WHEREAS:
A review of the case file discloses the following proceedings: 1- The plaintiff requests that the judgment declare: “1-. Completely cut down and fell the Dipteryx Panamensis (almendro amarillo) tree located on the property belonging to my principal, registered in the Alajuela registry district under Real Folio registration number 339969-000, whose description and photograph appear in the technical report labeled as evidence 2. 5-.(sic) If the State opposes this proceeding without grounds, an award of both categories of costs in this proceeding is requested.” (see electronic case file downloaded in PDF format, image 3). 2- The Procuraduría General de la República entered an appearance in this proceeding. Judge Ana Milena Castro Elizondo of the Agrarian Court of the Second Judicial Circuit of Alajuela, San Carlos, in oral judgment number 262-S-2024, issued at eleven hours and fifty-one minutes on veinticuatro de mayo del dos mil veinticuatro, ruled: “OPERATIVE PROVISIONS (POR TANTO): THE DEFENSE OF LACK OF PASSIVE STANDING ON THE MERITS (FALTA DE LEGITIMACIÓN AD CAUSAM PASIVA), raised by the Procuraduría General de la República, is sustained. The present Summary Felling action brought by ANANAS EXPORT COMPANY S. A against the State is DENIED. As a preventive and safety measure, the plaintiff must establish a BUFFER zone with a minimum radius of cincuenta metros around the almendro amarillo tree at issue in the proceeding, located on the property in the Alajuela registry district under registration number tres tres nueve nueve seis nueve – cero cero cero. No special award of costs is made. A copy of the operative portion of this judgment shall be sent to the SINAC Regional Office. III.APPEAL Attorney Carlos Francisco Millet Nieto, in his capacity as special litigation counsel for the plaintiff, filed an appeal expressly stating the grounds on which it was based in order to refute the trial court’s position (see electronic case-file download in PDF format, images 86 to 91). He sets forth the following grounds of appeal: 1- Erroneous assessment of the technical evidence. He argues that two expert opinions were submitted in the proceeding to determine the condition of the tree whose felling is sought. Despite this, he contends that the judgment gave greater weight to the technical report prepared by the official of the Sistema Nacional de Áreas de Conservación (hereinafter SINAC) than to the report prepared by the forestry engineer whom they presented in the proceeding; the latter report, he states, is more technical and is based on a detailed study of the tree’s current condition, its imminent damage, the absence of nesting by birds of any kind, and the danger it poses.
He maintains that this report emphasizes that the tree in question has an internal hollow in its trunk extending approximately 18 metros from its base, leaving it nearly dead and causing branches to fall and multiple ruptures along its trunk, as well as evident deterioration. He states that these conditions make the tree dangerous to persons who may pass near it. He further objects to the expert assessment prepared by SINAC, which he says was merely visual and did not analyze the depth of the trunk’s condition; moreover, it was based on three considerations: namely, that the tree has green leaves and was therefore deemed alive; that no external roots were observed and it was therefore deemed firmly rooted; and that it could be a nesting site for the lapa verde, without providing specific details on this point that would lend certainty to the opinion. Along those lines, he states that, when the two technical reports are compared, the one prepared by SINAC lacks information relevant to deciding this summary proceeding because it rests on mere assumptions, unlike the report prepared by the forestry engineer presented by the plaintiff, which states that the tree is nearly dead and has no possibility of surviving or regenerating.
He asserts that it was shown that no lapa verde has nested in the tree for a prolonged period because such birds do not nest in trees in that condition and because the tree stands in isolation. He continues his objection by asserting that the tree poses a danger because it could fall. 2- Erroneous application to this case of the pro natura principle and of the constitutional ruling cited in the judgment, namely Decision number 2008-13426 issued by the Sala Constitucional. He considers that the ruling seeks to prevent indiscriminate logging and exploitation of the tree in order to protect both the lapa verde and the almendro amarillo species, by virtue of the direct relationship between those two elements. He believes that, to apply this constitutional ruling specifically rather than generally, the condition of the tree whose felling is sought must be determined, together with at least some indication that it may be used by the lapa verde for nesting, so that it falls within the protection established therein.
He therefore considers that the present case does not seek to fell the tree for its exploitation—which, he asserts, is the first point of disagreement with the appealed judgment—but rather because of the danger it poses. He insists that it was established that the tree is unsuitable for bird nesting. In that regard, he considers that both the ruling and the pro natura principle were applied incorrectly because the conditions contemplated in the constitutional ruling under review were not satisfied, asserting that there is no basis for preserving a tree that is more than setenta por ciento dead and in which the lapa verde neither nests nor will nest. He objects that the challenged judgment assigns greater value to the aforementioned principle than to human life itself. He also challenges the judgment by stating: “Likewise, even though this is a measure imposed on the plaintiff on the basis of a matter lacking an adequate technical analysis, establishing a 50 metros protection zone around the tree (as a palliative measure to prevent harm to persons and keep them away from the tree) would neither change the tree’s condition nor lead lapa verdes to nest there; furthermore, it would not prevent injuries to persons because their passage cannot be entirely prevented, and the company is also being required to provide comprehensive training to more than 1200 employees regarding the tree’s condition and its dangers, generating an enormous expense without thereby eliminating the imminent danger posed by a tree in that condition. 3- Absence of any law requiring the establishment of a Buffer zone around the tree or the training of the plaintiff’s employees.
On this point, he objects: “The decision I hereby appeal requires my principal to create a buffer zone with a circumference of cincuenta metros around the tree as a kind of ‘protection zone’ for the plaintiff’s workers, in addition to having to train more (sic) than 1.200 workers regarding that particular zone and the condition of the tree at issue i (sic) this proceeding. There is, however, no law granting the Judge the authority to impose the mandatory establishment of that buffer zone around the tree (particularly because it is a remnant tree), nor is there any rule granting her the authority to require the company to train more than 1.200 employees regarding that situation and incur the enormous financial expense this entails. The absence of a rule granting the Judge authority to rule in that manner renders the decision unfounded and contrary to law, and it must therefore be reversed.
Likewise, there is no law empowering the Judge to require us to build a fence around the tree and remove the company’s pineapple crop surrounding it and located within the Buffer zone, with the consequences this entails, particularly if we consider that it is a remedial tree, is not located in any protected area or within a forest, and has remained in that condition during the decades in which pineapples have been grown on that property ...” On the basis of the foregoing, he requests: “... As a result of the foregoing, and because the Judge decided the proceeding by imposing obligations on the company without any legal basis and without adequately explaining why those obligations were imposed, we request that the judgment I hereby appeal be reversed and that the requested tree-felling proceeding be granted ...”
- REGARDING THE EVIDENCE OFFERED TO FACILITATE ADJUDICATION (PRUEBA PARA MEJOR RESOLVER): Before this Court, the plaintiff offered evidence to facilitate adjudication, as shown in images 92 to 99 of the electronic case file. The parties were given an opportunity to address that evidence pursuant to the decision issued at fifteen hours and thirty-six minutes on diecisiete de setiembre de dos mil veinticuatro; however, no statement was made. Consequently, pursuant to Article 52 of the Ley de la Jurisdicción Agraria, that evidence is admitted to facilitate adjudication.
- PROVEN AND UNPROVEN FACTS: The set of proven facts stated in the appealed judgment is affirmed because evidence supports them. This Court additionally finds the following fact: That there is a structure within a radius of ciento cincuenta metros around the tree whose felling is sought (see judicial inspection conducted by the Court). The finding that this fact was unproven is rejected because contrary evidence exists.
- REGARDING ENVIRONMENTAL PROTECTION: OVERVIEW ANTHROPOCENTRIC AND ECOCENTRIC: Environmental protection is especially significant because of the close relationship that people and ecosystems have with the environment. Since the last century, the deterioration of natural resources resulting from human activity has drawn the attention of the international community, prompting the adoption of urgent and necessary measures in response to the seriousness of the issue. Beginning with the International Covenant on Economic, Social and Cultural Rights of 1966, States Parties were encouraged to recognize everyone’s right to the enjoyment of the highest attainable standard of physical and mental health, which encompassed the environment (see Article 12). Later, the 1972 Stockholm Declaration recognized human beings as holders of environmental rights; however, it also assigned them a series of obligations aimed at promoting that right.
That international forum raised awareness of the factors accelerating environmental degradation, such as overpopulation, poverty, food insecurity, and the lack of housing and education. Nevertheless, it was in this Declaration that a series of commitments were agreed upon with the aim of protecting the environment under a sustainable development (desarrollo sostenible) model, understood as the possibility of making reasonable use of existing natural resources for present generations while safeguarding those same resources for future generations. Subsequently, at the Rio de Janeiro Summit in 1992, these commitments were reaffirmed, and twenty-seven environmental principles were established to guide countries toward a central objective that would confirm the sustainable development model. Years later, these agreements continued to be followed up through the 2002 Johannesburg Declaration, which once again confirmed the importance of promoting the sustainable development model for humanity and raised awareness of the environmental problems being faced.
This Declaration adopted principles of solidarity for the purpose of promoting another series of rights connected with the environment, such as the rights to food, access to drinking water, and adequate dignified housing, to name only a few. The same path was followed in 2012 through the adoption of the Rio+20 Declaration, which produced a document entitled “The Future We Want,” addressing not only the principles of environmental law (Derecho Ambiental) developed in 1992 and expanded in 2012, but also focusing on matters of interest such as promoting the green economy and eradicating poverty, as well as advancing the Sustainable Development Goals, whose agenda was established in 2015 and included a series of issues such as poverty, hunger, health and well-being, clean energy, reduced inequalities, peace and justice, among others. At the regional level, we can see how environmental protection also gained importance, to the extent that Article 11 of the 1988 Additional Protocol to the American Convention on Economic, Social and Cultural Rights, known as the Protocol of San Salvador, provided as follows: “Right to a Healthy Environment: I. Everyone shall have the right to live in a healthy environment and to have access to basic public services. 2- The States Parties shall promote the protection, preservation, and improvement of the environment.” All of this international development, which enabled the evolution of environmental law, affected our legal system to such an extent that the Asamblea Legislativa, through a process of partial constitutional amendment pursuant to Article 195 of the Constitución Política (derived constituent power (poder constituyente derivado)), incorporated into Article 50 the fundamental right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado).
It should be noted that, since 1989 and before this amendment, the Sala Constitucional had already recognized that right in our country through an expansive, progressive, and evolving interpretation of Article 21 of the Constitution. Nevertheless, this constitutional amendment opened the door even wider, both judicially and legislatively, leading to a series of judicial, constitutional, and statutory decisions and a considerable body of legislation promoting environmental protection in pursuit of human well-being (an anthropocentric approach (perfil antropocéntrico)). However, because of the need to guarantee such protection for persons within their living environment, some countries have promoted a new interpretation of environmental law based on a broader vision rooted in the customs of Indigenous and other populations, as well as in the need to safeguard ecosystems. Such is the case of Ecuador (2008, Article 10) and Bolivia (2009, Article 33), which incorporated into their Constituciones Políticas a broader vision of environmental protection that encompasses not only human beings, of course, but also nature itself and other living beings, with the intention that “Nature, or Pacha Mama, where life is reproduced and sustained, has the right to full respect for its existence and for the maintenance and regeneration of its life cycles, structure, functions, and evolutionary processes” (Article 71 of the Constitución Política de Ecuador).
Similarly, in a landmark case, the Corte Constitucional de Colombia ruled in favor of protecting Río Atrato, recognizing it as a rights-bearing subject (Sentencia T622 del 2016). Among the reasoning offered by that high court was the following: “...Accordingly, within our constitutional system—which follows global trends in this field—the environment and biodiversity have progressively acquired important socio-legal significance. However, this has not been an easy process: the conceptual evolution of the law, together with recognition of the importance of ‘Mother Earth’ and its many components in relation to the sustainable development strategy, has resulted from a complex and difficult process that continues to generate controversy when attempting to reconcile three elements simultaneously: economic growth, social well-being, and environmental protection, on the understanding that their combination makes possible the sustainable use of resources both now and in the future... 5.4.
Indeed, bearing in mind that the environment and its biodiversity form part of humanity’s vital surroundings and are indispensable for its survival and that of future generations, our Carta Política has rightly recognized the importance of this interest and, consequently, has undertaken—from its earliest case law—to establish the premises governing the relationships of the State and society with nature, based on specific mandates for environmental conservation and protection[77]. These premises and mandates comprise what the Court has called the Ecological Constitution (Constitución Ecológica), a definition that is, moreover, far from being a mere rhetorical declaration, insofar as it encompasses specific normative content composed of principles, fundamental rights, and obligations incumbent upon the State... 5.6. Now, the multiple existing legal provisions and the pluralistic approach promoted by the Carta Política itself make the relationship between the Constitution and the environment dynamic and continuously evolving.
In this regard, at least three theoretical approaches may be identified that explain the paramount interest of nature within the Colombian legal system and the special protection afforded to it: (i) first, an anthropocentric perspective (visión antropocéntrica)[80], which regards present-day human beings as the sole raison d’être of the legal system and natural resources as mere objects at their service; (ii) a second, biocentric perspective (punto de vista biocéntrico)[81], which embraces more global and solidarity-based conceptions of human responsibility and advocates equally for humanity’s duties toward nature and future generations; and (iii) finally, ecocentric positions (posturas ecocéntricas)[82] have been advanced that view nature as a genuine rights-bearing subject and support pluralistic worldviews offering alternatives to the approaches described above....” This constitutional judgment unquestionably underscores the concern for protecting nature for the benefit of human beings, but also for its own sake, because if international and regional agreements—and even agreements within individual countries—have been promoted and the environmental problem persists, the law must begin to be interpreted more broadly in order to achieve its very purpose: the protection of the human species and of nature itself.
The Corte Interamericana de Derechos Humanos ruled along the same lines in Opinión Consultiva 23-2017, in which it recognized the individual and collective nature of the right to a healthy environment. That decision also undertook an in-depth analysis of this branch of law, affirming its autonomy. The Court further stated: “In this regard, the Court notes a trend toward recognizing legal personality and, therefore, rights in nature, not only in judicial decisions but even in constitutional systems.” In our country, the Sala Primera de la Corte Suprema de Justicia has incorporated this new legal trend into some of its decisions (see Votos 1754-2021 y 912-2023). In conclusion, the evolution of environmental law is profoundly permeating countries’ legal systems and their courts and has prompted reconsideration of the need for an interpretation that protects both the rights of persons and nature itself. Ultimately, the outcome is the same: to guarantee ecological, social, and economic balance, as agreed in Stockholm in 1972 through the promotion of a sustainable development model.
- COURT’S DECISION: The appellant is not correct in the objections it raises against the trial court judgment under appeal. Three grounds of appeal (agravios) concern that ruling: namely, that the technical evidence (prueba técnica) entered into the case record (expediente) was improperly assessed; that the Trial Court erred in assessing the application of the pro natura principle (principio pro natura) and the Constitutional Chamber ruling used as the basis for the judgment; and, lastly, that the order issued in that judicial decision concerning the creation of a protection zone (zona de protección) around the tree and the training of personnel lacks a legal basis. With regard to the first ground of appeal, this Court examined both the technical evidence issued by the official of the Sistema Nacional de Áreas de Conservación (hereinafter SINAC) and that offered by the plaintiff and prepared by forestry engineer Marvin Lizano López, pursuant to section 54 of the Ley de la Jurisdicción Agraria.
That analysis leads to the conclusion that the tree whose felling is sought is indeed a yellow almond tree, is located in the middle of a pineapple plantation, is approximately fifty meters tall, is not within a protection zone or near any body of water, has no nearby structures around it, has a hollow in its trunk, remains vertical and without leaning, is well supported by deep roots, and also has a crown covered with green-leaved branches. The SINAC official’s opinion is that the tree is neither dead nor diseased and has sustained damage; however, it is in good phytosanitary condition (estado fitosanitario) and poses no danger of falling. In fact, he recommended creating a buffer or protection zone around it to prevent any risk to the personnel working for the plaintiff company, because its height makes pruning impracticable and because a branch could fall to the ground as a result of the natural regenerative process.
For his part, engineer Lizano López orally stated during the hearing held by the Trial Court that the tree exhibits mechanical damage to its bark and damaged branches, said that he observed cracks, and expressed the opinion that the tree had already completed its life cycle. He stated that establishing a buffer zone (zona buffer) would encompass an area of approximately seven thousand square meters, resulting in a loss for the plaintiff, and further considered that the tree provides no benefit. He also stated that creating such a safety zone would entail maintaining a guard to ensure that the zone is respected and, in addition, training personnel. In the supplement to his report, submitted at this level of review as evidence to assist in adjudication (prueba para mejor resolver) (images 92 to 99), he reiterated what he had stated in the oral report presented to the Trial Court. He further added: “...
On Wednesday, May 23 of this year, a drone flight was conducted to observe the phytosanitary condition of the upper portion of the tree. According to the images attached in Annexes 1 and 2, symptoms of dieback are evident in various areas of the crown, and termite nests are also visible. No cavities with potential for future nesting by the great green macaw were observed ...”. The remainder of the report is identical to his trial testimony concerning the nesting of the great green macaw in this type of tree, concluding that the tree whose felling is sought lacks the conditions necessary for this nesting process because of its phytosanitary condition and its isolation from other trees of the same species. Based on the foregoing, this Court agrees with the reasoning and assessment set forth in the oral judgment under appeal, because although the tree has sustained some damage, it remains alive and poses no danger.
Engineer Lizano López’s position cannot be accepted because it is based on probability rather than certainty. In other words, he asserts that, given the tree’s mechanical damage, it is on its way to dying. By contrast, the SINAC engineer concluded that the tree is indeed alive despite the fractures it has sustained, which is why he recommended creating the buffer zone challenged by the party. Accordingly, because the tree whose felling is sought is alive and its fractures do not pose an imminent risk of falling, according to the technical opinion, the requirements established in Article 108.1 of the Código Procesal Civil, applied supplementarily in this matter pursuant to Articles 6 and 26 of the Ley de la Jurisdicción Agraria, have not been met. That provision states: “Summary proceedings for felling (proceso sumario de derribo) shall be available when the poor condition of a building, structure, tree, or real property constitutes a threat to the rights of the possessor or passersby, or could damage public property.” Moreover, the technical report prepared by the forestry engineer retained by the plaintiff is based, among other things, on the adverse effect the tree has on the pineapple-growing activity conducted on the property, unlike the report issued by SINAC, which assesses the tree’s phytosanitary condition, whether it poses a risk, and the safety measures that could be adopted.
Because it has not been established that the tree, despite its fractures, is in imminent danger of falling, the claim must be rejected, since the technical evidence was properly analyzed and, as stated above, it established that the tree is healthy and poses no imminent danger of falling.
- The second ground of appeal is rejected. The claim is based on the party’s assertion that the challenged ruling relied on a Constitutional Chamber decision concerning the prohibition against cutting and harvesting yellow almond trees because they are nesting sites for great green macaws, which are endangered. In its argument, the appellant contends that the precedent does not apply to this matter because, in the case under review, felling is not being requested in order to harvest the timber, but because the tree poses a risk of falling. In this regard, it should be recalled that the scope of review in proceedings of this kind is set forth in Article 108 of the Código Procesal Civil. In other words, the purpose of summary tree-felling proceedings is to determine whether, because of its phytosanitary condition, a particular tree poses a danger or threat to possessors or passersby, or could damage public property.
Of course, cases of this type take on broader dimensions when the requested relief concerns a tree because of the environmental variable involved. In the case under review, this Court of Appeals does not agree with the challenge raised on this specific point. Although Constitutional Chamber Judgment No. 2008-13426 was issued with a view to preventing the cutting and harvesting of yellow almond trees, which is not the subject matter of the dispute (objeto de litis) in this case, it does demonstrate the need to preserve this species for the nesting process of the great green macaw, which is endangered. This therefore provides an additional basis for denying the felling of the tree at issue here, given that, despite its fractures, the tree is alive and poses no danger of falling. That constitutional ruling was issued in 2008 and indirectly reflects the need to preserve other nonhuman species because of their importance to ecosystem balance—the biocentric and ecocentric approach to environmental law (perfil biocéntrico y ecocéntrico del derecho ambiental).
The aforementioned constitutional ruling reasoned: “... The Costa Rican State undertook to protect flora and fauna, particularly endangered species, an obligation it assumed through various instruments of International Law and reinforced by enacting legislation designed to ensure their preservation. Those commitments are binding upon all public authorities because the bodies having jurisdiction over such matters decided to approve and incorporate them into our legal system. That situation consequently imposes numerous requirements on our Government, ranging from the planning and implementation of public policies, the allocation of resources, and the promotion of a culture aimed at environmental conservation, to the need to refrain from carrying out any conduct or measure, adopting any decision, or approving any legal or subordinate regulatory provision that could harm or threaten the preservation of any endangered or threatened species.
In this regard, under nearly all the provisions incorporated into the legal system, the State not only undertook to safeguard at-risk flora and fauna but also assumed the obligation to protect the habitats and ecosystems in which they interact and develop. That commitment is more than reasonable, since it would be extremely difficult for any species to survive on its own unless its surroundings are protected; if its habitat and ecosystem are threatened or even destroyed, it will be left without a place in which to live, feed, grow, or reproduce; that is, it will be destined to disappear ...”. The plaintiff’s arguments focus on asserting that the tree is no longer suitable for great green macaw nesting because of its condition; however, since that is not the subject matter of these proceedings, its claim must be denied because, as the judgment under appeal explained, the constitutional ruling provides a basis for reflecting in this matter on the importance of preserving the species, particularly when such trees pose no danger to persons or passersby.
It must likewise be considered that, even if the tree is unsuitable for nesting, as the appellant maintains, it could positively contribute to soil improvement, microclimate regulation, increased carbon sequestration, greater biodiversity, and enhancement of the scenic landscape, to cite only some of the positive effects the tree would have within the pineapple plantation. For those reasons, this ground of appeal is rejected.
IX.Regarding the third claim, the appellant is likewise without merit. The objection concerns the Court’s order requiring the creation of a buffer or safety zone (zona buffer o de seguridad) around the perimeter of the tree at issue and the training of the personnel working for the pineapple company. The appellant protests that this order was issued without any legal basis. In this regard, it is pertinent to note that the foundational provision of the Costa Rican State on environmental matters, which inevitably influences all branches of law and legal rules, is Article 50 of the Political Constitution, which provides: “The State shall seek the greatest welfare of all the country’s inhabitants by organizing and promoting production and the most appropriate distribution of wealth. Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to seek reparation for the harm caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties. Every person has the basic and inalienable human right of access to drinking water as an essential good for life. Water is an asset of the nation and is indispensable for protecting that human right. Its use, protection, sustainability, conservation, and exploitation shall be governed by the law enacted for these purposes, and priority shall be given to supplying drinking water for individuals and populations.” As mentioned, even before the constitutional amendment of 1994, the Constitutional Chamber of the Supreme Court of Justice had recognized the right to the environment (derecho al ambiente) from various perspectives and in various spheres, thereby defining the content of that constitutional guarantee. Likewise, fundamental statutory reforms were enacted that established the foundations of the present State’s environmental institutions.
Following the constitutional amendment of 1994 to the cited article, the guarantee of the right to the environment was recognized. That declaration includes the following elements: a) express constitutional recognition of the right to a healthy and ecologically balanced environment, b) the State’s obligation to protect the environment, c) broad standing (legitimación activa) for those who believe that their right to the environment has been infringed, and d) the incorporation of sustainable development (desarrollo sostenible) as the development model for activities carried out within the national territory. The integration of sustainable development into all productive activities becomes a mandate intended to safeguard sustainability, preserve life-support systems, and generate wealth. In other words, productive activity must be conducted by incorporating the environmental variable (variable ambiental) in order to achieve the objectives of generating wealth and stimulating the economy without harming ecosystems or species, thereby fulfilling the right of future generations to have sustainable and adequate life-support systems: the principle of intergenerational solidarity (principio de solidaridad intergeneracional).
Furthermore, the technical and scientific basis (sustrato técnico científico) serves as the foundation for interpreting environmental protection provisions. New technologies, scientific discoveries, and modern methods of ensuring the preservation of biodiversity constitute the core from which environmental legal provisions must be applied. In this respect, environmental law departs from the traditional system for applying and interpreting legal provisions because the object being protected is vulnerable and changing. Pursuant to the second paragraph of constitutional Article 50, property owners and persons engaged in productive activities must subject their property and activities to the system of environmental restrictions and limitations (límites y limitaciones de orden ambiental). Accordingly, the precautionary, preventive, non-regression, and inter- and intragenerational solidarity principles (principios precautorios, preventivo, no regresión, solidaridad inter e intrageneracional), to name only a few, must also be incorporated.
The same applies to the internationalization of the environmental burden (internacionalización de la carga ambiental) of activities and projects alleged to be harmful to the environment, so that nature is effectively protected through ecological criteria. This must be done, however, without diminishing the value and effectiveness of other rights and powers of various kinds granted by law to social and State actors. Along these lines, the aim is therefore to respect the constitutional principles of health, environment, life, and sustainable development, as well as property, freedom, and economic development. In the case under consideration, the decision under appeal allows pineapple production to continue while protecting the yellow cedar forest species, which must be kept alive according to the technical opinion of the competent State entity; that entity also provides a temporary technical and scientific solution to safeguard the physical integrity of persons and property located on the parcel where the tree stands.
In addition, Article 1 of the Biodiversity Law provides: “The purpose of this law is to conserve biodiversity and ensure the sustainable use of resources, as well as to distribute the resulting benefits and costs fairly.” This same legislation recognizes the environmental function of property (función ambiental de la propiedad) (Article 8) as a purpose to be considered together with the other functions of ownership, namely its social and economic functions. The justification in proceedings of this nature involving felling (derribo) must address safety issues, and in this case the temporary buffer-zone measure that was ordered reduces the risk that a fall might injure any person or damage any property. It should be noted that national scientific studies have stated the following concerning this species: “The almendro (Dipteryx panamensis, Pittier) is a native forest species of the family Fabaceae, subfamily Papilonaceae, with a natural distribution extending from the lowland forests of Nicaragua to Colombia (Flores 1992, Romo 2005).
In Costa Rica, it is abundant in the Caribbean and throughout the country’s Huetar Norte region (Castañeda et al. 2000). Once it reaches maturity, it is a prominent tree forming part of the upper canopy and may grow to 60 m in height and up to 2 m in diameter at the base. This species has a cylindrical trunk and broad basal roots, although it does not have buttress roots. It has ascending branches that form a hemispherical crown and produces highly attractive pink-violet blossoms (Gamboa 2008; Fournier 2003). The species’ timber has a high commercial value because of its hardness and specific gravity, which ranges from 0,83 – 1,09 gr/cm3 (Vozzo 2002; Carpio Malavasi 2000). It dries quickly in the open air but tends to crack. It has high natural resistance to attack by biological agents (fungi and bacteria) and considerable potential for carbon-sequestration plantations; however, its high tylosis and tannin content makes its preservation difficult (Flores 1992; Fournier 2003; Losi et al. 2003).
The species’ importance in Central America and the region lies in the high international demand for its use in flooring (ITTO 2016, Ravenshorst et al. 2013). In Costa Rica, it has been placed under a harvesting ban because of its role as a food source for endangered birds, which prompted a ruling by the Constitutional Chamber (Judgment 2008- 13426) prohibiting the harvesting (aprovechamiento) of the species throughout the national territory (Camacho 2015). Over the past 15 years, the growth and propagation of this species in Costa Rica have been studied and addressed by numerous authors (Delgado et al. 2003, Piotto et al. 2003, Petit and Montagnini 2006, Alice et al. 2004, Schmidt 2009, Montagnini 2010), among others. ... They also mention the importance of this species in providing environmental services (servicios ambientales) (soil, biodiversity, and climate) (Piotto et al. 2003a, Brenes 2007). In particular, the species’ potential for long-term carbon sequestration and fixation has been noted by (Redondo-Brenes 2007, RuizJaén and Potvin 2010).”

As can be inferred, the species is valuable because of its environmental services (servicios ambientales), and the fact that it is not located within an area containing a greater number of species does not diminish its value and potential as a nesting site for the great green macaw and for other biodiversity that may require it. The applicant seeking its removal must temporarily maintain this species in a responsible and technically sound manner, given the technical justifications provided by MINAE; this is consistent with the exercise of private-property rights and freedom of enterprise, in compliance with sustainable development and the obligation to safeguard natural resources.
All of this is reasonable and proportionate, as is the case in the specific matter under appeal. Accordingly, contrary to the party’s objection, this Court concurs with the decision issued in the judgment, because Article 108 of the Code of Civil Procedure, which applies supplementarily in this matter, provides in paragraph 3: “... A judgment granting relief shall order the removal or the adoption of permanent safety measures ...” (The underlining does not appear in the original). In other words, in this type of proceeding it is indeed possible to decide whether or not to fell (corta) the tree whose removal is sought, or alternatively to adopt a safety measure, including a permanent one. In that regard, the appealed decision ordered, among other things, the following: “... As a preventive and safety measure, the plaintiff must establish a BUFFER zone with a minimum radius of fifty meters around the yellow almond tree at issue in these proceedings, located on the property registered in the Alajuela Property Registry under number three three nine nine six nine – zero zero zero ...”.
In the reasoning portion of the judgment, the judge imposed the measure based on the technical recommendation issued by the SINAC engineer. The appellant’s objection is based on the opinion of forestry engineer Lizano López concerning the loss the company would incur in a portion of the land that it would have to set aside to ensure that safety zone around the tree, as well as his view that the tree generated no profit. However, its claims cannot be accepted because the safety measure imposed by the Court seeks to guarantee a protection zone (zona de protección) specifically for the personnel working at the plaintiff company, while also protecting biodiversity. Therefore, if its concern is that the tree might fall—which was shown not to be the case—it is reasonable to impose a safety measure that protects the integrity of its personnel and the tree itself, thereby addressing the environmental burden (carga ambiental) associated with its pineapple-growing activity in this specific case, which could entail setting aside a small area of land to conserve that forest species.
Thus, the provision of the Trial Court challenged before this Court is indeed grounded in law, specifically in paragraph 3 of Article 108 analyzed above in this judicial decision and in Article 50 of the Political Constitution, as well as in the scientific and technical basis provided by SINAC. Likewise, it is not true that the ruling ordered training for all company personnel regarding that safety zone, although it should reasonably be a duty undertaken by the plaintiff as a consequence of the measure imposed in the appealed decision. Lastly, the party challenges the imposition of the safety measure on the grounds that it affects its operations; however, it did not propose any remedy other than felling the tree that would have allowed this Court to assess a second alternative safety measure and determine which was more viable. That procedural omission means that only one technical recommendation exists in this matter: the recommendation adopted by the Trial Court, which the party objects to solely on the ground that the recommended course of action was to fell the tree at issue in the dispute.
The burden of proving disputed, constitutive, and preclusive facts rests with the party invoking them in its favor. The concept of burden of proof (carga de la prueba) must be understood as the party’s obligation to offer, submit, or present evidence at the appropriate procedural stage (pursuant to Articles 477 of the Labor Code and 41.1 of the Code of Civil Procedure). Accordingly, its objection cannot be accepted and, being unfounded, shall fail.
on Economic, Social and Cultural Rights, Article 11 of the Additional Protocol to the American Convention on Economic, Social and Cultural Rights, known as the 1988 Protocol of San Salvador, Articles 6, 26, 48, and 54 of the Agrarian Jurisdiction Act, and Article 108 of the Code of Civil Procedure, the appealed judgment is affirmed with respect to the matters challenged.

Del estudio del expediente se observan las siguientes actuaciones: 1- La parte actora solicita que en sentencia se declare: "1-. Cortar y Derribar totalmente el árbol de Dipteryx Panamensis (almendro amarillo) que se encuentra ubicado en la propiedad perteneciente a mi poderdante inscrita en el partido de Alajuela, Folio Real matrícula 339969-000 y cuya descripción y fotografía resulta visible en el informe técnico que se rotula como prueba 2. 5-.(sic) En caso de que el Estado se oponga al presente proceso infundadamente se pide la respectiva condenatoria de ambas costas de este proceso.». La jueza Ana Milena Castro Elizondo, del Juzgado Agrario del Segundo Circuito Judicial de Alajuela, San Carlos, en sentencia oral número 262-S-2024, de las once y cincuenta y un minutos horas del veinticuatro de mayo del dos mil veinticuatro, resolvió: «POR TANTO: Se acoge LA EXCEPCIÓN DE FALTA DE LEGITIMACIÓN AD CAUSAM PASIVA interpuesta por la parte Procuraduría General de la República. Se declara SIN LUGAR la presente demanda Sumaria de Derribo interpuesta por ANANAS EXPORT COMPANY S. A contra el Estado. La parte actora como medida de prevención y seguridad debe hacer una zona BUFFER con un radio de mÍnimo de cincuenta metros alrededor del árbol de almendro amarillo objeto de proceso, situado en la finca del Partido de Alajuela matrícula tres tres nueve nueve seis nueve – cero cero cero. Se resuelve sin especial condenatoria en costas. Remítase copia de la parte dispositiva de esta sentencia a la Oficina Regional del SINAC. Con base en el artículo 10 de la Ley de Notificaciones quedan las partes notificadas en el acto.”». III.APELACIÓN El licenciado Carlos Francisco Millet Nieto, en su condición de apoderado especial judicial de la parte actora, interpuso recurso de apelación con indicación expresa de las razones en que se apoya, para refutar la tesis del juzgado de instancia (ver descarga de expediente electrónico en formato PDF, imágenes 86 a 91). Dentro de los agravios expone: 1- Errónea apreciación de la prueba técnica. Cuestiona que en el proceso se ofrecieron dos dictámenes periciales para efectos de determinar la condición del árbol objeto de derribo. Pese a ello, acusa que la sentencia le dio más valor al informe técnico elaborado por el funcionario del Sistema Nacional de Áreas de Conservación (en adelante SINAC) y no al rendido por el ingeniero forestal que ofrecieron en el proceso, el cual, cita es más técnico y se basa en un estudio pormenorizado tanto del estado actual del árbol, su daño eminente, la no anidación de aves de ningún tipo en el mismo y el peligro que éste posee.
Sostiene que ese informe destaca que el árbol en cuestión tiene un hueco interno en su tronco de aproximadamente 18 metros desde su base ocasionando que el mismo se encuentre casi muerto generando caídas de ramas y reventaduras en múltiples partes de su tronco, así como un deterioro evidente. Manifiesta que esas condiciones del árbol generan peligrosidad para las personas que puedan transitar cerca de él. Por otro lado, protesta en contra del peritaje rendido por el SINAC, del cual dice solo fue visual, sin analizar la profundidad del estado del tronco, además, de basarse en tres aspectos, a saber, posee hojas verde concluyendo está vivo, no le observó raíces externas determinando está bien arraigado, y que podría ser un lugar de anidación de la lapa verde sin precisar en este punto detalles concretos con el fin de brindar certeza sobre su opinión. En esa línea, señala que al confrontar ambos informes técnicos el elaborado por el SINAC carece de información relevante para la decisión de esta causa sumaria al basarse en meras suposiciones, contrario al informe rendido por el ingeniero forestal ofrecido por la parte actora, en donde consignó que el árbol esta casi muerto sin posibilidad de que sobrevida o se regenere.
Establece que se demostró que durante un tiempo prolongado en el árbol no se ha dado ninguna anidación de la lapa verde puesto que dichas especies no se anidan en árboles en esas condiciones, y que se encuentran de forma aislada. Continúa su reclamo en el sentido de que el árbol causa un peligro por la caída que podría sufrir. 2- Errónea valoración para el caso del principio pro natura y del fallo constitucional indicado en la sentencia, sea el Voto emitido por la Sala Constitucional número 2008-13426. Considera que ese veredicto busca evitar la tala indiscriminada y el aprovechamiento del árbol con el fin de resguardar tanto a la lapa verde, así como a la especia de almendro amarillo, en virtud de la relación directa entre ambos elementos. Estima que para poder aplicar este fallo constitucional de forma específica y no general, debe determinarse la condición del árbol que se pide derribar y por ende el mínimo indicio de que este pueda ser objeto de anidación por parte de la lapa verde para que así encuadre dentro de la respectiva protección establecida.
Por ello, considera que en el presente caso no se está pidiendo derribar el árbol para su aprovechamiento, lo que afirma es el primer punto de discordia con el fallo apelado, sino que lo pretendido es el derribo producto de su peligrosidad. Insiste en que se acreditó que el árbol no es apto para la anidación de aves. En ese aspecto, considera que el fallo fue aplicado de forma errada, así como el principio pro natura, al no cumplirse las condiciones del fallo constitucional objeto de examen, afirmando no encuadra mantener un árbol con más del setenta por ciento muerto y en donde no anidan, ni anidarán la lapa verde. Protesta que el veredicto recurrido le da mayor valor principio pre citado, que a la misma vida humana. Asimismo, combate el fallo mencionando que: "De igual forma, y pese a que resulta ser un aspecto que se impone al actor basado en un aspecto carente de análisis técnico adecuado, estableciendo la zona de protección alrededor del árbol de 50 metros (como una medida paliativa para evitar daños a personas y que no se acerquen al árbol) no se variaría el estado del mismo ni se lograría la anidación de lapas verdes, aunado a que eso no impediría lesiones a personas ya que no puede impedirse el paso de los mismo del todo y además se está obligando a la empresa a realizar una capacitación total para más de 1200 empleados sobre las condiciones del árbol y sus peligros generando un gasto de grandes magnitudes sin que se evite de esa manera el peligro inminente que resulta ser un árbol en ese estado. 3- Inexistente normativa para obligar a crear una zona Buffer alrededor del árbol así como capacitar a los empleados de la actora.
Sobre este particular protesta: "La resolución que apelo en este acto obliga a mi representada a la creación de una zona buffer de cincuenta metros de circunferencia alrededor del árbol como una especia de “zona de protección” para los trabajadores de la actora aunado a tener que capacitar a mas (sic) de 1.200 trabajadores sobre esa zona en particular y el estado del árbol objeto d (sic) este proceso. Ahora bien, no existe normativa alguna que venga a otorgar a la señora Jueza la potestad de establecer la obligatoriedad de establecer esa zona buffer alrededor del árbol (máxime siendo este un árbol remanente) así como tampoco existe norma alguna que le otorgue la potestad de obligar a la empresa a capacitar a los mas de 1.200 empleados sobre esa situación y realizar el enorme gasto económico que eso conlleva. La inexistencia de una norma que le otorgue potestad a la Jueza para resolver de esa manera torna a la resolución en infundada y no apegada a Derecho y por ende debe ser revocada.
Asimismo, no existe normativa alguna que le faculte a la señora Jueza a obligarnos a construir un cerco alrededor del árbol y eliminar el sembradío de piña que posee la empresa alrededor del mismo y dentro de la zona Buffer con las consecuencias que eso conlleva, máxime si tomemos en cuenta que es un árbol remedial, no está ubicado en zona protectora alguna ni dentro de un bosque y así ha estado durante decenio de años en que se ha sembrado piña en esa propiedad ...". Con base en lo anterior, solicita: "... Producto de lo indicado y dado que la señora Jueza resuelve el proceso estableciendo obligaciones para la empresa sin sustento legal alguno y sin justificar de forma adecuada el porqué del establecimiento de sus obligaciones es que solicitamos se revoque la sentencia que en este acto recurro y se acoja el proceso de derribo del árbol pedido ...".
- SOBRE LA PRUEBA OFRECIDA PARA MEJOR RESOLVER: La parte actora ofreció ante esta Instancia prueba para mejor resolver según se obsevan de las imágenes 92 a 99 del expediente electrónico, la cual fue conferida en audiencia a las partes de acuerdo a la resolución de las quince horas treinta y seis minutos del diecisiete de setiembre de dos mil veinticuatro; sin embargo, no hubo pronunciamiento alguno. En consecuencia, de conformidad con el artículo 52 de la Ley de la Jurisdicción Agraria se admite dicha prueba para mejor resolver.
- HECHOS PROBADOS Y NO PROBADOS: Se avala el conjunto de hechos probados consignados en la sentencia apelada al existir prueba que los respaldan. Por parte de está instancia se tiene el siguiente: Que alrededor del árbol objeto de derribo y en un espacio de ciento cincuenta metros a la redonda se encuentre alguna construcción (ver reconocimiento judicial practicado por el Juzgado). Se imprueba el hecho no probado al existir prueba en contra.
- SOBRE LA TUTELA DEL MEDIO AMBIENTE: PERFIL ANTROPOCÉNTRICO Y ECOCÉNTRICO: La protección del medio ambiente tiene una especial relevancia debido al estrecho vínculo que tienen las personas y los ecosistemas con éste. Desde el siglo pasado el deterioro a los recursos naturales producto de la actividad humana despertó el interés de la comunidad internacional con el fin de adoptar medidas urgentes y necesarias que sirvieran de respuesta ante la gravedad que tenía el tema. Desde el Pacto Internacional sobre Derechos Económicos, Sociales y Culturales, de 1966, se incentivó a que los Estados partes reconocieran el derecho de toda persona al disfrute del más alto nivel posible de salud física y mental, dentro del cual se incluyó el medio ambiente (ver artículo 12). Luego, en la Declaración de Estocolmo de 1972, se reconoció al ser humano como sujetos de derechos al ambiente; sin embargo, también se le delegó una serie de obligaciones con miras a promover tal derecho.
En ese foro internacional se concientizó acerca de los factores que aceleraban el deterioro del ambiente, tales como la sobrepoblación, la pobreza, la alimentación, la falta de vivienda y educación. Empero, fue en esta Declaración en donde se acordaron una serie de compromisos con el objetivo de proteger al medio ambiente bajo un modelo de desarrollo sostenible, entendido éste, como la posibilidad de aprovechar de forma razonable los recursos naturales existentes para las generaciones presentes; pero, salvaguardando esos mismos recursos a las futuras generaciones. Posteriormente, a través de la Cumbre de Río de Janeiro en el año 1992, estos compromisos fueron reafirmados, además, de recoger veintisiete principios ambientales que sirvieran de ruta para los países en aras de establecer un objetivo central que ratificara el modelo de desarrollo sostenible. Años después, se continuaron dando seguimiento a estos acuerdos gracias a las Declaraciones de Johannesburgo, 2002, en donde se volvió a confirmar la relevancia de incentivar el modelo de desarrollo sostenible para la humanidad, además, de que se hizo conciencia sobre los problemas ambientales que se estaban afrontando.
En esta Declaración se adquirieron principios solidarios a efectos de promover otra serie de derechos vinculados al medio ambiente, como lo son: la alimentación, el acceso al agua potable, a la vivienda digna adecuada, solo por citar algunos. Esta misma ruta se siguió en el 2012, gracias a la aprobación de la Declaración de Río + 20, el cual generó un documento denominado "El futuro que queremos", abordando no solo aquellos principios del derecho ambiental construidos en 1992, y ampliados en el 2012, sino también se enfocaron temas de interés como lo son la promoción de la economía verde y la erradicación de la pobreza, así como, la promoción de los Objetivos de Desarrollo Sostenible, cuya agenda se estableció en el año 2015, incluyendo una serie de temas como lo son la pobreza, el hambre, la salud y el bienestar, las energías limpias, la reducción de desigualdades, paz y justicia, entre otros.
A nivel regional podemos visualizar como este tema de tutela al ambiente también adquirió relevancia, tanto que, en el Protocolo adicional a la Convención Americana sobre Derechos Económicos, Sociales y Culturales, conocido como Protocolo de San Salvador de 1988, se estipuló en el artículo 11 lo siguiente: "Derecho a un ambiente sano: I. Toda persona tiene derecho a vivir en un ambiente sano y a contar con servicios públicos básicos. 2- Los Estados partes promoverán la protección, preservación y mejoramiento del medio ambiente". Todo este desarrollo internacional que permitió la evolución del Derecho Ambiental impactó nuestro ordenamiento jurídico, al punto que, la Asamblea Legislativa mediante un proceso de reforma parcial a la Constitución amparado en el artículo 195 de la Constitución Política (poder constituyente derivado), incorporó en el cardinal 50 como derecho fundamental el ambiente sano y ecológicamente equilibrado.
Es preciso puntualizar, que la Sala Constitucional desde 1989 y antes de esta reforma ya venía reconociendo en nuestro país dicho derecho, haciendo una lectura expansiva, progresistiva y evolutiva del cardinal 21 de la Constitución. No obstante, gracias a esta reforma constitucional la puerta fue abierta con mayor apertura, tanto a nivel jurisprudencial, así como legislativo, en donde se emitieron una serie de decisiones judiciales, constitucionales y legales, y una gran cantidad de legislación que promovían la protección del medio ambiente buscando el bienestar de la persona humana (perfil antropocéntrico). Sin embargo, debido a la necesidad de garantizar esa protección a la persona en su entorno de vida se ha promovido por parte de algunos países una nueva lectura del derecho ambiental con base en una visión más amplia arraigada a costumbres de poblaciones originarias y otras, así como a la necesidad de resguardar los ecosistemas.
Tal es el caso de Ecuador (2008, artículo 10) y Bolivia (2009, artículo 33), quiénes en sus Constituciones Políticas integraron una visión más amplia de protección ambiental alcanzando por supuesto no solo al ser humano, sino también a la misma naturaleza y a otros seres vivos, con el ánimo de que " La naturaleza o Pacha Mama, donde se reproduce y realiza la vida, tiene derecho a que se respete integralmente su existencia y el mantenimiento y regeneración de sus ciclos vitales, estructura, funciones y procesos evolutivos" (artículo 71 de la Constitución Política de Ecuador). En igual sentido, la Corte Constitucional de Colombia en un emblemático caso falló a favor de la protección del Río Atrato reconociendo a éste como sujetos de derechos (Sentencia T622 del 2016). Parte del razonamiento de esa alta Corte fue, entre varios, los siguientes: " ...Así las cosas, en nuestro constitucionalismo -que sigue las tendencias globales en la materia-, el medio ambiente y la biodiversidad han adquirido progresivamente valiosas connotaciones socio-jurídicas.
Sin embargo, no ha sido un proceso fácil: la evolución conceptual del derecho a la par del reconocimiento de la importancia de la “madre tierra” y sus múltiples componentes frente a la estrategia del desarrollo sostenible han sido producto de un proceso complejo y difícil que aún genera controversia al intentar conciliar a un mismo tiempo tres elementos: el crecimiento económico, el bienestar social y la protección del medio ambiente en el entendido que esta conjugación permita la posibilidad de aprovechamiento sostenible de los recursos en el presente y en el futuro ... 5.4. En efecto, teniendo en cuenta que el medio ambiente y su biodiversidad hacen parte del entorno vital del hombre y que resulta indispensable para su supervivencia y la de las generaciones futuras, nuestra Carta Política, de manera acertada ha reconocido la importancia de dicho bien y, en consecuencia, se ha ocupado -desde temprana jurisprudencia- de fijar los presupuestos a partir de los cuales deben regularse las relaciones del Estado y la sociedad con la naturaleza, partiendo de mandatos específicos de conservación y protección del ambiente[77].
Dichos presupuestos y mandatos conforman lo que la Corte ha llamado la Constitución Ecológica, definición que, por demás, está muy lejos de ser una simple declaración retórica en la medida en que comprende un preciso contenido normativo integrado por principios, derechos fundamentales y obligaciones a cargo del Estado ... 5.6. Ahora bien, las múltiples disposiciones normativas que existen y el enfoque pluralista que promueve la propia Carta Política, hacen que la relación entre la Constitución y el medio ambiente sea dinámica y en permanente evolución. En este sentido, es posible establecer al menos tres aproximaciones teóricas que explican el interés superior de la naturaleza en el ordenamiento jurídico colombiano y la protección especial que se le otorga: (i) en primer lugar, se parte de una visión antropocéntrica[80] que concibe al ser humano presente como única razón de ser del sistema legal y a los recursos naturales como simples objetos al servicio del primero, (ii) un segundo punto de vista biocéntrico[81] reivindica concepciones más globales y solidarias de la responsabilidad humana, que abogan -en igual medida- por los deberes del hombre con la naturaleza y las generaciones venideras; (iii) finalmente, se han formulado posturas ecocéntricas[82] que conciben a la naturaleza como un auténtico sujeto de derechos y que respaldan cosmovisiones plurales y alternativas a los planteamientos recientemente expuestos ...".
Este fallo constitucional sin duda alguna resalta la preocupación de tutelar a la naturaleza para beneficio del ser humano; pero, también para ella misma, puesto que, si se han propociado acuerdo internacionales, regionales y hasta a lo interno de los países, y el problema ambiental continúa, debe de comenzar hacerse una lectura más amplia del derecho con el fin de lograr el fin mismo, sea la protección a la especie humana y a la misma naturaleza. En esa misma línea de pensamiento resolvió la Corte Interamericana de Derechos Humanos a través de la Opinión Consultiva 23-2017, en donde reconoció el carácter individual y colectivo del derecho ambiental. Asimismo, en ese veredicto se hizo un análisis profundo sobre esta rama del derecho consagrando su autononomía. Además, mencionó la Corte: "En ese sentido, la Corte advierte una tendencia a reconocer personería jurídica y, por ende, derechos a la naturaleza no solo en sentencias judiciales , sino incluso en ordenamiento constitucionales".
En nuestro país, la Sala Primera de la Corte Suprema de Justicia ha venido recogiendo en algunos fallos esta nueva tendencia jurídica (ver los Votos 1754-2021 y 912-2023). En conclusión, la evolución del Derecho Ambiental está penetrando de forma profunda los ordenamientos jurídicos de los países, sus Cortes, y ha repensado en la necesidad de hacer una lectura que permita tutelar los derechos de las personas, así también de la misma naturaleza. Al final el resultado es el mismo: garantizar el equilibrio ecológico, social y econónimico, conforme se acordó desde Estocolmo en 1972, al incentivar la promoción de un modelo de desarrollo sostenible.
- DECISIÓN DEL TRIBUNAL: No lleva razón la parte apelante con respecto a las protestas que emite sobre el fallo de primera instancia objeto de apelación. Son tres los agravios que giran alrededor de ese veredicto, a saber, que hubo una indebida valoración de la prueba técnica incorporada al expediente, afirma que el Juzgado erró al valorar para este caso la aplicación del principio pro natura y el fallo de la Sala Constitucional que se usó como base en la sentencia, y por último, cuestiona que la orden girada en esa decisión judicial con respecto a la creación de la zona de protección alrededor del árbol y la capacitación del personal no tiene sustento normativo. Con respecto al primer agravio, este Tribunal procedió a examinar tanto la prueba técnica emitida por el funcionario del Sistema Nacional de Áreas de Conservación (en adelante SINAC), así como la ofrecida por la actora y elaborada por el ingeniero forestal Marvin Lizano López, esto conforme al numeral 54 de la Ley de la Jurisdicción Agraria.
De ese análisis se concluye que, efectivamente el árbol objeto de derribo es de la especie de almendro amarillo, está ubicado en medio de una plantación de piña, mantiene una altura aproximada de cincuenta metros, no se encuentra dentro de una zona de protección o de algún cuerpo de agua, no existen construcciones cercanas a su alrededor, tiene un hueco en su tronco, mantiene una posición vertical, sin inclinación, con raíces profundas bien sostenido, además, de una corona cubierta con un follaje con ramas verdes. El criterio del funcionario del SINAC lo es que el árbol no está muerto, ni enfermo, ha sufrido daños; pero, fitosanitariamente se encuentra en buen estado y sin peligro de caída. De hecho, recomendó la creación de una zona buffer o de protección alrededor de éste con el fin de evitar algún riesgo para el personal que labora en la mercantil actora, debido a que por su altura no es viable hacer una poda y ante la realidad de que alguna rama pueda caer al suelo producto del mismo proceso regenerativo.
Por su parte, el ingeniero Lizano López de forma verbal durante la audiencia que celebró el Juzgado estimó que el árbol presenta unos daños mecánicos en la corteza, ramas dañadas, dijo que observó fisuras, y en su opinión el árbol ya cumplió su ciclo de vida. Citó que realizar una zona buffer abarcaría un área de unos siete mil metros cuadrados aproximadamente, siendo esto una pérdida para la actora, además, de considerar el árbol no genera ningún beneficio. También cita que de crearse esa zona de seguridad conllevaría a tener que mantener una guarda para garantizar el respeto a dicha zona y sumado a eso tendría que capacitarse al personal. En la amplicación a su informe, ofrecido en esta Instancia como prueba para mejor resolver (imágenes 92 a 99), reiteró lo dicho en el informe verbal que rindió ante el Juzgado. Además, agregó que: "... El día miércoles 23 de mayo del presente año, se realizó un vuelo con dron para observar el estado fitosanitario del árbol en la parte superior.
Según las imágenes adjuntas en los Anexos 1 y 2 se evidencia síntomas de mortalidad en distintas zonas de la copa, también se observa presencia de termiteros. No se observan cavidades que presenten potencial para un futuro anidamiento de lapa verde ...". El resto del informe es idéntico a lo declarado en juicio con respecto a la anidación de la lapa verde en este tipo de árboles, concluyendo, el objeto de derribo no tiene las condiciones para este proceso de anidación dada sus condiciones fitosanitarias y al encontrarse aislado de otras especies similares. Con base en lo anterior, este Tribunal comparte el razonamiento y valoración que se emitió en la sentencia oral apelada por cuanto el árbol pese a que ha sufrido algunos daños aun se encuentra vivo y sin ningún peligro. La tesis del ingeniero Lizano López no es de recibo por cuanto se basa en una probabilidad y no en certeza. Es decir, acusa que dada las condiciones de daños mecánicos del árbol va camino a fallecer.
Por otro lado, la conclusión del ingeniero del SINAC lo es que el árbol sí está vivo pese a las fracturas que ha sufrido, de ahí que, haya recomendado la creación de la zona buffer protestada por la parte. Así las cosas, al encontrarse vivo el árbol objeto de derribo, y sus fracturas no comprometen una caída inminente, según el criterio técnico, no se cumple con lo preceptuado en el artículo 108.1 del Código Procesal Civil, aplicado supletoriamente en esta materia de conformidad con los artículos 6 y 26 de la Ley de la Jurisdicción Agraria, en cuanto dispone: "El proceso sumario de derribo procederá cuando el mal estado de un edificio, construcción, árbol o inmueble constituya una amenaza para los derechos del poseedor o los transeúntes, o pueda perjudicar bienes públicos". Por otra parte, el informe técnico rendido por el ingeniero forestal ofrecido por la parte actora se sustenta, entre otras cosas, en la afectación que el árbol genera a la actividad de piña que se desarrolla en el inmueble, distinto al emitido por el SINAC, en donde aprecia el estado fitosanitario del árbol, si causa riesgo, y las medidas de seguridad que podrían adoptarse.
Al no acreditarse que el árbol pese a sus fracturas tenga una situación inminente de caída, lo que procede es censurar el reclamo al haberse hecho un adecuado análisis de la prueba técnica en donde como se ha indicado, se estableció que el árbol está sano y no hay peligro de caída inminente.
- Con respecto al segundo agravio se rechaza. El reclamo se sustenta en el sentido de que dice la parte el veredicto recurrido se basó en un Voto de la Sala Constitucional dirigido a la prohibición de talar y aprovechar los árboles de la especie de almendro amarillo dado que son fuente de anidación para las lapas verdes que se encuentra en peligro de extinción. En su alegato apunta que, el precedente no resulta aplicable a este asunto debido a que en el caso bajo examen no se está pidiendo el derribo para aprovechar la madera, sino por un riesgo de caída del árbol. En este aspecto, debe recordarse que en este tipo de procesos el ámbito de estudio se encuentra contemplado en el artículo 108 del Código Procesal Civil. Es decir, el fin del sumario de derribo de árbol se centra en determinar si una especie causa un peligro o amenaza, dada sus condiciones fitosanitarias, para las personas poseedoras, transeúntes, o bien, pueda perjudicar bienes públicos.
Por supuesto, la particularidad de este tipo de causas cuando se solicitan sobre un árbol alcanza unas dimensiones más extensas debido a la variable ambiental incluída. En el caso bajo examen, esta Cámara de Apelación no comparte el embate interpuesto en este punto en concreto. Si bien es cierto, la sentencia de la Sala Constitucional número 2008-13426, fue dictada a la luz de evitar la tala y el aprovechamiento de la especie de almendro amarillo, caso el cual no es objeto de litis en esta causa, si deja en evidencia la necesidad de mantener esta especie para el proceso de anidación de la lapa verde la cual se encuentra en peligro de extinción. Por lo que, este resulta ser un fundamento de más para rechazar la corta del árbol base de este asunto en consideración de que, a pesar de sus fracturas, el árbol está vivo, y no representa un peligro de caída. Este fallo constitucional, fue dictado en el año 2008, y refleja, de forma indirecta, la necesidad de mantener la preservación de otras especies no humanas debido a la importancia que genera para el equilibrio de los ecosistemas (perfil biocéntrico y ecocéntrico del derecho ambiental).
En el supracitado fallo constitucional se razonó: "... El Estado costarricense se comprometió a proteger la flora y la fauna, en especial a aquellas especies que se encuentren en peligro de extinción, obligación que adquirió a través de diversos instrumentos de Derecho Internacional y que reforzó aprobando la legislación que vela por la preservación de aquellas. Esos compromisos resultan ser de acatamiento obligatorio para todos los poderes públicos, pues los órganos competentes para esos efectos decidieron aprobarlos e incorporarlos a nuestro ordenamiento. Esa situación impone, en consecuencia, una multiplicidad de exigencias a nuestro Gobierno, las cuales van desde el planeamiento y la ejecución de políticas públicas, la dotación de recursos y la promoción de una cultura, tendientes todas a la conservación del medio, hasta la necesidad de abstenerse de ejecutar una conducta o medida, adoptar cualquier resolución o aprobar alguna disposición normativa -de rango legal o infralegal- que acaso pueda lesionar o amenazar la preservación de cualquiera de esas especies que se hallen en peligro o vías de extinción.
En ese sentido, en casi todas las normas incorporadas al ordenamiento, el Estado no solo se comprometió a velar por la flora y la fauna que se encuentra en riesgo, sino que, adicionalmente, contrajo la obligación de proteger el hábitat y el ecosistema en el que esta se relacione y desarrolle. Ese compromiso resulta más que razonable, pues cualquier especie muy difícilmente logrará sobrevivir por sí sola mientras su entorno no sea resguardado, debido a que, si su hábitat y ecosistema se ven amenazados, o acaso destruidos, se quedará sin un sitio donde habitar, alimentarse, crecer o reproducirse; es decir, estará destinada a la desaparición ...". Por lo que, los alegatos de la parte actora se centran en afirmar que el árbol ya no es apto para la anidación de la lapa verde dada sus condiciones; sin embargo, al no ser ese el objeto de este proceso debe de denegarse su reclamo, por cuanto, como lo explicó la sentencia apelada, el veredicto constitucional sirve para reflexionar en este asunto acerca de la importancia de mantener la especie, máxime cuando no representan un peligro para las personas o transeúntes.
Asimismo, debe de tomarse en cuenta que, si el árbol no resulta apto para la anidación conforme lo sostiene la parte apelante, éste podría servir de forma positiva para la mejora del suelo, regular microclimas, aumentar el secuestro de carbono, mejorar la biodiversidad y el paisaje escénico, solo por citar, algunas formas de impacto positivo que el árbol tendría dentro de la plantación de piña. Por esos motivos, se rechaza el agravio.
IX.Acerca del tercer reclamo, tampoco lleva razón la parte apelante. La inconformidad se dirige a la orden del Juzgado en relación a la creación de una zona buffer o de seguridad en un perímetro alrededor del árbol objeto del conflicto y la capacitación al personal que labora para la empresa piñera. Protesta la apelante de que esa orden se giró sin ningún tipo de sustento normativo. Sobre este aspecto, resulta pertinente citar que, la norma base del estado costarricense en materia ambiental que influye irremediablemente a todas las ramas jurídicas y cánones legales lo es el artículo 50 de la Constitución Política, que reza: “El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza. Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello, está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes. Toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano. Su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos y tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones". Como se mencionó, de previo a la modificación constitucional de 1994, ya se había reconocido por la Sala Constitucional de la Corte Suprema de Justicia el derecho al ambiente desde diversas perspectivas y esferas, que fueron definiendo el contenido de esa garantía constitucional. De igual forma, se produjeron fundamentales reformas legales que establecieron las bases de la institucionalidad ambiental del Estado actual.
Tras la reforma constitucional de 1994 en ese artículo citado, se reconoce la garantía del derecho al ambiente. En esa declaración se incluyen estos elementos: a) el reconocimiento constitucional expreso del derecho a un ambiente sano y equilibrado ecológicamente, b) la obligación del Estado de tutelar el ambiente, c) la legitimación activa amplia de quienes se sientan vulnerados en su derecho al ambiente, d) la incorporación del desarrollo sostenible como modelo de desarrollo de las actividades realizadas en el territorio nacional. La integración del desarrollo sostenible en todas las actividades productivas se torna en un mandato a fin de velar por la sostenibilidad, la preservación de los sistemas de vida y la generación de riquezas. Es decir, la actividad productiva debe ser desarrollada incorporando la variable ambiental, para lograr los objetivos de generación de riqueza y dinaminación de la economía, sin que se lesionen los ecosistemas o especies a fin de cumplir con el derecho de las futuras generaciones de contar con sistemas de vida sustentables y adecuados: el principio de solidaridad intergeneracional.
Por otra parte, el sustrato técnico científico surge como base de la interpretación de las normas tutelares del ambiente. Las nuevas tecnologías, los descubrimientos científicos y las modernas formas de asegurar la preservación de la biodiversidad, constituyen el núcleo a partir del cual deben de aplicarse las normas legales de orden ambiental. En ese sentido, rompe el derecho ambiental con el tradicional sistema de aplicación e interpretación de normas legales, dado el objeto a tutelar que es vulnerable y cambiante. Las personas titulares de propiedades y aquellas que desarrollen actividades productivas, debido al artículo 50 constitucional en su segundo párrado, deben someterse al régimen de límites y limitaciones de orden ambiental en sus bienes y actividades. Por ello, deben ser, además, incorporados los principios precautorios, preventivo, no regresión, solidaridad inter e intrageneracional, solo por mencionar algunos.
Así como la internacionalización de la carga ambiental de las actividades y proyectos que se acusan lesivos al ambiente y se tutele efectivamente la naturaleza mediante criterios ecológicos. Pero sin restar valor y efectividad a otros derechos y facultades de diversa índole otorgadas por la Ley a los actores sociales y estatales. En esa línea, se busca respetar entonces los postulados constitucionales de salud, ambiente, vida, desarrollo sostenible, así como propiedad, libertad y el desarrollo económico. En el caso en estudio, la decisión apelada, permite la continuidad de la actividad de producción piñera en resguardo de la especie forestal de cedro amarillo que debe mantenerse viva según criterio técnico de la entidad estatal competente, que además brinda una solución técnica científica temporal para resguardar la integridad de las personas y bienes que se ubiquen en la parcela donde se sitúa el árbol.
Sumado a lo anterior, el artículo 1 de la Ley de Biodiversidad estipula: "El objeto de la presente ley es conservar la biodiversidad y el uso sostenible de los recursos, así como distribuir en forma justa los beneficios y costos derivados". Esta misma legislación recoge el principio de la función ambiental de la propiedad (artículo 8), como fin a considerar en conjunto con las otras funciones del dominio como lo son la social y económica. La justiticación en procesos de esta naturaleza de derribo debe atender temas de seguridad y en este caso dada la medida temporal de zona buffer que se dicta, se logra aminorar el riesgo que una caída lesione algún bien o persona. Ha de mencionarse que sobre esta especie los estudios científicos nacionales han señalado: "El almendro (Dipteryx panamensis, Pittier), es una especie forestal nativa, de la familia Fabaceae, subfamilia Papilonaceae, con una distribución natural desde los bosques de tierras bajas de Nicaragua hasta Colombia (Flores 1992, Romo 2005).
En Costa Rica es abundante en el Caribe y en toda la región Huetar Norte del país (Castañeda et al. 2000). Una vez que alcanza la madurez, es un árbol prominente que forma parte del dosel superior y puede llegar a medir 60 m de altura y un diámetro en la base d hasta 2 m. Esta especie presenta un fuste cilíndrico y amplias raíces basales, sin embargo no presenta gambas. Tiene ramas ascendentes que forman una copa semiesférica y presenta una floración muy atractiva de color rosado-violeta (Gamboa 2008; Fournier 2003). La madera de la especie posee un alto valor comercial debido a su dureza y peso específico que oscila entre 0,83 – 1,09 gr/cm3 (Vozzo 2002; Carpio Malavasi 2000). Su secado al aire es rápido, pero con tendencia a agrietarse. Presenta una alta resistencia natural al ataque de agentes biológicos (hongos y bacterias) y un alto potencial para plantaciones de secuestro de carbono; sin embargo, su alto contenido de tílides y taninos dificultan su preservación (Flores 1992; Fournier 2003; Losi et al. 2003).
La importancia de la especie en Centroamérica y en la región radica en su alta demanda en el comercio internacional para pisos (ITTO 2016, Ravenshorst et al. 2013). En Costa Rica se le ha declarado en veda por su relación alimenticia con aves en vía de extinción, que motivó una declaratoria de la Sala Constitucional (Sentencia 2008- 13426) que prohíbe el aprovechamiento de la especie en todo el territorio nacional (Camacho 2015). En los últimos 15 años, el crecimiento y propagación de esta especie en Costa Rica, ha sido objeto de estudio y abordado por numerosos autores (Delgado et al. 2003, Piotto et al. 2003, Petit y Montagnini 2006, Alice et al. 2004, Schmidt 2009, Montagnini 2010), entre otros. ... Mencionan también la importancia de esta especie para proveer servicios ambientales (suelo, biodiversidad y clima) (Piotto et al. 2003a, Brenes 2007). En particular el potencial de la especie para secuestro y fijación de carbono en el largo plazo ha sido mencionado por (Redondo-Brenes 2007, RuizJaén y Potvin 2010)".

Como se logra deducir, la especie es valiosa por sus servicios ambientales, sin que el hecho de no encontrarse dentro de una zona con mayores especies reste su valor y potencial de ser lugar de anidación de lapa verde y de otra biodiversidad que lo requiera. El mantenimiento temporal de esta especie de forma responsable y técnica por la solicitante del derribo, se hace necesario dada las justificaciones técnicas del MINAE y se adecua al ejercicio de la propiedad privada y la libertad de empresa en cumplimiento del desarrollo sostenible y la obligación del resguardo de los recursos naturales.
Todo de forma razonable y proporcional; tal y como es el caso en concreto objeto de apelación. Así las cosas, contrario a lo cuestionado por la parte, este Tribunal comparte la decisión emitida en la sentencia en virtud de que el artículo 108 del Código Procesal Civil, aplicado supletoriamente en esta materia, en su punto 3 estipula: "... En la sentencia estimatoria se ordenará el derribo o la adopción de medidas de seguridad de carácter permanente ..." (Lo subrayado, no corresponde a su original). Es decir, si es viable en este tipo de procesos resolver la corta o no del árbol objeto de derribo, o bien, la adopción de alguna medida de seguridad, inclusive, de carácter permanente. En esa línea, el fallo recurrido dispuso, entre otras cosas, lo siguiente: " ...La parte actora como medida de prevención y seguridad debe hacer una zona BUFFER con un radio de mÍnimo de cincuenta metros al rededor del árbol de almendro amarillo objeto de proceso, situado en la finca del Partido de Alajuela matrícula tres tres nueve nueve seis nueve – cero cero cero ...".
En la parte considerativa de la sentencia la juzgadora emite la medida con base en la recomendación técnica que emitió el ingeniero del SINAC. La objeción por parte de la apelante se basa en el criterio del ingeniero Forestal Lizano López, con respecto a la pérdida que sufriría la empresa sobre un sector del terreno que tendría que dejarlo para garantizar esa zona de seguridad alrededor del árbol, y además, de que consideró este no generaba ganancias. Sin embargo, sus reclamos no son de recibo en virtud de que la medida de seguridad impuesta por el Despacho busca garantizar una zona de protección precisamente para el mismo personal que labora en la empresa accionante de forma conjunta con la protección de la biodiversidad. Por lo que, si su preocupación radica en la caída del árbol, la cual se comprobó no es el caso, resulta pausible emitir una medida de seguridad que resguarde la integridad de su personal y el árbol en sí mismo que conlleva a la carga ambiental de su actividad piñera en este caso en concreto, que podría significar el destino de un pequeño espacio de tierra para conservación de esa especie forestal.
Entonces, la disposición del Juzgado la cual es reclamada ante esta Instancia si tiene sustento normativo precisamente en el apartado 3 del cardinal 108 supra analizado en este fallo judicial, y el 50 de la Constitución Política, así como el sustento técnico científico emitido por el SINAC. Asimismo, no es cierto que el veredicto haya ordenado la capacitación a todo el personal de la empresa sobre esa zona de seguridad, aunque razonablemente debe de ser un deber que la actora asuma como consecuencia de la medida impuesta en la pieza recurrida. Por último, la parte cuestiona la imposición de la medida de seguridad al considerar afecta su actividad; sin embargo, no brindó otro remedio distinto a la corta del árbol para que esta Instancia valorará una segunda alternativa como medida de seguridad y determinará cuál era la más viable. Esa omisión procesal conlleva a que exista en este asunto una única recomendación técnica que fue la adoptada por el Juzgado y que la parte la objeta solamente en el sentido de que lo recomendable era la corta del árbol objeto del conflicto.
La carga de la prueba de los hechos controvertidos, constitutivos e impeditivos le corresponde a quien los invoca a su favor. El concepto de carga de la prueba debe entenderse como la obligación de la parte de ofrecer, allegar o presentar la probanza en el momento procesal oportuno (doctrina de los artículos 477 del Código de Trabajo y 41.1 del Código Procesal Civil). Por ende, no resulta de recibo su protesta y por infundada perecerá.
Internacional sobre Derechos Económicos, Sociales y Culturales, de 1966, 11 del Protocolo adicional a la Convención Americana sobre Derechos Económicos, Sociales y Culturales, conocido como Protocolo de San Salvador de 1988, 6, 26, 48 y 54 de la Ley de la Jurisdicción Agraria, 108 del Código Procesal Civil, se confirma la sentencia apelada, en lo que ha sido objeto de impugnación.
POR TANTO:
Se admite la prueba para mejor resolver ofrecida ante esta Instancia por la parte actora. Se confirma la sentencia apelada, en lo que ha sido objeto de impugnación.
