INCUBADORA COSTARRICENSE S.R.L.

DEFENDANT:

THE STATE No. N° 2023005687 ADMINISTRATIVE AND CIVIL COURT OF THE TREASURY, THIRD SECTION, SECOND JUDICIAL CIRCUIT, SAN JOSÉ, GOICOECHEA, at eleven fifty-five a.m. on the twenty-third of November, two thousand twenty-three.- Plenary proceeding brought by Incubadora Costarricense S.R.L., legal entity identification number 3 102-10054, represented by its special judicial attorney-in-fact (apoderado especial judicial), attorney Manuel Emilio Ramírez Castro, Bar membership number 2032, against the Municipalidad de Alajuela, represented by attorney Johanna Barrantes León, and against the State, represented by State Attorney Gloria Solano Martínez.

WHEREAS

I.Arguments in the complaint. The plaintiff company owns two properties, each registered under a real property folio (folio real). It states that the Municipalidad de Alajuela made use of a spring (naciente) near the properties by installing a water intake for human consumption, the 200-meter radius of which encompassed a strip measuring more than 10.000 m2 across the two properties, which became a national-domain reserve (reserva de dominio) in favor of the Nation, pursuant to Article 31 of the Ley de Aguas, as communicated to it in the land-use certificates (certificados de uso de suelo) for both properties. It adds that this caused the remaining portions to be left without access to a public road, leaving one of the properties completely landlocked and the other with insufficient frontage, rendering it entirely unusable for development in accordance with its natural purpose of urban subdivision (fraccionamiento urbano).

It considers that the Municipalidad de Alajuela, without prior compensation, curtailed and dispossessed it of its property right; the real-estate development opportunities that it could have pursued on those properties were lost, in violation of its property right, legal certainty, and the principle of legality. It further believes that the Legislative State bears strict civil liability (responsabilidad civil objetiva del Estado Legislador), entitling it to reparation for the damage caused, which is estimated at 50.000.000 colones, without prejudice to the findings of any appraisals conducted regarding the value of the properties (image 32). For these reasons, it asserts the following claims:

“A- PRINCIPAL RELIEF SOUGHT First: That the judgment order and provide for the expropriation of the areas that, pursuant to Article 31(a) of the Ley de Aguas and/or as a result of the designation of the Flow Area reserve provided for in Article 43 of the Plan Regulador Urbano del Cantón Central de Alajuela, comprise the national-domain reserve established in favor of the Nation on the properties owned by the plaintiff and recorded under real property folio numbers 2-540242-000 and 2-540084-000, which have been affected by the Public Administration; and, consequently, it is requested that, because these expropriations—those of the reserve areas—also cause absolute impairment and dysfunction of the remaining portions of those properties, the judgment order and provide that the expropriation and compensation encompass the entirety of the areas comprising the aforementioned properties, recorded, as stated, under real property folio numbers 2-540242-000 and 2-540084-000, all pursuant to Article 17 of the Ley de Expropiaciones.- Second: It is requested that the expropriations ordered in this judgment be carried out on behalf and in the interest of the Municipalidad de Alajuela, which is the direct author of the conduct that brought about the creation of the reserve areas.

Third: That it further be provided, in accordance with the ruling, that the expropriated properties, whose acquisition was necessary to comply with the legal provisions of Article 31 of the Ley de Aguas and/or others, are specifically those having the following characteristics: a) The property recorded under real property folio 2-540242-000, which, according to registered cadastral plan (plano catastrado) A-1883487-2016, has an area of fifty-six thousand seven hundred ninety-eight square meters and also has the following characteristics: nature: land for construction, located in the district of Guácima, First Canton of the Province of Alajuela, bounded to the north by the road to Rincón Chiquito and by Incubadora Costarricense S.R.L.; south: public road, national route 27; east: Incubadora Costarricense S.R.L.; west: Agropecuaria Mis Dos Hijas S.A. b) The property recorded under real property folio 2-540084-000, which, according to registered cadastral plan A-1883364- 2016, has an area of forty-nine thousand two hundred seven square meters and also has the following characteristics: nature: land for construction, located in the district of Guácima, First Canton of the Province of Alajuela, bounded to the north by a public road for 79.82 meters; south: public road, national route 27; east: Luz, Virginia, Aurea and Lili, all surnamed Lara Ocampo; west: Incubadora Costarricense SRL.

Fourth: That the order requiring the Municipalidad de Alajuela to pay compensation for the property damage inflicted upon the assets of the plaintiff herein require it to do so by payment in cash through a deposit into the Court’s bank account assigned to this case file, in the amount that this Court establishes as fair compensation (justiprecio) based on the valuation appraisals to be admitted as evidence, which are requested and offered for that purpose by this representation, and whose total amount, should the Court deem it appropriate, shall be itemized in the judgment under the categories identified by the valuation appraisal.

Fifth: It is likewise requested that the judgment order that, as compensation for the losses caused, the Municipalidad de Alajuela be required to pay interest on the total compensation amount established for the damage, as provided in Article 11 of the Ley de Expropiaciones, consisting of the interest accrued from the time of dispossession until the date of actual payment, at the statutory rate.- Accordingly, and for those purposes, it is requested that 30 May of the year two thousand seventeen be established as the date of dispossession, since that is the date on which the restriction of the national-domain reserve in favor of the Nation became effective with respect to the properties through the notice issued by the Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela in the corresponding land-use certificates contained in Official Letters MA-ACC-04496-2017 and MA-ACC-04497-2017, both dated 30 May 2017, which therefore marks the effective commencement of the designation of the properties as part of the newly created public domain (demanialidad).

Sixth: That the judgment further provide that the expropriated properties be allocated to the public domain in favor of the Nation established by Article 31(1) of the Ley de Aguas and order that they be registered in the name of the expropriating authority, free of encumbrances, restrictions, and notices, for which purpose it shall be provided that, once the judgment rendered becomes final, the Notarial Office of the designated public entity shall be authorized to notarize the relevant record (protocolización de piezas) for the proper registration of the expropriated property in the name of the expropriating authority.- It shall likewise be provided that the Registro Nacional is required to cancel all notices, levies, and encumbrances affecting the expropriated properties on the basis of the deed notarizing the relevant record, without any further procedure being necessary; and the judgment shall likewise order that any expenses that may be required for those registration procedures be borne by the expropriating authority.- It shall further be ordered that, once the judgment becomes final, notice must be given to the Dirección General de Tributación and the Municipalidad de Alajuela so that they may make the determinations required by law concerning national or municipal taxes.

Seventh: I request, in the alternative, that all obligations sought in this Principal Relief to be imposed upon the Municipalidad de Alajuela—if they are not granted against that Municipality because the Court considers that such conduct was undertaken by it solely pursuant to the legislation in force and that, therefore, such liability is attributable to the State in its capacity as Legislative State—then be deemed asserted and requested under claims First, Second, Third, Fourth, Fifth, and Sixth, in that event, against the State, so that they shall instead be ordered against and imposed upon the State, and so that the State shall be required to compensate the plaintiff and receive title to the expropriated areas.

B.- FIRST SUBSIDIARY RELIEF SOUGHT:

If, for any reason, the foregoing Principal Relief does not grant the portion of the first claim requesting that the expropriation of the entirety of the property recorded under Real Property Folio number 2-540084-000 be ordered pursuant to Article 17 of the Ley de Expropiaciones, and the Court dismisses that claim, I then request, in the alternative, based on the doctrine expressing the views of Professor Eduardo Ortiz Ortiz, who states on the subject: “The sacrifice of a property right or, as our Constitution calls it, its ‘deprivation,’ is the corollary of the constitutionally guaranteed content of that right: it is any public intervention, legislative or administrative, general or individual, that eliminates or equivalently diminishes, without expressly so naming them, the powers to enjoy and dispose of the property, in such a manner that the owner, although not ceasing to be its owner and although the owner’s right is not transferred to anyone, becomes legally or materially unable to obtain from the property sufficient benefit to justify holding and maintaining title to and/or possession of it...” (E, ORTIZ ORTIZ; Expropiación y responsabilidad, públicas, p. 144), that the judgment provide the following regarding the impact on that property recorded under Real Property Folio number 2-540084-000:

First.- That it be declared that the creation by the Municipalidad de Alajuela of the national-domain reserve area in favor of the Nation, as authorized by Article 31 of the Ley de Aguas, constitutes and gives rise to an expropriation of the area comprising that reserve and that compensation must therefore be awarded to the plaintiff in the judgment for the resulting financial loss; and that civil liability must also be declared for the compensable damage suffered by its owner, Incubadora Costarricense S.R.L., as a result of the partial impairment of the area comprising the remaining portion of that property.

Second: That it therefore be declared that the injury to be compensated specifically consists of: a) the partial loss of the land area suffered by the aforementioned property when it is allocated to the national-domain reserve; and b) the damage additionally caused to the remaining portion by the resulting impact and impairment, because the remainder is damaged through the partial deprivation of property rights, leaving this property, among other restrictions, without adequate and sufficient access from a public road to permit its development in accordance with its intended purpose and authorized use.- Third: That, as a consequence of the foregoing, it be declared that the compensation (indemnización) I request the Municipalidad de Alajuela be ordered to pay for the damage caused to the property recorded under Real Folio number 2-540084-000 shall be paid in cash by means of a deposit into the Tribunal’s bank account assigned to this case, in the amount that this Tribunal determines as just compensation (justiprecio) on the basis of the valuation expert reports requested for submission in these proceedings for that purpose, and whose total amount, if the Tribunal deems it appropriate, shall be itemized in the judgment according to the categories identified in the valuation expert report.- Fourth: I request that the expropriation (expropiación) ordered in the judgment, to be undertaken at the expense and on behalf of the Municipalidad de Alajuela, be specifically ordered with the following scope, content, and compensable items:

  • a)The expropriation of the reservation area established over property registration number 2-540084-000 shall be ordered, because the acts of the Municipalidad de Alajuela have established the existence of an ownership reservation (reserva de dominio) in favor of the State, which measures 3.276 square meters; alternatively, the area ultimately determined on the basis of the evidence admitted in this proceeding shall be expropriated.
  • b)Payment of compensation for the damage caused to the remaining portion (resto remanente) of property registration number 2-540084-000 shall likewise be ordered because, although it is not subject to the ownership reservation, the topographical conditions in which it remains affect its commercial value by restricting it and making it less commercially attractive, as well as by making its development and commercial exploitation more costly in accordance with its authorized urban uses.

Fifth: That, as a consequence of what has already been granted, it be determined that the area expropriated, whose expropriation is necessary to comply with the legal provisions of article 31 of the Ley de Aguas and/or others, is the area having the following characteristics: The expropriated reservation area is a portion to be segregated (segregar) from the property recorded under real folio 2-540084-000, which, according to the survey plan prepared for that purpose and recorded at folio 30 of Protocol 21142 of Expert Surveyor Rubén Cubero Martínez, licensed surveyor number TA5613, submitted for registration with the Catastro del Registro Nacional under CITAS DE PRESENTACION 2019 - 96416 – C, has an area measuring 3.276 square meters and the following additional characteristics: nature: land designated as an ownership reservation in favor of the Nation pursuant to article 31 of the Ley de Aguas, located in the distrito Guácima del Cantón Primero de la Provincia de Alajuela and bounded to the north by a public road for 79.82 meters.

South: Incubadora Costarricense S.R.L East: Luz, Virginia, Aurea and Lili, all surnamed Lara Ocampo West: Incubadora Costarricense SRL.- Sixth: It is likewise requested that the judgment order, as compensation for the losses caused, that the Municipalidad de Alajuela be required to pay interest on the total amount of compensation established for the damage; pursuant to article 11 of the Ley de Expropiaciones, such interest shall accrue at the statutory rate from the time of dispossession (desposesión) until the date of actual payment.- Accordingly, and for those purposes, it is further requested that the date of dispossession be established as 30 de mayo del año dos mil diecisiete, because that is the date on which the legal restriction consisting of the ownership reservation in favor of the Nation was imposed on the property through the communication issued by the Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela in the corresponding land-use certificate (certificado de uso de suelo) contained in Oficios MA-ACC-04496-2017, and it is that date, 30 mayo de 2017, that marks the effective commencement of the property’s subjection to the newly established public-domain status (demanialidad).- Seventh: It shall also be ordered in the judgment that the expropriated property be allocated to the public domain (dominio público) in favor of the Nation as provided in article 31 subsection 1) of the Ley de Aguas, and that the expropriated reservation area be segregated and registered in the name of the expropriating authority, free of encumbrances, restrictions, and notices; for this purpose, it shall be ordered that, once the judgment issued becomes final, the Notaria of the designated public entity shall be authorized to execute the corresponding notarization of court documents (protocolización de piezas) for proper registration of the expropriated property in its name.- It shall likewise be ordered that the Registro Nacional is required to cancel all notices, exactions, and encumbrances affecting the expropriated properties on the basis of the deed notarizing the court documents, without the need for any other formality; the judgment shall also provide that all expenses that may be required by such registration procedures shall be borne by the expropriating authority.- It shall likewise be ordered that, once the judgment becomes final, notice shall be given to the Dirección General de Tributación and the Municipalidad de Alajuela so that they may make such determinations concerning national or municipal taxes as may be required by law.

Eighth: It is also requested that, likewise, should the expropriation of the entire area of the other property, 2-540242-000, not be ordered under the Principal Prayer for Relief, all the claims contained in this First Subsidiary Prayer for Relief be deemed asserted under identical conditions and with identical scope in relation to the compensation payable for the impact on property number 2-540242-000, and that the defendant thus be ordered to compensate for the damage caused to it by the partial loss of area from that property and the damage to its remaining portion; such compensation shall be made under the conditions and for the items requested in this First Subsidiary Prayer for Relief, which, in essence, are as follows:

  • a)The expropriation of the area over which an ownership reservation in favor of the State has been deemed established on the property recorded under real folio registration number 2-540242-000 shall be ordered and paid for, because it constitutes an ownership reservation in favor of the Nation measuring 7.431 square meters; alternatively, expropriation shall be ordered for the area ultimately determined on the basis of the evidence admitted in this proceeding. The judgment shall therefore provide that the expropriated reservation area is a portion to be segregated from the property recorded under real folio 2-540242-000 and that, according to the survey plan prepared for that purpose and recorded at folio 28 of Protocol 21142 of Expert Surveyor Rubén Cubero Martínez, licensed surveyor number TA5613, and submitted for registration with the Catastro del Registro Nacional under CITAS DE PRESENTACION2019 - 96412 – C, it has an area of 7.431 square meters and the following additional characteristics: nature: land designated as an ownership reservation in favor of the Nation pursuant to article 31 of the Ley de Aguas, located in the distrito Guácima del Cantón Primero de la Provincia de Alajuela and bounded to the north by the road to Rincón Chiquito and by Incubadora Costarricense S.R.L.

South: Incubadora Costarricense S.R.L East: Incubadora Costarricense S.R.L West: Agropecuaria Mis Dos Hijas S.A. b) The obligation to pay compensation for the damage caused to the remaining portion of property registration number 2-540242-000 shall likewise be ordered because, although it is not subject to the ownership reservation, the topographical conditions in which it remains affect its value by restricting it, making it less commercially attractive, and making its development and commercial exploitation more costly, all in accordance with its authorized urban uses.

  • c)It is likewise requested that the judgment order, as compensation for the losses caused to the plaintiff, that the Municipalidad de Alajuela be required to pay interest on the total amount of compensation established for the damage arising from the impact on the property recorded under real folio 2-540242-000; pursuant to article 11 of the Ley de Expropiaciones, such interest shall accrue from the time of dispossession until the date of actual payment and at the statutory rate.- Accordingly, and for those purposes, it is further requested that the date of dispossession be established as 30 de mayo del año dos mil diecisiete, because that is the date on which the legal restriction consisting of the ownership reservation in favor of the Nation was imposed on the property through the communication issued by the Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela in the corresponding land-use certificate contained in Oficios MA-ACC-04497-2017, and it is that date, 30 mayo de 2017, that marks the effective commencement of the property’s subjection to the newly established public-domain status.- Ninth: I likewise request, in the alternative, that all obligations sought in this First Subsidiary Prayer for Relief against the Municipalidad de Alajuela—if they are not granted against that Municipality because the Tribunal considers that the Municipality undertook such conduct solely by reason of the legislation in force and that, therefore, the liability claimed herein is attributable to the State in its capacity as legislator—be deemed alternatively asserted and requested against the State under the first, second, third, fourth, fifth, sixth, seventh, and eighth claims of this First Subsidiary Prayer for Relief, so that they may instead be ordered against and at the expense of the State, and so that the State shall be ordered to compensate the plaintiff and shall receive title to the expropriated areas.

C.- SECOND SUBSIDIARY PRAYER FOR RELIEF:

Should this Tribunal decide not to order the expropriations or determine the amounts of the respective compensation as requested, on the ground that such claims properly belong and must be pursued within the Special Expropriation Proceeding (Proceso Especial de Expropiación), I then request that the action brought by Incubadora Costarricense S.R:L. against the Municipalidad de Alajuela and, in the alternative, against the State, be granted on the following terms:

First: That it be declared that the establishment of those ownership reservation areas in favor of the Nation through municipal action, as reflected in the administrative acts (actos administrativos) consisting of official letters MAACC- 04496-2017 and MA-ACC-04497-2017, and affecting the properties owned by the plaintiff and recorded under real folio numbers 2-540084-000 and 2-540242-000, entails and gives rise to compensable strict civil liability (responsabilidad civil objetiva) on the part of the Municipalidad de Alajuela and that, therefore, it is responsible for compensating the damage and losses that such acts have caused to the plaintiff’s assets.

Second.- That it be declared that the damages to be compensated to the claimant arise from the harmful effects that administrative and/or public conduct inflicted upon the claimant’s assets, specifically the assets consisting of the properties owned by it and recorded under real-property folio numbers 2-540242-000 and 2-540084-000. And that it be declared that the injury consists, on the one hand, of the partial loss of land area suffered by each of the aforementioned properties and, on the other hand, of the fact that such acts also affected the remaining areas of the properties by rendering them dysfunctional, thereby depriving the ownership rights over those properties of their substance.- Or, should it not be found that the remnants of the properties are entirely dysfunctional, order only the expropriation (expropiación) of the reserve areas through which those properties are incorporated into the public domain (demanio público), and include compensation for the damage—then deemed partial—suffered by the remnants in the amount of fair compensation (justiprecio) payable for those areas.

Third. That the Municipality of Alajuela consequently be ordered to initiate expropriation proceedings for the entirety of the properties located in the Province of Alajuela and recorded under Real Property Folio numbers 2-540242-000 and 2-540084-000; or, as may be determined with respect to the preceding prayer for relief, that only the expropriation of the newly created public-domain reserve areas (áreas de reserva de dominio) in favor of the Nation be ordered, in which case the damages to the remnants shall be determined in the expropriation proceedings requested below, all in accordance with the procedures and requirements governed by the Ley de Expropiaciones, No. 7495.

Fourth. That the judgment provide that such proceedings must be initiated jointly for both properties and within a maximum period of three months from the date this ruling becomes final. And that, for those purposes, the declaration of public interest (declaratoria de interés público) for those areas shall be dispensed with, because this ruling shall establish that the ordered expropriation is warranted on the stated grounds of encumbrance (afectación).

Fifth. I further and additionally request, at this time, that the judgment in these proceedings provide that, as damages, the Municipality of Alajuela must recognize and pay to the claimant herein, in the expropriation proceedings that must be initiated, the interest to which it is entitled under Article 11 of the Ley de Expropiaciones; that such interest must be calculated on the amount established in the judgment in those proceedings as fair compensation; and that such interest shall have accrued from the date the property became subject to the public-domain reservation, which was 30 de mayo del año 2017, that being the date on which dispossession (desposesión) occurred, until the date on which the compensation is actually paid, which, I repeat, I hereby request be so established.- Sixth: In the alternative, I request that all obligations sought in this Second Alternative Prayer for Relief against the Municipality of Alajuela—if they are not granted against that Municipality because the Court considers that such conduct was undertaken by it solely pursuant to the legislation in force and that, therefore, liability is attributable to the State in its capacity as legislative State (Estado Legislador)—then be deemed alternatively asserted and requested against the State under the circumstances described in the first, second, third, fourth, and fifth prayers for relief, and that the State accordingly be ordered to initiate the expropriation proceedings, that ownership of the expropriated areas be transferred to it, and that it fulfill all the requested terms and scope of compensation set forth in the aforementioned numbered paragraphs.- D.- COMMON PRAYER FOR RELIEF Sole.

That the Municipality of Alajuela or the State and, if applicable, both parties jointly and severally, depending on the manner in which this action is granted, be ordered to pay both categories of costs (ambas costas) of this action.”

II. DEFENSE OF THE MUNICIPALITY

Counsel for the Municipality opposed the action and raised the defenses of failure to state a valid legal claim (falta de derecho) and lack of standing as a defendant (falta de legitimación pasiva). In this regard, counsel clarified that the land uses (usos de suelo) for both properties were approved, but the properties are partially affected by the La Pradera spring (naciente), as provided both by the zoning plan (plan regulador) of that canton, which classifies them as an absolute spring reserve subzone, and by Article 31 of the Ley de Aguas, a provision that does not establish that expropriation or compensation in favor of the owner is warranted, particularly because there is no deprivation of the essential substance of the right to private property. Counsel considers that these are restrictions in the social interest imposed by operation of law, which are known to the claimant, are not compensable, and must be borne by the owner.

Counsel adds that the Municipality has caused no damage to those properties and has merely regulated land use through its zoning plan, which respects spring protection zones and incorporates the regulations established in both the Ley de Aguas and the Ley Forestal; consequently, it could not initiate expropriation proceedings and pay compensation to mitigate a statutory restriction, especially because public funds are involved and an expenditure is impermissible where it is not legally warranted. Counsel further states that the Contraloría General de la República itself has denied municipalities that administer water-supply systems authorization to purchase land adjacent to the 200m spring protection zone. Counsel adds that there is no evidence that the claimant inquired whether the boundary adjoining route 27 is authorized for access.”

III. DEFENSE OF THE STATE

Counsel for the State opposed the action, stating that the claimant was fully aware of the condition of the properties before initiating proceedings with the Municipality. Counsel raises the defense of failure to state a valid legal claim because springs and rivers are public-domain assets, which have long been protected, as may be verified in the Ley General sobre Terrenos Baldíos -Ley 13 de 10 de enero de 1939-, as reiterated in Article 31 of the Ley de Aguas and in Article 7,c) of the Ley de Tierras y Colonización -Ley 2825 del 14 de octubre de 1961-, from which the 200 m spring protection buffer derives. Counsel adds that the incorporation into the public domain occurred by operation of law and therefore considers the claimant to be acting in bad faith by seeking unjust enrichment with respect to land purchased in the year 2016 that was subject to an encumbrance dating from 1939 or 1941.

Likewise, the claimant may develop the land for the activity for which it requested land-use approval: urban development; compensation would be payable only if it had owned the property before enactment of the law declaring or incorporating it as a public asset, since otherwise the owner assumes the restriction. Counsel rejects any liability attributed to the State as legislative State because the claimant has made no substantive legal or evidentiary showing in that regard, rendering its claim untenable, particularly because none of the requirements for this type of liability is met: there is no single alleged injury, the injury is neither special nor exceptional, the affected persons do not constitute a small proportion, and the severity of the injury is not exceptional. Counsel also asserts that the limitations period for claiming liability for a legislative act has expired because the 4-year period established in Article 198 of the LGAP has elapsed. On those grounds, counsel requests that the action be dismissed in its entirety and that the moving party be ordered to pay both categories of costs and any interest accrued until actual payment.

IV. PROVEN FACTS

The following relevant facts are deemed proven:

  • 1)The claimant owns the property recorded under real-property folio registration number 2-540084-000, cadastral survey plan (plano de catastro) number A-1883361-2016, which, for purposes relevant to this action, borders a public road for 79.82 meters and the State to the north and national route 27 to the south, and has an area of 49.207 m2 (registry report at image 59 and plan at image 61).
  • 2)The claimant also owns the property recorded under real-property folio registration number 2-540242-000, with cadastral survey plan number A-1883487-2016, which adjoins the southwestern side of the property identified in the preceding fact. It borders a public road (calle Rincón Chiquito) to the north and national route 27 to the south and measures 56.798 m2 (registry report at image 57 and plan at image 64).
  • 3)The properties described in the preceding two facts are located in the district of La Guácima, canton of Alajuela, and resulted respectively from owner-retained subdivisions (segregación en cabeza propia) of the parent properties recorded under real-property folio registration numbers 2-2156719-000 and 2-99659-000, but they lack access from this public road (registry reports at images 57 and 59; MOPT official letter DVOP-DI-DV-PV-2016-0515 at image 527).
  • 4)The northeastern boundary of property 2-540084-000, which faces the local public road toward Rincón Chiquito, is partially affected by the protection radius of the La Pradera spring, which was used by the Municipality of Alajuela to collect and distribute drinking water to neighboring communities. The area affected by that spring is 3276m2, leaving a 20,81-meter strip of frontage along that public road that is not affected by the spring protection buffer (statement, report, and survey by Surveying Engineer Rubén Cubero Martínez at images 72 to 77; see sketch at image 73).
  • 5)The northern boundary of property 2-540242-000, which faces a local public road, is entirely affected by the protection radius of the La Pradera spring (statement, report, and survey by Surveying Engineer Rubén Cubero Martínez at images 72 to 77; official letter No. MA-PPCI-0207-2014 del 26 de marzo del 2014; sketch at image 76).
  • 6)Through official letters MA-ACC-004496-2017 and MA-ACC-004497-2017, both dated 30 de mayo del 2017, the Construction Control Division (Actividad de Control Constructivo) of the Municipalidad de Alajuela informed the claimant’s representative that, under the Plan Regulador Urbano del Cantón Central de la Provincia de Alajuela, properties registered under numbers 2-540084-000 and 2-540242-000 are located in a medium-density residential zone and that the proposed use for the “construction of an urban development” is permitted, with 300 m2 lots, minimum frontage of 12,5, and 50% coverage; however, both properties were deemed affected by a spring in the portion of the land located by drawing an imaginary line parallel to the boundary fronting the public road, with no type of construction permitted, pursuant to the Ley de Aguas No. 276, del 27 de agosto de 1942, published in La Gaceta number 190 of the same year, Article 31 A of which states, in pertinent part: “The following are declared public-domain reserves in favor of the Nation: A) The lands surrounding drinking-water collection sites or supply intakes, within a perimeter having a radius of no less than two hundred meters.” (images 68 to 71).
  • 7)After both land-use certificates (certificados de uso de suelo) were challenged, they were upheld by the Mayor of Alajuela in the decision issued at 9:00 h del 2 de febrero del 2018, who, pursuant to Articles 15 and 43 of the Ley de Planificación Urbana and based on the zoning map of that canton’s zoning plan, Article 43, confirmed that the properties are affected by the absolute spring reserve subzone and its flow area, in which no construction is permitted (images 87 to 89).
  • 8)The Mayor’s decision was challenged before the Third Section of the Administrative and Civil Court of the Treasury, which heard the matter under nonhierarchical appellate jurisdiction (jerarquía impropia) and affirmed the decision of the local authority in decision number 390- 2019, issued at 8:00 h 30 minutos on 31 de julio del 2019 (images 91 to 99).

V. UNPROVEN FACT

The following relevant fact has not been established: 1) That, as a result of the encumbrance created by the protection radius (radio de protección) of the La Pradera spring (naciente), properties registered under numbers 2-540084-000 and 2-540242-000 are rendered entirely incapable of being used by their owner (the case record).

VI. ON THE MERITS

This matter concerns the legal consequences produced by the Municipality of Alajuela’s collection of water from the La Pradera spring for the properties registered in the Real Property Registry (folio real) under numbers 2-540084-000 and 2-540242-000, which are owned by the plaintiff. As has been established, both properties are affected by the spring’s protection radius along the boundary facing the public road toward Rincón Chiquito. According to the claimant, her property right has been deprived of its substance for two reasons: first, because both properties have been left without access to a public road and are landlocked; and second, because they cannot be used for the urban development she intended, as communicated to her in the land-use certificates (certificados de uso de suelo) and in accordance with the conclusions of the court-appointed expert appraisal (pericia judicial); moreover, because the legislature expressly provided in section 31 A of the Ley de Aguas that the 200-meter protection radius around captured springs belongs to the public domain of the Nation (dominio de la Nación).

For the foregoing reasons, she considers herself entitled to due compensation for the frontage strip included within that protection radius and for the remainder of each property, and therefore claims payment of the full price of both parcels as determined by the expert. It is undisputed that the La Pradera spring contains drinking-water intakes that supply nearby communities, infrastructure consolidated by the Municipalidad de Alajuela to provide this essential resource through the municipal aqueduct—an undertaking that has been one of the major concerns of the XX and XXI centuries. National water legislation is a matter of public policy and general interest. Article 4 of the Código de Minería provides that mineral, groundwater, and surface waters are public and that the State holds dominion over and administers this resource. The Asamblea Legislativa first enacted the Ley de Aguas -No. 276 de 27 de agosto de 1942-, Article 41 of which provided that all aqueducts in the country were State property and that new infrastructure of this kind would be operated by the Ministerio de Salubridad Pública, while the administration of municipal aqueducts would remain with local governments until their nationalization was decreed.

The State, however, lacked the capacity to undertake the function contemplated by that law. Consequently, through the Ley General de Agua Potable, No. 1634 de 18 de setiembre de 1953, the planning and construction of water-supply infrastructure were declared to be in the public interest, and regulations were imposed upon administering bodies to ensure that the water was potable. The drinking-water supply crisis persisted, leading to the enactment of the Ley de Creación del Servicio Nacional de Acueductos y Alcantarillados - Ley Nº 2726 del 14 de abril de 1961-, under which that agency assumed responsibility for the drinking-water supply service, as well as the development, use, governance, and oversight of all waters in the public domain (dominio público). That law allowed municipal corporations to remain responsible for local aqueducts as long as they provided efficient service, except where the interested corporations themselves, individually or collectively, expressly requested intervention by the Servicio.

For a time, these provisions coexisted with Article 44 of the former Código Municipal -Ley No. 4574 de 4 de mayo de 1974, hoy derogado, desde la promulgación del actual texto, vigente a partir del 18 de mayo de 1998, Ley No. 7794-, which provided that municipalities were responsible for ensuring the efficient supply of drinking water and disposal of wastewater through aqueduct and sewer systems; this was to be understood as applying to communities that were not, at that time, served by the SNAA. Through Ley Nº 5915 de 12 de julio de 1976, the Sistema Nacional de Acueductos y Alcantarillados was reformed and renamed the Instituto Costarricense de Acueductos y Alcantarillados, which is regarded as the body succeeding to the powers conferred by that law on the State, ministries, and municipalities and is responsible for the direct administration and operation of aqueduct and sewer systems throughout the country, which it would gradually assume based on expediency and resource availability.

It is also responsible for defining protection areas around supply sources, such as springs, which are a natural form of groundwater discharge, while Article 3° of the Ley General de Agua Potable imposes upon it the obligation to select and locate waters intended for the piped-water service.

VII. ON THE RESPONSIBILITY OF THE LOCAL GOVERNMENT

Amid such extensive State intervention to guarantee the efficient provision and supply of water resources, the active and responsible participation of local corporations cannot be overlooked, since the municipality of each canton is responsible for administering “local” services and interests (Article 169 of the Constitution). It follows that their role is predominant, given their obligation to act promptly in exercising police power (poder de policía), safeguarding public order, public health, peace, and personal safety, as well as the moral, political, and economic organization of society, by using the powers granted to them by the legal system to fulfill their mandates. Article 50 of the Constitution establishes environmental protection in two respects: as a fundamental right and as a public function, requiring the State to guarantee, defend, and preserve that right. Municipalities form part of the organization of the Costa Rican State, since their nature as territorially decentralized entities also gives rise to responsibilities concerning environmental protection (in this regard, see judgment number 2001-05737 of the Sala Constitucional, issued at catorce horas cuarenta y un minutos on veintisiete de junio del dos mil uno).

This means that municipalities are responsible for protecting all assets encompassed by the environment, from every natural resource necessary for human existence to scenic beauty. This task includes, above all, oversight of every construction process, because urban growth tends to transform a portion of land into a settlement, constituting a complex process of environmental alteration with a major impact on natural and artificial ecosystems. Most works of this kind compact the land and cover a significant portion of the surface with an impermeable layer, potentially affecting aquifer reserves, increasing runoff, altering natural drainage, increasing the flow of rivers and other watercourses, and eliminating the original landscape. Land-use planning (ordenamiento territorial) encompasses the sustainable use and development of renewable and nonrenewable resources located in the country’s various regions, as well as respect for the cultural, historical, and social characteristics of the human populations involved, with the aim of achieving a balance between human settlements and their environmental conditions.

For that reason, municipalities, as the bodies responsible for administering local interests and services, have been entrusted with all matters concerning the approval of urban-planning regulations, as well as the issuance of subdivision (fraccionamiento) and construction permits, as provided in Article 169 of the Constitución Política (see also Código Municipal, Article 13 subsection o), Ley de Planificación Urbana, Ley de Construcciones, and Ley Orgánica del Ambiente). Articles 15 and 19 of the Ley de Planificación Urbana recognize the authority of each municipality to plan urban development within its territorial boundaries, in accordance with the regulations and regulatory plans (planes reguladores) enacted for that purpose. Every construction project must comply with the applicable urban-planning rules; this entails prior authorization or a “permit,” accompanied by oversight during the performance of the authorized activity to ensure that it is carried out in accordance with the license or permit granted and the environmental regulations governing the activity. This is why the construction process cannot be divorced from the environment in which it takes place, as explained by the Sala Primera de la Corte Suprema de Justicia in judgment N° 000507-F-04:

“the concept of property merges fully and perfectly with the constitutional right to the environment, which the Constitution proclaims with equal force and rank in Article 50. It is therefore not difficult to view urban-planning regulation as occupying an intermediate position between property and the environment, since, ultimately, it is the regulatory and building-oriented counterpart of the latter field. The environment and urban planning thus constitute areas of law that, through their limiting role, define the precise boundaries of the right to property—that is, its essential content.” Public-policy, urban-planning, and environmental regulations specifically require compliance by private parties, because they form part of the content of the right to property insofar as they establish the authorized or lawful scope of its exercise and embody some of the limitations permitted by Article 45 of the Constitution. It is understood that they neither dispossess owners of private property nor deprive them of the primary attribute of ownership; therefore, they give rise neither to compensation nor to expropriation proceedings. Consistent with that interpretation, Article 28 of the Ley de Planificación Urbana states that land development requires a land-use certificate to determine its compatibility with urban-planning regulations:

“Article 28.- It is prohibited to use or devote land, buildings, or structures to any use incompatible with the zoning in force. Henceforth, interested owners must obtain a municipal certificate attesting that the use complies with zoning requirements. Existing nonconforming uses must also be documented by a certificate stating that circumstance.

Each zoning regulation shall establish the date from which such certificates shall be mandatory.” This provision refers to the binding nature of urban-planning regulations (regulaciones urbanísticas) and the requirement that regulated parties (administrados) comply with the rules they impose because they are matters of public policy (orden público). Likewise, article 24 of the Ley de Planificación Urbana provides that zoning regulations (reglamentos de zonificación) must include the designation of land uses, provisions concerning the location, height, and construction area of buildings; the area and dimensions of lots, which directly affects the determination of land density; the size of setbacks (retiros), yards, and other open spaces, and lot coverage by buildings and structures; among other matters. Urban-planning regulation imposes limitations on regulated parties and defines the purposes and uses to which land may be put; local authorities therefore may not depart from its application.

A land-use certificate (certificado de uso de suelo) indeed compares the use intended by its owner with the existing zoning regulations and determines whether or not it complies with them. The theory that it is merely a declaratory act indicating only conformity with the permitted use has been superseded for several years. A land-use certificate is an administrative act (acto administrativo) that, by its nature, directly affects the legal sphere of the regulated party and is therefore capable of producing effects independently, since its content may state the existence of limitations on the exercise of the attributes of the right of ownership, pursuant to the urban-planning regulations and the environmental regime in force, thereby allowing or precluding subsequent decisions by private parties, including investments involving construction or business-license impacts.

VIII. THE SPECIFIC CASE

In the present proceeding, it is undisputed that a portion of both properties lies within the protection radius (radio de protección) of the La Pradera spring (naciente). In this regard, the current Ley Forestal, number 7575 of 13 de febrero de 1996, establishes protection areas (áreas de protección) in its article 33:

“Article 33.- Protection areas. The following are declared protection areas:

  • a)Areas bordering permanent springs, defined within a radius of one hundred meters measured horizontally...” And article 34 of the Ley Forestal adds:

“Article 34.- Prohibition against cutting in protected areas. The cutting or removal of trees in the protection areas described in the preceding article is prohibited, except in projects declared by the Poder Ejecutivo to be of national interest (conveniencia nacional). The boundary alignments (alineamientos) that must be processed in connection with these areas shall be carried out by the Instituto Nacional de Vivienda y Urbanismo.” The encumbrance (afectación) established in section 33 of the Ley Forestal is generally applicable, since it reflects the need to preserve the one-hundred-meter radius around every spring in order to conserve groundwater sources, which depend on the physical factors of the land (soil texture and its components, namely roots, sand, silt, and clay), as well as its chemical and biotic factors, the alteration of which by humans may lead to soil degradation and an increase in desert areas.

This limitation implicitly restricts the exercise of any other ownership powers (facultades dominicales) that could degrade the natural condition of springs, which obviously includes restricting the right to build on the land. Accordingly, these provisions prevail over any regulations contained in local or national rules. These regulations establish a legal presumption (presunción legal) of the land’s vulnerability arising from an entirely preventive intent, seeking to preserve the area surrounding a spring and prevent any human alteration of soil that has been declared protected. Such restrictions are matters of public policy and prevail over any individual interest; consequently, they must be borne by every owner whose land is affected by a spring’s protection radius, insofar as this is a public-policy limitation authorized under constitutional section 45. In the present proceeding, however, when initially issuing the land-use certificates, the municipal government applied section 31 of the Ley de Aguas, which reads as follows:

“Article 31.- The following are declared a public-domain reserve (reserva de dominio) in favor of the Nation:

  • a)Lands surrounding potable-water collection sites or water-supply intakes, within a perimeter having a radius of no less than two hundred meters; ...” For his part, when issuing his decision, the Mayor—without addressing the scope of the provision transcribed above and applied in the land-use certificates—denied the appeal (alzada) pursuant to the Plan Regulador del Cantón de Alajuela, which provides, in relevant part, as follows:

“Article 43. ABSOLUTE RESERVE SUBZONE FOR SPRINGS AND THEIR FLOW AREA.

The areas where springs and their flow areas are located are absolute reserves, in which construction shall not be permitted; these zones are indicated on the Zoning Map. For all tapped and untapped, identified and unidentified springs, with or without a hydrological study, a protection radius of 200 meters around the springs is designated, in addition to the flow area, in categories 1 and 2...” The theory advanced by the plaintiff is that the Municipality and the State, through the cited article 31, have deprived its right of ownership of its substance: first, with respect to the strips affected by the spring’s 200 m protection radius; and second, as a consequence of the foregoing, because of the encumbrance and serious harm suffered by the remainder of both properties, since it cannot use them for the urban purpose for which it intended them because they have been left without access to a public road.

If section 31 of the Ley de Aguas is read in isolation, it may be interpreted to mean that the entirety of the protection radius of a tapped spring (naciente captada) becomes part of the public domain (demanio público), and the subject matter of this proceeding is essentially based on that understanding. The Municipality’s defense has rejected that argument because it considers these to be limitations on private property that must be borne by the owners of the affected properties. The State, in turn, maintains that the designation of these lands as part of the public domain (demanialidad) occurred with the enactment of the Ley General sobre Terrenos Baldíos in 1939, the Ley General de Aguas in 1942, and the Ley de Tierras y Colonización in 1961, all of which predate the Plaintiff’s purchase of the land in 2016, thereby rebutting the procedural good faith (buena fe procesal) upon which the plaintiff might rely in claiming damages.

On this point, in a relatively recent matter concerning the degree to which private property within the protection radius of a tapped spring is affected, the Sala Primera de la Corte, in decision Nº 04155 – 2019 at 14:40 on 28 de noviembre del 2019, held that this constitutes a genuine limitation on the right of ownership insofar as it does not deprive that right of its attributes. In this regard, despite the length of the quotation, the statement of the High Court warrants transcription:

“V. Article 45 of the Political Constitution states that property is inviolable and that no one may be deprived of it except for a legally established public interest, subject to prior compensation (indemnización) in accordance with the law. Only on grounds of public necessity may the Legislative Assembly, by a vote of two-thirds of its entire membership, impose public-interest restrictions (limitaciones de interés social) on property. Although our constitutional system recognizes the right to private property (derecho a la propiedad privada), that concept has evolved and cannot be regarded as unlimited and exclusive or as being free from restrictions. Indeed, the concept of private property has undergone transformations, yielding to the concept of property as a social function (propiedad-función), which was adopted by the Constituent Assembly in the second paragraph of Article 45 of the Constitution, under which every individual has an obligation to fulfill certain duties toward the community; accordingly, the right of ownership is not unrestricted and is subject to public-interest restrictions established by the legislature through an enhanced majority, which are not compensable because they do not entail expropriation (expropiación).

The provisions contained in Article 45 of the Constitution are violated when a public-interest restriction is not general in nature and when the degree of impairment prevents the owner from exercising the attributes of the right of ownership, depriving it of its substance, so that it ceases to be a reasonable restriction and becomes a true expropriation, in which case a duty to provide compensation arises. (See, to this effect, Constitutional Chamber decisions No. 5097-93, 2345-96, 9779-2002). Regarding the nature of restrictions on the right to private property for the protection of the environment, the Constitutional Chamber of the Supreme Court of Justice, in decisions 5833-2002 and 2004-1923-2004, cited in judgment No. 573-2005 issued by the Second Section of this Court at 11:20 on November 25, 2005, in the ordinary proceeding brought by the plaintiffs against Municipalidad de Santa Bárbara de Heredia, determined that, given the characteristics of contamination of aquifers (mantos acuíferos) intended for public supply and the difficulty of restoring them, measures to prevent contamination must be preventive and protective, through the prohibition of certain human activities in specified areas or by requiring safety measures for certain potentially polluting activities.

These administrative measures entail various restrictions and controls on water uses or exploitation and on preexisting activities that may affect the resource, insofar as they are justified by a public interest, and therefore do not affect the right of ownership or the integrity of the estate. In the Court’s view, such measures must be regarded as public-interest restrictions that neither deprive the right of ownership of its substance nor expand the public domain over groundwater without prior compensation; rather, they shape its essential content and must therefore be borne as a general sacrifice or burden. As stated in the cited judgment, one of the most innovative instruments for protecting water resources is the establishment of protective perimeters (perímetros de protección) for the conservation of the resource and its surroundings, in order to preserve the quality and quantity of the water, as well as the geological formation known as an aquifer.

Thus, Article 31 of the Ley de Aguas declares as a reserved domain in favor of the Nation the lands surrounding potable-water collection sites or intake points, within a perimeter having a radius of no less than two hundred meters; and the forest zone that protects or is intended to protect all lands where potable-water infiltration occurs, as well as those containing watersheds and reservoir banks, supply sources, or the permanent course of those same waters. In this case, for the reasons set forth below, the plaintiffs have not demonstrated through suitable evidence that, given the nature of the property, the restrictions established in Article 31 of the Ley de Aguas impair the right of ownership to such an extent as to prevent the exercise of the attributes inherent in that right. Consequently, the action brought cannot succeed, and the lower-court judgment must be reversed.

VI.The plaintiffs have not submitted evidence into the record that would make it possible to determine with certainty that the restriction contained in Article 31 of the Ley de Aguas is of such a degree as to prevent any use whatsoever of the property, which is allegedly devoid of all market value and therefore withdrawn from commerce. Likewise, the plaintiffs have not demonstrated that they have been unable to use the property, that their rights of enjoyment and possession have been affected, or that the existence of the protective area (área de protección) for the spring (naciente) located on the property renders it entirely unusable for the purposes sought by the plaintiffs. The expert report submitted in the proceedings (folios 274 to 276) merely stated that the area affected by the water intake, extending 200 meters from the spring, covers approximately 88% of the land in total (8.488.33 square meters), leaving a usable remainder of 12% (1.157.50 square meters), and that the soil is normal and the area is classified as agricultural-semi-urban.

Although the expert report shows that a significant percentage of the property is affected, the plaintiffs have not submitted suitable evidence into the record that would make it possible to determine that the degree to which the property is affected, given its nature (land-use conformity certificate (certificado de uso conforme del suelo)), restricts the exercise of the attributes of ownership. Nor have they demonstrated—apart from their own assertions—the impossibility allegedly created by the restriction with respect to selling or mortgaging the property. As the Constitutional Chamber has determined, proof of those requirements is essential in order to establish that their right of ownership has been deprived of its substance, which is indispensable for an obligation to compensate for the value of the property through expropriation proceedings (proceso expropiatorio) to arise. For the foregoing reasons, the claims asserted in the action seeking a determination of an obligation to compensate for the value of the property or an obligation to commence expropriation procedures are unfounded.

VII.As stated by the representative of the defendant, the provisions cited by the claimants as the basis of their action do not impose upon that entity an obligation to acquire properties surrounding aquifer protective areas that, as in this case, are intended to supply potable water to the population of Santa Bárbara de Heredia. Although Article 31 of the Ley de Aguas declares as a reserved domain in favor of the Nation the lands surrounding potable-water collection sites or intake points, within a perimeter having a radius of no less than two hundred meters, that provision does not mandatorily require the defendant entity to acquire properties or commence expropriation proceedings concerning properties affected by that restriction. Likewise, the provisions contained in subsections f), g), and h) of Article 2 of the Ley Orgánica del Instituto Costarricense de Acueductos y Alcantarillados No. 2726 of April 14, 1961, amended by Ley No. 5915 of July 12, 1976, cited as the basis of the action, do not establish such an obligation.

Those provisions establish that said Institution has exclusive responsibility for oversight, advisory services, supervision, and governance concerning the administration, proper operation, and supply of potable water, but not an obligation to acquire the properties and infrastructure of other entities that administer aqueducts, such as Municipalidad de Santa Bárbara de Heredia in the present case. Although the defendant entity must enforce the Ley General de Agua Potable and is deemed the body succeeding the ministries and Municipalities, the law does not impose upon it a duty to directly administer and operate aqueduct and sewerage systems throughout the country; those systems are to be assumed progressively, taking convenience and the availability of resources into account. The provisions under discussion state that systems currently administered and operated by municipal corporations may remain under their responsibility for as long as they provide efficient service.

In the same vein, although the provision contained in Article 22 of the cited Law establishes jurisdiction over the conservation, expansion, and management required for maintaining the areas surrounding water sources, that provision likewise does not establish a legal obligation to acquire the protective areas established in Article 31 of the Ley de Aguas. Accordingly, none of the legal provisions cited as the basis of the action can support a judicial determination that the defendant Instituto is obligated to acquire the property owned by the plaintiffs because of the existence of a spring or the restrictions applicable within the protective areas of such sources, as the claimants seek; therefore, the action brought on this basis cannot succeed.”

As can be seen, the First Chamber considers that Article 31 cited above establishes a true restriction on the right to private property, with respect to which the administrative authority that performs the engineering works necessary to collect the water is not compelled to purchase, acquire, or even expropriate the land serving as the spring’s protective buffer strip (franja protectora). This is reasonable because, given the liberal character of our Political Constitution, proper compensation is warranted only when the right is deprived of its substance. It is therefore logical and reasonable for the owner to bear the public-order restrictions (limitaciones de orden público) intended to provide sufficient, proper, and adequate protection to the sources from which water resources intended for human consumption are obtained. Based on this reasoning, we must understand that the protective radius (radio de protección) of the La Pradera spring, within which the plaintiffs’ properties are located, constitutes a public-order restriction that takes precedence over the owner’s interests, such that the authority to build (facultad edilicia) inherent in the right of real-property ownership cannot, in fact, be exercised within that strip of land. The plaintiff must bear those restrictions because they form part of its right, which, as has repeatedly been stated, is not unlimited.

IX.Following the same reasoning expressed by the First Chamber, the only way compensation could be ordered for the area corresponding to the spring protection radius (radio protección de la naciente), as well as for the remainder of the properties, would be if evidence suitable for that purpose demonstrated that the restrictions are of such magnitude that they prevent the exercise of all attributes of the right of ownership, understood as the ius utendi (the right to use the thing), the ius fruendi (the right to receive the fruits or benefits of the thing), and the ius abutendi (the right to dispose of the thing). The ius utendi refers to the owner’s right to use the thing as the owner sees fit, in accordance with the owner’s interests but within its social function, subject to the limitations imposed by law and the prohibition against causing harm to others; the ius fruendi allows the owner to benefit from the fruits generated directly or indirectly by the thing, or remaining after its use; and the ius abutendi allows the owner to dispose of it as desired, whether by destroying, transferring, abandoning, or leasing it, provided that this does not contravene its social function or violate the rights of third parties or the law.

In the present case, through official letter No. MA-PPCI-0207-2014, the Municipalidad de Alajuela, signed by Mr. Roy Delgado Alpízar, informed the plaintiff, at its request, of the restrictions affecting property 2-0099659-000—which was the property that was subdivided and gave rise to property registration 2-540242-000—stating that “no type of construction is permitted, including access roads and surface or underground infrastructure works. These are absolute reserve areas designated for the protection of water resources through the elimination of any potential impact caused by construction within these areas. In this regard, it is clear that access to a potential real-estate project or a project of any other kind may not fall within the spring protection area affecting the property at issue; as a consequence of the restriction encumbering this property, because its frontage on the public road is limited precisely with respect to access, any project intended to be developed there will consequently be limited to a similar extent, since motor vehicles will not be able to travel into the property.” That document warrants the twofold analysis explained below.

First, restrictions on real property are defined through the application of the urban-planning regulatory framework in the respective land-use certificate (certificado de uso de suelo) issued by each municipal government for each property, as provided in articles 15 and 28 of the Ley de Planificación Urbana. It should be noted that the land-use certificates issued for the properties in dispute did not impose any such impediments whatsoever on the use of the properties; therefore, that official letter does not apply to them, and the scope attributed to that document was erroneous. Second, in this Chamber’s view, what was stated therein was nothing more than an erroneous interpretation by the municipal official regarding the scope of the restrictions affecting the property, from which it would appear that he considered the protection zone (zona de protección) to entail a kind of inaccessibility to the protected area, leaving the property without any means of entry.

That assertion is entirely incorrect because it lacks a regulatory basis, since protection of the spring must be based on technically and scientifically sound grounds, while taking into account that engineering systems currently exist that allow works to be implemented with zero or virtually no environmental impact. Precisely for that reason, nine years after issuing that official letter, the official himself testified at the oral and public trial that it is indeed possible to build a permeable road with an adequate water-drainage system. That document undoubtedly misled the plaintiff, which erroneously extended its effects to the subdivided properties, understanding that, despite having obtained favorable land-use certificates, it was still barred from any possibility of vehicular access; this was a genuine error by the municipal authority. It must be noted that the restrictions on this strip of land must be aimed at protecting the water-intake source, but vehicular access cannot therefore be denied in the terms expressed by the municipal government, because the “domain of the Nation,” under section 31 of the Ley de Aguas, together with the restrictions under section 43 of the Zoning Plan (Plan Regulador), merely subject that strip to a prohibition on construction and in no way prevent access by persons and/or vehicular traffic.

It must not be overlooked that the La Pradera spring is not located within the properties, but rather at a distance ranging from 70 to 80 meters across the public road, thereby showing that the area has been affected by works carried out by the Municipalidad itself, which does not even require access to the plaintiff’s land in any manner whatsoever. Under a correct interpretation of the existing regulations, these are restrictions consistent with constitutional section 45, which the plaintiff must bear insofar as its properties are near the spring used to collect and distribute water; accordingly, it must refrain from carrying out construction that affects the land and endangers the water-intake source. This means that the plaintiff retains its two properties in their entirety, since none of their frontage strips has been incorporated into the public domain (demanio público); it has vehicular access to them and may indeed carry out works providing such access, on the understanding that the required studies and authorizations must first be obtained, that the works must have minimal impact, must not render the land impermeable, and must allow adequate stormwater drainage.

The remainder of both properties may be used in accordance with the land-use certificates, which are genuine administrative acts (actos administrativos) conferring subjective rights (derechos subjetivos), and may be devoted to urban-development use because the area is zoned for medium-density residential use, with lots of 300 m2, a minimum frontage of 12,5, and 50% coverage, should the plaintiff so choose, as witness Roy Delgado Alpízar testified. Based on the foregoing, it may be concluded that no damage whatsoever exists with respect to the two properties, since it bears repeating that official letter MA-PPCI-0207-2014 was addressed to the parent property, not to the properties that are currently the subject of these proceedings, and contained a serious technical error because it left the parent property without access. That document undoubtedly caused the plaintiff confusion and considerable distress, leading it to believe that properties 2-540242-000 and 2-540084-000, affected by the spring, were subject to the same prohibition on road construction and vehicular access, which is incorrect.

It should be noted that land-use certificates Nos. MA-ACC-04496-2017 and MA-ACC-04497-2017, this time addressed to those two properties, did not impose such a burdensome restriction and referred only to the prohibition on construction at the site. Those certificates remain valid and effective because they became final upon review through an improper hierarchical appeal (alzada de jerarquía impropia) by this same Third Section, although differently constituted, which upheld the decision of the local highest authority in resolution number 390- 2019 of 8:00 h 30 minutos del 31 de julio del 2019. It must therefore be emphasized that those strips of land affected by the spring protection radius have not been incorporated into the public domain, nor can it be asserted that the right of ownership has been stripped of its substance with respect to any portion of the properties. The protective strip (franja protectora) must be subject to the construction prohibitions, but it cannot therefore be concluded that the plaintiff company has lost that area of land for the benefit of the community.

There is no evidence from which it may be concluded that the land is unavailable for disposition, that it has been removed from private commerce, or that it is not capable of transformation, transfer, and use, always on the understanding that the statutory restrictions must be respected. Regarding the remainder of the properties, this Chamber concludes that, in presenting its theory of the case, the plaintiff proceeds from the mistaken premise that the lack of access prevents it from using the land for urban development. As already explained, its frontage on the public road remains intact and, accordingly, it may develop the land in the manner permitted by the applicable urban-planning regulations, should it so choose, while respecting the frontage designated as a protection zone; this may be perfectly and eventually reconciled with the percentage of green areas required for any urban development under section 40 of the Ley de Planificación Urbana.

On that basis, this Chamber departs from the conclusions reached by expert José Esteban Vásquez Barquero, because both his report and his testimony at the oral trial proceed from the mistaken premise that both properties lost their boundary frontage on the public road through incorporation into the public domain. It is noted that determining the nature of that strip of land was not the expert’s responsibility, since that evidence offered by the plaintiff was intended to value the land for purposes of obtaining the compensation sought. Indeed, a reading of article 43 of the Plan Regulador de Alajuela shows that the medium-density residential subzone (outside the beltway) does not restrict land use to residential purposes, since it may also be used for small-scale commercial activities under the terms regulated by Anexo 2 of that body of regulations. Based on the foregoing, it may be concluded that the defendant municipal government is correct in defending the existence of the restrictions arising from the rules cited above, without the right of ownership having been stripped of its substance.

Under this reasoning, the defense of lack of legal right (falta de derecho) raised by the municipality must be sustained, because the legal analysis set forth in the complaint, in light of the events that occurred, is inconsistent with the legal system. Nevertheless, the objection based on lack of standing to be sued (falta de legitimación ad causam pasiva) must be rejected insofar as the municipal government’s actions caused the plaintiff to file this lawsuit. Accordingly, neither the compensation nor the expropriation sought by Incubadora Costarricense S.R.L. is warranted, insofar as the right of ownership has not been stripped of its substance; we are dealing with the occurrence of damage caused by the municipality, nor by the State in its legislative function, but rather with genuine, legitimate restrictions on the right of ownership for reasons of evident public interest, which are not compensable.

This requires declaring all the claims asserted in the complaint inadmissible for lack of legal basis. This Chamber does not agree with the defense argument presented by the representative of the Procuraduría General de la República because, it bears repeating, this is not a case involving public-domain status (demanialidad); therefore, the arguments developed in support of its defense of lack of legal right must be rejected.

The objection of lack of standing to be sued on the merits (falta de legitimación ad causam pasiva) must meet the same fate, since the literal wording of Article 31 of the Ley de Aguas, read in isolation, may well lead to arguments concerning the public-domain status (demanialidad) of property affected by protection strips (franjas de protección) around developed springs (nacientes captadas), as the plaintiff argued. The fact remains, however, that this would entail payment of the value of the land if and only if those restrictions deprive the property right of all content. In view of the foregoing, it is unnecessary to analyze the remainder of the State’s defense. In the absence of any damage, no limitation period (prescripción) applies to a claim for compensation either, since the State’s argument rests on the assumption that the lands are in the public domain and, as explained, they are not; the State’s defense in that regard must therefore be rejected. The action must be dismissed in its entirety, as is hereby ordered.

X. COSTS

Pursuant to section 193 of the Code of Administrative Procedure (Código Procesal Contencioso Administrativo), procedural costs and attorney’s fees (costas procesales y personales) are imposed upon the losing party by virtue of having lost, unless, in the Court’s judgment, there was sufficient cause to litigate or the judgment was rendered on the basis of evidence whose existence was unknown to the opposing party. In this case, this Chamber finds that the literal wording of Article 31 of the Water Law (Ley de Aguas), together with the actions of the municipality, caused uncertainty regarding the limits on the attributes of the claimant’s property rights, as she was informed that she had no vehicular access to her properties and came to believe that she had been deprived of all her assets. From this perspective, this Chamber finds that it was essential for her to appear before this court to clarify that issue. Although unsuccessful with respect to the compensation sought, she is now aware of the scope of the restriction imposed on both properties, which remain entirely her property. Therefore, despite being the losing party, she must be exempted from paying both categories of costs, insofar as there was sufficient cause to litigate.

POR TANTO

The defenses of statute of limitations (prescripción) and lack of standing as a defendant (falta de legitimación ad causam pasiva) raised by the defendants are denied. The defense of failure to state a legal right (falta de derecho) raised by the State is rejected, and the defense of failure to state a legal right raised by the Municipalidad de Alajuela is upheld. On the merits, the complaint filed by Incubadora Costarricense S.R.L. is dismissed in its entirety, but the claimant is exempted from paying both categories of costs. EL ESTADO Nº N° 2023005687 TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN TERCERA, SEGUNDO CIRCUITO JUDICIAL, SAN JOSÉ, GOICOECHEA, a las once horas con cincuenta y cinco minutos del ventitres de Noviembre del dos mil ventitres.- Proceso de conocimiento interpuesto por Incubadora Costarricense S.R.L., cédula de persona jurídica 3 102-10054, representada por su apoderado especial judicial el licenciado Manuel Emilio Ramírez Castro, carnet de abogado número 2032, contra la Municipalidad de Alajuela, representada por la licenciada Johanna Barrantes León y contra el Estado, representado por la Procuradora Gloria Solano Martínez.

CONSIDERANDO

I.Argumentos de la demanda. La sociedad accionante es propietaria de dos fincas con matrícula de folio real respectivamente. Indica que la municipalidad de Alajuela hizo uso de una naciente cercana a las fincas con toma de agua para consumo humano, cuyo radio de 200 metros abarcó una franja de más de 10.000 m2 entre ambas fincas, los cuales pasaron a ser reserva de dominio a favor de la Nación, conforme lo dispone el artículo 31 de la Ley de Aguas, según le fue comunicado en los certificados de uso de suelo de ambas propiedades. Agrega que ello provocó qué los restos remanentes quedaran sin acceso a calle pública, quedando una de las fincas totalmente enclavada y la otra con un frente insuficiente que la inutiliza totalmente para desarrollos, conforme a su finalidad natural de fraccionamiento urbano. Considera que la Municipalidad de Alajuela, sin previa indemnización, le cercenó y despojó de su derecho de propiedad, se perdieron las opciones de desarrollo inmobiliario que podía llevar a cabo en esas fincas, en atropello de su derecho de propiedad, de la seguridad jurídica y del principio de legalidad.

Estima adicionalmente que hay responsabilidad civil objetiva del Estado Legislador, lo que le hace merecedora de la reparación de los daños ocasionados, los cuales se estima en la suma de 50.000.000 de colones, sin perjuicio de lo que arrojen las pericias qué se hicieren sobre el valor de los inmuebles (imagen 32). Por tales motivos, plantea como pretensiones las siguientes:

“A- PETICIÓN PRINCIPAL Primero: Que se ordenen y dispongan en sentencia las expropiaciones de las áreas que, de conformidad del artículo 31 inciso a) de la Ley de Aguas y/o por la afectación de la reserva de Área de Flujo prevista en el artículo 43 del Plan Regulador Urbano del Cantón Central de Alajuela, conforman la Reserva de Dominio en favor de la Nación dispuesta en las fincas propiedad de la demandante inscritas a los Folios Reales, números folio real 2-540242-000 y 2-540084-000 y a que se han afectado por parte la Administración Pública y, se pide en consecuencia con ello que, siendo que estas expropiaciones –las de las áreas de reserva- producen además una afectación y disfunción absoluta en los restos remanentes de esos inmuebles, se ordene y disponga en sentencia entonces que la expropiación e indemnización sea del total de las áreas que conforman los referidos inmuebles, inscritos como se indicó, a los números folio real 2-540242-000 y 2-540084-000, todo de conformidad con el artículo 17 de la Ley de Expropiaciones.- Segundo Se pide que las expropiaciones que se dispongan en esta sentencia lo sean por cuenta y en interés de la Municipalidad de Alajuela que es la autora material de las conductas que ha propiciado la creación de las áreas de reserva.

Tercero Que se disponga además en razón de lo resuelto que los inmuebles expropiados, cuya adquisición fue necesaria para la cumplir con las disposiciones legales del artículo 31 de la Ley de Aguas y/u otros, se refiere en concreto, a los que tienen las siguientes características: a) El inmueble inscrito folio real 2-540242-000, y que tiene, según plano catastrado A-1883487-2016, un área de cincuenta y seis mil setecientos noventa y ocho metros cuadrados y que tiene además estas otras características, naturaleza: terreno para construir, situada en el distrito Guácima del Cantón Primero de la Provincia de Alajuela y que linda al norte con calle a Rincón Chiquito y con Incubadora Costarricense S.R.L. Sur: calle publica, ruta nacional 27 Este: Incubadora Costarricense S.R.L Oeste : Agropecuaria Mis Dos Hijas S.A. b) El inmueble inscrito folio real 2-540084-000 el que tiene según plano catastrado A-1883364- 2016 un área de cuarenta y nueve mil doscientos siete metros cuadrados y que tiene además estas características, naturaleza: terreno para construir, situada en el distrito Guácima del Cantón Primero de la Provincia de Alajuela y que linda al norte con calle publica con 79.82 metros. Sur: calle publica, ruta nacional 27 Este, Luz, Virginia, Aurea y Lili, todas Lara Ocampo Oeste: Incubadora Costarricense SRL.

Cuarto: Que la condena que se hace a la Municipalidad de Alajuela al pago de la indemnización que por los daños patrimoniales que le son irrogados en el patrimonio de la aquí demandante, deberá ordenársele hacerla mediante el pago en dinero efectivo y por medio de depósito que deberá realizarse en la cuenta bancaria del Tribunal asignada a este expediente en el monto que, a título de justiprecio, disponga este tribunal a partir de las pericias de valor recibir que como prueba, para tal fin, se piden y ofrecen por esta representación y cuyo monto total, si lo estima pertinente el tribunal, será desglosado en la sentencia en las partidas que la pericia de valor refieran.

Quinto De igual forma se pide ordenar en la sentencia que, a título de indemnización de los perjuicios ocasionados, la Municipalidad de Alajuela deberá ser condenada al pago de intereses que sobre la suma de indemnización total que por los daños se fije, según se dispone en el artículo 11 de la Ley de Expropiaciones, sean éstos los que hayan corrido desde el momento de la desposesión hasta la fecha del efectivo pago y al tipo de la tasa legal.- Por ello y para esos efectos, se pide establecer como fecha de desposesión el día 30 de mayo del año dos mil diecisiete, toda vez que esa es la fecha en que se materializó sobre los inmuebles la limitación de derecho reserva de dominio en favor de la Nación mediante la comunicación que hiciera la Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela en los correspondientes certificados de uso de suelo contenidos en los Oficios MA-ACC-04496-2017 y MA-ACC-04497-2017 y que son ambos de esa fecha, 30 mayo de 2017, la que representa por ello el inicio efectivo de las afectación de las fincas a la creada demanialidad.

Sexto: Dispóngase además en sentencia, que las fincas expropiadas sean destinadas al dominio público que en favor de la Nación que establece el artículo 31 inciso 1) de la Ley de Aguas y ordénese inscribirlas a nombre de la expropiante libres de gravámenes, limitaciones y anotaciones, para lo que se dispondrá que, una vez que la sentencia que se dicte adquiera firmeza, quedará autorizada a la Notaría del ente público que se disponga, con el fin de que se realice la protocolización de piezas correspondiente para la debida inscripción registral de lo expropiado a nombre del expropiante.- Deberá asimismo disponerse que el Registro Nacional queda obligado a cancelar todas las anotaciones, las exacciones y los gravámenes que pesen sobre los bien expropiados, con fundamento en la escritura de protocolización de piezas, sin necesidad de ningún otro trámite y, asimismo se ordenará en sentencia, que todos los gastos que eventualmente requiera dicho tramites registrales son a cargo del expropiante.- Además deberá ordenarse a que vez que la sentencia adquiera firmeza, deberá notificarse a la Dirección General de Tributación y a la Municipalidad de Alajuela para las determinaciones que relación a los impuestos nacionales o municipales corresponda tomar, conforme a la ley.

Sétimo: : Pido, en forma alternativa, que todas las obligaciones que en esta Petición Principal se piden que sean impuestas a cargo de la Municipalidad de Alajuela que, en el caso de que no sean concedidas contra dicha Municipalidad en razón de considerar el Tribunal de que estas conductas son asumidas por ella solo en razón de la Legislación vigente y que por tanto esa responsabilidad es imputable al Estado en tanto Estado Legislador, se tengan entonces los extremos petitorios primero, segundo, tercero, cuarto, quinto, y sexto deducidos y solicitados, para el caso dicho, contra el Estado, de manera que se ordenen entonces a cargo y en contra de éste, y que sea el Estado entonces, al que se le condene a indemnizar a la demandante y al que se transfieran en dominio las áreas expropiadas.

B.- PETITORIA SUBSIDIARIA PRIMERA:

Para que, en caso de que de la Petitoria Principal anterior, sea bajo la consideración que sea, no se conceda el extremo de la petición primera en que pide se ordene la expropiación del total de la finca inscrita a los Folio Real número 2-540084-000, que conforme al artículo 17 de la Ley de Expropiaciones se ha pedido, y desestime el Tribunal la indicada pretensión, subsidiariamente entonces pido que, con fundamento la doctrina que significa el pensar del Profesor Eduardo Ortiz Ortiz que sobre el tema dice ; "El sacrificio del derecho patrimonial o, como lo llama nuestra Constitución, su "privación, es el correlato del contenido constitucional garantizado de ese derecho: es toda intervención pública, legislativa o administrativa, general o singular, que suprima o disminuya equivalentemente, sin nombrarlas, las potestades de gozo y de disposición del bien, en forma tal que el propietario , aunque no deje de serlo y aunque no se transfiera a nadie su derecho, quede imposibilitado, jurídica o materialmente, para obtener del bien una utilidad suficiente que justifique tener y mantener su titularidad y/o su posesión..." (E, ORTIZ ORTIZ; Expropiación y responsabilidad, públicas, p. 144) pido se disponga entonces en sentencia en relación a la afectación de a esa finca inscrita a los Folio Real número 2-540084-000, lo siguiente:

Primera.- Que se declare, que la creación por parte de la Municipalidad de Alajuela del área de reserva de dominio que en favor de la Nación sobre a la que le habilita el artículo 31 de la Ley de Aguas, comportan y generan una expropiación del área que conforma esa reserva de dominio y deberá ordenarse por ello su indemnización de la demandante en sentencia en razón de la pérdida patrimonial que ello representa, y que además también deberá declararse responsabilidad civil por el daño indemnizable en favor de su dueño Incubadora Costarricense S.R.L. causado por la disfunción parcial del área del resto remanente de esa finca.

Segunda: Que entonces, se declare que la lesión a indemnizar consiste en concretamente en: a) la pérdida parcial del área de terreno que el inmueble referido sufre al ser destinado a reserva de dominio y, b) por los daños que la afectación y disfunción que esa pérdida produce adicionalmente en el resto remanente, por producirse un daño al remanente por el vaciamiento parcial de derechos de propiedad por quedar esta finca, entre otras limitaciones, sin acceso adecuado e insuficiente desde calle publica para ser desarrollada tal cual es su vocación y su uso autorizado.- Tercera: Que se declare, en consecuencia con lo anterior, que la indemnización que pido sea ordenada pagar a la Municipalidad de Alajuela por los daños ocasionados a la finca inscrita a los Folio Real número 2-540084-000 sea en dinero efectivo y mediante deposito que deberá hacerse en la cuenta bancaria del Tribunal asignada a este expediente en el monto que, a título de justiprecio, disponga este tribunal a partir de las pericias de valor que al efecto se piden recibir en el proceso para tal fin y cuyo monto total, si así lo estima pertinente el tribunal, será desglosado en la sentencia en las partidas que la pericia de valor refieran.- Cuarta: Pido que la expropiación que se ordene en sentencia que sea dispuesta a cargo y por cuenta de la Municipalidad de Alajuela, sea ordenada entonces en concreto con los siguientes alcances, contenidos y extremos indemnizatorios:

  • a)Se deberá disponer la expropiación del área de reserva creada sobre el inmueble que es de matrícula 2-540084-000, por los actos de la Municipalidad de Alajuela tienen por dispuesta la existencia de una reserva de dominio a favor del Estado, reserva de dominio que mide 3.276 metros cuadrados o bien se expropiara la medida del área que resulte ser en definitiva la que se termine a partir de las pruebas que en ese sentido puedan recibirse en este juicio.
  • b)Se deberá disponer de igual manera el pago del monto de la indemnización por los daños causados al área del resto remante del inmueble que es de matrícula 2-540084-000, ya que, a pesar no quedar sujeto a reserva de dominio, las condiciones topográficas en que queda, afectan su valor comercial por limitársele y hacérsele menos atractivo comercialmente, así como por hacer más oneroso su desarrollo y explotación comercial según los fines urbanos autorizados.

Quinta: Que se disponga en consecuencia de lo ya concedido, que el área expropiada y cuya expropiación es necesaria para la cumplir con las disposiciones legales del artículo 31 de la Ley de Aguas y/u otros, es el área que tiene las siguientes características: El área de reserva expropiada es parte a segregar del inmueble inscrito folio real 2-540084-000 el que tiene según plano al efecto elaborado registrado al folio 30 del Protocolo 21142 del Perito Topógrafo Rubén Cubero Martínez, topógrafo colegiado número TA5613 presentado a trámite de inscripción al Catastro del Registro Nacional según CITAS DE PRESENTACION 2019 - 96416 – C un área que mide 3.276 metros cuadrados y que tiene además estas otras características: naturaleza: terreno destinado a reserva de dominio a favor de la nación de conformidad con el artículo 31 de la Ley de Aguas, situada en el distrito Guácima del Cantón Primero de la Provincia de Alajuela y que linda al norte con calle publica con 79.82 metros.

Sur: Incubadora Costarricense S.R.L Este, Luz, Virginia, Aurea y Lili, todas Lara Ocampo Oeste: Incubadora Costarricense SRL.- Sexto: De igual forma se pide ordenar en la sentencia que a título de indemnización de los perjuicios ocasionados, la Municipalidad de Alajuela deberá ser condenada al pago de intereses que sobre la suma de indemnización total que por los daños se fije, los que según se dispone en el artículo 11 de la Ley de Expropiaciones, serán al tipo de la tasa legal y que hayan corrido desde el momento de la desposesión hasta la fecha del efectivo pago.- Por ello, y para esos efectos, se pide además establecer como fecha de desposesión el día 30 de mayo del año dos mil diecisiete, toda vez que esa es la fecha en que se materializó sobre el inmueble la limitación de derecho reserva de dominio en favor de la Nación mediante la comunicación que hiciera la Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela en el correspondiente certificado de uso de suelo contenido en el Oficios MA-ACC-04496-2017 y que es de esa fecha, 30 mayo de 2017 que representa el inicio efectivo de las afectación de la finca a la creada demanialidad.- Sétimo: Dispóngase además en sentencia, que lo expropiado sea destinado al dominio público en favor de la Nación que dispone el artículo 31 inciso 1) de la Ley de Aguas, y ordénese segregar e inscribir el área de reserva expropiada a nombre de la expropiante libre de gravámenes, limitaciones y anotaciones, para lo que se dispondrá que una vez que la sentencia que se dicte adquiera, quedará autorizada la Notaria del ente público que se disponga, con el fin de que se realice la protocolización de piezas correspondiente para la debida inscripción registral de lo expropiado a su nombre.- Deberá asimismo disponerse que el Registro Nacional queda obligado a cancelar todas las anotaciones, las exacciones y los gravámenes que pesen sobre los bien expropiados, con fundamento en la escritura de protocolización de piezas, sin necesidad de ningún otro trámite, siendo, y asimismo se dispondrá en sentencia, que todos los gastos que eventualmente requiera dicho tramites registrales son a cargo del expropiante.- Asimismo deberá ordenarse a que vez que la sentencia adquiera firmeza, deberá notificarse a la Dirección General de Tributación y a la Municipalidad de Alajuela para las determinaciones que relación a los impuestos nacionales o municipales, corresponda tomar conforme a la ley.

Octavo: Se pide también que, en igual forma, para el caso de que tampoco fuere ordenada en la Petitoria Principal la expropiación del área completa de la otra finca 2-540242-000, todos los extremos petitorios contenidos en esta Petitoria Subsidiaria Primera sean tenidos por propuestos en idénticas condiciones y alcances también en relación con la indemnización que debe hacerse por la afectación esa finca número 2-540242-000, y así ordenar a la demandada a indemnizar los daños que a ella se causan por la pérdida parcial de área de esa finca y por su daño al remanente; indemnización que deberá hacerse en las condiciones y extremos que en esta Petitoria Subsidiaria Primera se solicitan y que en lo medular resultan ser de la siguiente manera:

  • a)Se deberá ordenar y pagar, la expropiación del área en que se tiene por dispuesta la existencia de una reserva de dominio a favor del Estado sobre el inmueble que es de matrícula de folio real 2-540242-000, por constituir una reserva de dominio a favor de la Nación que mide 7.431 metros cuadrados, o bien se ordenará expropiar en la medida del área que resulte ser en definitiva la que se determine a partir de las pruebas que en ese sentido puedan recibirse en este juicio. Se dispondrá en sentencia por ello que el área de reserva expropiada es entonces parte a segregar del inmueble inscrito folio real 2-540242-000, y que tiene, según plano al efecto elaborado y registrado al folio 28 del Protocolo 21142 del Perito Topógrafo Rubén Cubero Martínez, topógrafo colegiado número TA5613 y presentado a trámite de inscripción al Catastro del Registro Nacional CITAS DE PRESENTACION2019 - 96412 – C tiene un área de 7.431 metros cuadrados, tiene además estas otras características, naturaleza: terreno destinado a reserva de dominio en favor de la Nación de conformidad con el artículo 31 de la Ley de Aguas, situada en el distrito Guácima del Cantón Primero de la Provincia de Alajuela y que linda al norte con calle a Rincón Chiquito y con Incubadora Costarricense S.R.L.

Sur: Incubadora Costarricense S.R.L Este: Incubadora Costarricense S.R.L Oeste: Agropecuaria Mis Dos Hijas S.A. b) Se deberá disponer asimismo la obligación de pago de un monto por la indemnización por los daños causados al resto remante de este inmueble matrícula 2-540242-000, el que a pesar de no quedar afecto reserva de dominio, las condiciones topográficas en que queda afectan su valor por limitársele y hacérsele menos atractivo comercialmente y más oneroso su desarrollo y su explotación comercial, todo según los fines urbanos autorizados, c) De igual forma se pide ordenar en la sentencia que, a título de indemnización de los perjuicios ocasionados a la demandante, la Municipalidad de Alajuela deberá ser condenada al pago de intereses que sobre la suma de indemnización total que se fije por los daños en razón de la afectación de la finca inscrita al folio real 2-540242-000, y que según se dispone en el artículo 11 de la Ley de Expropiaciones son los intereses que hayan corrido desde el momento de la desposesión hasta la fecha del efectivo pago y al tipo de la tasa legal .- Por ello y para esos efectos, se pide además establecer como fecha de desposesión el día 30 de mayo del año dos mil diecisiete, toda vez que esa es la fecha en que se materializó sobre el inmueble la limitación de derecho reserva de dominio en favor de la Nación mediante la comunicación que hiciera la Oficina de Actividad de Control Constructivo de la Municipalidad de Alajuela en el correspondiente certificado de uso de suelo contenido en el Oficios MA-ACC-04497-2017 y que es de esa fecha, 30 mayo de 2017 que representa el inicio efectivo de las afectación de la finca a la creada demanialidad.- Noveno Pido asimismo en forma alternativa, que todas las obligaciones que en esta Petición Subsidiaria Primera se han pedido que le sean impuestas a la Municipalidad de Alajuela, para el caso de que no sean concedidas contra dicha Municipalidad en razón de considerar el Tribunal de que estas conductas son asumidas por la ella solo en razón de la Legislación vigente y que por tanto esa responsabilidad aquí demandada le es imputable al Estado en tanto Estado Legislador, se tengan alternativamente entonces los extremos petitorios primero, segundo, tercero, cuarto, quinto, sexto, sétimo y octavo de esta Petitoria Subsidiaria Primera, deducidos y solicitados, para el caso dicho, contra el Estado, de manera que se ordenen entonces a cargo y en contra de éste, y que sea el Estado entonces, al que se le condene a indemnizar a la demandante y al que se transfieran en dominio las áreas expropiadas.

C.- PETITORIA SUBSIDIARIA SEGUNDA:

Para el caso de que este Tribunal decida no decretar las expropiaciones ni estimar los montos de sus respectivas indemnizaciones en la forma que se le solicita, en razón de considerar que las tales pretensiones son propias y deben darse dentro del procedimiento de Proceso Especial de Expropiación, solcito entonces que se declara con lugar la demanda interpuesta por Incubadora Costarricense S.R:L. contra la Municipalidad de Alajuela y alternativamente contra el Estado en los siguientes términos:

Primero Que se declare, que la creación de esas áreas de reserva de dominio que en favor de la Nación se dispuso por el actuar municipal y que se reflejan del contenido de actos administrativos que son oficios MAACC- 04496-2017 y MA-ACC-04497-2017, y afectan las fincas inscritas bajo los números de folio real 2-540084-000 y 2-540242-000 propiedad de la demandante, comportan y generan responsabilidad civil objetiva indemnizable por parte de la Municipalidad de Alajuela y por tanto es la responsable de indemnizar los daños y perjuicios que tales actos han inferido en el patrimonio de la demandante.

Segundo.- Que se declare que los daños y perjuicios que deben resarcirse a la demandante lo son como producto de los efectos lesivos que una conducta, administrativas y/o pública, irrogó al patrimonio de la demandante, concretamente en el patrimonio constituido por de las fincas de su propiedad inscritas a los folios reales números 2-540242-000 y 2-540084-000. Y que se declare que la lesión consiste: por una parte, en la pérdida parcial de áreas de terreno, que en cada uno de los inmuebles referido sufre y por otra parte, por haber tales actos afectado también el resto de las áreas remantes de los inmuebles por quedar los mismas siendo disfuncionales, y producirse con ello un vaciamiento de derechos de propiedad sobre esas fincas.- O, de no considerarse que existe disfuncionabilidad absoluta en los remanentes de las fincas, ordénese únicamente la expropiación de las áreas de reserva en que se afectas esas fincas al demanio púbico y que sea en el monto del justiprecio que por esas áreas deba pagarse, donde se incluya la reparación de los daños, entonces considerados parciales, sufridos en los remantes.

Tercero Que se ordene en consecuencia a la Municipalidad de Alajuela a iniciar los trámites de expropiación del área total las fincas del partido de Alajuela, inscritas a los Folios Reales números folio real 2-540242-000 y 2-540084-000 o bien, esto según se disponga en la petitoria anterior, ordénese únicamente la expropiación de las áreas de reserva de dominio en favor de la Nación creadas, en cuyo caso, los daños a los remanentes se establecerán en las diligencias de expropiación que adelante se pide se ordenen, todo conforme a los procedimientos y exigencias regulados en la Ley de Expropiaciones, No. 7495.

Cuarto Que se disponga en sentencia que dicho trámite deberá ser iniciado de manera conjunta para ambas fincas y dentro del plazo máximo de tres meses contados a partir de la firmeza del presente fallo. Y que, para tales efectos, se prescindirá de la declaratoria de interés público de esas áreas, siendo que en el presente fallo se establecerá la procedencia de la expropiación ordenada por las causas de afectación señaladas.

Quinto Pido además, adicionalmente y desde ya, que se disponga en la sentencia de este proceso que, a título de daños y perjuicios, deberán serle reconocidos y pagados por la Municipalidad de Alajuela a la aquí demandante en las diligencias de expropiación que se deberán iniciar, los intereses que conforme al artículo 11 de la Ley de Expropiaciones le corresponden, que estos le deberán calcularse sobre las suma que se fije en aquellas diligencias en sentencia como justiprecio, y que estos intereses sean los hayan corrido desde que se afectó el inmueble con la reserva de dominio que fue en fecha 30 de mayo del año 2017 que es la fecha entonces en que se produjo la desposesión, hasta la fecha en que se haga el efectivo pago de la indemnización, lo que pido que desde ya, repito, quede así se establecido.- Sexto: Pido en forma alternativa que todas las obligaciones que en esta Petición Subsidiaria Segunda se piden que le sean impuestas a la Municipalidad de Alajuela que, en el caso de que no sean concedidas contra dicha Municipalidad en razón de considerar el Tribunal de que estas conductas son asumidas por la ella solo en razón de la Legislación vigente y que por tanto esa responsabilidad es imputable al Estado en tanto Estado Legislador, se tengan entonces los extremos petitorios primero, segundo, tercero, cuarto y quinto, deducidos y solicitados, alternativamente y para el caso dicho, de manera a cargo del Estado y que sea a éste entonces, al que se ordene iniciar los procedimientos de expropiación y al que se transfieran en dominio las áreas expropiadas, así como el que cumpla con todos los extremos y alcances indemnizatorios que se han pedido en los numerales referidos.- D.- PETITORIA COMUN Único. Que se condena a la Municipalidad de Alajuela o al Estado y, si fuera el caso a ambas partes solidariamente según sea la forma en que se acoja esta demanda, al pago de ambas costas de esta acción.”

II. DEFENSA DE LA MUNICIPALIDAD

La representación de la municipalidad rechazó la demanda y planteó las defensas de falta de derecho y falta de legitimación pasiva. En tal sentido, aclaró que los usos de suelo de ambas fincas resultaron permitidos, mas se encuentran parcialmente afectadas por la naciente La Pradera porque así lo disponen tanto el plan regulador de ese cantón, que las clasifica como subzona de reserva absoluta de nacientes, como por el artículo 31 de la Ley de Aguas, norma que no dispone que proceda una expropiación o una indemnización a favor del propietario, sobre todo porque no se produce un vaciamiento del contenido esencial del derecho de la propiedad privada. Estima que estamos en presencia de limitaciones de interés social por imperio de ley, las cuales son de conocimiento del actor, no resultan indemnizables y deben ser soportadas por el propietario. Agrega que la municipalidad no ha causado ningún daño a dichas propiedades, limitándose a regular el uso de la tierra a través de su plan regulador, el cual respeta las zonas de protección de las nacientes e incorpora las regulaciones establecidas tanto en la Ley de Aguas como en la Ley Forestal, de modo que tampoco podría iniciar diligencias de expropiación y pagar una indemnización para mitigar una limitación de orden legal, máxime que se trata de fondos públicos y no es permitido realizar una erogación donde en derecho no procede, añadiendo que la misma Contraloría General de la República ha denegado a las municipalidades que administran acueductos, la autorización para comprar terrenos aledaños a los 200m de protección de las nacientes. Agrega que no consta que la parte actora hubiera consultado si el lindero que colinda con la ruta 27 se encuentra habilitado para darle acceso."

III. DEFENSA DEL ESTADO

La representación del Estado contestó negativamente la demanda, indicando que la demandante conocía plenamente las condiciones de los inmuebles antes de iniciar trámites en la municipalidad. Plantea la defensa de falta de derecho, por cuanto las nacientes y los ríos son bienes de dominio público, protegidos desde vieja data, como se puede verificar en la Ley General sobre Terrenos Baldíos -Ley 13 de 10 de enero de 1939-, lo cual fue reiterado en la Ley de Aguas según el artículo 31, así como en la Ley de Tierras y Colonización -Ley 2825 del 14 de octubre de 1961- artículo 7,c), de dónde se deriva el margen de 200 m de protección de las nacientes. Agrega que la afectación al demanio público se dio por disposición de ley, de modo que estima que existe mala fe de la parte actora, pretendiendo un enriquecimiento sin causa respecto de un terreno comprado en el año 2016 y sobre el cual pesaba una afectación que data desde 1939 o 1941.

Asimismo, puede explotar el terreno para la actividad para la cual solicitó el uso de suelo: desarrollo urbanístico, resultando indemnizable únicamente si hubiera sido propietario antes de la promulgación de la ley que declara o ingresa a la propiedad como bien público, caso contrario, el propietario asume la limitación. Rechaza cualquier responsabilidad como estado legislador que se le atribuye, pues la parte no hace un esfuerzo argumentativo ni probatorio al respecto, lo cual hace inatendible su reclamo, máxime que no se da ninguno de los presupuestos para hablar de este tipo de responsabilidad en tanto no hay un único eventual daño, ni es especial y excepcional, ni hay una pequeña proporción de afectados ni excepcionalidad en la gravedad del daño. Expone también la prescripción del plazo para reclamar la responsabilidad por acto legislativo por haber transcurrido el plazo de 4 años previsto en el artículo 198 de la LGAP. Con lo indicado pide se rechace en todos sus extremos la demanda, se condene a la parte promovente al pago de ambas costas y a los intereses que se generen hasta su efectivo pago.

IV. HECHOS PROBADOS

Se tiene como probados los siguientes hechos de relevancia:

  • 1)La demandante es propietaria de las fincas inscritas bajo el número de matrícula de folio real 2-540084-000 plano de catastro número A-1883361-2016, y para los efectos de interés de esta causa, colinda al norte con calle pública con 79.82 metros y el Estado, y al sur con la ruta nacional 27 y tiene una superficie de 49.207 m2 (informe registral imagen 59 y plano en imagen 61).
  • 2)La demandante también es propietaria de la finca con matrícula de folio real 2-540242-000, con plano de catastro número A-1883487-2016, la cual es colindante al sur oeste de la finca indicada en el hecho anterior. Lindera al norte con calle pública (calle Rincón Chiquito) y al sur con la ruta nacional 27 y mide 56.798 m2 (informe registral en imagen 57, plano en imagen 64).
  • 3)Las fincas descritas en los dos hechos anteriores están situadas en el distrito La Guácima del cantón de Alajuela y provienen de la segregación en cabeza propia de las fincas madres con matrícula de folio real número 2-2156719-000 y 2-99659-000 respectivamente, mas carecen de acceso por esta vía pública ( informes registrales en imágenes 57 y 59, oficio DVOP-DI-DV-PV-2016-0515 del MOPT en imagen 527).
  • 4)El lindero noreste de la finca 2-540084-000, que da a calle pública vecinal rumbo a Rincón Chiquito, se encuentra afectado parcialmente por el radio de protección de la naciente La Pradera, la cual fue aprovechada por la Municipalidad de Alajuela para captar y distribuir agua potable a las comunidades circunvecinas. El área afectada por dicha naciente es de 3276m2, quedando una franja de 20,81 metros frontales a esa vía pública, que no es afectada por la franja protectora de la naciente (declaración, informe y levantamiento del Ing. Topógrafo Rubén Cubero Martínez en imágenes 72 a 77, ver croquis en imagen 73).
  • 5)El lindero norte de la finca 2-540242-000, que da a calle pública vecinal, se encuentra afectado totalmente por el radio de protección de la naciente La Pradera (declaración, informe y levantamiento del Ing. Topógrafo Rubén Cubero Martínez en imágenes 72 a 77, oficio No. MA-PPCI-0207-2014 del 26 de marzo del 2014, croquis en imagen 76).
  • 6)Mediante oficios MA-ACC-004496-2017 y MA-ACC-004497-2017, ambos fechados 30 de mayo del 2017, la Actividad de Control Constructivo de la Municipalidad de Alajuela comunicó al representante de la demandante que, conforme al Plan Regulador Urbano del Cantón Central de la Provincia de Alajuela, las fincas con matrícula 2-540084-000 y 2-540242-000 se encuentran ubicadas en zona residencial media densidad, siendo permitido el uso pretendido para “construcción de desarrollo urbanístico”, con lotes de 300 m2, frente mínimo de 12,5, con cobertura del 50%, más sobre ambas propiedades se dispuso que se encuentran afectadas por naciente, en la porción del terreno localizada al trazar una línea imaginaria paralela al lindero frontal a calle pública, sin permitirse ningún tipo de construcción, en aplicación de la Ley de Aguas No. 276, del 27 de agosto de 1942, publicado en La Gaceta número 190, del mismo año, en su artículo 31 A, cual indica en lo conducente: “se declaran como reserva de dominio a favor de la nación: A) Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio.” (imágenes 68 a 71).
  • 7)Habiéndose impugnado ambos certificados de uso de suelo, los mismos fueron confirmados por el Alcalde de Alajuela en resolución de las 9:00 h del 2 de febrero del 2018, quien en aplicación de la Ley de Planificación Urbana, artículos 15 y 43, y con base en el mapa de zonificación del Plan Regulador de ese cantón, artículo 43, confirmó que las fincas se encuentran afectadas por la sub zona de reserva absoluta de nacientes y su área de flujo, en las que no se permite construcción alguna (imágenes 87 a 89).
  • 8)La resolución del Alcalde fue impugnada ante la Sección Tercera del Tribunal Contencioso Administrativo y Civil de Hacienda, la cual conoció en jerarquía impropia y confirmó lo resuelto por el jerarca local, en resolución número 390- 2019 de las 8:00 h 30 minutos del 31 de julio del 2019 (imágenes 91 a 99).

V. HECHO NO PROBADO

No se demuestra el siguiente hecho de relevancia: 1) Que con la afectación del radio de protección de la naciente La Pradera, las fincas con matrícula 2-540084-000 y 2-540242-000 queden absolutamente imposibilitadas de aprovechamiento por parte de su propietario (los autos).

VI. SOBRE EL FONDO

El presente asunto, versa en torno a las consecuencias legales que generó la captación de aguas en la naciente La Pradera, por parte del ayuntamiento de Alajuela, sobre las fincas con matrícula de folio real con matrícula 2-540084-000 y 2-540242-000 que son propiedad de la demandante. Tal y como ha quedado demostrado, ambas fincas quedan afectadas por el radio de protección de la naciente respecto del lindero que da a calle pública rumbo a Rincón Chiquito. Según estima la parte accionante, son dos motivos por los cuales se ha vaciado su derecho de propiedad, a saber: primero, porque ambas fincas han quedado sin salida a calle pública, enclavadas; además, porque no se pueden explotar para el desarrollo urbanístico que pretendía, tal y como le fue comunicado en los certificados de uso de suelo y de conformidad con las conclusiones emanadas de la pericia judicial; y, además, por la disposición expresa del legislador, que en el ordinal 31 A de la Ley de Aguas, dispuso que el radio de protección de los 200 metros de las nacientes captadas, son dominio de la Nación.

A razón de lo anterior, se considera merecedor de la debida indemnización, respecto de la franja frontal que está incorporada dentro de ese radio de protección y sobre el resto de cada finca, por lo que se le debe pagar el precio total de ambos terrenos, al cual arribó el perito. Es un hecho incontrovertido que en la naciente La Pradera se encuentran las tomas de agua potable que abastecen a comunidades cercanas, obras que fueron consolidadas por la Municipalidad de Alajuela a fin de suministrar el líquido vital mediante el acueducto municipal, esfuerzo que ha sido una de las grandes preocupaciones de los siglos XX y XXI. La legislación nacional sobre aguas es de orden público e interés general. El artículo 4 del Código de Minería establece que las aguas minerales, las subterráneas y superficiales son públicas, el Estado tiene dominio y administración de este recurso. La Asamblea Legislativa promulgó primero la Ley de Aguas -No. 276 de 27 de agosto de 1942-, que disponía en su artículo 41 que todos los acueductos del país eran patrimonio del Estado y que las nuevas obras de este tipo las operaría el Ministerio de Salubridad Pública, dejando la administración de los acueductos municipales en los gobiernos locales hasta que se decretara su nacionalización.

Sin embargo, el Estado no tuvo la capacidad de asumir la tarea prevista en dicha ley, por lo que, mediante la Ley General de Agua Potable, No. 1634 de 18 de setiembre de 1953, se declaró de interés público la proyección y ejecución de obras de abastecimiento de agua y se impuso regulaciones a los organismos administradores a efecto de garantizar la potabilidad del agua. La crisis de la provisión de agua potable persistía, de modo tal se aprobó la Ley de Creación del Servicio Nacional de Acueductos y Alcantarillados - Ley Nº 2726 del 14 de abril de 1961-, mediante la cual asumió el servicio de suministro de agua potable, así como el aprovechamiento, utilización, gobierno y vigilancia de todas las aguas de dominio público. Dicha ley permitió a las corporaciones municipales, seguir a cargo de los acueductos locales, mientras suministraran un servicio eficiente, excepto cuando las propias corporaciones interesadas, en forma individual o colectiva, le soliciten expresamente la intervención al Servicio.

Estas normas convivieron por un tiempo con el artículo 44 del antiguo Código Municipal -Ley No. 4574 de 4 de mayo de 1974, hoy derogado, desde la promulgación del actual texto, vigente a partir del 18 de mayo de 1998, Ley No. 7794-, que disponía que a las Municipalidades les correspondía garantizar una eficiente provisión de agua potable y de evacuación de aguas servidas, mediante sistemas de acueductos y alcantarillados, que debía entenderse en relación con las comunidades que no estuvieren en aquel momento amparadas al SNAA. Con la Ley Nº 5915 de 12 de julio de 1976, se reforma el Sistema Nacional de Acueductos y Alcantarillados y se cambia su nomenclatura por Instituto Costarricense de Acueductos y Alcantarillados, el cual se considera el órgano sustituto de las potestades atribuidas en esa ley al Estado, ministerios y municipalidades, encargado de la administración y operación directa de los sistemas de acueductos y alcantarillados en todo el país, los cuales los iba asumiendo paulatinamente tomando en cuenta la conveniencia y disponibilidad de recursos.

También, le compete definir las áreas de protección de fuentes de abastecimiento tales como los manantiales o nacientes que son una forma natural de descarga de las aguas subterráneas y el artículo 3° de la Ley General de Agua Potable, le impone la obligación de seleccionar y localizar las aguas destinadas al servicio de cañería.

VII. SOBRE LA RESPONSABILIDAD DEL GOBIERNO LOCAL

En medio de tan amplia intervención estatal para garantizar la dotación y suministro del recurso hídrico de manera eficiente, no se puede obviar la participación activa y responsable de las corporaciones locales, pues le corresponde a la Municipalidad de cada cantón administrar los servicios e intereses «locales» (artículo 169 constitucional), de donde se deriva que su papel es predominante dado que tienen la obligación de actuar oportunamente en el ejercicio del poder de policía, asegurando el orden público, la salubridad, la tranquilidad, la seguridad de las personas, así como la organización moral, política y económica de la sociedad; utilizando las potestades que el ordenamiento jurídico les ha otorgado para alcanzar sus cometidos. El artículo 50 constitucional establece la tutela del medio ambiente en una doble vertiente, como derecho fundamental y como función pública, en el que el Estado debe garantizar, defender y preservar este derecho.

Las Municipalidades constituyen parte de la organización del Estado costarricense, pues de su naturaleza de entes descentralizados en razón del territorio derivan responsabilidades también respecto de la tutela del ambiente (al respecto, ver la sentencia de la Sala Constitucional número 2001-05737, de las catorce horas cuarenta y un minutos del veintisiete de junio del dos mil uno). Ello implica que a cargo de las municipalidades está la protección de todos aquellos bienes que convergen en el ambiente, ya sean todos los recursos naturales necesarios para la existencia humana, hasta las bellezas escénicas. Esta labor incluye, por excelencia, la vigilancia de todo proceso constructivo, pues el crecimiento urbano tiende a convertir en un poblado una porción de terreno, lo cual es un proceso complejo de alteración ambiental de gran efecto sobre los ecosistemas naturales y artificiales, ya que la mayoría de este tipo de obras compacta los terrenos y cubre una parte importante de la superficie de una capa impermeabilizante, con lo que se pueden llegar a afectar las reservas de acuíferos, se aumenta la escorrentía, se alteran los desagües naturales y crece el caudal de los ríos y otros cursos del agua, además de eliminar el paisaje original.

El ordenamiento territorial incorpora el uso y desarrollo sostenible de los recursos renovables y no renovables ubicados en las distintas zonas del país, así como el respeto a las características culturales, históricas y sociales de las poblaciones humanas involucradas, aspirando a la obtención de un equilibrio entre los asentamientos humanos y sus condiciones ambientales. Es por ello que todo lo concerniente a la aprobación de la regulación urbanística, así como el otorgamiento de los permisos de fraccionamiento y construcción, se le ha conferido a las Municipalidades, como encargadas de la administración de los intereses y servicios locales, conforme lo dispone el artículo 169 de la Constitución Política (ver además, Código Municipal, artículo 13 inciso o), la Ley de Planificación Urbana, Ley de Construcciones y la Ley Orgánica del Ambiente). Los artículos 15 y 19 de la Ley de Planificación Urbana reconocen la competencia que dispone cada municipalidad para planificar el desarrollo urbano dentro de los límites de su territorio, conforme a los reglamentos y planes reguladores que al efecto dicten.

Cualquier proyecto constructivo debe resultar conforme con la ordenación urbanística aplicable; lo cual supone un control previo de habilitación o "permiso", acompañado de la actividad de fiscalización en la ejecución de la actividad autorizada, a fin de que se realice conforme a la licencia o permiso concedido y a las regulaciones ambientales que rigen la actividad. A ello obedece que el proceso constructivo no pueda divorciarse del medio en que se desarrolla, y así lo ha desarrollado la Sala Primera de la Corte Suprema de Justicia en la sentencia N° 000507-F-04 en que indicó:

"la noción de propiedad se amalgama de manera plena y perfecta con el derecho constitucional del medio ambiente, que con igual intensidad y jerarquía, proclama el cuerpo constitucional en su precepto 50. Por ello, no es difícil inferir la regulación urbanística como intermedia entre propiedad y ambiente, pues al fin y al cabo, es el anverso gris, ordenatorio y edificativo de ésta última materia. Ambiente y urbanismo se constituyen así en áreas del Derecho que por su rol limitante, delimitan el contorno preciso del derecho de propiedad, es decir, su contenido esencial." Precisamente, las regulaciones de orden público, urbanísticas y ambientales imponen el sometimiento de los administrados, pues éstas integran el contenido del derecho de propiedad, en tanto establecen el ámbito autorizado o legítimo de su ejercicio, al contener algunas de las limitaciones autorizadas por el artículo 45 constitucional, bajo el entendido de que no se produce un despojo de la propiedad privada ni la privación del atributo primario del dominio, por ello, no dan cabida a indemnización alguna, ni a trámite expropiatorio. Bajo esa misma inteligencia, el artículo 28 de la Ley de Planificación Urbana, señala que el aprovechamiento de la tierra requiere del certificado de uso a efectos de determinar su compatibilidad con la regulación urbanística:

"Artículo 28.- Prohíbese aprovechar o dedicar terrenos, edificios, estructuras, a cualquier uso que sea incompatible con la zonificación implantada. En adelante, los propietarios interesados deberán obtener un certificado municipal que acredite la conformidad de uso a los requerimientos de la zonificación. Los usos ya existentes no conformes, deberán hacerse constar también con certificado que exprese tal circunstancia.

Cada reglamento de zonificación fijará la fecha a partir de la cual dichos certificados serán obligatorios." Esta norma remite a la vinculatoriedad de las regulaciones urbanísticas y el sometimiento que deben los administrados a las normas que ellas imponen por ser de orden público. Asimismo, el artículo 24 de la Ley de Planificación Urbana, dispone que en los reglamentos de zonificación se debe incluir la determinación de los usos de la tierra, lo relativo a la localización, altura y área de construcción de las edificaciones; la superficie y dimensiones de los lotes, lo cual tiene directa incidencia en la determinación de la densidad de la tierra; el tamaño de los retiros, patios y demás espacios abiertos, y cobertura del lote por edificios y estructuras; entre otros. Es mediante la regulación urbanística que se imponen limitaciones a los administrados y definen el destino y uso que se puede dar a la tierra, no pudiendo, entonces, separarse las autoridades locales de su aplicación.

Ciertamente el certificado de uso de suelo coteja el uso pretendido por su dueño, con la regulación de zonificación existente, y dispone si resulta conforme o no. Desde hace varios años la tesis que sostenía que es un acto meramente declarativo que solamente indica la conformidad con el uso permitido, ha sido superada. El certificado de uso de suelo es un acto administrativo que, por su naturaleza, incide directamente sobre la esfera jurídica del administrado, de modo que es capaz de surtir efectos de manera independiente, puesto que su contenido puede enunciar la existencia de limitaciones al ejercicio de los atributos del derecho de propiedad, en aplicación de las regulaciones urbanísticas y el régimen ambiental vigente, que permite o impide la toma de decisiones posteriores por parte de los particulares, incluyendo inversiones de impacto de tipo constructivo o de patentes.

VIII. SOBRE EL CASO CONCRETO

En la presente causa, es indiscutible que una porción de ambas fincas está cubierta por el radio de protección de la naciente La Pradera. Al efecto, la Ley Forestal vigente, número 7575 de 13 de febrero de 1996, establece la figura de las áreas de protección en su artículo 33:

“Artículo 33.- Áreas de protección. Se declaran áreas de protección las siguientes:

  • a)Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal...” Y el artículo 34 de la Ley Forestal agrega:

“Articulo 34.- Prohibición para talar en áreas protegidas. Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional. Los alineamientos que deban tramitarse en relación con estas áreas, serán realizados por el Instituto Nacional de Vivienda y Urbanismo”.

La afectación contenida en el numeral 33 de la Ley Forestal es de alcance general, pues obedece a la necesaria conservación del radio de cien metros de toda naciente en aras de conservar las fuentes de agua que provienen del subsuelo, las cuales dependen de los factores físicos (textura del suelo y sus componentes, a saber, raíces, arena, limo y arcilla), químicos y bióticos del terreno, cuya alteración por parte del hombre, puede converger en la degradación de los suelos y el aumento de las zonas desérticas. Dicha limitación tiene implícita la restricción al ejercicio de aquellas otras facultades dominicales que puedan degradar el estado natural de las nacientes, lo cual incluye, como es obvio, la restricción al derecho a edificar sobre el terreno. Por ello, dichas normas se imponen por encima de cualquier regulación contenida en reglamentaciones locales o nacionales. Esta normativa se trata de una presunción legal de vulnerabilidad del terreno que deriva de una intención completamente preventiva, tendiendo a preservar el área que rodea una naciente y eludiendo cualquier alteración humana sobre el suelo cuya protección ha sido declarada.

Tales restricciones son de orden público y pesan por encima de cualquier interés individual y, por ello, deben ser soportadas por todo propietario que tenga terrenos que se encuentren afectados por el radio de protección de una naciente, en el tanto se trata de una limitación de orden público autorizada en el ordinal 45 constitucional. Ahora bien, en la presente causa el ayuntamiento ha aplicado en un primer momento, al emitir los certificados de uso de suelo, el ordinal 31 de la Ley de Aguas, que expresa de la siguiente manera:

"Artículo 31.- Se declaran como reserva de dominio a favor de la Nación:

  • a)Las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio; ..." Por su parte, el Alcalde al pronunciarse y, sin hacer referencia respecto del alcance de la normativa transcrita y utilizada al efecto en los certificados de uso de suelo, rechazó la alzada en aplicación del Plan Regulador del Cantón de Alajuela, el cual dicta en lo conducente lo siguiente:

“Artículo 43. SUB ZONA DE RESERVA ABSOLUTA DE NACIENTES Y SU AREA DE FLUJO.

Las áreas en donde se ubican las nacientes y su área de flujo, son de reserva absoluta, en la cual no se permitirá la construcción, estas zonas se indica en el plano de Zonificación. Para todas las nacientes captadas y no captadas, identificadas y no identificadas, con o sin estudio hidrológico, se designa un radio de protección de 200 metros de radio de la nacientes, además del área de flujo, en las categorías 1 y 2...” La teoría desarrollada por la parte demandante, radica en sostener que la Municipalidad y, el Estado a través del artículo 31 de cita, han vaciado de contenido su derecho de propiedad, primero, respecto de las franjas que se ven afectadas por el radio protección de 200 m de la naciente; y segundo, como consecuencia de lo anterior, por la afectación y el daño grave sufrido en el resto de ambas fincas por cuanto no las puede aprovechar para el fin urbano al que las quería destinar, por haber quedado sin acceso a calle pública.

Si se da lectura aislada del ordinal 31 de la Ley de Aguas, se puede llegar a sostener una interpretación en el sentido que la totalidad del radio de protección de una naciente captada es terreno que pasa al demanio público, y es sobre la base de ese entendimiento que radica en esencia, el objeto de esta causa. La defensa de la municipalidad ha rechazado tal argumentación, por cuanto estima que estamos en presencia de limitaciones sobre la propiedad privada que deben ser soportadas por los dueños de los fundos afectados. Por su parte, el Estado sostiene que la afectación a la demanialidad de esos terrenos se produjo con la promulgación de la Ley General sobre Terrenos Baldíos del año 1939, la Ley General de Aguas de 1942 y la Ley de Tierras y Colonización de 1961, las cuales datan de antes de la compra de los terrenos realizada en el año 2016 por parte de la Actora, desvirtuando así la buena fe procesal con la que la parte demandante puede venir a reclamar la producción de daños.

Sobre este particular, en un asunto relativamente reciente, en la que se conoció respecto del grado de afectación de la propiedad privada que se encuentra afectada por el radio de protección de una naciente captada, la Sala Primera de la Corte, en resolución Nº 04155 – 2019 de las 14:40 horas del 28 de noviembre del 2019, consideró que estamos en presencia de una verdadera limitación al derecho de propiedad, en el tanto no se produce un vaciamiento de sus atributos. Al efecto, a pesar de lo extensa de la cita, merece hacerse una transcripción de lo que dijo el Alto Tribunal:

“V. El artículo 45 de la Constitución Política señala que la propiedad es inviolable y que a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley. Sólo por motivos de necesidad pública podrá la Asamblea Legislativa, mediante el voto de los dos tercios de la totalidad de sus miembros, imponer la propiedad limitaciones de interés social. Si bien nuestro régimen constitucional reconoce el derecho a la propiedad privada, dicho concepto ha evolucionado y no puede ser considerado como ilimitado y exclusivo, sin sujeción a restricciones. En efecto, el concepto de propiedad privada ha sufrido transformaciones cediendo ante el concepto de propiedad-función, que ha sido adoptado por el Constituyente en el párrafo segundo del artículo 45 constitucional, según el cual todo individuo tiene la obligación de cumplir ciertas obligaciones con la comunidad, siendo que el derecho de propiedad no es irrestricto y está sujeto a limitaciones de interés social establecidas por el legislador por mayoría reforzada y que no son indemnizables, por no implicar expropiación.

El quebranto de las disposiciones contenidas en el artículo 45 constitucional se produce cuando la limitación de interés social no es de carácter general y cuando el grado de afectación impide al propietario el ejercicio de los atributos del derecho de propiedad, vaciando su contenido, dejando de ser una limitación razonable para convirtiéndose en una verdadera expropiación, en cuyo caso surge el deber de indemnización. (Ver en este sentido los votos de la Sala Constitucional No. 5097-93, 2345-96, 9779-2002). En cuanto a la naturaleza de las limitaciones al derecho de propiedad privada en aras de protección del ambiente, la Sala Constitucional de la Corte Suprema de Justicia en los votos 5833-2002 y 2004-1923-2004, citadas por la sentencia dictada por la Sección Segunda de éste Tribunal No. 573-2005, dictada a las 11:20 horas del 25 de noviembre del 2005, dentro del proceso ordinario interpuesto por los actores contra la Municipalidad de Santa Bárbara de Heredia, determinó que por las características de la contaminación de los mantos acuíferos destinados al abastecimiento público y su difícil regeneración, las medidas para evitar la contaminación deben ser preventivas y protectoras, mediante la prohibición de ciertas actividades humanas en determinadas zonas u ordenando medidas de seguridad sobre ciertas actividades potencialmente contaminantes.

Estas medidas administrativas suponen diversas restricciones y controles sobre los usos o aprovechamientos de agua y sobre las actividades preexistentes que puedan afectar el recurso en cuanto se justifican en un interés público, por lo que no afectan el derecho de propiedad o la integridad del patrimonio. En consideración del Tribunal tales medidas deben reputarse como limitaciones de interés social que no vacían de contenido el derecho de propiedad o amplían el dominio público sobre las aguas subterráneas, sin previa indemnización, sino que moldean su contenido esencial, por lo que deben ser soportadas, al tratarse de un sacrificio o una carga general. Conforme se señala en la sentencia de cita, uno de los instrumentos más novedosos en la protección de los recursos hídricos es la definición de perímetros de protección para la conservación del recurso y su entorno, con el fin de preservar la calidad y cantidad del agua, así como de la formación geológica denominada acuífero.

Así la Ley de Aguas en su artículo 31 declara como reserva de dominio a favor de la Nación, las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio; y la zona forestal que protege o debe proteger el conjunto de terrenos en que se produce la infiltración de aguas potables, así como el de los que dan asiento a cuencas hidrográficas y márgenes de depósito, fuentes surtidoras o curso permanente de las mismas aguas. En la especie, por las razones que se dirá, los demandantes no han demostrado por prueba idónea que conforme a la naturaleza del fundo, las limitaciones establecidas en el artículo 31 de la Ley de Aguas generan una afectación al derecho de propiedad de tal magnitud que impida el ejercicio de los atributos propios de ese derecho en razón de lo cual la demanda interpuesta no puede prosperar, debiendo revocarse la sentencia de instancia.

VI.Los demandantes no han aportado prueba a los autos que permita determinar con certeza que la limitación contenida en el artículo 31 de la Ley de Aguas, sea de tal grado que impida dar ningún uso al inmueble, el cual se encuentra supuestamente desprovisto de todo valor de mercado y que por ende se encuentre sustraído del comercio. Asimismo, los actores no han demostrado que no han podido hacer uso del inmueble y que su derecho de disfrute y posesión se ha visto afectado y que la existencia del área de protección de la naciente ubicada en el inmueble lo haga del todo inutilizable para los fines requeridos por los actores. El peritaje rendido en autos (folios 274 a 276) se limitó a señalar que la afectación por la captación de agua, de 200 metros desde la naciente, cubre un total aproximado de terreno de un 88% (8.488.33 metros cuadrados), quedando un remanente aprovechable de terreno de un 12% (1.157.50 metros cuadrados) y que el tipo de suelo es normal, tipo de zona agrícola-semi-urbana.

Si bien del peritaje se evidencia que existe una afectación en un porcentaje significativo del inmueble, los demandantes no han aportado a los autos prueba idónea que permita determinar que el grado de afectación de la finca conforme a su naturaleza (certificado de uso conforme del suelo), limita el ejercicio de los atributos de la propiedad. Asimismo no han demostrado -salvo su dicho- la imposibilidad que se genera con ocasión de la limitación respecto de la venta o hipoteca del inmueble. Conforme lo ha determinado la Sala Constitucional la demostración de dichos requisitos resulta esencial a los efectos de determinar que se ha dejado sin contenido su derecho de propiedad, lo cual resulta indispensable para que se genere la obligación de proceder a la indemnización del valor del inmueble a través del proceso expropiatorio. En razón de lo dicho, carece de fundamento las pretensiones contenidas en la demanda a efecto de que se determine la obligación de indemnización del valor del inmueble o la obligación de proceder al inicio de los trámites de expropiación.

VII.Conforme lo señala el representante de la demandada, las normas citadas por los accionantes como fundamento de su demanda, no imponen la obligación a cargo de esa entidad de adquirir los inmuebles circundantes a las áreas de protección de mantos acuíferos que como en este caso se encuentra destinado al abastecimiento de agua potable de la población de Santa Bárbara de Heredia. Si bien el artículo 31 de la Ley de Aguas declara como reserva de dominio a favor de la Nación las tierras que circunden los sitios de captación o tomas surtidoras de agua potable, en un perímetro no menor de doscientos metros de radio, dicha norma no otorga de manera imperativa que el ente demandado deba adquirir inmuebles o iniciar procesos de expropiación de inmuebles afectados por dicha limitación. De igual manera las disposiciones contenidas en los incisos f), g) y h) del artículo 2 de la Ley Orgánica del Instituto Costarricense de Acueductos y Alcantarillados No. 2726 del 14 de abril de 1961, modificada por la Ley No. 5915 del 12 de julio de 1976, citadas como fundamento de la demanda, no establecen dicha obligación.

Dichas disposiciones establecen que le corresponde de manera exclusiva a dicha Institución la obligación de vigilancia, asesoría, fiscalización y rectoría en cuanto a la administración y buen funcionamiento y suministro de agua potable, no así la obligación de adquirir los inmuebles e infraestructura, de otros entes que administran acueductos, como en el presente caso la Municipalidad de Santa Bárbara de Heredia. Si bien la entidad demandada debe hacer cumplir la Ley General de Agua Potable, considerándose como el organismo sustitutivo de los ministerios y Municipalidades, la ley no le impone el deber de administrar y operar directamente los sistemas de acueductos y alcantarillados en todo el país, los cuales se irán asumiendo tomando en cuenta la conveniencia y disponibilidad de recursos. Las disposiciones de comentario, señalan que los sistemas que actualmente están administrados y operados por las corporaciones municipales podrán seguir a cargo de éstas, mientras suministren un servicio eficiente.

En este mismo sentido, si bien la disposición contenida en el artículo 22 de la Ley de cita establece la competencia en lo que se refiere a la conservación, ampliación, gestión en que debe incurrir para el mantenimiento de las zonas circundantes a las fuentes de agua, dicha disposición tampoco establece la obligación legal de adquirir aquellas áreas de protección establecidas en el artículo 31 de la Ley de Aguas. Según lo dicho, ninguna de las disposiciones legales citadas como fundamento de la demanda, pueden constituir fundamento a efecto de determinar en sentencia la obligación del Instituto demandado de adquirir el inmueble propiedad de los actores con ocasión de la existencia de una naciente de agua o de la limitación en las áreas de protección de dichas fuentes, conforme lo pretenden los accionantes, por lo que la acción intentada con este fundamento no puede prosperar.”

Como se aprecia, la Sala Primera considera el artículo 31 de cita se desprende una verdadera limitación sobre el derecho de propiedad privada, respecto del cual, la administración que realice las obras de ingeniería necesarias para la captación del agua, no se ve compelida a comprar, adquirir o inclusive expropiar el terreno que sirve de franja protectora de la naciente. Lo indicado tiene sentido, pues partiendo que nuestra Constitución Política es de orden liberal, únicamente procede la debida indemnización cuando se vacíe de contenido el derecho, por la cual resulta lógico y razonable que recaiga sobre el propietario, el deber de soportar las limitaciones de orden público tendientes a dar protección suficiente, debida y adecuada de las fuentes donde se obtiene el recurso hídrico que se destina para el consumo humano. Partiendo de este razonamiento, debemos entender que el radio protección de la naciente La Pradera en donde están las fincas de la parte demandante, se trata de una limitación de orden público que se impone por encima de los intereses del propietario, de modo tal que, en efecto, en esa franja de terreno, no se puede ejercer la facultad edilicia inherente al derecho de propiedad inmobiliaria. Esas limitaciones debe soportarlas la parte actora, pues integran su derecho, mismo que como ya se ha dicho reiteradamente, no es ilimitado.

IX.Siguiendo la misma inteligencia expresada por la Sala Primera, la única manera que se podría ordenar una indemnización del área correspondiente al radio protección de la naciente, así como del resto de las fincas, es porque se ha demostrado mediante la prueba útil al efecto, que las limitaciones son de tal envergadura que impiden el ejercicio de todos los atributos del derecho de propiedad, entendidos estos como el ius utendi (derecho a usar la cosa), el ius fruendi (derecho de percibir los frutos o beneficios de la cosa), y el ius abutendi (derecho de disponer de la cosa). El ius utendi se refiere al derecho del propietario a usar la cosa como le plazca, conforme sus intereses mas dentro de la función social que posea, quedando limitado a las leyes y a la imposibilidad de causar lesiones a otros; mientras que el ius fruendi le permite aprovecharse de los frutos que la cosa genere directa o indirectamente, o que permanezca luego de su uso; y el ius abutendi le permite disponer como desee, ya sea para destruir enajenar abandonar alquilar, siempre y cuando no vaya en contra de su función social y no vulnere derechos de terceros o de la ley.

En la presente causa, mediante el oficio No. MA-PPCI-0207-2014 la Municipalidad de Alajuela, suscrito por el señor Roy Delgado Alpízar, informó a requerimiento de la actora, las limitaciones que recaían sobre la finca 2-0099659-000 -que fue la que se segregó y originó el nacimiento de la finca con matrícula 2-540242-000-, al disponer que “no se permite ningún tipo de construcción, incluyendo caminos de acceso y obras de infraestructura superficiales o subterráneas. Son zonas de reserva absoluta designadas para la protección del recurso hídrico mediante la eliminación de cualquier impacto potencial debido a construcciones dentro de estas áreas. En este sentido queda claro que un acceso a un posible proyecto inmobiliario o de cualquier otra índole no podrá coincidir dentro del área de protección de nacientes que afecta el inmueble de marras, como consecuencia de la restricción que pesa sobre esta finca, dado que el frente a calle pública se ve limitado de esa manera precisamente en el acceso, cualquier proyecto que se pretenda desarrollar allí quedará en consecuencia limitada en similar medida dado que vehículos automotores no podrán transitar hacia lo interno del predio”.

Ese documento merece un doble análisis que de seguido se explica. Primero, las limitaciones sobre la propiedad inmobiliaria quedan definidas por la aplicación que se haga del marco normativo urbanístico en el respectivo certificado de uso de suelo que cada ayuntamiento emite sobre cada propiedad, conforme lo dispone la Ley de Planificación Urbana, artículos 15 y 28. Nótese que en los certificados de uso de suelo que fueron expedidos a las fincas objeto de disputa, no se le dispuso de forma alguna tales impedimentos sobre el aprovechamiento de su propiedad, de modo que tal oficio no les es aplicable, errándose respecto del alcance que se le dio a este documento. Segundo, a criterio de esta Cámara, lo allí indicado no es más que una interpretación errónea que hizo el funcionario municipal respecto del alcance de las limitaciones que pesan sobre la finca, de donde pareciera desprenderse que consideraba que la zona de protección implica una especie de inaccesibilidad al área protegida, dejando sin entrada la finca por ningún medio.

Tal aseveración es totalmente incorrecta por ser carente de sustento normativo, dado que la protección de la naciente debe partir de bases técnicas científicamente sustentables, obviando que en la actualidad existen sistemas ingenieriles que permiten la implementación de obras con impacto cero o casi nulo sobre el medio. Precisamente por ello, el propio funcionario declaró en el juicio oral y público, a nueve años de haber emitido aquel oficio, que sí es posible construir un camino permeable con un sistema adecuado de drenaje de aguas. Sin duda, ese documento llevó a error a la parte accionante, que extendió sus efectos de manera errada a las fincas segregadas entendiendo que, a pesar de haber obtenido certificados de uso de suelo favorables, aún se le vedaba cualquier posibilidad de ingresar por vía vehicular, lo cual fue un verdadero desacierto de la autoridad municipal. Ha de advertirse que las restricciones sobre esta franja de terreno deben tender a dar protección de la fuente de captación de agua, mas no por ello se puede negar el acceso vehicular en los términos expresados por el ayuntamiento, puesto que el “dominio de la Nación”, en los términos del ordinal 31 de la Ley de Aguas, junto con las limitaciones del ordinal 43 del Plan Regulador, solamente sujetan esa franja a la ausencia de construcciones, mas de ninguna manera impide el acceso de personas y/o tránsito vehicular.

No se puede perder de perspectiva que la naciente La Pradera no se ubica dentro de las fincas, sino a una distancia que oscila entre 70 y 80 metros cruzando la calle pública, evidenciándose con ello que la zona se encuentra impactada con obras realizadas por la propia Municipalidad, la cual ni siquiera requiere de modo alguno de ingreso a los terrenos de la accionante. En una interpretación correcta de la regulación existente, estamos en presencia de limitaciones que se adecúan al ordinal 45 constitucional, que debe soportar la parte accionante, en el tanto sus inmuebles están en la cercanía de la naciente que se aprovecha para captar y distribuir agua, de modo que debe abstenerse de realizar construcciones que impacten el terreno y que pongan en riesgo la fuente captadora de agua. Lo expresado significa que la demandante mantiene la integralidad de sus dos fincas, pues ninguna de sus franjas frontales se ha incorporado al demanio público, teniendo acceso a las mismas por vía vehicular y bien pudiendo realizar obras que le den acceso, bajo el entendido que deben ser precedidas por los estudios y autorizaciones de rigor, con el mínimo impacto, que no impermeabilicen el terreno y que permitan el adecuado drenaje pluvial.

El resto de ambas fincas es aprovechable en los términos expresados en los certificados de uso de suelo, los cuales son verdaderos actos administrativos que confieren derechos subjetivos, y se pueden disponer para uso urbanístico, por tratarse de zona residencial media densidad, con lotes de 300 m2, frente mínimo de 12,5, con cobertura del 50% si a bien lo tiene la parte accionante, tal y como lo declaró el testigo Roy Delgado Alpízar. Con lo expuesto se puede concluir que no existe daño alguno sobre las dos propiedades, pues debe reiterarse que el oficio MA-PPCI-0207-2014 fue dirigido a la finca madre, no a las fincas que hoy día son objeto de este proceso, con un grave error técnico puesto que la dejaba sin acceso. Sin duda este documento llevó a confusión y grave disgusto a la demandante, llevándola a creer que las fincas 2-540242-000 y 2-540084-000 afectadas por la naciente, sufrían la misma prohibición de construcción de caminos y de acceso vehicular, lo cual es incorrecto.

Nótese que en los certificados de uso de suelo Nos. MA-ACC-04496-2017 y MA-ACC-04497-2017, dirigidos esta vez a esas dos fincas, no se dispuso una restricción tan gravosa y solamente se hizo referencia respecto de la prohibición de construcciones en el lugar, los cuales siguen siendo válidos y eficaces, en cuanto quedaron firmes en la revisión que se hizo en alzada de jerarquía impropia, por esta misma Sección Tercera pero con otra integración, la cual confirmó lo resuelto por el jerarca local, en resolución número 390- 2019 de las 8:00 h 30 minutos del 31 de julio del 2019. Ha de hacerse énfasis, entonces, que esas franjas de terreno afectadas por el radio protección de la naciente no están incorporadas al demanio público y tampoco puede aseverarse que se haya dado un vaciamiento del derecho de propiedad respecto de ninguna porción de las fincas. En cuanto a la franja protectora, debe someterse a las prohibiciones constructivas, mas no por ello se puede concluir que la sociedad demandante haya perdido, en favor de la colectividad, esa superficie de terreno.

No existe prueba alguna que permita concluir que hay indisponibilidad de los terrenos, que hayan quedado fuera del comercio de los hombres y que no sean susceptibles de transformación, enajenación y aprovechamiento, simpre bajo el entendido que se deben respetar las limitaciones de ley. Respecto del resto de las fincas, concluye esta Cámara que, en la disertación de su teoría del caso, la parte actora parte de una premisa equivocada, en el sentido que la ausencia de ingreso le impide aprovechar el terreno para un desarrollo urbanístico. Como ya se explicó, el frente a calle pública lo mantiene intacto y, por ello, puede explotarlo en los términos permitidos por la regulación urbana que rige al efecto si lo tiene a bien, respetando el frente destinado a zona de protección, lo cual puede armonizar perfecta y eventualmente con el porcentaje de zonas verdes que debe tener cualquier desarrollo urbanístico, en los términos del ordinal 40 de la Ley de Planificación Urbana.

Partiendo de ello, esta Cámara se separa de las conclusiones a las que arribó el perito José Esteban Vásquez Barquero, pues tanto su informe como su declaración en el juicio oral parten de una premisa equivocada, que es la pérdida del lindero frontal con calle pública de ambas fincas por incorporación al demanio público. Se advierte que no era responsabilidad del perito la determinación de la naturaleza de esa franja de terreno, puesto que esa probanza de la parte actora fue orientada con la finalidad de valorar el terreno a efectos de obtener la indemnización pretendida. Inclusive, de la lectura del Plan Regulador de Alajuela, artículo 43, se desprende que la subzona residencial media densidad (fuera del anillo de circunvalación) no limita el uso del suelo al residencial, puesto que también se puede aprovechar para comercio menor, en los términos que regula el Anexo 2 de ese cuerpo normativo.

Con lo expuesto se puede concluir que lleva razón el ayuntamiento demandado, cuando ha defendido la existencia de las limitaciones derivadas de las normas que se han venido invocando, sin que se haya dado un vaciamiento del derecho de propiedad. A tenor de este razonamiento, ha de acogerse la defensa de falta de derecho interpuesta por el municipio, por cuanto el análisis jurídico, a la luz de los hechos acaecidos, expresado en el libelo de demanda, no es conforme con el ordenamiento. No obstante, se ha de rechazar la excepción de falta de legitimación ad causam pasiva, en el tanto las actuaciones del ayuntamiento motivaron a la parte a interponer la presente demanda. No procede entonces la indemnización ni la expropiación reclamada por Incubadora Costarricense S.R.L., en el tanto no se ha vaciado de contenido el derecho de propiedad, estamos en presencia de la producción de un daño provocado por la municipalidad, tampoco por el Estado en su función legisladora, sino ante verdaderas limitaciones legítimas sobre el derecho propiedad por razones de evidente interés público, las cuales no resultan indemnizables, lo que lleva a declarar la improcedencia de la totalidad de las pretensiones planteadas en el libelo de demanda, al carecer de sustento jurídico.

No comparte esta Cámara la disertación de defensa expresada por la representación de la Procuraduría General de la República, pues se reitera, no estamos en presencia de demanialidad, de modo que sus alegatos que desarrollan su defensa de falta de derecho, deben ser rechazados. Misma suerte ha de llevar la excepción de falta de legitimación ad causam pasiva, pues la literalidad del artículo 31 de la Ley de Aguas, leída de manera aisalda, bien puede llevar a planteamientos relacionados con la demanialidad de los bienes afectados por franjas de protección de nacientes captadas, tal y como lo hizo la parte demandante, mas lo cierto es que solamente implicarían el pago del valor del terreno, sí y solo si vacían de contenido el derecho de propiedad. Por lo expuesto, no es necesario entrar a analizar el resto de la defensa del Estado, por resultar innecesario. Ante la ausencia de daño alguno, tampoco opera ningún criterio de prescripción para la reclamación de una indemnización, pues la disertación estatal parte del supuesto de que las tierras son dominio público y, como se ha explicado, no lo son, debiendo por ello rechazarse la defensa estatal en tal sentido. La demanda deberá declararse sin lugar en todos sus extremos, como en efecto se dispone.

X. COSTAS

De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales se impone a la parte vencida al pago por el hecho de serlo, salvo que, a juicio del Tribunal, mediare motivo suficiente para litigar o bien, cuando la sentencia se dicte en virtud de pruebas cuya existencia desconociera la parte contraria. En esta causa, estima esta Cámara que la literalidad el artículo 31 de la Ley de Aguas, junto con las actuaciones del ayuntamiento, fueron provocadoras de la incertidumbre respecto de los límites sobre los atributos del derecho de propiedad de la accionante,a quien se le comunicó que no tenía acceso vehicular a sus fincas y llegó a considerar que se le había abstraído de la totalidad de sus bienes. Desde este punto de vista, considera esta Cámara que era indispensable que arribara a esta sede jurisdiccional para aclarar ese punto, resultando perdidosa respecto de la indemnización pretendida, mas ahora siendo conocedora de los alcances de la limitación que pesa sobre ambas fincas, las cuales siguen siendo de su propiedad en su totalidad. Por ello, a pesar de resultar perdidosa, se le ha de exonerar respecto del pago de ambas costas, en el tanto hubo motivo suficiente para litigar.

POR TANTO

Se declara sin lugar las excepciones de prescripción, falta de legitimación ad causam pasiva opuestas por los demandados. Se rechaza la defensa de falta de derecho planteada por el Estado y se acoge la defensa de falta de derecho opuesta por la Municipalidad de Alajuela. En cuanto al fondo, se declara sin lugar en todos sus extremos la demanda incoada por Incubadora Costarricense S.R.L., pero exonerándole respecto del pago de ambas costas.
