Nº392-2006 Nº392-2006 TRIBUNAL CONTENCIOSO ADMINISTRATIVO. SECCIÓN SEGUNDA. II CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, at fourteen hours and forty minutes on the thirty-first of August, two thousand and six.
Enforcement of judgment (ejecución de sentencia), processed before the Juzgado de lo Contencioso Administrativo y Civil de Hacienda, brought by the State, represented by the Deputy Attorney General (Procuradora Adjunta), Ana Cecilia Arguedas Chen Apuy, married, attorney-at-law, resident of Heredia, identity card CED17290, against Nombre37563, in a common-law union, farmer, resident of Tilarán, identity card CED48591. The persons named above are adults.
WHEREAS:
The opinion is drafted by Judge Fernández Argüello, and
CONSIDERING:
I).- The elements that were deemed proven are upheld, as they are supported by the record, except for item 5), which, for lack of relevance, is stricken.
II).- The section on unproven facts is stricken, as none were recorded.
III).- The appellant first argues that the first-instance judgment neither analyzed nor weighed the documentary evidence offered in a timely manner, which he considers improper. He likewise notes that in the criminal case brought against him, the State, having appeared as the civil plaintiff (actor civil), limited the damages and losses to a sum far lower than what is being awarded here; that the harm caused to the environment is negligible; and that, moreover, it is difficult to determine the degree of impairment because the land is now covered with vegetation. He further contends that the appraisal submitted by the plaintiff is disproportionate, arbitrary, and unreasonable compared to the one he submitted when answering these proceedings, which he argues is valid because it was prepared at the time the unlawful act was committed. For these reasons, he requests that the judgment be reversed in its entirety so as to conform to the latter document.
IV).- The Court first addresses the argument that the a quo failed to analyze the evidence submitted by Nombre37563 — an argument that, it must be said at the outset, has no merit. When responding to the itemization submitted by the plaintiff, Nombre37563 requested that a judicial inspection be conducted, which was in fact carried out (folio 58 verso, 60, 70 to 81); he likewise submitted a certificate issued by the Tribunal de Juicio de Cañas from the file of the civil damages action (acción civil resarcitoria) (folios 38 to 57 and 59). As the answer makes clear, the latter was introduced into the record to demonstrate that the State had limited its pecuniary claims in the criminal court to five hundred fifty thousand colones, and that on that basis the defendant argued that the financial claims in these proceedings could not exceed that amount. In this regard, this collegial body notes that the Judge did address that specific issue, in Considerando IV of his ruling, where he stated: "... with respect to the difference between what was itemized within the civil damages action and what is sought here; it is worth pointing out to the defendant that the claim in one proceeding does not limit the other.
For we are dealing with two proceedings of different kinds (one declaratory and the other an enforcement proceeding), and when an abstract condemnation (condenatoria en abstracto) is issued, what is precisely sought through this avenue is the itemization and proof of the damages caused by the facts that served as the basis for that declaration, that is, the conviction..." (folio 89). This demonstrates that both that piece of evidence and the defendant's arguments grounded therein were in fact considered, and therefore any claim of nullity in that regard must be dismissed.
V).- On the merits, the record shows that the Tribunal de Juicio de Guanacaste, sitting in Cañas, found the defendant herein, Nombre37563, to be the responsible perpetrator of the offense set forth in Article 61 of the Ley Forestal, and in that capacity sentenced him to one month of imprisonment, granting him the benefit of a suspended sentence (ejecución condicional de la pena) for a period of three years. It likewise upheld the civil damages action brought by the State against him and condemned him, in the abstract, to pay the damages and losses caused to the environment "... specifically for the unauthorized felling of trees carried out over an area of one hectare of the property (finca) of Nombre65986. The parties must proceed to the appropriate forum once this judgment becomes final, so that through a qualified expert the nature of those damages may be established and their liquidation carried out" (operative section of the criminal conviction, folio 165).
On the basis of the foregoing, the Procuradora itemized sixteen million two hundred forty-three thousand one hundred fifty-five colones and seventy-five céntimos (¢16.243.155,75) as environmental damage, relying on an "environmental appraisal (avalúo ambiental)" prepared by Engineer Randall Castro Salazar, Head of Subregional Development (Encargado de Fomento Subregional) Cañas-Monteverde, of the Arenal-Tempisque Conservation Area, a body that forms part of the Sistema Nacional de Areas de Conservación of the Ministerio de Ambiente y Energía. The defendant objected to that document on the ground that no more than what had been itemized in the civil damages action could be claimed in these proceedings; the Judge, in the challenged ruling, rejected that argument and awarded the requested sum, plus legal interest from the date that decision became final until actual payment. He also ordered the defendant to bear the court costs of this enforcement proceeding. Nombre37563 is dissatisfied and, in substance, reiterates the arguments advanced before the Juzgado, but those arguments are not well taken, as set out below.
VI).- The judgment of the Tribunal de Juicio de Guanacaste, which ordered the now-convicted party to pay for the environmental damage caused by his unlawful conduct, placed no limit whatsoever on the amount the State could claim under that head. When addressing the issue of civil liability arising from that criminal act, that Court stated:
"... In this proceeding the Procuraduría General de la República has appeared as the Civil Plaintiff, representing the State. The State is certainly entitled to appear as a party in proceedings of this type and to demand compensation from the responsible person, who in this case has been shown to be the defendant, who is also civilly liable, as stated, for the felling of trees that caused, as a consequence, serious environmental harm duly established by the MINAE officers who testified at trial, and which the Procurador described as significant harm to the air and soil resources that are vital for human survival and which also results in the destruction of habitats, negatively affecting the natural balance of the area — seeking reparation for the environmental damage to the environmental services (servicios ambientales) referred to in Article 3, subsection K of the Ley Forestal. Since this authority lacks the parameters to determine the quantum of those damages and losses, the Civil Defendant Nombre37563 is condemned IN THE ABSTRACT to pay the State, represented by the Procuraduría General de la República, the damages and losses caused by the felling of trees that occurred over an approximately one-hectare area on the aforementioned property.
The parties must proceed to the appropriate forum once this judgment becomes final, so that through a qualified expert the nature of those damages may be established and their liquidation carried out." (Judgment, folio 164, emphasis added.)
It should be noted, therefore, that no specific amounts are mentioned; rather, the enforcement proceeding was left to determine not only the extent of the harm but, above all, its concrete monetary quantification. Accordingly, since the judgment that serves as the title for these proceedings established no specific limit, neither can this Court impose one — doing so would constitute a violation of the sanctity of res judicata (cosa juzgada material) and would amount, beyond doubt, to ruling contrary to what has been adjudicated. The first-instance authority acted correctly in analyzing the appraisal submitted by the State's representative on the basis of the stated criteria, and likewise in rejecting the defendant's arguments that sought to reduce the successful civil plaintiff's claims to five hundred fifty thousand colones.
VII). — Several additional reasons support the thesis set forth in the preceding Considerando. — In the first place, the act committed, as provided under article 61 of the Ley Forestal, caused serious environmental damage (daño ambiental) that was duly established before the criminal court (sede penal), and that unquestionably gives rise to the full liability of the offender, both in criminal and civil terms, pursuant to articles 2, subsection d), and 101 of the Ley Orgánica del Ambiente, which respectively provide: "Whoever pollutes the environment or causes damage to it shall be liable, in accordance with the laws of the Republic and the applicable international conventions in force," and: "Without prejudice to any other form of liability that may arise from their participation in any capacity, those who commit violations of this law or of the laws governing the protection of the environment and biological diversity, whether natural or legal persons, shall be civilly and jointly and severally liable for the losses and damages caused …" — Both provisions are closely related to the text of article 50 of the Constitución Política, which not only confers upon every person the right to report acts or omissions that infringe the right to a healthy and ecologically balanced environment, but also to claim full redress (reparación integral) for the harm suffered, which is precisely what the State seeks in the present case. — Environmental crimes, moreover, have been characterized by the legislature as "social" in nature, since they affect the foundations of society's existence; "economic," as they attack the materials and resources essential to productive activities; "cultural," in that they endanger the way of life of communities; and "ethical," because they threaten the very existence of present and future generations (Ley Orgánica del Ambiente, article 2, subsection e.). — This justifies the requirement that the responsible party fully cover, from his own resources, all of the harm caused, so as to attempt to restore the delicate natural balance that was diminished or affected by his conduct, although it must be acknowledged that in a great many cases — as occurs when primary forest (bosque primario) is felled — this will not be possible, owing to the inherent material impossibility of returning to the situation that existed prior to the facts, even though whatever compensation is awarded will always serve as a fair palliative toward preserving and helping to maintain the country's natural resources. — In sum, the Costa Rican legal order obliges those who cause environmental harm to fully cover all losses and damages occasioned; in the present case, those losses were serious, and there is an identified responsible party. — The judgment that established both findings, issued by the criminal court with the force and authority of res judicata (cosa juzgada), condemned the latter in the abstract to provide the said redress, imposed no limitations whatsoever on the amount of the eventual compensation, left its determination for the judgment enforcement phase (fase de ejecución de sentencia), and established as the sole parameter the obligation to resort to expert assistance. — VIII). — Having clarified the foregoing, this Tribunal finds that the expert appraisal (peritaje) submitted in these proceedings by the State is not invalid, nor does it exceed the parameters of reasonableness, proportionality, and rationality, as alleged by the defendant. — The valuation (avalúo) was prepared by an engineer responsible for the Cañas Monteverde sub-regional development area of the Area de Conservación Arenal-Tempisque, a body that forms part of the Sistema Nacional de Areas de Conservación of the Ministerio de Ambiente y Energía; this is valid, as the Ley Forestal expressly empowers officials of the State Forest Administration to act as appraisal experts (article 50, final paragraph). — In these proceedings, the defendant had an opportunity to exercise his right of defense and could have raised any argument he deemed pertinent if he believed the content of that document was not legally sound, as well as submitting counter-evidence of a technical nature to demonstrate that, as he has continued to allege, the harm caused is insignificant; however, he did not do so, and rested his defense on other arguments that do not have the virtue of undermining the validity and efficacy of that appraisal. — Oficio ACA-T-OSC-238-2002, dated the twenty-sixth of June, two thousand and three, signed by Engineer Randall Castro of the aforementioned office (folios 14 and 15), states that it was based on the judgment of the Tribunal de Juicio de Guanacaste, the report submitted during those proceedings by a technician of the Ministerio de Ambiente y Energía, and the data personally provided by that official, according to whom the forest that was cleared had characteristics of primary forest based on reported diameters, and of secondary forest (bosque secundario) based on the species mentioned, with its recovery rate estimated at twenty-five years given the environmental conditions of the site.
It further states that in the negatively impacted area there existed a creek (quebrada) or drainage channel forming part of the farm's internal hydrological network, which was left unprotected by the logging (tala), and considers other environmental services (servicios ambientales) such as CO2 capture, scenic beauty, and biodiversity. — As methodology, the standards set out in the document entitled "Valoración de los Servicios Ambientales de los Bosques de Costa Rica," prepared by the Centro Científico Tropical for the Ministerio de Ambiente y Energía and the Overseas Development Administration (Administración de Desarrollo de Ultramar), were used; and the values applied are those recommended by experts for the World Bank (Banco Mundial). According to those values, the study states, "… the values of each environmental factor were multiplied by the logged area, then added together to obtain the total damage amount for a one-year period, which was then multiplied by the recovery rate of the eliminated ecosystem, thereby yielding the economic value of the damage …".
These calculations produced an amount of sixteen million two hundred forty-three thousand one hundred fifty-five colones and seventy-five céntimos (¢16.243.155,75), as environmental damages, broken down as follows:

Nombre37563 must pay as compensation (indemnización) for the environmental harm for which he has already been tried and finally convicted in criminal proceedings. — Mr. Nombre37563 did not submit, as he erroneously claims, any expert appraisal at the time of responding to this enforcement claim (liquidación); in his brief, he merely requested the conducting of a judicial site inspection (inspección ocular judicial) and submitted a certificate containing several items from the criminal proceedings, so there is no other technical or specialized opinion capable of rebutting the content of the appraisal that forms the basis of the State's claims, whose preparation has a legal basis and is considered fair. — Furthermore, the judgment being enforced established that the accused (imputado) significantly affected the air and soil resources and destroyed habitats, thereby negatively impacting the natural balance of the area; and it is the case that the report that serves as the basis for the claim — and, by extension, the first-instance ruling that, relying on it, established the liquidated sum to be paid — fully respects those findings and quantifies them, which is entirely consistent with the purpose and objective of this type of proceeding. — Finally, it should be added that the appellant failed to advance a single argument regarding the alleged disproportionality of the administrative valuation, which renders the objection untenable.
It was not sufficient here to assert that the appraisal contains a defect; the defect must be specifically identified, and the relevant evidence must be submitted (article 317 of the Código Procesal Civil), yet this did not occur, which compels the Court to dismiss the challenge. — IX). — On the basis of the foregoing, the contested ruling warrants approval. Nevertheless, it is considered appropriate to note that funds received by the State in matters such as this one must be used, in their entirety, toward the concrete pursuit of full redress for the environmental harm that gives rise to this type of claim — that is, directly and immediately, in the affected area. — This is so because, including by constitutional mandate — article 41 — the general mechanism of compensation is provided precisely in order to remedy any harm "… suffered in one's person, property, or moral interests." Likewise, it must be borne in mind that, as regards the protection of the environment, recognized as a fundamental right under the terms of article 50 of the Constitución Política (from which, incidentally, specific public powers also derive, inasmuch as it imposes upon the State — lato sensu — the obligation to provide this protection adequately), the amount approved herein must be applied toward restoring the affected resource to the situation that existed prior to the harmful event; the contrary — that is, if the amounts received are used for other purposes, as would occur if those funds were simply allowed to enter the unified treasury (caja única) and be diluted — improperly, it must be said — to sustain the multiple charges and obligations borne by the National Budget (Presupuesto Nacional) — would distort the very purpose for which compensation was awarded in this specific matter. — In essence, it is considered that the correct meaning of the criminal judgment being enforced, of this ruling, and of the right to a healthy and ecologically balanced environment, is that the compensation must serve to mitigate the harm caused; and this will not occur if the plaintiff herein may dispose of those funds as it sees fit, without immediately applying them to the mitigation of the environmental harm adjudicated by the Tribunal de Juicio de Guanacaste. —
THEREFORE:

Goicoechea, a las catorce horas cuarenta minutos del treinta y uno de agosto del dos mil seis.- Ejecución de sentencia, que se tramita en el Juzgado de lo Contencioso Administrativo y Civil de Hacienda, establecida por el Estado, en la persona de la Procuradora Adjunta, Ana Cecilia Arguedas Chen Apuy, casada, abogada, vecina de Heredia, cédula CED17290, contra Nombre37563 , en unión libre, agricultor, vecino de Tilarán, cédula CED48591.- Las personas citadas son mayores.-
RESULTANDO:
Redacta el Juez Fernández Argüello, y
CONSIDERANDO:
I).- Los elementos que se tuvieron como acreditados se avalan, por tener respaldo en los autos, salvo el 5), que por carecer de interés, se elimina.- II).- Se elimina el acápite de hechos indemostrados, pues no se consignó ninguno.- III).- Reclama en primer término el recurrente, que la sentencia de primera instancia no analizó, ni valoró la prueba documental ofrecida oportunamente, lo cual considera indebido. Asimismo, señala que en la causa penal que se siguió en su contra, el Estado, constituido como actor civil, limitó los daños y perjuicios a una suma muy inferior a la que aquí se está concediendo, que los menoscabos ocasionados al ambiente son insignificantes, y que además, es difícil determinar el grado de afectación, porque el terreno hoy está cubierto de vegetación.- Que el peritaje aportado por el actor es desproporcionado, arbitrario e irracional, en comparación con el que él presentó al momento de contestar estas diligencias, el que sí es válido, en virtud de que se realizó al momento de la comisión del ilícito.- Por esas razones, pide que se revoque en su totalidad el fallo, para que se ajuste al último documento que se indicó.- IV).- Se entra a resolver primero, el alegato de que el a quo omitió analizar las pruebas del señor Nombre37563, cuestión que, dicho sea desde ahora, carece de fundamento.- Al referirse a la liquidación formulada por el actor, don Nombre37563 solicitó la realización de un reconocimiento judicial, que efectivamente se llevó a cabo (folio 58 vuelto, 60, 70 a 81); del mismo modo, entregó una certificación expedida por el Tribunal de Juicio de Cañas, del legajo de la acción civil resarcitoria (folios 38 a 57 y 59); según se desprende de la contestación, esta última se trajo a los autos para demostrar que el Estado había limitado sus pretensiones pecuniarias en sede penal, en la suma de quinientos cincuenta mil colones, alegando con base en ello, que los reclamos patrimoniales en esta sede no podían exceder de ese monto.- En relación, advierte este órgano colegiado que el señor Juez sí se refirió a ese asunto concreto, en el Considerando IV de su resolución, donde expresó, que: "... en lo tocante a la diferencia existente entre lo que se liquidó dentro de la acción civil resarcitoria y lo que aquí se pretende; es rescatable hacerle ver al accionado que la pretensión de uno no limita al otro.
Pues estamos en presencia de dos procesos de diversa índole (uno declarativo y el otro, de ejecución), y al darse la condenatoria en abstracto, precisamente lo que se pretende es que en esta vía se liquiden y demuestren los daños ocasionados con los hechos que sirvieron de base a dicha declaratoria <sea la condena> ..." (folio 89). Lo cual pone de manifiesto, que sí se consideró tanto ese elemento probatorio, como los alegatos del accionado que se fundaban en ella, razón por la cual, debe descartarse la existencia de nulidad alguna al respecto.- V).- En cuanto al fondo, consta que el Tribunal de Juicio de Guanacaste, con sede en Cañas, declaró al aquí demandado, Nombre37563 , autor responsable del delito previsto en el artículo 61 de la Ley Forestal, y en tal condición, le impuso un mes de prisión, concediéndole el beneficio de ejecución condicional de la pena por un período de tres años.- Igualmente, acogió la acción civil resarcitoria, interpuesta por el Estado en su contra y lo condenó, en abstracto, a pagar los daños y perjuicios causados al ambiente, "... propiamente por la tala de árboles no permitida realizada en un área de una hectárea de la finca de Nombre65986 .
Debiendo ir las partes a la vía correspondiente una vez firme esta sentencia para sea (sic) por medio de un perito idóneo donde se establezcan cuáles fueron esos daños y para su respectiva liquidación" (parte dispositiva de la sentencia penal condenatoria, folio 165).- Con fundamento en lo anterior, la señora Procuradora liquidó dieciséis millones doscientos cuarenta y tres mil ciento cincuenta y cinco colones con setenta y cinco céntimos (¢16.243.155,75), por concepto de daño ambiental, y para ello, se fundó en un "avalúo ambiental", elaborado por el Ingeniero Randall Castro Salazar, Encargado de Fomento Subregional Cañas Monteverde, del Area de Conservación Arenal-Tempisque, órgano que integra el Sistema Nacional de Areas de Conservación, del Ministerio de Ambiente y Energía.- El llamado a juicio se opuso a ese documento, por estimar que no podía pedirse en esa sede más de lo liquidado dentro de la acción civil resarcitoria, y el señor Juez, en el fallo que se combate, desechó ese alegato y concedió la suma solicitada, más los intereses legales a partir de la firmeza de esa decisión y hasta el efectivo pago.
Asimismo, impuso al accionado el deber de cubrir las costas de esta ejecución.- El señor Nombre37563 se muestra inconforme, y en lo esencial, reitera los alegatos esgrimidos ante el Juzgado, pero éstos no son de recibo, según se expone seguidamente.- VI).- La sentencia del Tribunal de Juicio de Guanacaste, que impuso al hoy condenado, el pago de los daños ambientales ocasionados con su actuar ilícito, no limitó en forma alguna, el monto a reclamar por el Estado, por ese concepto.- Al referirse al tema de la responsabilidad civil derivada de aquel hecho punible, ese Despacho manifestó:
"... En este proceso se ha tenido como parte Actora Civil a la Procuraduría General de la República, en representación del Estado, ciertamente el Estado está legitimado en este tipo de procesos para constituirse como parte y exigir el resarcimiento de la persona responsable, que en este caso se ha demostrado que lo fue el encartado, quien también es responsable civilmente como se indicó por la tala de árboles causó como consecuencia un grave daño al ambiente que fue debidamente establecido por los oficiales del Minae que declararon en juicio, y que el Procurador estableció como la afectación significativa a los recursos aire y suelo, vitales para la supervivencia humana y que además produce la destrucción de hábitats influyendo negativamente en el equilibrio natural de la zona, pretendiendo la reparación del daño ambiental a los servicios ambientales que se citan en el artículo 3 inciso K de la Ley Forestal.
En vista de que esta autoridad no tiene los parámetros para establecer el cuantum de esos daños y perjuicios se condena EN ABSTRACTO al Demandado Civil Nombre37563 a pagarle al estado, representado por la Procuraduría generakl de la República, los daños y perjuicios causados con la tala de árboles que se dio en un área aproximada de una hectárea, en la finca mencionada. Debiendo ir las partes a la vía correspondiente una vez firme esta sentencia para que sea por medio de un perito idóneo donde se establezcan cuáles fueron esos daños y para su respectiva liquidación" (sentencia, folio 164, énfasis agregado).- Adviértase pues, que no se hace ninguna mención a cantidades específicas, sino que se dejó para la ejecución de sentencia, la determinación no sólo de la extensión de la lesión, sino sobre todo, la de su liquidación concreta.- Por allí, si el fallo que sirve de título a estas diligencias no estableció ningún límite concreto, tampoco puede hacerlo este Tribunal, que en tal caso, incurriría en una violación a la santidad de la cosa juzgada material y estaría resolviendo, indudablemente, contra lo ejecutoriado.- Actuó correctamente la autoridad de instancia, cuando analizó el peritaje aportado por la representación estatal con base en los criterios señalados, y también al desoír los alegatos del accionado, que propugnaban por reducir a quinientos cincuenta mil colones, las pretensiones del actor civil ganancioso.- VII).- Varias razones adicionales, abonan la tesis expuesta en el Considerando precedente.- En primer lugar, la acción cometida, prevista en el artículo 61 de la Ley Forestal, ocasionó un daño ambiental grave, que quedó debidamente acreditado en sede penal, y que genera sin duda alguna, la responsabilidad plena del infractor, tanto en ese orden punitivo como en el civil, en los términos previstos por los numerales 2 inciso d) y 101 de la Ley Orgánica del Ambiente, que disponen por su orden que: "Quien contamine el ambiente o le ocasione daño será responsable, conforme lo establezcan las leyes de la República y los convenios internacionales vigentes", y que: "Sin perjuicio de las responsabilidades de otra naturaleza que les puedan resultar como partícipes en cualquiera de sus formas, los causantes de las infracciones a la presente ley o a las que regulan la protección del ambiente y la diversidad biológica, sean personas físicas o jurídicas, serán civil y solidariamente responsables por los daños y perjuicios causados ...".- Ambas normas, guardan íntima relación con el texto del artículo 50 de la Constitución Política, que no sólo legitima a toda persona para denunciar los actos u omisiones que infrinjan el derecho a un ambiente sano y ecológicamente equilibrado, sino también para reclamar la reparación integral de la lesión inferida, que es lo que en este caso concreto, procura el Estado.- Los delitos ambientales, por lo demás, han sido calificados por el legislador, como de carácter "social", dado que afectan las bases de la existencia de la sociedad; "económico", ya que atentan contra las materias y los recursos indispensables para las actividades productivas; "cultural", en tanto ponen en peligro la forma de vida de las comunidades; y "ético", porque amenazan la existencia misma de las generaciones presentes y futuras (Ley Orgánica del Ambiente, artículo 2, inciso e.).- Lo cual justifica que el responsable deba cubrir, cabalmente, de su peculio, todos los menoscabos que ocasione, a fin de intentar restablecer el delicado equilibrio natural que, con su actuación, resultó disminuido o afectado, aunque debe reconocerse que, en muchísimos casos -como ocurre cuando se tala un bosque primario-, ello no será posible, por la imposibilidad material intrínseca que conlleva volver a la situación anterior a los hechos, aunque la indemnización que se conceda será siempre un justo paliativo, para preservar y contribuir a mantener los recursos naturales del país.- En suma, el ordenamiento costarricense obliga a los causantes de una lesión ambiental, a cubrir integralmente los daños y perjuicios ocasionados; en este caso aquéllos se produjeron de manera grave, y también hay una persona responsable.- El fallo que determinó ambas cosas, emitido en la sede penal con el carácter y autoridad de la cosa juzgada, condenó en abstracto a esta última, a hacer la indicada reparación, y no estableció limitaciones de ninguna índole, en cuanto al monto del eventual resarcimiento, cuya fijación dejó para la fase de ejecución de sentencia, y estableciendo como único parámetro, la obligación de acudir al auxilio pericial.- VIII).- Aclarado lo anterior, cabe expresar que no encuentra este Tribunal, que el peritaje aportado en autos por el Estado, resulte inválido, o que rebase los parámetros de razonabilidad, propiorcionalidad y racionalidad, como acusa el demandado.- El avalúo fue elaborado por un Ingeniero encargado del área de fomento subregional Cañas Monteverde, del Area de Conservación Arenal-Tempisque, órgano que integra el Sistema Nacional de Areas de Conservación, del Ministerio de Ambiente y Energía; lo cual resulta válido, pues la Ley Forestal habilita expresamente a los funcionarios de la Administración Forestal del Estado, para que actúen como peritos evaluadores (artículo 50, párrafo último).- En esta vía, el accionado tuvo oportunidad de ejercer su derecho de defensa, y pudo alegar cuanto considerara pertinente, si era que estimaba que el contenido de ese documento no se ajustaba a derecho, así como de aportar contraprueba técnica, para demostrar que, como ha venido alegando, el daño causado es insignificante; empero, no lo hizo, y basó su descargo en otros alegatos, que no tienen la virtud de restarle validez y eficacia a esa valoración.- El Oficio ACA-T-OSC-238-2002, del veintiséis de junio del dos mil tres, suscrito por el Ingeniero Randall Castro, de la oficina mencionada (folios 14 y 15), establece que se tuvo como base la sentencia del Tribunal de Juicio de Guanacaste, el informe rendido durante ese proceso por un técnico del Ministerio de Ambiente y Energía, y los datos suministrados personalmente por ese servidor, según el cual, el bosque que se eliminó tenía características de bosque primario por diámetros reportados, y de bosque secundario por las especies mencionadas, estimándose que su tasa de recuperación es de veinticinco años por las condiciones ambientales del sitio.
Asimismo, expresa que en el área impactada negativamente, existía una quebrada o drenaje de la red hídrica interna de la finca que quedó desprotegida por la tala, y considera otros servicios ambientales como captación de CO2, belleza escénica y biodiversidad.- Como metodología, se utilizaron los estándares que señala el documento denominado "Valoración de los Servicios Ambientales de los Bosques de Costa Rica", preparado por el Centro Científico Tropical para el Ministerio de Ambiente y Energía y la Administración de Desarrollo de Ultramar; y los valores aplicados son los recomendados por expertos para el Banco Mundial. Conforme a ellos, expresa el estudio, "... se procedió a multiplicar los valores de cada factor del medio ambiente por el área talada, para posteriormente sumarlos y obtener el monto del daño ocasionado en el período de un año, para luego ser multiplicado por la tasa de recuperación del ecosistema eliminado, con lo que se obtienen el valor económico del daño ...".
Las operaciones indicadas dieron como resultado, la cantidad de dieciséis millones doscientos cuarenta y tres mil ciento cincuenta y cinco colones, con setenta y cinco céntimos (¢16.243.155,75), por concepto de daños ambientales, según el siguiente desglose:
Área afectada (ha) Datos 1 hectárea -------------------------------------- La hectárea se multiplica por cada valor Bosque secundario ($1.500/ ha) ----------- 1.500,00 carbono ($43,89 h/año) ---------------------- 43,89 Biodiversidad ($32.00 h/año ---------------- 32,00 Agua ($35,6 h/año) ---------------------------- 35,60 Belleza ($25.1 h/año) -------------------------- 25,10 Total dólares ------------------------------------- 1.636,59 Años de recuperación del área afectada ---- 25 Valor en dólares a 25 años -------------------- 40.914,75 Tipo de cambio ---------------------------------- 397.00 Valor en colones --------------------------------- 16.243.155,75 Total de Daño ----------------------------------- 16.243.155,75 Este Tribunal, luego del análisis detenido de esa pericia, considera que los parámetros utilizados allí, resultan justos y muestran, de una manera razonable, los aspectos que se vieron afectados con la tala ilegal hecha por el aquí apelante.- Indudablemente, ello generó la pérdida del bosque propiamente dicho, es decir, del recurso maderero y forestal, se afectó la biodiversidad del área, el agua -por la desprotección de la quebrada-, y la belleza escénica, a la vez que se disminuyeron en forma real, las posibilidades de captar carbono naturalmente.- La valoración en dinero de esos menoscabos tampoco aparece como desprovista de fundamentos, pues según se indicó, toman como base el criterio de expertos y la guía de documentos técnicos del Ministerio de Ambiente y Energía, cuya validez, aquí no ha sido siquiera cuestionada objetivamente, por lo que merecen fe a este órgano que, al igual que el señor Juez de instancia, estima que la suma que resulta de ella, es la que debe pagar el señor Nombre37563 a título de inmdemnización, por las lesiones ambientales por las que ya se le juzgó y condenó en firme, en la vía penal.- Don Nombre37563 no presentó, como erróneamente indica, ningún peritaje al momento de contestar esta liquidación; en su memorial, se limitó a solicitar la realización de una "inspección ocular judicial" y a aportar una certificación con varias piezas del proceso penal, por lo que no existe ningún otro criterio de orden técnico o especializado, capaz de enervar el contenido del que sirve de base a las pretensiones del Estado, cuya elaboración tiene base legal, y se considera justo.- Por otra parte, la sentencia que se ejecuta estableció que el imputado afectó significativamente los recursos aire y suelo y destruyó hábitats, con lo que influyó negativamente el equilibrio natural de la zona; y es del caso que el informe que sirve base de cobro, y por ende, el fallo de primera instancia que con fundamento en él estableció la suma liquida a pagar, respetan enteramente esos postulados y los cuantifica, lo que se ajusta en un todo, al objeto y fin de este tipo de diligencias.- Finalmente, cabe agregar que el apelante no formuló un sólo argumento acerca de la alegada desproporcionalidad del avalúo administrativo, lo que torna en inatendible el reclamo.
Aquí, no bastaba con afirmar que éste contiene un defecto; debe decirse concretamente en qué consiste y aportar la prueba pertinente (artículo 317 del Código Procesal Civil), pero ello no ocurrió, lo que obliga a desestimar el cuestionamiento.- IX).- Con base en lo expuesto, cabe impartirle la aprobación al pronunciamiento combatido. Sin embargo, se estima oportuno señalar, que los dineros percibidos por el Estado en asuntos como el presente, deben ser utilizados, en su totalidad, en la búsqueda concreta de la reparación integral del menoscabo ambiental que motiva este tipo de demandas, es decir, de manera directa e inmediata, en la zona afectada.- Ello, en atención a que, inclusive por mandato constitucional -artículo 41-, se prevé el mecanismo general del resarcimiento, precisamente para arreglar todo daño "... recibido en su persona, propiedad o intereses morales." Asimismo, debe de tenerse en cuenta que, tratándose de la tutela al ambiente, reconocida como un derecho fundamental al tenor del artículo 50 de la Constitución (del que por cierto, también se derivan concretas potestades públicas, en tanto impone al Estado -lato sensu-, la obligación de efectuar en forma adecuada esta tutela), el monto aquí aprobado debe usarse, en orden a la restitución del bien a la situación anterior al hecho dañoso; lo contrario, esto es, si lo percibido por aquél se utiliza para otros fines, como ocurriría si se permite que esos montos simplemente ingresen en la caja única, y se diluyan -indebidamente, valga acotar-, para dar sostenimiento a la multiplicidad de cargas y obligaciones que soporta el Presupuesto Nacional, llevaría a desnaturalizar el fin mismo para el que se otorgó en este asunto específico.- En esencia, se estima que el sentido correcto de la sentencia penal que se ejecuta, y de este pronunciamiento, así como del derecho a un ambiente sano y ecógicamente equilibrado, es que la indemnización sirva para paliar el perjuicio ocasionado, lo que no va a acontecer, si el aquí actor puede disponer de esos fondos de la manera que le plazca, sin aplicarlos de una vez a la mitigación de la lesión ambiental juzgada por el Tribunal de Juicio de Guanacaste.-
POR TANTO:
