SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- At trece horas cincuenta y dos minutos on seis de diciembre de dos mil veintitrés.- SUMMARY POSSESSORY INJUNCTION PROCEEDING (PROCESO SUMARIO INTERDICTAL) brought by JORGE VALLEJOS GONZÁLEZ, of legal age, married once but currently separated in fact, identity card number uno - ochocientos setenta y siete - cuatrocientos cuarenta y seis, resident of Santa Cruz; against GLADYS HAYDEE PASTRANA ARROYO, of legal age, married, identity card number cinco - ciento setenta y cinco - quinientos veintisiete, resident of Santa Cruz. Attorney José Cerdas Fonseca acts as public defender for the plaintiff. Heard before the Juzgado Agrario del Segundo Circuito Judicial de Guanacaste. This Tribunal reviews the declination of jurisdiction (inhibitoria) issued at ocho horas treinta y cinco minutos on quince de noviembre de dos mil veintitrés.

I.In a decision issued at ocho horas treinta y cinco minutos on quince de noviembre de dos mil veintitrés, the Juzgado Agrario de Santa Cruz declined subject-matter jurisdiction (inhibitoria por razón de la materia) to hear this matter. It was asserted that the property (fundo) where the trees that are the subject of the felling claim are located is not used for an agricultural activity (decision in images 10 and 11 of the electronic case file viewed as a complete file).
II.Agricultural subject-matter jurisdiction (competencia agraria por razón de la materia) is defined in general terms by Articles 1 and 2 of the Ley de Jurisdicción Agraria. Likewise, section 113 of the Ley Orgánica del Poder Judicial provides that the agricultural courts shall hear matters relating to agricultural law, regardless of the amount in controversy, as well as any other matters entrusted to them by law. Moreover, trees, as natural resources, are governed, among other provisions, by the Ley de Biodiversidad, Article 11(3) of which provides that the public environmental interest is one of the criteria for applying that legislation. Specifically, the provision states: “The use of the components of biodiversity must safeguard the development options of future generations, food security, ecosystem conservation, the protection of human health, and improvements in citizens’ quality of life.” Such matters must be considered in deciding this proceeding because a natural resource is at issue, and subject-matter jurisdiction to make that determination is reserved by law to this Jurisdiction.
In essence, section 108 of the Ley de Biodiversidad provides: “In biodiversity matters, and until an environmental jurisdiction exists, every dispute shall fall within the exclusive jurisdiction of the administrative courts. As exceptions to the foregoing rule, offenses against biodiversity shall be adjudicated by the criminal courts; likewise, disputes arising between private parties that do not involve an administrative act or public-domain property shall fall within the jurisdiction of the agricultural courts.”
III.In this case, the complaint alleges that the defendant is the manager of the property located in Barrio Limón, distrito primero Santa Cruz, cantón de Santa Cruz, provincia de Guanacaste, registered as 3073-M-000, whose property classification is a condominium consisting of cuarenta y cuatro individual units intended for residential use. The plaintiff states that he lives in one of the houses located on that condominium property and that, to enter and leave, all residents of the residential complex use an internal common access road leading to the main road. He alleges, however, that there is a large cenízaro tree that is very tall and leans toward the road, creating an imminent risk that it will fall onto that access road. He therefore requests that the defendant be ordered to fell it (complaint in images 2 to 6 of the cited electronic case file).
IV.It follows from the foregoing that, because this is a proceeding seeking the felling of an apparently very tall cenízaro tree that allegedly could fall onto an access road used by vehicles and persons, the matter falls within the subject-matter jurisdiction of the agricultural courts under the cited legislation. The declination of jurisdiction must therefore be rejected (see, to the same effect, this Chamber’s decisions N° 845-C-2019 and 62-C-21, among many others).
V.Dissenting opinion of Judge Alpízar Rodríguez: Judge Ruth Alpízar Rodríguez signs but does not join the majority opinion insofar as it rejects the subject-matter declination of jurisdiction and orders that this proceeding be heard by the Agricultural Jurisdiction. As stated in the majority opinion, agricultural subject-matter jurisdiction is defined in general terms in Articles 1 and 2(h) of the Ley de Jurisdicción Agraria. Those provisions empower the courts of this specialized jurisdiction to adjudicate or resolve disputes related to the conduct of agricultural or agro-environmental activities, or activities connected with them. In this case, the relief sought is the felling of a tree; therefore, irrespective of the nature of the parties (plaintiff and defendant), what matters in determining jurisdiction is the use to which the land where the tree is located and the land onto which it may fall are devoted.
If trees are located in water-source protection areas or along public roads, determining whether the matter is agricultural depends on whether they are situated in a rural area or within an urban center (if the latter, it is a civil matter; if the former, an agricultural matter). In this regard, it should be recalled that, whenever there is a legal basis, in the words of the Sala Constitucional, “...the litigant has the right to choose the jurisdictional branch before which to bring an action, provided that the substantive nature of the claim and the applicable legal framework are consistent with the—constitutional or statutory—specialization of the respective jurisdiction” (decision 9928 of 09.06.2010). According to the complaint, the land on which the tree at issue in this proceeding is allegedly located neither has an agricultural character nor is suited for agricultural use, given its current use as a residential condominium.
Accordingly, based on the relief sought and the matters in dispute, the undersigned judge considers that the subject-matter declination of jurisdiction should have been approved so that this matter could be adjudicated by the Juzgado Civil of the locality where the subject of the dispute is located.
THEREFORE:
The subject-matter declination of jurisdiction is rejected. This electronic proceeding shall be returned promptly so that the appropriate proceedings may continue. Judge Alpízar Rodríguez filed a dissenting opinion.

Conoce este Tribunal de inhibitoria de las ocho horas treinta y cinco minutos del quince de noviembre de dos mil veintitrés.
Redacta la jueza Fisher González; y,
I.El Juzgado Agrario de Santa Cruz en resolución de las ocho horas treinta y cinco minutos del quince de noviembre de dos mil veintitrés, declaró inhibitoria por razón de la materia para conocer de este asunto. Se aduce que el fundo donde se ubican los árboles objeto de la demanda de derribo no está destinado a una actividad agraria (resolución en imágenes 10 y 11 del expediente electrónico visualizado como archivo completo).
II.La competencia agraria por razón de la materia está determinada en forma genérica por los artículos 1 y 2 de la Ley de Jurisdicción Agraria. Así mismo, el numeral 113 de la Ley Orgánica del Poder Judicial indica, conocerán los juzgados agrarios de lo relativo a la materia agraria, cualquiera que sea la cuantía y de los demás asuntos que les encomienden las leyes. Por otra parte, los árboles como recursos naturales se encuentran regulados, entre otras normas, por la Ley de Biodiversidad, la cual dispone en el inciso 3 del artículo 11 que uno de los criterios de aplicación de esa normativa lo constituye el interés público ambiental. Concretamente, señala la norma: "El uso de los elementos de la biodiversidad deberá garantizar las opciones de desarrollo de las futuras generaciones, la seguridad alimentaria, la conservación de los ecosistemas, la protección de la salud humana y el mejoramiento de la calidad de vida de los ciudadanos".
Tales aspectos deberán ser considerados para la resolución de este proceso, al estar de por medio un recurso natural; y la competencia material para tal determinación está reservada por ley a esta Jurisdicción. Básicamente, el numeral 108 de la Ley de Biodiversidad señala: "En materia de biodiversidad y mientras no exista una jurisdicción ambiental, toda controversia será competencia exclusiva de la jurisdicción contencioso-administrativa. Como excepciones a la regla anterior, los delitos contra la biodiversidad serán juzgados por la jurisdicción penal; de igual modo, las controversias que se susciten entre particulares, donde no medie un acto administrativo ni del dominio público, serán competencia de la jurisdicción agraria".
III.En la especie, se alega en la demanda, que la parte accionada es la administradora de la finca situada en Barrio Limón, distrito primero Santa Cruz, cantón de Santa Cruz, de la provincia de Guanacaste matrícula 3073-M-000, cuya naturaleza es un condominio compuesto por cuarenta y cuatro filiales, que se destinarán a fines habitacionales. El actor expone que vive en una de las casas situadas en esa propiedad condominal, y que para entrar y salir todos los habitantes del residencial utilizan un acceso común interno que conduce a la carretera principal. Sin embargo, alega que existe un gran árbol de cenízaro, el cual tiene mucha altura y una inclinación hacia la calle, lo que genera un riesgo inminente de caída sobre ese acceso. Por ello solicita se ordene a la demandada su derribo (demanda en imágenes 2 a 6 del expediente electrónico citado).
IV.De lo expuesto se concluye, al estarse en presencia de un proceso en el cual se solicita el derribo de un árbol de cenízaro de aparente gran altura que se alega podría caer sobre un acceso donde transitan vehículo y personas, el asunto es parte de la competencia material de los tribunales agrarios conforme a la normativa citada, por tal razón procederá rechazar la inhibitoria (en este mismo sentido puede consultarse las decisiones de esta Cámara números N° 845-C-2019 y 62-C-21 entre muchos otros).
V.Voto salvado de la Jueza Alpízar Rodríguez: La jueza Ruth Alpízar Rodríguez, suscribe pero no comparte el voto de la mayoría, en cuanto rechaza la inhibitoria por materia y ordena se tramite este proceso por la Jurisdicción Agraria. La competencia agraria por razón de la materia, como se indica en el voto de mayoría, está definida genéricamente en los artículos 1 y 2 inciso h) de la Ley de Jurisdicción Agraria. Dichas normas facultan a los tribunales de esta disciplina para dirimir o resolver los conflictos relacionados con el ejercicio de actividades agrarias o agroambientales, o conexas a éstas. En este caso, lo solicitado es el derribo de un árbol, por lo que independientemente de la naturaleza de los sujetos (parte actora y demandada), lo que interesa para definir la competencia es a qué se dedican los terrenos dónde se localiza el árbol y aquellos sobre los cuáles puede caer. Si se trata de árboles en áreas de protección de fuentes de agua o en orillas de caminos públicos, para determinar si es materia agraria o no, lo que interesa es determinar si se localizan en una zona rural o dentro de un casco urbano (si es lo segundo, será materia civil; si es lo primero, materia agraria).
Al respecto, recuérdese que siempre que exista fundamento jurídico, en palabras de la Sala Constitucional, "...el justiciable tiene el derecho de elegir ante cuál orden jurisdiccional acciona, en el tanto la naturaleza material de la pretensión y el régimen jurídico aplicable sea congruente con la especialidad –constitucional o legal- de la respectiva jurisdicción" (voto 9928 de 09.06.2010). El terreno donde se afirma se ubica el árbol objeto del proceso, según la demanda, no es de naturaleza ni tiene vocación agraria, por su destino actual (condominio habitacional). Por consiguiente, con base en lo que se pretende y debate, para la suscrita jueza, debió aprobarse la inhibitoria por materia, para que este asunto fuese dirimido por el Juzgado Civil de la localidad donde se ubica lo que es objeto de litigio.
POR TANTO:
Se imprueba la inhibitoria por razón de la materia. Devuélvase a la brevedad este proceso electrónico para continuar con el trámite correspondiente. Existe voto salvado de la Jueza Alpízar Rodríguez.
