A., legal entity identification number 3-101-16978, currently represented in these proceedings by Mr. Aldo Milano Sánchez, of legal age, married, attorney, resident of San Rafael de Montes de Oca, identity card number 1-0788-989, acting as special judicial attorney-in-fact, as shown in images 531 and 532 of the virtual court file; Judge Solano Solano drafts the judgment; and PROCEDURAL CONSIDERATIONS The plaintiffs filed a formal complaint seeking annulment of: “1°. - The resolution adopted under Article V of ordinary session CTNBio N° SO-02-2016 of 14 de diciembre de 2016, constituting the favorable opinion of the Comisión Técnica nacional de Bioseguridad regarding the application by Bayer, S. A. for a certificate of release into the environment (certificado de liberación al ambiente), the rights to which have now been assigned to BASF de Costa Rica, S. A. (complaint and relief sought, as amended at the preliminary hearing of 12 de octubre de 2021); 2°. - The resolutions adopted under Article V of ordinary session N° SO-02-2017 OF CTNBio, which commence the review stage and reject the challenge and the supplement thereto, thereby exhausting the administrative remedies (vía recursiva); 3°. - The Certificate of Release into the Environment granted to Bayer S. A. for the importation, movement and/or release of the COT102 (SYN-IR102-Y) cotton plant line, published in La Gaceta 98 of 25 de mayo de 2017 and assigned to BASF de Costa Rica, S. A.”; 4.- That the Servicio Fitosanitario del Estado refrain from authorizing the release into the environment of stacked events (apilamientos de eventos) that have not been approved by CTNBio, in accordance with the principles of environmental protection and biosafety, rather than the interests of applicants seeking permits for the release of transgenic organisms into the environment (hearing of 12 de octubre 2021, recording at 03:04 hours); 5.- That the Servicio Fitosanitario del Estado and CTNBio comply with the applicable procedures and legislation, in accordance with scientific and technical principles, giving priority to environmental protection and biosafety rather than the interests of applicants seeking permits for the release of transgenic organisms (genetically modified organisms) into the environment.” (see images 159 and 160 of the virtual court file and the terms amending the relief sought at the Preliminary Hearing).
In response to the notice served, the State opposed the complaint, raised the defenses (excepciones) of lack of a current legal interest and failure to state a legal right, and requested “that the complaint be dismissed in its entirety and that the plaintiffs be ordered to pay all costs of the proceeding and the corresponding interest” (see images 355 to 373 of the virtual court file).
In response to the notice served, the Servicio Fitosanitario del Estado denied the allegations of the complaint, raised the defense of failure to state a legal right, and requested: “That this complaint BE DISMISSED (…) That the PLAINTIFFS BE ORDERED TO PAY THE COSTS thereof, AS WELL AS INTEREST thereon from the date the judgment becomes final until actual payment” (see images 229 to 250 of the virtual court file).
In response to the notice served, BASF (Costa Rica) S. A. denied the allegations of the complaint, raised the defense of failure to state a legal right, and requested: “(…) dismissal of the complaint in its entirety due to failure to state a legal right, together with an order requiring the plaintiffs to pay all costs” (see images 494 to 528 of the virtual court file).
The preliminary hearing (audiencia preliminar) was held on several dates, namely: 02 de marzo de 2021, 12 de octubre de 2021, 09 de agosto de 2022 and 14 de agosto de 2024. During those hearings, the relief sought was established, the complaint against Bayer, S. A. was voluntarily dismissed, and the relief sought was amended to clarify that the certificate of release into the environment had been assigned to BASF (Costa Rica) S. A. A request designated 3BIS that had been submitted at the Preliminary Hearing was declared inadmissible; the disputed facts were defined; and the documentary evidence was admitted, as was the testimonial expert evidence (prueba testimonial-pericial) offered by the plaintiffs, namely: Mr. Jaime Enrique García González, identity card number 1-0533-0503, and Fabián de Jesús Pacheco Rodríguez, identity card number 1-1017-0021; two of the three witnesses offered by the Servicio Fitosanitario del Estado, to be selected from among Alex May Montero, identity card number 1-0522-0995, Luis Alonso Chacón Araya, identity card number 1-0514-0063, and Alejandra Chaverri Esquivel, identity card number 1-0862-0654; and the testimonial evidence offered by BASF (Costa Rica) S. A., namely Nelly Mora Molina, as well as the expert witnesses (testigos-peritos), Engineer Lizzy María Retana Villalobos, identity card number 1-1163-0369, and Marta Fermina Valdéz Melara, identity card number 8-0159-0349 (see images 671 to 676, 738 to 743, 803 to 813 and 856 to 858 of the virtual court file, as well as the audio recordings of the preliminary hearings contained in the virtual desktop).
The public oral trial hearing was held over two days, 05 de junio and 06 de junio de 2025, beginning on 05 de junio in Courtroom 03 and continuing on 06 de junio in Courtroom 02, both located in Annex Building A of the Second Judicial Circuit of San José, with the undersigned judges present. The parties entered their appearances, and an intervenor in support of the plaintiff associations appeared and was permitted to participate. The Court also ruled on the State’s allegation that the term of the board of directors of Asociación Comunidades Ecologistas La Ceiba Amigos de la Tierra Costa Rica had expired. In response, the interested parties reported that renewal of the new board of directors was underway, following legalization of the association’s books. The Court determined that, for purposes of this proceeding, the special judicial power of attorney had been duly granted by the legal entity and that its representation in the judicial proceeding was valid and current; the proceedings therefore continued.
The public oral trial stage was formally opened, the parties delivered their opening statements, and the testimonial evidence was taken, with the clarification that the Servicio Fitosanitario del Estado had withdrawn all testimonial evidence it had offered and that BASF (Costa Rica), S. A. had withdrawn the testimony of Ms. Nelly Mora Molina. Consequently, testimony was received from the expert witnesses offered by the plaintiffs, namely Fabián de Jesús Pacheco Rodríguez, identity card number 1-1017-0021, and Jaime Enrique García González, identity card number 1-0533-0503, as well as from the expert witnesses offered by the defendant company, namely Marta Fermina Valdés Melara, identity card number 8-0159-0349, and Lizzy María Retana Villalobos, identity card number 1-1163-0369. Subsequently, at the parties’ request, they were granted until 11 de junio de 2025 to submit their closing arguments in writing.
Pursuant to the authority conferred by Article 111 of the Código Procesal Contencioso Administrativo, the Court deemed the matter highly complex and, consequently, the judgment will be issued within fifteen business days beginning on the business day following the expiration of the deadline for submitting closing arguments. The parties’ methods of notification were verified, and the public oral trial hearing was concluded (listen to the trial hearing, which was video-recorded and incorporated into the virtual court file).
No flaws or defects capable of causing the parties a denial of due process or nullity are observed and, following deliberation, this judgment is issued unanimously within the statutory period; and SUBSTANTIVE CONSIDERATIONS
Of relevance to the resolution of this matter, the following facts have been established:
A., the technical analysis reports concerning the original appeal (recurso) and its expansion are included, in which additional explanations are provided and a ruling on other matters is declined because they fall outside the jurisdiction of the Commission and instead fall within that of the Servicio Fitosanitario del Estado, while other objections are rejected because they pertain to the implementation stage of the environmental release (liberación al ambiente) and not to the decision-making stage for authorization of the environmental release certificate (certificado de liberación al ambiente) (see images 333 to 379 and 381 to 384 of Volume III of the administrative record);
Of relevance to the resolution of this matter, the following facts could not be deemed proven: 1) That the Comisión Técnica Nacional de Bioseguridad had issued a favorable opinion on the certificate for release into the environment (certificado de emisión al ambiente) concerning the COT-102 application submitted by Bayer, S. A. without the required quorum, or that it had stated that information necessary to decide whether to issue such an opinion was missing; 2) That Bayer’s application involved “molecular stacking” (apilado molecular) requiring the Servicio Fitosanitario del Estado, under conventionally accepted scientific criteria, to handle it differently from the manner in which it handled the COT102 application.
a. Claimant: On 10 de agosto de 2015, Bayer S. A. filed an application for the environmental release (liberación al ambiente) of COT102 (SYN-IR102-7) cotton plants, for importation as a stack with the GlyTol and TwinkLink events, and, for those purposes, on 28 de agosto they published a public notice (edicto) that failed to comply with the regulatory requirement under the Regulations to the Plant Health Law (Reglamento a la Ley Fitosanitaria), number 26921-MAG, to provide “an accessible description of the process to be carried out and its possible impacts,” thereby violating the principles of public disclosure and transparency at the commencement of that proceeding; and on 06 de octubre de 2015, the President of CTNBio forwarded to the Commission the application for an Environmental Release Certificate (Certificado de Liberación al ambiente, CLA) for review and issuance of the corresponding opinion (dictamen).
Mr. Jaime García González, as a member of CTNBio, requested information missing from BIO-02 and additional information, and also requested that a visit to the farm be conducted. Likewise, Mr. Fabián Pacheco Rodríguez, a member of the Commission, also requested information missing from BIO-02 and additional information; although that information was requested on 23 de noviembre de 2015, a response was provided belatedly on 21 de enero de 2016, rather than within the three days established by Article 9.12 of instruction DB-OGM-PO-06. From that point onward, Mr. Jaime García insisted that he had not been provided with complete information, and at session number SE-001-2016 dated 28 de noviembre de 2016, CTNBio approved Mr. García’s aforementioned request and postponed the vote on the environmental-release application until the requested information was provided to him. Similarly, Mr. Fabián Pacheco informed the President of the Commission that, in view of the incomplete response to the request for information submitted on 28 de noviembre de 2016, he was unable to cast a reasoned vote and requested that “the environmental release of that event not be authorized.” Subsequently, Mr.
García continued to request information that he believed had not been provided or was incomplete, and the President of the Commission sent him information that he considered incomplete and in need of clarification and supplementation. He alleges that on the very day of session number SO-02-2016 of 14 de diciembre de 2016, when the vote was held, they were provided with the 56-page document titled “TECHNICAL-SCIENTIFIC REPORT ON THE ENVIRONMENTAL RISK ASSESSMENT AND MANAGEMENT OF THE APPLICATION FOR AN ENVIRONMENTAL RELEASE CERTIFICATE FOR THE G.M. COTTON CROP, GENETICALLY MODIFIED GOSSYPIUM HIRSUTUM, trade name COT102, unique identifier (SYN-IR102-7) (…) The foregoing means that one of the members of CTNBio had the opportunity to read and analyze that important report” (see image 120 of the virtual court file). Consequently, they consider that the Commission made a decision without possessing all the information necessary to issue an opinion that is not merely a formality for compliance with documentary requirements, but rather a binding opinion (dictamen vinculante) that should take into account the establishment, in a “genuine, efficient, and logical manner, of plant-health controls over the domestic and international exchange of plants, biological-control agents, and other types of organisms used in agriculture, packaging and conditioning materials, and means of transportation capable of introducing pests that threaten food security and the economic activity on which agricultural production is based; in other words, it is NOT limited solely to the seed or product, but encompasses its transportation, warehousing controls, and relationship with other products or places that may be affected (…) and for that reason the law refers to issuing plant-health certificates in accordance with the international treaties in force on the matter, which concern not merely legal formalities or formal certificates, but complex technical provisions” (images 150 and 151 of the virtual court file).
Thus, the information missing when the favorable binding opinion was issued was technical in nature; the requirement to publish the public notice containing a description of the process to be carried out and its potential impacts was not met; and the State had an obligation to prevent risks threatening the continued existence of ecosystems (Article 45 of the Ley de Biodiversidad). Accordingly, the favorable binding opinion issued should be declared null and void because it was adopted despite missing information and without a technical-scientific analysis, which means that the opinion does not conform to the truth of the facts and violates Article 133 of the Ley General de la Administración Pública “because its content is not proportionate to the legal purpose, nor is it based on all the issues of fact and law that should have arisen from its grounds, pursuant to Articles 131 and 132 ibid.; consequently, it is affected by defects consisting of the omission of essential elements of the act and, in accordance with Articles 164 and 166 ibid., is absolutely null and void” (see image 156 of the virtual court file).
They also state that resolution 001-2017 UOGM, which approved the environmental release of COT102 requested by Bayer, S. A., is null and void because “Had the opinion been issued in accordance with law—that is, with all the required information—the outcome might have been negative and, consequently, the CLA application could and should have been denied” (see images 157 and 158 of the virtual court file). They further allege that the opinion is null and void because of a defect in the voting process, since “Two members stated their positions and left the session BEFORE THE VOTE; NEVERTHELESS, their votes were counted to form a majority in their absence in order to approve the CLA at issue and declare the decision final” (see image 1062 of the virtual court file). b. Servicio Fitosanitario del Estado: The purpose of the environmental-release application was clear in the public notice of 28 de agosto de 2015, as well as in that of 25 de mayo de 2017: planting for propagation and subsequent export.
Although it is true that, in vote number 2018004117, the Sala Constitucional de la Corte Suprema de Justicia found that the procedures for access to information needed improvement, it did so without retroactive effect; therefore, that ruling does not affect the public notice published in this case, and there was another opportunity for public comment through the notice published on 25 de mayo de 2017. The representatives of FECON and Red de Coordinación en Biodiversidad requested documents printed on paper, even though the system through which these matters are processed is digital. The application information was always available online to Mr. Jaime García, and his requests for information are merely subjective assessments. Mr. Pacheco Rodríguez’s position on the Commission lacks technical or scientific support, and the information required by the Administration was always complete; Mr.
García González did not access it through official channels, and Mr. García did not provide the technical assessment requested of him. The report concerning the “María Teresa” farm does not correspond to any requirement established for the evaluation of the Environmental Release Certificate, but rather constituted information for Servicio Fitosanitario del Estado. The institutions issue a written risk-analysis opinion on which they cast favorable votes. The favorable opinion on the application for the Environmental Release Certificate was based on scientific criteria from the entities comprising the Commission, and Mr. Fabián Pacheco and Mr. Jaime García did not support their disagreement with technical and scientific criteria, but merely presented a series of assumptions without an analytical methodology. The remaining members of the Commission were satisfied with all the information. Consequently, they contend that the complaint is entirely without merit (see images 229 to 248 of the virtual court file). c. The State: It begins by asserting that the complaint is inadmissible because it challenges a preparatory act (acto preparatorio), namely the opinion issued by CTNBio at session SO-02-2016 of 14 de diciembre de 2016, which has no independent legal effect, as is also true of the decision confirming the former upon resolving the challenge to the favorable-opinion decision, which was heard at session number SO-02-2017 dated 08 de febrero de 2017; and claims against preparatory acts cannot possibly be granted by the Court.
Similarly, the claim seeking nullification of the Environmental Release Certificate granted to Bayer, S. A. for the release of COT102 (SYN-IR102-7) cotton plants cannot be brought because it is merely a document and not the final administrative act (acto administrativo final). The environmental release took place in noviembre de 2017 and, therefore, there is no current legal interest in nullifying that release certificate. It must be borne in mind that the final administrative act in this proceeding is administrative resolution 001-2017 UOGM of 14:05 hours on 10 de mayo de 2017, issued by Unidad de Organismos Genéticamente Modificados, and that the relief sought cannot be expanded at the preliminary hearing (vote number 900-F-S1-2011 of 09:15 hours on 11 de agosto de 2011 of Sala Primera de la Corte Suprema de Justicia). Claims 4 and 5 are absurd because they merely request compliance with what the law establishes as the purpose of the actions of CTNBio and Servicio Fitosanitario del Estado: that they act in accordance with law.
It further states that the assertion that not all members of the Commission had sufficient information to vote is a subjective assessment by members García González and Pacheco Rodríguez. The members who believed that they needed more information requested it. Mr. García González’s repeated requests for information neither explained nor justified the need for that information; for example, he requested information from the résumé of Bayer, S. A.’s technical representative or clarification as to whether the parcel on which the release was to occur was owned or leased, which was neither pertinent nor useful information for assessing the risk posed by the event. Nevertheless, when the motion for reconsideration (recurso de revocatoria) was decided, each and every issue raised in that motion was addressed in a reasoned, detailed, and comprehensive manner. All requests for information were indeed answered.
The fact that Dr. García González considered the information incomplete or unclear was a subjective and highly personal assessment and does not mean that, objectively, the other CTNBio members lacked the elements necessary to issue the favorable opinion. The opinion was approved by a favorable vote with the quorum and requirements prescribed by law, as established in Articles 112 and 115 of Decree number 26921-MAG. The public notice was published adequately, and any person could appear before Servicio Fitosanitario del Estado to submit observations or request information of public interest (vote number 2017-0001110 of 09:05 hours on 25 de enero de 2017 of Sala Constitucional de la Corte Suprema de Justicia). Furthermore, after the Environmental Release Certificate was issued, another public notice was published so that interested persons could appear and file any motions for reconsideration or appeals they deemed appropriate.
Upon review of the administrative record, it can be determined that the Environmental Release Certificate (Certificado de Liberación al Ambiente) was issued within the national and international legal framework, without disregarding the precautionary principle (principio precautorio) (ruling number 2006-17747 issued at 14:37 hours on 11 de diciembre de 2006 by the Constitutional Chamber of the Supreme Court of Justice (Sala Constitucional de la Corte Suprema de Justicia)); d. BASF de Costa Rica, S. A.: That all the information necessary for the application for an Environmental Release Certificate was available in the digital system as of 10 de agosto de 2015, and that the type and quantity of additional information requested by Pacheco are excessive, disproportionate, and unnecessary, and are inconsistent with national and international regulations. That no information was missing from case file BIO-02-2015-150, contrary to Mr.
García’s contention, as corroborated by the unnumbered document dated 31 de agosto de 2015, digitally signed by Nelly Mora Molina, an official of the Servicio Fitosanitario del Estado. That, from a legal standpoint, it is improper to consider the same substantive and formal requirements applicable to declaratory administrative acts (actos administrativos declarativos) having independent legal effect to be equally applicable to mere preparatory acts (actos preparatorios), such that attempting to compare the content of those preparatory acts with decision-making acts (actos de decisión) is a “pointless and unproductive exercise.” That, as determined in the expert opinion commissioned by Ms. Marta Fermina Valdés, Mr. García’s requests for information are not related to estimates of risk levels, which can readily be estimated using the information submitted by the company to the CTNB (see image 561 of the virtual court record).
Finally, it states that resolution number 001-2017 UOGM, which granted the release into the environment of COT102 cotton, is not null and void; that the opinion was favorable by an overwhelming majority; and that “Only two of the members, given their manifest ideological opposition to GMOs (OVMs), recommended that the Environmental Release Certificate (CLA) be denied (…) denials that lack technical or scientific support, as has been shown”; and it requests that the action be dismissed and costs awarded against the plaintiff (see images 494 to 528 of the virtual court record).
ON THE SUBJECT MATTER OF THE PROCEEDING: Based on the arguments presented by the parties, it is clear that the purpose of this proceeding is to determine whether the favorable opinion (dictamen afirmativo) of the National Technical Commission on Biosafety approving the environmental release (liberación al ambiente) of COT102 cotton requested by Bayer, S. A. is null and void on formal grounds, such as the alleged lack of information identified by members Jaime García González and Francisco Pacheco Rodríguez, which purportedly vitiated elements of the opinion such as its grounds, content, and purpose; whether, had the Commission members had that information at hand, the outcome of the opinion would have been different; whether the 2015 public notice failed to explain the consequences or impacts of planting the transgenic crop, thereby affecting public notice and potentially causing the public not to submit objections; and whether there was a defect in the vote on the opinion at session SO-02-2016 of 14 de diciembre de 2016—all as grounds for nullifying administrative resolution 001-2017 UOGM, which authorized the environmental release.
In this regard, it is appropriate to clarify that the literal wording of the claim states: “3°. - Environmental Release Certificate (Certificado de Liberación al Ambiente) granted to Bayer S. A. for the importation, movement and/or release of the COT102 (SYN-IR102-Y) cotton plant line, published in La Gaceta 98 of 25 de mayo de 2017, assigned to BASF de Costa Rica, S. A.” Because this refers to the publication of the public notice in the Official Gazette La Gaceta of 25 de mayo de 2017, and that publication refers to resolution 001-2017 UOGM, this Court, by virtue of the application of the fundamental right of access to justice, construes the challenge as directed not against the physical document entitled “Certificado de Liberación al Ambiente,” but rather as seeking the nullification of the administrative act (acto administrativo) that formally authorized the environmental release. Indeed, the plaintiff states in its allegations that “Resolution 001-2017UOGM was based on the FAVORABLE BINDING OPINION issued by CTNBio in Agreement N°1 under Article V of ordinary session SO-02-2015, an opinion that, for the reasons explained in fact 24, lacks adequate grounds because it has no valid basis, since due process (debido proceso) was not followed for its adoption, nor was it based on the objective truth of the facts (verdad real de los hechos), because, when it was issued, technical information required by form BIO-02 was missing, as was additional information requested by members of CTNBio; pursuant to Article 133 of the Ley General de la Administración Pública, hereinafter LGAP, in conjunction with Articles 214 et seq. ibidem, this renders both that opinion and resolution 001-2017 UOGM absolutely null and void (nulidad absoluta)” (see image 134 of the virtual judicial case file).
ON CTNBio’S AUTHORITY TO APPROVE THE ENVIRONMENTAL RELEASE CERTIFICATE FOR GENETICALLY ENGINEERED ORGANISMS: Pursuant to the Ley Fitosanitaria del Estado and its regulations, the National Technical Commission on Biodiversity (CTNBio) has authority to issue a binding opinion (dictamen vinculante) for decisions concerning the registration and permitting of genetically modified organisms that any person proposes to import, export, test, transport, release into the environment, propagate, commercialize, or use for agricultural research (Article 46 of the Ley de Biodiversidad). The Commission is a scientific and technical body (órgano técnico científico) composed of the Ministerio de Agricultura y Ganadería, El Servicio Fitosanitario del Estado (which shall chair it), the Servicio Nacional de Salud Animal, the Oficina Nacional de Semillas, the Ministerio de Ambiente y Energía, the Ministerio de Salud, the Academia Nacional de Ciencias, the Federación para la Conservación de la Naturaleza, and the Cámara Nacional de Agricultura y Agroindustria (Article 112 of Decreto 26921-MAG).
It serves in an advisory capacity to the Servicio Fitosanitario del Estado on biotechnology matters (Article 40 of the Ley de Biodiversidad). By virtue of its opinion-issuing role as a scientific and technical body, its operating procedures require each member to provide a technical assessment of an application—in the matter before us, an application for the environmental release of a transgenic organism. Pursuant to Articles 112 and 115 of Decreto 26921-MAG, the Commission shall validly meet with half of its members plus one, and the same number shall constitute the quorum (quórum) required to validly adopt resolutions. Therefore, if it has nine members, the valid quorum for a meeting is five members, and the same number of votes is required for resolutions to be validly adopted.
ON THE LEGAL NATURE OF THE OPINION ISSUED BY THE NATIONAL TECHNICAL COMMISSION ON BIOSAFETY (CTNBio): It must be clearly understood that, under administrative law, the opinion issued by CTNBio is a preparatory act (acto preparatorio) that may serve as the basis for a subsequent administrative act, such as the decision that the Servicio Fitosanitario del Estado, as the decision-making body in that field, must issue concerning the application for the environmental release of COT-102 cotton. It must therefore be clarified that, by definition, an opinion as a preparatory act is not subject to the elements or validity requirements applicable to an administrative act. As has been stated: “Consequently, opinions, expert assessments, reports, views, proposals, etc., do not constitute administrative acts, but rather preparatory acts (also known as procedural acts (actos de trámite)) or simple acts of the Administration, issued to make the principal and final act possible.
Such acts have an indirect or intermediate effect; for example, a report may give rise to a disciplinary sanction, and an opinion may prompt another act. It follows from the foregoing that so-called ‘preparatory acts’ are, as a matter of principle, excluded from the concept of an administrative act” (JINESTA LOBO, Ernesto. Tratado de Derecho Administrativo, Tomo I. Biblioteca Jurídica Diké. San José, Costa Rica, año 2002, páginas 299 y 300). Accordingly, the elements inherent in an administrative act may be analyzed with respect to the administrative act concerning environmental release, including those emphasized by the plaintiff in its arguments—namely, its grounds, content, and purpose, which are the substantive elements (elementos sustantivos) of the act. However, it is not appropriate to formally require a preparatory act, such as the opinion issued by CTNBio, to contain those elements inherent in an administrative act.
Rather, that preparatory act will form part of the grounds for the determinative administrative act (acto administrativo determinativo) issued by the Servicio Fitosanitario del Estado. How, then, may the validity of the opinion be assessed? To answer that question, and based on the provisions cited supra, it is important to determine that the opinion’s validity must be assessed according to whether it was issued within the body’s area of authority, whether—in the case of a collegial body (órgano colegiado)—the quorum required for its issuance was observed, and whether it is supported by reasons. The substantive assessment contained in the opinion is, in turn, a matter for analysis by the body receiving that opinion when considering it for purposes of issuing the formal administrative act in question.
ON THE VALIDITY OF THE CTNBio OPINION ADOPTED AT SESSION NUMBER SO-02-2016 OF 14 DE DICIEMBRE DE 2016 AND CONFIRMED IN ARTICLE V OF SESSION SO-02-207 DATED 08 DE FEBRERO DE 2017: the arguments raised by the plaintiffs concerning the invalidity of the act authorizing release into the environment (liberación al ambiente) center on the claim that administrative decision (resolución administrativa) 001-2017 UOGM issued at 14:05 hours on 10 de mayo de 2017 by the State Phytosanitary Service is null and void because an essential component of its statement of reasons (motivación) is the favorable opinion (dictamen favorable) of CTNBio, which, according to the plaintiffs, is null and void due to a lack of supporting grounds (fundamentación), a violation of the procedure for its issuance arising from the failure to publish the notice (edicto), and a defect in the voting quorum. Accordingly, each of those arguments will be assessed in this recital (considerando), as follows: A) Regarding the alleged lack of information and, consequently, the improper grounds supporting the favorable opinion: the plaintiffs allege that, when CTNBio made its decision, information required by form BIO-02 was missing from the application submitted by Bayer, S. A., and that, in addition, further information was requested by the members representing the environmental sector who were then serving on that technical commission, namely Fabián Pacheco Rodríguez and Jaime García González.
In this regard, it is important to establish that we are dealing with the actions of a collegial body (órgano colegiado) composed of various sectoral representatives, each of whom is a specialist in a particular field of science. Thus, in the proper exercise of that representative role, each member may review the contents of the application and, from that member’s professional perspective, determine that further information is needed before deciding whether to support the application for the release into the environment of a genetically modified organism (organismo genéticamente modificado). The minutes of the Commission’s sessions show that the remaining members of CTNBio were fully aware of the information and of the objections raised by Engineers Pachecho and García concerning that information in relation to the release application, but they did not agree that there was insufficient information for purposes of their expert scientific assessment.
Indeed, the minutes in which the decision was made to issue a favorable opinion on the application state, as part of the reasoning underlying the votes, that the member: “reviewed and analyzed the information (…) Being aware of the presentation by the members of FECON AND RCB, and clarifying that the review would focus solely on strictly technical and scientific matters, given the Biodiversity conditions and taking into account the Cartagena Protocol and Public Health, the member therefore votes: IN FAVOR, subject to compliance with the conditions established in the opinion of MINAE and SFE, and adds that the conditions of RCB and FECON must be taken into account” (see image 277 of the virtual court file). In fact, the opinion was approved on that basis. Therefore, the argument that the Commission made its decision without knowing of the objections regarding an alleged lack of information, and that its vote was consequently uninformed, as though its members’ consent were defective (vicio en el consentimiento), cannot be accepted.
Rather, the legally proper interpretation is that, as independent members making their respective assessments, each member had an individual expert judgment, on the basis of which the available information was evaluated, and only the two aforementioned members of that commission (Pacheco and García) were dissatisfied with the information. In fact, the process allowed members, for purposes of their individual scientific assessments, to request further information and clarifications and then, in light of whether or not that new information was provided, each member was required to cast a reasoned vote. Such a request, however, was not to be made individually, but rather as an official request by the Commission, with respect to which the applicant company, as the regulated party (administrada), was entitled to receive a single consolidated request for information. The file contains requests for information and the corresponding responses (see the documents contained on Disc 3 of the administrative record (expediente administrativo), identified as “ii.
Response Emails to Jaime García 18 de noviembre de 2016” and “ii Information Request from Jaime García 18 de noviembre de 2016”); moreover, that documentation was required to be included in the file concerning the release application and thus to be made known to the other members. a.1- Opportunity to request information: At this point, it is important to establish that the submission of information requests cannot continue ad infinitum. Rather, clarifications or additional information must be requested in a measured and reasonable manner so that, at a given point, each member of the Commission may determine, on the basis of the materials reviewed, whether to support or reject the application. It cannot be accepted that an information request and successive requests for clarification may continue indefinitely without any time limit, precisely in light of the principle of legal certainty and security (principio de certeza y seguridad jurídicas).
Indeed, Article 118 of Decreto 26921-MAG, which governs the “Regulations to the State Phytosanitary Law” (“Reglamento a la Ley Fitosanitaria del Estado”), establishes that information may be requested “only once” and prescribes how it must be handled, as follows: “Article 118 (…) k. Request for clarification or supplementation of information. If, during the analysis stage conducted by UOGM, or by CTNBio in the applicable cases, it is necessary to expand upon or improve the information provided by the interested party through BIO-02 or BIO-06, UOGM is empowered to request in writing, only once and with justification, clarifications and information additional to that provided in the application, provided that such information is essential for conducting the substantive review (análisis de fondo) of the application and that this does not entail establishing requirements additional to those previously established.
The interested party shall have a period of 60 business days in which to submit it, which may be extended, upon that party’s express and justified request, only once and for an equal additional period; that request must be submitted within the period initially granted. Once the period granted for supplementation or clarification has expired, if the interested party has not submitted the required information or clarifications to UOGM, the proceeding may be denied and archived, and that action must be communicated to the interested party by administrative decision through the means of communication specified in the application. The administrative decision may be challenged through the ordinary remedies of reconsideration and appeal (recursos ordinarios de revocatoria y de apelación), in accordance with Article 254 of these Regulations. Once the information has been received in a timely and proper manner, CTNBio shall have an additional period of 30 calendar days in which to issue its favorable or unfavorable technical-scientific opinion (dictamen técnico-científico) on the application.
If additional information is required from the interested party, the period available to UOGM to decide the application shall be suspended” (underlining not in the original). Therefore, the practice described at trial by Mr. García González of making nine information requests or requests for clarification is, in light of the provisions transcribed above, excessive and beyond the authority granted to the members of that collegial scientific advisory body, in addition to the lack of clarity regarding the justification for the requested information in relation to the Commission’s exclusive jurisdiction (competencia exclusiva). It is important not to confuse the fact that, in practice, the Commission appears simply to forward its members’ requests or concerns regarding information to the applicant company, when the applicable regulations instead require the Commission, as a collegial body, to issue an official information request.
In that regard, it is clear that expert witness (testigo-perito) Valdéz Melara’s statement that the Commission does not decide whether a member’s information request is warranted, but rather that “it is simply made” (see expert witness Valdéz Melara’s response to a question from this Court contained in the video recording of the oral and public trial held on 06 de junio de 2025, which is included in the virtual file), reflects Ms. Valdéz Melara’s personal opinion concerning a legal issue in which the geneticist is obviously not an expert. She therefore speaks from empirical experience, but not from objective legal knowledge of the proper procedure for addressing requests for information directed to regulated applicants seeking approval for the release into the environment of a transgenic product; a.2- The requesting parties’ interest in the information: Likewise, during the oral and public trial, Mr.
Pachecho Rodríguez and Mr. García González directly acknowledged that they had ties to and a direct interest in the plaintiffs because they belonged to environmental or environmental-protection groups. It was also established at trial that they submitted information requests because they were interested in assessing the phenomenon of release into the environment comprehensively, in such a way that they addressed matters that would properly be evaluated at a subsequent stage involving the implementation of the release into the environment in situ, rather than at the stage of deciding whether to authorize the release. Mr. García González confirmed this in his testimony, stating that the information requested did indeed concern the biosafety (bioseguridad) stage of the physical on-site implementation of the release of transgenic cotton into the environment. He also acknowledged that the objections or observations he made regarding that stage were recorded on the reverse side of the physical release-authorization document (see Mr.
Jaime García González’s response to the Court’s questions during his testimony at trial on 05 de junio de 2025, the video recording of which is contained on the virtual desktop). Similarly, in his witness testimony, Mr. Pacheco Rodríguez, as one of the factors considered by this Chamber in assessing the objectivity of his conduct, stated that he did not agree with the “model of corporate appropriation of life,” because of the monopoly rights attached to those modified agents, which caused farmers to be viewed as criminals (see his testimony at the oral and public trial in response to one of the questions posed to Mr. Pacheco Rodríguez by Asociación Red de Coordinación de Biodiversidad). This would appear to reveal an ideological, rather than merely scientific, position in his assessments of the release application; he thus evaluates the application through that lens, subject to the appropriate caveat.
Accordingly, a bias is apparent in separating the issues and filtering the information strictly necessary to issue an opinion on the release, without extending the analysis to subsequent stages such as the physical implementation of the release or assessing potential human consumption, when authorization was requested solely to multiply seed and export it to another country.
However, it is important to establish that, likewise, even if it were for a later stage of material implementation or on-site risk management (gestión de riesgos en sitio), which pertains to the biodiversity-auditing stage (auditoraje en biodiversidad) and does not fall within the jurisdiction of what the CTNBio must decide, Mr. Pacheco Rodríguez expressed his interest in having wind-gust studies conducted—that is, in determining where the wind plume would travel and whether bees would be affected. This was included at the time among the conditions in the environmental-release certificate (certificado de liberación al ambiente) for purposes of its material implementation stage, subject to monitoring through biosafety auditing (auditoraje en bioseguridad). Similarly, Mr. Jaime García González admitted at trial that he was the author of an article entitled “Thirty Reasons Against Genetically Modified Crops in Costa Rica,” which would appear, from the outset, to reflect a position opposed to the introduction or environmental release (liberación al ambiente) of genetically modified organisms (organismos genéticamente modificados) (see the response to the question posed by BASF de Costa Rica, S. A., contained in the video recording of the oral and public trial at the hearing held on 05 de junio de 2025).
This is reflected in his testimony, in which he argues that he is concerned about the consequences for human or animal health, even though the purpose of the environmental release, as requested, was solely to multiply the seed and return it to its country of origin, and not to develop products for human consumption in Costa Rica. Indeed, the mandatory studies to be conducted during the implementation stage even included a study of seed germination in the digestive tract of the great-tailed grackle, as stated in the environmental-release certificate; a.3- The CTNBio’s assessment of those requests for information in this specific case: According to the evidence entered into the record, the procedure used in this case was that the CTNBio Presidency forwarded the Commission members’ requests for information to the applicant entity, but the CTNBio did not adopt an official position. Under the applicable provision, the members’ information-related concerns should instead have been collected and assessed to determine whether the requested information was justified as indispensable to the Commission’s purpose, and a single formal request for information should have been issued to the company seeking the environmental release, so that the Commission itself would officially request the information from the applicant company, duly explaining both its relevance and why the requested data were indispensable.
This also departed from the procedure established by law and makes it all the clearer that the requests for information mentioned by Messrs. Pacheco Rodríguez and García González could not be regarded as official requests by the Commission; nor did they invalidate the consent of the remaining members of that collegial body (órgano colegiado) to issue their favorable or unfavorable scientific opinion (dictamen científico) in this specific case. Consequently, the fact that a minority of the Commission’s members disagreed with the information provided or considered it incomplete did not invalidate the Commission’s decision, because a majority, based on the information available to them, considered that they had the elements necessary to decide the application, and there was no formal Commission resolution officially declaring that the information required to support the corresponding approval was incomplete.
In such cases, the UOGM shall communicate information of public interest to civil society by publishing a public notice in the Diario Oficial La Gaceta and on the SFE’s official website in the Public Consultation section, allowing a reasonable period of 10 business days for interested parties to submit to the UOGM their technically and scientifically supported positions regarding the authorization process for use of the OVM. f. Technical assessment of the potential receiving environment. Once the admissibility process, or the public-notice and consultation process in applicable cases, has been completed, the UOGM shall have 45 calendar days to conduct the technical assessment of the potential receiving environment. It must take into account the technically and scientifically supported positions submitted by interested parties during the public consultation concerning the authorization process for use of the OVM and, based on the technical criteria established by the UOGM for that purpose, shall issue a report on the results of the technical assessment. g. Simplified procedure for applications to use individual transformation events with a prior history of use in the country.
Once the technical assessment of the potential receiving environment has been completed, the UOGM shall identify applications for the use of individual transformation events that previously received a CLA. In such cases, the UOGM shall decide the application within a maximum period of 45 calendar days on the basis of the prior opinion or opinions and the technical assessment of the conditions of the potential receiving environment, thereby establishing the most restrictive biosafety measures (medidas de bioseguridad) according to the available criteria. The outcome of the application must be communicated to the interested party by means of an administrative decision (resolución administrativa), through the communication channel identified in the application. In cases where the intended objective or purpose of using the OVM covered by the application differs from those previously authorized, the UOGM may submit the application for review by the CTNBio and, in such case, must obtain its favorable opinion before issuing the corresponding CLA” (underlining not in the original).
It is therefore clear that assessment of the public notice’s content falls within the purview of the Servicio Fitosanitario del Estado and, accordingly, does not in any way invalidate the CTNBio’s actions. Now, because the invalidity (nulidad) of the final act granting the environmental-release certificate by the Unidad de Organismos Genéticamente Modificados is alleged, it is important to establish that, in this Court’s view, the public notice issued and shown in image 336 of the virtual court record clearly provides notice of the application for the environmental release of genetically modified cotton, the deadline for submitting objections, and the authority before which such objections may be filed. It therefore essentially fulfills the purpose of publication. Moreover, as the State has argued, the publication of the public notice dated 25 de mayo de 2017, after the environmental release had been approved, which appears in image 91 of Volume V of the administrative record and sets out the product’s possible risks and provides an opportunity to challenge the decision, substantially satisfies the requirements of adequate publicity and a public opportunity to submit objections.
Thus, on the merits, it would not invalidate the act, particularly because the record contains no evidence that any objection or appeal (recurso) was in fact filed in that regard; C) The Commission’s allegedly improper vote when considering the opinion on the application submitted by BAYER, S. A., for the environmental release of genetically modified cotton: The plaintiff alleges that the vote approving the environmental-release application for COT102 cotton was defective because: “After casting their votes orally, without waiting for the final result or for the voting procedure to conclude, Patricia Madrigal and Bernardo Jaén left the meeting. Thus, when the resolution was adopted, only seven of the CTNBio’s 12 members were present, two of whom issued unfavorable opinions; therefore, five votes in favor and two against should have been recorded. However, the minutes state that the vote was seven in favor and two against, which is not true because two members did not participate throughout the analysis and discussion of that opinion.
The minutes also state that, by a vote of seven in favor and two against, the resolution was declared final, even though only five members present agreed to declare it final” (see image 64 of the virtual court record). In response to this assertion, it should be borne in mind that, on 14 de diciembre de 2016, favorable opinions regarding the environmental release of COT-102 cotton were received from the following persons or entities: Alejandra Chaverri Esquivel, representative of the Ministerio de Salud (see images 121 and 122 of Volume III of the administrative record); Bernardo Jaén Hernández, representative of the Servicio Nacional de Salud Animal (SENASA), with the observations that “physical isolation measures must be maintained within a radius of 5 kilometers between the GMO planting site and the location of any apiary” and that “Access to the planting area must be restricted to authorized personnel” (see image 127 of Volume III of the administrative record); Patricia Madrigal Cordero, Vice Minister of the Ministerio de Ambiente y Energía (MINAE), and biologist Melania Muñoz García, with several clarifications (see images 1 through 10 of Volume III of the administrative record); and Federico Torres Carballo, representing the Ministerio de Ciencia, Tecnología y Telecomunicaciones (MICITT) (see images 113 through 116 of Volume III of the administrative record).
In other words, because of the inherently scientific nature of the matters on which each member must opine, it is apparent that they first issue their favorable or unfavorable views in writing. Similarly, Mr. Fabián Pacheco Rodríguez submitted an unfavorable opinion rejecting the application for the environmental release of COT-102 (see images 117 through 120, repeated in images 185 through 191 of Volume III of the administrative record), and at meeting number SE-001-2016 dated 28 de noviembre de 2016, Mr. Jaime García was directed to submit his opinion when it was resolved: “1) To grant Jaime García a period of 10 business days, beginning today, to issue his opinion; the information will be delivered to him and proof of delivery shall be placed on record” (see Minutes number SE-001-2016 dated 28 de noviembre de 2016, contained on Disc 3 of the administrative record). However, there is no evidence that Mr. Jaime García submitted any written opinion on the matter.
Now then, it being clear that the members of the Commission had submitted their opinions in writing, in accordance with the evidence entered into the record, particularly minutes number SO-02-2016 of 14 de diciembre de 2016, regarding whether they approved or rejected the application, the matter was put to a vote at the respective session, as follows: “The President clarifies that the votes and the reasons stated for them will be recorded, for purposes of both the affirmative and negative votes, considering that Patricia Madrigal would soon leave the session and would explain her vote, as all members will likewise do”; the reasons for each vote were then given, first by Ms. Patricia Madrigal Cordero, who voted in favor, followed by Ms. Melania Muñoz García, who voted in favor, at which point it was recorded that “PATRICIA MADRIGAL leaves at 11:10,” and then by the remaining members in the following order: Marco Jiménez, Bernardo Jaén, Alejandra Chaverri, Alonso Chacón, and Alex May, who voted in favor of the application for environmental release (liberación al ambiente), and Fabián Pacheco and Jaime García, who voted against it.
After Jaime García’s vote, it was recorded that “BERNARDO JAÉN leaves at 12:00 m.d.” The result of the vote was recorded under item “2. Vote” of this same Article V as “7 in favor and 2 against. Finality: 7 in favor and 2 against” (see images 276 to 279 of the virtual judicial case file). Likewise, Mr. Jaime García González insisted that the information was incomplete, that he continued to regard the issues as unaddressed, and that “how is it possible that the company cannot specify the quantity of material to be imported, and that it is ambiguous, when it must provide complete information for the assessment? Those reasonable doubts do not permit a vote, and therefore he disclaims responsibility. The distances stated are not those given by the company. For this reason, he votes: AGAINST”; and Mr. Fabián Pacheco stated: “In view of the apparently favorable majority vote, approval should be made conditional upon issuance of the studies described.
For this reason, he votes: AGAINST. He adds that the 14 kilometers of distance between these activities and the beekeeping centers are not taken into consideration, and they insist that the aforementioned studies have in fact been included” (see images 273 to 279 of the virtual judicial case file). Based on the foregoing, it is clear to this Chamber that the voting itself took place when each member, in addition to submitting a written opinion, directly and personally proceeded to give an oral justification for his or her vote; indeed, as recorded in the minutes, 7 persons voted in favor and 2 persons voted against granting the requested Environmental Release Certificate (Certificado de Liberación al Ambiente). To reiterate, the minutes expressly recorded the Commission President’s statement that “the votes and the reasons stated for them will be recorded, for purposes of both the affirmative and negative votes, considering that Patricia Madrigal would soon leave the session and would explain her vote, as all members will likewise do.” In other words, formally speaking, it was at that point that the formal vote was called; consequently, the contents of item 2, Vote, of Article V must be understood merely as the recording of the formal tally.
The vote itself, as explained by the Commission President, took place when those oral justifications were given, and he further clarified that this would occur after voting. It can therefore be seen that a vote took place in which the scientific reasons why each member voted for or against could be ascertained beyond doubt, and that, in substance, constitutes a voting procedure that must be recognized as valid. The fact that a person who voted left the session after casting his or her vote does not invalidate that vote, which must be taken into account for all legal purposes; the only consequence is that the person who leaves will not be able to learn firsthand the overall result of the vote or immediately object to anything relating to it, should he or she consider that necessary. It is also important to note the statement made at trial by Mr. Fabián Pacheco Rodríguez in response to questions from Red de Coordinación en Biodiversidad, to the effect that there had been “disorder in the voting” (the video recording of the oral and public trial hearing held on 05 de junio de 2025, available in the virtual case system, may be consulted); and Mr.
Jaime García González, in response to questions posed by Red de Coordinación de Biodiversidad, stated that “two people cast their votes and left before the discussion had concluded” (the video recording of the oral and public trial hearing held on 05 de junio de 2025, available in the virtual case system, may be consulted). In this regard, this Court considers it important to note that, although these two persons were present on the day the resolution was voted upon, they actually offer a nonlegal view of what occurred during the aforementioned session, which in no way undermines the legal characterization that must be given to those events, since voting is precisely that: a vote in which each expert, providing a technical justification for his or her opinion, casts a favorable or unfavorable vote on the application; it is not an occasion for discussion or analysis, or for challenging another member’s vote.
Accordingly, the voting procedure was conducted properly and in accordance with law. In a different vein, the plaintiff associations allege, and Mr. García González criticizes, that at that same session the resolution concerning the favorable opinion for the environmental release of COT102 was declared final and binding (firme). This Chamber observes, however, that this was not its actual legal effect, because the minutes were challenged by Mr. García González, and it was only after the challenge proceedings had concluded that, in Article V of CTNBio session SO-02-2017 dated 08 de febrero de 2017, it was decided to reject the challenge and affirm the Favorable Technical Opinion (Dictamen Técnico Favorable), and, in Article VI of that same session SO-02-2017, to approve minutes number SO-02-2016 (see images 404 to 420 of the virtual judicial case file). Thus, it was not until that date that the release opinion became final at the administrative level—that is, only on that date did it become final and effective.
This is reinforced by the fact that the resolution constituting the final or determinative administrative act (acto administrativo final o determinativo) granting the environmental release by the Unidad de Organismos Genéticamente Modificados del Servicio Fitosanitario del Estado was not issued until 10 de mayo de 2017 and included the favorable opinion among its considerations. All of this occurred only after, at session SO-02-2017 of 08 de febrero de 2017, CTNBio rejected the challenges filed, affirmed the favorable technical opinion of 14 de diciembre de 2016, and declared the administrative remedies exhausted (agotada la vía recursiva). It is therefore clear that the opinion issued on 14 de diciembre de 2016 neither became final nor produced legal effects until the respective remedies had been exhausted; accordingly, the resolution must likewise be deemed substantively valid.
OTHER ARGUMENTS OF INVALIDITY: Reference will be made here to other, non-central arguments raised by the plaintiff, through which it also challenged the validity of CTNBio’s favorable opinion (dictamen favorable). A) That it was a stack (apilado) and should have been processed under a different procedure as several events at once rather than as a single event: this argument by the plaintiff arises from the first fact alleged in the complaint, which states: “THE APPLICANT submitted, using the ‘BIO-02 Form’ of the digital information system for living organisms (…), the application for a CERTIFICATE OF RELEASE INTO THE ENVIRONMENT (…) for the purpose of importing it as a stack containing the GlyTol and TwinLink events (…)” (see image 3 of the virtual court file); moreover, during the trial hearing, reference was made to the existence of a stack in the application and to the contention that it should not be treated as a single event, which, in the plaintiff’s opinion, would invalidate the procedure followed to grant the authorization.
However, under the regulations in force, it was clear that the authority to determine whether the matter should be classified as a group of events or as a single event for purposes of submitting it to CTNBio lay with the Servicio Fitosanitario del Estado, as provided by Article 118 of Decreto 26921-MAG, which states: “(…) g. Simplified procedure for applications to use individual transformation events (eventos de transformación individuales) that have a history of prior use in the country. Once the technical assessment (valoración técnica) of the potential receiving environment (posible medio receptor) has been completed, UOGM shall identify applications to use individual transformation events that have previously received a CLA; in such cases, UOGM shall decide the application within a maximum period of 45 calendar days based on the prior opinion or opinions, as well as on the technical assessment of the conditions of the potential receiving environment, thereby establishing the most restrictive biosafety measures (medidas de bioseguridad) according to the available criteria.
The outcome of the application must be communicated to the interested party by means of an administrative decision (resolución administrativa), through the means of communication designated by that party in the application. In cases where the intended objective or purpose of using the LMO that is the subject of the application differs from those previously authorized, UOGM may submit the application for review by CTNBio and, in such event, must obtain its favorable opinion before granting the corresponding CLA.” Accordingly, it is clear that the Servicio Fitosanitario del Estado has authority to assess that situation and, once it has made its determination, shall submit it, as appropriate, to CTNBio on the basis of what it has previously determined under its sole responsibility. Therefore, in that respect, this issue cannot invalidate the actions taken by that Commission in conducting its analysis of the case submitted for its consideration.
Furthermore, it is important to establish that, in these proceedings, the plaintiff clearly stated that it would not address the substantive technical issues, and the evidence examined at the oral and public trial made clear that this is a matter of scientific debate, since the expert witnesses (testigos peritos) Pacheco and García stated in their testimony that COT102 involved a stack, whereas the expert witness Valdéz Melara (see the trial testimony given on 06 de junio de 2025 in response to the questions posed by supporting intervenor (coadyuvante) Juan Diego Quirós, as recorded in the video of the hearing contained in the virtual file) stated that there was no molecular stack in that case. This Court therefore infers that there is no consensus on the matter and that, in the absence of a conventionally accepted standard, it cannot be regarded as a defect in the procedure or processing of the application.
If the situation were otherwise, it would not have been enough merely to offer the testimonial opinions of Mr. Pacheco and Rodríguez; instead, the substantive technical issue should have been placed in dispute, and it should have been demonstrated through objective scientific evidence based on studies specific to this particular case that the matter unquestionably had to be treated as a group of stacked events. The plaintiff neither raised this issue for debate in these proceedings nor proved it in accordance with the burden of proof (carga de la prueba), or onus probandi, imposed upon it pursuant to Article 41.1 of the Código Procesal Civil in relation to Article 220 of the Código Procesal Contencioso Administrativo. Furthermore, it is important to clarify that the argument of Asociación Comunidades Ecologistas de La Ceiba Amigos de la Tierra Costa Rica concerning the email dated 22 de enero de 2018, sent by José Maynor Monge Villalobos to Mr.
Jaime García and contained on Disc 3 of the administrative record (expediente administrativo), does not establish that Bayer, S. A.’s application concerning the event involved its planting individually; instead, it states that the event had already been planted as a stacked event together with other events. Note, however, that it does not say by whom or when; moreover, it bears repeating that it has neither been debated nor demonstrated in these proceedings, in accordance with the burden of proof imposed upon the plaintiff, that the application in this particular case concerned or coincided with a stacked event under conventionally accepted scientific criteria. Indeed, the literal wording of the first line in the body of that email indicates that Bayer, S. A.’s application concerns an individual event. B) THAT THE COMMISSION ISSUED ITS OPINION AFTER THE DEADLINE: in this regard, it is important to recall that acts issued after the deadline are valid (Article 329. 3 of the Ley General de la Administración Pública), particularly when that fact, by itself, has no direct effect on the scientific assessments issued by the members in forming the collective decision (voluntad del órgano colegiado) of the collegial body (órgano colegiado).
Thus, although the application was filed in 2015 and there was a thirty-day period within which to issue the respective opinion (Article 118 subsection K) of Decreto 26921), under the applicable legal provision cited supra, it is clear that there is no defect and that the delay neither nullifies nor alters the substance of the scientific assessment contained in the official opinion issued by CTNBio.
REGARDING THE CLAIMS IN THESE PROCEEDINGS: This section addresses the claims formally asserted, which seek a declaration that the following are null and void: “1°. - The decision adopted under Article V of CTNBio regular session N° SO-02-2016 of 14 de diciembre de 2016, constituting the affirmative opinion of Comisión Técnica Nacional de Bioseguridad regarding the application for a certificate of release into the environment (certificado de liberación al ambiente) filed by Bayer, S. A., whose rights have now been assigned to BASF de Costa Rica, S. A. (complaint and claim amended at the preliminary hearing (AP) of 12 de octubre de 2021); 2°. - The decisions adopted under Article V of CTNBio regular session N° SO-02-2017, which declare the review stage commenced and reject the challenge and its supplement, thereby exhausting the administrative appeals process (vía recursiva)”: it being understood that CTNBio’s favorable opinion is challenged as an indispensable element of the final act (acto final) granting the release of COT102 into the environment, and given that the action substantially complied with the law, since the vote was properly conducted and informed, irrespective of the highly respectable view held by the two members representing the environmental sector regarding the quantity and quality of the information available for their personal scientific assessment, because the collegial body clearly did not share their view that the information was incomplete and, indeed, in practice, the requests for information exceeded in number what was legally permitted under the governing procedure, the defense of lack of legal entitlement (falta de derecho) is upheld and these claims must be denied; “3°. - The Certificate of Release into the Environment granted to Bayer S. A. for the importation, movement and/or release of the COT102 (SYN-IR102-Y) cotton plant line, published in La Gaceta 98 of 25 de mayo de 2017, and assigned to BASF de Costa Rica, S. A.”: Since decision number 001-2017 UOGM, as analyzed above, complied with the law and is based on a favorable opinion that is fully valid and effective, there is no basis whatsoever for annulling that act; accordingly, the defense of lack of legal entitlement is upheld and this claim shall be denied.
Furthermore, it should be noted that the act dates from 2017 and that it was established that the release of the genetically modified organism (organismo genéticamente modificado) into the environment occurred long ago, without any biosafety problems or violations resulting from that act having been established in the record. Accordingly, in this Court’s view, this claim also lacks a present legal interest (interés actual), as asserted by the government’s counsel. “4.- That the Servicio Fitosanitario del Estado be ordered not to authorize the release into the environment of stacks of events that have not been approved by CTNBio, in accordance with the principles of environmental protection and biosafety, and not according to the interests of applicants for permits to release transgenic organisms into the environment (hearing of 12 de octubre 2021, 03:04 hours recording); 5.- That the Servicio Fitosanitario del Estado and CTNBio be ordered to comply with procedures and legislation, in accordance with scientific and technical principles, prioritizing environmental protection and biosafety rather than the interests of applicants for permits to release transgenic organisms (genetically modified organisms) into the environment”: In this regard, it must first be stated that, since none of the acts challenged in the complaint has been annulled and the only relief sought is that the government bodies act in accordance with the law when exercising their powers—which they are already understood to be required to do—this does not per se constitute a procedural claim capable of adjudication in these proceedings and must be denied as irrelevant. Consequently, the complaint is dismissed in its entirety.
REGARDING THE COSTS OF THE PROCEEDINGS: Pursuant to Article 193 of the Código Procesal Contencioso Administrativo, litigation costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed upon the unsuccessful party, and because there are no grounds for departing from that general rule, the plaintiff is ordered to pay both categories of costs of the proceedings, in equal shares, in favor of the co-defendants. As requested, statutory interest (intereses legales) is awarded on the amounts determined as costs, accruing from the date on which the decision setting those amounts becomes final until payment in full.
THEREFORE (POR TANTO) The defense of lack of legal entitlement is upheld, as is, in part, the defense of lack of present legal interest (falta de interés actual). Consequently, the complaint is dismissed in its entirety. Both categories of costs of the proceedings shall be borne by the claimants, together with the corresponding interest, which shall accrue from the date on which the decision setting those amounts becomes final until payment in full. A., cédula jurídica número 3-101-16978, representada actualmente en juicio por el señor Aldo Milano Sánchez, mayor, casado, abogado, vecino de San Rafael de Montes de Oca, cédula de identidad número 1-0788-989, en su condición de apoderado especial judicial, según consta en imágenes 531 y 532 del expediente judicial virtual; Redacta el juez Solano Solano; y CONSIDERACIONES DE TRÁMITE Que la parte actora presenta formal demanda con la finalidad de pedir la nulidad del: “1°. - Acuerdo tomado en el artículo V de la sesión ordinaria CTNBio N° SO-02-2016 del 14 de diciembre de 2016, que es dictamen afirmativo de la Comisión Técnica nacional de Bioseguridad, a la solicitud de certificado de liberación al ambiente de la empresa Bayer, S. A. cedido actualmente sus derechos a la empresa BASF de Costa Rica, S. A. (demanda y pretensión ajustada en la AP del 12 de octubre de 2021); 2°. - Acuerdos tomados en el artículo V de la sesión ordinaria N° SO-02-2017 DE LA CTNBio, que da por iniciada la etapa de conocimiento y rechaza la impugnación y su ampliación, dando por agotada la vía recursiva; 3°. - Certificado de Liberación al Ambiente otorgado a Bayer S. A., para la importación, movilización y/o liberación de la línea de plantas de algodón COT102 (SYN-IR102-Y), publicado en la Gaceta 98 del 25 de mayo de 2017, cedido a BASF de Costa Rica, S. A.”; 4.- Al Servicio Fitosanitario del Estado, no autorizar la liberación al ambiente de apilamientos de eventos que no hayan sido aprobados por la CTNBio, de conformidad con los principios la protección al ambiente y a la bioseguridad, y no en los intereses de los solicitantes de permisos de liberación al ambiente de transgénico (audiencia 12 de octubre 2021, 03:04 horas grabación); 5.- Al Servicio Fitosanitario del Estado, y la CTNBio el cumplimiento de los procedimientos y legislación, de conformidad con los principios de la ciencia y de la técnica, teniendo como prioridad la protección al ambiente y a la bioseguridad, y no en los intereses de los solicitantes de permisos de liberación al ambiente de transgénicos (organismos genéticamente modificados).” (ver imágenes 159 y 160 del expediente judicial virtual y términos de ajuste de pretensiones en Audiencia Preliminar).
Que, en respuesta a la audiencia conferida, el Estado se opone a la demanda planteada, opuso la excepción de falta de interés actual y falta de derecho y solicitó “se declare sin lugar la demanda en todos sus extremos y se condene a la parte actora al pago de ambas costas del proceso y sus respectivos intereses” (ver imágenes 355 a 373 del expediente judicial virtual).
Que, en respuesta a la audiencia conferida, el Servicio Fitosanitario del Estado, contestó negativamente la demanda, opuso la excepción de falta de derecho y solicitó “Se DECLARE SIN LUGAR la presente demanda (…) Se IMPONGA LAS COSTAS del mismo a la parte ACTORA, así COMO LOS INTERESES sobre estas desde la firmeza de la sentencia hasta su efectivo pago” (ver imágenes 229 a 250 del expediente judicial virtual).
Que, en respuesta a la audiencia conferida, la empresa BASF (Costa Rica) S. A., contestó negativamente la demanda, opuso la excepción de falta de derecho y solicitó: “(…) el rechazo en todos sus extremos de la demanda, debido a la falta de derecho, con la correlativa condena en ambas cotas a las actoras” (ver imágenes 494 a 528 del expediente judicial virtual) Que la audiencia preliminar se desarrolló en diferentes fechas, a saber: 02 de marzo de 2021, 12 de octubre de 2021, 09 de agosto de 2022 y 14 de agosto de 2024, donde se establecieron las pretensiones, se desistió de la demanda contra Bayer, S. A. y se ajustaron las pretensiones aclarando que la certificación de liberación al ambiente se cedió a favor de la empresa BASF (Costa Rica) S. A., se declaró inadmisible una petitoria 3BIS planteada en la Audiencia Preliminar, se definieron los hechos como controvertidos y se admite la prueba documental, así como la prueba testimonial-pericial ofrecida por la parte actora, a saber: el señor Jaime Enrique García González, cédula de identidad número 1-0533-0503 y Fabián de Jesús Pacheco Rodríguez, cédula de identidad número 1-1017-0021; a dos de los tres testigos ofrecidos por el Servicio Fitosanitario del Estado a escoger entre: Alex May Montero, cédula de identidad número 1-0522-0995, Luis Alonso Chacón Araya, cédula de identidad número 1-0514-0063 y Alejandra Chaverri Esquivel, cédula de identidad número 1-0862-0654 y a la prueba testimonial ofrecida por BASF (Costa Rica) S. A, a saber: Nelly Mora Molina y las testigos-peritos: Ing. Lizzy María Retana Villalobos, cédula de identidad número 1-1163-0369 y Marta Fermina Valdéz Melara, cédula de identidad número 8-0159-0349 (ver imágenes 671 a 676, 738 a 743, 803 a 813 y 856 a 858 del expediente judicial virtual, así como los audios de la grabación de las audiencias preliminares que constan en el escritorio virtual).
Que la audiencia de juicio oral y público se llevó a cabo en dos días el 05 de junio y el 06 de junio de 2025, iniciando el día 05 de junio en la Sala 03 y el día 06 de junio en la Sala 02, ambas, del Edificio Anexo A del Segundo Circuito Judicial de San José, con la presencia de los jueces aquí firmantes y para su desarrollo, se dio la acreditación de las partes, se apersonó y aceptó la participación de una coadyuvancia a favor de las asociaciones actoras. Se decidió también sobre la alegación del Estado acerca de que la Asociación Comunidades Ecologistas La Ceiba Amigos de la Tierra Costa Rica, tenía la junta directiva vencida, ante lo cual, se informa por los interesados que se está en proceso de renovación de la nueva junta directiva, previa legalización de libros y se decide que, para efectos del proceso, el poder especial judicial está bien otorgado por la persona jurídica y la representación para efectos del proceso judicial es válida y vigente y se continúan con las diligencias.
Se declara formalmente abierta la etapa de juicio oral y público, se desarrollan los alegatos de apertura de las partes y se procede con la evacuación de la prueba testimonial, haciendo la aclaración de que el Servicio Fitosanitario del Estado desistió de la totalidad de la prueba testimonial que había ofrecido y la compañía BASF (Costa Rica), S. A. desistió del testimonio de la señora Nelly Mora Molina. En consecuencia, se recibió la declaración de los testigos-peritos ofrecidos por la parte actora, a saber: Fabián de Jesús Pacheco Rodríguez, cédula de identidad número 1-1017-0021 y Jaime Enrique García González, cédula de identidad número 1-0533-0503 y se recibió la declaración de las testigos-peritos ofrecidas por la compañía demandada, a saber: Marta Fermina Valdés Melara, cédula de identidad número 8-0159-0349 y Lizzy María Retana Villalobos, cédula de identidad número 1-1163-0369. Posteriormente, por solicitud de las partes, se dio plazo para que se rindieran las conclusiones por escrito hasta el día 11 de junio de 2025, siendo que, sobre la base de las facultades del artículo 111 del Código Procesal Contencioso Administrativo califica el asunto de muy complejo y, en consecuencia, se emitirá la sentencia dentro del plazo de quince días hábiles a partir del día hábil siguiente a la terminación del plazo para rendir conclusiones.
Se corroboran medios de notificación de las partes y se da por finalizada la audiencia de juicio oral y público (escuchar audiencia de juicio que quedó videograbada y que se incorporó como parte del expediente judicial virtual).
Que no se observan vicios o defectos capaces de generar indefensión a las partes o nulidad y, previa deliberación, esta sentencia se emite por unanimidad dentro del plazo de ley; y CONSIDERACIONES DE FONDO VI.HECHOS PROBADOS: De importancia para la resolución del presente asunto, se tienen por demostrados los siguientes hechos:
IX.ALEGATOS DE LAS PARTES: a. De la parte actora: Que en fecha 10 de agosto de 2015, Bayer S. A. presentó la solicitud de libración al ambiente de plantas de algodón COT102 (SYN-IR102-7), con el fin de ser importado como un apilamiento con los eventos GlyTol y TwinkLink y que para esos efectos, el 28 de agosto publicaron un edicto que no cumplió con el requerimiento reglamentario del Reglamento a la Ley Fitosanitaria, número 26921-MAG de realizar “una descripción accesible del proceso que se va a llevar a cabo y sus posibles impactos”, violando el principio de publicidad y transparencia en el inicio de dicho trámite y que el día 06 de octubre de 2015, el Presidente de la CTNBio remitió a la Comisión la solicitud de Certificado de Liberación al ambiente (CLA) para la revisión y emisión del dictamen respectivo. Que el señor Jaime García González , como integrante de la CTNBio, solicitó información faltante en el BIO-02 e información adicional y que también solicitó realizar una visita a la finca.
Asimismo, que el señor Fabián Pacheco Rodríguez, integrante de la Comisión, también solicitó información faltante del BIO-02 e información adicional, siendo que esas informaciones solicitadas el día 23 de noviembre de 2015, le fueron respondidas en forma extemporánea en fecha 21 de enero de 2016 y no dentro de tres días que establece el artículo 9.12 del instructivo DB-OGM-PO-06. Que, a partir de aquí, el señor Jaime García insiste en que no se le ha dado la información completa y que en la sesión número SE-001-2016 de fecha 28 de noviembre de 2016, la CTNBio, aprueba la precitada petición del señor García y se pospone la votación de la solicitud de liberación al ambiente hasta que se le haga llegar la información solicitada. Igualmente, el señor Fabián Pacheco le comunica al Presidente de la comisión que, ante la respuesta incompleta a la solicitud de información planteada, en fecha 28 de noviembre de 2016, dice que no puede emitir un voto razonado y solicita que “no se autorice la liberación al ambiente de ese evento”.
Posteriormente, el señor García continúa solicitando información que considera no le brindaron o que está incompleta y que el Presidente de la Comisión le hizo llegar información que consideró incompleta y necesaria de aclarar y adicionar. Alega que el mismo día de la sesión número SO-02-2016 del 14 de diciembre de 2016, en que se realizó la votación, se les entregó el documento “INFORME TÉCNICO-CIENTÍFICO DE LA EVALUACIÓN Y GESTIÓN DE RIESGO AMBIENTAL DE LA SOLICITUD DE CERTIFICADO DE LIBERACIÓN AL AMBIENTE DEL CULTIVO DE ALGODÓN G.M., GOSSYPIUM HIRSUTUM GENÉTICAMENTE MODIFICADO nombre comercial COT102 identificador único (SYN-IR102-7) de 56 páginas (…) Lo anterior significa que uno de los miembros de la CTNBio haya tenido la oportunidad de leer y analizar ese importante informe” (ver imagen 120 del expediente judicial virtual). En consecuencia, consideran que la Comisión tomó una decisión sin contar con toda la información necesaria para emitir un dictamen que no es una mera formalidad de cumplimiento de los requisitos documentales, sino que es un dictamen vinculante que debería tomar en cuenta que se establezca de manera “real, eficiente y lógica un control fitosanitario del intercambio, nacional e internacional, de vegetales, de agentes de control biológico y otros tipos de organismos usados en la agricultura, materiales de empaque y acondicionamiento, y medios de transporte capaces de introducir plagas que amenacen la seguridad alimentaria y la actividad económica en que se basa la producción agrícola, en otras palabras, NO se limita solo a la semilla o producto, sino que comprende su traslado, control de bodegaje, relación con otros productos o lugares que puedan ser afectados (…) y por ello la ley habla de expedir certificados fitosanitarios, de conformidad con los tratados internacionales vigentes sobre la materia, los cuales no tratan solo de formalidades legales o certificados formales, sino de complejas disposiciones técnicas” (imágenes 150 y 151 del expediente judicial virtual).
Entonces, que por la información faltante al momento de emitirse el dictamen vinculante favorable era de carácter técnico, que no se cumplió con el requisito de la publicación del edicto reseñando una descripción del proceso que se llevaría a cabo y eventuales impactos y que el Estado tenía la obligación de evitar el riesgo que amenace la permanencia de los ecosistemas (artículo 45 de la Ley de Biodiversidad). Que así, debería declararse la nulidad del dictamen vinculante favorable emitido porque se adoptó con información faltante, al no realizarse un análisis técnico científico, lo que hace que el dictamen no se ajuste a la verdad de los hechos, violando el artículo 133 de la Ley General de la Administración Pública “al no tener un contenido proporcional al fin legal, ni basarse en todas las cuestiones de hecho y de derecho que debieron surgir del motivo, según los numerales 131 y 132 ibídem, en consecuencia, acusa vicios de omisión de elementos esenciales del acto y, de conformidad con los artículos 164 y 166 ibídem, es absolutamente nulo” (ver imagen 156 del expediente judicial virtual).
Asimismo, dicen que la resolución 001-2017 UOGM, por la que se aprobó la liberación al ambiente del COT102 solicitada por Bayer, S. A. es nula porque “De haberse emitido el dictamen conforme a derecho, o sea, con la totalidad de la información requerida, el resultado pudo haber sido negativo y, en consecuencia la solicitud de la CLA pudo y debió haber sido negada” (ver imágenes 157 y 158 del expediente judicial virtual). También, alegan que el dictamen es nulo por un vicio en la votación porque “Dos miembros indicaron su criterio y se retiraron de la misma ANTES DE LA VOTACIÓN NO OBSTANTE se les tomó el voto para hacer mayoría en su ausencia para acordar el CLA en cuestión y para declarar la firmeza del acuerdo” (ver imagen 1062 del expediente judicial virtual). b. Servicio Fitosanitario del Estado: Que el objeto de la solicitud de liberación al ambiente estaba claro en el edicto del 28 de agosto de 2015, así como en el del 25 de mayo de 2017, que era la siembra para la multiplicación y posterior exportación.
Que, si bien es cierto, en el voto número 2018004117 de la Sala Constitucional de la Corte Suprema de Justicia estimó que se requieren mejorar los procedimientos de acceso a la información, pero que se hizo sin efecto retroactivo, por lo que no afecta el edicto publicado en este caso y que hubo otra oportunidad de pronunciamiento público con el edicto publicado el 25 de mayo de 2017. Que los representantes de la FECON y Red de Coordinación en Biodiversidad solicitaron documentos impresos en papel, a pesar de que el sistema donde se tramitan estos asuntos es digital. Que, siempre, la información de la solicitud estuvo a disposición del señor Jaime García en línea y que sus solicitudes de información son meras apreciaciones subjetivas. Que el criterio del señor Pacheco Rodríguez en la comisión, carece de sustento técnico o científico y que la información exigida por la Administración siempre estuvo completa, que el señor García González no la accedió por medios oficiales, que el señor García no emitió el criterio técnico que se le requería.
Que el informe de la finca “María Teresa” no corresponde a ningún requisito establecido para la dictaminación del Certificado de Liberación al Ambiente, sino que era información para el Servicio Fitosanitario del Estado. Que las instituciones emiten un dictamen escrito de análisis de riesgos sobre el cual votan de manera favorable. Que la dictaminación favorable a la solicitud del certificado de liberación al ambiente estuvo basado en criterios científicos de las entidades integrantes de la Comisión y que los señores Fabián Pacheco y Jaime García no presentaron su disconformidad sustentada en criterios técnicos y científicos, sino que se limitaron a presentar una serie de supuestos sin una metodología de análisis. Que el resto de los miembros de la Comisión se dieron por satisfechos con toda la información. En consecuencia, establecen que la demanda es completamente improcedente (ver imágenes 229 a 248 del expediente judicial virtual). c. El Estado: Empieza estableciendo que la demanda es improponible porque se está impugnado un acto preparatorio como es el dictamen emitido por la CTNBio en la sesión SO-02-2016 del 14 de diciembre de 2016, que no tiene efecto propio, al igual que el acuerdo que es confirmatorio del anterior, al decidir la impugnación contra el acuerdo de dictamen favorable, que se conoció en la sesión número SO-02-2017 de fecha 08 de febrero de 2017 y que es imposible que pretensiones contra actos preparatorios puedan ser acogidos por el Tribunal.
Igualmente, respecto de la pretensión de nulidad del Certificado de Liberación al Ambiente otorgado a Bayer, S. A. para la liberación de plantas de algodón COT102 (SYN-IR102-7), no puede impugnarse porque es un simple documento, pero que no es el acto administrativo final. Que la liberación al ambiente se dio en noviembre de 2017 y que, por tanto, hay una falta de interés actual en anular ese certificado de liberación. Que debe tenerse presente que el acto administrativo final, es la resolución administrativa 001-2017 UOGM de las 14:05 horas del 10 de mayo de 2017 de la Unidad de Organismos Genéticamente Modificados en este proceso y que no se puede ampliar las pretensiones en la audiencia preliminar (voto número 900-F-S1-2011 de las 09:15 horas del 11 de agosto de 2011 de la Sala Primera de la Corte Suprema de Justicia). Que las pretensiones 4 y 5 son absurdas, porque lo que hacen es pedir que se cumpla con lo que la ley determina como finalidad de actuación de la CTNBio y el Servicio Fitosanitario del Estado, que es que actúen conforme a derecho.
Asimismo, establece que la afirmación de que todos los miembros de la Comisión no tuvieron la información suficiente para votar, es una apreciación subjetiva de los integrantes García González y Pacheco Rodríguez. Que los miembros que consideraban que necesitaban más información la solicitaron. Que la solicitud de información reiterativa del señor García González no explicó ni justificó la necesidad de dicha información, cuando por ejemplo pedía información de la hoja de vida del representante técnico de Bayer, S. A. o aclarar si el lote donde se iba a liberar era propio o alquilado, lo que no era información ni pertinente, ni útil para valorar el riesgo del evento. Sin embargo, al resolverse el recurso de revocatoria se le explicó de manera razonada, detallada y amplia todos y cada uno de los cuestionamientos alegados en dicho recurso. Que todas las solicitudes de información sí le fueron atendidas.
Que el hecho de que el Dr. García González consideró omisa u oscura la información era una valoración subjetiva y muy personal y no significa que objetivamente, no se hubieran tenido los elementos necesarios para otorgar el dictamen favorable por parte de los demás miembros de la CTNBio. Que el dictamen fue votado favorablemente con el quorum y requisitos exigidos por ley, según lo establecido en el artículo 112 y 115 del Decreto número 26921-MAG. Que la publicación del edicto se dio de manera suficiente, que la persona puede apersonarse ante el Servicio Fitosanitario del Estado a hacer observaciones o solicitar información de interés público (voto número 2017-0001110 de las 09:05 horas del 25 de enero de 2017 de la Sala Constitucional de la Corte Suprema de Justicia). Que, además, una vez emitido el certificado de liberación al ambiente se publicó otro edicto para que las personas interesadas pudieran apersonarse y presentar los recursos de revocatoria o apelación que consideraran pertinentes.
Que revisado el expediente administrativo se puede determinar que el Certificado de Liberación al Ambiente se dio dentro del marco legal nacional e internacional, sin que se hubiera desaplicado el principio precautorio (voto número 2006-17747 de las 14:37 horas del 11 de diciembre de 2006 de la Sala Constitucional de la Corte Suprema de Justicia); d. BASF de Costa Rica, S. A.: Que la totalidad de la información necesaria para la solicitud de Certificado de Liberación al Ambiente se encontraba en el sistema digital desde el día 10 de agosto de 2015 y que el tipo y cantidad de información adicional solicitada por Pacheco es abusiva, desproporcionada e innecesaria y no está acorde con la normativa nacional e internacional. Que no había ninguna información faltante en el expediente BIO-02-2015-150, según lo argumentaba el señor García, lo que se corrobora en el documento sin número de fecha 31 de agosto de 2015, firmado digitalmente por Nelly Mora Molina, funcionaria del Servicio Fitosanitario del Estado.
Que no es procedente desde un punto de vista jurídico entender exigibles los mismos elementos sustanciales y formales de los actos administrativos declarativos con efecto propio a los meros actos preparatorios, lo que hace que tratar de contrastar el contenido de tales actos preparatorios con los actos de decisión, es un “ejercicio inútil e inconducente”. Que, según se determinó en el peritaje de parte de la señora Marta Fermina Valdés, las solicitudes de información del señor García no está vinculada a estimaciones de los niveles de riesgo, que bien pueden estimarse con la información presentada por la empresa ante la CTNB (ver imagen 561 del expediente judicial virtual). Por último, manifiesta que no hay nulidad de la resolución número 001-2017 UOGM que otorgó la liberación al ambiente del algodón COT102, que el dictamen fue positivo por abrumadora mayoría y que “Tan solo dos de los integrantes, dada su manifiesta oposición ideológica a los OVMs, recomendó el rechazo del CLA (…) rechazos que no poseen sustento técnico o científico, como se ha visto” y pide que se rechace la demanda y se condene en costas (ver imágenes 494 a 528 del expediente judicial virtual).
SOBRE EL OBJETO DEL PROCESO: Sobre la base de lo establecido por las partes en sus argumentos, se tiene claridad de que el objeto de este proceso se orienta a determinar si existe nulidad del dictamen afirmativo de la Comisión Técnica Nacional de Bioseguridad para la liberación al ambiente del algodón COT102 solicitado por Bayer, S. A., por los aspectos formales tales como la falta de información acusada por los miembros Jaime García González y Francisco Pacheco Rodríguez que viciaría los elementos del dictamen como motivo, contenido y fin, que si los miembros de la Comisión hubieran tenido esa información a la mano el resultado del dictamen hubiera sido distinto, que el edicto del año 2015 no explicó las consecuencias o impactos de la siembra del transgénico lo que afectó la publicidad y eventualmente, hizo que no se presentaran objeciones del público y por defecto en la votación del dictamen en la sesión SO-02-2016 del 14 de diciembre de 2016, todo ello como elemento de nulidad de la resolución administrativa 001-2017 UOGM que otorgó la liberación al ambiente.
En este sentido, se considera oportuno aclarar que la literalidad de la pretensión, establece que “3°. - Certificado de Liberación al Ambiente otorgado a Bayer S. A., para la importación, movilización y/o liberación de la línea de plantas de algodón COT102 (SYN-IR102-Y), publicado en la Gaceta 98 del 25 de mayo de 2017, cedido a BASF de Costa Rica, S. A.”, con lo cual, al aludirse a la publicación del edicto en el Diario Oficial La Gaceta del 25 de mayo de 2017 y en esa publicación aludirse a la resolución 001-2017 UOGM, entonces, en virtud de la aplicación del derecho fundamental de acceso a la justicia, este Tribunal interpreta que se está atacando, no el documento material denominado “Certificado de Liberación al Ambiente”, sino que se está pidiendo con ello la nulidad del acto administrativo que, formalmente, otorgó la liberación al ambiente, tanto así que en sus alegaciones, establece que “la Resolución 001-2017UOGM, tuvo como motivo el DICTAMEN VINCULANTE FAVORABLE emitido por la CTNBio en acuerdo N°1 del artículo V de la sesión ordinaria SO-02-2015, dictamen que, por lo explicado en el hecho 24, adolece de debida fundamentación por ausencia de motivo válido, ya que no se siguió el debido proceso para su adopción, ni se fundamentó en la verdad real de los hechos al faltar, al momento de emitirse, información técnica requerida en el formulario BIO-02, así como información adicional solicitada por miembros de la CTNBio, lo cual de conformidad con el artículo 133 de la Ley General de la Administración Pública, en adelante LGAP, en relación con los artículos 214 y siguientes ibidem, hace que ese dictamen y la resolución 001-2017 UOGM, se encuentren viciados de nulidad absoluta” (ver imagen 134 del expediente judicial virtual).
SOBRE LA COMPETENCIA DE LA CTNBio EN LA APROBACIÓN DEL CERTIFICADO DE LIBERACIÓN AL AMBIENTE DE ORGANISMOS GENÉTICAMENTE MANIPULADOS: De conformidad con la Ley Fitosanitaria del Estado y su reglamento, es competencia de la Comisión Técnica Nacional de Biodiversidad (CTNBio) emitir un dictamen vinculante para decidir el registro, permisos de organismos genéticamente modificados que cualquier persona proponga importar, exportar, experimentar, movilizar, liberar al ambiente, multiplicar, comercializar y usar para investigación organismos genéticamente modificados en materia agropecuaria (artículo 46 de la Ley de Biodiversidad). Esta Comisión es un órgano técnico científico, integrado por el Ministerio de Agricultura y Ganadería, El Servicio Fitosanitario del Estado (quien la presidirá), el Servicio Nacional de Salud Animal, la Oficina Nacional de Semillas, el Ministerio de Ambiente y Energía, el Ministerio de Salud, la Academia Nacional de Ciencias, la Federación para la Conservación de la Naturaleza, la Cámara Nacional de Agricultura y Agroindustria (artículo 112 del Decreto 26921-MAG).
Tiene una función asesora para con el Servicio Fitosanitario del Estado en materia de biotecnología (artículo 40 de la Ley de Biodiversidad). Por su propia naturaleza dictaminadora como órgano técnico científico, la dinámica de su funcionamiento implica que cada uno de los miembros rinde valoración técnica respecto de la solicitud de, para el caso que nos ocupa, liberación al ambiente de un organismo transgénico. De conformidad con lo establecido en los artículos 112 y 115 del decreto 26921-MAG, la Comisión sesionará válidamente con la mitad más uno de sus miembros y ese mismo será el quórum para tomar acuerdos válidamente, de ahí que si son nueve miembros, entonces, el quórum válido para sesionar será de 5 miembros y será ese mismo número de votos los necesarios para tener por adoptados los acuerdos de forma válida.
SOBRE LA NATURALEZA JURÍDICA DEL DICTAMEN EMITIDO POR LA COMISIÓN TÉCNICA NACIONAL DE BIOSEGURIDAD (CTNBio): Claramente debe entenderse que el dictamen que emite la CTNBio, en términos de derecho administrativo, es un acto preparatorio que puede servir de base para un acto administrativo posterior, como lo es la decisión que respecto de la solicitud de liberación al ambiente del algodón COT-102 debe emitir el Servicio Fitosanitario del Estado como órgano determinativo en ese campo, por lo que hay que aclarar que, entonces, por propia definición, al dictamen como acto preparatorio no le son exigibles los elementos o requisitos de validez del acto administrativo, así se ha dicho: “Consecuentemente, los dictámenes, pericias, informes, pareceres, proyectos, etc., no constituyen actos administrativos sino actos preparatorios (también denominados de trámite) o simples actos de la Administración, que se dictan para hacer posible el acto principal y final.
Este tipo de actos tienen un efecto indirecto o mediato, así, por ejemplo, el informe puede dar origen a una sanción disciplinaria y el dictamen puede provocar otro acto. Se desprende de lo anterior, que los denominados “actos preparatorios” quedan excluidos, en tesis de principio, de la noción de acto administrativo” (JINESTA LOBO, Ernesto. Tratado de Derecho Administrativo, Tomo I. Biblioteca Jurídica Diké. San José, Costa Rica, año 2002, páginas 299 y 300). Así las cosas, será el acto administrativo sobre liberación al ambiente al que se le puede realizar el análisis de los elementos propios de un acto administrativo, dentro de los que se resalta acá los dichos por la parte actora en sus alegatos, como son el motivo, contenido y fin, es decir, los elementos sustantivos del acto. Empero, a un acto preparatorio como lo es el dictamen que emite la CTNBio no es propio exigirle formalmente esos elementos propios de un acto administrativo, cuando más bien, ese acto preparatorio será parte del motivo del acto administrativo determinativo del Servicio Fitosanitario del Estado, entonces, ¿cómo se puede medir la validez del dictamen emitido?
Para responder a esa pregunta y sobre la base de la normativa citada supra, es importante determinar que la validez del dictamen debe estar orientada por la valoración de que se emita el dictamen en el área de su competencia, que para el caso de órganos colegiados se haya respetado el quórum necesario para su emisión y que esté justificado, siendo ya el tema de la valoración de fondo que realiza, tema de análisis por parte del órgano receptor de ese dictamen a la hora de tomarlo en consideración para la emisión del acto administrativo formal de que se trate.
SOBRE LA VÁLIDEZ DEL DICTAMEN DE LA CTNBIO ADOPTADO EN LA SESIÓN NÚMERO SO-02-2016 DEL 14 DE DICIEMBRE DE 2016 Y CONFIRMADO EN EL ARTÍCULO V DE LA SESIÓN SO-02-207 DE FECHA 08 DE FEBRERO DE 2017: los argumentos de invalidez del acto de liberación al ambiente establecidos por la parte actora, giran en torno a que esa resolución administrativa 001-2017 UOGM de las 14:05 horas del 10 de mayo de 2017 de Servicio Fitosanitario del Estado, es nula porque como parte esencial de su motivación posee el dictamen favorable de la CTNBio que, según el criterio de los actores, deviene en nulo por falta de fundamentación, violación del procedimiento para su emisión con la publicación omisa del edicto y el defecto en el quórum de la votación, por lo que en este considerando, se valorarán cada uno de esos argumentos, veamos: A) Sobre la alegada falta de información y en consecuencia, indebida fundamentación del dictamen favorable: se alega por la parte actora que al momento de tomar la decisión por parte de la CTNBio hubo información faltante exigible en el formulario BIO-02 de la solicitud de Bayer, S. A. y que junto con eso, se hicieron requerimientos adicionales de información por parte de los miembros representantes del sector ecologista, en su oportunidad, integrantes de esa comisión técnica como son Fabián Pacheco Rodríguez y Jaime García González.
En este sentido, es importante establecer que estamos frente a la actuación de un órgano colegiado integrado por diversos representantes de sectores y que cada uno reviste un carácter de especialista en una ciencia determinada y así, en el ejercicio propio de su representación, cada persona integrante puede observar el contenido de la solicitud y desde su perspectiva profesional, considerar que necesita más información, para luego, tomar una decisión respecto de si apoya o no la solicitud de liberación al ambiente de un organismo genéticamente modificado. Es así como, de las actas de las sesiones de la Comisión, se desprende que el resto de miembros de la CTNBio tenían pleno conocimiento de la información y las objeciones que respecto de ella planteaban a la solicitud de liberación los ingenieros Pachecho y García, pero no compartieron el criterio de que hubiera desinformación para efectos de su valoración científica experta, tanto así que en la propia acta donde se decidió emitir dictamen favorable a la solicitud, dentro de los razonamientos de los votos, se llegó a establecer que: “revisó y analizó la información (…) Conociendo la exposición de los miembros de la FECON Y LA RCB, aclarando que solo se concentraría en lo estrictamente técnico, científico, por las condiciones de Biodiversidad, considerando el Protocolo de Cartagena, y Salud Pública, Por esto vota: A FAVOR, debiendo cumplir con las condiciones dadas en el dictamen del MINAE y SFE, y agrega que debe contemplarse las condiciones de la RCB y de la FECON” (ver imagen 277 del expediente judicial virtual) y, de hecho, así fue votado el dictamen, con lo cual, no es de recibo el argumento de que la Comisión decidió sin conocer las objeciones sobre una supuesta falta de información y que entonces, su voto fue desinformado, a modo de vicio en el consentimiento de sus miembros, cuando más bien, lo que debe interpretarse conforme a Derecho, es que como miembros independientes en su valoración, cada uno de los integrantes tiene un criterio experto propio con lo cual, se valoró la información disponible y solo los dos miembros de esa comisión antes indicados (Pacheco y García), no estuvieron satisfechos con la información.
De hecho, la dinámica implicaba que, para los efectos de su valoración científica individual, los miembros podían solicitar más información y aclaraciones, para luego, a la luz de esa nueva información que se les entregara o no, cada miembro debía decidir su voto de manera justificada, pero no como aspecto individual, sino como una solicitud oficial de la Comisión, respecto de la cual la empresa solicitante como administrada, tenía derecho a que fuera una petición consolidada de información por una sola vez. En el expediente constan solicitudes de información y sus respectivas respuestas (ver documentos que constan en el Disco 3 del expediente administrativo identificados como “ii. Correos de Respuesta a Jaime García 18 de noviembre de 2016” y “ii Solicitud de información de Jaime García 18 de noviembre de 2016”), documentación que además, debía constar en el expediente de la solicitud de liberación al ambiente y así, ser de conocimiento del resto de los integrantes. a.1- Oportunidad para solicitar información: Llegados a este punto, es importante establecer que el ejercicio de requerimientos informativos no puede ser ad infinitum, sino que de forma mesurada y razonable, se ha de pedir aclaraciones o información adicional para que, llegado un momento, con lo que se haya tenido a la vista, cada uno de los integrantes de la Comisión pueda determinar si apoya o rechaza la solicitud de información, pero no podría admitirse que sin límite de tiempo, se pueda desarrollar una solicitud de información y nuevas solicitudes aclarativas sin término, precisamente, en virtud del principio de certeza y seguridad jurídicas.
De hecho, el artículo 118 del Decreto 26921-MAG, que norma el “Reglamento a la Ley Fitosanitaria del Estado”, establece que el requerimiento de información solo podrá darse “por una única vez” y el manejo que se debe dar a la misma, al disponer que: “Artículo 118 (…) k. Solicitud de aclaración o adición de información. Si en la etapa de análisis por parte de la UOGM, o la CTNBio en los casos que corresponda, se requiere ampliar o mejorar la información aportada por el interesado mediante el BIO-02 o BIO-06, la UOGM tiene la facultad de solicitar por escrito, por una única vez y de manera justificada, aclaraciones e información adicional a la aportada en la solicitud, siempre y cuando esta información resulte imprescindible para poder realizar el análisis de fondo de la solicitud, sin que esto implique establecer requisitos adicionales a los establecidos previamente, el interesado dispondrá de un plazo de 60 días hábiles para presentarla, que podrá prorrogarse a solicitud expresa y justificada de éste, por una única vez y por un plazo adicional igual, dicha solicitud debe presentarse dentro del plazo otorgado inicialmente.
Vencido el plazo otorgado para la adición o aclaración y si el interesado no presentó ante la UOGM la información o aclaraciones requeridas, se podrá declarar sin lugar el trámite y se procede a su archivo, acto que debe comunicársele al interesado mediante resolución administrativa a través del medio de comunicación señalado en la solicitud. Contra el acto de la resolución administrativa caben los recursos ordinarios de revocatoria y de apelación, de acuerdo con lo establecido en el artículo 254 de este Reglamento. Una vez recibida la información en tiempo y forma, la CTNBio dispondrá de un plazo adicional de 30 días naturales para emitir su dictamen técnico - científico favorable o desfavorable a la solicitud. En caso de que sea requerida información adicional a la persona interesada, se suspenderá el plazo que tiene la UOGM para resolver la solicitud” (el subrayado no es del original).
De ahí que, según se dijo en juicio por parte del señor García González, la dinámica de pedir nueve veces solicitudes de información o sus aclaraciones, a la luz de la normativa supra transcrita, resulta excesiva y fuera de las facultades permitidas a los integrantes de ese órgano colegiado científico dictaminador, adicional al hecho de no tenerse claridad acerca de la justificación de lo solicitado respecto de la competencia exclusiva de la Comisión. Es importante no confundir aquí que, pareciera que en la práctica, la Comisión simplemente traslada las solicitudes o inquietudes informativas de los miembros a la empresa solicitante, cuando más bien, la normativa vigente a lo que obliga es a que sea la Comisión la que realice una solicitud informativa oficial como órgano colegiado, en ese sentido queda claro que lo dicho por la testigo-perito Valdéz Melara en el sentido de que no es que la Comisión decide si procede o no la solicitud de información de un miembro, sino que “es que se hace” (ver respuesta de la testigo-perito Valdéz Melara a una pregunta de este Tribunal que consta en la videograbación de juicio oral y público del día 06 de junio de 2025 que se encuentra en el expediente virtual) es claro que es un criterio de la señora Valdéz Melara en lo personal, pero sobre un aspecto jurídico del que, obviamente, la científica genetista no es experta y por tanto, habla desde una experiencia empírica, pero no desde el conocimiento jurídico objetivo de cómo debe ser el procedimiento correcto de atención para las solicitudes de información a los administrados solicitantes de un evento de liberación al ambiente de un producto transgénico; a.2- El interés de la información por parte de sus solicitantes: Asimismo, dentro del juicio oral y público, de forma directa los señores Pachecho Rodríguez y García González, a su vez, aclararon que tienen relación e interés directo con las actoras por formar parte de los grupos ecológicos o de protección al ambiente, también se llegó a establecer en juicio que planteaban solicitudes de información porque les interesaba valorar el fenómeno de liberación al ambiente de manera integral, de forma tal que cubrían aspectos que ya serían propios de valorar en una etapa posterior de la ejecución de liberación al ambiente in situ y no de la etapa de decisión de si se autorizaba la liberación al ambiente, así lo determinó el señor García González en su declaración al establecer que la información solicitada sí tenía que ver con la etapa de bioseguridad de la ejecución material en sitio de la liberación al ambiente del algodón transgénico y a su vez, reconoció que las objeciones u observaciones que hacía para esa etapa, se recogían en el reverso del documento material de liberación al ambiente (ver respuesta del señor Jaime García González a las preguntas del Tribunal que emitió en su declaración en juicio el día 05 de junio de 2025 cuya videograbación consta en el escritorio virtual).
Igualmente, en su declaración testimonial, el señor Pacheco Rodríguez, como parte de esos elementos que aprecia esta Cámara respecto de la objetividad de su actuación, llegó a manifestar que no compartía el “modelo de apropiación corporativa de la vida”, por los derechos monopólicos de esos agentes modificados que hacían ver a los campesinos como delincuentes (ver declaración en juicio oral y público, en respuesta a una de las preguntas de la Asociación Red de Coordinación de Biodiversidad del señor Pacheco Rodríguez), lo que pareciera mostrar una posición ideológica y no meramente científica en sus apreciaciones respecto de la solicitud de liberación al ambiente y bajo ese tamiz, con la reserva del caso, valora la solicitud, por lo cual, se observa un sesgo a la hora de separar los temas y filtrar la información estrictamente necesaria para dictaminar la liberación al ambiente y no extenderse a otras etapas posteriores como la puesta en ejecución material de la liberación o valorar el eventual consumo humano, cuando solo se ha pedido autorización para multiplicar semilla e importarla a otro país.
Empero, es importante establecer que, igualmente, aunque fuera para una etapa posterior de la ejecución material o gestión de riesgos en sitio, que es propio de la etapa de auditoraje en biodiversidad y no competencia de lo que debe decidir la CTNBio, el señor Pacheco Rodríguez manifestaba su interés en que se hicieran estudios de ráfagas de viento, es decir, se determinara hacia dónde iba la pluma de viento y si no había afectación a las abejas, lo que, fue incluido en su momento en los condicionamientos dentro del certificado de liberación al ambiente para efectos de la etapa de ejecución material de la misma, a controlarse por parte del auditoraje en bioseguridad. En el mismo sentido, el señor Jaime García González admitió en juicio ser el autor de un artículo denominado “Treinta razones contra los cultivos transgénicos en Costa Rica”, con lo cual, de base, pareciera sostener una posición contraria a la introducción o liberación de organismos genéticamente modificados (ver respuesta a la pregunta planteada por la empresa BASF de Costa Rica, S. A., que consta en la videograbación del juicio oral y público, en la audiencia del día 05 de junio de 2025), lo cual se plasma en su declaración, donde argumenta su preocupación respecto de las consecuencias para la salud humana o animal, aunque el objeto de la liberación al ambiente, según fue solicitado, fuera únicamente para multiplicar semilla y regresarla a su país de origen y no para desarrollar productos para el consumo humano en Costa Rica, tanto así que hasta se incluyó dentro de los estudios obligatorios por realizar para la etapa de ejecución el estudio de la germinación de la semilla en el tracto digestivo del zanate, tal como consta en el documento de certificado de liberación al ambiente; a.3- La valoración de la CTNBio respecto de esas solicitudes de información en el caso concreto: Según la prueba allegada a los autos, la dinámica usada en este caso, fue que la Presidencia de la CTNBio, lo que hacía era trasladar la solicitud de información de los miembros de la Comisión a la entidad solicitante, pero no adoptaba una posición oficial por parte de la CTNBio, cuando según la norma, lo que debía hacerse era recolectar las inquietudes de información de los miembros, valorarlas y decidir, si había justificación de lo imprescindible para el objeto de la comisión y acordar, formalmente, una solicitud de información única a la empresa que solicitaba la liberación al ambiente, de forma tal que oficialmente y per se, la Comisión hiciera un requerimiento de información a la empresa solicitante justificando debidamente la solicitud respecto de su pertinencia y lo imprescindible de los datos solicitados, lo que también se apartaba del procedimiento normativamente regulado y así, con mayor razón, se observa que esas solicitudes de información a que aluden los señores Pacheco Rodríguez y García González, no podrían reputarse como una solicitud oficial de la Comisión y tampoco, viciaban el consentimiento del resto de los integrantes de ese órgano colegiado para emitir su dictamen científico favorable o desfavorable en el caso concreto.
En consecuencia, el hecho de que la minoría de los miembros de la comisión, no estuvieran de acuerdo con la información brindada o consideraran que no estaba completa, no hace que se viciara la voluntad de la Comisión, cuando en su mayoría, con la información con que contaban, consideraron que tenían los elementos necesarios para tomar una decisión respecto de la solicitud y no hubo un acuerdo formal de Comisión que, oficialmente, estableciera la incompletez de la información requerida para sustentar la aprobación respectiva. B) Que la publicación del edicto hecha en el año 2015 publicitando la solicitud de liberación al ambiente de la empresa Bayer, S. A., no explicaba los posibles riesgos del transgénico y que eso pudo impedir las objeciones del público: Frente a esta argumentación, hay que establecer que, según el bloque de legalidad aplicable, la etapa de publicación del edicto para dar a conocer la solicitud y sus eventuales riesgos, es una etapa anterior a la competencia de la Comisión, toda vez que está regulado en el mismo artículo 118 del Decreto 26921-MAG, al decir que: “e.
Comunicación y consulta pública de las solicitudes de uso de un OVM. Completado el proceso de admisibilidad de la documentación, la UOGM identificará las solicitudes de uso de eventos de transformación individuales que con anterioridad no han recibido un CLA, así como las solicitudes de uso de eventos de transformación individuales que con anterioridad han recibido un CLA favorable pero que no han tenido un historial de uso en el medio receptor propuesto, o las solicitudes de uso de apilados que presentan interacciones significativas entre las combinaciones nuevas de material genético de sus componentes individuales, para tales casos, la UOGM procederá a comunicar a la sociedad civil la información de interés público, mediante la publicación de un edicto en el Diario Oficial La Gaceta, así como en el sitio web oficial del SFE en la sección de Consulta Pública, brindando un plazo prudencial de 10 días hábiles para presentar ante la UOGM la posición de las partes interesadas con fundamento técnico y científico sobre el proceso de autorización del uso del OVM. f. Valoración técnica del posible medio receptor.
Completado el proceso de admisibilidad, o el de comunicación y consulta pública para los casos que corresponda, la UOGM dispondrá de 45 días naturales para realizar la valoración técnica del posible medio receptor, se deben tomar en cuenta las posiciones con fundamento técnico y científico de las partes interesadas que se manifestaron en la consulta pública sobre el proceso de autorización del uso del OVM, y con fundamento en los criterios técnicos establecidos por la UOGM para tal fin, se emitirá un informe de los resultados de la valoración técnica. g. Procedimiento simplificado para las solicitudes de uso de eventos de transformaciones individuales que cuentan con historial de uso previo en el país. Completado el proceso de valoración técnica del posible medio receptor, la UOGM identificará las solicitudes de uso de eventos de transformación individuales que con anterioridad han recibido un CLA, para estos casos, la UOGM resolverá la solicitud en un plazo máximo de 45 días naturales con base al o los dictámenes anteriores, así como en la valoración técnica de las condiciones del posible medio receptor, con lo cual se establecerán las medidas de bioseguridad más restrictivas según los criterios disponibles.
El resultado de la solicitud debe comunicársele al interesado, mediante resolución administrativa a través del medio de comunicación que este haya señalado en la solicitud. Para los casos en que el objetivo o propósito previsto para el uso del OVM objeto de la solicitud sea diferente a los autorizados previamente, la UOGM podrá someter la solicitud a revisión por parte de la CTNBio y, en este caso, contar con su dictamen favorable para el otorgamiento del respectivo CLA” (el subrayado no es del original), por lo que queda claro que el tema de la valoración del contenido del edicto, es resorte del Servicio Fitosanitario del Estado y por eso, no vicia de ninguna forma la actuación de la CTNBio. Ahora bien, como se alega la nulidad del acto final que decide conceder el certificado de liberación al ambiente por parte de la Unidad de Organismos Genéticamente Modificados, es importante establecer que en criterio de este Despacho, el edicto emitido y que se muestra a imagen 336 del expediente judicial virtual, es claro en informar de la solicitud de liberación al ambiente de algodón genéticamente modificado planteada del plazo para presentar objeciones y del lugar ante el cual puede plantearse tales objeciones, con lo que, en esencia, cumple con el objetivo de la publicación y que, tal y como se ha argumentado por el Estado, con la publicación del edicto una vez aprobada la liberación al ambiente, de fecha 25 de mayo de 2017 que se encuentra en imagen 91 del Tomo V del expediente administrativo, donde se expone los posibles riesgos del producto y se dio espacio para recurrir la decisión, se cumple de manera sustancial con la adecuada publicidad y espacio público de objeciones, lo que, por el fondo, no viciaría el acto, máxime cuando no consta en el expediente que, efectivamente, se haya presentado alguna objeción o recurso al respecto; C) Sobre la supuesta votación irregular de la Comisión al momento de conocer la dictaminación de la solicitud de liberación al ambiente de algodón transgénico planteada por la empresa BAYER, S. A.: se alega por la parte actora, que hubo un vicio en la votación del acuerdo favorable la solicitud de liberación al ambiente del algodón COT102, porque: “Después de emitir su voto en forma verbal, y sin esperar, el resultado final, así como tampoco el acto de votación, Patricia Madrigal y Bernardo Jaén abandonaron la sesión, por lo que al momento de tomarse el acuerdo, solo estaban presentes siete de los 12 miembros que integran la CTNBio, de los cuales dos emitieron dictamen negativo, por lo que debieron registrarse cinco votos a favor y dos en contra, pero en el acta se indica, que el resultado de la votación fue de siete votos a favor, y dos en contra, lo cual no es cierto, ya que dos integrantes no participaron durante todo el análisis y discusión de ese dictamen, y también se indica que con resultado de siete a favor y dos en contra, se declaró ese acuerdo firme, cuando solo cinco miembros presentes estuvieron de acuerdo en declararlo firme” (ver imagen 64 del expediente judicial virtual).
Frente a esta afirmación, debe tenerse presente que el día 14 de diciembre de 2016, se recibieron los dictámenes favorables para la liberación al ambiente del algodón COT-102 de las siguientes personas o entidades: Alejandra Chaverri Esquivel, representante del Ministerio de Salud (ver imágenes 121 y 122 del Tomo III del expediente administrativo); Bernardo Jaén Hernández, representante del Servicio Nacional de Salud Animal (SENASA) con las observaciones de que se disponga de “medidas de aislamiento físico de 5 kilómetros a la redonda entre el lugar de siembra del OGM y la ubicación de un apiario” y “Disponer de acceso restringido a personal autorizado en la zona de siembra” (ver imagen 127 del Tomo III del expediente administrativo); Patricia Madrigal Cordero, Viceministra del Ministerio de Ambiente y Energía (MINAE) y la Bióloga Melania Muñoz García, con varias aclaraciones (ver imágenes 1 a 10 del Tomo III del expediente administrativo); Federico Torres Carballo, en representación del Ministerio de Ciencia, Tecnología y Telecomunicaciones (MICITT) (ver imágenes 113 a 116 del Tomo III del expediente administrativo), es decir, por la propia naturaleza científica de las posiciones que debe absolver cada uno de los integrantes, se nota que primero emiten el criterio favorable o desfavorable por escrito.
En el mismo sentido, se presentó un criterio negativo, rechazando la solicitud de liberación al ambiente de COT-102, por parte del señor Fabián Pacheco Rodríguez (ver imágenes 117 a 120, que se repite en imágenes 185 a 191 del Tomo III del expediente administativo) y en la sesión número SE-001-2016 de fecha 28 de noviembre de 2016, se emplazó al señor Jaime García al acordarse “1) Otorgar un plazo de 10 días hábiles para que Jaime García emita su dictamen, contados a partir del día de hoy, que se le entregará la información y consta el comprobante” (ver Acta número SE-001-2016 de fecha 28 de noviembre de 2016 que consta en el Disco 3 del expediente administrativo), sin embargo, no consta que el señor Jaime García entregara algún criterio por escrito al respecto. Ahora bien, teniendo claridad de que los integrantes de la Comisión, habían entregado sus criterios por escrito, de conformidad con la prueba allegada a los autos, especialmente el acta número SO-02-2016 del 14 de diciembre de 2016, sobre si aprobaban o rechazaban la solicitud, se abrió a votación el tema en la sesión respectiva, siendo que: “El Presidente aclara que se consignará la votación con los motivos que expongan, esto para efectos de los votos positivos y negativos, considerando que Patricia Madrigal haría pronto abandono de la sesión y razonaría su voto, que igualmente tendrán todos los miembros” y se procede a dar el razonamiento del voto, primero por parte de la señora Patricia Madrigal Cordero, quien vota a favor, luego por la señora Melania Muñoz García que vota a favor y se consigna en este momento que “PATRICIA MADRIGAL se retira a las 11:10” y luego el resto de los miembros en el siguiente orden: Marco Jiménez, Bernardo Jaén, Alejandra Chaverri, Alonso Chacón y Alex May, quienes votan a favor de la solicitud de liberación al ambiente y Fabián Pacheco y Jaime García, votan en contra y luego del voto de Jaime García, se consigna que “BERNARDO JAÉN se retira a las 12:00 m.d.” y el resultado de la votación, se consigna en el punto “2.
Votación” de este mismo artículo V, con “7 a favor y 2 en contra. Firmeza: 7 a favor y 2 en contra” (ver imágenes 276 a 279 del expediente judicial virtual). Igualmente, el señor Jaime García González, insiste en que la información está incompleta, que él las mantiene como no atendidas y que “¿cómo es posible que la empresa no pueda precisar la cantidad de material a importar?, que sea ambigua, cuando deben dar la información completa para la valoración, esas dudas razonables no permiten vota, por lo que salva la responsabilidad. Las distancias que dice, no son las dichas por la empresa. Por esto vota: EN CONTRA” y el señor Fabián Pacheco estableció que: “En vista de la votación en mayoría aparentemente a favor, debería condicionarse a la emisión de los estudios expuestos. Por esto vota: EN CONTRA Agrega que no se consdiera los 14 kilómetros de distancia entre estas actividades y los centro apícolas, e insisten que si han sido incluidos esos estudios mencionados” (ver imágenes 273 a 279 del expediente judicial virtual).
Con base en lo anterior, para esta Cámara queda claro que el acto de votación propiamente dicho, se dio en el momento en que cada uno de los miembros, además de rendir un criterio escrito, verbalmente procedía a justificar de forma directa y personal su voto, siendo que, efectivamente, según lo consignado en el acta, resultó que 7 personas votaron a favor y 2 personas votaron en contra de otorgar el Certificado de Liberación al Ambiente solicitado. Se reitera, en el acta, se consignó expresamente por parte del Presidente de la Comisión que “se consignará la votación con los motivos que expongan, esto para efectos de los votos positivos y negativos, considerando que Patricia Madrigal haría pronto abandono de la sesión y razonaría su voto, que igualmente tendrán todos los miembros”, es decir, en términos formales, fue en ese acto que se convocó a la votación formal, con lo que debe interpretarse, que lo establecido en ese punto 2 de Votación del articulo V, es únicamente la consignación del resultado del conteo formal, pero la votación, según se explicó por el Presidente de la Comisión, se dio en el acto de esa justificación verbal y todavía aclaraba que luego de votar, por lo que se observa que se dio una votación donde de forma indubitable, pudo constatarse las razones científicas por las cuales cada integrante votaba a favor o en contra y eso, sustancialmente, es un acto de votación que debe reconocerse como válido.
El hecho de que la persona que ha votado, luego del acto de emitir su voto se retirara de la sesión, no invalida su voto, el que para todo efecto legal debe ser tomado en cuenta, lo único que pasa es que esa persona que se retira, no podrá conocer de primera mano el resultado total de la votación ni podrá objetar nada al respecto en el mismo momento, si lo considerara necesario. Es importante también hacer notar lo dicho en juicio por el señor Fabián Pacheco Rodríguez, ante preguntas hechas por la Red de Coordinación en Biodiversidad, quien manifestó que hubo “desorden en la votación” (puede consultarse la videograbación de la audiencia de juicio oral y público del día 05 de junio de 2025 que consta en el escritorio virtual) y el señor Jaime García González, en respuesta a preguntas planteadas por la Red de Coordinación de Biodiversidad, manifestó que “dos personas dieron su voto y se fueron sin haber terminado la discusión” (puede consultarse la videograbación de la audiencia de juicio oral y público del día 05 de junio de 2025 que consta en el escritorio virtual), frente a lo cual para este Tribunal es importante valorar que si bien es cierto, fueron dos personas que estuvieron presentes el día de la votación del acuerdo, en realidad, ofrecen una visión no jurídica de la situación que se presentó en la sesión referida, que en nada desvirtúa la calificación jurídica que debe darse a lo sucedido, puesto que la votación, es cabalmente eso: una votación donde cada uno de los expertos, justificando técnicamente su criterio, otorga su voto favorable o desfavorable a la solicitud, pero no es un momento de discusión o análisis, o de ataque al voto de otro integrante.
De ahí que, entonces, el acto de votación se dio de manera adecuada y conforme a Derecho. En otro orden de ideas, se alega por parte de las asociaciones actoras y se critica por parte del señor García González que en esa misma sesión se declarara un acto firme el acuerdo respecto de la dictaminación favorable para la liberación al ambiente del COT102, pero esta Cámara observa que no fue ese el efecto jurídico real, porque el acta se impugnó por parte del señor García González y fue hasta que se superaron las etapas de impugnación, que en el artículo V de la sesión SO-02-2017 de fecha 08 de febrero de 2017 de la CTNBio, se decidió: rechazar la impugnación planteada y confirmar el Dictamen Técnico Favorable y en el artículo VI de esa misma sesión SO-02-2017, aprobar el acta número SO-02-2016 (ver imágenes 404 a 420 del expediente judicial virtual), con lo cual, no fue sino hasta esa fecha que el dictamen de liberación se tuvo por firme en el nivel administrativo, es decir, hasta esa fecha fue que se tuvo firme y eficaz, lo se refuerza con el hecho de que la resolución que constituye el acto administrativo final o determinativo que concede la liberación al ambiente por parte de la Unidad de Organismos Genéticamente Modificados del Servicio Fitosanitario del Estado, se emite hasta en fecha 10 de mayo de 2017, incluyendo dentro de sus consideraciones, el dictamen favorable, pero todo ello, hasta que por la sesión SO-02-2017 del 08 de febrero de 2017, la CTNBio, rechaza las impugnaciones planteadas, confirma el dictamen técnico favorable del 14 de diciembre de 2016 y da por agotada la vía recursiva, con lo cual, queda claro que el dictamen emitido el 14 de diciembre de 2016, no adquirió firmeza ni surtió efectos, sino hasta el momento en que se agotaron los recursos respectivos, por lo cual, igualmente, de manera sustancial, el acuerdo debe entenderse válido.
OTRAS ARGUMENTACIONES DE INVALIDEZ: Se hará alusión aquí, a otras argumentaciones no centrales que se plantearon y con las que la parte actora, también atacaba la validez del dictamen favorable de la CTNBio. A) Que era un apilado y que debía tratarse con un procedimiento distinto como varios eventos a la vez y no como uno solo: este argumento de la parte actora se desprende del hecho primero de la demanda, al establecer que: “LA SOLICITANTE, presentó en el “Formato BIO-02” del sistema digital de información de organismos vivos (…) la solicitud de CERTIFICACIÓN DE LIBERACIÓN AL AMBIENTE (…) con el fin de ser importado como un apilamiento con los eventos GlyTol y TwinLink (…)” (ver imagen 3 del expediente judicial virtual) e incluso, en el desarrollo de la audiencia de juicio, se hablaba de la existencia de un apilamiento en la solicitud y que no debía tratarse como un solo evento, lo que en opinión de la parte actora viciaría el procedimiento seguido para conceder la autorización.
Sin embargo, de conformidad con la normativa vigente, quedó claro que la competencia para decidir cómo se calificaba el hecho si como un conjunto de eventos o uno solo para efectos de someter a conocimiento de la CTNBio le correspondía al Servicio Fitosanitario del Estado, al decir del Decreto 26921-MAG, en su artículo 118, que: “(…) g. Procedimiento simplificado para las solicitudes de uso de eventos de transformaciones individuales que cuentan con historial de uso previo en el país. Completado el proceso de valoración técnica del posible medio receptor, la UOGM identificará las solicitudes de uso de eventos de transformación individuales que con anterioridad han recibido un CLA, para estos casos, la UOGM resolverá la solicitud en un plazo máximo de 45 días naturales con base al o los dictámenes anteriores, así como en la valoración técnica de las condiciones del posible medio receptor, con lo cual se establecerán las medidas de bioseguridad más restrictivas según los criterios disponibles.
El resultado de la solicitud debe comunicársele al interesado, mediante resolución administrativa a través del medio de comunicación que este haya señalado en la solicitud. Para los casos en que el objetivo o propósito previsto para el uso del OVM objeto de la solicitud sea diferente a los autorizados previamente, la UOGM podrá someter la solicitud a revisión por parte de la CTNBio y, en este caso, contar con su dictamen favorable para el otorgamiento del respectivo CLA”, con lo cual, queda claro que es competencia del Servicio Fitosanitario del Estado, valorar esa situación y una vez que lo haya definido, para lo que corresponda, lo someterá a conocimiento de la CTNBio según lo que previamente y bajo su exclusiva responsabilidad, haya determinado, así que este aspecto no puede, en ese sentido, invalidar lo actuado por dicha Comisión para el ejercicio del análisis del caso que se le haya sometido a su conocimiento, siendo que, a mayor abundamiento, es importante establecer que en este proceso, la parte actora claramente manifestó que no entraría en temas técnicos de fondo y de lo indagado en el juicio oral y público, quedó claro que es un tema sujeto a discusión científica, toda vez que los testigos peritos Pacheco y García, en sus declaraciones, hablaban de que el COT102 implicaba un apilamiento, mientras que la testigo-perito Valdéz Melara (ver declaración en juicio rendida el día 06 de junio de 2025 en respuesta a las preguntas planteadas por el coadyuvante Juan Diego Quirós que consta en la videograbación de la audiencia y que se encuentra en el expediente virtual), decía que en ese caso no había un apilado molecular, infiriéndose entonces por este Tribunal, que no hay consenso sobre el tema y así, no existiendo un criterio convencionalmente aceptado, no puede tomarse como un vicio en el procedimiento o la tramitación.
Si otra era la realidad, no solo bastaba con ofrecer criterios testimoniales del señor Pacheco y Rodríguez, sino que debió introducirse la discusión técnica por el fondo del asunto y demostrarse con prueba científica objetiva con base en estudios específicos para el caso concreto, que de manera inobjetable, debía dársele el tratamiento de un conjunto de eventos apilados, tema que la parte actora no trajo a discusión en esta litis para ser debatido ni tampoco demostró según el deber de carga de la prueba u onus probandi que le era exigible de conformidad con lo establecido en el artículo 41.1 del Código Procesal Civil en relación con el artículo 220 del Código Procesal Contencioso Administrativo. A mayor abundamiento, es importante aclarar que el argumento de la Asociación Comunidades Ecologistas de La Ceiba Amigos de la Tierra Costa Rica, en el sentido de que el correo electrónico de fecha 22 de enero de 2018, de José Maynor Monge Villalobos y dirigido al señor Jaime García, que consta en el Disco 3 del expediente administrativo, no se desprende que la solicitud de Bayer, S. A. como evento, se sembrara de forma individual, sino que refiere que se había sembrado ya como evento apilado con otros eventos, pero nótese que no dice de quién, ni cuándo y tampoco, se reitera, se ha discutido ni demostrado en este proceso de conformidad con el deber de carga de la prueba que le era exigible a la parte actora, que la solicitud del caso concreto coincidiera o versara sobre un evento apilado, bajo criterios científicos convencionalmente aceptado y más bien, de la literalidad de la primera línea del cuerpo de ese correo, se desprende que la solicitud de Bayer, S. A. es de un evento individual.
SOBRE LAS PRETENSIONES DEL PROCESO: En este apartado, se hará pronunciamiento respecto de las pretensiones formalmente planteadas, por la que se solicita que se declare la nulidad de lo siguiente: “1°. - Acuerdo tomado en el artículo V de la sesión ordinaria CTNBio N° SO-02-2016 del 14 de diciembre de 2016, que es dictamen afirmativo de la Comisión Técnica Nacional de Bioseguridad, a la solicitud de certificado de liberación al ambiente de la empresa Bayer, S. A. cedido actualmente sus derechos a la empresa BASF de Costa Rica, S. A. (demanda y pretensión ajustada en la AP del 12 de octubre de 2021); 2°. - Acuerdos tomados en el artículo V de la sesión ordinaria N° SO-02-2017 DE LA CTNBio, que da por iniciada la etapa de conocimiento y rechaza la impugnación y su ampliación, dando por agotada la vía recursiva”: entendiéndose que se impugna el dictamen favorable de la CTNBio como elmento indispensable del acto final que otorga la liberación al ambiente del COT102 y viendo que, sustancialmente, la actuación se ajustó a derecho, toda vez que la votación fue correcta y el voto fue informado, con independencia del muy respetable criterio que los dos integrantes del sector ecologista tuvieran respecto de la cantidad y la calidad de la información para efectos de su valoración científica personal, ya que claramente el órgano colegiado no compartió su visión de incompletez de la información e incluso, en la práctica, las solicitudes de información excedieron en cantidad las posibilidades jurídicas establecidas normativamente en el procedimiento, se acoge la falta de derecho y se deberán rechazar estas pretensiones; “3°. - Certificado de Liberación al Ambiente otorgado a Bayer S. A., para la importación, movilización y/o liberación de la línea de plantas de algodón COT102 (SYN-IR102-Y), publicado en la Gaceta 98 del 25 de mayo de 2017, cedido a BASF de Costa Rica, S. A.”: Si la resolución número 001-2017 UOGM, como se ha analizado se ajustó a derecho y tiene como fundamento un dictamen favorable que es plenamente válido y eficaz, no existe razón alguna para anular ese acto, con lo cual, se acoge la falta de derecho y se rechazará esta pretensión.
A mayor abundamiento, nótese que el acto es del 2017 y quedó claro que se materializó hace mucho tiempo la liberación al ambiente del organismo genéticamente modificado, sin que se hayan acreditado en el expedientes problemas o violaciones de bioseguridad por ese acto, en virtud de lo cual, para este Tribunal, esta pretensión también carece de interés actual, tal y como lo señala la representación estatal. “4.- Al Servicio Fitosanitario del Estado, no autorizar la liberación al ambiente de apilamientos de eventos que no hayan sido aprobados por la CTNBio, de conformidad con los principios la protección al ambiente y a la bioseguridad, y no en los intereses de los solicitantes de permisos de liberación al ambiente de transgénico (audiencia 12 de octubre 2021, 03:04 horas grabación); 5.- Al Servicio Fitosanitario del Estado, y la CTNBio el cumplimiento de los procedimientos y legislación, de conformidad con los principios de la ciencia y de la técnica, teniendo como prioridad la protección al ambiente y a la bioseguridad, y no en los intereses de los solicitantes de permisos de liberación al ambiente de transgénicos (organismos genéticamente modificados)”: Al respecto, debe indicarse ante todo, que sin haberse anulado ningún acto de los atacados en la demanda y siendo que solo se pide que los órganos estatales actúen conforme a derecho en el ejercicio de sus competencias, lo que es algo que se sobreentiende deben hacer, debe decirse que esto no constituye per se una pretensión procesal valorable dentro del proceso y debe rechazarse por impertinente, consecuentemente, se declara sin lugar, en todos sus extremos, la demanda intentada.
SOBRE LAS COSTAS DEL PROCESO: De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida y no encontrándose razones para apartarse de dicha regla general, se condena a la parte actora a pagar, por partes iguales, ambas costas del proceso en favor de los codemandados. Por haber sido solicitado, se conceden intereses legales sobre las sumas que se determine por concepto de costas, desde la firmeza de la resolución que las fije y hasta su efectivo pago.
POR TANTO
Se acoge la excepción de falta de derecho y parcialmente la excepción de falta de interés actual. En consecuencia, se rechaza la demanda en todos sus extremos. Son ambas costas del proceso a cargo de las accionantes, junto con sus respectivos intereses, los que correrán desde la firmeza de la resolución que las fije y hasta su efectivo pago.
