Decision: 2021-0779 Case file: 20-000146-1130-PE (1) CRIMINAL JUDGMENT APPEALS COURT. Second Judicial Circuit of San José. Goicoechea, at trece horas con cuarenta y cinco minutos, on veinticinco de mayo de dos mil veintiuno.
APPEAL filed in the present proceedings against Nombre01, who is of legal age, Costa Rican, identity card number CED01, born in Limón, Matina, on 28 de marzo de 1968, son of Nombre02 and Nombre03, divorced, occupation unknown, resident of Limón, Matina, and Nombre04, who is of legal age, Costa Rican, identity card number CED02, born in Limón, Matina, Bataán, on 22 de noviembre de 1997, son of Nombre05 and Nombre06, single, occupation unknown, resident of Limón, Matina; for the offense of VIOLATION OF THE WILDLIFE LAW, to the detriment of the WILDLIFE LAW. Judges Giovanni Mena Artavia, Alfredo Araya Vega, and Rafael Mayid González González participated in deciding the appeal. Attorney Jonathan Argüello Coto appeared before this Court as public defender for the co-defendants, and attorney Andrés Alfaro Ramírez appeared on behalf of the State, Procuraduría General de la República.
BACKGROUND:
I.By judgment number 1720-2020, issued at diecinueve horas con treinta y tres minutos on veinticinco de setiembre de dos mil veinte, the Criminal Court of the First Judicial Circuit of the Atlantic Zone, Limón, Flagrante Delicto Section, ruled: “THEREFORE: In accordance with the reasons stated orally, Articles 39 and 41 of the Political Constitution, 11 of the Universal Declaration of Human Rights, Articles 1, 11, 30, 35, 45, and 71 of the Criminal Code, Articles 1 through 15, 142, 184, and 422 through 436 of the Code of Criminal Procedure, and Article 95(a) of the Wildlife Conservation Law, Nombre01 and Nombre04 are found criminally responsible as principals for the offense of trafficking in derivatives of endangered animals (leatherback sea turtle eggs), committed to the detriment of wildlife, and in that capacity each is sentenced to one year of imprisonment. Pursuant to Articles 59 through 63 of the Criminal Code, they are granted the benefit of a suspended sentence (ejecución condicional de la pena) for a term of three years, during which they may not commit an intentional offense punishable by more than six months, with the warning that otherwise the benefit granted to them will be revoked.
The private criminal complaint (querella) and civil action for damages (acción civil resarcitoria) brought by the Procuraduría General de la República are granted, and the civil defendants are held jointly and severally liable, with the amounts to be determined, for the claimed items of environmental damage, court costs, attorney fees, and statutory interest, which amounts shall be quantified during enforcement of the judgment. Once the judgment becomes final, it shall be entered in the Judicial Registry, and the customary certified copies shall be sent to the Instituto Nacional de Criminología, the Sentence Enforcement Court, the Procuraduría General de la República, and the Ministerio de Ambiente, Energía y Telecomunicaciones. The parties are hereby notified, as this is an oral judgment (The events occurring at the hearing and their details are duly preserved through the audio and video recording technology available to this Court, form part of this decision, and shall remain available to any party requesting them).” Nombre07. II.Attorney Jonathan Argüello Coto, acting as public defender for the accused, filed an appeal against the foregoing ruling.
III.After the corresponding deliberation was conducted pursuant to Article 465 of the Code of Criminal Procedure, the Court considered the issues raised in the appeal.
Judge Mena Artavia delivers the opinion of the Court; and,
CONSIDERING:
I.Attorney Jonathan Argüello Coto, defense counsel for defendants Nombre01 and Nombre04, appeals judgment number 170-2020 of the Flagrante Delicto Criminal Court of the First Judicial Circuit of the Atlantic Zone, issued at diecinueve horas treinta y tres minutos on veinticinco de setiembre de dos mil veinte. In the first section, concerning his disagreement with the legal reasoning, he alleges the erroneous application of the cited legal provisions. As legal support, he cites Articles 142, 458, and 459 of the Code of Criminal Procedure; Article 95(a) of the Wildlife Conservation Law; Article 6 of the Sea Turtle Population Protection, Conservation, and Recovery Law; and Article 150(a) of the Fisheries and Aquaculture Law. He asserts that, because it was established that his clients transported or moved the turtle eggs a short distance, Article 95(a) of the Wildlife Conservation Law was inapplicable.
It was not established that the defendants removed the eggs from their natural habitat or plundered the turtles’ nests. During closing arguments, the defense stated that “trasegar” could not be understood as synonymous with transporting because, according to the dictionary of the Real Academia de la Lengua Española, the former word means “to move something from one place to another,” with the latter phrase to be understood as “to alter, change, leave, or depart from one place where something lives for a different place.” The court therefore incorrectly applied the aforementioned Article 95(a). The appellant asserts that, during closing arguments, he stated that the provision applicable to the case was Article 6 of the Sea Turtle Population Protection, Conservation, and Recovery Law. Upon further analysis, however, he now considers that position erroneous and argues that Article 150(a) of the Fisheries and Aquaculture Law should instead apply.
He maintains that the best explanation of his position is found in decision 1536-2014 of the Criminal Judgment Appeals Court of San José, which he quotes extensively. He therefore requests that the appeal be granted, the judgment vacated, and, in the interest of judicial economy (economía procesal), his clients convicted of violating Article 150(a) of the Fisheries and Aquaculture Law and given the minimum sentence or, alternatively, that the matter be remanded to the court of origin for new proceedings. Denied. The evidence presented at trial established that defendants Nombre01 and Nombre04, without any permit and while traveling by bicycle, each transported eighty-six leatherback sea turtle eggs inside bags they were carrying. In total, they were carrying one hundred seventy-two units. On that basis, the appellant asserts that the conduct does not fall within the statutory offense (tipo penal) for which they were convicted, which provides: “Anyone who trades, deals, traffics in, or moves wild animals or their products and derivatives without the respective permit from the Sistema Nacional de Áreas de Conservación shall be punished as follows: a) By a fine of ten (10) to forty (40) base salaries or imprisonment for one (1) to three (3) years, together with forfeiture (comiso) of the animals or products that are the subject of the offense, when the species involved have populations declared to be reduced or endangered […]” (Article 95 of the Wildlife Conservation Law).
This is so because, in his opinion, the transportation or movement undertaken by his clients does not correspond to the operative verb (verbo típico) “trasegar,” according to the meaning given to that term in the dictionary of the Real Academia de la Lengua Española. Under the appellant’s interpretation of that source, “trasiego” entails “moving,” which occurs when something is removed from the place where it lives. Because the latter was not established, his clients’ conduct does not fall within the offense used as the basis for their conviction. The defense counsel’s conclusion, however, results from a tendentious understanding of the term because he relies only partially on that source of information without following the inquiry through to its conclusion. The Diccionario de la Real Academia Española does indeed define “trasegar,” in its second meaning, as “To move things from one place to another, especially a liquid from one vessel to another” (https://dle.rae.es).
But “mudar,” in its third meaning, is “To remove or separate from a place or employment” (loc. cit.); “remover” being understood, among other things, as “To pass or move something from one place to another” (op. cit.). Thus, a person who passes something—for example, briefcases containing turtle eggs—from one place to another removes it, that is, moves it, which means that the person “trasiega” it. The conduct constituting the offense is thereby established, since the eggs in question are “derivatives” (not products) of the animals from which they originate, as biologist Nombre08 explained, a distinction correctly adopted by the court in its judgment (digital file 200001461130PE-25092020073313_2-Multi, beginning at minute 52:36). That was precisely the conduct for which the defendants were convicted. Thus, even if we adhere to the purely lexicographical method attempted by the appellant, his argument cannot be accepted.
Because moving something does not always entail removing it from its habitat, his conclusion is not linguistically tenable. The appellant also states that he withdraws the interpretation advanced during closing arguments, under which he considered Article 6 of the Sea Turtle Population Protection, Conservation, and Recovery Law applicable to the case. He now instead considers it appropriate to classify the conduct under Article 150(a) of the Fisheries and Aquaculture Law and invokes as persuasive authority decision 1536-2014 of the Criminal Judgment Appeals Court of San José, issued at catorce horas cinco minutos on veintiuno de agosto de dos mil catorce. The first point to bear in mind is that the decision in question addressed an issue different from the one before us because possession of turtle eggs for commercial purposes was found established there, which did not occur here. In any event, irrespective of the relevance of the cited decision, it must be determined whether Article 150 of the Fisheries and Aquaculture Law applies.
In pertinent part, it provides: “A fine of five to fifteen base salaries shall be imposed on anyone who engages in any of the following conduct: a) Illegally possesses, stores, cultivates, transports, markets, or processes products of aquatic flora and fauna […]”. Once again, the issue raised here concerns products of flora and fauna, and a turtle egg is not technically such a product, as already noted. When expressly questioned on this point, expert witness (perito) Nombre08 clarified that a leatherback turtle egg “Is not a product because it has not been altered, extracted, or ‘disassembled’” (digital file 200001461130PE-17092020055352_2-Multi, beginning at minute 46:19). Furthermore, ruling out its classification as a turtle product, he added that, in the case of that animal, one may speak only of “use” and not of “exploitation,” because it is not a resource that can be sustained in the face of human predation; therefore, one may speak only of extraction and consumption.
He further stated that its purported exceptional nutritional value and its alleged connection to virility have been scientifically disproved; turtle eggs have the same nutritional value as chicken eggs. Thus, in the expert’s opinion, this is not a nutritious product or something a person needs to survive or live (same file, beginning at minute 47:01). Accordingly, because its status as a product of aquatic fauna has been disproved, it is incorrect to classify the conduct under the statutory provision suggested by the appellant. The claim must therefore be denied.-
II.As a second ground, the appellants challenge the reasoning supporting the sentence (fundamentación de la pena); specifically, they assert that the judgment contains unlawful intellectual reasoning (fundamentación intelectiva ilegítima) and fails to state the grounds for the sanction (falta de fundamentación de la sanción). The appellant relies on Articles 142, 363 subsection b), and 459 of the Code of Criminal Procedure (Código Procesal Penal). He states that the criminal offense applied provides for the possibility of a monetary sanction, which the trial judge did not consider. Regarding the civil consequences, although at the beginning of the judgment the trial judge noted that there were no motions requiring resolution therein, at the end he stated that the defenses raised were denied. However, he did not indicate which defenses these were or why he rejected them. At the beginning of the adversarial proceedings (contradictorio), the defense argued that defenses raised during the preceding stage had to be resolved before the case was committed for trial; thus, it is possible that the trial judge was referring to those defenses.
Furthermore, the appellants’ clients were ordered to compensate for environmental damage that had not been proven. When the proven facts were established, they corresponded to those alleged in the private criminal complaint (querella), specifically through the third fact, where “Nombre09” appears in parentheses, while the remainder and the allegations made by the Public Prosecution Service (Ministerio Público) were disregarded. The matters relating to removal from the natural environment, the explanation concerning the interruption of the natural life cycle, and the value of the eggs to humanity—all of which allegedly caused the environmental damage—were not deemed proven. It was therefore unlawful to hold them liable for something that had not been proven. Accordingly, he requests that the appeal be granted, the judgment vacated, and the case remanded for new proceedings concerning the sentence and the civil awards.
Granted. Article 95 of the Wildlife Conservation Act (Ley de Conservación de la Vida Silvestre), under which the defendant was convicted, provides: “Those who sell, negotiate, traffic, or transport wild animals or their products and derivatives without the respective permit from the National System of Conservation Areas (Sistema Nacional de Áreas de Conservación) shall be punished as follows: a) By a fine of ten (10) to forty (40) base salaries or imprisonment for one (1) to three (3) years, together with forfeiture (comiso) of the animals or products involved in the offense, when the species concerned have populations declared to be diminished or endangered […]”. Two possible penalties are established: a fine or imprisonment, with the latter clearly being more severe. The judge decided to impose the minimum term of imprisonment on the defendants but did not explain why the less severe option was rejected.
He merely stated that he was imposing the minimum penalty for the offense and granting the benefit of a suspended sentence (beneficio de ejecución condicional) (digital file 200001461130PE-25092020073313_2-Multi, beginning at 1:00:38). In other words, no justification whatsoever was provided on this point. Nor was any justification provided regarding the civil consequences of the proven criminal act. In this regard, the trial judge stated that the civil action (acción civil) had been filed in a timely and proper manner, that it met the legal requirements, and that it explained the causal relationship between the defendants’ conduct and the environmental damage. He therefore granted the civil action as to the four categories of relief claimed by the Office of the Attorney General of the Republic (Procuraduría General de la República): environmental damage, litigation costs (costas procesales), personal costs (costas personales), and statutory interest (intereses legales).
However, he stated that he was not addressing the specific amounts of the award because, in expedited flagrante delicto proceedings (flagrancia), the award is entered without a fixed amount (en abstracto), and the Procuraduría must seek determination during the judgment-enforcement stage (fase de ejecución de sentencia) (same file, beginning at 1:02:18). To conclude this point, the trial judge stated that he was granting the civil action and denying the defenses raised by the defense against that action because he considered that the Procuraduría was entitled to claim the relief sought and that the defendants were the persons against whom that agency was required to bring its claim (beginning at 1:03:45). Once again, the complete absence of reasoning is apparent. The civil claimant’s (actor civil) compliance with the formal requirements does not establish the merits of the claim. Moreover, the fact that the Procuraduría had explained the causal relationship between the alleged act and the verified damage did not relieve the court of the duty to conduct its own analysis.
On the contrary, the trial judge was required to explain why he deemed that causation to have been proven. Likewise, the fact that an award is entered without a fixed amount does not relieve the adjudicatory body of its obligation to explain why the civil claim should be granted. Finally, although the defenses are not even expressly identified, the judge appears to have rejected the defenses of lack of entitlement (falta de derecho) and lack of standing as a defendant (falta de legitimación pasiva). This appears to be the case because he referred to the Procuraduría’s entitlement to claim the relief sought and to the defendants’ status as the persons who were required to be sued. It is evident, however, that the judge’s mere reference to those matters falls far short of acceptable reasoning. The trial judge may not simply state that entitlement and standing exist; he must explain why that is so.
Accordingly, this ground must be granted, the judgment partially vacated with respect to the sentence imposed and the civil award, and the case remanded for new proceedings on both matters in accordance with law.
POR TANTO:
The second ground of the appeal filed by counsel for Nombre01 and Nombre04 is granted. The judgment under appeal is partially vacated with respect to the sentence imposed and the civil award. The case is remanded for new proceedings on both matters in accordance with law. NOTICE SHALL BE GIVEN.

RECURSO DE APELACIÓN interpuesto en la presente causa seguida contra Nombre01, quien es mayor de edad, costarricense, cédula de identidad número CED01, nacido en Limón, Matina, el 28 de marzo de 1968, hijo de Nombre02 y de Nombre03, divorciado, de oficio desconocido, vecino de Limón, Matina y Nombre04, quien es mayor de edad, costarricense, cédula de identidad número CED02, nacido en Limón, Matina, Bataán, el 22 de noviembre de 1997, hijo de Nombre05 y de Nombre06, soltero, de oficio desconocido, vecino de Limón, Matina; por el delito de INFRACCIÓN A LA LEY DE VIDA SILVESTRE, en perjuicio de LEY DE VIDA SILVESTRE. Intervienen en la decisión del recurso, los jueces Giovanni Mena Artavia; Alfredo Araya Vega y Rafael Mayid González González. Se apersonaron en esta sede el licenciado Jonathan Argüello Coto, en calidad de defensor público de los coencartados y el licenciado Andrés Alfaro Ramírez, en representación del Estado, Procuraduría General de la República.
RESULTANDO:
I.Que mediante sentencia número 1720-2020, de las diecinueve horas con treinta y tres minutos del veinticinco de setiembre de dos mil veinte, el Tribunal Penal del Primer Circuito Judicial de la Zona Atlántica, Limón, Sección Flagrancia, resolvió: "POR TANTO: De conformidad con lo expuesto oralmente, artículos 39 y 41 de la COnstitución Política, 11 de la Declaración Universal de Derechos Humanos, artículo 1, 11, 30, 35, 45, 71 del Código Penal, artículos 1 al 15, 142, 184, 422 a 436 del Código Procesal Penal, artículo 95 inciso a) de la Ley de Conservación de la Vida Silvestre, se declara a Nombre01 y Nombre04, autores responsables de un delito de trasiego de derivados de animales en peligro de extinción (huevos de tortuga baula), cometido en perjuicio de la vida silvestre, en tal carácter se le impone la pena de un año de prisión. De conformidad con los artículos 59 a 63 del Código Penal se les concede el beneficio de ejecución condicional de la pena por un término de tres años durante los cuales no podrán cometer delito doloso sancionado con pena superior a seis meses bajo apercibimiento de que de lo contrario se le revocará el beneficio concedido.
Se declara con lugar la querella y acción civil resarcitoria incoada por la Procuraduría General de la República y en abstracto se condena solidariamente a los demandados civiles por lo rubros reclamados de daño ambiental, costas procesales, costas personales e intereses legales, montos estos que se liquidarán en ejecución de sentencia. Firme el fallo, inscríbase en el Registro Judicial y envíense los testimonios de estilo ante el Instituto Nacional de Criminología, al Juzgado de Ejecución de la Penal, a la Procuraduría General de la República y al Ministerio de Ambiente, Energía y Telecomunicaciones. Quedan las partes notificadas al ser esta una sentencia oral (Lo acontecido en la audiencia y detalles, queda debidamente respaldado a través de los recursos tecnológicos de grabación de audio y video con que cuenta este Tribunal y forma parte de la presente resolución, y queda a disposición de las partes que así lo requieran)." II.Que, contra el anterior pronunciamiento, interpuso recurso de apelación el licenciado Jonathan Argüello Coto, en calidad de defensor público de los sindicados.
III.Que verificada la deliberación respectiva de conformidad con lo dispuesto por el artículo 465 del Código Procesal Penal, el Tribunal se planteó las cuestiones formuladas en el recurso de apelación.
Redacta el juez Mena Artavia; y,
CONSIDERANDO:
I.El licenciado Jonathan Argüello Coto, defensor de los encartados Nombre01 y Nombre04, interpone recurso de apelación contra la sentencia número 170-2020 del Tribunal Penal de Flagrancia del Primer Circuito Judicial de la Zona Atlántica, de las diecinueve horas treinta y tres minutos del veinticinco de setiembre de dos mil veinte. En un primer apartado, referente a la inconformidad con la fundamentación jurídica, alega errónea aplicación de los preceptos legales invocados. Cita como sustento legal los artículos 142, 458 y 459 del Código Procesal Penal; 95 inciso a) de la Ley de Conservación de la Vida Silvestre; 6 de la Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas; y 150 inciso a) de la Ley de Pesca y Acuicultura. Afirma que, en vista de que se demostró que sus patrocinados realizaron un transporte o traslado corto de los huevos de tortuga, no resultaba aplicable el artículo 95 inciso a) de la Ley de Conservación de la Vida Silvestre.
No se acreditó que los imputados sacaran los huevos de su hábitat natural o que saquearan los nidos de las tortugas. En conclusiones, la defensa señaló que trasegar no podía entenderse como sinónimo de transportar, porque la primera palabra significa, según el diccionario de la Real Academia de la Lengua Española “mudar una cosa de un lugar a otro”, debiendo entenderse esto último como “variar, cambiar, dejar o irse de un lugar donde se habita a otro distinto”. Por ello, el tribunal aplicó incorrectamente el artículo 95 inciso a) referido. Afirma el recurrente que, en conclusiones, dijo que la norma aplicable al caso era el artículo 6 de la Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas. Sin embargo, bajo un mejor análisis, considera que ello es erróneo, debiendo aplicarse, en su lugar, el artículo 150 inciso a) de la Ley de Pesca y Acuicultura. Sostiene que la mejor explicación de su punto de vista se encuentra en el voto 1536-2014 del Tribunal de Apelación de Sentencia Penal de San José, el cual cita extensamente.
Por ello pide se declare con lugar el recurso, se anule el fallo y, por economía procesal, se condena a sus patrocinados por la infracción del artículo 150 inciso a) de la Ley de Pesca y Acuicultura, imponiéndoseles la pena mínima o, en su defecto, que el asunto vuelva al tribunal de origen, para nueva sustanciación. Sin lugar. Se demostró, a partir de la prueba evacuada en juicio, que los encartados Nombre01 y Nombre04 transportaron, sin permiso alguno y desplazándose en bicicletas, ochenta y seis huevos de tortura marina Baula cada uno, dentro de unos bolsos que portaban. En total, se llevaban ciento setenta y dos unidades. Partiendo de ello, el recurrente afirma que la conducta no se ajusta al tipo penal por el cual se les condenó, que señala: “Quienes comercien, negocien, trafiquen o trasieguen animales silvestres, sus productos y derivados, sin el permiso respectivo del Sistema Nacional de Áreas de Conservación, serán sancionados de la siguiente manera: a) Con pena de multa de diez (10) a cuarenta (40) salarios base o pena de prisión de uno (1) a tres (3) años, y el comiso de los animales o productos objeto de la infracción, cuando se trate de especies cuyas poblaciones hayan sido declaradas como reducidas o en peligro de extinción […]” (artículo 95 de la Ley de Conservación de la Vida Silvestre).
Ello es así porque, en su opinión, el transporte o traslado que realizaron sus defendidos no corresponde con el verbo típico de “trasegar”, según el significado que ese término tiene en el diccionario de la Real Academia de la Lengua Española. Según la interpretación que el apelante hace de esa fuente, el trasiego implica “mudar” y esto se presenta cuando se saca algo del lugar donde se habita. Como esto último no se acreditó, la conducta de sus patrocinados no calza en el tipo utilizado para la condena. La conclusión del defensor, sin embargo, obedece a una comprensión tendenciosa del término, en tanto acude solo parcialmente a la referida fuente de información, sin seguir el proceso hasta el final. Ciertamente, el Diccionario de la Real Academia Española define trasegar, en su segunda acepción, como “Mudar las cosas de un lugar a otro, y en especial un líquido de una vasija a otra” (https://dle.rae.es).
Pero mudar, en su tercera acepción, es “Remover o apartar de un sitio o empleo” (loc. cit.); entendiéndose remover, entre otras cosas, como “Pasar o mudar algo de un lugar a otro” (op. cit.). Así, quien pasa algo —por ejemplo, unos maletines conteniendo huevos de tortuga— de un lugar a otro, los remueve, es decir, los muda, entendiéndose con ello que los trasiega. De esa forma se configura la conducta típica, en tanto los referidos huevos son “derivados” (no productos) de los animales de los que proceden, según explicó el biólogo Nombre08, precisión que fue correctamente asumida por el tribunal en su sentencia (archivo digital 200001461130PE-25092020073313_2-Multi, a partir del minuto 52:36). Esa fue, precisamente, la conducta por la que fueron condenados los justiciables. Así, ni siquiera ateniéndonos al procedimiento meramente lexicográfico que intenta el apelante, resulta posible darle la razón.
En tanto mudar no siempre implica sacar algo de su hábitat, la conclusión a la que llega no es lingüísticamente aceptable. También refiere el recurrente que se desdice de la interpretación que hizo en conclusiones, en virtud de la cual valoraba aplicable al caso el artículo 6 de la Ley de Protección, Conservación y Recuperación de las Poblaciones de Tortugas Marinas. En cambio, ahora considera atinada la adecuación del hecho al artículo 150 inciso a) de la Ley de Pesca y Acuicultura, e invoca como criterio de autoridad el voto 1536-2014 del Tribunal de Apelación de Sentencia Penal de San José, de las catorce horas cinco minutos del veintiuno de agosto de dos mil catorce. Lo primero que debe tenerse presente es que el voto en cuestión resolvió un tema distinto al que aquí se conoce, en tanto se tuvo por demostrada la posesión, con fines de comercio, de los huevos de tortura, cosa que no ocurrió aquí.
En todo caso, más allá de la pertinencia de la cita invocada, corresponde establecer si resulta aplicable el artículo 150 de la Ley de Pesca y Acuicultura, que en lo que interesa señala: “Se impondrá multa de cinco a quince salarios base, a quien incurra en las siguientes conductas: a) Posea, almacene, cultive, transporte, comercialice o industrialice, en forma ilegal, productos de flora y fauna acuáticos […]”. Véase, de nuevo, que aquí se trae a colación el tema de los productos de flora y fauna, uno de los cuales no es, técnicamente, el huevo de tortuga, como ya se adelantó. Interrogado expresamente sobre el punto, el perito Nombre08 aclaró que el huevo de tortuga baula “No es un producto porque no se ha alterado, no se ha extraído, no se ha “desarmado”” (archivo digital 200001461130PE-17092020055352_2-Multi, a partir del minuto 46:19). Más aun, descartando su categorización como producto de la tortuga, acotó que en el caso de dicho animal solo se puede hablar de “utilización”, mas no de “aprovechamiento”, en tanto no es un recurso que pueda mantenerse si se da la acción depredadora del hombre; por ello, solo se puede hablar de extracción y consumo.
Señaló, además, que su pretendido valor nutricional excepcional y su vínculo con temas de virilidad han sido desvirtuados científicamente; los mismos tienen igual valor nutricional que un huevo de gallina. No se trata, entonces, en opinión del experto, de un producto nutritivo, de algo que necesite la persona para sobrevivir o vivir (mismo archivo, a partir del minuto 47:01). Así, desvirtuada su condición de producto de la fauna acuática, resulta incorrecta la ubicación típica en la norma que sugiere el recurrente. De ahí que se imponga el rechazo del reclamo.-
II.Como segundo apartado, se invoca una inconformidad con la fundamentación de la pena; concretamente, se atribuye al fallo una fundamentación intelectiva ilegítima y falta de fundamentación de la sanción. Se ampara el recurrente en los artículos 142, 363 inciso b) y 459 del Código Procesal Penal. Refiere que el tipo penal aplicado contempla la posibilidad de una sanción pecuniaria que no fue considerada por el juzgador. En cuanto a las consecuencias civiles, si bien al inicio de la sentencia el juzgador advirtió que no había incidentes para resolver en la misma, al final dijo que las excepciones planteadas eran declaradas sin lugar. No indicó, sin embargo, de cuáles se trataba, ni por qué las rechazó. Al inicio del contradictorio, la defensa alegó que existían excepciones planteadas en la etapa anterior que debían ser resueltas antes de elevar la causa a juicio, por lo que es posible que a ellas se estuviera refiriendo el juzgador.
Por otro lado, se condenó a sus patrocinados al resarcimiento de un daño ambiental no acreditado. Al establecerse los hechos probados, los mismos correspondían a la querella, exactamente hasta el hecho tercero, donde se indica entre paréntesis “Nombre09”, desechando lo demás y lo acusado por el Ministerio Público. No se tuvo por demostrado lo referente a la extracción del medio natural, o la explicación sobre la evitación del ciclo de vida natural, o los valores de los huevos para la humanidad, todo lo cual ocasionaba el daño ambiental. Por ello, era ilegitimo condenarlos por algo que no se tuvo por probado. Consecuentemente pide declarar con lugar el recurso, anular el fallo y devolver el asunto para nueva sustanciación de pena y condenas civiles. Con lugar. El artículo 95 de la Ley de Conservación de la Vida Silvestre, en virtud del cual se condenó al justiciable, dispone: “Quienes comercien, negocien, trafiquen o trasieguen animales silvestres, sus productos y derivados, sin el permiso respectivo del Sistema Nacional de Áreas de Conservación, serán sancionados de la siguiente manera: a) Con pena de multa de diez (10) a cuarenta (40) salarios base o pena de prisión de uno (1) a tres (3) años, y el comiso de los animales o productos objeto de la infracción, cuando se trate de especies cuyas poblaciones hayan sido declaradas como reducidas o en peligro de extinción […]”.
Se establecen dos posibilidades de castigo: multa o prisión, siendo más grave, evidentemente, la segunda. El juez decidió imponer a los encartados la pena mínima de cárcel, pero sin justificar el descarte de la opción menos severa. Se limitó a decir que imponía la pena menor del delito y otorgaba el beneficio de ejecución condicional (archivo digital 200001461130PE-25092020073313_2-Multi, a partir de la 1:00:38). En otras palabras, no hubo justificación alguna sobre el punto. Tampoco la hubo respecto a las consecuencias civiles del hecho punible acreditado. Al respecto, señaló el juzgador que la acción civil se había presentado en tiempo y forma, que cumplía con los requisitos legales y que en ella se explicaba la relación causal entre la conducta de los encartados y daño ambiental. Por ello declaró con lugar la acción civil en los cuatro rubros reclamados por la Procuraduría General de la República: daño ambiental, costas procesales, personales e intereses legales.
Sin embargo, indicó que no hacía referencia a los montos concretos de la condena porque, en flagrancia, ello se dispone en abstracto, debiendo la Procuraduría dirigirse a fase de ejecución de sentencia (mismo archivo, a partir de la 1:02:18). Para cerrar el punto, el juzgador señaló que declaraba con lugar la acción civil y sin lugar las excepciones presentadas por la defensa contra esa acción, por considerar que la Procuraduría sí tenía derecho de reclamar lo pedido y que eran los imputados las personas a las que tenía que demandar dicho ente (a partir de la 1:03:45). De nuevo se hace patente la ausencia absoluta de fundamentación. El cumplimiento de los requisitos formales por parte del actor civil no conlleva la pertinencia de la pretensión. Además, el que la Procuraduría hubiera explicado la relación causal entre el hecho atribuido y el daño verificado, no eximía al tribunal de hacer su análisis.
Por el contrario, era deber del juzgador explicar por qué tenía por acreditada dicha causalidad. Asimismo, el hecho de que se condene en abstracto no exime al órgano juzgador de la obligación de fundamentar la procedencia de la pretensión civil. Finalmente, aunque ni siquiera las mencionan expresamente, el juez parece haber rechazado las excepciones de falta de derecho y legitimación pasiva. Parece así, porque hizo referencia al derecho de la Procuraduría de reclamar lo pedido y a la condición de los imputados como aquellos que debían ser demandados. Sin embargo, es evidente que mera referencia hecha por el juez dista mucho de ser una fundamentación aceptable. No corresponde al juzgador, simplemente, decir que se tienen el derecho y la legitimación, sino explicar por qué es así. En consecuencia, procede acoger este reclamo, anular parcialmente la sentencia en cuanto a la pena impuesta y a la condena civil, ordenando el reenvío para nueva sustanciación de ambos puntos conforme a derecho.
POR TANTO:
Se declara con lugar el segundo reclamo del recurso interpuesto por la defensa de Nombre01 y Nombre04. Se anula parcialmente la sentencia recurrida en cuanto a la pena impuesta y a la condena civil. Se ordena el reenvío para nueva sustanciación de ambos puntos conforme a derecho. NOTIFÍQUESE.
