SECOND JUDICIAL CIRCUIT OF SAN JOSÉ.- At ten hours and nine minutes on veinticinco de junio de dos mil veinticinco.- ORDINARY PROCEEDING brought by [Nombre 001], of legal age, divorced, homemaker, resident of Luzón de Batan, identity card [...]; against ROLAFAMA SOCIEDAD ANÓNIMA, corporate identification number three - one hundred one - five hundred seventy-six thousand eight hundred sixty, represented by its president, Rolando Calvo Ramos, who holds powers as a general plenipotentiary without limitation as to amount, of legal age, divorced, businessman, resident of San José, identity card one - five hundred sixteen - six hundred ten, the latter also acting in his personal capacity. Judge Fisher González authors the decision; and;

WHEREAS:

I. CLAIMS

The plaintiff filed this action seeking a judgment declaring the following: «PRINCIPAL CLAIM: 1) That this action be granted in all respects, upholding this ORDINARY proceeding in all respects. 2-) That the judgment declare that the plaintiff has exercised agrarian possession (posesión agraria) for more than 11 years, quietly, publicly, uninterruptedly, peacefully, as owner, peacefully, and in good faith. 3-) That the judgment declare that the plaintiff has standing to bring this special agrarian acquisitive-prescription proceeding (prescripción positiva agraria especial) against the defendants, having demonstrated her state of necessity as a precarious occupant (estado de necesidad en precario). 4-) That the judgment declare that the portion of land in the plaintiff’s possession must be subdivided (segregar) in her favor so that it may be registered with the Property Registry as a parcel independent of the Limón parent property [Valor 002], and that if the company’s representative refuses to provide his signature, the judge assigned at the time shall sign it. 5-) That, because agrarian acquisitive prescription exists in my favor, it be declared that I have acquired by special agrarian adverse possession (usucapión agraria especial), and that the judgment on the merits order the National Property Registry to register in my name the portion claimed from property [Valor 001]. 6-) That the defendants be ordered to pay both categories of costs (ambas costas) of this proceeding once the judgment becomes final. 7-) That the defendants be prohibited from transferring, conveying, mortgaging, or otherwise encumbering the property until this matter is resolved by a judgment on the merits, with the statutory warning that, for disobedience of authority, certified copies of the relevant records may be forwarded to the Prosecutor’s Office. 7)- That the defendant be ordered to pay both categories of costs of this proceeding, and the Court is requested to set defense counsel’s fees, which shall be deposited into the Banco de Costa Rica Public Defenders Account number [Valor 003].

SUBSIDIARY CLAIM 1-) That, should this proceeding be dismissed, the plaintiff is entitled to payment for all useful and necessary improvements (mejoras útiles y necesarias) and fixtures (accesiones) made on the land at issue in this proceeding, as well as payment for the years during which I have possessed the land; and that the plaintiff has a right of retention (derecho de retención) over the property until the amounts determined by the expert and awarded in the judgment on the merits have been paid, together with interest at the Banco Central’s lowest deposit rate, because the statutory interest rate is inapplicable since this is not an obligation arising from a loan, as recognized by our case law, until the principal sum has been paid in full, all in the event that the action is dismissed. 2-That the judgment declare that the property has appreciated in value as of today. 3-That the plaintiff has a right of retention over property [Valor 004] until the amounts determined by the expert and awarded in the judgment on the merits have been paid, together with interest at the Banco Central’s lowest deposit rate, because the statutory interest rate is inapplicable since this is not an obligation arising from a loan, as recognized by our case law, until the principal sum has been paid in full, all in the event that the action is dismissed. 4-) That the defendant be ordered to pay both categories of costs of this proceeding, and the Court is requested to set defense counsel’s fees, which shall be deposited into the Banco de Costa Rica Public Defenders Account number [Valor 003]...» (see downloaded electronic case file in PDF format, images 1 to 10; 29 to 31; 36 to 39; 42 to 45)"

II. ANSWER TO THE COMPLAINT

The defendant company answered the complaint filed against it and raised the defenses (excepciones) of lack of standing, lack of capacity to be sued, and failure to establish a legal right. In a ruling issued at eight hours and thirty-six minutes on cuatro de agosto de dos mil veinte, the Agrarian Court of Limón declared Rolando Calvo Ramos in default (rebelde) (see downloaded electronic case file in PDF format, images 70 to 73 and 74 to 75; 97).

III.Judge Valerie Sancho Bermúdez of the Agrarian Court of the First Judicial Circuit of the Atlantic Zone ruled as follows in judgment 2024000494, issued at fourteen hours and twenty-two minutes on veintidós de agosto del año dos mil veinticuatro: «THEREFORE: In accordance with the foregoing, the Special Agrarian Adverse Possession (Usucapión Especial Agraría) action brought by [Nombre 001] against Rolafama Sociedad Anónima and Rolando Calvo Ramos, in his personal capacity, concerning the land claimed by the plaintiff as part of property [Valor 006], is dismissed, as are the remaining principal claims. The subsidiary claims concerning settlement of the consequences of possession (liquidación del estado posesorio) are partially granted; any relief not expressly granted is deemed denied, and the claims are granted as follows: The two dwellings in poor condition, the well, the toilet facility, the fences, 1 cacao tree, manzana de agua, mango, mamón chino, fruta de mono, carao, and avocado tree are recognized as fixtures in favor of the plaintiff.

If Rolafama Sociedad Anónima, as the registered owner, prefers to retain the plantings or existing structures, it must reimburse the plaintiff for the value of the materials and labor, without regard to any increase or decrease in value that the property may have experienced. The claims concerning the years of possession, appreciation in value, right of retention, and recovery of interest are denied. The defenses of failure to establish a legal right and lack of standing are partially granted. Both parties are exempted from paying attorney fees and litigation costs (costas personales y procesales) in this action. IV.The Court affirms established facts 1) through 3) because they are consistent with the evidence in the record. The fourth fact is restated as follows: With respect to the case involving precarious occupation (ocupación precaria) of the land in dispute, the Instituto de Desarrollo Rural, Región de Desarrollo Huetar Caribe, determined that the administrative remedies had been exhausted because, by the date the application was filed, more than ten years had already elapsed since the occupation began (same evidentiary basis cited in the judgment). Likewise, the following fact of the same nature is added: The plaintiff entered and began occupying the property in dispute in 2005 due to a state of necessity, after suffering abuse by her husband, from whom she separated, leaving her as head of household with her young children and no other means of support. Her possessory acts (actos posesorios) have therefore consisted of planting various crops and fruit trees; raising laying hens for her own and her family’s consumption; and maintaining the family dwelling.

She supplemented her livelihood by selling those products and engaging in additional subsistence activities, such as selling “rice and beans” and empanadas, uninterruptedly through the present date (testimony of [Nombre 003] and [Nombre 004] and judicial inspection (reconocimiento judicial), all recorded in audio files linked to the electronic case file).

V. The finding that the fact was unproven is reversed in light of what has been established at this stage

VI.Attorney Joselyn Cordero Castillo, in her capacity as public defender for the plaintiff, filed an appeal (recurso de apelación), expressly stating the grounds on which she relies to refute the trial court’s position. The grounds for appeal asserted against the judgment are as follows:

  • 1)This proceeding concerns an ordinary action for special agrarian adverse possession (usucapión especial agraria), in which title to the property at issue is sought because Ms. [Nombre 001] entered the land due to a state of necessity (estado de necesidad). However, the adverse-possession claim was denied because it was allegedly not proven that she entered the property due to a state of necessity, a conclusion that is untenable.
  • 2)The judgment contains errors in the assessment of evidence (valoración probatoria). It should be noted that suitable and relevant evidence was submitted establishing Ms. Yolanda’s subsistence activities, including the judicial inspection (reconocimiento judicial) and testimonial evidence (prueba testimonial). In this regard, the judgment states as follows: “… [Nombre 003] and [Nombre 004] were consistent in stating that the plaintiff entered the land together with the other squatters in 2006; they stated that she grows crops such as plantain, cassava, and cucumber, as well as fruit trees, and that there are two dwelling houses; it was also stated that she lives from the crops she grows and resides there permanently; nevertheless, the fact remains that she has not proven that she entered due to a state of necessity.” From the foregoing text, it may be concluded that there are serious inconsistencies, because it states that no evidence was submitted while simultaneously assessing the witnesses’ statements. The assessment of the evidence is exceedingly confusing and invalid. The same applies to the analysis of the judicial inspection, in which the following assessment was made: “the judicial inspection conducted at eleven thirty-three a.m. on April second, two thousand twenty-four, confirmed the existence of a few crops on the property, which could not be considered essential to the basic needs of the plaintiff or her family, since it was not established that the land had been devoted to stable, consistent crops whose production was sufficient at least to consider that it consisted of remaining on the property…”. However, that proceeding did establish the production of cassava, calabazo, coconuts, cacao, water apples, pejibaye, carao, fruta de mono, rambutan, cassava, and avocado; accordingly, it is impossible to understand how these products constitute static possession (posesión estática). Once again, the assessments made bear no logical or technical relationship to the evidence received. Moreover, the assessment of the judicial inspection is erroneous because the production described is for the benefit of the plaintiff and her family and for sale, as was duly established by the testimonial evidence. Given Ms. Yolanda’s individual circumstances, she cannot be required to produce on a large scale, as this would be impossible in light of her financial situation. Doña Yolanda’s production is commensurate with her means.
  • 3)In addition to the foregoing, the judgment itself states that, in response to an inquiry, INDER indicated that no declaration of a precarious-occupation conflict (declaratoria de conflicto de ocupación precaria) exists. However, this is not a sufficient basis for denying this action, because the adjudicator must assess the plaintiff’s economic and social circumstances when she entered the property, throughout the period of possession, and in relation to what she has done to date. What can indeed be established is that Ms. Yolanda is the head of household, is a person of limited means, has made the property at issue productive, has provided for her own and her family’s financial situation, has built two modest dwellings through considerable effort, has sold food, and has fulfilled the property’s social and economic purpose; yet the adjudicator still finds that her state of necessity has not been established.
  • 4)Sections 92 and 101 of the Ley del ITCO are cited as the legal basis (see notice of appeal in images 254 to 257).

VII. ON SPECIAL AGRARIAN ACQUISITIVE PRESCRIPTION

First, on this subject, the First Chamber of the Court, in Judgment Number 172-F-S1-2008, issued at nine fifty-five a.m. on March fourth, two thousand eight, held: “IV.- In fact, the appellant’s principal argument focuses on asserting that the rules of ‘special agrarian acquisitive prescription’ should have been applied during the analysis and that, because this was not done, the court of appeals made a series of improper assessments of the evidence. In light of this claim, it is necessary to make several general observations regarding the means of acquiring ownership through positive prescription in agrarian matters. A distinction must therefore be drawn between ordinary and special acquisitive prescription, both of which are recognized by this branch of law. The former requires compliance with the requirements established by the Civil Code, owing to the absence of specific agrarian legislation; namely: a title transferring ownership, good faith, and possession.

Accordingly, anyone filing an agrarian action of this nature must demonstrate possession as owner, exercised publicly, peacefully, and uninterruptedly for a period of 10 years. It differs from civil proceedings involving positive prescription in that possession goes beyond mere occupancy of the property, since it entails agrarian acts of possession aimed at cultivating and improving the property sought to be acquired by prescription. Special agrarian acquisitive prescription, for its part, is provided for in the Land and Colonization Act and is founded upon precarious possession arising from the need to work an agrarian property as a means of subsistence for oneself or one’s family unit. Thus, Article 92 of that statute provides: ‘For the purposes of this Act, a precarious possessor shall be understood to mean anyone who, out of necessity, performs stable and effective acts of possession as owner, peacefully, publicly, and uninterruptedly for more than one year, with the intention of bringing the land into production for his or her own subsistence or that of his or her family, on land duly registered in the name of a third party in the Public Registry.

Precarious possessors who have possessed the land for ten years under the conditions stated in the preceding paragraph may register their right in accordance with this Act and through possessory-information proceedings....’ Article 101 of the same statute, in turn, states: ‘...for the purposes of the positive prescription addressed in this Article, the title transferring ownership required by the Civil Code was not necessary.’ As this Chamber has indicated, precarious possession of land constitutes a form of agrarian possession and, as such, consists of de facto control over productive property whose registered title belongs to a third party, exercised continuously, effectively, and personally through the conduct of an economically organized activity to obtain animal or plant products, the ultimate purpose of which is to satisfy the possessor’s own needs or those of his or her family. Accordingly, the need for food and family agricultural labor prevail in this form of possession.

Its subjective and objective requirements have distinct characteristics. A mere intention to possess is insufficient; possession must be effective, direct, and personal, for the purpose of satisfying the aforementioned needs. Therefore, for it to apply, the existence of good or bad faith is not determinative, because that element is replaced by necessity. As prescribed by law in this special case, no title transferring ownership is required. The most significant effect of precarious possession is the acquisition of agrarian property through ten years of possession, that is, agrarian acquisitive prescription. Conversely, when the conditions constituting a state of necessity referred to in the aforementioned Articles 92 and 101 of the Land and Colonization Act are not present, the matter involves ordinary agrarian acquisitive prescription, which is governed by a legal regime different from the special agrarian acquisitive prescription regulated by that Act.

In this regard, see Judgment No. 755 of this Chamber, issued at 2:00 p.m. on October 5, 2006.” This position was reiterated in Decision No. 1357-F-2017 of the same Chamber, issued at 2:45 p.m. on November 7, 2017. Likewise, this Court has recognized the continued validity of that special institution of Agrarian Law in numerous decisions, including Nos. 100-F-19, 271-F-18, 943-F-20, 1137-F-2020, 1260-F-2021, and, most recently, No. 1186, issued at 6:35 p.m. on December 16, 2024. The latter reviewed several judicial precedents of the First Chamber, the Constitutional Chamber, and the Agrarian Court and, insofar as relevant, emphasized: “Before examining the appellant’s grounds of appeal, it is appropriate to analyze the regime of acquisitive prescription and its requirements in order to determine whether the case was decided in accordance with law. This Court has repeatedly held: ‘Regarding the institution of AGRARIAN ACQUISITIVE PRESCRIPTION, it is necessary to distinguish special agrarian acquisitive prescription—regulated by the Land and Colonization Act—from ordinary agrarian acquisitive prescription.

Special agrarian acquisitive prescription dispenses with just title and good faith, as established by Articles 92 and 101 of the Land Act itself, but requires public, peaceful, and uninterrupted agrarian possession for more than ten years over land registered in the name of a third party, provided that the acts of possession and the agrarian activity are undertaken to satisfy the possessor’s own needs or those of his or her family. Ordinary agrarian acquisitive prescription, by contrast, requires just title and good faith in addition to the foregoing requirements. The basis may be original (such as a right of possession) or derivative (through a contract transferring possession). As regards good or bad faith, the former is always presumed; however, a possessor acts in bad faith when, upon taking possession, he or she had sufficient reason for doubt (Articles 284, 287, and 286 of the Civil Code).

Good or bad faith is linked to the person’s belief that he or she is possessing property of his or her own and that the person who transferred it was its lawful owner.’ Agrarian Court, Judgment No. 1033-F-06, issued at eleven twenty-five a.m. on October nineteenth, two thousand six.- The statement of facts and relief sought in the COUNTERCLAIM, as well as the appellant’s grounds of appeal, concern the requirements of special agrarian acquisitive prescription; consequently, it is unnecessary to determine whether possession was exercised in good or bad faith or whether there was a title transferring ownership, because both requirements are replaced by the adverse possessor’s state of necessity, as the First Chamber of the Court has held: ‘IV.- In fact, the appellant’s principal argument focuses on asserting that the rules of “special agrarian acquisitive prescription” should have been applied during the analysis and that, because this was not done, the court of appeals made a series of improper assessments of the evidence.

In light of this claim, it is necessary to make several general observations regarding the means of acquiring ownership through positive prescription in agrarian matters. A distinction must therefore be drawn between ordinary and special acquisitive prescription, both of which are recognized by this branch of law. The former requires compliance with the requirements established by the Civil Code, owing to the absence of specific agrarian legislation; namely: a title transferring ownership, good faith, and possession. Accordingly, anyone filing an agrarian action of this nature must demonstrate possession as owner, exercised publicly, peacefully, and uninterruptedly for a period of 10 years. It differs from civil proceedings involving positive prescription in that possession goes beyond mere occupancy of the property, since it entails agrarian acts of possession aimed at cultivating and improving the property sought to be acquired by prescription.

Special agrarian acquisitive prescription, for its part, is provided for in the Land and Colonization Act and is founded upon precarious possession arising from the need to work an agrarian property as a means of subsistence for oneself or one’s family unit. Thus, Article 92 of that statute provides: “For the purposes of this Act, a precarious possessor shall be understood to mean anyone who, out of necessity, performs stable and effective acts of possession as owner, peacefully, publicly, and uninterruptedly for more than one year, with the intention of bringing the land into production for his or her own subsistence or that of his or her family, on land duly registered in the name of a third party in the Public Registry. Precarious possessors who have possessed the land for ten years under the conditions stated in the preceding paragraph may register their right in accordance with this Act and through possessory-information proceedings....” Article 101 of the same statute, in turn, states: “...for the purposes of the positive prescription addressed in this Article, the title transferring ownership required by the Civil Code shall not be necessary.” As this Chamber has indicated, precarious possession of land constitutes a form of agrarian possession and, as such, consists of de facto control over productive property whose registered title belongs to a third party, exercised continuously, effectively, and personally through the conduct of an economically organized activity to obtain animal or plant products, the ultimate purpose of which is to satisfy the possessor’s own needs or those of his or her family.

Accordingly, the need for food and family agricultural labor prevail in this form of possession. Its subjective and objective requirements have distinct characteristics. A mere intention to possess is insufficient; possession must be effective, direct, and personal, for the purpose of satisfying the aforementioned needs. Therefore, for it to apply, the existence of good or bad faith is not determinative, because that element is replaced by necessity. As prescribed by law in this special case, no title transferring ownership is required. The most significant effect of precarious possession is the acquisition of agrarian property through ten years of possession, that is, agrarian acquisitive prescription. Conversely, when the conditions constituting a state of necessity referred to in the aforementioned Articles 92 and 101 of the Land and Colonization Act are not present, the matter involves ordinary agrarian acquisitive prescription, which is governed by a legal regime different from the special agrarian acquisitive prescription regulated by that Act.

In this regard, see Judgment No. 755 of this Chamber, issued at 2:00 p.m. on October 5, 2006.’ FIRST CHAMBER OF THE SUPREME COURT OF JUSTICE. Judgment Number 172-F-S1-2008, issued at nine fifty-five a.m. on March fourth, two thousand eight. Those social realities in the agrarian sector, such as the one present in this case, justify the existence and application of Articles 92 and 101 of the Land and Colonization Act in order to provide legal certainty in land tenure, consistently with the principle established in Article 50 of the Political Constitution that ‘The State shall seek the greatest welfare of all the country’s inhabitants by organizing and stimulating production and the most appropriate distribution of wealth,’ and with equity as a principle of Agrarian Law governed by Article 69 of our Constitution.

Moreover, Article XXIII of the “American Declaration of the Rights and Duties of Man,” adopted at the Ninth International Conference of American States, Bogotá, Colombia, 1948, as an expression of first- and second-generation Human Rights, provides: “Every person has the right to own such private property as meets the essential needs of decent living and helps to maintain the dignity of the individual and of the home.”- IX.- More recently, this Court has stated: “VI.- Constitutional Case Law: The Constitutional Chamber, in judgment No. 24178-2021, whose case law is binding, has developed the nature of agrarian property (propiedad agraria) in relation to this legal institution: VII.- On the agrarian property regime.- This Constitutional Court, through judgment No. 2000-9119 at 15:14 hours on 17 de octubre de 2000, stated the following regarding agrarian property: ‘Agrarian property, determined in this case by the manner in which it was acquired through the mechanisms established in the Ley de Tierras y Colonización, is characterized by the owner’s obligations to perform acts of possession (actos de posesión) in fulfillment of the social function of the owner’s right.

Ownership and possession are therefore so closely related that the former cannot be conceptualized without the latter; thus, without ownership losing its nature as a subjective right, its holder assumes a series of obligations in exercising that right. Taking into account not only that distinguishing character of agrarian property, but also the concept of the Social and Democratic State under the Rule of Law that governs our country, recognized in Article 50 of the Constitución Política, the State has established, through the Ley de Tierras y Colonización, a specific procedure for acquiring this right, with the aim of promoting the gradual increase of land productivity, ensuring a fair distribution of its output, and improving the social condition of farmers by enabling them to participate in the Nation’s development (Article 1 of the aforementioned Law).’ It follows from the foregoing that agrarian property may be acquired through a procedure whose purpose, by virtue of its nature, is fundamentally to ensure that the land is devoted to production.

This procedure is regulated by Ley No. 2825, Ley de Tierras y Colonización, beginning with section 92 et seq. of that statute. Article 92 of the Ley de Tierras y Colonización governs disputes between owners and precarious possessors (poseedores en precario), and provides that the Instituto de Desarrollo Rural is the agency responsible for intervening in cases of precarious possession of land (posesión precaria de tierras) in an effort to find satisfactory solutions in accordance with the law. It defines a precarious possessor as follows: ‘a person who, out of necessity, performs stable and effective acts of possession, as an owner, peacefully, publicly, and without interruption for more than one year, for the purpose of bringing the land into production for the person’s own subsistence or that of the person’s family, on land duly registered in the name of a third party in the Registro Público.

Precarious possessors who have possessed the land for ten years under the conditions set forth in the preceding paragraph may register their right in accordance with this law and through the possessory-information proceeding (información posesoria)….’ It is important to clarify that Ley No. 9036 transformed the Instituto de Desarrollo Agrario (IDA) into the Instituto de Desarrollo Rural (INDER), and its creation resulted in the repeal of provisions of Ley No. 2825. However, the final provisions of Ley No. 9036 clearly provided that Chapter VI of Ley No. 2825, which governs disputes between owners and precarious possessors, remains in force to date. Accordingly, the aforementioned provisions establish the requirements that must be met for a particular person to be deemed a precarious possessor under precarious occupation (ocupación precaria) when performing possessory acts (actos posesorios) to generate production on land that the person does not own.

For a better understanding of those requirements, Article 195 of the Reglamento a la Ley No. 9036 of 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER) defines the requirements imposed by Article 92 of the Ley de Tierras y Colonización as follows: ‘Article 195°- Precarious Occupation. For precarious occupation to be deemed to exist, compliance with the requirements established in Ley 2825 must be determined. Those requirements are as follows: a) One-year possession (Posesión anual): The person must demonstrate, by any means of evidence permitted by law, that the person has possessed the parcel at issue in the dispute for more than one year. b) State of necessity (Estado de necesidad): The applicant must demonstrate that the applicant entered the property to meet a subsistence need; that is, that upon entering the property and through the present date, the applicant has had no other means of subsistence for the applicant and the applicant’s family beyond the production conducted on the occupied parcel. c) Subsistence (Subsistencia): The applicant must demonstrate that the parcel at issue is the applicant’s sole means of subsistence; therefore, if the applicant has other means of subsistence, precarious occupation shall be deemed not to exist. d) Area (Área): The possessed area must be sufficient to be deemed a productive unit meeting the minimum parameters necessary for subsistence, according to the area in which it is located, its nature, and the productive activity carried out thereon.’ It is understood that the legal system permits a precarious possessor who meets the required conditions to acquire property registered in another person’s name in the Registro Público through the special agrarian adverse-possession regime (usucapión especial agraria), under the agrarian property model.

Accordingly, a dispute between an owner and a precarious possessor is understood to arise when the registered owner of private property abandons it and ceases performing acts of possession thereon—known as the presumption of abandonment (presunción de abandono)—and another person, although not its owner, instead undertakes acts intended to establish possession for the purpose of producing on that land to meet the person’s own subsistence needs and those of the person’s family group, without any claim or objection by the registered owner.’ Clearly, in the case of Mr. Isidoro, there was not only agrarian possession (posesión agraria) to meet his own and his family’s needs, but also total abandonment, since the registered owner never performed possessory acts on the property and likewise never exercised any remedy available to registered owners—possessory injunctions (interdictos posesorios), eviction based on mere tolerance (desahucio por mera tolerancia), an action for recovery of ownership (acción reivindicatoria), usurpation, etc.—to recover the property, except for the administrative eviction action (acción de desahucio administrativo) attempted in 2021 without any success, during which Mr.

Isidoro instead received support from CONAPAM in defending himself. The Constitutional Chamber, in the same judgment No. 24178-2021, elaborated on the application of that legal institution under the Reglamento de la Ley Inder No. 9036 of 09 de abril del 2018, further adding the following: ‘IX...It is now necessary to examine the purpose of the content of the challenged provision in order to determine whether it satisfies the parameters established by the principles of proportionality and reasonableness. The Reglamento a la Ley No. 9036 of 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER) contains Article 195, which establishes the requirements that must be met for precarious occupation under the agrarian-possession model. The petitioner specifically challenges the requirement set forth in subsection c) of that provision, namely: “c) Subsistence: The applicant must demonstrate that the parcel at issue is the applicant’s sole means of subsistence; therefore, if the applicant has other means of subsistence, precarious occupation shall be deemed not to exist.

(…).” As indicated, this Chamber has held that, for such a requirement to be upheld, it must be necessary, suitable, and proportionate. Necessity is based on protecting an interest or set of interests belonging to the community; specifically, requiring compliance with this condition seeks to protect the registered owner’s right to ownership of the property, as established by Article 45 of the Constitution. For its part, the suitability of the requirement lies in protecting the agrarian possession of a particular person who performs possessory acts on land without being its registered owner. The intent is not to give away the real property, but rather to require that such occupation arise from the performance of agrarian possessory acts, such as production on the land; therefore, as an essential element for acquisition, that work must be the sole means of subsistence of the person and the person’s family group.

Finally, the proportionality of the requirement serves to prevent the arbitrary dispossession of the registered owner and also prevents persons from using the legal doctrine of agrarian adverse possession (usucapión agraria) for profit or the commercialization of land; in other words, it seeks to prevent abuse. Based on the foregoing, the challenged provision is determined to be reasonable, suitable, and proportionate to the purposes for which it was created. It is likewise important to clarify that, when a particular person applies to be classified as a precarious possessor, that person has only an expectancy of a right (expectativa de derecho), because recognition is subject to compliance with the requirements established by law. The legislature designated the Instituto de Desarrollo Rural as the agency responsible for intervening in cases involving precarious possession of land; this is the source of its authority to determine whether a person satisfies the requirements to qualify as a precarious possessor, with agrarian productive activity on the land as the fundamental element.

In addition, agrarian adverse possession entails special requirements intended to promote agrarian production and labor—plant or animal. To provide further understanding of this doctrine, this Constitutional Chamber, in judgment No. 04587-97 at 15:45 hours on 05 de agosto de 1997, held as follows: “Regarding agrarian property, it should be noted that when the social function of property is recognized, the right of ownership is configured as a right-duty (derecho-deber), under which there is a specific manner of exercising the powers of ownership and obligations are imposed on the holder, such as the productive use of the land. Because the factual premise of the challenged provision—the first paragraph of Article 7 of the Ley de Informaciones Posesorias—could apply in circumstances where agrarian possession had been exercised over the land for which title is sought before that land became part of the public domain, it is necessary to identify the elements characterizing the legal institution of agrarian adverse possession, as was done above with the general regime of ordinary civil adverse possession (usucapión civil ordinaria).

According to the case law, that institution is founded on a general principle of Agrarian Law: the socioeconomic function of agrarian property (función económico social de la propiedad agraria). That principle fundamentally comprises two aspects: a subjective, economic aspect consisting of the owner’s obligation to produce, improve, and respect the environment; and an objective or social aspect entailing the State’s obligation to provide property to those who are capable of producing but lack land.

By virtue of the foregoing, agricultural labor (trabajo agrario) constitutes the foundation of acquisitive prescription in agricultural law (usucapión agraria), as it is the means by which ownership of land is acquired. For acquisitive prescription in agricultural law, possession (posesión) assumes central importance as a mandatory element for acquiring the right of ownership. The institution of acquisitive prescription in agricultural law in Costa Rica coincides structurally with general acquisitive prescription under the Civil Code; however, it differs in function because of the introduction of the principles set forth above. Among the elements characterizing acquisitive prescription in agricultural law is a special conception of the possessor’s intent to possess as owner (animus), which must be manifested through the exercise of agricultural possessory acts (actos posesorios agrarios).

This is reflected most strongly in the economic appropriation of profits obtained through labor performed on the property (fundo). A person who works the land in that manner is presumed to do so as owner. Furthermore, agricultural labor constitutes color of title (justo título), and the fact that it is not required to be evidenced by a document allows ownership to be acquired against title registered in the name of a third party in the Public Registry. Likewise, acquisitive prescription in agricultural law makes no distinction between possession in good or bad faith, because the essential consideration is productive agricultural activity. Special agricultural legislation in Costa Rica has progressively eliminated color of title and good faith as requirements for acquisitive prescription, to the point that dispensing with those requirements has become the rule, while the exception is found in civil proceedings in cases involving the derivative acquisition of possession (adquisición derivativa de la posesión).

Now, legal scholarship and case law have understood that Articles 92 and 101 of Ley de Tierras y Colonización No.2825 of 14 de octubre de 1961, as amended, expressly regulate acquisitive prescription of land in agricultural law. Those articles define the concept of precarious possession of land (posesión precaria de tierras), which is a form of agricultural possession (posesión agraria). It consists of de facto control over property of a productive nature, registered in the name of a third party in the Public Registry, over which stable and effective acts of possession are carried out for the purpose of placing the property into productive condition in order to meet the needs of the possessor and the possessor’s family. Because the need for food and agricultural labor prevail in precarious possession, possession must be exercised directly and personally—the mere intent to possess is insufficient.

Likewise, whether good or bad faith exists is immaterial, since the precarious possessor knows that the property being worked is registered in the name of a third party in the Public Registry. An instrument conveying ownership (título traslativo de dominio) is also excluded because agricultural labor constitutes the title.” (Emphasis not in the original). It follows from the cited precedent that the requirement set forth in the challenged provision for a particular person to be classified as a precarious possessor (poseedor precario) is based on the principle of social function (principio de función social), which seeks to ensure the productivity of land under conditions of necessity in order to meet the needs of both the occupant and the occupant’s family. Accordingly, this Constitutional Court considers the requirement stipulated in subsection c) of Article 195 of the Regulations to Law No. 9036 of 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER) to be entirely proportionate and reasonable.

In this regard, it is essential to reiterate the holding of the judgment described above that agricultural labor constitutes the foundation of acquisitive prescription in agricultural law, as it is the means by which ownership of land is acquired. It is determined that this special legal concept enshrined in Agricultural Law was created specifically for cases in which a person filing an application concerning disputes between owners and precarious possessors must demonstrate that the means by which the person meets basic subsistence needs derives from agricultural labor on the land, thereby excluding subsistence through means other than production from the land. This fundamental element justifies special acquisitive prescription in agricultural law (usucapión especial agraria) as an exception to the general concept, because the intent to possess is not sufficient. Thus, this requirement is neither arbitrary nor disproportionate and, in view of the foregoing, this Constitutional Court rejects the claim that the challenged provision violates the constitutional principle of proportionality (principio de proporcionalidad constitucional).

Consequently, the action must be dismissed with respect to this issue." It should be noted that the Constitutional Chamber reaffirms its own binding case law establishing agricultural labor as the foundation of special acquisitive prescription in agricultural law, precisely in order not only to recognize a means of obtaining access to ownership, but also to guarantee the exercise of the economic, social, and environmental function of property (función económica, social y ambiental de la propiedad). For this reason, Ley de Tierras y Colonización also incorporates other provisions, such as Article 144, establishing grounds for expropriation (causales de expropiación) due to failure to fulfill the social function, including leaving the property abandoned. The foregoing is consistent with a principle of Agricultural Law as a “law of equity” (derecho de equidad), contained in Article 1 of the Law, subsection 6) of which provides: “The purpose of this Law is: 6) To establish that land must not be used for the exploitation of agricultural workers.

The State shall, by every means at its disposal, encourage the formation of agricultural cooperatives in order to combine the dignity of small landholdings with the efficiency of large enterprises.” As a consequence of the foregoing, it is evident that, in this case, the conduct of the defendant Raúl Álvarez Alfaro (and his predecessors in title (trasmitentes)) consisted not only of completely abandoning the property, but also of seeking to evict the agricultural worker from it through administrative proceedings, thereby exploiting a worker who, through more than twenty-five years of effort, has kept the land in productive condition out of necessity in order to support and provide for his family." (TRIBUNAL AGRARIO, Voto No. 2024000695 de las diez horas doce minutos del quince de julio de dos mil veinticuatro)”.

VIII.In the case at hand, this Court has assessed the body of evidence under the principle of free evaluation of evidence (libre valoración) contained in Article 54 of the Ley de Jurisdicción Agraria (applicable to this case pursuant to Transitory Provision I of the Código Procesal Agrario), and is therefore able to conclude that the evidence clearly shows that the plaintiff entered into possession of the disputed property out of an evident state of necessity, in order to provide for her own subsistence and that of her family, given that she was in a situation of vulnerability and poverty. She exercised such possession continuously and as owner for a ten-year period that had already elapsed when the complaint was filed. Accordingly, this Court does not share the conclusions reached by the court below, since the very evidence cited in the judgment establishes precisely the opposite. Thus, the witness [Nombre 003] stated that she knew the plaintiff, Yolanda, as the owner, indicating that she took possession in the year 2005.

She explained that the plaintiff had rented another place to live but could no longer continue renting, and therefore decided to join a group of people who entered the property, which had been abandoned or was overgrown with brush. She explained that Yolanda arrived “with all her children,” approximately 4 or 5 of them, and that she is a person who has always struggled to get ahead; that she planted cassava and fruit trees and kept laying hens, which she used for her own consumption and for sale; and that she also made “rice and beans” and empanadas to earn a living. She stated that the plaintiff had never abandoned the land. Similarly, [Nombre 004] explained that the plaintiff had possessed the land for 12 or 14 years. She recounted that the plaintiff took the land because her husband was abusive, which led to their separation, leaving Yolanda alone with her young children; hence, she entered the land because she had nowhere to live, as she was a homemaker and did not have a job.

She agreed with the previous witness that the parcel (fundo) was completely overgrown and swampy, with dense brush, and that the group that entered the property cleared it and, since then, doña Yolanda has worked and cultivated the land. She explained that the plaintiff had grown various crops, including plantain, cassava, cucumber, and fruit trees; that a truck came and purchased coconuts from her; and that she had also kept chickens. She stated that when the plaintiff entered the parcel, she did not have a job, that she used the crops to generate her own income, and that she had never abandoned the land. She reiterated that Yolanda sells coconuts, mangoes, carao honey, and coconut oil, and grows cassava, cucumber, pipián squash, and other fruit trees. For their part, the witnesses offered by the defendant, namely Carlos Alberto Hernández Bonilla and Alejandro Brenes Obando, do not contradict those personal circumstances surrounding the plaintiff’s entry onto the property, nor has any other evidence been submitted to rebut what has been established.

Furthermore, the judicial inspection (reconocimiento judicial) conducted shows that this situation of poverty continues to some extent and that the plaintiff continues to use the property for her subsistence, as evidenced by two modest or dilapidated wooden houses, a well, and cacao, water apple, mango, carao, peach palm, fruta de mono, rambutan, cassava, plantain, squash, avocado, manga mango, and coconut crops, in an area that clearly reflects their subsistence purpose. In this connection, this Court is struck by the court below’s conclusion that the plaintiff’s preparation of tamales and “rice and beans” for sale does not correspond to a situation or state of necessity. This is because, under the rules of logic and human experience, it is instead an element that reinforces her situation of vulnerability and shows that this state of necessity continued even ten years later. It is evident that the plaintiff entered as a squatter by necessity (poseedora en precario), seeking to support her young children in a context of abuse by her husband—from whom she had to separate—leaving her as head of household, and that she combined a series of activities to survive, ranging from growing various crops and selling food to raising laying hens.

She also clearly used the parcel as a home for her family unit. Accordingly, the “static” possession characterized as such by the court below is inconsistent with the record. Admittedly, there is no large-scale agricultural production, but this does not negate the fact that the parcel served as her means of production to provide for her daily subsistence. A subsistence agricultural enterprise (empresa agraria de subsistencia) is recognized in our legislation, specifically in Article 92 of the Ley de Tierras y Colonización. That provision establishes: “For the purposes of this law, a squatter by necessity shall be understood to mean any person who, out of necessity, performs stable and effective acts of possession as owner, peacefully, publicly, and continuously, for more than one year, with the aim of bringing the land into production for the person’s own subsistence or that of the person’s family, on land duly registered in the name of a third party in the Public Registry.

Squatters by necessity who have possessed the land for ten years under the conditions set forth in the preceding paragraph may register their right in accordance with this law and through possessory-information proceedings (información posesoria)...” For its part, Article 101 of the same body of law provides: “...for purposes of the acquisitive prescription (prescripción positiva) addressed in this article, the instrument transferring title required by the Código Civil shall not be necessary.” One characteristic of this type of activity is that its primary purpose is to ensure the food security of a family group and satisfy its need for housing, sometimes through production involving a low level of technology because these subsistence activities are usually carried out in a more traditional manner. Consequently, under the cited provisions, neither good faith (buena fe) nor color of title (justo título)—which are elements of ordinary adverse possession (usucapión común)—is decisive, since these elements are replaced by necessity, with the need for food and family agricultural labor thus prevailing.

Moreover, the judgment’s statement that the plaintiff had been evicted from the property is not supported by the evidence introduced in these proceedings. Although the witnesses offered by the defendant, Carlos Alberto Hernández Bonilla and Alejandro Brenes Obando, mentioned the presence of the Fuerza Pública at the site between the years 2008 and 2009, this does not mean that an administrative eviction (desalojo administrativo) took place. The defendant did not prove this in these proceedings; in any event, the state of necessity under which the plaintiff entered the land has been established, as have her continued presence on the property since the year 2005 and her uninterrupted possession, without any judicial action having been filed or upheld against her that would interrupt the ten-year limitation period. Accordingly, grounds of appeal 1), 2), and 4) must be sustained.

IX.Turning to another matter, it remains to examine the statement in the judgment that INDER did not declare the plaintiff to be a squatter by necessity, which is challenged in the third ground of appeal. In this respect, the appellant is correct. The primary purpose of that administrative proceeding is for the entity, after establishing the occupant’s status as a squatter by necessity, to attempt to resolve the dispute through a direct purchase from the registered owner; however, it does not in any way preclude a court from examining, as a substantive prerequisite for special agrarian adverse possession (usucapión especial agraria), whether the person is a squatter by necessity, as established in this case (this Court ruled along the same lines in decisions No.688-F-2021 and No. 271-F-2018). Likewise, as is apparent from official communication No. RDHC-1322-2019, dated 10 de octubre del 2019, issued by the Instituto de Desarrollo Rural, Región de Desarrollo Huetar Caribe concerning the dispute over adverse possession by a squatter by necessity involving the property at issue, that status was not declared by the Instituto de Desarrollo Agrario because that entity reasoned that possession exceeding ten years was being claimed and that, under Article 194, paragraph 2, of the Reglamento Ejecutivo de la Ley 9036, when it is determined that the occupants have possessed the land for more than ten years, it must be declared that no squatter-occupancy dispute exists, thereby exhausting the administrative mediation process (document in image 51).

That administrative act (acto administrativo) must in no way be interpreted as a denial of the plaintiff’s status as a squatter by necessity; rather, it reinforces the fact that, because ten-year possession was alleged, declaring the dispute would serve no purpose. The logical basis for the foregoing is found in Article 101 of the Ley de Tierras y Colonización, which provides that “...plots with respect to which the defense of acquisitive prescription must be admitted as valid shall not be included in the appraisal or paid for...” This necessarily means that the Courts must assess whether that defense is valid, because once the vesting of special agrarian adverse possession has been established, intervention by the Instituto to carry out a potential expropriation or direct purchase would serve no purpose.

IX.In view of the foregoing, because special agrarian adverse possession has been established, pursuant to Articles 1 and 2 of the Ley de Jurisdicción Agraria and Articles 92 and 101 of the Ley de Tierras y Colonización, the judgment must be reversed. In its place, the defenses of failure to state a valid right (falta de derecho) and lack of standing, both active and passive (falta de legitimación activa y pasiva), are rejected, and the principal claim for special agrarian adverse possession is granted as set forth below. Consequently:

  • 1)It is declared that the plaintiff has acquired the disputed land through special agrarian adverse possession by demonstrating her state of necessity as a squatter by necessity for more than ten years; the land is located in [...], bounded to the North by [Nombre 005], to the South by a public road, to the East by [Nombre 004], and to the West by [Nombre 006], and forms part of the property in the province of Limón under registration number [Valor 008].
  • 2)During the judgment-enforcement stage (ejecución de sentencia), the aforementioned portion of land must be subdivided from the parent property (segregar) so that it may be registered in her name in the Registro Nacional as an independent property, with the plaintiff bearing the costs of preparing the cadastral survey plan (plano catastrado). Once the plan has been prepared and registered with the Departamento de Catastro, the property must be registered by means of the certified judgment (ejecutoria) issued by the court, and the plaintiff shall bear any expenses that may arise in connection with its effective registration.
  • 3)The defendant is ordered to pay costs.

THEREFORE (POR TANTO) The judgment is reversed. In its place, the defenses of failure to state a valid right and lack of standing, both active and passive, are rejected, and the principal claim for special agrarian adverse possession is granted as set forth below. Consequently: 1) It is declared that the plaintiff has acquired the disputed land through special agrarian adverse possession by demonstrating her state of necessity as a squatter by necessity for more than ten years; the land is located in [...], bounded to the North by [Nombre 005], to the South by a public road, to the East by [Nombre 004], and to the West by [Nombre 006], and forms part of the property in the province of Limón under registration number [Valor 008]. 2) During the judgment-enforcement stage, the aforementioned portion of land must be subdivided from the parent property so that it may be registered in her name in the Registro Nacional as an independent property, with the plaintiff bearing the costs of preparing the cadastral survey plan. ROLAFAMA S.A VOTO N° N° 2025000581 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las diez horas nueve minutos del veinticinco de junio de dos mil veinticinco.- PROCESO ORDINARIO establecido por [Nombre 001], mayor, divorciada, ama de casa, vecino de Luzón de Batan, cédula de identidad [...]; contra ROLAFAMA SOCIEDAD ANÓNIMA, cédula jurídica tres - cientos uno - quinientos setenta y seis mil ochocientos sesenta, representada por su presidente con facultades de apoderado generalísimo sin límite de suma Rolando Calvo Ramos, mayor, divorciado, empresario, vecino de San José, cédula de identidad uno - quinientos dieciséis - seiscientos diez, este último también en su carácter personal. Actúa como defensora pública de la parte actora, la licenciada Joselyn Cordero Castillo colegiado veintiocho mil novecientos cuarenta y dos; de la parte demandada el letrado Hilory Hunter Tatum, colegiado veintiséis mil quinientos ochenta y cinco. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, Limón.

Redacta la Jueza Fisher González; y;

CONSIDERANDO:

I. DE LAS PRETENSIONES

La parte actora formuló la presente demanda, para que en sentencia se declare lo siguiente: «PRETENSIÓN PRINCIPAL: 1) Con lugar la presente demanda en todos sus extremos acogiendo este proceso ORDINARIO en todos sus extremos. 2-) Que se declare en sentencia que la actora ha ejercido la posesión agraria con por más de 11 años de forma quieta, pública, ininterrumpida, pacifica, a título de dueño, pacifica, y de buena fe. 3-) Que se declare en sentencia que la actora tiene legitimación activa, para plantear dicho proceso de prescripción positiva agraria especial, en contra de los demandados, al demostrar su estado de necesidad en precario. 4-) Que se declare en sentencia que la actora, se le debe de segregar la porción de terreno que mantiene en su posesión y poder inscribirlo ante el Registro de la Propiedad como finca independiente de la finca partido de Limón [Valor 002], y que en caso de no dar la firma el representante de la sociedad no quiera firmar lo haga la jueza de turno que le corresponda 5-) Que al existir prescripción positiva agraria mi favor, se declara que mi persona a adquirido por usucapión agraria especial y ordenando en sentencia de fondo al Registro Nacional de la Propiedad la inscripción de una porción que se reclama de la finca [Valor 001] a mi favor. 6-) Se imponga a los demandado s la obligación de cancelar ambas costas de éste proceso una vez firme la sentencia.. 7-Que se le prohíba a los demandados de no traspasar, enajenar, hipotecar, gravar de cualquier medio la propiedad hasta tanto no se defina dicha situación en sentencia, de fondo con los apercibimientos de ley bajo desobediencia a la autoridad se podrían remitir a la fiscalía testimonio de piezas. 7)- Se imponga al demandado la obligación de pagar ambas costas de éste proceso en la cual se solicita al despacho que se fijen los honorarios de la defensa y se depositarán en la Cuenta de Defensores Públicos del Banco de Costa Rica número [Valor 003]..

PRETENSIÓN SUBSIDIARIA 1-) Que en caso de declara (sic) el presente proceso sin lugar, el actor tiene derecho al pago de todas las mejoras útiles y necesarias, y accesiones realizadas sobre el terreno objeto de éste proceso y derecho al pago de los años posesorios en que me he mantenido el terreno y la actora tiene derecho de retención de la propiedad hasta tanto, no cancelen los montos fijados por el perito y dictados en sentencia de fondo y cobrar los intereses al tipo de la tasa pasiva más baja del Banco Central, por no aplicarse el interés legal por no tratarse de una obligación derivada de un préstamo conforme lo ha reconocido así nuestra jurisprudencia, hasta el efectivo pago de la suma principal, todo ello en caso de declarar sin lugar la demanda. 2-Que se declare en sentencia que la propiedad al día de hoy aumento su plusvalía. 3-Que el actor tiene derecho de retención de la propiedad [Valor 004], hasta tanto, no cancelen los montos fijados por el perito y dictados en sentencia de fondo y cobrar los intereses al tipo de la tasa pasiva más baja del Banco Central, por no aplicarse el interés legal por no tratarse de una obligación derivada de un préstamo conforme lo ha reconocido así nuestra jurisprudencia, hasta el efectivo pago de la suma principal, todo ello en caso de declarar sin lugar la demanda. 4-) Se imponga al demandado la obligación de pagar ambas costas de éste proceso en la cual se solicita al despacho que se fijen los honorarios de la defensa y se depositarán en la Cuenta de Defensores Públicos del Banco de Costa Rica número [Valor 003]...» (ver descarga de expediente electrónico descargado en formato PDf imágenes 1 a 10; 29 al 31; 36 a 39; 42 a 45)"

II. CONTESTACIÓN DE DEMANDA

La Sociedad demandada contestó la demanda incoada en su contra e interpuso las excepciones de falta de legitimación activa y pasiva y falta de derecho. El Juzgado Agrario de Limón en resolución de las ocho horas treinta y seis minutos del cuatro de agosto de dos mil veinte, declaró rebelde al señor Rolando Calvo Ramos (ver descarga de expediente electrónico descargado en formato PDF imágenes 70 a 73 y 74 a 75; 97).

III.La Jueza Valerie Sancho Bermúdez, del Juzgado Agrario del Primer Circuito Judicial de la Zona Atlántica, en sentencia 2024000494 de las catorce horas con veintidós minutos del veintidós de agosto del año dos mil veinticuatro, resolvió: «POR TANTO: De conformidad con lo expuesto, se declara sin lugar la Usucapión Especial Agraría interpuesta por [Nombre 001] contra Rolafama Sociedad Anónima y Rolando Calvo Ramos en su carácter personal del terreno que reclama la actora en parte de la finca [Valor 006], así como las demás pretensiones principales. En cuanto a las pretensiones subsidiarias referente a la liquidación del estado posesorio se declaran parcialmente con lugar; entendiéndose por rechazado lo que que no haya sido expresamente concedido y acogiéndose de la siguiente forma: Se reconocen como accesiones las dos casa de habitación en mal estado, el pozo, el servicio sanitario, las cercas, 1 cacao, manzana de agua, mango, mamón chino, fruta de mono, carao, aguacate en favor de la actora.

Respecto de éstos, de preferir la accionada Rolafama Sociedad Anónima, como propietaria registral conservar lo plantado o las construcciones existentes, deberá reembolsar al actor el valor de los materiales y el de la mano de obra, sin consideración al mayor o menor valor que haya podido recibir la finca. Se rechazan los extremos de los años de posesión, plusvalía, derecho de retención, cobro de intereses. Se declaran parcialmente con lugar las excepciones de falta de derecho y legitimación activa. Se exonera a ambas partes del pago de las costas personales y procesales de la presente acción. Notifíquese.» (ver descarga de expediente electrónico descargado en formato PDf imágenes 237 a 251)

IV.El Tribunal avala los hechos probados 1) al 3) por ser coincidentes con el resultado de las probanzas que constan en autos. El hecho cuarto se reformula de la siguiente manera: El Instituto de Desarrollo Rural, Región de Desarrollo Huetar Caribe, respecto del caso de ocupación precaria del terreno en litis, dispuso dar por agotada la vía administrativa, dado que a la fecha que se planteó la gestión ya habían transcurrido más de diez años desde la ocupación (mismo fundamento de prueba citado en el fallo). De igual modo, de esta naturaleza, se añade el siguiente: La actora ingresa a ocupar el bien en litis en el año 2005, en virtud de un estado de necesidad, al haber sido objeto de agresión de su esposo del cual se separa, quedando como Jefa de Hogar con sus hijos pequeños y no contar con otro sustento, de forma tal que sus actos posesorios han consistido en siembras de distintos cultivos y frutales. gallinas ponedoras, para consumo propio y de su familia, habitación familiar, complementando su sustento con venta de esos productos así como actividades adicionales de subsistencia tales como venta de “rice and beans” y empanadas, de manera ininterrumpida hasta la fecha (declaraciones testimoniales de [Nombre 003] y [Nombre 004] y reconocimiento judicial, todos registrados en audios vinculados al expediente electrónico).

V. Se imprueba el hecho tenido por indemostrado dado lo que se ha tenido por probado en esta instancia

VI.La licenciada Joselyn Cordero Castillo, en su condición de defensora pública de la parte actora, interpuso recurso de apelación con indicación expresa de las razones en que se apoya para refutar la tesis del juzgado de instancia. Los agravios que se formulan contra el fallo son los siguientes:

  • 1)El presente proceso trata de una acción ordinaria de usucapión especial agraria, en el cual se pretende la titularidad de inmueble en litis debido a que la señora [Nombre 001] ingresó al terreno debido a un estado de necesidad. Sin embargo, la usucapión es rechazada debido a que supuestamente no se acreditó el ingreso al inmueble a causa de un estado de necesidad, lo cual no es de recibo.
  • 2)Se encuentran errores de valoración en la sentencia. Nótese que se aportaron medios de prueba idóneos y pertinentes que acreditan las actividades de subsistencia de la señora Yolanda, como lo es el reconocimiento judicial y la prueba testimonial. Sobre el particular, en la sentencia se indica lo siguiente: “… [Nombre 003] y [Nombre 004] fueron coincidentes en indicar que la actora ingresó al terreno junto a los demás invasores en el año 2006, indicaron que tiene cultivos como plátano, yuca, pepino, arboles frutales así como dos casas de habitación y se indicó que vive de los cultivos que siembra, y que habita permanente ahí, lo cierto es que no acredita haber ingresado por un estado de necesidad”. Del texto anterior, se puede concluir que existen graves incongruencias, debido a que se indica que no se aporta prueba y de manera simultánea se están valorando las declaraciones de las testigos. La valoración probatoria es sumamente confusa y nula. Y lo mismo sucede con el análisis dado en el reconocimiento judicial, en donde se valoró lo siguiente: “el reconocimiento judicial practicado a las once horas con treinta y tres minutos del dos de abril de dos mil veinticuatro se constató la existencia de unos pocos cultivos en el inmueble, que no se podrían tener como esenciales para las necesidades básicas de la actora o su familia, al no haberse constatado se haya dedicado el terreno a cultivos estables, consistentes y cuya producción alcance al menos para considerar de ha consistido en permanecer en el inmueble…”. Sin embargo, en esa diligencia, sí se acreditó la producción de yuca, calabazo, pipas, cacao, manzana de agua, pejibaye, carao, fruta de mono, mamón chino, yuca y aguacate, de ahí que no se logra entender cómo es que estos productos forman parte de una posesión estática. Nuevamente las valoraciones dadas no tienen una relación lógica y técnica con la prueba recibida. Además, la valoración sobre el reconocimiento judicial es errada en tanto la producción descrita es para la utilidad de la actora, su familia y para la venta, como bien quedó acreditada por la prueba testimonial. A causa de las individualidades de la señora Yolanda no se puede exigir una producción a grande escala resultando imposible debido a la situación económica de la misma. La producción realizada por doña Yolanda es de acuerdo a sus posibilidades.
  • 3)Aunado a lo anterior, en el mismo cuerpo de sentencia se indica que ante una consulta al INDER éste indica que no se cuenta con declaratoria de conflicto de ocupación precaria. Sin embargo, ello no es un elemento suficiente para rechazar esta acción, pues la persona juzgadora debe valorar la situación económica y social de la parte actora tanto al ingreso del inmueble, a lo largo del tiempo en posesión y lo que ha realizado en la actualidad. Lo que sí se puede acreditar es que la señora Yolanda es Jefa de Hogar, persona de escasos recursos, que ha puesto a producir el inmueble en litis, ha velado por la situación económica suya y de la familia, con mucho esfuerzo ha construido dos ranchos, ha realizado ventas de alimentos, ha cumplido con el fin social y económico de la propiedad y aún así no se acredita por parte de la juzgadora su estado de necesidad.
  • 4)Se cita como fundamento jurídico los ordinales 92 y 101 de la Ley del ITCO (ver escrito de apelación en imágenes 254 a 257).

VII. SOBRE LA USUCAPION ESPECIAL AGRARIA

En primer término, sobre este tema, la Sala Primera de la Corte en voto Número 172-F-S1-2008, de las nueve horas cincuenta y cinco minutos del cuatro de marzo de dos mil ocho ha considerado: “IV.- En realidad el argumento principal del recurrente se centra en proponer, que en el proceso de análisis se debieron aplicar las reglas de la “usucapión especial agraria”, y que por no haberse procedido de tal forma, el Ad quem incurre en una serie de indebidas apreciaciones de la prueba. A partir de este reclamo, resulta necesario, realizar algunas consideraciones generales respecto de los modos de adquirir la propiedad por prescripción positiva, tratándose de materia agraria. Así, habrá que distinguir entre la usucapión común y la especial, ambas previstas por esta rama del derecho. La primera requiere del cumplimiento de los requisitos exigidos por el Código Civil, debido a la ausencia de legislación agraria específica; es decir: título traslativo de dominio, buena fe y posesión.

Así, quien presenta una demanda agraria de esta naturaleza, debe demostrar el ejercicio de una posesión a título de dueño, en forma pública, pacífica e ininterrumpida por un período de 10 años. Se distingue de los procesos civiles por prescripción positiva, en que la posesión trasciende la simple ocupación del fundo, puesto que implica actos posesorios agrarios, tendientes a cultivar y mejorar el bien que se pretende usucapir. Por su parte, la usucapión especial agraria está prevista en la Ley de Tierras y Colonización, cuyo fundamento se encuentra en la posesión precaria, por la necesidad de explotación del fundo agrario, como medio de subsistencia propia o del núcleo familiar. Así, el numeral 92 de ese cuerpo legal establece: "Para los efectos de esta ley se entenderá que es poseedor en precario todo aquel que por necesidad realice actos de posesión estables y efectivos, como dueño, en forma pacífica, pública e ininterrumpida, por más de un año, y con el propósito de ponerlo en condiciones de producción para su subsistencia o la de su familia, sobre un terreno debidamente inscrito a nombre de un tercero en el Registro Público.

Los poseedores en precario que tengan posesión decenal en las condiciones enunciadas en el párrafo anterior, podrán inscribir su derecho de acuerdo con lo establecido en esta ley y por el procedimiento de información posesoria...". Por su parte el numeral 101 del mismo cuerpo normativo señala: "... para los efectos de la prescripción positiva de que este artículo trata, no era necesario el título traslativo de dominio que exige el Código Civil". Según lo ha indicado esta S., la posesión precaria de tierras constituye una modalidad de la posesión agraria, que por tal, consiste en el poder de hecho, sobre un bien de naturaleza productiva, cuya titularidad registral corresponde a un tercero, y que es ejercido de manera continua, efectiva y personal, mediante el desarrollo de una actividad económicamente organizada para la obtención de productos, animales o vegetales, cuyo fin último es satisfacer necesidades propias o las de su familia.

En esta, por ende, prevalecen la necesidad alimentaria y el trabajo familiar agrario. Sus requisitos, subjetivos y objetivos, tienen connotaciones distintas. No se requiere el simple ánimo de poseer, debe serlo en forma efectiva, directa y personal, para satisfacer las necesidades dichas. De ahí, para que opere, no es determinante la existencia de buena o mala fe, en tanto este elemento es sustituido por la necesidad. Según lo ordena la ley en este caso especial, no se exige el título traslativo de dominio. El efecto más importante de la posesión precaria es la adquisición de la propiedad agraria por la posesión decenal, es decir, la usucapión agraria. Por otro lado, cuando no se dan los presupuestos de un estado de necesidad, referidos en los ya citados artículos 92 y 101 de la Ley de Tierras y Colonización, se está frente a una usucapión agraria común, que tiene un régimen jurídico diverso a la usucapión agraria especial regulada por aquella ley.

Al respecto, consúltese la sentencia de esta Sala no. 755 de las 14 horas del 5 de octubre del 2006". Tal posición se reitera en resolución de esa misma Cámara No. 1357- F-2017 de las 14:45 horas del 07 de noviembre del 2017. Asimismo, este Tribunal ha reconocido la vigencia de ese instituto especial del Derecho Agrario, en reiteradas resoluciones, entre ellas las 100-F-19, 271-F-18 943-F-20, 1137-F-2020, 1260-F-2021 y más recientemente la 1186 de las 18:35 del 16 de diciembre del 2024. En esta última se hizo una reseña de varios antecedentes jurisprudenciales de la Sala Primera, Sala Constitucional y Tribunal Agrario, y en lo que interesa destacó: “De previo a entrar a analizar los agravios del recurrente, conviene realizar un análisis del régimen de la usucapión y sus requisitos, a fin de determinar si el caso ha sido resuelto conforme a derecho. Este Tribunal en forma reiterada ha sostenido: “En cuanto al instituto de la USUCAPION AGRARIA Es necesario distinguir la usucapión especial agraria –regulada en la Ley de Tierras y Colonización, de la usucapión agraria común.

La especial agraria, prescinde del justo título y de la buena fe, pues la misma Ley de Tierras, en su artículo 92 y 101 así lo establecen, pero exige la posesión agraria pública, pacífica, ininterrumpida, por más de diez años, sobre un terreno inscrito a nombre de un tercero, siempre y cuando los actos posesorios y la actividad agraria se realice para satisfacer necesidades propias o familiares. En la usucapión agraria común, en cambio, se exige además de los anteriores requisitos el justo título y la buena fe. Puede tratarse de una causa originaria (como el derecho de posesión) o derivada (mediante un contrato traslativo posesorio). Para el caso de la buena o mala fe, la primera se presume siempre, sin embargo, es poseedor de mala fe quien en el acto de la toma en posesión tuvo suficientes motivos para que dudara (artículos 284, 287 y 286 del Código Civil). La buena o mala fe se liga al convencimiento de la persona de que está poseyendo un bien propio, y la persona que le trasmitió era su legítima propietaria.” Tribunal Agrario, Voto No. 1033-F-06 de las once horas veinticinco minutos del diecinueve de octubre del dos mil seis.- El planteamiento de los hechos y las pretensiones de la RECONVENCIÓN, así como de los agravios del recurrente giran en torno a los requisitos de la usucapión especial agraria , por lo que no se requiere analizar si medió buena o mala fe en el ejercicio de la posesión ni se necesita un título traslativo de dominio, ya que ambos requisitos son sustituidos por un estado de necesidad en la precariedad del usucapiente, tal y como lo ha dicho la Sala Primera de la Corte: "IV.- En realidad el argumento principal del recurrente se centra en proponer, que en el proceso de análisis se debieron aplicar las reglas de la “usucapión especial agraria”, y que por no haberse procedido de tal forma, el Ad quem incurre en una serie de indebidas apreciaciones de la prueba.

A partir de este reclamo, resulta necesario, realizar algunas consideraciones generales respecto de los modos de adquirir la propiedad por prescripción positiva, tratándose de materia agraria. Así, habrá que distinguir entre la usucapión común y la especial, ambas previstas por esta rama del derecho. La primera requiere del cumplimiento de los requisitos exigidos por el Código Civil, debido a la ausencia de legislación agraria específica; es decir: título traslativo de dominio, buena fe y posesión. Así, quien presenta una demanda agraria de esta naturaleza, debe demostrar el ejercicio de una posesión a título de dueño, en forma pública, pacífica e ininterrumpida por un período de 10 años. Se distingue de los procesos civiles por prescripción positiva, en que la posesión trasciende la simple ocupación del fundo, puesto que implica actos posesorios agrarios, tendientes a cultivar y mejorar el bien que se pretende usucapir.

Por su parte, la usucapión especial agraria está prevista en la Ley de Tierras y Colonización, cuyo fundamento se encuentra en la posesión precaria, por la necesidad de explotación del fundo agrario, como medio de subsistencia propia o del núcleo familiar. Así, el numeral 92 de ese cuerpo legal establece: "Para los efectos de esta ley se entenderá que es poseedor en precario todo aquel que por necesidad realice actos de posesión estables y efectivos, como dueño, en forma pacífica, pública e ininterrumpida, por más de un año, y con el propósito de ponerlo en condiciones de producción para su subsistencia o la de su familia, sobre un terreno debidamente inscrito a nombre de un tercero en el Registro Público. Los poseedores en precario que tengan posesión decenal en las condiciones enunciadas en el párrafo anterior, podrán inscribir su derecho de acuerdo con lo establecido en esta ley y por el procedimiento de información posesoria...".

Por su parte el numeral 101 del mismo cuerpo normativo señala: "... para los efectos de la prescripción positiva de que este artículo trata, no será necesario el título traslativo de dominio que exige el Código Civil". Según lo ha indicado esta S., la posesión precaria de tierras constituye una modalidad de la posesión agraria, que por tal, consiste en el poder de hecho, sobre un bien de naturaleza productiva, cuya titularidad registral corresponde a un tercero, y que es ejercido de manera continua, efectiva y personal, mediante el desarrollo de una actividad económicamente organizada para la obtención de productos, animales o vegetales, cuyo fin último es satisfacer necesidades propias o las de su familia. En esta, por ende, prevalecen la necesidad alimentaria y el trabajo familiar agrario. Sus requisitos, subjetivos y objetivos, tienen connotaciones distintas. No se requiere el simple ánimo de poseer, debe serlo en forma efectiva, directa y personal, para satisfacer las necesidades dichas.

De ahí, para que opere, no es determinante la existencia de buena o mala fe, en tanto este elemento es sustituido por la necesidad. Según lo ordena la ley en este caso especial, no se exige el título traslativo de dominio. El efecto más importante de la posesión precaria es la adquisición de la propiedad agraria por la posesión decenal, es decir, la usucapión agraria. Por otro lado, cuando no se dan los presupuestos de un estado de necesidad, referidos en los ya citados artículos 92 y 101 de la Ley de Tierras y Colonización, se está frente a una usucapión agraria común, que tiene un régimen jurídico diverso a la usucapión agraria especial regulada por aquella ley. Al respecto, consúltese la sentencia de esta Sala no. 755 de las 14 horas del 5 de octubre del 2006." SALA PRIMERA DE LA CORTE SUPREMA DE JUSTICIA. Voto Número 172-F-S1-2008, de las nueve horas cincuenta y cinco minutos del cuatro de marzo de dos mil ocho.

Esas realidades sociales en el campo agrario, como la del presente caso, justifican la existencia y aplicación de los artículos 92 y 101 de la Ley de Tierras y Colonización, a fin de otorgar seguridad jurídica en la tenencia de la tierra, acorde con el principio establecido en el artículo 50 de la Constitución Política de que "El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza", y la equidad como un principio del Derecho Agrario regulado en el artículo 69 de nuestra Carta Magna. A mayor abundamiento, el artículo XXIII de la "Declaración Americana de los Derechos y Deberes del Hombre ", aprobada en la Novena Conferencia Internacional Americana, Bogotá, Colombia, 1948, como una manifestación de los Derechos Humanos de la primera y segunda generación, dispone: "Toda persona tiene derecho a la propiedad privada correspondiente a las necesidades esenciales de una vida decorosa, que contribuya a mantener la dignidad de la persona y del hogar".- IX.- Más recientemente, ha dicho este Tribunal: "VI.- Jurisprudencia Constitucional: La Sala Constitucional, en la sentencia No. 24178-2021, cuya jurisprudencia es vinculante, ha desarrollado la naturaleza de la propiedad agraria en torno a este instituto: VII.- Sobre el régimen de la propiedad agraria.- Este Tribunal Constitucional mediante la sentencia No. 2000-9119 de las 15:14 horas del 17 de octubre de 2000, indicó lo siguiente respecto a la propiedad agraria: “La propiedad agraria, determinada en este caso por su forma de adquisición a través de los mecanismos dispuestos en la Ley de Tierras y Colonización, se identifica por las obligaciones a cargo del propietario de ejercer actos de posesión en cumplimiento de la función social de su derecho.

Propiedad y posesión se encuentran entonces en una relación tal que la primera no puede ser conceptualizada sin la concurrencia de la segunda, de forma tal que, sin que la propiedad se desnaturalice como derecho subjetivo, su titular asume una serie de obligaciones en el ejercicio de su derecho. El Estado, atendiendo no sólo a ese carácter diferenciante de la propiedad agraria, sino enmarcado además dentro de la concepción de Estado Social y Democrático de Derecho que rige a nuestro país, reconocido en el artículo 50 de la Constitución Política, ha dispuesto a través de la Ley de Tierras y Colonización un procedimiento específicos de adquisición de este derecho con el afán de promover el aumento gradual de la productividad de la propiedad de la tierra, para una justa distribución de su producto y a efectos de elevar la condición social del campesino, haciéndolo partícipe del desarrollo de la Nación (artículo 1 de la citada Ley).” A partir de lo anterior, se desprende la posibilidad de adquisición por medio de la propiedad agraria a través de un procedimiento que busca como fin el destino de la producción de la tierra como característica fundamental, en virtud de su naturaleza.

Este procedimiento se encuentra regulado en la Ley No. 2825, Ley de Tierras y Colonización, a partir del numeral 92 y siguientes de dicho cuerpo normativo. El artículo 92 de la Ley de Tierras y Colonización establece los conflictos entre propietarios y poseedores en precario, donde se indica que el Instituto de Desarrollo Rural es el organismo encargado para intervenir en los casos de posesión precaria de tierras para procurar encontrar soluciones satisfactorias de acuerdo con la ley. Define al poseedor precario de la siguiente manera: “aquel que por necesidad realice actos de posesión estables y efectivos, como dueño, en forma pacífica, pública e ininterrumpida, por más de un año, y con el propósito de ponerlo en condiciones de producción para su subsistencia o la de su familia, sobre un terreno debidamente inscrito a nombre de un tercero en el Registro Público. Los poseedores en precario que tengan posesión decenal en las condiciones enunciadas en el párrafo anterior, podrán inscribir su derecho de acuerdo con lo establecido en esta ley y por el procedimiento de información posesoria…”.

Es importante aclarar que la Ley No. 9036, llegó a transformar el Instituto de Desarrollo Agrario (IDA) en el Instituto de Desarrollo Rural (INDER), y con su creación se realizaron derogaciones a la Ley No. 2825. Sin embargo, en las disposiciones finales de la Ley No. 9036, se dispuso claramente que el capítulo VI de la Ley No. 2825, que se encarga de regular los conflictos entre propietarios y poseedores en precario a la fecha se mantiene vigente. De conformidad con lo anterior, las normas en mención, establecen los requisitos que deben ser cumplidos para que una persona determinada sea considerada poseedora precaria bajo una ocupación precaria al realizar actos posesorios para generar producción en una tierra de la cual no es dueña. Para mayor entendimiento de los mismos, se cuenta con el artículo 195 del Reglamento a la Ley No. 9036 del 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER), quien se encargada de definir lo requisitos exigidos por el artículo 92 de la Ley de Tierras y Colonización, de la siguiente manera: “Artículo 195°- Ocupación Precaria.

Para que se considere que existe ocupación precaria deberá determinarse el cumplimiento de los requisitos establecidos en la Ley 2825 y que son los siguientes: a) Posesión anual: Deberá demostrar mediante cualquier medio probatorio permitido por ley que tiene más de un año de estar en posesión del predio objeto de conflicto. b) Estado de necesidad: Deberá demostrar el solicitante que ingresó a la propiedad para cubrir un estado de necesidad de subsistencia, es decir, que al momento del ingreso a la propiedad y hasta la fecha no tiene ningún otro medio de subsistencia para él y su familia que la producción que realiza en el predio ocupado. c) Subsistencia: Deberá demostrar el solicitante que el predio en conflicto es su único medio de subsistencia, por lo que, si tiene otros medios de subsistencia se considerará que no existe ocupación precaria. d) Área: El área poseída debe ser suficiente para ser considerada como una unidad productiva que responde a los parámetros mínimos que permitan la subsistencia conforme a la zona en que se ubica, su naturaleza y la actividad productiva que se realiza.” Se comprende que el ordenamiento jurídico permite que un poseedor precario al cumplir con los requisitos exigidos pueda adquirir una propiedad que se encuentra a nombre de otra persona en el Registro Público, por medio del régimen de la usucapión especial agraria, bajo la modalidad de la propiedad agraria.

De ese modo, se entiende que el conflicto entre un propietario y un poseedor precario, surge cuando el dueño registral de una propiedad particular la abandona para dejar de realizar actos de posesión en ella –conocida como presunción de abandono-, y en su lugar llega otra persona que aunque no le pertenezca adopta acciones tendientes a la posesión con el fin de producir en dicho terreno para satisfacer su necesidad de subsistencia, así como también la de su grupo familiar. Sin que exista algún reclamo u objeción por parte del propietario registral." Claramente, en este caso, del señor Isidoro, no solo existió posesión agraria, para satisfacer necesidades propias y de su familia, sino también un abandono total, pues nunca realizó actos posesorios en el inmueble, y tampoco ejerció ninguna acción permitida a las propietarios registrales (interdictos posesorios, desahucio por mera tolerancia, acción reivindicatoria, usurpación, etcétera), para poder recuperar el inmueble, salvo la acción de desahucio administrativo intentada en el año 2021 sin ningún éxito, donde más bien el señor Isidoro tubo apoyo de CONAPAM para poder defenderse.

La Sala Constitucional, en la misma sentencia No. 24178-2021, profundizó sobre la aplicación del referido instituto, en el Reglamento de la Ley Inder No. 9036 del 09 de abril del 2018, agregando a mayor abundamiento lo siguiente: "IX...Ahora bien, es necesario examinar la finalidad del contenido de la norma impugnada para determinar si cumple o no con los parámetros establecidos en el principio de proporcionalidad y razonabilidad. En el Reglamento a la Ley No. 9036 del 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER), se encuentra el artículo 195, el cual establece los requisitos que deben cumplirse para que se dé una ocupación precaria bajo la modalidad de la posesión agraria. La accionante cuestiona específicamente el requisito contemplado en el inciso c) de dicha norma, siendo este: “c) Subsistencia: Deberá demostrar el solicitante que el predio en conflicto es su único medio de subsistencia, por lo que, si tiene otros medios de subsistencia se considerará que no existe ocupación precaria.

(…).”. Como se indicó, esta Sala ha sostenido que para se sustente esa exigencia debe ser necesaria, idónea y proporcional. La necesidad tiene como base el proteger un bien o conjunto de bienes de la colectividad, en el caso específico al exigir el cumplimiento del requisito, busca proteger el derecho a la propiedad del propietario registral del bien, como lo establece el artículo 45 constitucional. Por su parte, la idoneidad del requisito es tutelar la posesión agraria a aquella persona determinada que realiza actos posesorios en un terreno sin ser el propietario registral del bien. No se pretender regalar el bien inmueble, sino busca que dicha ocupación surja con la realización de actos posesorios agrarios, como lo es la producción en la tierra, razón por la cual, exige como elemento esencial que dicho labor sea el único medio de subsistencia de la persona y de su grupo familiar para que de esa forma se dé la adquisición.

Finalmente, la proporcionalidad del requisito surge para evitar que se haga un despojo arbitrario al propietario registral; así como también evita que las personas utilicen la figura de la usucapión agraria para el lucro o la comercialización de las tierras; es decir, busca evitar que exista un abuso. A partir de lo expuesto, se determina que la norma impugnada es razonable, idónea y proporcional a los fines por los cuales fue creada. Asimismo, es importante aclarar que en el momento en que una persona determinada realiza la solicitud para ser calificada como poseedora en precaria, tiene únicamente una expectativa de derecho, debido a que la misma se encuentra sujeta al cumplimiento de los requisitos establecidos en la Ley. El legislador estableció que el Instituto de Desarrollo Rural es el organismo encargado para intervenir en los casos de posesión precaria de tierras, de ahí nace su legitimidad de poder determinar si una persona cumple o no con los requisitos para poder calificar como poseedor en precario persiguiendo como elemento fundamental la actividad productiva agraria en el terreno.

Aunado a lo anterior, se tiene que la usucapión agraria contempla requisitos especiales tendientes a buscar la producción y el trabajo agrario –vegetal o animal-. Para comprender más sobre esta figura, esta Sala Constitucional en la sentencia No. 04587-97 de las 15:45 horas del 05 de agosto de 1997, dispuso lo siguiente: “En cuanto a la propiedad agraria debe indicarse que cuando se reconoce la función social de la propiedad, el derecho de propiedad se configura como un derecho-deber, en el que existe una forma específica de ejercer las facultades del dominio, y se imponen al titular obligaciones como la utilización productiva de la tierra. Dado que el supuesto de hecho de la norma impugnada -artículo 7 párrafo primero de la Ley de Informaciones Posesorias- podría aplicarse en la hipótesis en que sobre el terrero que se pretende titular, antes de su afectación al dominio público, se haya ejercido posesión agraria, resulta necesario señalar los elementos que caracterizan el instituto de la usucapión agraria, como se hizo arriba con el régimen general de la usucapión civil ordinaria.

De acuerdo con la jurisprudencia, el fundamento de ese instituto lo constituye un principio general de Derecho Agrario: la función económico social de la propiedad agraria. Ese principio se integra fundamentalmente con dos aspectos: uno subjetivo, de orden económico, que consiste en la obligación del propietario de producir, mejorar y respetar el ambiente, y otro objetivo o social, que entraña la obligación del Estado de dotar de propiedad a quien está en condiciones de producir pero carece de tierra. En virtud de lo anterior, el trabajo agrario constituye el fundamento de la usucapión agraria al ser el instrumento por medio del cual se adquiere la propiedad de la tierra. Para la usucapión agraria la posesión adquiere un valor central como elemento obligatorio para adquirir el derecho de propiedad. El instituto de la usucapión agraria en Costa Rica coincide con la usucapión general del Código Civil en su estructura, sin embargo, difiere de ella en su función por la introducción de los principios antes expuestos.

Dentro de los elementos que caracterizan la usucapión agraria se encuentra una concepción especial del animus del poseedor que debe proyectarse por medio del ejercicio de actos posesorios agrarios. Este se refleja con mayor intensidad en la apropiación económica de las ganancias obtenidas por el trabajo sobre el fundo. Se presume que el que trabaja la tierra de esa forma lo hace a título de dueño. Por otra parte, el justo título lo constituye el trabajo agrario, y su no exigencia como documento permite que la adquisición pueda darse contra un título inscrito a nombre de un tercero en el Registro Público. Asimismo, en la usucapión agraria no existe la distinción de la posesión de buena o mala fe, porque lo que interesa es fundamentalmente la actividad productiva agraria. La legislación especial agraria en Costa Rica ha ido eliminando el justo título y la buena fe en la usucapión al punto de que la no exigencia de esos requisitos se ha convertido en la regla y su excepción se encuentra en sede civil en la hipótesis de adquisición derivativa de la posesión.

Ahora bien, la doctrina y la jurisprudencia han entendido que en los artículo 92 y 101 de la Ley de Tierras y Colonización No.2825 de 14 de octubre de 1961 y sus reformas, se regula expresamente la usucapión agraria de tierras. En esos artículos se define la figura de la posesión precaria de tierras que constituye una modalidad de la posesión agraria. Consiste en un poder de hecho sobre un bien de naturaleza productiva, inscrito a nombre de un tercero en el Registro Público, en el que se realizan actos estables y efectivos de posesión que se dirigen a poner el bien en condiciones de producción con el fin de satisfacer necesidades propias del poseedor y de su familia. Como en la posesión precaria prevalecen la necesidad alimentaria y el trabajo agrario, se debe poseer en forma directa y personal -no basta el simple ánimo de poseer-. Asimismo, se prescinde de la consideración de si existe buena o mala fe, toda vez que el poseedor en precario sabe que el bien que trabaja está inscrito a nombre de un tercero en el Registro Público.

También se excluye el título traslativo de dominio porque el título lo constituye el trabajo agrario.” (El resaltado no corresponde al original). Del precedente citado, se desprende, que el requisito contemplado en la norma impugnada para que una persona determinada sea calificada como poseedor precario responde a un principio de función social, que garantizar la productividad de las tierras en condición de necesidad para satisfacer las necesidades de la persona ocupante como de su familia. Así las cosas, este Tribunal Constitucional considera que la exigencia del requisito estipulado en el inciso c) del artículo 195 del Reglamento a la Ley No. 9036 del 09 de abril de 2018 (Ley de Transformación del IDA en el Instituto de Desarrollo Rural, INDER), es completamente proporcional y razonable. En ese sentido, resulta esencial reiterar lo señalado en la sentencia anteriormente descrita, respecto a que el trabajo agrario constituye el fundamento de la usucapión agraria al ser el instrumento por medio del cual se adquiere la propiedad de la tierra.

Se determina que está figura especial consagrada en el Derecho Agrario se creó precisamente para aquellos casos en donde una persona al plantear la solicitud del conflictos entre propietarios y poseedores en precario, tiene que demostrar que su medio de subsistencia de las necesidades básicas provengan del trabajo agrario de la tierra, lo cual, excluye que esa subsistencia se dé por medios distintos a la producción de la tierra. Este elemento fundamental justifica la usucapión especial agraria como excepción a la figura general, pues no basta el ánimo de poseer. De ese modo, tal requisito no resulta arbitrario ni desproporcionado, en virtud de lo expuesto, este Tribunal Constitucional descarta que la norma impugnada lesione el principio de proporcionalidad constitucional. En consecuencia, la acción debe ser desestimada en cuanto a este extremo se refiere." Véase que la Sala constitucional reafirma su propia jurisprudencia vinculante que establece al trabajo agrario con fundamento de la usucapión especial agraria, y es justamente para valorizar no solamente una forma de acceso a la propiedad, sino para garantizar el ejercicio de la función económica, social y ambiental de la propiedad.

Por eso es que también en la Ley de Tierras y Colonización se integran otras disposiciones, como el artículo 144, que establecen las causales de expropiación por incumplimiento de la función social, como lo es el dejar en estado de abandono la propiedad. Lo anterior va acorde con un principio del derecho agrario como "derecho de equidad", contenido en el artículo 1 de la Ley, que en su inciso 6) dispone: "La presente Ley tiene por objeto: 6) Determinar que la tierra no debe utilizarse para la explotación del trabajador agrícola. El Estado, por todos los medios a su alcance, estimulará la formación de cooperativas agrícolas para combinar la dignidad de la pequeña propiedad con la eficiencia de la gran empresa". Y como consecuencia de lo anterior, resulta evidente que en este caso, el comportamiento del demandado Raúl Álvarez Alfaro (y sus trasmitentes), fue no solamente de abandono total de la propiedad, sino de pretender desalojar en sede administrativa el mismo, explotando al trabajador agrícola, que con un esfuerzo de más de veinticinco años ha mantenido el terreno en condiciones productivas, por necesidad, para satisfacer y mantener a su familia." (TRIBUNAL AGRARIO, Voto No. 2024000695 de las diez horas doce minutos del quince de julio de dos mil veinticuatro)”.

VIII.En la especie, este Tribunal ha procedido a valorar el acervo probatorio con base en el principio de libre valoración contenido en el artículo 54 de la Ley de Jurisdicción Agraria (aplicable al caso por disponerlo así el Transitorio I del Código Procesal Agrario), de manera que logra concluir la prueba es diáfana en cuanto a que la actora ingresó a ocupar el bien objeto de litis por un evidente estado de necesidad, para proveerse su subsistencia y la de su familia, dado que estaba en una situación de vulnerabilidad y pobreza. Tal posesión la ha ejercido de manera ininterrumpida y como dueña por un plazo decenal que se había cumplido al momento de la interposición de la demanda. De ahí que no se compartan las conclusiones a las que llega la A Quo toda vez de las mismas pruebas que se citan en el fallo se deriva todo lo contrario. Así, la testigo [Nombre 003] manifestó conocer como dueña a la actora Yolanda, indicando que entró a poseer en el año 2005.

Explicó que ésta alquilaba otro lugar para vivir pero que ya no podía seguir alquilando y decide unirse a un grupo de personas que ingresan al bien, el cual estaba en abandono o encharralado. Detalló que Yolanda venía “con todos los chiquillos” de ella, como 4 o 5, y que es una persona que siempre la ha luchado, quien sembró yuca, árboles frutales, ha tenido gallinas ponedoras, que los usa para consumo propio y venta y que además hace “rice and beans” y empanadas para proveerse el sustento. Manifestó que ella nunca ha abandonado el terreno. En el mismo sentido, [Nombre 004], explicó que la actora tenía 12 o 14 años de poseer el terreno. Narró que ella tomó ese terreno porque el esposo era agresor, lo que motivó una separación, quedando Yolanda sola con sus hijos pequeños, de ahí que ingresó al terreno porque no tenía donde vivir, ya que era ama de casa y no tenía un trabajo. Coincidió con la anterior testigo en que el fundo estaba estaba totalmente encharralado y suamposo, con mucho breñero, y que el grupo que se introdujo al bien hizo la limpieza y desde eso doña Yolanda trabaja y cultiva el terreno.

Detalló que ha tenido diferentes cultivos como plátano, yuca, pepino, frutales, que llega un camión y le compra pipa y que además ha tenido gallinas. Expresó que cuando ella ingresó al fundo no tenía trabajo y que los cultivos los usaba para ingresos propios y que nunca ha abandonado el terreno. Volvió a reiterar que Yolanda comercializa pipas, mangos, miel de carao, saca aceite de coco, siembra yuca, pepino, pipian, y otros árboles frutales. Por su parte los testigos ofrecidos por la parte demandada, a saber, Carlos Alberto Hernández Bonilla y Alejandro Brenes Obando no contradicen esas circunstancias personales del ingreso de la actora al bien, ni se ha aportado otra prueba que desvirtúe lo acreditado. Además, del reconocimiento judicial practicado se deriva que esa situación de pobreza se mantiene relativamente, y que la actora sigue utilizando el bien para su subsistencia, pues se evidenciaron dos casas de madera humildes o en mal estado, un pozo, la existencia de cultivos de cacao, manzana de agua, mango, carao, pejivalle, fruta de mono, mamón chino, yuca, plátano, calabaza, un aguacate, manga y pipas, en un área que evidentemente refleja lo son para subsistencia.

En este orden de ideas, llama la atención a este Tribunal la apreciación de la A Quo de que el hecho la actora haga tamales y “rice and beans” para la venta no corresponda a una situación o estado de necesidad. Lo anterior porque de acuerdo a las reglas de la lógica y la experiencia humana más bien se aprecia que es un elemento que refuerza su situación de vulnerabilidad y que ese estado de necesidad se mantiene aún diez años después. Es evidente que la actora ingresa como poseedora en precario, para tratar de dar sustento a sus hijos pequeños, en un contexto de agresión que sufría de su esposo -del cual debió separarse- quedando como Jefa de Hogar, y combina una serie de actividades para subsistir, desde siembra de diversos cultivos, venta de comidas, hasta actividad de producción de gallinas ponedoras. Además, destinó evidentemente el fundo a vivienda para su núcleo familiar. De ahí que esa posesión “estática” que calificó la A Quo no sea conforme con el mérito de los autos.

Ciertamente no se da una producción agraria a gran escala, pero ello no elimina que ese fundo haya sido su medio de producción para proveer su sustento diario. La empresa agraria de subsistencia está reconocida en nuestra legislación, propiamente en el artículo 92 de la Ley de Tierras y Colonización. Tal norma establece: "Para los efectos de esta ley se entenderá que es poseedor en precario todo aquel que por necesidad realice actos de posesión estables y efectivos, como dueño, en forma pacífica, pública e ininterrumpida, por más de un año, y con el propósito de ponerlo en condiciones de producción para su subsistencia o la de su familia, sobre un terreno debidamente inscrito a nombre de un tercero en el Registro Público. Los poseedores en precario que tengan posesión decenal en las condiciones enunciadas en el párrafo anterior, podrán inscribir su derecho de acuerdo con lo establecido en esta ley y por el procedimiento de información posesoria...".

Por su parte el numeral 101 del mismo cuerpo normativo señala: "... para los efectos de la prescripción positiva de que este artículo trata, no será necesario el título traslativo de dominio que exige el Código Civil". Una de las características de ese tipo de actividad es que su fin primordial es garantizar la seguridad alimentaria de un grupo familiar y satisfacer su necesidad de vivienda, en ocasiones con una producción de bajo nivel de tecnificación debido a que esas actividades de subsistencia se suelen realizar de una manera más tradicional. Por consiguiente, conforme a las normas citadas, no es determinante la existencia de buena fe ni del justo título (propios de la usucapión común), en tanto estos elementos son sustituidos por la necesidad, prevaleciendo así la necesidad alimentaria y el trabajo familiar agrario. Por otro lado, lo que se indica en el fallo de que la actora había sido desalojada del bien, de la prueba traída al proceso no se desprende tal circunstancia.

Aunque los testigos ofrecidos por la parte demandada, Carlos Alberto Hernández Bonilla y Alejandro Brenes Obando mencionaron de la presencia de la Fuerza Pública en el lugar, entre los años 2008 y 2009, es lo cierto que ello no implica se hubiese realizado un desalojo administrativo. La parte demandada no lo probó en este proceso, y en todo caso se ha demostrado el estado de necesidad con que ingresó la actora al terreno, su permanencia en el inmueble desde el año 2005 y que lo ha hecho de manera ininterrumpida, sin que se hubiese interpuesto o declarado con lugar una acción judicial en su contra tendiente a interrumpir el plazo de la prescripción decenal. Así las cosas, procede acoger los agravios 1), 2) y 4).

IX.En otro orden de ideas, resta por analizar el argumento que se incluye en la sentencia en el sentido de que el INDER no procedió a declarar a la actora como poseedora en precario, lo cual se reprocha en el tercer cargo al fallo. En tal sentido lleva razón la apelante. Ese procedimiento administrativo tiene como fin primordial el que esa entidad, constatada la precariedad de la persona ocupante, trate de solucionar el conflicto a través de una compra directa al propietario registral, pero nunca excluye la posibilidad de que en vía judicial, se analice como presupuesto de fondo de la usucapión especial agraria la condición de la persona poseedora en precario, tal y como se constata en este caso (en esta misma línea ha resuelto este Tribunal en votos No.688-F-2021 y No. 271-F-2018). Asimismo, tal y como se desprende del oficio emitido por el el Instituto de Desarrollo Rural, Región de Desarrollo Huetar Caribe respecto del conflicto de usucapión precaria relacionado con la finca en litis, No. RDHC-1322-2019 de fecha 10 de octubre del 2019, tal condición no fue declarada por el Instituto de Desarrollo Agrario, al razonarse por tal ente que se reclamaba una posesión mayor a la decenal y que según el Reglamento Ejecutivo de la Ley 9036 en sus artículo 194, párrafo 2, al determinarse que las personas ocupantes tienen una posesión superior a los diez años, se declarara que no existe conflicto de ocupación en precario, dando por agotada la vía administrativa de intermediación (documento en imagen 51).

Ese acto administrativo en forma alguna debe de interpretarse como una denegatoria de la condición de posesión en precario, sino que más bien refuerza el hecho de que al alegarse existir una posesión decenal, a nada conducía declarar el conflicto. Lo anterior encuentra fundamento lógico en el canon 101 de la Ley de Tierras y Colonización en el sentido que dispone “…no se incluirán en el avalúo ni se pagarán, las parcelas respecto de las cuales deba admitirse como procedente la excepción de prescripción positiva …” lo que implica necesariamente que sean los Tribunales quienes analicen su procedencia, pues demostrada la consolidación de la usucapión especial agraria, a nada conduciría una intervención del Instituto para materializar una eventual expropiación o compra directa.

IX.En virtud de lo anteriormente expuesto, al haberse configurado la usucapión especial agraria, con fundamento en los artículos 1 y 2 de la Ley de Jurisdicción Agraria y ordinales 92 y 101 de la Ley de Tierras y Colonización procede revocar la sentencia. En su lugar se rechazan las excepciones de falta de derecho y de falta de legitimación activa y pasiva y se acoge la pretensión principal de usucapión especial agraria en la forma que se dirá. En consecuencia: 1) Se declara que la actora ha adquirido el terreno en litigio, por usucapión especial agraria al demostrar su estado de necesidad en precario por más de diez años, localizado en [...], colinda Norte [Nombre 005], Sur calle pública, Este [Nombre 004], Oeste [Nombre 006], parte de la finca de la provincia de Limón matrícula [Valor 008]. 2) En etapa de ejecución de sentencia se deberá de segregar la porción de terreno dicha para que se inscriba a su nombre en el Registro Nacional como finca independiente, debiendo la actora correr con los gastos de confección del plano catastrado. Una vez confeccionado el plano e inscrito ante el Departamento de Catastro, deberá inscribirse por medio de ejecutoria que emita el despacho, debiendo cubrir la actora los gastos que eventualmente se generen para su efectiva inscripción. 3) Se condena a la parte demandada al pago de las costas.

POR TANTO

Se revoca la sentencia. En su lugar se rechazan las excepciones de falta de derecho y de falta de legitimación activa y pasiva y se acoge la pretensión principal de usucapión especial agraria en la forma que se dirá. En consecuencia: 1) Se declara que la actora ha adquirido el terreno en litigio, por usucapión especial agraria al demostrar su estado de necesidad en precario por más de diez años, localizado en [...], colinda Norte [Nombre 005], Sur calle pública, Este [Nombre 004], Oeste [Nombre 006], parte de la finca de la provincia de Limón matrícula [Valor 008]. 2) En etapa de ejecución de sentencia se deberá de segregar la porción de terreno dicha para que se inscriba a su nombre en el Registro Nacional como finca independiente, debiendo la actora correr con los gastos de confección del plano catastrado.
