WHEREAS
On 22 de noviembre del 2016, the plaintiff Institute filed an ordinary proceeding, requesting that the judgment declare what is transcribed verbatim below: “1. The nullity of deed number 61, appearing at [Valor 017] of Notary Rafael Ortega Ayón’s notarial record book, by which properties number [Valor 002] al 004 and [Valor 003] al 004, all in the Province of Guanacaste, were consolidated.
The statutory terms and requirements have been observed throughout the proceedings, and no defects or omissions capable of rendering the proceedings null and void or depriving the parties of a defense are apparent. This judgment is issued unanimously, following deliberation and within the statutory period. Judge Marenco Ortiz drafted the judgment, with the affirmative votes of Judge Laura García Carballo and Judge Paulo André Alonso Soto.
The following facts of significance to the resolution of this matter are deemed proven:
THEREFORE. THEY DECREE: Article 1. The following properties of [Nombre 007] in the Guanacaste Registry District are hereby expropriated: a) [...] which consists of pastureland and the other particulars indicated by Registro; b) [...], which consists of pastureland and the other particulars indicated by Registro; and c) [...], which consists of pastureland, all three real properties located in La Argentina de Santa Rosa de Tilarán, fourth district of the eighth canton of Guanacaste. The expropriation is carried out in accordance with plans Numbers 119-3-188, lot 146, and 119-3-196, lot 200, prepared by Instituto Costarricense de Electricidad in agosto y septiembre de 1976 at its direction. Article 2. The other necessary information shall be timely supplied by the interested Institute to the corresponding Juzgado Contencioso Administrativo y Civil de Hacienda. Article 3. This decree shall take effect upon its publication. Issued at Casa Presidencial, San José, on veinte días del mes de febrero de mil novecientos noventa y ocho” (image 100, evidentiary file CD 2).
TESTIMONY
The following facts relevant to these proceedings were not proven: 1) The alleged environmental damage was not established (absence of evidence). 2) It was not proven that the defendants were the persons who cut down the trees (lack of evidence). 3) That the Public Registry acted negligently when registering the public instruments whose annulment is sought herein (the case record). 4) That Banco Nacional de Costa Rica, when creating the mortgage and enforcing that instrument, knew, under the Principle of Public Notice through the Registry (Principio de Publicidad Registral), that the property had been expropriated (the case record). 5) That the State engaged in any negligent act or omission related to its authority in the expropriation proceedings or thereafter (the case record). 6) The subjective emotional distress (daño moral subjetivo) caused by ICE’s conduct and suffered by the counterclaimant company Innotec Trading Costa Rica SRL (absence of evidence thereof).
1. The Plaintiff Institute. In essence, and without prejudice to a full reading of all the arguments presented, the plaintiff states that, as part of its acquisition of real property for the construction of the Embalse and the Planta Hidroeléctrica Arenal, its principal conducted appraisal 14469-E dated 11 de mayo de 1977 to acquire the properties recorded under real-property folio registration numbers (matrícula folio real) [Valor 013], [Valor 014], and [Valor 015], all in the province of Guanacaste and belonging to Mr. [Nombre 007]. Because Mr. ([Nombre 011]) did not accept the appraised amount, expropriation proceedings (proceso de expropiación) were commenced before the Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda, which issued judgment number 464 at 16:00 hours on 15 de julio de 1986. Mr. ([Nombre 011]) donated, in equal shares, all the expropriated properties to his children ([Nombre 008]) by deed number 165 dated 10 de noviembre de 1992, executed before Notary Public Germán Guillén Castro; that deed was annulled by a judgment issued at 11:00 hours on 24 de diciembre de 1997 by the Tribunal Penal de Alajuela.
In 1992, surveyor Luis Ángel Araya Alfaro, at the request of Mr. ([Nombre 011]), conducted a land survey (levantamiento topográfico) to consolidate properties registered as [Valor 013] and [Valor 014], which had been expropriated, registering survey plan number G-080239-1992 and executing public deed number 61 dated 20 de enero de 1993 before Notary Public Rafael Ortega Ayón. That deed stated an area of 50 hectares and 9072 square meters, whereas the correct area was 37 hectares and 4072 square meters, and the consolidation resulted in property number [Valor 016] in the province of Guanacaste. Mr. [Nombre 002] granted a mortgage over this consolidated property in favor of Banco Nacional de Costa Rica; the property was subsequently sold at auction and awarded to Mr. [Nombre 010] on 15 de octubre de 1995. That property gave rise to the new properties numbered 191796, 19222, 192230, 192231, 192232, and 193651, all in the province of Guanacaste and owned by the co-defendants herein.
Under the applicable law, property acquired through expropriation—here, under case file number 78-1216-163-CA—constitutes public-domain property (bienes demaniales) and may not be devoted to private purposes, given that the expropriation was undertaken for public-interest purposes, namely, the powers granted to its principal by Decreto Ley 449 to develop electricity services for the benefit of the Costa Rican population. Because the properties were registered in the names of private third parties, its principal has suffered serious harm and an irreparable legal situation; their registration must therefore be annulled and the properties returned to the public domain (demanio público).
2. The Registro Nacional. The representative of the Registro stated briefly, and without prejudice to a full reading of the submission, that, in light of the public-record information (publicidad registral) and the plaintiff’s theory of the case, there is no indication that its principal’s officials engaged in erroneous acts or omissions from which a causal link giving rise to any liability could be established. Furthermore, for 23 years the ICE has shown complete neglect in properly protecting, through the property-registration system, the ownership right it claims to have acquired as a result of the expropriation. It has been established that the transactions involving the properties at issue in the proceedings were carried out in reliance on public-record information that, until now, was presumed complete and accurate. Through its own negligence, the ICE caused its property not to be properly protected in the public records, thereby failing to comply with section 1 of the Ley de Inscripciones de Documentos en el Registro Público and its regulations.
Its principal acted in compliance with the Principle of Legality (Principio de Legalidad), and therefore there is no administrative conduct that can be alleged to have been erroneous. Lastly, it states that, under the rules established in articles 455 and 449 of the Código Civil and articles 1 and 32 of the Ley de Inscripción de Documentos, the applicable limitation period (plazo para la caducidad) has expired, and that this preliminary defense (defensa previa) should therefore be upheld.
3. The State. Upon appearing in the proceedings, the State’s representative stated that the ICE seeks to recover into its estate properties numbered six thousand five hundred fifty-nine, ten thousand seven hundred thirty-six, and thirteen thousand eight hundred sixty-two, all in the Guanacaste Registration District (partido), which were duly expropriated from Mr. [Nombre 007]. The ICE did not secure registration of those properties after they were expropriated, and when it attempted to register them years later, they had already been transformed into other properties that had been conveyed to third parties. In its complaint, the ICE does not identify any act or omission by my principal that could give rise to any type of liability; it merely states that those properties are registered “in favor of private-law persons, as a consequence of an act of the Registro Nacional,” a situation it characterizes as “entirely unlawful.” The circumstances described by the plaintiff are plainly attributable to a third party who, as we understand it, was even reported to the criminal authorities, as reflected in case No. 670-2-93 against [Nombre 007] and others for the offenses of fraudulent simulation (Fraude de Simulación) and another offense, to the detriment of the ICE.
This representative does not discern any affirmative or negative act or conduct giving rise to liability within the factual circumstances set forth in the complaint. The conduct of the Registro Nacional complied with the body of applicable law (bloque de legalidad) and with the information contained in the respective registry entries (asientos registrales). Accordingly, the State does not oppose the ICE’s recovery of the aforementioned land, as that recovery was ordered in due course by a final and binding judicial decision. Nevertheless, the ICE has no right to seek any compensation from my principal for any alleged loss or damage. There is no causal link that would make my principal liable in any respect, particularly when the plaintiff itself states that all registered instruments were prepared and processed by third parties. The damage that the plaintiff claims to have suffered can in no way be attributed to my principal, because there was no act or omission on its part that caused the alleged damage.
It requests that the preliminary objection based on expiration (excepción previa de caducidad) and the merits-based defense of lack of entitlement (falta de derecho) be upheld with respect to its principal.
4. Banco Nacional de Costa Rica. The bank’s legal representative states that the central issue in these proceedings is the ICE’s claim concerning a group of real properties whose expropriation was processed through judicial proceedings. Its principal had no involvement in either the expropriation of the properties or the subsequent events attributed to the co-defendants concerning the creation of property [Valor 001] in the Guanacaste Registration District. The only event connected to it concerns the mortgage created at the time, which has since been discharged. That transaction was entered into in good faith in reliance on the information recorded at that time in the Registro Nacional and in accordance with the Principle of Public-Record Notice (Principio de Publicidad Registral). There is no causal relationship between the events alleged to have occurred in connection with the properties, their ownership, and the damages claimed against it. The Banco was never the owner of the properties alleged to have been expropriated, nor did it process the registration of the other properties. There is no causal link to the claimed environmental damage. It raises the defenses of fault of the victim (culpa de la víctima) and act of a third party (hecho de un tercero).
5. Mr. [Nombre 010], Lualhe de Tilarán S.A., [Nombre 016], Murimarti S.A., [Nombre 015]. In the submission filed on 16 de febrero de 2021, the defendants’ legal representative stated that the ICE has never owned or held title or dominion (dominio) over the properties owned by the defendants and cannot claim rights over something that has never belonged to it. The plaintiff never expropriated the properties from Mr. [Nombre 007], because it failed to register them in the Registro Público as the judge had ordered at the time, thereby violating not only the judicial order but also article 455 of the Código Civil. This action is long since time-barred and expired (prescrita y caduca), more than 30 years having elapsed since judgment 464 was issued at 16:00 hours on 15 de julio de 1986 by the Juzgado Primero de lo Contencioso Administrativo. Through an absolute lack of diligence, the ICE failed to formalize and record the relevant portions of the proceedings in a notarial instrument (protocolizar piezas) and to register the properties in its name in the Registro Público de la Propiedad; it did not even enter a marginal notation against those properties concerning the filing of the action and the existence of the expropriation proceedings, thereby making it possible for third parties acting in good faith to suffer harm.
The ICE is mistaken in stating that this land forms part of the public domain, because all hydroelectric projects are private, as there was no legislative intent to incorporate these properties into the public domain; accordingly, they are not immune from prescription, attachment, and alienation (imprescriptibilidad, inembargabilidad e inalienabilidad).
6. The Estate of ([Nombre 003]). The estate’s legal representative states that the ICE’s allegations are untrue because the donation was genuine and made in reliance on the public-record information. The judgment cited by the plaintiff institute is time-barred. The property belonging to them is flooded and has not been expropriated. Property [Valor 015] has always been in the formal possession of its principals and registered in their names and that of their deceased brother, and this property does not form part of the consolidation of properties identified by the plaintiff. A judgment issued in proceedings to which they were not parties cannot be enforced against them in the cited expropriation matter. The deed underlying the conveyance in their favor has produced legal effects for more than 10 years, and they are therefore protected by the statute of limitations (prescripción). As for the damages claimed, they are not itemized, valued, estimated, or specified, and therefore cannot be awarded in the judgment.
Counterclaim (Reconvención). Regarding the counterclaim, they stated that they acquired property [Valor 015] in the Guanacaste Registration District free of encumbrances and annotations, and it remains so to this day. The ICE flooded that property, they had to leave it in the 1980s, and they were never paid anything for it. From the outset, they have been unable to use and exploit the property, despite efforts to reach an administrative settlement with the ICE. For that reason, they request that the defendant be ordered to pay compensation for the losses and damages caused by the material loss of property [Valor 015], which consisted of pastureland, the creation of the Embalse Arenal being the cause of the losses and damages claimed and making exploitation of the property impossible.
7. From [Nombre 002], [Nombre 009], and [Nombre 008]. Counsel for the defendants states that the ICE’s assertions are untrue, because the donation was genuine and made in reliance on the public-record status (publicidad registral). He states that the judgment cited by the plaintiff institute is barred by the statute of limitations (prescripción). He states that the property belonging to them is flooded and has not been expropriated. Property [Valor 015] was always formally possessed by his clients and registered in their names and that of their deceased brother, and this property is not part of the consolidation of properties (reunión de fincas) identified by the plaintiff. He states that a judgment issued in expropriation proceedings (proceso expropiatorio) to which they were not parties cannot be enforced against them. He states that the deed underlying the transfer in their favor has been producing legal effects for more than 10 years and that they are therefore protected by the statute of limitations.
He states that the damages (daños) sought are not itemized, appraised, estimated, or specified, and therefore cannot be awarded in the judgment. Counterclaim (reconvención). Regarding the counterclaim, they stated that they acquired property [Valor 015] in the province of Guanacaste free of encumbrances and annotations (gravámenes y anotaciones), and that it remains so to this day. They stated that the ICE flooded that property, that they had to leave it in the 80s, and that they were never paid anything for it. They stated that from the outset they have been unable to enjoy and exploit the property, despite efforts to reach an administrative settlement with the ICE. For this reason, they request that the defendant be ordered to pay the damages (daños y perjuicios) caused by the material loss of property [Valor 015], which consisted of pastureland, the source of the claimed damages being the creation of the Embalse Arenal, which made it impossible to exploit the property.
8. From Innotec Trading CR SRL. It opposes the complaint because its principal acquired the property in reliance on the public-record status, and it has never intended to dispossess the plaintiff of any property or cause any environmental harm, as alleged in the complaint. When the property was acquired, the real property division certified that there was no legal impediment to its transfer. The person who sold the real property to it, Mr. [Nombre 010], obtained it at an auction (remate) duly approved by a judicial authority, and he was the person who sold the subdivided lot (lote segregado) to its principal; there was good faith (buena fe) in the transaction at all times. Everything done in the expropriation proceedings occurred long before its principal acquired the property and therefore has nothing to do with it; there is no causal link (nexo causal) between the facts alleged in the complaint and the relief sought, particularly the claims concerning payment for environmental damages.
It raises the defenses of the statute of limitations and lapse (caducidad). Counterclaim. In the same pleading, it filed a counterclaim requesting: “1. That the counterclaim be granted in all respects. 2. That the defendant (ICE) be ordered to pay the damages caused by its actions to my principal, Innotech Trading C.R. Sociedad Responsabilidad Limitada, since they have caused my principal serious economic, moral, psychological, and property-related harm, which is prudentially estimated at ciento veinte millones de colones, an amount that shall be definitively determined once the actuarial expert report (pericia del actuario matemático) has been submitted. 3- That the ICE be ordered to pay both categories of litigation costs (costas procesales).”
Before ruling on the defenses of lapse (caducidad) and limitation (prescripción) raised by the defendants, as well as on the parties’ arguments concerning the merits of the matter and the relief sought in the complaint, it is necessary to make certain specific clarifications regarding the conceptualization of what legal scholarship has identified as public-domain property (bienes de dominio público), as opposed to so-called private-domain property (bienes de dominio privado), thereby determining the legal nature of the real property at issue in these proceedings. 1) General Considerations. Thus, since its enactment, our liberal Código Civil has provided in Article 261: “Public things are those which, by law, are permanently allocated to any service of general utility, and those from which everyone may benefit because they have been made available for public use. All other things are private and subject to private ownership, even if they belong to the State or to the Municipalities, which, for such purposes, as civil persons, are no different from any other person.” This general regulation of things of a public-domain or private nature has led legal scholarship and the courts to develop a series of concepts regarding what must be understood as public-domain property and private-domain property in relation to property belonging to the State, clarifying first that the Public Administration, like any legal person, may hold title both to public-domain property and to private-domain property.
The former are referred to in various ways, such as public-domain assets (bienes demaniales), government-domain assets (bienes dominicales), or public-domain property, and are allocated by law to public use and the general welfare. That statutory dedication (afectación legal) is a power of the Asamblea Legislativa, pursuant to Article 121(4) of the Constitución Política. Once an asset acquires that public nature, it also acquires its attributes or characteristics and is therefore inalienable, not subject to acquisitive prescription, and immune from attachment, as follows from Article 262 of the Código Civil, which states that public things are outside the stream of commerce; in this regard, the Sala Constitucional stated as far back as judgment number 2306-91 of 6 de noviembre de 1991: “The public domain consists of assets that, by the express will of the legislature, manifest a special purpose of serving the community and the public interest.
These are the so-called government-domain assets, public-domain assets, public property or public things, which do not belong individually to private persons and which are intended for public use and subject to a special regime, outside the stream of commerce. That is, they are dedicated by their very nature and purpose. Consequently, these assets belong to the State in the broadest sense of the term, are dedicated to the service they provide, which is invariably essential by virtue of an express rule. The characteristic features of these assets are that they are inalienable, not subject to acquisitive prescription, immune from attachment, cannot be mortgaged or encumbered under Civil Law, and administrative action takes the place of possessory proceedings (interdictos) for recovery of the property.” On this subject, and consistently with the views expressed by our highest constitutional body, this Section, sitting with a different composition, stated: “ III)- REGARDING THE LEGAL REGIME GOVERNING PUBLIC-DOMAIN PROPERTY: Public-domain assets, government-domain assets, public-domain property, or public things are those permanently allocated by law to a public-utility service or made available for public use so that everyone may benefit from them (Article 261 of the Código Civil).
This type of real property owned by the Central and decentralized Public Administration (Municipalities) has the characteristics of being immune from attachment, inalienable, and not subject to acquisitive prescription; accordingly, it may not be possessed by private persons, but may only be subject to a permit or concession. In this regard, it has been established that ‘For an asset or thing to be considered part of the public domain and subjected to the applicable regime, that asset or thing must be dedicated to direct or indirect “public use”; in the “latter” case, it must consist of things directly dedicated—as “final assets” or “assets for use”—to the common benefit or convenience, excluding from the public domain those State assets that are merely instrumental in nature.’ (Marienhoff, Miguel S., in his work Treatise on Administrative Law. Volume V. Abeledo-Perrot. Buenos Aires. 1992., p. 25).
On this particular issue, the Sala Constitucional ruled in decision N° 2306-91 at 14 horas 45 minutos on seis de noviembre de 1999, holding that: ‘The public domain consists of assets that, by the express will of the legislature, manifest a special purpose of serving the community and the public interest.- These are the so-called government-domain assets, public-domain assets, public property or public things, which do not belong individually to private persons and which are intended for public use and subject to a special regime, outside the stream of commerce.- That is, they are dedicated by their very nature and purpose.- Consequently, these assets belong to the State in the broadest sense of the term, are dedicated to the service they provide, which is invariably essential by virtue of an express rule. The characteristic features of these assets are that they are inalienable, not subject to acquisitive prescription, immune from attachment, cannot be mortgaged or encumbered under Civil Law, and administrative action takes the place of possessory proceedings for recovery of the property.- Because they are outside the stream of commerce, these assets cannot be possessed, although a right of use may be acquired, but not a right of ownership.’ Accordingly, assets are public-domain assets, government-domain assets, or public-domain property when a law has so declared them or when, by reason of their use or purpose, they are devoted to serving the community or the public, with the rebuttable presumption (presunción iuris tantum) of their public-domain nature applying to that determination.
In this regard, registration in the property registry is unnecessary insofar as their public-domain status (demanialidad) is manifest and indisputable, by reason of the direct and indirect use that every person may make of them and their purpose and dedication to common use (Sala Constitucional, decision number 3145 at 9.27 horas on 28 de junio de 1996, and 2408 at 16:13 horas on 21 de febrero del 2007); and if their nature is disputed in judicial proceedings, the party asserting or contesting that status must prove it, as the aforementioned Sala held in decision 5628-2002, at 14:37 horas on 12 de junio del 2002. That decision established that ‘The special category of public-domain assets causes them to be excluded from the ordinary legal regime governing private property, as stated in the preceding recitals (considerandos), which entails the existence of a distinct, singular, and exclusive legal regime governed by Administrative Law; within that framework, the principle of privileged ex officio recovery of possession of the dedicated asset applies, under which the Administration may recover disturbed possession of its assets without having to resort to a judge and without prejudice to adjudication of superior title in judicial proceedings.
The legal concepts contained in the articles challenged in this action fall under this principle; namely, the presumed dedication and incorporation of the asset into public service, which also entails the presumption of its public-domain status and, consequently, the possibility of exemption from the duty to register such assets, all as part of the State’s right and duty to safeguard or protect the public domain. The effective exercise of such protection must be intended to halt any improper encroachment by private persons upon the public domain, and the Administration may use force—the police power over the public domain—in its defense. However, given the extraordinary and privileged nature of this general principle, and because it must coexist with the fundamental principle of the inviolability of property (Article 45 of the Constitución Política), it presupposes, at a minimum, either that ownership of the asset is manifest or that the asset’s public character is indisputable, such that the privilege may not be exercised when reasonable patrimonial disputes concerning the asset exist, whether they are being litigated through administrative or judicial proceedings.
In other words, the presumption of the asset’s public-domain status is closely related to the means available to the Administration to acquire assets and rights, which, in very general terms, are the same means available to private persons for acquiring ordinary property, except as already stated regarding the need for an ordinary statute to create the relevant category and the necessary intent to decree its dedication to public use. All of this leads to a specific examination of the privileged regime embodied in the texts of the challenged provisions. What has been stated thus far is intended to indicate that, in the Sala’s view, the privilege protecting public-domain status may and must be exercised by the Administration when there is no doubt whatsoever regarding the public character of the asset involved’ (Decision number 081-2009 of 30 de noviembre de 2009). This collegiate body fully agrees with that criterion and finds it applicable to the case before us.
Having thus far determined the general characteristics of government-domain assets, it is necessary, in light of the factual circumstances of the present case, to clarify how State assets may be considered public or patrimonial. It is clear from the foregoing that assets are made subject to that regime by statutory provision; however, this assertion is not absolute because, as will be seen, this is not always the case, particularly when privately owned assets pass into the hands of the Public Administration by virtue of compulsory expropriation (expropiación forzosa). In this regard, the author García Trevijano Garnica stated in his article Change in the Dedication of Expropriated Assets: “Compulsory expropriation may give rise both to assets of a public-domain nature and to assets of a private nature. Not every public-domain asset originates through expropriation, nor does every expropriation give rise to public-domain assets.
As Otto MAYER has observed, ‘it is not true that every expropriated parcel of real property is immediately transformed into public-domain property, because the legal nature of the property acquired does not depend on the nature of the act of acquisition and is not an integral part of the concept of that act; it depends on circumstances independent of it.’ Two requirements must be satisfied for public-domain assets to exist: 1. Title to the asset must belong to a Public Entity. 2. The asset must be dedicated to public use or to a public function or service of the entity holding title or of another entity” (García Trevijano Garnica, Ernesto. Public-Domain Ownership and Dedication. Journal of Public Administration. Fundación Dialnet. España). In accordance with the prevailing concept described thus far, the public domain may be summarized as a set of assets that, under the legal system, belong to a State entity and are intended for the inhabitants’ direct or indirect public use.
This concept comprises four elements, which were developed extensively by Marienhoff and introduced into our national legal scholarship through the author Eduardo García de Enterría. Those elements are as follows: 1) Subjective: Who holds title to the public domain.
A careful reading of the defenses of lapse and statute of limitations asserted by legal counsel for the defendants shows that they are essentially directed at ICE’s right to register the expropriated properties at issue in these proceedings, arising from the judgment rendered by the Juzgado Primero de lo Contencioso y Civil de Hacienda, insofar as, in the co-defendants’ view, the period available to the plaintiff entity to enforce and register the judgment in the Registro Público has long since elapsed, and therefore it cannot now seek to recover those properties. The Court’s determination. The defense must be rejected for the following reasons. First, it should be emphasized that not one of the defendants substantiated the defense—they merely invoked it—much less cited any legal provision; although the “Iura Novit Curia Principle” exists, it does not relieve the parties of their duty to provide adequate grounds for their arguments.
This Court understands, however—and shall rule accordingly—that the asserted statute of limitations concerns enforcement of judgment number 464 of July 15, 1978, rendered by the Juzgado de lo Contencioso in the expropriation proceeding brought against Mr. [Nombre 007]. Because administrative law contains no specific provision, under the doctrine of article 9, subsection 1), of the LGAP, reference must be made to article 868 of the Código Civil, which provides, insofar as relevant: “Every right and its corresponding cause of action shall be time-barred after ten years.” This provision governs the general limitations period in order to provide the parties with legal certainty in any proceeding, unless a special rule establishes a different period. Second, to rule on those defenses, this Court finds that, given the particular nature of the matter under discussion, it cannot address them without referring to the central issue in dispute: whether the property in litigation is public-domain property (bienes demaniales) or private property, with the determination of whether it serves a public purpose underlying the entire proceeding. 1) Legal nature of the real property at issue in the proceeding.
Having emphasized the foregoing, it is necessary to determine the legal nature of the property that ICE seeks to recover through an action for recovery of title (reivindicar) in these proceedings. For that purpose, the events that occurred and were proven in the proceeding will be examined to determine whether they satisfy the elements stated ut supra, namely: Subjective: Who holds title to the public domain? Objective: Which property belongs to the public domain? Normative: By virtue of which rules has it been incorporated into the public domain? Teleological: For what purpose is public-domain property intended? Having emphasized the foregoing, the Court analyzes the following: A) Subjective. It has been established that, in 1978, the Poder Ejecutivo (Presidente y Ministro del Ramo), through Decreto Ejecutivo número 8031-G of February 20, 1978, acting on the basis of technical studies, declared the properties at issue in the proceeding to be of public utility (utilidad pública), relying for that purpose on laws number 1371 and 2292 in order to expedite the procedure.
The referenced Decree shows that it was expressly issued by the constitutional body Poder Ejecutivo, which possessed sufficient authority to issue the expropriation act (acto expropiatorio) at issue, thereby satisfying the subjective requirement. B) Objective. According to legal doctrine, this element means that property subject to the public-domain regime (régimen de dominio) must be under the control of the public authority, whether through an instrument transferring title (título traslativo de dominio), such as a deed, or through public-law title (título de dominio público), such as expropriation. In this case, title was transferred through expropriation; however, acquisition of title must be understood as occurring not through the act of registration—in the matter under examination (sub examine), registration of the judgment rendered by the Juzgado Contencioso—but through the administrative act (acto administrativo) declaring the property’s public utility and ordering the necessary steps to provide compensation (expropriation decree).
To explain this point, it is necessary to begin from the premise that the expropriation proceeding arose as a constitutional mechanism known as the power of expropriation (potestad de expropiación), designed by the legislature under a two-part framework. First, there is an administrative procedure in which the expropriation act is issued and the land appraisal (avalúo del terreno) is communicated to the owner, thereby allowing the authorities, if the owner accepts it, to take possession of the property and immediately use it for the public purpose. If the appraisal is not accepted, however, summary proceedings (proceso sumario) arise before the courts, limited to determining the “fair price” (“justi precio”), and the parties may not dispute any other aspect related to the expropriation. From the foregoing, it may be stated that both proceedings arise from the power of expropriation—again—under article 45 of our Carta Magna, which provides, insofar as relevant: “Property is inviolable; no person may be deprived of his or her property except for a legally established public interest and upon prior compensation in accordance with the law.” Thus, from the outset, the legislature regulated the expropriation procedure as being limited to fair payment of the property’s value, without permitting the Administration’s power of expropriation—then arising from article 29 of the Constitución Política in force—to be disputed.
Accordingly, in article 5 of law number 36 (Ley de Expropiación Forzosa por Causa de Utilidad Pública de 1896), the Congreso Constitucional de la República de Costa Rica decreed: “When an expropriation is required for matters of a national nature, the Ministerio de Gobernación shall send notice to the owner of the real property, advising the owner of the proposed project and the possible occupation of all or part of the owner’s property, and shall grant a period of no fewer than three and no more than twenty days for the owner to state agreement with or opposition to the measure and, in the latter case, to offer the evidence supporting the refusal.” Chapter Three of that law, entitled “Proceedings for Compensation Due to Expropriation,” regulates the summary procedure and even expressly precludes the matters decided there from being debated in plenary proceedings (proceso plenario), stating in article 24: “Once final, the judgment conclusively resolves the matter and precludes any subsequent debate in ordinary proceedings concerning the issues resolved therein and the amount it orders to be paid as compensation for the price of the real property and for the loss and damage caused by the expropriation.” This institution was adopted in its entirety by the 1949 constituent assembly and formed the basis of laws number 1371 and 2292, upon which Decreto Ejecutivo Número 8031-G of February 20, 1978, at issue here, is based, through Ley Número 7495, currently in force.
The latter contains a clearer framework and unambiguously limits judicial expropriation proceedings to the determination of the amount of compensation, emphasizing that expropriation itself is a power of the State exercised in its administrative capacity. It provides: “article 1. Purpose. This law governs compulsory expropriation on grounds of a legally established public interest. Expropriation shall be ordered in the exercise of the sovereign authority (poder de imperio) of the Administración Pública and includes any form of deprivation of private property or of legitimate property rights or interests, regardless of their holders, upon prior payment of compensation representing the fair price of the property expropriated. Article 18- Declaration of public interest (Declaratoria de interés público). The expropriation of property shall require a reasoned act declaring the required property to be of public interest.
In the case of a ministry, that act shall be signed by the minister responsible for the relevant portfolio and, in all other cases, by the head of the expropriating entity, unless otherwise provided by law. The declaration of public interest shall be served upon the interested party or the party’s legal representative and published in the official gazette La Gaceta. This declaration shall constitute sufficient grounds for any compensation for commercial activities or any other impairment of rights that the administration must provide by reason of that same expropriation. Article 27.- Expropriation order (Acuerdo de expropiación). The Administration shall issue an expropriation order in the following cases: a) If the person whose property is expropriated timely objects to the administrative appraisal (avalúo administrativo). Article 28.- Commencement of the special expropriation proceeding and deposit of the administrative appraisal amount.
Once the expropriation order has been issued under the preceding article, the expropriating administration shall commence the special expropriation proceeding before the Juzgado de lo Contencioso Administrativo y Civil de Hacienda. Once the judicial case file has been opened, the Administration shall deposit the administrative appraisal amount as an indispensable prerequisite to taking possession of the expropriated property. Article 29.- Subject matter of the dispute. In the special proceeding for determination of fair value (fijación del justiprecio), only matters concerning review of the administrative appraisal of the expropriated property, based on its condition at the relevant time, shall be heard, for the purpose of determining the final amount of compensation.” Based on the foregoing, it is clear to this Court that expropriation proceedings conducted before the courts are summary in nature; consequently, they do not adjudicate any right of the parties in the real property or challenge the power of expropriation—whether or not a public purpose exists—but address solely the amount to be paid by the State to the person whose property is expropriated.
This is the only issue as to which it may be said that there is a declaration of rights (declaratoria de derecho). Accordingly, such proceedings recognize no right of the Administration requiring enforcement. Again, the power of expropriation and the right to obtain the property by its own authority (manus propia) for a public purpose arise in the administrative forum and, in this specific case, are registered in the Registro Público. The compulsory acquisition of the property occurred through the administrative expropriation act, which, in the matter under examination, was effected by Decreto Ejecutivo Número 8031-G of February 20, 1978. In conclusion, it may be stated that the expropriation proceeding exists so that, in fulfilling its purpose of meeting public needs, the State may on occasion acquire property under private ownership and, in the exercise of its public function, decide to take such property.
This special burden or sacrifice imposed on the private party must therefore be compensated in advance. It should be noted, however, that the affected party never has the option—again—of disputing the basis for or necessity of the public utility of the property to be expropriated; what is regulated, as explained above, is the amount of compensation or fair value. Consequently, it is clear that the deprivation act (acto ablatorio) is issued by the Administración Pública, not by the judge. The second element is therefore satisfied. C) Normative. According to legal doctrine, this element entails that the property must actually and effectively be opened to public use (according to Marienoff, it must be placed in current use or operation). It is important to determine this issue in light of the arguments made at trial by legal counsel for one of the parties that the properties acquired at the time by ICE are not public-domain property, but private property, as well as the arguments of another party that those properties have never been used or possessed by the plaintiff entity.
According to the factual framework presented and the testimonial, documentary, and expert evidence, it could be stated that ICE acquired those lands for future use, which, according to legal doctrine, would not confer public-domain status (demanialidad) upon them but would instead make them patrimonial property (bien patrimonial). However, that apparent potential status, which in principle would not allow them to be deemed incorporated into the public domain (dominio público), does not apply in this case. On the one hand, as demonstrated by the testimony presented by the siblings ([Nombre 008], [Nombre 009], [Nombre 002]) and even acknowledged by them, part of the land acquired was flooded by ICE to create the reservoir, another part constitutes what is known as the shoreline (ribera), and the remainder of the property was designated as forest to serve as a water reservoir and buffer environmental impacts, according to the expert reports contained in the record.
It is therefore clear that the third element is satisfied in this manner, namely, public use (uso público), understood in this case as immediate public utility (utilidad pública). D) Teleological. That is, the intended purpose of the property. In this case, it should be noted that, pursuant to the expropriation resolution (as reiterated), the properties were acquired to form part of the reservoir, as the aforementioned Decree provided: “The Instituto Costarricense de Electricidad needs to acquire [the property] so that it may form part of the Reservoir of the Arenal Hydroelectric Project”; however, the reservoir must not be understood as comprising only the Arenal lagoon (water surface), but also the adjacent lands used to recharge that reservoir. Thus, Ley Número 4334 del 5 de mayo de 1959, in its first article, provided: “The Arenal lagoon, the Cote lagoon, and the Arenal river (channel and waters) are hereby declared a national electrical-energy reserve area, in accordance with the map prepared by the Instituto Geográfico de Costa Rica (sheets 3247 III and 3247 IV).
Said area includes the shorelines to the extent necessary to ensure that the resources of this watershed are transformed into electrical energy usable for the country’s development.” In other words, the legislature considered it necessary to establish a reserve area to safeguard the watershed’s resources. It should be noted that the provision clearly states that it must encompass the necessary extent and that its boundaries will be demarcated by the Instituto Geográfico de Costa Rica jointly with ICE, which will clearly be the entity conducting the technical studies to determine the required area. Consequently, upon declaring the need to acquire the three properties belonging to Mr. ([Nombre 011]), it is evident that all of them acquired national public-utility status, contrary to what the parties suggest in their grounds of appeal. This teleological element is reinforced by the provisions of the first article of the Ley de Adquisiciones, expropiaciones y servidumbres del ICE, del 4 de febrero de 1979, which provides: “Real property, whether entire properties, portions, rights, or legitimate property interests, which by reason of their location are necessary, in the judgment of the Instituto Costarricense de Electricidad, for the fulfillment of its purposes, is hereby declared to be of public utility.” Although this provision was enacted after the declaration of public utility concerning the properties at issue here (almost one year after the resolution), Article 29 and the transitory provision of that statute state: “Article 29.- It shall enter into force upon its publication.
Sole Transitory Provision.- Expropriations and the establishment of easements (constituciones de servidumbres) initiated by the Institute before the publication of this law shall continue to be processed in accordance with the rules then in force, and these provisions shall apply only insofar as they do not contradict or conflict with the established rules.” In summary, the factual framework shows that the legislature’s intent has always been to comply fully with the provisions established by the constituent authority concerning the power of expropriation (ex officio) and the compensation procedure, in order to protect private interests against the special sacrifice imposed upon the person subject to administrative action in an expropriation. It bears repeating, however, that the declaration of public interest is never at issue, since that power is reserved to administrative discretion, which must base its decision on technical criteria.
In this regard, that circumstance was not disproved in the case under review (sub examine), nor did the parties even dispute the matter. Based on the foregoing, this Chamber considers that the properties recorded in the Guanacaste Registry District under numbers [Valor 013], [Valor 014], and [Valor 015], which were expropriated from Mr. [Nombre 007] at the relevant time, were privately owned, intended for agricultural use, expressly subjected by law (Decree), and incorporated into the public domain by the express will of the Administration so that one part would be used to create the Arenal reservoir, which is flooded (as also confirmed by witnesses [Nombre 019] and [Nombre 020]), and the remainder would be used to create a buffer zone (zona de amortiguamiento), thereby satisfying the fourth element. In further support of the foregoing, and contrary to the statement made at trial by the legal representative of certain co-defendants that the properties at issue are patrimonial property and are therefore subject to acquisitive prescription (prescriptibles) and transferable, reference must be made to what the authors Santamaría Pastor and Parejo Alfonso stated on this subject: “Legal doctrine is unanimous in noting that the State owns a series of assets over which it directly exercises its full rights as owner.
It therefore represents a collection of assets, things, and so forth, held by the State in its capacity as owner. Patrimonial property does not, of course, possess the characteristics of public-domain property because it has not been dedicated to public use or a public service; nevertheless, its indirect purpose places it in a special category within the legal system as a whole, distinct from purely and simply private property. The following has been stated regarding the concept of patrimonial property: ‘The concept of patrimonial property is therefore residual in nature; it consists of assets belonging to Public Administrations that are not in the public domain. But alongside this negative characteristic, there is another, positive one: patrimonial property is subject to the ordinary civil-property regime, except for the existence of a special regime for its protection, a regime similar to that applicable to public-domain property (Santamaria Pastor, Juan Alfonso, and Parejo Alfonso, Luciano, Derecho Administrativo, La Jurisprudencia del Tribunal Supremo).’” In other words, while our courts accept that the State possesses patrimonial property to which ordinary law applies, it is also true, as legal doctrine indicates, that the State has patrimonial property subject to a special protection regime, as in the case of forest reserves, whether State-owned but privately administered or privately owned property subject to a special regime.
Thus, Ley Forestal, insofar as relevant, provides in Articles 1 and 2: “ARTICLE 1.- Objectives This law establishes, as an essential and priority function of the State, the duty to ensure the conservation, protection, and administration of natural forests and the production, harvesting, industrialization, and promotion of the country’s forest resources intended for that purpose, in accordance with the principle of the appropriate and sustainable use of renewable natural resources (…) ARTICLE 2.- Expropriation The Executive Branch is authorized, through the Ministerio del Ambiente y Energía, to establish protected wildlife areas (áreas silvestres protegidas) of any management category on privately owned land by virtue of the natural resources existing in the area to be protected, which shall be mandatorily subject to the forestry regime (régimen forestal). Such lands may be voluntarily incorporated into protected wildlife areas or purchased directly where the parties agree.
Otherwise, they shall be expropriated in accordance with the procedure established in Ley de Expropiaciones, No. 7495, del 3 de mayo de 1995 and its amendments. When, following scientific and technical justification of the public interest, it is determined by law that the land is indispensable for conserving biological diversity or water resources, a restriction on ownership (limitación a la propiedad) shall be established that prevents tree cutting and land-use change (cambio de uso del suelo)” (emphasis not in the original). In this Court’s opinion, this provision applies to the case under review pursuant to the Precautionary Principle (Principio Precautorio) in environmental law, which, according to our highest constitutional body, consists of safeguarding water resources by making the appropriate decisions concerning them. In that regard, that body stated: “XV.- PRECAUTIONARY PRINCIPLE OF ENVIRONMENTAL LAW AND PROTECTION OF GROUNDWATER.
One of the guiding principles of Environmental Law is the precautionary principle, also known as the principle of prudent avoidance. This principle is embodied in the United Nations Conference on Environment and Development, or Rio Declaration, which literally states: ‘Principle 15.- In order to protect the environment, the precautionary approach shall be widely applied by States according to their capabilities. Where there is a danger of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.’ Within the domestic legal system, Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), in Article 11, establishes the following principles as interpretive parameters (parámetros hermenéuticos): ‘1.- Preventive approach: It is recognized that anticipating, preventing, and addressing the causes of biodiversity loss or threats to it is of vital importance. 2.- Precautionary approach, or in dubio pro natura: Where there is a danger or threat of serious or imminent damage to elements of biodiversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures.’ In Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999 (reiterado en los Votos Nos. 9773-00 de las 9:44 horas del 3 de noviembre del 2000, 1711-01 de las 16:32 horas del 27 de febrero del 2001 y 6322-03 de las 14:14 horas del 3 de julio del 2003), this Court held as follows: ‘(...) Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, the guiding principle of prevention is based on the need to take and implement all precautionary measures to prevent or contain possible harm to the environment or human health. Accordingly, where there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, including the postponement of the activity concerned. This is because, in environmental matters, ex post facto coercion is ineffective: if socially harmful biological consequences have already occurred, enforcement may carry moral significance, but it will scarcely compensate for the damage caused to the environment.’ Subsequently, in Voto No. 3480-03 de las 14:02 horas del 2 de mayo del 2003, this Court stated that ‘Properly understood, the precautionary principle concerns the adoption of measures not in the absence of knowledge regarding facts that generate risk, but in the absence of certainty as to whether such facts will in fact produce harmful effects on the environment.’” In the case of groundwater (aguas subterráneas) contained in aquifers (mantos acuíferos) and recharge and discharge areas (áreas de carga y descarga), the precautionary principle (principio precautorio), or in dubio pro natura (indubio pro natura), means that when there are no studies or reports conducted in accordance with the unequivocal and precisely applicable rules of science and technology that would make it possible to reach a state of absolute certainty regarding the harmlessness of the activity intended to be carried out in relation to the environment, or when such studies or reports contradict one another, the entities and bodies of the centralized and decentralized administration must refrain from authorizing, approving, or permitting any new application or application for modification; suspend those in progress until the uncertainty has been resolved; and, at the same time, adopt all measures aimed at protecting and preserving groundwater in order to guarantee the right to a healthy and ecologically balanced environment.
In essence, the sound environmental management of groundwater requires protecting the resource before it is contaminated or degraded. Decision Nº 01923 – 2004. of 25 de Febrero del 2004)”. It follows from the foregoing excerpt that this guiding principle is based on the need to take and implement every measure necessary to prevent or contain potential harm to the environment or human health. It thus seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Accordingly, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity concerned may even be postponed. This is because, in environmental matters, ex post enforcement is ineffective, since once harm has occurred, the biologically and socially harmful consequences may be irreparable. In summary, this collegiate body (órgano colegiado) finds that the defendants failed to disprove ICE’s statement that the lands in question were acquired as a buffer zone (zona de amortiguamiento) and reservoir area for laguna Arenal; indeed, it was demonstrated that they serve not only to maintain the reservoir but also a chain of public needs, including the use of the water in irrigation areas and a treatment plant to make the water fit for human consumption.
In this regard, the witness and public official Luis Mariano Zúñiga (surveyor), concerning the study he conducted to determine the properties’ land-registry status (situación registral), stated: “Property 200 was acquired so that it would remain forestland, as a buffer zone for the water reserve. It is a forest remnant that supports the water resource in the reservoir. Certain areas surrounding it, outside the protection zone, were reserved to serve as a buffer for the surface of the Arenal reservoir. It relieves the pressure caused by human activity. Through the canals, the Arenal project forms part of a cascading system for irrigation and human consumption.” This demonstrates the public purpose (utilidad pública) for which the properties at issue in these proceedings were designated and for which they were expropriated at the appropriate procedural stage. Lastly, regarding the defenses of lapse and limitation (caducidad y prescripción) asserted by Lic. [Nombre 010] in his answer to the complaint on behalf of the co-defendants [Nombre 010], Lualhe de Tilarán S.A. Importacones Murisol S.A. [Nombre 015], [Nombre 016], Murarti S.A., based on Article 61 of the Expropriations Law (Ley de Expropiaciones), that provision states: “Limitation and lapse.
The rights and causes of action arising under this law shall be subject to a ten-year limitation period, calculated from the day following that on which the State took possession of or encumbered the property. An administrative claim shall lapse and be deemed not to have been filed if five years pass without the interested party pursuing the proceedings”; this defense is likewise unfounded in the case before us, because a careful reading of that provision makes it abundantly clear that it concerns the rights of the private party subject to expropriation (administrado expropiado) to assert claims against the Administration arising from the expropriation. It does not apply to this specific case because it addresses a different legal situation. Having stated the foregoing, and as established above, the property at issue in these proceedings constitutes public-domain property (bienes demaniales) that, it bears repeating, was expressly designated as such by the Administration at the time of expropriation, with the public purpose of serving as a buffer zone for the Arenal reservoir.
This renders moot any discussion as to whether ICE’s right of title to the property is subject to limitation, because one of the essential characteristics of public-domain property (as noted above) is that it cannot be acquired by prescription (imprescriptibilidad), since it is outside private commerce. Consequently, the defenses of limitation and lapse asserted by the defendants are denied. Having established that the matter under review (sub examine) concerns public-domain property, making any discussion of its ownership or possession unnecessary, this Court must nevertheless address the legal status of the third-party purchasers, some of whom have occupied these lands for more than two decades, using them as apparent owners and having acquired them in reliance on the public land-registry records (publicidad registral), a situation caused by the claimant entity itself through its absolute negligence. Accordingly, the Court proceeds to analyze their situation in order to determine the legally appropriate disposition.
In its response to the complaint, counsel for the defendant company INNOTEC TRADING CR SRL opposed ICE’s claims upon entering an appearance in the proceedings and simultaneously filed a counterclaim against that entity. Counsel stated that the company represented has no intention of appropriating the property that it previously acquired from Mr. [Nombre 010], because it purchased the property in good faith, since at that time the registry information disclosed no restriction whatsoever, much less did the company know of the facts on which ICE bases its claims. Counsel asserted that the negligence of that Institute caused the illegality at issue in these proceedings and that, therefore, the counterclaim defendant must be held liable for the damage caused to the company represented. Opinion of the Court. To resolve this issue, and given the unique nature of the proceedings before us, it is first necessary to clarify certain matters concerning the concept of “third-party purchasers in good faith” (terceros adquirentes de buena fe), so that it may be contrasted with the legal institution of public-domain status (demanialidad).
In the present case, we have two such types of transactions: bilateral transactions, such as the sale and purchase agreements (contratos de compraventa) that were entered into, and unilateral transactions, such as the donation. Both have as an essential element an internal intent and the external expression or manifestation of that intent. In the words of Costa Rican legal scholar Víctor Pérez, intent is defined as “that faculty which determines us to act with knowledge of the purpose and motives of the action.” Thus, subsection one of Article 627, in relation to Article 1008, both of the Código Civil, provide: “ARTICLE 627.- The following are indispensable to the validity of an obligation: 1º.- Capacity of the person assuming the obligation (…) ARTICLE 1008.- The parties’ consent must be freely and clearly expressed. It may be expressed orally, in writing, or through conduct from which it must necessarily be inferred.” In addition, the principle of good faith (principio de buena fe) must be taken into account and, in this particular case, the principles of initial registration (inmatriculación) and registry publicity, which are outlined in general terms below.
Regarding the principle of good faith, it should be noted that it permeates the entire legal system and imposes a series of standards of conduct on public and private persons alike, in procedural matters before the Public Administration (administrative procedures conducted within the Public Administration), in judicial proceedings (the various types of court proceedings), and in contractual matters (with respect to the formation, performance, and termination of contracts), including in the exercise of the right to freedom of contract (autonomía de la voluntad). Indeed, the principal characteristic of the principle of good faith is that it encompasses the requirement of a series of standards of conduct applicable to every branch of the legal system and, at the same time, enforceable against any public- or private-law person. In this regard, the author Pérez González has stated: “The general principle of good faith, which applies, as noted, not only to the exercise of rights and powers but also to the establishment of relationships and the fulfillment of duties, entails the necessity of loyal and honest conduct—that conduct which, in the judgment of society, may be expected of a person—protects the trust that may reasonably have been placed in the conduct of others, and imposes a duty of consistency in one’s conduct” (González Pérez, Jesús.
El Principio General de la Buena Fe en el Derecho Administrativo. Editorial Civitas, España). As for the principle relating to registry matters, it provides that public-domain property (bien de dominio público), by its nature and because State ownership is presumed, does not require registration. This follows from the fact that the public-domain regime (régimen demanial) exists per se; its existence and public notice operate independently of the Registry, and the registered owner may not invoke lack of knowledge as a means of disproving it and defeating the property’s dedication to the public domain (afectación). Regarding this principle, the Sala Primera de la Corte Suprema de Justicia stated in decision number 00896-2015, issued at 09:30 hrs. on August 4, 2015: “Second, formal conveyance is not indispensable under the principle of initial registration. This Chamber has stated in this regard: ‘Pursuant to the principle of initial registration, or the unnecessary registration of public-domain property, its existence and public notice operate independently of its registration, because ownership by the State is presumed.
Accordingly, the public-domain regime exists per se. Public notice concerning this type of property is substantive, and not necessarily formal or registry-based. By its nature, public-domain property does not require registration….’” (judgment no. 001259-F-S1-2009, issued at 10 hours 50 minutes on December 10, 2009). The principle of registry publicity establishes the presumption that every person knows the contents of the entries in a Public Registry, which is administered by the State. In this regard, the Sala Constitucional stated in decision number 3441-2003 of April 30, 2003: “It is the function of the State to promote, maintain, and provide security for its population. One manifestation of this security is that provided by a registry system. Indeed, establishing a registry system in a particular sphere of social life is intended to provide legal certainty. Registry security is the fundamental pillar of our registry system.” It follows from the foregoing quotation that legal certainty regarding property is an activity entrusted by the legal system to the Poder Ejecutivo through the Registro Nacional and its bodies.
In this regard, the Ley de Creación del Registro Nacional establishes it as a body of the Ministerio de Justicia. This objective is achieved by giving notoriety and publicity to certain facts or transactions and reviewing their legality. Registry security (seguridad registral) guarantees lawful property transactions and market transparency. The registry system guarantees property rights in their various manifestations and facilitates transactions involving them. By legitimizing and protecting the rights of the registered owner and providing certainty to third-party purchasers, it facilitates property transactions. Such protection is achieved through the Registro Público, as provided by Article 1 of Law Number 3883 of May 30, 1967 (Ley de Inscripción de Documentos en el Registro Nacional), which states in relevant part: “The purpose of the Registro Nacional is to guarantee the security of registered property or rights with respect to third parties.
This shall be achieved through the publicity of such property or rights. With respect to the processing of documents, its objective is to register them.” In summary, the purpose of the Registro Nacional is to guarantee the principle of registry security through its various internal registries; legal certainty therefore entails publicity, which is obtained by registering the documents submitted there. Having emphasized the foregoing, the Court will now, as indicated, analyze the legal position of the third-party purchasers named as defendants herein, since in their opening statements and closing arguments they requested compensation.
As may be inferred from the foregoing factual circumstances, this is the typical case of a good-fa third party (tercero de buena fe), protected and governed by law. Based on the matters discussed above, this Chamber considers that the Administration must always act subject to the legal system (the doctrine of Article 11 of the Political Constitution and Article 11 of the LGAP), which, as has already been established, did not occur because of repeated omissions over several decades that now affect good-fa third parties; and because rules of public law must be incorporated, their interpretation and application must ensure a balance between the efficiency of the Administration and the dignity, liberty, and fundamental rights of the governed person (administrado). Thus, in the opinion of this collegiate body, in the matter under review (sub examine), as previously stated, it was the ICE itself that, through its negligence, caused the real properties to be transferred to third parties—purchasers who, as already determined, acted in good faith—and, because they are public-domain property (bienes dominicales), they must be restored, but such restoration must entail a right to compensation.
In that regard, it is clear that this case cannot be characterized as an expropriation, but compensation for damages is warranted, which, pursuant to Article 190 of the LGAP, the Administration must pay because of its negligent conduct, thereby recognizing a legally protectable interest (situación jurídica tutelable). For the reasons already stated, this Court finds that the representative of the defendant and counterclaimant company is indeed correct in its claim because, as has already been established and the ICE itself was unable to refute, it was due to the ICE’s own negligence and malfunction that the property was not registered in its name at the proper procedural time, and when it subsequently attempted to do so, it again failed to complete the registration, all of which resulted in the situation being adjudicated here. There can be no doubt—it bears repeating—that the ICE itself created this situation, causing damages to the good-fa purchaser, which must be compensated.
In this connection, the counterclaimant itself states that it has no interest in retaining the property or, to that extent, in opposing the ICE’s assertion of rights arising from its own fault; however, it is precisely because of that negligence that the ICE must be ordered to compensate it for damages, which it assesses, in equity, at veinte millones de colones, divided, without separately estimating each category, into economic, emotional, psychological, and property damage. This Court shall examine that claim and determine whether it is admissible, in the form in which it was submitted by the legal representative of the counterclaimant company.
b.1. Economic Damage (Daño Económico). The party states that the ICE must be ordered to pay compensation for the damages caused by its conduct, specifically property damage (daño patrimonial). This Chamber understands—and so rules—that this refers to the amount invested in acquiring the property, together with the cost of improvements. The claim must be granted for the following reasons. Based on the foregoing discussion concerning good-fa third parties, it has been established that the counterclaimant company acquired the property in the year 2015 as a result of lot segregations (segregaciones de lotes) offered for sale by the previous good-fa purchaser, Mr. [Nombre 010], who had acquired it through an auction in 1994. That initial investment resulting from the purchase of the lot registered as the property of the counterclaimant company, recorded under computerized real-property folio number 122229, with an area of 9414, 39 m2, cadastral plan number G-386792-1997, and which, according to the court-ordered expert appraisal (peritaje judicial) contained in the record, lies within the area claimed by the ICE (images 1510-1514), and of which it is now being dispossessed, gives rise to the property damage claimed.
The possible improvements made to the real property, such as the dwelling and others, constitute the alleged loss. The existence of those improvements is established by the expert appraisal contained in the record, which shows that a dwelling currently exists; however, the value of those improvements cannot be determined from that appraisal because it was not within the scope of the expert examination. Accordingly, it bears repeating that there can be no doubt that the counterclaimant would suffer damage to its assets as a result of being dispossessed of that property, and that damage must be compensated. For the foregoing reasons and based on the factual and legal considerations set forth above, the ICE is obligated to compensate Innotec Trading CR SRL for the economic damage caused. That damage, however, must be awarded in an unspecified amount (en abstracto), pursuant to section 122.m.ii of the CPCA, which provides: “m) To order the payment of damages under the following terms: (...) ii) A ruling awarding an unspecified amount, when their existence has been established but not their amount”; the amount must be determined during enforcement of the judgment (ejecución de sentencia), using as parameters the price for which the lot was acquired, the use made of it while it was under the counterclaimant’s ownership, the investment and improvements that the counterclaimant made to the real property (construction), and its current fair market value.
b.2. Emotional and Psychological Harm (Daño Moral y Psicológico). The company’s legal counsel claims emotional and psychological harm on behalf of his client, but does not indicate the type of harm to which he refers—whether subjective or objective. This Court therefore understands the reference to psychological harm to mean subjective emotional harm, and so rules. As the First Chamber of Justice has correctly observed, the distinction between subjective and objective emotional harm must be kept in mind. On this subject, that Court has stated: “Emotional harm (also referred to in legal scholarship as incorporeal, non-pecuniary, emotional-distress harm, etc.) occurs when an individual’s sphere of non-pecuniary interests is injured. However, because its infringement may have pecuniary consequences, a distinction must be drawn between ‘pure’ subjective emotional harm, or emotional-distress harm, and objective or ‘objectified’ emotional harm.
Subjective emotional harm occurs when a non-pecuniary right has been injured without affecting the person’s assets, ordinarily involving an unjust disturbance of the individual’s emotional state (displeasure, discouragement, despair, loss of enjoyment of life, etc.; e.g., an affront to honor, dignity, privacy, so-called impairment of one’s relational life, grief over the death of a family member or loved one, etc.). Objective emotional harm injures a non-pecuniary right while affecting the person’s assets; that is, it produces economically measurable consequences (e.g., the case of a professional who, because of the act attributed to him, loses all or part of his clientele). This distinction serves to differentiate the harm suffered by an individual in his social standing (good name, honor, integrity, etc.) from that suffered in the personal sphere (grief over the death of a relative); thus, one concerns the social component and the other the emotional component of the person’s legally protected interests.
This distinction originally arose to determine the scope of compensable emotional harm because legal scholarship was initially reluctant to compensate pure emotional harm due to the difficulty of quantifying it. For purposes of compensation, a distinction must be drawn among the different types of emotional harm. Objective emotional harm must be proven in the corresponding manner, as is the case with property damage; however, because the amount of subjective emotional harm cannot be structured and proven precisely, its determination is left to the sound discretion of the judge, taking into account the circumstances of the case, general principles of law, and equity, and the lack of evidence concerning the magnitude of the harm does not preclude determination of its amount.” (Judgment number 112-F-92 of fourteen hours fifteen minutes on fifteen de julio de mil novecientos noventa y dos). Based on the foregoing, this Collegiate Body finds that the claim must be denied for two fundamental reasons.
First, the claimant is a limited-liability company (sociedad de responsabilidad limitada), a legal entity (persona jurídica), and a reading of the counterclaim shows that, when asserted, the claim was not framed as harm to the shareholder but directly as harm to the company that owns the real property. Under national case law, this must be treated within what legal scholarship refers to as objectified emotional harm; however, it bears repeating that it was not pleaded and claimed in that form. Rather, from the claimant’s arguments, this Chamber understands—and so rules—that the claim concerns subjective emotional harm suffered by the legal representative, which is inadmissible, it bears repeating, because of the manner in which it was requested. Second, even if this Court were to find that such harm was recoverable, the claimant failed to satisfy the basic prerequisite for any claim of subjective emotional harm, namely, the minimum burden of proof, because it made no effort whatsoever to prove the existence of the alleged manifestation of emotional harm, limiting itself solely to invoking it and proposing an equitable assessment thereof, stating only that “the defendant be ordered to compensate the serious emotional and psychological harm suffered by the claimant.” It bears repeating, however, that it did not clearly and plainly identify the causal nexus (nexo de causalidad) between the harm claimed and the challenged conduct, merely stating that it arose from the ICE’s negligence, without any supporting evidence; consequently, this Court cannot determine the causal nexus. The requested relief must therefore be denied.
With respect to the defenses based on the statute of limitations (prescripción) and expiration (caducidad) raised by the co-defendants, because it has been determined in this case that the property at issue is public-domain property (bienes demaniales), which cannot be acquired by prescription (imprescriptibles), those defenses must be rejected. As to the defense of lack of legal entitlement (falta de derecho) raised by the State and Banco Nacional de Costa Rica, for the reasons stated above it must be granted, and the action must consequently be dismissed in all respects. As to the defense of lack of legal entitlement raised by the siblings ([Nombre 009], [Nombre 008], [Nombre 002]) and the Estate ([Nombre 003]), the defense is rejected and the action is declared partially meritorious. With respect to the co-defendants [Nombre 010], Lualhe de Tilarán S.A., Importacones Murisol S.A., [Nombre 024], [Nombre 016], and Murarti S.A., the defense of lack of legal entitlement is partially granted, and the action is declared partially meritorious. When filing the complaint, the ICE’s representative asserted the following claims, which were established at the preliminary hearing and on each of which a separate ruling shall now be issued:
a. Claims in the Complaint.
It is therefore clear that, in the case at bar (subjudice), there is fault on the part of the victim (culpa de la víctima), arising from its failure to register the real property in its name; such negligence cannot be attributed to third-party purchasers, much less can compensation be sought for any damage caused by its own fault.
b. Claims in the Counterclaim (Pretensiones de la Reconvención). Upon entering an appearance in the proceeding and opposing the ICE claims, the legal representative of Innotec Trading CR SRL filed a counterclaim against ICE, asserting the following claims:
Pursuant to section 193 of the Código Procesal Contencioso Administrativo, court costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the unsuccessful party by virtue of having lost, subject to the exceptions contained in subsections a) and b) of that same article. Given the number of parties in the proceeding and the manner in which it was resolved, the award of costs must be apportioned. With respect to the siblings ([Nombre 008], [Nombre 009], [Nombre 002]) and the Estate Proceeding (Sucesorio) of ([Nombre 003]), because they were unsuccessful in both the complaint and the counterclaim, they are ordered to pay ICE’s attorneys’ fees and court costs in both proceedings. With respect to the co-defendants Innotec Trading CR SRL., [Nombre 010], Lualhe de Tilarán S.A. Importaciones Murisol S.A. [Nombre 015], [Nombre 016], and Murarti S.A., since they were found to be good-faith third parties (terceros de buena fe), this Tribunal finds that sufficient grounds existed for them to litigate; they are therefore exempted from paying costs, and each party shall bear its own.
With respect to the Estado, Banco Nacional de Costa Rica and Junta Administradora del Registro Nacional, because the complaint was denied, they are exempted from costs, and ICE is ordered to pay both attorneys’ fees and court costs. With respect to the counterclaim, due to mutual partial success (vencimiento recíproco), pursuant to article 73.2.3 of the Código Procesal Civil, no costs are awarded, and each party shall bear its own expenses.
POR TANTO
The statute-of-limitations and expiration defense (excepción de prescripción y caducidad) raised by the defendants is denied. The defense of lack of legal entitlement (excepción de falta de derecho) asserted by the co-defendants Junta Administrativa del Registro Nacional, Banco Nacional de Costar Rica and the Estado is granted. Consequently, because the lack-of-legal-entitlement defense is granted, the complaint filed by ICE against the Estado, Banco Nacional de Costa Rica and Junta Administrativa del Registro Nacional is denied, and the Instituto Costarricense de Electricidad is ordered to pay both attorneys’ fees and court costs. The lack-of-legal-entitlement defense asserted by [Nombre 002], [Nombre 009], [Nombre 008], all ([Nombre 002], [Nombre 008], [Nombre 009]), Sucesorio [Nombre 003], [Nombre 010], Lualhe de Tilarán S.A. Importacones Murisol S.A. [Nombre 015], [Nombre 016], Murarti S.A. t Innotec Trading CR SRL is partially granted; consequently, the complaint filed by the Instituto Costarricense de Electricidad is partially granted, and any relief not expressly granted is deemed denied.
With respect to the counterclaim, the lack-of-legal-entitlement defense asserted by the Instituto Costarricense de Electricidad is granted; consequently, the counterclaim filed by [Nombre 002], [Nombre 009], [Nombre 008], all ([Nombre 009], [Nombre 008], [Nombre 002]), Sucesorio [Nombre 003] against the Instituto Costarricense de Electricidad is denied, and the counterclaimants are ordered to pay the costs of that action. As to the counterclaim filed by Inotec Trading Costa Rica SRL, the defense of legal entitlement asserted by ICE is partially granted.
In the principal proceeding filed by the Instituto Costarricense de Electricidad, it is hereby declared:

[Nombre 002] N° 2025006570 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las ocho horas con cincuenta y nueve minutos del tres de Julio del dos mil veinticinco.- Proceso de Conocimiento Puro Derecho, interpuesto por Instituto Costarricense de Electricidad, representado por el Lic. Luis Salazar Solís, mayor, abogado, carné de colegiado número 207, en su condición de Apoderado Especial Judicial contra la Junta Administrativa del Registro Nacional, representada por su Apoderado Especial Judicial, Lic. Alberto Herrera Porras, mayor, abogado, carné de colegiado número 20084, El Estado, representado por las letradas Licda. Marcela Ramírez Jara, mayor, abogada, carnet de colegiada número 11396, y; Licda. Ariana Arias Murillo, mayor, abogada, carné de colegiado número 21530; Banco Nacional de Costa Rica, representado por el Lic. Andrés Bogarín Bustamante, mayor, abogado, carnet de colegiado número 19132; Inotecc Trading Costa Rica SRL, representada por el Lic. CONSIDERANDO
Que en fecha 22 de noviembre del 2016 el Instituto actor presentó proceso ordinario, peticionando que en sentencia se declare lo que a continuación se transcribe literalmente: “1. La nulidad de la escritura número 61, visible al [Valor 017] del protocolo del Notario Rafael Ortega Ayón, mediante el cual se reúnen las fincas número [Valor 002] al 004 y [Valor 003] al 004, todas de la Provincia de Guanacaste.
En los procedimientos se han observado los términos y prescripciones de ley, y no se notan vicios u omisiones susceptibles de producir nulidad o indefensión a las partes. Se emite este fallo por Unanimidad y previa deliberación dentro del plazo de ley. Redacta el juez Marenco Ortiz con los votos afirmativos de la jueza Laura García Carballo y el juez Paulo André Alonso Soto.
De importancia para la resolución de este asunto se tienen por demostrados los siguientes hechos:
POR TANTO. DECRETAN: Artículo 1. Exprópiese al señor [Nombre 007] sus fincas del Partido de Guanacaste así: a) [...] que es terrenos de pastos y demás detalles que indica el Registro; b) [...], que es terreno de pasto y demás detalles que indica el Registro; y c) [...], que es terreno de pasto, los tres inmuebles situados en La Argentina de Santa Rosa de Tilarán, distrito cuarto del cantón octavo de Guanacaste. La expropiación se realiza de conformidad con los planos Números 119-3-188, lote 146 y 119-3-196, lote 200, levantados por el Instituto Costarricense de Electricidad en agosto y septiembre de 1976 por su orden. Artículo 2. Los demás datos necesarios serán suministrados oportunamente por el Instituto interesado al correspondiente Juzgado Contencioso Administrativo y Civil de Hacienda. Artículo 3. Este decreto rige a partir de su publicación. Dado en Casa Presidencial, San José a los veinte días del mes de febrero de mil novecientos noventa y ocho” (imagen 100, expediente pruebas CD 2).
TESTIMONIOS
De importancia para el presente proceso se tienen como hechos no probados los siguientes: 1) No se logró acreditar el daño ambiental alegado (ausencia de prueba). 2) No se probó que los demandados fueran los que cortaron los árboles (ayuno de prueba). 3) Que el Registro Público actuara con negligencia al momento de inscribir los instrumentos públicos que aquí se piden anulen (los autos). 4) Que el Banco Nacional de Costa Rica al momento de constituir la hipoteca y ejecutar dicho título tuviera conocimiento bajo el Principio de Publicidad Registral que el inmueble hubiese sido expropiado (los autos). 5) Que el Estado hubiere realizado alguna conducta negligente u omisiva relacionada con sus competencias en el proceso de expropiación o posterior (los autos). 6) El dañó moral subjetivo infringido por el actuar del ICE y sufrido por la empresa reconventora Innotec Trading Costa Rica SRL (ausencia de la misma).
1. Del Instituto Actor. En lo fundamental y sin perjuicio de la lectura integral de todos los argumentos expuestos, la parte actora manifiesta que su representado como parte de la adquisición de bienes inmuebles para la construcción del Embalse y la Planta Hidroeléctrica Arenal, realizó el avalúo 14469-E con fecha 11 de mayo de 1977 para adquirir las propiedades con matrícula folio real de la provincia de Guanacaste números [Valor 013], [Valor 014] y [Valor 015] todas pertenecientes al señor [Nombre 007] que al no aceptar el señor ([Nombre 011]) el monto del avalúo se inició el proceso de expropiación en el Juzgado Primero de lo Contencioso Administrativo y Civil de Hacienda, el cual por medio de la sentencia número 464 de las 16:00 horas del 15 de julio de 1986. Que el señor ([Nombre 011]) donó por partes iguales a sus hijos todos ([Nombre 008]) las fincas que le fueron expropiadas, en la escritura número 165 del 10 de noviembre de 1992 otorgada ante el notario Germán Guillén Castro, dicha escritura fue anulada mediante sentencia de las 11:00 horas del 24 de diciembre de 1997 por el Tribunal Penal de Alajuela.
Que en 1992 el topógrafo Luis Ángel Araya Alfaro realizó por encargo del señor ([Nombre 011]) un levantamiento topográfico para reunir las fincas matrículas [Valor 013] y [Valor 014] que habían sido expropiadas inscribiendo el plano número G-080239-1992, y otorgándose la escritura pública número 61 con fecha 20 de enero de 1993 ante el notario Rafael Ortega Ayón en la cual se consignó la medida de 50 hectáreas con 9072 metros cuadrados, cuando lo correcto corresponde a 37 hectáreas con 4072 metros cuadrados, y dando como resultado dicha reunión la finca número [Valor 016] de la provincia de Guanacaste. Que sobre esta última reunión el señor [Nombre 002] constituyó hipoteca a favor del Banco Nacional de Costa Rica la cual fue rematada y adjudicada por el señor [Nombre 010] en fecha 15 de octubre de 1995. De dicha finca se han generado las fincas nuevas 191796, 19222, 192230, 192231, 192232, 193651 todas de la provincia de Guanacaste y propiedad de los aquí codemandados.
Que de acuerdo con la normativa vigente los bienes adquiridos por expropiación en este caso bajo el expediente número 78-1216-163-CA constituyen bienes demaniales y no pueden tener un destino privado considerando que el motivo de la expropiación fue para fines de interés público como son las potestades dada por el Decreto Ley 449 a su representada para desarrollar servicios de electricidad para beneficio de la población costarricense. Que al ser inscritas las propiedades a nombre de terceros privados se le genera a su representado una grave lesión e irreparable situación jurídica por lo que se debe anular la inscripción de la misma y devolver al demanio público.
2. Del Registro Nacional. La representación del Registro indicó de forma sucinta y sin perjuicio de la lectura integral del escrito que, su representado de acuerdo con la publicidad registral y a la teoría del caso del actor no se desprende que sus funcionarios hayan realizado actuaciones erróneas u omisas para considerar que exista un nexo de causalidad que le genere responsabilidad alguna. Que además a lo largo de 23 años ha existido una total desidia por parte del ICE en tutelar como corresponde en el ámbito registral el derecho de propiedad según expresa adquirió a consecuencia de la expropiación. Que se encuentra verificado que los movimientos que han existido sobre las fincas objeto del proceso han sido al amparo de una publicidad registral que hasta el momento se presumía íntegra y exacta. Que ha sido el ICE con su negligencia la que ha causado que sus bienes no sean tutelados registralmente como se debe, incumpliendo con lo indicado en el numeral 1 de la Ley de Inscripciones de Documentos en el Registro Público y sus reglamentos.
Que su representada actuó cumpliendo el Principio de Legalidad, por lo que no existe ninguna conducta administrativa que se pueda acusar de actuar erróneamente. Por último, indica que conforme a la normativa establecida en los artículos 455 del Código Civil en relación con el 449 del mismo Código, artículos 1 y 32 de la Ley de Inscripción de Documentos, el plazo para la caducidad que se invoca está superado, debiendo acogerse dicha defensa previa.
3. Del Estado. Al personarse la representación del Estado indicó que, el ICE pretende recuperar para su patrimonio los inmuebles número seis mil quinientos cincuenta y nueve, diez mil setecientos treinta y seis, y trece mil ochocientos sesenta y dos, todas del partido de Guanacaste debidamente expropiados al señor [Nombre 007]. El ICE no logró la inscripción de dichos inmuebles una vez expropiados y cuando años después intentó su inscripción ya los inmuebles se habían trasformado en otras fincas mismas que fueron traspasadas a terceros. En la demanda el ICE no especifica ninguna actuación u omisión por parte de mi representado que pudiera generar algún tipo de responsabilidad únicamente se limita a indicar dichas propiedades están inscritas “en favor de sujetos de derecho privado, como consecuencia de un acto del Registro Nacional,” situación que la califica como “totalmente antijurídica”.
La descripción que realiza el actor a todas luces son propias de un tercero, el cual, tenemos entendido que fue denunciado hasta en sede penal según se desprende de la causa No. 670-2-93 contra [Nombre 007] otros por el delito de Fraude de Simulación y otro, en perjuicio del ICE. No aprecia esta representación cuál acto, conducta positiva o negativa sea generadora de responsabilidad en el cuadro fáctico que se presenta en la demanda. La actuación del Registro Nacional se encuentra apegada al bloque de legalidad y a la información que constaba en los respectivos asientos registrales. En este orden, el Estado no se opone a que el ICE logre recuperar los terrenos dichos por así haberlo ordenado en su oportunidad un acto jurisdiccional firme y definitivo. No obstante, carece de derecho el ICE al pretender alguna indemnización por parte de mi representado para resarcir algún daño o perjuicio.
No existe ningún nexo de causalidad que haga imputable a mi representado algún tipo de responsabilidad más cuando es el propio actor que indica que todos los actos inscritos fueron confeccionados y gestionados por terceros. El daño que dice el actor haber sufrido nunca puede ser imputado a mi representado dado que no existe una acción u omisión propia que genere el daño alegado. Solicita se acoja la excepción previa de caducidad y la de fondo de falta de derecho con respecto a su representado.
4. Del Banco Nacional de Costa Rica. Indica la representación legal del banco que el punto medular del proceso estriba en la reclamación que hace el ICE respecto de un conjunto de bienes inmuebles cuya expropiación se tramitó en sede judicial. Que su poderdante ha sido ajeno a la expropiación de los inmuebles y de los hechos posteriores que se le imputan a los codemandados respecto a la constitución de la finca [Valor 001] del Partido de Guanacaste. Que el único hecho que se le relaciona es con respecto a la hipoteca que en su momento se constituyó, pero que al día de hoy está cancelada. Que dicho negocio se hizo de buena fe al amparo de lo que en el Registro Nacional se indicaba en ese momento y conforme al Principio de Publicidad Registral. Que no hay ninguna relación de causalidad entre lo que se afirma que sucedió en los inmuebles, su titularidad y el daño que se le reclama. Que el Banco en ningún momento ha sido propietario de dichos inmuebles que se afirman se expropiaron, ni gestionó la inscripción registral de las otras propiedades. Que no existe ningún nexo causal del daño ambiental reclamado. Interpone la excepción de culpa de la víctima y hecho de un tercero.
5. Del señor [Nombre 010], Lualhe de Tilarán S.A., [Nombre 016], Murimarti S.A., [Nombre 015]. En su escrito presentado el 16 de febrero de 2021 el representante legal de los demandados indicó que el ICE nunca ha sido propietario ni ha tenido la titularidad ni el domino de las fincas de su propiedad y no puede reclamar derechos sobre algo que nunca le ha pertenecido Que el actor nunca expropió las fincas al señor [Nombre 007] al omitir inscribir dichas fincas en el Registro Público como el juez en su oportunidad lo ordenó incumpliendo no solo con el mandato judicial sino con el artículo 455 del Código Civil. Que la presente demanda está ampliamente prescrita y caduca con más de 30 años de haberse dictado la sentencia 464 de las 16:00 horas del 15 de julio de 1986 por el Juzgado Primero de lo Contencioso Administrativo. Que el ICE en una absoluta falta de diligencia omitió protocolizar piezas e inscribir a su nombre en el Registro Público de la Propiedad, ni siquiera anotó al margen de dichas fincas la interposición de la demanda y existencia de procedimientos expropiatorios, haciendo posible la producción de un daño a terceros de buena fe.
Que se equivoca el ICE al indicar que esos terrenos son de dominio público, pues todos los proyectos hidroeléctricos son privados ya que no existe una voluntad de legislador en que se incorporaran dichos inmuebles al demanio público, por lo que no gozan de imprescriptibilidad, inembargabilidad e inalienabilidad.
6. Del Sucesorio ([Nombre 003]). Manifiesta el representante legal de la sucesión que no es cierto lo dicho por el ICE, ya que la donación fue real y al amparo de la publicidad registral. Que la sentencia que cita el instituto actor está prescrita. Que la finca que les pertenece se encuentra inundada y no ha sido expropiada. La finca [Valor 015] siempre estuvo en posesión formal de sus representados e inscrita a su nombre y del hermano fallecido, y que esta finca no forma parte de la reunión de las fincas que indica el actor. Que no puede hacerse efectiva en su contra una sentencia de la cual no formaron parte en el proceso expropiatorio citado. Que la escritura que dio pie al traspaso a su favor tiene más de 10 años de estar produciendo efectos jurídicos y por lo tanto, los cobija la prescripción. Que en cuanto a los daños cobrados, los mismos no se individualizan no se tasan, no se estiman y no se concretan por lo que no es posible declararlos en sentencia.
Reconvención. En cuanto a la reconvención indicaron que adquirieron la finca [Valor 015] del partido de Guanacaste sin gravámenes y anotaciones hasta el día de hoy. Que dicha finca el ICE la inundó, tuvieron que salir de la misma en la década de los 80 y nunca se les pagó nada por ello. Que desde el inicio no han podido disfrutarla y explotar el inmueble a pesar de que se ha tratado de llegar a un arreglo administrativo con el ICE. Por tal razón, solicitan se condene al demandado al pago de los daños y perjuicios causados por la pérdida material de la finca [Valor 015] que fueron terreno para pastos, siendo el origen de dichos daños y perjuicios reclamados la creación del Embalse Arenal siendo imposible explotarla.
7. De los señores [Nombre 002], [Nombre 009] y [Nombre 008]. Manifiesta el representante legal de los demandados que no es cierto lo dicho por el ICE ya que la donación fue real y al amparo de la publicidad registral. Que la sentencia que cita el instituto actor está prescrita. Que la finca que les pertenece se encuentra inundada y no ha sido expropiada. La finca [Valor 015] siempre estuvo en posesión formal de sus representados e inscrita a su nombre y del hermano fallecido, y que esta finca no forma parte de la reunión de las fincas que indica el actor. Que no puede hacerse efectiva en su contra una sentencia de la cual no formaron parte en el proceso expropiatorio citado. Que la escritura que dio pie al traspaso a su favor tiene más de 10 años de estar produciendo efectos jurídicos y por lo tanto los cobija la prescripción. Que en cuanto a los daños cobrados los mismos no se individualizan no se tasan, no se estiman y no se concretan por lo que no es posible declararlos en sentencia.
Reconvención. En cuanto a la reconvención indicaron que adquirieron la finca [Valor 015] del partido de Guanacaste sin gravámenes y anotaciones hasta el día de hoy. Que dicha finca el ICE la inundó, tuvieron que salir de la misma en la década de los 80 y nunca se les pago nada por ello. Que desde el inicio no han podido disfrutarla y explotar el inmueble a pesar de que se ha tratado de llegar a un arreglo administrativo con el ICE. Por tal razón solicitan se condene al demandado al pago de los daños y perjuicios causados por la pérdida material de la finca [Valor 015] que fueron terreno para pastos, siendo el origen de dichos daños y perjuicios reclamados la creación del Embalse Arenal siendo imposible explotarla.
8. De Innotec Trading CR SRL. Que se opone a la demanda por cuanto su representada adquirió el bien a la luz de la publicidad registral, que nunca ha sido su intención despojar al actor de bien alguno, ni causar ningún daño ambiental como se indica en la demanda. Cuando se adquirió el bien la sección de bienes inmuebles certificó que no existía ningún impedimento legal para ser objeto de traspaso. Que la persona que le vendió el bien inmueble, el señor [Nombre 010], lo obtuvo en un remate debidamente aprobado por una autoridad judicial, y este es quien le vende el lote segregado a su representada, existiendo siempre una buen fe en el negocio. Que todo lo que se actuó en el proceso expropiatorio sucedió mucho tiempo antes de que mi representada adquiriera el bien, por lo que no tiene nada que ver con ella, no existe ningún nexo causal entre los hechos planteados en la demanda y las pretensiones, sobre todo las atinentes al pago de daños y perjuicios ambientales.
Que interpone las defensa de prescripción y caducidad. Reconvención. En el mismo escrito interpuso reconvención solicitando: “1. Que se declare con lugar en todos sus extremos la reconvención. 2. Se condene a la demandada (ICE) al pago de los daños y. perjuicios ocasionado con sus acciones a favor de mi representada Innotech Trading C.R. Sociedad Responsabilidad Limitada toda vez que le han causado un grave daño económico, moral, psicológico y patrimonial a mi representada, el cual se estima de forma prudencial en la suma de ciento veinte millones de colones, monto que se fijará de forma definitiva una vez rendida la pericia del actuario matemático. 3- Se condene al ICE al pago de ambas costas procesales”.
Previo a resolver las excepciones de caducidad y prescripción interpuesta por los demandados así como los argumentos planteados por las partes sobre el fondo del asunto, y, las pretensiones estiladas en la demanda se hace necesario hacer algunas precisiones puntuales sobre la conceptualización de lo que en doctrina se ha indicado como bienes de dominio público en contra posición de los denominados bienes de dominio privado, determinando así la naturaleza jurídica de los bienes inmuebles objeto del proceso.
De una lectura atenta de las excepciones de caducidad y prescripción alegada por la representación legal de las partes demandadas, en esencia van dirigidas al derecho que tiene el ICE para inscribir las propiedades expropiadas y objeto del proceso, derivado de la sentencia dictada por el Juzgado Primero de lo Contencioso y Civil de Hacienda, en el sentido de que a criterio de los codemandados, el plazo que el ente actor tenía para ejecutar e inscribir la sentencia en el Registro Público de sobra ha transcurrido, por lo que no puede pretender en este momento querer recuperar dicho bienes. Criterio del Tribunal. La excepción debe de ser rechazada por los siguientes motivos. Primero, hay que resaltar que ninguno solo de los demandados fundamentó (solo la invocaron) su excepción y mucho menos referenció normativa alguna, y si bien existe el “Principio Iura Novit Curia”, ello no exime a las partes del deber de realizar una adecuada fundamentación de sus alegatos.
Ahora bien, entiende este Tribunal (y así lo resolverá) que la prescripción alegada se refiere a la ejecución de la sentencia número 464 del 15 de julio de 1978 dictada por el Juzgado de lo Contencioso en el proceso de expropiación seguido contra el señor [Nombre 007], para lo cual siendo que no existe una norma específica en el derecho administrativo, en doctrina del artículo 9 inciso 1) de la LGAP se debe acudir a los dispuesto en el artículo 868 del Código Civil que en lo que interesa indica: “Todo derecho y su correspondiente acción se prescriben a los diez años”; siendo esta norma la que regula el plazo prescriptivo general, para dar una certeza jurídica a las partes en cualquier proceso, excepto que por normal especial se regule otro plazo. Segundo, para poder resolver dichas excepciones considera este Tribunal que por la particularidad del tema sometido a discusión no es posible pronunciarse sobre dichas defensas sin hacer referencia al eje central de la discusión, como es la naturaleza demanial o privada de los bienes que se encuentran en litigio, siendo subyacente a todo el proceso determinar su utilidad pública o no. 1) Naturaleza jurídica de los bienes inmuebles objeto del proceso.
Resaltado lo anterior, se debe entrar a determinar la naturaleza jurídica de los bienes que el ICE pretende reivindicar en presente proceso. Para los efectos se someterá a examen los hechos ocurridos y acreditados en el proceso para verificar si se cumplen con los elementos indicados ut supra, que son: Subjetivo: ¿Quién es el titular del dominio público? Objetivo: ¿Cuáles son los bienes del dominio público? Normativo: ¿En virtud de qué normas están incorporados al dominio público? Teleológico: ¿A qué fin están destinados los bienes del dominio público? Resaltado lo anterior se analiza: A) Subjetivo. Se tiene por acreditado que para el año 1978 el Poder Ejecutivo (Presidente y Ministro del Ramo) por Decreto Ejecutivo número 8031-G del 20 de febrero de 1978 la Administración con fundamento en los estudios técnicos declaró de utilidad pública las fincas objeto del proceso utilizando para ello las leyes número 1371 y 2292, con el fin de darle agilidad al procedimiento.
Del Decreto referenciado se tiene que fue emitido expresamente por el órgano constitucional Poder Ejecutivo, el cual cuenta con la competencia suficiente para dictar el acto expropiatorio que nos ocupa, cumpliendo de esta manera con el requisito subjetivo. B) Objetivo. De acuerdo con la doctrina, este elemento hace referencia a que el bien sometido al régimen de domino, se encuentre en poder de la autoridad pública, sea por un título traslativo de dominio como puede ser una escritura o un título de dominio público como es la expropiación, en este caso, el traslado del dominio se dio por medio de la expropiación, pero se debe entender esta adquisición del dominio no por el acto de inscripción (en el sub examine inscripción de la sentencia dictada por el Juzgado Contencioso) sino por medio del acto administrativo que declara la utilidad del bien y ordena realizar las gestiones para indemnizar (Decreto de expropiación).
Para explicar este punto hay que partir de la premisa que el proceso de expropiación nace como una herramienta de carácter constitucional, conocida como potestad de expropiación, siendo diseñada por el legislador bajo un doble esquema. Un procedimiento administrativo donde se genera el acto expropiatorio y se le comunica al dueño el avalúo del terreno, permitiendo así, en caso de aceptarlo, entrar en posesión del bien una utilización inmediata del mismo para la utilidad pública; empero en caso de no ser aceptado el avalúo, surge en sede jurisdiccional un proceso sumario limitado a determinar el “justi precio” sin poder discutir las partes ningún otro aspecto relacionado con la expropiación; de lo anterior se puede afirmar que ambos procesos nacen de la potestad expropiatoria (se reitera) del artículo 45 de nuestra Carta Magna que dispone en lo que interesa: “ La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley”.
Es así que desde sus inicios el legislador reguló el procedimiento de expropiación circunscrito al pago justo del valor del inmueble, sin discutir la potestad expropiatoria de la Administración derivada en ese momento del artículo 29 de la Constitución Política vigente, así en el artículo 5 de la ley número 36 (Ley de Expropiación Forzosa por Causa de Utilidad Pública de 1896) el Congreso Constitucional de la República de Costa Rica decretó: “Cuando para asuntos de carácter nacional fuere el caso de una expropiación, el Ministerio de Gobernación dirigirá nota al dueño del inmueble, indicándole la obra en proyecto y la posible ocupación del todo o parte de su propiedad, y le concederá un término no menor de tres ni mayor de veinte días para que manifieste su conformidad o se oponga a la medida, y ofrezca en este caso las pruebas en que funde la negativa”, siendo en su capítulo tercero de dicha ley que se intitula “De los juicios de indemnización por expropiación”, que se regula el procedimiento sumario e incluso vedando expresamente que lo allí discutido pueda ser debatido en un proceso plenario al indicarse en el artículo 24 “La sentencia, una vez que sea ejecutoria, resuelve definitivamente la cuestión y hace imposible todo debate posterior en juicio ordinario respecto de las cuestiones por ella resueltas y del monto que la misma mande indemnizar como precio del inmueble y de los daños y perjuicios causados con la expropiación”.
Esta institución fue receptada íntegramente por el constituyente del 49 siendo la base de las leyes número 1371 y 2292 en las cuales se fundamenta el Decreto Ejecutivo Número 8031-G del 20 de febrero de 1978, que aquí nos ocupa; hasta la Ley Número 7495 vigente actualmente, la cual contiene un desarrollo más claro y circunscribe de forma diáfana el proceso expropiatorio en sede jurisdiccional a la discusión del monto a indemnizar, resaltando que la expropiación en si es una potestad del Estado ejercida en su función administrativa, así dispone: “artículo 1. Objeto. La presente ley regula la expropiación forzosa por causa de interés público legalmente comprobado. La expropiación se acuerda en ejercicio del poder de imperio de la Administración Pública y comprende cualquier forma de privación de la propiedad privada o de derechos o intereses patrimoniales legítimos, cualesquiera sean sus titulares, mediante el pago previo de una indemnización que represente el precio justo de lo expropiado.
Artículo 18- Declaratoria de interés público. Para la expropiación de un bien será indispensable un acto motivado, mediante el cual el bien requerido se declare de interés público. Tal acto, en caso de un ministerio, será firmado por el ministro del ramo y, en los demás casos, por el jerarca del ente expropiador, salvo disposición de ley en contrario. La declaratoria de interés público deberá notificarse al interesado, o su representante legal, y será publicada en el diario oficial La Gaceta. Esta declaratoria será motivo suficiente para las eventuales indemnizaciones por actividades comerciales o cualquier otra afectación de derechos que en razón de esa misma expropiación deba realizar la administración. Artículo 27.- Acuerdo de expropiación. La Administración dictará un acuerdo de expropiación en los siguientes casos: a) Si existiera disconformidad oportuna del expropiado con el avalúo administrativo.
Artículo 28.- Inicio del proceso especial de expropiación y depósito del avalúo administrativo. Dictado el acuerdo de expropiación, en los términos del artículo anterior, la administración expropiante deberá iniciar el proceso especial de expropiación ante el Juzgado de lo Contencioso Administrativo y Civil de Hacienda. Una vez conformado el expediente judicial, la Administración depositará el monto del avalúo administrativo, como requisito indispensable y previo a la entrada en posesión del bien expropiado. Artículo 29.- Objeto de litigio. En el proceso especial de fijación del justiprecio, solo se discutirán asuntos relacionados con la revisión del avalúo administrativo del bien expropiado, según las condiciones en que se encontraba, para fijar el monto final de la indemnización”. Con lo dicho hasta aquí es claro para este Tribunal que el proceso de expropiación seguido en sede jurisdiccional es sumario, por lo que no se discute ningún derecho de las partes sobre el bien inmueble o cuestionar la potestad expropiatorio (si existe o no utilidad pública) sino únicamente el monto a cancelar por parte del Estado al expropiado (siendo este tema el único extremo donde se puede decir que existe una declaratoria de derecho), por consiguiente, en ella no se le reconoce derecho alguno a la Administración que deba ser ejecutado, (se reitera, la potestad de expropiación y el derecho de obtener el bien por manus propia para un fin público se da en sede administrativa), y en este caso específico inscrito en el registro público, la adquisición forzosa del bien se realizó en el acto administrativo expropiatorio, que para el subexamine se dio con el Decreto Ejecutivo Número 8031-G del 20 de febrero de 1978.
En conclusión se puede afirmar que el proceso expropiatorio nace con la finalidad de que el Estado al cumplir con el fin de suplir las necesidades pública debe en algunas ocasiones adquirir bienes que se encuentra en dominio privado y para ello en su función pública decide tomarlos, por lo que esta carga o sacrificio especial del administrado debe ser compensado previamente, pero nótese que nunca hay opción (se reitera) por parte del perjudicado en discutir el fundamento o necesidad de la utilidad pública del bien a expropiar, lo que se regula como se vio anteriormente, es el monto de la indemnización o justiprecio; en consecuencia es claro que el acto ablatorio es dictado por la Administración Pública y no por el juez, con lo indicado se cumple el segundo elemento. C) Normativo. Este elemento conforme a la doctrina implica que el bien debe liberarse al uso público de forma actual y efectiva (según Marienoff debe ser puesto en uso o función actual).
Esto es importante determinarlo, en razón de los argumentos del representante legal (vertido en juicio) de una de las partes, en cuanto a que los bienes adquiridos en su momento por el ICE no son dominicales, sino privados, amén de ello, por otro lado, los argumentos de otra parte en cuanto a que dichos inmuebles nunca han sido utilizados o ejercidos la posesión por parte del ente actor. De acuerdo con el cuadro fáctico planteado y las pruebas testimoniales, documentales y periciales se podría indicar que el ICE adquirió dichas tierras hacia el futuro, lo que no le otorgaría según doctrina demanialidad sino ser un bien patrimonial, sin embargo, esa aparente potencialidad que en tesis de principio no tendría la facultad de tenerse como incorporada al domino público, en este caso no sucede así; ya que estas tierras, por un lado, como quedó demostrado con los testimonios presentados por los hermanos ([Nombre 008], [Nombre 009], [Nombre 002]) e incluso así aceptado por ellos, parte de los terrenos que se adquirieron fueron inundados por el ICE para la creación de la laguna, otra parte forma lo que se conoce como ribera y el resto de la finca destinada a bosque con el fin de servir como reservorio de agua y amortiguar los impactos ambientales, de acuerdo con los peritajes que consta en autos.
Con lo anterior es claro que se cumple de esta forma el tercer elemento, sea el uso público, es decir, entendiéndose en este caso utilidad pública inmediata. D) Teleológico. Es decir el destino del bien. En este caso véase que conforme al acuerdo expropiatorio (se reitera) los bienes fueron adquiridos para que formaran parte del embalse, así dispuso el mencionado Decreto: El Instituto Costarricense de Electricidad necesita adquirir para que forme parte del Embalse del Proyecto Hidroeléctrico de Arenal”, pero no solamente se debe entender embalse lo que conforma la laguna del Arenal (espejo de agua), sino también los terrenos adyacentes que son utilizados para la recarga de dicho embalse, así en la Ley Número 4334 del 5 de mayo de 1959, en su artículo primero se dispuso: “Declárase zona nacional de reserva de energía eléctrica, la laguna Arenal, la laguna Cote y el río Arenal (cauce y aguas), de acuerdo con el mapa elaborado por el Instituto Geográfico de Costa Rica (hojas 3247 III y 3247 IV).
Dicha zona incluye las riberas, en la extensión necesaria para garantizar que los recursos de esta cuenca se transformen en energía eléctrica utilizable para el desarrollo del país”; es decir, el legislador consideró necesario dejar una zona de reserva para garantizar los recursos de la cuenca, véase que claramente indica que debe ser la extensión necesaria y su extensión será demarcada por el Instituto Geográfico de Costa Rica en conjunto con el ICE, que claramente será el que hará los estudios técnicos para determinar el área que necesita, por consiguiente al declararse la necesidad de adquirir las tres fincas del señor ([Nombre 011]) es evidente que todas ellas adquieren una utilidad pública de orden nacional y no como lo sugieren las partes en sus agravios. Este elemento teleológico se ve reforzado por lo dispuesto en el artículo primero de la Ley de Adquisiciones, expropiaciones y servidumbres del ICE, del 4 de febrero de 1979, que dispone: “Declárense de utilidad pública, los bienes inmuebles, sea fincas completas, porciones, derechos o intereses patrimoniales legítimos, que por su ubicación sean necesarios, a juicio del Instituto Costarricense de Electricidad, para el cumplimiento de sus fines”; y si bien esta norma fue aprobada posterior a la declaratoria de utilidad pública de las fincas aquí en discusión (casi un año después del acuerdo), el artículo 29 y el transitorio de dicha norma indica: “Artículo 29.- Rige a partir de su publicación.
Transitorio único.- Las expropiaciones y constituciones de servidumbres, iniciadas por el Instituto antes de la publicación de esta ley, seguirán su tramitación conforme a las normas vigentes y estas disposiciones únicamente serán aplicables en lo que no contradigan o se opongan a las normas establecidas”. En resumen se desprende del cuadro fáctico que la voluntad del legislador siempre ha sido cumplir a cabalidad con lo dispuesto por el constituyente en cuanto a potestad expropiatoria (de oficio) y el procedimiento de indemnización con el fin de resguardar los intereses privados por el sacrificio especial que se le somete al administrativo en una expropiación; pero se reitera, nunca se discute la declaratoria de interés público, reservándose dicha potestad en la discrecionalidad administrativa la cual fundamentará su decisión en criterios técnicos, siendo en este orden de ideas que en el sub examine no se desacreditó tal situación y ni siquiera las partes discutieron tal asunto.
Con lo indicado hasta aquí es criterio de esta Cámara que las fincas inscritas en el Partido de Guanacaste número [Valor 013], [Valor 014] y [Valor 015], las cuales en su momento fueron expropiadas al señor [Nombre 007], eran de naturaleza privada y con vocación agrícola fueron afectadas por ley expresa (Decreto) e insertas al demanio público por voluntad expresa de la Administración con el fin de que una parte sirvieran para la creación del embalse Arenal, la cual se encuentra inundada, (así confirmado incluso por los testigos [Nombre 019] y [Nombre 020]) y el resto para la creación de zona de amortiguamiento, cumpliéndose con el cuarto elemento. En abono a lo indicado, y contrario a lo que manifestó en el juicio el representante legal de algunos codemandados en cuanto a que los bienes en discusión son patrimoniales y por consiguiente, prescriptibles y transferibles, hay que traer acotación lo indicado por los autores Santamaría Pastor y Parejo Alfonso sobre este tema: “La doctrina es conteste en señalar que El Estado es propietario de una serie de bienes, sobre los cuales ejerce directamente su derecho pleno como tal.
Representa por lo tanto, un conjunto de bienes, cosas, etc., que El Estado posee en calidad de propietario. Ciertamente los bienes patrimoniales no gozan de las características de los bienes de dominio público, en tanto no están afectados a un uso o a un servicio público, sin embargo, su finalidad mediata los hace tener una especial categoría dentro del marco total del ordenamiento jurídico, distinta de los puros y simples bienes particulares. Con relación al concepto de bienes patrimoniales se ha dicho lo siguiente: "El concepto de bienes patrimoniales posee, por lo tanto, un carácter residual; lo constituyen los bienes pertenecientes a las Administraciones públicas que no son de dominio público. Pero junto a esa nota de carácter negativo existe otra de sentido positivo, cual es la de que los bienes patrimoniales se encuentran sometidos al régimen ordinario de la propiedad civil, salvedad hecha de la existencia de un régimen especial de protección de los mismos, régimen que es similar al de los bienes de dominio público ( Santamaria Pastor, Juan Alfonso, y Parejo Alfonso, Luciano, Derecho Administrativo, La Jurisprudencia del Tribunal Supremo)”; es decir, bien es aceptado en nuestros tribunales que existen bienes patrimoniales del Estado a los cuales se les aplica el derecho común, también es cierto como lo indica la doctrina existen bienes patrimoniales del Estado que tienen la existencia de un régimen protección especial como es el caso de las reservas forestales sean del Estado en administración privada o bienes privados sometidos a un régimen especial, así la ley forestal en lo que interesa en sus artículos 1 y 2 regula: “ARTÍCULO 1.- Objetivos La presente ley establece, como función esencial y prioritaria del Estado, velar por la conservación, protección y administración de los bosques naturales y por la producción, el aprovechamiento, la industrialización y el fomento de los recursos forestales del país destinados a ese fin, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables (…) ARTICULO 2.- Expropiación Se faculta al Poder Ejecutivo para que, por medio del Ministerio del Ambiente y Energía, en terrenos de dominio privado, establezca áreas silvestres protegidas, cualquiera que sea su categoría de manejo, en virtud de los recursos naturales existentes en el área que se desea proteger, los cuales quedan sometidos en forma obligatoria al régimen forestal.
Estos terrenos podrán ser integrados voluntariamente a las áreas silvestres protegidas o bien comprados directamente cuando haya acuerdo de partes. En caso contrario, serán expropiados de acuerdo con el procedimiento establecido en la Ley de Expropiaciones, No. 7495, del 3 de mayo de 1995 y sus reformas. Cuando, previa justificación científica y técnica del interés público, se determine mediante ley que el terreno es imprescindible para conservar la diversidad biológica o los recursos hídricos, quedará constituida una limitación a la propiedad que impedirá cortar árboles y cambiar el uso del suelo” (subrayado no es del original), norma que a criterio de este Tribunal es aplicable al sub examine bajo el Principio Precautorio en materia de derecho ambiental que de acuerdo a nuestro máximo órgano constitucional consiste en resguardar los recursos hídricos tomando las decisiones pertinentes sobre ello, al respecto dicho órgano indicó : “XV.- PRINCIPIO PRECAUTORIO DEL DERECHO AMBIENTAL Y PROTECCIÓN DE LAS AGUAS SUBTERRÁNEAS.
Uno de los principios rectores del Derecho Ambiental lo constituye el precautorio o de evitación prudente. Este principio se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, la cual literalmente indica “Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente”. En el ordenamiento jurídico interno la Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), en su artículo 11 recoge como parámetros hermenéuticos los siguientes principios: “1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección”.
En el Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999 (reiterado en los Votos Nos. 9773-00 de las 9:44 horas del 3 de noviembre del 2000, 1711-01 de las 16:32 horas del 27 de febrero del 2001 y 6322-03 de las 14:14 horas del 3 de julio del 2003) este Tribunal estimó lo siguiente: “(...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible –o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente”.
Posteriormente, en el Voto No. 3480-03 de las 14:02 horas del 2 de mayo del 2003, este Tribunal indicó que “Bien entendido el principio precautorio, el mismo se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente”. Para el caso de las aguas subterráneas contenidas en los mantos acuíferos y áreas de carga y descarga, el principio precautorio o de indubio pro natura, supone que cuando no existan estudios o informes efectuados conforme a las regla unívocas y de aplicación exacta de la ciencia y de la técnica que permitan arribar a un estado de certeza absoluta acerca de la inocuidad de la actividad que se pretende desarrollar sobre el medio ambiente o éstos sean contradictorios entre sí, los entes y órganos de la administración central y descentralizada deben abstenerse de autorizar, aprobar o permitir toda solicitud nueva o de modificación, suspender las que estén en curso hasta que se despeje el estado dubitativo y, paralelamente, adoptar todas las medidas tendientes a su protección y preservación con el objeto de garantizar el derecho a un ambiente sano y ecológicamente equilibrado.
En esencia, una gestión ambiental segura de las aguas subterráneas pasa por proteger el recurso antes de su contaminación o degradación. Resolución Nº 01923 – 2004. del 25 de Febrero del 2004)”. Del anterior extracto se deriva que dicho principio rector se fundamenta en la necesidad de tomar y asumir todas las medidas para evitar o contener la posible afectación del ambiente o la salud de las personas. Así, pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, puesto que de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables.
Recapitulando, considera este órgano colegiado que no se logró por parte de los demandados desacreditar lo indicado por el ICE en cuanto a que dichos terrenos fueron adquiridos como zona de amortiguamiento y reservorio para la laguna Arenal, e incluso, sí se demostró que sirven no solo para mantener el embalse sino que existe una cadena de necesidades públicas como son la utilización de las aguas en zonas de riego y una planta de tratamiento para hacer que el consumo de agua sea humano, el testigo funcionario Luis Mariano Zúñiga (topógrafo) al respecto y sobre el estudio que realizó para determinar la situación registral de los inmuebles, indicó: “La propiedad 200 se adquiere con el fin de que sea remanente de bosque, como zona de amortiguamiento de reserva de agua. Es un remanente de bosque que ayude con el recurso hídrico que está en el embalse. Alrededor se reservó ciertas áreas que está fuera de la zona de protección que trata de ser de amortiguamiento para el espejo del embalse arenal.
Es un aliviador de la presión que existe por actividad humano. A través de los canales el proyecto arenal forma parte de un sistema en cascada para riego y consumo humano”, lo que demuestra la utilidad pública a la que fue destinado los inmuebles objeto del proceso y que fueron expropiados en su momento procesal. Por último, en cuanto a la excepción de caducidad y prescripción que el Lic. [Nombre 010] presentó en su escrito de contestación de la demanda en representación de los codemandados [Nombre 010], Lualhe de Tilarán S.A. Importacones Murisol S.A. [Nombre 015], [Nombre 016], Murarti S.A. fundamentada en el artículo 61 de la Ley de Expropiaciones, dispone dicho numeral: “Prescripción y caducidad. Los derechos y las acciones que se deriven de la presente ley prescriben en diez años, contados a partir del día siguiente a aquel en el que el Estado tomó posesión del bien o lo afectó. El reclamo, por vía administrativa, caducará y se tendrá por no interpuesto si transcurren cinco años sin que el interesado active las diligencias”; dicha excepción tampoco es procedente en el caso que nos ocupa, por cuanto de una lectura atenta de citado numeral se extrae meridianamente que se refiere a los derechos del administrado (expropiado) a reclamarle a la Administración derivados de la expropiación, no siendo aplicable al caso concreto por estar en otro supuesto jurídico.
Indicado lo anterior y conforme quedó sentado líneas atrás en el presente proceso nos encontramos frente a bienes demaniales que, se reitera, fueron afectados por voluntad expresa de la Administración al momento de la expropiación cuya utilidad pública es de servir de zona de amortiguamiento para el embalse Arenal; ello hace que la discusión sobre si existe prescripción o no del derecho que tiene el ICE sobre la titularidad de los bienes sea inocua, por cuanto una de las características esenciales de los bienes dominicales (como se indicó líneas atrás) es su imprescriptibilidad por estar fuera del comercio de los hombres, en consecuencia, se rechaza las excepciones de prescripción y caducidad interpuesta por los demandados. Dejado por sentado que en el sub examine estamos en presencia de bienes dominicales los cuales se torna innecesaria la discusión sobre su titularidad o posesión este Tribunal no puede dejar de pronunciarse sobre la situación jurídica de los terceros adquirentes que en algunos casos tienen más de dos décadas de estar en dichos terrenos, utilizándolos como aparentes propietarios y que fueron adquiridos a la luz de la publicidad registral, que el mismo ente actor ocasionó por su negligencia absoluta. En razón de ello se entra a su análisis para determinar lo que en derecho corresponda.
Dentro de la demanda la representación de la empresa demandada INNOTEC TRADING CR SRL, al momento de apersonarse al proceso se opuso a las pretensiones del ICE y concomitantemente interpuso reconvención contra dicho ente. Indicó que su representada no tiene intención de apropiarse la finca que en su oportunidad adquirió del señor [Nombre 010], pues su compra fue de buena fe ya que en ese momento la información registral no indicaba ninguna limitación, y mucho menos conocía los hechos en los que se basa el ICE para sus pretensiones. Que ha sido la negligencia de dicho Instituto lo que ha causado la ilegalidad de lo que se discute en este proceso, por lo que el reconvenido debe responder por los daños causados a su representada. Criterio del Tribunal. Para resolver este punto y por la singularidad del proceso en que nos encontramos se hace necesario de previo, realizar algunas precisiones sobre el concepto de "Terceros Adquirentes de buena fe" para poder contrastarlo con la institución jurídica de la demanialidad.
En el presente caso tenemos dos de estos tipos de negocios bilaterales como los contratos de compraventa que se suscitaron y los unilaterales como el de la donación. Ambos tienen como elemento esencial la voluntad hacia lo interno y la expresión o manifestación de esta voluntad hacia lo externo. En palabras del doctrinario nacional Víctor Pérez se denomina voluntad como: “aquella facultad que nos determina a actuar con conocimiento del fin y de los motivos de la acción”; así el inciso primero del artículo 627 en relación con el 1008 ambos del Código Civil disponen: “ARTÍCULO 627.- Para la validez de la obligación es esencialmente indispensable: 1º.- Capacidad de parte de quien se obliga (…) ARTÍCULO 1008.- El consentimiento de las partes debe ser libre y claramente manifestado. La manifestación puede ser hecha de palabra, por escrito o por hechos de que necesariamente se deduzca”. Aunado a lo dicho, debe tenerse en cuenta el Principio de buena fe, y en el caso particular los Principios de Inmatriculación y Publicidad Registral que a continuación de forma general se resaltan.
Sobre el principio de buena fe se ha de indicar que irradia a todo el ordenamiento jurídico e impone una serie de comportamientos a las personas públicas y privadas, tanto en los ámbitos procedimental (procedimientos administrativos llevados a cabo en el seno de la Administración pública), procesal (en los distintos procesos jurisdiccionales) y contractual (en lo que se refiere a la formación, ejecución y extinción de los contratos); inclusive, en el ejercicio del derecho a la autonomía de la voluntad. Precisamente, la principal característica del principio de buena fe, es el dar cobertura a la exigencia de una serie de comportamientos, que resultan aplicables a todas las ramas del ordenamiento jurídico y que, al propio tiempo, le son exigibles a cualquier persona, sea e´sta de derecho público o privado. En ese sentido, el autor Pérez González ha puesto de manifiesto que: “El principio general de la buena fe, que juega, como se ha sen alado, no solo en el ámbito del ejercicio de derechos y potestades, sino en el de la constitución de las relaciones y en el cumplimiento de los deberes, conlleva la necesidad de una conducta leal, honesta, aquella conducta que, según la estimación de la gente, puede esperarse de una persona, protege la confianza que fundadamente se puede haber depositado en el comportamiento ajeno e impone el deber de coherencia en el comportamiento” (González Pérez, Jesús.
El Principio General de la Buena Fe en el Derecho Administrativo. Editorial Civitas, España). En cuanto al Principio relacionado con materia registral, postula que un bien de dominio público por su naturaleza y al presumirse la titularidad estatal no necesita la inscripción registral, ello deriva en virtud de que el régimen demanial es per se, su existencia y publicidad se da con autonomía del Registro, sin que sea dable al titular registral alegar desconocimiento como medio de desvirtuarlo y contrarrestar la afectación. Sobre este principio la Sala Primera de la Corte Suprema de Justicia en la resolución número 00896-2015 de las 09:30 hrs. del 4 de agosto de 2015 indicó: “Segundo, el traspaso formal no es indispensable según el principio de inmatriculación. Ha dicho esta Sala sobre el particular: “De conformidad con el principio de inmatriculación o innecesaria inscripción del dominio público, su existencia y publicidad se da con independencia de su registro, porque se presume su titularidad por parte del Estado.
De que manera que, el régimen demanial es per se. La publicidad en este tipo de bienes es material, no necesariamente formal o registral. El bien de dominio público, por su naturaleza, no necesita de la inscripción registral….” (sentencia no. 001259-F-S1-2009 de las 10 horas 50 minutos del 10 de diciembre de 2009). En cuanto el Principio de Publicidad Registral postula la presunción de que toda persona conoce el contenido de lo inscrito en un Registro Público, lo cual se encuentra a cargo del Estado al respecto la Sala Constitucional en la resolución número 3441-2003 del 30 de abril de 2003 indicó: “Es función del Estado propiciar, mantener, suministrar seguridad a su población. Una de las manifestaciones de esta seguridad es la que brinda un sistema registral. Efectivamente, el establecimiento de un sistema registral en determinado ámbito de la vida social tiene como objeto proporcionar seguridad jurídica.
La seguridad registral es el pilar fundamental de nuestro sistema registral”. De la anterior cita se extrae que la seguridad jurídica patrimonial es una actividad que el ordenamiento confía al Poder Ejecutivo a través del Registro Nacional y sus órganos. En ese sentido, la Ley de Creación del Registro Nacional lo crea como un órgano del Ministerio de Justicia. Dicho fin se logra dando notoriedad, publicidad a determinados hechos o negocios, controlando su legalidad. Seguridad registral que garantiza el tráfico jurídico patrimonial y transparencia en el mercado. Es el sistema registral el que garantiza la propiedad en sus diversas manifestaciones, favoreciendo su tráfico jurídico. Al legitimar y proteger los derechos del titular registral y dar certeza a los terceros adquirientes, se favorece la negociación patrimonial. Tal resguardo se logra por medio del Registro Público, así dispuesto por el artículo 1 de la Ley Número 3883 del 30 de mayo de 1967, (Ley de Inscripción de Documentos en el Registro Nacional) que en lo relacionado reza: “El propósito del Registro Nacional es garantizar la seguridad de los bienes o derechos inscritos con respecto a terceros.
Lo anterior se logrará mediante la publicidad de estos bienes o derechos. En lo referente al trámite de documentos, su objetivo es inscribirlos”. En resumen el Registro Nacional tiene como objeto garantizar el principio de seguridad registral a través de los diferentes registros que internamente existen, siendo entonces que la seguridad jurídica implica publicidad la cual se obtiene por medio de la inscripción de los documentos que allí se presentan. Resaltado lo anterior como se indicó se entra al análisis de la situación jurídica de los terceros adquirentes aquí demandados ya que dentro de su discurso de apertura y conclusiones peticionaron se les indemnizaran.
Del anterior cuadro fáctico como puede desprenderse estamos ante el típico tercero de buena fe, protegido y regulado en la ley. Conforme a lo desarrollado ut supra, considera esta Cámara que la Administración siempre actuará sometida al ordenamiento jurídico (doctrina del artículo 11 de la Constitución Política y 11 de la LGAP) lo que como ya ha quedado plasmado no sucedió por las reiteradas conductas omisivas a través de décadas que en este momento afectan a terceros de buena, y siendo que se debe integrar normas del derecho público su interpretación y aplicación se debe hacer garantizando el equilibrio entre la eficiencia de la Administración y la dignidad, libertad y derechos fundamentales del administrado. Así, a criterio de este órgano colegiado en el sub examine como ya se indicó, es el mismo ICE quien ha provocado con su negligencia que los inmuebles fueran traspasados a terceros, (adquirentes que como ya quedó resuelto fueron de buena fe) y que por ser bienes dominicales deben de ser restituidos, pero con dicha restitución debe haber un derecho a indemnización.
En ese sentido es claro que en este caso no se puede hablar de una expropiación pero sí del pago de daños y perjuicios, que conforme al artículo 190 de LGAP la Administración debe pagar por su actuar negligente reconociendo en ese sentido una situación jurídica tutelable. Estima este Tribunal por las razones ya indicadas que efectivamente lleva razón la representación de la empresa demandada y reconventora en su reclamo, pues como ya ha quedado sentado y el mismo ICE no pudo desvirtuar, que por su propia negligencia y su mal funcionamiento, es que no se inscribió en el momento procesal oportuno la finca a su nombre, y cuando posteriormente lo intentó, tampoco lo concretó, derivando todo ello en la situación que aquí se dilucida. No cabe duda alguna que, se reitera, que es el mismo ICE el que se puso en esta situación, provocando daños y perjuicios al adquirente de buena fe, los cuales deben de ser resarcidos.
En este orden de ideas, la misma parte reconventora manifiesta que no es su interés dejarse la propiedad, ni oponerse en ese tanto a que el ICE haga valer sus derechos por culpa de él mismo, pero es precisamente por esa negligencia que debe ser condenado a pagarle los daños y perjuicios los cuales valora prudencialmente en veinte millones de colones, los cuales los se dividen si estimar cada uno de ellos, en económico, moral, psicológico y patrimonial. Reclamo que entra a conocer y analizar su procedencia o no este Tribunal en la forma en que fue planteado por la representación legal de la empresa reconventora.
b.1. Del Daño Económico. La parte indica que se debe condenar al ICE por los daños y perjuicios causados con su actuar, referidos al daño patrimonial. Entiende esta Cámara, y así lo resuelve, que se hace referencia a la suma de dinero invertida en dicha propiedad para su adquisición más sus mejoras. La pretensión debe ser otorgada por las siguientes consideraciones. Conforme a lo indicado líneas atrás sobre los terceros de buena fe, se tiene por acreditado que la empresa reconventora adquiere la propiedad para el año 2015 producto de segregaciones de lotes que en su momento el anterior adquirente de buena fe, el señor [Nombre 010], por medio de un remate en 1994, pone a la venta. Dicha inversión inicial producto de la adquisición de la compra del lote propiedad registral de la empresa reconventora,inscrita al folio real mecanizado número 122229, con un área de 9414, 39 m2 , plano catastrado número G-386792-1997, y que de acuerdo con el peritaje judicial que consta en autos se encuentra dentro del área reclamada por el ICE (imagenes 1510-1514), y que ahora es desposeída, origina el daño patrimonial reclamado, y que en razón de las posible mejoras que se la ha hecho al bien inmueble como son la casa de habitación y otros, constituyen el perjuicio aducido.
Reclamo que queda acreditada la existencia de dichas mejoras con el peritaje que consta en autos del cual se desprende que actualmente existe una casa de habitación, pero que del mismo no se logra desprender (no fue objeto de la pericia) el valor de dichas mejoras, por lo que, se reitera, no existe duda alguna que la reconventora sufriría un daño en su patrimonio con la desposesión de dicho bien, el cual debe de ser resarcido. En razón de lo indicado anteriormente, y por las consideraciones de hecho y derecho realizadas ut supra, el ICE se encuentra en la obligación de resarcir el daño económico causado a la empresa Innotec Trading CR SRL. Ahora bien, dicho daño debe ser otorgado en abstracto de conformidad con el ordinal 122.m.ii del CPCA, que dispone: "m) Condenar al pago de los daños y perjuicios, en los siguientes términos: (...) ii) Pronunciamiento en abstracto, cuando conste su existencia, pero no su cuantía"; debiendo ser en ejecución de sentencia donde sea fijado, tomando como parámetros el valor en que fue adquirido el lote, su uso del que fue objeto mienstras estuvo en el dominio de la reconventora, la inversión y mejoras que está realizó al bien inmueble (construcciones) y el valor real de mercado actual.
b.2. Daño Moral y Psicológico. Reclama el asesor legal de la empresa el daño moral y psicológico de su representada, pero sin indicar a qué tipo de daño se refiere, si se trata del subjetivo u objetivo, por lo que entiende este Tribunal hace referencia al subjetivo al referirse psicológico, y así se resuelve. Como bien lo ha señalado la Sala Primera de Justicia, debe recordarse la distinción que existe entre el daño moral subjetivo y objetivo. Sobre este tema ha apuntado ese Tribunal que: “El daño moral (llamado en doctrina también incorporal, extra patrimonial, de afección, etc.) se verifica cuando se lesiona la esfera de interés extra patrimonial del individuo, empero como su vulneración puede generar consecuencias patrimoniales, cabe distinguir entre daño moral subjetivo "puro", o de afección, y daño moral objetivo u "objetivado". El daño moral subjetivo se produce cuando se ha lesionado un derecho extra patrimonial, sin repercutir en el patrimonio, suponiendo normalmente una perturbación injusta de las condiciones anímicas del individuo (disgusto, desánimo, desesperación, pérdida de satisfacción de vivir, etc., vg. el agravio contra el honor, la dignidad, la intimidad, el llamado daño a la vida en relación, aflicción por la muerte de un familiar o ser querido, etc.).
El daño moral objetivo lesiona un derecho extra patrimonial con repercusión en el patrimonio, es decir, genera consecuencias económicamente valuables (vg. el caso del profesional que por el hecho atribuido pierde su clientela en todo o en parte). Esta distinción sirve para deslindar el daño sufrido por el individuo en su consideración social (buen nombre, honor, honestidad, etc.) del padecido en el campo individual (aflicción por la muerte de un pariente), así uno refiere a la parte social y el otro a la afectiva del patrimonio. Esta distinción nació, originalmente, para determinar el ámbito del daño moral resarcible, pues en un principio la doctrina se mostró reacia a resarcir el daño moral puro, por su difícil cuantificación. Para la indemnización debe distinguirse entre los distintos tipos de daño moral. En el caso del objetivo, se debe hacer la demostración correspondiente como acontece con el daño patrimonial; pero en el supuesto del daño moral subjetivo al no poder estructurarse y demostrarse su cuantía de modo preciso, su fijación queda al prudente arbitrio del juez, teniendo en consideración las circunstancias del caso, los principios generales del derecho y la equidad, no constituyendo la falta de prueba acerca de la magnitud del daño óbice para fijar su importe”.
(Sentencia número 112-F-92 de las catorce horas quince minutos del quince de julio de mil novecientos noventa y dos). Con lo anterior estima este Órgano Colegiado que tal pretensión debe ser denegada por dos razones fundamentales, primero, quien reclama es una sociedad de responsabilidad limitada (persona jurídica), y de una lectura del escrito de reconvención se extrae, que al momento de ser reclamado no fue delimitado como un daño al socio, sino directamente a la empresa propietaria del bien inmueble, lo cual conforme a la jurisprudencia nacional debe ser tratado dentro de lo que se conoce en doctrina como daño moral objetivado, pero se reitera, no fue planteado y reclamado en esa forma, sino de los alegatos de la parte reclamante, entiende esta Cámara, y así lo resuelve, se infiere al daño moral subjetivo sufrido por el representante legal, lo cual, no es procedente, se reitera, por la forma en que es peticionado; segundo, aun y cuando este Tribunal estimara que dicho daño fuera procedente, la parte reclamante, incumple el presupuesto básico del reclamo de todo daño moral subjetivo, como lo es la carga de la prueba mínima, ya que ni tan siquiera hizo esfuerzo alguno para acreditar la existencia de tal manifestación del daño moral reclamado, sino que se limitó únicamente a su invocación y la fijación prudencial del mismo indicando nada más que "se condene al demandado al grave daño moral y psicológico sufrido por su representada", pero, se reitera, sin indicar de forma clara y diáfana, cuál es el nexo de causalidad, entre el daño reclamado y la conducta impugnada, limitándose a indicar que proviene de la negligencia del ICE, y todo ello, sin prueba alguna; no siendo posible para este Tribunal en esa medida, determinar su nexo causal. Por consiguiente dicha petitoria debe ser denegada.
En cuanto a las excepciones de prescripción y caducidad interpuesta por los codemandados, siendo que en este caso se ha determinado que estamos frente a bienes demaniales los cuales son imprescriptibles, dichas defensas deben de ser rechazadas. En relación con la excepción de falta de derecho interpuesta por el Estado y el Banco Nacional de Costa Rica por las razones indicadas ut supra debe ser acogida en consecuencia se impone declarar sin lugar en todos sus extremos en el proceso. En relación con las excepciones de falta de derecho interpuesta por los hermanos ([Nombre 009], [Nombre 008], [Nombre 002]) y Sucesión ([Nombre 003]) se rechaza la defensa declarando parcialmente con lugar la demanda. En relación con los codemandados; [Nombre 010], Lualhe de Tilarán S.A. Importacones Murisol S.A. [Nombre 024], [Nombre 016], Murarti S.A. se acoge parcialmente la excepción de falta de derecho, declarando parcialmente con lugar la demanda. Al momento de interponer la demanda la representación del ICE estiló las siguientes pretensiones las cuales fueron fijadas en la audiencia preliminar y se entra a su pronunciamiento de cada una de ellas en forma individual:
a. Pretensiones de la Demanda.
b. Pretensiones de la Reconvención. Al apersonarse al proceso y contestar negativamente las pretensiones del ICE, la representación legal de la empresa Innotec Trading CR SRL, reconvino al ICE, estilando las siguientes pretensiones:
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo, con las excepciones contenidas en los incisos a) y b) del mismo artículo. Por la multiplicidad de partes que existen en el proceso y la forma en que se resolvió el proceso la condena en costas debe de hacerse diferenciada. Con respecto a los hermanos ([Nombre 008], [Nombre 009], [Nombre 002]) y Sucesorio ([Nombre 003]) al resultar perdidosos en este proceso tanto en la demanda como en la reconvención se condena al pago de las costas personales y procesales a favor el ICE de ambos procesos. En relación con los codemandados Innotec Trading CR SRL., [Nombre 010], Lualhe de Tilarán S.A. Importaciones Murisol S.A. [Nombre 015], [Nombre 016], Murarti S.A. al haberse determinado que son terceros de buena fe a criterio de este Tribunal existieron suficientes motivos para litigar por lo que se les exoneran del pago de costas debiendo correr cada parte con las propias.
Con respecto al Estado, Banco Nacional de Costa Rica y Junta Administradora del Registro Nacional al haberse declarado sin lugar la demanda se exonera de las costas y se condena al ICE al pago de ambas costas. Con respecto a la reconvención se condena a los reconvención al existir un vencimiento recíproco de conformidad con el artículo 73.2.3 del Código Procesal Civil no existe condena en costas sino que cada parte debe correr con sus propios gastos.
POR TANTO
Se rechaza la excepción de prescripción y caducidad planteada por los demandados. Se acoge la excepción de falta de derecho interpuesta por los codemandados Junta Administrativa del Registro Nacional, Banco Nacional de Costar Rica y el Estado. En consecuencia, del acogimiento de la falta de derecho se declara sin lugar la demanda interpuesta por el ICE contra el Estado, Banco Nacional de Costa Rica y la Junta Administrativa del Registro Nacional y se condena al Instituto Costarricense de Electricidad al pago de ambas costas. Se acoge parcialmente la excepción de falta de derecho interpuesta por los señores [Nombre 002], [Nombre 009], [Nombre 008] todos ([Nombre 002], [Nombre 008], [Nombre 009]), Sucesorio [Nombre 003], [Nombre 010], Lualhe de Tilarán S.A. Importacones Murisol S.A. [Nombre 015], [Nombre 016], Murarti S.A. t Innotec Trading CR SRL en consecuencia, se declara parcialmente con lugar la demanda interpuesta por el Instituto Costarricense de Electricidad, entendiéndose por denegado en lo no expresamente concedido.
En relación a la reconvención se acoge la excepción de falta de derecho interpuesta por el Instituto Costarricense de Electricidad en consecuencia se rechaza la reconvención interpuesta por los señores [Nombre 002], [Nombre 009], [Nombre 008] todos ([Nombre 009], [Nombre 008], [Nombre 002]), Sucesorio [Nombre 003] contra el Instituto Costarricense de Electricidad, en consecuencia se condenan a los reconventores al pago de las costas de dicha acción. En cuanto a la reconvención interpuesta por Inotec Trading Costa Rica SRL, se acoge parcialmente la excepción de derecho interpuesta por el ICE.
Dentro del proceso principal presentado por el Instituto Costarricense de Electricidad se declara:
