Processed before the Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón.* BACKGROUND* * 1.- The title applicant (titulante) files this possessory title proceeding to register in the Registro Inmobiliario the parcel described in cadastral plan (plano catastrado) A-1258087-2008, located at [Dirección1],, [Dirección2],, San Ramón, Province of Alajuela, measuring eight hectares, one thousand three hundred thirty-four square meters and ten square decimeters. Said property consists of secondary scrubland (tacotal), forested mountain land (montaña), and a small house; it is bounded to the NORTH by [Nombre3]; to the SOUTH by [Nombre4], [Nombre1], and [Nombre5]; to the EAST by [Dirección3], with a linear measurement of one hundred eighteen meters and seventy-seven centimeters, [Nombre3], [Nombre1], and [Nombre5]; and to the WEST by [Nombre3] and the Río Hediondo, with [Dirección4] JV Ltada lying between them (filings section: files 09/11/2016 8:10:11, 25/02/2019 16:31:12, 20/11/2019 8:13:05).* * 2.- The Instituto de Desarrollo Rural, the Procuraduría General de la República, and the Municipalidad de San Ramón were recognized as parties and entered appearances through documents included in the filings section, files 26/04/2019 16:08:44 and 08/05/2019 14:00:43.* * 3.- The adjoining landowners (colindantes) were duly notified (filings section: file* 09/11/2016 8:10:11). * * * * * * * * * * * * * * 4.- Judge Tatiana Rodríguez Herrera of the Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, ruled as follows in Judgment 247 of 27 de octubre de 2021: “In accordance with the foregoing and the cited laws, the present* possessory title proceedings filed by CAMINO VERDE JV KTDA,* corporate identification number CED7, represented by [Nombre1],* divorced once, farmer, resident of Curridabat, identification number CED8, ARE APPROVED; these proceedings* were conducted in compliance with the Ley de Informaciones Posesorias number one hundred thirty-nine* of catorce de julio de mil novecientos cuarenta y uno, its amendments and additions, and the* Ley de Jurisdicción Agraria number six thousand seven hundred thirty-four of veinticinco* de marzo de mil novecientos ochenta y dos and its amendments.- Accordingly: a) Free* of liens and real-property encumbrances (gravámenes y cargas reales), without co-owners and without prejudice to third parties holding superior* rights, the Registro Público, Sección Propiedad Inmueble, shall register in* the petitioner’s name the following unregistered parcel, described in cadastral* plan number A-1258087-2008, located at [Dirección5],, [Dirección6], Province of Alajuela, measuring EIGHT* HECTARES, ONE THOUSAND THREE HUNDRED THIRTY-FOUR SQUARE METERS AND TEN* SQUARE DECIMETERS.

The petitioner is reminded to comply with* the recommendations of the soil study. Once this decision becomes final, the corresponding certification shall be issued at* the petitioner’s request” (associated documents section: file 27/10/2021 13:36:23).* * 5.- The PGR appealed (filings section: files* 03/11/2021 15:24:07 and 15:24:12).* * Drafted by Judge Alpízar* Rodríguez; and,* CONSIDERING:*
I.The appellant offered, as evidence to assist in reaching a decision (prueba para mejor resolver), report SINAC-ACC-D-of-799-2021 of the Área de Conservación Central of SINAC, which states that there is evidence of an apparent overlap (traslape) of approximately 7% of the property described in plan 2-1258087-2008 with State-owned property (filings section: file 144- 03711/2021 15:24:07). The petitioner was given an opportunity to respond regarding this evidence by decision of 3 de diciembre de 2021 but made no submission. This evidence is admitted pursuant to Articles 11 of the Ley de Informaciones Posesorias and 52 of the Ley de Jurisdicción Agraria because, in view of the relief sought in the proceeding and the PGR’s allegations, it is deemed necessary for the proper processing of the matter.
* II.- In light of the manner in which this matter is decided, no ruling is made regarding the list of proven facts.* *II.- In the challenged judgment 247 of 27 de octubre de 2021, the possessory information proceeding (información posesoria) was approved and registration was ordered for the property described in plan A-1258087-2008, subject to the limitations established by the Ley de Caminos Públicos, Ley de Aguas and Ley Forestal. The PGR appeals on the basis of the following grounds:
III.Section 592 of the Código de Trabajo, applicable by reference under article 60 of the Ley de Jurisdicción Agraria, provides that, before ruling on the grounds raised in an appeal, the Court must review the proceedings to determine whether any procedural flaw or defect exists that should, if possible, be remedied or, otherwise, sanctioned by procedural nullity (nulidad procesal). Likewise, article 26 of the Ley de Jurisdicción Agraria provides, insofar as relevant: “When appropriate, the courts may, on their own initiative, declare nullities and order proceedings to be repeated in order to correct irregularities that could affect the validity of the proceedings.” Accordingly, if it is found that a formality capable of causing actual denial of the right to a defense (indefensión) has been omitted, correction of the defect must be ordered where possible, or the proceedings or rulings must be annulled to the extent necessary to restore the case to its normal course. Under those provisions, the position has been maintained that a declaration of procedural nullity is appropriate only exceptionally, when such a ruling is absolutely indispensable to prevent denial of the right to a defense or restore the proceeding to its normal course because essential procedural requirements were violated (articles 194 to 198 of the Código Procesal Civil, applied supplementarily).
VI.With respect to the matter under challenge, it is important to bear in mind that the Ley de Informaciones Posesorias 139 of 14 de julio de 1941 permits a person who possesses land as its owner to formalize title to the property for registration in the Registro Inmobiliario, provided that several requirements are met. Of particular relevance, article 1-f) requires that the property not have been previously registered. Furthermore, pursuant to sections 8 and 18 of the Ley de Catastro Nacional N°6545 of 26 de marzo de 1981, the information in the registry entry must truly correspond to that in the Catastro Nacional. The requirements, as well as the relevant evidence that must be submitted to corroborate the statements made in the initial petition, are clearly specified in the cited Law and in other special laws protecting water, forests, and soil (see precedents of this Court 827 of 19.12.2003 and 242 of 22.04.2005.
“Información Posesoria is a non-contentious judicial proceeding for formalizing a registrable title to a property right that has been acquired ..., upon compliance with the corresponding legal requirements. Possession under a claim of ownership (posesión a título de dueño) must be proven to have been quiet, public, peaceful, and uninterrupted (articles 1 of the Ley de Informaciones Posesorias and 856 of the Código Civil). In addition to lacking a title registered or capable of registration in the Registro Público, the title claimant must expressly state that the property has not previously been registered in the Registro Público. For reasons of public interest, and to prevent duplicate registration of the same property or to protect third parties having superior rights to those of the title claimant, the Law requires notice to certain persons… The Ley de Informaciones Posesorias directs the Judge to treat the adjoining landowners as parties and therefore to serve them personally from the outset of the proceedings, because the title sought could encompass part of the land belonging to them.
Notice must also be given to co-owners or condominium owners. Likewise, to safeguard the interests of the State, the Procuraduría General de la República and the Instituto de Desarrollo Agrario must be made parties to protect property subject to the public domain and State Agrarian Property (Propiedad Agraria estatal) (article 5)” (decision 755 of 13.11.2003).*
*VII.- In light of the foregoing, the PGR is partially correct in its assertions. In a non-contentious proceeding (proceso no contencioso) such as the one cited, the documentary evidence (prueba documental) submitted, especially evidence originating from public entities, must be assessed in accordance with the legal provisions governing compliance with the statutory requirements. In the case of official reports, that is, reports issued by State entities within the scope of their authority, it must be borne in mind that they are public and authentic documents (documentos públicos y auténticos), as provided by sections 368, 369, 370, and 377 of the Código Procesal Civil, in the version in force on the date this proceeding commenced (rules contained in sections 54.1 and 54.2 of the current Code). A public document is one issued or drafted by a public official, in compliance with the required formalities and within the limits of that official’s authority; hence, such documents have full evidentiary effect with respect to the contents set forth therein (they are presumed authentic and valid unless proven otherwise).
An authentic document is one that has been duly authorized or bears a date certain and leaves no doubt that its contents are true and credible because it was issued by a person qualified to do so who appears as its author (Sala Primera voto 145 de 29.08.1991; Sala Tercera voto 396 de 05.05.2006). To rebut its contents, it is not enough merely to argue that its grounds or assessments may contain an error, except where material errors are involved or it refers to different property. A declaration of falsity (declaratoria de falsedad) is therefore required, and such a declaration cannot be made in a non-contentious proceeding. This does not mean that evidence derived from public documents enjoys an irrebuttable presumption (presunción de pleno derecho), or constitutes indisputable truth that cannot be challenged by other evidence; rather, the party seeking to dispute its contents must endeavor to discredit them, and mere disagreement unsupported by further grounds is ineffective for that purpose (Sala Primera voto 209 de 23 marzo 2007).
If the moving party disagrees with the contents of such reports, the judge must weigh the reasonableness and legality of the reasons stated (and any legal or factual support submitted), but this type of proceeding cannot be used to “open a debate” concerning the relevance and proof of those reasons or of the position of the party opposing them, because doing so would distort the non-contentious possessory information proceeding (información posesoria). Nor may a non-contentious proceeding be used to challenge the truthfulness or relevance of the contents of a public document, or to refute it through reports from other authorities lacking jurisdiction to decide the matter, much less through private reports. To ensure due process (debido proceso), the dispute must be heard and resolved in the appropriate contentious proceeding (proceso contencioso), whether agrarian, civil, criminal, or contentious-administrative, depending on the relief sought.
Accordingly, expert evidence (prueba pericial) may not be admitted for the purpose of disregarding official reports. Such evidence must be taken and analyzed in the appropriate contentious proceeding.* *IX.- In its first three grounds of appeal (agravios), the PGR argues that it proved that the land for which title is sought includes areas belonging to [Dirección9]—registered in the name of the State—and described in cadastral plan (plano catastrado) A-872213-1990, and that the proceeding therefore cannot be approved on the basis of cadastral plan A-1258087-2008. It relies on the report of the Departamento Técnico Catastral del Registro Inmobiliario (DRI-CTE-03-0167-2019 and official letter DRI-03-481-2019), which states that the plans partially overlap (traslape parcial). Although this is a legally issued public document, it contends that the challenged judgment found that there was no overlap, based on a private report prepared by surveyor [Nombre4], dated 22 de mayo de 2019.
In addition to questioning the fact that this report was prepared in the same manner as the public report—that is, without fieldwork—because it states that it was based on the orthophotograph from the Sistema de información de registro inmobiliario (SIRI), the PGR emphasizes that the truthfulness of a public document cannot be challenged in that manner. If the Court had any doubts regarding the public document, the PGR considers that it should have admitted the expert evidence requested by the moving party. As explained in the preceding considerando, a non-contentious proceeding cannot be transformed into litigation, thereby distorting its nature. The PGR’s assertion that expert evidence should be taken in this type of proceeding to confirm or refute an official report is therefore unfounded. It is correct, however, that the contents and effects of the cited public document were not properly analyzed for purposes of this matter, which affects due process.
Indeed, finding of fact 12 of the judgment under appeal—which was not endorsed by the manner in which the case was decided—states, on the basis of the aforementioned private report and another report from [Nombre8] dated 24 de julio de 2021, that the cited plans do not overlap. The third considerando explains that the first report from [Nombre8] states:* “... according to the technical location study (estudio técnico de localización) conducted by the Inder, based on the copy of plan number A-1258087-08 submitted by the Court, it was determined that the land described therein overlaps properties that formerly belonged to INDER but are now owned by the State, specifically registered in the name of MINAET, property CED9. , registered in the province of Alajuela.” Accordingly, the judgment under appeal states—and this is indeed confirmed by the record—that [Nombre8] opposed continuation of the proceedings (filings section: file 34- 26/04/2019 15:25:12).
This prompted the issuance of the ruling of 20 de mayo de 2019, which declared the administrative process exhausted (vía administrativa agotada) and ordered the case file closed. The moving party filed a motion for reconsideration (recurso de revocatoria) based on a private report prepared by [Nombre4], according to which, after conducting a field study, he determined that property A- 505346-000 did not overlap at all with the property shown on plan A- 1.258087-2008. [Nombre8] was given an opportunity to respond and, in a submission dated 31 de mayo de 2019, stated that only institutional mapping was used to determine whether an overlap existed, without field inspections, and another report was therefore prepared stating: “Accordingly, recognizing that in this case, as in others, the SIRI system has not been very reliable in locating parcels, that the interested party submitted a field study using the information from plan A- 1258087-2008, for which title is sought, and that a strip of land still separates the identified reserve from its parcels, the field inspection determines that there is no overlap between the two properties” (filings section: file 61- 08/07/2019 10:15:08).
On that basis, in a ruling dated 10 de agosto de 2019, the Court reversed the ruling of 20 de mayo de 2019 (which had declared the administrative process exhausted because of [Nombre8]’s opposition) and ordered the proceedings to continue. Neither [Nombre8] nor the PGR opposed that ruling. The challenged judgment also explains—and the case file indeed confirms—that, in a submission dated 13 de septiembre de 2019, the PGR, relying on the report of the Departamento Técnico Catastral del Registro Inmobiliario (DRI-CTE-03-0167-2019 and official letter DRI-03-481-2019, both dated 27 de agosto de 2019), reiterated that the plan on which the proceeding was based overlaps the plan for registered property CED10 and therefore requested that the proceeding be denied. The judgment emphasizes that the Catastro Nacional report states: “Introduction.... this report is based on a desk review of cadastral and registry records...
The plans were overlaid using the orthophotograph at a scale of 1:5000 as the base. The plans were positioned according to their references and geographic location and were drawn by digitizing the traverse data (derrotero)...”. However, it did not take the remainder of the report’s contents into account. On the basis of the foregoing and Article 54 of the Ley de Jurisdicción Agraria, the Court deemed the Registro Nacional report untruthful because there were two reports that considered the cadastral information and fieldwork (prepared by surveyor Manuel Villegas Rodríguez and Engineer Juan [Nombre9], an INDER official), which state that the land for which title is sought does not overlap State property CED11. The judgment adds that anyone seeking to challenge the findings of those two previously submitted expert assessments or reports (one private and one public report from INDER) was required to submit a field report, rather than merely a desk report.
It further states: “Accordingly, after analyzing all the evidence submitted, including the Minae certification stating that the land is not located within any protected area (see certification No. SINAC-DACCVC-0704-2014 added to the electronic case file on 08 de noviembre del año 2016), this authority concludes that the land for which title is sought does not overlap State property CED12. and is not located within a protected area.”* * X.- The analysis in the preceding recital (considerando) shows that there have been violations of due process (debido proceso) arising from the manner in which the matter was decided, warranting annulment of the judgment. First, the contents of a public instrument (documento público), issued by the competent authority and whose contents have not been declared false, were improperly set aside. The report of the Departamento Técnico Catastral del Registro Inmobiliario is duly substantiated and identifies the sources used.
Its conclusions even expressly state: “1. Plans A-1258087-2008 and A-872213-1990 contain drafting errors that exceed institutional tolerances. 2. As shown in the image… Partial overlap (traslape) exists between plans A-1258087-2008 and A-872213-1990 (property 2-505346).” Regarding the base plan (plano base) for the proceeding, it expressly states: “Plan A-1258087-2008 contains drafting errors that exceed the maximum permitted tolerances; its traverse (derrotero) has a linear error of 2.48 metros when the tolerance for this plan is 0.28 metros. In addition, there is a difference of l757 m2 between the area generated by its traverse and the area indicated on the plan, whereas the area tolerance is 15.80 m2; therefore, to depict plan A-1258087-2008 in the overlays, it was necessary to vectorize the plan image.” Furthermore, in proceedings of this kind, such evidence cannot be challenged through private reports—the report of surveyor [Nombre4]—or through reports issued by public authorities acting outside their legal powers (Inder).
Aside from turning the proceeding into litigation, if the accuracy of the Catastro Nacional report was being challenged, that entity should have been asked for additional information on the matter, if appropriate, and should have been given an opportunity to respond if it was believed that other evidence called into question the information provided by its officials regarding the documentary overlap between the plans. Second, in any event, even if it were proven through the proper procedure that there may be no physical overlap between the parcels, an overlap may nevertheless exist in the documents, that is, in the plans. That is what the report of the Departamento Técnico Catastral del Registro Inmobiliario states, in addition to reporting the problems affecting both the promoting party’s plan and the plan for the State-owned property. In other words, in order for land to be registered, there can be no overlap either physically or in the documents—the plans.
Moreover, if the base plan contains errors that have been duly identified, those errors must be corrected. None of these matters appears to have been considered by the Court when it rejected the accuracy of report DRI-CTE-03-0167-2019 and official communication (oficio) DRI-03-481-2019. The Procuraduría is therefore correct that this proceeding should not be approved until those matters or problems have been duly remedied, within the limits permitted in proceedings of this kind, because it must always be borne in mind that a non-contentious proceeding (proceso no contencioso) must not be converted into ordinary litigation. In exceptional cases in which the accuracy of a public report duly issued by the competent authority is challenged, due process requires that the relevant entity be informed of the objections raised or be asked to provide the appropriate clarifications before the report’s contents are discredited.
In addition, with its appeal brief (escrito de apelación), the PGR submitted evidence for better adjudication (prueba para mejor resolver), which was admitted and which shows an apparent overlap between the plan for the property sought to be titled and the plan for registered property A-505346-000. This is a report issued by a competent authority, namely the relevant Área of SINAC, dated 1 de noviembre de 2021, because the land is forested and is therefore asserted to form part of the Patrimonio Natural del Estado. It must therefore be regarded as a valid public instrument. However, its conclusion is ambiguous because it does not provide precise information concerning what it was asked to report. This is because it states: “In response to official communication DAA-OFI-534-2021, requesting that it be determined whether cadastral plan 2-1258087-2008 overlaps land belonging to the Patrimonio Natural del Estado (PNE), particularly property 2-505346-000, cadastral plan 2-872213-1990, and that an overlay be prepared, I hereby inform you that, based on the information recorded for SINAC’s PNE properties, IGN topographic sheets at a scale of 1:50000, the municipal cadastre and cantonal roads of the Municipalidad de San Ramón, as well as plans 2-872213-1990 and 2-1258087-2008, there is an apparent overlap of parcel 2-1258087-2008 with the aforementioned State-owned property, as shown on the map in Figure 1, which shows an overlap along the southeastern boundary of plan 2-1258087-2008 of approximately 7%.
It must be clarified that the plan overlay in the Geographic Information System was not one hundred percent reliable, given the limitations of the available inputs—particularly the cadastral plans themselves—the rugged and mountainous geography of the site, with few reference features, and the limited time allowed for a response and for conducting an inspection visit to the site. Nevertheless, it was prepared to the best extent possible and using the closest approximate location in order to provide the requested response.” Despite the ambiguity of the response, it is important to note that it does not contradict the findings of the Departamento Técnico Catastral del Registro Inmobiliario report (DRI-CTE-03-0167-2019 and official communication DRI-03-481-2019). No ruling is made on the final ground of appeal (agravio), as it is unnecessary in light of the foregoing analysis.* * XI.- In accordance with the foregoing explanation and the provisions of Articles 1 and 11 of the Ley de Informaciones Posesorias and Articles 8 and 18 of the Ley de Catastro Nacional, the challenged judgment must be annulled so that the procedural defects may be corrected.
Before continuing with the proceeding, the Court must therefore order the competent authorities—Catastro Nacional and Área de Conservación Central del SINAC—to clarify in their reports whether an overlap actually exists and, if so, the percentage and location of the documentary overlap between plans A-872213-1990 and A-1258087-2008. If the existence of a documentary overlap is confirmed, the party seeking title (parte titulante) must, at the appropriate time, be ordered to submit a new plan and address all other related matters, ensuring that it excludes any areas or zones encompassed within [Dirección10], as described in cadastral plan A-872213-1990, or the Court must issue any other orders necessary to complete the corresponding proceeding, in accordance with Article 11 of the Ley de Informaciones Posesorias.
POR TANTO* Report SINAC-ACC-D-of-799-2021 of the Área de Conservación Central del SINAC, dated primero de noviembre de dos mil veintiuno, is admitted as evidence for better adjudication. Judgment 247 of veintisiete de octubre de dos mil veintiuno is annulled. Before continuing with the proceedings, the Court must order the competent authorities—Catastro Nacional and Área de Conservación Central del SINAC—to clarify in their reports whether an overlap actually exists and, if so, the percentage and location of the documentary overlap between plans A-ochocientos setenta y dos mil doscientos trece-mil novecientos noventa (A-872213-1990) and A-un millón doscientos cincuenta y ocho mil ochenta y siete-dos mil ocho (A-1258087-2008). VOTO N° 1234-F-2021* TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las nueve horas diecisiete minutos del catorce de diciembre de dos mil veintiuno.-* * INFORMACIÓN POSESORIA promovida por CAMINO* VERDE JV LIMITADA, cédula jurídica CED1 , representada por [Nombre1] mayor, divorciado una vez, agricultor, vecino de Curridabat, cédula CED2 . Intervienen como partes interesadas la PROCURADURÍA GENERAL DE LA REPÚBLICA (PGR), representada por Yamileth Monestel Vargas, mayor, soltera, abogada, vecina de Alajuela, cédula CED3 ; el INSTITUTO DE DESARROLLO RURAL (Inder), cédula jurídica CED4 , representado por Marjorie* Madrigal Muñoz, mayor, divorciada, abogada, vecina de San Ramón, Alajuela, cédula CED5 , en su condición de apoderada general judicial; MUNICIPALIDAD DE SAN RAMÓN por medio de su alcalde Nixon Gerardo Ureña Guillen, mayor, casado, abogado, vecino de Alajuela, cédula CED6 .
Actúa como apoderada especial judicial de la parte promovente: [Nombre2] , colegiada dos mil doscientos setenta y uno. Tramitado ante el Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón.* RESULTANDO* * 1.- La titulante plantea información posesoria para inscribir en el Registro Inmobiliario el fundo descrito en el plano catastrado A-1258087-2008, situado en [Dirección1] , , [Dirección2] , , San Ramón de la Provincia de Alajuela; cuya medida es de ocho hectáreas mil trescientos treinta y cuatro metros con diez decímetros cuadrados. Dicho inmueble es de tacotal, montaña y una casita; colinda al NORTE [Nombre3] , SUR: [Nombre4] , [Nombre1] y [Nombre5] , ESTE: [Dirección3] con una medida lineal de ciento dieciocho metros con setenta y siete centímetros, [Nombre3] , [Nombre1] y [Nombre5] y OESTE: [Nombre3] y Río Hediondo en [Dirección4] JV Ltada (apartado de escritos: archivos 09/11/2016 8:10:11, 25/02/2019 16:31:12, 20/11/2019 8:13:05).* * 2.- Se tuvo como partes al Instituto de Desarrollo Rural, la Procuraduría General de la República, y la Municipalidad de San Ramón, quienes se apersonaron en documentos incorporados apartado de escritos, archivos 26/04/2019 16:08:44 y 08/05/2019 14:00:43.* * 3.- Los colindantes fueron debidamente notificados (apartado de escritos: archivo* 09/11/2016 8:10:11). * * * * * * * * * * * * * * 4.- La jueza Tatiana Rodríguez Herrera del Juzgado Agrario del Tercer Circuito Judicial de Alajuela, San Ramón, en sentencia 247 de 27 de octubre de 2021 resolvió: "De acuerdo a lo expuesto y citas de ley SE APRUEBAN las presentes* diligencias de información posesoria promovidas por CAMINO VERDE JV KTDA* cédula jurídica CED7 representada por [Nombre1] ,* divorciado una vez, agricultor, vecino de Curridabat, cédula CED8; trámite que* cumplió apegado a la Ley de Informaciones Posesorias número ciento treinta y nueve* del catorce de julio de mil novecientos cuarenta y uno, sus reformas y adiciones, y la* Ley de Jurisdicción Agraria número seis mil setecientos treinta y cuatro del veinticinco* de marzo de mil novecientos ochenta y dos y sus reforma.- En consecuencia: a) Libre* de gravámenes y cargas reales, sin condueños y sin perjuicio de terceros de mejor* derechos, proceda el Registro Público, Sección Propiedad Inmueble, a inscribir a* nombre de la promovente, el siguiente fundo sin inscribir, descrito en el plano* catastrado número A-1258087-2008, situado en [Dirección5] , , [Dirección6] de la Provincia de Alajuela; cuya medida es de OCHO* HECTÁREAS MIL TRESCIENTOS TREINTA Y CUATRO METROS DON DIEZ* DECÍMETROS CUADRADOS.
Dicho inmueble es de tacotal, montaña y una casita; y* colinda al NORTE* [Nombre3] , SUR: [Nombre4] , [Nombre1] y [Nombre5] , ESTE: Calle pública con una medida lineal a ella* de ciento dieciocho metros con setenta y siete centímetros, [Nombre3] , [Nombre1] y [Nombre5] y OESTE: [Nombre3] y Río Hediondo en* medio de [Dirección7] JV Ltada. b) La promovente ha estimado el inmueble en la* suma de diecisiete millones cuatrocientos ochenta y seis mil ochocientos treinta y un* colones y las diligencias en la suma de diez millones de colones. c) Se ordena al* Registro Público, se consigne que el inmueble se encuentra afecto a las reservas de* los artículos 19 de la Ley de Informaciones Posesorias y 4 de la ley General de* Caminos Públicos, lo anterior en razón de que la colindancia este del terreno es calle* pública y que el área contigua a la quebrada sin nombre constituye área de protección* y que queda prohibida la corta o eliminación de árboles, según los artículos 33, inciso* b) y 34 de la Ley Forestal, además que las aguas superficiales y subterráneas* existentes en el inmueble, son de dominio público estatal y no forman parte de la finca* (Ley de Aguas, artículos 1, incisos a y b, y 3, inciso III; Ley Orgánica del Ambiente,* artículo 50 y Código de Minería artículo 4).
Se le recuerda a la promovente cumplir con* las recomendaciones del estudio de suelo. Una vez firme esta resolución, a solicitud de* la promovente, expídase la certificación correspondiente" (apartado de documentos asociados: archivo 27/10/2021 13:36:23).* * 5.- La PGR apeló ((apartado de escritos: archivos* 03/11/2021 15:24:07 y 15:24:12).* * Redacta la Jueza Alpízar* Rodríguez, y;* CONSIDERANDO:*
I.La parte apelante ofreció como prueba para mejor resolver informe SINAC-ACC-D-of-799-2021 del Área de Conservación Central del SINAC en él que dice se evidencia un aparente traslape de un aproximado del 7% del predio descrito en el plano 2-1258087-2008 respecto a la finca del Estado (apartado de escritos: archivo 144- 03711/2021 15:24:07). De ello se dio audiencia a la parte promovente, en resolución del 3 de diciembre de 2021, quien no se manifestó. Se admite dicha prueba, con fundamento en los artículos 11 de la Ley de Informaciones Posesorias y 52 de la Ley de Jurisdicción Agraria, al estimarse que, en función de lo pretendido en el proceso y lo alegado por la PGR, resulta necesaria para el debido trámite del asunto.
* II.- Por la forma como se resuelve, se omite pronunciamiento sobre el elenco de hechos probados.* * II.- En la sentencia impugnada 247 de 27 de octubre de 2021 se aprobó la información posesoria y se ordenó inscribir el inmueble descrito en el plano A-1258087-2008, con las limitaciones que establecen la Ley de Caminos Públicos, Ley de Aguas y Ley Forestal. La PGR apela con base en el siguiente agravio:
III.El numeral 592 del Código de Trabajo, aplicado por remisión del artículo 60 de la Ley de Jurisdicción Agraria, dispone que, antes de resolver los agravios de un recurso de apelación, el Tribunal debe revisar los procedimientos, para determinar si existe algún vicio o defecto procesal que de ser posible se deba subsanar, o en caso contrario, sancionar con nulidad procesal. Asimismo, el artículo 26 de la Ley de Jurisdicción Agraria, en lo que interesa dispone: "Cuando sea del caso, los tribunales podrán, por iniciativa propia, declarar nulidades y disponer la reposición de trámites, a fin de corregir irregularidades que pudieran afectar la validez del proceso". Por ende, si se encontrase que se ha omitido alguna formalidad, capaz de causar efectiva indefensión, debe decretarse la subsanación del vicio si es posible o bien la nulidad de las actuaciones o resoluciones, hasta donde sea necesario para orientar el curso normal del juicio. Al amparo de dichas regulaciones, se ha mantenido el criterio de que la declaratoria de nulidad procesal procede extraordinariamente, cuando sea absolutamente indispensable su pronunciamiento, para evitar indefensión o para orientar el curso normal del procedimiento, por violación a formas esenciales en el trámite (artículos 194 a 198 del Código Procesal Civil, aplicados supletoriamente).
VI.Por lo que es objeto de impugnación, es importante tener presente que la Ley de Informaciones Posesorias 139 de 14 de julio de 1941 permite a quien posea un terreno, como persona dueña, formalizar el título de propiedad para su inscripción en el Registro Inmobiliario, siempre que cumpla varios requisitos. Entre ellos interesa resaltar que el artículo 1-f) exige que la finca no esté previamente inscrita. Además, conforme a los numerales 8 y 18 de la Ley de Catastro Nacional N°6545 de 26 de marzo de 1981 debe existir una verdadera concordancia entre la información del asiento registral y la del Catastro Nacional. Los requisitos, así como la prueba pertinente que se debe aportar para corroborar lo declarado en el memorial inicial están claramente especificados en la Ley citada y en otras leyes especiales que tutelan el agua, los bosques y el suelo (ver precedentes de este Tribunal 827 de 19.12.2003 y 242 de 22.04.2005.
La “Información Posesoria es un trámite de actividad judicial no contenciosa para la formalización de un título registrable sobre un derecho de propiedad que se ha llegado a adquirir ..., cumpliendo para ello con los requisitos legales correspondientes. Se exige demostrar la posesión a título de dueño, en forma quieta, pública, pacífica e ininterrumpida (artículos 1 de la Ley de Informaciones Posesorias y 856 del Código Civil). El titulante, aparte de carecer de título inscrito o inscribible en el Registro Público, debe manifestar expresamente que la finca no ha sido inscrita en el Registro Público anteriormente. Por razones de interés público, y para evitar una doble inscripción registral sobre un mismo bien, o bien, para tutelar a terceros de mejor derecho que el titulante, la Ley exige notificar a ciertos sujetos… La Ley de Informaciones Posesorias ordena al Juez tener como partes y por tanto notificarles personalmente desde el inicio de las diligencias, a los colindantes, ello por cuanto la titulación podría abarcar parte de las tierras que les pertenecen.
También se ordena notificar a los condueños o condóminos. Igualmente, en resguardo de los intereses del Estado, se ordena tener como parte a la Procuraduría General de la República y al Instituto de Desarrollo Agrario, para el resguardo de la propiedad sujeta al dominio público, y de la Propiedad Agraria estatal (artículo 5)” (voto 755 de 13.11.2003). *
* VII.- En función de lo explicado, lleva razón parcialmente la PGR en lo que alega. En un proceso no contencioso como el citado, la prueba documental aportada, especialmente la proveniente de entes públicos, debe valorarse en función de lo dispuesto legalmente para el cumplimiento de los requisitos legales. Tratándose de informes oficiales, es decir, emanados de entidades estatales dentro de sus competencias, debe tenerse presente que son documentos públicos y auténticos, conforme lo disponían los numerales 368, 369, 370 y 377 del Código Procesal Civil, en su versión vigente a la fecha de iniciarse este proceso (reglas contenidas en los numerales 54.1 y 54.2 del Código actual). Documento público es el extendido o redactado por persona funcionaria pública, siguiendo las formas requeridas y dentro del límite de sus atribuciones, de ahí que tengan la virtud de tener eficacia probatoria plena sobre el contenido que detallan (se presumen auténticos y válidos mientras no se pruebe lo contrario).
El documento auténtico es aquel autorizado o con fecha cierta, que no deja dudas sobre que lo dictaminado en él es cierto y creíble, al provenir de una persona capacitada para emitirlo, que aparece como su autora (Sala Primera voto 145 de 29.08.1991; Sala Tercera voto 396 de 05.05.2006). Para desvirtuar su contenido, no basta con argumentar que puedan tener un error en sus fundamentos o apreciaciones y, además, salvo que se trate de errores materiales o se refiera a bienes diferentes. Debe existir entonces una declaratoria de falsedad y ello no puede realizarse en un proceso no contencioso. Lo anterior no implica que los elementos de prueba que se extraigan de documentos públicos gocen de una presunción de pleno derecho, o verdad indubitable, que no pueda ser atacada por otros medios de prueba, pero es la parte interesada en controvertir su contenido, quien debe realizar los esfuerzos por desacreditarles, siendo ineficaz para tal cometido, una mera disconformidad sin mayores fundamentos que la sustenten (Sala Primera voto 209 de 23 marzo 2007).
De existir divergencia por la parte promovente sobre el contenido de tales informes, la persona juzgadora debe ponderar la razonabilidad y legalidad de las razones expresadas (y el apoyo legal o fáctico que se presente), pero no es posible en este tipo proceso "abrir un debate", sobre la pertenencia y demostración de esas razones o de quien se opone a ellas, pues ello desnaturalizaría el proceso no contencioso de información posesoria. Tampoco se puede en un proceso no contencioso tratar de combatir la veracidad o pertinencia del contenido de un documento público ni refutarse a través de informes de otras autoridades que no tengan competencia para definir el tema. Mucho menos a través de informes privados. Para garantizar el debido proceso, la controversia deberá ser debatida y resuelta en un proceso contencioso, en la sede que corresponda, ya sea agraria, civil, penal o contencioso-administrativa, según lo que se pretenda.
Por ello no es de recibo recibir prueba pericial para descartar informes oficiales. Dicha prueba debe ser evacuada y analiza en el proceso contencioso que corresponda.* * IX.- En los tres primeros agravios la PGR alega que probó que el terreno a titular comprende áreas de la [Dirección9] -inscrita a nombre del Estado-, descrita en el plano catastrado A-872213-1990, por lo que no se puede aprobar el proceso con base en el plano catastrado A-1258087-2008. Ello mediante el informe del Departamento Técnico Catastral del Registro Inmobiliario (DRI-CTE-03-0167-2019 y el oficio DRI-03-481-2019), en el que se indica existe traslape parcial de planos. Pese a ser un documento público, extendido legalmente, reclama en la sentencia impugnada se tuvo por probado que no existe traslape, con base en un informe privado elaborado por el topógrafo [Nombre4] , fechado 22 de mayo de 2019. Además de cuestionar que se hizo de igual manera que el informe público, es decir sin labor de campo, porque se consigna que se utilizó como base la ortofoto del Sistema de información de registro inmobiliario (SIRI), resalta que no puede cuestionarse la veracidad del documento público de esa manera.
Si tenía alguna duda sobre el documento público, considera que el Juzgado debió haber admitido la prueba pericial solicitada por la parte promovente. Como se explicó en el considerando anterior, no puede un proceso no contencioso volverse litigioso, es decir, desnaturalizarlo. Por ello no es procedente lo indicado por la PGR, sobre evacuar prueba pericial en este tipo de proceso, para confirmar o desvirtuar un informe oficial. Pero si lleva razón en cuanto a que el contenido y efectos del documento público citado no fue debidamente analizado para los efectos del presente asunto, lo cual incide en el debido proceso. Efectivamente, en el hecho 12 de la sentencia apelada -que no fue avalado por la forma como se resuelve- se afirma que no existe traslape entre los planos citados con base en el informe privado referido y otro del [Nombre8] de 24 de julio de 2021. Y en el considerando tercero se explica que en el primer informe del [Nombre8] se expresa:* “... según el estudio técnico de localización realizado por el Inder, con base en la copia del plano aportado por el Juzgado número A-1258087-08, se determinó que el terreno que describe traslapa con propiedades que fueron del INDER, pero que hoy en día es propiedad del Estado específicamente a nombre del MINAET, finca CED9. , inscrita en el partido de Alajuela".
Por ello, dice la sentencia recurrida y efectivamente así se constata en el expediente, el [Nombre8] se opuso a la continuación del trámite (apartado de escritos: archivo 34- 26/04/2019 15:25:12). Ello motivó se emitiese la resolución del 20 de mayo de 2019, en la que se ordenó tener por agotada la vía administrativa y el archivo del expediente. La promovente interpuso recurso de revocatoria con base en un informe privado elaborado por [Nombre4] , según el cual, luego de hacer un estudio de campo, logró determinar que la finca A- 505346-000 no traslapaba en absoluto la finca del plano A- 1.258087-2008. De ello se dio audiencia al [Nombre8], quien en memorial del 31 de mayo de 2019 indicó que se trabajaba únicamente con la cartografía institucional, para determinar si existía traslape o no, sin inspecciones de campo, por lo que se elaboró otro informe en el cual se indicó: “Así las cosas reconociendo que en este como en otros casos el sistema SIRI, no ha sido muy confiable con la ubicación de los predios, que la parte interesada presenta un estudio de campo con la información de plano A- 1258087-2008, que se enterará titular y reserva señalada existe todavía una franja de terreno que separan sus predios y con la vista de campo se determina que no existe traslape entre ambas propiedades” (apartado de escritos: archivo 61- 08/07/2019 10:15:08).
Con base en lo anterior, el Juzgado, en resolución del 10 de agosto de 2019, revocó la resolución del 20 de mayo anterior (en la que tuvo por agotada la vía administrativa por la oposición del [Nombre8]) y ordenó continuar con el trámite. Ni el [Nombre8] ni la PGR se opusieron a lo anterior. Pero, se explica también en la sentencia impugnada, lo cual efectivamente consta en el expediente, que la PGR en memorial del 13 de septiembre de 2019, basándose en el informe del Departamento Técnico Catastral del Registro Inmobiliario (DRI-CTE-03-0167-2019 y el oficio DRI-03-481-2019, ambos de 27 de agosto de 2019), reitera que el plano base del proceso traslapa con el de la finca inscrita CED10 por lo que solicitó se impruebe el proceso. La sentencia resalta que en el informe del Catastro Nacional se indica: " Introducción.... el presente informe se fundamenta en el estudio de gabinete de los asientos catastrales y registrales...
El montaje de los planos se efectuó utilizando como base la ortofoto escala 1:5000. Los planos fueron ubicados según referencias y la ubicación geográfica, los planos fueron dibujados por medio de la digitación del derrotero...". Pero no tomó en cuenta el resto del contenido del informe. Con base en lo anterior y el artículo 54 de la Ley de Jurisdicción Agraria, el Juzgado calificó de no veraz el informe de Registro Nacional, por existir dos informes que toman en cuenta la información catastral y trabajo de un campo (elaborados por el topógrafo Manuel Villegas Rodríguez y el Ingeniero Juan [Nombre9] , funcionario del INDER), en los cuales se dice que el terreno a titular no traslapa la finca del Estado CED11. Agrega la sentencia que si se quería combatir lo señalado por esas dos pericias o informes anteriormente presentados (uno privado y uno público del INDER), debía presentarse un informe de campo y no solo de escritorio.
Dice, además: “Así, las cosas esta autoridad llega a la conclusión con base en el análisis de toda la prueba aportada, tomando en cuenta inclusive la certificación del Minae que señala que el terreno no está dentro de ningún área protegida (ver certificación No. SINAC-DACCVC-0704-2014 agregada al expediente electrónico el 08 de noviembre del año 2016), que el terreno que se quiere titular no traslapa la finca del Estado CED12. y tampoco está dentro de área protegida”.* * X.- Lo analizado en el considerando anterior evidencia que existen faltas al debido proceso por la forma como se ha resuelto, que ameritan anular la sentencia. En primer lugar, indebidamente se dejó sin efecto el contenido de un documento público, emitido por autoridad competente y cuyo contenido no ha sido declarado falso. El informe del del Departamento Técnico Catastral del Registro Inmobiliario está debidamente fundamentado e indica las fuentes que se utilizaron.
Incluso en sus conclusiones expresamente indica: “1. Los planos A-1258087-2008 y A-872213-1990 presentan errores de elaboración que exceden tolerancias institucionales. 2. Según se observa la imagen… Extinción traslape parcial entre los planos A-1258087-2008 y A-872213-1990 (finca 2-505346)”. Sobre el plano base del proceso se indica expresamente: “El plano A-1258087-2008 presenta errores de elaboración que exceden tolerancias sin finales permitidas, su derrotero presenta un error lineal de 2.48 metros cuando la tolerancia para este plano es de 0.28 metros, adicionalmente presenta una diferencia de l757 m2 entre el área generada por su derrotero y la indicada en el plano, siendo Ia tolerancia para el área de 15.80 m2; razón por la cual para representar el plano A-1258087-2008 en los montajes fue necesario vectorizar la imagen del plano”. Además, en este tipo de procesos no se puede controvertir ese tipo de prueba a través de informes privados (el del topógrafo [Nombre4] ) ni tampoco de otros emitidos por autoridades públicas fuera de sus competencias legales (Inder).
Aparte de volverse litigioso el proceso, si se cuestionaba la veracidad del informe del Catastro Nacional, era a tal entidad que se le debía pedir información adicional sobre el tema, si era del caso y a la que debió habérsele dado oportunidad de manifestarse, de considerarse que con otros elementos probatorios se cuestionaba lo informado por sus personas funcionarias Con respecto al traslape documental (de planos). En segundo lugar, en todo caso, aun cuando se probase por el procedimiento correcto que materialmente puede que no exista traslape entre terrenos, documentalmente, es decir, en los planos, si puede existirlo. Y ello es lo que indica el informe del Departamento Técnico Catastral del Registro Inmobiliario, además de informar sobre los problemas que tienen tanto el plano de la parte promovente como el de la finca del Estado. En otras palabras, no solamente materialmente sino también documentalmente (planos) no puede existir traslape para poder inscribir un terreno.
Y si el plano base presenta además errores que han sido puestos en evidencia debidamente, tales deben ser corregidos. Ninguno de sus aspectos parece haber sido tomado en cuenta por el Juzgado a la hora de descalificar la veracidad del informe DRI-CTE-03-0167-2019 y el oficio DRI-03-481-2019. Por ello lleva razón la Procuraduría en cuenta que no se debe aprobar este proceso mientras esos temas o problemas no sean debidamente subsanados, dentro del marco de lo que en este tipo de asuntos se puede permitir, porque en todo momento debe tenerse presente que un proceso no contencioso no se debe ordinariar, es decir, volverlo litigioso. En casos extraordinarios, en los que se cuestione la veracidad de un informe público debidamente emitido por la autoridad competente, debe, por debido proceso, ponerse en conocimiento del ente pertinente las objeciones planteadas o solicitársele las aclaraciones que corresponda, antes de descalificar su contenido.
Adicionalmente, la PGR, con su escrito de apelación aporta prueba para mejor resolver, la cual fue admitida, en la que se evidencia un aparente traslape entre el plano de la finca titular y el plano de la finca inscrita A-505346-000. Es un informe emitido por una autoridad competente, como lo es el Área respectiva del SINAC, fechado 1 de noviembre de 2021, dado que el terreno es boscoso, por lo que se afirma forma parte del Patrimonio Natural del Estado. Por lo que debe tenerse como documento público válido. Sin embargo, su conclusión es ambigua, dado que no ofrece un dato preciso sobre lo que se le solicita informar. Esto por cuanto indica: “En respuesta al oficio DAA-OFI-534-2021 en el que se solicita catastrado 2-1258087-2008 indicar si existe traslape con terrenos del Patrimonio Natural del Estado (PNE), especialmente la finca 2-505346-000, plano catastrado 2-872213-1990 y realizar un montaje, me permito indicarle que, con base en la información consignada en las Fincas de PNE del SINAC, hojas topográficas del IGN escala 1:50000, catastro municipal y vías cantonales de la Municipalidad de San Ramón así como de los planos 2-872213-1990 y 2-1258087-2008, se evidencia un aparente traslape del predio 2-1258087-2008 respecto a la finca del Estado supra citada, según se observa en el mapa de la Figura 1, en el que se evidencia un traslape en el límite sureste del plano 2-1258087-2008, de un aproximado de 7%.
Es necesario aclarar que el montaje de planos en el Sistema de Información Geográfica no fue fiable al ciento por ciento, dadas las limitaciones de los insumos disponibles (especialmente de los planos catastrados mismos), la accidentada y montañosa geografía del sitio con escasos elementos de referencia, y el escaso tiempo otorgado para respuesta, para realizar una gira de inspección al sitio, sin embargo este se realizó de la mejor manera posible y en la ubicación más aproximada con el fin de dar la respuesta requerida”. Pese a la ambigüedad la respuesta, es importante destacar que no contradice lo indicado en el informe del Departamento Técnico Catastral del Registro Inmobiliario (DRI-CTE-03-0167-2019 y el oficio DRI-03-481-2019). Se omite pronunciamiento sobre el último agravio de la apelación, por innecesario, dado lo analizado.* * XI.- Conforme a lo explicado y y lo dispuesto en los artículos 1 y 11 de la Ley de Informaciones Posesorias, 8 y 18 de la Ley de Catastro Nacional, debe anularse la sentencia impugnada, para corregir procedimientos.
Por ello debe el Juzgado, previo a continuar con el trámite, prevenir a las autoridades competentes -Catastro Nacional y Área de Conservación Central del SINAC- precisar sus informes en cuanto a si existe o no efectivamente traslape; y de ser así el porcentaje y ubicación del traslape documental entre los planos A-872213-1990 y A-1258087-2008. De confirmarse la existencia de traslape documental, deberá prevenir oportunamente a la parte titulante aportar un nuevo plano y demás aspectos relacionados con ello, en el que no se incluyan áreas o zonas comprendidas en la [Dirección10] , descrita en el plano catastrado A-872213-1990 o bien aquellas prevenciones necesarias para culminar el trámite correspondiente, de conformidad con el artículo 11 de la Ley de Informaciones Posesorias.
POR TANTO* Se admite como prueba para mejor resolver el informe SINAC-ACC-D-of-799-2021 del Área de Conservación Central del SINAC, fechado primero de noviembre de dos mil veintiuno. Se anula la sentencia 247 de veintisiete de octubre de dos mil veintiuno. Debe el Juzgado, previo a continuar procedimientos, prevenir a las autoridades competentes -Catastro Nacional y Área de Conservación Central del SINAC- precisar sus informes en cuanto a si existe o no efectivamente traslape; y de ser así el porcentaje y ubicación del traslape documental entre los planos A-ochocientos setenta y dos mil doscientos trece-mil novecientos noventa (A-872213-1990) y A-un millón doscientos cincuenta y ocho mil ochenta y siete-dos mil ocho (A-1258087-2008). De confirmarse la existencia de traslape documental, deberá prevenir oportunamente a la parte titulante aportar un nuevo plano y demás aspectos relacionados con ello, en el que no se incluyan áreas o zonas comprendidas en la finca de Alajuela [Dirección11] (A-505346-000) o bien aquellas prevenciones necesarias para culminar el trámite correspondiente.
