Amparo appeal (recurso de amparo) filed by Alexander García Sandí, identity card 0104580610, against the Municipalidad de Heredia.
Background:
Justice Guerrero Portilla writes the opinion; and, Whereas (Considerando):
I.Subject matter of the appeal. The petitioner requests that the Municipalidad del Cantón Central de Heredia be ordered to undertake work to stabilize an embankment adjoining his home and to respond to the letter that he addressed to the entity’s Mayor on 18 February 2011.
II.Proven facts. The following facts are considered duly established and relevant to the disposition of this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:
IV.Merits. The application for constitutional relief (amparo) filed by the plaintiff concerns the right to safety and physical integrity, as well as the right of petition. The connection with the first rights listed arises from the allegation that several persons are in a situation of risk that is considered not to have been addressed promptly (see, e.g., judgment #2006-16035 issued at 9:38 a.m. on 3 November 2006). However, the report submitted under oath by the municipal officials involved, together with the documents they provided, shows that the matter has in fact been addressed. The technical report requested in September 2010 was prepared in February 2011, and its conclusions identify a situation of vulnerability, although one caused not by the Municipalidad but by the distance between the petitioner’s home and those of other residents and by the gradient of the slope (talud). Likewise, neither the evidence submitted by the parties nor, in particular, the report of the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias indicates that the risk was caused by municipal works.
Responsibility for the works that must be constructed to maintain the stability of the slope is a matter of civil law and is not to be decided in summary amparo proceedings (vía sumaria del amparo). Therefore, insofar as the plaintiff requests a declaration that the Municipalidad de Heredia violated the right to safety of the local residents by carrying out works that destabilized the slope and that this violation must be remedied by requiring it to construct a retaining wall, the application must be denied. The foregoing is subject to the caveat that the Municipalidad must, within the scope of its authority, order and oversee the performance of the works required to prevent the slope from collapsing.
V.With regard to the right of petition and prompt response, governed by Article 27 of the Political Constitution and Article 32 of the Law on Constitutional Jurisdiction, that right requires public officials to decide requests submitted by persons subject to the Administration within ten business days from the date on which such requests are filed, unless another response period has been specified; provided that the Chamber shall assess any reasons offered for deeming that period insufficient, in light of the circumstances and nature of the matter, in which case the Administration remains obligated to inform the petitioner of the reasons for the delay in issuing its decision. In any event, the duty to decide does not entail receiving either a favorable or unfavorable response, but it does require consistency between the subject matter of the request and that of the response.
VI.In this matter, it has neither been shown nor alleged that the Mayor of the Municipalidad de Heredia responded to the petitioner’s letter of 18 February 2011. This portion of the application must therefore be granted, and the respondent must be ordered to answer that letter and serve notice of the response within five days following service of this judgment.

The application is granted solely as to the violation of the right of petition. José Manuel Ulate Avendaño, Mayor of the Cantón Central de Heredia, or whoever holds that office, is ordered to answer the petitioner’s letter of 18 February 2011 and serve notice of the response upon him within five days following service of this judgment. In all other respects, the application for amparo is denied. The Municipalidad de Heredia is ordered to pay the legal costs, damages, and losses caused, which shall be assessed during enforcement of the judgment in the administrative litigation proceedings. The aforementioned official is advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, any person who receives an order issued in an amparo proceeding that he or she must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. This decision shall be served personally upon the respondent.

*110043700007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las dieciséis horas y dieciocho minutos del diez de mayo del dos mil once.
Recurso de amparo interpuesto por Alexander García Sandí, cédula de identidad 0104580610, contra la Municipalidad de Heredia.
Resultando:
Redacta el Magistrado Guerrero Portilla; y,
Considerando:
I.Objeto del recurso. Solicita el recurrente se ordene a la Municipalidad del Cantón Central de Heredia adoptar las obras de estabilización de un talud colindante con su vivienda y sea contestada la nota que dirigió al Alcalde del ente el 18 de febrero de 2011.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
IV.Sobre el fondo. El amparo planteado por el actor se relaciona con el derecho a la seguridad e integridad física, así como con el derecho de petición. El vínculo con los primeros derechos enunciados nace de la denuncia de encontrarse varias personas en una situación de riesgo que se considera no ha sido atendida con celeridad (v., p.ej., la sentencia #2006-16035 de las 9:38 horas del 3 de noviembre del 2006). Sin embargo, del informe rendido bajo juramento por los funcionarios municipales involucrados y los documentos que aportan se evidencia que el caso sí se ha atendido. Que el informe técnico que se requirió en setiembre de 2010 fue elaborado en febrero de 2011 y las conclusiones que contiene señalan una situación de vulnerabilidad, pero no causada por la Municipalidad, sino por la distancia que media entre la vivienda del recurrente y otros vecinos y la pendiente del talud. Asimismo ni la prueba aportada por las partes ni, en especial, el informe de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias, señalan que el riesgo fuera provocado por obras municipales.
La responsabilidad de las obras que deben levantarse para mantener la estabilidad del talud es una cuestión de derecho civil y no a dirimir en la vía sumaria del amparo. Por ello, en cuanto el actor solicita declarar que la Municipalidad de Heredia violó el derecho a la seguridad de los vecinos del lugar, con la ejecución de obras que falsearon el talud y que esa lesión debe remediarse endilgándole la construcción de un muro de retención, el amparo debe declararse sin lugar. Lo anterior, bajo la advertencia que la Municipalidad deberá ordenar y fiscalizar, en el marco de sus competencias, que se ejecuten las obras que se requiera para evitar que el talud se desplome.
V.En lo que se refiere al derecho de petición y pronta respuesta, regulado en los artículos 27 de la Constitución Política y 32 de la Ley de la Jurisdicción Constitucional, él obliga a los funcionarios públicos a resolver las solicitudes de los administrados en el plazo de diez días hábiles a partir de la fecha de presentación de tales gestiones, a falta de que no se hubiere señalado otro plazo para contestar, con la salvedad que la Sala apreciará las razones que se aduzcan para considerar insuficiente ese plazo, atendidas las circunstancias y la índole del asunto, en cuyo caso la Administración siempre está obligada a comunicarle al petente las causas de la demora en pronunciarse. En todo caso, el deber de resolver no implica la obtención de una respuesta favorable o no, pero sí la necesaria congruencia entre el objeto de lo pedido y el de lo contestado.
VI.En este asunto, no se demuestra ni alega que el Alcalde Municipal de Heredia haya contestado la nota del recurrente del 18 de febrero de 2011, por lo que este extremo del recurso debe acogerse, ordenando al recurrido contestar la nota señalada y notificar la respuesta en los cinco días siguientes a la notificación de la presente sentencia.
Por tanto:
Se declara con lugar el recurso únicamente por violación del derecho de petición. Se ordena a José Manuel Ulate Avendaño, Alcalde Municipal del Cantón Central de Heredia, o a quien ocupe su cargo, contestar la nota del recurrente del 18 de febrero de 2011 y notificarle la respuesta, en los cinco días siguientes a la notificación de esta sentencia. En lo demás, se declara sin lugar el amparo. Se condena a la Municipalidad de Heredia al pago de las costas, daños y perjuicios ocasionados, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte al funcionario dicho que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese al recurrido la presente resolución en forma personal.
