SECTION I. Anexo A del Segundo Circuito Judicial de San José, Dirección01, at eight ten in the morning on ocho de junio del dos mil veintidós.
Ordinary proceeding number 21-05593-1027-CA, filed before the Tribunal Contencioso Administrativo y Civil de Hacienda by: Nombre24251 and Nombre163501, against: the State.
Following deliberation and unanimously, Reporting Judge (Jueza Ponente): Yazmín Aragón Cambronero WHEREAS (CONSIDERANDO)
I.The representative of the State filed an appeal with a concurrent claim of nullity (nulidad concomitante) against resolution number 220-2022, issued by Processing Judge (Jueza Tramitadora) Cindy Chavarría Hernández of the Tribunal Contencioso Administrativo y Civil de Hacienda at 11:00 hours on 11 de febrero del 2021, which ordered:
“In accordance with the foregoing, the cited case law, and section 12(2) of the Administrative Litigation Procedure Code (Código Procesal Contencioso Administrativo), the preliminary defense (defensa previa) of mandatory passive joinder (litis consorcio pasivo necesario) with the Sistema Nacional de Áreas de Conservación-SINAC is DENIED. SINAC shall be notified of the existence of the proceeding so that it may state whether it wishes to appear as an interested third party (tercero interesado) in this litigation once this resolution becomes final (…)”.
The appeal was admitted, and the respondents were given an opportunity to address the grounds for appeal, which the plaintiff did not avail itself of, whereupon this collegiate appellate body issues its ruling.
In the present case, the appellant essentially contends that resolution 220-2022 clearly recognizes that the plaintiff seeks a property right (derecho de propiedad) over land located within Reserva Forestal Los Santos; nevertheless, it found that Sistema Nacional de Áreas de Conservación (SINAC) could participate as an interested party because no conduct or administrative act of that body, which has instrumental legal personality (personalidad jurídica instrumental), was being challenged. She asserts that the claims affect the administration and protection of the property entrusted to SINAC because it is the administrator of Patrimonio Natural del Estado and has instrumental legal personality, pursuant to the powers conferred upon it by sections 6(a), 13, 14, 15, and 18 of Ley 7575; 22 and 28 of Ley 7788; and 32, paragraph 2, of Ley 7554 (constitutional decisions 16975-2008, 13073-2009, and 12716- 2012; Sala Primera, judgments 1070-F-S1-2010 and 286-F-S1-2015; Tribunal Contencioso Administrativo, decisions 474-2005-II, 1842-2009-VI, 38-2010-VI, 2642-2010-VI, 68-2013-IV, 74-2014-V, and 70-2015-VIII).
She cautions that SINAC must be joined as a necessary passive co-party (litisconsorte pasivo necesario) if the relief sought in the complaint, as is the case here, affects title to the property or SINAC’s authority to protect it—citing in support decision 274-2021-II of 7:31 hrs. on 15 de julio de 2021, issued by the Sección Segunda of this Tribunal de Alzada. She maintains that, to avoid depriving SINAC of an opportunity to defend itself in exercising its powers of administrative self-protection (autotutela) (Civil Procedure Code [Código Procesal Civil], sections 22.1 and 32.1), it must be joined as a necessary passive co-party, even though no conduct issued by it is challenged, thereby preventing the future nullity of procedural stages carried out without its participation as a defendant—citing in support judgments of the Sala I de la Corte Suprema de Justicia numbers 921-F-S1-2015 of 14:35 hrs. on 6 de agosto de 2015 and 1239-F-S1-2020 of 11:50 hrs. on 31 de marzo de 2020, and decision 290 of this Tribunal de Alzada dated 17 de mayo de 2013.
She adds that Sistema Nacional de Áreas de Conservación, in official letter No.SINAC-ACC-D-of-426-2021 of 7 de junio de 2021, certified that plan SJ-1056059-2006 in the name of Nombre163501, with an area of 47 Ha 1686.61 m2, lies entirely within Reserva Forestal Los Santos, created by Decreto 5389, and overlaps the land described in plan SJ-2176662-2020, administered by MINAE-SINAC, within that protected wilderness area (área silvestre protegida) belonging to Patrimonio Natural del Estado (answer filed on 30 de noviembre de 2021, Evidence 1). Consequently, pursuant to section 32 of the Ley Orgánica del Ambiente, section 13 of the Ley Forestal, sections 22 and 28 of the Ley de Biodiversidad, and sections 22.1 and 32.1 of the Código Procesal Civil, she requests that resolution 220-2022 be reversed and that Sistema Nacional de Áreas de Conservación instead be joined as a necessary passive co-party.
First, it should be noted that, when filing the appeal, the State’s representative alleged the concurrent nullity of the resolution under appeal. Nevertheless, upon reviewing the stated grounds for appeal in their entirety, it is clear to this Chamber that all of them challenge the merits of the decision and that the relief requested consists solely of reversal of the challenged order. Therefore, this Appellate Body will address only the merits, without examining the claimed nullity. Accordingly, to issue the ruling required by law, it is necessary to briefly recount the trial judge’s relevant findings concerning this particular case:
“(...) THIRD: In summary, the plaintiff alleges and seeks a declaration of a property right over land purportedly constituting public-domain property (bien demanial), which, according to the State, is located in Reserva Forestal Los Santos. Consequently, the defendants argue that, because the property belongs to Patrimonio Natural del Estado, SINAC must be joined pursuant to section 12.2, as it is a body attached to MINAE, has instrumental legal personality, and the administration and protection of the property at issue are affected. FOURTH: Pursuant to section 12.2 of the Código Procesal Contencioso Administrativo, for the ‘body’ to be deemed a necessary passive co-party, the conduct at issue in the proceeding must have been carried out by that body attached to the entity responsible for the relevant subject matter. Although SINAC has instrumental legal personality and is attached to MINAE, SINAC did not issue any administrative conduct or act that it must defend against the plaintiff by contesting the claims on that basis. In this particular case, the action is brought directly against MINAE (the State), because it is the entity responsible for defending public-domain assets (bienes de dominio público), represented by the Procuraduría General de la República, and SINAC’s participation as a necessary passive co-party is not indispensable to resolving the matter. That body may participate in the proceeding because it administers those assets and has a direct interest; that is, by intervening as a third party (tercería) pursuant to section 15 of the CPCA. As stated, no conduct or administrative act emanating from SINAC is challenged, and nothing to the contrary can be inferred from that section. Consequently, section 12.2 of the Código Procesal Contencioso Administrativo DOES NOT apply in this case, and Sistema Nacional de Áreas de Conservación therefore must NOT participate as a Necessary Passive Co-Party, as stated; instead, it may PARTICIPATE, if it so chooses, as a third-party intervener in the proceeding and jointly defend that conduct—the property’s public-domain status (demanialidad del bien)—but from a different standpoint..(...).”
In this case, this Collegiate Body finds the well-founded arguments of the State’s representative persuasive for the following reasons: As to the substantive issue under dispute, proper joinder of the parties (integración de la litis) ensures respect for the right of defense of all persons or entities, whether public or private, who, by operation of law or because of the nature of the substantive legal relationship (relación jurídica material), may be affected by the decision on the merits; it also ensures effective enforcement of the judgment ultimately entered (section 22.1 of the Código Procesal Civil, read in conjunction with section 220 of the Código Procesal Contencioso Administrativo). To determine whether mandatory passive joinder is necessary, the adjudicator must analyze the claim. In this particular case, the subject matter of the proceeding, as set forth in the complaint, is, insofar as relevant, a request that the judgment declare the following:
“(...) 1) That judgment be entered declaring that we, the plaintiffs herein, are the lawful owners, having acquired the property described in cadastral plan (plano catastrado) SJ-1056059-2006, located in Naranjo Arriba, First District, Copey de Dota, Canton 17 of Dota, Province of San José, with an area of forty-seven hectares, one thousand six hundred eighty-six square meters and six square decimeters, through the exercise having (sic) of possession (posesión) transferred publicly, peacefully, uninterruptedly, in good faith, as owners and under color of title, commencing 10 years before the creation of the Reserva Forestal Dota, and that they have currently exercised lawful possession for 63 years. 2) That, by virtue of the foregoing declaration, the absolute nullity (nulidad absoluta) of cadastral plan SJ-2176662-2020, registered in the name of the State, be ordered because it unlawfully overlaps the property owned by the plaintiffs herein. 3) That the Public Property Registry (Registro Público de la Propiedad) be ordered to register in favor of the plaintiffs the property described in Cadastral Plan SJ-1056059-2006, subject to the corresponding restrictions and encumbrances. For Ms. Nombre21254, as holder of the usufruct right (derecho de usufructo), and Mr. Nombre163501, the bare ownership right (derecho de la nuda propiedad) (...). FIRST ALTERNATIVE CLAIM: (...) 1) That judgment be entered declaring that we, the plaintiffs herein, are the lawful owners, having acquired the property described in cadastral plan SJ-1056059-2006, located in Naranjo Arriba, First District, Copey de Dota, Canton 17 of Dota, Province of San José, with an area of forty-seven hectares, one thousand six hundred eighty-six square meters and six square decimeters, through the exercise having (sic) of possession transferred publicly, peacefully, uninterruptedly, in good faith, as owners and under color of title, commencing 10 years before the creation of the Reserva Forestal Dota, and that they have currently exercised lawful possession for 63 years. 2) That, as a consequence of such declaration, the State’s objection in the Possessory Title Proceedings (diligencias de Información Posesoria) 19-000011-0699-AG, pending before the Agrarian Court of Cartago in the names of the plaintiffs herein, be declared unfounded and unlawful. 3) That, by virtue of the foregoing declaration, the absolute nullity of cadastral plan SJ-2176662-2020, registered in the name of the State, be ordered because it unlawfully overlaps the property owned by the plaintiffs herein. 4) That the Public Property Registry be ordered to register in favor of the plaintiffs the property described in Cadastral Plan SJ-1056059-2006, subject to the corresponding restrictions and encumbrances. For Ms. Nombre21254, as holder of the usufruct right, and Mr. Nombre163501, the bare ownership right (...). SECONDARY ALTERNATIVE CLAIM (SIC): (...) 1) That the property possessed and owned by the plaintiffs, described in cadastral plan SJ-1056059-2006, located in Naranjo Arriba, First District, Copey de Dota, Canton 17 of Dota, Province of San José, with an area of forty-seven hectares, one thousand six hundred eighty-six square meters and six square decimeters, overlaps by an area of 5 hectares with cadastral plan SJ-2176662-2020, registered in the name of the State. 2) That, by virtue of the foregoing, judgment be entered declaring that we, the plaintiffs herein, are the lawful owners, having acquired the property described in cadastral plan SJ-1056059-2006, located in Naranjo Arriba, First District, Copey de Dota, Canton 17 of Dota, Province of San José, with an area of forty-seven hectares, one thousand six hundred eighty-six square meters and six square decimeters, through the exercise having (sic) of possession transferred publicly, peacefully, uninterruptedly, in good faith, as owners and under color of title, commencing 10 years before the creation of the Reserva Forestal Dota, and that they have currently exercised lawful possession for 63 years, excluding the area overlapping the Plan registered in the name of the State, SJ-2176662-2020. 3) That, by virtue of the declaration, the plaintiffs are entitled to register in their names with the Public Property Registry an area of forty-two hectares and one thousand six hundred eighty-six square meters. 4) That the National Cadastre (Catastro Nacional) be ordered to register a new plan in favor of the plaintiffs herein, excluding the area described in Cadastral Plan SJ-2176662-2020, registered in the name of the State. 5) That, once the cadastral plan in question has been registered, the Public Property Registry be ordered to register the property possessed by the plaintiffs. For plaintiff Nombre21254, as holder of the usufruct right, and Mr. Nombre163501, the bare ownership right (...)”.
IV.Furthermore, for a better understanding of the final ruling, it is essential to provide a brief summary of the matters in dispute, as follows: The principal antecedent to these plenary proceedings (proceso de conocimiento), brought by Nombre24251 and Nombre163501, is the Possessory Title Proceedings instituted by them before the Agrarian Court of Cartago under case number 19-000110699-AG-6, for the purpose of obtaining title to an area of forty-seven hectares, one thousand six hundred eighty-six square meters and six square decimeters, described in cadastral plan SJ-1056059-2006 and located in Naranjo Arriba, First District, Copey de Dota, Canton 17 of Dota, Province of San José. In responding to the hearing granted by an order issued by the Agrarian Judge at 10:23 on 26 de marzo del 2021, the State Attorney, in a submission dated 22 de junio del 2021, objected to the proceedings, asserting essentially that plan SJ-1056059-2006, on which they were based, overlaps by an area of five hectares with plan SJ-2176662-2020, registered with the National Cadastre in the name of the State and possessed by the Ministerio de Ambiente y Energía, as purportedly documented in report SINAC-ACCD-of-426-2021—images 121, 126, 129-130 of the main electronic case file.
He further argued that the lands described in both plans lie within Reserva Forestal Los Santos, a protected wildlife area (área silvestre protegida) forming part of the State’s natural heritage (patrimonio natural del Estado). Accordingly, by decision 2021000137 issued at 13:52 on 07 de julio del 2021, the aforementioned judicial body, pursuant to Article 8, paragraph II, of the Ley de Informaciones Posesorias, ordered the proceedings closed and directed the petitioners to pursue contentious-administrative proceedings (vía Contencioso Administrativa) for full adjudication of the title sought. Thus, these plenary proceedings were filed with the courts on 24 de febrero del año en curso, principally seeking recognition of possession exercised publicly, peacefully, uninterruptedly, in good faith, as owners and under color of title, commencing 10 years before the creation of Reserva Forestal Los Santos, on the contention that they have now lawfully exercised possession for 63 years.
In summary, they therefore seek the annulment of cadastral plan SJ-2176662-2020, registered in the name of the State and administered by the Ministerio del Ambiente y Energía, and the registration of the entire property in the plaintiffs’ names or, ultimately, the exclusion of the area overlapping the Plan registered in the name of the State, SJ-2176662-2020, followed by the issuance of title to the remainder of the land in their favor.
V.It is evident to this Chamber that the dispute concerns title to an area of five hectares lying within Reserva Forestal Los Santos. It should be noted that what is disputed is not the existence of the protected area, but rather the exclusion of the tract that the plaintiff claims to have possessed for more than sixty years, beginning 10 years before the creation of the Reserve, or, ultimately, the issuance of partial title to the claimed area, excluding the area covered by plan SJ-2176662-2020. Accordingly, it may be inferred that, sub lite, it is the nature of the substantive legal relationship (relación jurídica material) and the content of a potential judgment granting relief, as related to SINAC’s powers and the protection of the State’s natural heritage, that require SINAC to be joined in the litigation. Contrary to the Trial Judge’s interpretation, it is not the provision of section 12:2 of the Contentious-Administrative Procedure Code (Código Procesal Contencioso Administrativo) that determines SINAC’s participation as a defendant in this particular case, because these proceedings do not seek judicial review of the legality of administrative conduct, which is the factual circumstance established by that provision for joining as a defendant—in this case jointly with the State—an administrative body possessing instrumental legal personality (personalidad jurídica instrumental) (similarly, Voto 290-2013, issued by this Chamber at 16:30 on 17 de mayo del 2013).
It must be borne in mind, as the State’s representative points out, that pursuant to Article 32 of the Ley Orgánica del Ambiente, protected wildlife areas, in any of their categories—including forest reserves—shall be administered by the Ministerio de Ambiente y Energía. In turn, section 22 of the Ley de Biodiversidad creates the Sistema Nacional de Áreas de Conservación (SINAC), with its own legal personality, for the following purpose: “(...) it shall be a decentralized and participatory system of institutional management and coordination, integrating powers concerning forestry, wildlife, protected areas, and the Ministerio del Ambiente y Energía, for the purpose of establishing policies and planning and implementing processes aimed at achieving sustainability in the management of Costa Rica’s natural resources (...).” (Emphasis added). Consequently, because these proceedings concern title to real property lying at least partially within Reserva Forestal Los Santos—the State’s Natural Heritage—SINAC’s participation as a defendant is necessary, as required by the nature of the substantive legal relationship—section 22.1 of the Civil Procedure Code (Código Procesal Civil), read together with Article 220 of the C.P.C.A.
Mere notice of the existence of the proceedings pursuant to Article 15 of the Code governing this matter is plainly insufficient, because it does not fully guarantee the exercise of the defense available to an entity having the status of a defendant and a direct interest in the ultimate disposition of the proceedings. Accordingly, the appealed decision must be reversed.

Decision number 220-2022, issued by Processing Judge Cindy Chavarría Hernández of the Tribunal Contencioso Administrativo y Civil de Hacienda at 11:00 on 11 de febrero del 2021, is reversed, and the following is ordered in its stead: The defense of failure to join a necessary defendant (litis consorcio pasivo necesario), raised by the State, is sustained, and the Sistema Nacional de Áreas de Conservación (SINAC) shall be joined in that capacity. The plaintiff shall submit a complete copy of the case file to the Trial Court so that the required service may be effected, with the warning that no future filings will be considered if the plaintiff fails to do so. Voto Nº199-20 Nº 199-2022-I TRIBUNAL DE APELACIONES DE LO CONTENCIOSO ADMINISTRATIVO Y CIVIL DE HACIENDA. SECCION I. Anexo A del Segundo Circuito Judicial de San José, Dirección01 , a las ocho horas y diez minutos del ocho de junio del dos mil veintidós.
Proceso de conocimiento número 21-05593-1027-CA, establecido ante el Tribunal Contencioso Administrativo y Civil de Hacienda, por: Nombre24251 y Nombre163501 , contra: el Estado.

CONSIDERANDO
I.La representante del Estado, interpuso recurso de apelación con nulidad concomitante contra la resolución número 220-2022 dictada por la Jueza Tramitadora del Tribunal Contencioso Administrativo y Civil de Hacienda, Cindy Chavarría Hernández, a las 11:00 horas del 11 de febrero del 2021, en la que se dispuso:
“De conformidad con lo expuesto y lo que al respecto establece la jurisprudencia reseñada y el ordinal 12 inc 2) del Código Procesal Contencioso Administrativo se RECHAZA la defensa previa de Litis Consorcio Pasivo Necesaria con el Sistema Nacional de Áreas de Conservación-SINAC. Se ordena comunicar al SINAC la existencia del proceso en aras de que manifieste su deseo de constituirse como tercero interesado en la presente litis una vez firme la presente resolución(…)”.
El recurso fue admitido y se confirió audiencia a los recurridos sobre los agravios formulados, la cual no fue atendida por la parte actora, luego de lo cual, resuelve este órgano colegiado en alzada.
En el presente caso la recurrente considera en esencia, la resolución 220-2022, tiene claro que la actora pretende un derecho de propiedad sobre un terreno, ubicado dentro de la Reserva Forestal Los Santos, sin embargo, estimó que el Sistema Nacional de Áreas de Conservación (SINAC), puede actuar como interesado por no atacarse conducta o acto administrativo propio de ese órgano con personería jurídica instrumental. Asevera, las pretensiones afectan la administración y tutela del inmueble a cargo del SINAC, por ser el administrador del Patrimonio Natural del Estado, con personalidad jurídica instrumental, conforme con las competencias que le otorgan los artículos 6 inciso a), 13, 14, 15 y 18 de la Ley 7575, 22 y 28 de la Ley 7788 y 32 párrafo 2° de la Ley 7554 (votos constitucionales 16975-2008, 13073-2009 y 12716- 2012; Sala Primera, sentencias 1070-F-S1-2010 y 286-F-S1-2015; Tribunal Contencioso Administrativo, votos 474-2005-II, 1842-2009-VI, 38-2010-VI, 2642-2010-VI, 68-2013-IV, 74-2014-V, 70-2015-VIII).
Advierte, debe integrarse al SINAC como litisconsorte pasivo necesario si la pretensión de la demanda, como aquí sucede, afecta la titularidad sobre el bien o sus facultades de tutela -cita en su apoyo, el voto: 274-2021-II de 7:31 hrs. de 15 de julio de 2021, dictado por la Sección Segunda de este Tribunal de Alzada-. Estima, para no causar indefensión al SINAC en el ejercicio de sus potestades de autotutela (Código Procesal Civil, artículos 22.1 y 32.1), ha de integrársele como litis consorte pasivo necesario, aun cuando no se impugne una conducta emitida por el mismo, evitando así hacia futuro la nulidad de las etapas procesales que se realicen sin su participación como demandado -invoca en su apoyo las sentencias de la Sala I de la Corte Suprema de Justicia números: 921-F-S1-2015 de 14:35 hrs. de 6 de agosto de 2015, 1239-F-S1-2020 de 11:50 hrs. de 31 de marzo de 2020; y de este Tribunal de Alzada el voto 290 de 17 de mayo de 2013- Agrega, el Sistema Nacional de Áreas de Conservación en oficio No.SINAC-ACC-D-of-426-2021 de 7 de junio de 2021, hizo constar que el plano SJ-1056059-2006 a nombre de Nombre163501 , con un área de 47 Ha 1686.61 m2, se ubica en su totalidad dentro de la Reserva Forestal Los Santos, creada mediante Decreto 5389, y se sobrepone al terreno descrito en el plano SJ-2176662-2020 en administración del MINAE-SINAC, en esa área silvestre protegida, Patrimonio Natural del Estado (escrito de contestación de 30 de noviembre de 2021, Prueba 1).
En consecuencia, de acuerdo con los artículos 32 de la Ley Orgánica del Ambiente, 13 de la Ley Forestal, 22 y 28 de la Ley de Biodiversidad, 22.1 y 32.1 del Código Procesal Civil, solicita revocar la resolución 220-2022 y en su lugar disponer la integración del Sistema Nacional de Áreas de Conservación como litisconsorte pasivo necesario.
En primer término, debe indicarse, al formular el recurso de apelación, la representación del Estado alegó la nulidad concomitante de la resolución venida en alzada, no obstante de la lectura integral de los agravios expuestos, resulta claro para esta Cámara, todos ellos se dirigen a atacar el fondo de lo decidido y como pretensión se solicita sólo la revocatoria del auto impugnado, por lo que este Órgano de Alzada, únicamente ingresará al análisis de fondo, sin reparo alguno en la nulidad invocada. Así las cosas, a efecto de resolver lo que en derecho corresponda, resulta necesario rescatar brevemente lo considerado por la juzgadora de instancia sobre el caso concreto, en lo que resulta de interés, indicó:
"(...) TERCERO: En síntesis de lo alegado y pretendido por el actor es la declaratoria de un derecho de propiedad sobre un terreno supuestamente de carácter demanial que se ubica en la Reserva Forestal Los Santos, según señala El Estado. Y en consecuencia alegan los demandados que al tratarse de una propiedad perteneciente al Patrimonio Natural del Estado debe integrarse al SINAC de conformidad con el ordinal 12.2 al ser un órgano adscrito al MINAE, con personalidad jurídica instrumental y porque se afecta la administración y tutela del inmueble objeto. CUARTO: De conformidad con el ordinal 12.2 del Código Procesal Contencioso Administrativo para que se tenga como litis consorte pasivo necesario al "órgano" la conducta objeto del proceso debe ser ejercida por ese órgano adscrito al ente rector de la materia; si bien es cierto el SINAC tiene personalidad jurídica instrumental y se encuentra adscrito al MINAE no es el SINAC quien emitió una conducta administrativa o acto que deba defender ante el actor, debatiendo sus pretensiones en ese sentido. En este caso particular se demanda directamente al MINAE ( Estado) por ser el ente encargado de la defensa de los bienes de dominio público y representado por la Procuraduría General de la República sin que la participación del SINAC como litis consorte pasivo necesario sea indispensable para la solución del asunto; ya que puede participar dicho órgano en el proceso al tener la Administración de esos bienes pero con un interés directo; es decir, ejerciendo la figura de la tercería de conformidad con el ordinal 15 del CPCA; ya que como se dijo no se ataca conducta alguna o acto administrativo emanado del SINAC y de ninguna manera se infiere de dicho artículo cosa distinta; siendo en consecuencia la NO aplicación en este caso de lo establecido en el ordinal 12. 2 del del Código Procesal Contencioso Administrativo y en ese tanto NO debe participar como Litis Consorte Pasivo Necesario el Sistema Nacional de Áreas de Conservación como se expresó; sino que debe ejercer su PARTICIPACIÓN, si a bien lo tiene, como una tercería en el proceso y defender esa conducta (demanialidad del bien) en forma conjunta pero desde otro vértice..(...)."
En la especie, considera este Órgano Colegiado, los respetables argumentos de la representante del Estado, resultan de recibo en razón de lo siguiente: En lo que se refiere al aspecto de fondo debatido, la correcta integración de la litis garantiza el respeto del derecho de defensa de todos aquellos sujetos (públicos o privados), que por disposición de ley o por la naturaleza de la relación jurídica material, sean afectados por la resolución de fondo; garantizando además la efectiva ejecución de la sentencia que en definitiva se dicte (artículos 22.1 del Código Procesal Civil en concordancia con el 220 del Código Procesal Contencioso Administrativo). A efecto de resolver sobre la necesidad de integrar la litis consorcio pasivo, necesariamente debe realizar el operador jurídico un análisis de la pretensión, para el caso particular, el objeto del proceso, deducido en el escrito de demanda, consiste en lo que interesa, que en sentencia se declare lo siguiente:
"(...) 1) Que se declare en sentencia que los acá actores somos legítimos propietarios por haber adquirido la finca descrita en el plano catastrado SJ-1056059-2006, ubicada en Naranjo Arriba del Distrito Primero, Copey de Dota, del Cantón 17 de Dota, de la Provincia de San José, con una extensión de cuarenta y siete hectáreas, mil seiscientos ochenta y seis metros cuadrados con seis decímetros cuadrados, mediante el ejercicio haber (sic) de la posesión transmitida de forma pública, pacífica, ininterrumpida, de buena fe, a título de dueño y con justo título con 10 años de antelación a la creación de la Reserva Forestal Dota y en la actualidad cuentan con 63 años del ejercicio legítimo de la posesión. 2) Que en razón de la anterior declaratoria se ordene al nulidad absoluta del plano catastrado SJ-2176662-2020, inscrito a nombre del Estado, por sobreponerse ilegalmente a la finca propiedad de los aquí actores. 3) Que se ordene al Registro Público de la Propiedad, proceder con la inscripción de la finca a favor de los actores descrita en el Plano Catastro SJ-1056059-2006, con las limitaciones y afectaciones correspondientes. Para la señora Nombre21254 , como propietaria del derecho de usufructo y el señor Nombre163501 , el derecho de la nuda propiedad (…). SUBSIDIARIA PRIMERA: (…) 1) Que se declare en sentencia que los acá actores somos legítimos propietarios por haber adquirido la finca descrita en el plano catastrado SJ-1056059-2006, ubicada en Naranjo Arriba del Distrito Primero, Copey de Dota, del Cantón 17 de Dota, de la Provincia de San José, con una extensión de cuarenta y siete hectáreas, mil seiscientos ochenta y seis metros cuadrados con seis decímetros cuadrados, mediante el ejercicio haber (sic) de la posesión transmitida de forma pública, pacífica, ininterrumpida, de buena fe, a título de dueño y con justo título con 10 años de antelación a la creación de la Reserva Forestal Dota y en la actualidad cuentan con 63 años del ejercicio legítimo de la posesión. 2) Que como consecuencia de tal declaratoria se declare que la oposición del Estado en las diligencias de Información Posesoria 19-000011-0699-AG que se tramitan en el Juzgado Agrario de Cartago, a nombre de los acá actores, es carente de fundamentación e ilegal. 3) Que en razón de la anterior declaratoria se ordene al nulidad absoluta del plano catastrado SJ-2176662-2020, inscrito a nombre del Estado, por sobreponerse ilegalmente a la finca propiedad de los aquí actores. 4) Que se ordene al Registro Público de la Propiedad, proceder con la inscripción de la finca a favor de los actores descrita en el Plano Catastro SJ-1056059-2006, con las limitaciones y afectaciones correspondientes. Para la señora Nombre21254 , como propietaria del derecho de usufructo y el señor Nombre163501 , el derecho de la nuda propiedad.(…). SUBSIDIARIA SEGUNDARIA (SIC): (…) 1) Que la finca en posesión y propiedad de los actores, descrita en el plano catastrado SJ-1056059-2006, ubicada en Naranjo Arriba del Distrito Primero, Copey de Dota, del Cantón 17 de Dota, de la Provincia de San José, con una extensión de cuarenta y siete hectáreas, mil seiscientos ochenta y seis metros cuadrados con seis decímetros cuadrados, se sobrepone con el plano catastrado inscrito a nombre del Estado SJ-2176662-2020, con una medida de 5 hectáreas. 2) Que en virtud de lo anterior se declare en sentencia que los acá actores somos legítimos propietarios por haber adquirido la finca descrita en el plano catastrado SJ-1056059-2006, ubicada en Naranjo Arriba del Distrito Primero, Copey de Dota, del Cantón 17 de Dota, de la Provincia de San José, con una extensión de cuarenta y siete hectáreas, mil seiscientos ochenta y seis metros cuadrados con seis decímetros cuadrados, mediante el ejercicio haber (sic) de la posesión transmitida de forma pública, pacífica, ininterrumpida, de buena fe, a título de dueño y con justo título con 10 años de antelación a la creación de la Reserva Forestal Dota y en la actualidad cuentan con 63 años del ejercicio legítimo de la posesión, con exclusión del área que se sobreponga con el Plano inscrito a nombre del Estado SJ-2176662-2020. 3) Que en virtud de la declaratoria a los actores les asiste el derecho de inscribir a su nombre en el Registro Público de la Propiedad un área de cuarenta y dos hectáreas mil seiscientos ochenta y seis metros cuadrados. 4) Que se ordene al Catastro Nacional la inscripción de un nuevo plano a favor de los acá actores excluyendo el área descrita en el Plano Catastro SJ-2176662-2020, inscrito a nombre del Estado. 5) Que inscrito el Plano Catastrado de marras, se ordene al Registro Público de la Propiedad, la inscripción de la finca en posesión de los actores. Para la actora Nombre21254 , como propietaria del derecho de usufructo y el señor Nombre163501 , el derecho de la nuda propiedad.(…)”.
IV.Por otra parte y para una mejor comprensión de lo que se resolverá en definitiva, resulta indispensable realizar un breve resumen de lo debatido, así se tiene que: El presente proceso de conocimiento, promovido por: Nombre24251 y Nombre163501 , tiene como principal antecedente, las Diligencias de Información Posesoria, tramitadas por ellos, ante el Juzgado Agrario de Cartago, bajo el número de expediente 19-000110699-AG-6, con el objeto de titular una extensión de cuarenta y siete hectáreas mil seiscientos ochenta y seis metros con seis decímetros cuadrados, descrita en el plano catastrado SJ-1056059-2006, ubicada en Naranjo Arriba del Distrito Primero, Copey de Dota, del Cantón 17 de Dota, de la Provincia de San José. El señor Procurador del Estado, al atender la audiencia concedida mediante auto dictado por la persona Juzgadora Agraria, a las 10:23 horas del 26 de marzo del 2021, en memorial de fecha 22 de junio del 2021, se opuso a las diligencias, señalando en esencia que, el plano SJ-1056059-2006, base de las mismas, se sobrepone en un área de cinco hectáreas, al plano SJ-2176662-2020, inscrito en el Catastro Nacional, a nombre del Estado, en posesión del Ministerio de Ambiente y Energía, lo que asegura, consta en el informe SINAC-ACCD-of-426-2021 -imágenes 121, 126, 129-130 del expediente electrónico principal-.
Adujo, además, los terrenos descritos en ambos planos están comprendidos dentro de la Reserva Forestal Los Santos, área silvestre protegida que forma parte del patrimonio natural del Estado. En razón, de lo anterior, mediante resolución 2021000137 de las 13:52 horas del 07 de julio del 2021, el citado Órgano Jurisdiccional, de conformidad con el artículo 8 párrafo II de la Ley de Informaciones Posesorias, ordenó el archivo de las diligencias y remitió a los promoventes a la vía Contencioso Administrativa, para la discusión plenaria de la titulación pretendida. Es así, que el presente proceso de conocimiento, fue presentado a estrados judiciales el 24 de febrero del año en curso, con el objeto de que se reconozca de manera principal, la posesión ejercida en forma pública, pacífica, ininterrumpida, de buena fe, a título de dueño y con justo título, con 10 años de antelación a la creación de la Reserva Forestal Los Santos, bajo el argumento de que en la actualidad cuentan con 63 años del ejercicio legítimo de la posesión; por lo que pretende en síntesis, se anule el plano catastrado SJ-2176662-2020, inscrito a nombre del Estado y administrado por el Ministerio del Ambiente y Energía, inscribiéndose la totalidad del bien en cabeza de los accionantes, o en última instancia, se excluya el área que se sobreponga con el Plano inscrito a nombre del Estado SJ-2176662-2020, y finalmente se logre la titulación del resto del terreno, a su favor.
V.Resulta evidente para esta Cámara, la discusión gira en torno a la titulación de un área de cinco hectáreas, comprendidas dentro de la Reserva Forestal Los Santos, nótese, lo discutido no es la existencia del área protegida, sino la exclusión de la zona, que dice la parte accionante ha poseído por más de sesenta años y que es anterior en 10 años, a la creación de la Reserva, o bien, y en última instancia, la titulación parcial del área reclamada, excluyendo la comprendida en el plano SJ-2176662-2020. En razón de lo anterior, es posible deducir, en sub lite, es la naturaleza de la relación jurídica material y el contenido de una eventual sentencia estimatoria vinculada con las competencias del SINAC y la protección del patrimonio natural del Estado, lo que determina la integración de la litis con el referido Órgano; no es, como lo interpreta la Juzgadora de Instancia, lo regulado en el numeral 12:2 del Código Procesal Contencioso Administrativo, lo que define, en el particular caso, la intervención como parte pasiva del SINAC, toda vez que, este proceso no tiene por objeto la revisión de legalidad de conductas administrativas, establecido como supuesto de hecho en el referido canon, para la integración como parte demandada -en este caso en forma conjunta con el Estado- de un órgano administrativo con personalidad jurídica instrumental (en similar sentido Voto 290-2013, dictado por esta Cámara a las 16:30 horas del 17 de mayo del 2013).
Tómese en consideración, tal y como lo señala la representación del Estado, de conformidad con el artículo 32 de la Ley Orgánica del Ambiente, las áreas silvestres protegidas, en cualquiera de sus categorías -lo que incluye las reservas forestales- serán administradas por el Ministerio de Ambiente y Energía; por su parte, el canon 22 de la Ley de Biodiversidad, crea el Sistema Nacional de Áreas de Conservación (SINAC), con personería jurídica propia, con el siguiente objeto: “(…)será un sistema de gestión y coordinación institucional, desconcentrado y participativo, que integrará las competencias en materia forestal, vida silvestre, áreas protegidas y el Ministerio del Ambiente y Energía, con el fin de dictar políticas, planificar y ejecutar procesos dirigidos a lograr la sostenibilidad en el manejo de los recursos naturales de Costa Rica(…).”(Énfasis suplido). En consecuencia, al debatirse en el presente proceso, la titulación de un bien inmueble, comprendido al menos parcialmente, dentro del área de la Reserva Forestal Los Santos -Patrimonio Natural del Estado- la intervención del SINAC, resulta necesaria en calidad de parte demandada, por así exigirlo la naturaleza de la relación jurídico material -canon 22.1 del Código Procesal Civil, en concordancia con el artículo 220 del C.P.C.A-; resulta a todas luces, insuficiente la sola comunicación de la existencia del proceso, con sustento el artículo 15 del Código que rige la materia, pues ello no garantiza de manera plena el ejercicio de la defensa que puede realizar quien ostenta la calidad de parte demandada, con un interés directo en lo que en definitiva se resuelva en el proceso. En razón, de lo anterior, la resolución recurrida deberá ser revocada.
POR TANTO
Se revoca la resolución recurrida número 220-2022 dictada por la Jueza Tramitadora del Tribunal Contencioso Administrativo y Civil de Hacienda, Cindy Chavarría Hernández, a las 11:00 horas del 11 de febrero del 2021, en su lugar se resuelve: Se acoge la defensa de litis consorcio pasivo necesario, interpuesta por el Estado, se ordena integrar en tal carácter al Sistema Nacional de Áreas de Conservación (SINAC). Deberá la parte actora, presentar ante el Tribunal de Instancia, copia completa del expediente, a efecto de realizar la notificación de interés, bajo el apercibimiento que, de no hacerlo, no se atenderán futuras gestiones.
