This Tribunal hears the declination of jurisdiction (inhibitoria) entered at nineteen hours and ten minutes on treinta y uno de julio del año dos mil veinticuatro.

Judge López Barrantes writes the opinion; and,

WHEREAS:

I.The Juzgado Agrario de Puntarenas declines jurisdiction over this matter on subject-matter grounds, stating that the holding (fundo) at issue is land intended for construction and is also located within the maritime-terrestrial zone (zona marítimo terrestre) (images 105 to 107).

II. CONCERNING AGRARIAN JURISDICTION OVER PUBLIC-DOMAIN PROPERTY (BIENES DE DOMINIO PÚBLICO)

Agrarian subject-matter jurisdiction is defined generally in Articles 1 and 2, subsection h), of the Ley de Jurisdicción Agraria. Those provisions empower judges in this field to adjudicate or resolve disputes related to the conduct of agrarian or agro-environmental activities (actividades agrarias o agroambientales), or activities connected with them. An agrarian holding (fundo agrario) is one devoted to such activities or capable of being devoted to them. For the latter situation, it is important to consider the size and location of the land and the type of production that may be undertaken on it. The foregoing criteria must also be adapted to the needs and requirements arising from modern technologies and scientific advances in agricultural development. For example, land that previously could not be devoted to agrarian activities—because of its size or the prevailing climate in the area—may now be so devoted if hydroponic agriculture or other technologies are actually implemented, in which the “earth or soil” substrate is not essential (Voto 180-2018, issued by this Tribunal, may be consulted).

Regarding disputes involving public-domain property, Article 22, subsection ch, of the 1982 Ley de la Jurisdicción Agraria provided: “... In matters heard by the agrarian jurisdiction, the parties are: ch) The Procuraduría General de la República, in all matters concerning the protection of the public domain and the exercise of the powers conferred upon it by law in this area ...”. In other words, under that provision, this field has subject-matter jurisdiction to hear cases adjudicated with respect to public-domain assets (bienes dominicales), but only insofar as they concern the subject matter of Articles 1 and 2 of this same agrarian legislation. Subsequently, Article 108 of the 1998 Ley de Biodiversidad provided as follows: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative-litigation courts (jurisdicción contencioso administrativa).

As exceptions to the foregoing rule, offenses against biodiversity shall be tried by the criminal courts; likewise, disputes arising between private parties, where neither an administrative act nor public-domain property is involved, shall fall within the jurisdiction of the agrarian courts.” This provision assigns disputes involving public-domain property to the administrative-litigation jurisdiction. However, Article 106.2 of the 2018 Código Procesal Civil established the following: “... A possessory injunction against interference (interdicto de amparo de posesión) shall be appropriate when a person in possession of real property is disturbed by acts that impair the free enjoyment of the property or demonstrate an intent to dispossess, or when such acts affect the use and enjoyment of public property to the detriment of the community ...”. Similarly, Article 106.3 established: “... A possessory restitution injunction (interdicto de restitución) is appropriate when the possessor, or the general public in the case of public property, is unlawfully dispossessed of the property, in whole or in part ...”.

In other words, the civil jurisdiction—and also the agrarian jurisdiction when applying the provisions of that supplementary legislation in summary possessory proceedings (conflictos sumarios interdictales) conducted before this specialized forum—is empowered to hear disputes concerning the public domain (demanio público). As may be observed, there is a conflict of laws that requires us to consider whether disputes involving public-domain assets fall within the exclusive jurisdiction of the administrative-litigation courts or within another jurisdiction, such as the agrarian jurisdiction. Article 49 of the Constitución Política provided: “... The administrative-litigation jurisdiction is hereby established as a function of the Poder Judicial for the purpose of ensuring the lawfulness of the administrative functions of the State, its institutions, and every other public-law entity... Misuse of authority shall constitute grounds for challenging administrative acts...

The law shall protect, at a minimum, the subjective rights and legitimate interests of persons subject to the administration ...”. It cannot be inferred from this text that the 1949 Constituent Assembly granted the administrative-litigation jurisdiction exclusive authority to hear disputes concerning public-domain property (bienes demaniales). Accordingly, this Tribunal understands that, because such property belongs to the community and safeguards a public interest, any court may hear a dispute arising in connection with it, provided that the claim does not seek to challenge the administrative functions of the centralized or decentralized State. Furthermore, in Voto 2010-9928, supplemented by Voto 2010-11034, the Sala Constitucional defined the rules governing jurisdictional conflicts between the administrative-litigation jurisdiction and other jurisdictions, holding that the legal regime applicable to the relationship and the substantive content of the claim must be examined.

Accordingly, in each case this jurisdiction shall determine whether the matter disputed within a public-domain area (zona dominical) must be decided under the body of rules comprising agrarian law, so that the dispute remains before this forum, or whether it must be referred to the administrative-litigation or civil jurisdiction, as appropriate.

III. DECISION OF THE TRIBUNAL

A review of the case file shows from the complaint (see fact 1, image 7) that the nature of the holding at issue is land intended for construction (see the property-certification evidence in box 27), registered under property number 53868-000 and described in survey plan P-0523221-1984, whose cadastral identifier is 609010053868 (image 28). In the fourth allegation of the complaint (box 8), the plaintiff states that the property is planted with mango and soursop trees. According to the account in the complaint, part of the dispute between the parties concerns the introduction of a cow onto the holding in question and the cutting of several mango trees (facts 6 and 9). In answering the action brought against them (boxes 70 to 75), the defendants deny the allegations and explain that the holding lies within the maritime-terrestrial zone. They acknowledge that mango and soursop trees exist at the site and even state that they use their fruit for personal consumption.

Evidence issued by the Departamento de Geografía y Geomática del Instituto Geográfico Nacional was added to the case file (images 83 to 100). That evidence concludes that the holding described in survey plan P-0523221-1984 is located within the public mangrove area belonging to the maritime-terrestrial zone. This case concerns a series of real-property actions (acciones reales) arising from ownership rights over land registered in the name of a private individual but situated within the maritime-terrestrial zone. Because the dispute does not concern any administrative conduct or function but instead involves agrarian real rights (derechos reales agrarios), particularly since the complaint indicates that the property claimed by the plaintiff is registered in that person’s name, this Chamber considers the matter agrarian in nature because fruit trees are cultivated there and the property has been used for subsistence livestock farming. Consequently, the declination of jurisdiction entered by the Juzgado must be denied.

IV.Pursuant to Articles 1, 2, 16, and 22 of the Ley de la Jurisdicción Agraria, 108 of the Ley de Biodiversidad, 106.3 and 106.4 of the Código Procesal Civil, and 49 of the Constitución Política, the declination of jurisdiction entered by the Juzgado is denied. The case file is ordered remanded so that the court of origin may continue hearing the matter.

Tramitado ante el Juzgado Agrario de Puntarenas. Conoce este Tribunal de la inhibitoria de las diecinueve horas con diez minutos del treinta y uno de julio del año dos mil veinticuatro.

Redacta el juez López Barrantes; y,

CONSIDERANDO:

I.El Juzgado Agrario de Puntarenas decreta la inhibitoria del conocimiento de este asunto en razón de la materia, exponiendo que el fundo objeto del conflicto responde a un terreno para construir, y, además, se ubica dentro de la zona marítimo terrestre (imágenes 105 a 107).

II. SOBRE LA COMPETENCIA AGRARIA EN BIENES DE DOMINIO PÚBLICO

La competencia agraria por razón de la materia está definida genéricamente en los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. Dichas normas facultan a las personas juzgadoras de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias o agroambientales, o conexas a éstas. Se considera fundo agrario aquel destinado a dichas actividades, o que pueda destinarse a ellas. Para éste último supuesto, es importante tomar en cuenta la medida, la ubicación del terreno y el tipo de producción que se puede desarrollar en él. Los anteriores criterios deben además ajustarse a las necesidades y requerimientos que las tecnologías modernas y avances científicos planteen en materia de desarrollo agropecuario. Por ejemplo, terrenos que antes no podían destinarse a actividades agrarias -por su tamaño o el clima imperante en la zona-, actualmente pueden serlo, si se desarrolla en hechos agricultura hidropónica o con otras tecnologías, en las cuales el sustrato "tierra o suelo" no es fundamental (puede consultarse el Voto 180-2018, emitido por este Tribunal).

Sobre las discusiones que recaen en bienes de dominio público el artículo 22, inciso ch, de la Ley de la Jurisdicción Agraria de 1982, dispuso: "... En los negocios de conocimiento de la jurisdicción agraria, son partes: ch) La Procuraduría General de la República, en todos los asuntos relativos a la tutela del dominio público y al ejercicio de las atribuciones que la ley le confiere en esta materia ...". Es decir, al amparo de esa norma nuestra materia tiene competencia material para conocer asuntos dirimidos en bienes dominicales; pero, siempre y cuando versen sobre los contenidos de los artículos 1 y 2 de esta misma legislación agraria. Posteriormente, mediante la Ley de Biodiversidad de 1998, se dispuso en su artículo 108 lo siguiente: "En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso administrativa.

Como excepciones de la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria". Esta norma le atribuye el conocimiento de conflictos en bienes de dominio público a la jurisdicción contenciosa administrativa. Sin embargo, a través del Código Procesal Civil de 2018, se estableció en el artículo 106.2 lo siguiente: "... El interdicto de amparo de posesión será procedente cuando el que se haya en la posesión de un inmueble es perturbado por actos que perjudiquen el libre goce del bien o que manifiesten intención de despojo, o bien, cuando estos actos se realizan afectando el uso y el disfrute de bienes públicos, en detrimento de la colectividad ...". En igual sentido, el cardinal 106.3 determinó: "...

Es procedente el interdicto de restitución cuando el poseedor, o la ciudadanía en general, en el caso de bienes públicos, son despojados ilegítimamente del inmueble, total o parcialmente ...". Es decir, se faculta a la jurisdicción civil, también la agraria al aplicar las disposiciones de esa normativa supletoria en conflictos sumarios interdictales tramitados ante esta sede especializada, los conflictos que versen sobre el demanio público. Como podemos observar, existe un conflicto de normas que nos hacen reflexionar si las discusiones en bienes de dominicales es una competencia exclusiva de la jurisdicción contenciosa administrativa, o bien, otra como sería el caso de la agraria. El artículo 49 de la Constitución Política dispuso: "... Establécese la jurisdicción contencioso - administrativa como atribución del Poder Judicial, con el objeto de garantizar la legalidad de la función administrativa del Estado, de sus instituciones y de toda otra entidad de derecho público...

La desviación de poder será motivo de impugnación de los actos administrativos... La ley protegerá, al menos, los derechos subjetivos y los intereses legítimos de los administrados ...". De este texto no se logra desprender que el Constituyente de 1949 le haya dado la exclusividad a la jurisdicción de lo contencioso administrativo del conocimiento de conflictos sobre bienes demaniales. Así las cosas, comprende este Tribunal que al ser bienes de la colectividad que resguardan un interés público cualquier estrado judicial puede conocer alguna controversia que surjan alrededor de éste, siempre y cuando, no se pretenda la impugnación de la función administrativa del Estado central o descentralizado. Además, la Sala Constitucional en el Voto 2010-9928, adicionado por el Voto 2010-11034, definió sobre la competencia de conflictos entre la jurisdicción contenciosa administrativa y otras, en donde dispuso que debe revisarse el régimen jurídico aplicable a la relación y el contenido material de la pretensión.

Así las cosas, ante esta jurisdicción se analizará en cada caso si lo discutido en zona dominical el régimen jurídico que corresponde decretar es a través del conjunto de normas que componen el ordenamiento agrario a fin de mantener el conflicto ante esta sede, o bien, remitirlo a la contenciosa administrativa o civil, según corresponda.

III. DECISIÓN DEL TRIBUNAL

Del estudio del expediente, se logra desprender de la demanda (ver hecho 1, imagen 7), que la naturaleza del fundo en conflicto lo es para construir (ver prueba de certificación de finca en cuadro 27), el cual está inscrito bajo matrícula 53868-000, y descrito en el plano P-0523221-1984, cuyo identificador predial es el 609010053868 (imagen 28). En el hecho cuarto de la demanda (cuadro 8), la parte accionante indica que el inmueble se encuentra sembrado con árboles de mango y guanábana. Parte del conflicto que se ha dado entre las partes, según el relato de la demanda, lo es la introducción de una vaca en el fundo en cuestión, y la corta de unos árboles de mango (hechos 6 y 9). La parte demandada al contestar la acción incoada en su contra (cuadros 70 a 75), lo hace de forma negativa y explica que el fundo se encuentra comprendido dentro de la zona marítimo terrestre. Aceptan que en el sitio existen árboles de mango y guanábana e incluso dicen lo aprovechan para consumo propio.

En el expediente se incorporó una prueba expedida por el Departamento de Geografía y Geomática del Instituto Geográfico Nacional (imágenes 83 a 100). En dicha probanza concluyen que el fundo descrito en el plano P-0523221-1984, está ubicado dentro de la zona pública de manglar perteneciente a la zona marítimo terrestre. En este caso, se discuten una serie de acciones reales del derecho de propiedad sobre un terreno inscrito a nombre de una persona particular; pero, que está inmerso en la zona marítimo terrestre. Al no versar el conflicto sobre alguna conducta o función administrativa, sino más bien, sobre la discusión de derechos reales agrarios, máxime que según se desprende de la demanda el bien que reclama la actora se encuentra inscrito a favor de dicha persona, considera esta Cámara que sí es de naturaleza agraria en virtud de que en éste existen cultivos de árboles frutales y el bien se ha dedicado a la actividad ganadera de subsistencia. En consecuencia, deberá de improbarse la inhibitoria decretada por el Juzgado.

IV.De conformidad con los artículos 1, 2, 16, y 22 de la Ley de la Jurisdicción Agraria, 108 de la Ley de Biodiversidad, 106.3 y 106.4 del Código Procesal Civil, y 49 de la Constitución Política, se imprueba la inhibitoria decretada por el Juzgado. Se ordena el reenvío del expediente para que el Despacho de origen continúe con su conocimiento.
