Res: [Telf1] COURT OF CRIMINAL CASSATION. Second Judicial Circuit of San José. Goicoechea, at eight o'clock in the morning on the twenty-fourth of February two thousand and four.

CASSATION APPEAL filed in the present case brought against [Nombre1], [Nombre2], adult, 49 years of age, married, farmer, national ID No. CED1, resident of El Espavel de Matina, for the offense of VIOLATION OF THE Ley Forestal in the form of ILLEGAL EXPLOITATION OF FOREST PRODUCTS to the detriment of THE STATE. Participating in the decision on the appeal are Judges [Nombre3], [Nombre4], and Jorge Luis Morales García. The following parties appeared in the cassation proceedings: Public Defender Atty. [Nombre5], Prosecutor Atty. [Nombre6], and Attorney General's Criminal Prosecutor Atty. [Nombre7] [Nombre8].

WHEREAS:

1. That by ruling issued at four hours and ten minutes in the afternoon on the twenty-seventh of January two thousand and three, the Trial Court (Tribunal de Juicios) of the First Judicial Circuit of the Atlantic Zone, Limón, held: In accordance with the foregoing, Articles 39 and 41 of the Political Constitution, 1, 30, 45, 71 through 74, of the Code of Criminal Procedure, [Nombre1] is declared the Responsible Author of the offense of VIOLATION OF THE Ley Forestal in the form of ILLEGAL EXPLOITATION OF FOREST PRODUCTS committed to the detriment of THE STATE, and in that capacity is sentenced to TWO MONTHS OF IMPRISONMENT. He is likewise ordered to pay the court costs of the trial. The sentence imposed shall be served with credit for any pre-trial detention already served, in the place and manner indicated by the Prison Regulations. Once the judgment becomes final, it shall be registered in the judicial registry. [Nombre9] [Nombre10], PRESIDING JUDGE.

2. That against the foregoing ruling, a Cassation Appeal was filed.

3. That upon completion of the corresponding deliberation in accordance with the provisions of Article 450 of the Code of Criminal Procedure, the Court considered the issues raised in the Appeal.

4. That in the proceedings, the applicable legal requirements have been observed.

DRAFTED BY JUDGE [Nombre11]; and,

CONSIDERING:

I.Procedural Appeal. — Atty. [Nombre5] has filed a cassation appeal on behalf of the accused [Nombre12] and alleges, as the first ground of appeal, the failure to observe Articles 39 and 41 of the Political Constitution; Article 11 of the Universal Declaration of Human Rights; Article 8.2 of the American Convention on Human Rights; and Articles 9, 142, 143, 178(a), 184, and 369(d) of the Code of Criminal Procedure, on grounds of insufficient reasoning in the judgment and violation of the rules of sound judgment (sana crítica), because the analysis of the testimony of [Nombre13], [Nombre14], and [Nombre15] is incomplete, cursory, superficial, and contradictory, since in fact none of them witnessed the accused cutting the Laurel tree at issue in this case, nor is it known whether the tree was felled or whether anyone actually made use of its timber. — The claim is not well-founded. Although none of the witnesses directly observed the accused cutting the Laurel tree in question, the judgment established that he was the author of the felling based on a series of indicia (indicios) which, considered together, reasonably allow for the conclusion that [Nombre16] indeed had control of the criminal act (dominio del hecho) with respect to the felling of said tree, namely: a) the accused informed [Nombre17] that he was going to cut the tree on the day of the incident; b) minutes later, [Nombre17] heard the noise of the tree falling after being cut, looked out, and observed the accused near the felled tree together with three other individuals; c) hours after the felling, the accused offered to pay [Nombre14] for the cut tree; and these indicia derive coherently from the testimony of [Nombre13], [Nombre14], and [Nombre15] as described in the ruling, which is sufficiently explained in Considerando III of the judgment on the merits (cf. folios 54 to 56).

II.Appeal on the Merits. — In this section of the appeal, Defense Atty. [Nombre5] alleges the failure to observe Article 61(a) of the Ley Forestal on the grounds that it was not proven that the tree was located in a forest or in a protected area (zona protegida), but rather in the yard of a community hall, such that the conduct does not constitute a criminal offense. — For her part, Prosecutor Atty. [Nombre18], in her written submission at folios 70 to 71, opposes this claim on the following grounds:

"The undersigned considers that the appellant is mistaken: Article 61(a) provides:

'A prison term of one month to three years shall be imposed on anyone who:

  • a)Exploits one or more forest products on private property without a permit from the State Forestry Administration (Administración Forestal del Estado), or on anyone who, even holding a permit, fails to comply with what has been authorized...' It is clear that the provision penalizes anyone who exploits forest products (a laurel tree) on private property without a permit from the AFE.

In the case at hand, the tree was in fact located within private property belonging to the Asociación de Desarrollo de 28 millas de Limón; the provision does not require that the land constitute a forest or a protected area, as the defense counsel suggests, and the accused cut the tree and made use of it (as evidenced by his offer to pay for it), thereby satisfying all the elements set out in the provision, as the trial judge held in his judgment.

The sole exception to the felling permit (permiso de corta) requirement is established in Article 28 of the Ley Forestal, for forest plantations (plantaciones forestales), agroforestry systems (sistemas agroforestales), and individually planted trees and their products. However, in the case at hand, the laurel tree cut by the accused was of natural origin, not planted, and therefore the corresponding permit was necessarily required" (folio 71).

The claim is well-founded. The challenged judgment established the following proven facts:

"A. That without specifying an exact date, but during the month of March two thousand and two, in the morning hours, the defendant herein, [Nombre16], appeared on land belonging to the Asociación de Desarrollo Integral de Veintiocho Millas de Matina de Limón, located in the locality of Veintiocho Millas, where he proceeded to cut a tree of the Laurel species without holding the corresponding permit from the State Forestry Administration, thereby illegally exploiting a forest product. B. The accused has prior convictions." (judgment, folio 52).

As can be seen, the foregoing account of proven facts does not contain sufficient information to determine whether Article 61(a) of the Ley Forestal (Ley 7575 of February 13, 1996) was applicable in this case, in accordance with the interpretation that the majority of the Court of Cassation has adopted regarding that criminal offense (tipo penal). Previously, some judges of this Court of Cassation considered that the simple act of cutting a timber tree, regardless of whether it formed part of a forest or a forest plantation, constituted the offense set out in the cited article — a position illustrated by the majority decision adopted by Judges Ulises Zúñiga Morales and [Nombre19] in voto 524-F-97 issued at 9:00 a.m. on June 27, 1997. However, in that same ruling, Judge Javier Llobet Rodríguez filed a dissenting opinion (voto salvado) and noted that, in view of the arguments of the appellant in that matter (Atty.

Magda Díaz Bolaños), she should be granted relief and the prevailing case-law standard should be changed, because not every felling of trees on private property constitutes a criminal offense; rather, the land must be forest-suitable (terrenos de aptitud forestal), and he developed a thorough explanation in his dissenting opinion of how Article 61(a) of the Ley Forestal must be interpreted in light of the principle of legality (principio de legalidad). Two months later, the Court of Cassation, composed of Judges Javier Llobet Rodríguez, Jorge Alberto Chacón Laurito, and Carmen Aguilar Mora, unanimously adopted the position of the first judge, and this latter standard has been reaffirmed in other rulings of this Court of Cassation, such as voto 845-F-97 issued at 10:00 a.m. on October 17, 1997 (by Judges [Nombre20], Carmen Aguilar Mora, and Jorge Alberto Chacón Laurito) and voto 2001-929 issued at 9:45 a.m. on November 16, 2001 (by Judges [Nombre3], Jorge Luis Arce Víquez, and Javier Llobet Rodríguez). The aforementioned precedent states, insofar as is relevant, as follows:

"The appellant is correct in its claim. Art. 61(a) of the Ley Forestal provides that a prison term of two months to two years shall be imposed on anyone who 'Exploits one or more forest products on private property without a permit from the State Forestry Administration, or on anyone who, even holding a permit, fails to comply with what has been authorized.' Said article, with respect to the concept of exploitation, has been interpreted in conjunction with Art. 3(a) of the Law, which defines 'timber exploitation (aprovechamiento maderable)' as:

'The act of felling, eliminating standing timber trees, or utilizing fallen trees, carried out on private lands, not covered under Art. 1 of this law, which generates or may generate any benefit, advantage, use, utility, or profit for the person performing it or for the person they represent.' From the combined reading of both articles, case law has concluded that the simple act of cutting a timber tree, regardless of whether it forms part of a forest or forest plantation, constitutes the offense contemplated in Art. 61(a) cited above (see voto 524-F-97 of this Court [with a dissenting opinion]).

Nevertheless, the judges of the Superior Court of Criminal Cassation designated to hear this matter consider that the foregoing case law must be changed.

The text of the criminal offense set out in Art. 61(a) is of great importance, as it refers to the exploitation '... of one or more forest products...' Regarding the interpretation of laws, the existence of various methods has been recognized, all of which are of course bounded by the principle of legality, provided for in Art. 1 of the Criminal Code and Article 39 of the Political Constitution, which is one of the fundamental principles of a State governed by the rule of law, a point on which there is consensus (see, for example: Sala Constitucional, voto 461-91).

It is significant that case law has tended to conceptualize 'forestal' [forest-related] as 'pertaining to trees,' which is incorrect. Indeed, if one looks up the term 'forestal' in the dictionary, one finds that it means 'pertaining to forests and their uses' (Vox Diccionario General Ilustrado de la Lengua Española, Barcelona, 1995, p. 517. See also: Larousse, Diccionario Usual, México, 1985, p. 266). Note further that the term 'forestal' derives from the Latin word 'foresta,' meaning forest. It is true that the Diccionario de la Real Academia, in defining 'forestal,' states that the term is understood to refer to what is 'pertaining to forests and the use of timber, pastures, etc.' (Diccionario de la Lengua Española, Real Academia Española, Madrid, twenty-first edition, 1992, p. 984). However, the term 'bosque' [forest] must be regarded as the fundamental element, and the reference to 'the use of timber, pastures, etc.' concerns the use of the forest, as indicated in other dictionaries." It should be noted that the objective elements of a criminal offense type (tipo penal objetivo) are composed of descriptive elements (elementos descriptivos) and, by way of exception, normative elements (elementos normativos).

It has been established that one consequence of the principle of legality (principio de legalidad) is that these latter elements should be avoided, owing to the legal uncertainty they introduce as a result of the evaluative discretion they grant to the adjudicator. For this reason, when interpreting an element of the criminal offense type, the starting point must be that the element is descriptive in character, unless there are sufficient reasons to conclude that it is not of this character but is instead normative. In the specific case at hand, there are no elements indicating that the term "forestal" (forestry/forest-related) should be understood in any sense other than that indicated above — that is, as a descriptive element. The foregoing is without prejudice to the fact that, indirectly, the term acquires normative characteristics, insofar as the Ley Forestal specifies concepts such as "bosque" (forest) and "plantación forestal" (forest plantation) (Art. 3 of the law).

Of relevance in supporting the foregoing with respect to the term "forestal" is that the ultimate purpose of the Ley Forestal is the protection and administration of forests and the use of forestry resources. This is made clear in Article 1 of the Ley Forestal, which specifies the objectives of that law — an aspect of paramount importance in interpreting its various provisions. That article provides:

"Objectives. This law establishes as an essential and priority function of the State to ensure the conservation, protection, and administration of natural forests and the production, harvesting (aprovechamiento), industrialization, and promotion of the country's forestry resources designated for that purpose, in accordance with the principle of adequate and sustainable use of renewable natural resources…" For its part, Article 3 of the law provides a series of definitions — for example, those of timber harvesting (aprovechamiento maderable), forest-aptitude lands (terrenos de aptitud forestal), forest ecosystem (ecosistema boscoso), forest, forest management plan (plan de manejo forestal), forest plantation, forest regime (régimen forestal), agroforestry system (sistema agroforestal), protected wildlife area (área silvestre protegida), primary processing center (centro de industrialización primaria), and environmental services (servicios ambientales).

Importantly, all of these definitions relate ultimately to the "forest regime," with the terms "forest" and "forest plantation" being particularly prominent. Reference must be made to the mention that has at times been made of Art. 3, paragraph a) of the Ley Forestal to justify the view that Art. 63, paragraph a) penalizes tree felling (corta de árboles) on non-forest lands. This argument relies on the reference in that article to tree felling not included in Art. 1. It has accordingly been argued that such felling is therefore disconnected from the law's objectives as set forth in Art. 1, mentioned above. This interpretation must be rejected — first, because Art. 1, as stated, is fundamental to the interpretation of the entire law insofar as it sets out its objectives. But the fundamental reason is that the reference made in Art. 3, paragraph a) to Art. 1 does not concern the first paragraph of that article — the relevant portion of which was quoted above — but rather the second paragraph of that same article, which, just like Art. 3, paragraph a), makes reference to tree felling, stating: "By reason of the public interest, and save as stipulated in Article 18 of this law, the felling or harvesting of forests in national parks, biological reserves, mangroves, protection zones, wildlife refuges, and State-owned forest reserves is prohibited." Of relevance with regard to the use of the concept of "forestal" as relating to forests, as previously noted, is that in the Ley Forestal the only article referring to the prohibition on cutting trees on private property that is neither forest nor plantation is Article 27.

That article provides: "Tree felling on agricultural and livestock land (terrenos de uso agropecuario) without forest cover may only be carried out upon prior authorization from the relevant Regional Environmental Council or municipality, and up to a maximum of five trees per hectare per year. For felling exceeding twenty trees per property, authorization from the State Forest Administration shall be required." This leads to the conclusion that, pursuant to a contrary-sense (a contrario sensu) interpretation, on lands without forest cover that are not agricultural and livestock land, the law imposes no prohibition whatsoever on tree felling. An attempt was made to remedy this through regulatory means. Thus, the Reglamento a la Ley Forestal, published in the Gaceta on January 23, 1997, defines what is to be understood by agricultural and livestock lands without forest cover, indicating that these are "those private farms with trees not established under an agroforestry system, or farms with areas of forest cover of less than two hectares, or trees located in urban areas" (Art. 2).

However, it is clear that this Regulation is inapplicable to the specific case at hand with respect to that definition. This is so, first and foremost, because the act under judgment was committed in early November 1995, and the Regulation was not even published until January 23, 1997 — such that any attempt to apply it would constitute a prohibited instance of retroactive application. Added to this is the fact that the Regulation, in defining what is meant by "agricultural and livestock lands," exceeds its bounds, losing sight of its purely executive character with respect to the law, since it attempts to encompass within the term "agropecuario" (agricultural and livestock) everything that is not of a forestry nature — which is inconsistent with the plain meaning of the word "agropecuario" (that is, relating to agriculture and livestock) — going so far as to reach the absurdity of classifying urban land as "agropecuario." In any event, it is even debatable what sanction applies to a violation of Art. 27 of the Ley Forestal — that is, with regard to tree felling on agricultural and livestock land — since the law establishes no penalty whatsoever for such conduct, and it is highly questionable whether, on that basis, it could be interpreted that in such a case Art. 61, paragraph a) of the Ley Forestal would apply, insofar as it refers to the harvesting of forestry products (productos forestales).

An interpretation to that effect would not in fact be consistent with the principle of legality, since nowhere in the law does it indicate that "forestry products" is to be understood as also encompassing tree products derived from land that is not forest but rather agricultural and livestock land. If one were to attempt an interpretation that included within Art. 61, paragraph a) of the Ley Forestal the felling of trees on agricultural and livestock land, one would have to proceed from the heading of Title Three of the Ley Forestal — "Private Forest Property" ("Propiedad Forestal Privada") — within which Art. 27 of the Ley Forestal is located. But an interpretation that sought by that route to expand the criminal offense type of Art. 61, paragraph a) of that law would not be consistent with the principle of legality, which requires clarity in the description of the prohibited conduct — clarity that would be absent under the interpretation described.

Important is the requirement to interpret legal provisions in conformity with the Constitución Política, of which constitutional doctrine speaks, which demands that it not be possible — through extensive systematic interpretations of the relevant criminal offense type — to deem as constituting an offense conduct that does not appear clearly described within the criminal offense type; for "forestal" is one concept and "agropecuario" is an entirely different one, and an interpretation claiming that the agricultural and livestock is equivalent to the forestry would lack any clarity.

In any event, in the specific case at hand one could not even speak of tree felling on "agricultural and livestock land," since the felling of the two trees took place on a plot of land intended for construction (see folio 35 front, lines 27–29).

At the risk of being repetitive, it must be emphasized that if it were maintained that tree felling as provided in Art. 27 of the Ley Forestal finds its sanction in Art. 63, paragraph a) of the Ley Forestal, the extension of the term "agropecuario" as set forth in the Reglamento a la Ley Forestal would, in addition to contradicting the executive character of the regulation with respect to the law, violate the very principle of legality (Art. 39 of the Constitución Política). This principle requires that the conduct classified as criminal be provided for in an ordinary law, and it cannot be done so in a mere regulation — all of which finds its basis in the Enlightenment doctrine that gave rise to the so-called separation of powers (Art. 9 of the Constitución Política). By way of exception, the Sala Constitucional has upheld the constitutionality of open-textured criminal statutes (leyes penales en blanco) — that is, laws which, with respect to the specification of one element of the criminal offense type, refer to a lower-ranking norm.

Of importance in this regard is that the Sala Constitucional has held that "it is possible to supplement a criminal provision by means of a regulation, provided that in doing so the Executive Branch remains within its proper sphere of competence and that the referring law establishes with sufficient clarity the conditions of punishability, as well as the type and extent of the penalty…" (Sala Constitucional, voto 1876-90). However, it is clear that by defining "agricultural and livestock lands without forest cover," the Reglamento a la Ley Forestal would extend the scope of the typified conduct (conducta típica) provided in the Ley Forestal and thereby exceed the competence of the Executive Branch. The same may be said of any attempt to use the word "árbol" (tree) as a synonym for "forestal," as the Reglamento a la Ley Forestal appears to intend when it uses the term "árbol forestal" (forest tree) (Art. 2).

In addition to the contrary-sense interpretation of Art. 27 of the Ley Forestal made above, of great relevance in this matter is the interpretation of Art. 63, paragraph a) in relation to Art. 56 of the Ley Forestal. The former of those articles classifies as criminal the violation of the aforementioned Art. 56. That article in turn states that "Log timber (madera en trozas), squared timber (madera encuadrada), and sawn timber (madera aserrada) originating from forest or plantation may not be transported without the corresponding documentation." Of importance is that, as the case law of the Tribunal Superior de Casación Penal has already established, only the unauthorized transport of timber "originating from forest or plantation" is penalized, but not the transport of timber originating from lands that are neither forest nor plantation — which is a significant argument for concluding that Art. 61, paragraph a) penalizes only the harvesting (and within it, the felling) of trees originating from forests or plantations.

It should be noted that the legislature sought to extend the "grip" of criminal law to various forms of conduct that form part of what we might call the "deforestation cycle" — to borrow the terminology used with respect to other types of offenses — so that the aim is to penalize not only conduct related to unauthorized tree felling on forest lands, but also the unauthorized transport of timber from trees on such land. There would therefore be no reason to penalize transport only when the timber originates from forests or plantations, yet — with respect to tree felling — to also penalize felling carried out on land that does not meet those characteristics.

It must be noted that there is great concern in Costa Rica for the protection of the environment, and within it of forests. Even in the Constitución Política, pursuant to the amendment introduced by ley 7412 of June 3, 1994, it was provided that:

"Every person has the right to a healthy and ecologically balanced environment. For that purpose, they are entitled to denounce acts that infringe upon that right and to claim reparation for the damage caused.

"The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties" (Art. 50, paragraphs 2) and 3)). The protection of the environment, including through criminal law (Derecho Penal), is one of the trends in comparative law (Derecho Comparado). However, this must not lead to an "inflation" of criminalized conduct that runs counter to the principle of Criminal Law as "ultima ratio" and to the harm principle (lesividad). It is true that, for the purpose of suppressing deforestation offenses, it is easier to penalize any tree felling, whether on forest lands or not. However, that would lead to an excessive expansion of Criminal Law, just as has occurred in Costa Rican practice, where, as noted, the mere felling of trees has been penalized even on urban land. Ultimately, reasons of mere convenience in suppressing certain offenses should not lead to extending prosecution to cases unrelated to the protected legal interest (bien jurídico protegido) (Environment: protection of forests).

It is clear that the State must act to prevent deforestation, that is, the destruction of forests. But the destruction of forests, if criminal prosecution is resorted to, can be addressed through penalizing the felling of trees within those forests, not the felling of trees that do not form part of forests. Therefore, it cannot be argued that this judgment leaves forests unprotected against deforestation; rather, it is consistent with the need to protect forests, bringing that protection to its proper measure, so that the argument of protecting forests does not result in the criminal penalization of tree felling in "non-forests." All of this follows not only from the principle of legality (principio de legalidad) mentioned above, but also from the harm principle itself. For all the foregoing reasons, since the conduct at issue in the present case constitutes conduct lacking typicity (conducta atípica), the proper course is to grant the appeal on the merits (recurso por el fondo) and acquit the defendant of the offense of violation of the Ley Forestal with which he has been charged.» (TCP, N° 682-F-97 de las 15:45 hrs. del 25 de agosto de 1997).

In the present case, the restrictive interpretation developed in the cited case law applies, because it was neither charged nor established whether the felled laurel tree formed part of a forest or a forest plantation (plantación forestal); indeed, the prosecutor did not specify any particular characteristic regarding the use, purpose, or designated vocation of the land where the tree was felled (in her brief at folio 71, the Prosecutor even states that such facts lack criminal relevance), but only that the land is the property of the Asociación de Desarrollo Integral de Veintiocho Millas de Matina de Limón, such that this imprecision regarding the location of the act makes it impossible to establish with certainty that the criminal offense (tipo penal) set forth in Article 61, subsection a) of the Ley Forestal applies in this matter. It is apparent that the defect in the detailed statement of facts (relación circunstanciada) originates in the charge itself filed by the Ministerio Público (cf. folios 15 and 16), and that this prosecuting party has shown no interest in correcting the defect, were such correction possible or appropriate.

The defendant, for his part, has defended himself against the charge of the Ministerio Público on the terms as presented, and only he has filed a cassation appeal (recurso de casación); consequently, by application of Article 432 of the Código Procesal Penal («Prohibición de la reforma en perjuicio» [Prohibition of Amendment to the Detriment of the Defendant]), the contested ruling may not be modified to his detriment, much less so when amending the defective charge with respect to the determination of the facts would require reverting the proceedings to a stage already barred by preclusion (cf. Article 179 ibídem), such that, since a retrial (juicio de reenvío) would be both impossible and futile, it is proper to directly acquit the defendant (see, in the same vein, ruling TCP, Nº 593 de las 9:07 hrs. del 26 de junio de 2003), given that the statement of proven facts does not contain the necessary elements to classify the charged conduct as constituting the criminal offense set forth in Article 61, subsection a) of the Ley Forestal. For all of the foregoing, the appeal on the merits is granted and the defendant [Nombre12] is acquitted of the offense with which he had been charged. Notify the parties.

POR TANTO:

The procedural appeal (recurso por la forma) is denied. The appeal on the merits is granted and the defendant [Nombre12] is acquitted of the offense with which he had been charged. Notify the parties.

Res: [Telf1] TRIBUNAL DE CASACION PENAL. Segundo Circuito Judicial de San José. Goicoechea, a las ocho horas del veinticuatro de febrero de dos mil cuatro.

RECURSO DE CASACION interpuesto en la presente causa seguida contra [Nombre1], [Nombre2], mayor, 49 años, casado, agricultor, con cédula N. CED1, vecino de El Espavel de Matina, por el delito de INFRACCION A LA LEY FORESTAL en su modalidad APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES en perjuicio de ES ESTADO. Intervienen en la decisión del recurso, los Jueces [Nombre3], [Nombre4] y Jorge Luis Morales García. Se apersonaron en casación, el defensor Público Lic. [Nombre5], la Fiscal Lic. [Nombre6] el Procurador Penal Lic. [Nombre7] [Nombre8].

RESULTANDO:

1. Que mediante resolución de las dieciséis horas con diez minutos del veintisiete de de enero de dos mil tres, el Tribunal de Juicios del Primer Circuito Judicial de la Zona Atlántica, Limón, resolvió: De conformidad con lo expuesto, artículos 39 y 41 de la Constitución Política, 1, 30, 45, 71 a 74, del Código Procesal Penal, se declara a [Nombre1] Autor Responsable del delito de INFRACCION A LA LEY FORESTAL en su modalidad APROVECHAMIENTO ILEGAL DE PRODUCTOS FORESTALES cometido en perjuicio de EL ESTADO y en tal caracter se el impone la pena de DOS MESES DE PRISION. Se le condena igulmente al pago de las costas del juicio. La pena impuesta la cumplirá previo abono de la preventiva sufrida, en el lugar y forma en que lo indiquen los Reglamentos Carcelarios. Firme la sentencia, inscríbase en el registro judicial. [Nombre9] [Nombre10], JUEZ DEL TRIBUNAL.

2. Que contra el anterior pronunciamiento, interpuso Recurso de Casación .

3. Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 450 del Código de Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el Recurso.

4. Que en los procedimientos se han observado las prescripciones legales pertinentes.

REDACTA EL JUEZ [Nombre11]; y,

CONSIDERANDO:

I.Recurso por la forma.- El Lic. [Nombre5] ha interpuesto recurso de casación en defensa del imputado [Nombre12] y acusa, como primer motivo de su recurso, la inobservancia de los artículos 39 y 41 de la Constitución Política; 11 de la Declaración Universal de Derechos Humanos; 8.2 de la Convención Americana sobre Derechos Humanos; 9, 142, 143, 178 inciso a), 184 y 369 inciso d) del Código Procesal Penal, por falta de fundamentación de la sentencia y violación a las reglas de la sana crítica, porque el análisis que se hizo de las declaraciones de [Nombre13], [Nombre14] y [Nombre15] es incompleto, escueto, superficial y contradictorio, pues lo cierto es que ninguno de ellos vio al imputado cortando el árbol de Laurel a que se refiere esta causa, ni se sabe si fue talado o si realmente alguien aprovechó su madera.- El reclamo no es atendible. Aunque ninguno de los testigos observó directamente al imputado cortando el árbol de la especie Laurel en cuestión, en la sentencia se estableció que él fue autor de la tala a partir de una serie de indicios que considerados conjuntamente permiten razonablemente tener la seguridad de que [Nombre16] efectivamente tenía el dominio del hecho respecto a la tala de dicho árbol, a saber: a) el imputado le informó a la [Nombre17] que iba a cortar el árbol el día del hecho; b) minutos despúes [Nombre17] escucha el ruido del árbol al caer cortado, se asoma y observa al imputado cerca del árbol caído junto a tres sujetos más; c) horas después de la tala el imputado ofreció pagarle el árbol cortado a [Nombre14]; y tales indicios se derivan coherentemente de los testimonios de [Nombre13], [Nombre14] y de [Nombre15] descritos en la resolución, lo que esta suficientemente explicado en el Considerando III de la sentencia de mérito (cfr. folios 54 a 56).

II.Recurso por el fondo.- En este capítulo del recurso el defensor Lic. [Nombre5] acusa la inobservancia del artículo 61 inciso a) de la Ley Forestal porque no se demostró que el árbol se encontrara en bosque o en zona protegida, sino que estaba en el patio de un salón comunal, por la que la conducta deviene atípica.- Por su parte, la fiscal Licda. [Nombre18], en su escrito de folios 70 a 71, se opone a este reclamo alegando lo siguiente:

«Considera la suscrita que no lleva razón el impugnante: El artículo 61 inciso A) establece:

"Se impondrá prisión de un mes a tres años a quien:

  • a)Aproveche uno o varios productos forestales en propiedad privada, sin el permiso de la Administración Forestal del Estado, o a quien auque cuente con el permiso, no se ajuste a lo autorizado..." Es claro que la norma sanciona a quien aproveche productos forestales (árbol de laurel), en propiedad privada, sin el permiso de la AFE.

En el caso que nos ocupa efectivamente el árbol se encontraba dentro de una propiedad privada que le pertenece a la Asociación de Desarrollo de 28 millas de Limón, la norma no indica que deba tratarse de un bosque o una zona protegida como lo hace ver el señor defensor y el encartado cortó el árbol y lo aprovechó, (puesto que pretendió pagar por él) por lo que se cumple con los presupuestos que establece la norma, tal y como lo establece el juez a quo en su sentencia.

La única excepción al permiso de corta se establece en el numeral 28 de la Ley Forestal, en plantaciones forestales, sistemas agroforestales y los árboles plantados individualmente y sus productos. Sin embargo en el caso que nos ocupa tenemos que el árbol de laurel cortado por el imputado fue de nacimiento natural, no fue plantado, por lo que necesariamente se requería el permiso correspondiente» (folio 71).

El reclamo es atendible. En la sentencia impugnada se tuvieron por acreditados los siguientes hechos:

«A. Que sin precisar fecha exacta pero, en el mes de marzo de dos mil dos, en horas de la mañana, el aquí imputado [Nombre16] se presentó en un terreno propiedad de la Asociación de Desarrollo Integral de Veintiocho Millas de Matina de Limón, mismo que se ubica en la localidad de Veintiocho Millas, donde procedió a cortar un árbol de la especie Laurel, sin que tuviera el respectivo permiso de la Administración Forestal del Estado, aprovechando en forma ilegítima un producto forestal. B. El imputado acusa juzgamientos anteriores» (sentencia, folio 52).

Como puede apreciarse, la anterior relación de hechos probados no contiene datos suficientes para establecer si en la especie resultaba de aplicación el artículo 61 inciso a) de la «Ley Forestal» (Ley Nº 7575 de 13 de febrero de 1996), conforme a la interpretación que la mayoría del Tribunal de Casación ha adoptado sobre ese tipo penal. Anteriormente algunos jueces de este Tribunal de Casación consideraron que la simple acción de cortar un árbol maderable, independientemente de si forma parte de un bosque o de una plantación forestal, era constitutiva del delito previsto en el artículo citado, tesis que ilustra la decisión que, por mayoría, adoptaron los jueces Ulises Zúñiga Morales y [Nombre19] en el voto Nº 524-F-97 de las 9:00 horas del 27 de junio de 1997. Sin embargo, en esa misma resolución, el juez Javier Llobet Rodríguez salvó el voto y señaló que teniendo en cuenta las argumentaciones de la recurrente en aquel asunto (Licda.

Magda Díaz Bolaños), debía dársele la razón y cambiarse el criterio jurisprudencial que se había venido sosteniendo, porque no toda corta de árboles en propiedad privada es delito, sino que se requiere que sea en terrenos de aptitud forestal, desarrollando en su voto salvado una amplia explicación de como debe interpretarse el artículo 61 inciso a) de la Ley Forestal a la luz del principio de legalidad. Dos meses después, el Tribunal de Casación, integrado por los jueces Javier Llobet Rodríguez, Jorge Alberto Chacón Laurito y Carmen Aguilar Mora, adopta unánimemente la tesis del primero, y este último criterio ha sido reiterado en otros votos de este Tribunal de casación, como los Nº 845-F-97 de las 10:00 horas del 17 de octubre de 1997 (por los jueces [Nombre20], Carmen Aguilar Mora y Jorge Alberto Chacón Laurito) y Nº 2001-929 de las 9:45 horas del 16 de noviembre de 2001 (por los jueces [Nombre3], Jorge Luis Arce Víquez y Javier Llobet Rodríguez). El precedente jurisprudencial mencionado señala, en lo que interesa, lo siguiente:

«La parte recurrente lleva razón en su reclamo. El Art. 61 inciso a) de la Ley Forestal indica que se impondrá prisión de dos meses a dos años a quien "Aproveche uno o varios productos forestales en propiedad privada sin el permiso de la Administración Forestal del Estado o a quien aunque cuente con el permiso no se ajuste a lo autorizado".

Dicho artículo en lo relativo al concepto de aprovechamiento ha sido interpretado en relación con el Art. 3 inciso a) de la Ley, que indica que "aprovechamiento maderable" es:

"Acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluída en el Art. 1 de esta ley, que genera o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa".

De la relación de ambos artículos se ha concluido por la jurisprudencia que la simple acción de cortar un árbol maderable, independientemente de si forma parte de un bosque o plantación forestal es constitutiva del delito contemplado en el Art. 61 inciso a), arriba mencionado (véase el voto 524-F-97 de este Tribunal (hay un voto salvado).

Sin embargo, los jueces integrantes del Tribunal Superior de Casación Penal designados para el conocimiento de este asunto, consideramos que debe variarse la jurisprudencia indicada.

Es de gran importancia el texto del tipo penal contemplado en el Art. 61 inciso a), en el que se hace mención al aprovechamiento "... de uno o varios productos forestales..." En lo relativo a la interpretación de las leyes se ha señalado la existencia de diversos métodos, todos lo cuales por supuesto encuentran como límite el principio de legalidad, previsto por el Art. 1 del Código Penal y el 39 de la Constitución Política, que es uno de los principios fundamentales de un Estado de Derecho, sobre lo que existe consenso (véase por ejemplo: Sala Constitucional, voto 461-91).

Importante es que se ha tendido por la jurisprudencia a conceptualizar "forestal" como "relativo a los árboles", lo que no es correcto. En efecto si se busca el término forestal en el diccionario se verá que quiere decir "relativo a los bosques y a sus aprovechamientos" (Vox Diccionario General Ilustrado de la Lengua Española. Barcelona, 1995, p. 517. Véase también: Larousse. Diccionario Usual, México, 1985, p. 266). Nótese incluso que el término forestal viene de la palabra del latín "foresta", sea bosque. Es cierto que el Diccionario de la Real Academia al definir "forestal" indica que por dicho término se entiende lo "relativo a los bosques y a los aprovechamientos de leñas, pastos, etc." (Diccionario de la Lengua Española. Real Academia Española, Madrid, vigésimo primera edición, 1992, p. 984). Sin embargo, el término "bosque" debe estimarse como el fundamental y lo concerniente a los "aprovechamientos de leñas, pastos, etc.", hace mención al aprovechamiento del bosque, tal y como se hace referencia en otros diccionarios.

Debe anotarse que el tipo penal objetivo de un delito se compone de elementos descriptivos y por vía de excepción de elementos normativos. Se ha estimado que una consecuencia del principio de legalidad es que deben evitarse estos últimos elementos, debido a la inseguridad jurídica que introducen, como consecuencia del ámbito valorativo que le conceden al juzgador. Por ello mismo debe partirse al momento de interpretación de un elemento del tipo penal de que éste es de carácter descriptivo, salvo que hayan razones suficientes para estimar que no es de este carácter, sino que es normativo. En el caso concreto no hay elementos que indiquen que el término forestal, deba ser entendido en sentido diverso al indicado arriba, sea como un elemento descriptivo. Lo anterior sin perjuicio de que en forma indirecta el término adquiere caracteres normativos, en la medida en que la ley forestal precisa conceptos como el de "bosque" y de "plantación forestal" (Art. 3 de la ley).

De relevancia para sostener lo anterior en cuanto al término forestal es que el fin de la ley forestal es en definitiva la protección y administración de los bosques y el aprovechamiento de los recursos forestales. Esto queda claro en el artículo 1 de la ley forestal, el que precisa los objetivos de dicha ley, aspecto que tiene una importancia capital en la interpretación de las diversas normas de la misma. Así se dispone:

"Objetivos. La presente ley establece como función esencial y prioritaria del Estado velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables...".

Por su parte el artículo 3 de la ley da una serie de definiciones, por ejemplo la de aprovechamiento maderable, terrenos de aptitud forestal, ecosistema boscoso, bosque, plan de manejo forestal, plantación forestal, régimen forestal, sistema agroforestal, área silvestre protegida, centro de industrialización primaria y servicios ambientales. Importante es que todas ellas se refieren en definitiva al "régimen forestal", destacándose en ellas los términos "bosque" y "plantación forestal". Debe hacerse referencia a la mención que se ha hecho en ocasiones del Art. 3 inciso a) de la Ley Forestal, para justificar que se sanciona en el Art. 63 inciso a) la corta de árboles en terrenos no forestales. Lo anterior en cuanto a la referencia que se hace en dicho artículo a la corta de árboles no incluida en el Art. 1. Así se ha expresado que por ello dicha corta está desvinculada de los objetivos de la ley fijados en el Art. 1, mencionados arriba.

Esta interpretación debe ser rechazada, en primer lugar ya que el Art. 1, como se dijo, es fundamental para la interpretación de toda la ley en cuanto menciona los objetivos de la misma. Pero la razón fundamental es que la referencia que se hace en el Art. 3 inciso a) al Art. 1, no es en lo relativo al párrafo primero del mismo, que fue transcrito en lo que interesa arriba, sino propiamente en lo concerniente al párrafo 2) del mismo artículo, que hace mención, al igual que el Art. 3 inciso a) a la corta de árboles, ello al decir: "En virtud del interés público y salvo lo estipulado en el artículo 18 de esta ley, se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológica, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado".

De relevancia en lo relativo a la utilización del concepto de "forestal" como concerniente a los bosques, a la que se hizo referencia antes, es que en la ley forestal el único artículo que se refiere a la prohibición de cortar árboles en propiedad privada que no sea bosques o plantaciones es el 27. En este se dispone: "Sólo se podrá llevar a cabo la corta de árboles en terrenos de uso agropecuario y sin bosque, obteniendo previamente la autorización del Consejo Regional Ambiental o de la municipalidad respectiva y hasta por un máximo de cinco árboles por hectárea por año. Para una corta que sobrepase los veinte árboles por inmueble se requerirá la autorización de la Administración Forestal del Estado". Ello lleva a que conforme a una interpretación a contrario sensu, en terrenos sin bosque y que no sean de uso agropecuario no hay ninguna prohibición en la ley para la corta de árboles. Esto trató de ser corregido por la vía reglamentaria.

Así el Reglamento a la Ley Forestal, publicado en la Gaceta del 23 de enero de 1997, que define qué se entiende por terrenos de uso agropecuario sin bosque, indicando que estos son "aquellas fincas privadas con la presencia de árboles no establecidos bajo un sistema agroforestal o fincas que tienen áreas con cobertura boscosa menores a dos hectáreas, o aquellos árboles ubicados en áreas urbanas" (Art. 2). Sin embargo, la no aplicación al presente caso concreto del Reglamento en lo relativo a dicha definición es clara. Ello en primer lugar debido a que el hecho que se juzga fue cometido a principios de noviembre de 1995, resultando que incluso el Reglamento fue publicado el 23 de enero de 1997, de modo que si se tratara de aplicar el mismo se estaría ante un supuesto prohibido de aplicación retroactiva. A lo anterior se agrega que el Reglamento al definir que se entiende por "terrenos de uso agropecuario", se excede, olvidándose el carácter meramente ejecutivo de la ley que tiene, por cuanto se trata de ubicar en el término "agropecuario" todo lo que no es forestal, lo que no concuerda con el sentido de la palabra "agropecuario" (sea que tiene relación con la agricultura y ganadería), llegándose incluso al absurdo de calificar de "agropecuario" lo urbano.

De todas maneras incluso es discutible qué sanción tiene la infracción al Art. 27 de la Ley Forestal, sea en lo relativo a la tala de árboles en terrenos de uso agropecuario, puesto que no se establece en la ley sanción alguna y es sumamente cuestionable que en virtud de ello pueda interpretarse que en tal caso, sería de aplicación el Art. 61 inciso a) de la Ley Forestal, en cuanto se refiere al aprovechamiento de productos forestales. Una interpretación en tal sentido no sería en realidad concordante con el principio de legalidad, puesto que en ninguna parte de la ley se indica que por productos forestales, se entienda también los productos arbóreos provenientes de un terreno que no es bosque, sino de un terreno de uso agropecuario. Si se intentara una interpretación que comprendiera dentro del Art. 61 inciso a) de la Ley Forestal la corta de árboles en terrenos de uso agropecuario tendría que partirse de la denominación del Título Tercero de la Ley Forestal, sea "Propiedad Forestal Privada", dentro del cual está ubicado el Art. 27 de la Ley Forestal.

Pero una interpretación que por esa vía tratara de ampliar el tipo penal del Art. 61 inciso a) de dicha ley, no sería concordante con el principio de legalidad, el que exige la claridad en la descripción de la conducta prohibida, claridad que no existiría con la interpretación indicada. Importante es el requerimiento de tratar de interpretar las normas conforme a la Constitución Política, de la que habla la doctrina constitucionalista, lo que exige que no sea posible que a través de interpretaciones sistemáticas extensivas del tipo penal respectivo, se llegue a considerar como típica una conducta que no aparece claramente descrita dentro del tipo penal, y es que un concepto es el de "forestal" y otro totalmente diverso es el de "agropecuario", no siendo clara una interpretación que dijera que lo agropecuario es forestal.

De todas maneras en el caso concreto ni siquiera podría hablarse de la existencia de una corta de un árbol en "terrenos de uso agropecuario", puesto que la corta de los dos árboles se dio en un terreno para construcción (véase folio 35 fte líneas 27-29).

A pesar de ser reiterativo debe recalcarse que si se sostuviera que la corta de árboles prevista en el Art. 27 de la Ley Forestal encuentra su sanción en el Art. 63 inciso a) de la Ley Forestal, la extensión del término agropecuario prevista en el Reglamento de la Ley Forestal además de contrariar el carácter ejecutivo del reglamento con respecto a la ley, violentaría el mismo principio de legalidad (Art. 39 de la Constitución Política). Este principio exige que el supuesto de hecho calificado como delictivo sea previsto en un ley ordinaria, no pudiéndose hacer ello en un simple reglamento, todo lo cual encuentra su fundamento en la doctrina de la Ilustración que dio origen a la llamada división de poderes (Art. 9 de la Constitución Política). Por vía de excepción la Sala Constitucional ha admitido la constitucionalidad de leyes penales en blanco, sea de leyes que en lo relativo a la precisión de uno de los elementos del tipo delictivo remite a una norma de menor rango.

Importante al respecto es que Sala Constitucional ha dicho que "resulta posible completar una norma penal por medio de un reglamento, siempre que al hacerlo el Poder Ejecutivo se mantenga dentro de su espera propia de competencia y que la ley que remite establezca con suficiente claridad los presupuestos de la punibilidad, así como la clase y extensión de la pena..." (Sala Constitucional, voto 1876-90). Sin embargo, es claro que con la definición de "terrenos de uso agropecuario sin bosque" el Reglamento de la Ley Forestal extendería el ámbito de la conducta típica prevista en la Ley Forestal y con ello de la competencia del Poder Ejecutivo. Lo mismo puede decirse de cualquier intento de utilizar la palabra "árbol" como sinónimo de "forestal", como al parecer pretende el Reglamento de la Ley Forestal al usar el término "árbol forestal" (Art. 2). Además de la interpretación a contrario sensu del Art. 27 de la Ley Forestal, hecha antes, tiene gran relevancia en este asunto la interpretación del Art. 63 inciso a) en relación con el Art. 56 de la Ley Forestal.

El primero de dichos artículos sanciona como delictivo la infracción del Art. 56 mencionado. Este artículo por su parte indica que "No se podrá movilizar madera en trozas, encuadrada ni aserrada proveniente de bosque ni de plantación, si no se cuenta con la documentación respectiva". De importancia es que, como ya lo ha dicho la jurisprudencia del Tribunal Superior de Casación Penal, se sanciona sólo el transporte no autorizado de madera "proveniente de bosque o plantación", pero no el transporte de madera proveniente de terrenos que no sean bosque o plantación, lo que es un argumento de relevancia para estimar que el Art. 61 inciso a) sólo sanciona el aprovechamiento (y dentro de éste la corta) de árboles provenientes de bosques o plantaciones. Nótese que el legislador trató de extender "las tenazas" del Derecho Penal a diversas conductas que forman parte de lo que podríamos llamar el "ciclo de la deforestación", parafraseando la terminología que se ha utilizado con respecto a otros tipos de delitos, de modo que se trata de sancionar no sólo las conductas relacionadas con la corta de árboles no autorizada en terrenos forestales, sino también el transporte no autorizado de la madera de árboles de dicho terreno.

Por ello no habría razón alguna para sancionar el transporte solamente cuando la madera proviene de bosques o plantaciones, pero en lo relativo a la corta de árboles sancionar la realizada aun en terrenos que no reúnan esas características.

Debe indicarse que existe una gran preocupación en Costa Rica por la protección del medio ambiente, y dentro de éste de los bosques. Inclusive en la Constitución Política, de acuerdo con la reforma producida por la ley 7412 del 3 de junio de 1994 se dispuso que "Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.

El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes" (Art. 50 párrafo 2) y 3)). La protección del medio ambiente, incluso por la vía penal, es una de las tendencias dentro del Derecho Comparado. Sin embargo, ello no debe llevar a una "inflación" de conductas delictivas que vaya en contra del principio del Derecho Penal como "ultima ratio" y del de "lesividad". Es cierto que es más fácil para la represión de los delitos de deforestación que se sancione cualquier corta de árbol, sea ésta en terrenos forestales o no. Sin embargo, ello llevaría a una extensión desmedida del Derecho Penal, tal y como ha ocurrido en la práctica costarricense, en la que se ha llegado, como se dijo, a sancionar simples cortas de árboles incluso en terrenos urbanos. En definitiva razones de mera conveniencia en la represión de determinados delitos no deberían llevar a extender la represión a supuestos diversos a los relacionados con el bien jurídico protegido (Medio Ambiente: protección de los bosques).

Importante es que es claro que debe actuarse estatalmente para evitar la deforestación, sea la destrucción de los bosques. Pero la destrucción de éstos, si se recurre a la incriminación penal, se puede tratar de evitar a través de la sanción en caso de tala de árboles en dichos bosques y no de la sanción a la tala de árboles que no forman parte de bosques. Por todo ello no puede sostenerse que esta sentencia, suponga la desprotección de los bosques frente a la deforestación, sino más bien es coherente con la necesidad de proteger los bosques, llevando dicha protección a la justa medida, de manera que con el argumento de proteger los bosques no se llegue a sancionar penalmente la corta de árboles en los "no-bosques". Todo ello es consecuencia no sólo del principio de legalidad, arriba mencionado, sino del mismo principio de lesividad. Por todo lo anterior estándose en el caso concreto ante una conducta atípica, lo correcto es declarar con lugar el recurso por fondo y absolver al imputado del delito de infracción a la ley forestal que se le ha venido atribuyendo.» (TCP, N° 682-F-97 de las 15:45 hrs. del 25 de agosto de 1997).

En el presente caso es de aplicación la interpretación restrictiva desarrollada en la jurisprudencia citada, porque no se acusó ni acreditó si el árbol de laurel cortado formara parte de un bosque o de una plantación forestal, en realidad el acusador no precisó ninguna característica particular sobre el uso, destino o vocación del terreno donde se cortó el árbol (en su memorial de folio 71 la Fiscal incluso señala que tales datos carecen de relevancia penal), sino tan solo que es propiedad de la Asociación de Desarrollo Integral de Veintiocho Millas de Matina de Limón, de manera tal que por esa imprecisión acerca del lugar del hecho no se puede tener certeza de que en este asunto sea de aplicación el tipo penal previsto en el artículo 61 inciso a) de la Ley Forestal. Se aprecia que el defecto en la relación circunstanciada del hecho tiene su origen en la propia acusación que planteó el Ministerio Público (cfr. folios 15 y 16), y que este actor penal no ha tenido ningún interés en la enmienda si fuere posible o pertinente de tal defecto.

Por su parte el imputado se ha defendido de la acusación del Ministerio Público en los términos que este la ha planteado, y sólo él ha interpuesto recurso de casación y, de modo que por aplicación del artículo 432 del Código Procesal Penal («Prohibición de la reforma en perjuicio») la resolución impugnada no puede modificarse en su perjuicio, mucho menos cuando la enmienda de la acusación defectuosa en punto a la determinación del hecho implicaría retrotraer el proceso a una etapa ya precluida (cfr. artículo 179 ibídem), de manera tal que al resultar imposible e inútil el juicio de reenvío procede absolver directamente al imputado (en este mismo sentido véase la resolución TCP, Nº 593 de las 9:07 hrs. del 26 de junio de 2003), dado que la relación de hechos probados no reúne los elementos necesarios para encuadrar la conducta acusada como constitutiva del tipo penal previsto en el artículo 61 inciso a) de la Ley Forestal. Por todo lo dicho se declara con lugar el recurso por el fondo y se absuelve al imputado [Nombre12] por el delito que se le había venido atribuyendo. Notifíquese.

POR TANTO:

Se declara sin lugar el recurso por la forma. Se declara con lugar el recurso por el fondo y se absuelve al imputado [Nombre12] por el delito que se le había venido atribuyendo. Notifíquese.
