Attorney Roberto Paniagua Vargas, identity card CED3 - - , bar membership number six thousand seven hundred ninety-three, acts as special litigation counsel (apoderado especial judicial) for the plaintiff; attorney Mauricio Rodríguez Méndez, identity card CED4 - - , bar membership number seven thousand one hundred twenty-one, acts for the defendant. Heard before the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia.

Judge Díaz Bolaños delivers the opinion; and,

WHEREAS:

I.According to the complaint entered in the virtual docket of the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, the plaintiff requests: “A—That the judgment declare the RESCISSION (RESOLUCIÓN), ABSOLUTE NULLITY (NULIDAD ABSOLUTA), AND INEFFECTIVENESS (INEFICACIA) of the deed executed at eight o’clock on catorce de noviembre del año dos mil doce, DEED NUMBER TWO HUNDRED THIRTY-TWO, COMMENCING ON THE FRONT OF FOLIO ONE HUNDRED EIGHTY-TWO OF VOLUME NUMBER TWENTY-SEVEN OF THE NOTARIAL RECORD OF [Nombre3] , whereby A RIGHT-OF-WAY EASEMENT (SERVIDUMBRE DE PASO) IS CREATED in favor of the property owned by [[Nombre2] ], described above. B—That the judgment release and discharge property number [Valor 003], which I own, from any right-of-way easement encumbrance. C—That the judgment declare that THE DEFENDANT HAS NO REAL OR PERSONAL RIGHT (DERECHO REAL NI PERSONAL) OVER PROPERTY NUMBER [Valor 003], WHICH I OWN, AND THAT SHE MUST THEREFORE BE PROHIBITED FROM ENTERING OUR LAND, AS MUST [Nombre4], AND MUST REFRAIN IN THE FUTURE FROM COMMITTING ANY ACT WHATSOEVER THAT INTERFERES WITH OUR OWNERSHIP OF THE LAND, WITH THE WARNING THAT, IN THE EVENT OF NONCOMPLIANCE, THEY SHALL BE PROSECUTED FOR THE OFFENSE OF DISOBEDIENCE TO AUTHORITY. D—In the event the defendant opposes the action, that she be ordered to pay the attorneys’ fees and litigation costs (costas personales y procesales) of the proceeding.”

II.Defenses raised. The defendant, [[Nombre2] ], answered the complaint in the brief entered on 17/10/2019 04:01:35 and raised the defenses (excepciones) of absence of a legal right, lack of standing on the part of both the plaintiff and the defendant, and lack of interest.

III.The defendant, [[Nombre2] ], filed a counterclaim (reconvención) against [[Nombre1] ], which was declared inadmissible by ruling issued at 15 hours 59 minutes on 20 de mayo de 2020 (see the virtual docket of the Juzgado Agrario de Liberia, brief entered on 17/10/2019 04:01:35 and ruling in entry 94).

IV.Judge Sergio Huertas Ortega of the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, in judgment number 45-S-2021, issued at sixteen hours fifteen minutes on once de marzo de dos mil veintiuno, ruled: “In accordance with the foregoing, the defenses of lack of standing on the part of the plaintiff and the defendant and lack of current interest are rejected. The defense of absence of a legal right is sustained. The ordinary complaint filed by [[Nombre1] ] against [[Nombre2] ] is DISMISSED IN ITS ENTIRETY. The plaintiff shall bear the costs of the proceeding. The prevailing party must submit an assessment thereof during the enforcement phase of this judgment” (see the virtual docket of the Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, associated documents, trial-court judgment entered on 27/04/2021 14:49:13).

V.Regarding the findings of fact (hechos probados), findings one, two, and three are affirmed. No ruling is made regarding the fourth because it was not appealed.

VI.With respect to unproven events (eventos indemostrados) one and six, there is no evidence concerning such matters. As for the remainder, they are unnecessary in light of the relief sought and are therefore not affirmed.

VII.The decision cited above in Considerando IV is appealed by attorney Roberto Paniagua Vargas, acting as special litigation attorney-in-fact (apoderado especial judicial) for the plaintiff, [[Nombre1] ]. He lists the following grounds of appeal (agravios): Contradictory reasoning, because the rules of logic and experience were not properly applied; the principles of consistency and derivation were disregarded. He argues that the conclusions of the judgment contradict the evidence presented in the proceedings. First, he alleges coercion in the execution of the easement (servidumbre) and that the defendant’s witnesses are unreliable. He transcribes the section concerning facts not proven (hechos no probados), specifically the first one. He considers that the assessment contained therein runs counter to the evidence presented, which constitutes a defect rendering the appealed judgment void. He states that the third allegation of fact in the complaint claims that his client signed the easement deed under coercion from her father; he reproduces that allegation.

The evidence presented demonstrated that, despite the division of the property, the plaintiff’s father always believed that the lots at issue belonged to him and therefore ordered his client to sign that document. The record demonstrated that, although his client did not agree, she consented in order to prevent harm to her father’s health, because he was an older adult with serious health conditions that left him depressed and distressed. He excerpts the testimony of [[Nombre5] ], which, in his view, clearly demonstrates that the execution of the easement document was affected by a defect of consent (vicio de voluntad), because his client was coerced into signing it at the behest of her father, [[Nombre6] ]; he reiterates that her father was elderly and ill and that she signed it so he could live his final days in peace, but always against the plaintiff’s wishes. He argues that the opposing party attempts to refute this through the testimony of [[Nombre7] ] and [[Nombre8] ].

He proceeds to reproduce portions of their statements. He asks the Court to note that both persons are siblings of Mr. [[Nombre6] ]. They said that they were alone when he told them that he was leaving the access lane to the other lots because there was no convenient access to the road. In his view, those assertions must be called into question because it is false that Mr. [[Nombre6] ] was ever left alone at his own client’s home; indeed, he always lived on the property at issue until his final days and was never left alone because he suffered from serious health conditions. He further asks the Court to note the contradiction in the opposing party’s witnesses’ statements that the lane was being left because access to [Dirección1] was difficult due to its poor condition. That circumstance is contradicted by the judicial inspection (reconocimiento judicial) contained in the record, which demonstrates that the defendant currently uses, and has always used, [Dirección2] .

The cited inspection confirms the construction of a red tubular gate with a chain and padlock, installed by the defendant to obtain unrestricted access to [Dirección3] . According to his account, its use by the opposing party is demonstrated by the presence of animal tracks leading from within her property toward the road via [Dirección4] , in the direction of the town of Nancital. Based on the foregoing, he concludes that the witnesses are lying when they state that there is no convenient access to [Dirección5] because it has been demonstrated that the defendant does use it. He refers to the witness [[Nombre9] ] and transcribes part of his statements. He asks the Court to note that the witness first said he had no family relationship with the parties and then acknowledged that he had been his client’s common-law partner, which, in his view, demonstrates bad faith, and that his testimony must be called into question because their relationship may have ended badly, for which reason he would testify against his client.

He considers it contradictory that the witness claimed to know the matters he asserted because he had lived with his client, yet ultimately stated that he had separated from [[Nombre1] ] 13 years earlier, meaning that he had not lived on the property at issue since 2007. He asks the Court to note that the easement document was signed in 2012, and thus logic and experience lead to the conclusion that the witness is lying. He emphasizes that the witness had not lived in the house at issue since 2007 and that his testimony must be called into question because of his contradictions and partiality. He adds that the witness lies when he states that [Dirección5] is impassable, when the proceedings demonstrated that it has always been used by the defendant, as evidenced by the fact that the red gate was installed a long time ago. He argues that, when considered as a whole, the evidence weighed in the judgment contains a defect rendering the judgment void, and he requests that it be so declared.

He labels a second group of grounds of appeal as follows: dominant estate (fundo dominante) with direct access to [Dirección6] , convenient satisfaction of its needs—existence of a red gate. He transcribes a section of the appealed decision concerning the unproven facts and its conclusions regarding whether the public road is passable, as well as the reasoning employed. He argues that this circumstance was demonstrated by the official communications issued by the Municipalidad de Carrillo, which expressly state that the properties are bounded on the south by [Dirección7] and that the northern access is within the Río Brasilito protection zone (zona de protección), an area that is not public. This is also confirmed by the property plans, which state that the properties are bounded on the south by a public road; an old fence that marked the boundary with the road can be seen, but the defendant herself moved it farther into her property to widen that road to 14 meters.

Regarding the judicial inspection, he notes that it records that part of the public road to the south is in poor condition. He emphasizes that this evidence shows that, where there is a red gate toward the town, the road is passable and has even been under repair by the Municipalidad de Carrillo. He explains that the matter has demonstrated that [Dirección8] is currently used, that the defendant installed a red gate, and that there are animal tracks running from inside the defendant’s property toward the road and then west toward the town of Nancital. The judicial inspection demonstrated that the defendant meets all her needs by using the direct access to the public path, because the parcel (predio) is used for grazing horses and contains a dwelling, fruit trees, and ornamental plants. He insists that the defendant meets her needs by means of that southern route, noting that she does not have large-scale crops requiring optimal access because she can benefit from the access described above, as she currently does.

He characterizes as unusual what occurred during the judicial inspection when the judge pointed out that only animal tracks, and no vehicle tracks, were evident at that red gate. Such an observation is logical given the defendant’s insistence on using the riverbank and the lane at issue because, in bad faith, she does not wish to pass through that location even though she could do so conveniently while meeting her needs. He asks the Court to note that the images from the cited judicial inspection show that, in the section of the public road where the red gate is located, the road is indeed passable and runs west toward the town of Nancital, which is the route the defendant has been using. On the other hand, this evidence shows that, in the southeastern portion of the defendant’s property, the public road fronting it is not in optimal condition. Nevertheless, the testimony of [[Nombre10] ] and [[Nombre11] ] demonstrated that the Municipalidad de Carrillo is already repairing that road with machinery suitable for the work.

He states that logic and experience lead him to conclude that, because it is a public road, that municipality must repair it, install bridges, and perform the necessary work in the areas where it is needed. He emphasizes that, because it is a local road, the aforementioned municipality is responsible for maintaining it. If the defendant does not complain about the condition of that road, that is a negligent “aptitude” (sic) on her part, and his client should not be adversely affected by it. He transcribes the statements of witnesses [[Nombre12] ] and [[Nombre11] ], both [[Nombre13] ], regarding the municipal issue. He considers that there can be no doubt whatsoever that the defendant has and uses direct access to the public road and that she installed a gate with a chain and padlock to obtain such access. That circumstance is confirmed by the animal tracks previously mentioned. He characterizes the statements in the judgment as contrary to the evidence, which constitutes a defect, and requests a declaration of nullity.

In the third point, he states that the defendant’s estate has direct access to a public road through the Río Brasilito protection zone—the property is in the same circumstances as the plaintiff’s. He reproduces the third fact not proven. He explains that the present complaint alleges that, in addition to having direct and convenient access to the public road, the defendant’s property has direct access to the bank of the aforementioned watercourse under the same conditions as his client’s property, which is another reason why she does not need the easement. He faults the judge for refusing to conduct the judicial inspection in the area where the defendant could travel perfectly and conveniently along the riverbank without having to enter his client’s property. The certified plan of the opposing party’s property confirms that the entire northern boundary of that property adjoins the Río Brasilito protection zone.

He emphasizes that the easement at issue is 80 meters long, which shows that there is little distance between the wire entrance gate and the point where the defendant’s property begins, and that the defendant can access her property along the riverbank under the same conditions as his client, without affecting his client’s property. He characterizes the defendant as acting in bad faith because she does not enter through that area, alleging that the easement area is at a higher elevation. The images from the judicial inspection in the record show that the wire entrance gate to the lane is lower than the lane’s interior; accordingly, logic and experience do not support the conclusion that the defendant can access the elevated lane if, at the entrance by the wire gate, the river prevents her passage. He considers that such a right-of-way (derecho de paso) makes no sense if she ultimately cannot use it because its main entrance at the barbed-wire gate is at a lower elevation, and therefore that argument “collapses under its own weigh” (sic).

He states that the witness testimony and judicial inspection proved that, during the rainy season, the flow of the aforementioned body of water increases, making it impossible to use the bank of that watercourse to travel over the easement at issue. He asks the Court to note that, on the day of the trial, they had to leave their vehicles on the other side of the river and reach the properties on foot by crossing a suspension bridge. The water level also prevents vehicle traffic; he recalls that, on that day, an ICE truck became stuck in the middle of the river due to the imprudence of attempting to cross it. He says the foregoing proves that access along the riverbank to reach the easement at issue is an inconvenient and inaccessible route during the rainy season. He adds that, because it is a protected area, the Municipalidad de Carrillo cannot construct, repair, or improve a road through that area while destroying part of the natural area, nor can it attempt to build a bridge to the properties.

He refers to an official communication offered as evidence to assist the Court in reaching a decision (prueba para mejor resolver), according to which the riverbank is not public. From the foregoing, he argues, it was demonstrated that access to the public road by way of [Dirección9] at issue is more convenient and accessible than access along the bank of the body of water, which cannot be traveled during the rainy season because of the increased flow. The judgment is contrary to the aforementioned evidence, which constitutes a defect, and he requests that it be annulled. Fourth, he considers that the assessment is contradictory with respect to what was not granted. He reproduces a section of the judgment referring to travel along the bank of the watercourse in question.

She states that the judgment accepts, on the one hand, that it would be highly dangerous to grant persons access on foot or by vehicle parallel to the riverbed through a judicial judgment, due to the instability inherent in the tributary itself. Nevertheless, contradicting its own reasoning, it denies her client’s request to extinguish the easement (servidumbre) at issue, which is accessed through that same watercourse acknowledged to be dangerous; hence, she considers that this contradiction renders the judgment null and void. As a fifth ground of appeal, she alleges the failure to rule on all the claims—nullity based on defects in consent (vicios del consentimiento) is not the complaint’s only request—stating that the action for release from the easement due to abuse of rights (abuso del derecho) is an independent claim. She quotes a passage from the judgment indicating that, because the alleged defects in consent were not proven, it was unnecessary to rule on the remaining requests.

She considers this untenable because the requests are independent of one another and are not mutually exclusive. In this case, she explains, the claim seeks release or discharge from the encumbrance consisting of a right-of-way easement (servidumbre de paso) or a real or personal right over her client’s property. She reproduces a passage from the complaint concerning the requests. She cites Section 399 of the Código Civil to explain that this provision authorizes the owner of a property to seek release or discharge from the obligation to provide passage to another parcel when such passage is no longer indispensable because the other parcel has convenient access to the road. In this matter, it has been demonstrated that the defendant’s property has direct and convenient access to a public road that is indeed passable. The Municipalidad de Carrillo is repairing it and, because it is public and under the Municipality’s administration, the Municipality may be requested—and even compelled—to make it suitable for those purposes.

It was established that this access is more convenient than entry through the río Brasilito, which is impassable during the rainy season, with no possibility of repairing it or installing a bridge because it is an inalienable area. Moreover, the legality of constructing a road over the bed of a tributary is itself in question; therefore, the action seeking release from the encumbrance at issue has been proven and substantiated. She reproduces Section 22 of the Código Civil to assert that the agreement establishing the easement constitutes the exercise of a right in a manner that is abusive and exceeds the normal limits of that right, because it was proven that the defendant can gain access by public road from two directions: directly from the south via the street, or directly from the north along the bank of the río Brasilito, without needing to enter her client’s land. The easement at issue restricts her client’s exercise of private-property rights over the parcel; therefore, under the cited provision, she has standing in this action to seek the adoption of judicial or administrative measures preventing the continuation of the abuse, by requesting its cessation or release from that encumbrance.

The trial judge’s denial and failure to rule on that claim constitute a defect rendering the appealed judgment null and void. As a sixth ground, she argues that the easement violates the right to private property and the free disposition of property. She reproduces a passage from the judgment referring to the agreement establishing the easement and to Articles 45 of the Constitución Política and 290 and 292 of the Código Civil. In her view, those provisions clearly define the right freely to dispose of private property, under which the owner of an estate (heredad) may do with it as the owner sees fit. In the case at bar, she finds it striking that the right-of-way easement seriously violates those provisions by preventing her client from doing as she wishes with the portion of land forming part of her property, which she cannot freely alter because of that encumbrance, even though the defendant can reach a public road from two directions; therefore, that restriction must be annulled.

She asks the Court to observe that the defendant’s survey plan, as well as the municipal certifications referenced above, clearly indicate that the opposing party’s parcel adjoins [Dirección7] and the riverbank. In her view, there is no doubt whatsoever that the defendant’s property has two points of access to a public road and therefore does not require the easement at issue. The appealed judgment disregards the access to that public road, contrary to the evidence in the record, and rejects the cited provisions; for that reason, she requests that it be annulled. As a seventh ground of appeal, she invokes the judiciary’s obligation to protect the inalienable area of the río Brasilito and the failure to afford MINAET a hearing. She states that, in this case, it was proven that the easement provides the defendant access to a public road across a protected area (área de protección) of that body of water.

She considers that it must be questioned whether a road across a river’s protected area is legally viable, when it is common knowledge that the area must be preserved in its natural condition. The issue in this matter is whether a private agreement between the parties establishing a right-of-way easement encompassing a protected area is lawful, or whether it constitutes an abuse of power by private parties that must be annulled for infringing inalienable rights, particularly when the judicial body did not afford MINAET a hearing in the proceedings. She objects that the judge is a guarantor of the protection of natural rights and must ensure that a private agreement does not infringe the State’s inalienable rights, even annulling it sua sponte. She reiterates that the judgment must be annulled because MINAET was not afforded a hearing. She requests that the decision be reversed and, in the interest of procedural economy (economía procesal), that release from the easement be declared in favor of her client’s property ([Dirección10] ).

VIII.Given the breadth of the appeal brief, as well as the repetition of issues, the appropriate course for a better resolution of the matter is to organize them as follows: as to form: 1. contradictory reasoning warranting a declaration that the judgment is null and void; 2. failure to afford MINAET a hearing; and 3. failure to rule on the claims asserted in the complaint. As to form, all relating to the improper assessment of the evidence: 1. coercion to sign the deed establishing the right-of-way easement (servidumbre de paso); 2. violation of the right to private property; and 3. extinguishment of the established easement because the defendant has access to a public road in two directions.

IX.As to form: The first issue to be resolved concerns the general allegation of contradictory reasoning that, in the appellant’s view, warrants declaring the judgment null and void. Throughout the appeal brief, the appellant complains of a lack of reasoning or analysis of the evidence. However, a reading of the challenged decision shows that it contains an analysis of the evidence entered into the record, to which the court assigned the weight it deemed appropriate in accordance with the system for assessing evidence in agrarian matters, governed by section 54 of the Ley de Jurisdicción Agraria. Furthermore, the law was applied and the claims were analyzed in accordance with the factual framework set forth in recital (considerando) IV and the unproven events listed in recital V of the judgment. The appellant particularly disagrees with the latter group, repeatedly maintaining that he proved the matters stated therein. Nevertheless, this Chamber considers that the judgment contains the elements required of this type of decision, in accordance with section 560 of the Código de Trabajo, which applies supplementarily to this subject matter. Thus, the weight assigned—or not assigned—to each item of evidence, as well as the application of the law, is a matter to be assessed when the grounds of appeal on the merits are considered. This ground of appeal must therefore be rejected.

X.The second basis on which the appellant seeks to have the judgment declared null and void is the failure to afford MINAET a hearing. The appellant argues that the court is required to notify that ministry because the easement at issue passes through a protection area (área de protección) of the río Brasilito. A comprehensive review of the complaint in frames 2 to 13 shows that there is no need to treat that entity as an interested third party or otherwise join it to the litigation. This case concerns a dispute between private parties in which the plaintiff seeks removal of the easement encumbering her property. According to the judicial inspection (reconocimiento judicial) (in the video file, compact disc I, from minutes 27:38 to 43:19), its route runs partly along the bank of the río Brasilito from a road [Dirección11], which is an unpaved area, and there are sections standing four meters above the edge of the body of water (minute 31:28).

Furthermore, according to the deed establishing the encumbrance (gravamen) in frames 15 to 17, the easement runs “parallel along the northern boundary of the servient estate (fundo sirviente), through an area passable to the rio (sic) Brasilito…” (frame 16). These elements do not establish that the portion running parallel to that watercourse and located within the protected zone (zona protectora) cannot be used as the route of an easement. It must be borne in mind that the protected zone is subject to environmental restrictions concerning exploitation. Those restrictions cannot in any way be extended to the circumstances analyzed here. The establishment of an easement is part of the right to use, enjoy, and exploit one’s property, pursuant to section 264 of the Código Civil. Moreover, according to the witness testimony, the road at issue has been used historically, and it was not proven that its existence and use have harmed natural resources.

Nor, when it was traversed during the judicial inspection, was any evidence recorded of danger to the body of water in question or of any related risk. Regarding the nature of protection areas, under Article 33(b) of Ley Forestal No. 7575, the cutting or removal of trees is prohibited. Their purpose is the conservation and protection of bodies of water. Such areas form part of the properties containing them, but their use and enjoyment are subject to environmental restrictions, such as the prohibition against building, cultivating, or carrying out activities that endanger bodies of water. In decision 596-F-2017, issued by this Tribunal at sixteen hours and thirteen minutes on seis de julio de dos mil diecisiete, it was held: “Third, the appellant is conceptually mistaken regarding the legal nature and treatment of the protection areas for bodies of water governed by section 33 of Ley Forestal N. 7575.

On this issue, it should be stated that the legally correct term for the section of land adjoining the bank of a body of water is ‘protection area,’ as identified by the cited statutory provision. It is not ‘protected zone,’ which corresponds to one of the management categories for protected wild areas (áreas silvestres protegidas) governed by Article 32 of the Ley Orgánica del Ambiente. They are not the same legal concepts and do not have the same legal scope, although there is widespread confusion arising from the use of those concepts as synonyms. Accordingly, under section 33(b) of the Ley Forestal, the protection areas relevant to this matter consist of a strip measuring 15 meters in rural areas and ten meters in urban areas, measured horizontally on both sides of the banks of rivers, ravines, or streams if the land is flat, and 50 meters horizontally if the land is rugged. These areas constitute what constitutional property-law doctrine calls limits and restrictions on the exercise of property rights.

They are regulations governing the manner in which the powers inherent in the real right of ownership over property are exercised, given the legal nature and status of the property subject to that real right. The appellant’s argument that, merely because it is a ‘protected zone,’ which must be understood as a protection area, it is public-domain property (bien de dominio público) possessing all the characteristics of public property (bienes demaniales), is unsound. Some properties are privately owned, whether registered in the Property Registry or not, and contain bodies of water whose adjoining areas form part of the parcel subject to private ownership rights. Because they contain a body of water and a protection area, they are subject to restrictions on construction or productive activities that could harm the water resource in the area governed by Article 33(b) of the Ley Forestal. Section 34 thereof prohibits the cutting or removal of trees in the protection areas described above and requires that boundary alignments (alineamientos) be processed by the Instituto de Vivienda y Urbanismo.” Accordingly, provided that the right-of-way easement is used in compliance with those statutory environmental limits and restrictions, there is no impediment to imposing the real-property burden (carga real) disputed in these proceedings.

The strip of land is private property, and the powers and content of the property right are governed and qualified by the cited statutory provisions. Those provisions do not deprive the property right of its substance to the point of making it unavailable for disposition. Consequently, and pursuant to Article 40, fourth paragraph, of the Ley de Jurisdicción Agraria and section 22.4 of the Código Procesal Civil, which applies supplementarily, it has not been established that MINAET must be joined to the litigation as a legally interested third party or must act as an intervening party (coadyuvante) supporting either of the principal parties to these proceedings; the claim must therefore be rejected.

XI.Lastly, as a procedural ground (motivo de forma), she objects that the claims in the complaint were not adjudicated. In view of the arguments raised on appeal, it is appropriate to transcribe the relief requested: “A-THAT THE JUDGMENT DECLARE THE RESCISSION (RESOLUCIÓN), ABSOLUTE NULLITY (NULIDAD ABSOLUTA), AND INEFFECTIVENESS (INEFICACIA) of the deed executed at ocho horas del catorce de noviembre del año dos mil doce, DEED NUMBER TWO HUNDRED THIRTY-TWO, COMMENCED ON THE FRONT OF FOLIO ONE HUNDRED EIGHTY-TWO OF VOLUME NUMBER (sic) TWENTY-SEVEN OF THE NOTARIAL PROTOCOL OF [Nombre3], whereby a RIGHT-OF-WAY EASEMENT (SERVIDUMBRE DE PASO) IS CREATED in favor of the real property owned by [[Nombre2] ], previously described. B- That the judgment release and exempt my property number [Valor 003] from any right-of-way easement encumbrance. C-THAT THE JUDGMENT DECLARE THAT THE DEFENDANT HAS NO REAL OR PERSONAL RIGHT WHATSOEVER OVER THE REAL PROPERTY OWNED BY ME, NUMBER [Valor 003], AND THAT SHE MUST THEREFORE BE PROHIBITED FROM ENTERING OUR LAND, AS MUST [Nombre4], AND MUST REFRAIN IN THE FUTURE FROM COMMITTING ANY ACT WHATSOEVER THAT DISTURBS OUR OWNERSHIP OF OUR LAND, WITH THE WARNING THAT, IN THE EVENT OF NONCOMPLIANCE, THEY WILL BE PROSECUTED FOR THE OFFENSE OF DISOBEDIENCE TO AUTHORITY.

D- Should the defendant oppose the action, that she be ordered to pay the attorney’s fees and procedural costs of the proceedings” (emphasis in the original text in frames 9 to 10). With respect to the facts alleged in the complaint, which are used to understand the scope of the prayer for relief (petitoria), it is apparent from the third fact, in image 4, that the plaintiff recounts that, under pressure and coercion from the litigants’ father, they signed a deed creating a right-of-way easement in favor of the defendant’s estate. In the fourth through sixth events, she states that the defendant’s property is not a landlocked parcel (fundo enclavado), that it has unrestricted access to a public road, and that, for this reason, passage through the plaintiff’s property is unnecessary. In the seventh fact, she explains that the encumbrance (gravamen) was not registered; in the eighth, she offers assessments concerning the nullity of the encumbrance, characterizing it as contrary to the private interest attached to her property; lastly, in the ninth, she recounts the filing of a possessory injunction action (acción interdictal) based on the alleged disturbance of the easement.

Upon examining the complaint, this Chamber concludes, contrary to the assertion made on appeal, that the request is clearly directed toward seeking termination of the right-of-way easement because defects existed when it was created. The statement of facts explains why the defendant’s estate does not require the easement, but when the facts and claims are considered together, it cannot be concluded that two different grounds are involved. In other words, the plaintiff seeks only the nullity of the agreement creating the easement on the basis of defects, but does not in any way invoke another ground, such as those listed in Article 381 of the Civil Code. Furthermore, the First Chamber of the Supreme Court of Justice has explained the following regarding the prayer for relief: “...A substantive claim (pretensión sustantiva) shall be understood as that set of requests made by the plaintiff in the complaint, seeking a declaration of rights and the imposition of obligations upon the defendant.

The cause of action (causa de pedir) corresponds to the facts giving rise to the right invoked; in other words, those legally relevant facts narrated by the litigants upon which their claims are based. These are specific events, the historical facts underlying the dispute that the judge is asked to resolve. Arguments are excluded as identifying elements of this cause of action (causa petendi), because they are not facts but intellectual constructs, as is the legal characterization assigned by the plaintiff (since that assessment does not alter those events, regardless of how they are characterized)” (decision number 82 of 14 hours 15 minutes on 22 de febrero de 2005). Accordingly, pursuant to section 54 of the Ley de Jurisdicción Agraria, the court below (órgano a quo) could not rule on matters that are merely incidental within the series of facts alleged in the complaint, such as the defendant’s potential alternative means of access.

As stated, the claim is directed exclusively toward seeking the nullity of the agreement that created the easement, as reasoned in the judgment. At this stage of the proceedings, it is impermissible to pursue another ground that was not properly invoked; although the matter of other exits to a public road is recounted, it was not expressly included in the relief requested in the complaint and, under sound procedural practice, should have been pleaded as ancillary relief. The request in item a), seeking rescission, absolute nullity, and ineffectiveness of the referenced instrument creating the easement, is linked to items b) and c), which seek release from that encumbrance, but those items can be understood only when read together with the relief requested in item a). Accordingly, the alleged nullity shall be rejected.

XII.As to form, all of the arguments concern the improper assessment of the evidence (valoración de las probanzas). The first issue relates to the alleged coercion (coacción) in obtaining the signature on the deed establishing a right-of-way easement (servidumbre de paso). The appellate brief reiterates that the opposing party’s witnesses are not credible because, in the appellant’s view, the coercion suffered by the plaintiff in establishing the easement was proven. On this point, it is relevant to note section 1017 of the Civil Code, insofar as it provides that a contract consented to under force or grave fear is voidable. Read together with it, section 1018 ibid. establishes that, in assessing force or intimidation, regard must be had to the age, sex, and circumstances of the person subjected to it. The Second Chamber of the Supreme Court of Justice has addressed this set of defects that could affect consent (vicios que podrían afectar la voluntad), defining them as follows: “…

The defects that affect consent are normally listed as falsehood, violence, mistake, fraud, and even grave fear. Violence and grave fear are relevant to this case. The former may be either physical or psychological, and the following has been stated in that regard: ‘Violence, in general terms, encompasses fear and force (psychological and physical violence). It always entails pressure exerted upon an individual to induce that person to perform an act. Physical violence, however, reduces the victim to a purely passive state, because it operates upon the physical means that the victim must use to perform the act, whereas psychological violence operates upon the mind. Force, physical or absolute violence, is material coercion or compulsion used to force someone to make a declaration. In that case, consent is wholly absent, whereas in psychological violence consent exists but is defective...

Psychological violence is pressure exerted upon an individual to induce that person to perform an act, in the form of threats that produce an insurmountable fear; ... It does not destroy consent, because the person threatened may choose among several courses of action: to resist, to perform the act, or to suffer the harm. The declaration is genuine, but consent is defective; the threat operated as an essential factor in its formation. The harm announced by the threat must be future, wrongful, and substantial. “Substantiality” refers to the assessment of the influence exerted by the violence, for which a reasonable average person must be considered, with regard to age, sex, and circumstances (art. 1018 C.C.). The harm must be wrongful, meaning that there is no right to inflict it.’ (Emphasis added. [Nombre14], Víctor. Private Law, San José, third edition, Litografía e Imprenta LIL, S.A., 1.994, pp. 259, 266).

Grave fear, for its part, has been said to closely resemble psychological violence, but it does not require that the intimidation be caused by a threat; objective or subjective factors that produce fear and make it determinative are sufficient. (Ibid., p. 268. Boldface and underlining are not in the original)…” (judgment number 748, issued at 09 hours 40 minutes on 28 de noviembre de 2003). For that reason, those parameters are relevant when assessing the evidence, the starting point being the account set forth in the third allegation of the complaint, which states, insofar as relevant: “… As shown by the notarial certification attached (sic), at eight hours on catorce de noviembre del años (sic) dos mil doce, UNDER THE PRESSURE AND COERCION OF OUR FATHER [[Nombre6] ], WE BOTH SIGNED DEED NUMBER (sic) TWO HUNDRED THIRTY-TWO, …by means of which A RIGHT-OF-WAY EASEMENT IS ESTABLISHED in favor of the property owned by [[Nombre2] ], described above…” (emphasis in the text shown in images 3 to 4).

It follows from the foregoing that the person who exerted the “pressure and coercion” was the litigants’ father. According to the Real Academia Española, coercion is the force or violence used against someone to compel that person to say or do something. Accordingly, the legal basis for the defects alleged by the appellant is found in the provisions of the Civil Code cited above. Given the allegation that the parent exerted pressure upon the plaintiff’s psyche so that she would sign the deed establishing the mortgage (escritura de constitución de la hipoteca) shown in boxes 15 to 17, it must be proven that the force employed was insurmountable or irresistible and that she was unable to refuse to execute the public instrument (instrumento público). Under section 477 of the Labor Code, the plaintiff bears the burden of proof (carga de la prueba) to establish the foregoing. Because the Civil Code requires consideration of the age, sex, and circumstances of the person subjected to such force, the record first shows that the plaintiff is a woman residing in Nancital de Sardinal de Carrillo, which is a rural area in the country’s northern region, that she works as a treasurer, and that although her age cannot be determined, the images from her examination as a party (declaración de parte) show that she is over 50 years old.

She expresses herself fluently, using ordinary and clear language (see II compact disc, examination as a party from minutes 1:02 to 51:40). Neither the testimonial nor documentary evidence contains any relevant information regarding the plaintiff’s circumstances that would assist in deciding this issue beyond the matters stated above. It must be borne in mind, pursuant to section 42.2 of the Code of Civil Procedure, which applies supplementarily to this matter, that the appellant’s examination as a party contains no admissions contrary to her interests, and therefore provides no information that would permit further inquiry into this issue. To be clear, those statements cannot be weighed because of the legal effects of an examination as a party, even though the appeal insists upon their evidentiary weight; this Chamber is legally precluded from accepting that argument for the reasons cited.

As to the personal characteristics of the litigants’ father, don [[Nombre6] ], no conclusive information was submitted concerning him, except that he was male, was an older adult with health conditions, and shared the same residence as the plaintiff; his age when the events alleged in the complaint occurred was not specified. Nor was any evidence provided concerning the relationship between Mr. [[Nombre7] ] and his daughters. This is relevant because the alleged act of coercion and pressure, and the type of violence involved, had to be proven, as did any roles potentially imposed by patriarchy, under which women are viewed as occupying a position different from that of men, with particular emphasis on father-daughter relationships, in which loyalty, violence, and submission may vitiate consent. Such devaluation in the treatment of women may be manifested in many ways, including through language, the roles assigned to them in their work, their social environment, prestige, and access to private property, among many others.

According to Professors Alda Facio and Lorena Fries: “Patriarchal ideologies not only (sic) affect women by placing them in an inferior position in most areas of life, but also restrict and limit men, despite their privileged position. Indeed, by assigning women a set of characteristics, behaviors, and roles ‘proper to their sex,’ men are compelled to dispense with those roles, behaviors, and characteristics and to maximize their differences from women…. In other words, patriarchal ideology not only (sic) explains and constructs the differences between women and men as biologically inherent and natural, but also maintains and intensifies other (all) forms of domination…” (Facio, Alda and Fries, Lorena (2005). Feminism, Gender and Patriarchy. http://www.derecho.uba.ar/publicaciones/ rev_academia/ revistas/ 06/ feminismo- genero-y- patriarcado.pdf). Moreover, the 1995 Beijing Declaration and Platform for Action, a forward-looking agenda for the empowerment of women, analyzed various issues, and the States made commitments to defend and vindicate women’s human rights.

In particular, with respect to the issue under review, Chapter III, Critical Areas of Concern, section d), on violence against women, paragraph 118 of the Platform for Action recognized: “Violence against women is a manifestation of the historically unequal power relations between women and men, which have led to men’s domination of women, discrimination against women, and the imposition of obstacles to their full development. Violence against women throughout their life cycle derives essentially from cultural patterns, particularly the harmful effects of certain traditional or customary practices and all acts of extremism related to race, sex, language, or religion that perpetuate the inferior status assigned to women in the family, the workplace, the community, and society. Violence against women is aggravated by social pressures, such as the shame associated with reporting certain acts; women’s lack of access to information, legal assistance, or legal protection…” .

Furthermore, still within the context of supranational sources, the Inter-American Convention on the Prevention, Punishment, and Eradication of Violence against Women, “Convención Belem Do Pará,” law number 7499 of 02 de mayo de 1995, provides a relevant definition in its first section, defining violence against women as: “any act or conduct, based on gender, that causes death or physical, sexual, or psychological harm or suffering to women, whether in the public or the private sphere.” Its second section defines violence within the family as follows: “Violence against women shall be understood to include physical, sexual, and psychological violence: a) that occurs within the family or domestic unit or within any other interpersonal relationship, whether or not the perpetrator shares or has shared the same residence with the woman, and includes, among other acts, rape, mistreatment, and sexual abuse;…”.

With respect to the United Nations Declaration on the Elimination of Violence against Women—known by its English acronym CEDAW—law number 6968 of 02 de octubre de 1984, article 1 states that the expression “discrimination against women”: “shall denote any distinction, exclusion, or restriction based on sex that has the purpose or effect of impairing or nullifying women’s recognition, enjoyment, or exercise, irrespective of their marital status, on the basis of equality between men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, and civil fields or in any other field.” At the national level, the Domestic Violence Act, number 7586, defines psychological violence (violencia psicológica) as: “Any act or omission intended to degrade or control the actions, behaviors, beliefs, and decisions of other persons through intimidation, manipulation, direct or indirect threats, humiliation, isolation, or any other conduct that harms psychological health, self-determination, or personal development.” In light of the foregoing, it must be borne in mind that the roles imposed by patriarchy generate relationships involving violence against women, which produce practices that people may regard as normal, but which restrict women’s human rights.

As stated, despite the allegations in the complaint, the testimony contains no information from which to understand the relationship between the father and his daughters or whether he exercised violence to such a degree that the plaintiff was unable to refuse to sign the deed. On this point, contrary to the assertion made on appeal, the brothers of the plaintiff’s father clearly stated that the land belonged to their brother and that he left it to his children.

Regarding the declarant [[Nombre15] ], concerning the creation of the easement (servidumbre), she stated that her brother told her that she had to provide the defendant with access (compact disc III, minutes 19:05 to 26:57). She recounted that she had the conversation with him when he was ill and lying in a bed, noting that the bed was located outside the dwelling. The other brother, that is, the litigants’ uncle, [[Nombre7] ], (compact disc III, minutes 40:59 to 47:51) stated that he spoke with his brother, who told him that he had arranged everything and had given land to his children. He testified that the access route belonged to [[Nombre2] ] and was the same one used by the father. He stated that this was said to him in the yard while they were alone. These statements are considered spontaneous and do not appear accommodating; although they reveal that the parties’ father may have exerted influence over the creation of the easement, they do not establish when those conversations took place, whether before or after the subdivision of the property, or whether before or after the creation of the easement.

Those statements contain no such information concerning the relationship with the plaintiff, which, as noted below, consists of details relevant to determining whether violence or force was used to compel her to sign the aforementioned deed. These two witnesses were very close to Mr. [[Nombre6] ] and could have provided information about the family relationships relevant to reaching a conclusion different from that in the judgment. Regarding the other testimony, [[Nombre5] ] (compact disc II, beginning at minute 52:40) recounted that he lives with the plaintiff and lived with her father during his lifetime. He described how they placed materials to install a gate where the disputed path begins. At minute 56:24, he stated that [[Nombre6] ] authorized the little path. [Nombre16] authorized it because [[Nombre6] ] asked her to do him the favor of granting that permission so that his peace would not be disturbed before he died.

He recounted that he understood that [Nombre16] had signed permission for passage. She went to his Law Office (referring to the appellant’s attorney). At minute 1:00:29, he explained that she signed—the document—because of her father; he asked her to do him the favor of signing because he did not want to live out and end his final days amid disputes and commotion. At minute 1:01:20, he stated that the father’s health was poor and that, for a person of that age, problems made him “worse,” more nervous. He stated that he believed the father had kidney failure and that his condition worsened each day. He reported that he was not present when the document was signed (minutes 1:03:02). He also provided information about the construction of the path. It cannot be inferred from this testimony that the plaintiff suffered coercion (coacción) by her father. It does not show that her father’s request prevented her from refusing, or whether there was any defect of consent (vicio en la voluntad) on the plaintiff’s part.

In this Court’s view, the declarant was a person who lived with both of them in the household where acts of physical and psychological violence are engendered. As noted, his account describes a request for a “favor,” without establishing how that request affected the appellant’s state of mind and, consequently, her will. The declarant [[Nombre12] ] (compact disc III, minutes 0:43 to 07:15) stated that he was a resident of Lobandito and was not related to the parties. He described aspects of the access routes to the properties and stated that he knew about the division of land carried out by Mr. [[Nombre6] ]. The witness [[Nombre11] ] (compact disc III, minutes 04:14 to 17:16) stated that he knew the parties. He said that he was a friend of Mr. [[Nombre6] ] and visited him. He stated that he had heard nothing about the distribution of the land and did not know who built the disputed road.

The remainder of his statements concerned the access routes. The witness [[Nombre9] ] (compact disc III, minutes 28:53 to 39:50) stated that he knew the land that had belonged to Mr. [[Nombre6] ], who divided it among his children, and believed that this occurred approximately 10 years ago. He described the access routes serving the disputed parcels and information relating to those routes. As for the documentary evidence in the record, frames 15 to 17 contain the certified copy of the public deed (escritura pública) creating the easement, most of which contains the standard general information customary in this type of instrument. The following was added: “Present as an eyewitness who fully authorizes this public instrument is [[Nombre6] ], of legal age, single, Retired (sic), holder of identity card number CED5- - - and residing at the same address as the first party. That is all…”. The fact that he was present when the easement was created and that the instrument stated that he fully authorized it, even though his daughters already held title, could constitute circumstantial evidence (indicio) for determining the father’s interference with his daughter’s will.

However, as noted, and particularly in light of the statements made by [[Nombre5] ], it cannot be established whether the request for “that favor” involved intimidation, manipulation, or a direct or indirect threat such that a pathology of consent (patología en la voluntad) on the plaintiff’s part could be found. The remaining documents concern land-registry and cadastral certifications (images 19, 21, 24, 27, 28), copies of filings from a possessory summary proceeding (interdicto) heard by the Juzgado Civil de Santa Cruz, number 17-23-1583-CI, in frames 29 to 33, and an official communication from the Municipalidad de Carrillo in frame 42. When the evidence is assessed as a whole, as required by section 54 of the Ley de Jurisdicción Agraria, it does not establish grounds for granting the plaintiff’s request for a finding that she suffered violence compelling her to sign the aforementioned public instrument.

This Chamber clarifies that direct evidence is not required, because circumstantial evidence may support a finding that this scourge against women occurred. The subtlety with which aggressors may perpetrate their acts is understood, as such acts are concealed by myths surrounding domestic violence. Nevertheless, the scant evidence analyzed does not permit a sufficiently thorough examination of the relationship between the father and his daughters to establish with certainty the existence of a defect of consent.

XIII.The second objection concerns the violation of the right to private property through the imposition of the encumbrance (gravamen). Under Article 264 of the Código Civil, ownership or absolute title (dominio o propiedad absoluta) over a thing encompasses the rights of possession, usufruct, transformation and disposition, defense and exclusion, and restitution and compensation. Thus, the titleholder has control over the thing. The law also provides that such control may be limited by creating a right in rem over another’s property (derecho real en cosa ajena), whether by operation of law or voluntarily. Easements (servidumbres) are imposed upon or for the benefit of an estate (numeral 370 Código Civil); they may be established by mutual agreement. In the case at bar, they resorted to voluntary establishment, according to the document in frames 15 through 17. This was an inter vivos contract, and under these circumstances the principle of party autonomy (autonomía de la voluntad de las partes), protected by canon 22 of the Código Civil, prevails.

The Sala Primera de la Corte Suprema de Justicia, in judgment number 26 at 08 hours 30 minutes on 15 de marzo de 1991, summarized the foregoing as follows: “V.- Easements are rights in rem over another’s property, or in re aliena. They constitute a real right over another’s estate allowing its partial use in some respect. For the owner of the servient estate (predio sirviente), this entails a limitation on the exercise of the right of ownership. The Código Civil regulates easements generally (Articles 370 to 382); consequently, there are no standard easements whose content is expressly regulated, except for certain types, such as the compulsory right-of-way obligation (obligación forzosa de paso), which is located outside the corresponding chapter (Articles 395 to 400), and some established in the Código de Minería N° 6797 de 4 de octubre de 1982 and Ley de Aguas N° 276 de 27 de agosto de 1942.

Easements may benefit and burden only estates. The real property burdened by the easement is called the servient estate, and the property benefiting from it is called the dominant estate (predio dominante). Easements may be compulsory or voluntary; the former are those for which the law authorizes private parties to obtain their imposition despite the opposition of the owner of the servient estate. Regarding this latter categorization, our Código Civil (Arts. 395-400) establishes the so-called right-of-way obligation, which is actually a compulsory right-of-way easement (servidumbre forzosa de paso), since it is established by a ruling of the court in the cases provided by law....” Accordingly, the asserted grievance must fail because there is no infringement of the plaintiff’s right to property, as the law permits the creation of easements such as the one stipulated; although they restrict her estate, this falls within the exercise of her rights as owner pursuant to numeral 45 of the Constitución Política.

XIV.Lastly, she argues that the established easement must be extinguished because the defendant has access to a public road from two directions. The preceding section addressed the manner in which easements are established. One characteristic of voluntary easements, specifically rights-of-way (servidumbres de paso), is that the estate need not be landlocked for them to be imposed. Following the reasoning of the aforementioned judgment of the Cámara de Casación, this point is illustrated as follows: “VII.- Thus, insofar as relevant to the resolution of this case, a distinction may be drawn between a voluntary easement (servidumbre voluntaria) and a right-of-way obligation; the latter arises by operation of law and the former by mutual agreement or by testamentary disposition. There are differences between them: a) as to establishment, a voluntary easement is created by an inter vivos or mortis causa legal transaction (negocio jurídico), whereas a compulsory easement is created by judicial declaration; b) voluntary easements may be established for the benefit of a landlocked or non-landlocked estate, whereas a compulsory easement benefits landlocked estates or those lacking adequate access to a public road (Art. 395); compensation is an inherent element of a compulsory right-of-way easement but is not indispensable for the other; d) a voluntary easement is governed by the general rules on easements, whereas a compulsory easement is governed by law (Sala de Casación de 15 horas 30 minutos del 27 de diciembre de 1927, II sem, II tomo, p. 1048).” (Sala Primera de la Corte Suprema de Justicia, judgment number 26 at 08 hours 30 minutes on 15 de marzo de 1991).

Accordingly, there is no need to analyze this issue for two reasons: first, as explained at length in the initial recitals (considerandos), the relief sought does not concern another, distinct ground for extinguishing the easement, namely, a defect of consent (vicio en la voluntad) at the time it was established. Second, the creation of a voluntary right-of-way easement does not require the dominant estate to be landlocked. The grounds for its extinguishment are expressly regulated in numeral 381 of the Código Civil, and those grounds have not been debated, which precludes this Court from analyzing the matters raised in the appeal, pursuant to Article 54 of the Ley de Jurisdicción Agraria. The grievance shall be rejected.

THEREFORE:

The asserted nullity (nulidad) is rejected. As to the matters appealed, the judgment issued at sixteen hours fifteen minutes on once de marzo de dos mil veintiuno is affirmed.

VOTO N° 001066-F-2021 TRIBUNAL AGRARIO. SEGUNDO CIRCUITO JUDICIAL DE SAN JOSÉ.- A las once horas veintisiete minutos del cinco de noviembre de dos mil veintiuno.

PROCESO ORDINARIO, establecido por [[Nombre1] ], mayor, soltera, tesorera, vecina de Sardinal de Carrillo, cédula de identidad [CED1 ]; contra [[Nombre2] ], mayor, divorciada, trabajadora social, vecina de Liberia, cédula de identidad [CED2 ]. Actúa como apoderado especial judicial de la actora, el licenciado Roberto Paniagua Vargas, cédula de identidad CED3 - - , colegiado seis mil setecientos noventa y tres; de la parte demandada el licenciado Mauricio Rodríguez Méndez, cédula de identidad CED4 - - , colegiado siete mil ciento veintiuno. Tramitado ante el Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia.

Redacta la jueza Díaz Bolaños ; y,

CONSIDERANDO:

I.De acuerdo con la demanda incorporada en el escritorio virtual del Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, la parte actora pide: "A-Que en sentencia se declare la RESOLUCIÓN, NULIDAD ABSOLUTA E INEFICACIA de la escritura otorgada a las ocho horas del catorce de noviembre del año dos mil doce, ESCRITURA NUMERO DOSCIENTOS TREINTA Y DOS, INICIADA AL FOLIO CIENTO OCHENTA Y DOS FRENTE DEL TOMO NUMERO VEINTISIETE DEL PROTOCOLO DEL NOTARIO [Nombre3] , mediante la cual se CONSTITUYE UNA SERVIDUMBRE DE PASO a favor del inmueble propiedad de [[Nombre2] ], antes descrito. B- Que en sentencia se libere y exonere de cualquier afectación de servidumbre de paso la finca de mi propiedad número [Valor 003]. C-Que en sentencia se declare que la DEMANDADA NO TIENE NINGÚN DERECHO REAL NI PERSONAL SOBRE EL INMUEBLE DE MI PROPIEDAD NÚMERO [Valor 003] , POR LO QUE LE DEBE PROHIBIR INGRESAR A NUESTRO TERRENO, ASÍ COMO DEBE HACER [Nombre4] Y DE ABSTENERSE EN EL FUTURO DE REALIZAR CUALQUIER TIPO DE ACTO DE PERTURBACIÓN SOBRE EL DOMINIO DE PROPIEDAD DE NUESTRO TERRENO, BAJO LA ADVERTENCIA DE QUE EN CASO DE INCUMPLIMIENTO SERÁN PROCESADOS POR EL DELITO DE DESOBEDIENCIA A LA AUTORIDAD. D- En caso de oposición por parte de la demandada se le condene al pago de las costas personales y procesales del proceso”.

II.Excepciones deducidas. La demandada [[Nombre2] ], contestó la demanda en el memorial incorporado el 17/10/2019 04:01:35, e interpuso las excepciones de falta de derecho, falta de legitimación activa y pasiva y falta de interés.

III.La demandada [[Nombre2] ], presentó reconvención contra [[Nombre1] ], la cual fue declarada inadmisible mediante resolución de las 15 horas 59 minutos del 20 de mayo de 2020 (ver escritorio virtual del Juzgado Agrario de Liberia, memorial incorporado el 17/10/2019 04:01:35 y resolución en cuadro 94).

IV.El juez Sergio Huertas Ortega, del Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, en sentencia número 45-S-2021, de las dieciséis horas quince minutos del once de marzo de dos mil veintiuno, resolvió: “De conformidad con lo expuesto, se rechazan las excepciones de falta de legitimación activa y pasiva e interés actual. Se acoge la falta de derecho. Se declara SIN LUGAR EN TODOS SUS EXTREMOS la demanda ordinaria interpuesta por [[Nombre1] ] contra [[Nombre2] ]. Son las costas del proceso a cargo de la actora. Debiendo la parte vencedora liquidarlas en la fase de ejecución del presente fallo", (ver escritorio virtual del Juzgado Agrario del Primer Circuito Judicial de Guanacaste, Liberia, documentos asociados, sentencia de primera instancia incorporada el 27/04/2021 14:49:13).

V.Sobre el conjunto de hechos probados se avalan los hechos probados uno, dos y tres. El cuarto se omite pronunciamiento porque no ha sido objeto de apelación.

VI.Concerniente a los eventos indemostrados uno y seis por cuanto no hay probanzas sobre tales datos. En cuanto a los restantes por lo pretendido son innecesarios y no se avalan por esa razón.

VII.Se recurre la decisión supracitada en el considerando IV por el letrado Roberto Paniagua Vargas en calidad de apoderado especial judicial de la actora [[Nombre1] ]. Elenca como agravios los siguientes: Fundamentación contradictoria, dado no se utilizó adecuadamente las reglas de la lógica y experiencia; existe inobservancia de los principios de coherencia y derivación. Aduce, las conclusiones de la sentencia son contradictorias con las pruebas evacuadas en el proceso. En primero orden, acusa coacción para la firma de servidumbre y testigos de demandada no confiables. Trascribe el segmento de hechos no probados, específicamente el primero. Considera el juicio de valor contenido en tal, va contra las pruebas practicadas, lo que constituye un vicio que anula la sentencia recurrida. Afirma, en el hecho tercero de la demanda, se alega, su representada firmó la escritura de servidumbre bajo coacción de su padre; copia tal hecho.

Con las probanzas evacuadas, se demostró el padre de la actora, a pesar de la división de la finca, siempre tuvo la convicción que los lotes en litis eran de él y por eso le ordenó a su representada firmar tal documento. En autos se demostró, su representada a pesar de no estar de acuerdo y para evitar quebrantos en la salud de su progenitor accedió a eso, porque era una persona adulta mayor con grandes afecciones de salud lo cual lo tenía deprimido e intranquilo. Extracta el testimonio de [[Nombre5] ], con lo cual estima, se tiene por demostrado claramente en la firma del documento de servidumbre existe un vicio de voluntad, porque su representada fue coaccionada a firmar por voluntad de su padre [[Nombre6] ]; reiterando era una persona de edad avanzada y enfermo, para que viviera tranquilo sus últimos días fue que lo rubricó, pero siempre contra de la voluntad de la actora. Aduce, la contraria lo trata de desvirtuar con el testimonio de [[Nombre7] ] y [[Nombre8] ].

Procede a copiar parcialmente las declaraciones. Pide se observe, las dos personas son hermanos de don [[Nombre6] ]. Dijeron ellos se encontraban solos cuando él les dijo que dejaba el callejón de acceso a los demás lotes, porque la calle no se tenía acceso cómodo. A su entender esas afirmaciones se deben de poner en tela de duda, porque es falso don [[Nombre6] ] se le hubiere dejado solo en casa de su propia representada; pues siempre vivió en el terreno en litis hasta sus últimos días por lo que no quedó solo nunca, porque padecía de grandes quebrantos de salud. Por otro lado, pide notar la contradicción de los testigos de la otra parte, al indicar el callejón lo dejaba porque no tenía acceso a la calle [Dirección1] por el mal estado. Tal circunstancia se contradice con el reconocimiento judicial que consta en autos, donde se demuestra la demandada hoy en día y siempre ha utilizado la [Dirección2] .

Con el reconocimiento citado, se comprueba la confección de un portón rojo de tubos con cadena y candado que la parte demandada hizo para tener acceso libre a la calle [Dirección3] . Se demuestra según expone, es usado por la contraria por la existencia de huellas de animales que van dentro de su propiedad y se dirigen a la calle por el [Dirección4] , en rumbo al pueblo de Nancital. Con lo anterior, concluye, los declarantes mienten, al indicar no hay acceso cómodo a la [Dirección5] porque se demuestra sí la utiliza. Se refiere al testigo [[Nombre9] ] y trascribe parte de las manifestaciones. Pide notar, que primero dijo no tenía vínculo de familiaridad con las partes, y después acepta fue la pareja en unión libre con su representada, lo que evidencia a su entender mala fe y su dicho debe ponerse en tela de duda, por cuanto existe la posibilidad que terminaran mal, por lo cual declararía en contra de mi representada.

Considera hay contradicción porque afirmó ser conocedor de sus aseveraciones por vivir con su representada, no obstante, al final afirma se separó de [[Nombre1] ] desde hace 13 años, es decir ya no vivía en el terreno en litis desde el 2007. Pide notar, el documento de servidumbre se firmó en 2012 por lo que la lógica y la experiencia lleva a concluir el testigo miente. Subraya, desde 2007 ya no vivía en la casa en litis, se debe poner en tela de duda por sus contradicciones y complacencia. Agrega, el declarante miente porque indica la [Dirección5] es intransitable, cuando en el proceso se demostró que tal es usada por la demandada siempre, dado se evidenció el portón rojo fue colocado desde hace mucho tiempo atrás. Aduce, las pruebas ponderadas en la sentencia en su conjunto contienen un vicio que hacen nula y pide se declare. En un segundo grupo de agravios, los titula fundo dominante con acceso directo a [Dirección6] , satisfacción cómoda de sus necesidades- existencia de portón rojo.

Trascribe un segmento de la pieza apelada en cuanto a los hechos indemostrados y lo que considera sobre lo transitable del camino público y el razonamiento empleado. Acude tal evento fue demostrado con los oficios emitidos por la Municipalidad de Carrillo, donde expresamente se indica las heredades lindan al sur con [Dirección7] y el acceso del norte es zona de protección del Río Brasilito área la cual no es pública. También se comprueba con los planos de los inmuebles los cuales indican, lindan al sur con vía pública; se evidencia una cerca vieja que delimitaba con la calle, pero la misma demandada corre hacia el interior de su propiedad para aumentar la vía de esa calle a 14 metros. En cuanto al reconocimiento judicial muestra, se hace constar una parte de la calle pública del sur está en malas condiciones. Resalta en tal probanza se muestra donde existe un portón rojo hacia el pueblo, la ruta está transitable e incluso ha estado en reparación por la Municipalidad de Carrillo.

En el asunto, explica, se ha demostrado a la fecha se emplea la [Dirección8] , y la demandada ha colocado un portón rojo, y hay rastros de huellas de animales las cuales transcurren del interior de la propiedad de la demandada hacia la calle y se dirige hacia el oeste al pueblo de Nancital. Con el reconocimiento judicial se ha demostrado la demandada satisface todas sus necesidades con el uso del acceso directo a senda pública, porque el predio se usa para el pastoreo de caballos, con una casa de habitación y sembradío de árboles frutales y plantas ornamentales. Insiste por esa ruta al sur satisface necesidades la demanda, considerando no tiene cultivos de grandes dimensiones que ameriten un acceso óptimo porque con el descrito en líneas anteriores puede beneficiarse tal y como lo hace a la fecha. Califica de anormal lo ocurrido en el reconocimiento judicial en cuanto el juez hizo ver que por ese portón rojo solo se evidencian huellas de animales y no vehículos.

Tal observación es lógica ante la insistencia de la demandada de utilizar la vera del río y el callejón en litis, porque esa parte, de mala fe no quiera pasar por ahí a pesar de poder hacerlo de forma cómoda y satisfaciendo sus necesidades. Pide notar, de las imágenes del citado reconocimiento judicial en el sector de la calle pública por donde se ubica el portón rojo, la vía si es transitable y se dirige hacia el oeste al pueblo de Nancital, lo cual ha estado haciendo la accionada. Por otra parte, con tal probanza, se evidencia en el sector sureste del predio de la demandada, en su frente la calle pública, no está en condiciones óptimas. Sin embargo, con los testimonio de [[Nombre10] ] y [[Nombre11] ], se demostró que la Municipalidad de Carrillo ya está reparando dicha vía, con maquinaria apta para esa labor. La lógica y la experiencia afirma, le lleva a la convicción que tales obras al ser vía pública, dicho ayuntamiento deberá repararla, colocar puentes y hacer las obras en las zonas que se necesiten.

Subraya, al ser una vía vecinal quien tiene la obligación de darle mantenimiento a tal es la municipalidad referida. Si la demanda no se queja del estado de esa calle es “aptitud”(sic) negligente de su parte y de la cual su representada no debe ser afectada. Trascribe lo indicado por el deponente [[Nombre12] ] y [[Nombre11] ] ambos [[Nombre13] ] en lo tocante al tema municipal. Considera no ha quedado la menor duda la demandada tiene acceso directo a la calle pública y la utiliza, colocó un portón con cadena y candado para tener ese ingreso. Tal situación se constata con las pisadas de animales ya referidas en líneas anteriores. Califica de contrarias a las pruebas lo indicado en la sentencia lo cual constituye un vicio y solicita se declare la nulidad. En el punto tercero, indica, el fundo de la demandada con acceso directo a vía pública a través de la zona de protección del río Brasilito- igualdad de condiciones del inmueble con el de la actora.

Copia el hecho no probado tercero. Expone en la presente demanda se alega que además de tener acceso directo y cómodo a calle pública, la heredad de la demandada tiene ingreso directo a la vera del citado afluente en las mismas condiciones que su representada, siendo otra razón por la cual no necesita la servidumbre. Recrimina el juez no quiso practicar el reconocimiento judicial en esa zona por donde la parte demandada podría perfecta y cómodamente transitar sobre la orilla del río, sin tener que ingresar al inmueble de su representada. Con la certificación del plano del inmueble de la contraria se comprueba tal heredad linda por todo el rumbo norte, con la zona de protección del río Brasilito. Resalta, la servidumbre en litis tiene una longitud de 80 metros, eso evidencia de donde se ubica el portón de alambre de ingreso hasta donde inicia la propiedad de la demandada hay poca distancia, y esa parte puede acceder a su finca por el margen del río en las mismas condiciones que su representada, sin tener que afectarle su heredad.

Califica a la demandada de mala fe, porque no ingresa por la zona, alegando el área de servidumbre es más alta. Con las imágenes del reconocimiento judicial en autos, se visualiza el portón de alambre de ingreso al callejón está más bajo que su interior, por lo que la lógica y experiencia no lleva a la convicción la demandada pueda acceder al callejón alto si el río en su ingreso a la puerta de alambre impide su transitar. Considera, no tiene sentido tal derecho de paso si al final no podrá usarlo por la menor altura de su ingreso principal por la puerta de alambres de púas, por lo que tal alegato “cae por su propio pese” (sic). Afirma, con la declaración de los testigos y el reconocimiento judicial se probó en época de invierno el citado cuerpo de agua aumenta su caudal por lo cual no es posible utilizar la vera de dicho afluente para transitar por la servidumbre en litis. Pide notar, el día del juicio tuvieron que dejar los carros al otro lado del río para pasar a los predios sobre un puente colgante y a pie.

También el nivel del agua impide transitar vehículos, remembrando ese día un camión del ICE se quedó pegado en medio río, por la imprudencia de intentar pasarlo. Con lo anterior, dice se comprueba el acceso por la orilla del río para ingresar a la servidumbre en litis es una ruta incómoda e inaccesible en época de invierno. Agrega, al ser área de protección, la Municipalidad de Carrillo no puede hacer, reparar ni acondicionar un camino por esa zona, destruyendo parte de esa área natural, ni tampoco intentar edificar un puente hacia las propiedades. Remite a un oficio ofrecido como prueba para mejor resolver, la vera del río no es pública. De lo anterior, aduce, quedó demostrado el acceso a vía pública por el [Dirección9] en litis es más cómodo y accesible que por la orilla del cuerpo de agua, el cual en invierno no se puede transitar por el aumento del caudal. La sentencia va contra la prueba antes indicada y es un vicio y solicita se anule.

En cuarto lugar, estima el juicio de valor es contradictorio con lo que no se concede. Copia un segmento de la sentencia que se refiere a transitar a la orilla del caudal en cita. Manifiesta, en la sentencia se acepta, por un lado, sería altamente peligroso conceder un acceso de personas a pie o en vehículo paralelo al cauce del río mediante una sentencia judicial, por la inestabilidad de la naturaleza del propio afluente. Empero violando su propio criterio declara sin lugar la solicitud de su representada de extinguir la servidumbre en litis la cual se accede por ese mismo caudal reconocido como peligroso, de ahí estima esta contradicción implica la nulidad de la sentencia. Como quinto agravio, acusa la omisión de resolver todas las pretensiones -nulidad por vicios del consentimiento no es la única petitoria de la demanda- afirma, la acción de exoneración de la servidumbre por abuso del derecho, pretensión independiente.

Extracta un segmento de la sentencia, donde indica que al no probar los vicios en el consentimiento alegado es innecesario pronunciarse sobre las restantes peticiones. Considera lo anterior no es dable porque las petitorias son independientes una de las otras y no son excluyentes. En este caso, expone, la pretensión solicita la exoneración o liberación de la afectación de servidumbre de paso o derecho real o persona sobre el inmueble de su representada. Copia un segmento de la demanda tocante a las peticiones. Cita el canon 399 del Código Civil, para exponer tal norma faculta al dueño a un inmueble pedir la exoneración o liberación de la obligación de dar paso a otro predio por dejar de ser indispensable; por tener acceso cómodo al camino. En este asunto, se ha demostrado, el inmueble de la demandada tiene acceso directo y cómodo a una calle pública, que sí es transitable. La Municipalidad de Carrillo está reparando y al ser pública y bajo su administración, puede acondicionarla para tales fines y así se le pide e incluso se le obliga.

Se comprobó el acceso es más cómodo que el ingreso por el río Brasilito, el cual es intransitable en invierno, sin posibilidad de repararlo ni colocar un puente por ser área inalienable. Incluso, bajo el cuestionamiento de sí es legal o no hace un camino sobre el cause de un afluente, por lo que la acción de exoneración de la afectación de litis ha quedado demostrada y fundamentada. Copia el numeral 22 del Código Civil, para afirmar el contrato de constitución de servidumbre corresponde al ejercicio de un derecho que abusa y sobrepasa los límites normales del ejercicio de tal, porque se probó la demandada puede acceder por vía pública por dos partes. Por el rumbo sur a calle directamente o bien por el norte por la vera del río Brasilito igual directamente, sin necesidad de ingresar al terreno de su representada. La servidumbre de litis limita el ejercicio de propiedad privada de su clienta sobre el predio, por lo que con sustento en la norma citada, se tienen legitimación de esta acción de adoptar las medidas judiciales o administrativas que impidan la persistencia del abuso con la solicitud de su cese o exoneración de dicha afectación.

La denegatoria que hace el juez de instancia y la omisión de resolución de tal pretensión constituye un vicio que anula la sentencia apelada. En sexto orden, la servidumbre viola el derecho de propiedad privada y libre disposición de los bienes. Copia un segmento de la sentencia donde se refiere al acuerdo de constitución de la servidumbre, y los artículos: 45 de la Constitución Política; 290 y 292 ambos del Código Civil. A su entender tales normas definen claramente el derecho de libre disposición de la propiedad privada, donde el dueño de una heredad puede hacer con este lo que le parezca. En el subjúdice le llama la atención la servidumbre de paso viola gravemente tales normas al limitar a su representada de hacer lo que desee con la porción de terreno que forma parte de su fundo, pero no puede transformar libremente por tal afectación, a pesar la demandada puede salir a vía pública por dos rumbos, por lo que tal limitación debe ser anulada.

Pide al Tribunal observar en el plano de la accionada, así como en las constancias municipales referidas supra, son claros en indicar el predio de la contraria linda con [Dirección7] y la vera del río. A su entender no existe la menor duda que el inmueble de la accionada tiene dos accesos a vía pública por lo que no necesita la servidumbre en litis. En la sentencia apelada, se desconoce el acceso a esa ruta pública, contra la prueba en autos, declarando sin lugar las normas citadas y por eso pide la nulidad. Como sétimo agravio reclama la obligación jurisdiccional de protección de la zona inalienable del río Brasilito y falta de audiencia al MINAET. Dice, en este caso se probó la servidumbre da acceso a vía pública a la parte demandada sobre un área de protección del citado cuerpo de agua. Estima se debe cuestionar si un camino sobre un área de protección de un río tiene viabilidad legal, cuando por todos es sabido que tal sector debe ser respetado en su condición natural.

En el asunto, se cuestiona si un acuerdo privado de partes para constituir la servidumbre de paso comprendiendo área de protección es legal o es un abuso de poder de partes privadas el cual ha de ser anulado por infringir derechos inalienables, y aún más cuando el órgano jurisdiccional no le dio audiencia al MINAET en el proceso. Recrimina, la persona juzgadora es un garante en la protección de los derechos naturales, deber ser vigilante que un acuerdo privado no lesione derechos inalienables del Estado e incluso anularlo de oficio. La sentencia, reitera debe ser anulada por la omisión de darle audiencia al MINAET. Pide se revoque la resolución y por economía procesal se declare la exoneración de tal servidumbre a favor del inmueble de su representada ([Dirección10] ).

VIII.Dado lo amplio del pliego de apelación, así como lo reiterativo de temas, lo adecuado para una mejor resolución del asunto es ordenarlos de la siguiente manera: por la forma: 1. fundamentación contradictoria que amerita decretar nulidad de la sentencia; 2. falta de audiencia al MINAET; y, 3. falta de resolución de pretensiones de la demanda. Por la forma, todos relacionados con la indebida valoración de las probanzas: 1. coacción para la firma de la escritura de constitución de servidumbre de paso. 2. Violación del derecho de la propiedad privada. 3. Extinción de la servidumbre constituida porque la demandada tiene acceso a vía pública por dos rumbos.

IX.Por la forma: El primer tema a resolver ataña a lo recriminado de manera genérica sobre la fundamentación contradictoria que a entender del recurrente amerita decretar nulidad de la sentencia. A lo largo del pliego recursivo se reclama la falta de fundamentación o análisis de las probanzas. Empero de la lectura de la pieza apelada, se denota que tal contiene un análisis de las probanzas vertidos en los autos, a las cuales les concedió el peso que estimó oportuno de conformidad con el sistema de valoración probatoria en materia agraria, regulado en el numeral 54 de la Ley de Jurisdicción Agraria. Por otra parte, se empleó el derecho y se analizaron las pretensiones de acuerdo con el cuadro fáctico elencado en el considerando IV y los eventos improbados enlistados en el considerando V de la sentencia. Particularmente con este último conjunto se muestra disconforme quien recurre pues reiteradamente considera probó aspectos ahí consignados. Empero, estima esta Cámara la sentencia contiene los elementos propios de este tipo de resolución, de conformidad con el numeral 560 del Código de Trabajo de empleo supletorio a la materia. De tal manera, el peso dado o no a cada elemento probatorio así como la aplicación del derecho, es un aspecto a valorar cuando se conozcan los agravios por el fondo. Procederá el rechazo de este agravio.

X.El segundo aspecto por el cual solicita la nulidad de la sentencia es por la falta de audiencia al MINAET. Aduce el recurrente, existe una obligación del órgano jurisdiccional de notificar a tal ministerio, porque la servidumbre en litis transcurre por un área de protección del río Brasilito. Del estudio integral de la demanda en cuadros 2 a 13 se denota no existe necesidad de tener a tal entidad como tercero interesado o de cualquier otra forma integrarlo a la litis. En la especie, se trata de un conflicto entre sujetos particulares, donde la actora procura se elimine la servidumbre que pesa sobre su heredad. El trayecto de tal, de conformidad con el reconocimiento judicial (en archivo de video, disco compacto I de minutos 27:38 a 43:19) transcurre en parte por la vera del río Brasilito desde una calle [Dirección11], que es un terreno de tierra y hay zonas que tienen una altura de cuatro metros con la orilla del cuerpo de agua (minuto 31:28).

Por otra parte, de la escritura de constitución del gravamen en cuadros 15 a 17, la servidumbre transcurre “paralelo a lo largo del lindero norte del fundo sirviente, por una zona transitable al rio (sic) Brasilito…” (cuadro 16). De tales elementos no se logra determinar, el sector paralelo a la corriente citada ubicada dentro de la zona protectora no pueda disponerse el trayecto de una servidumbre. Debe tenerse presente en la zona protectora existen limitaciones de carácter ambiental relativas a la explotación. De ninguna manera se puede ampliar a los supuestos aquí analizados. La constitución de una servidumbre es parte del derecho de uso, disfrute y aprovechamiento de su fundo de conformidad con el numeral 264 del Código Civil. A mayor abundamiento de razones, el camino en litis ha sido utilizado desde el pasado según la testimonial, sin que se probara que su existencia y uso han lesionado recursos naturales.

O que cuando se recorrió en el reconocimiento judicial se consignara prueba sobre peligro al cuerpo de agua en cuestión o que existiera algún riesgo al respecto. Sobre la naturaleza de las áreas de protección, según el artículo 33 inciso b) de la Ley Forestal No. 7575 y queda prohibida la corta o eliminación de árboles. Su fin es la conservación y protección de los cuerpos de agua. Tales forman parte de los inmuebles que la contienen, pero su uso y disfrute contiene limitaciones de índole ambiental, tales como la prohibición de construir, cultivar o desarrollar actos que pongan en peligro los cuerpos de agua. En voto 596-F-2017 de las dieciséis horas y trece minutos del seis de julio de dos mil diecisiete de este Tribunal, se ha resuelto: "En tercer lugar, existe un error conceptual del recurrente sobre la naturaleza jurídica y consideraciones de las áreas del protección de los cuerpos de agua que se regulan en el ordinal 33 de la Ley Forestal N. 7575.

Sobre este tema cabe decirse, la denominación correcta para nombrar legalmente las sección de un terreno que está aledaño a la ribera de los cuerpos de agua, es área de protección como la norma legal citada la identifica. No así zona protectora, que corresponde a una de las categorías de manejo de las áreas silvestres protegidas reguladas en el artículo 32 de la Ley Orgánica del Ambiente. No son figuras iguales, ni tienen el mismo alcance legal; aunque exista una confusión generalizada en cuanto el uso de esos conceptos como sinónimos. De tal forma, las áreas de protección de interés para este asunto, corresponden según la Ley Forestal en el canon 33 inciso b), a la franja de 15 metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de 50 metros horizontales, si el terreno es quebrado.

Dichas áreas conforman lo que la doctrina constitucional del derecho de propiedad denomina como límites y limitaciones al ejercicio del derecho de propiedad. Corresponden a regulaciones a la forma en que se ejercen los atributos del derecho real de propiedad sobre los bienes dada la naturaleza jurídica y legal del bien objeto de ese derecho real. No resulta atinado el argumento del recurrente cuando indica que por ser una "zona protectora", que se debe entender como área de protección, es por esa sola situación un bien de dominio público con todas las condiciones propias de los bienes demaniales. Existe la condición de propiedades en manos de particulares, inscritas registralmente o no, que contienen cuerpos de agua y cuyas zonas aledañas forman parte de la finca objeto del derecho de propiedad particular y que por la naturaleza de contener un cuerpo de agua y área de protección, lo que tienen son restricciones en cuanto la posibilidad de construcción o ejercicio de actividades productivas que lleguen a lesionar el recurso hídrico en la parte regulada por el artículo 33 inc b) de la ley Forestal.

El ordinal 34 Ibídem determina la prohibición de la corta o eliminación de árboles en al áreas de protección descritas supra y que los alineamientos deben ser tramitados por el Instituto de Vivienda y Urbanismo." De tal forma que, siempre y cuando se desarrolle un uso de la servidumbre de paso, en respeto de esos límites y limitaciones legales de carácter ambiental, no existe obstáculo para imponer la carga real que se discute en el proceso. La franja de terreno es propiedad privada cuyos atributos y contenido del derecho de propiedad está regulado y modulado por las normas legales citadas. Sin que tales vacié de contenido el derecho de propiedad a tal punto que lo hagan indisponible. Producto de lo anterior y de conformidad con el artículo 40 párrafo cuarto de la Ley de Jurisdicción Agraria y canon 22.4 del Código Procesal Civil de empleo supletorio, no se determina el MINAET deba ser traído a la litis como un tercero legal interesado o tenga que fungir como coadyuvante de alguna de las partes principales de este proceso, por lo cual procede el rechazo del reclamo.

XI.Por último reprocha como motivo de forma, la falta de resolución de pretensiones de la demanda. Dado lo alegado en la apelación resulta procedente trascribir lo pedido: “A-Que en sentencia se declare la RESOLUCIÓN, NULIDAD ABSOLUTA E INEFICACIA de la escritura otorgada a las ocho horas del catorce de noviembre del año dos mil doce, ESCRITURA NUMERO DOSCIENTOS TREINTA Y DOS, INICIADA AL FOLIO CIENTO OCHENTA Y DOS FRENTE DEL TOMO NUMERO (sic) VEINTISIETE DEL PROTOCOLO DEL NOTARIO [Nombre3] , mediante la cual se CONSTITUYE UNA SERVIDUMBRE DE PASO a favor del inmueble propiedad de [[Nombre2] ], antes descrito. B- Que en sentencia se libere y exonere de cualquier afectación de servidumbre de paso la finca de mi propiedad número [Valor 003]. C-Que en sentencia se declare que la DEMANDADA NO TIENE NINGÚN DERECHO REAL NI PERSONAL SOBRE EL INMUEBLE DE MI PROPIEDAD NÚMERO [Valor 003] , POR LO QUE LE DEBE PROHIBIR INGRESAR A NUESTRO TERRENO, ASÍ COMO DEBE HACER [Nombre4] Y DE ABSTENERSE EN EL FUTURO DE REALIZAR CUALQUIER TIPO DE ACTO DE PERTURBACIÓN SOBRE EL DOMINIO DE PROPIEDAD DE NUESTRO TERRENO, BAJO LA ADVERTENCIA DE QUE EN CASO DE INCUMPLIMIENTO SERÁN PROCESADOS POR EL DELITO DE DESOBEDIENCIA A LA AUTORIDAD.

D- En caso de oposición por parte de la demandada se le condene al pago de las costas personales y procesales del proceso” (lo destacado es del texto original en cuadro 9 a 10). En cuanto a los hechos de la demanda, los cuales son empleados para comprender el alcance de la petitoria, se denota a partir del hecho tercero en imagen 4 se relata la actora bajo presión y coacción del progenitor de las litigantes firmaron una escritura para constituir una servidumbre de paso a favor de la heredad de la demandada. Relata en los eventos cuatro a sexto, la propiedad de la accionada no es fundo enclavado, se comunica libremente a vía pública y por tal razón no requiere de pasar por el inmueble de la actora. En el hecho sétimo explica no fue inscrito el gravamen; en el octavo realiza apreciaciones sobre la nulidad de la afectación, calificándola de contraria al interés privado de su propiedad; por último, en el noveno relata la interposición de una acción interdictal por la supuesta perturbación a la servidumbre.

Del estudio del pliego de demanda, esta Cámara concluye, contrario a lo afirmado en el recurso, la petición está claramente orientada a pedir la extinción de la servidumbre de paso porque existieron vicios al momento de su constitución. Del relato de los hechos, se explica las razones por las cuales no requiere la heredad de la demandada la servidumbre, pero estudiada en conjunto los hechos y las pretensiones, no se concluye se trate de dos causales diversas. En otros términos, la actora solo pide la nulidad del acuerdo de constitución por vicios, pero de forma alguna pide otra causal, como las numeradas en el artículo 381 del Código Civil. A mayor abundamiento de razones, la Sala Primera de la Corte Suprema de Justicia ha explicado sobre la petitoria lo siguientes: "…Por pretensión sustantiva se entenderá aquel conjunto de peticiones tendientes a declarar derecho e imponer prestaciones al demandado, lo cual solicita el actor en su demanda.

La causa de pedir corresponde a los hechos constitutivos del derecho invocado; en otras palabras, aquellos hechos narrados por los litigantes, de relevancia jurídica, a partir de los cuales se formulan sus pretensiones. Se trata de acontecimientos concretos, hechos históricos del conflicto que se intenta resolver ante el juez. Dentro de esta causa petendi quedan excluidos como elementos identificadores los argumentos (porque no son hechos, sino construcciones intelectuales), y la calificación jurídica que el demandante le otorgue (pues esa valoración no modifica tales acontecimientos, aunque se dé en uno u otro sentido)" (voto número 82 de las 14 horas 15 minutos del 22 de febrero de 2005). De tal forma, en concordancia con el numeral 54 de la Ley de Jurisdicción Agraria el órgano a quo no podía pronunciarse sobre temas que son adyacentes dentro del elenco de hechos de la demanda, como es la posibilidad de otras salidas de la demandada.

La pretensión, como se indicó se dirige exclusivamente a pedir la nulidad del convenio que la constituyó tal y como se razonó en la sentencia. No es dable a estas alturas del proceso procurar otra causal que no fue adecuadamente invocada, aunque ese aspecto -de otras salidas a calle pública- se relata no se encuentra expresamente pedido en la demanda, la cual debería se accesoria en buena técnica procesal. De la lectura de la pretensión a) donde se pide la resolución, nulidad absoluta e ineficacia del instrumento de constitución referido, se concatena con la marcada b) y c) en cuanto a exonerarles de esa afectación, pero solo se pueden comprender si se unen a lo requerida en el segmento a). De tal forma procederá el rechazo de la nulidad invocada.

XII.Por la forma, todos relacionados con la indebida valoración de las probanzas. El primer tema se vincula con la acusada coacción para la firma de la escritura de constitución de servidumbre de paso. En el pliego recursivo se insiste, las personas testigas de la contraria no son confiables, pues a su entender se tiene por comprobada la coacción sufrida por la actora para constituir la servidumbre. En este punto es relevante reseñar el canon 1017 del Código Civil, en cuanto estipula el contrato es anulable consentido por fuerza o miedo grave. En conjunto el numeral 1018 ibid., establece para calificar la fuerza o intimidación, debe atenderse a la edad, sexo y condición de quien la sufra. La Sala Segunda de la Corte Suprema de Justicia se ha referido sobre este conjunto de vicios que podrían afectar la voluntad, delimitándolos de la siguiente manera: “… Entre los vicios que afectan la voluntad normalmente se enumeran la falsedad, la violencia, el error, el dolo e inclusive el miedo grave.

Al caso interesan la violencia y el miedo grave. La primera puede ser tanto física como moral y, al respecto, se ha señalado: “La violencia, en términos generales comprende el miedo y la fuerza (violencia moral y física). Siempre se trata de una presión que se ejerce sobre un individuo para determinarle a ejecutar un acto. Pero la violencia física reduce a la víctima a un estado puramente pasivo, pues actúa sobre los medios materiales de que debe valerse para realizar el acto mientras que la violencia moral opera sobre el ánimo. La fuerza, violencia física o absoluta es la coacción material o constreñimiento para forzar a alguien a una manifestación. En este caso no existe del todo voluntad, mientras que en la violencia moral la voluntad existe pero está viciada... La violencia moral es la presión que se ejerce sobre un individuo para determinarle a ejecutar un acto, en la forma de amenazas que producen un temor insuperable; ...

No destruye la voluntad, pues el amenazado puede optar entre varias determinaciones rebelarse, ejecutar el acto, o sufrir el daño. La declaración es real, pero la voluntad está viciada; la amenaza actuó como un motivo esencial en su formación. El mal que la amenaza anuncia debe ser futuro, injusto, e importante. La 'importancia' hace referencia al juicio de la influencia que la violencia produce, en el cual debe considerarse una persona media sensata, en atención a la edad, sexo y condición (art. 1018 C.C.) El mal debe ser injusto, es decir, que no se tenga derecho a infringirlo." (Énfasis suplidos. [Nombre14] , Víctor. Derecho Privado, San José, tercera edición, Litografía e Imprenta LIL, S.A., 1.994, pp. 259, 266). Por su parte, el miedo grave se ha indicado que se asemeja mucho a la violencia moral, mas no requiere que la intimidación sea producida por una amenaza, sino que bastan factores objetivos o subjetivos que produzcan el miedo y que éste sea determinante.

(Ibid., p. 268. La negrita y el subrayado no están en el original)…” (sentencia número 748 de las 09 horas 40 minutos del 28 de noviembre de 2003). Por tal razón esos parámetros son relevantes al momento de la valoración probatoria, siendo el punto de partida lo relatado en el hecho tercero de la demanda el cual en lo de interés indica: “… Que tal y como consta con la certificación notarial que se ajunta (sic), a las ocho horas del catorce de noviembre del años (sic) dos mil doce, BAJO LA PRESION Y COACCION DE NUESTRO PADRE [[Nombre6] ], AMBAS FIRMAMOS LA ESCRITURA NUMERO (sic) DOSCIENTOS TREINTA Y DOS, …mediante la cual se CONSTITUYE UNA SERVIDUMBRE DE PASO a favor del inmueble propiedad de [[Nombre2] ], antes descrito…” (lo destacado es del texto en imágenes 3 a 4). De lo anterior se comprende, quien fue el ejecutante de la “presión y coacción” fue el padre de las litigantes. En cuanto a la coacción de acuerdo con la Real Academia Española, es la fuerza o violencia que se hace a alguien para obligarlo a que diga o ejecute algo.

De ahí, el asidero jurídico para los vicios acusados por la apelante corresponde a lo estatuido en el Código Civil supra indicado. Dada la acusación indicada, por parte del progenitor, sobre la psiquis de la actora para que firmara la escritura de constitución de la hipoteca visible en cuadro 15 a 17, se debe probar que la fuerza empleada es insuperable o irresistible y no pudo negarse a suscribir el instrumento público. Al tenor del numeral 477 del Código de Trabajo la actora tiene la carga de la prueba para demostrar lo citado. Dado que el Código Civil impone ponderar la edad, sexo y condición de quien la sufra, en primer orden, de los autos se desprende la actora es una mujer, con domicilio en Nancital de Sardinal de Carrillo que es zona rural de la región norte del país, con una ocupación de tesorera, sin que se pueda precisar la edad, empero de conformidad con las imágenes de la declaración de parte, es una persona por encima de los 50 años.

Se expresa con fluidez, con un lenguaje normal y claro (ver II disco compacto, declaración de parte de minutos 1:02 a 51:40). De las probanzas, sea la testimonial y la documental no se extraen elementos de interés sobre la condición de la actora que permitan para resolver este punto más allá de lo citado. Debe considerarse al tenor del numeral 42.2 del Código Procesal Civil de aplicación supletoria a la materia, la declaración de parte rendida por la apelante no admite hechos contrarios a sus intereses, razón por la cual no hay información que permita ahondar en este tema. Se aclara, esas manifestaciones no pueden ser ponderadas por los efectos de la declaración de parte, aunque en el recurso se insiste el peso probatorio, encontrándose imposibilitada esta Cámara para acceder a tal aspecto por las razones legales citadas. En cuanto a las características personales del padre de las litigantes, don [[Nombre6] ] no se aportaron datos contundentes sobre esa persona, salvo era de sexo masculino, que era un adulto mayor con padecimientos en su salud, que compartía la misma vivienda que la actora, sin precisar la edad que tenía cuando acontecieron los hechos relatados en la demanda.

Tampoco se suministró prueba sobre la relación entre el señor [[Nombre7] ] y sus hijas. Este aspecto tiene relevancia porque se debía probar el acto acusado como coercitivo y de presión, el tipo de violencia que medio; así como los roles eventualmente presentes asignados por el patriarcado, donde se visualiza a las mujeres en un nivel diverso a los varones, con gran énfasis en las relaciones de padre a hijas, donde la lealtad, violencia y sumisión puede llevar a viciar la voluntad. Esa devaluación en el trato hacia las mujeres se puede mostrar de muchas maneras, entre otras por el lenguaje, los roles asignados en sus labores, en el entorno social, sobre el prestigio, el acceso a la propiedad privada, entre muchos otros. Para las profesoras Alda Facio y Lorena Fries: “Las ideologías patriarcales no sólo (sic) afectan a las mujeres al ubicarlas en un plano de inferioridad en la mayoría de los ámbitos de la vida, sino que restringen y limitan también a los hombres, a pesar de su situación de privilegio.

En efecto, al asignar a las mujeres un conjunto de características, comportamiento y roles “propios de su sexo”, los hombres quedan obligados a prescindir de estos roles, comportamiento y características y a tensar al máximo sus diferencias con ellas….En otras palabras, la ideología patriarcal no sólo (sic) explica y constituye las diferencias entre mujeres y hombres como biológicamente inherentes y naturales, sino que mantiene y agudiza otras (todas) formas de dominación…” (Facio, Alda y Fries, Lorena (2005). Feminismo, género y patriarcado. http://www.derecho.uba.ar/publicaciones/ rev_academia/ revistas/ 06/ feminismo- genero-y- patriarcado.pdf). Por otra parte, en la Declaración y Plataforma de acción de Beijín de 1995, que es una agenda con visión de futuro para el empoderamiento de las mujeres, analizó diversos temas y los Estados asumieron compromisos para la defensa y reivindicación de los derechos humanos de las mujeres.

En particular, por el tema en análisis, en el capítulo III esferas de especial preocupación, segmento d) sobre la violencia contra la mujer, acápite 118, de la Plataforma de Acción se reconoció: “La violencia contra la mujer es una manifestación de las relaciones de poder históricamente desiguales entre mujeres y hombres, que han conducido a la dominación de la mujer por el hombre, la discriminación contra la mujer y a la interposición de obstáculos contra su pleno desarrollo. La violencia contra la mujer a lo largo de su ciclo vital dimana esencialmente de pautas culturales, en particular de los efectos perjudiciales de algunas prácticas tradicionales o consuetudinarias y de todos los actos de extremismo relacionados con la raza, el sexo, el idioma o la religión que perpetúan la condición inferior que se asigna a la mujer en la familia, el lugar de trabajo, la comunidad y la sociedad. La violencia contra la mujer se ve agravada por presiones sociales, como la vergüenza de denunciar ciertos actos; la falta de acceso de la mujer a información, asistencia letrada o protección jurídica…” .

Por otra parte, siempre en el contexto de fuentes supranacionales, la Convención Interamericana para prevenir, sancionar y erradicar la violencia contra la mujer "Convención Belem Do Pará", ley número 7499 del 02 de mayo de 1995, de relevancia la define, en el numeral primero lo que se entiende por violencia contra la mujer así: “cualquier acción o conducta, basada en su género, que cause muerte, daño o sufrimiento físico, sexual o psicológico a la mujer, tanto en el ámbito público como en el privado”. En el canon segundo delimita la violencia en el seno familiar de la siguiente manera: “Se entenderá que violencia contra la mujer incluye la violencia física, sexual y psicológica: a) que tenga lugar dentro de la familia o unidad doméstica o en cualquier otra relación interpersonal, ya sea que el agresor comparta o haya compartido el mismo domicilio que la mujer, y que comprende, entre otros, violación, maltrato y abuso sexual;…”.

En cuanto a la Declaración sobre la eliminación de la violencia contra la mujer de las Naciones Unidas -por sus siglas en inglés CEDAW-, ley número 6968 del 02 de octubre de 1984, el artículo 1 señala, la expresión "discriminación contra la mujer": “denotará toda distinción, exclusión o restricción basada en el sexo que tenga por objeto o por resultado menoscabar o anular el reconocimiento, goce o ejercicio por la mujer, independientemente de su estado civil, sobre la base de la igualdad del hombre y de la mujer, de los derechos humanos y las libertades fundamentales en las esferas política, económica, social, cultural y civil o en cualquier otra esfera”. A nivel nacional la Ley contra la violencia doméstica, número 7586 define la violencia psicológica como: “Acción u omisión destinada a degradar o controlar las acciones, comportamientos, creencias y decisiones de otras personas, por medio de intimidación, manipulación, amenaza, directa o indirecta, humillación, aislamiento o cualquier otra conducta que implique un perjuicio en la salud psicológica, la autodeterminación o el desarrollo personal”.

Al amparo de lo reseñado, se debe tener presente, debido a los roles estipulados por el patriarcado se generan relaciones de violencia contra las mujeres las cuales producen prácticas que a vista de las personas podrían ser normalizadas, empero son limitantes de los derechos humanos de las mujeres. Como se indicó, a pesar de lo expresado en la demanda, de la testimonial no hay elementos para comprender la relación entre padre e hijas, y si él ejercía violencia a tal punto de generar una imposibilidad de la actora de negarse a firmar la escritura. En este punto, contrario a lo afirmado en la apelación, los hermanos del padre de la actora fueron claros en manifestar, el terreno era de su hermano y lo dejó a los hijos. En cuanto a la declarante [[Nombre15] ], relativo a la constitución de la servidumbre indicó que su hermano le dijo tenía que darle salida a la demandada (disco compacto III, minutos 19:05 a 26:57).

Relató la plática la sostuvo con él cuando estaba enfermo, acostado en una cama, señalando tal mueble se ubicaba afuera de la morada. El otro hermano, sea tío de las litigantes, [[Nombre7] ], (disco compacto III, minutos 40:59 a 47:51) expresó que conversó con su hermano quien le dijo tenía todo arreglado y le dio terreno a sus hijos. Declaró, la salida era la de [[Nombre2] ] y la misma que usó el papá. Indicó eso se lo expresó en el patio y estaban solos. Estas declaraciones son consideradas espontáneas, sin que se muestren complacientes, y aunque dejan en evidencia, el padre de las partes podría haber influido para la constitución de la servidumbre, no se precisa el tiempo en que tales conversaciones se dieron, si fue antes o después de la división de la finca; o bien, si fue previo o ulteriormente de la constitución de la servidumbre. Esas manifestaciones son ayunas de esa información sobre la relación con la actora, que tal como se indicó líneas infra, son detalles relevantes para ponderar si medió violencia o fuerza para obligarla firmar la escritura aludida.

Estos dos testigos son personas muy cercanas a don [[Nombre6] ] y quienes podrían haber suministrado información sobre las relaciones familiares relevantes para arribar a una conclusión diversa a la de la sentencia. Relativo a las demás declaraciones, [[Nombre5] ] (II disco compacto a partir de minuto 52:40) relató convive con la actora y en vida con su padre. Narró como pusieron unos materiales para establecer una puerta donde inicia el sendero en conflicto. Afirmó en minuto 56:24 el caminito lo autorizó [[Nombre6] ]. [Nombre16] lo autorizó por [[Nombre6] ] le pidió que lo hiciera el favor de darle ese permiso para que no le perturbaran la paz antes de morir. Relató, tenía entendido [Nombre16] firmó un permiso para el paso. Fue a su Bufete (refiriéndose al abogado de la apelante). En minuto 1:00:29 explicó -el documento- lo firmó por el papá, le pidió que le hiciera el favor de firmar, él no quería vivir y terminar sus últimos días mal con pleitos y bochinches.

Expuso en minutos 1:01:20 el estado de salud era mal, una persona de esa edad los problemas lo ponen “pior”, más nervioso. Indicó, creer tenía insuficiencia renal y fue cada día más mal. Informó no estuvo presente cuando se firmó el documento (minutos 1:03:02). Además, aportó datos sobre la confección del sendero. De esta declaración no se puede inferir la coacción que sufriera por parte del padre de la actora. No se desprende que lo pedido por el progenitor le impidiera negarse o bien si medio algún vicio en la voluntad de la actora. A criterio de este Tribunal, el declarante es una persona que convivía con los dos, en el seno del hogar donde se fraguan los actos de violencia, física, psicológica. De su relato como se indicó se dio una situación de “favor” sin poder precisar cómo ese pedido incidió en el ánimo y consecuentemente en la voluntad de la recurrente. El declarante [[Nombre12] ] (III disco compacto minutos 0:43 a 07:15) expresó ser vecino de Lobandito y no ser familia de las partes.

Relata aspectos de las rutas de acceso a las heredades y que era conocedor de la división de tierras realizadas por don [[Nombre6] ]. El deponente [[Nombre11] ] (III disco compacto, minutos 04:14 a 17:16) expresó conocer a las partes. Dijo ser amigo de don [[Nombre6] ] y le visitaba. Expresó no escuchó sobre el reparto de tierras y no sabe el camino en conflicto quién lo hizo. Las restantes manifestaciones versan sobre las rutas de acceso. El testigo [[Nombre9] ] (III disco compacto, minutos 28:53 a 39:50) expresó conocer el terreno que era de don [[Nombre6] ], quien lo dividió entre sus hijos, consideró que fue como 10 años atrás. Relata las salidas que tienen las parcelas en conflicto y datos vinculados a las rutas. Sobre la documental en autos, se encuentra el testimonio de la escritura pública en cuadros 15 a 17 donde se constituyó la servidumbre la cual en su mayoría contiene datos generales propios de este tipo de instrumento.

Se adicionó lo siguiente: “Como testigo presencial y que autoriza en todos sus extremos el presente instrumento público se encuentra presente [[Nombre6] ], mayor, soltero, Pensionado (sic), con cédula de identidad número CED5- - - vecino de la misma residencia de la primer parte. Es todo…”. El hecho que estuviera presente en la constitución de la servidumbre y se hiciera constar que autoriza en todos sus extremos el instrumento, cuando sus hijas ya eran titulares, podría constituir un indicio para determinar la injerencia del padre sobre la voluntad de su hija. Sin embargo, como se indicó, y particularmente de las manifestaciones de [[Nombre5] ], no se logra precisar si en el pedido de “ese favor” medió intimidación, manipulación, amenaza, directa o indirecta que de tal forma se pueda arribar a una patología en la voluntad de la actora. Los demás documentos, se vinculan a certificaciones registrales y catastrales (imágenes 19, 21, 24, 27, 28), copia de las piezas de un interdicto tramitado en el Juzgado Civil de Santa Cruz, número 17-23-1583-CI en cuadros 29 a 33, y oficio de la Municipalidad de Carrillo en cuadro 42.

Valoradas en conjunto las probanzas conforme lo impone el canon 54 de la Ley de Jurisdicción Agraria no se logran determinar elementos para acceder a lo pedido por la actora en cuanto determinar la violencia sufrida para firmar el ya citado instrumento público. Esta Cámara aclara, no es necesario contar con prueba directa, pues a partir de los indicios es dable arribar a la configuración de este flagelo contra las mujeres. Se comprende la sutileza con que las personas agresoras pueden ejecuta sus actos, los cuales se encuentran velados con los mitos sobre la violencia doméstica. Empero de las escuálidas probanzas analizadas no se puede profundizar en la relación entre padre e hijas para determinar con grado de certeza la existencia de un vicio de la voluntad.

XIII.El segundo reproche se relaciona con la violación del derecho de la propiedad privada por la imposición del gravamen. De acuerdo con el artículo 264 del Código Civil el dominio o propiedad absoluta sobre una cosa comprende los derechos de posesión, usufructo, transformación y enajenación, defensa y exclusión y de restitución e indemnización. De tal forma la persona titular tiene un gobierno sobre la cosa. También la legislación prevé que pueda limitarlo al crear un derecho real en cosa ajena, sea por mandato legal o por voluntad. En el caso de las servidumbres, se imponen a cargo o favor de una heredad (numeral 370 Código Civil); su constitución puede ser por acuerdo de voluntades. En el subjúdice, se recurrió a la constitución voluntaria, según el documento de cuadros 15 a 17. Se trató de un contrato inter vivos, y bajo este supuesto prevalece el principio de autonomía de la voluntad de las partes tutelado en el canon 22 del Código Civil.

La Sala Primera de la Corte Suprema de Justicia en sentencia número 26 de las 08 horas 30 minutos del 15 de marzo de 1991 resume lo anteriormente expuesto de la siguiente manera: “V.- Las servidumbres son derechos reales en cosa ajena o in re aliena. Constituyen un poder real sobre un predio ajeno para servirse de él parcialmente en algún aspecto. Para el dueño del predio sirviente implica un límite al ejercicio de su derecho de propiedad. El Código Civil regula las servidumbres en forma general (Artículos 370 a 382), en consecuencia no existen servidumbres típicas reguladas expresamente en su contenido, con excepción de ciertos tipos como sería el de la obligación forzosa de paso, ubicada fuera del capítulo respectivo (artículos 395 a 400) y algunas establecidas en el Código de Minería N° 6797 de 4 de octubre de 1982 y Ley de Aguas N° 276 de 27 de agosto de 1942. Las servidumbres recaen a favor y a cargo únicamente de fundos.

El inmueble que la sufre se denomina predio sirviente y el que la disfruta predio dominante. Las hay forzosas y voluntarias, las primeras son las que la ley faculta a los particulares para obtener su imposición, a pesar de la oposición del dueño del predio sirviente; en cuanto a esta última categorización nuestro Código Civil (arts. 395-400) establece la llamada obligación de paso, que en realidad en una servidumbre forzosa de paso, pues se constituye por resolución del órgano jurisdiccional en los casos establecidos por la ley...". De tal suerte deberá perecer el agravio elencado, por cuanto no existe infracción al derecho de propiedad de la actora, pues la legislación prevé la creación de servidumbres como la estipulada, si bien limitan su predio, se encuentra dentro del ejercicio de sus derechos como propietaria de conformidad con el numeral 45 de la Constitución Política.

XIV.Por último recrimina la necesaria extinción de la servidumbre constituida porque la demandada tiene acceso a vía pública por dos rumbos. En el acápite anterior se mencionó sobre la forma de constitución de las servidumbres. En cuanto a las voluntarias, y específicamente a las de paso, una cualidad es que el predio no tiene que estar enclavado para imponerlas. Siguiendo la inteligencia de la sentencia de la Cámara de Casación ya reseñada se ilustra este aspecto: “VII.- Así, en cuanto interesa a la solución de este caso, se puede distinguir entre servidumbre voluntaria y la obligación de paso, la última nace por disposición de ley y la primera por acuerdo de voluntades, o por última disposición. Entre ellas existen diferencias: a) en cuanto a la constitución, la voluntaria lo es por negocio jurídico inter vivos o mortis causa, en tanto la forzosa lo es por declaración judicial. b) las voluntarias pueden ser establecidas en favor de un fundo enclavado o no, en la forzosa favorece a predios enclavados o que no tengan salida bastante a la vía pública (art. 395); la indemnización es un elemento inherente a la servidumbre forzosa de paso no siendo indispensable en la otro; d) la servidumbre voluntaria, estaría regulada la normativa genérica de las servidumbres, en tanto la forzosa lo está por la ley (Sala de Casación de 15 horas 30 minutos del 27 de diciembre de 1927, II sem, II tomo, p. 1048)." (Sala Primera de la Corte Suprema de Justicia en sentencia número 26 de las 08 horas 30 minutos del 15 de marzo de 1991).

De tal forma, carece de interés realizar un análisis sobre este extremo por dos aspectos: el primero, como se explicó profusamente en los considerandos iniciales, la petitoria no gravita en torno a otra causal diversa para extinguir la servidumbre, cual es un vicio en la voluntad al momento de su constitución. En segundo orden, la servidumbre de paso voluntaria no implica para su creación que el predio dominante sea enclavado. Las causales para su extinción se encuentran expresamente reguladas en el numeral 381 del Código Civil y esas causales no han sido objeto de debate, impidiendo a esta Sede analizar los aspectos propuestos en el recurso, en atención al artículo 54 de la Ley de Jurisdicción Agraria. Se rechazará el agravio.

POR TANTO:

Se rechaza la nulidad invocada. En lo apelado se confirma la sentencia de las dieciséis horas quince minutos del once de marzo de dos mil veintiuno.
