Criminal case 25-000101-1262-PE brought against [Nombre 001] for the offense of MOVEMENT OF TIMBER FROM A FOREST OR PLANTATION, to the detriment of NATURAL RESOURCES.
Appeal from a criminal judgment filed by attorney Diego Umaña Sánchez, representative of the Public Prosecutor’s Office. Deciding the matter are Judge Xiomara Gutiérrez Cruz and Judges Jaime Robleto Gutiérrez and Marco Mairena Navarro;
Findings:
SOLE. By judgment number 144-2025, issued at nineteen hours and forty-two minutes on tres de abril del dos mil veinticinco, the Flagrante Delicto Court of the Second Judicial Circuit of the Southern Zone, Corredores Seat, ruled: “POR TANTO: Based on the foregoing and pursuant to Articles 39 and 41 of the Constitution; 1, 2, 6, 9, 142, 265, 267, 360, 364, 365 and 366 of the Code of Criminal Procedure; 1, 45 and 110 of the Criminal Code; and Articles 3, 56 and 61(b) of Ley Forestal number 7575, [Nombre 001] is acquitted of all punishment and liability for the offense of ILLEGAL TRANSPORTATION OF FOREST PRODUCTS, to the detriment of LEY FORESTAL AND FOREST RESOURCES. No special award of costs is made. REGARDING FORFEITURE (COMISO): Pursuant to Ley 6106, if the timber seized in this case was not auctioned, information that may be verified in the record, it is ordered returned to whoever holds title to it and proves such ownership with the corresponding documentation.
Likewise, the return of vehicle [Valor 001], Model 1996, brand Hyunda y, is ordered. For the foregoing, a period of 30 business days after this judgment becomes final is granted for it to be claimed; otherwise, if that period elapses without any interested party coming forward, its forfeiture and donation to the State are ordered. Considerations:
I.Admissibility: Prosecutor Diego Umaña Sánchez challenged oral judgment number 144-2025, issued by the Flagrante Delicto Court of the Second Judicial Circuit of the Southern Zone, Corredores Seat, at nineteen hours and forty-two minutes on tres de abril del dos mil veinticinco. The appeal is admissible because it was filed within the prescribed time and satisfies the requirements necessary for consideration of the objections raised, pursuant to Article 8.2(h) of the American Convention on Human Rights and Articles 458, 459, 460 and 462 of the Code of Criminal Procedure.
II.In the sole ground of his challenge, the prosecutor alleges a lack of analytical or intellectual reasoning, pursuant to Articles 142, 143, 184, and 363 of the Code of Criminal Procedure (Código Procesal Penal). The appellant states: “In the judgment being challenged, the judge did not provide complete analytical or intellectual reasoning regarding the testimonial evidence presented at the oral and public trial and the documentary evidence contained in the case file, because, upon reviewing and analyzing the oral judgment issued by the court, beginning at minute 26:25 of the recording, the Judge can be heard stating that, once the testimonial and documentary evidence had been analyzed, only one conclusion could be reached, and she states verbatim: ‘once both the accusation and the facts brought before the Court by the Public Prosecutor’s Office today are analyzed, this judge considers that these facts specifically fit, as the Public Prosecutor’s Office points out, Article 61(b), acquiring or processing forest products without complying with the requirements established by law; this judge considers that it was not demonstrated, at least by the officers, how you acquired or processed forest products.
We therefore move to the following point: with respect to this prohibited act of acquiring or processing a forest product, it must not be overlooked that the burden rested with the Public Prosecutor’s Office, and the fact is that what the officers reported is that you were arrested while transporting this timber, not acquiring or processing it. These are very different situations; they are facts, yes, very different situations from what the Public Force officers have described. There is no item of evidence, nor any further information showing that the officers pursued the matter or investigated further, or that the Public Prosecutor’s Office requested any type of report providing somewhat more detail about how you had acquired or were processing this timber. The fact is what was recounted today, and the officers came to describe what they saw and what actions they took at that time, but nothing beyond the transportation of the product can be drawn from their testimony.
And if we turn to Article 56, which concerns the movement of timber, it states that logs, squared timber, or sawn timber originating from a forest or plantation may not be moved without the corresponding documentation. We also see that both officers state that it was private property and that they heard sawing taking place on that private property, but we must also examine what Article 56 means when it speaks of a forest or plantation. Article 3 of this law, specifically subsection (d), also speaks of forests, defining a forest as a native, indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares. No inspection conducted at the site was presented here as evidence to determine that this was a forest, because we must bear in mind that it must consist of two or more hectares; they merely said that it was a property.
We see that many people may call something small, some trees, or a few trees a forest, but what is called a forest? No measurement was taken, and there was no further information as to whether it exceeded two or more hectares, with characteristics involving the presence of mature trees of different ages, species, and varying sizes, with one or more canopies covering more than seventy percent. Again, I reiterate, there was no inspection or SINAC report describing what that forest was like or what the place from which this was removed was like. As for a forest plantation, addressed in subsection (f), it is defined as an area of one or two hectares cultivated with one or more forest species whose principal, though not exclusive, purpose is timber production. Likewise, if what they state is that, at the time, you were found moving this timber or transporting it in your vehicle, the fact remains that it is unclear whether this actually came from a forest plantation.
There is not a single report; the Public Prosecutor’s Office did not examine this evidence in greater depth. It bases its accusation solely on the report and the events that occurred at the time, but it does not investigate further whether this was in fact the case or whether the principal purpose of that location was timber production. Although the officers identified it as one species, the second officer stated that he was unfamiliar with it; basically, he knew its name but did not know whether it was good timber or what it was used for. What he stated was that there were few specimens of that tree, but he provided no further information about the location, specifically the area from which this timber was extracted. I reiterate that, in the absence of any report or expert examination demonstrating the case advanced by the Public Prosecutor’s Office, what actually occurred at that location is, to some extent, unclear.
You are accused of having been arrested while transporting these pieces of timber, but this conduct is not itself described in Article 61 of Ley 7575, which specifically refers to acquiring or processing forest products. For this judge, the conduct you engaged in has not been duly demonstrated. The evidence does not go beyond the officers’ account placing you there and indicating that you said you were hauling or performing, providing, that transportation service; however, this does not establish whether you purchased or acquired this timber. This entire situation, in the Court’s view, creates a state of doubt. For this judge, what occurred there and what was described in the charging instrument (pieza acusatoria) remain unclear, and this doubt is insurmountable; consequently, the presumption of innocence (principio de inocencia) cannot be deemed to have been overcome. From this perspective, this judge considers it appropriate to acquit you of all punishment and liability.’ The honorable Judge argues or grounds this doubt essentially on the Public Prosecutor’s Office’s failure to determine how the timber transported by the accused, [Nombre 001], was acquired and processed, and on the fact that the act of ‘transporting’ is not described in Article 61 of the Ley Forestal.
In addition, the testimony of SINAC officials Oscar Beita Beita and Jairo Rodríguez Jiménez establishes that the accused was unlawfully transporting timber in his vehicle, but those officials did not determine how the accused, [Nombre 001], had acquired and processed that timber. As a first point, it may be observed that the honorable Judge essentially bases her doubt regarding the defendant’s criminal liability on the inability to determine how the timber in question—18 pieces of timber—was acquired and processed. If we specifically analyze Article 61 of the Ley Forestal—an important matter, even though it is understood that this appeal concerns the judgment’s lack of analytical or intellectual reasoning—subsection (b) specifically states as follows: ‘Acquires or processes forest products without complying with the requirements established in this law.’ An analysis of this subsection shows that its objective elements do not specify the manner or place in which forest products are acquired or processed, but it does state ‘without complying with the requirements established in this law.’ This is an important point to emphasize because the judge did not analyze either the testimonial or the documentary evidence.
It was established that, after SINAC officials advised the defendant of the fundamental rights afforded to him when he was approached, he stated that he had no permit whatsoever. This testimony is reinforced by the documentary evidence offered and admitted by the local Flagrante Delicto Court (Tribunal de Flagrancia) at the continuation hearing, appearing at folio 21 of the principal case record in official letter SINAC-ACOSA-DRFVS-SRP-044- 2025, which establishes that the accused had no permits for timber harvesting and transportation. This is further supported by the fact that, throughout the proceedings, no documentation was submitted demonstrating that the accused did have permits relating to the proven facts. This prosecutorial authority considers that the judge did not conduct this analysis and instead based her reasoning solely and repetitively on the proposition that the testimony of the SINAC officials, together with the lack of investigative measures or expert examinations, did not make it possible to determine how the timber unlawfully transported by the accused, [Nombre 001], had been acquired or processed.
As a second point, the judge bases her judgment on and reads Articles 56 and 3 of the Ley Forestal, which concern the events that were investigated but were not even raised at the oral and public trial because the charges concern other acts, namely the acquisition and transportation of timber without the permits required by law. This situation demonstrates to this prosecutorial authority a lack of congruence between the accusation and the judgment and, in fact, raises doubts about the analysis underlying that reasoning because, at least in this respect, the judge merely raises questions for herself regarding the meaning of the words contained in those provisions, without thereby rebutting or establishing the facts litigated at trial. The existing error is therefore a violation of the rules of sound judicial evaluation (sana crítica), specifically the rules of logic, because it breached the principle of derivation or sufficient reason (principio de derivación o razón suficiente), ‘which consists, in general terms, in the requirement that all reasoning, in order to be valid, must consist of rational deductions based on the evidence presented at trial and on the successive conclusions established on that basis, such that an infringement of this principle may render the judgment ineffective if it is shown that the reasoning “takes a leap into the void”; that is, that wholly improper conclusions are drawn from certain premises.’ As a third and final point, in the analysis on which the judge bases the reasoning of her judgment, she completely disregards the verb ‘transport,’ which is indeed described in Article 61 of the Ley Forestal, specifically in subsection (d), which states: ‘Removes forest products from private or State property or transports forest products obtained in the same manner.’ The reasoning of the oral judgment transcribed here focuses on the acquisition and harvesting of timber and, in only a very few isolated statements, alludes to and affirms that transportation was indeed demonstrated, but provides no further discussion of that conduct and states that transportation is not described in that provision.
This shows a complete disregard of what Article 61 of Ley 7575 penalizes in its various subsections. The reasoning supporting the acquittal neither explains nor states why unlawful timber transportation was not established and analyzes only, as has repeatedly been stated, the acquisition and harvesting of timber. This prosecutorial authority cannot provide more extensive reasoning on this point because the transportation of timber was not even analyzed; it was merely stated that it was not described in the provision.
This Office considers that, under the rules of experience and logic, it is important to point out that, in order to transport any product requiring permits, it must first have been acquired in some manner, whether or not in compliance with the established requirements. Otherwise, we would have an inexplicable number of judgments of acquittal (sentencias absolutorias) simply because the origin of a product is unknown, leaving unpunished the transportation of any legal or illegal product, with or without the respective permits. The case before us is no exception: in order to transport lumber, it necessarily had to be acquired in some manner, and this was done without the permits required by administrative rules and regulations. These actions satisfy the elements of an offense, are unlawful, and are culpable (típicas, jurídicas y culpables), since they are provided for in Article 61, subsections b) and d), of the Ley Forestal and were proven as such at the oral and public trial (debate oral y público)” [sic].
The appellant requests that the judgment be vacated and the case remanded for new proceedings (reenvío para nueva sustanciación). In responding to the hearing granted, public defender Ana Laura Sánchez Bertarioni stated: “After analyzing the prosecutor’s arguments, it is apparent that they reflect his own interpretation of the provision and his dissatisfaction with a ruling contrary to the prosecution’s interests. In the judgment, the trial judge adequately explains why she considers that the elements of the criminal offense (elementos del tipo penal) described in the provision were not proven, and she goes further by also analyzing whether they might fall within another criminal offense, which she likewise rules out, making clear that this resulted from a deficient investigation and even from the witnesses’ failure to provide testimony sufficient to establish them. The prosecution seeks to disregard the elements contained in the statutory definition of the offense (descripción típica) set forth in the Ley Forestal and to have the defendant convicted solely for carrying lumber, even though throughout the proceedings the prosecution was unable to prove precisely the element identified in Article 61, namely, that the lumber came from a forest or plantation.
This element was not established by documentary evidence or by testimony, and it cannot be presumed, as the prosecutor appears to expect the trial judge to do. The appellant states that Article 3 of the Ley Forestal was not raised at trial, but overlooks the trial judge’s duty to analyze and apply the provision as a whole, rather than only the portion favorable to the prosecutor. She was clearly required to address the conceptual definitions provided by the Ley Forestal itself, which contain the descriptions necessary for its application. Thus, notwithstanding the prosecutor’s assertions, these matters are relevant to the proceedings and had to be taken into consideration. Furthermore, although Article 61 does not refer to the verb ‘transport,’ Article 56 does; accordingly, the trial judge analyzed it and concluded that the facts could not be subsumed under that provision either, because it requires that the products have been unlawfully removed, another element that the prosecutor did not prove.
This Office considers that the judgment is sufficient and does not lack any statement of reasons (fundamentación), as alleged by the prosecutor; that the judge analyzed Mr. [Nombre 001]’s conduct in detail and concluded that it did not constitute any of the offenses described by the prosecution; and that the judgment of acquittal should therefore be upheld in all respects” [sic]. The claim is granted. The appellant is correct. To resolve the disputed issue, it should be noted that the Public Prosecution Service (Ministerio Público) alleged the following facts: “On 09 FEBRUARY 2025, at approximately 08:05 hours, in the area of PUNTARENAS, PUERTO JIMÉNEZ, CAÑAZA, MONTERREY, ON A PUBLIC ROAD, GEOGRAPHIC COORDINATES LONGITUDE N00946525 AND LATITUDE 600565707, the accused [Nombre 001], aware of the unlawfulness of his conduct, illegally acquired forest products that came from a previously sawn tree of the species TACHIGALI VERSICOLOR, A TREE KNOWN AS THE SUICIDE TREE, consisting of 18 pieces of sawn lumber OF DIFFERENT DIMENSIONS.
He made this acquisition without complying with the requirements established by the Ley Forestal, principally Article 61, subsection b), because he illegally acquired lumber OF THE SPECIES TACHIGALI VERSICOLOR, A TREE KNOWN AS THE SUICIDE TREE, without it being covered by a harvesting permit (permiso de aprovechamiento) or by a document demonstrating its lawful origin. At that same place, date, and time, the defendant [Nombre 001] illegally transported the lumber in a WHITE MINIBUS-STYLE VEHICLE, LICENSE PLATE [Valor 001], MODEL 1996, MAKE HYUNDAI, without the required documentation, in violation of the provisions of Decreto Ejecutivo number 30494 and the Reglamento a la Ley Forestal. Specifically, transportation of sawn lumber requires a current transportation permit (guía de transporte) issued by the State Forestry Administration (Administración Forestal del Estado), or a duly validated invoice from a forest-products industry” [sic].
This factual description shows that the defendant is accused of acquiring the lumber and transporting or moving it without the corresponding documentation. In the judge’s view, the alleged conduct was not proven, essentially because the Public Prosecution Service relied on Article 61, subsection b), of the Ley Forestal, which penalizes the acquisition or processing of forest products, whereas the evidence established only that the individual was stopped while transporting lumber, without showing how he obtained it or that he processed it. The Court further determined that, even considering the possible application of Article 56, which criminalizes transportation, it was not proven that the lumber came from a forest or plantation, as required by the provision, because there was no inspection, measurement of the area, SINAC report, or expert examination (peritaje) determining the origin or characteristics of the site.
It therefore found that, in its view, the deficient investigation and lack of additional evidence created insurmountable doubt concerning the essential particulars of the charge (imputación), on the basis of which it decided to acquit. Based on the foregoing, it is also relevant to note, for purposes of resolving the appeal, that the following provisions of the Ley Forestal are directly applicable to the case: “ARTICLE 55.—Proof of permit. Any natural or legal person possessing logs, squared timber, or sawn lumber for the purpose of carrying out their activities must prove that the forest product is covered by the respective harvesting permit, where applicable, or demonstrate its origin when requested by the State Forestry Administration. Any forestry industry that processes logs, squared timber, or sawn lumber for the purpose of carrying out its activities must provide the State Forestry Administration and the Oficina Nacional Forestal with such technical and statistical information as they deem appropriate.
ARTICLE 56.—Transportation of lumber. Logs, squared timber, or sawn lumber originating from a forest or plantation may not be transported without the corresponding documentation … CHAPTER II. Violations, penalties, and procedures. ARTICLE 57.—Violations. Violations of this law, in accordance with this title, constitute criminal offenses … ARTICLE 61.—Imprisonment from one month to three years. A term of imprisonment from one month to three years shall be imposed on anyone who … b) Acquires or processes forest products without complying with the requirements established in this law … ARTICLE 63.—Imprisonment from one month to one year. A term of imprisonment from one month to one year shall be imposed on anyone who: a) Violates the provisions of Article 56 of this law” (underlining added). These provisions are implemented by the Reglamento a la Ley Forestal number 25721, which provides in its eighth chapter: “Transportation of Forest Products.
Article 30: Transportation of forest products originating from plantations and agroforestry systems. The certificate of origin referred to in Articles 31 and 55 of the Ley Forestal must certify the existence of a forest plantation or agroforestry system on a particular property and must state the planted area, number of trees, species, location, and name of the owner. This certificate, which shall be unique to each property or area to be harvested, shall be issued only once, before the lumber is transported, whether as logs or sawn lumber, and a copy must be delivered to the A.F.E. For transportation-control purposes, once the copy of the Certificate of Origin has been delivered to the A.F.E., the owner shall be entitled, immediately and without any additional requirement, to a number of transportation permits proportionate to the reforested area or volume to be extracted. The owner shall complete one each time lumber is transported, and it must be delivered to the primary processing facility to substantiate the lumber’s origin.
The A.F.E. shall establish, by administrative decision, the minimum information that the transportation permit must contain. Any natural or legal person whose raw material originating from forest plantations or agroforestry systems is integrated into a forestry industry may, if desired, adopt an alternative system for transportation permits. This system consists of a permanent triangular emblem that must be placed on the rear of the load. The Director of the A.C., in agreement with the producers, shall establish its required characteristics and the identification number for each producer. The regulated party shall bear the cost of producing the emblem. Article 31: The transportation of logs, block timber, or squared timber not covered by the preceding article requires an identifying marker and a transportation permit issued, as applicable, by the A.F.E., the forestry manager (regente), the municipal official, or the Consejo Regional Ambiental.
The A.F.E. shall establish, by administrative decision, the minimum information that the permit must contain. The A.C., the forestry manager, the forestry professional, the municipal official, and the Consejo Regional Ambiental, as applicable, shall be responsible for preparing and furnishing the corresponding permits to the holder of the permit or management plan, at cost. The transportation permit shall state only the permit number or approval number of the management plan, as applicable, and the name of the owner of the property from which it originates … Article 32: Without prejudice to the preceding article, the transportation of sawn lumber must be supported by an authorized sales or sawmilling invoice. However, when the lumber is sawn directly by its owner, the owner must provide a certificate of origin establishing its lawful provenance. Failure to comply with any requirement established in this or the preceding article shall authorize the A.F.E., or any public authority conducting inspections, to seize the lumber and the vehicle transporting it as an instrument used in the commission of the offense, and to file the corresponding criminal complaint.
Persons or companies transporting lumber originating from a primary processing facility to a lumber yard owned by the same company without the authorized invoice referred to in this article shall be permitted to transport the sawn lumber on the basis of a transportation permit issued in accordance with Article 31 of this Regulation” (boldface in the original; underlining added). It follows from these provisions that the trial judge erred in finding that the lumber’s origin had to be proven in order for the elements of the criminal offense to be established.
This requirement, contrary to the applicable regulations, would prevent the Public Prosecutor’s Office (Ministerio Público) from bringing criminal proceedings (acción penal) in countless situations, with the resulting harm to the environment that the Ley Forestal seeks to prevent, since it is evident that the transportation or movement (movilización) of timber is essential to the chain of destruction of forest resources, as it is what ultimately enables the use of unlawfully obtained products. If the reasoning of the a quo judge were followed, the act could be prosecuted only if the precise origin of the timber were known, which is inconsistent with the regulations currently in force. Article 56 of the Ley Forestal penalizes the act of transporting or moving timber without the corresponding authorizations, whether the timber comes from a forest or a plantation, plantation being understood to include both one qualifying as a forest plantation (plantación forestal)—which was the only type considered by the trial judge—and any other plantation, which may include a single planted tree, as follows from a harmonious interpretation of the Law and the Regulations (Reglamento).
Specifically, section 32 of the Regulations requires that an invoice be carried in all cases, except when the person is the owner, who must then have a certificate of origin (certificado de origen). In other words, the provision does not contemplate any situation in which timber may be transported without documentation establishing its lawful origin, whether a certificate of origin, a transportation permit (permiso de transporte), or a waybill (guía), precisely to prevent the environmental harm caused by uncontrolled logging. Regarding transportation documentation, Article 30 of the Regulations refers to timber originating from a forest plantation or an agroforestry system (sistema agroforestal), while section 31 establishes the requirements for moving timber in log, squared-block, or squared form (en troza, en bloc o escuadrada) not covered by the preceding article; thus, it is very clear that documentation is always required to transport timber, and the absence of such documentation is precisely what is penalized by Article 56 in conjunction with Article 63(a) of the Ley Forestal.
Accordingly, although Article 28 of the Ley Forestal exempts persons from obtaining a permit for felling or transportation when the trees are from forest plantations or were planted individually, the respective waybill or certificate of origin must still be held, since even the owner, who is exempt from showing invoices, must possess that certificate. This is how the Sala Tercera de la Corte Suprema de Justicia has interpreted it, and its position is consistent with the foregoing: “This Chamber considers that, based on a comprehensive reading of these provisions, they must be interpreted to mean that timber felled from plantations, as in the present case, does not require a permit for felling, transportation, industrial processing, or export under Article 28 of the Ley Forestal. However, this does not exempt the timber owner and the carrier from carrying documents establishing the origin of that timber, as required by Article 31 of the same body of law, and it is that documentation to which Article 56 refers.
It must be clear that, although no government permit is required to fell or transport the timber, the issuance of a certificate of origin is required for it to be moved from one place to another, logically for the purpose of guaranteeing the lawful provenance of the timber and ruling out its unlawful extraction through theft, for example. [..] The certificate of origin referred to in Article 31 of the Ley Forestal is not a transportation permit, as the Tribunal de Apelación de Sentencia erroneously interpreted it, but rather a document stating the site or plantation from which the timber was extracted, in order to verify its legitimacy” (Sala Tercera, voto número 2014-1043 de las diez horas trece minutos del veintisiete de junio de 2014). Moreover, as noted above, the use of the term plantation in section 56 of the Ley Forestal does not in every case refer to the forest plantation described in Article 3(f), defined as “Land comprising one or more hectares, planted with one or more forest species, the principal, though not exclusive, purpose of which is timber production.” As indicated, the Regulations themselves establish the need to complete procedures for other types of plantations.
Therefore, under the applicable regulations, this concept is broader than that considered by the a quo judge and defense counsel, and is consistent with the purposes of the Ley Forestal and with the proper and sustainable use of renewable natural resources provided for in its first article. As already indicated, the protection afforded by that law through the penalization of various forms of conduct is not limited to felling and exploitation involving forests or forest plantations: Article 61(a) penalizes the felling and harvesting (aprovechamiento) of forest products on private property without authorization from the Administración Forestal del Estado, without requiring that they originate from a forest or plantation; and subsection (d) criminalizes the transportation of forest products removed from private property, likewise without such a requirement. Consequently, it is incorrect to maintain that the transportation of timber is punishable only if it is shown to have originated from a forest or forest plantation within the meaning of Article 3.
In light of all the foregoing, it is clear that transporting timber constitutes an offense when done without the corresponding documentation, a requirement that applies regardless of whether the product comes from a forest or from a plantation in the broad sense, including a forest plantation under art. 3, subsec. f), or trees planted on private property, even individually. This obligation, based on a systematic interpretation directed toward the comprehensive protection of forest resources, exists because transportation is an essential stage of harvesting and commercialization; accordingly, the Legislative Branch (Poder Legislativo) established a control mechanism to guarantee lawful provenance, preventing a mere statement by the carrier that the timber does not come from a forest or agroforestry plantation (plantación agroforestal) from being sufficient to exclude oversight of what is felled.
This position is consistent with the ruling of the Sala Constitucional in voto número 2007-3923, de las quince horas dos minutos del veintiuno de marzo del dos mil siete, which determined that the Legislative Branch had failed to establish requirements for environmental protection when drafting section 28 of the Ley Forestal, which provides: “Promotion of forest plantations. Article 28.—Exception from the felling-permit requirement. Forest plantations, including agroforestry systems and individually planted trees and their products, shall not require permits for felling, transportation, industrial processing, or export. However, in cases where, prior to the effective date of this law, there is a forestry contract signed with the State for the receipt of Forestry Credit Certificates (Certificados de Abono Forestal) or an income-tax deduction, felling must be carried out in accordance with the management plan (plan de manejo) approved by the Administración Forestal del Estado.” In this regard, it is appropriate to reproduce at length the constitutional body’s analysis because it is relevant to the interpretation of what is meant by plantation: “The challenged Article 28 does establish an exception to the tree-felling permit requirement, stating that forest plantations, including agroforestry systems and individually planted trees and their products, do not require permits for felling, transportation, industrial processing, or export.
When the provision refers to a forest plantation, it means one or more hectares planted with one or more forest species whose principal, though not exclusive, purpose is timber production. The foregoing distinctions are important because, for purposes of this analysis, it is relevant to distinguish a forest from a forest plantation and an agroforestry system in order to determine the degree of safeguard and protection afforded to species by the Ley Forestal. As already indicated, our law conceives of a forest as a native or indigenous ecosystem, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area and containing more than 60 trees per hectare with a diameter at breast height (diámetro a la altura del pecho, DAP) of fifteen or more centimeters.
A forest plantation, in turn, is land comprising one or more hectares planted with one or more forest species whose principal, though not exclusive, purpose is timber production. An agroforestry system, by contrast, is a form of land use involving the combination of forest species over time and space with agronomic species, with a view to ensuring the sustainability of the system. The foregoing is relevant in clarifying that the substantial difference among them is that forest plantations and individually planted trees exist as a result of their owners’ productive and economic decisions, and it is therefore reasonable to facilitate their felling, transportation, industrial processing, and export. This is the situation contemplated in the challenged Article 28 … It must be recalled that one of the premises of a forest plantation or agroforestry system is that whatever was planted from the outset was planted for the sole purpose of being harvested.
It was on that premise that the law sought to encourage them by eliminating certain administrative procedures. Nevertheless, before the trees are felled, it must be ensured that this is in fact the case, because the lack of oversight could enable the felling of areas that are actually neither forest plantations nor agroforestry systems. Furthermore, there is land on which, through the inaction of its owners, a true forest has been allowed to proliferate and is then felled without any regulation, as well as trees that, even if planted, serve as windbreaks (rompevientos) because of their number, location, and the function they have performed for many years; the protection of fundamental values warrants their conservation and the regulation of their felling, irrespective of the nature of their species … There is also the other situation in which owners, by their own decision, planted a small number of trees to beautify their land.
Depending on the number of such trees, it would likewise be unreasonable subsequently to require a permit to fell each one, as a mere restriction on the exercise of their property rights. The solution sought by the claimant, namely to prohibit all felling, is unacceptable in the opinion of this Court, considering that some trees are planted precisely in order to be harvested; therefore, Article 28 per se is not unconstitutional … The Chamber does find, however, that the law fails to prescribe precautionary measures (medidas precautorias) ensuring the proper application of the challenged Article 28, since not every plantation requires a management plan, and the only requirement is a certificate of origin, but only for removing and transporting the timber. That certificate must establish the existence of a forest plantation or agroforestry system on a particular property, indicate the planted area, the number of trees, the species, the location, and the name of the owner. Nevertheless, as already indicated, that certificate is issued beforehand, but only for the movement of the timber—that is, once it has been felled …
According to the analysis conducted of the challenged article, the legislature modified the concept of forest (bosque) on which the protections, restrictions, and permits granted under the Ley Forestal are based—as is the case with Article 28 at issue, “Exception from the cutting permit requirement (Excepción de permiso de corta)”—thereby restricting, without technical justification, the previous concept of forest that existed in the law before its amendment. Consequently, non-native species and areas of less than two hectares that constituted forest were left without statutory protection, with the result that, under the challenged Article 28, no permit to cut is required, nor even a prior inspection to ensure that the situation is one that the provision sought to encourage: any forest plantation (plantación forestal), agroforestry system (sistema agroforestal), or any planted tree. This leaves exposed areas that, because of their location, size, and the function they have served for many years, warrant conservation and regulation of their cutting, regardless of the nature of their species and the nature of the land on which they are located.
Accordingly, based on the foregoing, this Sala considers that this case involves unconstitutionality by relative omission (inconstitucionalidad por omisión relativa). Nevertheless, although the Sala Constitucional has jurisdiction to declare a provision unconstitutional, a violation of this nature must be remedied by the Asamblea Legislativa by extending the application of the law to cases not expressly contemplated therein, such as, in this case, the species and areas that were left unprotected under the current concept of forest, and by adopting prevention and control measures regarding the areas in which cutting is permitted” [sic] (emphasis added). It follows from this excerpt that the Sala Constitucional established that, although Article 28 provides an exemption from the cutting permit requirement in certain cases, none is exempt from the corresponding certificate of origin (certificado de origen), in addition to the transport guide (guía) provided for in the Regulations; furthermore, the decision also lists planted trees as forest products (productos forestales), demonstrating that the proposed interpretation is consistent with that of the Sala.
Regarding the acquisition of the timber, this Chamber finds that the reasoning is also insufficient, because it does not adequately explain why the prosecutor’s proposed interpretation of that verb is rejected, since the judge merely reads the definition from the Diccionario de la Real Academia Española without examining each of its meanings or whether any of them is compatible with the interpretation advanced by the Public Prosecutor’s Office. In any event, under the rules governing an apparent concurrence of offenses (concurso aparente de delitos), if it is determined that transportation occurred without the required documentation, the conduct in its entirety could be subsumed under the provision governing that latter matter. In accordance with all the foregoing, because the statement of reasons is defective, the challenged judgment is vacated and the corresponding remand trial (juicio de reenvío) is ordered for new proceedings, to be conducted by the same Tribunal de Flagrancia de Corredores with a differently constituted panel.
POR TANTO:
The appeal filed by prosecutor Diego Umaña Sánchez is granted. Consequently, the challenged judgment is vacated and the corresponding remand trial is ordered for new proceedings. NOTICE SHALL BE GIVEN.

Res: 2025-468 Tribunal de Apelación de Sentencia Penal de Cartago. Al ser las once horas del veintitrés de setiembre del dos mil veinticinco.
Causa penal 25-000101-1262-PE seguida contra [Nombre 001] por el delito de MOVILIZACIÓN DE MADERA DE BOSQUE O PLANTACIÓN en perjuicio de LOS RECURSOS NATURALES.
Recurso de apelación de sentencia penal formulado por el licenciado Diego Umaña Sánchez, representante del Ministerio Público. Resuelven la jueza Xiomara Gutiérrez Cruz, así como, los jueces Jaime Robleto Gutiérrez y Marco Mairena Navarro;
Resultando:
ÚNICO. Que mediante sentencia número 144-2025 de las diecinueve horas cuarenta y dos minutos del tres de abril del dos mil veinticinco, el Tribunal de Flagrancia del II Circuito Judicial de la Zona Sur, Sede Corredores, resolvió: "POR TANTO: De lo expuesto y conforme a los artículos 39 y 41 de la Constitución, 1, 2, 6, 9, 142, 265, 267, 360, 364, 365 y366 del Código Procesal Penal, 1, 45 y 110 del Código Penal, artículos 3, 56 y 61 inciso b) de la Ley Forestal número 7575 se absuelve de toda pena y responsabilidad a [Nombre 001] por un delito de TRANSPORTE ILEGAL DE PRODUCTO FORESTALES en perjuicio de LA LEY FORESTAL Y LOS RECURSOS FORESTALES. Se resuelve sin especial condenatoria en costas. SOBRE EL COMISO: de conformidad con la Ley 6106 Sí la madera decomisada en ésta causa no fue rematada, información que es corroborable en autos, se ordena que sea devuelta a quien ostente ser su propietario y así lo demuestre con la documentación respectiva, en este mismo sentido se ordena la devolución del vehículo [Valor 001] Modelo 1996 marca Hyunda y. Para lo anterior se otorga el término de 30 días hábiles, una vez firme para su reclamo, de lo contrario transcurrido dicho plazo sin interés de parte se ordena el Comiso y donación a favor del Estado.
Se hace constar que lo anterior es una minuta de la Sentencia Oral Integral dictada en este proceso, y que la totalidad de la audiencia y todas sus incidencias fueron grabadas en formato digital, registro electrónico al que las partes podrán tener acceso en caso de requerirlo.Qudan las partes notificadas por dictarse de forma oral. Yolanda Venegas Caballero. Jueza de Juicio" Informa la jueza Xiomara Gutiérrez Cruz, y;
Considerando:
I.Admisibilidad: El fiscal Diego Umaña Sánchez, impugnó la sentencia oral número 144-2025 dictada por el Tribunal de Flagrancia del II Circuito Judicial de la Zona Sur, Sede Corredores, a las diecinueve horas cuarenta y dos minutos del tres de abril del dos mil veinticinco. El recurso es admisible porque fue presentado en tiempo y de acuerdo con los presupuestos necesarios para el conocimiento de las inconformidades planteadas, de conformidad con el artículo 8.2 h de la Convención Americana sobre Derechos Humanos y los artículos 458, 459, 460 y 462 del Código Procesal Penal.
II.En el único motivo de su impugnación, el fiscal aduce falta de fundamentación analítica o intelectiva, de acuerdo con los artículos 142, 143, 184 y 363 del Código Procesal Penal. El recurrente señala: “En la sentencia que se impugna, no se realizó por parte de¡ juzgador una fundamentación analítica o intelectiva completa en cuanto a la prueba testimonial reproducida en juicio oral y público y la prueba documental, existente en el expediente, esto porque al revisar y analizar la sentencia oral, dictada por el tribunal, se puede escuchar a partir de¡ minuto 26:25 de la grabación, donde la señora Juez indica que una vez analizada la prueba testimonial y documental se llega a una única conclusión, y manifiesta textualmente "una vez que se analiza tanto la acusación, los hechos que viene a traer el Ministerio el día de hoy, considera esta juzgadora que propiamente estos hechos que encuadran, pues el Ministerio Público hace ver que son el artículo 61 inciso b), adquiera o procese productos forestales sin cumplir con los requisitos establecidos en la ley, considera esta juzgadora que no fue demostrado al menos por los oficiales como adquirió usted o procesó productos forestales, entonces, nos vamos a lo siguiente, esta acción típica de adquirir o procesar un producto forestal en este punto, no se puede perder de vista que la carga la tenía el Ministerio Público y lo cierto es que, lo que se informa por parte de los oficiales, es que, usted fue detenido, transportando esta madera, no adquiriendo o procesando, son situaciones muy distintas, son hechos, si, situaciones muy distintas lo que se viene indicando por los oficiales de Fuerza Pública, no hay un elemento de prueba, no hay mayor información que los oficiales hayan abordado, hayan investigado más, o que el Ministerio Público haya solicitado un tipo de informe que ampliara un poco más de como usted había adquirido, o estaba usted procesando esta madera, lo cierto es lo que se contó el día de hoy, y los oficiales vinieron a narrar que fue lo que vieron y que fue lo que ellos actuaron en ese momento, pero no se logra extraer de su declaración más allá que un transporte de producto y si nos vamos al númeral 56 que es la movilización de madera, refiere que no se podrá movilizar madera en trozos, escuadra, ni aserrada, proveniente de bosque o de plantación si no se cuenta con la documentación respectiva, vemos también que ambos oficiales refieren que era una finca privada, que escuchan que están aserrando en esa finca privada, pero también tenemos que ver, a que se refiere el artículo 56 cuando habla de bosque o de plantación, el artículo 3 de esta ley, también lo que es el inciso d), habla de bosques, que es un ecosistema nativo, autóctono intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, no se vino a tener aquí como prueba alguna inspección que se haya hecho en el lugar para determinar que este era un bosque, porque tenemos que tener presente que debe ser de dos o más hectáreas solamente dijeron que era una finca, vemos que muchas personas dicen que es un bosque talvez a algo pequeño, a unos árboles a unos cuantos árboles, pero, a que se le llama bosque, no se hizo una medición, no se tuvo más referencia, en cuanto a esto pasase de dos o más hectáreas, con características, por la presencia de árboles maduros de diferentes edades, especies y porte variado de una o más doseles que cubran más del setenta por ciento, igual, reitero, no se tuvo ninguna inspección, informe del SINA C que viniese a indicar como era ese bosque, como era e/lugar que se sustrajo esto, en cuanto a la platanción forestal que es el f), refiere que es un terreno de una o dos hectáreas cultivadas de una o más especies forestales cuyo objetivo principal, pero no único será la producción de madera, de igual forma, si es al momento, lo que ellos vienen a decir, que con lo que a usted lo encuentran es con la movilización de esta madera, o transportando/a en su vehículo, lo cierto es que no se tiene de manera clara, si esto era efectivamente era de una plantación forestal, no hay un solo informe, el Ministerio Público no ahondó más en esta prueba, únicamente hace su acusación unicamente con el informe, con los hechos que suceden en el momento, pero no ah onda más si esto es efectivamente, si ese lugar, el objetivo principal era la producción de madera, si bien se indicó por los oficiales que era una especie, el segundo oficial indicó que desconocía, basicamente sabía el nombre, que no sabía si era buena madera o para que la utilizaban, lo que indicó fue que habían pocas especies de ese árbol, pero no dio mayor información en cuanto al lugar, precisamente el área donde se extrae esta madera, reitero, al no haber algún informe, algún peritaje que viniera a demostrar el planteamiento que el Ministerio Público realiza, pues, en cierto modo es confuso que fue lo que realmente sucedió en ese lugar, en tanto a usted se le acusa de ser detenido transportando estas piezas de madera, que no se encuentra en sí esta acción descrita en el artículo 61 de la ley 7575 que en sí, lo que viene a reflejar es que adquiera o procese productos forestales, para esta juzgadora, no queda debidamente demostrado esta acción que usted realiza, no se logra llegar más allá de la versión de los oficiales que lo ubican a usted, indicando que por llevar, hacer un flete o realizar, brindar esa labor de transportar que fue lo que escucharon que usted informó, pero esto no viene a decir si usted la compro o adquirió esta madera, toda esta situación considera que genera un estado de duda, que para esta juzgadora no queda claro lo que acontese ahí, lo que fue descrita en la pieza acusatoria y que esta duda resulta de manera insuperable, no pudiendo tener por quebrantada el principio de inosencia, desde esta optica, considera esta juzgadora es absolverlo de toda pena y responsabilidad" Duda que argumenta o fundamenta la respetable Juez, básicamente en que no se determinó por parte del Ministerio Público, la adquisición y procesamiento de la madera que transportaba el acusado [Nombre 001], y que dicha acción de "transportar" no se encuentra descrita en el numeral 61 de la Ley Forestal; aunado a lo anterior, que con la declaración de los funcionarios del SINAC Oscar Beita Beita y Jairo Rodríguez Jiménez, se logra extraer que el acusado, transportaba madera de manera ilegal en su vehículo, más no se determinó por parte de estos, la forma de adquisición y procesamiento de dicha madera por parte del acusado [Nombre 001].
Cómo primer aspecto se puede apreciar que la honorable Juez, básicamente fundamenta su duda sobre la responsabilidad penal del imputado, en que no se puede determinar la forma de adquisición y procesamiento de la madera en cuestión (18 piezas de madera). Si analizamos propiamente el numeral 61 de la Ley Forestal, aspecto que es importante, aunque se tenga por conocido que ante lo que se recurre es a la falta de fundamentación analítica o intelectiva en la sentencia, en su inciso b) indica propiamente lo siguiente "Adquiera o procese productos forestales sin cumplir con los requisitos establecidos en esta ley", inciso del cual se analiza, que en sus elementos objetivos, no indica la forma o lugar en que se adquiera o procese los productos forestales, pero si indica "sin cumplir con los requisitos establecidos en esta ley", aspecto que es importante recalcar, ya que no se analiza por parte de la juzgadora, la prueba testimonial como la documental, pues se tiene por probado que, los funcionarios del SINAC, ante la advertencia e indicación de los derechos fundamentales que le asistieron al imputado, cuando éste fue abordado, el mismo indicó que no tenía permiso alguno, testimonio que se fortalece con la prueba documental ofrecida y aceptada por el Tribunal de Flagrancia de esta localidad en la audiencia de continuación, prueba que se refleja a folio 21 del legajo principal, mediante oficio SINAC-ACOSA-DRFVS-SRP-044- 2025, en el cual se acredita que el acusado no tenía permisos para el aprovechamiento y transporte de madera, y que para ello, se sustenta aún más, que durante todo el proceso, no fue aportada documentación alguna, que demostrase que el acusado si tenía permisos en relación a los hechos demostrados; análisis que, considera este ente Ministerial no se realizó por parte de la juzgadora, y que la misma única y exclusivamente de manera redundante fundamente que, los testimonios de los funcionarios del SINAC, mas la falta de diligencias de investigación o pericias, no se logra determinar la forma de adquisición o procesamiento de la madera que se transportaba ilegalmente por parte del acusado [Nombre 001].
Cómo segundo aspecto, la juzgadora fundamenta su sentencia y hace lectura de los numerales 56 y 3 de la Ley Forestal, mismos que hacen relación a los hechos que fueron investigados, pero no fueron ni tan siquiera traídos a colación al debate oral y público por cuanto son otros hechos los que se acusan, como son la adquisición y transporte de madera sin contar con los permisos requeridos por Ley, situación que hace ver esta representación fiscal, que no guarda correlación entre acusación y sentencia, y que más bien, si genera duda, sobre el análisis que se hizo para realizar dicha fundamentación, porque al menos en este aspecto, la juzgadora lo que hace es generarse incógnitas al significado de las palabras contempladas en dichos numerales en cuestión, pero que no vienen a desvirtuar ni a acreditar los hechos ventilados en el debate, por lo que el yerro existente es la violación a las reglas de la sana crítica, específicamente a las de la lógica, pues se produjo el quebranto al principio de derivación o razón suficiente "el cual consiste, en términos generales, en que todo razonamiento para ser verdadero deber estar conformado por deducciones racionales, a partir de la prueba producida en juicio, así como de las sucesivas conclusiones que sobre la base de ellas se vayan estableciendo, de modo que la infracción a este principio puede causar la ineficacia de fallo si se comprueba que el razonamiento "da un salto al vacío", es decir, de unas ciertas premisas se derivan conclusiones absolutamente improcedentes.
Cómo tercer y último aspecto, dentro del análisis que hace la juzgadora, y de¡ cual se basa para realizar su fundamentación de sentencia, obvia por completo el verbo "transportar" el cual si está descrito en el numeral 61 de la Ley Forestal, propiamente en el inciso d), que indica "Sustraiga productos forestales de una propiedad privada o del Estado o transporte productos forestales obtenidos en la misma forma", y es que, de la sentencia oral y aquí transcrita, su fundamentación se basa en la adquisición y aprovechamiento de madera, y en muy marcadas y pocas frases, hace alusión y afirma que si se demuestra el transporte, pero no da mayor desarrollo en cuanto a esta acción, de la cual indica que el transporte no está descrita en dicho numeral, lo que se hace ver que se ignora por completo, lo que el artículo 61 de la Ley 7575 sanciona en sus distintos incisos, y que en la fundamentación de absolutoria, no se desarrolla ni se dice el porque no se acredita el transporte ilegal de madera y que solo hace análisis, como ya se ha indicado en reiteradas ocasiones, en la adquisición y aprovechamiento de madera, no pudiendo esta representación realizar una mayor fundamentación a este aspecto, si ni tan siquiera se realizó un análisis del transporte de madera, y únicamente se dijo que no estaba descrita en la norma.
Considera esta representación que por las reglas de la experiencia y la lógica, es importante hacer ver que, para realizar el transporte de algún producto que requiera permisos, debe ser adquirido de alguna forma, sea o no, cumpliendo con los requisitos establecidos, por lo que, tendríamos una cantidad inexplicables de sentencias absolutorias, por el simple hecho de no conocer el origen de algún producto, dejando impune el transporte de algún producto legal o ilegal, con o sin los permisos respectivos y en este caso que nos ocupa no es la excepción, si para transportar madera, se tuvo necesariamente que adquirir de alguna forma, de la cual se realizó sin contar con los permisos correspondientes que establece las normas y reglamentos administrativos. Acciones que son típicas, jurídicas y culpables, ya que están contempladas en el artículo 61 incisos b) y d) de la Ley Forestal y que así fueron demostrados en el debate oral y público” [sic].
Solicita se anule la sentencia y se ordene el reenvío para nueva sustanciación. Al contestar la audiencia conferida, la defensora pública Ana Laura Sánchez Bertarioni indicó: “Una vez analizados los argumentos del señor fiscal, se logra denotar que los mismos obedecen a una interpretación propia de la norma y una inconformidad con el fallo en contra de los intereses fiscales. Durante la sentencia, la juzgadora fundamenta adecuadamente el porqué considera que no fueron probados los elementos del tipo penal descritos en la norma, y va más allá al analizar también la posibilidad de que los mismos encuadren en otro tipo penal. pero que también descarta, dejando claro que ello deriva de una investigación deficiente e incluso del que los testigos no dieron una deposición suficiente para acreditarlos. El representante fiscal pretende dejar de lado los elementos contenidos en la descripción típica que hace la ley forestal y que se condene al señor imputado solamente por llevar una madera, sin que el mismo a lo largo del proceso haya podido demostrar justamente el elemento que señala el artículo 61 y es que la madera provenga de un bosque o plantación, elemento que no se acreditó con prueba documental pero tampoco con los testimonios, sin que se pueda suponer tal y como pareciera que el señor fiscal pretende que se haga por parte de la juzgadora.
Señala el apelante que el artículo 3 de la ley forestal no fue objeto de colación en el debate, pero deja de lado que es deber de la juzgadora analizar y aplicar la integralidad de la norma y no solamente la parte que conviene al fiscal, debiendo evidentemente referirse a las líneas conceptuales que la misma ley forestal da y que contienen las descripciones que son necesarias para la aplicación de la ley, por lo que pese a lo señalado por el fiscal si son cuestiones que atañen al proceso y que debían ser tomadas en consideración. Por otra parte, si bien el numeral 61 no hace referencia al verbo transportar si lo hace el 56 y por ende la juzgadora lo analiza y concluye que tampoco es posible se encuadre de los hechos en el mismo, dado que este implica que se trate de productos que hayan sido sustraídos, elemento que tampoco fue comprobado por el fiscal. Considera esta representación que la sentencia es suficiente y no carece de fundamentación alguna como la alegada por el fiscal, que la jueza detalladamente analizó la conducta del señor [Nombre 001] y concluyó que no se configura ninguno de los ilícitos descritos por la fiscalía y que por ello debe mantenerse en todos sus extremos la sentencia absolutoria” [sic].
El reclamo se declara con lugar. Lleva razón el recurrente. A efectos de resolver el punto cuestionado interesa indicar que el Ministerio Público atribuyó los siguientes hechos: “El día 09 DE FEBRERO DEL AÑO 2025, al ser aproximadamente las 08:05 horas, en el sector de PUNTARENAS, PUERTO JIMÉNEZ, CAÑAZA, MONTERREY, SOBRE VÍA PUBLICA, CORRDENADAS GEOGRÁFICAS LONGITUD N00946525 Y LATIDAUD 600565707, el acusado [Nombre 001] consciente de su actuar ilícito, adquirió ilegalmente productos forestales, que provenían de¡ árbol aserrado previamente, de la especie de TACHIGALI VERSICOLOR ARBOL CONOCIDO COMO ARBOL SUICIDA, que correspondía a 18 piezas de madera aserrada, de DIMENSIONES DIFERENTES; adquisición que efectuó, sin cumplir con los requisitos establecidos por la Ley Forestal, principalmente en su artículo 61 inciso b), ya que adquirío de forma ilegal la madera DE LA ESPECIE TACHIGALI VERSICOLOR ARBOL CONOCIDO COMO ARBOL SUICIDA, sin estar amparado a un permiso de aprovechamiento, o bien, documento que demostrará la procedencia lícita.
Madera que en ese mismo lugar, fecha y hora, el imputado [Nombre 001], transportó de manera ilegal en el vehículo ESTILO BUSETA COLOR BLANCO, PLACA [Valor 001], MODELO 1996, MARCA HYUNDAI, sin contar con la documentación necesaria, contraviniendo lo estipulado conforme se establece en el Decreto Ejecutivo número 30494 y el Reglamento a la Ley Forestal, concretamente, para el caso de la movilización de la madera aserrada, se requiere la guía de transporte al día, emitida por la Administración Forestal del Estado, o factura debidamente acredita de una industria de productos forestales” [sic]. Se desprende de esta descripción fáctica que lo que se atribuye al imputado es la adquisición de la madera y el transporte o movilización de ésta sin contar con la documentación respectiva. Para la jueza, no demostró la conducta acusada, básicamente porque el Ministerio Público se basó en el artículo 61 inciso b) de la Ley Forestal, que sanciona la adquisición o el procesamiento de productos forestales, pero la prueba solo acreditó que la persona fue detenida transportando madera, sin demostrar cómo la obtuvo ni que la haya procesado.
Además, estableció el Tribunal que, aun valorando la eventual aplicación del artículo 56 que tipifica la movilización, no se probó que la madera proviniera de bosque o plantación como requiere la norma, pues no hubo inspección, medición del área, informes del SINAC, ni peritajes que determinaran el origen o las características del sitio, por lo que reprocha que, en su criterio, la falta de investigación y de elementos adicionales generó una duda insuperable sobre los extremos esenciales de la imputación, por la cual decidió absolver. Partiendo de lo anterior, para resolver el recurso también es relevante señalar que los artículos de la Ley Forestal que resultan directamente aplicables al caso son los siguientes: “ARTICULO 55.- Demostración de permiso. La persona física o jurídica que posea madera en troza, escuadrada o aserrada, para realizar sus actividades, deberá comprobar que el producto forestal está amparado por el respectivo permiso de aprovechamiento cuando proceda o bien, demostrar su procedencia, cuando la Administración Forestal del Estado lo solicite.
La industria forestal que procese madera en troza, escuadrada o aserrada para realizar sus actividades, deberá suministrar a la Administración Forestal del Estado y a la Oficina Nacional Forestal la información técnica y estadística que estas consideren conveniente. ARTICULO 56.- Movilización de madera. No se podrá movilizar madera en trozas, escuadrada ni aserrada proveniente de bosque ni plantación, si no se cuenta con la documentación respectiva … CAPITULO II. Infracciones, sanciones y procedimientos. ARTICULO 57.- Infracciones Las infracciones a la presente ley, de acuerdo con este título constituyen delitos … ARTICULO 61.- Prisión de un mes a tres años. Se impondrá prisión de un mes a tres años a quien … b) Adquiera o procese productos forestales sin cumplir con los requisitos establecidos en esta ley … ARTICULO 63.- Prisión de un mes a un año. Se impondrá prisión de un mes a un año a quien: a) Contravenga lo dispuesto en el artículo 56 de esta ley” (el subrayado es propio).
Estas normas son desarrolladas por el Reglamento a la Ley Forestal número 25721, el cual dispone, en su capítulo octavo: “Del Transporte de los Productos Forestales. Artículo 30: Del transporte de los productos forestales provenientes de plantaciones y sistemas agroforestales. En el certificado de origen a que se refiere el artículo 31 y 55 de la Ley Forestal deberá certificarse la existencia de una plantación forestal o un sistema agroforestal en determinada finca, e indicarse el área plantada, el número de árboles, las especies, la ubicación, el nombre del propietario o propietaria. Este certificado único para cada finca, o área a explotar, será expedido por una única vez previo a la movilización de la madera ya sea en troza o aserrada y deberá entregarse copia a la A.F.E. Para efectos de control en el transporte una vez entregada la copia del Certificado de Origen a la A.F.E., el propietario o propietaria tendrá derecho sin ningún requisito adicional y en el acto, a un número proporcional de guías de transporte de acuerdo al área reforestada ó volumen a extraer que serán llenadas por el propietario o propietaria cada vez que transporte madera, y deberán ser entregadas al centro de industrialización primaria para respaldar la procedencia.
La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía de transporte. Toda persona física o jurídica que tenga integrada su materia prima proveniente de plantaciones forestales o sistemas agroforestales a una industria forestal, podrá acogerse si lo desea a un sistema alternativo para las guías de transporte. Este sistema consiste en un emblema permanente en forma de triángulo que debe colocarse en la parte trasera de la carga. El Director del A.C. en acuerdo con los productores o productoras, establecerán las características que contendrá y el número de identificación requerido para cada productor o productora. La elaboración y costo del emblema correrá por cuenta del administrado. Artículo 31: Para movilizar madera en troza, en bloc o escuadrada, no comprendidos en el artículo anterior, deberá contarse con un distintivo y una guía de transporte emitida por la A.F.E., por el regente, por el encargado de la Municipalidad o el Consejo Regional Ambiental cuando corresponda.
La A.F.E. vía resolución administrativa establecerá los requisitos mínimos que deberá contener la guía. Será responsabilidad del A.C., del Regente, del profesional forestal, del responsable de la municipalidad y del Consejo Regional Ambiental, según corresponda, la edición y entrega al titular del permiso o plan de manejo de las correspondientes guías, al costo. La guía de transporte únicamente determinará el número de permiso o aprobación del plan de manejo según corresponda, nombre del propietario o propietaria de la finca de la cual proviene … Artículo 32: Sin perjuicio de lo establecido en el artículo anterior, cuando se transporte madera aserrada deberá respaldarse con una factura autorizada, de venta o de aserrío. Salvo cuando se aserre directamente por el propietario o propietaria de la madera en cuyo caso deberá aportar el certificado de origen que compruebe su legitimidad. El incumplimiento de cualquiera de los requisitos establecidos en este y el anterior artículo facultará a la A.F.E. o a cualquiera de las autoridades públicas que realizan control al decomiso de la madera y del vehículo que transporta la misma, como medio de ejecución del delito, así como proceder a la interposición de la denuncia penal correspondiente.
Se permitirá el transporte de madera aserrada mediante el respaldo de una guía de transporte emitida de conformidad con el artículo 31 de este Reglamento, a aquellas personas o empresas, que transporten madera sin la factura autorizada a que hace referencia el presente artículo, cuando el producto proveniente de un centro de industrialización primaria es llevado a un depósito de madera propiedad de la misma empresa” (la negrita es original, el subrayado es propio). De estas normas se desprende que erró la juzgadora al considerar que era necesario que se demostrase la proveniencia de la madera para considerar configurado el tipo penal. Esta exigencia, contraria a lo dispuesto en la normativa, impediría al Ministerio Público ejercer la acción penal en un sinnúmero de supuestos, con la consecuente afectación al ambiente que la Ley Forestal busca prevenir, pues es notorio que el transporte o movilización de la madera es esencial en la cadena de destrucción de los recursos forestales, al ser el que, en última instancia, posibilita el aprovechamiento de productos ilícitamente obtenidos.
De seguirse el razonamiento de la a quo, solo podría perseguirse el hecho si se conoce el origen preciso de la madera, lo que no corresponde con las previsiones normativas vigentes. El artículo 56 de la Ley Forestal sanciona la acción de transportar o movilizar sin contar con las autorizaciones correspondientes, provenga la madera de bosque o de plantación, entendiéndose plantación tanto la que califique como forestal (que fue la única que tomó en cuenta la juzgadora), como cualquier otra, que puede incluir un solo árbol plantado, según surge de la interpretación armónica de la Ley y del Reglamento. Precisamente, el numeral 32 del Reglamento exige que, en cualquier caso, se porte factura, salvo que se trate del propietario, que entonces deberá contar con el certificado de origen. Es decir, la norma no prevé ningún supuesto en el cual pueda transportarse madera sin contar con documentación que acredite su origen legítimo, sea un certificado de origen, un permiso de transporte o una guía, precisamente para evitar la afectación al ambiente que se genera con la tala sin control.
En cuanto a la documentación para el transporte, el artículo 30 del Reglamento se refiere a la madera proveniente de una plantación forestal o un sistema agroforestal y el numeral 31 dispone los requisitos para la movilización de madera en troza, en bloc o escuadrada, no comprendidos en el artículo anterior, es decir, resulta muy claro que siempre se necesita documentación para transportar madera y la ausencia de esta es, precisamente, la que se sanciona por el artículo 56 en relación con el 63 inciso a de la Ley Forestal. De ahí que, aunque el artículo 28 de la Ley Forestal exime de obtener permiso para la corta o el transporte cuando se trate de árboles de plantaciones forestales o plantados individualmente, sí debe constarse con la guía respectiva o el certificado de origen, pues incluso el propietario, a quien se exime de mostrar facturas, debe poseer dicho certificado. Así lo ha entendido la Sala Tercera de la Corte Suprema de Justicia, cuya posición concuerda con la recién expuesta: "Considera esta Sala, que, con base en la lectura integrada de estas normas, debe interpretarse que, la madera cortada de plantaciones, como la del presente caso, no requerirán permiso de corta, transporte, industrialización ni exportación, de acuerdo con el artículo 28 de la Ley Forestal.
Sin embargo, ello no exime al propietario de la madera y al transportista, de portar consigo los documentos que acrediten el origen de dicha madera, tal como lo ordena el artículo 31 del mismo cuerpo legal, siendo a esa documentación a la que se refiere el artículo 56. Debe tenerse claro que, si bien no se requiere permiso estatal para cortar o trasportar la madera, sí se exige la expedición de un certificado de origen para que circule de un sitio a otro, ello con el fin, como es lógico suponer, de garantizar la procedencia legítima de la madera, para descartar su extracción ilegal por robo, por ejemplo. [..] El certificado de origen referido en el artículo 31 de la Ley Forestal, no es un permiso de transporte, como erróneamente lo interpreta el Tribunal de Apelación de Sentencia, sino que es un documento en el que consta el sitio o plantación de donde se extrajo la madera, para corroborar su legitimidad" (Sala Tercera, voto número 2014-1043 de las diez horas trece minutos del veintisiete de junio de 2014).
Por otra parte, como se señaló líneas atrás, el empleo del término plantación incluido en el numeral 56 de la Ley Forestal no remite, en todos los casos, a la plantación forestal del artículo 3, inciso f), definida como “Terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de madera”. Conforme se indicó, el propio reglamento establece la necesidad de realizar trámites para otros tipos de plantaciones. Por ello, tal noción, de acuerdo con la normativa, es más amplia que la considerada por la jueza a quo y por la defensa técnica, la cual es coherente con los fines de la Ley Forestal y con el uso adecuado y sostenible de los recursos naturales renovables previsto en su artículo primero. Como ya se indicó, la protección que contiene la citada ley al sancionar distintas conductas no se limita a la corta y explotación provenientes de bosques o de plantaciones forestales: el artículo 61, inciso a), sanciona la corta y el aprovechamiento de productos forestales en propiedad privada sin autorización de la Administración Forestal del Estado, sin exigir que provengan de bosque o plantación; y su inciso d) tipifica el transporte de productos forestales sustraídos de propiedad privada, igualmente sin esa referencia.
En consecuencia, sostener que solo es punible el transporte de madera si se demuestra que procede de un bosque o de una plantación forestal en los términos del artículo 3 es incorrecto. Es claro, conforme todo lo expuesto, que el transporte de madera constituye delito cuando se realiza sin la documentación respectiva, exigencia aplicable con independencia de que el producto provenga de bosque o de una plantación en sentido amplio, incluida la plantación forestal del art. 3, inc. f) o árboles plantados en propiedad privada, incluso individualmente. Esta obligación, fundada en una interpretación sistemática orientada a la tutela integral del recurso forestal, obedece a que el transporte es una fase esencial del aprovechamiento y la comercialización; por ello el Poder Legislativo instauró un control que garantice la procedencia lícita, evitando que una mera afirmación del transportista, que indique que la madera no proviene de bosque o de plantación agroforestal, sea suficiente para excluir el control sobre lo que se tala.
Tal posición es acorde con lo que resolvió la Sala Constitucional en el voto número 2007-3923, de las quince horas dos minutos del veintiuno de marzo del dos mil siete, en el cual determinó que el Poder Legislativo fue omiso en establecer requisitos para la tutela del ambiente al redactar el numeral 28 de la Ley Forestal que dispone “Fomento de las plantaciones forestales. Artículo 28.- Excepción de permiso de corta. Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirán permiso de corta, transporte, industrialización ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado”.
Al respecto, interesa transcribir in extenso lo que el órgano constitucional desarrolló, por ser relevante para la interpretación sobre lo que debe entenderse por plantación: “el artículo 28 impugnado, sí dispone una excepción al permiso de corta de árboles, señalando que en las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requieren permiso, transporte, industrialización, ni exportación. Cuando la norma hace alusión a plantación forestal, se refiere a una o más hectáreas cultivadas de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de madera. Las anteriores precisiones son importantes, porque resulta relevante a efectos de este estudio, diferenciar un bosque, de una plantación forestal y del sistema agroforestal, con el objeto de determinar el grado de tutela y protección que le otorga la Ley Forestal a las especies.
Como ya se indicó, nuestra ley concibe el bosque como un ecosistema nativo o autóctono, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del 70% de esa superficie y donde existan más de 60 árboles por hectárea de quince o más centímetros de diámetro a la altura del pecho (DAP). Por su parte, la plantación forestal, es aquel terreno de una o más hectáreas cultivadas de una o más especies forestales, cuyo objetivo principal, pero no único, es la producción de madera. El sistema agroforestal por otro lado, es la forma de usar la tierra que implica la combinación de especies forestales en tiempo y espacio con especies agronómicas, en procura de la sostenibilidad del sistema. Lo anterior es de relevancia, a efecto de clarificar que la diferencia sustancial entre ellas, es que la existencia de plantaciones forestales y árboles plantados individualmente obedecen a una decisión productiva y económica de sus propietarios, por lo que razonablemente se requiere de la facilidad para su corta, transporte, industrialización y exportación.
Este es el supuesto contemplado en el artículo 28 impugnado … Debe recordarse, que uno de los presupuestos de una plantación forestal o sistema agroforestal, es que lo plantado desde un inicio, lo sea con el único fin de ser aprovechado. Es bajo ese supuesto, que la ley intentó incentivar las mismas, eliminando ciertos trámites administrativos. No obstante, debe garantizarse que ello es así, previo a la corta de los árboles, toda vez que podría estarse propiciando por la falta de control, que sean taladas áreas que en realidad no constituyen ni una plantación forestal, ni un sistema agroforestal. Además, existen terrenos que por la inercia de sus propietarios, han dejado proliferar un verdadero bosque en su propiedad y luego es talado sin regulación alguna, o árboles que aún cuando hayan sido plantados, sirven de rompevientos, por la cantidad, su ubicación y la función que han ejercido durante muchísimos años, lo que en protección de valores fundamentales, amerita la conservación y regulación de su tala, independientemente de la naturaleza de su especie … también está el otro caso en el que los propietarios por decisión propia, sembraron una pequeña cantidad de árboles con el fin de embellecer su terreno.
Dependiendo de la cantidad de éstos, no resultaría razonable tampoco, que posteriormente requiera de un permiso para talar cada uno de éstos, como mera imposición al ejercicio de su derecho de propiedad. La solución pretendida por el accionante, en el sentido de impedir cualquier tala, es inaceptable en criterio de este Tribunal, tomando en consideración, que algunos árboles son plantados precisamente para ser aprovechados, por lo que el artículo 28 per se no resulta inconstitucional … Sin embargo, la Sala sí evidencia, que la ley no determina medidas precautorias que aseguren la correcta aplicación, de lo dispuesto en el artículo 28 impugnado, toda vez que, no toda plantación requiere de un plan de manejo y lo único requerido es el certificado de origen, pero para sacar la madera y transportarla. Con ese certificado, se debe acreditar la existencia de una plantación forestal o un sistema agroforestal en determinada finca, indicar el área plantada, el número de árboles, las especies, la ubicación, el nombre del propietario o propietaria. No obstante, como ya se indicó, dicho certificado se emite previamente, pero a la movilización de la madera, o sea una vez talada ….
Según el análisis practicado al artículo impugnado, el legislador modificó concepto de bosque a partir del cual se desarrolla la protección, restricciones y permisos otorgados en la Ley Forestal -como es el caso del artículo 28 en cuestión "Excepción de permiso de corta"-, de tal manera que, restringió sin fundamento técnico, el concepto anterior de bosque existente en la ley previo a su reforma. De modo que fueron dejadas sin protección vía ley, las especies no autóctonas y las áreas inferiores a dos hectáreas que constituyeran bosque, trayendo como consecuencia, que a través del artículo 28 impugnado, no se requiera de permiso para talar, ni siquiera de inspección previa, que permita asegurar que se trata del supuesto que la norma quiso incentivar, toda plantación forestal, sistema agroforestal o cualquier árbol plantado, quedando expuestas áreas que por su ubicación, cantidad y la función que han ejercido durante muchísimos años, amerita la conservación y regulación de su tala, independientemente de la naturaleza de su especie y de la naturaleza del terreno donde se ubique.
Así las cosas, esta Sala considera de conformidad con lo expuesto, que en este caso, se produce una inconstitucionalidad por omisión relativa. No obstante, si bien la Sala Constitucional es la competente para declarar la inconstitucionalidad de una norma, una violación de esta naturaleza debe ser subsanada por la Asamblea Legislativa, extendiendo la aplicación de la ley a los casos no contemplados expresamente por ella, como en este caso, a las especies y áreas que quedaron desprotegidas en el concepto de bosque actual, así como tomar medidas de prevención y control sobre las áreas en las que son permitidas la tala” [sic] (el subrayado es propio). De este extracto se desprende que la Sala Constitucional evidenció que, aunque el artículo 28 exime de permiso de corta en algunos casos, en ninguno se exonera del correspondiente certificado de origen, a lo que se agrega la guía contemplada en el Reglamento y, además, en el voto también se enumeran los árboles plantados como parte de los productos forestales, lo que evidencia que la interpretación que se plantea es coherente con la de dicha Sala.
En cuanto a la adquisición de la madera, encuentra esta Cámara que también existe falta de fundamentación, pues no se explica adecuadamente cómo se excluye la interpretación de ese verbo propuesta por el fiscal, ya que la jueza se limita a dar lectura a la definición del Diccionario de la Real Academia Española, sin detenerse a estudiar cada uno de los significados y si alguno de estos es compatible con la interpretación que realiza la Fiscalía. En todo caso, por las reglas del concurso aparente de delitos, de determinarse que se produjo la movilización sin la documentación respectiva, la totalidad de la conducta podría subsumirse en la norma que regula este último aspecto. De conformidad con todo lo expuesto, al encontrarse viciada la motivación, se anula la sentencia impugnada y se ordena el correspondiente juicio de reenvío para nueva sustanciación, que deberá realizarse por el mismo Tribunal de Flagrancia de Corredores, con distinta integración.
POR TANTO:
Se acoge el recurso de apelación presentado por el fiscal Diego Umaña Sánchez. En consecuencia, se anula la sentencia impugnada y se ordena el correspondiente juicio de reenvío para nueva sustanciación. NOTIFÍQUESE.
