costa Rica has participated, emphasis should be placed on the “Declaration of the United Nations Conference on the Human Environment,” held in Stockholm in junio de l972, and the “Declaration on the Right to Development,” approved by the General Assembly in Resolution 41-128 of 4 de diciembre de 1986.

The former, proceeding from the premise that “man is both creature and moulder of his environment, which gives him physical sustenance and affords him the opportunity for intellectual, moral, social and spiritual growth,” establishes, among others, the following fundamental principles: “The natural resources of the earth, including the air, water, land, flora and fauna and especially representative samples of natural ecosystems, must be safeguarded for the benefit of present and future generations through careful planning or management…. The capacity of the earth to produce vital renewable resources must be maintained and, wherever practicable, restored or improved…. Man has a special responsibility to safeguard and wisely manage the heritage of wildlife and its habitat, which are now gravely imperiled by a combination of adverse factors. Nature conservation, including wildlife, must therefore receive importance in planning for economic development….

The non-renewable resources of the earth must be employed in such a way as to guard against the danger of their future exhaustion and to ensure that benefits from such employment are shared by all mankind…. Resources should be made available to preserve and improve the environment, taking into account the circumstances…. In order to achieve more rational management of resources and thus improve the environment, States should adopt an integrated and coordinated approach to their development planning so as to ensure that development is compatible with the need to protect and improve the human environment for the benefit of their population…. All countries, big or small, must address international issues concerning the protection and improvement of the environment in a cooperative spirit and on an equal footing….” The “Declaration on the Right to Development,” in turn, proclaims: “The human right to development also implies the full realization of the right of peoples to self-determination, including, subject to the relevant provisions of both International Covenants on Human Rights, the exercise of their inalienable right to full sovereignty over all their natural wealth and resources….”

V.It is important to mention Judgment No. 16975-2008 issued at 14:53 hours on 12 de noviembre de 2008 by the Constitutional Chamber, which refers to the State Natural Heritage and its designation as part of the public domain: “… IV.- The Chamber considers the challenged decree unconstitutional in its entirety because it violates Article 50 of the Political Constitution, which recognizes the right to a healthy and ecologically balanced environment. Indeed, as highlighted in the report of the Procuraduría General de la República, the State Natural Heritage is public-domain property whose conservation and administration are entrusted by law to the Ministerio del Ambiente y Energía through the Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a and 13 pfo.2°, and 14; Ley Orgánica del Ambiente, Article 32, pfo. 2°). It comprises two important components: a) Protected Wild Areas, regardless of their management category, declared by Law or Executive Decree: forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° subsection i; Ley Orgánica del Ambiente 7554, Article 32; Ley de Biodiversidad N° 7788, arts. 22 et seq. and 58; Ley del Servicio de Parques Nacionales N° 6084, Article 3° subsections d and f, in relation to Ley Orgánica del MINAE N° 7152 and its Regulations; Ley de Conservación de la Vida Silvestre N° 7317, Article 82, subsection a). b) All other forests and forest land or land suitable for forestry (terrenos de aptitud forestal) belonging to the State and public institutions (Article 13 of the Ley Forestal), which are immediately subject to this legal designation.

With respect to the maritime-terrestrial zone (zona marítimo terrestre), Ley 6043 itself (Article 73) excludes Protected Wild Areas from its scope and subjects them to their own legislation. The remaining forested areas and land suitable for forestry along the coasts are also administered by the Ministerio del Ambiente and governed by their specific regulations (Ley Forestal, Article 13 and related provisions).” In this judgment, the Constitutional Chamber recognizes the public-domain status of forests, because they belong to the State Natural Heritage.

VI.Consequently, forestry regulations establish, for all cases and throughout the national territory—and not merely for some—a special regime applicable to all forest resources, from which forest ownership (propiedad forestal) arises. National reserves are subject to that regime by operation of law because, as they belong to the State, the legislature requires no additional formality, and expropriation is appropriate only when private property is designated for the creation of national parks, forest or biological reserves, forests, or forest land. In this particular case, there is a forest area of approximately 45 hectares, that is, 30% of the property to which title is sought, which forms part of the State Natural Heritage. Based on all the foregoing, the undersigned considers that, pursuant to Articles 13, 14, and 15 of the Ley Forestal and Article 11 of the Ley de Tierras y Colonización, such land is part of the public domain because it forms part of the national reserves comprising the State Natural Heritage; therefore, the judgment issued must be reversed and, consequently, the possessory information proceeding brought by Los Remedios de la Vieja Sociedad Anónima must be denied.

VOTO N° 0240-F-10 TRIBUNAL AGRARIO DEL SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las trece horas dieciocho minutos del dieciséis de marzo de dos mil diez.- DILIGENCIA DE INFORMACIÓN POSESORIA promovida por [Nombre1] , mayor, casado, agricultor, vecino de Liberia, cédula de identidad CED1 - - , quien cedió sus derechos a LOS REMEDIOS DE LA VIEJA SOCIEDAD ANÓNIMA, cédula jurídica número CED2 - - , representada por [Nombre2] , mayor, soltero, ingeniero mecánico, cédula de identidad CED3 - - . Tramitado ante el Juzgado Agrario de Liberia. Intervienen en el proceso la PROCURADURÍA GENERAL DE LA REPÚBLICA representada en su carácter de Procuradora Adjunta por Lydiana Rodríguez Paniagua, de calidades desconocidas en autos, y el INSTITUTO DE DESARROLLO AGRARIO, representado por [Nombre3] , mayor, casado una vez, Ingeniero Agrónomo, cédula de identidad CED4 - - , vecino de Siquirres Limón, en su condición de apoderado generalísimo sin límite de suma. Actúa como apoderado especial judicial de la parte promovente el licenciado Hugo Zúñiga Clachar, mayor, casado, abogado, cédula de identidad número CED5 - - .-

RESULTANDO:

1. La parte promovente planteó las presentes diligencias de información posesoria, estimadas en la suma de un millón colones, a fin de que se ordene inscribir en el Registro Público de la Propiedad, el inmueble que se describe así: "Terreno de tacotal, con una área de cincuenta hectáreas aproximadamente, potrero con un área de sesenta hectáreas aproximadamente y el resto de montaña, con una casa, corral y saguan situado en [Dirección1], ( ), (Liberia), de la provincia de Guanacaste. Linderos: NORTE Río Tizate, SUR [Nombre4] , Los Remedios de la Vieja S.A., Quebrada Pital y Baldioceda Rojas Hermanos LTDA, ESTE: Dry Forest Conservation Fund y Baldioceda Rojas Hermanos Ltda, [Dirección2] Rio Tizate, [Dirección3] , [Nombre5] , [Nombre1] . Según plano catastrado número G-1203365-2008, a nombre de [Nombre1] , fechado 29 de enero del 2008, mide extensión ciento treinta y cinco hectáreas dos mil novecientos once metros con cuarenta decímetros cuadrados", (folios 15, y 163).- 2.

Se apersonaron al proceso la Procuraduría General de la República y el Instituto de Desarrollo Agrario a los términos que corren a folios 41 y 44, 114, 127, 137 respectivamente.- 3. El licenciado Luis Andrés Angulo Sequeira, juez de primera instancia, en resolución de las dieciséis horas del siete de diciembre de dos mil nueve, resolvió: "De conformidad con la LEY DE INFORMACIONES POSESORIAS N°139 del 14 de julio de 1941 y sus reformas, SE APRUEBA esta INFORMACIÓN POSESORIA promovida por LOS REMEDIOS DE LA VIEJA S.A.. En vista de la situación de los caminos que corren frente a la finca inscrita mediante esta información, ésta quedará afectada por las reservas que indica la Ley General de Caminos Públicos, en cuanto a que el ancho mínimo de las carreteras es de veinte metros y de los caminos vecinales de catorce metros (artículos 19 de la Ley de Informaciones Posesorias y 4 de la Ley General de Caminos Públicos.

Debe el titulante, evitar la corta o eliminación de árboles en el área de protección del Rio Tizate y la Quebrada Pital, de conformidad con los artículos 33 y 34 de la Ley Forestal número 7575 del 13 de febrero de 1996, siendo su cauce y las corrientes de agua de dicho río de dominio público, en virtud de lo establecido en el artículo 1 de la Ley de Aguas número 276 del 27de agosto de 1942 y sus reformas. Proceda el REGISTRO PUBLICO DE LA PROPIEDAD a inscribir, libre de gravámenes y con las cargas reales ya señaladas, sin perjuicio de terceros de mejor derecho, a nombre de LOS REMEDIOS DE LA VIEJA S.A., el terreno que se describe así: Terreno de tacotal, con una área de cincuenta hectáreas aproximadamente, potrero con un área de sesenta hectáreas aproximadamente y el resto de montaña, con una casa, corral y saguan situado en [Dirección1], ( ), (Liberia), de la provincia de Guanacaste. Linderos: NORTE Río Tizate, SUR [Nombre4] , Los Remedios de la Vieja S.A., Quebrada Pital y Baldioceda Rojas Hermanos LTDA, ESTE: Dry Forest Conservation Fund y Baldioceda Rojas Hermanos Ltda, [Dirección4] , [Dirección3] , [Nombre5] , [Nombre1] .

Según plano catastrado número G-1203365-2008, a nombre de [Nombre1] , fechado 29 de enero del 2008, mide extensión ciento treinta y cinco hectáreas dos mil novecientos once metros con cuarenta decímetros cuadrados El terreno es cruzado por la quebrada pital en parte. En el inmueble se han ejercido los actos posesorios, cumpliendo con el uso conforme del suelos. Se recomienda aumentar el número de apartos y el área de pastos mejorados. Mantener la protección de los acuíferos y del bosque, (folios 164 a 165) 4. La Procuraduría General de la República interpuso recurso de apelación con indicación expresa de las razones por las cuales refuta la tesis del juzgado de instancia, a los términos que corren a folios 167 a 190.- 5. En la substanciación del proceso se han observado las prescripciones legales, y no se observa la existencia de errores u omisiones capaces de producir la nulidad del fallo.

Redacta la jueza Vargas Vásquez; y, CONSIDERANDO:

I.Se comparten los hechos tenidos por probados en la sentencia apelada al ser acordes con las probanzas constantes en autos. De tal naturaleza en esta instancia se agrega: 10° El inmueble se encuentra debidamente delimitado (ver acta de reconocimiento judicial de folio 57, declaración testimonial de [Nombre6] , [Nombre7] y [Nombre8] , de folios 59 y 59). 11° La promovente, [Nombre9] y [Nombre1] , durante el tiempo que han tenido en posesión el fundo, cada uno en su tiempo, han protegido el recurso forestal existente en el inmueble (ver acta de reconocimiento judicial de folio 57, declaración testimonial de [Nombre6] , [Nombre7] y [Nombre8] , de folios 59 y 59 y certificación de estudio de suelos emitida por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria de folio 55).­

II.La licenciada Lydiana Rodríguez Paniagua, Procuradora Adjunta de la Procuraduría General de la República, interpuso recurso de apelación contra la sentencia en memorial remitido por fax el 14 de diciembre de 2009, cuyo original fue presentado el día 16 del citado mes y año (folios 167 y 179). En lo medular, alega que del certificado de uso del suelo, de la prueba testimonial y del reconocimiento judicial se desprende, la naturaleza del inmueble a titular es de bosque. Por ende, agrega, aunque la legislación forestal permite titular inmuebles ubicados fuera de áreas silvestres protegidas, debe tenerse en consideración la declaratoria de dominio público forestal hecha por la Ley Forestal 4465 de 1969, en el artículo 33, reformada por la Ley Forestal 7174 de 1990, en el artículo 32, y el carácter demanial que mantuvo la Ley Forestal 7575, en los numerales 13 y 14. Transcribió algunos precedentes jurisprudenciales en apoyo de su planteamiento.­

III.El artículo 7 de la Ley de Informaciones Posesorias permite la titulación de inmuebles ubicados fuera de zonas protegidas que contengan bosques, siempre que la persona promovente acredite el ejercicio de la posesión decenal del fundo, haber protegido el recurso forestal y tener el bien debidamente delimitado mediante cercas y carriles. En este proceso se pretende la titulación de un bien ubicado en El Pital de Cañas Dulces, [Dirección5] , cantón primero de la provincia de Guanacaste, con una medida de 135 hectáreas 2911,40 metros cuadrados, destinada a potrero y tacotales, según el plano catastrado [Placa1] (folio 108). El plano G-1052708-2006 fue cancelado en el Catastro (folios 1º, 51 y 98). Esa propiedad se ubica fuera de cualquier área silvestre protegida, según certificación emitida por el Sistema Nacional de Áreas de Conservación (folios 3 y 102). En el escrito inicial -presentado a estrados el 24 de julio de 2006- se indicó se trata de un terreno "tacotales, potrero y montaña" cuyos actos posesorios han consistido en "cercar el inmueble, chapearlo, hacerle rondas, cuidarlo y mantener la casa" (folio 15).

Para acreditar la posesión, se presentó documento mediante el cual [Nombre9] donó los derechos posesorias del fundo a [Nombre1] , el 27 de febrero de 2004, se hizo constar que el bien está destinado a "potrero, tacotales y montaña" (folio 4). El Juzgado realizó un reconocimiento judicial del inmueble el 13 de marzo de 2007, haciendo constar en el acta respectiva que el fundo se encuentra delimitado y que en él existen pastizales de jaragua, braquiaria, guinea, tacotales, árboles de diferentes especies como pochote, cedro, cenízaro y otros, así como ocho cabezas de ganado y dos caballos (folio 57). Además, se recibió la declaración testimonial de [Nombre6] , [Nombre7] y [Nombre8] . El primero de ellos dijo conocer el fundo desde hacía treinta años, que primero le perteneció a [Nombre9] , padre del promovente y que luego pasó a ser de éste, destinándolo ambas a cultivos agrícolas tales como arroz, frijoles y maíz, así como a la ganadería y que el fundo está debidamente delimitado (folio 58).

El señor [Nombre7] dijo conocer la finca "desde que tengo uso de razón" y señaló tiene cincuenta y seis años. Afirmó, la finca era de [Nombre9] quien la destinaba a la agricultura de maíz, frijoles y caña de azúcar, así como a la ganadería; mismas actividades que realiza el promovente, e indicó, el inmueble está debidamente delimitado (folio 59). Por su parte, [Nombre8] declaró que el inmueble lo conoce desde hace cuarenta años, que era de [Nombre9] y luego pasó a ser del titulante, manteniéndola ambos debidamente delimitada (folio 59 vuelto). Así mismo, en el estudio de suelos emitido por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria se certificó que se ha ejercido la posesión cumpliendo con uso conforme del suelo para la actividad que se realiza de acuerdo con la metodología aprobada, agregándose, los acuíferos se encuentran protegidos por una zona boscosa y que la finca está destinada a la ganadería extensiva y a protección del bosque (folio 55).

Después de recibir dicha prueba, se presentó cesión de derechos de parte del promovente inicial a favor de Los Remedios de la Vieja S.A., la cual siguió con la tramitación del proceso. De lo anterior se desprende que en este proceso se han cumplido los requisitos dispuestos en el artículo 7 de la Ley de Informaciones Posesorias, entre los demás requerimientos dispuestos por dicha normativa, a saber, que el fundo está debidamente delimitado, que se ha protegido el recurso forestal y que se acreditó el ejercicio de la posesión de quien transmitió los derechos posesorios a la actual promovente, señor [Nombre1] , y por parte del padre de éste, dueño anterior, lo cual permite a este Tribunal llegar a la conclusión de que los alegatos de la recurrente carecen de sustento. Además, en criterio de este Tribunal, el artículo 7 de la Ley de Informaciones Posesorias permite la titulación de inmuebles ubicados fuera de áreas protegidas, que contengan bosque, norma en relación con la cual la Sala Constitucional de la Corte Suprema de Justicia en forma reiterada ha rechazado las acciones de inconstitucionalidad formuladas, criterio que tiene carácter vinculante, entre ellas, el voto [Telf1].

Es importante mencionar que en este proceso se debatió acerca de la colindancia con Parque Nacional; sin embargo, al emitirse la sentencia no se consignó como parte de las colindancias, aspecto que no fue objetado por la representante del Estado al impugnar la sentencia, por ende, no es un motivo de agravios. Así mismo, debe señalarse que aunque existe disparidad de datos en el expediente acerca de la naturaleza del inmueble a titular, pues en el plano inicial se señala es potrero, tacotales y montaña, de la misma forma que se indica en el escrito inicial y en el documento de traspaso, en el segundo que se levantó indica, sólo se hace referencia a potrero y tacotales, al igual que se describe en el acta de reconocimiento judicial; lo importante es que el criterio técnico emitido por el Instituto Nacional de Innovación y Transferencia de Tecnología Agropecuaria, hace alusión en su certificación a la existencia de potreros, tacotales y bosque, incluyendo así todas las versiones anteriores. -

IV.Por lo expuesto, deberá confirmarse la resolución recurrida en lo que ha sido objeto de apelación, en el entendido de que el área del inmueble es de ciento treinta y cinco hectáreas dos mil novecientos once metros con cuarenta decímetros cuadrados, según plano catastrado G-uno dos cero tres tres seis cinco- dos mil ocho.-

POR TANTO

En lo apelado,se confirma la sentencia, en el entendido de que el área del inmueble es de ciento treinta y cinco hectáreas dos mil novecientos once metros con cuarenta decímetros cuadrados, según el plano catastrado G- uno dos cero tres sies cinco- dos mil ocho.- DAMARIS VARGAS VÁSQUEZ [Nombre10] CARLOS PICADO VARGAS VOTO SALVADO JUEZ [Nombre10]

I.El suscrito se aparta del voto de mayoría de este Tribunal al considerar el fundo objeto de la titulación mediante el trámite de la presente información posesoria, por parte de Los Remedios de la Vieja S.A., no puede ser objeto de apropiación particular al considerar gran parte de los terrenos objeto de titulación su naturaleza es de bosque, por lo que los mismos forman parte del dominio público del Estado. El fundo de marras se encuentra ubicado en la Provincia de Guanacaste, [Dirección6] , con una medida de 148 hectáreas 6871 metros cuadrados.

II.Es importante traer a colación lo estipulado por la Ley de Tierras y Colonización, número 2825 de catorce de octubre de 1961, la cual en su artículo 11, en lo que nos interesa estipula “…Mientras no se pruebe lo contrario, pertenecen al Estado en carácter de reservas nacionales: a) Todos los terrenos comprendidos dentro de los límites de la República que no estén inscritos como propiedad particular, de las Municipalidades o de las Instituciones Autónomas; b) Los que no estén amparados por la posesión decenal;…”. En refuerzo de lo anterior se hace necesario analizar lo dicho por la primera Ley Forestal, la número 4465 de 25 de noviembre de 1969, acerca de la propiedad forestal. Ésta establecía en sus artículos 32 y 33 lo siguiente:” Artículo 32.- El patrimonio forestal del Estado está constituido por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública….” “Artículo 33.- Los terrenos forestales y bosques que constituyen el patrimonio forestal del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reivindicatoria del Estado por estos terrenos es imprescriptible.

En consecuencia, no son susceptibles de inscripción en el Registro Público mediante información posesoria; su invasión y ocupación serán sancionadas conforme con lo dispuesto en esta ley.”(lo resaltado es del redactor). Partiendo de lo transcrito, la primera ley forestal, catalogaba como bienes demaniales las áreas boscosas y terrenos de aptitud forestal dentro de las Reservas Nacionales, al calificarlas de inembargables, inalienables e imprescriptibles, no sujetas a apropiación particular, ésto desde mil novecientos sesenta y nueve. Posteriormente la Ley Forestal siguiente, la número 7032 de 7 de abril de 1986, contemplaba normativa respecto al patrimonio forestal del Estado y establecía lo mismo que la anteriormente transcrita en los mismos numerales. Ésta última normativa fue declarada inconstitucional, volviendo a restablecer la vigencia de la Ley 4465, ya mencionada. Para el año de mil novecientos noventa se promulga una nueva Ley Forestal, bajo el número 7174 del 28 de junio de 1990, la cual vuelve a consagrar la demanialidad del los terrenos con bosques y terrenos forestales de las Reservas Nacionales.

La ley en mención estuvo vigente hasta el cinco de febrero de 1996, fecha de promulgación de la actual Ley Forestal número 7575. Esta norma contempla nuevamente la demanialidad de las áreas boscosas y terrenos de aptitud forestal de las reservas nacionales al decir en lo que nos interesa en su artículo 13: “… El Patrimonio natural del Estado estará constituido por los bosques y terrenos forestales de las reservas nacionales …”. Así mismo el numeral 14 de dicho cuerpo normativo indica “…Los terrenos forestales y bosques que constituyen el patrimonio natural del Estado, detallados en el artículo anterior, serán inembargables e inalienables; su posesión por los particulares no causará derecho alguno a su favor y la acción reinvindicatoria del Estado por estos terrenos es imprescriptible. En consecuencia, no pueden inscribirse en el Registro Público mediante información posesoria y tanto la invasión como la ocupación de ellos será sancionada conforme a lo dispuesto en esta ley…”.

III.Consecuentemente con el análisis normativo anterior, es claro, existe un régimen especial aplicable a los recursos forestales, génesis de la propiedad forestal, con la vigencia de la ley. De lo expuesto no queda la menor duda las reservas nacionales están sometidas de derecho a este régimen de propiedad forestal, pues pertenecen al Estado y conforme a lo analizado los terrenos boscosos y terrenos de aptitud forestal no han salido de la afectación de bienes de dominio público dado a través de las diferentes leyes forestales han estado vigentes a través del tiempo hasta la actualidad.

IV.En el presente caso se trata de terrenos cubiertos en parte de bosques, lo cual a criterio del suscrito resulta suficiente para la denegación del título mediante el trámite de información posesoria, pues resulta son bienes afectos al dominio publico a partir del año mil novecientos sesenta y uno, al promulgarse la Ley de Tierras y Colonización y han continuado bajo tal demanio público hasta la actualidad. Es importante mencionar la Sala Constitucional ha sido vehemente en cuanto a que se analice por parte de los juzgadores a partir de cuando se afecta un bien al demanio público.- En ese sentido, la Sala Constitucional en Voto N° 4587 de las 15:45 horas del 5 de agosto de 1997, en el cual analizó la constitucionalidad del artículo 7 citado, dispuso para poder titular los terrenos ubicados en las zonas protegidas que ahí se señalan, debía el interesado demostrar la posesión diez años antes de la vigencia del Decreto respectivo.

Básicamente dijo la Sala en esa oportunidad: "… dada la naturaleza del bien que se pretende titular (cosa pública), el plazo de posesión apta para la usucapión debe transcurrir antes de que se produzca la afectación del bien al dominio público. Es decir, la declaratoria de área silvestre protegida evita que cuente la posesión posterior a la afectación, e impide concretar los requisitos de la usucapión si a ese momento no se ha adquirido el derecho, o sea, no han transcurrido los diez años de posesión apta para usucapir con las condiciones que establece la ley… resulta importante sintetizar los elementos básicos que a nivel de doctrina y jurisprudencia se manejan con estos temas, y que obligan al juez – en relación con la norma impugnada- a determinar en cada caso el tipo específico de acto posesorio que se ha ejercido en el fundo – que entra a formar parte del área silvestre protegida- que se pretende titular.

Lo anterior con el objeto de que el juez tenga un criterio más amplio – que no se limite a la fecha de entrada en vigencia de la ley o el decreto ejecutivo que defina los límites de un área silvestre determinada- para establecer con mayor precisión el momento en que dichos bienes se convirtieron en inalienables e imprescriptibles, a los efectos de determinar si sobre ellos se ejerció la posesión ad usucapionem durante diez años anteriores a que adquirieron esa condición. Esta perspectiva de mayor amplitud favorece la protección del patrimonio ambiental de la Nación, determina que cuando se pretenda titular – mediante el procedimiento de informaciones posesorias- un terreno ubicado dentro de un área silvestre protegida, la discusión no se reduzca al simple cálculo del tiempo que tiene de haber ingresado a un inmueble en relación con la fecha en que se haya producido la declaratoria de área silvestre protegida, ya que -por un lado deberá contemplarse a los efectos de acreditar la posesión ad usucapionem durante el plazo establecido en el artículo 7 de la Ley de Informaciones Posesorias, los elementos que cada tipo específico de posesión contempla, y –por otro lado- la posible existencia de normas que de antaño declaraban inalienables esos terrenos, aún antes de su afectación específica al dominio público…

". En el caso, valorada la prueba a conciencia y sin sujeción estricta a las normas de derecho común (artículo 54 de la Ley de Jurisdicción Agraria), el suscrito llega a la ineludible conclusión de que esta diligencia debe ser rechazada por comprender un bien que forma parte del Patrimonio Natural del Estado, al no haber sido demostrado por el titulante haber adquirido y consolidado un derecho de propiedad sobre el mismo con anterioridad a la afectación de las áreas de bosques de las reservas nacionales al demanio público según lo expuesto. También es importante tener presente la ley Forestal es la que regula todo lo que tiene que ver con el recurso forestal tanto privado como público, siendo de naturaleza especial, por lo que según lo expuesto los terrenos con bosque quedaron afectos a la demanialidad con la vigencia de la primera ley forestal dictaminada en el año de mil novecientos sesenta y nueve.

Lo anteriormente analizado también lleva a concluir a este servidor que al estarse discutiendo sobre áreas con bosques o montaña, priva el principio de especialidad de las normas, en este caso la Ley Forestal, que es la que regula el recurso forestal, contrario a lo resuelto en el voto de mayoría en cuanto a la aplicación del ordinal 7 de la Ley de Informaciones Posesorias, al ser ésta de carácter general. Aparte de lo anterior, el reconocimiento del derecho a un ambiente sano y ecológicamente equilibrado marca un hito en la historia ecológica del país. Contiene lineamientos de altísimo contenido axiológico cuyo desarrollo no es exclusivamente nacional. Por el contrario, se trata de un movimiento de carácter universal cuyo resultado ha sido colocar al derecho al ambiente sano y ecológicamente equilibrado como un verdadero derecho humano. Se le ubica dentro de los denominados derechos de la tercera generación: un paso adelante de los derechos humanos clásicos, civiles o políticos (de la primera generación) y de los económicos, sociales y culturales (de la segunda generación).

Ello ha dado base para formular una nueva clasificación jurídica: la del Derecho Ecológico. Hoy tiene un objeto muy definido en los recursos naturales, y su complejo de fuentes caracterizados por la organicidad y completez. Solo para mencionar dos documentos fundamentales impulsados por Naciones Unidas, en los cuales Costa Rica ha participado, deben recalcarse la "Declaración de la Conferencia de Naciones Unidas sobre el Medio Ambiente", celebrada en Estocolmo en junio de l972, y la "Declaración sobre el Derecho al Desarrollo", aprobado por la Asamblea General en su resolución 41-128 del 4 de diciembre de 1986. La primera, partiendo de que "el hombre es a la vez obra y artífice del medio que lo rodea, el cual se da el sustento material y le brinda la oportunidad de desarrollarse intelectual, moral, social y espiritualmente" establece como principios fundamentales -entre otros- los siguientes: "Los recursos naturales de la Tierra, incluidos el aire, el agua, la tierra, la flora y la fauna y especialmente muestras representativas de los ecosistemas naturales, deben preservarse en beneficio de las generaciones presentes y futuras mediante una cuidadosa planificación y ordenación... .

Debe mantenerse y, siempre que sea posible, restaurarse o mejorarse la capacidad de la Tierra para producir recursos vitales renovables... . El hombre tiene la responsabilidad especial de preservar y administrar juiciosamente el patrimonio de la flora y fauna silvestres y su habitad, que se encuentran actualmente en grave peligro por una combinación de factores adversos. En consecuencia, al planificar el desarrollo económico debe atribuirse importancia a la conservación de la naturaleza, incluidas la flora y la fauna silvestres... . Los recursos no renovables de la tierra deben emplearse en forma que se evite el peligro de su futuro agotamiento y se asegure que toda la humanidad comparte los beneficios de tal empleo... . Deberían destinarse recursos a la conservación y mejoramiento del medio, teniendo en cuenta las circunstancias... . A fin de lograr una más racional ordenación de los recursos y mejorar así las condiciones ambientales, los Estados deberían adoptar un enfoque integrado y coordinado de la planificación de su desarrollo con la necesidad de proteger y mejorar el medio humano en beneficio de su población... .

Todos los países, grandes o pequeños, deben ocuparse con espíritu de cooperación y en pie de igualdad de las cuestiones internacionales relativas a la protección y mejoramiento del medio ...". Por su parte en la "Declaración sobre el Derecho al Desarrollo" se proclama: "El derecho humano al desarrollo implica también la plena realización del derecho de los pueblos a la libre determinación, que inclusive, con sujeción a las disposiciones pertinentes de ambos pactos internacionales de derechos humanos, el ejercicio de su derecho inalienable a la plena soberanía sobre todas sus riquezas y recursos naturales ...".

V.Es importante hacer mención del Voto Nº 16975-2008 de las 14:53 horas del 12 de noviembre de 2008, dictado por la Sala Constitucional el cual hace referencia al Patrimonio Natural del Estado y su afectación al demanio público:"... IV.- La Sala considera que el decreto impugnado es inconstitucional en su totalidad, por vulnerar el artículo 50 de la Constitución Política, que reconoce el derecho a un medio ambiente sano y ecológicamente equilibrado. En efecto, como lo ha puesto de relieve el informe de la Procuraduría General de la República, el Patrimonio Natural del Estado es un bien de dominio público cuya su conservación y administración están encomendadas, por la ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a y 13 pfo.2°, y 14; Ley Orgánica del Ambiente, artículo 32, pfo. 2°). Lo integran dos importantes componentes: a) Las Áreas Silvestres Protegidas, cualquiera sea su categoría de manejo, declaradas por Ley o Decreto Ejecutivo: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° inciso i; Ley Orgánica del Ambiente 7554, artículo 32; Ley de Biodiversidad N° 7788, arts. 22 y sigts. y 58; Ley del Servicio de Parques Nacionales N° 6084, artículo 3° incs. d y f, en relación con la Ley Orgánica del MINAE N° 7152 y su Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, artículo 82, inciso a). b) Los demás bosques y terrenos forestales o de aptitud forestal del Estado e instituciones públicas (artículo 13 de la Ley Forestal), que tienen una afectación legal inmediata.

Para la zona marítimo terrestre, la misma Ley 6043 (artículo 73) excluye de su ámbito las Áreas Silvestres Protegidas y las sujeta a su propia legislación. El resto de áreas boscosas y terrenos de aptitud forestal de los litorales, están también bajo la administración del Ministerio del Ambiente y se rigen por su normativa específica (Ley Forestal, artículo 13 y concordantes)". En este voto la Sala Cosntitucional reconoce la demanialidad de los bosques pues estos pertenecen al Patrimonio Natural del Estado .

VI.En consecuencia, la normativa forestal establece, para todos los casos y en todo el territorio nacional -y no solo para unos-, un régimen especial aplicable a todos los recursos forestales, de donde nace la propiedad forestal. Las reservas nacionales están sometidas de derecho al régimen, pues perteneciendo al Estado la voluntad legislativa no exige ningún otro requisito, y solo procede la expropiación cuando tratándose de bienes privados se afecten para conformar parques nacionales, reservas forestales o biológicas, bosques o terrenos forestales. En este caso particular existe un área de bosque de aproximadamente 45 hectáreas, es decir un 30% de la finca a titular que conforma parte del patrimonio natural del estado. Partiendo de todo lo anteriormente expuesto, considera el suscrito y de conformidad con la Ley Forestal en sus ordinales 13, 14 y 15, y el ordinal 11 de la Ley de Tierras y Colonización tales terrenos son demanio público al ser parte de las reservas nacionales que integran el Patrimonio Natural del Estado, por lo que se deberá revocar el fallo dictado y en consecuencia rechazar las diligencias de información posesoria promovida por Los Remedios de la Vieja Sociedad Anónima.
