Voto N° 019-2022-II ADMINISTRATIVE AND CIVIL COURT FOR PUBLIC FINANCE MATTERS, SECOND SECTION. SECOND JUDICIAL CIRCUIT OF SAN JOSÉ. Goicoechea, at eleven thirty on once de marzo de dos mil veintidós.- Ordinary proceeding (proceso de conocimiento) seeking a declaration of injury to the public interest (lesividad), declared to involve purely questions of law (de puro derecho), filed by the Instituto de Desarrollo Rural (hereinafter INDER), legal entity identification number CED19554, against the Estate (Sucesión) of [Nombre62 001]; [Nombre62 002], identification card number [Valor CED63]; and Banco de Costa Rica, legal entity identification number CED233. Attorneys Nancy Campos Porras, acting as special litigation attorney-in-fact (apoderada especial judicial) for INDER, and Alfonso Alejandro Faba Alpízar, acting as general litigation attorney-in-fact (apoderado general judicial) for Banco de Costa Rica, appear in the proceeding. The State participates as an interested third party.- The Court now renders judgment by unanimous vote of its members.

CONSIDERING
II.POSITION OF THE CLAIM.- INDER’s counsel argues, insofar as relevant, as follows: “GROUNDS. REGARDING THE LANDS BELONGING TO THE INALIENABLE ZONE ALONG THE SOUTHERN BORDER. By legislative mandate, the lands located within the two-thousand-meter strip running along the border with Panama constitute public-domain property (bienes de dominio público), a long-standing designation (afectación) protected since the nineteenth century, initially under Tax Code No. 8 of 31 de octubre de 1885, which subsequently underwent certain amendments. Decree number 3 of 29 de octubre de 1914 declared a fifty-kilometer-wide zone along the definitive border with the Republic of Panama unavailable for claims (indenunciable); subsequently, Laws numbers 11 of 22 de octubre de 1926 and 149 of 16 de agosto de 1929 reduced the designated area to a width of five kilometers along the border with Panama and eight kilometers along the border with Nicaragua.
Later, the Vacant Lands Law (ley de Terrenos Baldíos), No. 13 of 10 de enero de 1939, modified its size, reducing it to two kilometers, and Article 10 thereof provided: ‘The lands located within a two-kilometer-wide zone along the borders with Nicaragua and Panama are likewise inalienable.’ Decree number 6 regulated the Vacant Lands Law, and Article 15, subsection f), thereof authorized the Executive Branch to lease lands located within a two-kilometer-wide zone along the borders with Nicaragua and Panama; all of this was intended to preserve them within the public domain while allowing their use for a defined period by persons who met a series of requirements and undertook certain obligations, including directly using the land for the purpose for which it was granted. Finally, the enactment of Law 2825 on Lands and Colonization of 14 de octubre de 1961, as amended, perpetuated this designation to the present day, with Article 7, subsection f), providing: ‘Until the State, on its own initiative or at the recommendation of the Ministry of Agriculture or the Institute of Lands and Colonization, and for reasons of national interest, determines which lands must remain under its ownership, the lands located within a 2.000-meter-wide zone along the borders with Nicaragua and Panama shall be deemed inalienable and incapable of acquisition through a claim (denuncia) or possession.’ [Partially transcribes decision N°2306-91 issued at 14:45 on 6 de noviembre de 1991 by the Constitutional Chamber]. In decision number 2008-008309, issued at nueve horas y quince minutos on dieciséis de mayo del dos mil ocho, the Constitutional Chamber establishes the defining elements of public-domain property (bienes demaniales). [Partially transcribes the decision]. The foregoing satisfies the teleological element whereby, because the lands belonging to the Southern Border Zone are owned by the State, they are exempt from attachment, inalienable, incapable of acquisition through possession, and the State’s action to recover them is not subject to a statute of limitations; from this, the characteristics of public-domain property may be inferred, as established by the Constitutional Chamber in judgment number 1991-02306, issued at catorce horas cuarenta y cinco minutos on seis de noviembre de mil novecientos noventa y uno. [Partially transcribes the decision]. Accordingly, the administrative act (acto administrativo) issued by the entity I represent, through the resolution adopted by the Board of Directors under Article 66 of session 041-05, held on 24 de octubre de 2005, which authorized the subdivision and conveyance (segregar y traspasar) of parcel number 79 of the [Nombre62 004] Settlement, measuring 29.963,85 m2, located in the Province of Puntarenas, Canton of Coto Brus, District of Sabalito, in Progreso, pursuant to Law 2825 (Law on Lands and Colonization), specifically under the Ordinary Titling Program, within the agronomic unit consisting of the property recorded in the Puntarenas Real Property Folio [Valor 008] in the Institute’s name, by conveyance to [Nombre62 001], identity card number [CED104 ], and [Nombre62 002] , identity card [CED136 ], is absolutely null and void because the land at issue in these proceedings lies within the inalienable 2000-meter zone of the Southern Border Zone and therefore constitutes public-domain land.
In view of the foregoing and to safeguard the Public Domain, the entity I represent seeks annulment of the title granted. GROUNDS FOR NULLITY IN THE VALIDITY ELEMENTS OF THE ADMINISTRATIVE ACT. From the facts alleged in this claim and the documentation contained in the administrative record (expediente administrativo), it follows that absolute nullity (nulidad absoluta) exists because title was granted to a parcel located within the inalienable zone of the Southern Zone. In this regard, Article 158 of the General Law of Public Administration provides that the absence or defect of any requirement of an administrative act expressly or implicitly required by the legal system shall constitute a defect therein. That article is related to Article 166 of the same law, which establishes that an act shall be absolutely null and void when one or more of its constituent elements are wholly absent, either factually or legally, and to Article 167, which provides that an act shall be relatively null and void (nulidad relativa) when one of its constituent elements is defective, unless the defect prevents fulfillment of its purpose, in which case the nullity shall be absolute.
In referring to the grounds (motivo) as an element of the validity of an administrative act, Article 133 of the General Law of Public Administration provides that such grounds must be lawful and must exist as they were considered when the act was issued. The IDA Board of Directors authorized the conveyance of the lot in question, apparently because all requirements established in the Regulations for the Selection of Awardees had been satisfied; this constituted the grounds for the administrative act approving the conveyance of the parcel to the applicants. Article 132 of the same law, in turn, establishes that the substance (contenido) of the administrative act must be lawful, possible, clear, precise, and encompass all factual and legal matters arising from its grounds. Because the land is subject to inalienability and, by virtue of its characteristics, belongs to the State, the resolution authorizing its conveyance is unlawful, since, as cited above, it concerns inalienable public-domain property that cannot legally be conveyed to private parties, given that the property is outside the stream of commerce and dedicated to serving the community; it is therefore an act detrimental to the public interest.
UNLAWFUL SUBSTANCE AND INJURIOUSNESS OF THE ACT. Aware of the administrative error committed in authorizing and formalizing the subdivision of the land at issue in this claim without properly verifying that State lands were not affected, the entity I represent resolved, pursuant to Article 34 of the Code of Administrative Litigation Procedure, to declare its conduct injurious to the public interest (Lesividad) through a Board of Directors Resolution, Article 54 of Ordinary Session 003-2015, held on 26 de enero de 2015, in order to proceed under these rules with the present claim, whose purpose is to annul the administrative act vitiated by absolute nullity and the acts connected thereto that generated or depend upon the property title, because this title was processed before the National Registry even though the administrative act failed to comply with essential statutory requirements. Such absolute nullity must be declared by the judicial authority, and pursuant to the cited provision, that relief is accordingly sought in these proceedings.”
III.POSITION OF BANCO DE COSTA RICA.- The Bank’s representative responds as follows: “It is evident that, in this case, the Bank had no involvement or participation whatsoever in the facts disputed in this action, since any irregular situation in this matter, if one occurred, arose before the mortgage loan (crédito hipotecario) was established in favor of the Bank; that loan was duly consummated in accordance with law at the relevant time and is registered as such in the corresponding section of the Real Estate Registry (Registro Inmobiliario). Such registration would neither have occurred nor become final had there been any issue concerning the mortgaged property that prevented the creation of the encumbrance (gravamen) at issue, because, as shown in the current registry report, [Nombre62 001] and [Nombre62 002] have owned the property that is the subject of this litigation since December 2005, while the mortgage in favor of the Bank was created in August 2008, that is, more than two years and six months after the property was registered in their names.
None of the subsequent circumstances concerning the property that are the subject matter of the dispute (litis) appeared in the Registry when the encumbrance was created. At that time, the Bank acted on the basis of the principles of reliance on the public registry (fe pública registral), the legal certainty (seguridad jurídica) arising and deriving from such public notice, and the principle of specificity (principio de especialidad), under which registered rights must be duly defined or recorded with respect to their ownership, content, limitations, and the nature of the properties to which they apply, for the purpose of maintaining a clear and precise identification of each property (Articles 460 and 462 of the Civil Code). In accordance with the foregoing, and in due harmony with the principles stated above, the mortgage registered under references [Valor 007] was created on the basis of the legal certainty afforded by public registry notice, and this Judicial Authority must uphold my client’s right because it is fully compliant with the law.
It should also be noted that, with respect to a good-faith third party (tercero de buena fe) who has acquired rights in reliance on public registry notice, the acts or contracts affecting that party enjoy an irrebuttable presumption (presunción iuris et de iure) of legitimacy and effectiveness and therefore may not be annulled; this follows from a harmonious reading of Articles 17, 18, 21, 22, 456, 457, 462, 471,474 and 477 of the Civil Code. Of utmost relevance to this case is Article 456 of the Civil Code, a provision fully applicable to the matter before us, which states in pertinent part: ‘Nevertheless, acts performed or contracts executed by a person who appears in the Registry as having the right to do so shall not, once registered, be invalidated as against a third party, even if the grantor’s right is subsequently annulled or terminated by virtue of an unregistered title, implicit grounds, or grounds that, although explicit, do not appear in the Registry.’ Furthermore, Article 22 provides: ‘The law does not protect abuse of rights (abuso del derecho) or the antisocial exercise thereof.
Any act or omission under a contract that, because of its author’s intent, its purpose, or the circumstances in which it is carried out, manifestly exceeds the normal limits governing the exercise of a right, causing harm to a third party or the other contracting party, shall give rise to the corresponding compensation and to the adoption of judicial or administrative measures preventing the continuation of the abuse.’ It is clear that we fall within the circumstances contemplated by law, because when the mortgage was created over the property that is the subject of this proceeding, [Nombre62 001] and [Nombre62 002] appeared, and continue to appear, as the lawful owners of the property mortgaged under a first-priority lien (primer grado), and consequently had sufficient legal authority to consent to mortgaging the property. Moreover, no restrictions or notices appeared against the property that would have alerted anyone to, or prevented, the creation and registration of the corresponding mortgage.
In any event, even if this action were to succeed against the defendant, it could not affect the rights arising from the security interest (garantía real) created in favor of my client as a good-faith third party, pursuant to the aforementioned provision. DEFENSES (EXCEPCIONES). I hereby raise the defenses of lack of standing to sue and be sued (falta de legitimación activa y pasiva), as well as failure to state a legal right (falta de Derecho), all in relation to my client’s status as mortgagee and because credit transaction number CED61148 has, moreover, been paid off since October 2017.”
IV.POSITION OF [Nombre62 002] AND THE ESTATE OF [Nombre 001].- [Nombre 005], acting on her own behalf and as executor (albacea) of the Estate of [Nombre62 001], responds as follows: “1. Probate proceeding (proceso sucesorio) N°19-000007-0419-AG concerning the late [Nombre62 001], who was [...], identity card number [Valor CED11782], is pending before the Agrarian Court of the Second Judicial Circuit of the Southern Zone, Corredores. By a ruling appearing in the electronic case file, issued at ten hours and fifty minutes on cuatro de marzo de dos mil diecinueve, the undersigned, [Nombre62 002], was appointed PROVISIONAL EXECUTOR (ALBACEA PROVISIONAL). I submit certification of my appointment as executor (certificación de albaceazgo). 2. I am an older adult of limited means and, due to my lack of knowledge, I had not entered an appearance (apersonado). 3. With respect to this proceeding, I state that I have no objection whatsoever to the deeds being annulled; those deeds are registered in the name of the undersigned, [Nombre62 006], and my deceased husband, and for that reason I consent to the claims (me allano) in this proceeding. 4.
Based on the foregoing, I request that it be established that I have priority for INDER to grant me the concession (concesión) over the aforementioned land. 5. I will not appear at any hearings scheduled by this Court because my age, financial circumstances, and the distance from this Court would make it physically impossible for me to do so, and also because I do not oppose this proceeding in any respect. 6. Another proceeding involving the same cause, plaintiff, defendants, and court is pending under case file 17-0098464027-CA (sic); I therefore request that it be consolidated (acumule) with this proceeding in the interest of procedural economy (economía procesal). 7. I request that costs not be assessed against me because I am acting in good faith.”
V.ESTABLISHED FACTS (HECHOS PROBADOS).- The following relevant facts are deemed established for purposes of deciding this matter:
The land has an area of 2 ha. 9963,85 m2 and is described in cadastral plan number [Valor 006] , and the resolution was formalized in deed number fifteen of volume eight executed before Notary Jimmy Meza Lázarus at ocho horas del veintisiete de octubre de dos mil cinco and recorded in the Registro Inmobiliario under the following recording references: Volume 560, Entry 19557, thereby creating property number one hundred forty-three thousand eight hundred thirty-five in the province of Puntarenas, interests zero zero one and zero zero two, because it allowed rights in favor of a private individual to be established over land that was affected in its entirety because it is located within the southern border zone, as demonstrated by certification AT-426-2016, dated 17 de mayo de 2016, issued by Eng. Jimmy Garita Hernández, Head of the Surveying Department of the Instituto de Desarrollo Rural, in contravention of the regulations in force when the act was issued, pursuant to Article 7, subsection f), of Law 2825 (Ley de Tierras y Colonización), because the land forms part of the State Patrimony and is subject to the public domain, and therefore cannot be removed from such status except by statutory reservation. (...)” (Folios 149 to 157 of the administrative record in physical format).
VI.MERITS.- ADMISSIBILITY OF THE CLAIM. INALIENABILITY OF THE BORDER STRIPS.- This proceeding seeks a declaration of partial nullity (declaratoria de nulidad parcial) of the resolution adopted by the Junta Directiva del Instituto de Desarrollo Rural in Article 66 of session 041-05, held on 24 de octubre de 2005, insofar as it concerns authorization for the segregation (segregación) and conveyance of a parcel of land in favor of [Nombre62 001] and [Nombre62 002], described according to registered cadastral plan number [Valor 006], as well as the partial nullity of public deed number 15, executed before Notary Jimmy Meza Lázarus at 08:00 hours on 27 de octubre de 2005, solely insofar as it concerns the conveyance of Parcel 79 of the Asentamiento [Nombre62 003] in favor of [Nombre62 001] and [Nombre62 Placa704], which gave rise to real-property registration under real folio number Placa4033, interests cero cero uno and cero cero dos, in the Province of Puntarenas, registered cadastral plan number [Valor 006] and, consequently, by reason of connectedness, the nullity of the registry entry recording the property registered under the Folio Real system ut supra, as well as the encumbrance (gravamen) on that property securing a mortgage loan in favor of Banco de Costa Rica in the amount of seis millones de colones, which encumbrance was recorded in the Mortgage Section of the Registro Inmobiliario under registry references [Valor 017], and whose debtor was Mr. [Nombre62 007].
According to the documentary technical evidence contained in the record, which was not challenged by the defendants in view of their consent to the claim (allanamiento a la demanda), the aforementioned property lies within and partially overlaps the so-called Southern Border Strip, which, by operation of law, has been inalienable and owned by the State since 1926. -The Northern Border Strip had already held that status since Decreto del Congreso N°30 del 22 de junio de 1888-. Indeed, with respect to the southern border strip, Ley N°11 del 22 de octubre de 1926 amended certain articles of the Código Fiscal de 1885, insofar as relevant here, as follows: “Article 508.-All land located within the boundaries of the Republic that does not belong to private parties under lawful title shall be deemed vacant State land (tierras baldías), and such land shall be presumed vacant unless proven otherwise.
Vacant land, whether situated on islands or on the mainland, belongs to the State.” “Article 509.-Ownership of vacant land is inalienable, subject only to the following exceptions: (...) Transitional Provision.-The provision of subsection 29 of this article, as amended, applies to land occupied up to the date on which this law enters into force.” “Article 510.-The conveyances permitted by the preceding article may never involve the following lands, which are inalienable throughout their entire area: (...) 4°-Those located within a five-kilometer-wide zone along the border with Panamá. 5°-Those located within a two-hundred-meter-wide zone along the border with Nicaragua.” Subsequently, Ley General sobre Terrenos Baldíos (N°13 del 10 de enero de 1939) repealed Article 510 of the Código Fiscal but retained the inalienability of both border strips, providing as follows: “Article 10.- Land located within a two-kilometer-wide zone along the borders with Nicaragua and Panamá shall likewise be inalienable.” Some time later, Ley General sobre Terrenos Baldíos was itself repealed by Article 184 of Ley de Tierras y Colonización (N°2825 del 14 de octubre de 1961).
However, the latter legislation, in Article 7 subsection f), maintained the public-domain status (carácter demanial) of the aforementioned northern and southern border strips by providing as follows: “Until the State, on its own initiative or at the recommendation of the Ministerio de Agricultura or the Instituto de Desarrollo Agrario, and for reasons of national interest, determines which lands must remain under its control, the following shall be deemed inalienable and incapable of acquisition through a land claim (denuncio) or possession, except for those held under private ownership pursuant to lawful title: … f) Those located within a 2.000-meter-wide zone along the borders with Nicaragua and Panamá. (…)”. This body of law makes entirely clear the legal impossibility of any parcel located wholly or partially within the border zone (2.000 meters wide along the borders with Nicaragua and Panamá) being possessed or acquired under any title by private parties, much less conveyed to third parties subject to mortgage encumbrances securing loans, as occurred in this case.
Regarding the nature and characteristics of the border strips, the Sala Constitucional has stated: “With respect to the border strip, Ley de Terrenos Baldíos, No. 13 de 10 de enero de 1939, provided in Article 10: ‘Land located within a two-kilometer-wide zone along the borders with Nicaragua and Panamá shall likewise be inalienable.’ This protection arose because our border zones continue to be regarded as essential to the country, not only for reasons involving the defense of national sovereignty, given the importance of preserving them as strategic zones for the security of the Nation, but also because of their relevance to the protection of the State’s natural heritage. By reason of their location and forest cover (cobertura boscosa), the border zones constitute an extremely important area for protecting the environment as a territory, an indispensable buffer zone for the movement of flora and fauna, water resources, and the ecosystem prevailing in particular regions of the country; hence the Costa Rican State’s interest in and need to regulate and protect the natural resources existing today, which, without control and restrictions on their disposal by the competent authorities, would place the right to a healthy environment in serious jeopardy.” (Resolución N°2988-99 de las 11:57 horas del 23 de abril de 1999).
In the same vein, the Sala Constitucional stated: “It is no coincidence that the Costa Rican legal system has preserved State public ownership of the internal border zones along both the northern and southern borders of the country under a special legal regime, given that, because of their particular nature, they constitute strategic zones for the defense of sovereignty and the security of the Nation, as well as for establishing controls in matters of clear public interest such as health, customs, migration, and the exit and entry of goods, among others. Accordingly, the indiscriminate and general removal from the public domain (desafectación) contemplated in the Bill under consultation, without a prior technical study specifically identifying the properties to be removed from the public domain so as to assess, among other matters, whether doing so would endanger the security of the Nation, prevent the effective exercise of sovereignty, or impede adequate migration or customs control, etc., is irrational and disproportionate and therefore contrary to the Constitutional Principles of Security and Sovereignty.” (Resolución N°18836-2014 del 18 de noviembre de 2014).
As may be seen, the Sala Constitucional clearly recognizes the public-domain status (demanialidad) of the country’s northern and southern border zones on the basis of the statutory provisions so establishing, while also reinforcing their public-domain character in light of the paramount constitutional purposes protected by those areas, including the right to a healthy and ecologically balanced environment, health, migration control, customs control, and the defense of national sovereignty and security. As to the nature of public-domain property (bienes de dominio público), the Sala Constitucional has stated: “…these are assets title to which is held by the State in its capacity as administrator; they must therefore be understood as assets belonging (sic) to the ‘Nation’ and consequently forming part of the public patrimony. Because of their special legal nature, they possess the following attributes: they are not subject to acquisitive or extinctive prescription (imprescriptibles), meaning that ownership of them, or even mere possession, cannot be acquired through the passage of time—that is, they cannot be acquired by adverse possession (usucapión), nor can rights in them be lost through prescription.
For this reason, permits for use granted by the Administration over such property are always precarious and may be revoked by the Administration at any time for reasons of expediency or convenience—in the terms provided in Articles 154 and 155 of Ley General de la Administración Pública—and concessions granted for their use may likewise be canceled through the applicable procedure. They are immune from attachment (inembargables), meaning that they may not be subject to any encumbrance or attachment by either private parties or the Administration; and they are inalienable, meaning that they are outside the stream of commerce (fuera del comercio de los hombres). Consequently, they may not be conveyed, sold, or acquired, whether gratuitously or for consideration, by private parties or by the State; they are therefore excluded from commerce among persons and are subject to a special, enhanced legal regime.” (Resolución N°2007-2408 16:13 horas del 21 de febrero de 2007).
Indeed, and in keeping with the foregoing, public-domain property consists of assets devoted to public use or a public service, lies outside the stream of commerce, is not subject to prescription, is immune from attachment, and is inalienable, and enjoys a special, enhanced legal regime (Articles 261 and 262 of the Código Civil and 121 subsection 14 of the Constitución Política). In this case, because the southern border strip (2.000 meters wide along the border with Panamá) is public-domain property, as duly explained, the lands lying wholly or partially within that area logically are likewise inalienable and outside the stream of commerce; consequently, any basis for acquiring them is null and void by operation of law, as is any consensual encumbrance imposed upon them. It is therefore manifest that Parcel 79 of the Asentamiento [Nombre62 003], which is located partially within and overlaps that southern border strip, could not be conveyed under any title in favor of [Nombre62 001] and [Nombre62 002], much less through an administrative act as occurred in this case, in clear violation of the principle of reservation to law (principio de reserva de ley).
It must be recalled that the public use or public service to which particular public-domain property has been dedicated may be changed only by statute, as this falls within the exclusive authority of the Asamblea Legislativa pursuant to provision 121 subsection 14 of the Constitución Política. The private title resulting from the registry entry cannot be asserted against this, since, pursuant to Article 456 of the Código Civil, registration in the Registry does not validate registered acts or contracts that are null and void under the law.
Accordingly, in light of the legal violations set forth above, it is concluded that the resolution adopted by the Board of Directors of the Instituto de Desarrollo Rural in Article 66 of session 041-05, held on 24 de octubre de 2005, is absolutely null and void due to defects in its grounds, content, and purpose (Articles 131, 132, 133, 158, 164 inciso 2, 166 and 186 of the Ley General de la Administración Pública), solely with respect to the authorization of the segregation (segregación) and conveyance (traspaso) of parcel 79 of the Asentamiento [Nombre 003] in favor of [Nombre62 001] and [Nombre62 002], according to cadastral plan number [Valor 006]; likewise, public deed number 15, executed before Notary Jimmy Meza Lázarus at 08:00 hours on 27 de octubre de 2005, is absolutely null and void solely insofar as it effectuated that conveyance, the registration of which created real-property folio registration number [Valor 018] in the Partido de Puntarenas; the registry entry recording said property must also be canceled by reason of its connection thereto.
VI.REGARDING THE DEFENSES (EXCEPCIONES).- The defendants [Nombre62 001] and [Nombre62 002] did not raise any defenses because they acquiesced to the complaint. For its part, Banco de Costa Rica raised the defenses of lack of standing to sue and be sued and lack of legal entitlement; however, at the Preliminary Hearing, INDER’s counsel withdrew claim number 4, which was the only claim asserted against the Bank. Accordingly, the action against Banco de Costa Rica must be deemed withdrawn, and no ruling should be issued on the defenses raised by the financial institution.
VIII.CLAIMS.- Based on all the foregoing, the complaint must be granted on the following terms. The resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario (now INDER), in Article 66 of session number 041-05, held on 24 de octubre de 2005, is declared harmful to the public interest (lesivo a los intereses públicos) and, consequently, is partially annulled, solely with respect to the authorization for the segregation and conveyance (segregación y traspaso) of parcel 79 of Asentamiento [Nombre 003] to [Nombre62 001] and [Nombre62 002], as described in registered survey plan (plano catastrado) number [Valor 006]. By reason of relatedness (conexidad), public deed number fifteen, executed before notary Jimmy Meza Lázarus at eight o’clock on veintisiete de octubre de dos mil cinco, is partially annulled, solely insofar as it formalized the segregation and conveyance of parcel 79 of Asentamiento [Nombre 003] to [Nombre62 001] and [Nombre62 002], thereby creating real-property folio (folio real) Placa13395 of the Puntarenas Registry District, with registered survey plan number [Valor 006].
By reason of relatedness, the registration entry (asiento registral de inscripción) for real-property folio number Placa13395 of the Puntarenas Registry District, issued by the Registro Nacional, is annulled. By reason of relatedness (Article 122, subsections a and k, of the CPCA), the registration entry for cadastral plan (plano de catastro) number [Valor 006], issued by the Registro Nacional, is annulled.
IX.REGARDING COSTS (COSTAS).- Pursuant to section 193 of the Código Procesal Contencioso Administrativo, litigation costs and attorneys’ fees (costas procesales y personales) constitute a burden imposed on the unsuccessful party by virtue of having lost. In this case, because this is an action seeking a declaration that an administrative act is harmful to the public interest (lesividad), in which, logically, there was administrative action favorable to the defendants, this Court finds that, with respect to [Nombre62 002] and the Estate of [Nombre62 001], the matter under consideration should be resolved without a specific award of costs. Furthermore, pursuant to section 197(1) of the Código Procesal Contencioso Administrativo, because INDER withdrew claim number 4 during the Preliminary Hearing, the matter should be resolved without a specific award of costs with respect to Banco de Costa Rica.
POR TANTO
The action seeking a declaration of harmfulness filed herein is granted. The resolution adopted by the Board of Directors of the Instituto de Desarrollo Agrario (now INDER), in Article 66 of session number 041-05, held on 24 de octubre de 2005, is declared harmful to the public interest and, consequently, is partially annulled, solely with respect to the authorization for the segregation and conveyance of parcel 79 of Asentamiento [Nombre 003] to [Nombre62 001] and [Nombre62 002], as described in registered survey plan number [Valor 006]. By reason of relatedness, public deed number fifteen, executed before notary Jimmy Meza Lázarus at eight o’clock on veintisiete de octubre de dos mil cinco, is partially annulled, solely insofar as it formalized the segregation and conveyance of parcel 79 of Asentamiento [Nombre 003] to [Nombre62 001] and [Nombre62 002]. By reason of relatedness, the registration entry for real-property folio number [Valor 019] of the Puntarenas Registry District, issued by the Registro Nacional, is annulled.

Voto N° 019-2022-II TRIBUNAL CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA, SECCIÓN SEGUNDA. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ. Goicoechea, a las once horas treinta minutos del once de marzo de dos mil veintidós.- Proceso de conocimiento (lesividad), declarado de puro derecho, interpuesto por el Instituto de Desarrollo Rural (en adelante INDER), cédula de persona jurídica número CED19554; contra la Sucesión de [Nombre62 001]; [Nombre62 002], cédula de identidad [Valor CED63] ; y el Banco de Costa Rica, cédula de persona jurídica CED233. Intervienen los abogados Nancy Campos Porras en calidad de apoderada especial judicial del INDER y Alfonso Alejandro Faba Alpízar en condición de apoderado general judicial del Banco de Costa Rica. Participa el Estado como tercero interesado.- A continuación, se emite la sentencia con el voto unánime de sus miembros.

CONSIDERANDO
II.POSICIÓN DE LA DEMANDA.- La representación del INDER argumenta en lo pertinente lo siguiente: "FUNDAMENTACIÓN. SOBRE LOS TERRENOS PERTENECIENTES A LA ZONA INALIENABLE DE LA FRONTERA SUR. Los terrenos comprendidos dentro de la franja de dos mil metros que discurre a lo largo de la Frontera con Panamá, constituyen por voluntad del legislador bienes de dominio público, afectación de vieja data tutelada desde el siglo XIX, primeramente en el Código Fiscal, No. 8 del 31 de octubre de 1885, afectación que luego sufrió algunas modificaciones. Con Decreto número 3 de 29 de octubre de 1914 se declara indenunciable una zona de cincuenta kilómetros de ancho a lo largo de la frontera definitiva con la República de Panamá, posteriormente con leyes números 11 de 22 de octubre de 1926 y 149 del 16 de agosto de 1929, se reduce la afectación a cinco kilómetros de ancho a lo largo de la frontera con Panamá y ocho con Nicaragua; más adelante, la ley de Terrenos Baldíos, No. 13 de 10 de enero de 1939, modifica el tamaño, reduciéndola a dos kilómetros, siendo que en su artículo 10 se establecía: "Son asimismo inalienables los terrenos comprendidos en una zona de dos kilómetros de ancho, a lo largo de la frontera con Nicaragua y con Panamá".
Con Decreto número 6 se reglamenta la ley de Terrenos Baldíos, y en su artículo 15 inciso f), se faculta al Poder Ejecutivo para dar en arrendamiento los terrenos comprendidos en una zona de dos kilómetros de ancho a lo largo de la frontera con Nicaragua y con Panamá; todo ello con la finalidad de conservarlos dentro del dominio público y permitir un aprovechamiento por tiempo definido a quienes satisfagan una serie de requisitos y asumieran algunos compromisos, entre ellos, dar uso directo al terreno para el fin que se entregó. Finalmente, con la promulgación de la Ley 2825 de Tierras y Colonización del 14 de octubre de 1961, y sus reformas, se perpetúa hasta nuestros días esta afectación, siendo que el artículo7 inciso f) estipula: "Mientras el Estado, por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Tierras y Colonización, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncia o posesión, los comprendidos en una zona de 2.000 metros de ancho a lo largo de las fronteras con Nicaragua y con Panamá". [Transcribe parcialmente la resolución N°2306-91 de las 14:45 horas del 6 de noviembre de 1991, de la Sala Constitucional]. [Transcribe parcialmente el dictamen C-146-2008 del 5 de mayo de 2008, de la Procuraduría General de la República]. [Cita doctrina].
La Sala Constitucional en la resolución número 2008-008309 de las nueve horas y quince minutos del dieciséis de mayo del dos mil ocho, establece los elementos de conceptualización de los bienes demaniales. [Transcribe parcialmente la resolución]. Lo anterior cumple con el elemento teleológico que los terrenos que pertenecen a la Zona Fronteriza Sur, por ser del Estado, son inembargables, inalienables, no susceptibles de ser adquiridos por posesión y la acción del Estado para recuperarlos es imprescriptible, con lo que se infieren las características de un bien de dominio público, según las establece la Sala Constitucional en la sentencia número 1991-02306, de las catorce horas cuarenta y cinco minutos del seis de noviembre de mil novecientos noventa y uno. [Transcribe parcialmente la resolución]. Conforme a lo anterior, el acto administrativo dictado por mi representada, en el acuerdo tomado por la Junta Directiva artículo 66 de la sesión 041-05, efectuada el 24 de octubre de 2005, que autorizó segregar y traspasar la parcela número 79 del Asentamiento [Nombre62 004], con una medida de 29.963,85 m2, sito en la Provincia de Puntarenas, Cantón de Coto Brus, Distrito Sabalito, ubicado en Progreso, al amparo de la Ley 2825 (Ley de Tierras y Colonización), específicamente dentro del Programa ordinario de Titulación, dentro de la unidad agronómica formada por la finca inscrita al Folio Real de Puntarenas [Valor 008], a Nombre62 del Instituto, traspaso a favor de los señores [Nombre62 001], cédula de identidad número [CED104 ] y [Nombre62 002] , cédula de identidad [CED136 ], resulta absolutamente nulo porque el terreno objeto de este proceso se encuentra dentro de la zona inalienable de los 2000 metros de la zona Fronteriza Sur, por lo que se constituye en predio de dominio público, en virtud de lo antes expuesto y en resguardo del Dominio Público, es que mi representada solicita la nulidad del título otorgado.
VICIOS DE NULIDAD EN LOS ELEMENTOS DE VALIDEZ DEL ACTO ADMINISTRATIVO. De los hechos relatados en esta demanda y la documentación que consta en el expediente administrativo, se concluye que existe una nulidad absoluta, al titular un predio comprendido dentro de la zona inalienable de la Zona Sur; al respecto el artículo 158 de la Ley General de la Administración Pública, dispone que la falta o defecto de algún requisito del acto administrativo expresa o implícitamente exigido por el ordenamiento jurídico constituirá un vicio de éste, artículo que se relaciona con el 166 de la misma ley que establece que habrá nulidad absoluta del acto cuando falte totalmente uno o varios elementos constitutivos, real o jurídicamente y el artículo 167 que dispone que habrá nulidad relativa del acto cuando sea imperfecto uno de sus elementos constitutivos, salvo que la imperfección impida la realización del fin en cuyo caso la nulidad será absoluta.
El artículo 133 de la Ley General de la Administración Pública, al referirse al motivo como elemento de validez del acto administrativo, dispone que éste tiene que ser legítimo y existir tal y como ha sido tomado en cuenta para dictar el acto. La Junta Directiva del IDA autorizó el traspaso del lote en cuestión, aparentemente porque se había cumplido con todos los requisitos establecidos por el Reglamento de Selección de adjudicatarios, siendo este el motivo del acto administrativo que acordó el traspaso de la parcela a los solicitantes. Por su parte, el artículo 132 de la misma ley, establece que el contenido del acto administrativo debe ser lícito, posible, claro, preciso y abarcar todas las cuestiones de hecho y derecho surgidas del motivo. Al tratarse de un terreno afectado por la inalienabilidad, terrenos que por sus características pertenecen al Estado, el acuerdo que autorizó el traspaso de este se torna ilícito, ya que se trata de un bien inalienable de dominio público de acuerdo a lo supra citado, que jurídicamente no es posible traspasarlo a particulares, dado que el bien está fuera del comercio de los hombres y destinado al servicio de la comunidad, por lo que es un acto lesivo al interés público.
CONTENIDO ILEGAL Y LESIVIDAD DEL ACTO. Mi representada consciente del error administrativo cometido al autorizar y formalizar la segregación del terreno objeto de esta demanda, sin la debida verificación de que no se afectaba terrenos del Estado, dispuso de conformidad con el artículo 34 del Código Procesal Contencioso Administrativo, declarar la Lesividad de su conducta mediante Acuerdo de Junta Directiva, Artículo 54 de la Sesión Ordinaria 003-2015, efectuada el 26 de enero de 2015, para continuar conforme esta normativa con la presente demanda cuyo propósito es anular el acto administrativo viciado de nulidad absoluta y los conexos a éste, que generaron o son dependientes del título de propiedad, al haberse gestionado este título ante el Registro Nacional sin cumplir, el acto administrativo, con requisitos esenciales dados por ley, nulidad absoluta que debe ser declarada por la autoridad judicial, por lo que de conformidad con la norma indicada, así se demanda en este proceso".
III.POSICIÓN DEL BANCO DE COSTA RICA.- La representación del Banco contesta lo siguiente: "Resulta evidente que en este caso, el Banco no ha tenido ninguna injerencia ni intervención en los hechos debatidos en esta demanda, pues cualquier situación anómala en este asunto, si es que se ha dado, se produjo con anterioridad a la constitución del crédito hipotecario a favor del Banco, mismo que fue debidamente consumido conforme a derecho en su oportunidad; y así se encuentra inscrito en la sección respectiva del Registro Inmobiliario, situación que no se hubiera producido ni consolidado de haber existido algún problema con el inmueble hipotecado que impidiera la constitución del gravamen que interesa, pues tal y como aparece en el informe registral actual, los señores [Nombre62 001] y [Nombre62 002] son propietarios del inmueble objeto de este litigio desde diciembre de 2005, y la hipoteca a favor del Banco se constituyó en agosto del 2008, es decir más de dos años y seis meses posterior a la inscripción de la finca en su favor.
Todas las circunstancias sobrevenidas acerca del inmueble y que son objeto de la litis, no constaba en el Registro al momento en que se constituyó el gravamen. El Banco, en su momento, actuó con sustento en los principios de fe pública registral, de seguridad jurídica que deviene y se deriva de dicha publicidad y del principio de especialidad, según el cual se exige que los derechos registrados estén debidamente definidos o registrados respecto a su titularidad, contenido, limitaciones, naturaleza de los inmuebles sobre los que recaen, teniendo como finalidad mantener una clara y precisa individualización de cada inmueble (artículos 460 y 462 del Código Civil). Conforme a lo expresado, y en debida armonía con los principios indicados anteriormente, es que se procedió a constituir la hipoteca inscrita bajo las citas [Valor 007], fundamentada en la seguridad jurídica que se desprende de la publicidad registral, debiendo ratificarse el derecho de mi representado por esa Autoridad Judicial por encontrarse plenamente ajustada conforme a derecho.
Valga la oportunidad para indicar, que respecto del tercero de buena fe que ha adquirido derechos al amparo de la publicidad registral, los actos o contratos con respecto a él, gozan de una presunción de legitimidad y eficacia iuris et de iure, por lo que no serán anulables; ello se desprende de la armónica relación de los artículos 17, 18, 21, 22, 456, 457, 462, 471,474 y 477 del Código Civil. Resulta de suma relevancia para este caso, lo dispuesto en el artículo 456 del Código Civil, normativa perfectamente aplicable en el caso que nos ocupa; que en lo conducente establece: "Sin embargo, los actos o contratos que se ejecuten u otorguen por persona que en el Registro aparezca con derecho para ello, una vez inscritos no se invalidarán en cuanto a tercero, aunque después se anule o resuelva el derecho del otorgante en virtud de título no inscrito o de causas implícitas o causas que aunque explícitas no consten en el Registro".
Además, el artículo 22 establece: "La ley no ampara el abuso del derecho o el ejercicio antisocial de éste. Todo acto u omisión en un contrato, que por la intención de su autor, por su objeto o por las circunstancias en que se realice, sobrepase manifiestamente los límites normales del ejercicio de un derecho, con daño para tercero o para la contraparte, dará lugar a la correspondiente indemnización y a la adopción de las medidas judiciales o administrativas que impidan la persistencia en el abuso". Es claro que nos encontramos dentro del presupuesto que se establece en la ley, debido que cuando se constituyó la hipoteca sobre el inmueble, objeto de este proceso, los señores [Nombre62 001] y [Nombre62 002] , aparecían y aparecen aún como legítimos propietarios del inmueble que se hipotecó en primer grado, y en consecuencia con suficiente derecho para brindar el consentimiento de hipotecar el bien.
Además, constando que sobre el bien no aparecían limitaciones ni anotaciones que alertaran o impidieran la constitución e inscripción de la respectiva hipoteca. Con todo, aún cuando esta acción prosperara contra la parte demandada, no podrá afectar los derechos derivados de la garantía real constituida a favor de mi representado, como tercero de buena fe, de conformidad con lo dispuesto en la norma precitada. EXCEPCIONES. Procedo a interponer las excepciones de falta de Legitimación activa y pasiva así como la falta de Derecho, todo ello en relación en la calidad de acreedora hipotecaria de mí representada y por estar incluso cancelada la operación de crédito número CED61148 desde octubre del año 2017".
IV.POSICIÓN DE [Nombre62 002] Y LA SUCESIÓN DE [Nombre 001] .- La señora [Nombre 005] en su condición personal y como albacea de la Sucesión de [Nombre62 001], contesta lo siguiente: "1. En el Juzgado Agrario del II Circuito Judicial De La Zona Sur, Corredores, se tramita el proceso sucesorio N°19-000007-0419-AG, de quien en vida fue [Nombre62 001] quien fuera [...], cédula de identidad número [Valor CED11782] . Mediante resolución visible en expediente electrónico a las diez horas y cincuenta minutos del cuatro de marzo de dos mil diecinueve se me nombró como ALBACEA PROVISIONAL a la suscrita [Nombre62 002]. Aporto certificación de albaceazgo. 2. Soy una adulta mayor de escasos recursos, por lo que por la falta de conocimiento no me había apersonado. 3. Con respecto al presente proceso manifiesto que no tengo oposición alguna en que se anulen la escrituras, las cuales están inscritas a Nombre62 de la suscrita [Nombre62 006] y de mi esposo fallecido, razón por la cual me allano en el presente proceso. 4.
Por lo anteriormente citado solicito se establezca que tengo prioridad para que el INDER me otorgue la concesión del citado terreno. 5. No me presentaré a las audiencias que cite su autoridad, ya que por mi edad, condición económica y lejanía de su despacho, se me haría materialmente imposible hacerlo, y también porque no me opongo en nada al presente proceso. 6. Existe otro proceso por la misma causa, actor, demandados, despacho, bajo el expediente 17-0098464027-CA (sic), por lo que solicito que se acumule al presente proceso, esto por economía procesal. 7. Solicito que no se me condene en costas pues actúo de buena fe".
VI.SOBRE EL FONDO.- PROCEDENCIA DE LA DEMANDA. INALIENABILIDAD DE LAS FRANJAS FRONTERIZAS.- En este proceso se pretende la declaratoria de nulidad parcial del acuerdo adoptado por la Junta Directiva del Instituto de Desarrollo Rural, en el artículo 66 de la sesión 041-05, celebrada el 24 de octubre de 2005, en lo que se refiere a la autorización de segregación y traspaso de un terreno a favor de [Nombre62 001] y [Nombre62 002], descrito según el plano catastrado número [Valor 006], así como la nulidad parcial de la escritura pública número 15, otorgada ante el Notario Jimmy Meza Lázarus, a las 08:00 horas del 27 de octubre de 2005, únicamente en lo que se refiere al traspaso de la Parcela 79 del Asentamiento [Nombre62 003], a favor de [Nombre62 001] y [Nombre62 Placa704], que generó la matrícula registral folio real Placa4033 , derechos cero cero uno y cero cero dos, del Partido de Puntarenas, plano catastrado número [Valor 006] y, en consecuencia, por conexidad, la nulidad del asiento registral de la inscripción de la finca inscrita bajo sistema de Folio Real ut supra y sobre el gravamen que soporta el inmueble de cita por crédito hipotecario en favor del Banco de Costa Rica, por un monto de seis millones de colones, gravamen que fue inscrito en la sección Hipotecas del Registro Inmobiliario, bajo las citas registrales [Valor 017] y cuyo deudor era el señor [Nombre62 007].
Según la prueba técnica documental que consta en autos y que no fue combatida por los demandados en vista del allanamiento a la demanda, el inmueble citado se encuentra inmerso y traslapado parcialmente dentro de la denominada Franja Fronteriza Sur que, por disposición de Ley, es inalienable y de titularidad estatal desde 1926. -La franja fronteriza Norte ya lo era desde el Decreto del Congreso N°30 del 22 de junio de 1888-. Efectivamente, en lo que atañe a la franja limítrofe sur, la Ley N°11 del 22 de octubre de 1926 reformó algunos artículos del Código Fiscal de 1885, en lo que aquí interesa, así: "Artículo 508.-Son tierras baldías todas las comprendidas en los límites de la República que no pertenezcan con título legítimo a particulares, las cuales se presumen baldías mientras no se pruebe lo contrario. Los terrenos baldíos, ya estén situados en las islas, ya en tierra firme, pertenecen al Estado".
"Artículo 509.-La propiedad de las tierras baldías es inalienable con las únicas excepciones siguientes: (...) Transitorio.-La disposición del inciso 29 de este artículo, y conforme a la reforma que se le ha introducido, se contrae a los terrenos ocupados hasta la fecha en la cual entre en vigencia la presente ley". "Artículo 510.-Las enajenaciones que permite el artículo anterior no podrán recaer nunca sobre los siguientes terrenos, los cuales son en su extensión, inalienables: (...) 4°-Los comprendidos en la zona de cinco kilómetros de ancho a lo largo de la frontera con Panamá. 5°-Los comprendidos en una zona de doscientos metros a lo largo de la frontera con Nicaragua". Posteriormente, la Ley General sobre Terrenos Baldíos (N°13 del 10 de enero de 1939) derogó el artículo 510 del Código Fiscal, pero mantuvo la inalienabilidad de ambas franjas fronterizas disponiendo así: "Artículo 10.- Son asimismo inalienables los terrenos comprendidos en una zona de dos kilómetros de ancho, a lo largo de la frontera con Nicaragua y con Panamá".
La Ley General sobre Terrenos Baldíos tiempo después fue, a su vez, derogada por el artículo 184 de la Ley de Tierras y Colonización (N°2825 del 14 de octubre de 1961). Sin embargo, ésta última legislación, en su artículo 7 inciso f), mantuvo el carácter demanial de las referidas franjas fronterizas norte y sur, al preceptuar lo siguiente: “Mientras el Estado, por voluntad propia o por indicación del Ministerio de Agricultura o del Instituto de Desarrollo Agrario, atendiendo razones de conveniencia nacional, no determine los terrenos que deben mantenerse bajo su dominio, se considerarán inalienables y no susceptibles de adquirirse por denuncio o posesión, salvo los que estuvieren bajo el dominio privado, con título legítimo, los siguientes: … f) Los comprendidos en una zona de 2.000 metros de ancho a lo largo de las fronteras con Nicaragua y con Panamá. (…)”. Pues bien, este compendio normativo deja total claridad sobre la imposibilidad jurídica de que algún predio ubicado totalmente o parcialmente dentro de la zona fronteriza (2.000 metros de ancho a lo largo de las fronteras con Nicaragua y con Panamá), sea susceptible de ser poseído o adquirido bajo cualquier título por sujetos particulares, menos que sea enajenable a favor de terceros con imposición de gravámenes hipotecarios por créditos garantizados, como ocurre en la especie.
Sobre la naturaleza y características de las franjas fronterizas, la Sala Constitucional ha señalado: "Respecto a la franja fronteriza, tenemos que la Ley de Terrenos Baldíos, No. 13 de 10 de enero de 1939, en el artículo 10 dispuso: "Son asimismo inalienables los terrenos comprendidos en una zona de dos kilómetros de ancho, a lo largo de la frontera con Nicaragua y con Panamá". Dicha protección nace a raíz de que nuestras zonas fronterizas siguen siendo consideradas indispensables para el país, no sólo por razones de defensa de la soberanía del país, ante la importancia que tiene reservarlas como zonas estratégicas para la seguridad de la Nación, sino también por su relevancia desde el punto de vista de la protección del patrimonio natural del Estado. Las zonas fronterizas por su posición y cobertura se convierten en un área sumamente importante para la protección del medio ambiente como territorio, una zona de amortiguamiento indispensable para la comunicación de la flora y fauna, recursos hídricos y del ecosistema imperante en determinadas regiones del país, y por ende, el interés y la necesidad del Estado costarricense de regular y proteger los recursos naturales existentes hoy en día, y que sin el control y la limitación en cuanto a su disposición por parte de las autoridades competentes, pondrían en grave peligro el derecho a un ambiente sano".
(Resolución N°2988-99 de las 11:57 horas del 23 de abril de 1999). En el mismo sentido, la Sala Constitucional expresó: "No es casualidad que el ordenamiento jurídico costarricense haya preservado la titularidad pública estatal de las zonas internas limítrofes de las fronteras, tanto del norte como del sur del país, bajo un régimen especial, dado que, por su especial naturaleza, representan zonas estratégicas para la defensa de la soberanía y para la seguridad de la Nación; así como para el establecimiento de controles en materias de claro interés público como la salud, aduanas, migración, salida e ingreso de mercancías, entre otros. De manera tal, que la desafectación indiscriminada y en forma general que contiene el consultado Proyecto de Ley, sin contar, de previo, con un estudio técnico que establezca en concreto cuáles son los inmuebles que se van a desafectar, a fin de valorar, entre otros, si ello pone o no en peligro la seguridad de la Nación o si impide un efectivo ejercicio de la soberanía, o un adecuado control migratorio o aduanero, etcétera, resulta irracional y desproporcionado, lo que resulta contrario a los Principios Constitucionales de Seguridad y Soberanía".
(Resolución N°18836-2014 del 18 de noviembre de 2014). Como se observa, la Sala Constitucional, es clara en reconocer la demanialidad de las zonas fronterizas norte y sur del país, a partir de la normas legales que así lo disponen, pero además refuerza su carácter de tal (de dominio público), en atención a los fines superiores constitucionales que dichas áreas protegen, como lo son el derecho a un ambiente sano y ecológicamente equilibrado, la salud, el control migratorio, el control de aduanas y la defensa de la soberanía y la seguridad nacionales. Ahora bien, sobre la naturaleza de los bienes de dominio público, la Sala Constitucional ha señalado: “…se trata de bienes cuya titularidad ostenta el Estado en su condición de administrador, debe entenderse que se trata de bienes que pertenecen (sic) la "Nación", con lo cual, conforman parte del patrimonio público; y que, por su especial naturaleza jurídica, presentan los siguientes atributos: son imprescriptibles, lo cual implica que por el transcurso del tiempo, no puede adquirirse el derecho de propiedad sobre ellos, ni siquiera de mera posesión, es decir, no pueden adquirirse mediante la usucapión, así como tampoco pueden perderse por prescripción; motivo por el cual los permisos de uso que la Administración conceda sobre ellos, siempre tienen un carácter precario, lo cual hace que puedan ser revocadas por motivos de oportunidad o conveniencia en cualquier momento por la Administración –en los términos previstos en los artículos 154 y 155 de la Ley General de la Administración Pública–; y las mismas concesiones que se otorguen sobre ellos para su aprovechamiento, pueden ser canceladas, mediante procedimiento al efecto; son inembargables, que hace que no pueden ser objeto de ningún gravamen o embargo, ni por particulares, ni por la Administración; y son inalienables, lo que se traduce en la condición de que están fuera del comercio de los hombres; de donde no pueden ser enajenados, vendidos o adquiridos, ni a título gratuito ni oneroso, ni por particulares, ni por el Estado, de modo que están excepcionados del comercio los hombres y sujetos a un régimen jurídico especial y reforzado”.
(Resolución N°2007-2408 16:13 horas del 21 de febrero de 2007). En efecto y en orden a lo anterior, los bienes de dominio público son aquellos que están destinados a un uso o a un servicio público, se encuentran fuera del comercio de los hombres, se caracterizan por ser imprescriptibles, inembargables e inalienables, y gozan de un régimen jurídico especial reforzado (artículos 261 y 262 del Código Civil y 121 inciso 14 de la Constitución Política). En este caso, siendo que la franja fronteriza sur (2.000 metros de ancho a lo largo de la frontera con Panamá) es un bien demanial, como ha sido debidamente explicado, los terrenos que comprenden total o parcialmente esa área, lógicamente, tienen también la característica de ser inalienables y de estar fuera del comercio de los hombres, con lo cual cualquier causa adquisitiva es nula de plena derecho y con ello, cualquier gravamen convencional que se imponga sobre ellos.
Consecuentemente, es palmario que la parcela 79 del Asentamiento [Nombre62 003] que se encuentra ubicada parcialmente traslapada dentro de esa franja limítrofe sur, no podía ser traspasada a favor de [Nombre62 001] y [Nombre62 002], bajo ningún título, mucho menos a través de un acto administrativo como se hizo en este caso, en clara violación del principio de reserva de ley, pues debe recordarse que el uso público o servicio público al que es afectado un determinado bien demanial, solo puede ser variado mediante Ley, por ser competencia exclusiva de la Asamblea Legislativa, de acuerdo con el precepto 121 inciso 14 de la Constitución Política, no siendo oponible el título privado que resultó de la inscripción registral, pues debe recordarse que de acuerdo con el artículo 456 del Código Civil, la inscripción en el Registro no convalida actos o contratos inscritos que sean nulos conforme a la Ley.
Así las cosas, por las violaciones jurídicas expuestas, se concluye que el acuerdo adoptado por la Junta Directiva del Instituto de Desarrollo Rural, en el artículo 66 de la sesión 041-05, celebrada el 24 de octubre de 2005, es absolutamente nulo por vicios en su motivo, contenido y fin (artículos 131, 132, 133, 158, 164 inciso 2, 166 y 186 de la Ley General de la Administración Pública), únicamente respecto de la autorización de la segregación y traspaso de la parcela 79 del Asentamiento [Nombre 003] a favor de [Nombre62 001] y [Nombre62 002], según el plano catastrado número [Valor 006], así como también es absolutamente nula la escritura pública número 15, otorgada ante el Notario Jimmy Meza Lázarus, a las 08:00 horas del 27 de octubre de 2005, únicamente en cuanto materializó ese traspaso cuya inscripción generó la finca folio real matrícula [Valor 018] del Partido de Puntarenas; debiendo anularse también ese asiento registral de inscripción de dicha finca por conexidad.
VI.SOBRE LAS EXCEPCIONES.- Los demandados [Nombre62 001] y [Nombre62 002], no formularon excepciones en razón de haberse allanado a la demanda. Por su parte, el Banco de Costa Rica opuso las excepciones de falta de legitimación activa y pasiva y falta de derecho, no obstante, en la Audiencia Preliminar la representación del INDER desistió de la pretensión número 4, que era el único extremo de pretensión que fue deducido contra el Banco, por tal motivo debe tenerse por desistida la acción en relación con el Banco de Costa Rica, resultando improcedente emitir pronunciamiento sobre las excepciones planteadas por el ente financiero.
VIII.PRETENSIONES.- Con fundamento en todo lo expuesto, procede acoger la demanda en los siguientes términos. Se declara lesivo a los intereses públicos y, en consecuencia, se anula parcialmente el acuerdo adoptado por la Junta Directiva del Instituto de Desarrollo Agrario (hoy INDER), en el artículo 66 de la sesión número 041-05, celebrada el 24 de octubre de 2005, únicamente en lo que se refiere a la autorización de segregación y traspaso de la parcela 79 del Asentamiento [Nombre 003], a favor de [Nombre62 001] y [Nombre62 002], descrita en plano catastrado número [Valor 006]. Por conexidad, se anula parcialmente la escritura pública número quince, otorgada ante el notario Jimmy Meza Lázarus, a las ocho horas del veintisiete de octubre de dos mil cinco, únicamente en cuanto formalizó la segregación y traspaso de la parcela 79 del Asentamiento [Nombre 003], a favor de [Nombre62 001] y [Nombre62 002], que generó la finca folio real matrícula Placa13395 del Partido de Puntarenas, con plano catastrado número [Valor 006]. Por conexidad, se anula el asiento registral de inscripción de la finca folio real matrícula número Placa13395 del Partido de Puntarenas emitido por el Registro Nacional. Por conexidad (artículo 122 incisos a y k del CPCA), se anula el asiento registral de inscripción del plano de catastro número [Valor 006] emitido por el Registro Nacional.
IX.SOBRE LAS COSTAS.- De conformidad con el numeral 193 del Código Procesal Contencioso Administrativo, las costas procesales y personales constituyen una carga que se impone a la parte vencida por el hecho de serlo. En la especie, tratándose de una lesividad, en la que por criterio lógico existía una conducta administrativa de contenido favorable a los demandados, estima este Tribunal que, en relación con [Nombre62 002] y la Sucesión de [Nombre62 001], lo debido es resolver el asunto en examen sin especial condenatoria en costas. Por otra parte, de conformidad con el numeral 197 inciso 1) del Código Procesal Contencioso Administrativo, en razón del desistimiento de la pretensión número 4 que planteó el INDER en el transcurso de la Audiencia Preliminar, procede resolver sin especial condena en costas en relación con el Banco de Costa Rica.
POR TANTO
Se declara con lugar la demanda por Lesividad interpuesta. Se declara lesivo a los intereses públicos y, en consecuencia, se anula parcialmente el acuerdo adoptado por la Junta Directiva del Instituto de Desarrollo Agrario (hoy INDER), en el artículo 66 de la sesión número 041-05, celebrada el 24 de octubre de 2005, únicamente en lo que se refiere a la autorización de segregación y traspaso de la parcela 79 del Asentamiento [Nombre 003], a favor de [Nombre62 001] y [Nombre62 002], descrita en plano catastrado número [Valor 006]. Por conexidad, se anula parcialmente la escritura pública número quince, otorgada ante el notario Jimmy Meza Lázarus, a las ocho horas del veintisiete de octubre de dos mil cinco, únicamente en cuanto formalizó la segregación y traspaso de la parcela 79 del Asentamiento [Nombre 003], a favor de de [Nombre62 001] y [Nombre62 002]. Por conexidad, se anula el asiento registral de inscripción de la finca folio real matrícula número [Valor 019] del Partido de Puntarenas emitido por el Registro Nacional. Por conexidad, se anula el asiento registral de inscripción del plano de catastro número [Valor 006] emitido por el Registro Nacional.
