He states that the Ministry authorities are failing to perform their duties in the Caribbean region because they refrain from acting despite having verified the existence of environmental damage. Regarding the alleged tree clearing, he states that the petitioner himself acknowledges that the complaint was addressed by MINAET officials and that there was no failure to perform their duties merely because it was not handled immediately. He asserts that it is false that soil was removed from the Refuge; rather, the weather events of 2005 caused landslides that knocked down power-line poles and obstructed the roadway, and the Costa Rican Electricity Institute therefore carried out cleanup and slope-stabilization work so that the poles could be reinstalled. Regarding the amendment to the Refuge’s management plan, he states that it must be updated every ten years to facilitate improved socio-environmental development and that this requires technical and scientific criteria. He requests that the proceeding be denied.

Justice Ulate Chacón authors the opinion; and,

Considering

I. Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter

1. By Executive Decree number 34946, dated 6 de noviembre de 2008, the Zoning Regulations for the Gandoca-Manzanillo National Wildlife Refuge, Mixed Category, were issued (folio 21).

2. By a submission dated 21 de octubre de 2009, the Assistant Prosecutor of the Bribrí Prosecutor’s Office requested that the Criminal Court for Treasury Matters order the final dismissal of the officials of the Ministry of Environment, Energy and Telecommunications accused of an alleged failure to perform their duties regarding events that occurred at Playa Chiquita (folio 30).

3. The Costa Rican Electricity Institute carried out cleanup and slope-stabilization work for the installation of electrical poles in the Gandoca-Manzanillo Wildlife Refuge due to landslides that occurred in 2005 (folio 27).

II.The right to a healthy and ecologically balanced environment. Article 50 of the Political Constitution establishes the right of every person to a healthy and ecologically balanced environment as a fundamental right. The State is the guarantor of the protection and safeguarding of the environment and natural resources. From this provision, read in conjunction with Articles 20, 69, and 89 of the Political Constitution, arises the State’s responsibility to exercise a protective and governing role in this field, as provided by the constitutional provision under discussion, a role developed by environmental legislation. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right. In this regard, it must be considered that the legislation designates the Ministry of Environment and Energy as the governing body for the natural resources, energy, and mining sector, pursuant to Article 2 of the Organic Law of that Ministry, number 7152, dated 4 de junio de 1990.

In the Chamber’s view, this governing role in environmental matters encompasses not only the establishment of appropriate regulations governing the use of forest resources and natural resources, as also provided by Article 56 of the Organic Law of the Environment, but also confers upon it the important function of exercising leadership in environmental matters, which consists of maintaining a preeminent role in this field. In this sense, the oversight and enforcement of environmental matters and activities constitute an essential function of the State pursuant to Article 50 of the Constitution, insofar as the third paragraph provides, in relevant part: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Political Constitution, which expressly prohibits the Branches of Government from delegating the exercise of functions inherent to them, particularly when such functions are essential.

Accordingly, with respect to environmental protection, the functions of governance, oversight, and enforcement in environmental matters belong to the State and are entrusted to its various administrative agencies.

III.Coordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed. For this purpose, “public institution” includes both the Central Administration—Ministries such as the Ministry of Environment and Energy and the Ministry of Health, which, by reason of their subject matter, have broad participation and responsibility regarding environmental conservation and preservation and which most often act through their specialized agencies in the field, such as the General Directorate of Wildlife, the Forestry Directorate, and the National Environmental Technical Secretariat (SETENA)—and decentralized institutions such as the National Institute of Housing and Urban Development, SENARA, the Costa Rican Tourism Institute, and the Costa Rican Institute of Aqueducts and Sewers.

Municipalities likewise bear significant responsibility for this task within their respective territorial jurisdictions. Furthermore, failures to fulfill the duty to protect the environment and enforce environmental regulations are constitutionally significant because administrative inaction in this area may cause harm to the environment and natural resources, sometimes with consequences similar to or greater than those resulting from administrative action. Examples include authorizing regulatory plans or construction projects without approval of an environmental impact study by the National Environmental Technical Secretariat; failing to oversee and enforce the implementation of management plans for protected areas through the General Directorate of Wildlife of the Ministry of Environment and Energy; allowing businesses to operate without the required health permits concerning wastewater treatment—the Costa Rican Institute of Aqueducts and Sewers and the Ministry of Health; or failing to verify noise controls in bars, restaurants, or event venues—municipalities and the Ministry of Health.

IV.The specific case. The alleged breach of duties concerning the events at playa Chiquita. The petitioner alleges that in 2009—without specifying a date—he filed a complaint with the authorities of the Ministerio del Ambiente, Energía y Telecomunicaciones concerning alleged environmental damage (daño ambiental)—which he likewise did not specify—that occurred at Playa Chiquita, within the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. Nevertheless, he states that, through official letter ACLAC-VU-053-2009, the ministerial authorities replied that the reported environmental damage did not exist. The petitioner disagreed with that determination and filed a criminal complaint against the Ministry officials, alleging a breach of duties (incumplimiento de deberes) by the officials involved. In this regard, the Chamber (Sala) notes that the petitioner’s disagreement does not concern a failure to act or unlawful action by the authorities, but rather his disagreement with the technical opinion issued.

Such a difference of opinion cannot be raised and resolved through constitutional jurisdiction (jurisdicción constitucional), because the nature of this protective proceeding is incompatible with conducting adversarial proceedings that would permit a technical determination of whether the reported damage occurred. On the contrary, the Administration’s technical bodies concluded that the damage had not occurred; therefore, if the petitioner continued to disagree with that determination, he should have brought the appropriate actions before whichever administrative or judicial bodies he deemed appropriate. In the case under review, given the difference of opinion, the petitioner chose to file a criminal complaint against the ministerial officials. The Fiscalía de Bribrí requested a final dismissal (sobreseimiento definitivo) of that complaint, finding that the offense alleged by the complainant had not been established, because, in response to the environmental complaint, the Ministry officials conducted the corresponding inspection and determined that the work being performed consisted of ordinary beach-cleaning activities: removing garbage, logs, fallen leaves, and natural debris deposited there by weather events and the season’s heavy surf. Consequently, the alleged constitutional violation must be rejected, and the amparo appeal (recurso) must be denied as to this issue, as is hereby ordered.

V.The Administration’s response to the complaint concerning tree cutting. The petitioner further alleges that, on a Monday morning, he filed a complaint by telephone concerning the alleged clearing of seven thousand square meters of forest along the road connecting Puerto Viejo and Cocles. However, he continues, that complaint was addressed by the Ministry authorities the following Wednesday; he therefore believes that the right to a healthy environment (derecho al ambiente) was also violated. Thus, the petitioner himself expressly acknowledges that the complaint he filed was in fact addressed by the authorities of the Ministerio del Ambiente, Energía y Telecomunicaciones within the following forty-eight hours. It is therefore improper to allege that the Administration failed to act in protecting the environment. Accordingly, the appeal must likewise be denied as to this issue.

VI.Regarding the alleged unlawful removal of soil from the Refuge. The petitioner additionally claims that soil was unlawfully removed from the Refugio de Vida Silvestre Gandoca-Manzanillo, an act that he also reported without obtaining any favorable result. In this regard, the respondent authorities demonstrate that landslides occurred in the Refuge as a result of the weather events that struck the area in 2005, causing utility poles to fall and obstructing the road. For that reason, the Instituto Costarricense de Electricidad performed cleanup and slope-stabilization work in order to reinstall the electric utility poles affected by those events. Accordingly, what the petitioner perceived as unlawful removal was in fact the earthworks (movimiento de tierra) that public institutions had to perform to rehabilitate and reactivate the area. The appeal must therefore also be denied as to this issue.

VII.Regarding the amendment of the Management Plan (Plan de Manejo) for the Refugio Gandoca-Manzanillo. Finally, the petitioner alleges that the Refuge’s Management Plan introduced a change in several coastal areas from Cocles to Manzanillo, which were redesignated as recreational and residential areas, thereby allowing greater development possibilities where development had previously been prohibited and consequently affecting coastal forests and mangroves. In this regard, the respondent authorities state that the Refuge’s Management Plan is a tool for regulating the activities conducted within it, that it is updated every ten years to promote improved social and environmental development, and that technical and scientific criteria are required for its amendment. On this point, the Chamber has clearly held that regulatory instruments of this type must plainly indicate that the corresponding technical studies were conducted, without requiring the Decree to reproduce all the assessments performed—in this regard, see judgment number 2010-6922, issued at fourteen hours thirty-five minutes on 16 de abril de 2010.

In the case under review, the referenced Management Plan is contained in Decreto Ejecutivo number 34946, of 6 de noviembre de 2008, entitled Reglamento de Zonificación del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, Categoría Mixta. It expressly states that the Refuge is classified precisely as a mixed-category refuge and that it is therefore critically important to establish zoning (zonificación) based on technical and scientific criteria derived from the technical and scientific proposal prepared by an experienced and recognized interdisciplinary group of professionals. The same Decree states that the zoning was presented to civil society for consultation through activities conducted on 30 de junio and 21 de octubre de 1995, and 9 and 16 de marzo de 1996; that it was reviewed by the ministerial authorities and the Municipalidad de Talamanca; that it was discussed by the Consejo Regional del Área de Conservación Amistad Caribe on 14 de diciembre de 2007 and 11 and 23 de enero de 2008, at sessions held at the Centro Operativo del Refugio, in the community of Gandoca, at the Parque Nacional Cahuita-Sector Puerto Vargas and Manzanillo, and at the Refuge’s community center in the Gandoca sector; that it was approved by that Consejo Regional on 8 de febrero de 2008; and, finally, that it was approved by the Consejo Nacional de Áreas de Conservación on 18 and 19 de febrero of that same year.

Thus, the Decree fulfills the requirement of indicating that the studies on which it is based were conducted, starting from the Refuge’s mixed-category designation, which in no way precludes the development of productive activities—see considerando VI of this judgment—while also expressly describing the public dissemination of the zoning and the bodies that participated in its approval. It is also noted that the Decree defines fifteen zones within the Refuge—which are in turn divided into fifteen subzones—classified into three groups: recommended use, conditionally recommended use, and prohibited use. Accordingly, the various activities proposed must comply with the established zoning criteria and with the nature of the site and the conditions of the land. In this regard, it is improper to allege generally that the zoning adopted undermines environmental protection, because the Administration may determine, when reviewing approvals in specific cases, whether a particular activity may be carried out in a manner compatible with the environment and in accordance with the applicable regulations.

Thus, the regulations issued by the Poder Ejecutivo concerning activities that may be conducted in the Refuge are intended precisely to regulate the pursuit of productive activities that are compatible and harmonious with the environment to be protected. It is therefore inaccurate to allege generally that the mere existence of these regulations contravenes the environmental protection that must be afforded within the Refuge. Accordingly, the appeal must likewise be denied as to this issue.

VIII.In conclusion, because the constitutional violation alleged by the petitioner has been rejected, the appeal must be denied, as is hereby ordered.

Recurso de amparo presentado por Philippe Remi Karen Vangoidsenhoven, portador del documento de identidad número 105600008202, contra el Ministerio del Ambiente, Energía y Telecomunicaciones.

Resultando

  1. 1Por escrito recibido en la Secretaría de la Sala a las ocho horas veintisiete minutos del 30 de setiembre de 2010, el recurrente interpone recurso de amparo aduciendo violación al derecho a un ambiente sano y ecológicamente equilibrado. Señala, las autoridades del Ministerio incumplen sus deberes en la zona del Caribe, porque omiten actuar a pesar de acreditar la existencia de daños ambientales. Refiere una denuncia por daños en Playa Chiquita fue resuelta indicando que no había daños ambientales, cuando en su criterio sí los hubo; que en otra ocasión reportó la tala de siete mil metros cuadrados de bosque entre Puerto Viejo y Cocles, pero las autoridades se presentaron cuando todos los árboles se habían eliminado –llamó un lunes y se apersonaron hasta el miércoles. Agrega, hubo extracción ilegal de tierra del refugio de Manzanillo, pero las autoridades no actuaron como debían ni interpusieron las denuncias; y, finalmente, que el MINAET introdujo un cambio en el Plan de Manejo del Refugio Gandoca-Manzanillo, publicado en diciembre de 2008, variando la condición de las zonas costeras de Cocles a Manzanillo, al pasarlas a ser zonas recreativas y residenciales, lo que permite una mayor afectación de bosques y manglares. Por estas razones interpuso una denuncia penal contra varios oficiales del Ministerio. Requiere se ordene la actuación de las autoridades recurridas. Solicita declarar con lugar el recurso.
  2. 2Mediante escrito recibido en la Secretaría de la Sala a las catorce horas cincuenta y ocho minutos del 20 de octubre de 2010 (folio 20), informa bajo fe de juramento Andrei Bourrouet Vargas, Ministro a.i. de Ambiente, Energía y Telecomunicaciones, que el Decreto Ejecutivo número 34946-MINAET, “Reglamento de Zonificación del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, Categoría Mixta”, pretende, con base en los estudios técnicos y las consultas a los sectores involucrados, armonizar los fines de conservación y los de desarrollo económico de la zona, y que no existe expediente administrativo relacionado con los hechos aducidos por los amparados. Solicita declarar sin lugar el recuso.
  3. 3Por escrito recibido en la Secretaría de la Sala a las diez horas treinta y cuatro minutos del primero de noviembre de 2010 (folio 23), el señor Vandogoidsenhoven Philippe Remi Karen, aduce ser él quien interpuso el amparo, y las demás personas firmantes apoyan la gestión.
  4. 4Mediante escrito recibido en la Secretaría de la Sala a las diez horas veintiséis minutos del 2 de noviembre de 2010 (folio 25), las señores Blanca Amalia Arce López, Cristina Zeledón, Yorleny Bonilla López, Cristina Vives, y los señores Luis Videla y Eduardo Montes, indican ser personas comprometidas con un desarrollo sostenible en armonía con el ambiente, pero no son partícipes en la presentación de este amparo, por lo que solicitan retirar sus nombres de esta acción.
  5. 5Por escrito recibido en la Secretaría de la Sala a las ocho horas veintitrés minutos del 8 de noviembre de 2010 (folio 26), informa bajo fe de juramento Marcelo Pacheco Jiménez, Coordinador del Refugio de Vida Silvestre Gandoca-Manzanillo, que sobre los hechos denunciados por el recurrente se dictó sobreseimiento definitivo en sede penal. Respecto de la aducida tala de árboles, refiere que el propio amparado señala que la denuncia fue atendida por los funcionarios del MINAET, y que no hay incumplimiento sólo porque no se realizó de forma inmediata. Afirma que es falso que se haya extraído tierra del Refugio, sino que los eventos climatológicos del 2005, causaron deslizamientos que provocaron el derribo de los postes de tendido eléctrico y obstruyeron la carretera, por lo que el Instituto Costarricense de Electricidad realizó labores de limpieza y estabilización de paredones para colocar el posteado nuevamente. Sobre el cambio del plan de manejo del Refugio, indica que debe actualizarse cada diez años para permitir un mejor desarrollo socio ambiental, y requiere de criterios técnicos y científicos. Solicita declarar sin lugar el recurso.
  6. 6Mediante escrito recibido en la Secretaría de la Sala a las once horas treinta y cuatro minutos del 16 de diciembre de 2010 (folio 39), el Coordinador del Refugio Gandoca-Manzanillo indica haber presentado el informe requerido.
  7. 7Por constancia del Secretario de esta Sala, de 18 de enero de 2011 (folio 48), se acredita que no aparece que del 14 de diciembre de 2010 al 17 de enero de 2011, el Director del Área de Conservación La Amistad, subregión Talamanca, haya presentado escrito o documento alguno para rendir el informe requerido en la resolución de curso de este amparo.
  8. 8En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Ulate Chacón; y,

Considerando

I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:

1. Mediante Decreto Ejecutivo número 34946, de 6 de noviembre de 2008, se emite el Reglamento de Zonificación del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, Categoría Mixta (folio 21).

2. Mediante escrito de 21 de octubre de 2009, el Fiscal Auxiliar de la Fiscalía de Bribrí, solicita al Juzgado Penal de Hacienda el sobreseimiento definitivo de los funcionarios del Ministerio del Ambiente, Energía y Telecomunicaciones denunciados por presunto incumplimiento de deberes respecto de hechos producidos en playa Chiquita (folio 30).

3. El Instituto Costarricense de Electricidad realizó labores de limpieza y estabilización de paredones para colación de posteado eléctrico en el Refugio de Vida Silvestre Gandoca-Manzanillo, con motivo de deslizamientos producidos en el año 2005 (folio 27).

II.El derecho a un ambiente sano y ecológicamente equilibrado. El artículo 50 de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de 4 de junio de 1990.

Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no sólo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.

De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

III.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados.

Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte de la Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas residuales -Acueductos y Alcantarillados y Ministerio de Salud-, o no verificar los controles sónicos en bares, restaurantes o centros de fiestas -municipalidades y Ministerio de Salud-.

IV.El caso concreto. El presunto incumplimiento de deberes respecto de los hechos en playa Chiquita. Aduce el recurrente, que en el año 2009 –sin precisar fecha- interpuso una denuncia ante las autoridades del Ministerio del Ambiente, Energía y Telecomunicaciones, respecto de un presunto daño ambiental –tampoco precisado- acontecido en Playa Chiquita, dentro del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. No obstante, refiere, mediante oficio ACLAC-VU-053-2009, las autoridades ministeriales le respondieron que no existía el denunciado daño ambiental, criterio con el cual el amparado no se encontró conforme e interpuso denuncia penal contra los servidores del Ministerio alegando el incumplimiento de deberes de los funcionarios relacionados. Sobre el particular, la Sala advierte que la inconformidad del recurrente no es por la falta de actuación o la actuación ilegítima de las autoridades, sino porque no comparte el criterio técnico vertido, diferencia de criterio que resulta inviable de plantear y resolver por la jurisdicción constitucional, pues la naturaleza de esta acción de garantía es incompatible con la realización de un proceso contradictorio que permita determinar de manera técnica si se produjo o no el daño denunciado.

Por el contrario, las instancias técnicas de la administración concluyeron que el daño no se había producido, por lo que de mantener alguna divergencia de criterio al respecto, el recurrente debió interponer las acciones pertinentes ante las instancias administrativas o judiciales que estime pertinentes. En el caso bajo estudio, ante la divergencia de criterio, el recurrente optó por interponer una denuncia penal contra los servidores ministeriales, denuncia sobre la que la Fiscalía de Bribrí solicitó el sobreseimiento definitivo al considerar que no se configuraba el ilícito aducido por el gestionante, toda vez que ante la denuncia ambiental, los servidores del Ministerio realizaron la inspección correspondiente, y determinaron que los trabajos que se estaban realizando eran propios de limpieza de la playa, eliminando basura, troncos, hojas caídas y deshechos naturales allegados hasta ahí por los eventos climatológicos y el fuerte oleaje de la época. En consecuencia, debe descartarse la aducida violación constitucional, y el recurso declararse sin lugar en cuanto a este extremo, como en efecto se dispone.

V.La respuesta de la administración ante la denuncia de tala de árboles. Por otra parte, aduce el amparado que un lunes, en horas de la mañana, realizó una denuncia vía telefónica por la presunta tala de siete mil metros cuadrados de bosque en el camino que comunica Puerto Viejo con Cocles. Sin embargo, continúa, esa denuncia fue atendida por las autoridades del Ministerio el miércoles siguiente, por lo que estima, hubo también una violación al derecho al ambiente. De tal forma, el propio recurrente reconoce de manera expresa que la denuncia por él planteada sí fue atendida por las autoridades del Ministerio del Ambiente, Energía y Telecomunicaciones dentro de las cuarenta y ocho horas siguientes, motivo por el cual resulta impropio aducir que hubo inercia de la administración en la tutela del ambiente. En este sentido, el recurso igualmente debe ser desestimado en cuanto a este extremo.

VI.Sobre la aducida extracción ilegal de tierra en el Refugio. Adicionalmente, plantea el amparado que en el Refugio de Vida Silvestre Gandoca-Manzanillo hubo una extracción ilegal de tierra, acto que también denunció sin obtener resultado favorable alguno. Al respecto, las autoridades recurridas acreditan que en el Refugio hubo deslizamientos de tierra producto de los eventos climatológicos que azotaron la zona en el 2005, los cuales ocasionaron el derribo de los postes de tendido eléctrico y obstrucción de la carretera, razón por la cual el Instituto Costarricense de Electricidad realizó labores de limpieza y estabilización de paredones, para colocar de nuevo el posteado eléctrico lo acontecido. En este sentido, la presunta extracción ilegal apreciada por el recurrente fue en realidad el movimiento que hubo de realizar por parte de las instituciones públicas para la rehabilitación y reactivación de la zona. De tal forma, el recurso también debe ser declarado sin lugar en cuanto a este extremo.

VII.Sobre la modificación del Plan de Manejo del Refugio Gandoca-Manzanillo. Finalmente, aduce el recurrente que el Plan de Manejo del Refugio introdujo un cambio en varias zonas costeras de Cocles a Manzanillo, que pasaron a ser zonas recreativas y residenciales, lo que ofrece más posibilidades de desarrollo donde antes no se podía hacer, afectando con ello bosques y manglares costeros. Al respecto, refieren las autoridades recurridas que el Plan de Manejo del Refugio es una herramienta de ordenamiento de las actividades a realizar dentro del mismo, que se actualiza cada diez años para el mejor desarrollo socio ambiental, y que requiere de criterios técnicos y científicos para su modificación. Sobre el particular, la Sala ha sido precisa en indicar que este tipo de instrumentos normativos, deben ser claros en referir la realización de los estudios técnicos correspondientes, sin que sea necesario que en el Decreto se transcriba todas las evaluaciones efectuadas –en este sentido, ver sentencia número 2010-6922, de las catorce horas treinta y cinco minutos del 16 de abril de 2010-.

En el caso bajo estudio, el Plan de Manejo indicado se encuentra en el Decreto Ejecutivo número 34946, de 6 de noviembre de 2008, denominado Reglamento de Zonificación del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, Categoría Mixta, el cual señala de manera expresa que dicho Refugio es, precisamente, de categoría mixta, por lo que resulta de suma importancia establecer la zonificación bajo criterios técnicos y científicos que fueron el resultado de la propuesta técnico-científica de un grupo profesional interdisciplinario, experimentado y reconocido. Expresa el mismo Decreto, que la zonificación fue consultada con la sociedad civil mediante actividades desarrolladas el 30 de junio y el 21 de octubre de 1995, y 9 y 16 de marzo de 1996; fue revisada por las autoridades ministeriales y de la Municipalidad de Talamanca; se discutió por el Consejo Regional del Área de Conservación Amistad Caribe los días 14 de diciembre de 2007, 11 y 23 de enero de 2008 en sesiones efectuadas en el Centro Operativo del Refugio, en la comunidad de Gandoca, en el Parque Nacional Cahuita-Sector Puerto Vargas y Manzanillo, y en el centro comunal del Refugio en el sector Gandoca; fue aprobada por ese Consejo Regional el 8 de febrero de 2008, y, finalmente, por el Consejo Nacional de Áreas de Conservación los días 18 y 19 de febrero del mismo año.

De tal forma, el Decreto cumple con indicar la realización de los estudios en que se fundamenta, partiendo de la consideración de categoría mixta del Refugio, lo cual no impide de manera alguna el desarrollo de actividades productivas –ver considerando VI de esta sentencia-, al mismo tiempo que que participaron en su aprobación. Asimismo, se advierte que el Decreto define la existencia de quince zonas dentro del Refugio –divididas a su vez en quince subzonas-, las cuales se clasifican en tres distintos grupos: uso recomendado, uso recomendado con condición, y uso no permitido, por lo que las diferentes actividades que se pretenda desarrollar deberán ajustarse al criterio de zonificación dispuesto y a la naturaleza de la ubicación y condiciones del terreno. En este sentido, resulta impropio aducir de manera genérica que la zonificación efectuada atenta contra la protección ambiental, pues será de acuerdo a las aprobaciones de los casos concretos, que podría la administración adentrarse a conocer si una actividad determinada puede o no realizarse de manera compatible con el ambiente y de acuerdo a lo establecido en la regulación correspondiente.

De esta manera, la reglamentación emitida por el Poder Ejecutivo sobre las actividades que pueden desarrollarse en el Refugio, tienden precisamente a ordenar el ejercicio de actividades productivas que sean compatibles y armónicas con el ambiente que se pretende proteger, siendo así que resulta inexacto aducir en genérico, que la sola existencia de esta reglamentación contravenga la protección ambiental que debe otorgarse dentro del Refugio. Así, el recurso debe igualmente ser desestimado en cuanto a este extremo.

VIII.En definitiva, al descartarse la violación constitucional aducida por el amparado, el recurso debe ser declarado sin lugar, como en efecto se dispone.

Por tanto

Se declara sin lugar el recurso.
