* * Case file: 15-006655-0007-CO Decision No. 2019000673 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at twelve o’clock on dieciséis de enero de dos mil diecinueve.

Constitutional challenge (acción de inconstitucionalidad) brought by ÁLVARO SAGOT RODRÍGUEZ, seeking a declaration that the Law Regulating the Creation and Development of the Las Tablillas Border Post, Ley No. 8803, published in the Diario Oficial La Gaceta No. 125 of 29 de junio de 2010, as well as the Regulations implementing that law, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G, published in the Diario Oficial La Gaceta No. 60 of 26 de marzo de 2014, are unconstitutional because they are deemed contrary to the right protected under Article 50 of the Constitución Política, the precautionary principle (principio precautorio), the principle of reasonableness (principio de razonabilidad), the principle of non-reduction of forests (principio de irreductabilidad del bosque), the principle of objective substantiation (principio de objetivación), and the principle of non-regression (principio de no regresión). Also participating in the proceedings were the representative of the Procuraduría General de la República, the representatives of the Ministerio de Ambiente y Energía, the Viceministro de Comercio Exterior, the Ministro de la Presidencia, and the representatives of the Ministerio de Comercio Exterior.

Findings:

  1. 1By written submission received by the Secretariat of the Sala at 09:33 hours on 14 de mayo de 2015, the petitioner requested that the following be declared unconstitutional: a) the Law Regulating the Creation and Development of the Las Tablillas Border Post, Ley No. 8803, published in the Diario Oficial La Gaceta No. 125 of 29 de junio de 2010; b) the Regulations implementing Ley No. 8803, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G, published in the Diario Oficial La Gaceta No. 60 of 26 de marzo de 2014. The provisions are challenged insofar as they provide for the excision (segregación) of portions of the Refugio Nacional de Vida Silvestre Corredor Fronterizo, located along the boundary between Costa Rica and Nicaragua, so that those areas may be administered by the Municipalidad de Los Chiles and used exclusively for the establishment and operation of state institutions providing the public services required for the proper operation of the border post. It is alleged that this excision infringes the right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado), particularly because this law was enacted without a technical study or specific report justifying the excision of these areas.
  2. 2In support of the standing (legitimación) to bring this constitutional challenge, the petitioner states that it derives from Article 75, paragraph 2, of the Ley de la Jurisdicción Constitucional, insofar as the petitioner appears in defense of diffuse interests (intereses difusos) and, specifically, to protect every person’s right to a healthy and ecologically balanced environment.
  3. 3By ruling issued at eleven hours and twenty-seven minutes on catorce de mayo de dos mil quince (appearing at folio 018 of the case file), the challenge was admitted for processing, and the Procuraduría General de la República and the Ministerio de Ambiente y Energía were granted a hearing.
  4. 4The public notices (edictos) referred to in the second paragraph of Article 81 of the Ley de la Jurisdicción Constitucional were published in issues 106, 107 and 108 of the Boletín Judicial on 03, 04 and 05 de junio de 2015 (folio 035 of the case file).
  5. 5The Procuraduría General de la República submitted its report (see folios 27 to 34 of the case file). It states that: a) Regarding standing: It asserts that, pursuant to Article 50, second paragraph, of the Constitución Política, Article 75, second paragraph, of the Ley de la Jurisdicción Constitucional, and the settled case law of this Sala concerning diffuse interests, the challenge is admissible because it falls within the legal protection of the environment; b) Regarding the merits of the matter: It states that the Law Regulating the Creation and Development of the “Puesto Fronterizo las Tablillas,” No. 9223 of 20 de marzo de 2014, reduces the area of the Refugio Nacional de Vida Silvestre created by Decreto No 22962-MIRENEM of 15 de febrero de 1994, excluding from its boundaries an area of approximately 10 hectares, in two portions separated by the highway. It indicates that the land surveys (levantamientos topográficos) included in legislative case file No 17244 describe the nature of the excised lands as rice-growing or agricultural land and pasture.The report “Solicitud de Reducción del Área del Refugio Nacional de Vida Silvestre Corredor Fronterizo” of setiembre de 2007 describes an area with 5% slopes, no risk of flooding, and the following characteristics: “Essentially, the area consists of natural pasture and cleared land that is cultivated or ready for planting. It has very few isolated trees, and there is no forest cover (cobertura boscosa) or land undergoing natural regeneration within this area.” It indicates that reducing a protected wilderness area (área silvestre protegida) requires that the reduction be effected by law and that sufficient technical studies justifying the measure be conducted beforehand. It states that Legal Opinion No OJ-98-2009, issued by the Procuraduría during consideration of the bill that culminated in the Law under review, analyzed the technical study then included in the case file and found it insufficient to justify the reduction, stating: “…it must respectfully be noted that this technical report does not meet the requirements necessary to substantiate the bill under consultation.Note that it examines the 236 hectares initially proposed and concludes that the project is not viable from an environmental and social standpoint. However, that study does not explain in any way why this negative impact would not occur within the proposed 13 hectares or, in other words, there is currently no technical opinion addressing the reasons why the excision of the 12.3 hectares specified in the bill under consultation is in fact viable. The requirement established by Article 38 of the Ley Orgánica del Ambiente is clear, and technical studies justifying the reduction of protected wilderness areas must be available; therefore, in this specific case, MINAET should issue a new opinion on the matter, but this time concerning the proposed area of 12.3 hectares, according to the coordinates described in the bill.” Notwithstanding the foregoing, it considers it important to verify, in the technical justification provided by the Ministerio de Ambiente y Energía, the technical and scientific basis for Ley No. 8803.Regarding the alleged violation of the constitutional principle of compensation (principio constitucional de compensación), it states that the Sala has established compensation for the removed area with another area of equal size as an additional requirement for carrying out the reduction. Nevertheless, it considers that unconstitutionality arising from a violation of this principle would not necessarily be remedied by annulling the Law; if characterized as unconstitutionality by omission (inconstitucionalidad por omisión), it would be sufficient for this Sala to order in its judgment that a portion compensating for the removed area be added to the Refugio. It considers that the information provided by MINAE will be essential to analyzing the petitioner’s allegations concerning the principle of non-reduction of forests (principio de irreductibilidad del bosque) and landscape protection (protección del paisaje), because the document “Solicitud de Reducción del Área de Refugio Nacional de Vida Silvestre Corredor Fronterizo” states that “The lands adjacent to the highway are occupied by numerous families… of Costa Rican and foreign smallholders. Most of the parcels are small and are planted with subsistence crops, the important ecosystems bordering the highway to the Puesto Fronterizo de Tablillas.” It concludes that:1) This Sala has exclusive jurisdiction to determine whether the technical support justifying the reduction of the Refugio Nacional de Vida Silvestre is sufficient, as well as to assess compliance with the principle of reasonableness, and thereafter to determine whether the requested demolition is appropriate.2) Should this Sala conclude that Ley No 8803 lacks a scientific and technical basis, a declaration that Decreto No. 38628-MP-COMEX-MINAE-SP-G is unconstitutional would be appropriate.3) There is unconstitutionality by omission due to the failure to compensate for the removed area with another area of equal size, which could be remedied through an addition.4) No infringement of Article 89 of the Carta Magna or of the principle of non-reduction of forests is established.
  6. 6Edgar E. Gutiérrez Espeleta submits his report in his capacity as Minister of Environment and Energy (see pages 37 to 46 of the electronic case file) and states: This law originated as a bill intended to create and develop a border post between Costa Rica and Nicaragua, located in the community of Las Tablillas de Los Chiles, which would be established on an area of land that currently forms part of the Refugio Nacional de Vida Silvestre Corredor Fronterizo, created by Decreto Ejecutivo No 22962-MIRENEM of 15 de febrero de 1994 and amended by Decreto Ejectivo No 23248-MIRENEM of 20 de abril of the same year. He indicates that the area under discussion has a special designated purpose because it forms part of the State’s natural heritage (patrimonio natural del Estado), having been declared a Wildlife Refuge (Refugio Silvestre), and therefore is not subject to private occupation; accordingly, land of this nature must be acquired by the State through purchase or expropriation (expropiación).He states that the intent was not to remove the area in question from the public domain (desafectación del dominio público), but rather to authorize the use of a portion of the area for another purpose in the public interest, namely the installation of a border and customs post, since the structures would belong to the State and not to private parties. He indicates that in marzo de 2007, following a series of sessions, studies, and research, and drawing on the experience of the Puesto Fronterizo Peñas Blancas, the Border Post Commission proposed that the area to be declassified (desafectar) should consist of a strip of land measured 250 meters on either side from the center of the highway until it exits the Corredor Fronterizo, comprising a total of 236 hectares. He indicates that the Ley Orgánica del Ambiente permits reducing the surface area of protected wilderness areas (áreas silvestres protegidas), but imposes two requirements: compliance with the principle of statutory reservation (principio de reserva de ley) and the existence of a technical study supporting the measure.He states that on 28 de setiembre de 2007, the technical report prepared by the Caso Tablillas commission, entitled “Solicitud de reducción del área del Refugio Nacional Corredor Fronterizo,” was issued, proposing the declassification of a 13-hectare area adjoining the border line, because officials from the Área de Conservación Arenal Huetar Norte deemed the segregation (segregación) of the stated 236-hectare area unfeasible. The report ultimately concluded that a 13-hectare area would be a more viable proposal from the standpoint of impacts on the ecosystems present at the site and in the surrounding area. He states that the report considered biophysical aspects such as soil type, current land use, topography, the existence of wetlands (humedales), etc. The declassified area is very small in relation to the size of the Refuge and, moreover, had already undergone a land-use change (cambio de uso), so neither forest nor wetlands would need to be removed.Regarding socioeconomic aspects, declassifying the entire requested area would create a risk of significant social impact because many families live along the highway within the proposed area. He states that the Ministry of Environment and Energy prepared the technical report concerning the feasibility of segregating the 13 hectares, which was endorsed by the Consejo Regional del Área de Conservación Huetar Norte during the legislative approval process conducted by the Asamblea Legislativa. He requests that this action of unconstitutionality (acción de inconstitucionalidad) be dismissed.
  7. 7By a ruling issued at sixteen hours and twenty-one minutes on veintinueve de junio del dos mil quince, the responses to the hearings granted to the Procuraduría General de la República and the Ministry of Environment and Energy were deemed submitted, and the Minister of the Presidency, the Minister of Foreign Trade, and the Vice Minister of Foreign Trade, in his capacity as president of the Consejo de Puestos Fronterizos Terrestre, were admitted as supporting respondents (coadyuvantes pasivos) in this action.
  8. 8Alexander Mora Delgado, in his capacity as Minister of Foreign Trade, and Jhon Fernando Fonseca Ordoñez, in his capacity as Vice Minister of Foreign Trade and as supporting respondents in this action of unconstitutionality, state that, after conducting inspections within Lots 1 and 2 segregated by Ley No 8803 of 16 de abril de 2016 and in the surrounding areas, they found agricultural and livestock activities being conducted within the area declared part of the State forest heritage (patrimonio forestal del Estado), which forms part of the Refugio Nacional de Vida Silvestre Corredor Frontera Norte. They emphasize that no primary or secondary forest cover (cobertura boscosa) is evident on Lots 1 and 2 or in their surrounding areas and that those Lots contain only tacotal cover (dense scrubland), medium-height grasslands, occasional shrubs, and palms native to the area. In the surrounding areas, there is a pronounced presence of extensive plains devoted to growing rice, cassava, corn, and sugarcane, among other crops, as well as livestock grazing and fattening activities.Likewise, the areas adjoining the Puesto Fronterizo Las Tablillas contain both temporary and permanent human settlements. The former are associated with the agricultural and livestock activities conducted in the area by residents of Las Tablillas and Los Chiles and consist of storage facilities for agricultural tools and supplies, while the latter consist of residences accessible from the public road and provided with some public utilities. All of the foregoing occurs less than one kilometer from the border line and therefore takes place within the Refugio Nacional de Vida Silvestre Corredor Frontera Norte, dating from before the enactment of Ley No 8803 on 16 de abril de 2010, or even many years before the studies contained in the Informe Técnico Solicitud de reducción del área del Refugio Nacional de Vida Silvestre Corredor Fronterizo were conducted. That report recommends locating the Border Post in the area identified as Lots 1 and 2, since there are no important or fragile ecosystems, such as wetlands, primary or secondary forests, rivers, streams, etc., that could be affected by potential infrastructure development.
  9. 9Sergio Iván Alfaro Salas, in his capacity as Minister of the Presidency, and Alexander Mora Delgado, in his capacity as Minister of Foreign Trade and as supporting parties in this action of unconstitutionality, state that, because the Instituto Costarricense sobre Drogas is a body with maximum administrative autonomy (órgano de desconcentración máxima) attached to the Ministry of the Presidency, the manner in which the fight against drug trafficking is addressed is of direct interest to that Ministry by reason of their inter-agency oversight relationship (relación de dirección interorgánica), which in the present case is embodied in the Puesto Fronterizo Las Tablillas. With respect to the Ministry of Foreign Trade, they state that it has an interest because the Puesto Fronterizo Las Tabillas serves as a strategic point for facilitating trade with Nicaragua, Central America, and Mexico, making its operation essential.They indicate that Decreto Ejecutivo No 22962-MIRENEM of 15 de febrero de 1994 was amended by the Executive Decree. As to the facts: The special protection of the 2.000-meter border strip for environmental purposes is not the sole reason for retaining these areas within the State domain, since the historical legal regime currently applicable to these areas, together with the environmental regime, was initially more closely related to the defense of sovereignty and national security (as is also evident from judgment number 2988-99 of the Sala Constitucional). The technical report prepared by MINAE in setiembre del 2007 appears at pages 76 to 94 of the legislative record (expediente legislativo). The identified site is suitable for development of the Border Post project because it had already been affected by human activity, as demonstrated by the absence of important or fragile ecosystems, the absence of primary or secondary forest cover, and the absence of wetlands or watercourses; instead, the site contains only natural grasslands and cleared land used for cultivation or ready for planting.Moreover, the area is strategically suitable from a technical standpoint for locating the Border Post because of its proximity to the border line, the existence of transportation routes for internal travel (roads), and a national highway connected to the roadway on the Nicaraguan side of the border. The petitioner (accionante) is incorrect in asserting that there were no environmental studies supporting the reduction of the protected area, which represents 0,02% of the total area. Furthermore, the challenged law did not remove the segregated area from the public domain. The “Puesto Fronterizo Las Tablillas” project arose from the need to implement the binational interests of the Governments of Nicaragua and Costa Rica by providing a land route intended, among other anticipated effects, to contribute to border development in San Carlos de Nicaragua and Los Chiles de Costa Rica. With a view to obtaining the environmental permit (permiso ambiental) for the project, the professionals conducted a field inspection on 25 de setiembre del 2014 and indicated that, given the characteristics of the land, an exhaustive biological study was not considered necessary, although they did recommend certain preventive measures, such as refraining from capturing wildlife, properly disposing of solid waste, preventing machinery oil spills, and properly managing soils.The requested demolition of the public infrastructure would immediately leave public order, peace, health, sustainable development, life, and human dignity without protection. Furthermore, the State has no obligation to compensate for an area that had already been deforested and affected by providing another area, because there was never any reduction of the forest or environmental impact that would justify a compensatory measure. The petitioner’s argument that the provision entails regressive environmental measures is inadmissible, given that it is progressive with respect to human rights. They request that the action be dismissed.
  10. 10The hearing provided for in Articles 10 and 85 of the Ley de la Jurisdicción Constitucional is dispensed with pursuant to the authority granted to the Chamber by Article 9 thereof, because this decision is deemed sufficiently grounded in clear principles and rules of law, as well as in the case law of this Court.
  11. 11The statutory requirements have been fulfilled in the proceedings.

Whereas:

I. Subject Matter of the Challenge.-

The petitioner challenges the Law Regulating the Creation and Development of the Las Tablillas Border Post, Law No. 8803, published in the Official Gazette La Gaceta No. 125 of 29 de junio de 2010, as well as the Regulations to that law, Executive Decree No. 38628-MP-H-COMEX-MINAE-SP-G, published in the Official Gazette La Gaceta No. 60 of 26 de marzo de 2014. Regarding the identification of the challenged law, it should be clarified that a clerical error was observed in the report submitted by the Procuraduría General de la República, because it initially stated the law number incorrectly, but subsequently identified it correctly. This Chamber therefore noted the error and understands, based on the substance of the report and because the number was subsequently stated correctly, that it was a clerical error and that the Procuraduría’s report refers to Law no.8803, which is the subject of this action.

The petitioner considers those provisions unconstitutional because they violate the right protected by Article 50 of the Political Constitution, the precautionary principle (principio precautorio), the principle of reasonableness (principio de razonabilidad), the principle of the irreducibility of forests (principio de irreductabilidad del bosque), the principle of objectification (principio de objetivación), and the principle of non-regression (principio de no regresión). He states that on 15 de febrero de 1994, the Executive Branch ordered the creation of the Refugio Nacional de Vida Silvestre corredor fronterizo, comprising the lands extending along the border with Nicaragua (Decreto n°22962-MIRENEM). That refuge was established to protect biodiversity and the landscape in Costa Rica’s northern border region. However, on 29 de junio del 2010, the Asamblea Legislativa enacted the challenged Law, segregating and removing several hectares from the refuge without any environmental studies to justify that action.

This therefore constitutes regression, because an area forming part of the State’s natural heritage (patrimonio natural del Estado) was segregated and the purposes of protecting biodiversity were undermined. He states that the Convention for the Conservation of Biodiversity and Protection of Priority Wilderness Areas in Central America (Ley 7433) even requires special protection for protected border areas. He further adds that no compensatory measures (medidas de compensación) were ordered either. The entire law is challenged; it provides verbatim as follows:

“ARTICLE 1.- Segregation A total area of ciento veintiún mil doscientos treinta y siete metros con veintitrés centímetros cuadrados is hereby segregated from the Refugio Nacional de Vida Silvestre Corredor Fronterizo, created by Executive Decree N.º 22962-Mirenem, of 15 de febrero de 1994, and amended by executive decree N.º 23248-Mirenem, of 20 de abril del mismo año, and located along the boundary line between the Republics of Costa Rica and Nicaragua, in accordance with the land survey (levantamiento topográfico) mentioned below.

The total area to be segregated is divided into two subareas located between points one and twenty-nine and one and fourteen, respectively, in the table set forth below:

(…)

ARTICLE 2.- Administration The segregated area shall be administered by the Municipalidad de Los Chiles and shall be used exclusively for the installation and operation of the State institutions providing the public services required for the proper operation of the border post.

State institutions are authorized to provide all forms of advice and assistance to the Municipalidad de Los Chiles, and the specified Municipalidad is authorized to arrange for and receive such advice and assistance, for the purpose of ensuring the construction of all types of infrastructure and the effective operation of the border post.

Likewise, the Municipalidad and the public institutions that will use this space are authorized to assign rights of use and usufruct (usufructo) to securitization trusts (fideicomisos de titularización) or similar arrangements whenever such an instrument or mechanism is considered necessary or advisable for carrying out construction or building the infrastructure works required for the effective operation of the border post.

ARTICLE 3.- Boundary Marking Based on the aforementioned land survey, the Ministerio de Ambiente, Energía y Telecomunicaciones (Minaet) shall mark the boundaries (amojonará) of the area segregated from the Refugio Nacional de Vida Silvestre Corredor Fronterizo in order to safeguard the area that remains subject to the declaration as a protected wilderness area (área silvestre protegida) from the potentially harmful effects of human development.

ARTICLE 4.- Authorization The Executive Branch is authorized to undertake the necessary measures to establish a customs and immigration post in the segregated area.

ARTICLE 5.- Regulations The Executive Branch shall issue regulations for this Law within a maximum period of sixty days from its publication in La Gaceta.

Effective as of its publication.”

II. Standing in This Case.-

The petitioner has sufficient standing (legitimación) to seek a declaration that the challenged provisions are unconstitutional, without needing a prior case on which to base this action. This is because he appears in defense of an interest concerning the national community as a whole, namely, the right to the environment. He therefore has full standing to bring a direct action under the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional. Furthermore, this is a matter whose constitutionality may properly be reviewed through this proceeding, since it concerns statutory and regulatory provisions. The requirements stipulated in sections 78 and 79 of the procedural Law were also satisfied. In conclusion, this action is admissible, and the subject matter and merits of the case must therefore be addressed immediately.

III.Methodology for Analyzing the Action.- To facilitate review of the challenged provisions, the following recitals (considerandos) will first analyze their general scope, then the case law of this Chamber concerning the sufficiency of technical reports, and finally undertake a specific examination of the allegations of unconstitutionality.

IV.General Considerations Regarding the Law Regulating the Creation and Development of the Las Tablillas Border Post (Law No. 8803) and Its Regulations (Executive Decree No. 38628-MP-H-COMEX-MINAE-SP-G).- Through Decree No. 22962-MIRENEM of 15 de febrero de 1994, the Executive Branch ordered that the border corridor along the border with Nicaragua be declared a Refugio Nacional de Vida Silvestre, deeming the area an extremely important biological corridor (corredor biológico). The area thereby became part of the State’s natural heritage and, as such, is not susceptible to private occupation. The challenged law was subsequently enacted: the Law Regulating the Creation and Development of the “Puesto Fronterizo las Tablillas,” No. 9223 of 20 de marzo del 2014, which was introduced for the purpose of creating and developing a border post between Costa Rica and Nicaragua, located in Las Tablillas, Cantón Los Chiles.

The post would be established on land forming part of the Refugio Nacional de Vida Silvestre Corredor Fronterizo. For that purpose, the law reduces the surface area of the Refugio Nacional de Vida Silvestre by excluding from its boundaries an area of nearly 13 hectáreas, in two portions separated by the highway. The regulations to that law, Decree No. 38628-MP-COMEX-MINAE-SP-G, promote the participation of State institutions in making the infrastructure operational and placing the Puesto Fronterizo Las Tablillas into operation.

V.Case Law on the Reduction of Protected Areas, the Sufficiency of Technical Reports, and Proper Compensation.- Regarding the reduction of protected areas, the case law of this Chamber establishes the following:

1. Constitutional requirements for reducing a protected wilderness area (statutory reservation and technical studies): In support of Article 38 of the Ley Orgánica del Ambiente (“the surface area of protected wilderness areas forming part of the State’s natural heritage, regardless of their management category, may be reduced only by a Law of the Republic and after conducting technical studies justifying the measure”), there has been a consistent line of case law holding that two essential requirements must be met to reduce a protected wilderness area under any of its management categories (including national wildlife refuges): “by means of a law and after conducting sufficient technical studies justifying the measure.” (Sala Constitucional, decisions numbers 13367-2012 and 010158-2013. Similarly, judgments numbers 7294-1998, 11155-2007, 1056-2009, 18702-2010 and 14772-2010, among others). As stated in the aforementioned 1998 decision:

““(…) once a particular area has been declared a protected zone (zona protectora) by an act of the State, the State may not simply remove all or part of that designation (desafectarlo) in order to protect other interests—public or private—to the detriment of the enjoyment of a healthy environment, in accordance with Article 50 of the Constitution. However, the fact that a provision, regardless of its rank, has declared a particular area a protected zone does not make it an immutable zone in the sense that its area may never be reduced by subsequent legislation. Nevertheless, it must be borne in mind that the declaration and delimitation of a protected zone, in fulfillment of Article 50 of the Constitution, entails protecting the fundamental right to the environment; consequently, a reduction in its area must not impair that right, a matter that must be determined in each specific case. The fact that a subsequent law reduces the area of a protected zone, forest reserve, National Park, or any other site of environmental interest is not necessarily unconstitutional, provided that the reduction is justified insofar as it does not violate the right to the environment.

It may be that, due to various circumstances, a particular site has lost, at least in part, the environmental interest that originally warranted its protection, which, after the relevant studies have been conducted, would justify its modification or reduction, all in application of the principle of constitutional reasonableness…” (decision No. 7294-1998).

Specifically regarding the statutory reservation (reserva legal) in this field, decision No.14772-2010 stated:

(…) the public purpose of public-domain property (bien del demanio público) may not be altered without a legislative act; in other words, the reduction of the area of a protected zone is subject to the guarantee afforded by the principle of statutory reservation (principio de reserva de ley). Although, pursuant to Article 36 of the Ley Orgánica del Ambiente, the Executive Branch is authorized to establish Protected Wilderness Areas upon satisfaction of the requirements set forth in that provision—and Parque Nacional Corcovado was accordingly established through Executive Decrees No. 5357-A of 24 de octubre de 1975 and 1148-A of 5 de febrero de 1980—its modification may be carried out only in accordance with Article 38 of the Ley Orgánica del Ambiente, following technical and scientific studies and through a legislative act. (emphasis not in the original).

Likewise, judgment no.1056-2009 stated that a reduction is possible only by law:

“when it comes to expanding the boundaries of the protective zones (zonas protectoras) of the State Forest Heritage (patrimonio forestal del Estado), this may be done through regulations; however, when it comes to reducing them, this may be done only by law, provided, of course, that there is a prior assessment justifying the measure.” (Judgment of the Sala Constitucional Nº 1056-2009) This was applied when the Sala declared unconstitutional the regulatory provision (Decreto Ejecutivo Nº 32753-MINAE) through which the Poder Ejecutivo reduced the territory of Refugio Gandoca-Manzanillo, removing the Refuge’s urban zone from the protected area and protection regime.

Furthermore, with regard to the studies, they must be prior, sufficient, necessary, and individualized—as indicated in the following section. The same 1998 decision stated:

“According to the foregoing, mutatis mutandis, if, for the creation of a protected wilderness area (área silvestre protectora), the Asamblea Legislativa, through a law, required compliance with specific requirements in order to determine whether the designation in question was justified, it logically follows that certain requirements—such as conducting technical environmental studies—must also be met for its partial or total removal from protected status (desafectación), in order to determine that such removal does not violate the substance of Article 50 of the Constitution. In this regard, we may speak of levels of removal from protected status. Thus, not every removal of protected status from a protected zone is unconstitutional, insofar as it does not impair or threaten the right to the environment. Accordingly, to reduce any protected wilderness area (área silvestre protegida), the Asamblea Legislativa must do so on the basis of sufficient and necessary technical studies establishing that no harm will be caused to the environment and that it will not be endangered and, consequently, that the substance of Article 50 of the Constitution will not be violated.

The principle of reasonableness (principio de razonabilidad), in relation to the fundamental right to the environment, requires that provisions enacted in this area be duly supported by rigorous technical studies, even if no other legal provision expressly required it. In the opinion of this Tribunal Constitucional, the requirement contained in Article 38 of Ley Orgánica del Ambiente No. 7554, to the effect that, before a protected wilderness area established by formal law may be reduced, technical studies justifying the measure must be conducted in advance, is simply the concrete expression of the principle of reasonableness in matters of environmental protection.” (emphasis not in the original).

2. Technical study as a scientific and individualized analysis: The Sala has addressed the sufficiency of the technical study by establishing in several decisions that such a study must constitute a scientific and individualized analysis. It stated:

“the requirement for technical studies is not a mere formality; rather, it is a substantive requirement, meaning that the degree of the corresponding measure’s impact on the environment must be substantively demonstrated through a scientific and individualized analysis, recommendations aimed at mitigating its adverse environmental impact must be proposed, and it must be shown how the measure entails development that meets the needs of the present without jeopardizing the ability of future generations to meet their own needs.” (Voto No. 13367-2012. See also No. 10158-2013).

It follows that the technical study required by Article 38 of Ley Orgánica del Ambiente, which is the concrete expression of the constitutional principle of reasonableness in matters of environmental protection, requires a technical analysis involving an individualized analysis that must address, at a minimum, the following matters:

The degree of the corresponding measure’s impact on the environment; Recommendations aimed at mitigating the adverse impact on the environment; A demonstration of how the measure adopted entails development that meets the needs of the present without jeopardizing the ability of future generations to meet their own needs.

In summary, this prior study must demonstrate that the removal from protected status is consistent with the constitutional protection of the right to the environment because, as stated in voto no. 18702-2010, “areas of this nature cannot be allowed to be titled indiscriminately, since this would run counter to the very environmental conservation policies pursued by the Estado pursuant to the mandates established by the Constitución Política and the international conventions it has signed.” 3. Compensation measures (medidas de compensación): A protected area may be reduced only if this is done by law, if technical and scientific studies rule out environmental harm, and if the removed area is compensated for with another area of equal size. There can be no doubt that all provisions reducing protected areas without the support of technical studies or any compensation whatsoever are unconstitutional” (voto Nos. 12887-2014, 2773-2014, 2012-13367 y 2009-1056).

VI.On the challenged legislation.- As can be seen, both the Law regulating the creation and development of the Las Tablillas border post, Ley No. 8803, and its Regulations are challenged in their entirety, essentially for two reasons: because they lack a technical study supporting the reduction of a protected area (in this case, a national wildlife refuge), and because they fail to establish compensation measures. Each of these claims is examined separately. REGARDING THE TECHNICAL STUDY: The petitioner states that the challenged Law and its Regulations are segregating and reducing several hectares of the Refugio Nacional de Vida Silvestre in the border area, without any environmental studies justifying that action. The petitioner states that the legislators relied on a mere recommendation that could never be regarded as a serious, thorough, and comprehensive study permitting the action taken.

In its report, the Procuraduría General de la República states that, in its Legal Opinion No. O.J.-98-2009, issued on 14 de octubre del 2009 in response to a consultation by the legislators during the consideration of the bill that culminated in Ley No. 8803, it had already analyzed the technical study then included in the case file and deemed it insufficient to justify the measure: “…it must respectfully be noted that said technical report does not meet the requirements necessary to substantiate the bill under consultation. It should be noted that it conducts a study of the 236 hectares initially proposed and concludes that the project is not viable from an environmental and social standpoint. However, said study does not explain in any way why that adverse impact would not occur on the proposed 13 hectares; in other words, to date there is no technical assessment addressing the reasons why the segregation (segregación) of the 12.3 hectares established in the bill under consultation would be viable…”.

The Ministro de Ambiente y Energía states that there is no unconstitutionality. He adds that the challenged law was not intended to remove the area in question from the public domain (desafectación del dominio público), but rather to authorize the use of a portion of the area for another public-interest purpose, namely the installation of a border and customs post, with the understanding that the facilities would be State-owned rather than private. Accordingly, on 28 de setiembre del 2007, the technical report prepared by the comisión caso Tablillas, entitled “Solicitud de reducción del área del Refugio Nacional Corredor Fronterizo,” was issued, proposing the removal from protected status (desafectación) of an area of 13 ha adjoining the border line, because officials of the Area de Conservación Arenal Huetar Norte deemed the segregation of the specified 236 ha area unfeasible. The report concluded that: “13 hectares would be a more viable proposal from the standpoint of the impact on the ecosystems present at the site and in the surrounding areas.” That report considered biophysical, socioeconomic, and security-related aspects.

It concludes that the cost-benefit balance of establishing posts to control and regulate migratory entry in that sector helps regulate entry through the public-domain strip (franja demanial) that overlaps with the Área Silvestre Protegida. The Ministros de la Presidencia y de Comercio Exterior state that the technical report prepared by MINAE in setiembre del 2007 appears at pages 76 through 94 of the legislative record. The identified site meets the appropriate conditions for developing the Border Post project because it had already been affected by human activity, as demonstrated by the absence of important or fragile ecosystems, primary or secondary forest cover (cobertura boscosa), wetlands, or watercourses, and the presence only of natural grasslands and cleared land for cultivation or ready for planting. Furthermore, the area is strategically suitable from a technical standpoint for the location of the Border Post because of its proximity to the border line and the existence of transportation routes for internal travel (roads), as well as a national highway connected to the road on the Nicaraguan side of the border.

In this regard, this Chamber concludes that the Procuraduría General de la República is indeed correct in its report: there is no technical study addressing the viability of this project, since the study that was conducted concerned a larger area and concluded that it was not viable from an environmental and social standpoint. It was therefore necessary to explain why the new proposal would not cause problems affecting the wetlands, the species in the area, or the aquifers, and would not create social problems of the kind identified in the initial proposal. The technical study cited by the Ministers is clearly insufficient because it does not explain in any way why that adverse impact would not occur on the proposed 13 hectares, the degree of the corresponding measure’s environmental impact, the recommendations aimed at mitigating its adverse environmental impact, or how the measure constitutes development that meets the needs of the present without jeopardizing the ability of future generations to meet their own needs.

Moreover, although it may be true, as the Ministers state in their report, that the property is not leaving the public domain, it is nevertheless true that, from an environmental standpoint, it is being removed from protected status. It may also be true, as the Ministers state in their report, that, in addition to the environmental interest in the border area, other relevant interests may exist, such as migration security and others. However, that is precisely what the technical report should have addressed in its supporting rationale. It should be noted that, as the Ministers state, certain environmental measures may have been taken; however, this does not alter the fact that the technical report required to support the law was lacking, leaving those environmental measures without the required technical basis. Accordingly, the alleged unconstitutionality of the challenged law—and, by extension (por conexidad), of its Regulations—is established due to the absence of a sufficient technical report supporting the reduction of the Refugio Nacional de Vida Silvestre in the border area.

REGARDING COMPENSATION MEASURES: The petitioner states that the law did not establish timely compensation measures in response to the ordered segregation. In its report, the Procuraduría General de la República states that a finding of unconstitutionality due to violation of this principle would not necessarily be remedied by annulling the Law; if characterized as unconstitutionality by omission (inconstitucionalidad por omisión), it would suffice for the Sala Constitucional to order in its judgment that a portion or portions compensating for the removed area be added to the Refuge, which could even be done through regulations. The Ministros de la Presidencia y de Comercio Exterior state that the requested demolition of the public infrastructure would immediately leave public order, peace, health, sustainable development, life, and human dignity unprotected. They also consider that the State has no obligation to compensate for an already deforested and impacted area with another area, since there was never any reduction of the forest or environmental harm that would justify a compensation measure.

In this regard, this Chamber concludes that the challenged provisions are indeed also silent with respect to compensation measures. Given the evident segregation of approximately 13 hectares, as stated in Article 1 of the challenged law, and although those hectares did not leave the public domain, they did cease to fall within an environmental management category (categoría de manejo ambiental), which required the establishment of statutory compensation measures that, as is apparent from a reading of the entire law, were neither adopted nor guaranteed. Accordingly, the alleged unconstitutionality of the challenged law—and, by extension, of its Regulations—is established due to the absence of compensation measures for the reduction of the Refugio Nacional de Vida Silvestre in the border area.

VII.Conclusion.- According to this Chamber’s settled case law, every reduction of a protected wilderness area (área silvestre protegida), under any of its management categories (including national wildlife refuges), must meet three essential requirements: statutory reservation (reserva legal) (that is, it may be done only by law), the prior completion of sufficient technical studies justifying the measure, and the establishment of compensation measures. In this case, it was established that the Law regulating the creation and development of the Las Tablillas border post (Ley No. 8803) and its Regulations proceeded with the segregation, and consequent reduction, of the Refugio Nacional de Vida Silvestre in the border area. However, although this was done by law, no sufficient prior study was conducted that justified the measure, established the degree of its environmental impact, set forth recommendations aimed at mitigating the adverse environmental impact, demonstrated how the measure constitutes development that meets the needs of the present without jeopardizing the ability of future generations to meet their own needs, or specifically and comprehensively established compensation measures. All of this establishes unconstitutionality by omission. Accordingly, the action is upheld in this case, with the effects of this judgment being tailored (dimensionamiento), as stated below.

VIII.On the tailoring of the effects of this judgment.- Having established the unconstitutionality, the action must be upheld and, consequently, both the Law regulating the creation and development of the Las Tablillas border post, Ley No. 8803 of 16 de abril de 2010, and its Regulations, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G of 16 de setiembre de 2014, must be annulled and removed from the legal system. Pursuant to section 91 of the Ley de la Jurisdicción Constitucional, the effects of this judgment are, by majority decision, calibrated and tailored. With respect to this Chamber’s authority to tailor the effects of judgments, it should be recalled that prior decisions have stated (see decision number 2018-012782 at 16:45 hours on 08 de agosto del 2018):

The broad scope of declarations of unconstitutionality arises from the legal theory adopted by the Constituent Assembly, which positioned the Constitución Política as the foundation of the Costa Rican democratic State and the cornerstone of the national legal system. Indeed, the Fundamental Law contains the cardinal guidelines that all subordinate constitutional legislation (articulado infra constitucional) must follow, as well as the organic rules governing our country’s institutions. The importance of the Constitución Política is such that its mere interpretation by this Court may have significant consequences for legal certainty, vested rights (derechos adquiridos), the actions of public institutions, social stability, and other matters.

Within this context, the Sala Constitucional has been mindful of the significance of its decisions, whose ramifications may affect multiple areas of Costa Rican society. In this regard, from the outset of this constitutional jurisdiction, this Court stated:

“Our system of constitutional adjudication (sistema jurisdiccional constitucional) follows a mixed theory combining the so-called “American” approach, which simply declares the nonexistence or absolute nullity of rules enacted in violation of the Constitution, and the so-called “Austrian” approach, which recognizes the validity and effectiveness of a rule until it is annulled and therefore empowers the Judge to define the effects of a declaration of unconstitutionality (declaratoria de inconstitucionalidad), so as to prevent vested legal situations (situaciones jurídicas consolidadas) or rights acquired in good faith (derechos adquiridos de buena fe) from being affected. Indeed, Article 11 empowers this Chamber to declare rules of any nature unconstitutional, and Article 91 of the Ley de la Jurisdicción Constitucional defines, as already stated, the declaratory and retroactive effect of a judgment of unconstitutionality (sentencia de inconstitucionalidad), and also empowers the Chamber to calibrate the effects of that judgment so as to avoid ‘serious disruptions to social security, justice, or peace,’ thereby demonstrating that, although the rule is unconstitutional because of an original defect, it produced effects that endure over time and across jurisdictions.” (Judgment N° 1990-001409 of 14:27 hours on October 26, 1990).

The legislation governing constitutional jurisdiction (jurisdicción constitucional) recognizes the supremacy of the Fundamental Law and, accordingly, develops the implications of the premise described above. For example, Article 13 of the Ley de la Jurisdicción Constitucional grants erga omnes binding effect to the case law and precedents of this jurisdiction. No body other than the Sala Constitucional may modify or reverse such criteria. This is because the particular authority or active force of this Court’s rulings does not derive from its status as a judicial authority; rather, those qualities emanate from the Constitution itself, which prevails over any body or rule that conflicts with it. Just as the Constitution prevails over the rest of the legal system (ordenamiento jurídico), so too do the judgments of the constitutional jurisdiction that interpret, apply, and safeguard the Fundamental Law.

When approving the Ley de la Jurisdicción Constitucional, the Legislature understood the importance of this forum and, moreover, anticipated that this Court’s judgments, because of the aforementioned authority and in view of the effects of abruptly annulling a rule, might need to be tailored in cases involving declarations of unconstitutionality. The Legislature therefore created legal mechanisms to ensure that judgments of unconstitutionality would be enforced in harmony with the Constitution without overlooking their material effects in practice.

By way of example, section 93 provides that the provision contained in Article 91 (as it concerns the retroactive effect of declarations of unconstitutionality) shall not apply to legal relationships or situations that have become final due to a statute of limitations (prescripción) or lapse (caducidad), by virtue of a judgment having acquired the authority of substantive res judicata (cosa juzgada material), or through their factual consummation, where they are materially or technically irreversible or where their reversal would seriously affect rights acquired in good faith. The provision then states, “all the foregoing without prejudice to the powers of the Chamber, in accordance with that article” (referring to section 91).

Now, for purposes of deciding the matter sub examine, section 91 is precisely a clear example of the Legislature’s foresight in taking into account the impact of the Chamber’s judgments when they declare a rule unconstitutional. The first paragraph of that provision establishes the general rule that a declaration of unconstitutionality has ipso iure and ex tunc effect:

“Article 91. A declaration of unconstitutionality shall have declaratory effect and shall be retroactive to the date on which the act or rule entered into force, without prejudice to rights acquired in good faith.” It then, however, modulates those effects (modula tales efectos) by providing:

“A constitutional judgment of annulment (sentencia constitucional de anulación) may calibrate and tailor its retroactive effect as to territory, time, or subject matter, and shall establish the rules necessary to prevent it from causing serious disruptions to social security, justice, or peace.” Section 91 thus confers broad powers upon the Chamber. Specifically, on the one hand, it may “calibrate and tailor as to territory, time, or subject matter” the retroactive effect of its judgments; on the other, it may establish “the rules necessary to prevent it from causing serious disruptions to social security, justice, or peace.” Based on that legislation, constitutional case law has held that the tailoring of effects (dimensionamiento) also operates prospectively, which is entirely consistent and necessary, since the ratio iuris of that power lies in modulating the effects of declarations of unconstitutionality, which clearly have the capacity to affect the past, the present, and the future (see judgments 2015-012250 of 11:30 hours on August 7, 2015, 2015-018537 of 10:20 hours on November 25, 2015, 2006-07965 of 16:58 hours on May 31, 2006, and 2005-013914 of 15:08 hours on October 11, 2005). We will later discuss the typology of normative judgments (sentencias normativas) resulting from the modulation of the effects of judgments declaring unconstitutionality.

Similar criteria are found in other legal systems (for example, Article 140.5 of the Federal Constitutional Law of Austria), as well as in rulings with deferred effects issued by the constitutional courts of other countries. For example, the Constitutional Court of Italy uses several types of exhortative judgments (sentencias exhortativas). In some, the court rules on the need to bring the law into conformity with the Constitution, urges the legislature to do so, and at the same time warns the Legislative Branch that, if it fails to act in accordance with the Court’s recommendation, the challenged provision will be declared unconstitutional the next time it is challenged. In others, although the Court recognizes that the challenged provision is unconstitutional, it does not so declare because it weighs the probable adverse effects of a hypothetical immediate judgment of dismissal (sentencia desestimatoria) (this is then referred to as provisional constitutionality (constitucionalidad provisional)).

Likewise, the Constitutional Court of Spain has resorted to judgments of deferred unconstitutionality (sentencias de inconstitucionalidad diferida). It has thus held that a provision may be declared unconstitutional while simultaneously establishing a deferred or prospective period after which the law will be definitively annulled (judgments 45/1989, 13/92, 195/98 and 209/99, among others). In particular, in judgment 195/98, although Ley 6/1992 was deemed unconstitutional because its enactment had been carried out by the Central Government rather than by the Autonomous Community of Cantabria, the legislation was temporarily kept in force because an immediate declaration of unconstitutionality “could cause serious harm to the natural resources of the area in dispute.” In Germany, although Section 35 of the Federal Constitutional Court Act generally permits that court to regulate the enforcement of its judgments, it is no less true that there is no provision authorizing it to defer the effects of judgments of unconstitutionality, much less to grant Parliament a period within which to enact a particular law.

Nevertheless, beginning with the judgment of 11 May 1970 (BVerfGE 28, 227), case law created the so-called “verfassungsgerichtliche Unvereinbarerklärung verfassungswidriger Gesetze” (declaration of incompatibility of unconstitutional laws), whose practical consequence has been the possibility, on an exceptional basis, of provisionally applying a provision declared unconstitutional. This type of normative judgment (sentencia normativa) was incorporated into positive law through the reform of 21 December 1970 to the Federal Constitutional Court Act, although to date neither that reform nor any subsequent reform has regulated its effects. The aforementioned gap in positive law therefore persists to this day, as German legal scholarship generally recognizes. Even so, judgments of incompatibility (sentencias de incompatibilidad), as a normative reality, are now part of German legal doctrine; they have been used in case law, among other circumstances, when, in view of the particular features of the provision declared unconstitutional, constitutional-law considerations make its temporary or provisional application necessary to avoid creating a situation even further removed from the constitutional order or giving rise to a serious problem of legal certainty.

For example, in BVerfGE 109, 64 (judgment of 18 November 2003), Section 14(1)(1) of the Maternity Protection Act was declared incompatible with the Constitution. That legislation provided that women were to receive their full salary before and after childbirth. The costs were divided between the state and the employer: the former was required to contribute 25 DM per day, while the latter was responsible for covering the difference in salary. When the law was enacted in 1968, that difference amounted to 13 DM, but by 2000 it had risen to 88,60 DM. As a result of the additional costs to employers, women had fewer opportunities to be hired. This was found unconstitutional because it violated the rights to equality and freedom to work. However, the Legislature was granted until 31 December 2005 to enact a constitutional law; in the interim, the provision incompatible with the Constitution remained in force.

Similarly, the Supreme Court of the United States of America has resorted to a variant of this type of judgment. For example, in the above-mentioned racial-discrimination case Brown v. Board of Education of Topeka (discussed in the preceding recital (considerando)), in addition to the judgments of 17 May 1954 and 31 May 1955 being classified as structural judgments (sentencias estructurales), they may also be viewed as a type of exhortative judgment—particularly Brown II—because the United States Supreme Court concluded that eliminating discrimination in public schools where African American and white students were segregated required more than the annulment of a provision; it required a variety of measures to be undertaken by different agencies. In Peru, the Constitutional Court has applied judgments with deferred effects (sentencias de efectos diferidos) when changing precedent. Thus, in a judgment of 10 October 2005, it ruled: “The Constitutional Court may exceptionally order that a binding precedent (precedente vinculante) that changes or replaces an earlier precedent take effect after a deferred period (vacatio sententiae), in order to safeguard legal certainty or prevent an inherent injustice that could arise from a sudden change in the binding rule established by the Court and complied with and enforced by litigants and public authorities.

Indeed, the decision to grant expressly and residually prospective effect is made by the Constitutional Court for the purpose of addressing constructively and prudently the sometimes conflicting relationship between continuity and change in adjudication of a constitutional nature. The technique of giving prospective effect to binding precedent seeks, on the one hand, not to undermine the commitment to fidelity and respect shown by litigants and public authorities toward the prior precedent and, on the other, to foster the conditions necessary for adapting to the rules contained in the new binding precedent.” Likewise, the Constitutional Court of Colombia has repeatedly issued judgments with deferred effects, a variant of exhortative judgments. Thus, in judgment C-366 of 2011, the Court determined that Ley 1382 de 2010, which had amended Ley 685 de 2001 Código de Minas, was unconstitutional because prior consultation (consulta previa) with Indigenous and Afro-descendant peoples had been omitted.

Nevertheless, because, on the one hand, an interpretive judgment filling the statutory gap (sentencia integradora) was not legally feasible and, on the other, the immediate unconstitutionality of the challenged regulations would leave a regulatory gap concerning environmental matters in the mining sector—which would create a serious and undesirable situation for environmental protection—the Court held that the effects of the provision’s unconstitutionality would be deferred for two years, “…so that, at the initiative of both the Government and the Congress of the Republic and within the scope of their respective powers, they may proceed with legislative measures aimed at reforming the Código de Minas, after completing a prior-consultation procedure with Indigenous and Afro-Colombian communities, under the terms of Article 330 of the Political Constitution.” See also judgments C-818 of 2011, C-720 of 2007 and C-737 of 2001, among many others.

For its part, the Supreme Court of Justice of the Argentine Nation, in Rosza, Carlos Alberto et al. (decided by judgment of 23 May 2007), declared unconstitutional the system of interim judicial appointments (régimen de subrogancias) (replacement of judges) approved by the Council of the Judiciary. Nevertheless, given the decision’s impact on pending proceedings, it ordered that the affected substitute judges remain in office until the reasons giving rise to their appointments ceased to exist or until they were replaced or confirmed through a constitutionally valid procedure, in accordance with the guidelines established in that judgment. “Under no circumstances may those substitute judges remain in office beyond a period of one year from notification of this ruling, during which time Congress and the Executive Branch, in the exercise of their powers, shall establish a definitive system governing the matter in dispute, in strict compliance with the constitutional parameters already examined.” In legal scholarship, the constitutional case law and developments that have led to this type of atypical judgment (sentencia atípica) have been compiled, systematized, and classified.

For example, taking Néstor Pedro Sagüés’s criterion as a basis, but with certain adjustments, these judgments may be classified as “exhortative,” and may in turn be subdivided as follows: A) The delegating exhortative judgment (sentencia exhortativa de delegación), which declares a provision unconstitutional and advises the Legislative Branch of the standards that it should meet when enacting a new law compatible with the Constitution. In this type of judgment, the issuance of provisional minimum regulations has been permitted when required by the legal lacuna (laguna jurídica) resulting from the annulment of the challenged provision (an example of this position is judgment 2013-011499 of 16:00 hours on 28 August 2013). B) The exhortative judgment based on precarious constitutionality (sentencia exhortativa por constitucionalidad precaria), in which the constitutional jurisdiction (jurisdicción constitucional) considers that the challenged provision remains constitutional but may soon cease to be so, or that it is not entirely satisfactory from a constitutional standpoint.

The Constitutional Court therefore urges the legislature to enact new regulations that are fully constitutional and may also provide substantive guidelines for doing so (in Germany, this type of judgment is known as an “Appellentscheidung”). C) The exhortative judgment of simple unconstitutionality (sentencia exhortativa de inconstitucionalidad simple), called “Unvereinbarerklärung” in German legal scholarship, in which the Constitutional Court, although finding a provision unconstitutional, does not invalidate it (for various reasons, such as the adverse effects of sudden annulment, or when the unconstitutionality lies not in the provision itself but in a normative relationship whose resolution falls to the Legislature), but does impose on the Legislative Branch the duty to remedy the unconstitutional situation by approving a bill that restores harmony with the Constitution. Thus, the law deemed unconstitutional continues to be applied for a certain period until new legislation consistent with the Constitution is enacted. As will be shown below, the decision made in the case at bar (sub judice) falls within this latter type of exhortative judgment.

Indeed, a typical case of a hortatory judgment of simple unconstitutionality (sentencia exhortativa de inconstitucionalidad simple) arises when the annulment of the challenged provision (norma impugnada) does not, in and of itself or automatically, restore a situation of constitutional normality, but instead requires the cooperation of the Poder Legislativo. That is the case here, where the unconstitutionality of the challenged provision does not ensure the protection of the right to the environment. Accordingly, this modulation of effects (dimensionamiento) is undertaken for the purpose of urging the Asamblea Legislativa, in the exercise of its constitutionally assigned powers, to enact, within 18 months from the full publication of this ruling in the Boletín Judicial, a new law regulating the creation and development of the Las Tablillas border post, based on comprehensive technical studies and incorporating the appropriate compensation measures.

IX. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are hereby advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, in accordance with the provisions of the “Regulations on Electronic Case Files before the Judiciary” (“Reglamento sobre Expediente Electrónico ante el Poder Judicial”), approved by the Corte Plena at session N° 27-11 of 22 de agosto del 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 de enero del 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 de mayo del 2012, Article LXXXI.

Por tanto:

The constitutional challenge (acción) is declared GRANTED and, consequently, the Law Regulating the Creation and Development of the Las Tablillas Border Post, Law No. 8803 of 16 de abril de 2010, and its Regulations, Executive Decree No. 38628-MP-H-COMEX-MINAE-SP-G of 16 de setiembre de 2014, are annulled. Pursuant to section 91 of the Ley de la Jurisdicción Constitucional, by majority vote, the effects of this judgment are calibrated and modulated, and the Asamblea Legislativa is urged, in the exercise of its constitutionally assigned powers, to enact, within 18 months from the full publication of this ruling in the Boletín Judicial, a new law regulating the creation and development of the Las Tablillas border post, based on comprehensive technical studies and incorporating the appropriate compensation measures. Justices Salazar Alvarado and Araya García declare the challenge granted, except insofar as a deadline is established for enacting the aforementioned law.

A summary of this judgment shall be published in the Diario Oficial La Gaceta, and the judgment shall be published in full in the Boletín Judicial. Notice shall be served on the petitioner (accionante), the Presidenta de la Asamblea Legislativa or whoever holds that office, the Ministro de la Presidencia, the Ministro de Ambiente y Energía, the Ministerio de Comercio Exterior, the Viceministro de Comercio Exterior in his capacity as president of the Consejo de Puestos Fronterizos Terrestre, and the Procuraduría General de la República.- Fernando Castillo V.

* * SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas del dieciséis de enero de dos mil diecinueve.

Acción de inconstitucionalidad promovida por ÁLVARO SAGOT RODRÍGUEZ, para que se declare inconstitucional la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803, publicada en el Diario Oficial La Gaceta No. 125 de 29 de junio de 2010, así como contra el Reglamento a esa ley, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G, publicado en el Diario Oficial La Gaceta No. 60 de 26 de marzo de 2014, por estimarlos contrarios al derecho protegido en el artículo 50 de la Constitución Política, el principio precautorio, el principio de razonabilidad, de irreductabilidad del bosque, de objetivación y de no regresión. Intervinieron también en el proceso el representante de la Procuraduría General de la República, los representantes del Ministerio de Ambiente y Energía, el Viceministro de Comercio Exterior, el Ministro de la Presidencia y los representantes del Ministerio de Comercio Exterior.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 09:33 horas del 14 de mayo de 2015, el accionante solicita que se declare la inconstitucionalidad de: a) la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803 publicada en el Diario Oficial La Gaceta No. 125 de 29 de junio de 2010; b) el Reglamento a la Ley No. 8803, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G, publicado en el Diario Oficial La Gaceta No. 60 de 26 de marzo de 2014. Las normas se impugnan en cuanto disponen segregar porciones del Refugio Nacional de Vida Silvestre Corredor Fronterizo, que se ubica en la línea divisoria entre Costa Rica y Nicaragua, para que dichas áreas sean administradas por la Municipalidad de Los Chiles y se dediquen de forma exclusiva a la instalación y operación de instituciones estatales que brinden servicios públicos requeridos para la adecuada operación del puesto fronterizo. Se alega que esta segregación lesiona el derecho a un ambiente sano y ecológicamente equilibrado, especialmente porque para la aprobación de esta ley se careció de un estudio técnico o informe específico que justifique la segregación de estas áreas.
  2. 2A efecto de fundamentar la legitimación que ostentan para promover esta acción de inconstitucionalidad, señalan que proviene de artículo 75 párrafo 2 de la Ley de la Jurisdicción Constitucional en cuanto acude en defensa de los intereses difusos y, en concreto, para la protección del derecho de toda persona a un ambiente sano y ecológicamente equilibrado.
  3. 3Por resolución de las once horas y veintisiete minutos del catorce de mayo de dos mil quince (visible a folio 018 del expediente), se le dio curso a la acción, confiriéndole audiencia a la Procuraduría General de la República y al Ministerio de Ambiente y Energía.
  4. 4Los edictos a que se refiere el párrafo segundo del artículo 81 de la Ley de la Jurisdicción Constitucional fueron publicados en los números 106, 107 y 108 del Boletín Judicial, de los días 03, 04 y 05 de junio de 2015 (folio 035 del expediente)
  5. 5La Procuraduría General de la República rindió su informe (ver folios 27 a 34 del expediente). Señala que: a) Sobre la legitimación: Manifiesta que al tenor de lo dispuesto en el artículo 50 párrafo segundo de la Constitución Política, artículo 75 párrafo segundo de la Ley de la Jurisdicción Constitucional, y la reiterada jurisprudencia de esta Sala sobre el tema de los intereses difusos, la acción es admisible, al enmarcarse en la protección jurídica del ambiente; b) Sobre el fondo del asunto: Manifiesta que la Ley para regular la creación y desarrollo del “Puesto Fronterizo las Tablillas” No. 9223 de 20 de marzo de 2014 reduce la superficie del Refugio Nacional de Vida Silvestre creado mediante Decreto No 22962-MIRENEM del 15 de febrero de 1994, excluyendo de sus límites una superficie cercana a las 10 hectáreas, en dos porciones separadas por la carretera. Indica que los levantamientos topográficos incorporados al segregados como de arroz o agricultura y pasto.El informe “Solicitud de Reducción del Área del Refugio Nacional de Vida Silvestre Corredor Fronterizo” de setiembre de 2007, describe un área con pendientes de 5%, sin riesgo de inundaciones, y las siguientes características: “Básicamente lo que existe es pasto natural y terreno limpio cultivado o listo para siembra. Cuenta con muy pocos árboles aislados y no existe dentro de esta área cobertura boscosa o en proceso de regeneración natural. Indica que para la reducción de un área silvestre protegida debe cumplirse con que se haga por medio de ley y previa realización de estudios técnicos suficientes que justifiquen la medida. Señala que en la Opinión Jurídica No OJ-98-2009 dado por la Procuraduría durante la tramitación del proyecto que culminó en la Ley en estudio, se analizó el estudio técnico incorporado al indicando: “…respetuosamente debe señalarse que dicho informe técnico no reúne los requerimientos necesarios para fundamentar el proyecto que se consulta.Nótese que el mismo hace un estudio sobre las 236 hectáreas que se proponían inicialmente y concluye que el proyecto no es viable desde el punto de vista ambiental y social. Sin embargo, dicho estudio no produce sobre las 13 hectáreas que se proponen, o en otras palabras, no existe a la fecha, un criterio técnico que se refiera a los motivos por los cuales sí es viable la segregación de las 12.3 hectáreas que se establecen en el proyecto de ley consultado. El requerimiento del artículo 38 de la Ley Orgánica del Ambiente es claro, y debe contarse con estudios técnicos que justifiquen la reducción de las áreas silvestres protegidas, por lo que en este caso específico lo que corresponde es que el MINAET se pronuncie nuevamente sobre el tema, pero esta vez sobre el área que se propone de 12.3 hectáreas, según las coordenadas descritas en el proyecto de ley.” Considera que a pesar de lo anterior, es importante constatar en la justificación técnica que suministre el Ministerio de Ambiente y Energía el fundamento técnico y científico de la Ley No. 8803.Sobre la violación al principio constitucional de compensación, señala que si bien la Sala ha establecido que otro requisito para poder realizar la reducción es la compensación del área suprimida con otra de igual tamaño. No obstante, considera que una inconstitucionalidad por violación a este principio no se resuelve necesariamente con la anulación de la Ley, si se califica como una inconstitucionalidad por omisión, bastaría que esta Sala dispusiera en sentencia adicionar al Refugio la porción que compense el área suprimida. Considera que la información que brinde el Minae será indispensable para analizar los alegatos del accionante relativos al principio de irreductibilidad del bosque y protección del paisaje, lo anterior por cuanto en el documento “Solicitud de Reducción del Área de Refugio Nacional de Vida Silvestre Corredor Fronterizo” se describe que “Los terrenos aledaños a la carretera se encuentran ocupados por numerosas familias… de parceleros nacionales y extranjeros.Las parcelas, en su mayoría son de poca extensión, están sembradas con productos de subsistencia, los ecosistemas importantes que colindan con la carretera al Puesto Fronterizo de Tablillas”. Se concluye que1) Es competencia exclusiva de esta Sala constatar la suficiencia del sustento técnico justificante de la reducción del Refugio Nacional de Vida Silvestre, así como valorar si se cumple el principio de razonabilidad, para posteriormente determinar la procedencia de la demolición solicitada.2) En caso de que esta Sala concluya la carencia de fundamento científico y técnico de la Ley No 8803, se estima procedente la declaratoria de la inconstitucionalidad del Decreto No. 38628-MP-COMEX-MINAE-SP-G.3) Hay inconstitucionalidad por omisión de compensar el área suprimida con otra de igual tamaño, la cual podría solventarse con una adición.4) No se constata la lesión al artículo 89 de la Carta Magna ni al principio de irreductibilidad del bosque.
  6. 6Rinde su informe Edgar E. Gutiérrez Espeleta, en su calidad de Ministro de Ambiente y Energía (ver folios 37 a 46 del expediente electrónico) y señala: Esta ley nace de un proyecto con el fin de crear y desarrollar un puesto fronterizo entre Costa Rica y Nicaragua, ubicado en la comunidad de las Tablillas de Los Chiles, y que se asentaría en un área de terreno que actualmente forma parte del Refugio Nacional de Vida Silvestre Corredor Fronterizo, creado mediante Decreto Ejecutivo No 22962-MIRENEM del 15 de febrero de 1994 y modificado por el Decreto Ejectivo No 23248-MIRENEM del 20 de abril del mismo año. Indica que el área en discusión goza de una vocación especial por ser parte del patrimonio natural del Estado al haber sido declarado Refugio Silvestre por lo que no es susceptible de ocupación privada, por lo que los terrenos de esa naturaleza deben adquirirse por compra o expropiación por parte del Estado.Expresa que lo que se pretendía no es la desafectación del dominio público de la zona en cuestión, sino autorizar la utilización de una porción del área para otro destino de interés público, que es la instalación de un puesto fronterizo y aduanal, en el sentido que se trata de construcciones del Estado y no privadas. Indica que en marzo de 2007 la Comisión de Puesto Fronterizo, como producto de una serie de sesiones, estudios e investigación, y siguiendo la experiencia del puesto Fronterizo Peñas Blancas, propone que el área que se debe desafectar es una franja de terreno medida del centro de la carretera 250 metros a cada lado hasta salir del Corredor Fronterizo, comprendiendo un total de 236 hectáreas. Indica que la Ley Orgánica del Ambiente permite reducir la superficie de las áreas silvestres protegidas, pero impone dos requisitos: que se debe cumplir el principio de reserva de ley y que exista un estudio técnico que justifique la medida.Manifiesta que el 28 de setiembre de 2007 se emite el informe técnico elaborado por la comisión Caso Tablillas, denominado “Solicitud de reducción del área del Refugio Nacional Corredor Fronterizo” que propone un área a desafectar de 13 hectáreas limítrofes con la línea fronteriza, por cuanto los funcionarios del Área de Conservación Arenal Huetar Norte consideraron inviable la segregación del área indicada de 236 hectáreas, concluyendo al final del informe que un área de 13 hectáreas sería una propuesta más viable desde el punto de vista de impacto a los ecosistemas presentes en el sitio y alrededores. Manifiesta que en el informe se consideraron los aspectos biofísicos como el tipo de suelo, uso actual topografía, existencia de humedales, etc. El área desafectada es muy pequeña en relación con la extensión del Refugio, además ya había sufrido un cambio de uso por lo que no se requería eliminación de bosque ni humedales.En los aspectos socioeconómicos, de desafectarse la totalidad del área solicitada se corría el riesgo de causar un impacto social importante pues hay una gran cantidad de familias que viven a orillas de la carretera, dentro del área propuesta. Manifiesta que por parte del Ministerio de Ambiente y Energía se realizó el informe técnico acerca de la viabilidad de segregación de las 13 hectáreas, el cual fue avalado por el Consejo Regional del Área de Conservación Huetar Norte, dentro del proceso de aprobación de Ley que realizó la Asamblea Legislativa. Solicita se desestime la presente acción de inconstitucionalidad.
  7. 7Mediante resolución de las dieciséis horas y veintiuno minutos del veintinueve de junio del dos mil quince se tuvieron por contestadas las audiencias conferidas a la Procuraduría General de la República y al Ministerio de Ambiente y Energía, y se tiene como coadyuvantes pasivos en esta acción al Ministro de la Presidencia, al Ministro de Comercio Exterior y al Viceministro de Comercio Exterior en su condición de presidente del Consejo de Puestos Fronterizos Terrestre.
  8. 8Manifiestan Alexander Mora Delgado en su condición de Ministro de Comercio Exterior, y Jhon Fernando Fonseca Ordoñez en su condición de Viceministro de Comercio Exterior, coadyuvantes pasivos de la presente acción de inconstitucionalidad indicando tras realizar recorridos dentro de los Lotes 1 y 2 segregados por la Ley No 8803 del 16 de abril de 2016, como en los alrededores de estos, se desarrollan actividades agropecuarias dentro del área declarada patrimonio forestal del Estado y que forma parte del Refugio Nacional de Vida Silvestre Corredor Frontera Norte, destacando que no se nota la presencia de cobertura boscosa primaria o secundaria en los Lotes 1 y 2 ni en las áreas aledañas a éstas, siendo que, en los mencionados Lotes, únicamente existe cobertura tipo tacotal (matorral espeso), pastizales de altura media, uno que otro arbusto y palmas originarias de la zona. En las áreas circundantes se acentúa la presencia de extensas llanuras dedicadas a la siembra de arroz, yuca, maíz y caña de azúcar, entre otros productos y a actividades pecuarias de pastoreo y repasto para engorde de ganado.Asimismo, en dichas áreas colindantes con el Puesto Fronterizo Las Tablillas, se encuentran tanto asentamientos humanos temporales como permanentes. Los primeros están relacionados con las actividades agropecuarias que desarrollan en la zona los vecinos de Las Tablillas y Los Chiles, en cuyo caso, se trata de bodegas para almacenar herramientas e insumos agropecuarios, mientras que en el segundo caso, se tienen casas de habitación a las cuales se accede desde la calle pública, las cuales cuentan con algunos servicios públicos. Todo lo anterior ocurre a menos de un kilómetro de la línea fronteriza, por lo tanto se llevan a cabo dentro del Refugio Nacional de Vida Silvestre Corredor Frontera Norte desde antes de la emisión de la Ley No 8803 el 16 de abril de 2010 o bien, incluso muchos años antes de la realización de los estudios que constan en el Informe Técnico Solicitud de reducción del área del Refugio Nacional de Vida Silvestre Corredor Fronterizo, que recmienda ubicar el Puesto Fronterizo en el área identificada por el lote 1 y 2, toda vez que no existe ningún ecosistema de importancia y frágil, tipo humedal, bosque primario o secundario, ríos, quebradas, etc, que se puedan afectar con un posible desarrollo de infraestructura.
  9. 9Manifiestan Sergio Iván Alfaro Salas en su condición de Ministro de la Presidencia, y Alexander Mora Delgado en su condición de Ministro de Comercio Exterior, coadyuvantes de la presente acción de inconstitucionalidad indicando que dado que el Instituto Costarricense sobre Drogas es un órgano de desconcentración máxima adscrito al Ministerio de la Presidencia, y que por tanto es de interés directo para éste en razón de la relación de dirección interorgánica, el manejo que se le de al tema de la lucha contra el narcotráfico, lo que en el caso del presente se materializa en el Puesto Fronterizo Las Tablillas. Con relación al Ministerio de Comercio Exterior manifiesta que es de interés en cuanto el Puesto Fronterizo Las Tabillas sirve como punto estratégico para facilitar el comercio con Nicaragua, Centroamérica y México, por lo que su funcionamiento resulta clave. Indican que mediante el Decreto Ejecutivo No 22962-MIRENEM del 15 de febrero de 1994, reformado por el Decreto Ejecutivo.En cuanto a los hechos: La protección especial de la franja fronteriza de 2.000 metros para fines ambientales no es la única causa para mantener dentro del dominio del Estado estas áreas, pues el régimen histórico que actualmente pesa en conjunto con el ambiental para estas áreas se relacionaba inicialmente más con la defensa de la soberanía y seguridad nacional (lo cual se desprenden además del voto número 2988-99 de la Sala Constitucional). En los folios del 76 al 94 del 2007 por el MINAE. EL sitio identificado reúne las condiciones aptas para el desarrollo del proyecto de un Puesto Fronterizo por cuanto ya había sido impactada por la acción humana, hecho que se comprueba con la no existencia de ecosistemas de importancia o frágiles, la no presencia de cobertura boscosa primera o secundaria, ni de humedales o cursos de agua, sino únicamente de pastos naturales y terreno limpio para cultivo o listo para siembra.Además el área es técnicamente estratégica para la ubicación del Puesto Fronterizo por la cercanía con la línea limítrofe y la existencia de vías de comunicación para el desplazamiento interno (caminos) y una carretera nacional conectada a la vía del lado nicaragüense de la frontera. No lleva razón el accionante al señalar que no existieron estudios ambientales que justificaran la reducción del área protegida, que representa un 0,02% del área total. Además la ley impugnada no desafectó el área segregada del dominio público. El proyecto “Puesto Fronterizo Las Tablillas” surge por la necesidad de darle cauce ejecutivo a intereses binacionales de los Gobiernos de Nicaragua y Costa Rica, con el fin de dotar de una vía terrestre que contribuya, entre otros efectos esperados, con el desarrollo fronterizo en San Carlos de Nicaragua y Los Chiles de Costa Rica. Con miras a la gestión del permiso ambiental para el proyecto los profesionales realizaron una inspección de campo el 25 de setiembre del 2014, indicando que, dadas las características del terreno no se estimaba se requiere un estudio biológico exhaustivo, pero sí valoraron tomar algunas medidas preventivas como no capturar animales silvestres, disponer de desechos sólidos, evitar derrame de aceites en maquinaria, adecuado manejo de suelos.La pretensión de demolición de la infraestructura pública causaría la inmediata desprotección del orden, la paz, la salud, el desarrollo sostenible, la vida y la dignidad humana. Por lo demás, no existe una obligación del Estado de compensar un área ya deforestada e impactada con otra, toda vez que nunca se dio una reducción del bosque ni una afectación al ambiente que justificare la medida de la compensación. No es admisible el argumento del accionante de que la norma implica medidas regresivas en materia ambiental, pese a que la misma es progresiva en materia de derechos humanos. Solicita declarar sin lugar la acción.
  10. 10Se prescinde de la vista señalada en los artículos 10 y 85 de la Ley de la Jurisdicción Constitucional, con base en la potestad que otorga a la Sala el numeral 9 ibídem, al estimar suficientemente fundada esta resolución en principios y normas evidentes, así como en la jurisprudencia de este Tribunal.
  11. 11En los procedimientos se ha cumplido las prescripciones de ley.

Redacta Magistrado Cruz Castro; y,

Considerando:

I.Objeto de la impugnación.- El accionante impugna la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803, publicada en el Diario Oficial La Gaceta No. 125 de 29 de junio de 2010, así como contra el Reglamento a esa ley, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G, publicado en el Diario Oficial La Gaceta No. 60 de 26 de marzo de 2014. En cuanto a la identificación de la ley impugnada, debe aclararse que se observó un error material en el informe que rindió la Procuraduría General de la República, pues inicialmente consignó erróneamente el número de ley, pero luego la identifica correctamente. Así que esta Sala advirtió el error, y entiende, por el fondo de lo informado y porque luego se consignó correctamente, que se trató de un error material y que el informe de la Procuraduría se refiere a la Ley no.8803, objeto de esta acción.

Estima el accionante que tales normas son inconstitucionales en virtud de que violan el derecho protegido en el artículo 50 de la Constitución Política, el principio precautorio, el principio de razonabilidad, de irreductabilidad del bosque, de objetivación y de no regresión. Señala que el 15 de febrero de 1994 el Poder Ejecutivo dispuso la creación del Refugio Nacional de Vida Silvestre corredor fronterizo, conformado por los terrenos comprendidos a lo largo de la frontera con Nicaragua (Decreto n°22962-MIRENEM). Ese refugio se estableció para proteger la biodiversidad y el paisaje en la zona fronteriza norte de Costa Rica. Sin embargo, el 29 de junio del 2010 la Asamblea Legislativa emite la Ley impugnada, segregando y reduciendo varias hectáreas del refugio, sin que existan estudios ambientales que justificaran esa acción. Por lo que estamos frente a una regresión, al segregar una zona que es patrimonio natural del Estado, y desnaturalizando los fines protectores de la biodiversidad. Indica que, el Convenio para la Conservación de la Biodiversidad y Protección de Aéreas Silvestres Prioritarias en América Central (Ley 7433) incluso obliga a dar especial protección a zonas protegidas fronterizas. Agrega además que, tampoco se dictaron medidas de compensación. Se impugna toda la ley, la cual establece literalmente lo siguiente:

“ARTÍCULO 1.- Segregación Segrégase del Refugio Nacional de Vida Silvestre Corredor Fronterizo, creado mediante Decreto Ejecutivo N.º 22962-Mirenem, de 15 de febrero de 1994, y modificado por decreto ejecutivo N.º 23248-Mirenem, de 20 de abril del mismo año, y ubicado en la línea divisoria entre las Repúblicas de Costa Rica y Nicaragua, un área total de ciento veintiún mil doscientos treinta y siete metros con veintitrés centímetros cuadrados, según el levantamiento topográfico mencionado más adelante.

El área total por segregar se divide en dos subáreas que se ubican entre los puntos uno y veintinueve y uno y catorce, respectivamente, del cuadro que se detalla a continuación:

(…)

ARTÍCULO 2.- Administración El área segregada será administrada por la Municipalidad de Los Chiles y se dedicará exclusivamente a la instalación y operación de las instituciones del Estado prestadoras de los servicios públicos requeridos para la adecuada operación del puesto fronterizo.

Se autoriza a las instituciones del Estado para que faciliten y den todo tipo de asesoramiento y colaboración a la Municipalidad de Los Chiles, así como a la Municipalidad indicada para gestionar y recibir este asesoramiento y colaboración, con el propósito de asegurar el levantamiento de todo tipo de infraestructura y la efectiva operación del puesto fronterizo.

Asimismo, la Municipalidad y las instituciones públicas que utilizarán este espacio quedan facultadas para ceder los derechos de uso y usufructo a fideicomisos de titularización o figuras similares, en el caso en que se considere necesario o conveniente este instrumento o mecanismo para llevar a cabo la construcción o levantar las obras de infraestructura requeridas para el efectivo funcionamiento del puesto fronterizo.

ARTÍCULO 3.- Amojonamiento El Ministerio de Ambiente, Energía y Telecomunicaciones (Minaet), con base en el levantamiento topográfico de previa cita, amojonará el área segregada del Refugio Nacional de Vida Silvestre Corredor Fronterizo, a fin de salvaguardar, de los posibles efectos nocivos del desarrollo humano, el área que continúa afectada por la declaratoria de área silvestre protegida.

ARTÍCULO 4.- Autorización Autorízase al Poder Ejecutivo para que realice las gestiones necesarias para establecer un puesto aduanal y migratorio en la zona segregada.

ARTÍCULO 5.- Reglamentación El Poder Ejecutivo reglamentará esta Ley en un plazo máximo de sesenta días, contado a partir de su publicación en La Gaceta.

Rige a partir de su publicación.”

II.La legitimación en este caso.- El accionante ostenta legitimación suficiente para demandar la inconstitucionalidad de las normas impugnadas, sin que para ello resulte necesario que cuente con un asunto previo que le sirva de base a esta acción. Lo anterior porque acude en defensa de un interés que atañe a la colectividad nacional en su conjunto, como lo es el derecho al ambiente. Por lo que se encuentra perfectamente legitimado para accionar en forma directa, a la luz de lo que dispone el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional. Asimismo, s e trata de materia cuya constitucionalidad procede revisar en esta vía , pues se refiere a normas legales y reglamentarias. Además, se cumplió con los requisitos estipulados en los numerales 78 y 79 de la Ley de rito. En conclusión, la presente acción es admisible, por lo que debe entrarse de inmediato a discutir el objeto y el fondo del asunto.

III.Sobre la metodología de análisis de la acción.- Para facilitar el estudio de la normativa impugnada, en los considerandos siguientes se analizará primero los alcances generales de las normas impugnadas, luego la jurisprudencia de esta Sala sobre la suficiencia de informes técnicos, para finalmente entrar al examen concreto de los alegatos de inconstitucionalidad.

IV.En general sobre la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas (Ley No. 8803) y sobre su Reglamento (Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G).- Mediante Decreto No. 22962-MIRENEM del 15 de febrero de 1994, el Poder Ejecutivo dispuso declarar el corredor fronterizo de la frontera con Nicaragua como un Refugio Nacional de Vida Silvestre, al considerar la zona como un importantísimo corredor biológico. Así, dicha área entra a formar parte del patrimonio natural del Estado, que como tal, no es susceptible de ocupación privada. Luego viene la ley impugnada, Ley para regular la creación y desarrollo del “Puesto Fronterizo las Tablillas”, No. 9223 de 20 de marzo del 2014, que se presentó con el fin de crear y desarrollar un puesto fronterizo entre Costa Rica y Nicaragua, ubicado en las Tablillas del Cantón Los Chiles. Puesto que se asentaría en un área de terreno que forma parte del Refugio Nacional de Vida Silvestre Corredor Fronterizo.

Para ello, la ley reduce la superficie del Refugio Nacional de Vida Silvestre, excluyendo de sus límites una superficie cercana a las 13 hectáreas, en dos porciones separadas por la carretera. Por su parte, el reglamento a dicha ley, el Decreto No. 38628-MP-COMEX-MINAE-SP-G, promueve la participación de las instituciones estatales en la habilitación de la infraestructura y la puesta en operación del Puesto Fronterizo Las Tablillas.

V.Jurisprudencia sobre la reducción de áreas protegidas, la suficiencia de los informes técnicos y la debida compensación.- Sobre la reducción de zonas protegidas, de la jurisprudencia de esta Sala se tiene lo siguiente:

1. Requisitos constitucionales para la reducción de área silvestre protegida (reserva legal y estudios técnicos): En apoyo del artículo 38 de la Ley Orgánica del Ambiente (“la superficie de las áreas silvestres protegidas, patrimonio natural del Estado, cualquiera sea su categoría de manejo, sólo podrá reducirse por Ley de la República, después de realizar los estudios técnicos que justifiquen esta medida ”), ha habido una sólida línea jurisprudencial, en el sentido de que para la reducción de un área silvestre protegida, en cualquiera de sus categorías de manejo (en cuenta los refugios nacionales de vida silvestre), deben cumplirse dos requisitos esenciales: “por medio de ley y previa realización de estudios técnicos suficientes que justifiquen la medida.” (Sala Constitucional, votos números 13367-2012 y 010158-2013. En similar sentido, las sentencias números 7294-1998, 11155-2007, 1056-2009, 18702-2010 y 14772-2010, entre otras). Tal como se dijo en la resolución mencionada de 1998:

““(…)una vez declarada una determinada área como zona protectora por un acto del Estado, no puede éste, simplemente, desafectarlo en todo o en parte, para proteger otros intereses -públicos o privados- en menoscabo del disfrute de un ambiente sano, de conformidad con lo dispuesto en el artículo 50 constitucional. Ahora bien, el hecho de que una norma, del rango que sea, haya declarado como zona protectora una determianda área, no implica la constitución de una zona pétrea, en el sentido de que, de manera alguna, su cabida pueda ser reducida por una normativa posterior. Sin embargo, se debe tener presente que la declaratoria y delimitación de una zona protectora, en cumplimiento de lo preceptuado en el artículo 50 constitucional, implica una defensa del derecho fundamental al ambiente y, por ello, la reducción de cabida no debe implicar un detrimento de ese derecho, situación que debe establecerse en cada caso concreto.

No resulta necesariamente inconstitucional el hecho de que por medio de una ley posterior se reduzca la cabida de una zona protectora, una reserva forestal, un Parque Nacional o cualesquiera otros sitio de interés ambiental, siempre y cuando ello esté justificado en el tanto no implique vulneración al derecho al ambiente. Podría ser que, por diversas circunstancias, un determinado sitio haya perdido, al menos en parte, el interés ambiental que, en su momento, provocó, lo que, hechos los estudios del caso, justificaría su modificación o reducción, todo en aplicación del principio de razonabilidad constitucional…” (voto No. 7294-1998).

Concretamente sobre la reserva legal en esta materia, en el voto No.14772-2010 se dijo:

(…) no se puede modificar el destino público de un bien del demanio público sin un acto legislativo, es decir, la reducción de área de una zona protegida se encuentra bajo la garantía que proporciona el principio de reserva de ley. Si bien, de conformidad con el artículo 36 de la Ley Orgánica del Ambiente, el Poder Ejecutivo se encuentra autorizado para constituir las Áreas Silvestre Protegidas mediante el cumplimiento de los requisitos establecidos en esa norma, así, el Parque Nacional Corcovado se constituyó mediante los Decretos Ejecutivos No. 5357-A del 24 de octubre de 1975 y 1148-A del 5 de febrero de 1980, su modificación solo podrá hacerse de conformidad con lo dispuesto en el artículo 38 de la Ley Orgánica del Ambiente, previo estudios técnicos y científicos, y mediante un acto legislativo. (resaltado no corresponde al original).

Asimismo, en sentencia no.1056-2009 se indicó que la reducción únicamente es posible vía legal:

“cuando de la ampliación de los límites de las zonas protectoras del patrimonio forestal del Estado se trata es posible hacerlo vía reglamento, pero cuando de su reducción se trata, únicamente se puede hacer vía legal, claro está, siempre y cuando exista un criterio previo que justifique la medida.” (Sentencia de la Sala Constitucional Nº 1056-2009) Lo cual fue aplicado cuando la Sala declaró inconstitucional la norma reglamentaria (Decreto Ejecutivo Nº 32753-MINAE) mediante la cual el Poder Ejecutivo disminuyó el territorio del Refugio Gandoca-Manzanillo, sustrayendo del área y del régimen de protección, la zona urbana del Refugio.

Además, en cuanto a los estudios, estos deben ser previos, suficientes, necesarios e individualizados –como se indica en el apartado siguiente-. Así se dijo en esa misma resolución de 1998:

“De acuerdo con lo citado, mutatis mutandi, si para la creación de un área silvestre protectora la Asamblea Legislativa, por medio de una ley, estableció el cumplimiento de unos requisitos específicos, a fin de determinar si la afectación en cuestión es justificada, lo lógico es que, para su desafectación parcial o total, también se deban cumplir determinados requisitos -como la realización de estudios técnicos ambientales- para determinar que con la desafectación no se transgrede el contenido del artículo 50 constitucional. En este sentido, podemos hablar de niveles de desafectación. Así, no toda desafectación de una zona protegida es inconstitucional, en el tanto implique menoscabo al derecho al ambiente o amenaza a éste. De allí que, para reducir un área silvestre protegida cualquiera, la Asamblea Legislativa debe hacerlo con base en estudios técnicos suficientes y necesarios para determinar que no se causará daño al ambiente o se le pondrá en peligro y, por ende, que no se vulnera el contenido del artículo 50 constitucional.

El principio de razonabilidad, en relación con el derecho fundamental al ambiente, obliga a que las normas que se dicten con respecto a esta materia estén debidamente motivadas en estudios técnicos serios , aún cuando no existiera otra normativa legal que así lo estableciera que contiene el artículo 38 de la Ley Orgánica del Ambiente No. 7554, en el sentido de que para reducir un área silvestre protegida por ley formal deben realizarse, de previo, los estudios técnicos que justifiquen la medida, no es sino la objetivación del principio de razonabilidad en materia de protección al ambiente.” (resaltado no corresponde al original).

2. Estudio técnico como un análisis científico e individualizado: La Sala se ha referido a la suficiencia del estudio técnico, cuando mediante varias resoluciones ha establecido que dicho estudio debe ser un análisis científico e individualizado. Así se dijo lo siguiente:

“el requerimiento de estudios técnicos no es una mera formalidad, sino que se trata de un requisito material, es decir materialmente se tiene que demostrar, mediante un análisis científico e individualizado, el grado de impacto de la medida correspondiente en el ambiente, plantear recomendaciones orientadas a menguar el impacto negativo en este, y demostrar cómo tal medida implica un desarrollo que satisface las necesidades del presente sin poner en peligro la capacidad de las generaciones futuras para atender sus propias necesidades.” (Voto No. 13367-2012. Véase además el No. 10158-2013).

De lo cual se desprende que, el estudio técnico que exige el artículo 38 de la Ley Orgánica del Ambiente y que es la objetivación del principio constitucional de razonabilidad en materia de protección al ambiente, requiere de un análisis técnico que implica un análisis individualizado, el cual debe contener como mínimo las siguientes medidas:

El grado de impacto de la medida correspondiente en el ambiente; Las recomendaciones orientadas a menguar el impacto negativo en el ambiente; La demostración de cómo la medida que se toma, implica un desarrollo que satisface las necesidades del presente sin poner en peligro la capacidad de las generaciones futuras para atender sus propias necesidades.

En síntesis, dicho estudio previo debe demostrar que la desafectación es conforme con la protección constitucional al derecho al ambiente, pues como se dijo en el voto no. 18702-2010 “no se puede permitir que se titulen áreas de esta naturaleza en forma indiscriminada, ya que esto iría contra las mismas políticas conservacionistas del ambiente que ha procurado el Estado en virtud de los cometidos ordenados por la Constitución Política y los Convenios Internacionales que ha suscrito".

3. Medidas de compensación: Un área protegida solo se puede reducir si se hace mediante ley, si hay estudios técnicos y científicos que descarten el daño ambiental y si se da una compensación del área suprimida con otra de igual tamaño. No cabe duda que todas aquellas normas en los cuales hay reducción de las áreas protegidas sin el respaldo de estudios técnicos ni compensación alguna, son inconstitucionales” (voto Nos. 12887-2014, 2773-2014, 2012-13367 y 2009-1056).

VI.Sobre la normativa impugnada.- Tal como se observa, tanto la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803, como su Reglamento, son impugnados en su totalidad, básicamente por dos razones: por no contar con el estudio técnico que sustente la reducción de un área protegida (en este caso un refugio nacional de vida silvestres), y por no establecer medidas de compensación. Cada uno de estos alegatos se examina por separado. SOBRE EL ESTUDIO TECNICO: El accionante indica que la Ley impugnada y su reglamento, están segregando y reduciendo varias hectáreas del Refugio Nacional de Vida Silvestres de la zona fronteriza, sin que existan estudios ambientales que justificaran esa acción. Indica que los diputados tomaron una simple recomendación que nunca puede ser considerado un estudio serio, profundo y amplio que permitiera hacer lo que se hizo. La Procuraduría General de la República en su informe indica que, ya en la Opinión Jurídica de esta Procuraduría No. O.J.-98-2009, emitida el 14 de octubre del 2009 por consulta de los Diputados, durante la tramitación del proyecto que culminó en la Ley No. 8803, analizó el estudio técnico incorporado al expediente en ese momento, considerándolo insuficiente para justificarla: “…respetuosamente debe señalarse que dicho informe técnico no reúne los requerimientos necesarios para fundamentar el proyecto que se consulta.

Nótese que el mismo hace un estudio sobre las 236 hectáreas que se proponían inicialmente y concluye que el proyecto no es viable desde el punto de vista ambiental y social. Sin embargo, dicho estudio no explica en forma alguna, por qué motivo ese impacto negativo no se produce sobre las 13 hectáreas que se proponen, o en otras palabras, no existe a la fecha, un criterio técnico que se refiera a los motivos por los cuales sí es viable la segregación de las 12.3 hectáreas que se establecen en el proyecto de ley consultado…”. El Ministro de Ambiente y Energía indica que no hay inconstitucionalidad. Agrega que, no se pretendía con la ley impugnada la desafectación del dominio público de la zona en cuestión, sino autorizar la utilización de una porción del área para otro destino de interés público, que es la instalación de un puesto fronterizo y aduanal, en el entendido que se trata de construcciones del Estado y no privadas.

Así el 28 de setiembre del 2007 se emite el informe técnico elaborado por la comisión caso Tablillas, denominado “Solicitud de reducción del área del Refugio Nacional Corredor Fronterizo” que propone un área a desafectar de 13 ha limítrofes con la línea fronteriza, por cuanto los funcionarios del Area de Conservación Arenal Huetar Norte consideraron inviable la segregación del área indicada de 236 ha, concluyendo el informe que: “13 hectáreas, sería una propuesta más viable desde el punto de vista de impacto a los ecosistemas presentes en el sitio y alrededores.” Dicho informe consideró aspectos biofísicos, socioeconómicos, seguridad. Concluye que, el balance del costo beneficio de establecer puestos que realicen control y ordenamiento del ingreso migratorio en dicho sector, contribuye a regular el ingreso por la franja demanial coincidente con el Área Silvestre Protegida. Los Ministros de la Presidencia y de Comercio Exterior indican que, en los folios del 76 al 94 del expediente legislativo consta el informe técnico elaborado en setiembre del 2007 por el MINAE.

El sitio identificado reúne las condiciones aptas para el desarrollo del proyecto de un Puesto Fronterizo por cuanto ya había sido impactada por la acción humana, hecho que se comprueba con la no existencia de ecosistemas de importancia o frágiles, la no presencia de cobertura boscosa primera o secundaria, ni de humedales o cursos de agua, sino únicamente de pastos naturales y terreno limpio para cultivo o listo para siembra. Además el área es técnicamente estratégica para la ubicación del Puesto Fronterizo por la cercanía con la línea limítrofe y la existencia de vías de comunicación para el desplazamiento interno (caminos) y una carretera nacional conectada a la vía del lado nicaragüense de la frontera. Al respecto, esta Sala concluye que, en efecto, la Procuraduría General de la República lleva razón en su informe, no existe un estudio técnico que se refiera a la viabilidad de este proyecto, pues el que se realizó se refería a una zona de mayores dimensiones, concluyendo que no resultaba viable desde el punto de vista ambiental y social.

Por ello, debía justificarse por qué la nueva propuesta no generaría problema en los humedales, en las especies de la zona, en los mantos acuíferos y no produce una problemática social, tal como se detectó en la propuesta inicial. El estudio técnico que refieren los Ministros, resulta evidentemente insuficiente, pues no explica en forma alguna, por qué motivo ese impacto negativo no se produce sobre las 13 hectáreas que se proponen, el grado de impacto de la medida correspondiente en el ambiente, las recomendaciones orientadas a menguar el impacto negativo en el ambiente, ni tampoco la demostración de cómo la medida que se toma, implica un desarrollo que satisface las necesidades del presente sin poner en peligro la capacidad de las generaciones futuras para atender sus propias necesidades. Por otro lado, si bien puede ser cierto, como dicen los Ministros en su informe, la propiedad no está saliendo del dominio público, es lo cierto que sí está siendo desafectada, ambientalmente hablando.

También puede ser cierto, como dicen los Ministros en su informe, que además del interés ambiental en la zona fronteriza, pueda haber otros intereses relevantes como la seguridad migratoria y otros. Sin embargo, ello justamente es lo que debió haber contenido el informe técnico en su fundamentación. Nótese que, como indican los Ministros, puede ser cierto que se hayan estado tomando ciertas medidas ambientales, ello no enerva el hecho de la carencia de informe técnico con el que debió contar la ley, que dejan esas medidas ambientales sin sustento técnico requerido. Así entonces, se evidencia la inconstitucionalidad alegada, de la ley impugnada –y por conexidad de su reglamento-, por la carencia de informe técnico suficiente que sustentara la reducción del Refugio Nacional de Vida Silvestre de la zona fronteriza. SOBRE LAS MEDIDAS DE COMPENSACIÓN: El accionante indica que no se estableció en la ley medidas de compensación oportunas, ante la segregación ordenada.

La Procuraduría General de la República en su informe indica que, una inconstitucionalidad por violación a este principio, no se resuelve necesariamente con la anulación de la Ley, si se califica como una inconstitucionalidad por omisión, bastaría que la Sala Constitucional dispusiera en sentencia adicionar al Refugio la porción o porciones que compensen el área suprimida, lo cual podría hacerse incluso por vía reglamentaria. Los Ministros de la Presidencia y de Comercio Exterior indican que, la pretensión de demolición de la infraestructura pública causaría la inmediata desprotección del orden, la paz, la salud, el desarrollo sostenible, la vida y la dignidad humana. Además consideran que no existe una obligación del Estado de compensar un área ya deforestada e impactada con otra, toda vez que nunca se dio una reducción del bosque ni una afectación al ambiente que justificare la medida de la compensación.

Al respecto, esta Sala concluye que, en efecto, también las normas impugnadas son omisas en cuanto a las medidas de compensación. Siendo evidente la segregación de alrededor de 13 hectáreas, conforme lo indica el artículo 1° de la ley impugnada, y aunque éstas no salgan del dominio público, si salieron de una categoría de manejo ambiental, lo cual obligaba a establecer medidas de compensación legales, que no fueron adoptadas, ni garantizadas, según se observa de la lectura de toda la ley. Así entonces, se evidencia la inconstitucionalidad alegada, de la ley impugnada –y por conexidad de su reglamento-, por la carencia de medidas de compensación a la reducción del Refugio Nacional de Vida Silvestre de la zona fronteriza.

VII.En conclusión.- De la jurisprudencia reiterada de esta Sala se tiene que, toda reducción de un área silvestre protegida, en cualquiera de sus categorías de manejo (en cuenta los refugios nacionales de vida silvestre), deben cumplirse tres requisitos esenciales: reserva legal (es decir, sólo por ley puede hacerse), previa realización de estudios técnicos suficientes que justifiquen la medida y establecer medidas de compensación. En este caso se evidenció que la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas (Ley No. 8803) y su Reglamento, procedieron a la segregación, y consecuente reducción, del Refugio Nacional de Vida Silvestre de la zona fronteriza. Sin embargo, aunque se hizo por medio de una ley, no se realizó un estudio previo suficiente que: justificara la medida, estableciera el grado de impacto de la medida correspondiente en el ambiente, las recomendaciones orientadas a menguar el impacto negativo en el ambiente, ni tampoco que demostrara cómo la medida que se toma implica un desarrollo que satisface las necesidades del presente sin poner en peligro la capacidad de las generaciones futuras para atender sus propias necesidades, o estableciera en concreto y detalle medidas de compensación. De todo lo cual se evidencia la inconstitucionalidad por omisión. Procediéndose en este caso a declarar con lugar la acción, con un dimensionamiento de esta sentencia, tal como se indica.

VIII.Sobre el dimensionamiento de esta sentencia.- Al constatarse la inconstitucionalidad, procede declarar con lugar la acción y, en consecuencia, anular del Ordenamiento Jurídico, tanto la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803 de 16 de abril de 2010, como su Reglamento, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G del 16 de setiembre de 2014. Siendo que, con base en el ordinal 91 de la Ley de la Jurisdicción Constitucional, por mayoría, se gradúan y dimensionan los efectos de esta sentencia. En cuanto a la competencia de esta Sala para dimensionar las sentencias, recuérdese que se ha dicho, en votos anteriores (ver voto número 2018-012782 de las 16:45 horas del 08 de agosto del 2018):

El vasto alcance de las declaratorias de inconstitucionalidad surge de la propia teoría jurídica por la cual se ha decantado el Constituyente, quien ha venido a posicionar la Constitución Política como basamento del Estado democrático costarricense y pilar del ordenamiento jurídico nacional. En efecto, la Ley Fundamental contiene los lineamientos cardinales que debe seguir todo el articulado infra constitucional, así como las normas orgánicas que rigen la institucionalidad de nuestro país. La relevancia de la Constitución Política es tal, que su mera interpretación por parte de este Tribunal puede llevar aparejados efectos de peso para la seguridad jurídica, los derechos adquiridos, la actuación de las instituciones públicas, la estabilidad social, entre otros.

Dentro de este contexto, la Sala Constitucional ha sido consciente de la trascendencia de sus decisiones, cuyas ramificaciones pueden incidir en múltiples ámbitos de la sociedad costarricense. En ese sentido, desde los inicios de esta jurisdicción, este Tribunal señaló:

“Nuestro sistema jurisdiccional constitucional sigue una tesis mixta entre el llamado "norteamericano" que simplemente declara la inexistencia o nulidad absoluta de las normas dictadas en contra de la constitución, y el llamado "austriaco" que admite la vigencia y eficacia de la norma hasta su anulación por lo que faculta al Juez a definir los efectos de la declaratoria de inconstitucionalidad, para evitar que situaciones jurídicas consolidadas o derechos adquiridos de buena fe sean afectados. En efecto, el artículo 11 faculta a esta Sala a declarar la inconstitucionalidad de las normas a cualquier naturaleza, y el artículo 91 de la Ley de la Jurisdicción Constitucional define como ya se dijo, el efecto declarativo y retroactivo de la sentencia de inconstitucionalidad, y además faculta a la Sala a graduar los efectos de esta sentencia para evitar "graves dislocaciones de la seguridad, la justicia o la paz sociales" con lo que se demuestra que la norma aunque es inconstitucional por vicio originario, surtió efectos que prevalecen en el tiempo y en el espacio.” (Sentencia N° 1990-001409 de las 14:27 horas del 26 de octubre de 1990).

La normativa que regula la jurisdicción constitucional reconoce la supremacía de la Ley Fundamental y desarrolla, de manera consecuente, las derivaciones de la premisa descrita. Verbigracia, el artículo 13 de la Ley de la Jurisdicción Constitucional otorga efectos vinculantes erga omnes a la jurisprudencia y los precedentes de esta jurisdicción. Ninguna otra instancia, más que la Sala Constitucional, puede variar o revertir tales criterios. Esto es así porque la especial potencia o fuerza activa de los pronunciamientos de este Tribunal no proviene de su carácter de autoridad jurisdiccional, sino que tales cualidades dimanan de la propia Constitución, la cual se impone sobre cualquier instancia o norma que se le oponga. Así como la Constitución prevalece sobre el resto del ordenamiento jurídico, de igual forma lo hacen las sentencias de la jurisdicción constitucional que vienen a interpretar, aplicar y resguardar la Ley Fundamental.

Al momento de aprobar la Ley de la Jurisdicción Constitucional, el Legislador comprendió la relevancia de esta sede y, más aún, previó que las sentencias de este Tribunal, a causa de la citada potencia y ante los efectos de la abrupta anulación de una norma, pudieran ser dimensionadas en el caso de declaratorias de inconstitucionalidad. De este modo, el Legislador creó herramientas jurídicas con el propósito de que la ejecución de las sentencias de inconstitucionalidad se diere en armonía con la Constitución pero sin pasar por alto sus efectos materiales en la realidad.

A manera de ejemplo, el numeral 93 estatuye que la disposición contenida en el artículo 91 (en lo atinente al efecto retroactivo de las declaraciones de inconstitucionalidad) no se aplicase respecto de aquellas relaciones o situaciones jurídicas que se hubiesen consolidado por prescripción o caducidad, en virtud de sentencia pasada en autoridad de cosa juzgada material o por consumación en los hechos, cuando estos fuesen material o técnicamente irreversibles, o cuando su reversión afectase seriamente derechos adquiridos de buena fe. Acto seguido, la norma dispone “todo lo anterior sin perjuicio de las potestades de la Sala, de conformidad con dicho artículo” (refiriéndose al ordinal 91).

Ahora bien, a los efectos de resolver el sub examine, precisamente, este numeral 91 constituye un claro ejemplo de la previsión del legislador de tomar en consideración el impacto de las sentencias de la Sala, cuando declaran la inconstitucionalidad de una norma. El primer párrafo de esa regulación impone la regla general del efecto ipso iure y ex tunc de la declaración de inconstitucionalidad:

“Artículo 91. La declaración de inconstitucionalidad tendrá efecto declarativo y retroactivo a la fecha de vigencia del acto o de la norma, todo sin perjuicio de derechos adquiridos de buena fe.” Empero, acto seguido modula tales efectos, cuando estipula:

“La sentencia constitucional de anulación podrá graduar y dimensionar en el espacio, el tiempo o la materia, su efecto retroactivo, y dictará las reglas necesarias para evitar que éste produzca graves dislocaciones de la seguridad, la justicia o la paz sociales.” De este modo, el ordinal 91 confiere amplias facultades a la Sala. En concreto, por un lado, puede “graduar y dimensionar en el espacio, el tiempo o la materia” el efecto retroactivo de sus sentencias, por otro, puede dictar “las reglas necesarias para evitar que éste produzca graves dislocaciones de la seguridad, la justicia o la paz sociales.” A partir de tal normativa, la jurisprudencia constitucional ha valorado que el dimensionamiento también opera para el futuro, lo que resulta del todo congruente y necesario, toda vez que la ratio iuris de tal potestad radica en modular los efectos de las declaraciones de inconstitucionalidad, que evidentemente tienen la capacidad de afectar tanto hacia el pasado como en el presente y con posterioridad (ver sentencias 2015-012250 de las 11:30 horas del 7 de agosto de 2015, 2015-018537 de las 10:20 horas del 25 de noviembre de 2015, 2006-07965 de las 16:58 horas del 31 de mayo de 2006 y 2005-013914 de las 15:08 horas del 11 de octubre de 2005). Más adelante nos referiremos la tipología de sentencias normativas que resulta de la modulación de los efectos de las sentencias declaratorias de inconstitucionalidad.

Criterios similares se advierten en otros ordenamientos jurídicos (verbigracia, el artículo 140.5 de la Ley Constitucional Federal de Austria) así como en pronunciamientos con efectos diferidos dictados por tribunales constitucionales de otros países. Por ejemplo, la Corte Constitucional de Italia utiliza varios tipos de sentencias exhortativas. En unas, el órgano jurisdiccional se pronuncia acerca de la necesidad de adecuar la ley a la Constitución, exhorta al legislador a que lo haga y a la vez previene al Poder Legislativo que, de no actuar conforme a la recomendación de la Corte, se declararía la inconstitucionalidad de la norma impugnada en la próxima ocasión en que fuere impugnada. En otras, la Corte, aunque reconoce la inconstitucionalidad de la norma cuestionada, no la declara, dado que pondera los probables efectos negativos de la hipotética sentencia desestimatoria inmediata (se habla entonces de una constitucionalidad provisional).

Igualmente, el Tribunal Constitucional de España ha acudido a sentencias de inconstitucionalidad diferida. De esta manera ha señalado que se puede declarar que la norma es inconstitucional y al mismo tiempo prever un plazo de manera diferida o prospectiva para que la ley quede anulada en forma definitiva (sentencias 45/1989, 13/92, 195/98 y 209/99, entre otras). Particularmente, en la sentencia 195/98, aunque la Ley 6/1992 se estimó inconstitucional porque su tramitación fue desarrollada por el Estado Central y no por la Comunidad Autónoma de Cantabria, transitoriamente se mantuvo la legislación por cuanto una declaración inmediata de inconstitucionalidad "podría producir graves perjuicios a los recursos naturales de la zona objeto de controversia". En Alemania, si bien la Ley del Tribunal Constitucional Federal, en su numeral 35, le permite a este órgano jurisdiccional en forma genérica regular la ejecución de sus fallos, no menos cierto es que no existe norma alguna que lo faculte a diferir los efectos de las sentencias de inconstitucionalidad ni menos aún a darle plazo al Parlamento para que emita determinada ley.

No obstante, a partir de la sentencia del 11 de mayo de 1970 (BVerfGE 28, 227), por vía jurisprudencial se creó la denominada “verfassungsgerichtliche Unvereinbarerklärung verfassungswidriger Gesetze” (declaración de incompatibilidad de leyes inconstitucionales), cuya consecuencia práctica ha sido la posibilidad, con carácter excepcional, de aplicar provisionalmente una norma declarada inconstitucional. Este tipo de sentencia normativa vino a ser incorporada al texto positivo a partir de la reforma de 21 de diciembre de 1970 a la Ley del Tribunal Constitucional Federal sin que a la fecha ni esa ni ninguna reforma posterior haya llegado a regular cuáles son sus efectos, de manera que el mencionado vacío jurídico positivo persiste hasta el día de hoy, como pacíficamente admite la doctrina alemana. Pese a ello, lo cierto es que las sentencias de incompatibilidad, en tanto realidad normativa, ya son parte de la dogmática jurídica alemana; jurisprudencialmente se han utilizado, entre otros casos, cuando, ante las particularidades de la norma declarada inconstitucional, razones jurídico-constitucionales vuelven necesaria su aplicación temporal o provisoria a fin de evitar que se caiga en una situación aún más lejana del orden constitucional o que emerja un grave problema de seguridad jurídica.

Por ejemplo, en BVerfGE 109, 64 (sentencia del 18 de noviembre de 2003) se declaró incompatible con la Constitución al ordinal 14 inciso 1 punto 1 de la Ley de Protección a las Madres. Esta normativa preveía que la mujeres recibieran su salario completo antes y después del parto. Al respecto, los costos fueron divididos entre el estado y el empleador: el primero debía aportar 25 DM por día mientras al segundo le correspondía cubrir la diferencia de salario. Al tiempo de la adopción de la ley en 1968, tal diferencia ascendía a 13 DM, pero en el 2000 tal suma subió a 88,60 DM. Consecuencia de los gastos adicionales para los empleadores, las mujeres tenían menos oportunidad de ser contratadas. Lo anterior resultó inconstitucional por violación a los derechos a la igualdad y a la libertad de trabajo. Empero, al Legislador se le confirió plazo hasta el 31 de diciembre de 2005 para aprobar una ley que fuere constitucional; en el ínterin, la norma incompatible con la Constitución continuó vigente.

De similar forma, la Corte Suprema de Estados Unidos de América ha acudido a una variante de este tipo de sentencia. Por ejemplo, en el supra citado caso de lucha contra la discriminación racial Brown versus Consejo de Educación de Topeka (explicado en el considerando anterior), amén de que las sentencias de 17 de mayo de 1954 y 31 de mayo de 1955 se catalogan como estructurales, también pueden ser vistas como una especie de sentencias exhortativas -particularmente Brown II-, dado que la Corte estadounidense concluyó que para erradicar la discriminación en las escuelas públicas donde se separaban a estudiantes afroamericanos y blancos, no bastaba la anulación de una norma sino que se requería de diversidad de medidas a cargo de distintas dependencias. En Perú, el Tribunal Constitucional ha aplicado la sentencia de efectos diferidos cuando se está ante un cambio de precedente. Así, en sentencia de 10 de octubre de 2005 dispuso: “El Tribunal Constitucional puede disponer excepcionalmente que la aplicación del precedente vinculante que cambia o sustituya uno anterior opere con lapso diferido (vacatio sententiae), a efectos de salvaguardar la seguridad jurídica o para evitar una injusticia ínsita que podría producirse por el cambio súbito de la regla vinculante por él establecida, y que ha sido objeto de cumplimiento y ejecución por parte de los justiciables y los poderes públicos.

En efecto, la decisión de otorgar expresa y residualmente eficacia prospectiva es establecida por el Tribunal Constitucional, en aras de procesar constructiva y prudentemente la situación a veces conflictiva entre continuidad y cambio en la actividad jurisdiccional de naturaleza constitucional. La técnica de la eficacia prospectiva del precedente vinculante se propone, por un lado, no lesionar el ánimo de fidelidad y respeto que los justiciables y los poderes públicos mostrasen respecto al precedente anterior; y, por otro, promover las condiciones de adecuación a las reglas contenidas en el nuevo precedente vinculante.” Del mismo modo, la Corte Constitucional de Colombia reiteradamente ha dictado sentencias con efectos diferidos, variante de las sentencias exhortativas. Así, en la sentencia C-366 de 2011, la Corte determinó la inconstitucionalidad de la Ley 1382 de 2010, que había modificado la Ley 685 de 2001 Código de Minas, por haber omitido la consulta previa a los pueblos indígenas y afrodescendientes; sin embargo, dado que, por un lado, una sentencia integradora no era jurídicamente plausible y, por otro, una inconstitucionalidad inmediata de la regulación cuestionada dejaba un vacío normativo sobre la materia ambiental en el ámbito minero –lo que acarrearía una situación grave e indeseable en materia de protección al ambiente–, la Corte consideró que los efectos de la inconstitucionalidad de la norma demandada se diferían por un lapso de dos años, “…para que tanto por el impulso del Gobierno, como del Congreso de la República y dentro de sus competencias, den curso a las medidas legislativas dirigidas a la reforma del Código de Minas, previo el agotamiento de un procedimiento de consulta previa a las comunidades indígenas y afrocolombianas, en los términos del artículo 330 de la Carta Política”.

También pueden verse los votos C-818 de 2011, C-720 de 2007 y C-737 de 2001, entre muchos otros. Por su parte, la Corte Suprema de Justica de la Nación Argentina, en el caso Rosza, Carlos Alberto y otro (resuelto en sentencia de 23 de mayo de 2007), declaró la inconstitucionalidad del régimen de subrogancias (reemplazos de jueces) aprobado por el Consejo de la Magistratura. No obstante, dado el impacto que la decisión provocaba en los procesos en curso, dispuso que los jueces subrogantes afectados continuasen en sus cargos hasta que cesasen las razones que habían originado su nombramiento o hasta que fuesen reemplazados o ratificados mediante un procedimiento constitucionalmente válido, según las pautas fijadas en tal voto. “En ningún caso dichos subrogantes podrán continuar en funciones más allá del término de un año, contado a partir de la notificación de este pronunciamiento, lapso durante el cual el Congreso y el Poder Ejecutivo, en ejercicio de sus atribuciones, procedan a establecer un sistema definitivo sobre la materia en debate con estricta observancia de los parámetros constitucionales ya examinados.” En el ámbito doctrinario, la jurisprudencia y dinámicas constitucionales que han llevado a este tipo de sentencias atípicas, han sido recogidas, sistematizadas y clasificadas.

Por ejemplo, tomando como base el criterio de Néstor Pedro Sagüés, pero con ciertos ajustes, podemos calificar este tipo de sentencias como “exhortativas”, las cuales a su vez se subdividen de la siguiente forma: A) La sentencia exhortativa de delegación, que declara inconstitucional a una norma, y advierte al Poder Legislativo qué pautas debería satisfacer para emitir una nueva ley que sea compatible con la Constitución. En este tipo de voto, se ha admitido el dictado de una regulación mínima provisional, cuando la laguna jurídica derivada de la anulación de la norma impugnada lo exige (un ejemplo de esta tesitura es la sentencia 2013-011499 de las 16:00 horas del 28 de agosto de 2013). B) La sentencia exhortativa por constitucionalidad precaria, en la que la jurisdicción constitucional estima que la norma impugnada todavía es constitucional, pero que puede pronto dejar de serlo; o que no resulta del todo satisfactoriamente constitucional, por lo que el Tribunal Constitucional insta al legislador a que produzca una nueva regulación plenamente constitucional, para lo cual puede darle también pautas de contenido (en Alemania, este tipo de sentencia se denomina “Appellentscheidung”).

  • C)La sentencia exhortativa de inconstitucionalidad simple, llamada “Unvereinbarerklärung” en la doctrina alemana, en la que el Tribunal Constitucional si bien constata la inconstitucionalidad de una norma, lo cierto es que no la invalida (por diversas razones, como los efectos adversos de una repentina anulación o cuando la inconstitucionalidad no radica en la norma en sí sino en una relación normativa cuya resolución atañe al Legislador) pero sí impone al Poder Legislativo el deber de solucionar la situación de inconstitucionalidad a través de la aprobación de un proyecto de ley que devuelva la armonía con la Constitución. De este modo, la ley reputada inconstitucional se continúa aplicando por cierto lapso hasta que se apruebe una nueva normativa que esté conforme con la Constitución. Según se evidenciará de seguido, la decisión tomada en el sub judice se subsume en este último tipo de sentencia exhortativa.

En efecto, un típico caso de sentencia exhortativa de inconstitucionalidad simple acaece cuando la anulación de la norma impugnada no comporta por sí solo o de manera automática el retorno a una situación de normalidad constitucional, sino que requiere de la cooperación del Poder Legislativo. Esto ocurre en la especie, donde la inconstitucionalidad de la norma impugnada, no resuelve la defensa del derecho al ambiente. Por ello, este dimensionamiento se hace a efectos de instar a la Asamblea Legislativa, en el uso de sus atribuciones constitucionalmente asignadas, a que en el plazo de 18 meses, contado a partir de la publicación íntegra de este pronunciamiento en el Boletín Judicial, se apruebe una nueva ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, que esté fundamentada en estudios técnicos completos e incorpore las medidas de compensación que correspondan.

IX. DOCUMENTACIÓN APORTADA AL EXPEDIENTE

Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el "Reglamento sobre en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.

Por tanto:

Se declara CON lugar la acción y, en consecuencia, se anulan la Ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, Ley No. 8803 de 16 de abril de 2010, y su Reglamento, Decreto Ejecutivo No. 38628-MP-H-COMEX-MINAE-SP-G del 16 de setiembre de 2014. Con base en el ordinal 91 de la Ley de la Jurisdicción Constitucional, por mayoría, se gradúan y dimensionan los efectos de esta sentencia y se insta a la Asamblea Legislativa, en el uso de sus atribuciones constitucionalmente asignadas, a que en el plazo de 18 meses, contado a partir de la publicación íntegra de este pronunciamiento en el Boletín Judicial, se apruebe una nueva ley para regular la creación y el desarrollo del puesto fronterizo Las Tablillas, que esté fundamentada en estudios técnicos completos e incorpore las medidas de compensación que correspondan. Los magistrados Salazar Alvarado y Araya García declaran con lugar la acción, excepto en cuanto se establece un plazo para dictar la ley de cita.

Reséñese esta sentencia en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese al accionante, a la Presidenta de la Asamblea Legislativa o a quien ocupe su cargo, al Ministro de la Presidencia, al Ministro de Ambiente y Energía, al Ministerio de Comercio Exterior, al Viceministro de Comercio Exterior en su condición de presidente del Consejo de Puestos Fronterizos Terrestre, y a la Procuraduría General de la República.- Fernando Castillo V.
