The STATE participates as a third party asserting independent claims (tercero con pretensiones propias), represented by State Attorney Susana Fallas Cubero, bar membership card N° 9669. Likewise, INSTITUTO COSTARRICENSE DE TURISMO (ICT), represented by its special judicial attorney-in-fact Jimy Álvarez García, bar membership card N° 13134, appears as an intervenor supporting the defendant (coadyuvante pasivo). Attorney Juan Arturo Abdelnour Granados, bar membership card N° 10226, serves as counsel for the plaintiffs.
RECITALS
I.On 13 de junio del año 2018, corrected by a filing dated 27 de junio de 2018, the plaintiffs commenced this ordinary proceeding, seeking a judgment declaring: “1) That this action be granted in all respects. 2) That, pursuant to Article 79 of Law 6043 – Law on the Maritime-Terrestrial Zone of 2 de marzo de 1977, that law does not apply in the Mata de Limón area; rather, Law 5582 of 2 de marzo de 1977 and its amendment, Law 7915 of 21 de setiembre de 1999, published in La Gaceta 193 of 5 de octubre de 1999, apply. 3) That, because Laws 9242 and 9408 of 6 de mayo del 2014 and 11 de noviembre de 2016, respectively, are subordinate to Law 6043 – Law on the Maritime-Terrestrial Zone, which by operation of law (Art. 79) does not apply in the Mata de Limón Area, they consequently do not apply in the Mata de Limón area. 4) That, pursuant to Law 7915 of 21 de setiembre de 1999, published in La Gaceta N° 193 of 05 de octubre de 1999, Municipalidad de Esparza is required to adopt an Urban Regulatory Plan (Plan Regulador Urbano) for the declassified area (área desafectada), which had been frozen by Ley Caldera 5582 of 21 de setiembre de 1974, published in La Gaceta N° 193 of 05 de octubre de 1999; therefore, a Coastal Plan (Plan Costero) may not be adopted for that same territory. 5) [WITHDRAWN].” At the preliminary hearing, the party clarified that, when it refers to the “Mata Limón area,” it means the entire maritime-terrestrial zone (zona marítimo terrestre) of the canton of Esparza. (See image 42, as well as the audio and video in SIGAO for the digital court case file and the minutes at images 246-249 of the digital court case file).
II.After service of process as required by law, counsel for Municipalidad de Esparza answered the complaint in the negative in a filing dated 14 de agosto de 2018 and raised the defense of failure to join necessary parties (falta de integración de la litis), which was resolved by an interlocutory ruling. (See images 50- of the digital court case file).
III.The plaintiffs replied to the Municipality’s answer in a filing dated 12 de setiembre de 2018, without offering additional evidence. (Images 81-83 of the digital court case file).
IV.The first portion of the preliminary hearing was held on 16 de enero de 2019, at which the State and ICT were summoned with respect to the action filed. (Audio in SIGAO, as well as the minutes at images 96-98 of the digital court case file).
V.The State appeared as a third party asserting independent claims in a filing dated 13 de marzo de 2019 and subsequently, in a filing dated 26 de setiembre de 2019, modified and expanded its claims, seeking a judgment declaring: “1. That the lands of Zona Protectora Tivives are governed by the special provisions of Articles 73 of Law 6043 and 32 and 37 of Law 7554, and are therefore excluded from municipal planning. 2. That lands belonging to Patrimonio Natural del Estado, such as mangrove areas—even those deprived of their original conditions—forests and other forest lands or lands suitable for forestry, listed in Article 13 of Ley Forestal, are administered by Sistema Nacional de Áreas de Conservación pursuant to Sections 13 of Ley Forestal and 22 and 28 of the Biodiversity Law, and are therefore excluded from municipal planning. 3. That the lands geographically located within the maritime-terrestrial zone that formed part of the port reserve area (zona de reserva portuaria) under Laws 5582 and 6309, and that were subsequently excluded by Law 7915, are governed by Law 6043 and its Regulations.
Therefore, their planning must be conducted pursuant to a coastal regulatory plan (plan regulador costero). 4. That the lands excluded from the ‘reserved port area’ by Law 7915 that do not form part of the maritime-terrestrial zone and are not subject to another special regime (such as that of Zona Protectora Tivives or other components of Patrimonio Natural del Estado) are those that may be included within an urban regulatory plan adopted by Municipalidad de Esparza pursuant to the Urban Planning Law.” (Images 107-116 and 147-156 of the digital court case file).
VI.ICT appeared as an intervenor supporting the defendant, without submitting evidentiary elements or grounds for challenge, in a filing dated 10 de junio de 2019. (Images 119-120 of the digital court case file).
VII.Counsel for the plaintiffs answered the third-party claim (tercería) in filings dated 23 de agosto de 2019, 22 de noviembre de 2019, and 15 de setiembre de 2020, alleging failure to state a legal right (falta de derecho) and lack of standing on both the plaintiff and defendant sides (falta de legitimación activa y pasiva). VIII.The State replied to the opposition to the third-party claim in a filing dated 19 de octubre de 2020. (Images 195-198 of the digital court case file).
IX.The continuation of the preliminary hearing provided for in Section 90 of the Administrative Litigation Procedure Code was held on 12 de marzo de 2021, with all parties present. The disputed facts were defined, the claims were modified, and documentary evidence was admitted; the matter was then declared to involve a pure question of law, and the parties were directed to submit written closing arguments. X.ICT submitted its closing arguments in a filing dated 12 de marzo de 2021, while the plaintiffs, the Municipality, and the State did so in filings dated 17 de marzo de 2021. (Images 245 of the digital court case file).
XI.On 23 de noviembre de 2022, reiterated on 15 de febrero de 2023, the defendant submitted additional evidence, and the parties were given an opportunity to respond by an interlocutory ruling issued at 15:16 hours on 11 de diciembre de 2023. Once the response period had elapsed, only the State responded, in a filing dated 13 de diciembre de 2023. (Images 251-263 of the digital court case file).
XII.This matter was originally assigned, as of 9 de abril de 2021, to Judge Gustavo Irías Obando (image 250). However, upon the redesign of the Court, this matter was reassigned to reporting Judge Mejías Rodríguez on 15 de agosto de 2023, awaiting its turn pursuant to agreement 11.VI.2023 of the Administrative Litigation Commission from the session of 27 de julio de 2023. After the necessary interlocutory proceedings described in the preceding recitals had been completed, the matter was transferred to the judgment queue on 21 de diciembre de 2023, to be heard during the January 2024 session based on seniority. Pursuant to Sections 100, 101, 104 to 111, and 119.1 of the CPCA (Law N° 8508); Section 60, subsections 1, 4, and 5; Section 79, subsections 4, 5, and 6; and Sections 81 and 82 of the Autonomous Regulations on the Organization and Service of the Administrative Litigation and Civil Jurisdiction of the Treasury (Circular 001-08); Sections 7 and 8, subsections b, c, and d; Section 12, subsections a, b, c, and d; and Sections 13, 14, 15, 16, and 17 of the General Internal Control Law (N° 8292); as well as agreement 3° of minutes N° 7 of the ordinary session of 1° de setiembre de 2023 of the Administrative Litigation and Civil Commission of the Treasury, the matter is declared highly complex due to the subject under dispute and the nature and number of the parties’ grounds for challenge.
This judgment is issued within the statutory period, unanimously and following deliberation by the members of the Court, with no grounds having been identified that could invalidate the proceedings. Judge Mejías Rodríguez authors the judgment, with the concurring votes of Judges Bolaños Salazar and Gómez Chacón.
CONSIDERING
As stated in recital XI of this judgment, Municipalidad de Esparza submitted a filing that essentially notified the Court of the amendment made to Section 79 of Law 6043. Strictly speaking, this circumstance does not constitute new evidence, but it is a fact that affects the claims in both the complaint and the third-party claim asserting independent claims; accordingly, it will be addressed below by the Court.
Although it is true that the parties submitted their respective documentary evidence, this matter exclusively concerns an eminently legal issue. Thus, although the parties submitted copies of judgments, opinions of the Procuraduría General del Estado, legislative records, and minutes of the Concejo Municipal de Esparza, none constitutes direct probative evidence (elementos de convicción) in terms of proving a fact; rather, they are essentially part of the grounds for challenge (agravios) asserted by the parties in support of the central legal issue to be determined, as set forth in the claims of both the action and the third-party intervention asserting independent claims (tercería con pretensiones propias). All such claims are framed, in general terms, as requests for declaratory relief, insofar as they seek a judicial determination of the legal parameters applicable to the strip of territorial space that the parties call Mata Limón de Esparza, Puntarenas.
Furthermore, although the Procuraduría, within the framework of its Ley Orgánica, has the authority to issue opinions that are binding upon the entities that submit matters for its consideration, those opinions do not have the same effect within the administrative-litigation jurisdiction (jurisdicción contenciosa administrativa). Consequently, the submitted documents are essentially treated as part of the grounds supporting one or another position of those participating in these plenary proceedings (proceso de conocimiento). It should be noted that none of the aforementioned acts is the subject of specific claims for administrative-litigation review or oversight, and they are therefore treated accordingly. Thus, for example, the usefulness of the evidence offered by the plaintiffs consisting of minutes 51-2017 of the Concejo Municipal de Esparza is rejected, since those minutes were not challenged in this forum.
Now, among the evidence in the record, specifically that submitted by the respondent Municipality and in the State’s third-party intervention asserting independent claims, and for purposes of the spatial and territorial delimitation at issue, there are orthographic sheets (images 54-56), as well as SINAC-ACOPAC-TOPO-011-2019, the report on the mangrove (manglar) in that area (images 220-224). Both items are useful and relevant to resolving this matter, although we expressly note that the spatial and territorial delimitation is not itself the subject of the dispute; rather, the dispute concerns the application of a particular legal framework within that space. They are therefore admitted as probative evidence establishing the following PROVEN FACTS: 1) The Manglar de Mata Limón and the Zona Protectora Tivives, which forms part of the Área de Conservación Pacífico Central and is administered by MINAE, are located in the canton of Esparza, district of Esparza (Images 220-224). 2) The Zona Portuario de Caldera, as established under laws 5582, 6309 and 7915, is located in the canton of Esparza, district of Esparza. (Images 54-56 and 220-224 of the digital court record).
None in this matter.
In the complaint, reply, and closing arguments, the plaintiffs, after presenting what they consider to be a historical account of the origin of the Puerto Caldera project and the regulations governing it over time, state, as relevant here, that under law 4558, the declaration designating Esparza as a tourism area was issued on 6 de agosto de 1970. That area extended from the mouth of the río Jesús María, including Playa Tivives and el Peñón, the beaches of Mata Limón and Caldera, to the mouth of the río Barranca at Playas de Doña Ana (the boundary with the canton of Puntarenas). This area was modified by law 4668, which amended transitory provision VI of law 4558, recognizing it as an area “subdivided and developed by the Ministerio de Agricultura y Ganadería and the Instituto de Tierras y Colonización” and establishing the method for measuring the 50-meter zone referred to in art. 6, which was to be measured from the oceanfront beach rather than from the estuary (estero).
Accordingly, in the case of Mata Limón, the provision established that the Maritime-Terrestrial Zone (Zona Marítimo Terrestre) was excluded from the jurisdiction of the Municipalidad de Esparza. In 1974, an international loan agreement was created under Law 5582 (Ley Caldera), which gave rise to Puerto de Caldera over an area of 3457 hectares, freezing privately owned land on the mainland in order to subject it to a “Reserved Port Zone” (“Zona Portuaria Reservada,” ZPR), with land-use restrictions imposed on owners, possessors, and tenants, as well as a freeze on the free disposition of property. In 1979, that area was expanded by law 6309 and regulated by decreto 11494 de 19 de mayo de 1980, under which the competent governing body was not the municipality but the Ministerio de Obras Públicas y Transportes. Separately, in 1977, the Ley de la Zona Marítimo Terrestre was enacted, art. 79 of which excludes the Mata Limón area from the application of that law and states that law 5582 applies to that space, a point acknowledged by the PGR in its opinion C-119-1990.
In 1991, an amparo proceeding (recurso de amparo) was filed because the area had remained frozen without expropriations being carried out, resulting in judgment 2765-1996, which held the State liable for failing to comply with Ley Caldera. Subsequently, in 1999, law 7915 was enacted, amending law 5582 and reducing the size of the Zona Portuaria Reservada, thereby lifting the existing encumbrance and releasing owners from the restrictions. It also imposed a mandate upon the Municipio de Esparza with respect to the de-designated area (zona desafectada), requiring it to prepare a zoning plan (Plan Regulador) encompassing the areas surrounding the ZPR as well as the area de-designated by that law, and ordering compliance with the provisions of Ley de Planificación Urbana 4240. The plaintiffs assert that, despite that order, the respondent Municipality has resisted preparing the Plan Regulador and seeks to apply law 6043 and its supplementary provisions, Laws N° 9242 and 9408, within that space.
They contend that the release of areas under law 5582 results in reversion (retrocesión) and restoration of the owners’ original powers, as stated in decision 1584-2014 of the Sala Constitucional. In 2017, through agreement 51-2017 adopted at the Ordinary Session of 17 de abril de 2017, artículo IV inciso 2, the Concejo Municipal de Esparza accepted and approved the requirements for land uses (usos de suelo) under Precarious Status (Estado Precario) pursuant to laws 9408 and 9248, with the respondent municipality seeking to apply them to the Mata Limón area. They likewise assert that the municipal position, which is based on opinions of the PGR, entails an application founded upon false premises adopted by the State body and that those premises are contrary to law. In its answer and closing arguments, the Municipality states that PGR opinions C-323-2004, C-095-2012 and C-259-2017 explain the reasons why law 6043 does apply to the Mata Limón area, specifying that the area de-designated by law 7915 did not lose its public-domain status (demanialidad), but instead became subject to the maritime-terrestrial regime.
Furthermore, the aforementioned “Mata Limón area” refers to the administrative seat of the district of Caldera but encompasses an extensive area and therefore includes the State Natural Heritage (Patrimonio Natural del Estado)—the mangrove, estuary, beach, saltwater forest, and other areas, with PGR opinion C-102-96 being invoked—the Reserva de Tivives, the port zone, the Maritime-Terrestrial Zone, roads, and any land not subject to any of those areas, which would technically constitute private property upon which an Urban Zoning Plan (Plan Regulador Urbano) may be adopted. Regarding this matter, the Municipality states that an Urban Zoning Plan project does exist and has been approved by SETENA (2374-2016-SETENA), and that the adjustment and correction of the urban regulations and related cartography are currently being processed, after which the public-hearing procedure will be conducted and the approval and implementation of the plan will be completed pursuant to art. 17 of law 4140.
With respect to the Maritime-Terrestrial Zone, a Coastal Zoning Plan (Plan Regulador Costero) is being processed and is awaiting MINAE’s determination of the State Natural Heritage. In its closing arguments, ICT, as a supporting party for the defense (coadyuvante pasivo), maintains that the withdrawal of the fifth claim removed ICT from the merits of the matter.
In its third-party intervention asserting independent claims, the State states in its initial submission and reply that the plaintiffs have not demonstrated how their individual rights (derechos subjetivos), legitimate interests (intereses legítimos), or legal situations have been adversely affected so as to establish standing (legitimación activa). It further states that law 4558 was suspended by law 5602 and repealed by law 6043. It explains that, in the case of Mata Limón, although there is a loan agreement governed by law 5582, the Zona Protectora Tivives, the manglar de Mata de Limón (decreto 17023), and other areas outside that zone also exist there and fall outside municipal jurisdiction, as stated in opinions C-323-2004, C-346-2015 and C-259-2017, because jurisdiction over them is reserved to MINAE, as the Sala Constitucional has held in decisions 1886-1995, 8713-2008, 16975-2008, 21258-2010, 12973-2013 and 19776-2014.
Turning specifically to the area de-designated by law 7915, the State considers that the plaintiffs err in maintaining that its public-domain use was de-designated, because that would constitute an implied de-designation (desafectación implícita), which has not been recognized by constitutional case law (decisions 10466-2000, 3821-2002, 3480-2003, 8928-2004, 454-2006, 11346-2006, 2063-2007 and 2408-2007, among others). Consequently, following the de-designation, it was necessary to determine whether the lands within the released area remained subject to other special regimes, such as the State Natural Heritage or the Maritime-Terrestrial Zone regimes. Only spaces not subject to another particular regime would be covered by a de-designation allowing the Municipalidad de Esparza to issue an Urban Zoning Plan under the terms of the Ley de Planificación Urbana. In its closing arguments, the State explains that the merits of the matter are limited to the interpretation of law 7915 and article 79 of law 6043 with respect to the Mata Limón area, reiterates the grounds previously set forth, and states, in summary, that the usefulness of the action is unclear because it seeks an urban zoning plan rather than a coastal zoning plan, without establishing what difference would result from applying one regime instead of the other.
In its answer and closing arguments opposing the third-party intervention, the plaintiff states that its members are residents of the de-designated area and therefore have standing because they suffer the consequences of lacking municipal zoning, and are protected under art. 14 of law 3859 and art. 11 of its regulations. It further explains that the State’s position seeks to disapply the provisions of law 5582 and instead apply provisions of law 6043, even contradicting its own opinion in C-119-1990. It considers the State’s position to consist of relying on its own opinions to validate its arguments, which is improper. It further argues that the Zona Protectora de Tivives was established in decreto 17023 without studies of any kind having been conducted and despite the existence of an earlier designation under law 5582, as stated in decision 2765-1996 of the Sala Constitucional. It contends that the Tivives decree constitutes a misuse of power (desviación de poder) and a form of corruption intended to give retroactive effect to the ley orgánica del ambiente.
In any event, it states that there is no State Natural Heritage within the area de-designated by law 7915, because forests could refer only to those that were expropriated and are located on State-owned lands. Furthermore, decreto 42404 del 6 de abril de 2020 corrected the boundaries of Tivives, acknowledging that law 5582 had not been respected.
Before analyzing the merits of this matter, it is necessary to make two clarifications regarding the subject matter of the dispute, in view of the parties’ statements, particularly those made by the plaintiffs throughout the proceedings. First, no municipal resolutions (acuerdos municipales) are being challenged. Although the plaintiffs refer in their action to a resolution of the Concejo Municipal de Esparza, that resolution is not reflected in any of the claims for relief. The same applies to the opinions of the Procuraduría; therefore, addressing the validity of those acts falls outside the scope of this litigation. Moreover, although the plaintiffs refer—particularly in their closing arguments—to the legality of decreto 17023 and its amendments (decreto 42404), those measures were likewise not directly challenged in this matter. Accordingly, what we have in this case are primarily declaratory claims (pretensiones declarativas), as defined both by the relief sought in the complaint and by the third-party intervention asserting independent claims (tercería con pretensiones propias).
Another aspect of vital relevance to the present matter, which affects the claims asserted in the complaint as well as the subject matter of the dispute itself, is that a ruling is sought regarding the “Mata Limón Area”; however, nowhere in the complaint is there any reference to what territory that area encompasses. It should be noted that it was not until Law 9235 dated 6 de mayo de 2014 that District No. 6 of the Canton of Esparza was created and named Caldera; pursuant to Article No. 2 of that law, it is spatially defined as follows: “According to the 1:50000-scale map sheets published by the Instituto Geográfico Nacional and named Juntas, San Lorenzo and Chapernal, this district is bounded to the north by the Canton of Puntarenas, districts of Espíritu Santo and San Juan Grande, beginning at the mouth of the Barranca River and proceeding upstream until entering Quebrada Honda, up to the point at coordinates 215450N-462100E; it then proceeds eastward along the deepest depression in the terrain to the point at coordinates 215375N-462550E on the road leading from Juanilama to Caldera, from which point it descends southeastward to the spring (naciente) of an intermittent stream, whose waters flow into the Paires River and then into the Jesús María River; to the east, from the confluence of the Paires River and the Jesús María River to its mouth at the Pacific Ocean; to the south, it is bounded by the mouth of the Jesús María River; and, to the west, the boundary runs from the mouth of the Jesús María River, continuing northward along the coast to the mouth of the Barranca River,” while Article 3 states that the hamlets included in that district are “Mata de Limón, which shall be the district seat, Hacienda Salinas, Cambalache, Tivives, Caldera, Quebrada Honda, San Antonio, Cabezas, Finca Cortijo, Hacienda La Moncha, Hacienda Playa Linda, Cuesta Jocote, Finca Brazo Seco, Cascabel, Corralillo, Figueroa, Jesús María (Estación), Hacienda Mata de Guinea, Silencio, Villanueva, Guardianes de la Piedra and Alto de las Mesas.” Thus, legally speaking, everything indicates that the area in dispute refers exclusively to the district seat.
Nevertheless, throughout the proceedings and in the various applications made in the complaint, as well as in the answers, third-party claim, and closing arguments, the spatial framework is not limited exclusively to the district seat; rather, it refers to the geographical area originally covered by Law 5582, Article 2 of which provided: “Beginning at the intersection of horizontal axis No. 213 and vertical axis No. 457, proceed along axis No. 457 until it intersects horizontal axis No. 214. From that point, proceed along axis No. 214 until it intersects vertical axis No. 461. From that intersection, proceed along axis No. 461 until it intersects horizontal axis No. 207. From that intersection, proceed along axis 207 until reaching a point located 200 meters from the coast. Then proceed along a line running parallel to the coast at a distance of 200 meters until it intersects horizontal axis No. 209.
From that point, proceed along axis No. 209 until it intersects the coast (Punta Corralillo). The Instituto Geográfico Nacional shall interpret the boundaries described in accordance with advances in the cartographic mapping of the country’s base map. Said Institute shall also publish a map of the Reserved Port Zone....” This area was expanded by Art. 8 of Law 6309 to include the following: “Beginning at the intersection of horizontal axis No. 214 with the coast, proceed eastward along horizontal axis No. 214 until it intersects vertical axis No. 461. From this point, proceed southward along vertical axis number 461 until it intersects horizontal axis No. 211. From this intersection, proceed westward along horizontal axis No. 211 until it intersects the Jesús María River; from this point, proceed along the centerline of the Jesús María River until it intersects vertical axis No. 461. From that intersection, proceed southward along axis No. 461 until it intersects horizontal axis No. 207.
From that intersection, proceed westward along axis No. 207 until reaching a point located 200 meters from the coast. Then proceed along a line running parallel to the coast at a distance of 200 meters until it intersects horizontal axis number 209. From that point, proceed along axis No. 209 until it intersects the coast.” These areas are depicted in images 222 and 223 of the digital court record. Following this amendment, they constitute what this Court refers to as the area originally subjected to restrictions, which received the technical name “reserved port zone” (zona portuaria reservada, ZPR). At the time the restrictions were imposed, this area included both public and private property, which was subjected to the provisions of the aforementioned Law 5582; that law served as the basis for purchases, expropriations, and the construction of roads, a railway line, among other works, for the construction of the Proyecto Puerto Caldera.
Lands that were not part of the public domain (demanio público) at that time were subjected to a special land-use control regime (régimen especial de control urbanístico), with Art. 3 of Law 5582 providing that: “The owners, possessors, or tenants of lands located within the reserved zone shall refrain from carrying out work or construction that would make the acquisition of the property to be allocated to the Caldera industrial port complex more burdensome,” while Transitory Provisions II and III stated: “TRANSITORY PROVISION II.- In the case specified in Article 4, owners and tenants shall not be evicted from their lands until those lands are to be occupied by port installations or facilities, as determined by the Ministerio de Obras Públicas y Transportes. TRANSITORY PROVISION III.- Owners and tenants shall maintain the existing structures until they are expropriated by the Ministerio de Obras Públicas y Transportes.” Concurrently, in 1986, Decree 17023 was issued, creating the Zona Protectora de Tivives (ZPT), Article 1 of which defined an area of approximately 2.368,75 hectares encompassing the Mata Limón and Tivives mangroves, as well as the remaining tract of tropical dry forest.
Subsequently, in 1996, Art. 71 of Ley 7575 modified the area, but the Sala Constitucional annulled that provision through Vote 7294-1998. Finally, in 2020, the area was rectified by Decree 42404, removing from the Zona Protectora Tivives the boundary descriptions (derroteros) of the properties using the CRTM05 X and CRTM05 Y System, based on registered survey plans (planos catastrados) 6-1823326-2015 and 6-1824697-2015, as detailed in report SINAC-ACOPAC-TOPO-011-2019, shown in images 220 and 221 of the digital court record. Now, as a second line of discussion, we find that the legal regime governing that same area was subsequently modified or transformed in 1999 by Law 7915, which amended Art. 2 of Law 5582, reducing the ZPR to include only the following area: “Beginning at the intersection of parallel axis 212.700 with the lower low-water line, proceed eastward along this parallel axis until intersecting the left-hand boundary of the right-of-way of National Route No. 23 when traveling from El Roble de Puntarenas toward puerto Caldera.
Proceed southeastward along this left-hand boundary until that line intersects the point defined by the intersection of meridian axis 458.200 and parallel axis 210.860. Proceed southward along this meridian axis until intersecting parallel axis 210.000. Proceed westward along this parallel axis until intersecting the lower low-water line. Continue along this line until its intersection with parallel 212.700. This boundary excludes the section of the lower low-water line that enters and exits the Mata de Limón estuary. Likewise, the reserved port zone shall continue to include the lands located on the Mata de Limón hill, south of the settlement of the same name, that as of this date are in the possession or ownership of the Ministerio de Obras Públicas y Transportes, the Instituto Costarricense de Electricidad, and the Instituto Costarricense de Puertos del Pacífico, because their elevated location makes them necessary for navigational aids, telecommunications, and the supply of drinking water to the Caldera port complex and surrounding communities.
Within this reserved port zone, the Ministerio de Obras Públicas y Transportes is authorized to carry out the infrastructure works necessary to expand said Port, including any coastal works required to preserve, maintain, or protect the installations and facilities of the port of Caldera.” This area is depicted in images 55, 56, and 224. Similarly, it newly clarifies that “The lands included in the reserved port zone created by Laws No. 5582 and No. 6309 shall be governed by Law No. 6043 on the Maritime-Terrestrial Zone, dated 2 de marzo de 1977,” while, with respect to the area previously classified as ZPR and the lands surrounding those areas, the Municipalidad de Esparza was required to prepare a regulatory and urban-development plan (plan regulador y de ordenamiento urbano), in accordance with Law 4240. Finally, as a third line of discussion, we find that, in 2022, Art. 79 of Law 6043 was amended to expressly provide: “The provisions of this law shall not apply to the coastal areas of the district of Caldera administered by the Municipalidad de Esparza.
To promote and encourage the development of the port of Caldera and its surrounding areas, land-use planning (ordenamiento territorial) shall be implemented in those areas through an urban regulatory plan (plan regulador urbano), in accordance with the provisions of Law 4240, Urban Planning Law, dated 15 de noviembre de 1968. Excluded from this amendment are areas subject to special regimes: the Zona Portuaria Reservada under Law 5582 and its amendment by Law 7915, the Zona Protectora Tivives pursuant to Decree No. 17023, lands constituting Patrimonio Natural del Estado as defined under Ley Forestal 7575, mangroves, forests and forest lands, and the public zone corresponding to the first fifty meters of beach measured from ordinary high tide. Structures, installations, and properties located in the coastal areas of the district of Caldera administered by the Municipalidad de Esparza must provide for community, tourism, urban, residential, commercial, and agricultural development in a manner that is sustainable with respect to natural resources.” With this statutory framework as a reference, we shall analyze the merits of the matter.
Upon reviewing both the claims in the complaint and the third-party intervention asserting independent claims (tercería con pretensiones propias), all of them appear to be contradictory; nevertheless, if we take into consideration the problem of the spatial delimitation described in the preceding recital (considerando), as well as the amendment of art. 79 of Ley 6043 by Ley 10236, regarding which the parties were granted a hearing (resultando XI of this judgment), we find that all the claims are partially admissible, provided that it is determined where the petition is supported. To elaborate on the foregoing statement, it is necessary to consider two aspects that limit this ruling and define the scope of what is decided herein: on the one hand, the fact that neither the claims of the plaintiff nor those of the State contain technical evidence or requests specifically seeking to geospatially delimit zones or areas in which the public or private real-property regulatory regimes considered in this judgment are to apply.
This is precisely because, throughout the record, the “Zona de Mata Limón” is referred to as though it were a delimited area when, as stated supra, it is not. Accordingly, if the parties were to seek a specific delimitation of these areas, this would have to occur in a separate proceeding whose purpose is that delimitation. This is an aspect of vital importance for the environmental protection area encompassing both the dry forest and the mangrove that form part of this dispute. In this regard, applying the pro-action principle (principio pro actione), this Chamber analyzes all the claims as fundamentally declaratory petitions, so that the Court may determine a possible legal regime governing the area at issue, which was identified and delimited in the preceding recital. From this follows, as a consequence, a limitation on what is decided, because a declaration that a specific regime applies, where that regime might be deemed prejudicial to a particular person in a specific case, would require a separate proceeding to determine the consequences of applying that specific regime.
In other words, as a consequence of the manner in which the claims were pleaded, this judgment is declaratory in scope and does not specifically define or determine, with respect to any particular property, the application or regulation of one real-property system or another, whether public or private. Thus, by way of example, if this judgment states that mangroves are subject to a public-purpose designation (afectación pública) and special environmental protection having certain characteristics, and if, in a specific case, a person holds a parcel that may be affected by those rules, the specific consequences of regularizing tenure over those areas would have to be clarified in a separate proceeding. With the foregoing made clear, we turn to the first fundamental issue concerning the merits. VII.1- MULTIPLE PUBLIC-PURPOSE DESIGNATIONS IN CASES INVOLVING THE PUBLIC DOMAIN: Without requiring an extensive discussion of the classification of property under sections 261 and 262 of the Código Civil, we may summarize that public-domain status (demanialidad) arises, broadly speaking, from three sources: designation by law (afectación por ley), meaning when an applicable legal provision expressly determines the public nature of an asset or class of assets; when assets are dedicated to providing a service of general utility; and, finally, assets used by everyone for public use.
Under the principle of parallelism of forms (principio del paralelismo de formas), once an asset has been placed under the public regime, it may enter commercial circulation only through express removal of that designation (desafectación expresa). Accordingly, the State is correct in maintaining that, under the relevant case law on the subject, implied removal of a public-purpose designation (desafectación tácita) is not possible. Likewise, public-domain status should not be understood as exclusive or incompatible; rather, depending on the regime involved, there may be a single or multiple designated purposes, which may in turn overlap or be supplemented by other regimes. One example is the public-road regime, which has a basic framework governed by the Ley General de Caminos Públicos and related regulations and is supplemented by rules governing public lighting services, sidewalks, stormwater and sanitary sewerage, drinking-water distribution, telematic services, railway service, land traffic generally, public transportation, and so forth.
Even protection systems as restrictive as environmental protections applicable to national parks are compatible, for example, with tourism management and use plans. Ultimately, determining which regime predominates, as well as its compatibility, limitations, or scope, requires weighing the intensity with which each regime applies to a specific case, as overlapping layers of public or private real-property regulation. Likewise, the coexistence of regimes may mean that removal of one public-purpose designation does not necessarily eliminate all restrictions; instead, the specific case must be analyzed to determine the applicable legal situation. Finally, there may be a change in public-domain designation (mutación demanial), whereby one public purpose is replaced with another. With that in mind, we analyze the claims in the complaint and the third-party intervention concerning the three principal areas in dispute: first, the Reserved Port Zone (Zona Portuaria Reservada, ZPR), following Ley 7915 and the amendment introduced by Ley 10236 to Ley 6043; second, the area previously designated by Ley 6309 and released from that designation by Ley 7915; and, finally, the environmental regulations applicable in either area.
VII.2.- REGULATION OF THE “RESERVED PORT ZONE” (ZONA PORTUARIA RESERVADA, ZPR) AFTER LEY 7915: Following the amendment introduced by Ley 7915, the area encumbered by the ZPR regime established by Ley 5582 was substantially reduced, and additional rules concerning the designated use of that area were also included. As its primary use, or foundational regulatory layer under the administration of MOPT, the area remains designated “for carrying out the infrastructure works necessary to expand said Port, including any coastal works required to preserve, maintain, or protect the facilities and amenities of Puerto de Caldera.” Nevertheless, this was supplemented by a second regulatory layer providing that Ley 6043, Ley de la Zona Marítimo Terrestre (ZMT), would also apply. It is important to note that the regulation established by that law is not confined exclusively to the so-called public zone (zona pública) and restricted zone (zona restringida) referred to in art. 10 thereof; rather, it also establishes special regulations for mangroves and estuaries, whether insular or continental, classifying them as public zones, as well as regimes governing industrial and related activities, such as that contained in art. 18, which includes the “construction of industrial plants, sport-fishing facilities or artisanal facilities, port works, mariculture programs, or other similar establishments or facilities whose operation necessarily requires their location near the sea… construction, installation, and operation of shipyards and dry or floating docks”; art. 22 includes the “establishment and operation of State-owned tourism facilities of clear benefit to the country,” as well as other infrastructure works consistent with the public purpose of the public zone; access routes (roads) under art. 23; and, consequently, the Ley General de Caminos Públicos and related or associated regulations referenced supra.
From a planning perspective, port regulations would have greater force and predominance in this area, while maritime-terrestrial regulations would apply secondarily. In this regard, the second claim in the complaint, which states, “That pursuant to artículo 79 of Ley 6043 – Ley sobre Zona Marítimo Terrestre of 2 de marzo de 1977, that law does not apply in the Zona de Mata de Limón; instead, Ley 5582 of 2 de marzo de 1977 and its amendment, Ley 7915 of 21 de setiembre de 1999, published in La Gaceta 193 of 5 de octubre de 1999, apply,” must be rejected. This is because, pursuant to the fourth paragraph of art. 2 of Ley 5582, as amended by Ley 7915, the so-called “Zona de Mata Limón,” delimited in the preceding recital, includes part of the ZPR; and, in that zone, by mandate of the same provision, Ley de la Zona Marítimo Terrestre N° 6043 does apply and, as stated, is not incompatible with Ley 5582.
However, taking into consideration the third claim in the complaint, which states, “That because Leyes 9242 and 9408 of 6 de mayo del 2014 and 11 de noviembre de 2016, respectively, are subordinate to Ley 6043 – Ley sobre la Zona Marítimo Terrestre, which by operation of law (art. 79) does not apply in the Zona de Mata de Limón, consequently those laws do not apply in the Zona de Mata de Limón,” that claim must be granted with respect to the ZPR. This is because art. 3° of Ley 9242 begins by stating, “Municipalities having jurisdiction within the restricted zone of the maritime-terrestrial zone and having a current coastal regulatory plan (plan regulador costero) may preserve existing structures, provided that they comply with the plan and applicable environmental regulations…” (emphasis added). Because the ZPR has a foundational regulatory regime in favor of MOPT, it cannot be said to fall within the “jurisdiction” of the defendant Local Government.
Consequently, Ley 9242 and its amendment, Ley N° 9408, indeed would not govern the portion of what the parties call the “Zona de Mata Limón” that lies within the ZPR, because, as emphasized, port regulations predominate over other maritime-terrestrial regulations in this area, without prejudice to what will be stated infra regarding environmental matters. VII.3.- REGULATION OF THE AREA RELEASED FROM ITS DESIGNATION BY LEY 7915 AND PREVIOUSLY DELIMITED BY LEY 6309: Contrary to the State’s position, the enactment of Ley 7915 did constitute an express, rather than implied, removal of the public-purpose designation from the area originally subject to the ZPR at the location described in Leyes N° 5582 and 6309. This is the area that the plaintiffs call “frozen” and whose regime changed beginning in 1999 pursuant to Ley 7915; it is sufficient to reiterate the graphic representation contained in official communication SINAC-ACOPAC-TOPO-011-19, appearing at images 222 through 224, as proof thereof.
It is with respect to this expressly released area, which the plaintiffs call the “Zona de Mata Limón,” that claims 2, 3, and 4 of the complaint, as well as claims 3 and 4 of the State’s third-party intervention, may also be analyzed. For that purpose, we must divide the area into three parts: the coastal area, the environmental area, and, finally, the remainder. We clarify that the area designated as environmental will be addressed infra in the following subsection. The coastal area is the area that can be identified by comparing the “map of the ZPR boundaries” appearing at images 223 and 224 of the court record and corresponding to the coordinates partly 214000 to partly 212000 (vertical) :: partly 455000, 458000 (horizontal), as well as the area at coordinates 210000,207000 (vertical) :: partly 456000, partly 459000 (horizontal).
In those areas, removed from public-domain status (desafectados) by ley 7915, the ZPR governed by ley 5582 is eliminated. Therefore, in light of the parties’ claims, it is necessary to determine the applicable legal regime, since, while the plaintiffs contend that there has been a complete removal from public-domain status and, consequently, that the areas are subject to the private-property regime, the State contends that ley 6043 must apply, classifying the area as Maritime-Terrestrial, with the difference that an Urban Regulatory Plan would apply under one regime and a Coastal Regulatory Plan under the other. Aside from the State’s argument that the claimants fail to explain the substantial difference between the two legal frameworks, the fact remains that, within the scope of the claims asserted by the plaintiffs, on which the Court must rule, as well as the claims asserted by the State itself, it is necessary to identify the applicable regime.
In this regard, the amendment introduced by ley 10236 identifies the applicable regime, as it provides: “The provisions of this law shall not apply to the coastal areas of the district of Caldera administered by the Municipalidad de Esparza. To promote and encourage the development of the port of Caldera and its surrounding areas, land-use planning (ordenamiento territorial) shall be implemented in those areas through an Urban Regulatory Plan, in accordance with Ley 4240, Ley de Planificación Urbana, of 15 de noviembre de 1968. Excluded from this amendment are areas subject to special regimes: the Reserved Port Zone under Ley 5582 and its amendment by Ley 7915, the Zona Protectora Tivives pursuant to decreto N.° 17023, State Natural Heritage lands (terrenos Patrimonio Natural del Estado) as defined by Ley Forestal 7575, mangroves, forests and forest lands, and the public zone corresponding to the first fifty meters of the beach measured from the ordinary high-tide line.
Buildings, facilities, and properties located in the coastal areas of the district of Caldera administered by the Municipalidad de Esparza must provide for community, tourism, urban, housing, commercial, and agricultural development in a manner sustainable with natural resources.” As may be seen, consistently with the preceding subheading, ley 6043 would not apply in the coastal area administered by the Municipalidad de Esparza. Accordingly, claim 2 of the complaint would have to be granted in part with respect to the application of artículo 79 of ley 6043 to the area released from restrictions; however, ley 5582 and its amendments would not apply because the area would not constitute a ZPR. Consequently, the third claim in the State’s third-party proceeding would have to be denied for the reasons stated. Thus, for land-use planning purposes, the applicable regime in that area would be that of the Ley de Planificación Urbana, guided by the objective of “promot[ing] and encourag[ing] the development of the port of Caldera and its surrounding areas” (art. 79 de la ley 6043).
This is consistent with the designated purpose set forth in ley 7915 itself, which states: “…To ensure the proper urban, social, and environmental development of the areas surrounding the reserved port zone, the Municipalidad de Esparza shall prepare a regulatory and urban-development plan that includes the area removed from public-domain status by virtue of the enactment of this law. In preparing and implementing this plan, that Municipality and the public institutions involved shall be governed by Ley de Planificación Urbana, Nº 4240, del 15 de noviembre de 1968,” without prejudice in all cases to the public-zone regime covering the 50 meters measured from the high-tide line. We note that, contrary to the claimants’ position, the removal from public-domain status effected by ley 7915 can extend only to the restrictions contained in ley 5582 and its amendments. It cannot be construed as altering in any way the other public-order regulations that coexisted before, during, and after the designation of the ZPR, such as those governing public roads, public services, and other public-domain assets (bienes demaniales) existing in the area.
This analysis would apply equally to the remaining area—that is, the area that would be neither coastal nor environmentally protected under the terms of the following section—and that was released from restrictions by ley 7915. This area would be eligible for planning through an Urban Regulatory Plan and is identified on the “map of the ZPR boundaries” between coordinates 214000, hasta en parte 207000 (vertical) :: en parte 455000, 461000 (horizontal). Accordingly, the fourth claim of the complaint is granted on these terms, with the clarification that the respondent Municipality is required to plan these areas through an Urban Regulatory Plan, always subject to the jurisdictional limits and procedures currently applicable to any Urban Regulatory Plan. VII.4.- ENVIRONMENTAL REGULATION IN ANY OF THE FOREGOING AREAS: Finally, we find an area located both within and outside the coastal area described above that could even form part of the ZPR, as well as areas farther inland.
In general terms, this regulation would take precedence, causing the other regulations to yield in their application. We refer to areas subject to special environmental protection, identified as the mangroves of both Tivives and Mata Limón, which are protected at the national level (Ley 6043 and Ley Forestal N° 7575, Ley 7224 “Convenio Ramsar”, Ley Orgánica del Ambiente N° 7554, Ley de Biodiversidad N° 7788), and to the Zona Protectora de Tivives (Decreto 17023), which, in addition to the territories comprising the Mata Limón and Tivives mangroves, includes the remaining tract of tropical dry forest located on the Hoja Cartográfica Barranca, as well as other areas that may qualify as State Natural Heritage. We reiterate what has been stated thus far: the removal from public-domain status under ley 7915 does not preclude the protection and application of the regimes governing these other areas.
Furthermore, this proceeding does not concern the location, identification, or classification of these areas, matters that fall outside its scope. Nevertheless, in general terms and as requested by the State in its third-party proceeding, claims 1, 2, and 4 thereof must be granted because they are consistent with the reasoning set forth above.
With respect to the lack of standing to sue (falta de legitimación activa) asserted against the defendants, given that the relief sought in these proceedings is a declaration of the applicable legal regime and that the plaintiffs’ statements place them as persons within the geographic area in which the declaration contained in this judgment has effect, it is determined that, pursuant to art. 9.b in relation to numeral 10.4 of the CPCA, the plaintiffs have standing to sue; accordingly, this defense must be rejected. With respect to the third-party claimant’s alleged lack of standing to sue and be sued (falta de legitimación activa y pasiva), that defense must be rejected because, pursuant to Constitutional Article 50, the Estado, in its capacity as the governing authority on environmental matters and as a relevant actor under ley 6043, has sufficient standing to file the third-party claim (tercería), while, although the claims are not directed against the plaintiffs in their personal capacities, the fact remains that the relief requested in the third-party claim directly affects the relief sought in the complaint, thereby requiring them to assume a respondent position—standing to be sued—in order to properly defend their interests, as occurred in this litigation.
With respect to the lack of legal grounds (falta de derecho), for the reasons given in the preceding whereas clause (considerando), that defense must be partially upheld both against the complaint and against the third-party claim asserting independent claims (tercería con pretensiones propias).
Pursuant to numeral 193 of the Código Procesal Contencioso Administrativo, litigation costs and attorneys’ fees are a burden imposed upon the losing party by reason of having lost. Waiver of such an award is permissible only when, in the Court’s judgment, there was sufficient reason to litigate or when the judgment is rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Collegiate Body does find grounds to apply the exceptions established by the applicable provisions, because there is mutual defeat and partial acceptance of the claims in this particular matter. Accordingly, this judgment is issued without a specific award of costs.
POR TANTO
The defense of lack of legal grounds against the complaint and the third-party claim asserting independent claims is partially upheld; the defense of lack of standing to sue asserted against the plaintiffs is rejected, as are the defenses of lack of standing to sue and be sued asserted against the third-party claimant asserting independent claims. Accordingly, the complaint filed by the ASOCIACIÓN DE DESARROLLO INTEGRAL DE MATA LIMÓN ESPARZA PUNTARENAS (ADI MATA LIMÓN) and the ASOCIACIÓN DE VECINOS UNIDOS DEL SECTOR TURISMO Y COMERCIO DE CALDERA Y MATA LIMÓN against the MUNICIPALIDAD DE PUNTARENAS is declared PARTIALLY WELL-FOUNDED. The first claim is rejected in view of the manner in which this matter is decided. The second claim is rejected with respect to the reserved port zone, in which ley 6043 does apply, but is upheld with respect to the coastal zone administered by the Municipalidad de Esparza and the residual area of Mata Limón that is not subject to that port zone or to the environmental regime in which art. 79, as amended, of Ley 6043 applies.
Accordingly, the fourth claim is upheld, and the respondent Municipality is obligated to plan that area through an Urban Regulatory Plan (Plan Regulador Urbano), always subject to the limits of its authority and to the procedures currently applicable to any Urban Regulatory Plan. The third claim is upheld, as leyes 9242 and 9408 are not applicable in any of the areas under discussion. Likewise, the THIRD-PARTY CLAIM ASSERTING INDEPENDENT CLAIMS filed by the ESTADO is PARTIALLY UPHELD. The first and second claims are upheld in their entirety, declaring that the lands of the Zona Protectora Tivives are governed by the special provisions of artículos 73 de la Ley 6043, 32 y 37 de la Ley 7554 and are excluded from municipal planning. Likewise, the lands of the Patrimonio Natural del Estado, such as mangrove areas—even those stripped of their original characteristics—forests, and other forest lands or lands suited for forestry, as listed in artículo 13 de la Ley Forestal, are administered by the Sistema Nacional de Áreas de Conservación pursuant to numerales 13 de la Ley Forestal, 22 y 28 de la Ley de Biodiversidad and are therefore excluded from municipal planning.
The third claim is rejected in its entirety, and the fourth claim is upheld for the same reasons governing the disposition of the claims in the complaint. The foregoing is pursuant to the ruling in the seventh whereas clause of this judgment, and all relief not expressly granted is rejected. This judgment is issued without a specific award of costs. SECCIÓN PRIMERA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las once horas con siete minutos del treinta y uno de Enero del dos mil veinticuatro.- Proceso de conocimiento declarado de puro derecho interpuesto por la ASOCIACIÓN DE DESARROLLO INTEGRAL DE MATA LIMÓN ESPARZA PUNTARENAS (ADI MATA LIMÓN), cédula jurídica 3-002-061926, representada por su apoderado generalísimo Douglas Antonio Arce Solís, mayor, soltero, empresario, vecino de Caldera, Esparza de Puntarenas, portador de la cédula de identidad número 1-0707-0029; y la ASOCIACIÓN DE VECINOS UNIDOS DEL SECTOR TURISMO Y COMERCIO DE CALDERA Y MATA LIMÓN, cédula jurídica 3-002-682808, representada por su apoderado generalísimo Jairo Herrera Jara, mayor, soltero, empresario, vecino de Caldera de Esparza, portador de la cédula de identidad 6-0277-0996, en contra de la MUNICIPALIDAD DE PUNTARENAS, representada por su apoderado especial judicial Asdrúbal Calvo Chaves.
Participa como tercero con pretensiones propias el ESTADO, representado por la Procuradora Susana Fallas Cubero, carnet de colegiada N° 9669. De igual manera, se tiene al INSTITUTO COSTARRICENSE DE TURISMO (ICT), representado por su apoderado especial judicial Jimy Álvarez García, carnet de colegiado N° 13134 en calidad de coadyuvante pasivo. Participa como patrocinio letrado de las partes actoras, el Lic. Juan Arturo Abdelnour Granados, carnet de colegiado N° 10226.
RESULTANDO
I.En fecha 13 de junio del año 2018, rectificado en escrito de fecha 27 de junio de 2018, las actoras interponen el presente proceso de conocimiento, para que en sentencia se declare: "1) Que se declare con lugar esta acción en todos sus extremos. 2) Que conforme el artículo 79 de la ley 6043 – Ley sobre Zona Marítimo Terrestre de 2 de marzo de 1977, esta ley no tiene aplicación en la zona de Mata de Limón, sino la Ley 5582 de 2 de marzo de 1977 y su reforma, Ley 7915 de 21 de setiembre de 1999, publicada en la Gaceta 193 del 5 de octubre de 1999. 3) Que siendo las leyes 9242 y 9408 de 6 de mayo del 2014 y 11 de noviembre de 2016, respectivamente, subordinadas de la ley 6043 – Ley sobre la Zona Marítimo Terrestre, que por imperio legal (art. 79) no tiene aplicación en la Zona de Mata de Limón; consecuentemente éstas no tienen aplicación en la zona de Mata de Limón. 4) Que conforme lo dispuesto en la ley 7915 de 21 de setiembre de 1999, publicada en la Gaceta N° 193 de 05 de octubre de 1999, la Municipalidad de Esparza tiene la obligación de dictar un Plan Regulador Urbano en el área desafectada, la cual había sido congelada por la Ley Caldera 5582 de 21 de setiembre de 1974, publicada en la Gaceta N° 193 de 05 de octubre de 1999; por lo que no procede dictar un Plan Costero sobre ese mismo territorio. 5) [DESISTIDA]".
En la audiencia preliminar aclaró la parte que, cuando hace referencia a “zona de Mata Limón” se refiere a toda la zona marítimo terrestre del cantón de Esparza. (Ver imagen 42 así como audio y video en SIGAO del expediente judicial digital y minuta a imágenes 246-249 del expediente judicial digital).
II.Otorgado el traslado de ley, la representación de la Municipalidad de Esparza y contesta negativamente la demanda en escrito de fecha 14 de agosto de 2018 e interpone la defensa de falta de integración de la litis, que fue resuelta interlocutoriamente. (Ver imágenes 50- del expediente judicial digital).
III.La parte realizó réplica de la contestación municipal en escrito de fecha 12 de setiembre de 2018, sin ofrecer prueba adicional. (Imágenes 81-83 del expediente judicial digital).
IV.La primera parte de la audiencia preliminar fue realizada el día 16 de enero de 2019, en la cual se emplaza al Estado y al ICT respecto de la acción presentada. (Audio en SIGAO así como minuta a imágenes 96-98 del expediente judicial digital).
V.El Estado se apersona como tercero con pretensiones propias en escrito de fecha 13 de marzo de 2019, posteriormente, en escrito de fecha 26 de setiembre de 2019, ajusta y amplía pretensiones para que en sentencia se declare: “1. Que los terrenos de la Zona Protectora Tivives se rigen por las disposiciones especiales de los artículos 73 de la Ley 6043, 32 y 37 de la Ley 7554, quedando excluida la planificación municipal. 2. Que los terrenos del Patrimonio Natural del Estado, tales como las zonas de manglar –aún desprovistas de sus condiciones originarias−, los bosques y otros terrenos forestales o con esa aptitud, enlistados por el artículo 13 de la Ley Forestal, los administra el Sistema Nacional de Áreas de Conservación conforme a los numerales 13 de la Ley Forestal, 22 y 28 de la Ley de Biodiversidad, y por ende están excluidos de la planificación municipal. 3. Que los terrenos ubicados geográficamente dentro de la zona marítimo terrestre que formaron parte de la zona de reserva portuaria según las Leyes 5582 y 6309, y que posteriormente fueron excluidos mediante la Ley 7915, se rigen por la Ley 6043 y su Reglamento.
Por ende, su planificación debe ser conforme a un plan regulador costero. 4. Que los terrenos exceptuados de la “zona portuaria reservada” por la Ley 7915, que no formen parte de la zona marítimo terrestre y no estén sometidos a otro régimen especial (como el de la Zona Protectora Tivives u otros componentes del Patrimonio Natural del Estado), son los que podrán contemplarse dentro de un plan regulador urbano que adopte la Municipalidad de Esparza con base en la Ley de Planificación Urbana”. VI.El ICT se apersona como coadyuvante pasivo sin aportar elementos de convicción ni agravios en escrito de fecha 10 de junio de 2019. (Imágenes 119-120 del expediente judicial digital).
VII.La representación accionante contesta la tercería en escrito de fecha 23 de agosto de 2019, 22 de noviembre de 2019 y 15 de setiembre de 2020, alegándose falta de derecho y falta de legitimación activa y pasiva. (Imágenes 135-137, 163-167 y 183-188 del expediente judicial digital).
VIII.El Estado replicó a la oposición de la tercería en escrito de fecha 19 de octubre de 2020. (Imágenes 195-198 del expediente judicial digital).
IX.La continuación de la audiencia preliminar establecida en el ordinal 90 del Código Procesal Contencioso Administrativo, fue celebrada en fecha 12 de marzo de 2021, con presencia de todas las partes. Se definieron los hechos controvertidos, se ajustaron las pretensiones y se admitió prueba de tipo documental, procediéndose a declarar el asunto de puro derecho y se emplazó para rendir conclusiones por escrito. X.El ICT brindó conclusiones en escrito de fecha 12 de marzo de 2021, mientras que las accionantes, la Municipalidad y el Estado en escrito de fecha 17 de marzo de 2021. (Imágenes 245 del expediente judicial digital).
XI.En fecha 23 de noviembre de 2022, reiterado el 15 de febrero de 2023, la demandada presenta prueba adicional, emplazándose a las partes por resolución interlocutoria de las 15:16 horas del 11 de diciembre de 2023. Superado el emplazamiento, solamente el Estado contestó en escrito de fecha 13 de diciembre de 2023. (Imágenes 251-263 del expediente judicial digital).
XII.El presente asunto se encontraba, originalmente turnado desde el 9 de abril de 2021 al juzgador Gustavo Irías Obando (imagen 250). No obstante, en ocasión del rediseño del Tribunal, el presente asunto fue returnado al juez ponente Mejías Rodríguez en fecha 15 de agosto de 2023, esperando a turno conforme el acuerdo 11.VI.2023 de la Comisión de lo Contencioso Administrativo de la sesión del 27 de julio de 2023. Una vez realizadas las gestiones interlocutorias necesarias descritas en ellos resultandos anteriores, el asunto fue pasado al módulo de pase a fallo en fecha 21 de diciembre de 2023, para ser conocido en el turno de enero 2024, bajo el criterio de antigüedad. Conforme los arts. 100, 101, 104 a 111 y 119.1 del CPCA (Ley N° 8508), art. 60 incs. 1, 4 y 5, art. 79 incisos 4, 5, 6 y arts. 81, 82 del Reglamento Autónomo de Organización y Servicio de la Jurisdicción Contencioso Administrativa y Civil de Hacienda (Circular 001-08), arts 7, 8 incisos b, c y d, arts. 12 incisos a, b, c y d, arts. 13, 14, 15, 16 y 17 de la Ley General de Control Interno (N° 8292), así como el acuerdo 3° del acta N° 7 de la Sesión ordinaria del 1° de setiembre de 2023 de la Comisión de los Contencioso Administrativo y Civil de Hacienda, se declara el asunto como muy complejo, en ocasión del objeto en discusión, así como la calidad y cantidad de agravios de las partes.
Se dicta esta sentencia dentro del plazo de ley, por unanimidad y previa deliberación de los integrantes del Tribunal, sin que se observen causales capaces de invalidar lo actuado. Redacta el juez Mejías Rodríguez, con el voto favorables de las Juezas Bolaños Salazar y Gómez Chacón.
CONSIDERANDO
Tal y como se señaló en el resultando XI de esta sentencia, la Municipalidad de Esparza presenta escrito en la cual, básicamente, pone en conocimiento de la reforma habida al numeral 79 de la Ley 6043. Ahora bien, dicha situación, técnicamente no es prueba nueva, pero sí es un hecho que tiene impacto en las pretensiones tanto de la demanda, como de la tercería con pretensiones propias, por lo que será, de esa manera abordado por el Tribunal infra.
Si bien es cierto las partes presentaron sendos elementos documentales, lo cierto es que este asunto es, exclusivamente, un tema eminentemente jurídico. Así, si bien las partes aportan copias de sentencias, dictámenes de la Procuraduría General del Estado, expedientes legislativos y actas del Concejo Municipal de Esparza, lo cierto es que ninguno constituye elementos de convicción directos, en términos de acreditación de un hecho, sino que son, en el fondo, parte de los agravios que las partes plantean para sustentar el eje de discusión de la temática jurídica a definir y que está planteada en las pretensiones, tanto de la acción, como de la tercería con pretensiones propias y que están todas planteadas, en términos generales, de manera declarativa en tanto buscan que se defina, judicialmente, los parámetros jurídicos aplicables a la franja de espacio territorial que las partes denominan Mata Limón de Esparza, Puntarenas.
A ello, si bien, la Procuraduría, en el marco de su Ley Orgánica posee la capacidad de emitir dictámenes que son vinculantes para los entes que se someten a su criterio, lo cierto es que ello no alcanza a tener el mismo efecto hacia la jurisdicción contenciosa administrativa, de ahí que, en el fondo, sean tratados dichos documentos aportados como parte de agravios para sustentar una u otra postura de quienes participan de este proceso de conocimiento. Nótese que ninguno de los referidos actos tiene pretensiones concretas de revisión o fiscalización contenciosa, por lo que se les da dicho tratamiento, descartando así la utilidad, por ejemplo, de la prueba ofrecida por las accionantes del acta del Concejo Municipal de Esparza 51-2017, el cual no fue impugnado en esta sede. Ahora bien, de la prueba obrante en autos, atinente a la aportada por el Municipio accionado, así como en la tercería con pretensiones propias estatal, encontramos, a efectos de la delimitación espacio – territorial en discusión, unas láminas ortográficas (imágenes 54-56), así como el informe SINAC-ACOPAC-TOPO-011-2019 del manglar en dicha zona (imágenes 220-224), ambos insumos que sí resultan útiles y pertinentes para la resolución de este asunto, aunque advertimos, de forma expresa, que la delimitación espacio territorial no es, en sí misma, un objeto de litigio, sino la aplicación de un marco jurídico determinado en dicho espacio, por lo que se tienen como elementos de convicción para acreditar como HECHOS PROBADOS: 1) Que en el cantón de Esparza, distrito de Esparza, se encuentra el Manglar de Mata Limón, así como la Zona Protectora Tivives, parte del Área de Conservación Pacífico Central, administrada por el MINAE (Imágenes 220-224). 2) Que en el cantón de Esparza, distrito de Esparza, se encuentra la Zona Portuario de Caldera Según las leyes 5582, 6309 y 7915. (Imágenes 54-56 y 220-224 del expediente judicial digital).
Ninguno para este asunto.
En la demanda, réplica y conclusiones, las partes actoras, después de hacer lo que consideran un recuento histórico respecto del nacimiento del proyecto Puerto Caldera y la regulación que ha tenido en el tiempo, señalan de interés que, bajo la ley 4558, se emite el 6 de agosto de 1970 la declaratoria de área turística de Esparza, la cual es ubicada desde la desembocadura del río Jesús María con la Playa Tivives y el Peñón, las playas de Mata Limón y Caldera, hasta la desembocadura del río Barranca en Playas de Doña Ana (límite con el cantón de Puntarenas). Esta zona fue ajustada por la ley 4668, que reformó la ley 4558 en su transitorio VI, reconociéndose como un área “parcelada y urbanizada por el Ministerio de Agricultura y Ganadería y por el Instituto de Tierras y Colonización” y estableciendo la forma de medición de la zona de 50 metros a que refiere el art. 6 midiéndose desde la playa frente al mar y no desde el estero, por lo que, en el caso de Mata Limón, la norma dispuso que la Zona Marítimo Terrestre quedó fuera del dominio de la Municipalidad de Esparza.
Para el año 1974, se crea el contrato empréstito internacional bajo la Ley 5582 (Ley Caldera) que es la que le da origen al Puerto de Caldera con una envergadura de 3457 hectáreas, congelando terrenos privados en tierra firme, para someterlos a una “Zona Portuaria Reservada” (ZPR), con restricciones urbanísticas a los propietarios, poseedores y arrendatarios y un congelamiento de la libre disposición de bienes. Para el año 1979, dicha área es ampliada por ley 6309 y regulada por el decreto 11494 de 19 de mayo de 1980, donde el órgano rector competencial no era el municipio, sino el Ministerio de Obras Públicas y Transportes. En otro orden de ideas, en el año 1977, se crea la Ley de la Zona Marítimo Terrestre, en cuyo art. 79 excluye de la aplicación de dicha ley a la zona de Mata Limón, señalando que, para ese espacio, lo que aplica es la ley 5582, aspecto que reconoció la PGR en su dictamen C-119-1990.
Para el año 1991, se presentó un recurso de amparo por mantener la zona congelada sin realizar expropiaciones, dando lugar a la sentencia 2765-1996 el cual condena al Estado por incumplir la Ley Caldera. Posteriormente, para el año 1999, se promulga la ley 7915, la cual reforma la ley 5582 y reduce el tamaño de la Zona Portuaria Reservada, levantando así el gravamen existente, y liberando a los propietarios de las limitaciones, además, estableció un mandato para la zona desafectada para el Municipio de Esparza, correspondiente a la elaboración de un Plan Regulador que incluyese las zonas circunvecinas de la ZPR, así como la zona desafectada con la referida ley, ordenando que se siguiese con lo que dispone la Ley de Planificación Urbana 4240. Afirma que, pese a dicha orden, la Municipalidad accionada se resiste a la realización del Plan Regulador, pretendiendo aplicar en dicho espacio, la ley 6043 y sus normas complementarias Leyes N° 9242 y 9408.
Apunta a que, la liberación de espacios por la ley 5582 provoca la retrocesión y recuperación de las potestades originarias de los propietarios, tal y como lo señala el voto 1584-2014 de la Sala Constitucional. Para el año 2017, por medio del acuerdo 51-2017 de la Sesión Ordinaria del 17 de abril de 2017, artículo IV inciso 2, el Concejo Municipal de Esparza admite y aprueba los requisitos para usos de suelo en Estado Precario al amparo de la ley 9408 y 9248, pretendiendo el municipio accionado que sea aplicado a la zona de Mata Limón. De igual manera, afirma que la posición municipal sustentado en criterios de la PGR, resultan en una aplicación sobre premisas falsas del órgano del Estado, siendo tales contrarios a la ley. En la contestación y conclusiones de la Municipalidad, señalan que la PGR en dictámenes C-323-2004, C-095-2012 y C-259-2017 explican las razones y motivos por los cuales sí aplica la ley 6043 a la zona de Mata Limón, especificando que, el área desafectada por la ley 7915, no perdió su demanialidad, sino que pasa a la aplicación marítimo terrestre.
Además, la referida “zona de Mata Limón” que refiere a la cabecera del distrito de Caldera, pero que incluye una zona extensa, por lo que incluye patrimonio natural del Estado (manglar, estero, playa, bosque salado y otros e invoca el dictamen C-102-96 de la PGR), Reserva de Tivives, zona portuaria, zona marítimos terrestre, vías, y, lo que no esté afecto a ninguna de las referidas zonas, sería técnicamente propiedad privada, sobre la cual sí es posible un Plan Regulador Urbano. Sobre este tema, señala que sí existe un proyecto de Plan Regulador Urbano, el cual cuenta con aprobación de SETENA (2374-2016-SETENA), siendo que se encuentra en trámite el ajuste y rectificación de los reglamentos urbanos y de la cartografía conexa para posteriormente hacer el trámite de audiencia pública y finalizar la gestión de aprobación e implementación del plan conforme el art. 17 de la ley 4140. Por su parte, para la zona marítimo terrestre, se está tramitando un Plan Regulador Costero, el cual está a la espera de la definición del Patrimonio Natural del Estado por parte del MINAE. La posición del ICT como coadyuvante pasivo en conclusiones es que, al desistirse de la pretensión quinta, se desvinculó al ICT del fondo del asunto.
En su tercería con pretensiones propias el Estado señala en su escrito inicial y réplica que, las accionantes no demuestran cuál es la afectación a los derechos subjetivos, intereses legítimos o situaciones jurídicas lesionadas para tener legitimación activa. Por otra parte, señala que la ley 4558 fue suspendida por la ley 5602 y derogada por la ley 6043. Explica que, para el caso de Mata Limón, si bien existe el contrato de empréstito amparado en la ley 5582, sobre dicha zona existe la zona protectora Tivives, así como el manglar de Mata de Limón (decreto 17023) y otros fuera de esa zona, que están fuera de la competencia municipal, tal y como lo afirma en sus criterios C-323-2004, C-346-2015 y C-259-2017, ya que ello se reserva al MINAE, tal y como lo ha señalado la Sala Constitucional en sus votos 1886-1995, 8713-2008, 16975-2008, 21258-2010, 12973-2013 y 19776-2014. Ahora bien, circunscribiéndose específicamente a la zona desafectada por la ley 7915, considera que las actoras yerran al considerar que se desafectó el uso demanial, ya que ello sería una desafectación implícita, lo cual no ha sido reconocido por la jurisprudencia constitucional (votos 10466-2000, 3821-2002, 3480-2003, 8928-2004, 454-2006, 11346-2006, 2063-2007 y 2408-2007, entre otros).
Consecuentemente, ante la desafectación, se tenía que analizar si, sobre la zona liberada, los terrenos no quedan afectos a otros regímenes especiales, como los de Patrimonio Natural del Estado o Zona Marítimo Terrestre, entendiéndose que sólo sobre los espacios que no tuviesen otro régimen particular, aplicaría la una desafectación que le permitiese a la Municipalidad de Esparza a emitir un Plan Regulador Urbano en los términos de la Ley de Planificación Urbana. Detalla en conclusiones, que el fondo del asunto se circunscribe a una interpretación de la ley 7915 y del artículo 79 de la ley 6043, en lo que respecta a la zona de Mata Limón, reitera los agravios previamente expuestos y señala, en síntesis, que no queda clara la utilidad de la demanda, ya que se pretende un plan regulador urbano en lugar de uno costero, sin que se acredite cuál sería la diferencia de aplicar uno u otro régimen.
La parte actora se opone en la contestación y conclusiones a la tercería señalando que son vecinos del área desafectada, por lo que poseen legitimación ya que sufren los efectos de no contar con una zonificación municipal, teniendo amparo conforme el art. 14 de la ley 3859 y art. 11 del reglamento a la misma. Por otra parte, explica que la posición del Estado lo que pretende es desaplicar las disposiciones de la ley 5582 y pretender que, en cambio, se aplique disposiciones de la ley 6043, yendo en contra incluso de su propia opinión en el criterio C-119-1990. Considera que la postura Estatal consiste en fundamentarse en sus propios criterios para validar sus argumentaciones, lo cual resulta improcedente. Por su parte, arguye que la zona protectora de Tivives contemplada en el decreto 17023 sin realizar estudios de ningún tipo, y existiendo una afectación previa a la ley 5582, tal y como lo señala el voto 2765-1996 de la Sala Constitucional, siendo el decreto de Tivives una desviación de poder y una forma de corrupción, pretendiendo darle un efecto retroactivo a la ley orgánica del ambiente.
En todo caso, señala que, en la zona desafectada por la ley 7915 no hay Patrimonio Natural del Estado, siendo que, los bosques podrían referirse solamente a los expropiados y que estén en terrenos estatales. Por otra parte, en el decreto 42404 del 6 de abril de 2020 se rectificaron los linderos de Tivives, reconociendo que se irrespetó la ley 5582.
De previo al análisis de fondo de este asunto, es necesario realizar dos precisiones respecto del objeto en litigio, dadas las manifestaciones de las partes, principalmente de las partes accionantes a lo largo de los autos. Lo primero a señalar, es que no se están impugnando acuerdos municipales, aunque en la acción las demandantes hacen referencia a un acuerdo del Concejo Municipal de Esparza, el mismo no está reflejado en ninguna de las pretensiones. Lo mismo ocurre con los criterios de la Procuraduría, por lo que hablar de la validez de dichos actos, escapa de este litigio. Por otra parte, si bien, sobre todo en las conclusiones de las accionantes, se hace referencia a la legalidad del decreto 17023 y sus reformas (decreto 42404), lo cierto es que dichas actuaciones tampoco fueron impugnadas, directamente, en este asunto. Así las cosas, lo que encontramos en este asunto son pretensiones eminentemente declarativas, marcadas tanto por los pedimentos incluidos en la demanda, como en la tercería con pretensiones propias.
Otro aspecto de vital relevancia para el presente asunto y que repercute en las pretensiones de la demanda, así como el objeto de litigio como tal, es que se busca pronunciamiento respecto de la “Zona de Mata Limón”, no obstante, no se hace referencia en ninguna parte de la demanda a qué se entiende territorialmente por ese espacio. Nótese que, no es sino hasta la ley 9235 de fecha 6 de mayo de 2014, que se crea el distrito N° 6° del Cantón de Esparza, el cual denomina como Caldera y que, conforme el artículo N° 2 de esa ley, se define espacialmente de la siguiente manera “Según las hojas cartográficas a escala 1:50000, editadas por el Instituto Geográfico Nacional y denominadas Juntas, San Lorenzo y Chapernal, este distrito limita al norte con el cantón de Puntarenas, distritos de Espíritu Santo y San Juan Grande, partiendo de la boca del río Barranca, aguas arriba hasta ingresar por la Quebrada Honda hasta el punto de las coordenadas 215450N-462100E; luego se dirige hacia el este por la mayor depresión del terreno hasta el punto de las coordenadas 215375N-462550E sobre el camino que conduce de Juanilama a Caldera, punto desde el cual se desciende hacia el sureste hasta la naciente de una quebrada intermitente, cuyas aguas llegan a río Paires y luego hasta el río Jesús María; al este, desde la unión del río Paires y río Jesús María hasta la desembocadura en el océano Pacífico; al sur limita con la desembocadura del río Jesús María y, al oeste, el límite va desde la desembocadura del río Jesús María, continuando por la costa rumbo norte hasta la boca del río Barranca”, mientras que el artículo 3° afirma que los caseríos que dicho distrito contempla son “Mata de Limón, que será la cabecera, Hacienda Salinas, Cambalache, Tivives, Caldera, Quebrada Honda, San Antonio, Cabezas, Finca Cortijo, Hacienda La Moncha, Hacienda Playa Linda, Cuesta Jocote, Finca Brazo Seco, Cascabel, Corralillo, Figueroa, Jesús María (Estación), Hacienda Mata de Guinea, Silencio, Villanueva, Guardianes de la Piedra y Alto de las Mesas”, por lo que, jurídicamente hablando, todo indica que el espacio en litigio, se refiere exclusivamente a la cabecera del distrito.
No obstante, a lo largo del proceso y en las diferentes gestiones planteadas en la demanda, así como de las contestaciones, tercería y conclusiones, el marco espacial no es, exclusivamente, la cabecera de distrito, sino que refiere a la zona espacial contemplada, originalmente, en la ley 5582, que disponía en su artículo 2°: “A partir de la intersección del eje horizontal N° 213 y el eje vertical N° 457 se sigue sobre el eje Nº 457 hasta interceptar el eje horizontal Nº 214. A partir de ese punto se sigue sobre el eje N° 214 hasta interceptar el eje vertical N° 461. A partir de esa intersección se sigue sobre el eje Nº 461 hasta interceptar el eje horizontal Nº 207. A partir de esa intersección se sigue sobre el eje 207 hasta llegar a un punto ubicado a una distancia de 200 metros de la costa. Luego, se sigue sobre una línea que bordea a la costa a 200 metros de distancia hasta interceptar el eje horizontal No.209.
A partir de ese punto se sigue sobre el eje N° 209 hasta interceptar la costa (Punta Corralillo). El Instituto Geográfico Nacional interpretará los límites descritos de acuerdo con el avance cartográfico del mapa básico del país. Dicho Instituto deberá también publicar un mapa de la Zona Portuaria Reservada...”, y que fue ampliada por el art. 8 de la ley 6309 para que incluyera “A partir de la intersección del eje horizontal Nº 214 con la costa, se sigue sobre el eje horizontal Nº 214 con rumbo Este hasta interceptar el eje vertical Nº 461. A partir de este punto se sigue sobre el eje vertical número 461 hacia el Sur hasta interceptar el eje horizontal Nº 211. A partir de esta intercepción se sigue sobre el eje horizontal Nº 211 con rumbo Oeste hasta interceptar el río Jesús María, a partir de este punto, se sigue sobre la línea centro del río Jesús María hasta interceptar el eje vertical Nº 461.
A partir de esa intersección se sigue sobre el eje Nº 461 hacia el Sur hasta interceptar el eje horizontal Nº 207. A partir de esa intersección se sigue sobre el eje Nº 207 hacia el Oeste hasta llegar a un punto ubicado a una distancia de 200 metros de la costa. Luego se sigue sobre una línea que bordea a la costa a 200 metros de distancia hasta interceptar el eje horizontal número 209. A partir de ese punto se sigue sobre el eje Nº 209 hasta interceptar la costa" y que están graficadas a imágenes 222 y 223 del expediente judicial digital, siendo con esta reforma, lo que este Tribunal denomina como zona originalmente afectada y que recibió el nombre técnico de “zona portuaria reservada” (ZPR). Es sobre esta zona que se encontraba, al momento de la afectación, dominio público y privado, que fue sometido a las disposiciones de la señalada ley 5582, que fundamentó compras, expropiaciones, construcciones de carreteras, vía férrea, entre otros, para la construcción del Proyecto Puerto Caldera.
Sobre los terrenos que no hubiesen sido parte del demanio público para ese momento, se sometió a un régimen especial de control urbanístico, disponiendo el art. 3° de la ley 5582 que “Los propietarios, poseedores o arrendatarios de los terrenos comprendidos en la zona reservada se abstendrán de realizar trabajos y obras que hagan más gravosa la adquisición de los bienes que se destinarán al complejo portuario industrial de Caldera”, mientras que los transitorios II y III señalaban “TRANSITORIO II.- En el caso que determina el artículo 4°, los propietarios y arrendatarios no serán desalojados de sus terrenos hasta tanto éstos no vayan a ser ocupados con las instalaciones o facilidades portuarias, a juicio del Ministerio de Obras Públicas y Transportes. TRANSITORIO III.- Los propietarios y arrendatarios deberán realizar el mantenimiento de las construcciones existentes, hasta tanto éstas sean expropiadas por el Ministerio de Obras Públicas y Transportes”.
Concomitantemente, para el año 1986, se emite el decreto 17023 el cual crea la Zona Protectora de Tivives (ZPT), la cual definía en su artículo 1° el área de aproximadamente 2.368,75 hectáreas para incluir los manglares de Mata Limón y Tivives, así como el reducto de bosque tropical seco existente. Posteriormente en el año 1996, por el art. 71 de la ley 7575 se modificó el área, mas la Sala Constitucional anuló dicha norma por voto 7294-1998. Finalmente, para el año 2020, la zona fue rectificada por decreto 42404, eliminando de dicha Zona Protectora Tivives los derroteros de los inmuebles con el Sistema CRTM05 X, y CRTM05 Y, con base en el plano catastrado 6-1823326-2015 y 6-1824697-2015, tal y como se detalla en el informe SINAC-ACOPAC-TOPO-011-2019 visible a imágenes 220 y 221 del expediente judicial digital. Ahora bien, como un segundo eje de discusión, encontramos que, sobre ese mismo espacio, posteriormente, en el año 1999, se da una modificación o mutación del régimen jurídico, que es introducido por la ley 7915, el cual cambia el art. 2° de la ley 5582, reduciendo la ZPR para incluir solamente el siguiente espacio: “Partiendo de la intersección del eje paralelo 212.700 con la línea de bajamares inferiores, se continúa sobre este eje paralelo en sentido Este, hasta interceptar el lindero de margen izquierdo del derecho de vía de la Ruta Nacional Nº 23 en sentido El Roble de Puntarenas a puerto Caldera.
Se continúa sobre este lindero de margen izquierdo en sentido sur-este, hasta la intersección de esta línea con el punto definido por la intersección del eje meridiano 458.200 y el eje paralelo 210.860. Se continúa sobre este eje meridiano en sentido Sur, hasta interceptar el eje paralelo 210.000. Se sigue sobre este eje paralelo, en sentido oeste, hasta interceptar la línea de bajamares inferiores. Se continúa sobre esta línea hasta su intersección con el paralelo 212.700. En este límite, se exceptúa la sección de línea de bajamares inferiores que ingresa al estero de Mata de Limón y sale de ahí. Asimismo, dentro de la zona portuaria reservada se mantienen los terrenos ubicados en el cerro de Mata de Limón, ubicado al sur del poblado del mismo nombre, que a esta fecha están en posesión o propiedad del Ministerio de Obras Públicas y Transportes, el Instituto Costarricense de Electricidad y el Instituto Costarricense de Puertos del Pacífico, ya que, por su localización elevada, son necesarios para los servicios de ayuda a la navegación, las telecomunicaciones y el agua potable para el complejo portuario de Caldera y las poblaciones circundantes.
En esta zona portuaria reservada, el Ministerio de Obras Públicas y Transportes está autorizado para ejecutar las obras de infraestructura necesarias para ampliar dicho Puerto, incluidas las obras costeras que se requieran para conservar, mantener o proteger las instalaciones y facilidades del puerto de Caldera”, la cual aparece graficada en las imágenes 55, 56 y 224. De igual manera, de forma novedosa, aclara que “Los terrenos incluidos en la zona portuaria reservada, creada por las leyes Nº 5582 y Nº 6309 se regirán por la Ley sobre la Zona Marítimo-Terrestre Nº 6043, del 2 de marzo de 1977”, mientras que, sobre la zona que previamente estaba catalogada como ZPR, así como los terrenos circundantes a dichos espacios, se crea la obligación a la Municipalidad de Esparza de elaborar un plan regulador y de ordenamiento urbano, siguiendo la Ley 4240. Finalmente, como tercer eje, encontramos que, en el año 2022, se realiza una modificación al art. 79 de la Ley 6043, disponiendo expresamente: “Las disposiciones de esta ley no se aplicarán a las áreas de las zonas litorales del distrito de Caldera administradas por la Municipalidad de Esparza.
Para impulsar e incentivar el desarrollo del puerto de Caldera y las zonas a su alrededor, se aplicará en dichas áreas el ordenamiento territorial por medio de un plan regulador urbano, de conformidad con lo establecido en la Ley 4240, Ley de Planificación Urbana, de 15 de noviembre de 1968. Se exceptúan de esta reforma las zonas que se encuentran bajo regímenes especiales: la Zona Portuaria Reservada Ley 5582 y su reforma por la Ley 7915, la Zona Protectora Tivives según decreto N.° 17023, los terrenos Patrimonio Natural del Estado definidos según la Ley Forestal 7575, los manglares, bosques y terrenos forestales, y la zona pública correspondiente a los primeros cincuenta metros de la playa a partir de la pleamar ordinaria. Las construcciones, las instalaciones y los predios situados en las zonas litorales del distrito de Caldera, administradas por la Municipalidad de Esparza, deben considerar el desarrollo comunal, turístico, urbanístico, habitacional, comercial y agropecuario, de manera sostenible con los recursos naturales”. Con este marco de referencia normativo, analicemos el fondo del asunto.
De la revisión tanto de las pretensiones de la demanda, como de la tercería con pretensiones propias, todas se encuentran, en apariencia, en contradicción; no obstante, si tomamos en consideración el problema de la delimitación espacial descrita en el considerando anterior, así como la modificación del art. 79 de la ley 6043 por la ley 10236, de la cual se le otorgó audiencia a las partes (resultando XI de esta sentencia), encontramos que todas las pretensiones son parcialmente admisibles, siempre y cuando se determine dónde es que el pedimento lleva sustento. Para desarrollar el anterior enunciado, es necesario tener en consideración dos aspectos limitantes de este pronunciamiento y que dimensionan el alcance de lo que acá se falla: por un lado, el hecho de que, ni en las pretensiones de la parte actora, ni en las pretensiones del Estado, existe prueba técnica o pretensiones para, de manera concreta, delimitar geo-espacialmente zonas o áreas de aplicación concreta de los regímenes jurídicos de regulación inmobiliaria, pública o privada que se considera en este fallo, siendo justamente ello resultado de que, a lo largo de los autos, se afirma de la “Zona de Mata Limón” como si fuese un espacio delimitado cuando, como se dijo supra, no lo es.
Así las cosas, si las partes buscasen una delimitación concreta de estos espacios, ello debería ser en un proceso aparte, el cual tenga por finalidad dicha delimitación. Aspecto de vital relevancia para el espacio de protección ambiental tanto del bosque seco como del manglar que forma parte de este litigio. En ese sentido, todas las pretensiones son analizadas por esta Cámara, en aplicación del principio pro actione como eminentes pedimentos declarativos, para que el Tribunal determine un eventual régimen jurídico sobre el espacio que se discute y que fue identificado y delimitado en el considerando anterior. Derivado de esto y como consecuencia, se desprende una limitación en cuanto a lo que se falla, puesto que la declaratoria de aplicabilidad de un régimen específico que pudiese considerarse que perjudica a un sujeto determinado en un caso concreto, forzaría a que sea objeto de otro proceso, para que se determinen las consecuencias de la aplicación de ese régimen en específico, en otras palabras, la presente sentencia, consecuencia de las pretensiones como han sido planteadas, posee un alcance declarativo y no constituye la definición o determinación en concreto respecto de un inmueble de la aplicación de uno u otro sistema inmobiliario (público o privado), así como su regulación.
Con ello, a manera de ejemplo, al decir en esta sentencia que los manglares poseen un régimen de afectación pública y tutela especial ambiental con determinadas características y, en el caso concreto, existiese algún sujeto con la tenencia de una parcela que pueda verse afectada por dicha regulación, sería en un proceso aparte que se clarifique las consecuencias concretas de la regularización de la tenencia de esos espacios. Claro lo anterior, abordamos un primer aspecto fundamental para el fondo del asunto. VII.1- SOBRE LA AFECTACIÓN MÚLTIPLE EN CASOS DE DEMANIO PÚBLICO: Sin necesidad de un desarrollo extenso de la clasificación de bienes en los términos de los numerales 261 y 262 del Código Civil, podemos sintetizar que la demanialidad proviene, groso modo, de tres fuentes: la afectación por ley, entiéndase cuando de manera expresa por norma aplicable se determina la naturaleza pública de un bien o tipo de bienes, cuando está afectos a la prestación de un servicio de utilidad general, y finalmente, los que aprovechan todos para el uso público.
Ahora bien, bajo el principio del paralelismo de formas, una vez afecto el bien al régimen público, solamente a través de una desafectación expresa puede ingresar al tráfico de comercio. Con ello, lleva razón la postura del Estado de que, siguiendo la jurisprudencia relevante en la materia, no es posible una desafectación tácita. De igual manera, la demanialidad no ha de entenderse como única o incompatible, sino que, dependiendo del régimen que se trate, puede ser que exista un destino único o múltiple y que éste, a su vez, pueda ser superpuesto o complementado con otros regímenes. Un ejemplo de ello lo da el régimen de vías públicas, el cual posee un régimen básico regidos en la Ley General de Caminos Públicos y normativa afín, que se complementa con regulación en materia de servicios de alumbrado público, aceras, alcantarillado pluvial, sanitario, distribución de agua potable, servicios telemáticos, servicio ferroviario, tránsito terrestre en general, transporte público, etc. Aún sistemas de protección tan restrictivos como el ambiental, en tema de parques nacionales, resulta compatibles con, por ejemplo, planos de manejo y explotación de tipo turístico.
En el fondo, para definir cuál régimen es el predominante, su compatibilidad, limitaciones o alcance, es necesario ponderar con qué intensidad cada uno de ellos aplica a un caso concreto, a manera de capas superpuestas de regulación inmobiliaria pública o privada. De igual manera, esta coexistencia de regímenes puede significar que una desafectación no necesariamente implique la eliminación de todas las restricciones, sino que corresponde analizar el caso concreto, para así definir la situación jurídica aplicable. Finalmente, puede ser que exista una mutación demanial, en el que un destino público, sea cambiado por otro. Con ello en mente, analicemos las pretensiones de la demanda y tercería sobre los tres grandes espacios en discusión: por un lado, la Zona Portuaria Reservada, después de la ley 7915 y con la modificación introducido por la ley 10236 a la ley 6043; por otro lado, la zona previamente afectada por la ley 6309 y desafectada por la ley 7915; y finalmente, la regulación ambiental aplicable en cualquiera de ambos espacios.
VII.2.- SOBRE LA REGULACIÓN DEL ESPACIO “ZONA PORTUARIA RESERVADA” (ZPR). DESPUÉS DE LA LEY 7915: Después de la reforma introducida en la Ley 7915, se redujo sustancialmente el espacio gravado por el régimen de ZPR desde la ley 5582, incluyendo, además, una regulación adicional respecto al destino de ese espacio. Se conserva, como uso primordial, o capa regulatoria base bajo la administración del MOPT, el destino de la zona para “para ejecutar las obras de infraestructura necesarias para ampliar dicho Puerto, incluidas las obras costeras que se requieran para conservar, mantener o proteger las instalaciones y facilidades del puerto de Caldera”. No obstante, se complementó con una segunda capa regulatoria, al señalar que, además, será aplicable la ley 6043, Ley de la Zona Marítimo Terrestre (ZMT). Es importante advertir que, la regulación de dicha ley no se circunscribe, exclusivamente, a las denominadas zona pública y zona restringida a la que refiere el art. 10 de la referida Ley, sino que, además, regulación especial sobre manglares y esteros, insulares o continentales, calificándolos de zona pública, así como regímenes de actividad industrial y afines como el contenido en el art. 18 que incluye “construcción de plantas industriales, instalaciones de pesca deportiva o instalaciones artesanales, de obras portuarias, programas de maricultura, u otros establecimientos o instalaciones similares, para cuyo funcionamiento sea indispensable su ubicación en las cercanías del mar… construcción, instalación y operación de astilleros y diques secos o flotantes”, el art. 22 incluye “establecimiento y operación de instalaciones turísticas estatales de notoria conveniencia para el país”, así como otras obras de infraestructura que sean atientes al fin público de la zona pública; las vías de acceso (caminos) en el art. 23 y por consecuencia, la Ley General de Caminos Públicos y normativa conexa o asociada que se ejemplificó supra.
Sobre este espacio, desde la perspectiva de planificación, tendría mayor intensidad y dominancia la regulación portuaria y secundariamente, la regulación marítimo terrestre. En este sentido, ante el planteamiento en la pretensión segunda de la demanda que reza “Que conforme el artículo 79 de la ley 6043 – Ley sobre Zona Marítimo Terrestre de 2 de marzo de 1977, esta ley no tiene aplicación en la zona de Mata de Limón, sino la Ley 5582 de 2 de marzo de 1977 y su reforma, Ley 7915 de 21 de setiembre de 1999, publicada en la Gaceta 193 del 5 de octubre de 1999” debe rechazarse, ello por cuanto, conforme el párrafo cuarto del art. 2 de la ley 5582, reformado por ley 7915, la denominada “zona de Mata Limón” delimitada en el considerando anterior, tiene presencia de ZPR, y en esta zona, por mandato de la misma norma, sí tiene aplicación la Ley de la Zona Marítimo Terrestre N° 6043, la cual, como se dijo, no es incompatible con la ley 5582.
Empero, tomando en consideración la pretensión tercera de la demanda que señala “Que siendo las leyes 9242 y 9408 de 6 de mayo del 2014 y 11 de noviembre de 2016, respectivamente, subordinadas de la ley 6043 – Ley sobre la Zona Marítimo Terrestre, que por imperio legal (art. 79) no tiene aplicación en la Zona de Mata de Limón; consecuentemente éstas no tienen aplicación en la zona de Mata de Limón”, la misma se tendría que acoger, respecto del caso de la ZPR, ello dado que, el art. 3° de la ley 9242 comienza afirmando “Las municipalidades con jurisdicción en la zona restringida de la zona marítimo terrestre, que cuenten con un plan regulador costero vigente, podrán conservar las construcciones existentes, siempre que se ajusten al plan y a la normativa ambiental aplicable…” (resaltado es nuestro), por lo que, siendo que la ZPR tiene una regulación base en favor del MOPT, no es posible afirmar que sea una “jurisdicción” en favor del Gobierno Local demandado, por lo que, efectivamente, en lo que refiere a la ZPR de lo que las partes llaman “zona de Mata Limón”, efectivamente, no regiría la ley 9242 o su modificación, ley N° 9408, ya que, se insiste, sobre esta área tendrá dominancia la regulación portuaria sobre la demás marítima terrestre, sin perjuicio de lo que se dirá infra, en materia ambiental.
VII.3.- SOBRE LA REGULACIÓN DEL ESPACIO DESGRAVADO POR LA LEY 7915 Y PREVIAMENTE DELIMITADO POR LA LEY 6309: Contrario a la tesitura expuesta por el Estado, el advenimiento de la ley 7915 sí constituyó una desafectación expresa y no tácita, del área originalmente sometida a ZPR en la ubicación descrita en las leyes N° 5582 y 6309, área que las partes actoras denominan “congelada” y cuyo régimen cambió a partir del año 1999 con la referida ley 7915, baste reiterar la demostración gráfica contenida en el oficio SINAC-ACOPAC-TOPO-011-19 visible a imágenes 222 a 224 para acreditarlo. Sobre esta área, expresamente desafectada, que las partes actoras denominan “zona de Mata Limón” es que, también, es posible analizar tanto las pretensiones de la demanda 2, 3, y 4 de la demanda, así como las pretensiones 3 y 4 de la tercería del Estado. A ello, tenemos que dividir dicho espacio en tres: el litoral, el ambiental y finalmente el remanente.
Aclaramos que el denominado ambiental lo abordaremos infra en el siguiente acápite. Denominados como área litoral a aquella que podemos identificar comparando el “mapa de los límites de la ZPR” visible a imágenes 223 y 224 del expediente judicial y que corresponde a las coordenadas en parte 214000, a en parte 212000 (vertical) :: en parte de 455000, 458000 (horizontal), así como el espacio en las coordenadas en 210000,207000 (vertical) :: en parte 456000, en parte 459000 (horizontal). En dichos espacios, desafectados con la ley 7915, se elimina la ZPR regulada por la ley 5582, por lo que, frente a las pretensiones de las partes, es necesario determinar cuál es el régimen aplicable, dado que, mientras que las actoras consideran que existe una desafectación total y, en consecuencia, el sometimiento al régimen de propiedad privada, el Estado considera que, ha de aplicarse la ley 6043, calificando la zona como Marítimo – Terrestre, con al diferencia de que, en uno se aplicaría un Plan Regulador Urbano y en el otro, un Plan Regulador Costero.
Al margen de la discusión planteada por el Estado de que las accionantes no llegan a desarrollar cuál sería la diferencia sustancial entre uno u otro ordenamiento, lo cierto es que, en el marco de las pretensiones planteadas por las actoras, y sobre las cuales el Tribunal debe verter pronunciamiento, así como de las pretensiones planteadas por el propio Estado, se hace necesario identificar el régimen aplicable. A ello, la reforma introducida por la ley 10236 es la que viene a identificar el régimen aplicable, puesto que dispone: “Las disposiciones de esta ley no se aplicarán a las áreas de las zonas litorales del distrito de Caldera administradas por la Municipalidad de Esparza. Para impulsar e incentivar el desarrollo del puerto de Caldera y las zonas a su alrededor, se aplicará en dichas áreas el ordenamiento territorial por medio de un plan regulador urbano, de conformidad con lo establecido en la Ley 4240, Ley de Planificación Urbana, de 15 de noviembre de 1968.
Se exceptúan de esta reforma las zonas que se encuentran bajo regímenes especiales: la Zona Portuaria Reservada Ley 5582 y su reforma por la Ley 7915, la Zona Protectora Tivives según decreto N.° 17023, los terrenos Patrimonio Natural del Estado definidos según la Ley Forestal 7575, los manglares, bosques y terrenos forestales, y la zona pública correspondiente a los primeros cincuenta metros de la playa a partir de la pleamar ordinaria. Las construcciones, las instalaciones y los predios situados en las zonas litorales del distrito de Caldera, administradas por la Municipalidad de Esparza, deben considerar el desarrollo comunal, turístico, urbanístico, habitacional, comercial y agropecuario, de manera sostenible con los recursos naturales”. Como puede observarse, en concordancia con el subacápite anterior, en la zona litoral administrada por la Municipalidad de Esparza no aplicaría la ley 6043, con lo que, sobre este espacio, la pretensión 2 de la demanda tendría que acogerse parcialmente, ello en cuanto a la aplicación del artículo 79 de la ley 6043 sobre la zona litoral desgravada, mas no sería aplicable la ley 5582 y sus reformas, en tanto no sería ZPR, y en consecuencia, tendría que rechazarse la pretensión tercera de la tercería Estatal, por las razones expuestas.
Así, en dicho espacio, en los términos de planificación territorial, el régimen aplicable sería el de la Ley de Planificación Urbana y siguiendo como norte el “impulsar e incentivar el desarrollo del puerto de Caldera y las zonas a su alrededor” (art. 79 de la ley 6043) lo que coincide con el destino dispuesto en la propia ley 7915 que señala “…Con el fin de asegurarse el adecuado desarrollo urbano, social y ambiental de las zonas circunvecinas de la zona portuaria reservada, la Municipalidad de Esparza elaborará un plan regulador y de ordenamiento urbano, que incluya la zona desafectada en virtud de la aprobación de la presente ley. Para elaborar y aplicar este plan dicha Municipalidad y las instituciones públicas involucradas se regirán por la Ley de Planificación Urbana, Nº 4240, del 15 de noviembre de 1968”, quedando siempre a salvo, el régimen de zona pública de 50 metros contados desde pleamar.
Advertimos que, contrario a la postura de las accionantes, la desafectación dada por la ley 7915 solamente se puede extender a las limitaciones contenidas en la ley 5582 y sus reformas, sin que sea posible interpretar que, las demás regulaciones de orden público que coexistían antes, durante y después de la afectación de la ZPR, se vean de alguna forma alterados por dicha desafectación, como lo sería la regulación de caminos públicos, servicios públicos y otros demaniales existentes en la zona. Análisis que aplicaría, de igual manera, en la zona remanente, es decir, en la zona que no sería ni litoral ni la zona ambientalmente tutelada en los términos del acápite siguiente, y que es zona desgravada por la ley 7915, que sería susceptible de planificación a través de un Plan Regulador Urbano, siendo identificado este espacio en el “mapa de los límites de la ZPR” entre las coordenadas 214000, hasta en parte 207000 (vertical) :: en parte 455000, 461000 (horizontal).
Con ello, se acoge, en estos términos, la pretensión cuarta de la demanda, advirtiendo que es obligación de la Municipalidad accionada de planificar, a través de un Plan Regulador Urbano dichos espacios, siempre sometiéndose a los límites competenciales y a la tramitología vigente a cualquier Plan Regulador Urbano. VII.4.- SOBRE LA REGULACIÓN AMBIENTAL EN CUALQUIERA DE LOS ESPACIOS ANTERIORES: Finalmente, encontramos una zona que existe dentro y fuera de la del área litoral descrito anteriormente y que podría, incluso, formar parte de la ZPR, así como zonas tierra dentro por lo que, en términos generales, se trataría de una regulación que, en primacía, provocaría que las demás regulaciones retrocedan en aplicación. Nos referimos a las áreas que encuentran una zona de tutela especial ambiental, identificados como manglares, tanto de Tivives como Mata Limón, que encuentran protección tanto a nivel nacional (Ley 6043 y Ley Forestal N° 7575, Ley 7224 “Convenio Ramsar”, Ley Orgánica del Ambiente N° 7554, Ley de Biodiversidad N° 7788), la Zona Protectora de Tivives (Decreto 17023), el cual incluye además de los territorios que como prenden los manglares de Mata Limón y Tivives, se incorpora el reducto de bosque tropical seco existente, ubicado en la Hoja Cartográfica Barranca, así como otras zonas que sean calificables de Patrimonio Natural del Estado.
Se reitera lo dicho hasta el momento que, la desafectación de la ley 7915 no alcanza a inhibir la tutela y aplicación de estos otros espacios, así como que, por otra parte, en este proceso no se está discutiendo ni la ubicación, identificación o calificación de estos espacios, que quedaría fuera de este proceso. Empero, en términos generales, tal y como se ha solicitado por parte del Estado en su tercería, tendría que acogerse sus pretensiones 1, 2 y 4, al encontrarse ajustadas al razonamiento expuesto supra.
En cuanto a la falta de legitimación activa en contra de las demandadas, siendo que lo pretendido en este proceso es la declaratoria del régimen jurídico aplicable y la manifestación de las partes actoras las ubican como sujetos dentro de la zona geográfica en donde la declaratoria de esta sentencia tiene efecto, se determina que, en el marco del art. 9.b en relación con el numeral 10.4 del CPCA, existe legitimación activa de las accionantes, por lo que ha de rechazarse. En cuanto a la falta de legitimación activa y pasiva de la tercería, la misma debe rechazarse, ello por cuanto, en el marco del artículo 50 Constitucional, el Estado en calidad de rector en materia ambiental, así como agente relevante en términos de la ley 6043, posee la legitimación suficiente para interponer la tercería, mientras que, si bien las pretensiones no son en contra de la calidad personal de las demandantes, lo cierto es que los pedimentos de la tercería influyen, directamente, a las pretensiones de la demanda, con lo que obliga a ostentar una posición pasiva (legitimación pasiva) para la correcta defensa de sus intereses, tal y como se configuró en esta litis. En cuanto a la falta de derecho, conforme a las razones dadas en el considerando anterior, ha de acogerse parcialmente, tanto frente a la demanda como frente a la tercería con pretensiones propias.
De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. La dispensa de esta condena solo es viable cuando hubiere a juicio del Tribunal, motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En la especie, este Órgano Colegiado sí encuentra motivo para aplicar las excepciones que fija la normativa aplicable, ya que, en el asunto en concreto, existe vencimiento recíproco y aceptación parcial de las pretensiones. En consecuencia, se dicta esta sentencia sin especial condenatoria en costas.
POR TANTO
Se acoge parcialmente la falta de derecho en contra de la demanda y de la tercería con pretensiones propias, se rechaza la falta de legitimación activa invocada en contra de las actoras, así como la falta de legitimación activa y pasiva invocadas en contra de la tercerista con pretensiones propias. En consecuencia, se declara PARCIALMENTE CON LUGAR la demanda interpuesta por la ASOCIACIÓN DE DESARROLLO INTEGRAL DE MATA LIMÓN ESPARZA PUNTARENAS (ADI MATA LIMÓN) y la ASOCIACIÓN DE VECINOS UNIDOS DEL SECTOR TURISMO Y COMERCIO DE CALDERA Y MATA LIMÓN, en contra de la MUNICIPALIDAD DE PUNTARENAS, se rechaza la pretensión primera por la forma en cómo se resuelve este asunto, se rechaza la pretensión segunda respecto de zona portuaria reservada en la cual sí aplica la ley 6043, pero se acoge respecto de la zona litoral administrada por la Municipalidad de Esparza y la zona residual de Mata Limón no afecta a dicha zona portuaria o al régimen ambiental en la cual aplica el art. 79 reformado de la Ley 6043, acogiéndose en consecuencia la pretensión cuarta, siendo obligación de la Municipalidad accionada de planificar, a través de un Plan Regulador Urbano dicha zona, siempre sometiéndose a los límites competenciales y a la tramitología vigente a cualquier Plan Regulador Urbano; se acoge la pretensión tercera no siendo aplicable las leyes 9242 y 9408 en ninguno de los espacios en discusión.
Asimismo, se acoge PARCIALMENTE LA TERCERÍA CON PRETENSIONES PROPIAS planteada por el ESTADO, se acogen las pretensiones primera y segunda en su totalidad, declarando que los terrenos de la Zona Protectora Tivives se rigen por las disposiciones especiales de los artículos 73 de la Ley 6043, 32 y 37 de la Ley 7554, quedando excluida la planificación municipal, así como los terrenos del Patrimonio Natural del Estado, tales como las zonas de manglar –aún desprovistas de sus condiciones originarias−, los bosques y otros terrenos forestales o con esa aptitud, enlistados por el artículo 13 de la Ley Forestal, los administra el Sistema Nacional de Áreas de Conservación conforme a los numerales 13 de la Ley Forestal, 22 y 28 de la Ley de Biodiversidad, y por ende están excluidos de la planificación municipal. Se rechaza la pretensión tercera en su totalidad y se acoge la pretensión cuarta por los mismos motivos que resuelven las pretensiones de la demanda.
Lo anterior, en el marco de lo resuelto en el considerando sétimo de esta sentencia, rechazándose en lo no expresamente indicado. Se dicta esta sentencia sin especial condenatoria en costas. Notifíquese.- CARLOS JOSÉ MEJÍAS RODRÍGUEZ CLAUDIA BOLAÑOS SALAZAR LAURA GÓMEZ CHACÓN ???????????????
